burger present mr corman here mr ray here mr goldstein here mr stecker here thank you all right uh first order of business this evening is the approval of the meeting minutes from september 9th 2025. does anybody have any corrections additions or deletions for those meeting minutes do i have a motion motion to approve second we have a motion and a second please call the rule okay um mr mcintosh yes miss denby burger yes mr corman yes miss ray yes mr goldstein yes mr stacker yes thank you all right uh we have two quasi-judicial items tonight uh mr city attorney would you like to read the statement i will thank you uh for the public uh the members of the planning and zoning board are volunteers here tonight and i'm going to read slow so our other member can come up as she moseys down nice to see you glad to see you well um so these members are here to serve the public their true public servants they're here out of the goodness of their heart to serve the fellow residents um they're here to the site applications presented to them by the city they're not authorized to change any of the city's codes only the city council's authorized to do that decisions from this board require a minimum of four votes for an item to pass short of those four votes the item will be deemed denied these hearings are quasi-judicial so that means they will be testimony and evidence conducted under oath and those that oath will be taken at the conclusion of my remarks the city will begin the matter by presenting the case to the board then the respondent and any other witnesses that you have will have the opportunity to present any evidence or testimony relevant to the matter before the board following that discussion the board may ask you questions you may ask questions of the city and the city may ask questions of you at the conclusion the chairman will open it up to the public for a public discussion and then the board the matter will be closed and decided by the board tonight and that decision will be rendered in writing the board may also postpone the decision if they need additional information to make a decision with that being said if you have a case tonight or plan on speaking please stand and raise your right hand and be sworn in that that means everybody who may come up and speak on a case you swear foreign the testimony you'll give will be the truth the whole truth and nothing but the truth you may be seated mr chairman thank you uh first item that we have this evening is pm25-0026 consideration of a request to approve a practical difficulty waiver for the bartholome residents the property is located at 5220 southwest 8th street and zoned rs 3g residential single family staff if you would good evening can you hear me uh to the board the chair planning and zoning board members assistant city attorney and assistant city clerk to the public my name is shamika butts i'm a planner one with the city of plantation and i will be presenting this project for you tonight okay as indicated the project number is pm25-0026 for the patholome residents here's the location map and the red star depicts the location of the property it is located at 5220 southwest 8th street the owner is wilner buttholome the lot size is approximately 10 288 square feet or 0.23 in acres it is zoned rs 3g the use is residential single family the subject site is developed with a one story 2148 plus or minus square foot single family residence with a two-car garage and a swimming pool the zoning map depicts the subject site outlined in the blue hashtag area the property is surrounded by single family residents to the north east south and west that are also zoned rs 3g the aerial map shows the public notification boundary in purple so every property within that circle received notices there were 40 notices the applicant is requesting a practical difficulty waiver from the rear setback of section 2772 c3 of the dimensional standards table 72 2 which requires a 20 foot rear yard setback in the rs 3g zoning district the request is to reduce the rear yard setback from 20 feet to 8 feet here's a boundary survey of the property prior to the addition the site plan here depicts the proposed addition of through 346 square feet to the rear of the property and that's shown by the green box here's a floor plan of the property showing the proposed den and bedroom addition connected by a hallway and it is identified within the limits of the red rectangle the the elevations to the west the north and the east of the property the property owner is stating that he is going to match the existing construction material finishes and also the height of the existing structure here's a typical wall section the current conditions of the property at this time is upon a site check it there are exterior walls in the roof that is constructed constructed constructed so far and they are unpermitted at this time there is a current building code violation on the property for construction of an addition without the required permits that case number is ce24-02169 i did find that it was initiated back in august 28th of 2024 to date there have been no permits applied for or submitted on behalf of this property here i'm giving you an aerial map ranging from 2023 to 2025 just showing that to the rear of the property which is here for 2023 that addition was not there there was a structure there i can't tell if it was temporary or something more permanent but it was there also without the required permits and this area is 2024 2023 and 2025 would be the last one and there you can see the addition on the rear of the property there's a street view of the property and upon my site check this is what i found and as you can see the exterior walls are there pretty much ready to go but the interior is not complete at this time staff has not received any written citizen comments or phone calls objecting to the proposed application project analysis criteria and findings from section 2752 g2 the request shall not be substantial does not meet the request will be compatible with development patterns does not meet the essential character of the neighborhood would be preserved meets the request can be approved without causing substantial detriment to the adjoining properties meets the request is due to unique circumstances of the property does not meet in conclusion staff recommends denial of the requested practical difficulty waiver but in the event the planning and zoning board finds that the applicant has proven entitlement to the practical difficulty waiver or variance and recommends approval of the request staff recommends