[00:00:00] Speaker ?: Thank you. Please be seated. Good morning ladies and gentlemen. Your Honor, I'm sorry to apologize. The rule has never been formally invoked and there's a gentleman in the back. [00:00:13] Speaker 1: We don't know who he is. Maybe a witness. Which one? [00:00:19] Speaker 2: Okay. It's Christie's side. No, that's a clerk. Thank you. Sorry, go ahead. [00:00:30] Speaker 3: Okay. Good morning ladies and gentlemen. Mr. Hill remains under oath and subject to further direct examination. Thank you, Your Honor. [00:00:41] Speaker ?: Welcome. [00:00:57] Speaker 4: Good morning, Your Honor. May I inquire? Please, sir. Thank you. Good morning. Good morning, Mr. Hill. Good morning. Yesterday, we were at a point where we were talking about April 7th, 2025. Do you recall that? [00:01:19] Speaker 5: Yes, ma'am. Okay. [00:01:21] Speaker 4: Your Honor, I'm going to ask that we display petitioner's exhibit or plaintiff's exhibit 14. 14. [00:01:57] Speaker 2: In that small portion or just the whole video? [00:02:20] Speaker 4: That small portion. [00:02:22] Speaker 5: Well, I'm saying she'll, in that small portion, sounds like. [00:02:26] Speaker 4: Mr. Hill, what are you saying there? [00:02:41] Speaker 5: I'm saying, it sounds like I said, you hit me. [00:02:45] Speaker 4: No, Mr. Hill, in those, just hearing that, why did you need to say, chill, chill, and you hit me? [00:02:55] Speaker 5: Because it came a moment where, like, obviously, the argument was intense. So she felt, well, they felt the need to put their hands on me. You know what I'm saying? So they, like, obviously, my language doesn't need to be excused from any of this, like, obviously. But in that moment, they felt like they needed to try to rage bait me into, like, doing something to them. So they hit me first. And I didn't react back. I was, you know what I'm saying? I was just saying what I said. I didn't know that the nanny cam was playing or just anything was going on. I was just, it was just, it was just a flow of just a conversation and just a flow of how things were, like, happening. You know? So that statement, by me just saying chill, chill, but, like I say, like, they were just trying to rage bait me into doing something. And I did it, like, I was. [00:03:56] Speaker 4: Mr. Gil, there's also been some testimony about the plaintiff's mother-in-law that had approached you at the crib. Do you recall that testimony? [00:04:10] Speaker 5: Yes, ma'am, I do. [00:04:11] Speaker 4: Well, I just want to play that clip for you so that you can have an opportunity to explain to the court what took place. Again, no media, correct. [00:04:25] Speaker 6: Thank you. [00:04:25] Speaker ?: Thank you. [00:04:51] Speaker 4: Well, in that video right there, I was trying to get to baby Earl. [00:05:01] Speaker 5: You know, I, like, I know it sounds kind of selfish of me, but in that moment I felt like I needed to, like, pick up, you know what I'm saying, our daughter to give me just that reassurance that I am a great father. You know what I'm saying? And I do show up every day for our daughter. You know, so, um, that video there, it showed me just simply just moving Mama V out the way. You know what I'm saying? Like, I, I, I, like, I care for Mama V the same way I do for my mom. Like, because I looked at her as my mom. Like, that's how I grew up. Like, I don't believe in, like, um, mother-in-laws or sister-in-laws or whatever. Like, if we are married, like, I look at her as my mom. So, in that moment, I just simply just moved her out of my way just to get to our daughter. [00:05:48] Speaker 4: Thank you. And, Mr. Hill, you weigh about 195 pounds? [00:05:52] Speaker 5: Yes, ma'am. [00:05:54] Speaker 4: About how much muscle mass do you have? [00:05:56] Speaker 5: Uh, I'm probably about, last time I did it, well, in that instance, I was playing. So, I'm probably about 10% body fat. I say body fat. [00:06:10] Speaker 4: And in your job, do you have experience pushing and shoving people? [00:06:16] Speaker 5: Yeah, so, in my job, like, I mean, I've always been, like, the smallest guy on every football team that I've been on. And just generally every football field I've been on. So, I block guys that are, like, 50% bigger than me. So, let's say a 6'6", 6'8", defensive end, like, pushing them on the ground. Like, that's my job, essentially. You know what I'm saying? To block. And, um, to say that I, you know, harm these people, um, my wife and, um, essentially my other mom, it's just, it's tasteful to hear. And, also, it's not just exactly who I am. You know what I'm saying? So, sorry. [00:07:01] Speaker 4: That's okay. So, can I call you Tyree? Yes, ma'am. Thank you. So, Tyree, I want to direct your attention to one of the plaintiff's specific allegations that you wrestled for 30 minutes. Right. Do you watch wrestling? [00:07:17] Speaker ?: I do not. Okay. [00:07:20] Speaker 4: You already testified that you have about 10% fat. [00:07:24] Speaker ?: Yes. Okay. [00:07:26] Speaker 4: And, just in your opinion, as a professional athlete of your size and strength, is it physically believable that you, for 30 minutes, wrestled with a woman similar to my size? [00:07:44] Speaker 3: Jackson, leading an ultimate issue. Overruled. [00:07:49] Speaker 5: It's not, I mean, it's not believable at all, man, because, like I said, I would never stand over my wife. I would never harm my wife in any kind of way. That's not my role. So, you know, the way that my grandparents taught me is, you know, you wear your hat wherever your feet are. You know, if I'm playing football, obviously I'm going to be doing my job because my job is to block. My job is to, you know, be in that mode to be whatever I got to be to get the job done. But when I'm at home, I'm being soft because I'm around my daughter. Like, I'm being soft because I'm around my wife, I'm around my family, my kids, our kids. [00:08:26] Speaker 4: So, Mr. Hill, if that was to occur, would you suppose that there's going to be some physical injuries as a result of wrestling with you for 30 minutes? [00:08:43] Speaker 5: Oh, sorry. Uh, yeah, of course. But I'm no doctor, you know what I'm saying? So, I really don't, you know what I'm saying? But. [00:08:52] Speaker 4: Now, plaintiff has also alleged several claims where you have impeded her breathing. [00:08:57] Speaker ?: Right. [00:08:58] Speaker 4: And placed your hands around her throat and covering her mouth and nose. [00:09:05] Speaker 2: Right. [00:09:05] Speaker 4: You remember those allegations, right? I do. Yesterday, we were talking about the size of your hands and your strength. [00:09:12] Speaker 2: Right. [00:09:12] Speaker 4: Again, just in your opinion, as a professional athlete of your size and strength, would you suppose that if you placed your hand and mouth around a person of my size, would you expect that person to not have any physical signs of injury? [00:09:39] Speaker 5: I mean, they would have some kind of signs of something, you know what I'm saying? But, like, at the end of the day, like, I feel like I personally experienced, like, an experience like that on my own. And I didn't want to be around, like, that certain person. You know what I'm saying? And I may be getting off topic or something like that, but it's like, for her to say that and then to show another side when it's me and her, like, just alone, it, like, hurts me a lot. You know what I'm saying? Like, because after the divorce, you know what I'm saying, I get it, man. Like, a lot of people, you know, go through trauma. A lot of people go through stuff. Like, we all have our own real life issues in marriage and whatever you're going through, man. But it hurts me a lot, you know what I'm saying, after finding out that my wife, you know, filed these allegations against me and we're still doing, like, normal stuff together. I wouldn't be able to hang out, like, I wouldn't be able to be around a person like that. [00:10:55] Speaker 4: So, Mr. Hill, I want to direct your attention to the time where you keep referring to divorce, but you're still married. Yes, ma'am, we are. So you're referring to when she filed for divorce. Isn't that correct? Yes, ma'am. And that was April 8th, 2025? [00:11:10] Speaker 5: Yes, ma'am. [00:11:10] Speaker 4: I want to direct your attention to that time period beginning April 8th, 2025, until about after Father's Day in Lake Jim. Okay? Where were you living? [00:11:25] Speaker 5: I was living in the, well, for a small portion of it, I was living in the condo with Keira and the baby and her mom, but eventually I moved out and moved into, where did I move to? I believe I moved to the Ashton Martin residences, I believe so. [00:11:46] Speaker 4: Were you living there after she filed around April 8th, April 9th? Yeah. [00:11:52] Speaker 5: Yes, ma'am, I was. [00:11:53] Speaker 4: So how long until you moved out? [00:11:55] Speaker 5: Probably like a month, give or take. [00:11:59] Speaker 4: And once you moved out, where was the plaintiff and your daughter living? [00:12:06] Speaker 5: Oh, in the same building. [00:12:08] Speaker ?: Okay. [00:12:09] Speaker 4: And did you have opportunities to spend time with your daughter? [00:12:14] Speaker 5: You know what, man? It varied. It varied depending on, you know what I'm saying, the attitude of, you know, obviously my wife and then obviously the outcome of the court hearings. You know what I'm saying? Like, it was a struggle, you know what I'm saying? Like, so if things didn't go particularly her way that day or something, or she didn't receive the money that she didn't want to receive, I would see my daughter. [00:12:40] Speaker 4: So were there times when you would reach out to the plaintiff and ask her if you could see your daughter? [00:12:46] Speaker 5: Oh, there are a multitude. There were like 10 messages in a row, like saying, hey, do you mind if I spend time with baby girl today? I almost said it, but I almost spend time with baby girl today, and there would be no response back. It would be like, just blank. [00:13:02] Speaker 4: And the times, some of the times, were you requested to go to the condo to have to see your daughter? [00:13:09] Speaker 5: Yes. She would tell me that directly that I would have to come to her to see the baby, and I'm like, wait a minute. I don't feel comfortable with that, though. [00:13:22] Speaker 4: And you were going to the condo. Now, when you were at the condo, did she demonstrate any fear to you? [00:13:29] Speaker 5: No, no, no, ma'am. Not at all. It was all cordial. Like I said, this is all new to me. When it's me, her, and the baby, we have a great time, I'm like the best dad ever. I'm like the bestest ever. But when we get in front of, excuse me, your honor, but when we get in front of everybody else, it's like, I'm like the worst person ever. And I'm like, hold on. That's kind of confusing. [00:13:56] Speaker 4: So, did you understand, though, that you could have gone to the condo and just taking your baby and spent time with her? [00:14:06] Speaker 5: I don't know about taking it, but I know that I have a right to because we're married. But I don't want to live my life like that. I don't want to live my life where I got to like force, you know what I'm saying, my wife to allow me to give, you know what I'm saying, that kind of visitation with our daughter. Like, I don't want to, I don't want to, I don't want to have that, I don't want to have that like mix up in our relationship. You know what I'm saying? [00:14:32] Speaker 4: So, is it safe to say that you are avoiding conflict? [00:14:35] Speaker 5: Oh, yeah, for sure. I don't want to deal with that. I'm like trying to stay away from that. Because at the end of the day, I got a job to do, you know what I'm saying? I got a job to take care of the kiddos, you know what I'm saying? [00:14:48] Speaker 4: And did there come a time when you were allowed to take your daughter with you by yourself? [00:14:56] Speaker 5: It'll be, it'll be moments where, it'll be moments where like, I, after like a court hearing or something, she'll randomly, I'll text her and she'll text back and say, hey, you can come pick her up and, but you'll have to have her back at a certain time. You know what I'm saying? [00:15:14] Speaker 4: Was there a time when you were intending to go to Orlando with your daughter? [00:15:19] Speaker 5: Yes. [00:15:20] Speaker 4: Could you tell the jury what happened at that time? [00:15:23] Speaker 5: So, like I said, these dates were just random how she allowed me to pick up Baby Girl. So it was one, one day I wanted to take Baby Girl to Disney World and I had picked her up. We were going to go to the train station with a few of my friends and we're going to take the Bright Line down to Orlando. I wasn't on the fly. I wasn't going to drive because I was like, I want to spend this time with Baby Girl and enjoy her on the train. Let it be her first train ride. Why not? Doing that is when my wife pulled up and she was like standing at the gate of the train station or whatever. We're about to get on the train, mind you, me and my friends and also my other kids. We're going to get on the train. [00:16:12] Speaker 4: And had you told her what station or where you were going? [00:16:17] Speaker 5: No, I did not tell her. I did not tell her what station or where I was going at all. The crazy part is she put a, she put a, what's them little tracker things called? Them little tracker things. She put a tracker thing in the baby bag. [00:16:33] Speaker 4: But did, did the plaintiff show up at the train station with a group of people? [00:16:39] Speaker 5: Yeah. It was, so she showed up, but she walked, she, she walked in by herself. And when she walked in by herself, she had her hands folded. And I turned around because one of my friends were like, ain't that, I'm like, why, why she up here? So I go over there, she's like, hey man, like, where do you think you're going with my baby? And I'm like, I'm going to take her to Disney World. I told you I'm going to take her to Disney World. You know what I'm saying? I want to spend this time with her. She, so she was like, nah, you're not taking my baby nowhere. You're not taking her to Disney World. And I'm like, yo, just chill. Like, and people, you know, like people started looking, started looking around like, hey, what's going on? So I ended up, ultimately I ended up giving her our donor back because, hey, I didn't want to argue and be, I just didn't want to cause any drama. [00:17:26] Speaker 4: And at that time, she was by herself with you? [00:17:29] Speaker 5: Yeah, yeah, yeah. She was, yeah. [00:17:31] Speaker 4: Did she exhibit any fear or anything? No, ma'am, she did not. And this was after she filed for divorce in April 8th? [00:17:37] Speaker 1: Yes, April. [00:17:39] Speaker 4: But before she amended her pleadings to make all these allegations, correct? Yes. [00:17:45] Speaker 5: The actual date is May 30th, actually. [00:17:47] Speaker 4: Okay. Were you able to see your daughter on Father's Day 2025? No, ma'am, I wasn't on. Did you ask to? [00:17:55] Speaker 5: Yes, I did. I wanted to take my daughter to Disney World in California again for Father's Day, and that obviously got shut down. [00:18:06] Speaker 4: Were you going to see other children? [00:18:09] Speaker 5: Yes, I was. [00:18:11] Speaker 4: And did you have other children with you at the time? [00:18:13] Speaker 5: Yes, I did. [00:18:14] Speaker 4: Did you have your parents with you? [00:18:15] Speaker 5: Yes, I did. I had my parents with me. [00:18:24] Speaker 4: I just wanted to go to something that you, I heard you say, that you had gone to the condo sometimes. How was the plaintiff dressed when you would go to the condo? [00:18:37] Speaker 5: So after the time that we had that little situation or whatever, I just ended up just start bringing the, I just ended up bringing like the police with me just so that they can be a witness for us both. You know what I'm saying? I had to just go ahead and just, just set the standard right there. Let's just, let's just go ahead and just do what we got to do. [00:18:58] Speaker 4: You just mentioned the situation. [00:19:02] Speaker 5: Right. [00:19:04] Speaker 4: Could you explain to me what you're talking about, about the situation? [00:19:08] Speaker 