"and happy monday to you everybody welcome to courtroom insider it is the 12th of october 2026 so glad you're with us we had rain all weekend long like all weekend long which is good we desperately need the water here in idaho and uh we had a we went to a trunk or treat which i was just talking with"

[00:00:00] Speaker 1: and happy monday to you everybody welcome to courtroom insider it is the 12th of october 2026 so glad you're with us we had rain all weekend long like all weekend long which is good we desperately need the water here in idaho and uh we had a we went to a trunk or treat which i was just talking with grace long our producer and she did not know what a trunk or treat was and then it got me wondering maybe that's just like an idaho utah thing but i swear when we lived in virginia they had them it's a it's where people decorate their trunks and you go the kids go and they go trunk to trunk to trunk to get candy for halloween uh it's like a safer thing you could say because everybody's all in one and they're not going home to home but anyway have you heard of a trunk or treat let me know if you've heard of it or if you have no clue what i'm talking about if it sounds interesting to you because they're big they're really big where we live here in east idaho so yeah we went to a trunk or treat on saturday had a good weekend stayed inside uh stayed nice and warm and it's good to be back with you all tonight we're talking about the case of faith hedgepath the 19 year old uh girl who what young woman i should say who was murdered back in 2012 would love to know where you're watching from if you've got any questions and please subscribe if you haven't uh she was killed in september of 2012 and now 14 years later her family is in court every day for the trial of the man accused of killing her his name miguel salguero olivares he was 19 at the time faith was killed she was also 19. uh the state is presenting its case that he was a stranger attending a barbecue in the parking lot near the apartment where she was staying she was staying with her friend carina they shared one a one-bedroom apartment and they left the door unlocked because they only had one key between them on september 7th of 2012 someone walked in and the state says that salguero olivares raped her and then brutally beat her so we're in day four of the trial we had some top moments like the police interview with carina we saw that today a data expert who investigated and inspected faith's cell phone and there was no tie to her to her having knowledge of the defendant the defendant the defendant was nowhere in the communications no texting no phone calls nothing faith had no sex assault injuries too but an expert says that doesn't mean that she wasn't necessarily assaulted we're going to talk all of about that uh today but before we go any further i want to bring in grace wong who has been moderating this case every word of it from the beginning grace happy monday happy monday nate good to see you again it was day four of the trial uh give us kind of your key [00:02:56] Grace: takeaways um well there are a couple witnesses being called which uh i think we're getting into kind of the course of the investigation and where it led police and what uh they ended up doing um so we ended today with the lead investigator who um did not she she remained on the investigation for two years but then was reassigned and uh we almost got into what they did because what they learned from all the swabbing was that they had developed a male dna profile and so the next step for them was to look for this suspect and they and she testified that they tested or obtained dna samples from close to 300 people because they had to work within faith hedge pets circle of friends and she was very involved i mean we learned a lot about faith i mean she was very active in many circles she was active in the native american students association she was act she worked at red robin as a waitress and she had all these friends so they had to work within all these circles and obtain dna um samples from all the men in all these circles and uh some of them were not cooperatives which uh she said that they used other investigative tools to rule them out um so it it we're hearing a lot about or at least starting to about where the investigation took them at the point where um they developed this male dna profile but we're in this cross of this investigator and and uh the the defense is trying to show that there were mistakes made in the investigation there were swabs that were lost and so i think they're going to keep hammering on that theme um of pointing to a very flawed uh investigation to um plant reasonable doubt in the minds of jurors uh do you think that [00:04:58] Speaker 1: that's working grace i mean are there enough points being raised that you're like hmm that's that's interesting that could be a thing because sometimes they kind of throw stuff at the wall and it's not [00:05:09] Grace: really sticking well i think i think that's part of it because um it's it's difficult to say where they're going with it because there was also a nurse practitioner who was an expert on forensic um sexual assault