Good evening and welcome. The Wednesday, October 8, 2025 City of Plantation City Council meeting is now called to order at 6 p.m. Ms. Beggarrow, please call the roll. Council Member Anderson is not here yet. Council Member Andre? Here. Council Member Fadgen? Here. Council Member Horland? Here. Council Member Reinstein? Here. Mayor Sortel? Here. City Attorney Ezra? Here. And Ms. Beggarrow, while I see that Council Member Anderson is not here, it was my understanding that he's going to try and appear via Zoom. So I just ask that as soon as that technical difficulty is worked out and he's able to appear, if you just let us know. Thank you very much. So tonight's opening remarks and Pledge of Allegiance will be provided by Council Member Andreu tonight. Council Member Andreu, the floor is yours. Thank you, President Reinstein. So as you all know, October is Breast Cancer Awareness Month, and so I have a short poem about breast cancer. And what cancer cannot do, it cannot cripple love, it cannot shatter hope, it cannot corrode faith, it cannot destroy peace, it cannot kill friendship, it cannot suppress memories, it cannot silence courage, it cannot invade the soul, it cannot steal eternal life, and it cannot conquer the spirit. And I want to thank Plantation PD for having their car out at the Broward Mall Saturday, Mayor Sortel, Council Members Horland and Reinstein, and our Parks and Rec Director who stole the show, Trish O'Toole and JoJo, for making our inaugural Runway for a Cure a huge success this past Saturday at Broward Mall. We had vendors from Dillard's, Broward Mall, and also Daily Threads. And more importantly, we raised awareness about breast cancer and raised $1,000 for our Plantation Relay for Life team. And so I hope all of you, I expect to see all of you out at Relay in the spring, and you'll receive more information as we get closer to that date. At this time, I'd like to turn it over to one of our wonderful residents and students from NSU, Zachary Kopelman, who is going to lead us in the Pledge of Allegiance and the Star Spangled Banner. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible with liberty and justice for all. Oh, say can you see by the dawn's early light What so proudly we hailed at the twilight's last gleaming Whose broad stripes and bright stars through the perilous fight O'er the ramparts we watched Were so gallantly streaming And the rocket's red glare The bombs bursting in air Gave proof enough That our flag was still there Who say does that star-spangled banner Yet we're the land of the free The whole of the Move, don't move, Zachary You may be seated But Zachary, tell us a little bit about your Stars Before Dark He is the founder of Stars Before Dark Tell us a little bit about that organization that you founded And you school, what grade are you in And what are you hoping to do upon graduation? Of course Thank you so much, first of all, for having me here I really appreciate it I am a junior in high school at NSU University School And I did indeed start an organization called Stars Before Dark I started it a little over a year ago And I go to, along with other professional performing artists That I've done shows with Or who are in the local South Florida community We go to assisted living communities Retirement homes, memory care facilities All across South Florida And we all actually did a show in Tampa That was one of the first Stars Before Dark shows And we do about an hour long cabaret For residents at all of these communities In hopes to illuminate their day And make them remember what their The music from their childhood And make them feel happy about life And just being here And we do a bunch of songs Broadway and jazz And I have a lot of fun doing it Because it's something I'm very passionate about And I hope in the future after high school To be performing Whether that's in theater Or writing my own music And just being on the stage Thank you so much Thank you so much, Jackie We look forward to seeing you on Broadway soon Thank you, President Reinstein having today with us District 6 School Board member Adam Cervera Who is going to speak to us Welcome School Board member Cervera The floor is yours Good evening Mayor Sorrell Council members Residents Good evening, everybody It's always great To be in the city of Plantation I always enjoy my time here I want to thank you For the opportunity to come And speak to the council As well as to the community And let everybody Know what's going on With District 6 As well as some Overall things That have Good things Good things That have been happening Within the district First and foremost We are an A-rated school district For the second year in a row We're very proud of that Absolutely And along with those ratings I'm also happy to report That Broward County Does not have any D Or F schools In the entire district So that's a very Very big accomplishment That we are all Very proud of Within the district Let's talk about Some of the highlights Of our schools First and foremost Central Park Elementary School An A-rated school For the last 10 years Their teacher Nicole Doody Was recently recognized On ESPN's Go the Extra Yard As the teacher Of the month So congratulations To Miss Doody For your work At the school And for that Prestigious recognition By ESPN Also within Central Park They received The first place prize In the How Low Can You Go Challenge The How Low Can You Go Challenge Is an annual competition That is now In its 13th year In which it encourages Students to lower Their energy input Within the schools Turning off the lights Turning off the water Things of that nature During the time period During the competition Last year Central Park Elementary Reduced its energy By over 35% Which is fantastic Which resulted In a savings Of $19,000 To the district So a fantastic job For Central Park And as a reward For that great work They had the Miami Heat Extreme Team Visit them on Monday I was fortunate enough To attend Bernie was there The mayor of Uptown I think is his name Dale The MC from the Miami Heat He was bringing the energy There was a lot of dancing A lot of singing And the kids Really had a blast And kudos to them For winning that competition I would also note In Central Park They are the first school In Broward County To earn recognition As a Guy Harvey Conservation school Which means that They are the leaders In protecting oceans And wildlife conservation So kudos to Central Park Illinois We're all very, very proud Of the work That they are doing there Plantation Park They are having A fantastic event Coming up on October 24th Called the Owlene Excuse me Owlene They play on Halloween Spooky Spectacular This is a trick-or-treating event This is a costume event This is going to be Games and food For the entire family The school's been Working very hard on that And that event Is going to be taking place On October 24th From 6.30 to 8.30 You do need tickets To participate In the walk-through Within the school But the outside events In the parking lot Are free So I would encourage All the family folks here If they want to check that out October 24th At Plantation Park Elementary It's going to be a good time For all in anticipation Of Halloween Tropical Elementary School A-rated school For the last five years So kudos to them A lot of great things They are an Imagine Learning School Of the Year winner For their ELL program So great work On that They are also Involved in the Broward County American Heart Association And they are Top three Contributor For like the Fifth year in a row So fantastic job With Tropical Elementary School And they've also Opened some new clubs I'm being told In their extracurricular Activities They have an art club Now a sports club A science club And a morning news program So good job To our students there South Plantation High School Their football team Folks is five and one They are doing Phenomenal Phenomenal Very proud of those boys And let me tell you Something guys They're not only just winning They're winning With some force They are going out there And they are dominating So congratulations To everything they're doing Not just on the field But also in the classroom Just so you know There are some proud Football parents Here in the audience Sun scoring touchdowns Left and right Right there Fantastic Fantastic So we're on our way Five and one I mean that's That's no joke I think that is The highest rated football team In District 6 So congratulations To South Plantation Keep up the good work But we're not done Right We're not done We got bigger aspirations Right We got bigger aspirations Playoffs Absolutely But they're doing well Just not on the football field Academically They are excelling as well An A rated school For the first time In 10 years So congratulations To them For that achievement Their school wide Model this year Raising the bar Raising the bar Very inspirational College and career readiness They have excellent Dual enrollment programs This year That we're rolling out They have the Brace success programs Career pathways The largest culinary Arts program now In Broward County At South Plantation High School So all A lot of great work That they are doing At South Plantation As well I would be remiss If I didn't mention The world class Magnet programs They have there Only environmental science And Everglades Restoration magnet In the entire world Not country The entire world So kudos to South Plantation High School For all of the Great work That they're doing A quick footnote On that school I will be attending The school On October 24th With my Principal for a Day Initiative It's where I go out To the schools And I shadow The principal I shadow the teachers I meet with folks Understanding their needs Their desires Letting know How everything's going And obviously Be whatever Whatever assistance I can offer I'm happy to do that And I would also like In closing On South Plantation To mention Their teacher of the year Miss Kenya Brown And their employee of the year Mr. James Cody So great job With those folks I would also like To close with this I'm very proud Of the work That we're doing In our district Six schools And plantation I'm very proud Of all the schools And plantation Let's be real I'm very proud Of what's going on In the city Of plantation And I want to assure This council And I want to assure Everyone who's sitting In this audience I know that there's A lot of concern And unanswered questions And some anxiety About what we've been Hearing about With our redefining Of our schools And I know A lot of people Are following on the media And I want to assure Everyone this I do not know Obviously as I stand here What the final outcome Will be But I will promise you this One of my jobs As a school board member Is to stay as engaged As possible So anybody who wants To reach out to me To discuss this Whether you're an elected Official Or whether you're a member Of the community What not I will always listen I will always engage With you I want to know People's thoughts Because we do Have a very hard decision That has to be made And one of those decisions Is going to affect plantation In district five So I want to make sure That I have As much input From the community As I can So I don't want Anybody to be a stranger Email me Call me Fax me If we still have Fax to hear From everybody The main point Of all of this Is for community Engagement And just like you folks Took the time out To come to this Council meeting today Leading up to the months Until that out to me So I won't call you Out publicly But thank you For reaching out And bringing that To my attention Because It did make sense With the time I'm embarrassed to say In the midst Of a busy schedule Sometimes you just You pluck things in But this obviously Makes some more sense It's 6 o'clock Parents will be home The kids will be home From school Parents will be home From work So there will be A lot more engagement So definitely a good thing I looked at her I didn't call her I didn't call her out But Councilmember Hoorland Does have a question Very quickly I don't want to take up Too much time But I wanted to thank you For being here tonight Mr. Savera And I likewise Was going to thank you For being responsive To the community's Concerns about adjusting that In your district 6 You have 3 DHH cluster schools That has been A primary concern And I think I told you When we met you You have a mayor Administration and council That are very involved In our schools And I do want to mention You mentioned Central Park Elementary All of those awards They got One teacher Monica Mormon Has been spearheading Those environmental efforts You are correct We typically bring her And her environmental stewards Into the school And I think it bears mentioning It's a phenomenal effort there But your DHH clusters At Tropical and Seminole And South Plantation There are some concerns That it's vital For the success Of our deaf students That they're dual identified As DHH and ELL I want to bring that To your attention I'd like to have A further conversation With you And conversation With the community I know that School board member Wholeness Has been likewise Engaged in district 5 We had gotten involved A couple of years ago Because there were Some concerns About our DHH students Not having their Emergency notifications In the classroom So the council Did get engaged in that So I'd love to have A further conversation With you And bring that up Publicly tonight And council member We're going to have That conversation Right You know I know Tropical Elementary school Has the What do they call it The house of the DHH DHH program Which is a phenomenal program And they're doing A lot of great things Here And they've got The epic audio system Right The EPIC audio system For the hard of hearing Obviously we need To take care of our kids With any disabilities Not just hard of hearing Disabilities But certainly making sure That they're put in An environment Where they're not just In school We need to send These kids to school To learn And have effective Learning techniques 100% Success rate Is always the goal With your permission I'm going to forward Some information to you And I'd love to continue The conversation 100% We're just thrilled That whereas She began her career As a crime intelligence Analyst At the state attorney's Office In Miami Where her sharp Analytical skills Were invaluable And where those skills Led her To track down And marry A handsome law enforcement Officer Roberto Valise Her husband of 35 years Whereas Marlon's deep-seated Commitment to the community Led her to pursue Her passion for education Earning her undergraduate degree From Florida International University And a master's degree In educational leadership From Nova University And whereas Marlon and Roberto's Two beautiful daughters Christina and Melissa Have been a source Of immense pride And Marlon's Unwavering support And love As a wife and mother Have been a constant Inspiration to her family And whereas She began teaching At St. Lawrence Catholic School And then made her way To the Broward County Public Schools And whereas Her career Has spanned Over 27 years Of service In Broward County Public Schools Positively impacting Countless students And colleagues At Parkway Middle School For one year Sawgrass Elementary School For 16 years And Mirror Lake Elementary School And Plantation For the past 10 years Leaving an indelible mark At each institution And whereas As