[00:45:07] Speaker 13: All of them were nice. Yeah.
[00:45:10] Speaker 12: Could you describe the attitude between the defendant and Momta at that time?
[00:45:19] Speaker 13: They were looking a good couple at that time.
[00:45:22] Speaker 12: So they were looking a good couple at that time? Did you ever become friends with Momta?
[00:45:31] Speaker 13: Yes.
[00:45:32] Speaker 12: Could you describe for the members of the jury your friendship with Momta?
[00:45:36] Speaker 13: Initially it was just like hi, hello and catching our friends. But once they moved to the Manassas, we were like a close friend.
[00:45:45] Speaker 12: You said they moved to Manassas. Where do you live?
[00:45:48] Speaker 13: I live in Manassas.
[00:45:49] Speaker 12: And what is your address?
[00:45:51] Speaker 13: 9435 Bright Star Drive, Manassas.
[00:45:55] Speaker 12: And where did Momta and Nourish move? When? Where did they move?
[00:46:02] Speaker 13: They moved to Manassas. It's close to my house, like three to four minutes drive.
[00:46:09] Speaker 12: How far away is your house walking from each other?
[00:46:12] Speaker 13: 15 to 20 minutes.
[00:46:18] Speaker 12: And when Momta and Nourish moved to Manassas, did you see her more or less?
[00:46:25] Speaker 13: Yes, more. She used to come into my house walking mostly.
[00:46:30] Speaker 12: Did you ever attend parties with her? Yes. What kind of parties did you attend?
[00:46:36] Speaker 13: Just our cultural program, like some of them like a rice ceremony party or a birthday party.
[00:46:47] Speaker 12: Is it the rice ceremony party? Could you explain what that is?
[00:46:51] Speaker 13: The rice ceremony is the, it's our culture. We introduce the first solids to the kids. So it's like a big celebration for us.
[00:47:05] Speaker 12: So the first solids to the kids, what age would that be?
[00:47:09] Speaker 13: For the daughter, it's between four to five. And then for the son, it's between five to six months.
[00:47:15] Speaker 12: So four to five months for the daughter and five to six months for the son? Yeah. You said you have a three and a half year old son. Did you invite Momta to that rice feeding ceremony?
[00:47:30] Speaker 13: Yes. Both of them were there.
[00:47:32] Speaker 12: And did they both attend? Sorry? Did they both attend the party?
[00:47:35] Speaker 13: Yeah, they attend my rice ceremony party for my son, Norris and Momta both.
[00:47:45] Speaker 12: Did Momta have a rice feeding ceremony? Yes.
[00:47:50] Speaker 13: I was there too.
[00:47:55] Speaker 12: When was Momta's rice feeding ceremony for her baby?
[00:48:01] Speaker 13: It was on the winter, August, I don't remember. It's like probably December.
[00:48:11] Speaker 12: Was that the first time Momta invited you to the rice feeding ceremony?
[00:48:15] Speaker 13: For the rice ceremony, yes.
[00:48:20] Speaker 12: Could you talk about your closeness with Momta? Were you close or were you not so close?
[00:48:26] Speaker 13: I'm close with her.
[00:48:28] Speaker 12: And when you say you were close with Momta, what do you mean by that?
[00:48:31] Speaker 13: She used to share everything with me.
[00:48:39] Speaker 12: Did Momta ever discuss her relationship with you?
[00:48:43] Speaker 13: Yes. Not initially, but after they had a fight. Yes. She told me everything.
[00:48:56] Speaker 8: Issues that were raised pre-trial and objected.
[00:49:02] Speaker 1: I don't have a question that elicits hearsay yet. The question of did she share with you about her relationship does not elicit hearsay. That's overruled. If you need to approach on where this is going, you're welcome to.
[00:49:38] Speaker ?: Thank you. Thank you.
[00:50:38] Speaker 1: Thank you. We're going to go ahead and handle something outside of your presence. I don't anticipate it's going to take long, but I've been wrong on that before, so I'm going to ask you all to step back, and we will let you know when we're ready for you.
[00:51:08] Speaker ?: Okay. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Okay. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you.
[00:51:26] Speaker 12: Ms. Nupon did mom ever discuss her feelings with you about her relationship? Yes. At that point how long had you known her? Like the feelings? At the point that Mamta was comfortable sharing with you how long had you known Mamta? It's she shared me
[00:52:05] Speaker 13: everything on well she was at my house that's on February. So my question is at
[00:52:14] Speaker 12: the at the time that she's sharing with you had you known her for a long period
[00:52:18] Speaker 13: of time? Yes. How long had you known her? Almost like two years, two and a half years. And are you
[00:52:30] Speaker 12: do you know what employment Mamta had? Yeah. What what did she do for work? She is a nurse she was a nurse. Just like you? Yeah. So is that something that you were able to
[00:52:42] Speaker 1: bond with Mamta over? Yes. Ms. Williams. I'm not doing full testimony outside of the presence of the jury. I'm just asking to see if you can lay a foundation and none of these potential of possibly one are foundational questions. So get me to where you want to be on these statements because we can't do half the trial outside
[00:53:04] Speaker 12: their presence. Did Mamta talk to you about what did Mamta talk to you about her
[00:53:18] Speaker 13: relationship? After they're like plan for the rice ceremony party they had a fight and Mamta told me Norris hit her and also her mom her his mom was not happy well she also saw me the video as well while she was at my house after the fight. Okay so let's talk about February. Yeah. What year are we talking about? 2023? Was it the
[00:53:51] Speaker 12: February right before Mamta went missing? Yeah. How many years ago was that? Two years ago. When did you first talk to Mamta about what was going on in her
[00:54:06] Speaker 13: relationship? She was actually walking to my neighborhood on the phone she was crying and I found her when I was walking to and she suddenly grabbed me and crying and I took her in my house like what happened and she told me everything. Okay so she was
[00:54:22] Speaker 12: crying walking. Where did why did you know she was walking to your house? I didn't
[00:54:27] Speaker 13: know that she was walking. I was walking in my neighborhood it was like evening time. She came close to the Walmart side. And when you took her to your house what did she tell you? She told me they had a fight before the rice ceremony party. They actually changed the original date of the rice ceremony party. When they invited us that was the date they changed it a little bit later because she had a bruise on her face she also showed me the picture as well. Did you see the bruise on her
[00:54:57] Speaker 12: face? Yes. And you said she showed you a picture? What was the picture about? He hit
[00:55:07] Speaker 13: her on the face. It was the bruise on her left cheeks. Let me get clarification. Is
[00:55:14] Speaker 1: this all in that February conversation? You mentioned February. I don't think I heard her say February but it's is that all the same conversation? Yeah I see the