5: Well, after the divorce, like, we were, we had an intimate moment, you know what I'm saying, that I didn't really want to be a part of, you know what I'm saying? [00:19:17] Speaker 4: Are you referring to your testimony yesterday when you were talking about you all were intimate in the condo? Yes, ma'am. I am. I am. And, and did you push your wife up against the wall during that moment? No. [00:19:34] Speaker 7: This is all asked and answered from yesterday, your honor. Sustained. [00:19:38] Speaker 4: Did you cause, did you cause a hole to be incurred in the wall? [00:19:46] Speaker 7: Same objection. [00:19:48] Speaker 4: We did not get into that. No. [00:19:50] Speaker 7: I don't remember that. Go ahead. [00:19:52] Speaker 4: Did you cause a hole to be created in your wall that day? [00:19:58] Speaker 7: Oh, yes, ma'am. [00:19:59] Speaker 3: I remember yesterday, your honor, I asked an answer. Oh, okay, I want to, I don't remember, I Googled the objection. [00:20:08] Speaker 4: You can answer, sir. [00:20:09] Speaker 5: Oh, yeah, yes, ma'am, I did. I did create a, a hole in the wall because I was trying to evade, you know what I'm saying, my wife at the time. [00:20:18] Speaker 4: What that, was that from your wife? You, did you create the hole from your wife or was it from a door or what? [00:20:24] Speaker 7: You had an bleeding and asked an answer to yesterday. Sustained as the bleeding, please rephrase the question. Like, what? [00:20:29] Speaker 4: What caused, what caused that hole in the door, in the wall? [00:20:34] Speaker 5: Oh, the door. The, the main door. So, how the layout is, is when you walk. Objection, that has to be answered for yesterday. [00:20:43] Speaker 8: You can answer, sir. [00:20:44] Speaker 5: Oh, okay. So, how the layout is, is, like I said, when you get off the elevator, it's like a straight shot to the three bedrooms. So, three bedrooms are in a line like this. You got the main room first. You got the guest bedroom second. And then you got the baby girl's room. But in the middle of that is the kitchen. So, I got to walk through the kitchen. And then, I'm going to the, to the guest room. As you walk into the guest room, on the left side is the closet. I'm trying to get in the closet. She's, like, literally right behind me trying to close the door. Like, because she already put the baby girl inside of the, uh, inside the playpen or whatever. So, I'm trying to get some clothes. She's trying to, like, fondle whatever she's trying to fondle. And I'm trying to get out of there. I'm trying to get out of there quick. And as I'm trying to evade, like, I'm not trying to, like, harm her or push her up against the wall or um like do anything crazy i'm just trying to get out the way and as i'm trying to as we're both struggling i put a hole in the wall with the door mr hill have you ever apologized to [00:21:47] Speaker 4: the planet yes i have for what reasons have you apologized i just i just feel like man like [00:21:58] Speaker 5: sometimes like we like as men like we don't take enough you know i'm saying accountability on our end as far as like what we may have done with like as far as like my words is as far as just anything like i failed us like as the leader of of our family i failed us you know i'm saying and i i apologize to her during the marriage i apologize to her after the marriage even with the words i apologize to her to this day like i dropped off our baby last week and i and like was that no it was like two weeks ago when i dropped off our daughter to her and i apologize you know what i'm saying so you're [00:22:40] Speaker 4: not were you ever apologizing for any physical injuries that you caused to her no ma'am of course [00:22:46] Speaker 5: not why would i probably ask for that i i haven't done anything wrong [00:22:49] Speaker 4: uh mr hill you mentioned yesterday about your wife stealing some money [00:22:58] Speaker ?: correct [00:22:59] Speaker 4: could you explain to the court the specific instances in which you were stating that your wife was stealing money from you [00:23:09] Speaker 5: uh well when i say stealing money so i don't know if i can get into any of this right now but um i guess i'll talk until i get stopped um well let me let me direct you a little bit here did you all have a shopify account yes ma'am we did well no no we didn't have a shopify account uh my soul in the store had a shopify account and was that a joint account no ma'am it was not and that account belonged to you and i belonged to the store the store the store and was there an instance where you were concerned about money being missing from that account so with that though like there would be multiple like there would be multiple accounts where like i would be like putting money into like my brand or whatever and you know when you put money into your brand there's a shopify account you need that you need obviously the customer's gonna go on shopify they're gonna buy stuff and when they buy stuff the money go into the shopify account you use that money so that way you can purchase more product purchase more designs for your clothing brand so that way you're not coming out of pocket you're basically using the customer's money so that way you can put back into the brand i had found out blindly because my sister was telling me but i wasn't listening i had found [00:24:32] Speaker 4: out you can't sorry you can't say what your sister had told you okay perfect just based upon your own knowledge did you find out that money was coming out of that account yes and where was that money going into uh keyless bank account and you didn't authorize that no ma'am i did not authorize that did you have a conversation about that with the brand yes of course we had conversations about like [00:24:57] Speaker 5: stuff like that all the time but you know like it just led into an argument and of course i ignored it [00:25:02] Speaker 4: miss tyreek is your mom still homeless my mom no so mom so i moved back into um the south west ranch's home and [00:25:17] Speaker 5: my mom has moved back in with me [00:25:19] Speaker 4: you stated that your mom and your sister didn't like the planet great could you explain a little bit to the jury what makes you say that do you believe that your mom and your sister would ever hurt actually hurt the planet [00:25:47] Speaker 5: i don't i i i i truly don't you know because they know that you know kita was was my wife you know and they understood that she had a certain place in my heart um and that i really care for her you know regardless of you know um what may have been said or what people may say they they understand they understood that [00:26:17] Speaker 9: do you believe you've been a good husband [00:26:22] Speaker 4: man i don't i don't i don't could you explain to the jury in what areas do you believe that you [00:26:32] Speaker 5: have not been a good husband i don't i really don't man i i just think that you know as i'm a little in the football terms but i i just think that you know after watching the film like there are there are a lot of areas that i can improve man you know it's being a husband you know father a plus father but as far as husband like i think the one thing that sticks out to me the most is it's my language like i i can i can talk better to my wife you know because she deserves that respect from me you know i i mean i knew her i knew how she grew without no father you know and i was supposed to be that man to like step up for her but i didn't you know and essentially i failed you know um and i feel like i failed our daughter in that nature as far as like not holding our family together and it just sucks to say out loud man there's so many people just to get to see it but the pros of it is a lot of people can learn from this situation a lot of people can you know educate themselves and you know so i think it's it is good it's not good obviously but i think it's good that a lot of people can like actually learn from the situation what was that bad husband i'll take that on [00:27:52] Speaker 4: on the chin yes mr hill you've heard you've heard some testimony about all the police are your fans some testimony regarding the police all being your fans oh yes ma'am have you within the last year had the negative interaction with the police i don't know if y'all seen why wasn't it uh yeah actually uh [00:28:22] Speaker 5: when i was on the way to a football game actually they the police weren't i guess those guys were like raiders fans or something they like pulled me out of the car they weren't entirely tyreek hill fans but i would not like with that situation though it was just a situation that you know i had to learn a lot you know and i educated myself and i completely see that cop's point of view okay but in that [00:28:52] Speaker 4: situation they were doing their job yeah they were definitely doing their job okay Thank you. [00:40:48] Speaker 4: Thank you. [00:40:50] Speaker 5: generally what it looked like, like, nearly every time, you know. Who would choose the places and locations of your time with your dog? It was the side of us both, you know what I'm saying, obviously, and all depending on when Capri, when baby girl wanted to, or when it allowed her schedule, because, you know, she's a baby, like, she sleeps a lot, like, that's her routine, you know, so, it was predicated depending on when she was available, you know. Like, we even, like, the crazy part about it is, like, when baby girl was first born, like, we even seen the movie Avatar. Avatar is three hours long, you know. Was it your request to exercise your time sharing watching the movie Avatar? I mean, that was the only time that I could get with baby girl, so I said, let's do it. And when you say the only time that you could get, [00:41:50] Speaker 4: you're saying the only time that the plaintiff would allow you to have that time? Yes, ma'am. Okay. You can go to the next one. [00:42:06] Speaker 9: Pardon me, can you identify, I want to move a little bit of a distance, but can you identify the individuals in this video? [00:42:18] Speaker 1: Myself, baby girl, and key. I don't know. [00:42:23] Speaker 4: And is this April 12th? I don't know who that guy is, though. Is this April 12th, 2026? [00:42:31] Speaker 1: Yes. [00:42:32] Speaker 4: And do you recall where you all were at that time? [00:42:35] Speaker 1: Oh, yes. Oh, yeah. Okay. I know where this is. This is at church. [00:42:41] Speaker 4: So, you and the plaintiff would attend church together? [00:42:45] Speaker 5: Yeah, so, after, what's the crazy part is, like, we actually went to church more after we, after the petition was filed or whatever. We went to church more, you know, together. Like, we spent, we went regularly, like, every Sunday, and that's how we would spend our time together. And that would be another form of me seeing my daughter. Well, our daughter. Sorry. [00:43:10] Speaker 4: Now, Mr. Field, and from your perspective, in any of those videos, did the plaintiff get scared? [00:43:19] Speaker 5: I mean, I don't know. I don't know. I was paying a lot more attention to a baby girl, you know. But from her movements, from her mannerisms, the way she acted, you know, it felt like we were married again, essentially, well, we still are married. Well, I mean, I had just a moment. [00:43:53] Speaker ?: No, no, no, no. [00:43:54] Speaker 4: Before we leave, I believe, I want to show you a couple or more of the videos. Mr. Field, can you identify the individuals in this video? [00:44:32] Speaker 1: Me, baby girl, and Keith. [00:44:35] Speaker 4: And where were you all? [00:44:37] Speaker 1: We were at, I don't know if it was part, I believe. [00:44:40] Speaker 4: And this is April 15, 2026? [00:44:42] Speaker 1: Yes. [00:44:49] Speaker 4: So, other than five-star restaurants, you all also went to the parks sometimes. [00:44:53] Speaker 1: Correct. [00:44:55] Speaker 5: Because that was a time that, uh, baby girl was like, really learning how to walk, walk, and, you know, we wanted to do more things that involved her, you know, [00:45:07] Speaker 1: get, like, being able to control her motor skills better. So, it's not real to the park. [00:45:29] Speaker 4: And is this a video of you all still at the park? [00:45:34] Speaker 1: Yes, yes. Trying to get her to kick them off, but, as you can see, she... [00:45:51] Speaker 8: You can go to the next one. Now, where are you all here? [00:46:10] Speaker 1: Leaving church, Indiana. [00:46:12] Speaker 4: And are these still you, your daughter, and the planet? [00:46:15] Speaker 1: Yes, ma'am, it is. [00:46:23] Speaker ?: So, I'm going to go to the next one. I'm going to go to the next one. [00:53:16] Speaker 4: And where are you in this video on May 13, 2026? Swim. And this is a different swim. [00:53:41] Speaker 1: That's the same swim. [00:53:42] Speaker 4: A different date. [00:53:43] Speaker 5: Oh, yeah, it's a different date. But like I say, like, I don't know what the other side is doing. But I know what I'm doing is, like, I try to commit myself to baby girl each and every day. Like, she deserves that right, you know, from my father. [00:54:01] Speaker 4: And who is in this video as well? [00:54:04] Speaker 1: Myself, Key, and baby girl. And swim teacher. [00:54:09] Speaker 4: And when you say Key, you're required to play. [00:54:11] Speaker 1: Yes, ma'am, I am. [00:54:12] Speaker ?: Okay. And this is May 13, 2026? Yes. [00:54:16] Speaker 4: Okay. And this is May 13, 2026? Yes. [00:54:19] Speaker 1: Okay. [00:54:20] Speaker ?: Thank you. [00:54:50] Speaker 4: And is that the planet there in Swinsu? [00:55:05] Speaker 1: Yes. [00:55:20] Speaker 9: So, you can stop me. Thank you. [00:55:28] Speaker 4: Tyreek, just two quick questions. One, did you make a police report the day you went to the train, when the planet came to the train station? [00:55:37] Speaker 1: I did. I didn't feel entirely comfortable doing it, but I did. [00:55:42] Speaker 4: Okay. And having watched all of these videos, with the dates after the allegations that the plaintiff has made regarding having PTSD. Right. Was any of your interaction with the plaintiff, did you experience or see any symptoms or results of her having PTSD? [00:56:17] Speaker 3: Did you see any anxiousness from the plaintiff? [00:56:28] Speaker 4: No, ma'am. Like I said earlier, like, it's not my job to, like, determine or give her symptoms or anything. [00:56:40] Speaker 5: Like, when, in those moments or after the petition was followed, like, I thought we were, you know, trying to reconcile our marriage and work on our marriage. Because that was the image or what was being said during some of those conversations. [00:57:13] Speaker 4: Did you see any fear from the plaintiff towards you? [00:57:19] Speaker 5: No, ma'am. Not at all. Like, like I said, we had a good time. Like, we enjoyed ourselves. [00:57:24] Speaker 4: Did you see any reluctance from the plaintiff towards you? [00:57:29] Speaker 5: No, ma'am. Not at all. Like, even at church, there was a moment at church where she had locked herself out of her car. Like, she locked herself out of her car. And in that moment, like, I was going to leave because it was, at that point, I had, you know, time sharing or whatever with our daughter. So I didn't, I didn't have no obligation to her. But in that moment, you know, some words were exchanged. Like, oh, like, you only care about yourself. Like, if you was a real man, you would pay for my locksmith. So I sat there. I allowed her to sit in the car while I called the locksmith. And I paid for her locksmith to come open the car for her. So in that moment, I'm like, while all of this is going on still, at this point, I already knew about the allegations. So I'm like, man, look, bro, I don't, look, I call the locksmith if I pay for it, whatever I got to do, bro. Because at the end of the day, I am the man. And that's what my parents taught me. Resilience. You know what I'm saying? And I can't hold grudges against anybody, bro. That's just who I am as a person. [00:58:37] Speaker 4: Just a final question. Did there come a time when you did not want her present for your time sharing? [00:58:59] Speaker 5: Oh, yeah, for sure. Because I think it's important for myself to foster a relationship with our daughter. [00:59:05] Speaker 