together like at the end of the [33:09] night she she basically told you that she had to use the meds it was earlier in the day it was before [33:16] the wedding but yeah okay and do you recall how to your observation how dedicated was she [33:27] to taking her medications as instructed by the numerous doctors that she ultimately saw she always [33:34] took them as instructed do you remember did she in fact have a diary that she kept of the milligrams [33:50] the type of medication the date that she took the medication what if any reactions that she had to [33:58] it do you recall that yeah and do you remember where that was kept did she keep it in any particular [34:04] place i think she kept in the kitchen in the kitchen so i'm going to show you a photograph that [34:11] the state [38:42] referral i think she just said this is a specialist that you might want to talk with all right and did [38:48] she go to see the specialist yeah and did you go with her or was this a no i never met her [38:53] should talk myself up with these like in-person meetings or are they like um what do you call [38:58] them zoom meetings and most of the meetings were zoom the only in person that i'm aware of was with [39:04] rebecca gelata rebecca gelata okay and that was because you insisted on it right i i thought it was [39:11] warranted at that time yeah right because you were pretty much at your wits end with the with the 15 [39:16] minute zooms and you wanted to sit down eyeball to eyeball and talk to this person right i hadn't [39:22] attended any prior to that i just um i just wanted to get clarification i wanted to get see if we could [39:28] get on the same page all right so now lindsay's on zoloft from dr tuss the psychiatrist correct correct [39:38] and then that runs into when when you guys she goes to see nurse paul can you clarify what was it [39:50] can you clarify what you're asking yeah what month when when was it that she saw um maybe october but [39:56] i'm not sure okay when she saw nurse paul do you remember where she saw nurse paul or was it a video [40:02] thing i don't know i wasn't involved okay did nurse paul prescribe medication to her a lot if he knows [40:14] uh i don't know off the top of my head right um do you recall whether or not to your opinion [40:20] that she had any reactions to the zoloft that she had been placed on by dr um tufts i don't know any [40:28] observations that were made right so it's not guesswork it's observations anything you saw and observed [40:36] yeah it seemed to align with her uh insomnia symptoms now the insomnia inability to sleep was that a [40:44] significant problem from your observations with her yeah it was a huge problem and when you say [40:50] a huge problem uh was there one point when she was on medication from tufts that in fact she had [40:55] gone 48 hours i think without sleep yeah and that was disturbing to her yeah and it was just hard to [41:02] function and how about you was it disturbing to you i just wanted her to get sleep and feel better now [41:09] during that period of time she then went and saw the next doctor or nurse practitioner which we talked [41:15] about which would be uh nurse practitioner paul at south shore right right now after seeing dr nurse [41:22] practitioner paul if you remember or no did you observe did she seem to get better or did she seem [41:29] to get worse it would be hard to say it was i think it was a week at most so um it's really hard to say [41:39] in that shorter time frame sure and when you say a week at most you mean that that's like she was [41:44] seeing nurse practitioner paul for about a week yeah and i mean she may have only seen her once it [41:51] was very brief and then she got reassigned somewhere so and the reason that if you know that she got [41:56] reassigned somewhere would be doctor nurse practitioner gelada right right same practice right right and the [42:05] reason was because paul moved on to another job right right so lindsay wasn't out doctor hunting she was [42:13] referred by the nurse practitioner that was referred to you guys by your mom because paul was leaving [42:21] right yeah she just switched doctors in the same practice all right now she sees dr gelada right [42:28] right did dr gelada to your knowledge put her on medication yeah and what was the medication if you [42:36] know uh mainly seroquel and um benzodiazepines ativan no benzodiazepines um they're addictive right [42:50] apparently objection um and and a benzo would be for example ativan correct correct now um seroquel [43:04] she was placed on seroquel as well is that correct right and to your observation again you're not a doctor [43:10] what you saw of your wife was she affected positively or negatively by the seroquel that she was on it [43:20] appeared that she was affected very negatively and she's reporting that it um that she was getting [43:26] worse on the seroquel and do you know did she report that to dr gelada yeah um when she would consult [43:36] with dr gelada prior to you actually going do you know were they all on video if you know yeah they're all [43:45] on zoom okay do you have any opinion for the jury as to approximately how long these meetings on zoom [43:51] would be with the nurse practitioner probably around 20 minutes um at some point do you recall that [43:59] you went with lindsay to see dr gelada is that right yes and do you remember if you remember when [44:07] that was