[00:55:24] Speaker 13: video. It's not on the face and the person. You saw the video but that's when
[00:55:30] Speaker 1: you saw her walking and crying. She came into your house and told you what happened. Anything else from that from that day? Yes Your Honor. Okay. On that
[00:55:42] Speaker 12: day did you offer help to Mamta? Yes. What kind of help did you offer her? I told
[00:55:48] Speaker 13: her she can stay at my house if she just don't don't want to go back because they she said that they were not even letting her to eat and she was hungry for
[00:56:00] Speaker 12: a few days also. Said they were not letting her eat. What do you mean by that? His mom
[00:56:06] Speaker 13: and him they also did not let her eat in the house. Why not? They had a fight. During
[00:56:22] Speaker 12: that time did she stay with you? Yes. How long did she stay with you for? Almost 19
[00:56:27] Speaker 13: days at my house. Was she with Nima? Initially when she came in she was by herself. And how long until Nima came? In between seven to eight days Norish came into my house around like 6:30ish. He was the one who dropped Nima at my house and Mamta was about to go to her night shift at the work and Mamta told him to like can you just take her back because his parents was there to watch her and she said I can watch her from tomorrow but I have to go to night shift. She already had so many call out in the work but he did not listen to her and he just dropped the Nima at my house and her uber was already outside. She went to the work. Did he say anything to you during that incident? He did not say anything to me. During that
[00:57:21] Speaker 12: February time when Mamta was talking to you did she talk to you about the defendant's faithfulness to her? Yes he was not. And what did she tell you specifically when it came to defendants faithfulness? So their fight was
[00:57:38] Speaker 13: beginning because the reason was like she said he has multiple girlfriends and he fight he found like couple of the evidence through his phone. That was the reason they
[00:57:48] Speaker 12: started from the fight. That she found in his phone what did she find? What did she find? Like
[00:57:53] Speaker 13: messages and chat that he was talking about some other random goals.
[00:58:04] Speaker 12: at that point did Mamta talk to you about divorce? Yes. And what about divorce did Mamta say? She
[00:58:14] Speaker 13: wanted to get divorced and just take Nima with her but he did not want it.
[00:58:18] Speaker 12: I think at this point your honor we can stop. I have an objection for hearsay and other other grounds. Mr.
[00:58:35] Speaker 8: Edwold, go ahead. Did she ask a question? Sure. I miss Nupani. I want to clarify a couple of things. The video that you're talking about, was it video of the actual fight or was it a video of Mamta afterwards? It was the afterwards.
[00:59:14] Speaker 13: And was Mamta just taking a video of, what was she taking a video of? She was taking the video that they, his family was talking and also at the end of that video she pointed out to herself and also it was seeing the bruise on her cheeks. You didn't see the fight? I didn't see it.
[00:59:38] Speaker 8: And you didn't see how the bruise happened yourself? Yes, I didn't see it. And the picture of the bruise is that from the same fight or is that a different bruise? It was from the same fight. Did you see the bruise on Mamta yourself or just in a picture? In the picture. And when you saw Mamta walking in your neighborhood, did you start talking on the walk back or did you get back to your house and then she told you?
[01:00:21] Speaker 13: I started talking like what happened? Why are you crying? I started from the walking.
[01:00:28] Speaker 8: And just to be very clear, all of the information about the relationship between Mamta and Naresh, you heard from Mamta. Yes. And you didn't see any of it yourself. Sorry, you didn't see anything happen in the moment.
[01:00:53] Speaker 13: Yeah. I didn't see anything happen in the moment. Yeah, I didn't see on my eyes.
[01:01:00] Speaker 8: Judge, based on that, I have hearsay objections. I have...
[01:01:05] Speaker 1: Well, let's take them one at a time. I've got the statements and she's crying and grabbed her. So you've got the objection response?
[01:01:21] Speaker 12: To rely heavily on the motions that I previously filed.
[01:01:25] Speaker 1: Just give me your basic hearsay response.
[01:01:28] Speaker 12: The mental, emotional, physical condition, state of mind.
[01:01:31] Speaker 1: Right. That objection's overruled. Those statements come in. Next. What are your other objections?
[01:01:37] Speaker 12: Prior bad acts?
[01:01:39] Speaker ?: Prior bad acts.
[01:01:41] Speaker 1: Response?
[01:01:43] Speaker 12: Your Honor, 2:404 B Evidence, the prior bad acts that the defense is raising. These come in to show intent, motive, lack of mistake, a long list of things which all apply in this case.
[01:01:56] Speaker 1: Any response to that?
[01:01:58] Speaker ?: Yes, ma'am.
[01:02:00] Speaker 8: First of all, the balance attest for 4 will be that prior bad act evidence only comes in at the legitimate, primitive value outweighs it's incidental. Higher standard than regular relevance. I'm pulling that from the Williams versus Commonwealth 85 VA app, 2025. And I have copies.
[01:02:29] Speaker 1: I do not need.
[01:02:31] Speaker 8: I'm calling all this proponent. So they've stated that Vasey's intent has to establish a causal relation or logical or natural connection between the two acts or that they form parts of one transaction. So they need to show that this incident from February is somehow causally connected to an intent somehow formed in July, which is several months later. We've done that at this point. Lack of accident or mistake. We have got a certain accident or mistake. That's the other issue with prior bad accidents. We have not made any sort of decision at this point. This is not us or anything like that. I think it's more appropriate if the defense response to our case in chief for them to come up in rebuttal. And that's why about it then. But really, a lot of the case law around prior bad acts is that it comes in because the defendant asserts something. They put on some sort of evidence. They say something about how the alleged act occurred. We have not done that yet, Judge. We have not put on any sort of specs. And this would be reminded of the other. Judge, I think, again, it's too remote in time for this. Really, what it does is exactly what 404B is trying to prevent, what 404 is trying to prevent, which is use of this. This information about a fight that they had about possible physical abuse. Using it to say that Nareshbat then killed her later on. That's propensity of insurance. They're pressing it up in the language of motive and intent. But that's, I think, it's too remote in time for them to do that. And they have not sufficiently established that link between what's going on in February with what's going on in July.