4: And did you have to obtain the removal of her from the court? [00:59:14] Speaker 5: Oh, yes, I did. And she fought us tooth and nail for it in court. Like she, she, she wanted to be there. You know what I'm saying? For some odd reason. I don't know why. But for me, you know, like, like I would tell them all the time, I'm like, hey, bro, whatever it takes to see baby girls, because I'm already missing so much time. And, like, in my life span, and just, you know, the children that I'm already raising, like I miss so much time in their life, like putting so much time into my craft. And I don't want to miss another, you know, precious moment of my daughter's life. You know what I'm saying? And I had to bite the bullet. Like for real, I had to bite the bullet and just say, hey, bro, look, you got to set all that aside, bro, and just do whatever you got to do to see your daughter at this point, man, because that's what's important. And that's what's still gonna be important 20 years from from now, man, that every single day. [01:00:08] Speaker 4: Thank you, Tyrese. Your Honor, I have no hope. [01:00:11] Speaker 3: Okay, thank you. Uh, anybody want a break or are you ready to go right into the process at least? Are you okay? We're okay. I was allowed. That's all right. [01:00:21] Speaker 7: I was going to ask for a minute, Judge, just to get set up. Yes, Your Honor, I was going to ask for a minute if it's okay because you got set up with everything. Okay, then we will take a short recess there in five minutes. [01:00:31] Speaker ?: Thank you all for getting the opportunity to get set up so we have a smooth morning and afternoon. Domestic abuse is wrong, right? Correct. You understand there's different kinds of domestic abuse? Correct. Physical abuse? Correct. Verbal abuse? Yes, sir. Emotional abuse? Yes, sir. All of those things are wrong, right? Yes, sir. And the man should never abuse his wife. [01:00:57] Speaker 1: Yes, sir. Correct. [01:00:59] Speaker 7: No qualifications. No reservations. It's never okay to abuse your wife. It's not allowed. It's not allowed. It's not allowed. [01:01:05] Speaker ?: It's not right. [01:01:06] Speaker 7: It's not allowed to touch anybody. [01:01:08] Speaker ?: It's not right. Right? [01:01:10] Speaker 3: Argument sustaining. Well, you abuse Keita, right? [01:01:15] Speaker 7: Excuse me? [01:01:16] Speaker 5: You abuse Keita. [01:01:17] Speaker 7: Allegations? [01:01:18] Speaker 5: Those are allegations. Allegations? [01:01:21] Speaker 7: I'm talking about your testimony, sir. When you testify, you push her to a wall. Argumentative. Asked an answer. No. [01:01:29] Speaker 6: Now that's the first time on cross-examination, it's being asked about the wall, and that's [01:01:33] Speaker 3: not argumentative. You push her through a wall, right? No, sir. I do not. You testified yesterday. You pushed her through a wall. You pushed her through a wall, right? No, sir. [01:01:41] Speaker 1: I do not. You testified yesterday. [01:01:43] Speaker ?: You pushed her through a wall. [01:01:44] Speaker 5: I may have misspoken, but what I meant to say was I was trying to evade my wife. We'll get to that. [01:01:55] Speaker 7: Let's talk about what you testified to yesterday first. Sure. [01:01:58] Speaker 5: That continued for like a whole five minutes. I tell her crazy this. [01:02:03] Speaker ?: This is not anything you, sir, are not the attorney that's handling this request. [01:02:03] Speaker 5: You're a kid. Yeah. [01:02:05] Speaker ?: And this is my story, bro. [01:02:06] Speaker 5: I told her that night. I said, "Don't you never tell me she's in your life." I pushed her against the wall, and I tried to force her to get off me. I created a hole in the wall, trying to force her to get off me that night. This happened to me, of course. That was your testimony yesterday. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. I was just a little bit of a question. [01:02:34] Speaker ?: That was your testimony yesterday, right? Yes, sir. Now, I understand your lawyer asked you some additional questions this morning about your testimony, right? Correct. About this specific testimony, you can take that down, please. Right? Oh, yes, sir. You worked on that last night? [01:02:49] Speaker 7: No, sir. I did not. Didn't talk to anybody about your testimony? [01:02:52] Speaker 5: I didn't talk to anybody last night. [01:02:54] Speaker 7: Now, you testified this morning when this incident happened where you put your wife through the wall that you were trying. Objection. [01:03:03] Speaker 4: Objection. This characterized as the statement of the witness. [01:03:07] Speaker 7: Overmove. Your testimony this morning about when you put your wife through the wall. Correct. You said you were trying to evade my wife, right? Yes, sir. So, you wanted to clarify and explain you were trying to evade her, right? Right. [01:03:22] Speaker 5: I mean, obviously, like I said, I did not put my hands on my wife. You know what I'm saying? I was simply trying to evade my wife. And I just wanted to clear that up with some of the people on the jury. Like, I don't want no misunderstanding. Oh, neither do I. [01:03:37] Speaker 7: That's completely fair. But we agree you were just trying to evade her? Yes, sir. [01:03:42] Speaker 5: Okay. [01:03:43] Speaker 7: You are an NFL superstar, right? [01:03:46] Speaker 5: I'm not a superstar. You said that. I didn't. [01:03:50] Speaker 7: You don't think you're a superstar? No, sir, I'm not. You haven't beat some of the best defensive backs in the NFL? [01:03:55] Speaker 5: That doesn't mean anything to me, bro. I grew up in South Georgia, baby. [01:03:58] Speaker 7: You can evade an NFL defensive back, but you can't evade Rakita Lojaro without putting her through a wall? [01:04:05] Speaker 5: It's not that moment for that, though. Okay. It's not a moment for that. You got to warm up for those kind of things. I'm old. I'm 33, bro. I got back pains. [01:04:14] Speaker 7: So you had to put your wife through a wall because you're old? [01:04:17] Speaker ?: Object, Your Honor. [01:04:18] Speaker 4: This is Irene. Sustain. [01:04:20] Speaker 7: You testified on direct today that when you're at work, I imagine that means as a pro football player, right? Yes, sir. That you push and shove grown men, right? Yes, sir. That you're a professional pusher and shover? [01:04:37] Speaker 5: That's not my job title. My job title is to, you know, catch passes and, you know, make you look good in the end zone. [01:04:44] Speaker 7: Well, it's one of your responsibilities, right, to push and shove when you're blocking? [01:04:49] Speaker 8: Objects, relevance, Your Honor. [01:04:52] Speaker 7: Well, what would you ask about? [01:04:54] Speaker 5: It's not my main job, but I like to get in there and get dirty sometimes. I like to get in there and get dirty sometimes, I'd like to say. [01:05:02] Speaker 7: Did you bring your work home with you? [01:05:03] Speaker 5: No, I did not. [01:05:04] Speaker 7: Now, you also verbally infuse your wife, right? [01:05:08] Speaker 5: When you say verbally, you mean with words, right? Yes. Oh, yes, sir. [01:05:14] Speaker 7: And that verbal abuse caused her a lot of emotional damage. Do you agree with that? [01:05:19] Speaker 8: Objection, Your Honor. [01:05:21] Speaker 7: Sustain. Oh, this is deposition testing, huh? [01:05:26] Speaker 8: Excuse me? I'm still confused. What does that have to do with you? It sounded like a medical thing. [01:05:32] Speaker 3: Okay. [01:05:33] Speaker 7: So, you already admitted to abusing your wife here, right? [01:05:44] Speaker 3: Do you agree with that? [01:05:45] Speaker 4: Same objection, Your Honor. [01:05:46] Speaker 3: I don't know. Same objection. [01:05:48] Speaker 4: Objection. Well, it turns out. I don't know. [01:05:51] Speaker 3: Asked and answered, I think. Is that particular opinion. [01:05:53] Speaker ?: Whether this witness can express a medical opinion. Oh, not the question. Not the question. I'm sorry. [01:05:59] Speaker 7: The question was based on the verbal abuse answer, you've already admitted to abusing your wife, right? Verbal abuse is abuse? Yeah, verbal. Sorry. [01:06:06] Speaker 1: Yes, verbal abuse. [01:06:07] Speaker 7: So, is there any other abuse you want to admit to before we continue here today? What is? [01:06:13] Speaker 4: Objection, Your Honor. He's being argumentative with the witness. Full rule. [01:06:17] Speaker 7: Is there any other abuse you would like to admit to before we continue on here today? [01:06:25] Speaker 5: There's nothing to admit to, sir. I already admitted to verbally abusing my wife. And I'm sorry for that. I'm sorry. Like every day, I'm sorry for that. I don't know what you want me to continue to say. [01:06:36] Speaker 7: Well, let's talk about some of your beliefs. You talked about being raised by your grandparents, right? Correct. And you told the jury and all of us about lessons you learned from your grandfather and your grandmother, right? Yes, sir. And one of the things you learned from your grandfather is that women can be a little emotional. Second. [01:06:54] Speaker 5: Say that again. [01:06:55] Speaker 7: One of the things you learned from your grandfather is that women can be a little emotional. [01:07:00] Speaker 5: Can you remind me when did I say that, please? Sure. Thank you. [01:07:08] Speaker 7: You were deposed in this case, right? [01:07:09] Speaker 5: Yes, sir. [01:07:10] Speaker 7: I was. I'm talking specifically about the April 24th deposition for the battery claims, not the divorce case. [01:07:16] Speaker 10: Yes, sir. I'm not sure what the council is trying to do. [01:07:18] Speaker ?: Refreshing is recollection is a significant number. Well, okay. [01:07:18] Speaker 10: Good. Please go ahead. [01:07:20] Speaker ?: Thank you. [01:07:20] Speaker 10: Please go ahead. Thank you. [01:07:22] Speaker ?: Thank you. Thank you. [01:07:22] Speaker 10: Thank you. [01:07:23] Speaker ?: Thank you. [01:07:24] Speaker 7: there are no line numbers unfortunately for the second last second last second i'm just [01:07:39] Speaker 4: one object to this process i'm not sure what the council is trying to do [01:07:59] Speaker 5: yes sir that's it thank you for that no problem if at any time you don't remember something happy to [01:08:08] Speaker 7: come up and show you your position thank you you agree that one of the things you learned from your granddad is that women can be a little emotional right that wasn't all that i learned but that's [01:08:16] Speaker 5: just one of the things that you pointed out so sure one fact at a time the next thing you learned from [01:08:21] Speaker 7: him is the man's job to always de-escalate always and your job as the man is to always de-escalate [01:08:31] Speaker 5: right correct got to know when to pick and choose your battles and you described [01:08:37] Speaker 7: as an emotional being do you remember that uh i don't remember does that sound like something you [01:08:44] Speaker 1: would say you got to keep refreshing [01:09:03] Speaker 7: which line there are no line numbers it's the second full paragraph [01:09:20] Speaker 5: okay [01:09:24] Speaker 7: so now you remember describing your wife as an emotional being right i don't think that i think you're [01:09:33] Speaker 5: i think you're blowing that out of proportion of what the that full context said in that paragraph i'm not blowing anything out of anything i i think you're described her as an emotional being i'm sorry for cutting you off by the way um i think in that instance in that paragraph that you're talking about it's just in those moments you know what i'm saying okay so that's your testimony you were just talking about in those moments i mean that's what the paragraph was saying i didn't say that oh she's an emotional being i was saying like in in those moments she's she was being an emotional [01:10:09] Speaker 7: person that's it it does not say in those moments in the passage you just read right no no no no sir but [01:10:16] Speaker 4: that's what i don't think i have but that's what that's what i meant [01:10:26] Speaker 7: you do a good job controlling your anger every day right i i don't have anger i'm sorry do you ever believe that you've had difficulty in specific circumstances and controlling your anger never have you ever answered that question differently i'm sorry i don't think i have but so you are also under oath in the divorce case you need a deposition in that case as well okay donner do you have a copy of this i don't have a copy i don't need it okay so at page 297 line 16 you have the following questions by mr mark's okay the following answer i know what i want to do thank you so at that position you were asked the following question and gave the following answer question do you believe that you ever had difficulty in specific circumstances controlling your anger answer i mean i do a good job at it every day you know what i'm saying there's always room for improvement for all of us in this room so i'm going to speak for myself and i said this earlier not always trying to be tough around my kids is me being vulnerable and certain things like that i think i am the nicest guy in the room always with the biggest smile man and i think that sometimes people that's what people don't see it they don't value it you know what i'm saying so that's once again why i've been able to be one of the boldest guys in the miami dolphins because of how i carry myself each and every day and how i treat every person inside of the building every single day and i show up and i'm consistent every single day that was your testimony of deposition right yes sir no question no question oh sorry you never got angry with keto no never frustrated yeah frustrated yes yesterday you testified the argument april 7th this was the nanny camp day right yes sir or baby camp you testify that argument was about you trying to have a conversation with my wife about money getting stolen like a hundred thousand dollars correct [01:13:15] Speaker 1: do you recall testifying differently in your deposition i do not but if you can refresh my memory that's perfect thank you [01:13:29] Speaker ?: okay [01:13:35] Speaker 7: stage 249 [01:13:40] Speaker ?: start [01:13:50] Speaker 1: all realities [01:13:52] Speaker 7: whatever you're comfortable with you can start at the top of the page don't say anything just let it go okay [01:14:14] Speaker 5: excuse me i didn't i didn't i didn't get your name what's your name so i can just call your name up i don't understand mr whaley mr whaley mr whaley mr whaley okay okay [01:14:27] Speaker 7: your recollection were fresh yes sir it is so you did testify you did not testify about a hundred thousand dollars when you were asked about the argument on equal acceptance at your deposition i [01:14:38] Speaker 5: didn't get specifics but um in that deposition though it does say something that we all need to catch in there um it said something about um us arguing about me not giving her enough money and then that's when i brought up the argument about her stealing money you did not say anything in your deposition [01:14:56] Speaker 7: when you were asked about what the argument on april 7th was about yes sir about stealing [01:15:01] Speaker 5: women you did not use those words oh you're absolutely correct you're absolutely correct sir [01:15:10] Speaker 7: now you want to set a good example for your daughter right of course you want to set a good example for [01:15:15] Speaker 5: all your kiddos right yes sir for every kid in the world i think that's important your kids specifically of course and you testified i believe that you want to treat your wife the way you want [01:15:28] Speaker ?: someone to treat your daughter one day right yes sir you want your kids to have a great childhood [01:15:34] Speaker 1: yes sir you want them to have a safe and stable environment right correct and the only thing you [01:15:41] Speaker 7: were trying to do that day april 7th was to be a good husband and good father to your daughter right yes sir now you say on that nanny canteen i'm going to get my daughter and get the out right correct and you admitted yesterday during your direct testimony you didn't know why you were getting the baby out of the crib