early december in early december of 2022 can you tell the jury from your observations [44:16] how did lindsay appear how was she acting how was she faring she was extremely sleep deprived and um [44:25] just highly anxious was there a number of occasions that you would actually see her [44:33] on the sofa rocking back and forth with her head under a pillow yeah did you report that and other [44:39] symptoms to dr gelada lindsay did so when was it if you recall that you went and saw dr gelada with your [44:48] wife person to person when was it yep early december i think it was december 6th and do you remember [44:58] you have a pretty good memory about this do you remember what medication she was prescribed by gelada [45:04] coming out of that meeting yep um yeah she uh increased the seroquel significantly um and then i uh then she [45:15] prescribed her valium to help taper off of the benzos taper off the benzos yeah um to your knowledge [45:23] did lindsay go to doctors to seek out benzodiazepines or drugs just because she was a drug addict no no [45:33] lindsay i think wanted to um she definitely didn't want to take any more benzodiazepines and definitely [45:40] didn't want to take any more seroquel i think that it wasn't really a matter of trying to get off the [45:45] medication it was just trying to get on the right medication okay um let's say mid-december what [45:52] observations if any heading up towards christmas did you guys uh endure um she seemed to get worse [46:02] um the seroquel was increased to 400 milligrams 400 yeah and dr gelada yeah and the idea behind that [46:11] was it would help with sleep um but she didn't get better she she got worse do you recall that at one [46:21] point she went to a place called women's and uh infants yeah in rhode island right women and [46:31] infant center for women's behavioral health do you recall that right do you remember when she actually [46:38] went to women's behavioral health uh sometime in mid-december i don't know the exact date all right [46:45] so if i suggest to you sir that i have certified copies of the women and infants medical records [46:51] uh indicating that on december 20th of 2022 uh that was the day that you dropped her off at [46:58] women does that refresh your memory yeah your honor i'd like to offer the certified copies of the women [47:03] and infants hospital records i would object we don't have a copy of those you don't have any could i see [47:23] so mr clancy do you remember that day december 20th of 2022 that she went to that place how did she [47:31] get there i drove her and do you remember dropping her off yeah do you remember what her state of mind [47:37] was to go there was she scared was she happy was she i think she was scared do you remember what you [47:45] did that day i took dawson skiing and where did you go skiing what she said um at some point in the [47:53] afternoon did you receive a phone call yeah was it from lindsay yeah and as a result of the phone call [47:59] what did you do um she said that you need to come pick me up and um the doctors here want to um talk [48:08] to you have you come in and talk for a bit okay did you go and talk to them yeah do you remember who [48:13] you talked to i don't remember their names do you remember the conversation did you describe or [48:19] indicate what her symptoms were at that point in december 20th of 2022 yeah the conversation was um they [48:26] didn't objection uh sustained at this time um did the people at uh women's and infants [48:38] facility in rhode island prescribe any medication to your knowledge i don't think so they provide [48:44] any counseling or anything i think they tried to um but they felt that it wasn't the right fit for [48:51] lindsay recall uh the fact sustained recall whether or not let's have reached out to dr gelata i don't [49:11] think so if he knows i don't think they did no and was it one day or half a day that she went to [49:20] women and infants in rhode island it was a half a day half a day so after you pick her up and you [49:27] bring her home it's now you and the kids and lindsay and it's days before christmas right yeah and [49:36] her parents were there why were her parents there uh they were visiting trying to help out and i took [49:45] dawson to watch she said so they stayed home with cora and kellen now during that time frame in [49:50] december of 22 maybe a little bit before maybe after thanksgiving did your mom and dad and lindsay's [49:59] parents comments to your house and try to help out with the kids uh yeah i think it was separately though [50:07] yeah of course it would be separate i mean what would that what would they do just be there help out [50:14] um play with them um to get take out play scrabble uh did lindsay's mother and father actually stay [50:24] there and sleep in the basement for they did yeah time were you aware personally back up you and lindsay [50:32] as husband and wife would would in effect sleep in the same bedroom is that correct yeah it was an [50:38] occasion though that she said to you about you go downstairs and then i think she ended up downstairs [50:44] yeah for the purposes of her getting better sleep and for her purposes of getting better sleep [50:51] were you aware that on one occasion she used a gummy a sleep aid gummy did you know that i don't recall [51:01] that but we did have them in the house okay now to your knowledge was lindsay a person