examinations and this nurse was also cross-examined and um you know based on the cross-examination it's hard to tell if the defense position is that he had sex with her but it was voluntary uh because then he has to admit that he was there and so they're kind of admitting or you know there's this legal strategy that a lot of defense attorneys use which is um admit what you have to and deny what you can so at this point not having the dna evidence in i think he's planting the seeds as to whether this was indeed a sexual assault if the examination or the collection of the dna was not um done to protocols or done to the standards that this expert claims that um um you know that you're supposed to do and then there's all this questioning and cross-examination of the of the actual investigation and and the fact that some swabs of of uh blood evidence was lost so the defense is continuing to try to punch holes in the investigation and uh the dna that was collected and i think that's just laying the groundwork because ultimately when the dna evidence does come in you know it may be very compelling when you know you're talking about billions to one that this is the likely candidate who [00:06:54] Speaker 1: left this dna right they're gonna have to eventually admit that he was there whether you know he forced himself in or whether it was a consensual sort of relationship or encounter uh based on what we heard at opening arguments by opening statements by the prosecution that his dna was was all over her uh any other things stick out to you today [00:07:17] Grace: well we heard the uh roommate's police interview which was done uh shortly after the discovery of the body and um it was you know her her testimony has been very compelling and it was very compelling to hear what she had to say soon after faith's body is being discovered because her and marisol came in at the same time that they they walked into the apartment and she had no idea that faith was dead at the time she was still under the impression that faith might have passed out or was unconscious and so um i think that just reinforces her credibility that she is not someone that was involved in faith's death because she was so unaware until she saw the blood and realized that something was seriously wrong that she called police the other thing that she said that was very telling was that she noticed the bag you know she testified about having a sandwich that she she had took a couple of bites from but she didn't really like it and she put it back into the bag um and there was writing on the bag and she said that as far as she knew there was no writing on the bag it was a plain white paper bag but that bag was found on the bed near faith's body with that writing on it um i'm not stupid yeah but you know jealous uh so that i thought was very telling she knew that when she had the bag there was no writing on it but the writing had to have been after she left the bag and she she said that she thought she would have left it on her table i mean you know this was a very messy house and so the police detectives who did explore the crime scene needed to know from her what would it be out of place and so she did say that that's not something that she would have left [00:09:12] Speaker 1: on the bed she would have left on the table so again go ahead well i do you think that they're going to like bring it in handwriting expert and have him admit samples of his handwriting to see [00:09:24] Grace: if it matches that bag i you know that's not something that they may have done because the evidence of the dna may have been so strong right and writing expert because the defense did say in its opening that they should be that they should prove that he wrote that message and so for him to raise that in openings and when i say him i mean the defense attorney mr uh rainsford um for him to raise that it means that that is a a hole that was left in the investigation and frankly you know he during his cross he does raise a lot of questions but and he's raising mainly questions about the collection and the storage of the dna swabs and um and so i i think like i said he's he's he's laying that groundwork so that that might plant some seeds of reasonable doubt when that dna evidence does come in and the and and it's very compelling dna evidence tends to be very compelling and it's really hard to overcome once they are able to say that the odds are you know insurmountable that this could be someone else's dna right all right what can we expect tomorrow i think we can expect more of her cross-examination and i think they're you know they they are talking about other investigators that were on the scene and uh i think they're gonna basically take us through or walk us through the investigation and what they did to try to narrow down the pool of people knowing that they have a suspect knowing that they have this dna profile what they did so they could be getting into the ancestry part of it trying to locate these relatives that they first initially interviewed before they got suspect yeah [00:11:19] Speaker 1: that sort of stuff can always be fascinating just to see where they go with the family tree who