[14:32] these challenges through the institutionalization of important policies and practices as well as the
[14:41] introduction of critical reforms to the national budget process this measure institutionalizes the
[14:50] framework framework for the preparation enactment execution and monitoring of the national budget
[14:58] based on existing practices and policies implemented with the dbm and other relevant agencies it likewise
[15:07] introduces key reforms aim to strengthening alignment between local development priorities and national
[15:15] government programs while also institutionalizing a meritocracy based framework for budgeting the
[15:25] present mr chair many of the policies and rules governing the national process are spread across various
[15:34] issuances circulars guidelines and administrative practices while these mechanisms have guided the

[20:54] as part of the pfm committee actively advocates for as part of the philippine pfm reforms roadmap 2024 to
[21:03] 2028 in the next slide you will see that the the key challenge in the pfm legal landscape the country's
[21:14] current pfm legal framework is a patchwork of fragmented laws executive assuances and court rulings
[21:22] the accumulation of disparate legislative and administrative directives over the year has
[21:28] generated systemic fiscal frictions and leakage which incentivized procedural compliance over
[21:37] for four months this has led to contradictory regulations weakened internal and expenditure
[21:44] control and reporting gaps a system that has been vulnerable to abuse while book six of eo 292 or the
[21:53] administrative code has served us our fiscal policy foundation for nearly four decades 40 years
[21:59] the current circumstances demand for an upgrade in our legal landscape a crucial shift from trans
[22:07] traditional administration to a high performance budgeting system that is anchored on meritocracy
[22:15] this is a rightful action as we respond to the heightened call for transparency and accountability
[22:21] the philippine budgeting code on a practical note aims to eliminate legal fragmentation by consolidating and
[22:28] codifying all budgeting rules into a single modern law so that both the executive and legislative branches
[22:36] can operate under one framework enabling policy makers implementers and stakeholders efficiently
[22:44] interpret and implement budgeting rules with clarity efficiency and certainty this will pave the way for
[22:52] clearer regulations improved internal and expenditure control modernized reporting measures and
[22:59] improved sustainability of reforms this move is well aligned with advanced countries which are now
[23:05] operating under one comprehensive budget law one example is south korea who has the national finance act
[23:15] in the next slide we saw that uh we saw the parts of the philippine budgeting code but we highlight that this
[23:28] is not a new intervention in fact this started in the 17th congress the work for this proposed
[23:36] measure dates back to 2014 that's 12 years ago during aftermath of the supreme court rulings on pdf and dap the
[23:47] measure has then evolved with in-depth analysis and consultation with pfm practitioners and our international
[23:55] development partners such as the international monetary fund the philippine budgeting code consists of seven
[24:02] books books that cover the structure of government funds national budget process financial management systems
[24:09] institutional oversight and transparency mechanisms applicable to all national government agencies and
[24:16] instrumentalities and were specified local government units the next slide the passage of this bill will
[24:27] usher the following fundamental shifts first greater transparency in the budget process
[24:34] where rules on errata will be clarified and alignment of planning and budgeting calendar from the local to
[24:41] national level will be ensured to reflect genuine needs on the ground second prudent fund management with a
[24:50] standardization of funds including the nature sources and allowable purposes the measure sets the ceiling of
[24:58] unprogrammed appropriation to two percent of the total expenditure program
[25:03] and limits its coverage to foreign assisted projects it clarifies the role of the permanent committee
[25:10] on fund management of course all of this will be subject to further discussion in the committee
[25:17] in the next uh in in the third one the measure also intends to provide clear safeguards to protect the
[25:26] economy in times of crisis through the national disaster risk reduction and management fund contingent fund and
[25:35] impoundment of appropriations the fourth it will enforce greater accountability and efficiency by delivering
[25:43] results and reports on time through institutionalization of the cash budgeting system
[25:49] including clear rules on what constitutes accounts payable and integrated financial management
[25:55] information system while establishing also the pfm technical support office to ensure a long-term
[26:02] management solution of the ifnis and finally the fifth the measure clearly specifies mechanisms to
[26:10] ensure effective citizen engagement in the budget process the bill has been filed in both houses
[26:18] the senate is currently refining the language in its fifth pwg meeting and while we are here in the
[26:25] committee deliberation next slide as we look forward to the future of philippine public financial
[26:34] management one thing is clear we cannot meet tomorrow's challenges with obsolete tools i would like to
[26:41] leave you with the thought that realizing our midterm fiscal managed fiscal framework targets
[26:48] and necessitates a modernized legal structure designed for high-speed execution rather than fragmented