she embarks On her well-deserved retirement She can reflect On a career Defined by service And a life Built on love And family Now therefore Nick Sordal The Mayor violence survivors And be a voice for them They deserve safety This includes physical Emotional Spiritual And financial safety They have a right To live in homes And neighborhoods That are free Of violence They deserve Our support They deserve Solidarity No person should Have to stand alone In the face Of intimate Partner violence Community Connectedness Is critical To effective Advocacy We must all Continue to show up For survivors Of intimate Partner violence There are a number Of resources available There is a national Hotline that has Over 200 languages There are websites So that if your Partner You know Comes in behind you When you're on Your computer You can X out And your browser History is cleared I want to thank Mayor Sordal For his ongoing Support of me As a victim advocate And for your Continued support Of all survivors Of crime Thank you to The city council Members I just want to say That council member Horland and Andreu Are participating In really a Broward Department First up This coming Monday October 13th We've got a Kids day off At Jim Ward Community Center Saturday October 18th Is the Family Fall Festival At Volunteer Park That's from 10am To 2pm Monday October 20th Another kids Day off At the Plantation Community Center And Friday October 31st We have Our annual Trunk or Treat Event Pine Island Park From 6pm To 8pm Before I move Through The rest of my list I just want to Address a change That we're making To Trunk or Treat This year You may have Seen our posts That it is Plantation residents Only And just to Explain why We're doing That this year We identified Some concerns After last Year's Trunk or Treat Number one Is we had A 60% Increase In attendance We went From 4300 To nearly 7000 In 2024 So For the Safety Enjoyment And everything Else Of families We wanted To try To limit Attendance Other cities Do this Sunrise Davie Parkland When we Looked at The data There was About 50% Residents That attended Last year Which would Get us To a Reasonable 3000 To 3500 People In the Two hour Time span So After hearing Concerns Even from Some of The vendors That Really They're there To promote Their business They were Just bombarded With people And it Just It got A little Bit Unmanageable So We're Trying to Follow Other cities We have Logistics Planned Out We know Change Is Difficult For some And people Feel like We're turning Them away But really It's for the Best interest Of the staff The residents And the vendors Coming So that is Mostly the reason Why we're doing it If you see If you see the Comments Online Swim Plantation Swim Team Tryouts Are Happening On Tuesdays At 330 And 445 At the Plantation Aquatic Complex And also This Saturday October 11th At the Aquatic Complex Will be Closed To the Public For a Mentioned Before For Clarity To Avoid Confusion The 26 Ballots Going To Be Quite Full And This Is A Very Particular Issue We Just Think It Would Be A Little Bit Easier To Digest If Folks Were Focused On The One Issue However That Said We Are Sensitive To The Cost We Know It Will Be 297 Registered Voter What We Don't Know And We Don't Have An Answer For Is The Variable Cost The Poll Workers The Administration Of It We Did I Reached Out To Donna McCormick Today To See If There Might Be Some Ways We In Lue Of Getting Paid Could That Defray Some Of The Cost If Instead Of Having Volunteer Park And Central Park At Play If We Could Just Use Volunteer Park Could That Defray Some Of The Concern Being We Want To Make Sure The Cake Is Fully Baked If You Will That The Budget Is Done Because What We Don't Want To Do We Wouldn't Want To Inherit The District Say Two To Three Months Before The Beginning Of The Fiscal Year And Shift The Burden To The City To Finish The Budget While We Going Through Our Budget At That Point When We Don't Have The Years Worth Of Familiarity And Also Do The Ad Valorum Assessment Implementation And That Also Marries Well With The Economic Impact Statement That Will Be Required As Part Of The Local Bill Effort Because There We Need To Provide A Two Year Snapshot Looking Forward And Our Perspective Is That We Should Work Within The Existing Rate Structure For That Two Years Realize If That Moves Forward The Efficiencies From The Cost Allocations Of Positions That Wouldn't Be Needed Like District Administrator Put Those Funds In The Ground And Use That Two Years To Engage The Rate Payers To Develop Just Like We Did With Our Storm Water System A More Holistic Plan Of Moving Forward Identify The Assets The State Of Affairs Of Those Assets Integrate Them Into Our Master Plan If Y'all Do Elect To Move Forward At The General Election We Can Handle That As Well That Absolutely Comes After The Fiscal Year So It Wouldn't Be Problematic From That Perspective That's Really All I Have Thank You Very Much I'm Going To Start Off The Discussion So There's No Question That The Overwhelming Amount Of Contact That I've Received From The Residents Has Been In Favor Of To Take Over The Dissolved Independent Special District I've Also Received Probably Just Like My Colleagues A Number Of People Who Have Some Concerns Regarding The Dissolution And Think That It's Not Necessary And They've Raised Some Various Concerns The Concern That I Found The Most Concerning Was Whether Or Not The Paid Board Members Who Were Recently Elected Were Elected For The Sole Reason To Dissolve The Board And I Wanted To Make Some Comments On That To Start Off Is That The Truth Is Is That When You Vote For Somebody In Any Role Top To Bottom You Have To Vote On Them And You Do Vote On Them Based On All The Information That You Have Available I Think There Are Probably Times Where You May Find Information At Another Point In Time That Makes You Think I Wish I Didn't Vote For Them But When We See When I See That The Current Paid Board Most Recent Vote Is Four To One Voting To Support The Dissolution I Know That It Comes After Two Prior Votes So It Wasn't Without Much Thought And Discussion Not Only Amongst Themselves But With Residents And Again My Understanding Of My Own Role Here On The Council Is That While I Am Required To Vote On Certain Matters And It Will Be My Own Decision Making To Vote On Certain Matters I Believe That I Rely On The Community And The Residents To Help Guide Those Decisions And I Have To Believe That The Current Paid Board That Voted 4 To 1 Dissolved Was Doing That Based On What They Believed Was In The Best Interest Of Plantation Acres Based On All The Information That They Had Available To Them In Regards To The Plantation Acres Improvement District That Being Said Recognizing That One Voted Against It And I Don't Know If If Dr. Fine Is Here I Don't See Him Here I Was Hoping He Would Be Here Because He Was The Sole Person That Voted Against The Dissolution That Being Said Is That Seeing That Alone That Was The Fact That It Was It Was Voted Multiple Times In The Most Recent Vote And The Vote That Is Really The One That I I Am Concerned With Right Now Is For Dissolution So I Wanted To Start Off With Those Comments Second Is That We Started Talking About This At The Last Council Meeting Before It Was Tabled At The Request Of My Colleagues And We We're Starting To Get A Little Technical In Terms Of The Florida Statutes That Are Applicable To The Dissolution So I'm Going To Return To That The Applicable Statute Is Florida Statutes 189.072 That Refers To Dissolution Of Independent Special District That Statute Has Four Parts To It I Believe The Relevant Parts Are One And Two Part One Is Identified As Voluntary Dissolution Part Two Is Identified As Other Dissolutions I Believe That Other Dissolutions Means Involuntary Dissolutions In The Context Of What We're Discussing In This Case Because The Vote Was In Favor Of Dissolution This Would Be A Voluntary Dissolution For The Benefit Of The Public I'm Going To Read Those The One Sentence That Makes Up Section One Voluntary Dissolution If If The If If If since paid voted as a majority to dissolve the next step is for the legislature to to vote whether to approve essentially enact the request for a voluntary dissolution and the reason why I point that out is because there's a lot of discussion based on the draft of our resolution and the draft of the proposed act in regards to a referendum and if the decision of the council is that a referendum is required then so be it I don't believe that based on the law that a referendum is is necessary meaning that all this talk about the referendum may be may be unnecessary and and I started out with the vote because to me the vote that took place by paid because it was the majority that's why you no longer need a referendum if if there was no voluntary dissolution then a referendum would be required so I don't believe that the referendum is required I believe that we could amend this resolution if it is approved to take out the language regarding paying for a referendum and regarding the necessity for a referendum I obviously haven't discussed it with my colleagues so I'm gonna put that on the table as part of the discussion and I'll I see mr. Newton maker wants to comment before they do so I would just like to respond back from an administration's perspective that if I read the board's actions and listen to what they they discussed during their multiple times entertaining this they don't necessarily favor the dissolution as much as giving the rate payers a voice in that but I think you're correct I think you're absolutely correct that a vote once they take that action it is not required and even if we run this local bill with the referendum request it doesn't mean that's going to happen but I have a couple concerns about that one that we we we are not seeking this I mean I think it I my professional opinion is it would be in their best interest to have the city take it but we are not a panacea for everything that needs to be addressed in that district it is a long-haul effort it's going to be a very arduous effort to get them where they need to be so we we want to be very careful about their expectations and that's why our thought process was if there's a referendum we engage the residents in November kind of layout how we would operate the district give them a sense of things and then they could go make that decision the new board they have been much easier to work with they've been much more engaged engaged with the residents there is it is it going as quickly as it needs is it as substantive as it needs to be no they don't have the depth and breadth of resources to do that it is a huge affair as we've seen here because y'all been a part of the turnaround we've had with our stormwater system here so while I agree that it likely is not required to have the vote I think there's a lot of reasons why a vote would be prudent that we have the buy-in of the community we get the opportunity to kind of engage them lay out what our our process would be and they can poke us and ask us questions but they should also understand at this point once we go to the legislature the legislature will do what they do and so before I turn over my colleagues just to respond to that is that so your last point there's no question that the legislature will do what it chooses to do and they will do that with a local bill as well so that if if there's language in the local bill that let's suggest that it's approved by the delegation and it's sent up to Tallahassee if they believe that it doesn't fit whatever type of language that they want they will send it back anyway whether it's a request for a referendum or no request for a referendum and I also add that I don't disagree with what I think are your comments that a referendum would allow further response from the public in in plantation acres to to to vote on this directly and and I'm not against it my only point is I don't think it's required by law and since there seems to be a lot of discussion as to and there may be more discussion as to who's going to pay for the referendum and the timing of the referendum I want to make sure that at least it's part of the discussion that it may not be necessary so with that I will turn it over to councilmember Fadgen thank you council president Reinstein first I'd like to thank the page board for calling their emergency meeting to reaffirm what they already voted on in February because it really threw us for a loop so I thank you for correcting that that action I think all the conversations I've had for the people that are advocating for the dissolution of the the district you know they all want a referendum and I think that is an appropriate action to be take so and there is risk with this local bill that we're going to pass at the it'll get the committee in Tallahassee and it'll be you know the referendum item since it is not required by law in a voluntary dissolution that they would remove it and not put it to the people but my hope would be that they do allow the people in the district to actually vote for it so the people I which I'm sure I'm not the only one I think council president Reinstein has alluded to this that we did start getting phone calls about people do not want to dissolve the district and I'm really agnostic to it you know if I know we're capable of taking over the district if if that's what the people have decided to do but if they decide not to dissolve it you know we'll assist them wherever we can obviously because you're our residents and our constituents so we want to try to help your life be better but we want to be ultimately responsible for it so I guess my first question because I just want to get it out in the public is is to the city attorney if we are to vote because the request of the people who do not want to dissolve is to vote this down if we if we do not approve this does this thing die here again this is a little bit of a unique situation because typically you would expect the independent district to be moving the bill forward right so we are moving the bill forward in essence in my view on behalf of the district if we if you all decided not to move this forward the only other way it would move forward would be for the district to move it forward and it could move forward based upon the initiative of the district do they have a do they have a timeline that they could get this on there on as a referendum as an alternative route in the next election cycle well if they were going to do a local bill the deadline the deadline for submission of the local bill is October 17th if we turn if we vote this down it stops this process for this year and then they're probably too late to come up with their own local bill and presumably yeah you can't talk for them presumably but okay mechanically okay if we do approve this resolution in the local bill that we're trying to usher to the Broward delegation and ultimately to Tallahassee the paid board in the supervisor election would have to they would figure out when the election is going to happen that's correct there is an existing written agreement between the supervisor of elections and the the the district just like there is a separate supervisor of elections agreement for all municipalities and districts within Broward County and that's the memo you sent me today that's yes okay so reading that memo a concurrent and I'm saying this because I want to get this out in public because there's some things that were said