the approval be subject to the conditions included in 5b of the staff report that concludes my presentation at this time um i do believe that i saw the owner or representative come in they can answer any questions that you may have and also staff thank you um you're the owner just to verify you were here when the signing in occurred he was not come on up okay could you come up and get sworn in yeah you can stay right there but just he's the guy who's going to be saying yeah raise your right hand you swear from the testimony you get will be the truth the whole truth and nothing but the truth you uh name and address for the record and then will know about telling me address is 5220 southwest a treat plantation do you have anything you'd like to say before questions or anything you want to add to what the staff said yeah what i like to said about like she done review everything the the thing is the problem i had on my family the family is a large family and that's when i'm request the board to see if they can and get me granted to see if i can seeking to get because i'm already like i know i'm 60 60 percent of the backseat and then i'm trying to see if can help me with that and with their requests okay um stay up here for questions because i'm there are probably some questions from the dais for both you excuse me and staff okay um does anybody have questions max yeah i have questions for staff mainly um the first one is would this waiver kind of backdate the um the code violation so i'm assuming that he would have to go to a magistrate of some sort to get that worked out you can say something yeah i'm gonna restore some additional information that i have could you swap out with the microphone so that we can get it on record thank you so some additional information that i have i did the research um and i did speak with the code violation for the building department prior to coming here even as late of as of today um right now this case has been at a standstill since may 21st of 2025 he was granted a continuance then he was granted another continuance on july 16th and at this time it's just pending no fine has been confirmed no hearing date has been rescheduled that's where we are right now so i say that to say this if this was approved it would technically be up to the magistrate if they would want to proceed further as there's no fines confirmed at this time typically typically it's it's pending the outcome of this hearing and if it's not granted he would need to remove the structure or the magistrate will go through with the the case um if it is granted he'd have to go through and get a building permit and that would close out the case okay yeah that was my question if we kind of like solve that case but if we approve this project so well he still have to go through with it right and get all the proper the hurdles the hurdle of being able to actually apply and get a permit is pending based on this hearing because they can still actually confirm a fine up until right they can they have that right my other question was about the the engineering staff comments from section 5b because while it says no objection it also says that they need to maintain a 65 percent um impervious area 65 percent or less the way that it's worded sounds to me like we don't have that number i don't have anyone here to speak on behalf of the engineering department but that is my understanding that at permitting yes we'll receive that information yeah that that that happens with permitting just as a well the reason go ahead yeah the reason that i ask is because i want to know if this is the only waiver that he's going to need to apply for or if he's going to need another waiver like for impervious surface there was there was an attachment within the document page 28 that is the impervious calculation that shows 48.18 are you speaking of the application and documents um i'm speaking of everything that was given to us there is a calculation on this that says 48.18 so it's below the 65 if that's what you have but i i don't feel comfortable speaking on behalf of them because what if there's something else because looking at this property there are some areas of concern for them and i think that's why they made that statement based on another structure that's there trying to figure out what type of ground coverage it is okay i just i can only go off of what we were given and so for them to be that far off i mean i would want i would want some clarification and if nobody from engineering is here then it's kind of hard for us to actually evaluate that particular bullet point in considering this application i definitely understand right right but what we don't want to happen is in the case that we do if we do approve this waiver that he's going to go through the permitting process and have to come back for another waiver in a few months i understand that definitely could be a possibility okay i understand that's it for me are there any other um what's involved with this addition that you're putting in is there a kitchen a bathroom anything else in the addition i'm sorry and that one i can't hear you into the speaker a bathroom but the unit the addition you're putting in could be rented out to an individual no just for the kids sorry i'm not talking about what you're using it for i'm talking about in the future if you sell the property that could be considered a secondary i don't residence the way i look at the plans there's a bedroom and a den at the end of a hallway so it doesn't seem that it could be separated and isolated out from the house as an adu and you're also asking for a reduction from 20 feet to eight feet for a setback um yes please that's pretty that's a lot yeah i understand but but the way it's built is not bought in the neighborhood and stuff it's particularly look nice i'm sorry um all right so if we're going to have conversations like that let's have them audio i'm sorry um miss butts before the previous slide said that there were when you went on the property for to inspect there were two additional violations can you explain what that was thank you during the site check of the property um doing it during a site check of the property getting prepared for this meeting um one of the things we look at is we're also checking to make sure he's not going to have a lot coverage issue which is something if he did we wouldn't want to address that all at one time for him so when i go out there the plans uh i won't say the plans that were submitted for the building department uh permit but the plans that were submitted for this project itself