[01:05:08] Speaker 12: Your Honor, so 2:404B allows this evidence to come in not to show the character trait of the defendant. This is not being admitted to show that the defendant is simply the type of person who would do this. It is being offered to show very specifically the opportunity, the motive, the intent, lack of mistake or accident because it shows the trajectory of the relationship. It's, again, not character evidence. It's not impermissible character evidence. It's going to show the dynamics of their relationship. It's going to show the state of mind of the victim, which is, as the case law says, always relevant. Defense is citing to the fact that they haven't not yet raised some of these issues during the course of trial. 2:404B doesn't pertain only to the Commonwealth's rebuttal case. It also goes to the Commonwealth's case-in-chief because of these issues and because the Commonwealth intends to show the trajectory of the relationship.
[01:06:21] Speaker ?: Okay.
[01:06:22] Speaker 1: I would accept it. No, no. We're not. We're not. It's your objection that we're done with the argument. I'm going to allow the evidence in. I think that it is not so remote as to not be part of the motive in this case. It is a clear state of mind exception to the hearsay rule. And Virginia law also has been moving in the direction of allowing the sin to show the nature of the relationship of the parties. And we are only five months, if I did my math right, in advance of the date they're claiming that he's missing, that she is missing. So I'm going to allow that in. Do you have more that's coming in through this witness so I don't have to keep bringing the jury back and out?
[01:07:15] Speaker 12: I have somewhat, I'm not sure if defense will raise an objection to this, but might as well address it head on beforehand. Ms. Newpond, at any point did you assist MOMTA in accessing a bank account?
[01:07:28] Speaker 1: Sorry? Are you going to, this is not about hearsay or prior bad acts. This is not.
[01:07:33] Speaker 8: Ms. Newpond wants to just proffer the question.
[01:07:36] Speaker 12: Yes. Certainly. So proffering about the witnesses assisting MOMTA in getting a new phone and getting a bank account that is separate apart from her husband.
[01:07:47] Speaker 1: Is there an objection to that? No. All right, let's bring in the jury.
[01:08:01] Speaker 12: Force brief indulgence. There is, I missed one line. There is some prior bad acts as far as sexual prior bad acts. I can certainly proffer that when MOMTA was postpartum, you know, the defendant wanted to have sex with her in certain positions. And that was being communicated to the witness.
[01:08:23] Speaker 1: You're going to have to lay some solid foundation on that, approach on that.
[01:08:32] Speaker ?: Thank you. Thank you. Thank you. Thank you.
[01:09:49] Speaker 1: All right, when you all left, there was an objection to hearsay and other things. I've heard testimony. I have overruled the objections with exception to the last part that just came out, and that is sustained. The lawyers know now what they're going to do. We're going to start again.
[01:10:31] Speaker 12: So going back to where we left off, at any point did Momta discuss her relationship with you? At any point did Momta discuss her feelings about her relationship with you?
[01:10:45] Speaker 13: Yes.
[01:10:51] Speaker 12: When was the first time that Momta talked to you about her relationship with the defendant?
[01:10:57] Speaker 13: Once she was at my house on the February.
[01:11:01] Speaker 12: Okay, and going back, you said it was February? How many years ago was that?
[01:11:07] Speaker 13: It was two years ago, two and a half almost.
[01:11:10] Speaker 12: Was that the February of 2024?
[01:11:17] Speaker 13: Yes, 2024.
[01:11:20] Speaker 12: And in February of 2024, how did Momta start talking to you about her relationship?
[01:11:31] Speaker 13: She was at my house after when I find her, she was crying. I took her to my house, and then I asked her what happened, why are you crying, and then she told me everything at that time.
[01:11:42] Speaker 12: Okay, so backing up, where did you see her when she was crying?
[01:11:47] Speaker 13: In my neighborhood, close to the Walmart.
[01:11:53] Speaker 12: What was she doing when she was crying?
[01:11:56] Speaker 13: She was talking in the phone when I found her first.
[01:12:01] Speaker 12: And at any point did you stop and ask her what was wrong?
[01:12:04] Speaker ?: Yeah.
[01:12:11] Speaker 12: Where did you take Momta?
[01:12:12] Speaker 13: In my house.
[01:12:14] Speaker 12: And while she was in your house, did she talk to you about her relationship?
[01:12:18] Speaker 13: Yes.
[01:12:23] Speaker 12: What did she talk to you about?
[01:12:26] Speaker 13: She said they had, like, multiple fights in the last couple of years, and she said she was tired with everything. She just wanted to move on with her daughter.
[01:12:38] Speaker 12: She said she had multiple fights. Did she show you anything about the fight?
[01:12:45] Speaker 13: No, that's the only video I saw.
[01:12:49] Speaker 12: Okay, you said a video that you saw. What do you mean by that?
[01:12:52] Speaker 13: But that was the video. She took it after their fight in December. Like, I think before her past knee. That's what she said.
[01:13:02] Speaker 12: And the video that she showed you, what did you see in that video?
[01:13:05] Speaker 13: She was clicking the conversation, her in-laws and husband. And at the end, she also had a picture move her camera around her face, too.
[01:13:17] Speaker 12: And what was on her face?
[01:13:18] Speaker 13: It was a little bit bruised on her left cheeks.
[01:13:22] Speaker 12: And did you see a bruise on her?
[01:13:25] Speaker 13: Yes, on the video.
[01:13:30] Speaker 12: Did she talk to you about how that bruise got there?
[01:13:32] Speaker 13: She said he hit her.
[01:13:44] Speaker 12: Did she talk to you about her rice feeding ceremony?
[01:13:48] Speaker ?: Sorry?
[01:13:48] Speaker 12: Did she talk to you about her first rice feeding ceremony? Yes. And did she say anything to you about scheduling that ceremony?
[01:13:59] Speaker 13: She had to move her rice ceremony dead because she had a bruise on her face. So the original date was different and then she invited again the another date.
[01:14:11] Speaker 12: You said she had to reschedule her rice feeding ceremony to a different date? Yes. And the reason for that was because she had a bruise on her face? Did mom to ever talk to you about divorce?