they're able to eliminate and cross off i mean we saw it in brian coberger those of you in idaho we saw it with chris tapp and angie dodge that not he didn't kill her but brian drips did and they were able it was a cigarette that was tossed out the window the police tested and anyway that that sort of thing is interesting grace before you go can i ask you do you ever get stressed yes i do get stressed you do you're are you is is covering trials can it be stressful yes it could be very stressful i mean [00:11:54] Grace: it's not as cool as a cucumber but working for courtroom insider is not nearly as stressful as working for court tv okay i don't have the pool responsibilities that i once had so yeah but [00:12:08] Speaker 1: there is a certain amount of stress yes grace handles it also well the reason i ask is because i'm about to send you one of these this this is a this looks like a little hammer uh there i think you can see our logo if you look closely and the logo is not count room insider for the record that was the first question i got when i showed my wife should tell me it doesn't say count room it says courtroom um although it looks like count room is still very popular i know i know well by the way if you go to countroominsider.com we own that we probably need to put something on there this is a not only a mallet to keep things in order but it's a stress reliever thing so i'm going to send this to you so you can take these to your trials and then just squeeze it five times and i guess if two you're going to donate [00:12:53] Grace: blood to squeeze it anyway i think i'll need more than one nate okay i'll send you 10 and those of you [00:12:59] Speaker 1: watching at the end of the program i'm going to let you know how you can get one because these just arrived today right before i walked into this room the box showed up i ordered them like eight months ago but earth eight weeks ago anyway grace thanks for your hard work judge wong reporting for duty [00:13:15] Grace: today anything you want to add uh no i just i i'm looking forward to receiving your uh is it a gavel [00:13:23] Speaker 1: it's a gavel it's a gavel yeah yeah it's a gavel right it's a gavel and i'll even sign the back right there if you want oh yeah and the other nate sign it too yes yes we'll have the whole team then every time you squeeze that marker can get on your hand all right grace we'll see you tomorrow thanks thank you all right so you stay tuned at the end of the broadcast i'm going to let you know how you can get one of these for you we have a limited number of them and they're just so fun i've been carrying around all day slamming it on everything okay let's get to the trial the first witness of the day was a woman named heather waleski she's a sex sexual assault nursing uh expert a training expert she was asked by prosecutors to give a basically an anatomy class of the female body the reproductive system for women before she moved into faith's medical records eventually miss waleski explained how it is possible to give an examination to a sexual assault victim even when there appears to be no visible injuries so [00:14:27] Speaker 3: there's a couple different techniques that we use to look for injuries not just with the naked eye after we are once we get down to the anogenital exam it's a very systematic way that we conduct the exam and collect evidence so that we are following an order and looking for injuries if we jump to the speculum exam before we do a exam of the external genitalia we may miss that and then this the speculum very rarely but it can cause injuries and so we have to make sure that we're looking at all looking at all of that before we do the speculum exam there's also a blue kind of blue purple dye called toluidine blue dye that we use once we've looked and collected all of our external dna swabs for someone else's dna will then do some labial separation attraction to be able to visualize those areas [00:15:22] Speaker 1: waleski says you can be sexually assaulted and not have any injuries especially if you're intoxicated if you've blacked out if you're unconscious because a lot of times in those situations you're not fighting back your body is is not moving you you are you are not with it you're you're out of it uh she did not actually do the examination on faith's body for injuries but she did look at photos from the autopsy [00:15:50] Speaker 3: and she made conclusions based on those images reviewed the report of the autopsy that they did not see any external you know genital injuries or vaginal injuries or injuries to her cervix i reviewed this photo and one other that's kind of just a wider view where you can see a little bit more of her abdomen and was not really able to see whether or not there was any injury on this photo [00:16:23] Speaker 4: um and based on your observations of that photo limited though they they were um and your review of the autopsy did you form an opinion yes what what is your opinion uh so the lack of any anogenital findings [00:16:39] Speaker 3: in this report as in others is not inconsistent with a sexual assault uh and any unknown dna that may have been collected on any of those swabs from the