it did not include on the survey or anything else that i have the site plan the additional pergolas that we have out there there's one to the east of the property and there's one near the back portion of the property and there's no record of that on what was given to us so we want to make sure that they're always maintaining the proper lot coverage and that's why i'm putting that note on here for him because at permitting if those things are not permitted and they shouldn't be there um he would have to either permit those or remove them what are the accessory structures i'm sorry pergolas so here i don't know if you can barely see it back there that's some type of trellis pergola back here and that is a permanent structure there and then here it's one here and that one looks almost you know like it's ready to come down there that he could possibly take that down much faster if it's not a permitted structure thank you you're welcome my question is there been any communication with the neighbor behind you who would be closest to the building um are there any letters of support or anything of that nature um i was um thinking about that that was a little too late to let them shoot write them something let them sign to making sure there's nothing wrong and they just to see what i'm doing is kind of not bothering anybody well then the neighbor is here and i believe you were you sworn in i was okay so when we open comments we can we'll talk to you thank you those other uh the pergolas were those put in with permit or no for the permit was there no we didn't that's two more items that were not done with permit yes or no let me ask that question a different way okay when did you buy the house i think june 24 24 24 okay because we got the deed that's dated may of 24 so may of 24 august of 24 was when the first note of construction on this particular project began correct so there's been no action taken over the last almost year over a little over a year is that correct no action okay the images you showed us from previous that shows those pergolas on the overhead doesn't it okay so the pergolas are probably not put up by you did you put the items on the pool did you construct items out by the pool yes or no no okay so they were not his so the previous owner didn't follow the rules right right okay so when you buy the house you buy the problem i'm aware okay but but i just want to make it clear that he did not actively go out and put the pergolas up he did actively go out and start building an addition so my question is were you unaware of what was required to be done in order to build an addition onto your house and if so why didn't you actually follow the rules well um i didn't go in going all through that um because the you know on my conscience i can say i didn't go and didn't follow the rules but after everything gone gone let through the city so i'm trying to figure it out exactly the better way just to do it got it go ahead on i'm sorry the contractor did the addition is he a licensed contractor yeah i think yes you think he is yeah but you don't know i believe he's sorry i think he's off he didn't warn you about what you were doing was against the law or against the building code i'm not really i'm sorry not really vicki did you have something so basically you bought the house in 2024 and since then you've made additions to it with a contractor doing the work for you you didn't do the work yourself right um because i'm i'm a carpenter um you're a licensed contractor and i'm a carpenter but i'm not a licensed carpenter okay but this this work i was trying to do somebody just help him with that you could have pulled a permit under your under an owner i pulled permit for my house for i and i'm not a carpenter but i had something done in my house i pulled the permit under my name and if it had failed inspection by the city i would have been where you are in front of the same people okay but how long this is your first home in plantation yes okay sorry gotta play by the rules in plantation yeah um what is the width of the utility easement along the back side is it six feet it's a 20 foot setback well it's a 20 foot setback but there's an easement that they can't go into and that's what i wanted to look at so that's the dash line on that right there okay so at this point are there any other questions from the dais is that is that into the utility easement no i can't see it from here no it's not it's a couple feet away from the utility easement that's why i was asking because it's 20 down to eight so that puts 12 feet that's two feet off of the of the utility easement um at this point i'm going to open it up to comments from the chamber i believe ma'am you said you wanted to speak okay if you would just step off to the side or grab a seat if you would name an address please i'm very nervous i'll tell you right now don't be nervous my name is vera vera brody and i live at 5220 uh southwest eighth court right behind him directly um you want me to just state what i'm saying whatever it is you want to say about this particular issue positive negative neutral okay thank you talk about state world affairs it's all up to you okay on august of last year all of a sudden we see a building going up and then that's the next day and this was behind there before they put this building up this was in 24 i have it on my phone actually can i look at that picture yes sir that answers the question about the permanence of what was there so that's a pretty damn permanent structure yeah but for staff quickly that's that box out there that you were talking about looks like it was a permanent structure so just to verify that was probably not permitted as well so the previous owners really did a number okay okay please continue okay um as a 31-year homeowner in plantation i'm opposed to changing any setback reductions i believe the required 20-foot setback should be upheld because as i live behind the house the set bed in question it unfairly encroaches on my property with a window that looks directly facing my whole backyard i have photos showing just how close the structure in proximity to my fencing and yard and homar my concern is if there are more people moving into this structure will they be renting a revolving door or is this to be a mother-in-law suite in closing it's my hope you consider how you would react if this was happening to your home environment after 31 years i think you would feel the same as i do i'm sorry if you were to allow this encroachment at the very least they should have to raise the fence to prevent you throwing in my