[01:14:27] Speaker 13: Yes.
[01:14:29] Speaker 12: What did mom to tell you about divorce?
[01:14:33] Speaker 13: She said she has been trying so hard to keep that relationship with Norris. And he's been like hitting her so many times. He was cheating her. And after the postpartum, their relationship was not good. I invited Norris at my house after she came to my house. The next day I invited Norris in my house. Me and my husband, we wanted to have a conversation like why are you guys fighting? What's happening? And the Norris point was like he is not happy because he's not cleaning her house. That's the reason he said that.
[01:15:05] Speaker 12: I'm going to stop you there and I'm going to circle back a little bit and we'll get there. When she first talked to you about divorce, did she indicate that there was a fight? That started? And what was that fight about?
[01:15:22] Speaker 13: She found out like multiple chats and conversation with other girls. That was the reason the fight has been started.
[01:15:29] Speaker 12: And when you say multiple chats with other girls, what did she tell you about those chats?
[01:15:34] Speaker 13: She did not mention me anything about the chat, but that's the word she said.
[01:15:40] Speaker 12: And you said multiple girls. Did she tell you how many?
[01:15:43] Speaker 13: No, she did not mention how many. But she said like a couple of in the Maryland and also in the Virginia and also one in the Nepal. His parents also know that goal as well.
[01:15:54] Speaker 12: That his parents know the girl that he was chatting to?
[01:15:58] Speaker 13: Yeah, that was the goal. They just want to get married first.
[01:16:04] Speaker 12: The girl that he was going to get married to first.
[01:16:07] Speaker 13: Yeah, in a back home and still he was talking to her.
[01:16:11] Speaker 12: And what did mom to tell you about that girl?
[01:16:13] Speaker 13: That was the fight. It started after this goal actually.
[01:16:22] Speaker 12: You said you were born in Nepal? Yeah. How is divorce looked on in your culture?
[01:16:31] Speaker 13: We actually don't go through the divorce until this is the like last case scenario. We try to like, you know, compromise and try to think sort doubts. We try to fix it first.
[01:16:50] Speaker 12: And you tried to fix it first. Is there anything about, is there anything else about divorce in the Nepali culture? Sorry? Is there anything else about divorce in the Nepali culture?
[01:17:05] Speaker 13: Yeah, it's like if you are divorced, the society will be like, you know, looking in a different way. Like, hey, she's a divorce. There is like no chance you can get another man or woman. This is like that how we look at it.
[01:17:26] Speaker 12: You testified previously that you invited Naresh to come talk to you?
[01:17:39] Speaker 13: Yeah.
[01:17:40] Speaker 12: When did you invite Naresh to come talk to you?
[01:17:43] Speaker 13: After Momta came to my house the next day.
[01:17:46] Speaker 12: And did Naresh come to talk to you? He did.
[01:17:51] Speaker 13: Who all was there? It's me, my husband, and Momta, and Naresh.
[01:17:57] Speaker 12: What did the defendant say to you about what was happening?
[01:18:01] Speaker 13: I asked him, like, why are you fighting? What was the reason? Because Momta came to my house. Her phone was already blocked. Her account was already locked. There was no money at all. I see on my eyes. My husband also see that. And why you did that? And he said, because she's not cleaning the house. She's not following her, whatever his mom telling.
[01:18:26] Speaker 12: Do you recall whether or not his parents were in the United States at that point?
[01:18:34] Speaker 13: They were there.
[01:18:36] Speaker 12: And do you recall where they were living at that point?
[01:18:38] Speaker 13: I did not recall them.
[01:18:43] Speaker 12: Do you recall any fights around food? Sorry? Do you recall any fights Momta was having about food?
[01:18:54] Speaker 13: Yeah. She mentioned that they were not letting her to eat in a house.
[01:18:57] Speaker 8: I have an objection to that.
[01:19:03] Speaker 1: Thank you, ma'am. Ladies and gentlemen, jury, I'm going to go ahead and strike from the record from the question with regard to food and any answer that was given.
[01:19:58] Speaker 12: During that conversation that you had with Naresh, did he say anything else about why they were fighting?
[01:20:06] Speaker 13: Yeah, that was the reason he said, like, she was not cleaning the house. That's the only reason he said that in front of me and my husband both.
[01:20:16] Speaker 12: Did the defendant ever admit to you that he hit Momta?
[01:20:22] Speaker 13: Yes. He said he was trying to protect himself. That's how she got hurt.
[01:20:33] Speaker 12: During that time in February of 2024, did Momta ask for help from you? Yes. Did you give her help? What kind of help did you give her?
[01:20:45] Speaker 13: I let her to stay at my house. She did not have a phone. She had a new brand, 15 Pro Max, under his name. He blocked that phone and blocked the line. And also he took all the money. I took her to the banks. She used to drive a car, but she did not have any. They had only one car. So I took her to the bank, opened the bank account. I gave her some cash and also bought the tubal mini phone through the Amazon also so she can use the Uber to go to work.
[01:21:11] Speaker 12: And go back a little bit. How long did she stay with you at your house?
[01:21:15] Speaker 13: Almost like 10, 11 days.
[01:21:27] Speaker 12: Did Momta ever drive a car, to your knowledge?
[01:21:29] Speaker 13: Yes. She had a driver's license.
[01:21:32] Speaker 12: She had a driver's license. But did you ever see her drive a car?
[01:21:36] Speaker 13: Yes, I have seen it.
[01:21:39] Speaker 12: Did you ever see her take Ubers or Lyfts?
[01:21:43] Speaker 13: Mostly Uber and Lyft.
[01:21:45] Speaker 12: Did you see her usually drive or usually take Ubers or Lyfts?
[01:21:50] Speaker 13: She always take Uber and Lyfts because she did not have a car. Norris has only one car.
[01:21:58] Speaker 12: Do you know what car Norris had?
[01:22:01] Speaker 13: Tesla.
[01:22:04] Speaker 12: And you said that was the only car that they had?
[01:22:06] Speaker ?: Yeah.
[01:22:08] Speaker 12: And who was the one to drive the Tesla?
[01:22:11] Speaker 13: Norris.
[01:22:14] Speaker 12: Did you ever see Mom to drive the Tesla?
[01:22:16] Speaker 13: No, he never let her drive. That's what she said.