internal vagina or the anus and rectum um are medically diagnostic or what we would call confirming for sexual contact now when it came time for the defense to [00:17:02] Speaker 1: cross-examine her they pointed out uh that to buleski you didn't do the exam and she said you're right i didn't do the exam but um and and also that she didn't speak with the doctors who did do the exam and those doctors reported no sex assault injuries they're saying she wasn't sexually assaulted as for dna sperm can be recovered up to five days after an alleged assault it's almost kind of like they're saying that maybe these two had an uh an encounter that was consensual that perhaps the defendant maybe had sex with her but he didn't kill her they haven't flat out said that and we'll see what their defense is when it comes time to it but uh here's a little bit about uh some other [00:17:51] Speaker 5: questioning that the defense had with the witness you're not giving an opinion that there was um a sexual assault correct correct and and given the opinion in this case about unknown dna you're not giving an opinion on how long that particular dna um was located or had been the time since uh deposit [00:18:17] Speaker 1: sure no i can't determine the time and when it was after miss waleski finished we heard from brian walker a chapel hill investigator back in 2012 he specializes in data and cell phone forensics he did a data extraction on faith hedge pets cell phone and he said before the witness could perfect well actually before the witness could even present the phone data the defense objected to it uh within the debates of allowing the jury to review the information the state revealed that in arguments to the judge that miguel salguero olivares is nowhere on the call logs or the data and the defense through mental many rebuttal rebuttal arguments to the judge um said they didn't think that the jury should be able to see this and that because just because they he he wasn't in her phone doesn't mean that they didn't know each other and this kind of gives us a look of where the defense is heading that um about his his dna on faith and at the crime scene the judge ultimately denied the objective the objection and limited data from the cell phone to be presented from hers and karina's cell phone too but first an interview with karina was played we talked about that earlier karina was faith's best friend and roommate who discovered her body and called 9-1-1 she starts off in the interview recounting the day before the murder when faith left for an hour while she karina was studying at the library she didn't realize faith had left to see a boy named talib recently she had expressed me that she kind of had feelings [00:19:51] Speaker 6: for 20 but she liked him more spread and she didn't know what to do about it um i just wanted to see what happened but she also like tired she just had a lot going on with like emotions about people um but talib has always been like her good friend since freshman year they've always been close always [00:20:22] Speaker 7: all right do you have any ideas as to what what you think may have happened that she went out there [00:20:29] Speaker 6: um probably nothing i mean she probably went over there they just hung out i mean i don't know i know they probably didn't have sex because she's on her period um but it's not uncommon for her to just go over at his place and just chill i know i don't i don't know i mean it seems weird but it's really not so weird to think that faith would do that um she just does for moments stuff sometimes she knew i was [00:21:04] Speaker 1: writing a paper so i wasn't going anywhere later that night she texted a guy named mitch the security guard at the thrill letting him know that they were headed over she says they were socializing faith was dancing around 2 15 a.m the place shut down they decided to head out karina says she was really [00:21:22] Speaker 6: drunk and crying over her ex-boyfriend we gave out to the apartment it had to be around three because we lived about 15 minutes away so i would say um we go in the apartment all i remember is throwing up i remember her trying to help me when i'm throwing up um when i went back to the place the next day like when i saw the bed and everything i saw there was a trash can next to my side of the bed with a trash bag in it she had to have done that um because i would have done it that was and then i got out of bed i think after i got out i was feeling better from throwing up i went to the bathroom and maybe i was still queasy but i sat right next to the toilet i was just laid up like [00:22:15] Speaker 1: against the wall next to the toilet and crying karina was in the bathroom for an hour texting people we heard a lot of this testimony the other day when she took the stand but but this proves that she her story hasn't changed she was able to give police this this uh you know recitation of what happened uh the only person so she's in the bathroom texting people she's sad about her boyfriend she's really intoxicated she texts her boy a guy named jordan who testified last week he drives over and picks [00:22:44] Speaker 6: her up i went straight out