that liked to [51:07] smoke the weed and use the cbds oils and all that stuff or did she not invite them i don't know she didn't [51:15] smoke so you had these gummies in the house sleep aid right i mean some people might call them a sleep [51:24] aid okay um heading into the holidays of 22 do you recall where you spent christmas um i think it was [51:39] at our house we celebrated cora's birthday um and then i think we actually went down to wallingford [51:46] connecticut to be with her parents after her parents yeah okay um and then heading into january [51:55] of 23 who did she then see for doctors or nurse practitioners if you know after she got back [52:05] from mclean yes she switched back to jennifer tufts now before she switches back to tufts in january [52:14] on new year's of 2022 2023 you guys drive to boston go to mgh and ultimately she turns herself into [52:28] mclean hospital right right now mclean hospital is basically a locked ward facility correct correct [52:36] was she allowed to just wander around and leave the place whenever she wanted she couldn't leave [52:41] but she inside she could go to different areas can you tell the jury what her state of mind was as [52:47] she went to mclean hospital with her husband on new year's 23 at that point um she was scared she [52:54] didn't want to go but i think it was um the second time we went to the er and um i said you have to go [53:02] now at mclean hospital i know you you visited with her is that correct yeah uh district attorney [53:09] asked you yesterday about the excellent care that she was provided with all these counselors and [53:13] therapists and you indicated that it was your understanding that she was playing with clay [53:18] and coloring right right can you describe for the jury what mclean was like to you [53:23] as a husband visiting his wife in other words were there doctors were there nurses were there people [53:28] in the hallways um what i saw was uh it looked like mainly nurses it was um the tail end of covid so [53:36] they're mostly behind this plastic covered area and um it could have been the just the time of day that [53:45] i visited but um people were hanging around watching tv playing with clay um do you know whether or not [53:54] she saw a doctor psychiatrist ultimately from mclean hospital i was not aware of that the only one i was [54:03] aware of it was the doctor on the second last or final day and what was that dr goodhart yeah and did [54:12] you speak to dr goodhart i ended up calling her um i wanted to see what her evaluation was [54:21] um and um so i gave her a call and we we spoke and um she said you know she's she's clearly [54:31] depressed sustained okay um so you you spoke to dr goodhart uh did dr goodhart to your knowledge [54:41] prescribe any medication i think she recommended medication and then how many medications did she [54:48] recommend i i don't know if she recommended multiple i i want to say it was cymbalta um but she said you [54:58] know check with your doctor and make a decision so when lindsay left it was because she wanted to [55:05] leave one day early because of cora's birthday is that right i didn't think it was i i don't think [55:11] it was one day early i think she had a five day stay which at the time was my understanding was that [55:16] was pretty standard and um yeah she did want to attend cora's birthday so there's no doubt sir in your [55:24] mind that when she was discharged from mclean that you got these right mclean yes that when she was [55:31] discharged from mclean hospital it was not against medical advice the doctors gave her right any [55:42] objection no they may be admitted now you know when you go to the hospital and you get out of the [55:53] hospital they give you a bag and you've got medications and a little card and says thank you [55:58] for being here stuff like that did you guys get anything from mclean at all i don't think so did you get any [56:03] recommendations other than the doctor suggesting that you might want to try cymbalta they give you [56:09] a script i don't think so you know what cymbalta was no you remember dr goodhart telling lindsay to [56:17] google it uh i think that's accurate yeah in fact she googled hundreds of times yeah medication right yeah [56:28] so when you guys go home and now it's january obviously um you had the party for cora correct [56:37] yeah you guys had friends over or guys friends that you guys knew friends came to the party which was [56:44] at a um place in plymouth would you agree with me that lindsay uh had a number of friends from [56:51] actually grammar school through high school through college that she stayed in touch with over the years [56:56] yeah and you as well yep um and they're good friends like you still would see them and you guys would [57:03] do dinner and things of that nature right yeah actually one of your friends i think it was one of your [57:07] friends it might have been one of her friends actually named her in january around that time [57:12] frame to be god uh mother i would take care of their child if anything bad happened to them and they [57:19] were they were dead right remember that i my brain has been foggy for the last couple years but i understand [57:27] yeah okay um in january as time went by do you recall that she would actually continue to take [57:41] notes of her medications that she was taking right that sounds like something lindsay would do [57:47] get the diary or a little log right yep we're approaching you sir with this and asking if you [57:52] can identify yes when you say yes and i put a screen what is it it's um the dosage of medication [58:12] that she took and how she's feeling so this is kind of like a little medical diary that she was keeping [58:19] yeah for example you know here you see on that five milligrams valley and 200 seracole slept well [58:25] horrible thoughts in the morning right yeah and did she at some point uh i think the da had asked you [58:32] i'm going to offer this if i may any objection no that may be admitted there was an occasion where she told you [58:53] in the presence of her mother that she was having horrible thoughts right right and you told us about that [59:00] yesterday um and that took it was quite an emotional thing for her to do that right right after that [59:09] time frame um you continued on you you were working in the basement right yeah i shouldn't say basement it [59:17] was a finished place right basement yeah and that was where you worked on a regular basis is that right [59:26] yeah would that be a 40 hour week or longer it varied but yeah roughly 40 hours and i know it was [59:33] maybe covert tail end of cobra but one of the other reasons that you did that was so you could be home [59:38] and help out is that right yeah i i worked from home since 2018 okay um but yeah i built an office down [59:45] there so you were always there yeah not always but you were down there when you would work when i wasn't [59:51] traveling yeah i was there okay so when would you travel tell us about that uh i really didn't travel [59:58] actually um much during cove but just towards the end and once in november november of what year 2022 [1:00:06] november of 2022 but before that i traveled extensively let's look at november of 2022 [1:00:13] november of 2022 is a month before she was having thoughts about her children right right november of [1:00:23] 2022 and you traveled where did you travel to new york and how long were you there sir um two nights and [1:00:33] and who took care of the kids uh lindsey lindsey took care of the kids so for two days two nights a [1:00:49] month and a week or so before she killed the children she was home with the kids for two days [1:00:58] is that right right fair to say that you also had your friends that you would do brunch with [1:01:04] on occasion sundays or weeknights or whenever guys guys night type thing yeah and you'd be out with your [1:01:10] friends if she wanted to kill the kids she certainly could have done at that time when you're out right [1:01:15] in theory as opposed to sending you on a three-minute trip to cvs and a nine-minute trip to a restaurant [1:01:24] you were away for two days in november and on a number of occasions for brunch as well as skiing [1:01:29] right you're a pretty active guy yeah i'm going to approach you sir and another one of the books that [1:01:39] was in the kitchen cabinet i remember i i don't think so that she had a number of books called [1:01:59] parenting and things like that and this one here was pregnancy and postpartum anxiety workbook [1:02:11] um did she have workbooks that you were aware of or work diagrams and things like that uh she had books [1:02:21] of different sorts um you can't identify this as being in the kitchen i don't recall seeing that book [1:02:32] now yeah sure thank you by the way um i'll approach you sir with this document um it says postpartum [1:03:07] depression and anxiety patient information sheet and if you go towards the end there there's [1:03:12] i'm scared to be writing all right that may be admitted sir looking at this uh item it's got a bunch [1:04:00] of flowers on the front um appears to be a notebook so your understanding that the state police went in [1:04:07] your house and they seized all sorts of items such as this yeah so we don't have originals that the [1:04:13] police do but these are very inaccurate yeah is that the caption that you were referring to yes [1:04:23] postpartum depression and anxiety yes and at the end of this particular document you would agree sir that [1:04:33] it has writing yeah and whose writing is that lindsey's and is this like a book or notes that she would take [1:04:43] documenting on a daily basis any effect that she had from postpartum it appears to be a case yeah [1:04:52] but after the uh records of dr jennifer tufts ask the mental health records all right that may be they [1:05:19] may be admitted i'm gonna have to i think um maybe uh talk to the da about this because i do have a lot [1:05:26] of tabs and notes in this one i know we have this clean copy we have a clean copy we're planning to admit [1:05:31] so good okay so we'll enter that and then before we can then substitute it with a clean copy can i see [1:05:48] the exhibit for the things that you had identified yesterday was the document that you obtained from [1:06:06] cbs is that correct yes it sets forth all of the medications that were purchased by lindsey by [1:06:14] prescription from the physicians that she had seen during that period of time correct correct and [1:06:21] indicated yesterday that the police had seized a number of pill bottles and then you also had a [1:06:33] number of pill bottles is that right right and the pill bottles that you had oh what are the [1:06:44] circumstances that you had them in a bag in your car uh the reason i had them