to me that doesn't coincide with the the memo that I received today that was from the supervisor elections on 9 30 2025 and it amended a previous memo I believe what I read in the beginning so can if they run a concurrent election if it's one item it's gonna be twelve thousand two hundred thirty nine dollars if it happens to be two pages and I guess it if it turned into two pages would be the length of whatever the referendum would have the wording of the referendum it would be thirteen thousand five hundred fifty five dollars in the memo it says the district responsible 100 of the fees of cost for a standalone election ie a special district election held when there are no other countywide or statewide elections the dates for such special elections may be called by the governor and the cost and fees are substantially higher than the fees and charges referenced above so the baseline is the twelve two to thirteen five and then there's significantly more cost um and I don't necessarily think it's a matter of poll working and I don't know if that's really a solution because you know mr. Conklin will tell you there's significant training for poll watchers um I don't you know to um to actually watch the poll so it's more than just having volunteers it's about having qualified volunteers and I'm not really sure if you can just have volunteers do it they get I don't know I know you don't know I'm just I'm just trying to minimize I know you're trying to be a problem solver so I appreciate that um so this is probably not going to be popular to give the most flexibility um for the scheduling of this if we pass this um resolution I think that we should expand uh make the the window um on or before November 3rd 2026 which I think is the November election and if the board decides they want to stand alone or if they want to have it in August I don't see how March is a possibility because the legislature is going to be meeting in January and it this is probably not going to be one of the top things on their agenda um and who knows if they have a six month uh session who knows how that affects us um so I think the path of least harm in some of the people that and I disagreed with them I had some calls that people were there for not or against dissolution they felt that and I think council member Reinstein alluded to this is that they felt that um the people that um that are for the dissolution supported candidates covertly um that they get them in place to dissolve the the district and and my opinion is I remember the election and I remember them telling me about the people that they put up to put on the board was the primary platform of those people that they got on there was the dissolve the um dissolve the district so I don't really buy the covert argument but I think the past the path of least harm is to proceed with the process that we have now expanding that window to the November 3rd so to give them the biggest flexibility to give them basically two options to hopefully have a concurrent election either November or August and I think the the ranking would be November August or um standalone um just from a cost savings standpoint because that seemed to be a concern of mine so my opinion is expand it and then um let's proceed with the local bill to get a referendum and hope that the legislature uh doesn't strike the referendum part as council uh president reinstein uh mentioned that it it's not required so they and they might have the intention of just wanting to get rid of these districts so um that's my comments and I appreciate it thank you thank you council member fadgen um council member horland you're recognized no i don't all right i thought she was um um thank you council president like i see it uh baseball um council member fadgen i'm confused about first of all i'm not in favor expanding the timeline um i think that we need to um for the benefit of the residents of the district um have this revit this referendum um as a standalone but you mentioned march um couldn't this not be placed on the august couldn't the special election be set up for august that's some primary we're gonna have to work with paid and the soe on that um frankly i'm not sure okay um i don't want this to be a two-hour conversation i think that we we talked about a lot of this um previously um i do agree with you council president that's the correct interpretation of the law but i think with all of the um conversation the emails that we've had about this i do think that it is the most prudent thing is to proceed with the referendum i think it's the most democratic as i said previously i did not like the fact that the will of the people the majority of people that we've heard from um was not being uh respected and i think that they have the right as taxpayers in that district to determine their own destiny on this to date i've only received three notifications on contact rather from people who were not in favor of dissolution so i just want to go back to the cost again because my understanding is and i want to clarify with the city attorney the initiator of the dissolution is responsible for the cost but if we are the ones moving it forward i want to be clear about that because do we need to amend the language in the act to ensure uh that the rest of the taxpayers in city of plantation are not paying for this the bill provides uh for the district to be financially responsible for the election the resolution requires it that's why we worded it as a resolution and support because the statute does say if you uh adopt an ordinance or resolution in favor of it uh you are responsible to pay for it and that was my understanding interpretation but there's been a lot of back and forth i want to be clear about that uh because i had even said to mr nunnamaker that was not clear if there could be a clawback if we were to take over because i i do believe in their right to self-determination but i did not believe that the rest of the taxpayers should pay well you also have to remember on on effective dissolution all assets and liabilities right go to the city yeah come to the city so um again i'm not going to belabor this tonight um i do believe that it should be a standalone election um a referendum i agree with staff i agree with the majority of the residents that have requested that i think we need to eliminate as much confusion as possible uh with this so that will be my vote tonight would you be moved forward with the um with what is before us and a standalone referendum council member andrea thank you president reinstein uh i too would be in favor of a referendum hearing uh what president reinstein said agreeing with what you said but um i absolutely i think i heard from five uh residents who were not in agreement with us moving forward um the majority of course were i lost count after about a hundred or so um but i i am in favor of an august or if possible you know again in collaboration with the supervisor of elections an august uh special election um at the expense of paid and i spoke to mr nunamaker who uh assured me that they have the budget for that because um council member fadgen gave us baseline numbers but i imagine it being about double that um i think it will be closer to you know that 30 to 50 000 range but i again they have uh some line items in their budget that could account for those expenses yes ma'am based on their last audit they have they have a healthy fund balance and they do have as we discussed line items that could be utilized as well and then um just also going forward and maybe attorney ezra could help me with the exact uh florida statute but if we are to go forward you know i said it before that i was agnostic and i know that council member fadgen just said that as well we cannot use public funds to advocate for this so i just want to be very clear on that you could educate you could educate and give facts but we cannot advocate and try to um swayed any voters to vote in a in a specific fashion so i just want to make sure we have that on the record as well um and incur any i'm still concerned about some of the other soft costs that we would be incurring even with this entire process um as far as like the presentation staff time presentations um anything that we are working with our i think already we've had some expenses from the attorney absolutely let me address that because that's come up before as we discussed as you've seen in the statute if they once they vote for dissolution we're on the hook we don't know how this is going to go so for from our perspective it's in our best interest to make sure that structure is something that we can work with and again the comments we've heard i've heard it both ways are is paid going to be benefiting from the city and vice versa so this provides a clean instrument to address it we also want to make sure that it's it's transparent seeing some of the comments are well how are we going to know what you're doing what's going to be the process and so to be able to point to something like analogous to our cra how is it handled in our budget i think will give a little bit of peace of mind we also we have assets in the area we have the roads we have our parks so that's something that matters to us so we do have a vested interest there and then the bottom line is as was mentioned earlier these folks are they're all stakeholders in the city and most of them are residents and that's really how we got started in this whole affair by responding to a storm event so that was a logic getting into it as far as moving forward you know we'll we'll create as minimal a footprint as possible because obviously we've got a lot to deal with anyway but we have to at least spend the time to be able to educate them to go through the thought process i mean i sat down with samir and annie the other day we're going through the budget you know how do we approach this what will be our plan for those first two years so we can tell the residents what our approach to be would be again not to sell it it's just this is how we'll handle it y'all make the decision and it goes where it goes and just so i'm clear on a hypothetical timeline if you will say this were to go to october 26 special election the comment you made about the budget so you would not assume responsibilities officially until october 20 27. oh no ma'am in that case as long as it's after and we're after our budget so october 27th okay fine okay what i wouldn't want is they vote in august of 26 august 15th and then august 16th i have to go talk to ann and say hey guess what uh we need to do this budget too hey samir guess what we've got to run this non-avalorum assessment and that does not give us nearly enough time um we'd rather have it if we to your point inherited october 27th of 26 we've got just about a full year to develop engage and work those issues out and as i said our plan would be to keep that rate structure in place engage the residents much as we've done our rate payers within the city if there need to be adjustments we have those conversations thank you thank you mr newtonmaker thank you so a couple more questions though just as i'm hearing my colleagues ask questions and comments i want to take a look at the um the draft of the of the act itself um and i want to look at section three this the paragraph on referendum the one that talks about the october 1st 2026 um october um october 1st 2026 is fine with me compared to needing it for the month later for november but my question is is that so the language here is that the plantation acres improvement district shall call and conduct a referendum so to be clear is that although we've had quite a bit of involvement it would require paid to coordinate with the supervisor of elections office yes sir in order for this referendum to actually take place correct yes sir okay and again just to be clear is that the city despite all of our involvement with the preparation and the coordination will not be making that call to the supervisor of elections office we can call we can discuss but we can't execute okay um i'm not exactly sure what that meant but just in order to follow up though is that what i want to just make sure i understand is that if the if we are relying on paid to take the steps forward to make sure that this referendum is executed i just want us to understand that if they don't take those steps right we've seen back and forth on paid yes sir right um that also could happen i mean in the scheme of things of right um i just i'm just thinking of that in terms of um you know we can only do so much in terms of our responsibility to try and and respond to our residents requests paid still has to um take the steps with the supervisor of elections to make sure that the referendum is executed 100 it so it is possible the only thing i would say to that is based on the last board meeting i suspect there's an interest in the board members even though i think their interest is to demonstrate the achievements they've made in in the vote in their favor to maintain paid that they want to give their ratepayers a voice so i would i have every expectation that they will effectuate an agreement with soa but to your point they could not yeah i i hope that um you know the this this effort is an effort in futility right is that we were they follow through with what they have voted and what the um what the residents have seemed to overwhelmingly be requesting um i do also just a couple other minor points and maybe this will be to the city attorney is that um if there are some concerns regarding the drafting of the act some somewhat grammatical somewhat stylistic um do you want them discussed now is this the appropriate time or is it would it be necessary would it be necessary to bring them up now i think uh substantive items should be the focus of discussion the reso as drafted gives the city attorney and administration flexibility to modify the the bill itself uh you have already i think we took into account some of the comments that were made at the last meeting you have pointed out to me additional comments before the meeting certainly we will look at those again very good but before you move on yeah so depending upon where the discussion goes because there's been some discussion about whether the election will be uh a standalone or uh part of a general uh section three now says honor before october 1 right so that would mean automatically it's a standalone correct but if it's if it if well unless it happened in uh august possibly which would not be a standalone assuming that the supervisor would allow for that to take place but if we're going to allow for an election to take place before october 1 in the in the end of this discussion we need to also address the fact that the transition or the dissolution would not take effect before october 1 regardless so if the election for example if the election took place in august we wouldn't want the right we wouldn't want the dissolution to occur before october 1 because we want their budget to be done before we take over for dissolution so if i understood your comments i think one of um one of the ones that i am suggesting is that in lines in section two where it indicates dissolution uh is that there would need to be some additional language that it's dissolved upon the effective date of right we'll have to tweak that based upon where this discussion ends up in light of how the election when the election will will occur exactly yes understood and so