[01:22:23] Speaker 12: Did you ever assist Momta in getting a bank account?
[01:22:27] Speaker 13: Yes, I took her to the bank to open the bank account.
[01:22:30] Speaker 12: Do you recall what bank that was?
[01:22:33] Speaker 13: It was close to my house. I have to remember. Sorry. Sorry.
[01:22:46] Speaker 12: Would anything refresh your recollection? Sorry? Would looking at the bank account refresh your recollection as to what bank it was?
[01:22:55] Speaker 13: Yeah.
[01:22:56] Speaker 12: Of course, brief indulgence.
[01:23:04] Speaker 13: It's next to the Fresh World at my house. That's from Xi. Oh my. I'm postpartum. Sorry. I'm forgetting things and everything.
[01:23:17] Speaker 12: I'm approaching you with the document. If you could take a look at this. Yes.
[01:23:42] Speaker ?: Yeah.
[01:23:42] Speaker 12: Does that refresh your recollection as to what it was? Mm-hmm.
[01:23:45] Speaker 13: It was a test bank.
[01:23:54] Speaker 12: Why did you help Mom to get a bank account?
[01:23:58] Speaker 13: So Xi mentioned that Xi does not have any money at all. He used to control all the money. And also Xi sold me the bank account. Xi did not have any money. He gave her a credit card that's only she can use it. But he was the one who controlling all the transferring and money and everything. That's what Xi said.
[01:24:20] Speaker 12: And at any point, did you assist Mom to in getting anything else?
[01:24:25] Speaker 13: No. That's the only... I took her to the bank and opened bank accounts. She wanted to buy a car, save some money. It is like $5,000 to $6,000. That's why she opened the bank account.
[01:24:35] Speaker 12: Did Mom to have a phone?
[01:24:38] Speaker 13: Yes, she had a phone when she came to my house. It was the 15 Pro or 15 Pro Max.
[01:24:44] Speaker 12: Was there any issues with Mom to phone when she came to your house?
[01:24:48] Speaker 13: No, it was not. But initially, within a few hours, her phone number was blocked. And then the phone was reported missing and stolen.
[01:24:55] Speaker 12: Okay, how do you know that?
[01:24:57] Speaker 13: She showed me in front of me. So that she requested me, like, she had to work next day. She cannot do Uber. That was the reason I bought the phone from Amazon. And the next day, I did Uber for her. It takes, like, maybe 24 hours from the prime to get her phone.
[01:25:12] Speaker 12: Okay. So the phone that she came to your house with, you said initially that was working.
[01:25:18] Speaker 13: Yeah.
[01:25:18] Speaker 12: At any point, at what point did that phone stop working?
[01:25:24] Speaker 13: Almost two, three hours at my house while she was in.
[01:25:26] Speaker 12: Two to three hours?
[01:25:27] Speaker 13: Mm-hmm.
[01:25:28] Speaker 12: And how did that phone stop working?
[01:25:36] Speaker 13: Her phone, I don't know. But initially, after two, three hours, her phone was, like, totally sat down. She was not able to make a call. And then it was all down.
[01:25:51] Speaker 12: You previously testified that it was reported missing. How do you know that it was reported missing?
[01:25:57] Speaker 13: The iPhone shows, like, we call the Apple Store, and it says the phone was reported missing.
[01:26:05] Speaker 1: Sustained.
[01:26:10] Speaker 12: At any point during this time, February of 2024, did Manta talk to you about becoming an American citizen?
[01:26:18] Speaker 13: Yes.
[01:26:21] Speaker 12: What did she say about becoming an American citizen?
[01:26:25] Speaker 10: Sustained.
[01:26:27] Speaker 12: You know, this goes towards the state of mind of the victim. And again, it was-
[01:26:32] Speaker 1: Lay your foundation before you ask the question, Ms. Williams. You're saying.
[01:26:40] Speaker 12: Are you familiar in your own life with immigration practices from Nepal to the United States?
[01:26:47] Speaker 13: Yes.
[01:26:48] Speaker 12: And how are you so familiar with that?
[01:26:50] Speaker 13: Sorry?
[01:26:50] Speaker 12: How are you familiar with the immigration process from Nepal to the United States?
[01:26:56] Speaker 13: So we have, like, a different categories how you can come to the United States. Some people come in through the Eastern visa or lottery, or also some of them through the husband. This is how we came in here in the U.S.
[01:27:12] Speaker 12: And are you familiar with how Manta came into the United States? Yes. And how did she come into the United States?
[01:27:21] Speaker 13: After she get married with the nurse, he bring her here.
[01:27:29] Speaker 12: And when she came into the United States, was she able to work in the United States? Yes, she was. And how did she work?
[01:27:39] Speaker 13: Initially, she was working in some gas station, also working as a nanny before she did not have any license for the nursing. But after the nursing license, she started working as a nurse.
[01:27:52] Speaker 12: And do you know whether or not Manta was an American?
[01:27:56] Speaker 13: No, she was not. She was only a green card holder.
[01:28:01] Speaker 8: I'd ask for foundation on how she was that.
[01:28:04] Speaker 12: How did you come to know that Manta was not an American citizen?
[01:28:13] Speaker 13: She told me. And also Naresh told me, too.
[01:28:19] Speaker 8: I object to it coming in to your Manta judgment.
[01:28:23] Speaker 1: I'll sustain that. It can come in through Mr. Pot. Thank you, Your Honor.
[01:28:28] Speaker 12: So what did Naresh tell you as it relates to Manta being an American citizen or not?
[01:28:34] Speaker 13: So it's a process. She was in a green card holder. They gave her a conditional green card, which is for only two years. So after three years, you will be able to apply for the citizenship.
[01:28:50] Speaker 12: Did Naresh talk to you about whether or not she was applying for citizenship?
[01:28:55] Speaker 13: Yes, he said that he was going to apply for her, but that was not the time to apply. But later she applied by herself when it was the time.
[01:29:11] Speaker 12: At any point during talking to Manta during this time, were you aware whether or not Naresh knew where she was? At any point during this time when you were talking to Manta, did you know one way or the other whether or not Naresh knew where she was?
[01:29:43] Speaker 13: Yeah, he knew it. Yeah, he knew it.
[01:29:49] Speaker 1: It's vague and speculative and I'll let you try and flesh that out better.