right i mean we were going to leave well what you said yesterday was when you took the baby out of the crib you didn't know what you were doing with her at that moment sure yes sir [01:16:15] Speaker 5: but you were going to leave right essentially yes sir not essentially i mean you just said i was going to leave right you were barefoot in that video it ain't nothing you throw on some slides and just get on the elevator that's not the question i asked i mean you said i was barefooted but i always kept my shoes right beside the elevator door so i could just go press the button and go down that's great you you were barefooted in that video yeah in the video yes sir okay now [01:16:47] Speaker ?: you didn't stop the closet right for what i had a close no at the closet in the baby's room you didn't stop there you just walked out of the room right for what i'm asking you you didn't stop the closet for [01:16:59] Speaker 7: everything you just walked out of the room with the baby right yes sir so on the nanny cam at the very beginning of it she's sleeping right correct she didn't stay sleeping right if you told your wife the little ass girl get the out divorce today yes she tells you to stop is that yes yes sir sorry you did not stop right you called her a little ass girl who will never be successful in your life correct you say i'm gonna throw your ass up man [01:17:47] Speaker 5: you don't remember i don't remember that part right there could you play it for me please thank you and it's good my daughter's name mother thank you [01:18:12] Speaker 7: right correct yes sir divorce today you and your mom can get the out of my house [01:18:17] Speaker ?: yes sir i said it you said little ass girl will never be anything i said it yes sir that was about [01:18:26] Speaker 5: your wife right yes sir and to your wife to my wife i read it to her you said you a bitch [01:18:33] Speaker ?: not yes sir you said you ain't but a broke bitch that's all you is i said it this is all to your wife right and if it's on the baby cam the baby could hear all this right correct she could you say at least [01:18:51] Speaker 7: don't scare me bro right yes sir i said it you said you broke bitch you broke you already said that well yes sir i said it i didn't say that one you can't stop me either that's what you said right before you took the baby out of her friend right i did say that yes sir i did you also threatened your [01:19:14] Speaker 5: wife right i don't know how i threatened her could you help me out please classic you said we're going [01:19:22] Speaker 7: to see when the crew come over here we're going to see what can happen remember saying that yeah i do [01:19:28] Speaker 5: but that's not really a threat though we just gonna see what's gonna happen that's not really a threat though what's gonna happen when the crew come over here i don't know but that's not really a threat like you just made that a threat though the the language i'm gonna take that all day on the chin i'm gonna take that bro i'm not proud of that i'm not i'm sorry let me continue with that like i'm i'm i'm i am ashamed like i i don't even go back home because my because my because my because my marriage failed i don't even go back home like i'm scared to invite my grandparents over to my house now because my marriage failed and i don't know how to answer to them because the way that they raised me i don't know how i don't know how i don't know how i'm sorry you know the language was terrible it was terrible you know i wish i could have been better in every single moment you know but i'm not perfect i only thing i can do is just learn from it and move forward you know and never ever talk to my my my co-parent like that never again wait what's that wrong you know you finish yes sir i'm finished [01:20:35] Speaker 7: that's wonderful do you remember what my question was yeah you said that it was a threat but it's not so let's just answer the questions at our house is that fair do you know i'm just going to object to that instruction it's your job to ask questions so everything that you saw and everything that you heard this is how you as a man always de-escalate the situation no sir it's not but this is how you [01:21:00] Speaker 5: talk to your wife it's not it's not it's not fun man but it's like in my mind like spending i've been working my tail off every single day and i come home and all i want to do is just have that moment with my with my wife we have a conversation about finance and we have a conversation about potentially her mom moving out and i feel like i got dismissed in a little bit where it's like oh you're not doing enough for me and you're not giving me enough money and it's like you're already getting a lot of money from me like what more do you want i just want to spend time with you and just enjoy our moments together and i never felt like i never got that like i i dating back all the way back to the house burning down i pull up to that situation you laughing and smiling and i'm literally bawling crying because the hard work and everything that i put into my job is is going down into flames and you sitting up there laughing and it's not even funny and then as you like i'm not even gonna talk about the situation with the kiddos i mean not being able to see my kids is already hard and i push all that aside just to try to make my wife happy and that's it excuse my my man and that hurts that hurts a lot i have a breaking point at some point and and that's no and that's no excuse that's no excuse for no man [01:22:27] Speaker 7: nobody i'm the leader there's no excuse for me sorry sorry you felt dismissed and disrespected so that's how you acted that's no logical answer to it i'm sorry please answer the question you just said you felt dismissed and disrespected so that's how you act right i just gave you my answer i'm sorry man that's all i got for you bro [01:22:55] Speaker 5: that's your answer is there's no logical reason i i can't i can't talk to my wife like that man i'm sorry [01:23:07] Speaker 7: you are doing you are doing everything you can in that video to hurt your wife emotionally aren't you [01:23:19] Speaker 5: in that moment yes emotionally you wanted to break her mentally that's not what i wanted to do bro [01:23:29] Speaker 7: is there anything nastier you could have said to your wife than what we heard on that video [01:23:37] Speaker 5: yeah besides i didn't want to give her no more money i think she she didn't like that more than anything [01:23:41] Speaker 7: you admitted that you put your hands on mama being alicia during this argument right i did and according to you that was in self-defense because she touched you first right correct [01:24:03] Speaker 4: yeah i'm just going to object your honor to miscarriage miscaracteration of the testimony so i'm going to destroy yes sir [01:24:27] Speaker 7: uh could you refresh my recollection please sure thank you you were deposed in the divorce case in july of last year ok do you remember that yes sir specifically july 23rd july 23rd [01:25:07] Speaker ?: ok ok [01:25:11] Speaker 3: ok [01:25:15] Speaker ?: ok ok ok ok [01:25:23] Speaker 7: that deposition happened before you saw the hand back right i can't recall well that deposition whether you saw it or not you testified there was no physical contact by anybody that day right [01:26:03] Speaker 5: i'll either say that in the deposition and you tried to buy that footage off here right [01:26:11] Speaker 3: i'll handle this one [01:26:25] Speaker ?: i'll handle this one [01:26:25] Speaker 3: no i don't think so i think that this break is handling the speech ok [01:26:43] Speaker ?: Okay, let's come to the side. [01:27:01] Speaker 3: Ready? Ready? Okay, the court sustains the objection. Now let's drug the jury. Please don't consider that last question and answer about the matter. [01:27:13] Speaker 7: So, Mr. Hill, you testified yesterday you don't have a baby to push them off on someone else, right? Yeah, you don't. You just don't do that. How many kids do you have? Eight. In how many different states? [01:27:33] Speaker 3: I heard a lot of them go back. [01:27:40] Speaker 1: Count this state right here, three. Where is the baby girl? [01:27:46] Speaker 7: So, Florida and where else are your other kids? I don't want to say that. I don't have to ask them to answer that. But other states, not Florida, right? Yes, sir. And you testified yesterday that you devote your life to baby girl. That's the baby girl you have with this car on there every day, right? Every single day, man. And you describe yourself today as the best dad ever, right? For sure. You said about this incident on April 7th today, you said you picked her up for reassurance that you were being a good dad for her, right? Right. Because of the things that Ms. Favaro and her mother were saying to you, right? Yes, sir. So, you picked her up for you and not her, right? [01:28:31] Speaker 1: What do you mean? [01:28:33] Speaker 7: The baby didn't need to be taken out of the crib. You wanted to take the baby out of the crib because you wanted reassurance that you were a good dad. [01:28:39] Speaker 5: I mean, reassurance of being a good dad and then also baby girl. The fact that she was waking up in that video also, if you watched the video. [01:28:46] Speaker 7: Was she waking up or was she woken up? [01:28:49] Speaker 5: If she's waking up, that means that it's time to feed her. [01:28:53] Speaker 7: Was that what you were doing? No, I wasn't. So, you said yesterday you wanted to get up in the middle of the night and do bottles and diapers, right? Yes, sir. And that was specifically about this baby girl. [01:29:04] Speaker ?: Yeah. [01:29:04] Speaker 7: It's hard to do that when you have the schedule that you do as a professional athlete, right? [01:29:10] Speaker 5: It's not. Like, you're picking shoes with, like, I was ready to dedicate my life to, you know what I'm saying, our daughter. Like, she deserved that right. If I marry this woman, I'm going to dedicate my life to my daughter and then also my wife. Like, I can put my job to the side because I have that right. You know what I'm saying? [01:29:32] Speaker ?: Sure. [01:29:34] Speaker 7: I'm just saying you described some of your training yesterday on direct examination. Do you remember that? [01:29:38] Speaker ?: Oh, yes, sir. You need to wake up at 5 a.m., right? Right. Train literally three times per day, right? Correct. To be in the best physical shape. Correct. The best endurance. [01:29:51] Speaker 7: Correct. [01:29:52] Speaker ?: To be the best in general. Right. [01:29:53] Speaker 7: You do finger drills. Right. And you have seven other kids in at least two other states, right? [01:30:00] Speaker 8: Argumentics, if you want to ask. It's named. [01:30:02] Speaker 7: You don't have to answer. There's not even a question. Well, you have a lot going on, right, Mr. Hill? I always have a lot going on. So it's difficult sometimes to devote all of the attention and care that Ms. Vaccaro and the baby girl deserve, right? [01:30:17] Speaker 5: I wouldn't say that, man. I would say this. Like I said, when I say I've been committing my time to our daughter, our daughter does speech twice with her dad ever since I've been able to follow the judge's rule with giving me co-parenting time. She does gymnastics. [01:30:34] Speaker ?: She does gymnastics. [01:30:34] Speaker 5: I do gymnastics every Tuesday with our daughter at 10:30 sharp and I make sure I don't miss and I make sure that I'm dedicated to her because she deserved that right. She does swimming on Wednesday. That kid, that kid takes her to. And guess who signed her up for that? Her dad. Because her dad thinks that we need to devote our life to our daughter every single day. So when you sit up here, when you sit and ask me about, oh, Mr. Hill, like David, no. Like I devote my life to our daughter because she deserved that, sir. I'm sure if you got kids, you devote your life to your kids. You're not there every second, but in those times, you're going to FaceTime whenever you need to update, whenever they go to the doctor. Also another thing, I go to doctor's appointments too. I don't miss those. I don't. I don't. I don't miss those because the thing, what I said in my testimony earlier about my earlier kids is I miss so much of that time and I don't want to miss that time for a baby girl because she deserved that. [01:31:32] Speaker 7: Can I answer your answer? [01:31:34] Speaker 5: Yes, sir. Okay. [01:31:36] Speaker 7: Everything that you just described, like speech for instance, she wasn't in speech at five or six months old, right? [01:31:44] Speaker 5: She was, but she took her out. [01:31:48] Speaker 7: Your daughter was in speech therapy at five months old? [01:31:51] Speaker 5: She wasn't in speech therapy because I wasn't a part of the, that was when the whole video was shown on the screen of us going to catch and stuff. She wasn't in then. [01:32:02] Speaker 7: Is it your testimony that your infant daughter was talking at five months old? [01:32:07] Speaker 5: Speech isn't just for talking, sir. You know that, right? It's not my testimony to say that she was in speech, but I'm saying now that she's, she's on a consistent plan with myself now. [01:32:21] Speaker 7: When you say speech, you mean speech therapy? Yes, sir. [01:32:25] Speaker 5: I do. [01:32:26] Speaker 7: Okay. And it's your testimony that has nothing to do with whether someone can talk? [01:32:30] Speaker 5: She's trying to learn how to talk. You know what speech therapy is, sir? [01:32:35] Speaker 7: I sure do. My son did it. All right. When he was seven years old. [01:32:39] Speaker ?: Okay. [01:32:40] Speaker 7: Now, this is the one off the rest. [01:32:43] Speaker ?: Any other, any subjects on cross-examination? Sure. So you say you know how to change a diaper, for instance. [01:32:48] Speaker 5: I do. [01:32:49] Speaker 7: I do. You're one of the best at changing diapers, according to you. [01:32:52] Speaker 5: I wouldn't say I'm one of the best, but I get the job done. [01:32:56] Speaker 7: You would not say you're one of the best at changing diapers? [01:32:58] Speaker 5: I mean, I get the job done. [01:33:01] Speaker 7: Have you ever testified differently? [01:33:04] Speaker 5: Can I, can I, could you refresh my memory, sir? Thank you. [01:33:08] Speaker 4: Your Honor, I'm only objecting because I'm not sure of the relevance of all this. I sustained that objection. Thank you, Your Honor. [01:33:17] Speaker 7: Well, let's make it strictly relevant, then. When you took your daughter out of the crib, you did not check her diaper, right? [01:33:25] Speaker 8: Objection, Your Honor. [01:33:26] Speaker 7: Sustained. You didn't even know whether she had a cloth or disposable diaper. I sustained that. [01:33:35] Speaker 3: Forward, no questions about the diaper. Can you add a sidebar, then, please? No, sir. That is an ironclad move, or cloth, or paper, I don't know. [01:33:44] Speaker 7: So, you watched some surveillance videos just now, right? [01:33:48] Speaker 5: I mean, I watched them, sir. [01:33:50] Speaker 7: It was hard for me to watch, but I watched them. It was hard for you to watch? That was your prime investigative videos, right? [01:33:56] Speaker 5: Because I say it's hard to watch, man, simply the fact that, like, seeing my wife act like this in front of all of the people, it's just insane to me. It really hurts my heart a lot, man. And for her to, like, act like that on the video, I don't want to have to be secretive or do anything, like, remotely like that. I just want to live my life, I just want to be the best father I can be, you know, and be the best player I can be, because that's what matters. Like, I'm in that span of my life, you know what I'm saying? [01:34:36] Speaker 7: I don't. You're a private investigator took those videos, right? [01:34:39] Speaker 5: My, yeah, yes, sir? [01:34:42] Speaker 7: You did not tell your wife that she was being recorded, right? [01:34:46] Speaker 5: Oh, no, I mean, I didn't tell them what to record. I didn't tell the private investigator to record at a certain time. I'm just saying, hey, brother. [01:34:53] Speaker 7: That was not my question. Let me be very clear. You did not tell your wife that a private investigator was