yard kitchen and patio and they should have to pay for it would you like these photos if you would like them entered into the record yeah yeah that one that one hold on to um no no if you would step back um so a couple of contradictions i just want to clarify out sure i'm sorry you don't want them to you you don't want the setbacks reduced but you'd be okay with it if they raise the fence is that correct i would not really but i have to have something their window looks directly into my kitchen my i understand i'm just where they're building it and there's a door on each end of that building and a window so right i i'm just trying i'm not trying to that's just a three minute timer don't worry about it um well all i'm trying to figure out is what your actual feelings are but i don't want it there it's okay that was i am one of the first people that called to say i didn't see a permit out front why is this happening got it okay any questions i have a quick question for staff because for it to be a separate rental it would have to be an adu which is a separate application separate process from what's going on now like even if we approve this the homeowner cannot rent this out to anybody else it's just he just wants like his own children to live there or something correct this would not fall under uh the adu uh guidelines or standards so this would be part of the of the structure itself right now that's not to say that he can't rent out his the entire property but just right it wouldn't be a separate unit right that's correct are there any other comments from the chamber all right so i'm going to close do i have any online by any chance i didn't think so but okay i feel the need to ask that question um so i'm going to close public comments are there any further questions or clarifications sought from the dais just to verify how how many people are currently living in the house if you would i have six kids six kids six kids and the current bedroom footprint is how many four okay and i'm supporting the two kids for my sister okay that's neither here nor there it's a clarification question what i didn't hear uh it was it was an it was a comment that says not our problem and i was clarifying that that was not the point of it it was a it was clarification for me that's right um provided the engineering drawings that you gave us was that your contractor uh yes used to work i think i i i think i had his number because it was work for the city and plus he was doing some work for the same guy who was helping me with that okay contractor what not the contractor the engineering the the engineering drawings is what i was asking about and does somebody from staff know since engineering isn't here do those engineering drawings meet all of our specs i assume well we don't but that's that's i mean i'm assuming because there were no comments on the let me ask the question a different way because there were no comments from engineering on the application can i assume that those engineering plans meet our building requirements no okay they will have to in order for the permit to be issued though okay at that point if it if it gets there okay well i hope is that it was set before that okay all right so and they may but it just for at this stage it doesn't that's not that's not the issue i understand what you're saying but it's okay he could he could fix that if it was a problem right i just it for me it was more that what if everything that was on the application is accurate because staff brought up the the form which is section 9-400-4 plantation city code storm calculation of impervious percentage it's filled out right but they're not telling me whether or not i can trust what's in the application so um all right those are all the questions i have any further comments i have an additional question um mr bartholomew when you close in the house because it's pretty recent 2024 did you did you have an inspection before you closed and did they tell you that those were unpermitted projects as part of the inspection um on the building yes the two i was there he was there who was there he was there because it looked funny that's why i was knocked that out so you're actually trying to remove the two yeah that was not funny actually well i'm sorry i'm having a hard time that one day was made and behind the building it was too funny that's why i was knocked out to make it a little proper but did you get your house inspected before you purchased it yes and what did the inspector say about the unpermitted structure so that small little room that you knocked down did they say anything about you didn't tell me anything about it okay home inspector is not required but that's the question that she asked so i wanted to make sure it got answered for ariel's stuff all right um with no other questions i'm request to approve a practical difficulty waiver for the ramirez residence the property is located at 9820 northwest 10th street and is owned rs3g residential single family so sorry uh shemika butts planner one for the record here to represent uh the case of the ramirez residence project number pm25-0041 the location map shows the subject site with the red star it's located at 9820 northwest 10th street the owner is jose ramirez the approximate size of the lot is 10 144 square feet or 0.23 in acres it is zoned rs3g the use is residential single family the subject site is developed with a one-story 2781 plus or minus square foot single family residence with a two-car garage and a swimming pool the zoning map shows the subject site outlined in the blue hashed area the property is bound on the north east west by single family properties also zoned rs3g and on the south by canal then single family residents zoned prd9q which is planned residential development the area map to the left shows the public notification boundary which is a purple circle on the map everyone within a 300 square foot radius received notification of the project there was 67 properties notified the applicant's first request is for the adu minimum area from section 27105 a1b that code requires that the minimum area shall be at least 400 square feet in the rs3g zoning district the request is to reduce the minimum area from 400 square feet to 262 square feet which is a 34.5 percent reduction the applicant's second request deals with lot coverage from section 2772 c3 of the dimensional standards table 72 2 which requires a maximum lot coverage of 35 percent in the rs3g zoning district the applicant is requesting to increase the maximum lot coverage from 35 to 40.4 percent which is a 5.4 