[01:29:54] Speaker 12: At any point when you had Manta staying over at your house in February of 2024, didn't Naresh come?
[01:30:10] Speaker 13: Yeah, he used to come in every single day, but he never came in inside of my house, but I can see and I had a camera at my house. He always coming outside and he was following after once he get out from my house to the work.
[01:30:23] Speaker 12: So if you have a camera outside your house, could you tell that it was Naresh that was coming?
[01:30:29] Speaker 13: Yeah, it was Naresh.
[01:30:30] Speaker 12: How could you tell it was Naresh?
[01:30:31] Speaker 13: I see him also from the inside, his car and everything. I can recognize him.
[01:30:36] Speaker 12: At those times, did he come up to your door and talk to you?
[01:30:40] Speaker 13: No, he did not.
[01:30:42] Speaker 12: What was he doing around your house?
[01:30:49] Speaker 1: I guess that depends on the answer. Are you asking what was he physically doing as she observed him? That you can answer.
[01:30:58] Speaker 12: What was Naresh physically doing?
[01:31:01] Speaker 13: He was inside the car and he just took over and he was just following after her.
[01:31:06] Speaker 8: Objection to that judge, that's that he was just left.
[01:31:12] Speaker 12: That's fine to her.
[01:31:12] Speaker 1: From what you could see, where did he go when she left? Oh, he was just following her Uber. I think that's loud, if she could see it.
[01:31:34] Speaker 12: After that time that Mamta was staying with you, at any point did she go back home, to your knowledge?
[01:31:42] Speaker 13: After my house, she went to the apartment, it's close to the Fairfax, because she thinks Norris was coming every single day at my house and it's bothering us. So, she wanted to move out from my house.
[01:31:55] Speaker 12: To your knowledge, at any point did Mamta return to her Manassas home?
[01:32:03] Speaker 13: Yes. We were the one who left her in a home.
[01:32:08] Speaker 12: To your knowledge, when was that, that she returned to her Manassas home?
[01:32:14] Speaker 13: It's between around the end of the second week after my house. She came back to my house and Asi's parents came to my house to convince her. It was the Norris birthday we left her home on that day.
[01:32:30] Speaker 12: Objection to hearsay. And I'm not seeking to elicit that, it's for the truth of the matter.
[01:32:37] Speaker 1: I'm going to let that stand as what happened, what she saw happen there as the parents came to her home.
[01:32:47] Speaker 12: And you can finish answering the question.
[01:32:48] Speaker 13: Yeah, it was the Norris birthday when we left her home, tried to sort out the things. It's me, it's my family, Asi's family, and then the Norris family. We were there to sort out things, and we celebrated his birthday as well.
[01:33:02] Speaker 12: So that was for Norris' birthday? Yeah. And were you also there to celebrate Norris?
[01:33:06] Speaker 13: No. We just went there to drop her off. And later on, we knew it was his birthday. And they were like a cake and everything was ready.
[01:33:18] Speaker 12: At any point after she returned home, did she continue to talk to you?
[01:33:22] Speaker 13: Yes.
[01:33:23] Speaker 12: What did she continue to talk to you about?
[01:33:26] Speaker 13: She wanted to work. She left her job. I'm going to have to check at this point.
[01:33:34] Speaker 1: I don't know if it will be. You can answer the question of what, in general, she talked to you about.
[01:33:43] Speaker 13: She talked to me about getting her citizenship applied, wanted to work as a nurse in my hospital.
[01:33:50] Speaker 12: And did she continue to work as a nurse, to your knowledge?
[01:33:53] Speaker 13: Sorry?
[01:33:54] Speaker 12: Did she continue to work as a nurse, to your knowledge?
[01:33:57] Speaker 13: Yeah, I refer her in my hospital, in the UBA.
[01:34:02] Speaker 12: What was the last contact that you had with Mamta?
[01:34:19] Speaker 13: I had a chat on July 29th. I invited her through the chat at my housewarming party, which was August. So I asked her, can you come to my housewarming party? That was the last conversation I had on the chat.
[01:34:35] Speaker 12: When was your housewarming party scheduled for?
[01:34:38] Speaker 13: It was for August 22.
[01:34:42] Speaker 12: Did she respond in any way to your message inviting her to that housewarming party?
[01:34:47] Speaker 13: Yes, she said she would let me know, but you know the situation, that's what she said.
[01:34:57] Speaker 12: Did she ever go to your housewarming party?
[01:34:59] Speaker 13: No.
[01:35:02] Speaker 12: Since July 29th, 2026, has she messaged you back in any way?
[01:35:07] Speaker 2: No.
[01:35:08] Speaker 12: Have you heard from her at all? Have you seen Mamta at all? And for the record, the witness is shaking her head no. Could you please answer audibly on whether or not you've seen Mamta since July 29th, 2024? No. How did you find out that Mamta was missing?
[01:35:36] Speaker 13: I got the call from Mamta's mom and brother and also the sister from the New York.
[01:35:44] Speaker 12: When did you find out that Mamta was missing?
[01:35:46] Speaker 13: It was August 2nd or 3rd.
[01:35:53] Speaker 12: Did the defendant tell you that Mamta was missing?
[01:35:56] Speaker 13: No, he did not tell me and I called him immediately that day when I got to know and we wanted to be in his house and he said no, don't come in but I, my husband was the one who called him and my husband said, can I just come in by myself and he was like no. No, then I was so afraid to go to his house by ourselves, I called the assis and assis and we went all together in his house and instead of he said no, don't come in but we went there.
[01:36:24] Speaker 12: So did Naresh at that time invite you into his house at all?
[01:36:27] Speaker 13: No, we went by ourselves. We called him, he said don't come in. It's my husband called, not me actually. I'm just going to clarify.
[01:36:38] Speaker 12: First brief indulgence. Going back just a little bit, when Mamta started working at UVA, do you know when she started working at UVA?
[01:36:56] Speaker 13: Uh, it was probably the July.
[01:37:02] Speaker 12: Do you know whether or not she started working on time?
[01:37:08] Speaker 13: Like she was, he started on time for the orientation period, yes.
[01:37:17] Speaker 12: Um, when Mamta stayed with you at your house, you said that, um, eventually Naresh came with Nima. Yes. When was that?
[01:37:26] Speaker 13: Uh, it was between 6th or 7th day at my house.