in a bag is because [1:06:50] sometimes a provider would adjust medications so for example i do remember um lindsey had a [1:07:00] prescription of ativan and then a few days later they wanted to increase the dosage because it wasn't [1:07:06] effective so what they would do is they would say give that old prescription to your husband he'll [1:07:13] discard it and then continue taking from the new prescription the da yesterday went through scripts and [1:07:22] there were pills over 30 count but then 27 and three were gone but that's because she wasn't [1:07:28] taking her medication that's that's not the case it was what you were told to do right correct yeah [1:07:33] without that context um it um it paints a different picture um exhibit two would be the pills that you [1:07:45] had turned in correct right i remember it's it's exhibit two though okay wednesday january 24th um the [1:08:01] troopers uh located four medication bottles and at some point the 26th at about 2 30 in the afternoon [1:08:09] bottles were then uh documented by the police when was it if you know that you turned these items into [1:08:15] the police um i believe it was it was after the event i don't remember the exact date but i remember i [1:08:24] um i told them i do have other prescriptions in my truck still and i gave them to them okay so the [1:08:31] police already went in with a search warrant they already seized all the drugs that they could find [1:08:36] in the house in the kitchen in the bedroom with their drugs in the kitchen by the way yeah yeah they're [1:08:41] all over the place right yeah and they seized that right yeah and then you to be cooperative told the [1:08:50] police that you also had pills in your car and you went to the da's office and getting to attorney sprague [1:08:56] in the in the state police right right but to be clear those were discontinued prescriptions these [1:09:01] are the ones like that she stopped correct all right and then you had new prescriptions so there [1:09:06] were new prescriptions yes now when i met with you in the house long after the state police had gone [1:09:14] and finished their search yeah you recall that we went up to the bedroom and i removed this from [1:09:21] the nightstand right next to the bed yeah can you tell us what that is what is this is it is it [1:09:27] that's the drawer that goes into the nightstand and inside the drawer sir do you recall that there [1:09:34] were a number of items described as creatine we had a pain in the summer 20th yeah shot down [1:10:09] lemonade or water wound up these pills right lindsey clancy december 16th 22. mertazapine [1:10:27] described to lindsey clancy january those are in this drawer and they were all empty right right there's [1:10:41] something else that was in the drug you recognize that yeah what is it it's her apple watch her [1:10:46] apple watch this is the apple watch that apparently police use that is downstairs heartbreak yeah [1:10:54] apparently it's a face mask for sleeping sleep yeah now you had mentioned something i think about [1:11:16] low spray uh she bought some pillow spray apparently helps you sleep yeah yeah she did i think there's a [1:11:46] there's a watch on the side there no objection okay do you want to you put you want to put that in [1:12:00] as one exhibit okay to the apple watch sir how many apple watches just one just one it's the only one [1:12:15] she had please never see correct the drugs that were in the drug the empty drugs and the pill bottles [1:12:23] from january and december 22 23 the police never seized it no sir it's like a green face you've ever seen [1:12:41] that before yeah we'll tell the jury what it is objection we could go to yeah can i see council [1:12:48] sidebar please to your knowledge sir was she advised by nurse nurse practitioner toughs to keep a [1:13:12] nighttime dump of thoughts and write them down so that she had something that she could refer to [1:13:19] not that i'm aware of you ever see her writing notes in a diary or like a thing with dates on it [1:13:27] november 23rd for example things of that nature i knew she kept notes but i i didn't see her doing [1:13:33] it this document yeah does that contain yeah just take a look yeah call okay that may be admitted [1:14:28] it appears to be a document uh do you recognize her handwriting that document with dates september 29 for [1:14:35] example 22. yes and is that if you can tell us what that appears to be sir if you know uh looks like a [1:14:45] schedule for calen and the schedule for calen that would be sleeping or something like that yeah and [1:14:54] naps yeah so for example where it says september 29 22 and then it makes reference to calen last fed [1:15:05] with a time frame and then there's a bunch of pages like that that go forward on those dates is that what [1:15:10] that is yeah put them down for a nap 9 35 with a smiley face things like that right right is this typical [1:15:17] for lindsay that she would document these things as a new mother yeah was she being controlling in your [1:15:24] opinion of her child and of you by doing this schedule no i found it helpful any objection that may be [1:15:34] admitted one of the things sir that the district attorney had asked you about is the uh exhibits of [1:15:47] the i think it was the uh the window um in the bedroom you said it was 20 feet drop to the ground right [1:15:55] is that right um this is a photograph of the