[00:03:05] Speaker 3: Was he married or single when you met him? [00:03:07] Speaker 4: He was single. [00:03:10] Speaker 3: And at that time, would you consider yourself to be friends with him? [00:03:15] Speaker 4: No, not that time. [00:03:17] Speaker 3: Did you become friends with him at any point? [00:03:21] Speaker 4: Yes, after a couple of years. [00:03:29] Speaker 3: Did you know Naresh when he got married? [00:03:32] Speaker 4: Yes. [00:03:34] Speaker 3: And do you recall when he got married? Sorry? Do you recall when he got married? [00:03:41] Speaker 4: They got married in a back home, but I knew it he was going to get married. [00:03:46] Speaker 3: And when you say back home, what are you referring to? [00:03:49] Speaker 4: Nepal. [00:03:50] Speaker 3: Oh. Do you know who he got married to? [00:03:54] Speaker 4: Yes. [00:03:55] Speaker 3: Who did he get married to? [00:03:56] Speaker 4: It's Mamta Kafle. [00:04:00] Speaker 3: Who is Mamta Kafle? [00:04:03] Speaker 4: His wife. And I got to know her through him. [00:04:12] Speaker 3: Did you know Mamta Kafle before she got married to the doctor? No. [00:04:20] Speaker 4: When did you first meet Mamta Kafle? The first meet after she came to the United States, but I knew her before while she was in Nepal through the Facebook. [00:04:34] Speaker 3: And how did you become acquaintances on Facebook with her? [00:04:38] Speaker 4: Nurse asked me to be friends with her because she was applying for the nursing license to be nurse here in the United States. So I was helping her how we can evaluate our documents and everything. [00:04:49] Speaker 3: So the defendant asked you to be friends with her? And your first contact was online? [00:04:57] Speaker 4: Yeah, through the Facebook. [00:05:01] Speaker 3: When did you first meet her in person? [00:05:04] Speaker 4: In their apartment in the Folters. After she passed the NCLEX, she invited me and my husband for the dinner. [00:05:12] Speaker 3: And where did they invite you for dinner? [00:05:16] Speaker 4: In their apartment in the Folters. [00:05:20] Speaker 3: And who all attended that dinner at the apartment in Falls Church? [00:05:25] Speaker 4: It's me, my husband, Nourish, and Mamta. There was also some tenants on the other room. [00:05:33] Speaker 3: And could you describe the attitude of everyone at that party? [00:05:38] Speaker 4: All of them were nice. [00:05:42] Speaker 3: Could you describe the attitude between the defendant and Mamta at that time? [00:05:50] Speaker 4: They were looking a good couple at that time. [00:05:53] Speaker 3: So they were looking a good couple at that time? Did you ever become friends with Mamta? [00:06:02] Speaker 4: Yes. [00:06:03] Speaker 3: Could you describe for the members of the jury your friendship with Mamta? [00:06:08] Speaker 4: Initially, it was just like, hi, hello, and catching our friends. But once they moved to the Manassas, we were like a close friend. [00:06:16] Speaker 3: You said they moved to Manassas. Where do you live? [00:06:19] Speaker 4: I live in Manassas. [00:06:21] Speaker 3: And what is your address? [00:06:23] Speaker 4: 9435 Brightestad Drive, Manassas. [00:06:26] Speaker 3: And where did Mamta and Nourish move? [00:06:31] Speaker 4: When? [00:06:32] Speaker 3: Where did they move? [00:06:33] Speaker 4: They moved to Manassas. It's close to my house, like three to four minutes drive. [00:06:40] Speaker 3: How far away is your house walking from each other? [00:06:44] Speaker 4: 15 to 20 minutes. [00:06:49] Speaker 3: And when Mamta and Nourish moved to Manassas, did you see her more or less? [00:06:56] Speaker 4: Yes, more. She used to come into my house walking, mostly. [00:07:02] Speaker 3: Did you ever attend parties with her? [00:07:05] Speaker 4: Yes. [00:07:05] Speaker 3: What kind of parties did you attend? [00:07:07] Speaker 4: Just our cultural program, like some of them, like a rice ceremony party or a birthday party. [00:07:19] Speaker 3: Is it the rice ceremony party? Could you explain what that is? [00:07:22] Speaker 4: The rice ceremony is the, it's our culture. We introduce the first solids to the kids. So it's like a big celebration for us. [00:07:35] Speaker 3: So the first solids to the kids, what age would that be? [00:07:40] Speaker 4: For the daughter, it's between four to five. And then for the son, it's between five to six months. [00:07:46] Speaker 3: So four to five months for the daughter and five to six months for the son? [00:07:49] Speaker ?: Yeah. [00:07:54] Speaker 3: You said you have a three and a half year old son? Did you invite Mamta to that rice feeding ceremony? [00:08:01] Speaker 4: Yes. Both of them were there. [00:08:03] Speaker 3: And did they both attend? Sorry? Did they both attend the party? [00:08:07] Speaker 4: Yeah, they attend my rice ceremony party for my son, Norris and Mamta both. [00:08:12] Speaker 3: Did Mamta have a rice feeding ceremony? [00:08:19] Speaker 4: Yes. I was there too. [00:08:26] Speaker 3: When was Mamta's rice feeding ceremony for her baby? [00:08:31] Speaker 4: It was on the winter, August, I don't remember. It's like probably December. [00:08:42] Speaker 3: Was that the first time Mamta invited you to the rice feeding ceremony? [00:08:46] Speaker 4: For the rice ceremony, yes. [00:08:51] Speaker 3: Could you talk about your closeness with Mamta? Were you close or were you not so close? [00:08:57] Speaker 4: I'm close with her. [00:08:59] Speaker 3: And when you say you were close with Mamta, what do you mean by that? [00:09:02] Speaker 4: She used to share everything with me. [00:09:10] Speaker 3: Did Mamta ever discuss her relationship with you? [00:09:14] Speaker 4: Yes. Not initially, but after they had a fight. Yes. She told me everything. [00:09:31] Speaker 1: I don't have a question that elicits hearsay yet. The question of did she share with you about her relationship does not elicit hearsay. That's overruled. If you need to approach on where this is going, you're welcome to. [00:10:09] Speaker ?: Thank you. Thank you. [00:11:09] Speaker 1: We're going to go ahead and handle something outside of your presence. I don't anticipate it's going to take long, but I've been wrong on that before, so I'm going to ask you all to step back, and we will let you know when we're ready for you. [00:11:39] Speaker ?: Okay. Thank you. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Okay. Ms. Nupon, did Mom ever discuss her feelings with you about her relationship? Yes. Yes. At that point, how long had you known her? Like the feelings? At the point that Mom was comfortable sharing with you, how long had you known her? It's... It's... She shared me everything, she shared me everything, and she shared me everything. Okay. [00:12:09] Speaker 2: Okay. Okay. [00:12:11] Speaker ?: Okay. Okay. Okay. Okay. [00:12:15] Speaker 3: Okay. Ms. Nupon, did Mom ever discuss her feelings with you about her relationship? [00:12:19] Speaker 4: Yes. [00:12:20] Speaker 3: At that point, how long had you known her? [00:12:25] Speaker 4: Like the feelings? [00:12:27] Speaker 3: At the point that Mom was comfortable sharing with you, how long had you known Mom? [00:12:33] Speaker 4: Yes. It's... She shared me everything on... While she was at my house. That's on February. [00:12:41] Speaker 3: So my question is, at the time that she's sharing with you, had you known her for a long period of time? Yes. How long had you known her? [00:12:52] Speaker 4: Almost like two years, two and a half years. [00:12:57] Speaker 3: And are you... Do you know what employment Momta had? Yeah. What did she do for work? [00:13:05] Speaker 4: She is a nurse. She was a nurse. Yes. [00:13:08] Speaker 3: Just like you? Yeah. So is that something that you were able to bond with Momta over? Yes. [00:13:14] Speaker 1: Ms. Williams, I am not doing full testimony outside of the presence of the jury. I'm just asking to see if you can lay a foundation. And none of these potential of possibly one are foundational questions. So get me to where you want to be on these statements because we can't do half the trial outside their presence. Happy to. [00:13:35] Speaker 3: Did Momta talk to you about... What did Momta talk to you about her relationship? [00:13:49] Speaker 4: After the like plan for the rice ceremony party, they had a fight and Momta told me Norris hit her. And also her mom, her, his mom was not happy. She also saw me the video as well while she was at my house after the fight. [00:14:09] Speaker 3: Okay. So let's talk about February. Yeah. What year are we talking about? [00:14:14] Speaker ?: 2023? Was it the February right before Momta went missing? [00:14:16] Speaker 4: Yeah. How many years ago was that? Two years ago. [00:14:19] Speaker 3: When did you first talk to Momta about what was going on in her relationship? [00:14:37] Speaker 4: She was actually walking to my neighborhood on the phone. She was crying and I found her when I was walking too. And she suddenly grabbed me and crying and I took her in my house like what happened. And she told me everything. [00:14:51] Speaker 3: Okay. So she was crying, walking. Where did... Why did you know she was walking to your house? [00:14:56] Speaker 4: I did not know that she was walking. I was walking in my neighborhood. It was like evening time. She came close to the Walmart side. [00:15:03] Speaker 3: And when you took her to your house, what did she tell you? [00:15:07] Speaker 4: She told me they had a fight before the rice ceremony party. They actually changed the original date of the rice ceremony party. When they invited us, that was the date. They changed it a little bit later because she had a bruise on her face. She also showed me the picture as well. [00:15:25] Speaker 3: Did you see the bruise on her face? [00:15:27] Speaker 4: Yes. [00:15:28] Speaker 3: And you said she showed you a picture? What was the picture about? [00:15:35] Speaker 4: He hit her on the face. It was the bruise on her left cheeks. Let me get clarification. [00:15:43] Speaker 1: Is this all in that February conversation? Mm-hmm. You mentioned February. I don't think I heard her say February, but it's... Is that all the same conversation? [00:15:53] Speaker 4: Yeah. I see the video. It's not on the face and the person. [00:15:57] Speaker 1: You saw the video, but that's when you saw her walking and crying. She came into your house and told you what happened. [00:16:04] Speaker 5: Mm-hmm. [00:16:05] Speaker 1: Anything else from that day? Okay. [00:16:08] Speaker 3: Yes, Your Honor. [00:16:09] Speaker 1: Okay. [00:16:10] Speaker 3: On that day, did you offer help to Mamta? [00:16:15] Speaker 4: Yes, I did. [00:16:16] Speaker 3: What kind of help did you offer her? [00:16:17] Speaker 4: I told her she can stay at my house if she just don't want to go back because she said that they were not even letting her to eat and she was hungry for a few days also. [00:16:31] Speaker 3: You said they were not letting her eat. What do you mean by that? [00:16:35] Speaker 4: His mom and him, they also did not let her eat in the house. Why not? They had a fight. [00:16:50] Speaker 3: During that time, did she stay with you? [00:16:53] Speaker 4: Yes. [00:16:54] Speaker 3: How long did she stay with you for? [00:16:56] Speaker 4: Almost 19 days at my house. [00:17:02] Speaker 3: Was she with Nima? [00:17:04] Speaker 4: Initially, when she came in, she was by herself. [00:17:07] Speaker 3: And how long until Nima came? [00:17:10] Speaker 4: In between seven to eight days, Norish came into my house around like 6:30ish. He was the one who dropped Nima at my house. And Mamta was about to go to her night shift at the work. And Mamta told him to like, can you just take her back? Because his parents was there to watch her. And she said, I can watch her from tomorrow, but I have to go to night shift. She already had so many call out in the work. But he did not listen to her. And he just dropped the Nima at my house. And her Uber was already outside. She went to the work. [00:17:42] Speaker 3: Did he say anything to you during that incident? [00:17:45] Speaker 4: He did not say anything to me. [00:17:50] Speaker 3: During that February time when Mamta was talking to you, did she talk to you about the defendant's faithfulness to her? [00:17:58] Speaker 4: Yes, he was not. [00:18:01] Speaker 3: And what did she tell you specifically when it came to the defendant's faithfulness? [00:18:06] Speaker 4: So their fight was beginning because the reason was like she said he has multiple girlfriends and he found like couple of the evidence through his phone. That was the reason they started from the fight. [00:18:19] Speaker 3: That she found in his phone. What did she find? What did she find? [00:18:23] Speaker 4: Like messages and chat that he was talking about some other random girls. [00:18:33] Speaker 3: At that point, did Mamta talk to you about divorce? [00:18:37] Speaker 4: Yes. [00:18:40] Speaker 3: And what about divorce did Mamta say? [00:18:43] Speaker 4: She wanted to get divorced and just take Nima with her. But he did not want it. [00:18:57] Speaker 3: I think at this point, Your Honor, we can stop. [00:19:00] Speaker 1: I have an objection for hearsay and other other grounds. Mr. Edwalt. Go ahead. [00:19:07] Speaker ?: Could you ask a question? [00:19:08] Speaker 1: Sure. [00:19:22] Speaker 6: Hi, Ms. Nupani. I want to clarify a couple of things. The video that you're talking about, was it video of the actual fight or was it a video of Mamta afterwards? [00:19:40] Speaker 4: It was the afterwards. [00:19:43] Speaker 6: And was Mamta just taking a video of -- what was she taking a video of? [00:19:49] Speaker 4: She was taking the video that they -- his family was talking. And also at the end of that video, she pointed out to herself also it was she and the bruise on her cheeks. [00:20:03] Speaker 6: You didn't see the fight? [00:20:05] Speaker 4: I didn't see it. [00:20:06] Speaker 6: And you didn't see how the bruise happened yourself? Yes, I didn't see it. And the picture of the bruise, is that from the same fight or is that a different bruise? [00:20:19] Speaker 4: It was from the same fight. [00:20:21] Speaker 6: Did you see the bruise on Mamta yourself or just in a picture? In the picture. [00:20:27] Speaker 4: And when you saw Mamta walking in your neighborhood, did you start talking on the walk back or did you get back to your house and then she told you? [00:20:38] Speaker 6: I was -- I started talking like, what happened? [00:20:53] Speaker 4: Why are you crying? Why are you crying? I started from the walking. [00:20:57] Speaker 6: And just to be very clear, all of the information about the relationship between Mamta and Naresh, you heard from Mamta. Yes. And you didn't see any of it yourself? Sorry, you didn't see anything happen in the moment? [00:21:24] Speaker 4: Yeah, I didn't see on my eyes. [00:21:26] Speaker 6: Judge, based on that, I have hearsay objections, I have -- [00:21:34] Speaker 1: Well, let's