whichever way you all take this if it's not the general election we'd want latitude to work with the city attorney to make sure the effective date was sometime october 1 or thereafter i don't see any um further discussion from the dais um nor online so before we take on comments from from the public do we have a motion motion to approve item 17 um giving the um feedback we've provided to the city attorney um that dissolution uh transition how do you want to word this would not take effect prior to october 1st 2026 right thank you and do we need to also add that the act will be amended per the discussion and what's i said given the comments here i think it's i believe mr has already stated that they have authorization that um the act provides that ability the resolution provides that ability but i thought you also had amendments to the act so grammatical the resolution provides for the ability to amend the act okay that is that correct that is correct okay so um just to make clear is that i think the motion stated that the motion takes into consideration the discussion that has been made and so the record will reflect that yes sir i just want to make sure we all are on the same page and i'll make sure again at the conclusion of the discussion and second and before um before i call on um the public since it's been moved and seconded and um before i call on the discussion i also just want to make sure that it is clear on the record at this discussion that um in our our prior discussion when we began at the prior council meeting began talking about this i put a number of things on the record in regards to my role as legal counsel for the broward county legislative delegation um i think i put it out there exhaustively and so i'd like to just reiterate that that was put previously on the record and um all of what was previously put on the record still stands as we sit here today um that being said let's move to discussion um first up i have mr conklin on deck will be um andrew garnett followed by anita manning dennis conklin excuse me dennis conklin 4581 northwest sixth court um with the discussion here that took place uh at the beginning dealing with the cost um i'm not sure if you're aware but um dallas county texas which uh has a very similar population to broward county and likewise very similar voter registrars in the counties they have had the republican party decide to hold their elections on paper and hand counted and with the discussion of what it might cost for a plantation i was wondering if because i was a big advocate of moving to the november elections because of the cost of the machines if we could steer plantation back towards march elections and hopefully uh with this information that's coming from a similar county size and registration in texas we might be able to influence broward to do likewise county wise i got to tell you the cost difference between machine elections and hand counted paper ballots is like astronomical light years so uh that's basically what i wanted to mention about this because particularly for a small district a special district like this when you have just a few households i think it might be a ideal petri dish let's say and i'll yield back my time thank you mr conklin there's no yielding back your time but thank you mr garnett and um evita manning you're on deck good evening andrew garnett 11401 southwest third street so last time i was here i was very angry you may have been able to tell since that time we had discussion with the paid board so i can speak to what uh mr fajim was saying there was no covert action we helped to elect people that were also disillusioned with paid the way that we were in fact a direct quote from one of the the current paid board members it was a complete train wreck for 25 years we weren't even permitted to speak at the meetings like we are here so last time i said taxation without representation because we weren't even allowed to speak so now that we have the new board basically what happened they came in with the idea of dissolving it but being good people that they are they said well we're not just going to sit here and dissolve it we want to actually do some things and then they got excited that they were making some progress but i still believe and as you saw with the the vote they still believe that it should be dissolved they wanted a little bit more time to try to prove that they could do some things but in the end needs to be dissolved i do have a quick question if you send to the legislature saying that you want to have the referendum and legally it's not required are they able to or can they say okay there is not going to be a referendum we're going to just do this so i'll first turn to the city attorney they are the legislature in my opinion they can do that okay all right so i would say the politically correct thing for you to do is to include it there and maybe if we can advocate for that um there are some folks that don't believe that the city can handle this i disagree i believe that can look at this as purchasing another business and from there there is some expertise so i just ask that the city actually work with the the folks and learn some of those different things that they can do all right well thank you tell you my concerns are the transparency that's not there the lack of knowledge of what's in the budget how they decide on the budget the fact that they can make a budget and give us additional taxes in addition to the people they're hiring we're not they're not being advertised we have no idea what their background is and how they're even coming into these people but thank you you did you put drive i hope you guys got my uh email hopefully i just wanted to cover i had a setup of what i was going to say and then after all the discussion i've kind of modified it so please bear with me overt versus covert nothing was covert yes we did support people that would be for dissolution for our commissioners we have four very good men on the paid board and i'd like to recognize what they've attempted to do at the end of the day they are for residents they are not the city they do not have we are not step children we are part of you it's not you know like purchasing another building we're not purchasing another building we've been part of this city forever paid's only been in existence since 1982 and it's failed miserably not necessarily at the lack of effort of and i know we have at least one board member in here today and i love him dearly um he's a good man these guys go out and they do what they can do they they just don't have the resources it's as simple as that you guys do over i was one of the people went out door to door with the flyers talking to the citizens saying we want to dissolve paid here's who we want to let i'll be totally transparent but i'm the most transparent guy you can uh ever meet if you read my uh if you read my uh email so paid's efforts recognize cost we've spent money cutting up streets putting in pipes and then repaving the streets a second time we spent seventeen thousand dollars in one month to have an engineer that we contract to go over an owner's manual for a temporary pump to learn how to use it in training for a pump cost of for of an election of a special election if it's necessary i don't think should even be an issue you guys are a breath of fresh air even just stand here we had a contract attorney that would sit there and you thought you were going to get your hands hit with a paddle you know or a ruler if he was a nun just for trying to speak we have no voice here we have a voice here you guys have checks and balances you're held accountable whatever you can do to make it the fastest process i would hope as long as there's not a challenge down the road by the state or some other government entity i would prefer that we've been fighting this fight for a long time so we're really trying and we're republic we're founded as a republic that's another little branch of government with an amazing amount of power that we have no control over the whole idea of our government is to have smaller government if we can absorb that and go back into the city where we belong i mean come on 1982 we're still drowning out there i know some people aren't and they're and they're favored you know they're okay and they're friends with certain people maybe a person on the board so they're going to speak positive to you but i want you guys to take us over i'll volunteer anytime anything you need to do whatever needs to be done thank you thank you very much next up ted followed by doug mcintosh mr president council mayor thank you so much um i echo the sentiments of my neighbors all right just state your name and address for the record ted tarni 500 gettysburg terrace plantation i echo the sentiments of my neighbors from this meeting and the previous meeting it's quite extensive so i'm not going to go back into it but my point two points number one it should be a single ballot one question special election where it's clear to the residents what they're voting on going to a regular election where you have four or five pages of a ballot with dozens of candidates from federal state municipal county a bunch of question on amendments a bunch of question on references and other questions from municipal question is going to be confusing um second point we started this path two and a half years ago we got the residents behind it and it's been one of the most transparent processes that i can recall we set up a website we did two rounds of postcard mailings to everybody in plantation acres we did a email campaign we did a digital campaign we did a social media campaign we set up a town hall meeting over 100 people attended we went to all the paid most of the paid meetings they were set up three meetings where they voted to self-dissolve and it was posted on the agenda after all this resident interest and as we're coming to this little gateway to move to the next step you have a few people that are speaking up now saying that this hasn't been transparent we haven't done anything to educate anybody i think we've done more than enough to educate everybody in plantation acres we did a canvas campaign we walked from home to home we left door hangers reverting everybody to the website where the information was explaining what this movement is about so it's clear we didn't hide this from anybody we picked candidates that we met with that resonated with the changes that the residents want and now we are here and we're asking for your support to get us to the next step so we can bring some change for flood control and water management in an area that has been neglected for 30 40 years and we have proven this over the past two and a half years so thank you so much for your efforts thank you so much for your help and i look forward to moving forward and give us a chance to move to a new service provider where we can actually get some work done you know in a way that's kind of benefit the neighborhood thank you so much thank you very much and i'll just add thank you also for all the correspondence that you sent breaking down your thoughts zero northwest 12th street plantation council president mr mayor council members just very quickly tonight is refreshing it's refreshing to me because i have been a resident of plantation for 44 years when i graduated from nova southeastern it was then nova university with my law degree i had marty dishowitz come to my home to tell me why he should be a council member while i was fixing my sprinklers in my first home in bayberry village since then and before then john gibbs my good friend i helped on council and since then i have supported dozens of council members why my dad served as a civil servant he was a mayor of two municipalities in miami-dade county where i was born and raised tonight is refreshing council president reinstein you have seized on something that i looked at when i looked at the statute today strict statutory construction there is no referendum that's needed this is a voluntary dissolution under section 189 072 the paid commissioners have voted four to one to dissolve the district period end of conversation the statute says the voluntary dissolution of an independent special district and operating pursuant to a special act may be effectuated only by the legislature and it's only necessary to put it to a referendum of the voters in the district for an other dissolution i.e an involuntary dissolution i echo what mr terno said move this forward i have our vision was always to live in plantation acres when we first moved in it's our third home in plantation and we've been there now 30 some years in the acres i have seen firsthand the ineptitude the inaction and the downright malfeasance of these paid commissioners for too many years the right people were voted in the right people said this is no longer needed it is no longer working we have a city i have worked with the engineers in this city i have worked with the zoning people here in the city of plantation they are excellent they are responsive they are on top of their game totally different than paid paid is the exact opposite of that i echo exactly what mr terno has sent to each of you council members i've read every word of it when you have the latest fiscal year that i reviewed 86 percent of the expenses going to overhead administration that we don't need instead of the infrastructure that we sorely require it's time to get rid of it the commissioners have voted the district uh directors to dissolve time for to close 30 seconds please thank you they have voted to dissolve the statute strict statutory construction it's ready seize it move it forward let's get it to the legislature with our broward delegation and move this ball across the goal line thank you thank you mr mcintosh uh mr mcintosh i'll just point out one thing um is that while i appreciate that you agreed with my um interpretation of the law um as a also proud nova law school alum yes sir you are uh nova southeastern university yes um i did pull up the the correspondence that we received and i think it should be mentioned because i didn't in my remarks is that um the chair of paid that sent the correspondence to the mayor on september 26 2025 um while it does say and i'm just going to read the paragraph because it's very short it says on behalf of the plantation acres improvement district board of commissioners i'm advising you that on september 25 2025 the paid board of commissioners voted 4-1 to reaffirm its february 27 2025 vote to support a referendum regarding whether paid should be dissolved so while they also say the board's vote are consistent with the provisions of section 189.0721 florida statutes related to the dissolution of the independent special districts so while i agree as i stated that in section one a referendum is not required um the the vote actually was four to one to support a referendum um i think as we've also stated is that we could ask for a referendum as part of what is being sent to the delegation and if the delegation sends it to the legislature the legislature could say thank you so much but we don't think it's necessary um or vice versa right is that we don't request it and they say we've read the backup correspondence that says that it was only dissolved based on wanting a referendum and they could require a referendum so um i just wanted to point out that that is how it's worded may i respond very quickly i was at the september 