the door and i told her i was sleeping did you see her no i did not see her i just figured she was in the bedroom either sleeping or watching tv i didn't even go back in there in the bedroom no it's all was the tv on i don't know what i thought was strange though i told the other officer though that faith when you basically they usually leave the tv on um i don't know she just didn't turn it on because she was helping me at the time or that she had turned it on after i left but she usually turns tv on or i'll turn it on maybe she was just really tired i mean sometimes we sleep with it off but i mean normally we sleep with [00:23:38] Speaker ?: it on i mean it was really late but i thought it was strange she was off [00:23:48] Speaker 6: but i literally just walked right out the door i didn't have my key i didn't have id a card i just have whatever was in my back pocket louie jordan's house we're there and then woke up the next morning around 8 30 because he was up because he would get up early for class um and i was talking to him and i was talking to his roommate oc to kind of share a room so all that's like stopping is like occurring and he was joking about how he like heard me and jordan last night um and i mean i was just talking to oc until he left and then i started to call i called faith then i texted her up telling her i needed my notebook i knew she had class like nine something she should have either been up or she should have already been on campus um i kept texting her i called her at least 14 times because i was just like i really need those essays like i had two essays too and i didn't want to go all the way to the apartment and she had locked the door and then i can't get in and i can't get to them so i was already near campus if she was on campus something like hey can i get the key or hey like is the door unlocked um sometimes we'll just leave the key under my mat but she never responded so i called my soul marisol their other friend who we heard from [00:25:27] Speaker 1: too then picks up karina from jordan's place and drives her back home together they walk up the stairs and they make the horrible discovery that faith is dead um walk in the bathroom light was still on [00:25:42] Speaker 6: which i thought either i because i left it off but i mostly thought that faith had gotten up in the morning and used the bathroom was getting ready and had left for class um going to the bedroom i don't see her i don't see any sheets on the bed like initially i was just like oh she must just left and then i started to process everything i first saw like the comforter was like off the bed um so i walk kind of that side because she usually sleeps on the left side of the bed and i always sleep on the right um then i see her hair and i was like oh my gosh i just thought she had passed out like she had rolled off the bed and passed out like i didn't think anything and then i started to see red blood like red stuff on the pillows and the wall and then i pulled the sheet down and i saw that she had plaque by i didn't think she was dead though i thought it was just she had passed out or i don't know why but my initial thing was we still need to call 911 i don't know what happened before we just need to call so i reached my phone first and i got it unlocked first and i called and they asked me to check if she was breathing i thought she was breathing like i just i'm just like of course she's breathing like why wouldn't she and i pulled it down more and like i saw like where her chest and i didn't see anything move or anything and i was just like i don't know i i've never checked for something who wasn't breathing before and i touched her and they're like can you check to see if she's cold and i was like she's kind of cold i don't know i was just can you please hurry up i was just so panicked i didn't understand what was going on i didn't think she was dead [00:27:37] Speaker 1: now the interview turns personal because the investigator by now knows that karina had blood on her hand jordan who had picked her up noticed it he brought this up in his testimony the other day so it's brought up in the police interview they talk about it and here's what she said and tell me again what would you guys do when you got there it says you did have sex with me [00:28:02] Speaker 7: did y'all discuss anything else i don't know i was just emotional i'm pretty sure [00:28:08] Speaker ?: i was i mean he knows that like i've gone through a lot [00:28:18] Speaker 6: where are you are you on your period right now no i mean i was spotting before that because i just had an abortion last week but um i'm not on my period [00:28:36] Speaker 7: so [00:28:41] Speaker 6: what do you mean by responding like sometimes i'll just bleed a little bit it's nothing like it's not like a period [00:28:57] Speaker 7: when's the last time you were spying today today yeah what did you guys discuss from the apartment to this house i don't remember you don't remember i really don't i remember mentioning something about [00:29:12] Speaker ?: that's what i really thought about it but i really don't know i wish i did [00:29:17] Speaker 8: do you remember him asking you about a blow