take them one at a time. I've got -- I've got the statements and she's crying and grabbed her, so you've got the objection response? [00:21:51] Speaker 3: Relying heavily on the motions that I previously filed. [00:21:54] Speaker 1: Just -- just give me your basic hearsay response. [00:21:57] Speaker 3: The mental, emotional, physical condition, state of mind. Right. [00:22:01] Speaker 1: That objection's overruled. Those statements come in. Next. What are your other objections? [00:22:07] Speaker 3: Prior bad acts. [00:22:10] Speaker 1: Response. [00:22:11] Speaker 3: Your Honor, 2:404 B Evidence, the prior bad acts that defense is raising. These come in to show intent, motive, lack of mistake, a long list of things which all apply in this case. [00:22:25] Speaker 1: Any response to that? Yes, ma'am. [00:22:28] Speaker ?: Yes, ma'am. [00:22:29] Speaker 6: First of all, the balance attests for 4 or 4B, that prior bad act evidence only comes in if the legitimate, primitive value of something. It outweighs it's incidental. It's a higher standard than regular relevance. I'm pulling that from Williams versus Commonwealth 85 VA app, 2025, and I have copies if the court needs. [00:22:59] Speaker 1: I do not need. [00:23:01] Speaker 6: I don't need to do anything. [00:23:02] Speaker ?: I don't need to do anything. I don't need to do anything. [00:23:03] Speaker 6: I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. [00:25:36] Speaker ?: I don't need to do anything. I don't need to do anything. [00:25:38] Speaker 3: I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. I don't need to do anything. [00:26:49] Speaker 1: No, no, we're not. We're not. It's your objection that we're done with the argument. I'm going to allow the evidence in. I think that it is not so remote as to not be part of the motive in this case. It is a clear state of mind exception to the hearsay rule. And Virginia law also has been moving in the direction of allowing the sin to show the nature of the relationship of the parties. And we are only five months, if I did my math right, in advance of the date they're claiming that he's missing, that she is missing. So I'm going to allow that in. Do you have more that's coming in through this witness so I don't have to keep bringing the jury back and out? [00:27:37] Speaker 3: I have somewhat, I'm not sure if defense will raise an objection to this, but it might as well address it head on beforehand. Ms. Newpond, at any point did you assist MAMTA in accessing a bank account? [00:27:57] Speaker 1: Are you going to, this is not about hearsay or prior bad acts. This is not. [00:28:02] Speaker 6: Ms. Newpond wants to just proffer questions. [00:28:05] Speaker 1: Yes. [00:28:06] Speaker 3: Certainly. So proffering about the witnesses assisting MAMTA in getting a new phone and getting a bank account that is separate apart from her husband. Is there an objection to that? [00:28:17] Speaker 1: No. [00:28:18] Speaker ?: Okay. [00:28:19] Speaker 1: All right. Let's bring in the jury. [00:28:23] Speaker 3: Force brief indulgence, there is, I missed one line. There is some prior bad acts as far as sexual prior bad acts. And I can certainly proffer that when MAMTA was postpartum, the defendant wanted to have sex with her in certain positions and that was being communicated to the witness. [00:28:52] Speaker 1: You're going to have to lay some solid foundation on that, approach on that. [00:29:10] Speaker ?: Okay. Thank you. Thank you. Thank you. Thank you. Thank you. Thank you. All right. [00:30:41] Speaker 1: When you all left, there was an objection to hearsay and other things. I heard testimony. I have overruled the objections with exception to the last part that just came out and that is sustained. The lawyers know now what they're going to do. We're going to start again. [00:31:01] Speaker 3: We're going back to where we left off. At any point, did MAMTA discuss her relationship with you? At any point, did MAMTA discuss her feelings about her relationship with you? [00:31:15] Speaker 4: Yes. [00:31:20] Speaker 3: When was the first time that MAMTA talked to you about her relationship with the defendant? [00:31:27] Speaker 4: Once she was at my house on February. [00:31:30] Speaker ?: Okay. [00:31:31] Speaker 3: And going back, you said it was February. How many years ago was that? [00:31:36] Speaker 4: It was two years ago, two and a half almost. [00:31:39] Speaker 3: Was that the February of 2024? [00:31:44] Speaker 4: Yes, 2024. [00:31:49] Speaker 3: And in February of 2024, how did MAMTA start talking to you about her relationship? [00:32:01] Speaker 4: She was at my house after when I find her. She was crying. I took her to my house and then I asked her what happened. Why are you crying? And then she told me everything at that time. [00:32:12] Speaker 3: Okay. So backing up, where did you see her when she was crying? [00:32:16] Speaker 4: In my neighborhood close to the Walmart. [00:32:23] Speaker 3: What was she doing when she was crying? [00:32:25] Speaker 4: She was talking in a phone when I found her first. [00:32:31] Speaker 3: And at any point, did you stop and ask her what was wrong? [00:32:34] Speaker ?: Yeah. [00:32:41] Speaker 3: Where did you take MAMTA? [00:32:42] Speaker 4: In my house. [00:32:44] Speaker 3: And while she was in your house, did she talk to you about her relationship? [00:32:47] Speaker 4: Yes. [00:32:54] Speaker 3: What did she talk to you about? [00:32:55] Speaker 4: She said they had multiple fights in the last couple of years. And she said she was tired with everything. She just wanted to move on with her daughter. [00:33:07] Speaker 3: She said she had multiple fights. Did she show you anything about the fight? [00:33:15] Speaker 4: No. That's the only video I saw. [00:33:19] Speaker 3: Okay. You said a video that you saw. What do you mean by that? [00:33:22] Speaker 4: That was the video. She took it after their fight in December. I think before her past knee. That's what she said. [00:33:32] Speaker 3: And the video that she showed you, what did you see in that video? [00:33:35] Speaker 4: She was clicking the conversation, her in-laws and husband. And at the end, she also had a picture move her camera around her face too. [00:33:47] Speaker 3: And what was on her face? [00:33:48] Speaker 4: It was a little bit of bruise on her left cheeks. [00:33:53] Speaker 3: And did you see a bruise on her? [00:33:55] Speaker 4: Yes, on the video. [00:34:00] Speaker 3: Did she talk to you about how that bruise got there? [00:34:03] Speaker 4: She said he hit her. [00:34:14] Speaker 3: Did she talk to you about her rice feeding ceremony? [00:34:17] Speaker ?: Yes. [00:34:18] Speaker 3: Did she talk to you about her first rice feeding ceremony? Yes. And did she say anything to you about scheduling that ceremony? [00:34:29] Speaker 4: She had to move her rice ceremony dead because she had a bruise on her face. The original date was different and then she invited again another date. [00:34:40] Speaker 3: You said she had to reschedule her rice feeding ceremony to a different date? Yes. And the reason for that was because she had a bruise on her face? Did mom to ever talk to you about divorce? [00:34:57] Speaker ?: Yes. [00:34:59] Speaker 3: What did mom to tell you about divorce? [00:35:02] Speaker 4: She said she has been trying so hard to keep that relationship with Norris and he's been like hitting her so many times. He was cheating her and after the postpartum their relationship was not good. I invited Norris at my house after she came to my house. The next day I invited Norris in my house. Me and my husband we wanted to have a conversation like why are you guys fighting? What's happening? And the Norris point was like he is not happy because he's not cleaning her house. That's the reason he said that. [00:35:35] Speaker 3: I'm going to stop you there and I'm going to circle back a little bit and we'll get there. When she first talked to you about divorce, did she indicate that there was a fight that started? And what was that fight about? [00:35:52] Speaker 4: She found out like multiple chats and conversation with other girls. That was the reason the fight has been started. [00:35:59] Speaker 3: And when you say multiple chats with other girls, what did she tell you about those chats? [00:36:04] Speaker 4: She did not mention me anything about the chat but that's what she said. [00:36:09] Speaker 3: And you said multiple girls. Did she tell you how many? [00:36:12] Speaker 4: No, she did not mention how many. But she said like a couple of in the Maryland and also in the Virginia and also one in the Nepal. His parents also know that goal as well. [00:36:24] Speaker 3: That his parents know the girl that he was chatting to? [00:36:28] Speaker 4: Yeah, that was the goal. They just want to get married first. [00:36:31] Speaker 3: The girl that he was going to get married to first. [00:36:36] Speaker 4: Yeah, in a back home and still he was talking to her. [00:36:40] Speaker 3: And what did mom to tell you about that girl? [00:36:43] Speaker 4: That was the fight. It started after this goal actually. [00:36:50] Speaker 3: You said you were born in Nepal? How is divorce looked on in your culture? [00:37:00] Speaker 4: We actually don't go through the divorce until this is the last case scenario. We tried to like, you know, compromise and try to think sort out. We tried to fix it first. [00:37:20] Speaker 3: Is there anything else about divorce in the Nepali culture? Sorry? Is there anything else about divorce in the Nepali culture? [00:37:35] Speaker 4: I still didn't get that one. I still didn't get that one. Yeah, it's like if you are divorced, the society will be like, you know, looking in a different way. Like, hey, she's a divorce. There is like no chance you can get another man or woman. And this is like that how we look at it. [00:38:05] Speaker 3: You testified previously that you invited Naresh to come talk to you? [00:38:09] Speaker ?: Yeah. [00:38:10] Speaker 3: When did you invite Naresh to come talk to you? [00:38:13] Speaker 4: After Momta came to my house the next day. [00:38:16] Speaker 3: And did Naresh come to talk to you? [00:38:19] Speaker ?: Yes, he did. [00:38:21] Speaker 4: Who all was there? It's me, my husband and Momta and Naresh. [00:38:27] Speaker 3: What did the defendant say to you about what was happening? [00:38:31] Speaker 4: I asked him like, why are you fighting? What was the reason? Because Momta came to my house. Her phone was already blocked. Her account was already locked. There was no money at all. I see on my eyes. My husband also see that. And why you did that? And he said, because she's not cleaning the house. He's not following her, whatever his mom telling. [00:38:59] Speaker 3: Do you recall whether or not his parents were in the United States at that point? [00:39:04] Speaker 4: They were there. [00:39:05] Speaker 3: And do you recall where they were living at that point? [00:39:08] Speaker 4: I did not recall them. [00:39:13] Speaker 3: Do you recall any fights around food? Sorry? Do you recall any fights Momta was having about food? [00:39:24] Speaker 4: Yes, she mentioned that they were not letting her to eat in a house. [00:39:28] Speaker ?: An objection to that. [00:39:33] Speaker 1: Thank you, Mary. [00:39:35] Speaker ?: Thank you. [00:40:05] Speaker 1: Ladies and gentlemen, the jury, I'm going to go ahead and strike from the record from the question with regard to food and any answer that was given. [00:40:18] Speaker 3: During that conversation that you had with Naresh, did he say anything else about why they were fighting? [00:40:35] Speaker 4: Yeah, that was the reason he said she was not cleaning the house. That's the only reason he said that in front of me and my husband both. [00:40:42] Speaker 3: Did the defendant ever admit to you that he hit Momta? [00:40:51] Speaker 4: Yes, he said he was trying to protect himself. That's how she got hurt. [00:41:02] Speaker 3: During that time in February of 2024, did Momta ask for help from you? Yes. Did you give her help? What kind of help did you give her? [00:41:14] Speaker 4: I let her to stay at my house. She did not have phone. She had a new brand, 15 Pro Max, under his name. He blocked that phone and blocked the line. And also he took all the money. I took her to the banks. She used to drive a car, but she did not have any. They have only one car. So I took her to the bank, opened the bank account. I gave her some cash and also bought the tubal mini phone through the Amazon also. So she can use the Uber to go to work. [00:41:41] Speaker 3: And go back a little bit. How long did she stay with you at your house? [00:41:45] Speaker 4: Almost like 10, 11 days. [00:41:57] Speaker 3: Did Momta ever drive a car to your knowledge? [00:41:59] Speaker 4: Yes. She had a driver license. [00:42:01] Speaker 3: She had a driver's license, but did you ever see her drive a car? [00:42:05] Speaker 4: Yes, I have seen it. [00:42:09] Speaker 3: Did you ever see her take Ubers or Lyfts? [00:42:12] Speaker 4: Mostly Uber and Lyft. [00:42:14] Speaker 3: Did you see her usually drive or usually take Ubers or Lyfts? [00:42:19] Speaker 4: She always take Uber and drives because she did not have a car. Norris has only one car. [00:42:28] Speaker 3: Do you know what car Norris had? [00:42:30] Speaker 4: Tesla? [00:42:31] Speaker ?: Tesla. [00:42:31] Speaker 3: And you said that was the only car that they had? [00:42:36] Speaker ?: Yeah. [00:42:38] Speaker 3: And who was the one to drive the Tesla? [00:42:40] Speaker 4: Norris. [00:42:41] Speaker 3: Did you ever see Momta drive the Tesla? [00:42:46] Speaker ?: No. [00:42:46] Speaker 4: He never let her drive. That's what she said. [00:42:49] Speaker 3: Did you ever assist Momta in getting a bank account? [00:42:57] Speaker 4: Yes, I took her to the bank to open the bank account. [00:42:59] Speaker 3: Do you recall what bank that was? It was close to my house. [00:43:02] Speaker ?: I have to remember. Sorry. Would anything refresh your recollection? Sorry? Would looking at the bank account refresh your recollection as to what bank it was? Yeah. Of course, brief indulgence. [00:43:03] Speaker 4: No. Of course, brief indulgence. No. Okay. It's next to the Fresh World at Madison. [00:43:08] Speaker ?: It's next to the Fresh World at Madison. [00:43:08] Speaker 4: I'm sorry. [00:43:09] Speaker ?: I'm sorry. Would anything refresh your recollection? Sorry? [00:43:12] Speaker 3: Would looking at the bank account refresh your recollection as to what bank it was? [00:43:25] Speaker 4: Yeah. [00:43:26] Speaker 3: Of course, brief indulgence. [00:43:30] Speaker 4: It's next to the Fresh World at my house. Oh my. I'm postpartum. Sorry. [00:43:47] Speaker 3: So, I'm approaching you with a document if you could take a look at this. Yeah. Yeah. Yeah. It was a Chase bank. Why did you help mom to get a bank account? [00:44:27] Speaker 4: So, she mentioned that she does not