[41:36] which mandates meaningful engagement of citizens and stakeholders during budget preparation meaningful
[41:42] participation is a cornerstone of human rights ensuring that those affected by budgetary decision have a voice in the
[41:48] process and third focus on human development outcomes section 35 establishes a meritocracy based budgeting
[41:56] framework that accords preferential consideration to programs demonstrating improvements in human development
[42:02] outcomes including health education economic standards of living and consumer price affordability this
[42:10] aligns with the principle of the progressive realization of economic social and cultural rights
[42:17] the chr offers the following points for consideration to further strengthen the human rights framework one
[42:23] prioritization of minimum essential levels from a human rights standpoint the state has a core obligation
[42:29] to ensure the satisfaction of at the very least minimum essential levels of each right the code should explicitly state
[42:36] that even times of fiscal discipline under section 5a the budget for basic services such as primary health care and
[42:43] based basic education must be protected from disproportionate cuts and to protection of rights during disasters
[42:48] and to protection of rights during disasters the chr supports the national disaster risk reduction and
[42:55] management fund under section 15 and its role in relief recovery and reconstruction
[43:01] we are we recommend that the special condition for this branch prioritize the rights of displaced persons and the most
[43:08] vulnerable communities to ensure that no one is left behind during the crisis
[43:12] the commission on human rights supports the passage of house bill number 8520
[43:17] by codifying principles of transparency accountability and inclusivity
[43:22] this bill provides a foundation for a national budget that serves as an instrument of social justice
[43:29] thank you mr chair thank you very much uh the committee commission on human rights your
[43:34] uh points have been well taken and will be considered uh can we hear from the um representative of the
[43:43] philippine association of state universities attorney luis viminda marsales the legal officer of the paso
[43:49] good morning honorable chair and the honorable members of this committee the philippine association of state
[43:58] university universities and colleges submitted just this morning our position paper while expressing our support
[44:06] to the proposed measures but at the same time we also take this opportunity uh to put forward some
[44:15] observations and recommendations that would help address the challenges being faced by the state
[44:21] universities and colleges uh in relations its fiscal and operational autonomy and on the uh on its
[44:31] constitutionally and statutory mandates so mr chair in general so we're proposing uh we're supporting the
[44:40] public financial management uh framework being put forward but we hope to see a framework that is
[44:47] developmental and enabling and not just transactional or administrative uh within that context mr chair uh we
[44:56] propose that the framework recognized the special constitutional and statutory character of souks as academic
[45:05] institution vested with academic freedom and institutional autonomy ensure that budgetary policies do not
[45:13] inadvertently impair the capacity of souks deliver instructions research extension innovation and production
[45:21] functions allow flexibility allow flexibility for multi-year academic research infrastructure and innovation
[45:28] programs whose implementation time timelines necessarily extend beyond annual budget cycles recognize the need for
[45:37] differentiated applications of budgeting accounting auditing and administrative controls consistent with the
[45:44] constitutional constitutional constitutional and statutory character of souk um mr chair so we also respect the
[45:53] centralized or uniform public financial management framework but hopefully the centralization and budget execution
[46:01] and fund utilization uh will work and again recognize the unique character of the state universities and
[46:08] colleges and colleges and in relation to that to explicitly acknowledge the developmental role of souks in the national innovation
[46:17] regional development human capital formation and inclusive economic growth our uh we also have specific comments and
[46:25] recommendations under section two declarations of policy under section three the scope and coordinates under section four
[46:32] the definition of the definition of terms under section 31 of the gas budgeting section 52 52 on the
[46:39] implementations of gas budgeting and on section 74 on iran sentination so we discussed that mr chair on the position
[46:47] paper that we discussed this uh we submitted this morning thank you mr chair thank you ma'am attorney
[46:54] before we proceed like to acknowledge the presence of uh representative anna victoria below so to us on
[47:02] third district uh can we hear from department of health uh the representative good morning mr chair the
[47:13] department of health expresses its support for the objectives of house bill number 8520 for the proposed
[47:20] philippine budgeting code particularly in promoting transparency accountability participatory
[47:27] budgeting and a more efficient public financial management system the doh recognizes that these reforms
[47:36] are important in strengthening the implementation of the universal healthcare and ensuring that health
[47:43] funds are utilized properly timely and in accordance with the actual needs of the public the department
[47:52] likewise recognizes the importance of the proposed provisions on performance informed budgeting
[48:00] digitalization of financial systems and the strengthening of monitoring and accountability mechanisms to
[48:08] further improve the delivery of health services the doh remains open to collaborating with congress and
[48:16] other stakeholders to ensure that these reforms are practical efficient and will not adversely affect the
[48:25] continuous implementations of key health programs and government emergency response mechanism further the
[48:35] department of health will issue official position paper on the proposed measure and shall be submitted separately

[51:29] while promoting transparency fiscal responsibility operational effectiveness and results orientation of
[51:36] the budget given the significant impact of this legislation on the department's fiscal and strategic
[51:43] framework our financial management service and planning and monitoring service are reviewing the
[51:49] measure and will be submitting our specific comments and recommendation asap the department also stands
[51:56] ready to actively participate in uh further committee hearings to refine these fiscal mechanisms