on your fingers because apparently you had some blood on your hand that he asked you about [00:29:33] Speaker 6: i don't i mean i was throwing out red stuff but i don't remember the people out of my hand [00:29:43] Speaker 7: you don't remember that conversation [00:29:48] Speaker 9: i don't i really don't [00:29:52] Speaker 8: did you have any injuries on your back [00:30:02] Speaker ?: do you have any injuries on your back [00:30:02] Speaker 6: i mean i had like a scratch from when i had stabbed myself a pencil during class [00:30:15] Speaker 1: he goes on to ask her what she did upon discovering faith's body and asks her to describe the scene and what she saw or noticed was odd you touched her stomach like right here [00:30:39] Speaker 10: did you have any blood in your hands at that time did you see any blood on her stomach [00:30:47] Speaker 9: not where i touched it and on her arm where i touched i didn't touch any blood [00:30:51] Speaker 10: why did you touch the sun just because i wanted to see if she was breathing breathing [00:30:57] Speaker 6: and i touched her on because they asked me to check if she was cold [00:31:00] Speaker 10: did you touch any bloody spots on her at all no no no after that i did not touch [00:31:05] Speaker 6: they asked me to move her on her back and i told them no i can't do that the way she was positioned and i just could not touch her i couldn't [00:31:19] Speaker 7: and while that's going on where is the other girl [00:31:23] Speaker 6: me so she's right next to me and she's freaking out she's like oh my god oh my god um and i was like we need to call 911 and she had her phone out and i had my phone out but i reached it first because i had 911 on the speed dial [00:31:43] Speaker 11: and while you're talking on the phone to 911 where where are you at are you in the are you in the bedroom yeah because they had asked me to touch and at what point did you get off the phone with your bedroom [00:32:04] Speaker 6: did i get off the phone i was still on the phone with them when i left the bedroom and went out the front door because i was looking out to see where the ambulance was and when the cop hold up it was like [00:32:15] Speaker 7: the cops are here what struck you is is is the oddest thing that you saw when you went in that bedroom [00:32:25] Speaker 6: a lot of things were odd um first other job is what the way she was dressed the fact that her shirt was pulled all the way up here and she didn't have anything else on that was really odd because i know faith i mean i know she likes to sleep naked but she wouldn't in my bed the wine bottle on the floor i thought that was a little bit odd because the last time i remember she was sitting on the kitchen counter thing why did you come in i noticed that i think after i had noticed her i was just like freaking out and i mean i wasn't thinking about it at the time but afterwards i was like there was one bottle sitting on the floor which i know i didn't put there was it was a wine bottle [00:33:27] Speaker 10: yeah and is there any particular type of wine [00:33:32] Speaker 1: that's it she told police that faith was her world the two never argued and she had no idea who would have done this to her best friend [00:33:45] Speaker 6: i would have given her anything she was staying with me because she didn't have a place to stay we would study together we i love faith i like anyone would tell you that it was always me and faith always me and her if you saw faith you saw carina right behind her we text we text all the time baby told me she was like you're probably the only one that i like consistently text every day she's terrible with texting [00:34:23] Speaker 7: so you guys always talk [00:34:28] Speaker 6: never a problem ever [00:34:36] Speaker 7: why didn't you talk to her that night if you were having so many problems [00:34:42] Speaker 6: she knows about them that's what i was crying about the parking lot she knows but it's not the same like i didn't probably be held by a guy i wanted to feel how i felt when i was with my ex like the protected not someone who's gonna hurt me i mean faith has helped me out so much in the past but it's like she can't feel something like that and she understands that and she's like we talk about it all the time like she would be like we're gonna just need someone to go cuddle with like and it's not the same like me and her just can't we're not gonna just cuddle in bed like it's not the same feeling as with somebody else [00:35:31] Speaker 7: but she understands where i'm coming from so how do you think she died [00:35:39] Speaker 9: that's what i want to know i just want to know when she had suffered what if she had called out for me when she had woken up in the middle of the night [00:35:59] Speaker 6: i don't get it it doesn't make sense there's too much blood everywhere do you think she was raped that was my first guess because the way that her clothes was she just went away and she wouldn't get undressed like that even if i was there she wouldn't have just been walking around without the pants on she just she just doesn't do that i mean she's a free spirit and i'm not saying that i've seen her like naked before