have any money at all. He used to control all the money and also she sold me the bank account. She did not have any money. He gave her a credit card. That's only she can use it but he was the one who was controlling all the transferring and money and everything. That's what she said. [00:44:48] Speaker 3: And at any point, did you assist Momta in getting anything else? [00:44:55] Speaker 4: No. That's the only - I took her to the bank and opened bank accounts. She wanted to buy a car, save some money, at least like five to six thousand. That's why she opened the bank account. [00:45:06] Speaker 3: Did Momta have a phone? [00:45:09] Speaker 4: Yes. She had a phone when she came to my house. It was the 15 Pro or 15 Pro Max. [00:45:15] Speaker 3: Was there any issues with Momta's phone when she came to your house? No. [00:45:19] Speaker 4: It was not. But initially, within a few hours, her phone number was blocked and then the phone was reported missing and stolen. [00:45:26] Speaker 3: Okay. How do you know that? [00:45:28] Speaker 4: She showed me in front of me so that she requested me like she had to work next day. She cannot do Uber. That was the reason I bought the phone from Amazon and the next day I did Uber for her. It takes like maybe 24 hours from the prime to get her phone. [00:45:43] Speaker 3: Okay. So the phone that she came to your house with, you said initially that was working. [00:45:48] Speaker 4: Yeah. [00:45:49] Speaker 3: At any point - at what point did that phone stop working? [00:45:54] Speaker 4: Almost two to three hours at my house. So two to three hours? [00:45:58] Speaker 3: Mm-hmm. And how did that phone stop working? [00:46:04] Speaker 4: Her phone - I don't know, but initially after two to three hours, her phone was like totally sat down. She was not able to make a call and then it was all down. [00:46:19] Speaker 3: You previously testified that it was reported missing. How do you know that it was reported missing? [00:46:26] Speaker 4: The iPhone shows like we call the Apple Store and it says the phone was reported missing. Report missing. [00:46:35] Speaker 1: Sustained. [00:46:36] Speaker 3: At any point during this time, February of 2024, did Manta talk to you about becoming an American citizen? [00:46:49] Speaker 4: Yes. [00:46:50] Speaker 3: What did she say about becoming an American citizen? [00:46:56] Speaker 7: Sustained. [00:46:58] Speaker 3: This goes towards the state of mind of the victim. [00:47:02] Speaker 1: Lay your foundation before you ask the question, Ms. Williams. [00:47:05] Speaker 3: Are you familiar in your own life with immigration practices from Nepal to the United States? Yes. And how are you so familiar with that? [00:47:20] Speaker 4: Sorry? [00:47:21] Speaker 3: How are you familiar with the immigration process from Nepal to the United States? [00:47:26] Speaker 4: So we have like a different categories how you can come to the United States. Some people come in through the Eastern Visa or Lottery DV or also some of them through the husband. This is how we came in here in the U.S. [00:47:41] Speaker 3: And are you familiar with how Manta came into the United States? Yes. And how did she come into the United States? [00:47:51] Speaker 4: After she got married with the nurse, he bring her here. [00:47:56] Speaker 3: And once she came into the United States, was she able to work in the United States? Yes, she was. And how did she work? [00:48:09] Speaker 4: Initially she was working in some gas station, also working as a nanny before she did not have any license for the nursing, but after the nursing license, she started working as a nurse. [00:48:22] Speaker 3: And do you know whether or not Manta was an American? [00:48:27] Speaker 4: No, she was not. She was only a green card holder. [00:48:31] Speaker 6: I'd ask for foundation on how she was that. [00:48:35] Speaker 3: Okay. I'm happy to leave the foundation. How did you come to know that Manta was not an American citizen? [00:48:43] Speaker 4: She told me. And also Naresh told me too. [00:48:48] Speaker 6: I object to it coming in your Manta. [00:48:53] Speaker 1: I'll sustain that. It can come in through Mr. Pott. Thank you. [00:48:58] Speaker 3: So what did Naresh tell you as it relates to Manta being an American citizen or not? [00:49:05] Speaker 4: So it's a process. She was in a green card holder. They gave her a conditional green card, which is for only two years. So after three years, you will be able to apply for the citizenship. [00:49:18] Speaker 3: Did Naresh talk to you about whether or not she was applying for citizenship? Yes. [00:49:25] Speaker 4: He said that he was going to apply for her, but that was not the time to apply. But later she applied by herself when it was the time. [00:49:43] Speaker 1: The stand, I'll strike it. [00:49:54] Speaker 3: At any point during talking to Manta during this time, were you aware whether or not Naresh knew where she was? Yeah. He knew it. It's vague and speculative, and I'll let you try and flesh that out better. Understood. Understood. [00:50:09] Speaker ?: At any point when you had Manta staying over at your house in February 18th? [00:50:09] Speaker 3: Did you know? Did you know one way or the other whether or not Naresh knew where she was? [00:50:13] Speaker 4: Yeah. He knew it. [00:50:15] Speaker ?: It's vague and speculative, and I'll let you try and flesh that out better. Understood. Understood. [00:50:19] Speaker 1: At any point when you had Manta staying over at your house in February of 2024, did Naresh come? Yeah. He used to come in every single day, but he never came in inside in my house. [00:50:28] Speaker ?: But I can see and I had a camera at my house. He used to come in every single day. [00:50:32] Speaker 3: He used to come in every single day, but he never came in inside in my house. [00:50:45] Speaker 4: But I can see and I had a camera at my house. He always coming outside. And he was following after once he get out from my house to the work. [00:50:53] Speaker 3: So if you had a camera outside your house, could you tell that it was Naresh that was coming? [00:51:00] Speaker 4: Yeah, it was Naresh. [00:51:01] Speaker 3: How could you tell it was Naresh? [00:51:02] Speaker 4: I see him also from the inside, his car and everything. I can recognize him. [00:51:07] Speaker 3: At those times, did he come up to your door and talk to you? [00:51:11] Speaker 4: No, he did not. [00:51:13] Speaker 3: What was he doing around your house? Objection, speculation. [00:51:19] Speaker 1: I guess that depends on the answer. Are you asking what was he physically doing as she observed him? That you can answer. Sorry? [00:51:28] Speaker 3: What was Naresh physically doing when he was inside the house? [00:51:32] Speaker 4: He was inside the car and he just took Uber and he was just following after her. [00:51:37] Speaker 6: Objection to that, that speculation is correct. That's fine to her. [00:51:43] Speaker 8: From what you could see, where did he go when she left? Oh, he was just following her Uber. I think that's loud if she could see it. [00:52:04] Speaker 3: After that time that Mamta was staying with you, at any point did she go back home to your knowledge? [00:52:12] Speaker 4: After my house she went to the apartment. It's close to the Fairfax because she thinks Norris was coming every single day at my house and it's bothering us. So she wanted to move out from my house. [00:52:26] Speaker 3: To your knowledge, at any point did Mamta return to her Manassas home? [00:52:34] Speaker 4: Yes. We were the one who left her in a home. [00:52:38] Speaker 3: To your knowledge, when was that, that she returned to her Manassas home? [00:52:43] Speaker 4: It's between around the end of the second week after my house. She came back to my house and Asi's parents came to my house to convince her. It was the Norris birthday. We left her home on that day. [00:53:01] Speaker 3: Objection to hearsay. And I'm not seeking to elicit that as for the truth of the matter. [00:53:08] Speaker 1: I'm going to let that stand as what happened, what she saw happen. There's the parents came to her home. [00:53:14] Speaker 3: And you can finish answering the question. [00:53:19] Speaker 4: Yeah, it was the Norris birthday when we left her home, tried to sort out the things. It's me, it's my family, Asi's family, and then the Norris family. We were there to sort out things. And we celebrate his birthday as well. [00:53:32] Speaker 3: So that was for Norris's birthday? Yeah. And were you also there to celebrate Norris? [00:53:37] Speaker 4: No. We just went there to drop her off. And later on we knew it, it was his birthday. And they were like a cake and everything was ready. [00:53:48] Speaker 3: At any point after she returned home, did she continue to talk to you? [00:53:52] Speaker 4: Yes. [00:53:53] Speaker 3: What did she continue to talk to you about? [00:53:56] Speaker 4: She wanted to work. She left her job. [00:54:00] Speaker 1: I don't know if it will be. You can answer the question of what, in general, she talked to you about. [00:54:13] Speaker 4: Well, she talked to me about getting her citizenship applied, wanted to work as a nurse in my hospital. [00:54:20] Speaker 3: And did she continue to work as a nurse, to your knowledge? [00:54:24] Speaker 4: Sorry? [00:54:25] Speaker 3: Did she continue to work as a nurse, to your knowledge? [00:54:28] Speaker 4: Yeah, I do for her in my hospital, in the UVA. [00:54:33] Speaker 3: Thank you. What was the last contact that you had with Mamta? [00:54:50] Speaker 4: I had a chat on July 29th. I invited her through the chat at my housewarming party, which was August. So I asked her, "Can you come to my housewarming party?" That was the last conversation I had on the chat. [00:55:05] Speaker 3: When was your housewarming party scheduled for? [00:55:08] Speaker 4: It was for August 22. [00:55:11] Speaker 3: Did she respond in any way to your message inviting her to that housewarming party? [00:55:17] Speaker 4: Yes, she said she would let me know. But you know the situation, that's what she said. [00:55:28] Speaker 3: Did she ever go to your housewarming party? [00:55:30] Speaker 4: No. [00:55:32] Speaker 3: Since July 29th, 2026, has she messaged you back in any way? No. Have you heard from her at all? Have you seen Mamta at all? And for the record, the witness is shaking her head no. Could you please answer audibly on whether or not you've seen Mamta since July 29th, 2024? No. How did you find out that Mamta was missing? [00:56:07] Speaker 4: I got the call from Mamta's mom and brother and also the sister from the New York. [00:56:15] Speaker 3: When did you find out that Mamta was missing? [00:56:17] Speaker 4: It was August 2nd or 3rd. [00:56:24] Speaker 3: Did the defendant tell you that Mamta was missing? [00:56:27] Speaker 4: No, he did not tell me. And I called him immediately that day when I got to know. And we wanted to be in his house and he said no, don't come in. But my husband was the one who called him. And my husband said, can I just come in by myself? And he was like, no. Then I was so afraid to go to his house by ourselves. I called Asis. And Asis and we went all together in his house. Instead of he said no, don't come in. But we went there. [00:56:53] Speaker 3: So did Naresh at that time invite you into his house at all? No. [00:56:58] Speaker 4: We went by ourselves. We called him. He said don't come in. It's my husband called, not me actually. I'm just going to clarify. First, brief indulgence. [00:57:18] Speaker 3: Going back just a little bit. When Mamta started working at UVA, do you know when she started working at UVA? [00:57:27] Speaker 4: It was probably the July. [00:57:33] Speaker 3: Do you know whether or not she started working on time? [00:57:38] Speaker 4: Like she was started on time for the orientation period. Yes. [00:57:48] Speaker 3: When Mamta stayed with you at your house, you said that eventually Naresh came with Nima. Yes. When was that? [00:57:57] Speaker 4: It was between 6th or 7th day at my house. Yes. [00:58:03] Speaker 3: To your knowledge, did Mamta want Nima there earlier than that? [00:58:11] Speaker 4: Yes. She wanted, but because of the work, she had multiple call outs on the work. She did not want it to be fired from the Fairfax Ainaba because that was the one reputation hospital around in Virginia. She already had a few call outs from the work. Just for the work. Yes. [00:58:28] Speaker 3: Could you talk to us about Mamta's relationship with Nima, her daughter? Yes. [00:58:34] Speaker 4: She was such a loving mom. [00:58:36] Speaker ?: Yes. [00:58:38] Speaker 3: Was there anything about Mamta's relationship with Nima that stood out to you? [00:58:42] Speaker 4: She was such a great mom. I think even, I am not maybe, but she was a great mom. She was so worried about her. She was trying to save some money so that she can take care of her daughter. Yes. [00:59:04] Speaker 3: Based on your understanding of who Mamta was, would she leave her daughter? [00:59:11] Speaker 4: No. No way. Even she told me if she is going anywhere, she will let me know. I was the only one person she can trust. That's what she said. [00:59:20] Speaker 3: Did Mamta ever talk to you about the defendant saying he wanted a divorce? Sorry? Did Mamta ever talk to you about the defendant Naresh talking about divorce? [00:59:37] Speaker 4: I think he didn't want to give her divorce that what she mentioned to me. [00:59:45] Speaker 3: That he didn't want to give a divorce? [00:59:47] Speaker 4: She was thinking because maybe of the money we had to give it our cultures. [00:59:54] Speaker 1: Sustained. This goes to the state of mind. I heard, I think he was thinking. I have a lot of speculation there. Sustained. Understood. [01:00:17] Speaker ?: I should say for the record it was also hearsay. [01:00:18] Speaker 3: Ms. Nupon, did Nima ever have a first birthday party? [01:00:32] Speaker 4: Yes. [01:00:33] Speaker 3: Did you attend that birthday party? [01:00:35] Speaker 4: I was the one who was planning. So you were the one who did what? I was the one who went to celebrate the birthday party. I booked the cake and I was the one who wanted to do her first birthday party. [01:00:45] Speaker 3: So you brought the cake for the birthday party? Yeah. [01:00:48] Speaker 4: Did you make plans about the birthday party? [01:00:51] Speaker 3: Yeah. [01:00:52] Speaker 4: Norris didn't want to do because of the situations and everything. But yes, I called him like, hey, let's do it. It's going to be forever, the first birthday party. [01:01:00] Speaker 3: Was Mamta at the birthday party? No. Did you attend Nima's second birthday party? [01:01:11] Speaker ?: Yes. [01:01:12] Speaker 4: No. Second, no. Third, yes. [01:01:15] Speaker 3: Did you attend her third birthday party? Yes, sir. Did you attend her third birthday party? Yes. Was Mamta at her third birthday party? [01:01:21] Speaker 9: No further questions for this