recording the timeshare visits. Oh, I didn't. No, sir. Now, you know that your wife had to be at those timeshare visits, right? [01:35:11] Speaker 4: Your Honor, I'm going to object to what Mr. Hill may know. [01:35:18] Speaker 7: You know that your wife had to be at those timeshare visits, right? [01:35:23] Speaker 5: No, like I said earlier in my testimony when I was doing that rape, she fought us tooth and nail to be there. I didn't want her to be there. I even offered to get a nanny at the time. I was like, I will get a nanny. And obviously, we finally got a nanny. But I was like, I get a nanny. I have my mom. Like, I want to be able to build a, I want to be able to foster a relationship with our daughter on my own, you know? Like, if we're going to do this co-parenting thing, yeah, that's cool. I'm going to let you know when speech, when gymnastics, when it's women. But I want to be able to, you know, build that relationship with baby girl, create memories with her other side of the family. And she fought us tooth and nail herself to be there. Did I say I wanted her there? No, I didn't want her there. But like I said, I had to bite the bullet, you know what I'm saying, to be able to see my daughter. You know what I'm saying? I had to let by guns be by guns and say, you know what, bro? Whatever it takes to see our daughter. Because that's important. Granted, how I feel, you know what I'm saying? It's all about the little one. [01:36:38] Speaker 7: You done? [01:36:39] Speaker 5: Yes, sir. [01:36:40] Speaker 7: Great. There was a court order on the supervised timesharing, right? [01:36:46] Speaker 5: Yes, sir. [01:36:46] Speaker 7: Okay. And in that court order, which you've seen, she was court ordered to be at these timesharing, right? Because. Okay. That's just yes or no. She was court ordered to be there. [01:36:59] Speaker 8: Oh, excuse me. You're on our object. You can't restrict the witnesses. [01:37:02] Speaker 3: Okay, I agree. Not to restrict the witnesses, but otherwise the question is fine. [01:37:06] Speaker 7: She was court ordered to be at these supervised timesharing visits. That you were recording, right? [01:37:12] Speaker 5: She, she, like I said, I offered her in those court order things, a nanny. We was offering a nanny, my mom, and she was to the nail. [01:37:25] Speaker 7: She was court ordered to be there. You know that, right, sir? That's the answer. Is your testimony that she fought tooth and nail to be at those visits? [01:37:35] Speaker 4: Objective, and it's been asked to the nail. [01:37:37] Speaker 7: That's the answer. [01:37:38] Speaker 4: Three or four times. [01:37:38] Speaker 7: You're, you're aware that she wanted an independent professional to be at those visits, right? I wasn't aware of that. Sure. Was looking at her proposed parenting plan, refresher recollection? [01:37:54] Speaker 5: Yeah, uh, sure. I mean, I don't think I've never seen this document before, by the way. [01:38:00] Speaker ?: Read that. Don't read it out loud. [01:38:03] Speaker 5: Child care professional. Don't, don't, don't, don't read it out loud. [01:38:05] Speaker 3: Have you seen that document before? [01:38:06] Speaker 5: I've never seen that document. [01:38:07] Speaker 3: Okay, take the document back. [01:38:09] Speaker 5: Sorry, I've never seen that before, sir. [01:38:12] Speaker 3: It's not a matter. [01:38:17] Speaker 7: Respect, but it doesn't need to be in evidence to refresh. Thank you for sharing. You know that she was not fighting tooth and nail to be at those visits, right? Oh yeah, yeah, yeah. [01:38:30] Speaker 4: I'm just objecting to this question. [01:38:32] Speaker 7: Ask and answer. So, you set your wife up to be secretly videotaped during these visits, right? [01:38:43] Speaker 4: Objection. Ask and answer. [01:38:45] Speaker 7: Let's actually go to that March 28th surveillance video, please. While we're doing it, Mr. Hill, you test it by, you do finger exercises, you have strong hands. Yes, sir. [01:39:14] Speaker 4: You are only asking with regard to the film. It was showing that surveillance video. [01:39:45] Speaker 7: This one was just a marriage. [01:39:47] Speaker 4: Can we show that? No. Yeah. That's all right. [01:40:00] Speaker 3: I can't hear what you said, Miss. [01:40:02] Speaker ?: It is connected. [01:40:03] Speaker 3: I don't see her icon here for me to add into the screen. [01:40:10] Speaker 2: Should we connect with her? [01:40:13] Speaker 3: No, I don't see her icon here. [01:40:19] Speaker ?: Just at the same time, please. All right? No. Okay. Okay. Okay. Thank you. [01:40:55] Speaker 7: Thank you. There we go. Let's back up and try it again. Sorry for the inconvenience. So Mr. Hill, right here, this is a stroller that converts into a car seat? [01:42:03] Speaker 5: Yeah. Yes, sir. Sorry. [01:42:04] Speaker 7: Thank you. [01:42:05] Speaker 5: I mean, that's one of the things that's like, it's kind of confusing to do. You got to actually like, I actually want to ball one for a baby girl, like right after this so I can actually know how to maneuver it. You know what I'm saying? Because I was just trying to do it with just finger strength instead of just trying to like put my, like now I know I got to put my foot in front of it, press the button and then push it forward. I ain't know that in the beginning. [01:42:51] Speaker 7: Now you know, right? Oh yeah, now I know. She got out to help you then, right? What do you mean? What are you asking? He got out to help you then, right? [01:43:01] Speaker 5: I mean, can you play the video a little bit more so I can... *Squeak* [01:43:04] Speaker 6: *Squeak* Can you see your wife right there? [01:43:06] Speaker ?: *Squeak* *Squeak* *Squeak* She's so high. [01:43:10] Speaker 6: She's so high. She's so high. She's so high. [01:43:14] Speaker ?: She's very early. [01:43:15] Speaker 6: She's very early. She's a little bit so hard. Can you get a little bit more? *Squeak* [01:43:19] Speaker ?: *Squeak* *Squeak* [01:43:21] Speaker 6: What does she have with? [01:43:22] Speaker 7: She wasn't helping you get the stroller in the car seat? [01:43:32] Speaker 5: She might have got four hands or something. I didn't see her reach over and do nothing. *Squeak* Can you finish, please? Unless I can't see. I got blurred vision a little bit. You fellin' us? You fellin' us? [01:43:45] Speaker 7: So she also comes over to check if the car seat is in the right way, right? [01:44:00] Speaker 5: I mean, of course. It's good to have two set of eyes. [01:44:06] Speaker 7: Did you know how to make sure the car seat was secure on that date? Your Honor, what's the relevance? It's sustained. [01:44:13] Speaker 10: The relevance, Your Honor, is that it's going to be undirected. I can respond. I don't know if that's the same way. [01:44:19] Speaker 7: So, when you took your baby out of the crib on April 7th. Yes, sir. The reason you did that was to hurt your wife, right? [01:44:32] Speaker ?: No. [01:44:33] Speaker 5: No, no, no, sir. [01:44:34] Speaker ?: Not at all. You wanted to make her as upset as you felt. No, sir. You're on objection. You're on argumentative. Ask the phone. [01:44:42] Speaker 8: And ask an answer. Ask an answer. [01:44:44] Speaker 7: Ask an answer. Well, that same day, April 7th, you tried to sell that condo out from under your wife and the girl. [01:44:55] Speaker 5: That is not true. It didn't get listed on the market. Are you sure about that, that that's not true? [01:45:01] Speaker 7: It didn't get listed on the market, sir. [01:45:03] Speaker 5: Actually, Your Honor, are you in it? [01:45:05] Speaker 4: He's asked and answered the question. [01:45:07] Speaker 7: You have a company called 25105 Holdings? Yes, sir. [01:45:14] Speaker 1: I do. [01:45:15] Speaker 7: And you recall signing a listing agreement for that company, right? Whatever. [01:45:24] Speaker 4: I'm not really sure for real. Like I said, I really don't manage any of that stuff. [01:45:29] Speaker 3: Well, if you recall on April 7th, the same date of the nanny pen video, you signed a listing agreement for that condo. Your Honor, I'm just going to object. [01:45:38] Speaker 5: I'm not sure what he's attempting to refer to, but none of these exhibits have been in any [01:45:44] Speaker ?: of their exhibit lists. Okay. It's not that they're not being admitted. [01:45:46] Speaker 7: I'm refreshing my question. Okay. Okay. Let's go ahead there. Okay. [01:45:51] Speaker ?: Let's go ahead there. [01:45:51] Speaker 7: Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. [01:45:56] Speaker 4: Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. [01:46:05] Speaker 7: Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. [01:46:10] Speaker ?: Let's go ahead there. Let's go ahead there. Okay. Let's go ahead there. [01:46:14] Speaker 4: Let's go ahead there. [01:46:15] Speaker ?: Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Let's go ahead there. Oh, it's go ahead there. Let's go ahead there. Oh, it's go ahead there. Let's go ahead there. Oh, it's go ahead there. Oh, it's go ahead. [01:46:38] Speaker 7: Let's go ahead there. Let's go ahead there. Look at this document. Yes, sir. Don't read out loud from it. I'll actually read up here. And then, you can see right here. [01:46:49] Speaker ?: Okay. All right. [01:47:04] Speaker 5: All right. Yes, sir. [01:47:06] Speaker 7: Great. The condo that we've been talking about that April 7th happened, that's on Collins Avenue without getting the address? Correct. And so, your recollection is refreshed now that on the same date as the nanny can video, you signed a listing agreement for that condo, right? Yeah. [01:47:27] Speaker 5: Yes, sir, I do. [01:47:28] Speaker 7: Now, do you ever recall denying that you signed a listing agreement for that condo on April 7th? I mean, if you've got something to refresh me, that would be perfect. [01:47:45] Speaker ?: Sure do. So, this is the divorce deposition. I'm sorry. Temporary guarantee. [01:47:49] Speaker 7: Temporary. Temporary. [01:47:51] Speaker ?: Temporary. [01:47:52] Speaker 7: highlighted language, some highlighted language, page 43, line 23, page 44, line 7, just take a look at that, don't read out loud from it, so I don't have to read out loud? No, not read it out loud, just read it, and let me know if your recollection is regretful. [01:48:30] Speaker 5: Hold on, which one's again, sir? Just the highlights. Okay. Here to the next. Okay. [01:48:51] Speaker ?: Do you have a copy? I will show you a copy. [01:49:02] Speaker 10: Before I ask you a question, let me show you, okay? Okay. Okay. [01:49:13] Speaker ?: I will show you a copy. So, Mr. Hill, there was a hearing in the divorce case in July of last year, right? Correct. [01:49:41] Speaker 7: You testified on the road just like you're testifying here today. Yes, sir. And at that hearing, you were asked the following questions and gave the following answers. Right. Question, is the forged condominium where your wife and child are living and where you just stipulated today for the first time that she could have exclusive use and occupancy, is that condominium had you listed it for sale? Answer, no, sir, and I never have. Question, okay, did you have a listing, a realtor come over on April 8th, the day that she filed for divorce, to talk about listing that property? Answer, no, sorry. Right? Right. [01:50:33] Speaker 10: That was your testimony? That was my testimony. Your Honor, it is about 12:40 and a bit of a natural stopping point, so I don't know what time is if you haven't had quite a bit. [01:50:46] Speaker 3: Okay. Ladies and gentlemen, that's perfect for the lunchtime during the lunch and recess. Please don't discuss your testimony with anybody who are doing independent research and don't form it as basic conclusions. The time is now 12:40, so let's try to come back at 1:30. [01:51:03] Speaker 7: All right. Before the lunch break, Mr. Hill, we went over some questions you have been asked at previous proceedings, depositions and hearings and things like that. Yes, sir. Yes, sir. Did you review those things to prepare for your testimony today? I did not. These are extremely serious allegations that are being made against you. Do you agree with that? You just hit me with like two questions, I think. I'm confused on what you're trying to ask. These are extremely serious allegations that are being made against you in this case. Do you agree? Yes, sir, I agree. And you did not, well, strike that. This is not the first time here today and yesterday that you have been asked questions about these topics, right? What do you, what do you mean? You were asked about these topics in two different depositions, right? [01:51:56] Speaker 5: If you're including the divorce and this portion of it, yes, sir? That is what I'm referring to. Okay. I'm just making sure we're on the same page, sir. [01:52:08] Speaker 7: I want everyone to be on the same page. Thank you for that. And you did not review those depositions before you testified yesterday? No, I'm sorry, I did not. You did not review them before you testified today? What, sir? You describe yourself as a great communicator, right? [01:52:31] Speaker 5: Yes, sir. I would like to think so. [01:52:33] Speaker 7: Did you get media training as part of your NFL experience? [01:52:37] Speaker 5: No media training. [01:52:39] Speaker 7: None? [01:52:39] Speaker 5: None. You would, you would think that they'll give it to you, but none. [01:52:49] Speaker 7: So going back to some of your testimony about your NFL experience yesterday, do you remember giving that testimony? If you can refresh me, that'll be perfect. Sure. The only thing you can do, like in my sport, you got to control what you can control, and I try to add that same principle to my life. Do you remember testifying to that yesterday? I do, sir. So that control is important to you? [01:53:13] Speaker 5: As long as I'm controlling what I can control. [01:53:17] Speaker 7: You don't like feeling controlled, right? What do you mean? Do you like feeling controlled? [01:53:23] Speaker 5: I have no idea what that means. [01:53:26] Speaker 7: You've described yourself as someone who's going to test the limits, right? Depending on the situation. Well, if someone tells you, hey, Tyreek, don't go, don't walk out that door right now, you're going to test the limits, right? [01:53:43] Speaker 5: I will not test the limits. If the owner told me, don't walk out that door, you're going to tell you that I'm just going to get up and go? No, sir. [01:53:47] Speaker 7: Good qualification. If someone other than the judge told you don't walk out that door, you would still get up and walk out, right? I would not get up and walk out that door. Do you recall testifying differently to that position? [01:54:00] Speaker 5: I just say it depending on the circumstances, but if you can refresh me, that'd be great, sir. Thank you. [01:54:13] Speaker ?: Thank you. Thank you. Thank you. Thank you. [01:55:43] Speaker 7: Thank you. You're called now, testifying in a deposition that if you tell me, hey, Tyreek, don't go, if you say, hey, Tyreek, don't walk out that door right now, I'm going to test the limits. That's an example, right? Yeah, I did say that in a deposition. That's a way of saying it. If someone tells you not to do something, you're going to do it? [01:56:29] Speaker 5: It depends on the situation, like I said. [01:56:32] Speaker 7: Well, you testified yesterday that your family loved Keo, right? Correct. And they were happy for you when you told them that you two had gotten married, right? Right. And by your family, that specifically includes your grandparents who raised you? [01:56:46] Speaker 5: When I say family, I mean I'm close to all of my family, you know? I'm close to my grandparents, my mom, my aunties, my uncles, just everybody in my entirety of a circle. [01:56:59] Speaker 7: Well, my question is specifically about your grandparents being happy for you. Do you remember testifying to that yesterday? Oh, yeah, yeah, yes, sir. Now, do you recall testifying differently in a deposition? [01:57:13] Speaker 1: Uh, I may have misspoken, but if you can refresh me, that'd be great. Sure. Thank you for more. [01:57:29] Speaker ?: I'll start with one more, and go to one more. [01:57:40] Speaker 1: One more, and have what you