same one you already introduced but i installed so this [1:16:04] is the photograph of the house you can identify that right yeah that's the um living room window the [1:16:15] window that you're talking about that's 20 feet up would be on the very top of that picture correct [1:16:22] correct identified this picture you see that there's some kind of an orange ball appears to be an orange [1:16:47] ball underneath the silt yeah it appears to be red marks or red spots like possibly blood above it [1:16:56] yep can you tell the jurors what that little orange ball is uh yeah we had a um a woodpecker who would [1:17:03] peck at the house and create holes that's why i've paired some of the other sections too and i took some [1:17:09] foam and fill the hole i'd offer that your honor just uh that may be admitted and that also if i may [1:17:24] just uh the top picture is also see where it looks like fingerprints or blood on the uh edge of the [1:17:33] window coming from the surface pro but your testimony was that it could [1:19:12] have come from your iphone correct correct and in fact you watched footage earlier of yourself going [1:19:18] into the cvs in kingston at 5 32 pm correct correct and you had your phone with you correct because you used [1:19:25] it and we also saw you on the 3v footage using your phone as well correct right um so this you were [1:19:33] clearly out of the house at 5 24 pm correct um sorry what time did you say i was at cvs so so you walked [1:19:42] in at 5 32 pm correct correct and you left the house as you were leaving the house lindsay sent you the text [1:19:51] about pdlx correct uh i i don't know if i had left the house yet but um yeah but that was sent at 5 15 [1:19:59] pm correct right and how far away is the king to kingston cvs three minutes okay and so um you leave [1:20:08] the house you get into your car and you drive to cvs correct correct and so that should have taken three [1:20:14] minutes correct yep so after the text that was sent at 5 15 pm that would have been sometime around [1:20:20] 5 18 or 5 20 pm that you should have arrived at cvs correct right but you don't go in until 5 32 pm [1:20:28] correct i i don't know i don't know what time i pulled in the parking lot i'm not asking what time [1:20:36] you pulled into the parking lot but it is is it fair to say that the video that you were shown earlier [1:20:40] shows you entering the store at 5 32 pm yes so from the time you should have been at the parking lot of [1:20:47] cvs around 5 20 pm until 5 32 pm could you have been in your car sending this email on your iphone [1:20:55] yeah i just don't know if i pulled into the parking lot at 5 20. but sometime after the text was sent [1:21:01] from lindsay about pdlx but before 5 32 pm you were in your car correct okay um now you were asked about [1:21:14] um my questions to you about going uh to boston um and and my questions to you were about december [1:21:23] 3rd not december 2nd correct correct because your anniversary is december 3rd not december 2nd correct [1:21:28] right so dawson was taken to the doctors on december 2nd correct correct and on december 3rd did you have [1:21:36] plans not that they were followed through but did you have plans to go to boston that day yeah so i can [1:21:41] provide some clarification on that sure um so yeah on monday i was a um a little bit confused by it [1:21:49] because we were home um but yeah i think there was a plan prior to that uh like an anniversary plan [1:21:56] to go to boston um but it was canceled okay and the picture you showed was from september so the the [1:22:04] plans that you had to go to boston um showing you here text messages between yourself and lindsay [1:22:19] here there's one here um that says this is booked but you're on the wait list as a backup i have you [1:22:26] booked for massage at the nearby ihg for 90 minutes at 145 is that correct yeah and then you later say we [1:22:36] can get lunch and then head over she responds okay and then you write that they'll let you use the gym [1:22:45] and the pool while she's getting her massage is that correct right and then you talk about plans [1:22:53] for lunch and dinner um and so there were the plans they just fell through right yeah we canceled them [1:23:00] yeah so it's not as if i made that up out of thin air that's here in the text messages correct right [1:23:06] yeah it was it was just confusing uh because we were home but uh but yeah when i left i uh recollected [1:23:12] that and then i found the picture and the picture was from september and was that from the wedding [1:23:16] you went to yeah any objection that may be admitted now in cross-examination you you said that lindsay [1:23:34] always took the medications exactly as instructed um but indirect you said you you weren't always with [1:23:40] her every time she took the pills is that correct that's correct but the understanding was that she [1:23:45] took it as directed because she told you she did uh yeah and because you trusted her to do so yeah [1:23:51] okay but you can't sit here and say definitively that she took every pill exactly as instructed [1:23:58] every single time because you didn't watch her every time correct i was not standing next to her [1:24:03] every time she took pills and you were asked about the uh the facebook search in august august 23rd 2022 [1:24:11] um and you were you were asked about being on the surface pro and looking up the