witness. [01:01:28] Speaker 3: If you could answer any questions that defense counsel has for you at this time. [01:01:33] Speaker 1: All right. [01:01:34] Speaker ?: Ms. Rodwell. [01:01:35] Speaker 6: Good morning, ma'am. I want to make sure I'm getting your name right. Is it Nupan or Nupani? Nupani. Nupani. Nupani. Ms. Nupani, I'm sure this is very difficult for you to be here. Ms. You just told us a lot about what you saw of Naresh and Mamta's relationship. You did not live with them, correct? No. Ms. You didn't see every day they spent together. No. Ms. Most of what you just told us came from Mamta. Everything that you said actually was what Mamta told you about Naresh. You didn't see the fight that you just talked about? Yeah. [01:02:38] Speaker 4: I didn't see it. [01:02:40] Speaker 6: Ms. You did not see Naresh hit Mamta? [01:02:43] Speaker 4: No. [01:02:44] Speaker 6: Ms. You did not see how Mamta would interact with Naresh. apart from when you were together as couples, correct? Yes. Ms. You said that Mamta moved back to the house in Manassas after February. For the record, yes or no? Ms. Yes. Ms. And to your understanding, she said that everything was fine with their relationship after February and that they were working on things, correct? Ms. Yes. Ms. Court's in Google. No further questions, Judge. [01:03:39] Speaker 3: No further questions Judge. Any redirects? Ms. Dupon, you were friends with Naresh first, is that correct? Yes. You were friends with Mom to after? Yes. Could you describe for the court and for the members of the jury your efforts to look for Mom to? [01:04:25] Speaker 1: Stained. [01:04:27] Speaker 3: I think her cross-examination included her efforts to indicate where she went after she left [01:04:37] Speaker 1: the House, it goes to the efforts to search for her? No. The objection is sustained. [01:04:51] Speaker 3: Ms. Dupon, as far as your relationship with both Naresh and with Momta, could you describe your relationship with both of them before they moved to Manassas? Sustained. [01:05:08] Speaker 1: Understand. No further questions at this time. All right. Is this witness free to go? All right, ma'am. You are subject to recall, which means you are still under the rule of witnesses. You can't be in here. You can't discuss your testimony [01:05:21] Speaker 3: with anyone, okay? Thank you. I'm going to come up with a recall right now. Any objection? Go ahead. Thank you. You're still under oath. Ms. Dupon, what were your efforts [01:05:46] Speaker 4: to search for Momta? So we posted in the Facebook that she was missing. We initially had to tell Naresh to post it. He was not wanting to do it. Objection speculation. [01:06:00] Speaker 1: You have to lay a foundation for the second half of that answer. I'm going to strike that that he was not wanting to do it unless you lay a foundation. Thank you. Did Naresh tell [01:06:13] Speaker 3: you about posting on Facebook? He didn't want to post it. We went to his house after the [01:06:22] Speaker 6: . All right. I'll strike that answer. It wasn't -- it wasn't your fault. I understand. Go ahead. [01:06:31] Speaker 3: What, if anything, did Naresh tell you about not wanting to post to Facebook? [01:06:37] Speaker 4: So when we went to his house, we asked him what happens and where is he going or maybe -- he said, "We don't know. She left Nima. I'm the only one who is suffering." And she had her -- all the clothes, all -- everything was taken out by herself. And she does not even have like a shoes outside she used to wear from the work. She took everything and she left. That's what he said. But he didn't [01:07:06] Speaker 3: say where she goes. So going back to what Naresh told you about not wanting to post to Facebook, what did he say about posting to Facebook? That fact is not in evidence because I struck it. So that's a [01:07:21] Speaker 1: leading question. In fact, not in evidence. Yes, Your Honor. What, if anything, did Naresh talk to you about when Mamta went missing? [01:07:36] Speaker 4: When we were there at a house, at his house, he said he just left. But he didn't know where she's gone. And when was that? It was August 3rd or 4th. We went to his house. After Mamta was missing. And after I got the call from the mother, brother and everyone that she was missing. Did Naresh talk to you about efforts he made to search for Mamta? He did not put any efforts to find her. I don't see anything from my eyes. Did he tell you anything at that time about their relationship? No, he did not say anything about that time. [01:08:23] Speaker 3: When you previously testified, you testified that you saw the video of the bruise on Mamta's cheek. And when the defendant explained that, he said he was defending himself. Is that correct? Yeah. When you saw Naresh on August, when you saw Naresh on August when you went to his house, did he have any bruise on his face? No. Did he have any bruise anywhere that you could see? No. Did he have any bruise? No further questions for this witness. Cross. Cross. [01:09:11] Speaker ?: Thank you. [01:09:41] Speaker 1: Is this what is now excused? All right, ma'am, you are free to go. Thank you so much for being here. Okay, hang on one second. I think she needs an interpreter. Stay right where you are. Are you going to do it through the headset? [01:10:30] Speaker 10: Without the headset. [01:10:31] Speaker 1: Okay, then I'll ask you to just interpret loudly this time. All right, you can raise your right hand, ma'am. Remain standing and be sworn in. And thank you. [01:10:40] Speaker 2: Do you solemnly swear or affirm that the evidence you shall give in this case before the court shall be the truth, the whole truth, and nothing but the truth? [01:10:52] Speaker 10: Yes. [01:10:53] Speaker ?: Yes. [01:10:53] Speaker 10: Okay. [01:10:54] Speaker 2: Thank you. [01:10:57] Speaker 1: All right. Does this answer any questions Ms. Sammy has of you? [01:11:01] Speaker 10: Good morning. Can you please state and spell your name? Spelling. Spelling. [01:11:16] Speaker 11: How do you know Mamta Kafle? [01:11:17] Speaker 12: How do you know Mamta Kafle? [01:11:30] Speaker 10: Mamta Kafle. How do you know Mamta Kafle? How do you know Mamta Kafle? [01:50:01] Speaker 15: I did. [01:50:02] Speaker 17: Did you tell the jury why at this point are you going back to interview the defendant again? [01:50:08] Speaker 15: So with information I had received, more information, I wanted to go back to the house to follow up on anything that I missed the first time and to ask more in detail about the relationship. [01:50:26] Speaker 17: Did you ask the defendant for permission to search his house? I did. And did he consent to you searching his house? He did. During this second interview with the defendant, could you describe what his demeanor was at that time? [01:50:41] Speaker 15: The same as the first time. [01:50:47] Speaker 17: And could you tell us what that demeanor was like the first time and the second? [01:50:54] Speaker 15: Like he wasn't affected, no worry, nothing. [01:51:07] Speaker 17: During your interview with the defendant, was there any discussion between you and him about their -- about their -- was there any discussion between you and him about stress? Yes. Tell the jury. Yes. Tell the jury. [01:51:23] Speaker 15: So I asked him how he was doing and he said stressed because of -- he wasn't able to work due to not having a sitter. [01:51:36] Speaker 17: Was there anything more that the defendant was telling you about his stress other than not having a babysitter? [01:51:53] Speaker 15: Not that I can remember. [01:51:57] Speaker 17: Did the defendant discuss with you his work situation? [01:52:01] Speaker 15: Yes. He told me what days he would work and hours that he would work. [01:52:08] Speaker 17: Do you recall what he said? Days and how long? [01:52:11] Speaker 15: Um, Monday, Tuesday, Wednesday were his work days, about 11 hours a day. [01:52:25] Speaker ?: Yes. [01:52:26] Speaker 17: Was there a discussion between you and the defendant about his relationship with Mamta when it first started? Yes. Tell us what he said. [01:52:40] Speaker 15: So he said the relationship was great. He did mention that he wanted to pursue a relationship with one of Mamta's friends. Um, but instead he ended up, uh, talking to Mamta, getting to know her. [01:52:55] Speaker 17: Were there any discussions between you and the defendant of him mentioning there being any marital difficulties in their relationship? [01:53:20] Speaker 15: Um, he did mention a one incident that happened, um, while they were in Fairfax, but nothing else that I can recall. [01:53:34] Speaker 17: Do you recall what the defendant said about this one situation when they were living in Fairfax? [01:53:40] Speaker 15: Yes. It had something to do with, um, Mamta cooking a meal. He didn't want to eat. Um, they got into an argument. Um, he went to smack the plate or the plate ended up hitting her on the head. But aside from that, no other physical altercations. [01:54:03] Speaker 17: So the defendant's conveying to you, this was the only time there was a physical altercation in their relationship? [01:54:11] Speaker 15: From what I remember, yes. He also, um, said that he doesn't yell. That's another thing. I couldn't hear you. [01:54:21] Speaker 17: Sorry, Detective. [01:54:22] Speaker 15: Sorry. He also, um, advisor let me know that he doesn't yell. But he's not a yeller. He's not a yeller. If, um, they, they disagree, um, they'll go separated for a couple days or hours. [01:54:40] Speaker 17: Was there any discussion about finances and phone accounts between the defendant and? Yes. Yes. Tell us. Tell us. Tell us what you recall. [01:54:51] Speaker 15: So, I recall him, um, or her being under his phone plan and when it came to bank accounts, um, I believe he had one and she had one. [01:55:10] Speaker 17: Was there any discussion about a Navy federal bank account? Yes. Tell us what he said. [01:55:25] Speaker 15: Um, I remember asking him for paperwork, which he wasn't able to provide then until later on. Um, and when he provided paperwork, there was no activity in that Navy federal account. [01:55:46] Speaker 17: Whose bank account was the Navy federal bank? [01:55:50] Speaker 15: Um, Naresh's. [01:56:03] Speaker 17: Did you specifically ask the defendant about the last time he saw Mamta on July 31st, that Wednesday? [01:56:12] Speaker ?: Yes. [01:56:13] Speaker 17: Yes. What did the defendant say about the last time he saw her? [01:56:17] Speaker 15: Um, it was Wednesday. She was cooking dinner. Um, and she would cleaned up while he put, uh, baby to bed. [01:56:28] Speaker 17: You asked the defendant how he felt when he found out that Mamta did not show up for work. [01:56:52] Speaker ?: I did. What did he say? [01:56:54] Speaker 15: He didn't worry. [01:56:55] Speaker 17: Discuss with the defendants. [01:56:56] Speaker 15: Discuss with the defendant. Discuss with the defendant. [01:56:58] Speaker ?: His efforts to look for Mamta. Sorry. Can you ask that again? [01:57:01] Speaker 17: Sure. Did you speak with the defendant and ask him what, if any efforts he was making to find his wife? [01:57:09] Speaker ?: I believe so. And what did he say? [01:57:10] Speaker 17: I don't remember him telling me if he did anything. [01:57:24] Speaker 15: Detective. [01:57:25] Speaker ?: Detective. [01:57:25] Speaker 17: Does Mamta, through the course of your investigation. [01:57:27] Speaker ?: Did you? [01:57:28] Speaker 15: I don't remember him telling me if he did anything. [01:57:32] Speaker ?: Detective. [01:57:33] Speaker 17: Does Mamta, through the course of your investigation, did you determine or find out if Mamta has any family in the United States? Any blood relatives in New York or Texas? She does not have any family here. [01:58:08] Speaker 15: Everyone is in Nepal. family here. Everyone's in Nepal. [01:58:39] Speaker 17: Your Honor, I'm going to play the second body-worn camera. It's dated August 9th, 2024. For the court's information and the jury, this video is an hour and 38 minutes. [01:59:07] Speaker 1: We are not going to see the entirety of the video today, just so you know. Go ahead. [01:59:14] Speaker 17: Playing the video. [01:59:17] Speaker 15: So like I said, I'm bringing a police officer and essentially my boss. [01:59:26] Speaker ?: How are you today? Yes, yes, sir. Are you in your army? Yes, sir. [01:59:40] Speaker 18: What's your name? [01:59:41] Speaker ?: What did you do? [01:59:42] Speaker 18: I was in law school, supplier, specialist. The logistics and supply? Yes, sir. [01:59:45] Speaker ?: How's everything going? [01:59:45] Speaker 18: So far, so good. And then did you get the voicemail and the text messages? Yeah, somebody sent me like yesterday, asses and then he sent me those text messages. I said like somebody, and then I spoke to the person and then he said like, you know, I'm very confident and I see this and that or that. I don't know. So I, he said like, you know, send someone over there. [02:00:17] Speaker 15: This is the person somebody, that's your friend though, right? Yeah, it's a known person to you. No, this is, this is not the known person. This is the one that sent you the stuff, right? [02:00:25] Speaker 18: Yes. Yeah, no, no. This is the person like, you know, I don't know this person. [02:00:30] Speaker ?: Okay. [02:00:30] Speaker 18: And then this person said like, you know, this and that and then I got the phone number, this is the phone number and then I spoke to that person. I don't know this person. Okay, what did they say? He said like, you know, I'm very confident. I see but like, you know, he said like, you know, I did not aware at that time. After that, I see the post and then, you know, like, faces like I'm 99% sure. That's what he was saying. And he never went to talk to her? He said like, you know, he saw in the store. This is the store's name, that's all. [02:00:58] Speaker 15: Yeah, so he was just roaming around in the store and he saw her working there? Yeah, that is like Naphti's grocery store and then the gas station. So he say like, you know, he saw there. I don't know. [02:01:07] Speaker 18: Okay, but he never went up to talk to her, are you saying that? No, because, you know, he went, no. Do you ever talk to him? [02:01:14] Speaker 15: Well, no, I'm here to talk to you first. Just because there's a lot of information, I guess, that I missed when I first talked to you. So I kind of want to sit down, just start fresh to speak to you. But I know when I did come by Tuesday, you had said that clothes was missing, her socks were missing, her casual clothes were missing. Yes, some, some. So I essentially brought them to here, just like while we speak, if they could just, in case I miss anything or you've missed anything, if they could just look around just to make sure there's not something we're missing, right? All right. Because I, because of how big this investigation has gotten, I don't want to miss anything and I can't