[01:37:29] Speaker 12: Um, to your knowledge, did, uh, Mamta want Nima there earlier than that?
[01:37:40] Speaker 13: Uh, yes, she wanted, but her, because of the work, she had multiple call-outs on the work. She did not want to be fired from the Fairfax, I know, but because that was the one reputation hospital around in the Virginia. She already had a few call-outs from the work, just for the work.
[01:37:57] Speaker 12: Could you talk to us about Mamta's relationship with Nima, her daughter?
[01:38:02] Speaker 13: Yes, she was such a loving mom. Yes.
[01:38:05] Speaker 12: Um, was there anything about Mamta's relationship with Nima that stood out to you? That stood out to you?
[01:38:12] Speaker 13: She was such a great mom. I think I even, I am not married, but she was a great mom. She was so worried about her. She was trying to save some money so that she can take her, take care of her daughter. Yes.
[01:38:33] Speaker 12: Um, based on your understanding of who Mamta was, uh, would she leave her daughter?
[01:38:40] Speaker 13: No. No way. Even she told me, if she is going anywhere, she will let me know. I was the only one person she can trust, that's what she said.
[01:38:51] Speaker 12: Did Mamta ever talk to you about the defendant saying he wanted a divorce? Sorry? Did Mamta ever talk to you about the defendant, Naresh, talking about divorce?
[01:39:04] Speaker 13: I think he didn't want to give her divorce, that's what she mentioned to me.
[01:39:10] Speaker 12: That he didn't want to give a divorce?
[01:39:16] Speaker 13: She was thinking because maybe of the money, we had to give it our closers.
[01:39:22] Speaker 1: Sustained. This goes to the state of mind. I heard, I think he was thinking, I have a lot of speculation there. Sustained. Understood. I should say for the record, it was also hearsay.
[01:39:52] Speaker 12: Um, Ms. Nupon, did Nima ever have a first birthday party? Yes. Did you attend that birthday party? I was the one who was planning.
[01:40:02] Speaker 13: So you were the one who did what?
[01:40:03] Speaker 12: I was the one who went to celebrate the birthday party.
[01:40:08] Speaker 13: I booked the cake and I was the one who wanted to do her first birthday party. So you brought the cake for the birthday party?
[01:40:16] Speaker 12: Yeah. Did you make plans about the birthday party?
[01:40:22] Speaker 13: Yeah. Norris didn't know what I wanted to do because of the situations and everything. But yes, I called him like, "Hey, let's do it. It's going to be forever, the first birthday party."
[01:40:31] Speaker ?: Was Mamta at the birthday party?
[01:40:33] Speaker 12: No. Did you attend Nima's second birthday party? Yes. No. Second no.
[01:40:41] Speaker ?: Third yes.
[01:40:42] Speaker 13: Yes, sir. Did you attend her third birthday party?
[01:40:45] Speaker 12: Was Mamta at her third birthday party? Yes, sir. Did you attend her third birthday party? Was Mamta at her third birthday party? No further questions for this witness. If you could answer any questions that defense counsel has for you at this time.
[01:41:02] Speaker 1: All right. Ms. Rodwell.
[01:41:04] Speaker 8: Good morning, ma'am. I want to make sure I'm getting your name right. Is it Nupan or Nupani?
[01:41:19] Speaker 13: Nupani.
[01:41:20] Speaker 8: Nupani. Ms. Nupani, I'm sure this is very difficult for you to be here. You just told us a lot about what you saw of Nuresh and Mamta's relationship. You did not live with them, correct?
[01:41:38] Speaker 2: No.
[01:41:39] Speaker 8: Ms. You didn't see every day they spent together.
[01:41:44] Speaker 2: No.
[01:41:45] Speaker 8: Ms. Most of what you just told us came from Mamta. The first thing that you said actually was what Mamta told you about Nuresh. You didn't see the fight that you just talked about? Yeah. I didn't see it. You did not see Nuresh hit Mamta?
[01:42:13] Speaker 13: No.
[01:42:14] Speaker 8: Ms. You did not see how Mamta would interact with Nuresh apart from when you were together as couples, correct?
[01:42:26] Speaker ?: Yes.
[01:42:27] Speaker 8: Um. You said that Mamta moved back to the house in Manassas after February. For the record, yes or no? Yes. Um. And to your understanding, she said that everything was fine with their relationship after February and that they were working on things, correct?
[01:43:04] Speaker 13: Yes.
[01:43:06] Speaker 8: Of course. No further questions, Judge.
[01:43:11] Speaker 1: Any redirect? Ms. DuPont, you were friends with Nuresh first, is that correct?
[01:43:18] Speaker ?: Yes. You were friends with MAMTA after. Yes.
[01:43:23] Speaker 12: You were friends with Nuresh first, is that correct?
[01:43:28] Speaker ?: Yes.
[01:43:29] Speaker 12: You were friends with Mamta after? Yes. You were friends with MAMTA after? Yes. You were friends with MAMTA after? Yes. You were friends with Nuresh?
[01:43:37] Speaker 4: Mm-hmm.
[01:43:40] Speaker 12: Could you describe for the court and for the members of the jury your efforts to look for MAMTA?
[01:43:49] Speaker ?: Abstained.
[01:43:50] Speaker 12: Your cross-examination included her efforts to search and to indicate where she went after she left the house, it goes to the efforts to search for her.
[01:44:12] Speaker 1: No. Objection sustained.
[01:44:14] Speaker ?: Okay.
[01:44:15] Speaker 12: Ms. DuPont, as far as your relationship with both Nuresh and with MAMTA, could you describe your relationship with both of them before they moved to Manassas? Sustained.
[01:44:33] Speaker 8: No further questions at this time.
[01:44:36] Speaker 12: All right.
[01:44:41] Speaker 1: Is this witness free to go? All right, ma'am, you are subject to recall, which means you are still under the rule of witnesses. You can't be in here. You can't discuss your testimony with anyone. Okay?
[01:44:53] Speaker 12: Thank you. I'm going to come up with a recall here right now.
[01:45:02] Speaker 1: Any objection? Go ahead.
[01:45:11] Speaker 12: You're still under oath. Ms. DuPont, what were your efforts to search for MAMTA?