country singer who [1:24:19] had killed himself is that right right okay so um i think that um what you what you said when you were [1:24:32] asked by um by defense counsel about whether or not you accidentally went to this site on methods of [1:24:41] suicide you said that could be likely that might have happened you're not sure correct it's yeah it's so [1:24:48] subtle that i i don't remember specifically but i do remember listening to tom t hall how often did you [1:24:54] listen to him it was like for a week okay and so were you aware that on a 8 23 um august 23rd 2022 [1:25:03] at 9 40 a.m someone signed into lindsay's facebook account on the surface pro uh no and then at 9 43 p.m [1:25:14] is when the tom hall site was accessed do you recall that yeah and at 9 45 a.m is when a person not just [1:25:23] hit a link by accident but actually had to click on a link to go to suicide methods are you aware of [1:25:28] that no okay um is there any reason why you would have been going in and logging on to lindsay's [1:25:35] facebook account while going on wikipedia and and looking at suicide methods all in that same five [1:25:41] minutes um i didn't use i didn't log into uh lindsay's facebook ever um it's very possible that i [1:25:51] looked at tom hall's wikipedia page but at some point yeah do you remember spending three minutes [1:26:00] on the methods of suicide site scrolling through and reading the methods of suicide site for three [1:26:06] minutes no i don't remember something i did for three minutes almost four years ago do you remember [1:26:13] being on that site the methods of suicide and clicking on a link to a bridge in australia that [1:26:20] people use to commit suicide no no so in this five minutes or so where someone's using the surface pro [1:26:29] using lindsay's facebook while doing that and then clicking on these links you don't remember [1:26:35] you think it might have been you i have no idea now you talked about lindsay's stay at mclean hospital [1:26:46] um you said that um that it was a locked ward she had to stay there is that correct correct but it was [1:26:54] a voluntary commitment wasn't it uh yeah you didn't file any um legal paperwork to have her committed [1:27:02] correct correct there was no court order making her stay there correct correct so she wanted to leave [1:27:09] and express to the doctors that she wanted to leave and they didn't believe she was a danger to herself [1:27:13] or others she could leave correct uh to be honest i don't know okay now um you stated on direct [1:27:23] examination that you visited her two times um during the time that she was there at mclean right [1:27:29] at least twice yeah and you said those were in the evening hours is that correct yeah afternoon and [1:27:34] evening afternoon and evening so you weren't there during um the morning and early afternoon hours when [1:27:39] they were offering these group therapies and when she was meeting with other practitioners i wasn't [1:27:46] there in the morning and were you there during the um when the staff was checking on her every 15 minutes [1:27:52] uh no but she did tell me about that okay and were you aware that she was evaluated several times and [1:27:58] at first she had to stay on the unit but then eventually based on what she was telling them she [1:28:03] was allowed to to go on the grounds with staff i was aware that she went on at least i think at least [1:28:09] one walk and so people were seeing her and interacting with her in in changing um the way her stay went [1:28:18] at mclean hospital throughout her stay yeah and you talked about dr goodhart recommending medications um [1:28:28] what was the medication that you you said that she um recommended i thought it was cymbalta [1:28:34] um but i think she ended up taking amitriptyline here at the um cvs records that you provided you see [1:29:00] see here yep you thought that dr goodhart had just recommended medication when it was actually a [1:29:25] prescription that was given by dr goodhart correct right but i believe so there's another one as well [1:29:31] lorazepam i believe those were prescribed while she was staying there and so they were filled at cvs [1:29:39] and sent to mclean uh possibly i i remember there was an issue where she didn't have her medications [1:29:48] when she went to mclean so she needed them to be brought there she was discharged on january 5th correct [1:29:54] right um are you aware that this document from cvs says that the uh prescription for trazodone 50 [1:30:00] milligrams prescribed by dr alia goodhart was filled on january 5th 2023 right okay and then the other [1:30:08] prescription by dr goodhart the lorazepam was also one milligram lorazepam was also filled on january 5th [1:30:17] 2023 correct yeah so that's when she was discharged not while she was staying there correct right that's [1:30:24] correct so doctor uh for lindsay trazodone and ativan and not cymbalta correct she recommended [1:30:35] cymbalta but she didn't actually she wasn't the one who prescribed that and in fact no one prescribed [1:30:40] that correct because it ended up switching to amitriptyline and the amitriptyline was prescribed by [1:30:48] dr jennifer tufts correct right and that and dr uh tufts prescribed five milligrams of diazepam [1:31:10] on january 9th 2023 right and triply on january 6 10 milligrams of amitriptyline and that was prescribed [1:31:24] when lindsay said she