do it all by myself, right? All right. So if you don't mind, if we could just sit somewhere, talk and then they'll kind of just roam around just to look and make sure I don't miss any information. [02:02:08] Speaker 18: So do you want to sit over there or? [02:02:10] Speaker 15: We can sit at this table. [02:02:11] Speaker 18: Yeah. Sometimes baby doesn't, you know, like. Okay. Yeah. [02:02:14] Speaker 15: We can sit here. They're kind of just going to roam around. If they have any questions on anything, they'll come in. [02:02:21] Speaker 9: You said she just did a couple of her clothes with her when she was there? [02:02:25] Speaker 18: Some, you know, like, because, you know, some, maybe she, you know, like last time she was there and she left there, because some clothes, we both, you know, like, you know, those are mine, but like, these are, sometimes, like, you know, home, at home. Not like, you know, other, like, you know, Buddhist stuffs. Okay. Buddhist stuffs are already here. [02:02:44] Speaker 9: And so you have an address in the room? [02:02:46] Speaker 18: Or? No, I don't know the address. No, no, I'm saying in this house. Huh? [02:02:51] Speaker 19: She has a dresser? Or is it a closet? [02:02:53] Speaker 18: Yeah, yeah, yeah. Or in the bedroom? Yeah. [02:02:56] Speaker 9: Okay. [02:02:57] Speaker ?: All right. We'll check it out. Thank you. [02:02:58] Speaker 15: Yeah. So they'll kind of check it out. If you need to, every once in a while, peek in on the baby, I understand that. Okay? [02:03:03] Speaker 18: Yeah. If they remove the shoes, because baby sleeps on the floor now, that's fine. [02:03:07] Speaker 15: Okay. Yeah, yeah. No, that's fine. Um, sorry. Can I just want to sit down? Because I don't think we, I properly introduced myself to you when I first came in. Do you want to have a seat? [02:03:16] Speaker 18: Yeah, that's fine. [02:03:19] Speaker 15: Okay. All right. Okay. So my name is Detective Ventura, okay? I kind of work every type of case. And, um, I was given the missing person case. Okay? Because of the length of time and everything that's essentially going on. Um, I don't want to miss anything. Like I told you before, I kind of just want to make sure I have every information that I can. And if I miss anything, at least the other two guys, um, or anyone else working the case can help. Right? Okay. But I start off, I love talking to the husband, boyfriend, and stuff, anybody, because you know her better than- Yes. Anybody around, right? Yes. Um, so I do want to start fresh on that end. How long have you guys been together? [02:04:03] Speaker 18: Um, since 2020? Um, since 2020. [02:04:05] Speaker 15: 2020? Okay. Can you tell me how that relationship started from the beginning? [02:04:10] Speaker 18: Uh, okay. I was, you know, about to get married, you know, like, uh, where I'm from is arranged marriage. Okay. And then I was about to marry one of her friend. Okay. And then after that, because that was arranged marriage. And then, you know, like the, some, you know, uh, I don't know the exact English terminology, some horoscope that doesn't match with her. Mm-hmm. And then see the classmate of her. Mm-hmm. So, and then after that, you know, like, uh, she comes and then we decided, okay, ready. And then I just flew from here. And then we just get married. And then everything went like, you know, that's what happened over there. Right. Okay. Like, we don't date and then this and that. Right. We just spoke on the phone. And then my parents, her parents, they meet each other. They say, like, okay, you know, like, both are suitable for each other. Mm-hmm. And then that's how we started. And then she came over here within, like, a few months. Mm-hmm. Because I was in the military at that time. I was deployed. And then, you know, like, uh, they expedite my case. And then she came over here very fast. Mm-hmm. After that, we moved to the Pennsylvania for a few times, like, two months. Okay. [02:05:12] Speaker ?: Okay. [02:05:12] Speaker 18: To get the job and then some training stuff. And we came back from the Pennsylvania. We used to live in a foster church. And, uh, after that, uh, she start preparing for her nursing license. [02:05:25] Speaker 19: Okay. [02:05:26] Speaker 18: And then I just, you know, like, working other stuff and, you know, preparing for the IT stuff. Mm-hmm. I started my IT job. She started her nursing job. But, like, you know, it takes little bit time. Mm-hmm. And then everything was good. And then our parents come over here to visit us. And then they went back. Everything was good. And, uh, once we have a baby, she conceived the baby. Mm-hmm. And we planned, like, you know, let's say we have to, you know, buy a home and stuff like that. Mm-hmm. And then, uh, she prefer, like, you know, any type of home. I say, like, at least I need, like, you know, like, all the sack at the end so our baby can play. Right. And then it takes, like, long enough, you know, like, to get this home. Mm-hmm. Mm-hmm. And then once we get this home, um, I think it's, like, a year, almost a year. Mm-hmm. Mm-hmm. And then, again, our parents come over here. And then she bring parents. I don't think she bring the parents. Yeah. And then after that, we were about to buy another home. Okay. And then, like, we were about to, you know, like, everything was ready and then the realtor was ready, everything. And then she say, like, you know, we're gonna hold because, you know, like, we don't need a lot of burdens. And then, so we stopped that. And then she say, like, for now, we're gonna live ourself, you know, we don't live with our parents, send their parents back. And then they went back somewhere on the 1st of May. Okay. And then after that, we are here. And then in the meantime, sometimes, you know, she say, like, you know, I don't wanna live, sometimes, I think, like, four or five times, I don't wanna live with the parents, you know, because usually, like, we go work, they cook, and she doesn't like that, and this and that, they go back, and then we say, like, okay, then they're gonna go back. And then in the meantime, sometimes she go out, you know, she say, like, once she went to the false earth, she say, decide, decide either you live with your parents or with me. I say, like, you know, that's not how it works. So, you know, parents are helping us. She say, like, no, just we're gonna send them back and then I'll bring that, and you did not bring them, I bring them. That's what she said, because she bring them, you know, like, now, you know, our difficult time is over. So, you know, that's what she said, and then they went back. After they went back, she doesn't like that much to my parents. So, you know, that's all about, and in the meantime, she keep going out, you know, like, with the friends, and then sometimes she doesn't tell me, you know, like, you know, right here, one of my friends. My friend, after that her friend as well, because, you know, I was here since long time, and then she came after, and then I introduced, and then even, like, she goes over there, and then she say, like, hey, I'm in Fairfax or something like that, and then I just see, like, you know, just at the door, okay, you are here. Then, and then she keeps saying, like, to the friends, hey, like, don't tell me to, don't tell him, like, you know, if I'm here, and then they said, no, if Nares call, my name is Nares, if Nares call me, I'm gonna tell him. Mm-hmm. But, like, I did not call them, I saw it, because, you know, it's like five, four, five minutes, it's not that far. [02:08:35] Speaker ?: Right. [02:08:35] Speaker 18: So, you know, I see them, see her, and then some of, like, you know, some of her stuff were over there, and then in Fall Church, she, you know, like, rented or something in Fall Church. Mm-hmm. That's all. Okay. [02:08:50] Speaker 15: When she first came to America, how was your relationship then? How did, how was it? It was, like, great. Okay. Yeah. What did you guys like to do? Uh, you mean, like, what type of stuff? [02:09:00] Speaker ?: Like, when y'all spent time together, what was something you guys did together? [02:09:00] Speaker 15: Sometimes, you know, in last hours, we keep watching movies, sometimes, and, uh, just, you know, walk around, like, you know, just walk around. [02:09:04] Speaker 18: Usually, like, wherever I go, even I deploy it, you know, I bring with, like, you know, with, uh, I, like, I take with me. Right. Like, even, like, that's not authorized, okay, you stay somewhere, you know, I take it with me. Right. Like, even, like, that's not authorized, okay, you stay somewhere, you know, I take it with me. Right. Like, even, like, that's not authorized, okay, you stay somewhere nearby the base. Okay. So, that, you know, once I'm done with my work, I will be there. Even, like, I was in Wisconsin, I bring her to Wisconsin. Even, I was in Pennsylvania, that, when she came, I say, like, you know, we, you know, we married for, like, you know, togetherness. So, the relationship, as a whole, it was, like, you know, very good. Okay. Yeah. As a whole, it was, like, our, in, in, in our family, or in her family, there is no any divorce, nothing. And, you know, sometimes we, like, threaten to each other, okay, we're going to divorce, this, like, this and that. This is United States, over here, like, a lot of people do this, that. But, like, that's not how it works, you know. Right. Yeah, we don't have that, any, like, you know, plan to do that. But, like, multiple times, you know, like, she said, like, oh, I'm going to do that, this, I'm going to do that, you know. Sometimes I say, like, okay, I'm going to do this, that, that, you know. But, like, we, you know, like, never. That was never actually an option. [02:10:25] Speaker 19: No, no. [02:10:26] Speaker 18: Just, like, you know, threatening her. Yeah. Some, multiple times, she said, like, you know, I'm going to be disappeared, and then I'm going to be somewhere, go somewhere, and then see from there, and then how the world watching me, you know, like, but that we don't take seriously. [02:10:38] Speaker 19: Okay. [02:10:39] Speaker 18: Yeah, because, you know, like, sometimes, you know, like, husband and wife, this happens. [02:10:43] Speaker 19: How often would she bring up divorce? Or you would bring up divorce? [02:10:48] Speaker 18: What would you do? [02:10:49] Speaker 15: Either one. Like, if you guys got into an argument, and, because you mentioned, you know, either one would say, yeah, we're going to separate, we're going to get a divorce. [02:10:56] Speaker 19: But it wasn't something that would actually happen. No, no, no. Yeah, sometimes. How often would that be brought up? [02:11:02] Speaker 18: Sometimes, you know, like, if, you know, like, last time, you know, let's say, like, you know, sometimes, if I did something, she doesn't like it, and then, you know, like, we are not talking to each other for one day, you know. Yeah. Then she say, like, if you are not talking to me, like, I'm going to divorce like that. Okay. Okay. Because, you know, sometimes, and then over here, she cook food, sometimes I do cook food, and then, you know, but, like, you know, we are kind of angry, and then we don't talk to each other. Okay. If, like, you know, we have a fight, it means, like, we don't talk to each other. [02:11:33] Speaker 19: Okay. [02:11:34] Speaker 18: You know, like, that means, like, you know, sometimes, you know, she eats some other food, and then, you know, I eat my food, you see, okay. That lasts for sometimes, like, a few hours, sometimes a day. Okay. [02:11:45] Speaker 15: Yeah. How often were you guys fighting recently? In the last year? [02:11:52] Speaker 18: I think, like, after mom and dad, after mom and dad, they went, we don't have any, like, so, one day we have an argument on the 4th July, she said, like, let's go watch for the fireworks. I said, like, baby is sleeping, you know, like, she said, like, no, not for us, it's big for the memory. I said, like, I don't wanna go, just we can see from here on the back, back, she said, and just do it. Then we go, and then we don't have that type of argument. Okay. After, like, mom and dad go. Yeah. She was, you know, like, after mom and dad go, you know, that's, she wants, and then after that, everything was going very good. Okay. [02:12:27] Speaker 15: What about at the beginning of the year? I know, uh, we got called out here for some incident, I guess, that they believed happened between you two? [02:12:36] Speaker 18: Oh, at that time, mom and dad was here. Yeah. They were here. Okay. Yeah, mom and dad was here, and then she called, I feel like, I do have videos, she said, like, you know, I missed, you know, like, my documents. Because, oh, the one another thing, we moved from there to here, she moved, like, she missed, like, you know, her green card. That's what she says, green card and social. After that, she found. After that, she found somewhere, and green card, she did not found. Okay. But, like, she, I made the paper, already the paper, that last for 36 months or something like that. Okay. She had that paper, but the expired green card. Last time, we remember, we went to the Arlington, and then, uh, went to the, what they say, like, the tower. You know, we climbed on the tower, at that time, she was pregnant. Okay. And then, we just go there. At that time, I saw the green card with her, and then, I, like, you know, I, I tell her, at that time, my brother is here as well. He came from somewhere else. I said, like, how careless you are, you know, like that, in my language, how careless you are, why you are carrying green card everywhere? If you lost, do you know, like, how important it is? And then, after that, she put somewhere. And then, even, like, you know, every time, I don't like to carry, every time, social security, and then, green card, you know, like, if we lost, you know, that's, that, that give us the problem. [02:13:50] Speaker 19: Mm-hmm. [02:13:51] Speaker 18: And then, she say, like, uh, okay, I'm gonna, you know, keep it safe. Mm-hmm. After that, we move here, you know, a lot of stuff, we have to move, you know, once we move from foster to here, a lot of stuff. So, she say, like, you know, I'm missing my green card, and then, social security. She found the social security, but she say, like, she doesn't found the green card. Okay. And then, you know, there is just one office, and then, they make, like, you know, some kind of, uh, note or something, then she start working here. [02:14:18] Speaker 19: Okay, so she has a work visa? [02:14:20] Speaker 18: No, she has a green card. [02:14:22] Speaker 19: Oh, so, but she's able to work with the green card. Yes. Okay, and how often do you have to renew the green card? [02:14:28] Speaker 18: Oh, uh, first time, two and a half years, that's why I did renew. Right. Doing that renew, uh, it's a, they say, conditional, yeah. Okay. Yeah, conditional. [02:14:42] Speaker 19: And I know you mentioned that the, um, the