when she's changing but i mean she wouldn't just walk around like that and i know she wouldn't just pulled out her tampon she looked like she wasn't drunk she wouldn't just pulled it out like in my bedroom that doesn't make sense like she wouldn't do that that's just [00:37:00] Speaker 1: that doesn't make sense there was a piece of evidence on the bed we've talked about it it was that note grace talked about it tonight that note scribbled on a takeout bag karina never saw the takeout bag on the bed she told the investigator that a friend gave her a to-go breakfast sandwich [00:37:19] Speaker 6: a few days earlier i was at timeout on wednesday um a friend had gotten me a it was in a white bag of biscuit um it was like an egg and cheese sandwich but i finished it i literally just left it in the back [00:37:37] Speaker 7: did you take a bite out of it how much of it did you eat not a lot not a lot at all do you not like [00:37:44] Speaker 6: it i don't really just eat egg and cheese [00:37:51] Speaker 7: do you say somebody gave that to you or brought it to you who was it on wednesday it was brandon's [00:37:56] Speaker 6: friend i don't know his name he was um he's also friends with mitch the security guard because i went out with brandon mitch and this other guy he's caucasian he involved had um i think he also worked a lot of the security like no um we were on franklin street and they him and mitch were having a bet about um getting people to break a time out it's really stupid me and britney were on our way over there walking down and got bald head he came running and he's like don't go if you go mitch is going to the bed he's like i got you two sandwiches [00:38:39] Speaker 7: and i'm like okay and you took those you took the sandwich home was it two of them yeah just five [00:38:47] Speaker 6: and did you eat it in your room probably left it in my room um i took a bite out of it while i was on franklin street but i still took it with me because i just was like oh i'm not gonna waste it maybe i'll eat it later because i was i was kind of tipsy sometimes i like to eat my go but i really didn't like the sandwich at all did you put it in the bag yeah it was still in the bag and was it in [00:39:11] Speaker 7: the bag when you left in your room i left out and what do you think you'll have to do [00:39:19] Speaker ?: i don't know if i just throw things he might have just been on my side of the bed like right next to it [00:39:26] Speaker 1: so it's interesting to hear how this bag may come into play uh next up we heard from captain johnny brit with chapel hill police brit said the chapel hill on average gets between one to three homicides a year relatively safe low crime community captain brit was an investigator in 2012 who responded to the apartment and was asked today during testimony to describe the bedroom crime scene blood spatter on [00:39:52] Speaker 12: the wall where the pillows would be um and were and then on the closet door as well and then faith was off to the left of the bed what do you remember about what faith looked like when you got there i i did not get super close and involved because you don't want to disturb anything i think that's a really important thing to point out is that we don't go in there to really do anything or take any action at that point so i did not get super close to her but obviously she had um you could see all the blood everywhere the black eyes i noticed the tampon on the floor i don't remember if i noticed it or if sabinage pointed that out to me and it looked like it had been flattened like somebody stepped on it at some point and then the white takeout bag that was on the bed which seemed very much out of place since there were weren't really covers on the bed it was kind of an odd placement for a bag so i noticed that as well did you notice anything else about the white bag um it had writing on it do you remember what it said it said i'm not stupid bitch jealous brit also investigated the building across from the [00:41:00] Speaker 1: parking lot because the state had said that a family was having a barbecue that night and that is why the defendant was at the location we've heard about that the defenses said he wasn't there he was not at the barbecue brit described the distance and point of view from the other side of that building [00:41:19] Speaker 4: maybe not on this occasion but on any occasion ended up walking down to that 1400 building which is [00:41:25] Speaker 12: across from where faith and karina lived yes we did follow up there multiple times will you tell us about that so i have a couple like two notable times where i do remember specifically going to that apartment complex um i did some follow-up at apartment 1407 which was on the back side it's actually down i would say on if you're facing the 1400 building it's on the right hand side and it's down i would say in the deepest part of the berm and it was apartment on the back side if that makes a little bit of sense there um the only reason i remember i went with lori patino sanchez who was also one of our investigators she speaks spanish and there were spanish-speaking folks that lived there and the reason i remember is