percent increase here's a survey of the property which is the current survey of the property and here's a site plan of the property which is showing the addition outline in the orange square to the front of the property the plans include the foundation plans the roof framing plans the electrical plans and the floor plan elevations to the west north and east have been provided the proposed addition will match the existing construction material finishes and the height of the existing structure here are a couple site photos from the street view of the property and right here in the front will be where the adu will be constructed the current condition of the lot are as follows the proposed location of the new attached accessory dwelling unit or adu it is the most logical location based on the development of the lot the applicant owner is restricted to where he can place the adu and meet the structural setbacks pertinent information on october 3rd of 2025 staff did receive written comment to the proposed application from a residence of jacaranda lakes i have provided that information for all members the project analysis criteria and findings from section 2752 g2 are as follows the request shall not be substantial is partially met the approval of the practical difficult waiver will be compatible with development patterns that does meet the essential character of the neighborhood would be preserved meets the request can be approved without causing substantial detriment to adjoining properties meets the request is due to unique circumstances of the property meets in conclusion staff recommends approval of the requested practical difficulty waiver waivers in the event the planning and zoning board finds that the applicant has proven entitlement to the practical difficulty varicence and waivers and recommends approval of the request staff recommends that the approval be subject to the conditions included in section 5b of the staff report that concludes my presentation i do have the applicant owner here that can answer any questions for you that you may have and staff is also available thank you do we have any questions for staff right off the bat from the dais could this unit could this unit be considered rentable in the future yes it's an adu yes it's an adu which is not in that neighborhood i'm sorry which we do not have in that neighborhood no we have it city-wide now oh do we yes i stand corrected um is the applicant is here yes if you would you free to make statement comments same as you saw before uh if you would just your name and address please jose ramirez 9820 uh northwest 10th street um the only comments i have is the uh i have my mother-in-law with me and whether while i would prefer to take a pleasure trip you heard that that doesn't seem to be an option and continue to be married so um so i gotta figure out a way to get to get my mother-in-law some some privacy and give ourselves some privacy and um these uh what i would have loved to build a 400 square foot it doesn't fit without um encroaching on the um setbacks and i felt that that would be more important than than making making a bigger area one thing that happened to the comment of renting it is that the uh the hoa originally we were going to submit this with with a independent entrance and the hoa didn't feel that they liked that so they uh they made me reduce my closet size and i gotta put it going into the house so to ease any any um feelings that this could look like a duplex or anything like that just know that it won't so so the hoa took care of that yeah the hoa in their own way had their ideas about what is supposed to happen and i i corrected it so other than that it's just trying to make it happen for my mother-in-law to to stay close and help us could you pop back to the plan view or the elevation rather okay so just to verify the addition is going to have the same roof line spine all the way from the back of the house to the front of house the same way the garage side does is that correct okay any other questions from the days matches the rest of the house any comments from the audience i have a question vicki um only one letter came in from one of your neighbors and the comment at the end said um it in my it should have ingress and egress it will not disturb the neighbors not an airbnb or a verbal which i totally understand i live in a zero lot line community and uh you know i know how large the property is in your neighborhood versus in my neighborhood and um your hoa approved it do you allow renters at your hoa and do they have to go through a um a vetting process if somebody were to rent your whole house out like for on an annual basis i have no clue okay from from fort myers and i bought i sold bought and i don't if i can never talk to the hoa again i would be very happy i'm present in my hoa vicki the way the way my hoa the way that that hoa put the restriction on the entrance makes it highly unlikely that that would happen yeah and no it does because you can't have a separate entrance so this is actually not even an adu in the truest sense of the word this is a mother-in-law yeah this is keeping his marriage secure no it's a literal mother-in-law suite so um you can call it that also just a quick note is that our adu ordinance implantation has an owner occupancy requirement where the owner has to occupy the property either in the main house or the adu so even if it were to get sold in the future to someone else they can't they can't separate it right if you want to rent your house you bought the house next door to me tomorrow and you were just using it as an investment you could not rent it for the first two years yeah but this is talking every hoa has their own right right this is about the city the city law the city zoning code and this is specific to adus and so because we're we're deciding on an adu the question of the adu rules come into play and like max said you've got to have the owner on on site so whether or not it's rented or just given to a mother-in-law at that point is secondary to she's up in boston so um so any okay this does not have a separate paperwork goes it talks about it doesn't have two separate ones and it simply says granted or granted reference paragraph five which one of these boxes am i checking we'll get you the right document sort of along the way as we've been working on uh the city's comprehensive plan we finally are at the point where we have uh what we call a final draft uh and we have both uh but primarily what we've been discussing heretofore has primarily been the goals objectives and policies uh section