marriage was arranged, right? Yes. [02:14:47] Speaker 15: And this is, this could be just a personal question, because I'm trying to understand everything, right? Um, at what point during your relationship, or when you're married, did you find out, like, or did you feel you loved her? Or was that ever not a thing, because it was arranged? [02:15:05] Speaker 18: No, we, we, we, we loved each other, even, like, you know, uh, I think, like, for the first few months, even we hit in the same place. Okay. [02:15:13] Speaker 19: Yeah. [02:15:14] Speaker 18: Because, you know, everything, like, you know, even my brother, my sister, we got, like, you know, that type of marriage over there. Yeah. [02:15:20] Speaker ?: Yeah. [02:15:20] Speaker 18: Yeah. Most of, like, 90% marriage get arranged. You know, like, mom and dad, even, like, we talk each other, and then we do video calls, stuff like that. But, like, you know, like, mom and dad, like, you know, they sometimes decide, like, you know, if, sometimes, you know, people, they can find girl or boy at school or college. Mm-hmm. That's fine. Otherwise, like, even, like, we find, then we, like, notify our parents. They say, like, this is the girl, look at this, and then this is her parents, you know, this is her qualification, this is my qualification, this and that. And then that's how it works, and then that works very fine for everybody. Okay. [02:15:53] Speaker 19: So how long were you in the military for? [02:15:55] Speaker 18: Seven, eight years. [02:15:56] Speaker 19: Okay. And where were you based out of? [02:15:59] Speaker 18: Uh, Fort Belvoir. I'm a reserve. I'm a reserve, and then I got deployed twice. Uh, one time, you know, like, she was in Nepal, and then, you know, I was here, and then that wasn't last long, because, you know, I just get married, and then, you know, I was about to bring her, and then I talked to my commander. Yeah. And that, my wife is coming over here very soon, and then she doesn't know anything about it, and then they give me the excuse, they send me back, because my wife is coming here. So they say, like, let's postpone this and that. I say, like, without wife, you know, I can do like that. Right. Yeah. And then, after they send me back, and then after they send me back, next time, I deployed to the Afghanistan mission, that was in Wisconsin, and then I, after a month, I, that was like, you know, they say, like, not the legal, but, like, we are not authorized to do that. Even, like, my platoon surgeon, they all know, so, like, you know, hey, like, my wife, I want to bring my wife, and then we stayed there together. But, like, you know, I used to work, and then whenever I get a chance, you know, like, I used to live with her. But, usually, I suppose to live in the barracks, but, you know, sometimes they give me the break on the weekends, or something like that, and then I used to live. Where was her bedroom? The master bedroom is over here. Which room was hers? Uh, this room right here, this room, usually, like, you know, the baby's room. Okay. And then, you know, like, we have a prayer room here, or something like that, usually we don't sleep here. Okay. And then this room here, if I'm working, I'm gonna sleep here. Okay. No, who, who gonna work, they're gonna sleep. Okay, so, you know, working stays there, okay. [02:17:29] Speaker 11: Yeah. [02:17:30] Speaker 18: Got it. Because, you know, like, I get the good sleep, and then the, some, and then now we, we don't sleep on the beds. Mm-hmm. We sleep on the floor, because, you know, like, last time, baby fall down from the bed. Okay. Yeah, we sleep on the, uh, floor. [02:17:44] Speaker 19: Okay. There's a basement in the house? [02:17:46] Speaker 18: Yes. Somebody's living in the basement. [02:17:48] Speaker 19: Oh, someone lives in the basement? [02:17:49] Speaker 18: Yeah. Are they here now? I have no idea. Okay. Because, you know, like, we just, we speak with them with Google Translate only. [02:17:57] Speaker 19: Oh, okay. [02:17:58] Speaker 18: But, they are very, yeah. [02:17:59] Speaker 19: Are they friends? [02:18:00] Speaker 18: Yeah. [02:18:01] Speaker 19: Okay. [02:18:02] Speaker 18: No, no, I don't know them. [02:18:03] Speaker 19: You don't know them? [02:18:04] Speaker 18: Uh, we found them on Facebook, and- [02:18:06] Speaker 19: Oh, okay. [02:18:07] Speaker 18: Marketplace. Is that how that works, or? Oh, you can, you need to Google Translate. They speak Spanish for you. Okay. [02:18:14] Speaker 19: They only speak Spanish? Yes. Oh, perfect. [02:18:17] Speaker 18: Okay. Yeah. Okay. [02:18:20] Speaker ?: Yeah. [02:18:21] Speaker 18: Either this way or this way. We can go from this way and then you knock the door. [02:18:51] Speaker 15: So, I don't know. It's a lot. A lot is going on. How are you feeling right now? [02:18:59] Speaker 18: Yeah, you know, like I'm trying to go to, I can't explain. And you know, sometimes I feel like, you know, being my parents, sometimes I'm thinking about I'm going to go back. And sometimes I cannot explain. It's very tough. [02:19:19] Speaker 15: How is it with the baby? [02:19:21] Speaker 18: Yeah, sometimes, you know, it's easy with baby because, you know, like she keep me like busy. And then yesterday, baby and myself and then I asked to help one of the friend and then we went to the Falls Church where she stayed before. She stayed in that apartment, but I don't know the apartment number. And then just we stay outside and then check the mailbox, you know. [02:19:40] Speaker 19: So what, what Falls Church apartment was it? [02:19:45] Speaker 18: I don't know the apartment. [02:19:46] Speaker 19: Okay, how'd you get there? [02:19:47] Speaker 18: Oh, because, you know, last time she was there and then at that time she was talking to one of her friends and then her mom. [02:19:54] Speaker 19: What friend was it? [02:19:55] Speaker 18: Uh, right here, like, you know, just I say like, you know, she usually stayed with her friend. [02:20:00] Speaker 15: So it's that friend's mom who lives in Falls Church? [02:20:03] Speaker 18: No, no, no, no. We don't know like whom we, whom in Falls Church, whom she was living. We just know like, you know, she goes to the Falls Church and then I know like, you know, she was in a Falls Church. Okay. [02:20:15] Speaker 19: And you went and checked? Okay. [02:20:17] Speaker 18: And then I, you know, last time, you know, at that time I said like, okay, you know, she said like, either you have to really stay with your parents or me. That's what I said. Okay, let's come on and then we're going to figure it out. [02:20:29] Speaker 19: How long did she leave before? [02:20:32] Speaker ?: How long? [02:20:33] Speaker 18: How many times? How long? Uh, exactly. I do not remember. Two weeks. Two weeks. Okay. [02:20:40] Speaker 15: And in those two weeks, how was it? Where was the baby? [02:20:42] Speaker 18: My, at that time, baby was only with my, my mom. [02:20:46] Speaker 19: Okay. Her grandma. [02:20:48] Speaker 18: Yeah. Like, usually she sleep and then my parents, when my parents were here, even like, she never sleep with us. Always with like, you know, grandparents. [02:20:57] Speaker 15: And is that a cultural thing as well? [02:21:00] Speaker 18: It's not a cultural thing, but like, you know, yeah, you know, if, in, you know, where we from, you know, mostly, you know, they take care of the baby. Even like, you know, we scream on baby, hey, what are you doing? If they see, they don't talk. They don't talk. Because they love grandkids, grandkids, grandkids more. So we cannot, you know, do anything in front of them. Right. [02:21:22] Speaker 15: Yeah. So when it comes to work, what are you doing right now? [02:21:27] Speaker 18: I'm working at IT. Okay. At White House. [02:21:30] Speaker 15: At the White House? [02:21:31] Speaker 19: Yes. Okay. [02:21:33] Speaker 18: I work Monday, Tuesday, Monday, Tuesday, Wednesday. She works Thursday, Friday, Sunday. [02:21:38] Speaker 19: Okay. What are your hours? [02:21:40] Speaker 18: Hours are 40 hours. That's why I work Monday 14 hours, Tuesday 13 hours, and Wednesday 13 hours. [02:21:47] Speaker 15: Okay, so Monday 14 hours, Tuesday and Wednesday 13 hours each. 13 hours. Okay. What time do you start? [02:21:55] Speaker 18: What do you do? What time do you start work? Work? Usually at 6:00, sometimes 6:00 to 8:00, otherwise 7:00 to 8:00. [02:22:04] Speaker 19: Okay. [02:22:05] Speaker 18: In the morning and then I have to, you know, usually go early from here. [02:22:09] Speaker 15: Okay, so you go into work? Yeah. Okay, do you ever work from home? [02:22:13] Speaker 18: No, I don't have time. [02:22:14] Speaker 15: Okay, so what are you doing right now when it comes to work? [02:22:21] Speaker 18: I'm not working now. Okay. Because, you know, I have babies, so I'm not working now. [02:22:26] Speaker 19: Like, you quit or you're on vacation for now? [02:22:30] Speaker 18: Yeah, and then I talk to my managers and then, you know, like, explain the situation because, you know, on Monday I'm supposed to be there and then they say, like, on Tuesday or Wednesday, because I have some assets from my, you know, employer. They say they're going to sell some, you know, like, military and then they're going to pick that up, you know, make those stuff ready. And then, now my laptop isn't working. But, like, they say, like, okay, we're going to hold and then we're going to hold your job because that's what, you know, I described and then, hey, this happens. They say, like, okay, they say, like, I'm paid. I'm not going to get paid, but, like, you know, they're going to hold my job. [02:23:08] Speaker 19: Okay. [02:23:21] Speaker 10: Can we sit here so that we can see you have a place, maybe? Yeah, that's fine. [02:23:35] Speaker 18: Right here. Okay. Or I can bring a chair. [02:23:38] Speaker 9: Oh, just a moment. [02:23:47] Speaker 2: Thank you. It's Rachel. Okay. So... [02:23:52] Speaker 15: Do you work for a certain company in the White House? Like, is it still military? Where your job is from? [02:24:07] Speaker 18: It's like a White House Communication Agency. I'm a contractor. Okay. [02:24:11] Speaker 15: And are you still active? [02:24:13] Speaker 18: No, I'm reserved. [02:24:14] Speaker 15: Oh, you're reserved? Okay. How long have you been living in this house? [02:24:21] Speaker 18: A year. [02:24:22] Speaker 15: A year? Yeah. Okay. And you just... [02:24:25] Speaker 18: We bought a year ago. [02:24:26] Speaker 15: Okay. And you decided to move here because you guys were going to have a baby? [02:24:30] Speaker 18: Yeah. Because of the baby. And then, you know, we have a plan, like, you know, let's move to the bigger house. Right. And, you know, work like that. You know, we were, like, kind of making kind of good money, you know, to mention this stuff. So... [02:24:44] Speaker 2: Right. [02:24:45] Speaker 15: Okay. And when it comes to bank accounts and everything, explain that situation to me. [02:24:51] Speaker 18: We have, like, you know, she has all her bank accounts. I do have all on my bank accounts. We have a specific bank accounts. She has, like, you know, Navy Federal and Chase. I have, like, you know, Wells Fargo and the Navy Federal. [02:25:07] Speaker 15: Okay. And the Navy Federal is because you were in the military, right? Yes. But you guys used to share an account together. Yes. [02:25:23] Speaker 18: Which one was that? [02:25:24] Speaker 15: Wells Fargo. Wells Fargo account? Okay. And what caused you guys to separate that account? [02:25:30] Speaker 18: So, one day, you know, like, she just, you know, I mentioned, like, she was out and then she needed the money. At that time, we just borrowed the home and then she doesn't, she needed the money and then she didn't find the money. So, you know, like, you know, like, we were spending together. She said, like, I'm going to keep my money on and then you have to keep your money on. So, you know, like, that's how, that's how we're going to, we are trying to make two accounts and then that was a mistake from the branch. And then they say, like, account is closed. And then, you know, we try to reopen that account and then they say, like, once closed, we can do anything. You know, it takes, like, two weeks and then after that, they say, like, we can't do anything. [02:26:14] Speaker 15: Okay, which account was closed? [02:26:16] Speaker 18: Checking account on the West Fargo. [02:26:18] Speaker 15: Okay, the one you guys had joint. Yes. And once you guys separated bank accounts, how was she getting her money from work? [02:26:28] Speaker 18: Oh, at that time, she had, like, some issue with the old work and then she quit the work. Okay. And then something happens to her hospital with the manager or something like that. Okay. And then she has a Chase bank. [02:26:42] Speaker 15: Okay, she has a Chase account. [02:26:44] Speaker 18: I think, like, she opened the Chase bank account at the same time somewhere. Okay. And then she has the Navy Federal account. [02:26:52] Speaker 15: Okay. Do you have her Navy Federal information bank account? [02:26:55] Speaker 18: Yes. But her, I don't have her. [02:26:58] Speaker 15: Okay. But you guys opened the Navy Federal account, she was able to open it through you. [02:27:04] Speaker 18: No. I think it was in, I was in one time, you know, working for the Quantico and then at that time, she did make the, one is checking share, checking account share on the Navy Federal account. And then, after that, she was trying to get the car, you know, like, on her own name. Because, you know, we have only one car. Sometimes she drives herself. Sometimes, you know, most of the time I do. I do. And she was trying to get, like, you know, on her loan because I already have a loan from the Navy Federal. And then, they just make another account. And then close one another account and then they can make another account and then she has another account. That was, like, very, very recent. I do, like, two months back. Okay. Three or three or something. [02:27:48] Speaker 15: But she was getting mail here as well. [02:27:51] Speaker 18: Most of the mail here, yes. [02:27:53] Speaker 15: Okay. So, again, in order to open a Navy Federal account because she is married through you, it essentially goes through you because you're military. Right? I kind of know how that works. They give her a pin, she's able to open some account. Do you have her account information? There's any paperwork stating where it's going to say, "This is her Navy Federal account." Stop. [02:28:39] Speaker 18: Okay. [02:28:41] Speaker 15: And what about insurance? Insurance? [02:28:44] Speaker 18: I do have my insurance. [02:28:45] Speaker 15: You do? [02:28:46] Speaker 18: Yeah. I mean, like, what they say, like, TriCare, and then we all cover through the TriCare. [02:28:52] Speaker 15: Okay. So, she has insurance through you? [02:28:55] Speaker 18: Yes. Okay. And then my mom and dad, they do not. They don't? No. Because, you know, they stay here