[01:45:18] Speaker 13: So we posted on the Facebook that she was missing. We initially had to tell Nuresh to post it. He was not wanting to do it.
[01:45:28] Speaker 8: Objection stipulation.
[01:45:33] Speaker 1: You have to lay a foundation for the second half of that answer. I'm going to strike that he was not wanting to do it unless you lay a foundation.
[01:45:40] Speaker 12: Did Nuresh tell you about posting on Facebook?
[01:45:48] Speaker 13: He didn't want it to post it. We went to his house after the start.
[01:45:53] Speaker 8: All right.
[01:45:54] Speaker 1: I'll strike that answer. It wasn't... It wasn't your fault. I understand. Go ahead.
[01:46:01] Speaker 12: What, if anything, did Nuresh tell you about not wanting to post to Facebook?
[01:46:07] Speaker 13: So when we went to his house, we asked him what happens and where is he going, or maybe he said, we don't know, she left Nima, I'm the only one who is suffering. And she had her, all the clothes, all, everything was taken out by herself. And she does not even have like a shoes outside she used to wear from the work. She took everything and she left. That's what he said. But he did not say where she goes.
[01:46:37] Speaker 12: So going back to what Nuresh told you about not wanting to post to Facebook, what did he say about posting to Facebook?

[02:20:33] Speaker 6: Well, I see. I have American Agri. They go that go monsters to be like a particular bill. I'm a customer. So, what about you?
[02:20:43] Speaker 15: Who could see it here? American Agri.
[02:20:46] Speaker 6: Becoming a citizen. She was very happy.
[02:20:49] Speaker 14: Did you ever have a conversation with Mamta about her getting a divorce with Naresh?
[02:21:04] Speaker 6: Yes, those matters came up.
[02:21:21] Speaker 14: In your Nepali culture, are there any impacts that come about when a divorce occurs or if it was to occur between two Nepali people?
[02:21:40] Speaker 6: I'm going to interject to foundation and relevance. This is a broad question. Right. Overruled on foundation, overruled on relevance. Maybe a little broad, but I'm going to allow it and see if you need to break that down.
[02:21:55] Speaker 8: I would like to request a repetition. Sure.
[02:21:57] Speaker 1: In your culture, in the Nepali culture, what, if any, impact is there when two Nepali people
[02:22:10] Speaker 6: try to get a divorce?
[02:22:12] Speaker 14: All right. What do you mean by that? What do you mean by that? In your culture, in the Nepali culture, what, if any, impact is there when two Nepali people

[02:23:37] Speaker 14: Once you heard your mother's efforts to talk to Mamta, that she couldn't get through, what, if anything, did you do?
[02:23:47] Speaker 6: When my mother told me, what did she do? What did she do?
[02:23:54] Speaker 15: I tried by myself.
[02:23:59] Speaker 14: Does that mean you tried calling Mamta?
[02:24:05] Speaker 6: Did she answer the phone? No.
[02:24:14] Speaker 14: After you tried calling to speak to Mamta, and she didn't answer the phone, did you try calling the defendant?
[02:24:24] Speaker ?: Naresh?
[02:24:24] Speaker 14: No.
[02:24:25] Speaker ?: I tried, but through my mother's phone.

[02:24:49] Speaker 6: Yes. Okay.
[02:24:51] Speaker 14: Thank you, sir. Yes. Okay.
[02:24:54] Speaker 6: Thank you, sir. Mahesh's mother's phone.
[02:24:56] Speaker 14: When you tried calling Mahesh through your mother's phone, did she withdraw? Did you try reaching out to Mahesh? And did you talk to Mahesh about where is Mahesh?
[02:25:14] Speaker 6: In the beginning, we could not get through the phone.
[02:25:29] Speaker 14: Let's kind of walk through a timeline, if you can recall. Did you call Mahesh on Friday, August 2nd, 2024, to talk about where is Mahesh?
[02:25:48] Speaker 6: Oh, good idea. Yes, I did. What did Mahesh say about where his wife may be on Friday, August 2nd? He told me she went for work and she has not yet returned.
[02:26:32] Speaker 14: Did you call Mahesh on the next day, Saturday, August 3rd, 2024, to ask Mahesh where is Mahesh? I did.
[02:26:41] Speaker 6: What did Mahesh say about where his wife was? The same thing. She told me she went for work and she has not written yet.
[02:27:19] Speaker 14: Let's go to the next day, Sunday, August 4th. Did you call Naresh to find your sister?
[02:27:27] Speaker 6: Yes, I did.
[02:27:39] Speaker 14: What did the defendant say about where Maapta was on Sunday?
[02:27:45] Speaker 6: What did the defendant say about that? What did the defendant say about that?
[02:27:51] Speaker 15: The defendant said that there are other people missing from our neighborhood as well.
[02:27:57] Speaker 6: Well, he told me there are other people missing from our neighborhood as well. I don't know where she was missed or she was lost.
[02:28:15] Speaker 14: That's what Naresh is telling you about where's Maapta? Did Naresh say anything about the baby being a factor in trying to find Maapta?
[02:28:33] Speaker 15: He told me because of the baby, he could not go anywhere and find out what happened because of the baby. That's what he told me.
[02:28:55] Speaker 6: Let's go to the next day, Monday, August 5th, 2024. Did you talk to Naresh about where is Maapta?

[02:29:21] Speaker 6: Did you talk to Naresh about where is Maapta? Yes, I did. And I told him, why don't you file a complaint to the police? Did Naresh say anything about Maapta's phone or her laptop?
[02:29:47] Speaker 14: Did Naresh say anything about Maapta's phone or her laptop? Did Naresh say anything to you about Maapta's phone or Maapta's laptop?

[02:30:13] Speaker 6: Yes, he told me when she went to work, she took her phone and she took her laptop.
[02:30:17] Speaker 14: Did Naresh ever ask you to do anything to help him find Maapta? Once you realize Maapta is not being responsive to your calls, your mother's calls, Naresh's efforts, is that why you came to the United States?
[02:31:03] Speaker 6: Did you fly from Kathmandu, Nepal to Dulles, Virginia? Yes.
[02:31:34] Speaker 14: The airport code for Kathmandu, is that KTM?
[02:31:38] Speaker 6: Since you've been here in Virginia, what have you done to try to find Maapta? I have been consulting with the police station. I have been consulting with police and law enforcement.