which is really what most people are interested uh in but there is a volume two which deals with the data inventory and analysis um so you are now in possession of uh the volume two uh as well um so we're kind of uh you know we've submitted that to you um we have sort of adjusted the schedule i know at the last meeting you uh had requested some additional time to kind of have a chance to uh review that so we did not put it on for action uh for vote tonight to kind of move it forward uh to the city council uh so we will probably we will uh seek to take that action at the next planning and zoning board meeting uh but um what staff is basically doing at this particular point because we have a final draft we're just doing some final meetings with some of the departments we're looking at some of the final maps and some of the final graphs that need some of them need to be cleaned up a bit and refining some of the language but it is i would say probably about 90 percent there in terms of what we'll move forward with as a final product back to this board so you have copies of it i'm happy to answer any questions if you've had a chance to kind of start looking at it we will still be taking input uh through your your next meeting so you still have an opportunity to give us any input that that you would like but you are now in possession of volume one volume two my suggestion is i think i mentioned this at the last meeting is that even though most people think it kind of strange i would read like volume two like if you're looking at the future land use element for example read volume two which is the data inventory and analysis section first because it'll help inform the goals objectives and policies section which is volume one so it kind of most people kind of start with volume one and get the volume two but the data inventory and analysis is very important because you can kind of see why the the goals objectives and policies are what they are and it usually flows from the data inventory and analysis so i'm happy to answer any questions that you have or anything you'd like to discuss relative to the plan max hey danny um i was reading through it and i don't know if if everything from the comp plan was included but i remember speaking to you a few times about the um the county's new upcoming transportation plans regarding non-car non-motorized transportation the safety the broward safety action plan which is about to conclude we just had our final oversight board meeting for it the um low stress multimodal master mobility plan the acronym is the same but but the words might be changed right and i i did see that the safety action plan was referenced in the document that we got in the backup the low stress multimodal master plan was not and i think it's very important that we do so for for two reasons well i want them to be included in the actual policy section instead of just in the goals section because i want to direct our engineering department to follow the standards and guidelines set out by those two documents and it's very important to do so so the safety action plan actually has a different i want to call it a timeline for how these projects get approved and designed compared to the current process that we're following which is the old county process and it it puts safety really at the forefront for transportation projects and then we have to actually follow up on the standards and guidelines that the plan sets forward and if we don't put that in the policy section samira and the engineering department can't use that so so let me make sure i because i'm not quite when you say the policy section because to us the policy section is the goals objectives and policy so you're um if i remember you said you didn't want it in that you wanted it in because the other both the other volume is the data inventory and analysis so so so correct me if i'm wrong the way that volume one works is that you have like the general overview at the beginning of each uh sub element yeah and then you have the policies you know one one one two one three right right correct so i'm saying that that the references to adopting the standards and processes of these plans has to be both in the uh overview of the element or sub element and then also we have to have a policy you know one one our engineering department is going to follow the safety action so all right for for example because we're talking about the transportation and mobility right now the uh the introduction to that in the goals objectives and policy just kind of gives you like a purpose and direction statement very generalized statement to kind of help uh the public or the reader kind of understand the purpose and intent of the uh transportation and mobility element so i'm it's very short so i'm just going to read so it just says purpose and direction transportation mobility element cities plantation comprehensive plan establishes a forward-thinking framework for safe efficient and connected transportation system that serves all users pedestrians cyclists transit riders and drivers it promotes a balanced multi-modal network that supports transit-oriented development reduces reliance on single occupancy vehicles and enhances mobility throughout the city the el this element emphasizes regional connectivity ensuring that plantation's transportation system is well integrated with neighboring communities and regional networks that supports the adoption of emerging technologies to improve system performance safety and user experience a strong focus on equity ensures that mobility solutions are inclusive and accessible to all residents regardless of age ability or income and through thoughtful planning resilient infrastructure and coordinated investment plantation aims to create a transportation system that advances sustainability economic opportunity and exceptional quality of life so that's where you're saying that you would like to see some of that language because that's um either there or in one of the enumerated so yeah because i i i think this is just sort of a generalized statement yeah and the general statement that's so yeah so enumerated policies i don't remember i i just went through the document right before this meeting i i didn't see in the enumerated policy section the um any reference to the broward safety action plan or the count i saw references to the city's multimodal plan but not the county's multimodal yeah i i did the information that you sent me i did and it's almost in there verbatim um okay i don't remember seeing it in the backup for today's meeting and i'm trying