for two months and then, you know, they don't have, like, [02:29:16] Speaker ?: insurance. [02:29:17] Speaker 15: Okay. When was the last time she used this account? [02:29:20] Speaker 18: I don't know. Usually, like, you know, all the home stuff, I do, like, you know, grocery and then everything, like, you know, getting all those stuff I do. Okay. [02:29:33] Speaker 19: Okay. What about phone account? [02:29:35] Speaker ?: I have. [02:29:36] Speaker 18: That is also the military agenda. [02:29:38] Speaker 15: And you have it through who? [02:29:40] Speaker 18: Uh, military agenda plan. [02:29:43] Speaker ?: Yes. [02:29:44] Speaker 15: Who's your carrier? Oh, T-Mobile. [02:29:46] Speaker 18: Okay. [02:29:47] Speaker 15: T-Mobile. [02:29:48] Speaker 17: And what phone number is she using? Do you have something showing that? [02:30:16] Speaker 19: I mean, like, your T-Mobile account? Okay. Do you have anything on that? Okay. [02:30:25] Speaker ?: Okay. Do you have anything on that? Okay. Okay. [02:30:38] Speaker 18: So, this is the number. [02:31:00] Speaker 15: How many lines do you have? [02:31:02] Speaker 18: Uh, one, two, three, four, five, six, seven lines. [02:31:07] Speaker 19: Okay. And whose wall are those? Four and one. [02:31:11] Speaker 18: This is like, this is the one I'm using. [02:31:14] Speaker 19: Okay. [02:31:15] Speaker 18: Um, two, six, four, nine, six, four, nine, six, four, nine, six, four, nine. And then this is one of my friends. And then husband and wife, both are using those. Okay. And then one my sister. And then this is one of my brother. Uh, this is my girlfriend. [02:31:33] Speaker 15: Okay. Are you able to click on it to see? [02:31:36] Speaker 18: Uh, she has, like, you know, other phones as well, but like, no other phones as well. But like, no, she used for just the Tik Tok and then stuff like that. Usually, like, no, no, she keep, like, you know, secret that, you know, like, she goes live and then stuff like that for the Tik Tok and Instagram. [02:32:17] Speaker 19: Okay. [02:32:18] Speaker 15: So, if you go to your account information, will it show if she's used any text messages or calls or anything like that, no? How would you be able to find her? [02:32:29] Speaker 18: Okay. Like, uh, for finding that, you know, we have to, you know, like, before, uh, you know, like, uh, some tracking system is there. We never did that, you know, like, you know, you know, in our life, we never did that. There is some tracking system, you know, like, we can track, like, where she is going now. And then that is, like, iPhone to iPhone. Okay. I don't think, like, that, uh, that through the carrier. [02:32:51] Speaker 15: Okay. When was the last time you texted or called her? [02:32:57] Speaker 18: A lot of calls are, okay, once I try, a lot of people are here, so maybe I have to go all the way down. I'm going to try now and then we can see the history over there. [02:33:28] Speaker 19: You don't have our number saved on your phone? [02:33:31] Speaker 18: I, I don't really remember and then I have a save. I'm going to try now and then we can see the history over there. And then we can see the history over there. And then we can see the history over there. [02:33:53] Speaker ?: And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. [02:34:06] Speaker 18: And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And then we can see the history over there. And July 22, you know, breakfast. It means like breakfast is ready. These are kind of some information. So, you know, like breakfast is ready. And then did you eat? Like this. This number. And then she said. [02:36:14] Speaker 15: And what address did she send you? [02:36:16] Speaker 18: This is the address. This is the address. This is the address. Yeah. Right here, yeah. [02:36:22] Speaker 19: Okay. [02:36:23] Speaker 18: What was that for? That is one for like, you know, Baby care. Baby sick care. Oh, okay. Yeah. Sometimes, you know. No, no. We just trying to, you know, do that. And then we just put there. And then she was trying a lot. Because sometimes, you know, if we have math the schedule. So, you know, like we say like, you know, just we're going to math the schedule. And then we don't put the baby. [02:36:43] Speaker 15: So, was she enrolled in daycare then? No. Okay. How many times did she go? [02:36:48] Speaker 18: Uh, three, four times. I think like one day we have like same schedule. Like four or five times. Maximum that. Okay. You know, she does take care, you know, because digs, she gives the address. Sometimes I have to go to the pickup. Okay. And then I have to. [02:37:03] Speaker 9: How many times did you have to pick her up? Four? [02:37:06] Speaker 18: Five. Four or five times? Yeah. [02:37:09] Speaker 9: How many times did she have to pick her up? [02:37:11] Speaker 18: Oh, zero times. Oh, because she did the drive? Drive. She drive. But like usually I do. Okay. Yeah. Before we have only one car, I do drive. She doesn't drive. Okay. [02:37:21] Speaker 15: So how many days was she enrolled in daycare? [02:37:23] Speaker 19: No. [02:37:24] Speaker 18: That is like, you know, her kind of like, you know, it's not the daycare. It's like, you know, some person she knows and then she figure that out and then she pay a little bit of money and then. Okay. [02:37:35] Speaker 19: So how many times did she go? [02:37:36] Speaker 18: Another one, she enrolled. To the Clark one, the Colonial one? [02:37:38] Speaker 19: I think like four or five times. Exactly. [02:37:40] Speaker 18: I don't remember. Yeah. Four or five times. Where'd she go before? Before, like, you know, she's not in the daycare. And then she enrolled in one daycare and then we do not drop that daycare because she's like, you know, extensive or something like that. Right here, like, you know, by the route 28. [02:38:00] Speaker 19: Okay. [02:38:01] Speaker 18: In the daycare. [02:38:02] Speaker 19: Okay. And when did you delete her contact from your phone? [02:38:05] Speaker 18: Usually I don't say, you know, even like my mom, dad, you know, like, because I remember all those numbers, you know, uh, sometimes I had a say before and then sometimes it's not deleted. Like I don't, I don't put this number. It's not deleted. Okay. [02:38:21] Speaker 19: Um, so the last time you spoke to her was July 28, at least through text, right? [02:38:31] Speaker 17: A good breaking point. I know they're going to transition to another subject matter. Just for the record, I've paused it at 39 minutes and 13 seconds. life, liberty, and the pursuit of happiness. That's the American dream. liberty. That's what we all want. That's why people move to this great country to pursue life, liberty, and the pursuit of happiness. It's what the defendant wanted. It's what the defendant wanted. The right spot. [02:39:21] Speaker ?: Good life. [02:39:22] Speaker 17: On liberty. To move freely. And he wanted to pursue his form of happiness. And he wanted to pursue his form of happiness. This trial is going to prove how this defendant was living the American dream. And how it ultimately ended as a nightmare when the defendant kills his wife. Momta Koffle defiles her body and then conceals her dead body, never to be found again. So, here in this courtroom sitting before you is Naresh Dagbhai. He was born on February 21st, 1977, making him 49 years old today. He was raised in Nepal. He finished his high school in 2005. He obtained his diploma in pharmacy and pharmaceuticals in 2009. The defendant was living a good life, had all the liberty that we all want. [02:42:05] Speaker ?: The defendant's pursuit of happiness. [02:42:06] Speaker 17: The defendant meets a beautiful woman from his home country of Nepal, Mapta Kafle. They start a relationship, which then elevates to a marriage. The defendant and Mapta Kafle get married in December of 2020. The defendant was living in the United States. Mapta was living in Nepal. The defendant works as an information technology officer with a top secret clearance and begins doing work for the White House military office. The defendant starts making good money. The defendant then buys a house. Puts the house only in his name, but he buys a house. The defendant and his new bride, Mapta, move into that new house in Manassas Park, Virginia. August 20th, 2023, the defendant and Mapta have a baby. A sweet little girl named Nima, also lovingly referred to as Minnie Mapta. The defendant buys himself a brand new Tesla. The defendant is now making new friends, new neighbors, expanding his social and professional network here in Manassas Park. The defendant was experiencing the American dream to its fullest, living that good life, making money, no restrictions on his liberty, and pursuing everything that made him happy. [02:45:00] Speaker ?: And July 30th, 2024. [02:45:07] Speaker 17: And July 30th, 2024. The defendant throws it all away. July 30th, 2024 marks the beginning of a series of the most horrific and violent crimes against his wife. Momta Koffle. I submit again, this trial will prove the defendant kills his wife, Momta. Momta. Dismembers her body and then conceals her body parts by throwing her body in trash bags and in different trash bins in Manassas Park and in Fairfax County. He concealed her dead body. And when it came time to answer the question, sir, where's your wife? Where's your baby mother? The stories, the inconsistent statements, the suspicious behavior, the lies, flow right out of the defendant's mouth. The evidence that this trial will show you the defendant lied to everyone, to his friends, to his family. To the police, to the press, to this community. So how are we going to prove a no body homicide as Sammy told you during jury selection with powerful and persuasive circumstantial evidence? In the universe of information that exists, this prosecution has sorted out the evidence and the witnesses that we're going to bring to this courtroom to show you proof beyond a reasonable doubt that this man killed, defiled and concealed his wife's dead body. We are going to present to you over the course of seven years. We are going to present to you over the course of seven years. How does a brand-new mother, Mamta, leave her brand-new baby? Throughout this trial, it will become crystal clear. The answer to that question, every time, is premeditated, first-degree murder. The next category of circumstantial evidence will be the defendant's inconsistent statements, his lies. How he lied to the police, how he lied to the media, how he lied to this community. You've heard the expression, "The devil's in the details." Pay close attention. When you hear the evidence come out, Mamta does not show up for work for two consecutive days. The police go to the defendant's house. They ask him, "Where is Mamta? Where is your wife?" You're going to see the body-worn camera of the police that respond to the defendant's house. Within the first two minutes of that video, of that question, "Where is your wife?" You will see inconsistent statements. You will see unbelievable spin as to where Mamta went, where she could be. You're going to hear the defendant tell the police that he and his wife Mamta had a fight, and that Mamta went to either New York or Texas to go see her sisters, and that she broke her phone. Days later, same question. Days later, same question, "Where is your wife?" You're going to hear a different version of events of "Where is Mamta?" You're going to hear the defendant tell a journalist that Mamta and him didn't have a fight, and he has no idea where Mamta is. Ask yourselves this question, "Why is the defendant telling different stories to the same question?" The same answer applies. Premeditated, first-degree murder. The next category of circumstantial evidence will be the crime scene inside the defendant's house. The crime scene evidence will show you blood in the bedroom, in the bedroom carpet. You're going to see bloody drag marks from the defendant's bedroom to his bathroom. You're going to hear about the blood that's found in the bathroom shower. You're going to hear about the blood that's found underneath the bathtub. You'll learn that the bathroom is a tile floor. We all have our common sense. We didn't check it at the door. We all understand that cleaning a tile floor is much easier than cleaning blood off a rug. The evidence will show you from the pooling of the blood in the bathroom. What's wrong? From the bedroom to the blood drag marks, the bloody drag marks from the bedroom to the bathroom. That is evidence that Mamta is dead. And the defendant's movement of her dead body from the bedroom to the bathroom is his attempt to conceal the crime he's committed. Continuing a little bit more with the crime scene. The evidence will show you. You will see and hear the police techniques used to detect the presence of blood using a liquid tool called Blue Star. When Manassas Park Police got a warrant and they entered the defendant's house, they apply this Blue Star liquid in the bedroom in the bathroom. You will learn that the Blue Star chemical reacted with the blood causing a blue glow. That blue glow is what assisted the police in their murder investigation. The evidence at this trial will show you that a murder was cleaned up. That that bedroom rug was scrubbed. That bedroom furniture was moved to conceal and cover that scrubbed rug. That the defendant's bathroom was wiped down and cleaned up. You will learn that the window blinds that belong in that bathroom are found in a hallway closet with blood in the blinds. You will learn more about the cleaning tools that the defendant used to clean his murder scene. 