they had an automatic air freshener in there and i was standing too close to it and it spritzed me which seems like kind of a silly reason to remember that but really that was like the notable thing for me at that particular apartment that day um and the other time i definitely remember going there um i was actually with the sbi at that time doing some follow-up and it had started sleeting or snowing a little bit and i actually slid down the hill so again a notable occurrence [00:42:39] Speaker 4: of the 1400 building do you do you remember um the perspective if you're standing at the bottom of that berm next to the 1400 building what it looks like to look at the parking lot at like what level is the [00:42:56] Speaker 12: parking lot if you're standing at the bottom of that berm so it's a little bit on the right hand side of the building it's a steeper drop off there's stairs on that side and i believe there's stairs in another section as well closer to the middle of the building but it's definitely steeper on that side and if you stand at the bottom of the berm the view would vary along there but it's deeper and so it's almost like your like eye level with the parking lot because it's such a such a hill there and the [00:43:30] Speaker 4: area to be clear that you're talking about where it's deeper uh is next to where the picnic table and the grill were located yes on the right side of that bill yes okay the captain was part of the dna [00:43:42] Speaker 1: hunt to find the killer gathering dna samples within a two-year period from 300 men it was male dna that was [00:43:51] Speaker 12: present how did you go about looking for that person so that was a big task um that it was became a massive undertaking for us um like i mentioned earlier with an investigation you generally start with those tight circles around the victim faith was very much full of life very likable she was super involved in so many things which made it's great for her and it was a very huge challenge for us um we looked at her phone contacts who she'd been texting who she had seen recent recently who she interacted with at the thrill nightclub the night before um she was involved with the carolina indian circle on campus she was taking classes that semester she worked at red robin and so we explored men in all of those places um including people that lived at the apartment complex or would have lived there at the time of this crime while [00:44:53] Speaker 1: captain brett was on the case the killer was never found she moved on with her career and chapel hill continued the dna search now in cross-examination the defense asked about a person named joy barker joy barker a neighbor to faith in karina's apartments who said that uh noises and loud thumping sounds were [00:45:17] Speaker 12: heard my recollection is is that miss joy reported hearing noises from upstairs um early in in the early [00:45:27] Speaker 5: hours of that morning so noises from upstairs in the early hours did you follow up on that to figure out what kind of noise is and what time frame [00:45:47] Speaker 12: there were several people that talked to joy and interviewed her so i don't know that it was me specifically but i know sergeant matthews did um and i believe investigator bosselman spoke to her [00:45:59] Speaker 5: as well i mean the reason i'm asking is you you talked about getting information that will you know focus in investigation one way or the other correct yes so downstairs neighbor reporting hearing noises in early morning hours that'd be something that you would want to consider in an investigation like this wouldn't you yes so knowing her written statement and what she i guess wrote as close in time as possible to when she says she heard those noises that'd be something that you would also want to consider you know the close proximity of what she's writing in relation to when she says that she heard it you'll have to repeat that question i'm not sure where you're asking i'll do it way better because there was a terrible question somebody writes a statement six months later time's passed right but if somebody writes a statement the morning of they say they heard something it's a closer in time the memory hasn't had time to be affected by things like the media right yes do you want to get statements from people as soon as possible while their memories are still fresh correct yes so somebody like downstairs neighbor reporting hearing noises the earlier you get a statement from that person the better correct yes now this testimony went right up until about [00:47:16] Speaker 1: five o'clock eastern and then it was time to break for the day so captain brett will return to the jury stand tomorrow so the case is progressing curious to note your thoughts about where you think it's going and where you think the defense will go with this i'm curious if they call him to the stand very hard to beat dna as we talked about with grace but perhaps perhaps there's there's something um we'll just have to wait and see before we go tonight i want to tell you about nicole irene anderson she's 56 well it was 56 at the time she vanished from her home in randolph minnesota it happened around 8 54