25th paid meeting i asked the commissioners in a second question session why did you vote to dissolve in february four to one said because it's necessary the the commission's not functioning they answered my question directly when i asked why did you vote to dissolve now i will say that if the referendum is prophylactic and a good idea move it up do it as soon as possible and it must be a standalone election there is no it will be so confusing if it's coupled with a november midterm election thank you thank you very much mrs bernardy um followed by donna mccormick laurie bernardy 11681 northwest 6th street good evening council mayor attorney ezra and city clerk i stand before you not only as a resident that pays a tax to paid but as a resident that pays city taxes as well i'm not only concerned about matters that happen in plantation acres but the whole of the city that is why you see me constantly at these these meetings and speaking up when i see it once again the comments i am about to make are not directed at most of the paid commissioners most of them show up to the meetings and are doing the best they can to try and make up for the past misdoings there's just too much tonight i am here to ask you to continue the path that has been started by the residents of the acres and paid to dissolve paid i'm asking you to vote for a separate election for this to put both a candidate election and the dissolved paid question on the same ballot would be too confusing paid is constantly complained about a money issue for this without researching the cost and that is the only reason that you want it to want it together so much money has been watched wasted over the years by paid and now that the residents are fed up and want to change we don't care that we don't care that we need to spend the money for an election we are entitled and requesting it is time for change and we have spoken numerous times one of the things i'm hoping for is something like this it's the mayor is mayor soils plantation update which i happen to read today it talked about cleary flooding and our problematic areas especially the south acres have continued with the same problems for at least over 20 years i have lived there i have developed a problem with the new construction was continually put off by paid and then told too late construction is done the problem has grown worse we saw the problems that we were having on the north side of the new park that was built but when your people got involved in it and came up with a better idea guess what they don't have flooding over there anymore at all they are so happy so i'm sure that whole street's gonna say some of them are saying now even one of them have turned and said oh paid did a great job we told them it wasn't paid it was the city we want to see a plan and start to at least the problem has grown worse okay we want to see a plan and a start to at least a project you would have all our money we have over a two million plus budget a year 500 000 of that is just an administrative fees before anything gets started the only thing they keep saying now is they're probably going to have to keep going up on our tax to get things done but the problem is there's they're down to like four people now to do the work and there's more houses being built every day there's just no way that four people can do what compared to how many people are in the city can do so that's money the 500 000 that you could start with doing projects plus the rest of the two million plus that that could go to projects the need to be done you would start something and i'm sure no matter how long it took you with a plan which would get it done so i thank you for your time for always listening to us and have a nice referendum for plantation acres voters to vote on whether or not paid should be dissolved two documents in the agenda package the 2026 legislature and the resolution write-up both indicate a referendum on or before october 1st 2026 however the resolution document that requires the mayor's signature does not reference a separate referendum referendum with a date and i think that simply adding that information to that document solves the concerns and resolves the issues at hand i'm not sure why there's so much time being spent debating this issue when it's clear that paid supports the separate election and will pay for it and the city supports taking their functions over should the voters make that decision i hope we can all get behind this decision however i would absolutely i'm not absolutely not trying to derail this conversation but i would be remiss if i did not mention that i've received multiple phone calls regarding the recent shooting at the stvr at 6th street and our residents concerns that this issue needs to be immediately addressed by the city i have been assured by jason nunamaker that the city will address the stvr issue and in our community and i'm confident that both both the paid issue will be resolved and the stvr issue will be looked at thank you very much for your consideration thank you miss mccormick jen fane followed by linda carr 11831 donna brought up to me and i thought was a really good point um combining the two um if we didn't have a standalone referendum it would be like putting on the same ballot you guys running for mayor or city council voters were would also be asked on that same ballot how would you like to change the entire structure of your government from a strong mayor to a city manager system don't you guys think that wouldn't you appreciate how incredibly confusing that would be for voters um how would that affect your seats so i think it's it's really pertinent it's really important to have them separated so that i was originally going to say uh i just as a resident i see a call for better flood management from paid and they did it they've changed a lot of things and actually i went to the meeting thursday and there was one commissioner that said yeah we um came on with the intent of dissolving paid because we didn't think we could do the job but actually we do think we can do the job but then they still voted to dissolve so you know um and my only concern with the october election is that you're not going to get the resident involvement that you think you're going to people um just don't show up to you know you get in november elections you got 15 to 30 percent of the people that'll show up and and for an october election you're just going to get the same 10 percent that sign the petition and um but you've already made a motion so that's it thank you thank you miss garner thank you also for um your correspondence and your detailed thoughts in advance of tonight as well so thank you very much matthew mcintosh no um okay okay so i don't see any further um comment cards did i miss anybody are there any further requests to speak from the public seeing none and seeing no further discussion from the dais we have a motion already and a second i do have a point of inquiry just to make sure as to i know the motion was made and seconded based on all of our conversation um does the because the current language of the of the act refers to um on or before october 1st 2026 um where did we leave off with specifying whether we want a this to be a standalone election as opposed to be included um would automatically based on it being october 1st 2026 assuming that the paid complies with that and would they be required to comply with that so that it would be a standalone right so that if it's if we're we're including the october 1st which means it must be a standalone uh unless it's all unless they go with august correct so um i just maybe i'll ask the motion maker right um did you specify as to how you want whether it's a standalone election to preclude it being included in august i'll turn to the city attorney do you think that we need to specify that in the act given the discussion we've had tonight i think you should have a consensus on how you would like to see it so we know okay uh what what we're doing um we're going to tweak the wording of the document i think we all agree that the effective date of the district regardless of when the election occurs will not be prior to october one correct right so that's that's not right an issue um again we already have heard although i have not spoken directly with the supervisor of elections they've indicated that they won't have a special election unless they're directed okay by the governor which a special act would be direction by the governor in my opinion so if you want to provide for a special election uh we can provide for it here um if you do not want to specify a special election as opposed to a general i would suggest having a election on or before november 3rd and that would then give the district the opportunity to work with the supervisor of elections for purposes of scheduling the election so i will then amend my motion to include uh the request for a standalone election and i'll allow you to word that in the act did that satisfy your question president reinstein is it it's not a question of whether to me it satisfies my question i want to make sure that it satisfies the needs of um the direction of the council to make sure that it properly gets moved ahead to both the delegation as well as to the governor so that the request is clear it's clear because as we've been going through all of this and thinking about exactly how that motion was made um i didn't think that it was specified clearly enough so i'm going to turn back again to the city attorney do you think that has the motion um with the addition to request that it's a standalone election is that sufficient for the direction that we need to make that request to the governor it is for me because i do intend to talk to the attorney for the supervisor of elections and discuss the wording of this once you confirm your direction we have a pretty short fuse to get this done uh and delivered to the delegation so again if if the consensus by way of a majority of you and your vote is you want a special election we will work with the supervisor of elections attorney to come up with language that will satisfy them uh to have that special election okay and i think going back to my original motion given the discussion we've had you understand our intention i do thank you so um councilman horland has amended the motion um does the second agree to the amendment yes did did you want to say special standalone election before november it would just be a special election all right we don't need to say yes but just so for the record if the county attorney representing the supervisor says that we should put in those words standalone we will uh the motion has been amended and has been seconded um councilmember fadgen thank you uh council president reinstein um the points that i were making about expanding the window for flexibility really didn't have anything to do regarding cost um it really has to do about turnout so mrs carr um i i was in agreement with that comment it's really about making sure we get the most voices to um to um cast their ballot on that um i had nobody that really wanted agreed with that and i'm fine with that i guess the only question i have regarding i'm thinking of this memo it's a substantial cost and that's a very broad number so if it's i kind of was initially thinking well maybe it's going to be 50 000 but what if they say it's a hundred thousand is there a threshold that we should put that um a standalone election is a bridge too far hold on one second please let's not hear from the public on this go ahead councilmember fadgen i'm just asking do we want to put a threshold if if that number even come it might not come up in the discussion that our city attorney is going to have with the soes attorney but if we find out that information let's just say it's 250 000 dollars i don't think it's going to be that but um is there a threshold that we want to say that that's too much for a standalone election and i'm just bring this up for consideration and if nobody agrees that that should be part of the consideration i'm fine with it but i think it's a point that should be made so i will respond to that um councilmember fadgen i appreciate um um bringing us back to the question of the cost and there's no question that um cost should be a consideration and i think that at least it has been something i've been thinking about quite a bit however um our resolution makes clear that the city fund shall not be used to pay for the required referendum so despite the fact that we would be taking over the assets and we're still concerned with uh the amount to be spent and i do believe that as part of our role being stewards of um the budget for the city and our responsibility to the residents that live in the acres um if paid believes that the that the amount is way too is too high um they could choose not to move forward okay is that if that is that going to be in there well well it the resolution requires that um city funds shall not pay for the required referendum i mean i understand that i'm just saying i i don't know i i'm just bringing this point up paid you know we are basically spending someone else's money with this so because we you know i i understand technically i don't think we have no it's you know if this was the city's money i would not be able to vote for this with the memo i'm just saying should we put a constraint in the resolution if nobody thinks that that's fine i'm ready to move forward and vote on it i'm just saying that you know i forget what they said 2.2 million uh annual budget so you know what if they came back and said it's five percent of their budget to do a standalone election i don't feel they're going to be locked into this thing if um they get an act for a standalone election so and we might not even get the information then then if that's the case then i'm you know i'm just asking should we consider putting a constraint on there if we find out before we have to submit this to the broward out delegation if it's in excess of i'm making a number up 150 000 you know they should schedule it at the most opportune time that's going to be economically feasible that that's the only point i'm bringing up if you don't think it's it's worthwhile or necessary then i'm fine i brought up the point i think it should be heard understood no and thank you very much councilman fadgen i just want to make sure that um i'm clear with my understanding is that um just as we are relying on the four to one vote by paid to make this a voluntary dissolution if this is approved right here tonight it goes back to paid in order to effectuate and to execute the referendum with the supervisor of elections which includes the determination of the cost so that if i believe my understanding of the process is that if that cost comes back to paid and paid says this is more than we wish to pay for it um there's there would be a mechanism for them to stop the process i could ask you a question because you're bringing up a point that i was wondering that um so if this goes to the brow delegation with with the amendment that council member horland and um council member andreou amended her second to if it goes to the brow delegation then it goes to the state legislature they're they're not going to be locked in by statue at that point that they have to have this referendum they still have an uh an optional um path to actually have the referendum put on the uh the ballot you understand what