to think is this may be it right here let me see uh policy tm 020307 partnered with broward county npo to utilize the safe streets for broward crash of roadway condition database and identifying high-risk corridors and implementing targeted safe improvements the city shall incorporate this data into the prioritization process for funding local road improvements aimed at eliminating severe injuries and fatalities i think that's the exact language that's two different things okay what what that statement is is that you're taking the data right from the plan but i'm not talking about the data i'm talking about the actual design guidelines right for when we actually design the roadway okay why should the stripes all right so this is what i suggest do send me a draft of the language that you are looking for i will because we're still reviewing things with the engineering department i need to the engineering department needs to sort of bless that as well because they may have a reason or rationale why they do not want to follow their guidelines and have the city's own guidelines i can tell you that we have been working very closely with the npo we've been working very closely with their safe streets for broward and many improvements that we are looking at for several roadways within the city i know cleary boulevard is one of them for example they are designed to sort of implement some of the uh safety information and we have been taking some of that crash data and kind of looking at ways to make the roadway safer so we are starting to to do that but like i said um if you give me that specific language um so i can make sure that i'm capturing uh you know what you'd like um send that to me i do have a follow-up meeting uh with her uh early next week and uh i'll i'll discuss that uh with her and uh i will i'll even follow up with you after we discuss that with her okay yeah i'll make sure to send that to you okay um and similar thing for the low stress multimodal mobility master plan because it's not just for the data that plan is actually creating a new level of service standard that the county is adopting right and we need to adopt it in our comp plan right as it so the county has not adopted it yet right no but i i just went through the because they have the meeting on the 16th their next uh broward next okay so so the other thing i want you to know that the document is not a static document so yeah so we can as uh but the counties are adopting right and i want us to match because those level service standards are going to be much better yes the level of service standards that we're using oh agreed agreed um yeah that's basically it okay so any other questions comments from dash yep um so i'm new here um to the board but in looking through the gop's document i'm just curious if there's a strike underlined version or is it the case that the parentheses policies at the end of is that referencing the old volume right bingo yeah so yeah so as you that's that's a good point and i'm sorry i didn't so as you go through this with some of the policies that you see you'll see in parentheses um like i'm in the transportation element right now and say like under uh policy tm 020310 uh at the end of that policy you'll see in parentheses policy 6.1.5 and policy 6.1.7 that is referencing our current comp plan letting you know that this policy is either verbatim coming from that policy or it's been tweaked a little bit but it's uh kind of the same uh you know uh you know very similar in terms of the information that's found in the previous plan so as you go through there if you see that you'll know that that's coming from the previous plan uh and if you want to take a look at that plan is available online if you want to take a look at it so you can kind of compare the language if you don't see a parentheses there it is uh new language that we're proposing so we are incorporating this this plan sort of builds upon the previous plan but um i will tell you that there's this we really kind of take a turn from our previous comprehensive plan too we're really trying to incorporate uh more sustainable policies we're really looking very much as indicated at uh you know multimodal uh transportation trying to make sure all modes of uh you know transportation are available within the city and the previous plan just didn't incorporate much of that there's a heavy emphasis on housing affordability within this plan there's a whole new element the resiliency and sustainability element which was not in our previous uh plan that is basically also indicating that the city has to uh do a couple of studies that the south florida regional planning council has uh requested that the city take a look at in terms of looking at a vulnerability assessment for the city in fact the city council has already i think a couple of months ago has already uh approved uh the city undertaking that uh vulnerability assessment which will be very important for the city as well so um it's it's a pretty significant term from the you know from our previous plan and overall um as and i'm going to go over this sort of in the in the presentation i'm going to do a pretty large presentation i'll be as succinct as possible uh but i'm going to kind of go through each element for you kind of just give you a summary of what some of the data from that element sort of identifies and kind of give you a preview of some of the you know the goals objectives and policies that have been put in place uh kind of to sort of implement or so that we can deal with whatever that data is telling us um so i'll say overall we know that the city's population is continuing to grow so our biggest one of our biggest challenges are right off the bat is that we are largely developed city 98 percent developed not much uh you know uh vacant land or green what we call greenfield development uh out there so most of our development is going to be uh redevelopment infield type development uh and development primarily within some of our uh districts that are already designed and already planned to take on new growth like uh midtown uh the gateway district and one of the areas right now that we're looking at uh as a more transit oriented type corridor is the sunrise boulevard corridor near university of where you have the motorola campus or what have you that really dovetails as well where one of the elements in here as you know is the intergovernmental coordination elements that we are looking at as max indicated uh plans that the mpo is putting out there plans that the uh broward county transit is sort of putting