say? [01:57:41] Speaker ?: Sure. Okay. [01:57:52] Speaker 2: I'm still a leader, sorry. Take your time. Yes, I'm good. I don't see nothing new here about that. [01:58:22] Speaker 1: I got follow you here for a little bit. [01:58:26] Speaker 7: Make sure we're on the same page. You were asked about whether your marriage went forward over the objections of your mom and dad, right? That basically said, basically, but everybody don't. Just, I just want to be clear on the question you were asked first, okay? That's what the deposition says, sir. Right. So the deposition question you were asked is, so, sir, sounds like you decided to go forward with the marriage kind of over the objections of your mom and dad, right? That was the question? [01:58:56] Speaker 5: Answer that one more time. I mean, I'm a slow processor, sorry. [01:59:02] Speaker 7: So, sir, it sounds like you decided to go forward with the marriage kind of over the objections of your mom and dad. And your answer was basically of everybody. Your friends, everybody. That was your testimony at deposition, right? [01:59:17] Speaker ?: Yes, sir. [01:59:18] Speaker 7: And you went on to testify in what, sorry. Why did you decide to marry Peter, then? [01:59:26] Speaker 5: Because I loved it. I feel like at the end of the day, like, my family supported me no matter what. You know what I'm saying? People can have opinions. Everybody has opinions. You know what I'm saying? But at the end of the day, it's up to me and wifey to figure it out, you know? [01:59:42] Speaker 7: At deposition, you were asked the same question. Why did you decide to marry her? You gave a different answer. Do you remember that? [01:59:47] Speaker 1: What was it? If you could refresh me, please, that'd be great. Thank you, sir. [02:00:10] Speaker ?: Where are we now? 84. It's the same passage. [02:00:16] Speaker 1: I don't know why I don't even have this part. I can read it. Yeah, perfect. [02:00:25] Speaker 7: In deposition, you were asked, okay, so why did you decide to marry her? And your answer was, I already answered you. I basically told you, like, if somebody tell me, don't do something, I'm going to do it. That was your answer in deposition. [02:00:40] Speaker ?: Right? Right, correct. All right. [02:00:46] Speaker 7: That you believe, and I think you testified already, that you believe in the marriage, the man's role was to lead, right? [02:00:52] Speaker 5: I mean, that's what, at least that's how I was raised and taught. [02:00:57] Speaker 7: You did not like it when you felt that keto was controlling you, right? [02:01:01] Speaker 5: No, she got her own life, she can do her own thing, you know, she got her own objectives. It's like, you know, I had my life before, she had her life too, you know, and whenever we would come together, you know, that's when we did our thing together. But obviously, if she wanted to lead, sometimes she'd lead, bruh. I want to let you know, like, in my grandparents' marriage, primarily, and yes, my dad says he's the leader, but at the end of the day, we all know who lead in that marriage, and that's my grandmother. She run that marriage, you know, and that's the same example, what I wanted, what wifey. [02:01:37] Speaker 7: You thought keto played mind games with you? [02:01:41] Speaker 5: So, if you can refresh me, I don't want to give you an answer. [02:01:50] Speaker 7: 183. [02:02:08] Speaker 5: Oh, you just pointed that from here to here. Okay. [02:02:28] Speaker 2: Okay. [02:02:33] Speaker 7: So, that position you were asked, the mind game was about the post-nup, your answer was no, this is just her way of, like, controlling the situation, you know what I'm saying, like, not being able to, like, have those kinds of conversations with me, you know what I'm saying, like I said, I wanted to be on the same page, I didn't want my divorce to end because of the post-nup agreement, marriage to end, I'm sorry, you misspoke there. That was your testimony to deposition, right? Yes, sir, it was. So, it frustrated you when you couldn't leave her, right? [02:03:07] Speaker 5: Like I said, I've been saying from day one, the post-nup agreement is just something, it's like a blueprint, it's like a contract or whatever you have in contract negotiation talks or whatever with a team, per se, let's just say, hey, Tyree, or my agent would go to that team and say, hey, we think he deserves this amount, and the team would come back and say, well, particularly, he's not performing the way he's performing, so we think he deserved that, this amount. That was all that was. What did you say your name was again? I'm sorry, I keep forgetting. Mr. Whaley. Mr. Whaley, so that's really all that was. There's no need for me to control the situation, because like I said, if I didn't want to be in that situation, I would have just evacuated, I would have got out of there quick, but my love for my wife, I wanted to see it work, I wanted us to work towards a common goal and then even work through through the agreement. I wanted us to work on that together, you know? Like she sent it to her attorney, she knew her thing, they sent it back. You finished? Maybe, yes. Sorry. Do you think this is [02:04:18] Speaker ?: funny? It's not funny. Sorry. Do you remember what my question was? No, sir, I don't. Let's try [02:04:24] Speaker 7: answering the questions. We don't need to be here any longer. It frustrated you when you couldn't control PETA, [02:04:34] Speaker 10: right? No, sir. I did not. So, I'm going to show you what's the marks on our exhibit list. [02:05:00] Speaker 7: Yes, sir. Let me know when you had a chance to redo it. Okay, done. Do you recognize Exhibit 32 as text messages between yourself and Nikita? Yes, sir. [02:05:46] Speaker 5: Sorry, I felt like I was trying to just take it. All right. [02:05:57] Speaker ?: Thank you. Thank you. Thank you. Got it? Yes, sir. [02:06:26] Speaker 7: You can hang on to that one. All right. [02:06:29] Speaker 3: Save some time. Okay. Bill, could you open the blinds for me? [02:06:38] Speaker 7: Can I have a seat here? Please. So, you were asked about this text message exchange and deposition, right? Right, yes, sir. And your response was, sounds very controlling, trying to control the situation, right? [02:06:54] Speaker 5: Yes, sir. As far as my response in the deposition, right? Yes. [02:06:58] Speaker 7: Say that again? Your response in the deposition, on page 237, right in front of you, was, sounds very controlling, trying to control the situation. Right, yep. You did not like when she stood up for herself. [02:07:10] Speaker 5: I mean, I get it right to respond back, though, right? [02:07:13] Speaker 7: I didn't say you didn't, but you didn't like when she stood up for herself. [02:07:17] Speaker 5: All right, she can stand up for herself all day. I never said nothing what was wrong with that, sir. [02:07:22] Speaker 7: You said it sounds very controlling, right? [02:07:25] Speaker 5: That was my honest opinion in the deposition. [02:07:27] Speaker 7: I'm not saying it's not your honest opinion. You felt that it was controlling. That's not a positive feeling, right? Something that's controlling. [02:07:35] Speaker 5: I wouldn't necessarily say that, though. I just feel like you're just trying to create a narrative now, and it's not there. [02:07:42] Speaker 7: I'm just asking you questions, Mr. Hill. Yes, sir. You testified yesterday about this argument on November 24th, 2024. Do you remember Ms. Bright asking questions about that day? Yes, sir, I do. This was an argument about what your wife was wearing in the house? [02:08:05] Speaker 5: I would say that was part of it. It was part of the argument, but obviously, you know, the deposition was a long time ago, so if you can refresh me, that'd be perfect. [02:08:17] Speaker 7: Let's be clear. I'm not asking about your deposition a long time ago, the April deposition for this year. I'm asking about your testimony from yesterday afternoon. Yes, sir. So in your testimony yesterday afternoon, you were asked, do you recall any arguments or disputes that took place that morning, being November 24th? Yes, sir. Your answer was just typical husband-wife argument, like one of those situations where Keaton was barely wearing clothes in the house, and my granddad was there. I'm like, hey, can you put on some clothes because my granddad is there, flung your booty around in front of my pops. I mean, you've got to have kind of respect for that, I think. That was kind of the argument, and she was like, and then you raised your voice and said, [02:08:56] Speaker 8: hey, this is my house, and all right, bro. [02:08:59] Speaker 7: Do you remember that question and answer? Was that deposition? No, that was yesterday afternoon. Oh, yeah. So you mocked her voice yesterday afternoon. Do you remember that? [02:09:11] Speaker 8: Objection, you're on an argument again. Sustain. [02:09:16] Speaker 7: That argument you testified yesterday was about what she was wearing in the home, right? [02:09:21] Speaker 5: I mean, like I say, like, it was about probably what she was wearing around my parents, because I felt like that was disrespectful, and then also the fact that of her, like, getting ready, too, though. Like, being late to the game. [02:09:38] Speaker 7: You felt like she was being disrespectful. [02:09:42] Speaker 5: I mean, if somebody's, if your wife is walking around the house, barely wearing any clothes in front of your family, where I'm from, that's kind of disrespectful. My wife can wear whatever she wants in my house. [02:09:54] Speaker 7: Our house. So you testified yesterday, the first time you saw Keita was at Club Live. Yes, sir. You flashed your grill at her. [02:10:08] Speaker 5: I mean, it was Ann, so she had to see it. [02:10:11] Speaker 7: Well, you testified yesterday, I flashed my grill at her, right? Yes, sir. And what did you say to her? [02:10:17] Speaker 5: I didn't want to say nothing much to her. Just showed her my phone. [02:10:21] Speaker 7: Yesterday, you said, you said, I gotcha, right? [02:10:26] Speaker 5: That was like in a, in like a, in your head space. [02:10:29] Speaker 7: You know how you talk to yourself and you be like, I gotcha. That's fair. That was not clear. So in your head, you thought, I gotcha. Yes, sir. You testified today about taking your daughter to Disney. Do you remember that testimony? [02:10:43] Speaker ?: I do. [02:10:44] Speaker 7: Okay, okay. Now, this is not the first time you testified about this experience with the Bright Line and your wife, right? [02:11:01] Speaker 5: Actually, the second time, I believe. [02:11:03] Speaker 7: The first time was at your deposition in the divorce case. Do you remember that? [02:11:10] Speaker 5: I don't. I just remember talking about it in court, I think. [02:11:14] Speaker 7: That's, that's fair. Let me. [02:11:23] Speaker 2: Okay. [02:11:37] Speaker 7: While we're looking for that, your testimony today was very clear that you told Kida where you were bringing your daughter, right? [02:11:48] Speaker 5: I mean, I told Kida that, and I don't want to miss, miss, miss, misspeak about anything, you know? I don't want to, yeah, I'm not even going to misspeak. If you could refresh me, that'd be perfect. [02:12:03] Speaker 7: I'm just asking, would you testify about, I don't have a record. What we did this morning. I'm just asking if you remember testifying this morning. You said very clearly that you told your wife that you were taking your daughter to Disney, right? I don't even want to put that on the record, sir. [02:12:17] Speaker 5: I just don't want to get like a blurry line about anything. [02:12:21] Speaker 7: I don't want to have blurry lines about anything either, Mr. Hill. Yes, sir. So, let's try to take this in order. You were asked about this Bright Line issue and a deposition in the divorce case a little more than a year ago. Do you remember that? [02:12:37] Speaker 1: Could you refresh me, please? Yes. Thank you. [02:12:42] Speaker 7: Is it worse that position? [02:12:56] Speaker ?: I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do that. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:13:51] Speaker 7: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm going to be able to do it. [02:14:00] Speaker ?: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:14:04] Speaker 7: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:14:18] Speaker 5: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:14:22] Speaker ?: I'm not going to be able to do it. [02:14:23] Speaker 7: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to do it. I'm not going to be able to do it. [02:14:28] Speaker ?: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:14:35] Speaker 7: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:14:38] Speaker ?: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:14:44] Speaker 7: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:14:49] Speaker 5: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:15:10] Speaker ?: I'm not going to be able to do it. I'm not going to be able to do it. [02:15:12] Speaker 5: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:15:20] Speaker 7: I'm not going to be able to do it. I'm not going to be able to do it. [02:15:22] Speaker 4: I'm not going to be able to do it. I'm not going to be able to do it. I'm not going to be able to do it. [02:15:25] Speaker ?: I'm not going to be able to do it. [02:15:26] Speaker 4: I'm not going to be able to do it. I'm not going to be able to do it. [02:15:28] Speaker 7: I'm not going to be able to do it. Perfect. Yes. So you can understand why your wife would be alarmed that the baby tracker showed the baby getting on the bright line in Orlando if all you told her was I'm taking her to lunch, right? [02:15:42] Speaker 4: I object, Your Honor. Call for speculation. [02:15:44] Speaker 7: Testify about the tracker, correct? [02:15:46] Speaker 4: No. [02:15:47] Speaker 7: The question is not speculation. Sorry. I know we've thrown around a lot of dates. This was in May of 2025, the bright line. I have no idea what year it is, sir. Can you just check back on the deposition? Page 95 of the divorce deposition. You have it in front of you. Oh, I got it. I have it for you. I have it. Page 95. You were asked, on May 30th, do you recall telling Peta that you were coming over and taking the baby to lunch? Do you remember that? This is the day of the bright line incident. Your answer was, oh, sure, yeah. Yeah, sure. Sorry. You got to refresh me. Thank you. I appreciate that. Thank you. Right? She was six months old, seven months old, something like that. [02:16:46] Speaker ?: Correct. [02:16:46] Speaker 7: You heard Peta testify about a January 21st incident at a hotel in Orlando. Yes, sir. I did. Originally, when you were questioned about this, you claimed not to remember that incident. Do you remember that? Uh... [02:17:06] Speaker ?: I don't. [02:17:07] Speaker 5: Okay. You go to the April deposition? Yes. Well, here. [02:17:11] Speaker ?: There's one that says April 2026 on the front. Can I see it right here? Yes, sir. Can I see it right here? Yes, sir. Can I see it right here? Yes, sir. Can I see it right here? Yes, sir. Can I see it right here? Yes, sir. Can I see it right here? Yes, sir. Can I see it right here? Yes, sir. Can I see it right here? 151. Halfway down the page it says that morning at the Orlando Hotel. Yes, sir. Can I see it right here? Can I see it right here? [02:17:30] Speaker 7: Yes, sir. Can I see it right here? Can I see it right here? [02:17:33] Speaker ?: Yes, sir. Can I see it right here? [02:17:35] Speaker 1: Yes, sir. Can I see it right here? Yes, sir. Can I see it right here? Yes, sir. [02:17:40] Speaker ?: Can I see it right here? 151. [02:17:42] Speaker 7: Halfway down the page it says that morning at the Orlando Hotel. What does it say? That morning at the Orlando Hotel. [02:18:07] Speaker 5: Okay, I see it. It's halfway. Okay, got it. [02:18:11] Speaker 7: So, at that deposition you were asked that morning at the Orlando Hotel. Did you ask her to sign the post-nuptial agreement again? Answer. I mean, you had conversations about it. Question. Do you remember that morning? Answer. I don't remember that morning. But I would remember us always having like that would like the totality