i'm trying to say i do um i think that's a different question than what it's talking about the cost but i'm going to turn it correct but i'm going to i'm going to turn it back to the city attorney i i i think if the bill as ultimately drafted contains this provision requiring the special election they are required to hold the special right but but against and again i'm going to run this by the county attorney's office who represents a supervisor of elections to make sure we're not going to have an issue with the supervisor of elections right the question of cost is a separate issue well correct and i'm just trying to say if we if we don't find out what this substantial cost that they described in the memo for a standalone election is then let's just proceed with this motion but i'm saying if we find out that if we are able to find out before we have to remit it i don't i don't think we will okay i don't think so either yeah why not put the because the elect we don't know when the election is going to take place yet we don't know the registered number of voters we have the um uh you know the uh we have the per person you know we have the per person well we know what the registered numbers voters are by september of 25 if the um again then the number may change for whatever reason when the election occurs it shouldn't be a significant difference so okay it it doesn't sound like um there's an appetite for what i'm what i'm uh addressing so i i just brought it up because i think that's a fiduciary responsibility and if you're not in agreement with me then let's just move forward with what we're doing well thank you for that um before we do that though i i do want to make sure that um and i want to ask um city attorney ezra is that this issue of the cost am i correct that the way that our resolution is written is that it is paid that is paying for the cost of the referendum based upon the wording in the resolution that is correct again being mindful of the fact that there is a statute out there that provides for uh responsibility for the cost of the election to be borne by the local government the city if it adopts a ordinance or resolution of support we have not adopted at least we've carefully worded our resolution to avoid adopting a resolution in support to minimize the risk of payment for attorney's fees for the election and if it's such time that during the process that this is approved and it moves through the delegation and moves to the legislature that num that an amount is determined um that is and it's determined that the city is responsible would it be correct to say that uh we could direct the mover of the local bill to uh rescind it we could request yeah that that request could could be made absolutely okay um i don't have anything further but uh mayor i think um did you want to speak on this yeah uh mr terrenu and i have talked about this and we did the math can we hear from can we hear from him about the math yeah i don't believe it's necessary if there's something that you want to relate but i think we've received the the same um it's he's done a wonderful job of providing the math but i don't think it's necessary he's already had an opportunity to speak so you tell me the math and i'll tell everybody else mayor i don't think that's appropriate please come on man um it's just no i we we've we've received it um but i i appreciate it um seeing no further whole truth and nothing but the truth all right thank you thank you very much we're gonna we're taking the two of these together they'll be voted on separately um i'll turn to mr holmes is there a presentation okay good evening mr chair members of the council for the record dan holmes planning zoning and economic development director i'm going to ask you to bear with me we seem to be having some technical difficulties with the so i've got a human uh doing it tonight so uh this is uh application pp25 dash 0005 for plantation midtown it is a consideration of requests for site plan elevation and landscape plan approval to construct a six-story 300 unit multi-family residential development and associated with it there are also five zoning waivers and two landscape waivers from chapter 27 of the code this is the city's uh general location map so the property is located at 7510 west sunrise boulevard that's roughly at the southeast corner of sunrise boulevard and university dry within the plantation point uh development the agent for the request is barbara hall the approximate size of the parcel is about 7.87 acres uh the underlying zoning is the il2p i'll just pause here for a second because you'll see a little asterisk and a note there so this is a part of uh the kind of live local act under uh section 166 of the florida statutes typically we're accustomed to uh with live local when we're dealing with 40 percent or more uh you know units that are being proposed as affordable that it does not require approval by the uh you know by by the uh city council or have to go through the approval process in this case i just want to explain this the applicant is requesting to provide 20 percent uh of the units as affordable so under the affordable uh under the live local act uh they're asking to bypass some of the uh like uh rezoning and land use uh and so that's something that the council has a discretion to to do or not and so that's that's why i just paused there to explain that uh why uh that's there um the existing uh use uh or the location uh is currently a vacant parking lot that's uh very uh seldom used uh if you drive by there on most occasions in fact you'll notice that uh that area the of the uh site is vacant or underutilized uh the again the land use is industrial and the adjacent uh zoning districts uh to the south and to the west are uh il2p which is within the uh the plantation point development uh to the north is b2p and and uh cfp and to the uh to the east of the parcel is rm 17.3 this is a aerial location map for the property um you'll see the purple uh boundary there just indicating that there's a 500 foot uh notice boundary for this within that there were 397 notices mailed uh to uh surrounding property owners again the request is for site plan elevation landscape plan and uh approval for a six-story 300 unit multi-family residential development this is the proposed site plan uh just point out here that the proposed height is uh at 61 feet there's a maximum height in this district uh believe it or not of 150 feet so this is well below uh the that height um this is below the the lot coverage and it comes in at thirty three point five one percent within the uh il2p there is no floor area ratio that's applicable to that district this shows uh some of the elevations uh for the site so this is the elevation if you were standing uh on uh sunrise boulevard looking south at the the site at the top at the bottom there is the elevation uh if you were uh facing uh the building from the west and then if you go to the next slide this is the elevation uh from the rear or from the south of your uh internal to the site uh looking at the building and on the uh the the one on the bottom there is the elevations uh shown from the east so if you were kind of looking at from the omega uh uh development looking um west this is uh what you would see materials board as you see here that's been provided tonight uh we do have uh the it does meet the the city's uh material requirements uh you'll see brick cladding and a decorative aluminum slats for the decorative material and then you can see the color scheme that's also proposed and the detail of the of the railing as well renderings so the renderings kind of give you a better perspective than the elevations a little bit uh so this is a rendering if you were uh traveling along sunrise boulevard actually headed east from university uh kind of turning into the site there this is uh kind of the perspective that you would see of the proposed building and then this is a perspective again if you were on sunrise boulevard kind of coming from the from the east from say like plantation high school traveling west it sort of gives you a perspective rendering and this is a rendering uh from if you were kind of looking at the proposed building from the canal and this is the proposed landscape plan uh quite a bit of landscape that's proposed for the site i do note that there are as noted previously there are two landscape waivers that are proposed as part of the application floor plan there are studio one bedroom two bedroom and three bedroom units so these are the uh different floor plans that are proposed we note again 20 percent of the uh units have been proposed as affordable that amounts of 60 affordable housing units and we kind of have a breakdown uh 10 of those units uh would be proposed uh the affordable units will be proposed as studio units 23 would be proposed as one bedroom units 21 as two bedroom units and six is three bedroom units so you kind of have some affordable units in all of those categories this is a parking table uh kind of showing you uh some information just to give you a little more information uh so you can better consider the parking waiver at the top we're just kind of showing based upon the combination of all the uses on the site there uh they would require uh 3975 parking spaces um these the uh the development as as it exists is over parked uh by 259 surplus there are 4234 spaces on site totally but if we look at the the individual uh parcel that they're proposing there are 678 spaces that would be required under the code once we sort of subtract out because they are eligible for uh some parking reductions uh within the city code uh for example their accessibility to transit uh if they're within 1000 feet but bus stop they are eligible for a five percent reduction in parking uh for some of the bicycle amenities and parking that they're providing another five percent uh because it is a mixed-use campus uh there's a 10 reduction that's available so once you add those uh parking reductions in it goes from 678 required spaces to 543 the applicant is proposing 523 spaces so that's a 20 space uh deficit there but overall the campus has adequate parking so with regard to the traffic study there was a traffic study performed um the traffic study shows that there would be 1072 uh trips uh as part of this proposed development we like to break this down and sort of give you uh what that kind of looks like in terms of the a.m peak hour the total number of trips that you would find during the a.m peak hour will be 95 and during the p.m peak hour 89 trips generated from the property this kind of shows the pedestrian bicycle circulation so if you look at the uh the uh in blue there these are the new pedestrian routes that are proposed so with the development these are routes that we are trying to pretty much connect into some of the existing pedestrian routes that you see in green there so we kind of make it a more walkable site also along sunrise boulevard kind of in the yellow or mustard color you see there uh there uh there it kind of identifies the bike lane that exists and you'll see at the top there that uh little indicator for the bus so there's a a bus stop that's located uh just north of the of the property so um as we kind of went through this as well there's a lot of uh traffic study recommendations or recommendations that came out of the development review committee given some of the city's recent traffic studies as you know we've recently done a multi-modal uh transportation plan because this is it within one mile of university drive sunrise boulevard and also uh northwest 11 place was which is one of the local streets that has some improvements that are slated under uh this plan the applicant is agreeing to share in the in the cost uh by providing 150 000 that will help implement the traffic improvements along northwest 11th place and that's sort of a diagram from the mm from the multimodal transportation plan kind of showing what some of those improvements are basically with the traffic circle there and then some of the speed tables uh shown there again uh some other traffic recommendations uh the uh briar county transit uh the applicant has agreed to request signal timing of uh three traffic signals uh in the vicinity one at sunrise boulevard and north pine island road sunrise boulevard and north university drive and then sunrise boulevard and magic leap intersection that's right at the uh the uh eastern portion of the i'm sorry the western portion of the development and then finally um the city uh um the applicant will coordinate with the city for further analysis of uh some other improvements uh we're kind of looking at depending on the traffic that's generated uh a second inbound lane uh for the magic leap uh entryway uh upgrades to pavement and cross walk markings at three uh project points uh looking at ev charging and also working with briar county transit for improvements to that existing bus shelter and we also note that uh this project is located along uh the sunrise boulevard where briar county transit has the primo plan which we've discussed before so the what's proposed here is very consistent uh with the the long-term transit plans for this corridor and the waivers so the first uh zoning waiver zoning waiver request number one uh is indicated uh deals with uh parking the development requires uh 543 parking spaces uh the applicant is requesting to provide five hundred and twenty three so they are requesting a waiver i did previously kind of go over the parking reductions that uh the applicant received as part of this request zoning waiver request number two is from uh table 87-2 within the code which requires a setback of 75 feet from sunrise boulevard applicant is requesting to allow a setback of 45.2 feet along the north property line zoning waiver request number three is from section 27 126 of the code which requires six off street loading zones the applicant is requesting to provide three off street loading zones those are kind of located uh on the southern uh end of the property you can see there and then zoning waiver requests uh number four is from uh both section 27 122 this deals with both uh the size of parking spaces within the parking garage and also drive out so the applicant is requesting to reduce the size of uh parking spaces within the garage when next to columns and walls from 10 feet to 9 feet and to reduce the drive out with uh from 25 feet to 24 feet within the garage and i just noticed just to note that these uh nine feet is our typical if you were in doing surface parking that's a typical size and also if you were doing surface uh within the the surface parking area 24 foot i drive out is what's typical for uh the surface parking lot zoning waiver request number five is from section 27 300 a4 which requires exterior walls to have uh eight inch offset every 50 feet um so if you look at the the top diagram there you can kind of see that uh the building has uh kind of undulates a little bit has some interest there but the applicant is requesting to modify uh the uh the the offset from every 50 feet to uh require the offset at 59.1 feet the northern elevation and at southern elevation kind of given uh the development of the parking garage what have you to uh reduce that down to 179.7 feet at the southern elevation where the parking garage is so that's um it's being proposed there and landscape waiver request number one is from uh section 27 255 d2 this deals