out there broward county transit does have a uh a primo transit plan uh and so uh some of the things that we're proposing along the sunrise boulevard corridor are directly in line with the broward county uh transit plan as well so that's sort of the the plan for how we uh grow the city uh at the same time protecting the existing neighborhoods and the established character of the existing neighborhoods in the city so those are those are the the sort of overall just a summary of of how we plan to sort of move forward uh the what you'll find also is that while the plan does show as you get into even some of the uh the potable water sanitary sewer and storm water elements um particularly potable water sanitary sewer while we do have level service or capacity at our plants to serve to service some of the projected growth some of the infrastructure that's currently in place uh will have to be improved because right now you know we'll have like for some of the sanitary sewer issues the plant can service it but we are having some problems getting everything to the plant to get service so some of the uh the line the feeder lines and stuff are going to have to be uh addressed and the developers that are coming in now um we're utilities is kind of working out plans with these developers because uh they are impacting these systems so they are going to have to help fund the improvements to these systems so we're trying to put together plans so all of these developers are kind of contributing uh to the development of this new infrastructure that's necessary so the good news is we have the plant capacity the bad news is that there's going to be some uh infrastructure improvements that are necessary uh to to make everything work and then as i said from the other elements public schools facilities elements is pretty simple no major changes there we're pretty much just following the district plan and when you look at the public school facilities element as you go from city to city you're going to basically see the same exact policies because you know all um local governments are basically uh you know are parties to the to the agreement with the school board um that's okay she doesn't want to go to sleep yet nope no problem all right um so um you know that's kind of where we are conservation element uh we'll take a look at uh how we preserve um you know some of the um um some of the uh vegetative communities and stuff that we have within the city and other things that has a water quality things of that sort so but i i will tell you um as you go through um volume two which is a data inventory and analysis they're very it's a very short read as to get through each element so it's not it's not a very long chapter it's just really summary can i get something clarified sure um in the introduction it quotes from the 2016 plan um there are a couple bullet points that are out there talking about the urbanizing vision uh and one of the bullets said advance urban growth goals by raising minimum residential density to 50 units per acre and this is specifically talking about midtown when we go to the uh lupa section that you got page 127 of the comp plan volume two data inventory and analysis there's a highlighted section residential 26 du to 50 du and there's no quantity on the acreage there so my question is that highlighted because it's looking at raising 50 to be the minimum density per acreage no no 50 would be the maximum um so why did the other document say minimum uh which which do you have the page i'd have to look at it one nine of volume one okay because it could have been a a typo maybe one nine of volume one it was it was quoting from the 2016 comp plan for the plans for midtown okay well and that's the same thing that includes the westfield mall instead of broward mall whatever it may be but then i saw it again and then i saw this highlighted portion so as applies to areas of maximum density that we're talking about now along the transit oriented quarters whatever village we decide to call the broward mall whenever that's done the maximum density there is going to be at 50 per acre so right now the 50 right in the um plantation midtown master plan uh it actually calls for increasing the density uh within uh the midtown area and that's to 50 um increasing the minimum or the maximum maximum density to to 50. okay right now the maximum density in the city uh as prescribed by the comprehensive plan is 25 dwelling units per acre what that master plan would go to 50 if they're using like some county tools right so yeah so i was just getting ready to point that out but what that master plan also indicated was that that 25 dwelling unit per acre max is not going to get uh the city to the density that it identifies will be necessary to truly create a urbanized type uh district as they you know as the plan calls for so um yeah so you're absolutely right the there are some tools that you can utilize and that our comp plan also um allows when you use uh flex and other things that you can and you can also uh what we call stacking you know so like a lot of development in midtown now some of the newer development that's going up that's right next to some of the office uh buildings well even though there's there's uh office uh buildings uh you know actually built on a site um we're still you're still able to count the density for that plus like the you know the uh like in one of them there's a parking area that it's going to be developed on so in the end it looks like because of the stacking that the density is low but if you if we actually calculate the density uh just on the portion of that's being built like we do on other areas of the city we're already upwards to 50 60. most people don't realize that right and that's but that that's always been my concern now that you've you've heard me say so many times now we've got a comp plan i just want to be certain so the the blank area that's highlighted on that page that reference is just because we haven't decided how many acres we want to commit to that level of density right that that was there um basically and we're first going through i left some highlights there because there are some things that i knew we needed to go back and to revisit those are some of the things that we're doing now just clarifying so that that will definitely be cleaned up so wherever whenever wherever you see like a yellow highlight those are some things that we know we have to go back and we're taking a look at to make sure we get that language precise and and clean up all right that's all i had anybody else uh just to