of our marital issues right there was that agreement right there in whole. And we would always argue about it. We would always have like conversations about it. That was your testimony in your deposition? Yes, sir. Okay, you can set that down. You had two friends with you at the Orlando Hotel? Yes, sir. I had two of my friends there. It's Julius and Swerve. Yes, sir. And what did they do? Didn't they do something for your company? [02:19:00] Speaker 5: No, they didn't. [02:19:01] Speaker 7: They didn't do nothing for my company. These are just friends of yours? They're just friends of mine. You say in front of your friends that Keita needed an UEL? [02:19:08] Speaker 5: I would never disrespect my wife like that in front of my friends. And plus, I have good enough friends that if I would remotely say something like that, they would instantly whoop my butt. So I have good enough friends that would hold me to a standard and hold me a combo too. [02:19:25] Speaker 7: So you never said that Keita needed an EBL or called her a bony ass in front of your friends? [02:19:32] Speaker 5: Not in front of my friends. Did you do that in private? [02:19:34] Speaker 7: In private? Yeah. Did you do it in private? [02:19:37] Speaker ?: Yeah. [02:19:38] Speaker 7: Did you do it in private in Orlando that day? That day? Oh. [02:19:46] Speaker ?: I... [02:19:47] Speaker 7: Hmm. On January 20th or 21st, did you call Keita a bony ass who needed a EBL in private? [02:19:57] Speaker 1: In private, yeah. [02:19:59] Speaker 7: Now she said, and you heard her testimony, that you grabbed her by the breasts during this argument, right? Yeah. That's her testimony. That's her testimony. I know you don't agree with it, but that's what she said. Fair. Now, she also said you tried to take the ring off her finger. You heard that testimony? Yes, sir. I heard that. Now there was an argument about the ring. Do you admit that? [02:20:20] Speaker 1: An argument about the ring? [02:20:21] Speaker 7: Yes. [02:20:22] Speaker 1: Uh, did I say that in my deposition? [02:20:25] Speaker 7: You sure did. Page 158. Page 158. [02:20:28] Speaker ?: All the way at the bottom of the page, the last question. Okay. I think I'm in a wrong move. April 24th. April 24th. Okay. Okay. [02:20:48] Speaker 7: Okay. Okay. [02:20:50] Speaker ?: Okay. [02:20:50] Speaker 7: Okay. Okay. [02:20:52] Speaker ?: So, you remember now. [02:20:53] Speaker 7: Ok. I think I'm in the wrong blue. April 24th. Ok. Ok. So you remember now, telling the police that there was an argument about the ring, right? Yes, sir. And during that argument, according to what you told the police, you wanted that ring back. I object, Your Honor, [02:21:42] Speaker 4: he's misstating what's the deposition statement saying. Overruled. You told the police, you [02:21:53] Speaker 7: know, I'll read the full question and answer. Telling the officer what was the argument about the ring. Answer. I mean, I just felt like, man, if we're gonna get a divorce, we might just like hand the ring back. You go your way, I go my way, and we just call it even. I mean, I thought that was the ethical thing to do. That was your answer, right? Yes, sir, that was my answer. And you testified yesterday, afternoon, in response to a direct question from your lawyer that your wife never told you before the divorce that you harmed her in Orlando. Do you [02:22:32] Speaker 5: remember that question? I don't know. It sounds like you're trying to, like, twist the words about [02:22:39] Speaker 7: me a little bit, Mr. Wally. I'm not trying to twist anything. Let's read the words. The question you were asked yesterday is, following that Orlando trip, did Kia ever inform you in any way that you had physically harmed her? That is the exact question you were asked by your lawyer yesterday. Do you remember it now? A little bit. Your answer was, no, ma'am. Do you remember saying that? Okay. I'm following you now. Yes, sir. Yes, that was your answer. Do you remember saying that? Yeah, yeah, that was my answer. She also asked you, did you all ever discuss it, discuss any injuries to her, and your answer was, no, ma'am. Do you remember saying that? Yes, yes, sir. Okay. She also asked you, did she, in Keita, send you any text messages or any communications about it? Your answer was, no, ma'am. Right? Correct, yes, sir. Now, none of that is true, right? I have no idea. Like, like I said, like, [02:23:41] Speaker 5: he never accused me of any of this, like, through text, like, battering her, like, slamming her against the wall, or hitting her, like, whatever the case may be. So that's what I mean, sir. [02:23:55] Speaker 7: Can I get exhibit 11, please? Mr. Hill, you've been present for the entire trial, right? Yes, sir. Yes, sir. Okay, yes. [02:24:04] Speaker 9: He did not say that he didn't know anything. Okay. What's the next question? [02:24:07] Speaker 7: So on January 21st, 2024, people call out the bottom blue. January 21st, 2024, this is Keita's text message, text message to you, where was the love when you were trying to rip off my tis? Where was the love when you were disrespecting me in front of your people, telling me I need a damn BDL, I'm good exactly how I am? You remember receiving that message, right? Yes, sir, I do. You responded to it that day. I don't got a paper I needed. Call out the next one, please. You responded to it that day? [02:24:56] Speaker 1: Oh, yes, I did. [02:24:59] Speaker 7: So she's saying that you disrespected her in front of your people, were there other people there besides Julius and Swerve? [02:25:06] Speaker 5: Yeah, like I said, my friends didn't have a lot of that. Like, I wouldn't do such a thing. [02:25:12] Speaker 7: Well, when you wrote back to her, you didn't say, "I wouldn't do such a thing." You wrote, "Baby, you know how I am during our intercourse. I'm sorry, BDL, baby. You don't need to know I married you. Nobody else I trusted you to wife out of everyone because I love you." That's your response that day, right? Yes, sir. That is my response. [02:25:30] Speaker 5: And if you would, I mean, it's an honor. I mean, if the judge would allow it, I don't mind explaining any of it. [02:25:37] Speaker 10: That's what you said that day, right? That's all I'm asking. [02:25:40] Speaker 7: Yeah. Okay. So, babe, you know how I am during our intercourse. What you're suggesting there is the rip-off her titties with something that happened while you two were having intercourse? [02:25:54] Speaker 5: Yes, sir. And like I said, I don't mind explaining it to you guys. But I would, obviously, if you tell me to explain it, I would like the cameras to be cut off. I'm asking for permission for our daughters in the future, Andy, and also with respect of... Mr. Bell, there's no question there. All right. [02:26:11] Speaker 7: Yesterday, your lawyer asked you a question with the camera on. Right. About whether you ever twisted your wife's breasts. Do you remember that? Yeah. Yeah. And you said, "No." Correct. Okay. Can we go to the next page, please? Call up the first two text messages. She then writes to you, "It wasn't during sex first off." Do you see that? Yes, sir, I do. And in your response, you don't say, "Yes, it was," right? Oh. [02:26:47] Speaker 5: Of course not. You guys had a question? [02:26:49] Speaker 1: Yeah. [02:26:50] Speaker 5: Sorry. [02:26:51] Speaker ?: I mean, of course not. [02:26:52] Speaker 5: I mean, I'm not trying to argue with, you know, my wife. I'm trying to avoid. You know, I'm not trying to sit up here and just be arguing through a text message. Because at that point, it's called, I believe it's called, like, lingering. Like, I'm not trying to do all that with her. So why would I continue to argue through a text message? [02:27:11] Speaker 7: She's accusing you of something pretty awful, right? [02:27:14] Speaker 3: Right? So, you've got your answer to the sentence. So... [02:27:44] Speaker ?: Thank you. [02:28:14] Speaker 7: There was a different set of text messages. Well, let me put it this way. You had an 816 phone number at this time in January 2024? [02:28:23] Speaker ?: Yes, sir. [02:28:25] Speaker 7: You had more than one phone number? I only got one phone now. At this time, January 20th? Oh, yes, sir. And you texted with Kida on January 21st, 2024 on the 816 phone number. Do you remember that? Yes, sir. I do. I can approach. [02:28:44] Speaker 3: On what, sir? Yes, sir. This was, this is the name of Kida. Wait, what's the exhibit? It was listed. It was listed. It was listed. Yeah, two days ago, two days ago, in the middle of the trial. Mm-hmm. Okay, come to sign the letter. [02:29:29] Speaker ?: Thank you. [02:29:29] Speaker 3: Thank you. [02:29:30] Speaker ?: Thank you. [02:29:34] Speaker 3: Yes, sir. Yes, sir. [02:29:36] Speaker ?: So, if you recall, having a separate text message exchange from Kida on January 21st, 2024? I don't, sir. I don't, sorry. I don't. Sorry about that. You don't remember it having a review exchange? Yeah, I have a review on this, yes. So, you do remember it? [02:29:54] Speaker 7: Well, it was a while ago, but I have to look at this. [02:29:55] Speaker ?: I'm just, I'm objecting. What is he talking about reviewing? [02:29:55] Speaker 7: Is it what you stopped saying that objective on already? [02:29:56] Speaker ?: Exactly. [02:29:57] Speaker 7: So, it was a while ago, but I have to look at this. Is that what you said documents or where it was text messages? That's what you remember. I have to look at this. I'm objecting. What is he talking about reviewing? [02:30:04] Speaker 1: Is it what you stopped saying that objective on already? Is that what you sent documents or where it was text messages? [02:30:06] Speaker 7: That's what you remember. I'm just asking if you remember this. I'm just asking if you remember this. I'm just asking if you remember this. I'm just asking if you remember this. I'm just asking if you remember this. [02:30:12] Speaker ?: I'm just asking if you remember this. [02:30:13] Speaker 5: I'm just asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. [02:30:17] Speaker 4: I'm asking if you remember this. [02:30:18] Speaker ?: I'm asking if you remember this. I'm asking if you remember this. [02:30:20] Speaker 4: I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. [02:30:23] Speaker 3: I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. [02:30:29] Speaker 4: I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. [02:30:32] Speaker 3: I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. [02:30:39] Speaker ?: I'm asking if you remember this. [02:30:40] Speaker 7: I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. [02:31:05] Speaker 8: I'm asking if you remember this. I'm asking if you remember this. I'm asking if you remember this. [02:31:08] Speaker 7: I'm asking if you remember this. [02:31:10] Speaker ?: I'm asking if you remember this. [02:31:11] Speaker 7: She said I'm getting abused physically and mentally every day. Do you remember her saying that to you in a text message? [02:31:25] Speaker 1: I don't. You have to show it to me, sir. You have to put it up on the exhibit. [02:31:31] Speaker 8: I've checked the handle on it. It's the same document? [02:31:34] Speaker 3: Yes. Let's move on from this document. [02:31:36] Speaker 7: You remember testimony yesterday about a phone call on May 15th? May 15th? [02:31:56] Speaker ?: Yeah. [02:31:57] Speaker 1: Yes, sir. [02:31:58] Speaker 7: I remember that day. And you were calling on May 15th? [02:32:00] Speaker ?: May 15th? Yeah. [02:32:02] Speaker 1: Yes, sir. I remember that day. [02:32:04] Speaker 7: And you were calling your testimony that you told Keita's mother that Keita needed to leave the car before she gets hurt, right? Yes, sir. And you testified yesterday that you made a statement during this call about being able to get people to hurt her, right? Yes, sir. I did make that statement. You testified that those people were your real mom and sister. They wanted to do things to her. That was your testimony yesterday? Yes, sir. No. [02:32:34] Speaker ?: No. [02:32:35] Speaker 7: During that call, you used the word "friends," right? What do you mean? During that call, you didn't say, "I can get people to hurt her." You said, "I can get friends to hurt her." Do you remember that? I don't. I don't remember that. I can have a sidebar. [02:32:54] Speaker ?: I can have a sidebar. [02:32:54] Speaker 7: Okay. Yeah. [02:32:56] Speaker 3: Yes. Yes. [02:32:58] Speaker ?: You testified yesterday during this phone call on 8-15th. You told Keita's mother to tell her to get out before she gets hurt, right? [02:32:59] Speaker 7: You testified yesterday during this phone call on 8:15. You told Pia's mother to tell her to get out before she gets hurt, right? Sorry about that. Yes, sir. Is that de-escalation? No, sir. You testified yesterday that you would do anything to protect her from being your wife, right? Yes, sir. And that was in reference to your mom and your sister wanting to do something to her, right? Of course. Who did she need protection from, Mr. Hill? [02:33:59] Speaker 1: No one. She doesn't need protection from anyone. [02:34:05] Speaker 7: Do you remember Ms. Bright asking you yesterday if you smoke? Yes, sir. Do you remember answering no, ma'am? [02:34:12] Speaker 5: To be. Yes, sir. I'm going to let you finish your point. Go ahead. That was my point. [02:34:17] Speaker 7: That was my point. [02:34:18] Speaker 5: Oh. [02:34:19] Speaker 7: Your lawyer asked you if you smoke, you said no, ma'am, right? Yes, yes, sir. Now, you were asked questions about this January 30th incident in '80. Do you remember those questions? Yes, sir. Do you remember your wife's testimony? She testified that you smashed a blunt in her face, right? Yes, sir. That's what she told the police that day. Right. The police questioned you that day too, right? Yes, sir. And you told them that there was a cigar, right? [02:34:46] Speaker 5: Cigar, yes. [02:34:49] Speaker 7: And you told the police that you did pick it up, right? [02:34:53] Speaker 5: I don't recall telling anyone that, but if you could pass the police report so I can read it, that'd be perfect, Mr. Wally. [02:35:23] Speaker ?: Yes, sir. Thank you. Thank you. Thank you. Okay. Against that paragraph? Yes, sir. That's all I'm asking you about. [02:35:58] Speaker 7: Do you remember now we told the police that day? [02:36:15] Speaker 1: Yeah. Yes, sir. [02:36:17] Speaker 7: Sorry. You don't have to apologize. You told the police that day that you flicked a cigar towards her, right? Right. So you were holding a cigar and you flicked it at her. [02:36:30] Speaker 5: No, let's not put that image out there, please. How I explained it yesterday, I try to bring fun into every atmosphere that I'm in. I'm always trying to have fun. Because like I said, I'm not trying to argue with my wife, you know? Like I said, she was sitting beside the trash can and I seen the trash can and, at least specific, it was a cigar. And I just flicked the cigar, you know, towards the trash can, not intended for my wife. [02:37:01] Speaker 7: Okay, well, let's unpack that. So, you told the police that you started arguing about the post-nuff, right? You just saw that. Correct. And you flicked the cigar after the argument, right? Or during the argument. Correct. You thought it would be fun to flick a cigar at or towards your wife during the argument? [02:37:22] Speaker 5: Like, all of the arguments you're thinking of in your head, like, it's simply, I can see what you're picturing. You're picturing April 7th argument, but all of our arguments weren't like that. Like, we had controlled conversations, you know what I'm saying? Like, and I just feel like you're just trying to paint a picture that's not there, Mr. Wally. [02:37:50] Speaker 7: This is not about what's in my head, it's about what you said and what you did. [02:37:53] Speaker 8: Objection on our argumentative. [02:37:55] Speaker 3: I sustained the objection, Mr. Wally. Please don't respond, please. Excuse me. All right. [02:38:07] Speaker 7: There was someone else there when you flicked the cigar, right? [02:38:10] Speaker 1: cigar right? Right? I don't think no one was there. Was one of your kids was there? I'm thinking. I'll read. Give me a second. There's so much going on. I can't remember. Would you refresh your recollection of what is your deposition? Yes sir. Please. You can go now. You know? What? [02:38:40] Speaker 7: All right. Yes sir. You remember now your son was there. All right. Yes sir. And it's your testimony yesterday that you did not flick it at her. Yes. Those are my words and I'm going to stand on that. You agree a man should not push his wife out of a car, right? [02:39:19] Speaker 5: A man shouldn't put his hands on a woman at all. [02:39:22] Speaker 7: Even if there aren't any, right? Nope, no sir. Ever. Ever. Now, you were asked some questions by your lawyer yesterday about the May 1st incident. Do you remember those questions? This is after the Netflix party. [02:39:34] Speaker 1: Yes, sir. [02:39:35] Speaker 7: I remember. I remember. In your testimony, there was an argument in the car about you looking at someone, whether you looked at someone for too long, right? Yes, sir. And you testified, I think earlier, you described PETA as an emotional beating that was specifically in the context of this argument. Do you remember that testimony? I don't remember that. Page 219 of your April deposition. [02:40:07] Speaker ?: All right. Judge, this question asked and answered. I'm going to choose a emotional failure. It's going to be my doctor. Did my question? Did it? [02:40:20] Speaker 7: This is about in the context of this incident. I asked generally earlier. What page again? 