with the landscape pedestrian zones so the the applicant is requesting uh from 30 feet uh get well based upon the the height of the building the applicant is requesting to go from 30 feet along the the southern portion uh down to between zero and 8.5 along the west from 30 feet down to 23.6 feet and then the landscape pedestrian zone length uh on the the southern uh boundary from uh to 93 feet uh from 93 feet i'm sorry to 66 feet on the on the south so the so that deals with both the the width and the length of the landscape pedestrian zone and then landscape waiver request number two uh require under section under section 27 255 c3 the applicant will be required to provide a 10-foot wide landscaping parking divider so basically you can see between uh as when when two parking spaces uh kind of face each other we generally have a requirement for a landscape divider in between so the applicant is requesting uh to get rid of the the middle uh parking divider and not provide the the landscape uh buffer there and community meeting as you know our code does require a community meeting the applicant held the community meeting on june 5th at the plantation central park multi-purpose building a copy of the meeting notice uh notification list a sign-in sheet and a discussion summary have been provided uh citizen comments we did receive one objection uh to the request and with regard to uh other concerns or issues with the property we do know that there are no code violations on the property at this time and in conclusion with staff's analysis we did find that the development is compatible with the surrounding zoning designations that we found that the uh the development is in compliance with the comprehensive plan uh particularly we do note a couple of policies within the comprehensive plan that we found it to be specifically in compliance with so there are elements uh there are policies within the future land use element housing element intergovernmental element and the transportation element which we've noted there you can go to the next slide please then uh consistency with the zoning code we we did find that the development is consistent with the zoning code and it's met the uh development plans under oops under section 2750 and uh we found that it is consistent with the criteria for the practical difficulty waiver under section 2752 g2 and based upon that we are recommending approval for the proposed development thank you very much appreciate the uh very thorough presentation um councilmember andreo you're recognized thank you president reinstein um mr holmes can you explain to me and i'm sorry i wasn't able to call you in advance but the 2020 broward county roadway capacity and the level of service analysis so there was like a prediction up into uh year 2045 those letter grades yeah the c and the d right right can you explain what a letter grade of is it considered a letter grade that's the teacher in me what does each d and an f represent so it that's kind of indicating how the road in terms of the number of amount of traffic on the roadway and when typically when you have a grade of a that means that as a driver you're pretty much able to move about the road pretty freely not much interference from other drivers and so as you kind of go through that you know you're having a more drivers on the road which is going to limit your ability to kind of move about the roadway once you get to level service d it's still meeting the capacity but you're getting to the point where the road is nearing uh over being over capacity and would require uh you know either extension lane changes things of that sort so the two ish thank you for that explanation and the two concerns i have with this particular project is looking ahead and it sounds far off but 2045 is not that far off right and on university drive this has an f so i'm very concerned about the traffic on university drive right um and even though we know right that the transportation options are improving it's still rated as f so what when was the traffic study done the traffic study was done as part of the development the exact date um i see the city engineer is coming up because it seems to me i couldn't understand the traffic study in relation to this letter grade uh good evening samira shallan city engineer the traffic study is recent uh is related to the development as it moved from the application of the development review committee and because this application went through the live local act my understanding the application was in 2025 so the traffic study was conducted during this uh year in 2025 let me just explain something about the level of service a through f university drive currently at level of service f at that intersection university and sunrise so usually when we rate a project as they come in we rate the impact of the project in on the local and the regional network so currently the road is at level f and with the project is going to continue at level f part of the traffic study the developer is obligated to pay concurrency traffic fees to the county for improvement to the county-wide regional regional system in addition to their contribution to the city plantation point as a campus have been been contributing to the mmtp uh plan that was adopted by council so every site plan that came before you whether it is chick-fil-a or motorola site or other components since i became the city engineer we worked with the developer and the campus itself contributed to uh financially to improvement on university drive this monetary contribution is currently held by the city as the campus getting to complete we don't want to act yet because like the money is not totally there yet but we are in coordination with fdut on some improvement need to be done i know it's a lengthy answer but i want to have a comprehensive understanding of how this particular project affect the one point on university drive so as a conclusion it is currently level of service f and it's going to continue with the project as level of service f fdut have some plans and on their capital improvement plans for some improvements on university drive but as a state agency you know they move slower than local agency but we're going to continue coordinate with them i hope that answers some of your question it did thank you and i have a second part to that uh involving utilities so um there is supposed to be a signed and sealed cost estimate for the required off-site improvements i'm very concerned because in the whole utility section you have to read between the lines so in nowhere does it state that they're actually in agreement with this proposal right they don't have any objections to the waivers but beyond that there are some major off-site improvements that are needed and they mentioned that the density will have a direct impact on how our current system is the ability to handle the flow so how is that being addressed and i don't see where some of the items that were stated have been received as a matter of fact it says it has not been received so to date has the notarized letter uh that was requested has that been received i mean i know there are several meetings that kind of took place between utilities and the developer i think mr polio could kind of better update you on and i'd like to know if you've received that mr polio and the signed and sealed cost estimate and exactly how the developer is going to deal with these off-site improvements good evening danny polio utilities director we've been in meetings with the developer and administration for months regarding this project we always look at these high density projects when they do come in it is always the developer's responsibility to install the off-site improvements the improvements that would be required for this site are specific to uh they'll have to do an on-site lift station which obviously their site will go into and the key component is the off-site force main the off-site force main will have to go into all plantation water controls right away and it'll be tied directly into our 30-inch force main uh the developer has agreed that they'll be funding this there is a vehicle that will be it's it's not set in stone yet regarding how it's going to work but there'll be a payback clause to be proactive let me back up a little bit back when we were discussing 8601 and we were looking at this project and we also looked at future projects potentially that may impact the mercedes site so we look at things globally when we're doing it so knowing that we had these projects coming down the line we met with old plantation water control part of what our consultants looked at because we go out way ahead of these projects and we look at well what are the impacts going to be potential never knowing what the numbers are going to be because we don't know what the numbers are until we start getting into the meat of the conversations that being said we picked a route that would best serve the city of plantation we were proactive in obtaining an easement agreement with old plate old plantation water control that would not only potentially facilitate off-site improvements for 8601 but this site as well taking it back to one of our largest forced mains in the city which is a direct shot back to the sewer plant so we are as far as the utility department because there's other there's other develop this is going to benefit the city these off-site improvements so we obtain the easement agreement with the we work you know through administration to uh to achieve this and the developer the cost of those improvements are going to be born by the developers when it comes time for installation if we're putting flow into those lines we're adding flow we're going to we meaning the city not necessarily the developer we're going to if there's upsizing required we're willing to contribute because it's going to benefit the city as a whole when it comes to that so we're performing the design for this in order to get we had to come up with plans before we could get an agreement with old plantation water control for this route that is going to benefit even beyond 8601 further to the west it's the most open route it's the least most or i should say the most cost effective route should we start looking at the north acres or further west so we went ahead with the administration's approval we obtained as i said the agreement and we're paying for the design sizes are yet to be determined again until we know exactly what the flows are going to be for this project before you tonight what 8601 flows are going to be what potential flows might be for mercedes which isn't even on the table or being discussed at this point but the developer will be responsible for installing those off-site improvements again we are funding the design we needed a design in order to get that route speaking with mr butler from old plantation water control we needed to secure our place within that wide right-of-way that the canal that runs east west down the north side of sunrise boulevard to the canal that runs north south behind this site that we're discussing tonight or you all are discussing tonight and that goes directly to where our 30-inch main is to the plant so there was a benefit for the city and for us to do that but we had to do those plans in order to get that easement fpnl had gone in there and i want to say fpnl i think their numbers were somewhere over 300k that they had to pay to secure their spot within that easement because we're the utilities department we provided the design we didn't have to pay for it but it's getting to be a crowded easement according to mr butler so we needed to secure our site within that easement but as far as the off-site improvements if you see unknowns or unknowns within the comments because we haven't determined what the size is but we are in general agreement that they're going to be funded by the developers now if 8601 gets together with this current project being discussed tonight obviously there could be some type of payback agreement i don't know exactly what that payback agreement is going to look like but if one developer funds it and another developer needs to tie into it to convey theirs that's where the agreement is going to be made and those were the discussions we had with administration so has the developer sent you the notarized letter authorizing this and advising that they're willing to do these off-site improvements i believe that what we have in order for it to proceed where it has gone this far they have agreed to do the off-site improvements have you received the notarized letter i can't tell you that for certainty tonight that i have it in hand that doesn't mean that it's not in my uh capital improvement administrative file back that's run by mr adams have they provided a signed and sealed cost estimate the cost estimate has been provided we do have a signed and sealed cost estimate and i believe the neighborhood of this site is somewhere around 1.3 million don't quote me on that exact number the on-site lift station um depending upon the size of the well and the pumps and the needs that are going to be done that will be funded by them so uh the cost estimate for that would be irrelevant to us we don't need it because it's theirs that they'll convey to the city it's the off-site force main that we're going to convey the wastewater to there may be i don't want to speak out of school but there could be other things under consideration for the site that we don't have yet so that main size could change so generally before we do this we will ask for what a cost estimate is we obtained our own we do this when we go and we know what when we have these projects coming in so it's safe to say we have a pretty good handle on what the cost would be for that i just i still don't feel certain of the commitment but i'll wait and hear from my colleagues thank you the good news is that the utility department has to sign off on a building permit before a permit can be issued and if we can't service the site we can't sign i i as the utilities director can't sign off on the permit so first uh i'd like to make a jennings disclosure um i've spoken to the applicant and to their representative and it will not affect uh my my vote tonight uh can i make the same please go ahead i'm going to make the same jennings disclosure i i want to before i i have a question regarding i think it's slide 21 or 22 regarding the traffic study recommendations but um i want to go back to some of the questions that council member andreu raised and um want to ask is that based on what you were referring to council member andreu in terms of the commitment um the the was a notarized commitment that has not yet been received i hope that you'll ask the question again of the applicant maybe there's a commitment that we can receive here today and include that in the in the motion um you know get something on the record from them i don't know if that will satisfy your line of inquiry in terms of what you feel has not been included and you like to see um i would just say that if there is that we just need to make sure that any motion is very specific um as to that discussion right um just wanted to think out loud and raise that with you um in terms of it is recommended that once the residential project is completed and occupied the development team contact um broward county transmit to request i was i heard you say that and i was reading that it's recommended so it may or may not