409 rug cleaner solution. Disinfected wipes, air fresheners, large trash bags. You will learn that the defendant makes multiple runs to the store to get these cleaning supplies, to buy the trash bags, to buy a ready pack of three knives. Two of which are still missing from that house. The evidence will show you the gallons and gallons and gallons and gallons of water that's run on the day Mocta comes up missing in that house. You will learn that that volume of water usage is inconsistent with personal use. The next category is going to be what we're calling suspicious and conspicuous behavior by the defendant. You will learn that the defendant used a babysitter to watch baby Nima while the defendant makes these runs to the store to buy the knives, to buy the gloves, to buy the cleaning products, to buy the heavy trash bags. You're going to learn about the saw. You will learn that the defendant practically gives away a reciprocating saw to his landscaper. You will learn that that saw tests positive for blood and Mocta's DNA. Defiling her dead body with that saw. You're going to see video surveillance of the defendant making those multiple runs to trash compactors in Manassas Park and in Fairfax County. A location far from his home late at night in the middle of the day waiting for people to clear the area. The defendant removing large bags, wearing gloves, approaching the trash compactor and throwing it in and as far away from himself as possible and as deep into that trash compactor as it could go. Concealing a dead body. We're also going to see video surveillance of the defendant going to a gas station in Loudoun County without his phone. The evidence in this case will show you that while the defendant is in Loudoun County without his phone, Mocta's cell phone is hitting off the cell tower where the defendant is at. But Mocta is nowhere to be seen or found. You will learn that after the police make contact with the defendant to help him find his wife. The police start investigating. They look for Mocta. The defendant then sells his brand new Tesla car to CarMax. You will learn that while Mocta is missing, the defendant tries selling his house. Take note of this. The defendant's trying to sell his house while his wife isn't just missing. She's an endangered missing person. Ask yourselves this question. Why is the defendant getting rid of his assets? Remeditated first degree murder. Members of the jury. You will watch this prosecution. Lay out brick by painful brick. Of the circumstantial evidence that will convince you to find this man guilty. You've only heard a small sample of what we are going to present at this trial. I want to transition now and talk a little bit more about Mocta. I want to talk about how Mocta lived. I want to talk about how Mocta loved. And I want to talk about how Mocta languished with this man. Mocta wanted the same experience as her husband to live that American dream. To pursue that good life. Liberty to move freely. And to pursue her happiness. Mocta's journey began in Nepal. Mocta's journey began in Nepal. She was born on May 28, 1996. That would make her 30 years old today. 28 years old when she was murdered. Mocta was raised by her two parents. Her father, Dili Kafle. And her mother, Gita Kafle. Mocta has two brothers. A much younger brother, who is still in Nepal. And her oldest brother, Mahesh Kafle. You will hear from Gita and Mahesh at this trial. You'll learn that Mocta went to college. She got her nursing degree. That's when she meets the defendant. They start this relationship. They get married in December of 2020. The defendant sponsors her. Brings her to the United States. Mocta leaves her life in Nepal. Leaves her family behind him. [03:03:08] Speaker ?: Behind her. [03:03:09] Speaker 17: And moves to the U.S. Mocta obtains her lawful permanent resident status. In July of 2021. When Mocta comes to the United States. She begins to work. She works at a security company in Arlington. She starts working or caring for the elderly. At a senior center in Arlington. And in June of 2023. Mocta begins working as a nurse. At Inova Fairfax Hospital. That's when the defendant. And Mocta move out. Of their Falls Church apartment. To the city of Manassas. To the city of Manassas. That's when Mocta moves into. [03:04:03] Speaker ?: A house. Only in. [03:04:05] Speaker 17: The defendant's name. That address. [03:04:11] Speaker ?: That. [03:04:12] Speaker 17: Domestic residence. Is 9408. Heather Court. In the state of Manassas. [03:04:19] Speaker ?: In the state of Manassas. [03:04:19] Speaker 17: In the state of Manassas. [03:04:20] Speaker ?: In the state of Manassas. In the state of Manassas. In the state of Manassas. In the state of Manassas. [03:04:24] Speaker 17: In the state of Manassas. In the state of Manassas. In the state of Manassas. In the state of Manassas. In the state of Manassas. In the state of Manassas. In the state of Manassas. In the state of Manassas. [03:04:32] Speaker ?: In the state of Manassas. [03:04:33] Speaker 17: Mocta starts meeting. And expanding her own. Social. And professional network. While working at these two hospitals. Mocta meets. Two. Key friends. That were going to testify. At this trial. You're going to hear from. Sunita. Thapa. She's from. Inova. Fairfax hospital. You will hear from. Sarita. Nupani. Who works at the. Prince William hospital. Momta explains. The dynamics of her relationship. With. This man. These two. Key friends. Advise. Momta. A way to. Improve her life. With or without. The defendant. To. Obtain. Her own liberty. Without the defendant. How she can pursue. Her own happiness. Without this defendant. Without this defendant. Anyone that's married. Or has ever been married. Knows and understands. Every marriage. Has. Within it. Marital strife. Marital strife. We had a baby. To the mix. And the. Ups and the downs. Become significantly. Greater. Again. [03:06:00] Speaker ?: Momta. Left. Nepal. To be with. [03:06:04] Speaker 17: The defendant. Mamta left Nepal to be with the defendant. She moved into a house only in the defendant's name. She had a baby with him. She stood by him as he bought one Tesla car for himself. She stood by him while the defendant managed or controlled the flow of money. Mamta stood by the defendant when the defendant's parents moved into that marital home and controlled how that sweet little baby was going to be raised. And despite all the domestic marital strife between Mamta and the defendant, she always loved him. And the only way out for Mamta was for death to do them part. Talk to you a little about Sarita Nupani, the friend that Mamta met while working at the hospital. Sarita will tell you she was a friend to Mamta, that she helped Mamta work through these domestic strifes she was having with her husband. Sarita helped Mamta get her own bank account. She helped Mamta to get her own phone. She helped Mamta to find another place to stay when the marital strife was at its peak. Sarita even allowed Mamta to live with her during the marital strife. Sarita will tell you that when Mamta moved out, her baby went with her. And even after moving out, despite all the marital strife, Mamta loved this man and then moved back in with him to be a good wife and to make it work. In the end, the evidence will show you how it cost her her life. I already told you you're going to hear from Mamta's mother, Gita. She testified that she talked to Mamta every day and sometimes twice a day. Gita got to experience watching Mamta raise her baby. Mamta loving her life. Gita will testify that the last conversation she had with her daughter was July 30th, 2024. In mind, Gita was in Nepal when she would talk to Mamta, who was here in Virginia. Nepal is about 10 hours ahead of Virginia time. I told you a little bit about the saw. I'm going to tell you a little more. That saw, a reciprocating saw, also known as a sawzall, a Ryobi sawzall, we'll learn is what we will prove was used to dismember Mamta. You're going to hear from the defendant's landscaper, Jose, who will tell you about this saw. Jose will tell you that on August 1st, 2024, he was working at a neighbor's yard and saw the defendant using this reciprocating saw out on his own property on a tree. The defendant calls Jose over, and they work out a deal that the defendant wanted Jose to do the landscaping on the defendant's property. Jose was charging $40 to work the yard. The defendant tells Jose, I don't have any money, I'll pay you, here, take this saw. To Jose, it's a pretty good deal. Because that saw is worth in excess of $100. For the defendant, it was even a greater deal. To give the saw to an unsuspecting landscaper. Get the evidence out of the house. Good deal for the defendant at that time. Because weeks later, Jose learns that Naresh Bhatt has been arrested for murder. A light goes off. I got this saw. I got to give this to the police. So Jose brings the saw to the police. The police open up the saw. And you will see, with your own eyes, Martha's blood in that saw. Not on the blade. In the body of the saw. I'm pretty sure everybody here has a cell phone on them. I'm pretty sure it's powered down. But in 2024, the defendant also had a phone. The police looked into the defendant's phone. What did they find? They found his Google searches prior to this murder. The evidence that we will use to prove premeditation comes from the defendant's Google searches. Here are the words. The defendant types into Google. What happened if spouse disappears in divorce in Virginia? What happened if spouse disappears? Need divorce. Spouse died in Virginia. These are the search terms the defendant's doing on his phone prior to her murder. That's premeditation. I'm down to my last two pieces of circumstantial evidence. Just bear with me. USCIS. United States Citizenship and Immigration Services. MAPTA was not a United States citizen. She held a green card. But what does that mean? It means MAPTA could be removed from this country for whatever reason. And if she was removed, where does her baby go? It goes to him. So MAPTA also wanted to become a naturalized citizen here in this country. She files all the appropriate paperwork. She pays the fees out of her own pocket. MAPTA got all the way to the end of the process to the final interview, which was scheduled for August 5th, 2024. MAPTA never shows. The last hurdle to her obtaining ultimate freedom, ultimate liberty. And MAPTA never shows. She never calls USCIS to say, hey, I'm late. She never reaches out to them to reschedule, to get her citizenship, to be free, to have her own liberty. She doesn't show. Why is that? In conclusion, for any of the parents in this room, we know life gets busy with our own jobs, with our careers, getting an education, our house responsibilities, our houses of worship, going to church, going to the temple, going to the mosque, wherever you pray. Life gets busy for us as parents. Sometimes, in the midst of our busyness, we miss our child's soccer game. We miss the wind ensemble. We miss those things. You know what no parent here will ever miss? Ever. Their baby's first birthday. You would move mountains to be there. You would resolve any grievances you have with your partner to be at your baby's first birthday. Baby Nima was born on August 20th, 2023. This was Mabta's first baby. This was her little girl. This was Minnie Mabta. August 20th, 2024. Mabta never made it to her baby's first birthday. Not a card. Not a text message. Not an email. Not a gift. Nothing. And this trial is going to prove why. Dead. The evidence will prove this man killed her. The evidence will prove this man defiled her dead body. The evidence will prove this man concealed her dead body. In approximately seven weeks, hopefully sooner, but in seven weeks, we will prove this case to you beyond a reasonable doubt and will lead you to the one conclusion you can draw upon this evidence. At that time, we are going to ask you to find this defendant guilty of all three charges. Thank you. [03:18:27] Speaker 12: Now, Ms. McNabb, this is Commonwealth Exhibit 331A. Before I start publishing this, can you tell the court and the jury a fun fact about this particular camera? [03:18:39] Speaker 20: The camera image comes in inverted. So kind of think of it as the backward mirror image of it. [03:18:49] Speaker 12: So, for example, if somebody was driving a car, would it appear that they were getting out of the passenger side? [03:18:58] Speaker 20: It definitely looks like the driver is getting out of the passenger side. [03:19:05] Speaker 12: Publishing, and I will skip forward to minute seven. [03:19:18] Speaker ?: And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. And I will skip to minute seven. [03:19:48] Speaker 12: Now, Ms. McNabb, we see a vehicle coming into view at approximately 7:43 on the timestamp. Is that the vehicle that law enforcement requested you to find on your cameras? Yes, that is. Can you remind us the day and the time of this video? [03:20:22] Speaker 20: This video is July 30th in the morning. I'm going to say between 7:00 to 9:30-ish. [03:20:30] Speaker 12: And is that Tuesday, July 30th, 2024? [03:20:36] Speaker 20: I don't remember Monday, Tuesday, Wednesday, Thursday, but it is July 30th, 2024. Thank you. [03:20:42] Speaker ?: Thank you. Thank you. Thank you. Thank you. [03:21:12] Speaker 12: Stopping that video approximately nine minutes in. [03:21:42] Speaker ?: Thank you. [03:22:09] Speaker 12: Publishing now, Conwell's Exhibit 331D. Are we looking at the same camera view that we saw in 331A? Yes. Is this still an inverted? [03:22:27] Speaker 20: It is still inverted, so it will look like the passenger is getting out, but it's actually the driver. And can you remind us the date and time of this video? This is the same day, July 30th, 2024. Timing, I think this one was more around lunchtime-ish. I'm going to go 12 to 2-ish. And then that was the Tesla that the police were looking for. [03:22:56] Speaker 12: That just entered the screen approximately at 40 seconds in. [03:23:00] Speaker ?: Exactly. [03:23:00] Speaker 20: Pulling into the same spot beside the dumpster. Now, we see the individual who got out of the Tesla start to walk across the parking lot. [03:23:16] Speaker 12: What direction is that in? Or what buildings are in that location? [03:23:36] Speaker 20: I'm walking in the direction of 9700 and 9702. Clark, please. [03:23:40] Speaker 12: I'm going to skip forward a little bit. I'm going to skip forward a little bit. [03:24:12] Speaker ?: I'm going to skip forward a little bit. I'm going to skip forward a little bit. I'm going to skip forward a little bit. I'm going to skip forward a little bit. Now approximately one minute and 55 seconds. Do we see that same Tesla that we've been seeing in the other videos? Can I enter into the screen? Yes. [03:33:32] Speaker 20: Where is he parking? Directly in front of the dumpster. Again, it is inverted. So it is going to look like he gets out of the passenger side. But he is the driver. [03:33:43] Speaker 12: And at this time, I am going to zoom in. I am going to tools, effects and filters, video effects, geometry, interactive zoom. We see the individual appear to put something on his hands. Can you tell what that is? [03:34:19] Speaker 20: It appears he put gloves on. [03:34:24] Speaker 12: And what does it appear he removed from the vehicle? [03:34:27] Speaker 20: A large bag of trash. [03:34:30] Speaker 12: Does he place it into the dumpster? Yes. Is there a second bag that he used? Yes. [03:34:46] Speaker 20: That one looks smaller than the first. Looks like he dropped it, so he bent down to make sure he put it in the dumpster that time. [03:34:55] Speaker 12: Again, we just saw him enter what appears to be the passenger seat. [03:35:16] Speaker 20: But that is the driver because of the inversion of the camera. [03:35:37] Speaker 12: I'm stopping that video at 3 minutes and 50 seconds. [03:35:50] Speaker ?: I'm going to put it in the dumpster. I'm going to put it in the dumpster. I'm going to put it in the dumpster. I'm going to put it in the dumpster. Again, I'm basing this on the shades differences. This one's probably in your 4:00 to 6:00 p.m. range. [03:36:53] Speaker 12: And just remind us, you said July 31st, is that 2020? [03:36:57] Speaker 20: Yes, sorry, 2024. [03:37:00] Speaker 12: Is this also inverted? Yes.