219, 219. Second full paragraph. [02:40:36] Speaker 5: I'm going to school that minute. I don't know. I forgot what paragraphs are. Can you come point it out for me? [02:40:44] Speaker ?: Sure. Thank you. Thank you. The first paragraph is the same. Okay. [02:41:13] Speaker 7: So that statement about the emotional being, that was during this May 1st arline, right? Yes, sir. May 1st, she was pregnant, right? Yes, sir. And you're not denying that she took a lift home that night? I'm not denying it. Do you recall giving a different answer in your deposition? [02:41:36] Speaker ?: I mean, I let her out. [02:41:38] Speaker 7: That's not my question. Do you recall giving a different answer to that question in your deposition? [02:41:43] Speaker 5: I don't recall. [02:41:44] Speaker ?: I don't recall. [02:42:13] Speaker 10: Thank you. [02:42:43] Speaker 2: All right. [02:42:52] Speaker 7: When you were asked at your deposition, you're not denying she ended up having to take a lift home. Your answer was, I don't got nothing to do with that boss, right? [02:43:04] Speaker 4: Your Honor, I object. This is not what he did. [02:43:09] Speaker 9: He already agreed to it. [02:43:13] Speaker 7: That was your testimony in deposition? [02:43:17] Speaker 1: Yes, sir, it was. [02:43:21] Speaker 7: So when you were asked about the lift in deposition, you did not say, I waited for Honor on the side of the road, right? [02:43:28] Speaker 5: I mean, I didn't think I needed this. In a deposition, I didn't know what was going on for real. That was my first time, and I'm just answering questions, for real. [02:43:40] Speaker 7: You didn't think it was important to say that you waited for her until the car came? I mean... Let's talk about the prenuptial and postnuptial agreements for a minute. Okay. You read, before the marriage, Keita was completely on board with signing a prenup. [02:44:01] Speaker 1: Oh, yes, sir. [02:44:03] Speaker 7: You asked her to do it before the wedding, and she was down, right? Yes, sir. Page 110, oh, I'm sorry. She was down to sign a postnup, too, right? Yep. You were called testifying she was all for it, right? Yes, sir. And you only had the prenup that we've heard about, the written one, you only had that drawn up because she said she would sign it, right? This is before... I'm sorry, postnup. Thank you. Let me back up and ask the right question. Okay. You only had the postnup drawn up because Keita said that she would sign one, right? [02:44:39] Speaker 1: I mean, we had those discussions together, so... [02:44:47] Speaker 5: I'm trying to think. Yeah, we had those discussions regularly, you know? Although I believed in something else. Like I said, man, I grew up watching my grandparents in love for 50 years without a postnup, you know? And I wanted my marriage to be like that, but unfortunately, I can't live my life like that, you know? I got to take everything that I learned for the kiddos. And so, we've had discussions about that. [02:45:16] Speaker 7: My question was, you only had the postnup drawn up because she told you that she was going to sign it, right? That's kind of a confusing question a little bit. Okay. You recall answering that question in deposition differently than you just did today? [02:45:33] Speaker 1: Could you refresh me, please? [02:45:35] Speaker 7: Sure. Thank you. Okay, page 114 of the April deposition. All right. [02:45:40] Speaker ?: All right. [02:45:58] Speaker 7: Starting with the second to last question. Okay. And going on to the second line of page 115. And let me know what you're done. Thank you. [02:46:07] Speaker ?: Thank you. Got it. [02:46:32] Speaker 7: Do you recall what you testified to at your deposition? Yes, sir. And that was, you know, had it drawn up because she said she was going to sign it, right? I mean, we had agreed to it. I'm not asking what you agreed to. I'm asking what you testified at your deposition that you had it drawn up because she said she would sign it, right? [02:46:52] Speaker 5: I mean, I feel like I just gave you my answer, Mr. Wally. That's what we agreed to. [02:46:57] Speaker 7: I'm not asking what you agreed to. I'm asking what you said at your deposition. You testified. Why would I have this all drawn up if she wasn't going to sign? Bottom of page 114 on top of page 115. Question was, so she was going to sign it, answer. I mean, why would I have all this drawn up if she wasn't going to sign? Question. She was going to sign it, answer. I wouldn't have went this far. That was your testimony at deposition? Yes, sir, it was. You mentioned you see this like a contract negotiation, right? [02:47:37] Speaker 5: As far as, like, they agreed, man, but not their relationship. [02:47:41] Speaker 7: That's completely fair, right? A post-nuptial agreement is a type of contract, but very different between husband and wife as the player and team, right? And you know, marriage back in the day, it was a business. [02:47:54] Speaker ?: I don't know. [02:47:59] Speaker 7: You read this, the $1 damages provision when it was written. [02:48:08] Speaker 8: Object, Your Honor. [02:48:14] Speaker 7: Your Honor, there's testimony undirected about this. Your Honor, this was not. [02:48:23] Speaker ?: Can we approach, Your Honor? Yes, please. Thank you. [02:48:29] Speaker 7: You were aware, Mr. Hill, of this $1 provision in the post-nope? [02:48:57] Speaker 5: I really wasn't aware of it until my wife who brought it to my attention. [02:49:05] Speaker 7: So you were aware of it then? [02:49:08] Speaker 5: Yes, sir. [02:49:11] Speaker 7: So you read that provision at some point? [02:49:13] Speaker 5: No, I did not. The subject is drawn out by my attorneys. [02:49:17] Speaker 7: But you talked about that $1 provision with your wife, right? [02:49:21] Speaker 5: I didn't specifically talk about it with her. [02:49:25] Speaker 7: Have you ever testified differently? [02:49:26] Speaker 1: I don't know, but if you can refresh me, that'll be great. [02:49:34] Speaker ?: Page 118 of the April 4th deposition. All right. [02:49:42] Speaker 7: Page 118. [02:49:51] Speaker ?: Sorry. All right. Yeah. [02:49:54] Speaker 7: Give me one second. [02:50:23] Speaker ?: I'm going to ask you to discuss this specific provision with your wife, the $1 provision. [02:50:37] Speaker 7: Yeah, that was after the fact that she brought it to my attention, sir. And it hurt you that she wouldn't sign that agreement, right? [02:51:00] Speaker 5: Why would that hurt me? [02:51:03] Speaker 7: Is it your testimony that it did not hurt you? [02:51:07] Speaker 5: I would say that it hurt that she didn't sign the agreement overall. Like, we didn't... We didn't... It hurt that we didn't reach an agreement. Not that it hurt me that she didn't sign it for a dollar. [02:51:23] Speaker 7: So that post-nuptial agreement that you had, you agree you had many arguments over that, right? Yes, sir. And that agreement was the totality of your marital issues, right? Yeah, unfortunately. Yesterday, do you remember your attorney asking you some questions and you giving some testimony about your wife stealing from you? Yes, sir. You used that word a few times, I think, today, too, right? Yes, sir. She never had access to your accounts, right? [02:51:55] Speaker 5: She had access to the FC card. [02:51:59] Speaker 7: That's the family card? Yes, sir. Her name was not on that account, right? No, sir. She just had a debit card? Yes, sir. She was allowed to use that card, I think you said, for things around the house and groceries? Yes, sir. And you had discussed limits on the use of that card? [02:52:16] Speaker 5: I didn't discuss limits. It just came with a limit, you know what I'm saying? Set up by my financial advisor, you know? Because we try to stay under our budget, you know what I'm saying, each and every month. Wife, she gets her money every month. And there was a family card designated with a budget on it. And obviously, you know, I had my budget per month. [02:52:40] Speaker 7: When you say a family card, how many other people had a card that went to that family account? [02:52:47] Speaker 5: Just Keita had the card. [02:52:49] Speaker 7: Just Keita? Yeah, she's the only person that had the card. And this is a debit account, right? Yes, sir. So she can't spend more money than is in the account, right? Yeah, correct. [02:52:58] Speaker 1: Okay. [02:53:02] Speaker 7: This is not the first time you've testified about the use of that debit card, right? [02:53:09] Speaker 1: Correct. [02:53:10] Speaker 7: You monitored her spending, right? [02:53:12] Speaker 5: I didn't monitor it. I didn't monitor it. Like I just said, like my financial team, they put a budget inside of the family card situation. I didn't monitor it. [02:53:23] Speaker 7: Have you ever testified differently? [02:53:26] Speaker ?: I don't remember. Sure. [02:53:28] Speaker 7: You can go to page 108 of your April deposition. [02:53:31] Speaker 5: Same book, right? Yes. All right. [02:53:42] Speaker 7: 108? That's right. Right at the top. All right. You were asked, did you monitor her spending? And you answered, I mean, after she hit that budget, yeah. That was your testimony of deposition? Right. And you did not describe it as stealing in your deposition, right? [02:54:06] Speaker 5: It's like two different situations what you're talking about. I feel like you're just trying to put one into that one. [02:54:14] Speaker 7: If I'm trying to be on the same page as you. I'm trying to understand your testimony. Your testimony yesterday was that she had one card, right? [02:54:22] Speaker 5: I mean, one family card. And obviously she had her own personal accounts, too. [02:54:28] Speaker 7: But in terms of her access to your money, it was that one family card, right? Correct. And in your deposition about that one family card, the debit card, you never said she was stealing, right? [02:54:42] Speaker 5: I would say she was stealing from that because I gave it to her. [02:54:45] Speaker 7: I agree with that. Did you? Now, whatever she did with a family card, that was not something you ever resented or complained about, right? [02:55:02] Speaker 5: I only had things to say to wifey whenever she obviously overspent or she just is going to buy, you know, Chanel bags with the family card, you know what I'm saying? And it's clearly like stuff needed to be done around the house. [02:55:24] Speaker 7: So is the stealing you're referring to when she would use the family card money for something like a bag? [02:55:31] Speaker 5: I would say the stealing would be like, I would do like small things outside of my job to earn cash, you know, and I would have like cash laying around, like a lot of cash. And I would come home and it would be missing. And I would ask her, I would say, hey, babe, like, where's all this cash? Like, you're getting all this money already. Like, why do you need all this cash? So I have, I mean, I had so many questions that I rarely got answers to. And it's like, oh well. [02:56:06] Speaker 7: Do you recall your counsel asking about what you meant by stealing money yesterday, right? Correct. And you were asked when you say stealing money, did you have joint accounts? You answered, no, never had a joint account, right? Right. Did you ever give her access to your account? Answer, no, I never gave her access, but I did have a family card that I gave her access to. Right. You were asked, you were referring to her utilizing that family card, answer, yes. Right? Right. So that was your testimony yesterday about stealing, right? [02:56:35] Speaker 5: I mean, I just told you exactly what the difference was. And then also, too, after the divorce, too, though, like, after the petition was filed, like, there was money being removed out of the account. Now, you can consider that stealing, because at that point, we divorced. [02:56:58] Speaker 7: I just want to make sure we're talking about that one family account, right? [02:57:00] Speaker 5: No, I mean, I just gave you a situation of stealing he was talking about. He was talking about on the court. [02:57:06] Speaker 7: From the family account, right? [02:57:07] Speaker 5: Yeah, she stole from that account, like, 30K. [02:57:10] Speaker ?: Okay. [02:57:12] Speaker 7: We talked a little earlier about some of the beliefs that you got based on how you were raised by your grandparents, right? Right. And you feel like a man has his role in the marriage and a woman has hers. Have you ever covered this yet? No, this is different. It doesn't sound different. It sounds the same. Let me ask the whole question. You want to come home, lay down in peace, eat some good food, play games, spend some time with you, and then, you know, we call it night, we wake up, and we do the same thing over again. That's your vision of a marriage, right? Sounds pretty good. You testified to that in one of your depositions, right? Yes, sir. So, in that list of priorities you gave in deposition, spend time with my wife is number four after five after play games. [02:58:00] Speaker 3: It doesn't sound all of it. It sounds like it's your cover. [02:58:06] Speaker 7: You described yourself yesterday as traditional? Yes, sir. Old school man are the ones that you use? Old school, yes, sir. You said you want to get off the elevator, see the kitchen, want to see my wife making us dinner, and our daughter saying, Daddy, Daddy? [02:58:21] Speaker 4: Again, I'm just going to object to this is a couple. Ask and answer, delegate, call it. [02:58:26] Speaker 3: I sustain the interest. We covered things in general, and then you asked for some specific incidents, and we've done that. [02:58:35] Speaker 7: You described your dream girl as a church-going, flower-picking wife. Do you remember that? [02:58:41] Speaker 8: Yes, I object to relevance. [02:58:44] Speaker 3: I'm not sure the relevance, but we just haven't heard this portion. We haven't heard this question. [02:58:50] Speaker 5: Yeah, yes, sir. [02:58:52] Speaker 7: What does that mean, flower-picking? [02:58:54] Speaker 5: I don't know, man. I come from South Georgia, man. I went to church with about 12 people, and that's what I envisioned for my life. And that's what I seen you as. She was a small-time girl. She's beautiful. [02:59:08] Speaker 7: You saw her as a girl who was not selling OnlyFans. She's going to church. She's with her mom every day picking flowers. That's how you described her, right? [02:59:18] Speaker 4: You're going to ask an answer. Ask an answer. [02:59:21] Speaker 3: Okay. That was ask an answer. [02:59:23] Speaker 7: We don't really know how to rule this, because we have no idea what you're talking about. You can give me some leeway. This is my direct examination, Your Honor. I might just have some leeway to ask two more questions here. [02:59:32] Speaker 4: Well, Your Honor, it's not a direct examination. I believe it's a cross examination.