happen and it we may not get any assistance from broward county transit is that so we're requesting here that they contact broward county transit to uh based upon the traffic conditions to look at each of the light the uh lights at each of those intersections i know you're you said requested that says recommended so let me clarify uh one thing um all our traffic lights uh within the city is controlled by broward county traffic engineering understood and we have a lot of problems with those therefore um part of the engineering permit engineering staff will put those those conditions in the staff report prior to the issuance of the permit at time of ceo we would request the applicant to contact broward county so the protocol is established part of the permitting the engineering permit just just to clarify is that so that says recommended you've said requested let's let's let's take that it is requested and it's not recommended um it's only to request the signal so obviously broward county transit could say thank you for the request but we're we're not doing that right now no that's not i want to make sure that it's clear yeah that what happened a request from the applicant through actually the liaison for any uh traffic modifications throughout uh city of plantations through the city engineer office so that condition will be superimposed on the engineering permit for engineering staff to ensure that this request or this condition is imposed on this particular development as a reminder to the applicant and to the city to ask the question of broward county the reason for the word request because we don't have the jurisdiction over changing that i understand that's why i want to so upon asking it doesn't necessitate that broward county transit will um acquiesce and make the obligation of the interlocal agreement between city of plantation and broward county traffic engineering they have to conduct that traffic study and provide the report to the city engineer office upon the request right and that's part of making a consideration it's not changing the the lighting pattern i just want to make sure because um we've had other issues where we've talked about requests being made to broward county and actually um you yourself have been up here i remember very specifically in regards to peters road there were some requests that were made and my understanding is that a polite request usually gets a very polite response that does comply but they're not required to and so they could do their study and say um thank you but we're not going to make the changes that you're requested there is traffic engineering thresholds that need to be met in order for a change to happen so they will conduct the traffic study they will release the conclusion of the traffic study to the city engineer and i usually discuss these uh conclusion with administration and if the threshold if it's reached the threshold are they necessitated to respond yeah they respond regardless if it meets or does not mean for example there was a request on knob hill and third it did not meet or 12th avenue where i live at the entrance of jacaranda lakes and uh knob hill um a left turn signal a request from the office of city engineer to broward county they conducted a study it did not meet the threshold however a recommendation of striping and make making the intersections safer came out of that request so when they deny the request based on that threshold they may doing other recommendation to do some safer um maneuver at that intersection i think i understand i just uh you know i um and it's it's not the i think the project's been presented very well and i i don't really have any questions in terms of the project itself um i do have a concern about traffic implantation right and so um you know i want to make sure that when i read this and i saw it says recommended i look at that it's like oh well you know that's nice but it doesn't actually do us any uh there's no promises that we're making to the residents that traffic you know once you're an f you're you can't get below f right so we're making it a worse f right um we're not making it a better f and i mean that's the kind of the nature of the beast in terms of traffic in that area um i don't have anything for there but thank you very much um does anybody else um from the dais have any i didn't um if you you can ask first from uh staff uh mr holmes or we can bring up the applicant thank you just um you're calling on me i was what you you buzzed in but then you buzzed out so um you called on me um thank you mr holmes for the uh presentation i think um council member andreo i i appreciate because i had those notes um on utilities as well oh and i do want to make a gennings disclosure i did meet with um miss hall representing the applicant and the applicant mr horn having dealt with this applicant on um the prior development of this campus um and i and i'm sure they're going to get up there up here and reassure us i i know that they had made past improvements um at our request and i think that they've been very good partners with us i happen to like the way this campus has been developed but i know there were ongoing conversations about the utilities and you know cost sharing on that so um i'm comfortable with what mr polio presented i'll be interested to hear from the applicant on that i just want to point out i know you get tired of me talking about live local but it was in the news this week about fort lauderdale maybe looking at 930 story towers and i call it i use it as a verb live local they're being live local and i think that again i often say and this is for the public as well while this council and administration and planning department is very thoughtful about these discussions we have to keep that in mind right so we have an applicant who could have come in and completely live local this project they're doing part of so in doing so they are not required by live local to do any off-site improvements so i think it's very important when we have these partnerships with the applicants coming in we don't always get everything we want and we're all concerned about the impacts on our infrastructure both our roads and our utilities but in in developing these relationships and and hopefully a healthy partnership um we don't get live local and we get these off-site improvements as mr polio was saying it's going to be a bigger benefit to the city so i think it's something we always have to keep in mind and i would venture to say because i was there last night picking up dinner um at just salad that the chick-fil-a that we approved probably causes more traffic and i'm just saying that not as a traffic engineer but um you know then the residents uh residents could one thing that i do want to mention and again i'll be interested here from the applicant when i met with them one of the things i requested because i do think that the campus has been developed well is perhaps for them to incentivize the employees that already work there be it chewy or magic labor any of those businesses offer incentives to them first to live on those apartments because that will further reduce those trips and i think that's another way to just really fully flush out that campus the way it's been developed but to be able to reduce some of that impact so um they you know thought that was a good idea so i don't know if they've you know taken that back and had any further discussions but um i'll wait to hear it from them but i just want to make those comments thank you mr holmes thank you and i'm just going to add to that last comment because i didn't make it before but um the incentivizing for those local businesses um makes such perfect sense um but i'd also love to see some incentivizing to the plantation high school teachers just down the street um and you know we started off this meeting hearing from the school board member um who briefly mentioned um that there are issues going on discussions and um you know some of the discussions that we've also heard not tonight but elsewhere is that um plantation high school in order to um in order to be the best it can be needs to be able to attract the best teachers it can attract and um i think one one way that we could help um attract those best teachers is to help them with finding um good affordable housing in the area and so um any you know incentives that are directed towards them i think would be um amazing for the entire city um particularly the community where where you want to be situated so um i think now we'll turn to the applicant um and uh and hear from you mrs hall as the applicant approaches councilmember reinstein i honestly can't remember if i need to do a jennings disclosure yes isn't that sad i i would also like to make a jennings disclosure and it will not impact my vote thank you good evening um mr holmes did a very thorough excellent report on the property so i'm not going to bring up my little powerpoint after that but to go over some of your questions um in regard to the utility cost estimate um as mr polio said um we weren't required to do it for the lift station but that will be at least 1.5 million dollars and we know that and we are required to do it in regard to the force main our engineers did a preliminary cost estimate but the design is not finished yet so we can't provide and it's not our engineers doing it it's the city's consulting engineers so there would be no way for us to provide the certified cost estimate so um in regard to offering the affordable housing actually when we met with you we got good recommendations from everyone um commit council member horland recommended that we reach out to people working on the campus and of course that's something that makes all the sense in the world because putting residential here is like the the peg that was missing in the mixed use project to make it work to provide housing and to provide the people who have housing with employment and good places to eat so of course that's a good recommendation certainly for the teachers absolutely so our marketing plan will include initially the teachers the people on the campus and also the volunteer firefighters as requested by uh council member fadkin so we understand those are great suggestions they make all the sense in the world um and i don't know what the other questions were that were asked of us but thank you very much we've been a partner i think in this project as all of you have been and the staff has been and it shows the results i think so thank you thank you very much um i i do want to turn about councilmember andrea i know you didn't buzz in but um did that satisfy your query your concerns it did i i think the verbal commitment was there and as you stated it's on the record and um it sounds like mr polio uh also feels confident that we will get the lift station needed uh traffic still a major concern as you pointed out earlier right um but this is where we find ourselves mr holmes anything further needed on the record based on this discussion thank you uh mr ezra um there i i think there should be a discussion about the duration of the restrictive covenant you have a draft in your backup but the duration is not filled in um so i think that should be a discussion that occurs on the record because when we do finalize it we would need to have some guidance okay um this is oh i see you've jumped up to the podium yes um you know there are some benefits of using this live local provision um that is that it allows you to kind of bypass land use and zoning if you provide at least 10 percent affordable housing but the approval has to go to the local government and unlike the 40 percent where you just it must be approved as long as you meet certain criteria well in this case rather than providing the 10 we are requesting to provide 20 but we'd like to restrict it for 20 years so that's our request and that's what we've asked you to approve and thank you for the reminder council member andrea you're recognized i believe last time we had 30 years so i would like to recommend 30 again uh well our request obviously is for 20 years because we went to 20 percent which is not typical of what you're getting so we hope you'll consider that this is all 25 22 councilmember fadgen i feel 20 is a reasonable request i mean they're giving us double what they're required to under the live local so i understand councilmember andrea wanting to extend us as long as possible but we're getting double the affordable housing um with the um 20 so that's all seeing no further uh buzzing in no further discussion um and we do have a couple members of the public that wish to speak but do we have a motion on um well let's do it this way um let's hear the let's hear the public first because we're going to take each of these uh we're going to hear from the public to speak on the entirety both 18 and 19 so instead of voting on one at a time and mr conklin you're up when we think of a2f we're thinking of course like we want the a we don't want to be we want the straight a's but if a road was like at a like a or b scale that would mean that the road is empty which would mean the county or the city or whoever that owns the road spent millions of dollars on something that isn't being used to the capacity uh from what i heard from a friend the county seems to want to more focus on a d or e for for the roads because that means if it's like at the capacity then that means the county didn't spend money on something that isn't being used so i just feel like that a2f skills can be very deceptive uh aside from that i'm very happy of kind of having more housing as i've said before we're in a housing crisis we need more affordable housing of course it would be nice to just mandate it at the front but the way to get out of a affordable housing crisis is by building more housing in general and that'll make the older housing uh more affordable this kind of like the same thing with cars and other goods where it's you know if you want more affordable cars you wouldn't want to shut down the factories making the new cars or else that's going to lead to want to let you know that i've spoken to chief harrison and mr ninemaker today i did reach out to the um my contact the government affairs rep at airbnb um because he had said to me on the phone once if you ever have a i mentioned this particular group that we were having an issue with um this management group the five properties they own and he said if you ever have a major incident reach out to me and we'll see if we can get them off the platform well i reached out this morning um so with staff's help trying to gather some data um they will await the completion of the police report i'm not making any promises i i don't hold any hope but i think that there's more ways to skin a cat and because the legislature has tied our hands the way they have that we need to throw everything at the wall that we can um because our residents feel unsafe with um these short-term rentals that are being mismanaged in this way it's the second shooting in the city in the last six i mean we had one in park east same thing in the last six weeks i think so um at any rate i don't want to belabor that but i just want to let you know i did reach out to him and uh on a personal note i want to wish my husband a happy 37th wedding anniversary i choose to spend my evening with all of you tonight so he's making dinner at home what do you mean uh council member fadgen i think everything that needed to