was um having some issues um with depression correct correct okay so she went [1:31:32] to mclean hospital and she was weaned off the serequil correct i believe so yeah and all the medications [1:31:39] that she had taken prior to going to mclean she was no longer on those were gone correct [1:31:45] once she had been in mclean um i don't know if it was i'm not sure i'm not i don't know if it was all [1:31:49] of them well are you are you did you have conversations with your wife about what she was taking maybe were [1:31:57] you aware that she was only on track only prescribed trazodone and ativan when she left mclean and then [1:32:04] amitriptyline was only added on the 16th so just those three medications yeah but i i think i [1:32:10] thought she was taking trazodone before mclean right so she had been prescribed it before and [1:32:16] stopped taking it correct i don't remember i'd have to look back on records so you're not sure [1:32:22] about what she was taking and when are you not the exact dates but i remember she was taking trazodone [1:32:28] and uh i thought she was taking it before mclean so the best resource of um what she was prescribed and [1:32:35] when would most likely be the doctors and the cvs records then correct the cvs records is a good resource [1:32:41] and um you talked about the pills and how these were pills that she was no longer on so it wasn't [1:32:54] really a good record what she had taken correct correct but she was only prescribed zoloft once [1:33:01] right at the very beginning right and she only took seven of those pills correct right so it wasn't as [1:33:08] if she um was prescribed a higher dose or a different dose of zoloft and was still taking that and so that [1:33:16] seven pills misrepresents the zoloft she took right i believe she switched because uh or she stopped [1:33:23] because she was switched to prozac okay and then even going forward the prozac there weren't many [1:33:29] pills taken out of that either correct yeah eventually she stopped that as well okay so she'd take a few [1:33:34] pills she'd have some side effects they'd switch the medication correct yes and so they were trying to [1:33:40] figure out what would work for her correct yeah okay and then she ends up at mclean because she [1:33:47] she's having difficulties according to her with the seroquel correct that was part of it yeah and they [1:33:52] wean her off of that right yep and then after mclean she's only on the trazodone the ativan and then [1:34:01] on the 16th adding in the amitriptyline correct right you mentioned um that you went to new york in [1:34:11] november of 2022 defense counsel said that was a month before the the children uh were killed but [1:34:17] that's actually two months before they were killed correct it was um yeah it was about a little more [1:34:23] than two months and she hadn't been on the seroquel yet right uh i i don't know exactly when she started [1:34:30] the seroquel would december sound right yeah or end of november yeah and so when you took your trip [1:34:39] to new york she was having some issues but she was doing okay wasn't she she was doing much better [1:34:46] than she was in december okay and you all did you also take another trip with cora in november yeah so [1:34:54] i did the trip to new york and as soon as i got back um went to bed and then the next morning left [1:34:59] with cora and was that november 4th through the 7th to san francisco yeah and where um who was taking [1:35:06] care of dawson and callan while you were in san francisco with cora lindsay and so during your [1:35:12] trip to new york and then immediately after your trip um to san francisco with core were there any [1:35:18] issues um or any problems or did anything happen while lindsay was caring for those kids uh nothing [1:35:25] bad happened she was um i would say her anxiety and depression was starting to tick up but uh yeah [1:35:32] obviously nothing bad happened okay and it's your testimony that things started to get worse in [1:35:39] december is that correct correct but it was also your testimony that after the stay at mclean things [1:35:45] got better wasn't it and she steadily progressed throughout january getting better right definitely [1:35:52] yeah and on january 24th 2023 you testified that that was one of her best days yeah you were asked [1:36:04] about the apple watch um the police didn't collect the apple watch right they did collect her phone [1:36:10] correct you identified it earlier right correct yeah um and her apple watch was linked to her phone was [1:36:16] it not it probably was yeah um you were also asked about the drop from the floor window um were you aware [1:36:28] that the measurement from the the windowsill to the ground was actually 12 feet i've never measured it but [1:36:34] yeah i believe what you're saying and one of the exhibits from defense council um it's the um exhibit 84 [1:37:04] um this was the um the packet here that defense council was going through with you um where um you [1:37:12] said this is lindsay writing kellen's schedule is that right right but this was also lindsay sending notes [1:37:19] back and forth between herself and elaine is that correct um possibly there's different writing [1:37:28] here correct if you want to look at it yeah it looks like it yeah and then down here there's a note [1:37:44] that's in different handwriting correct yeah i would say so are you aware that lindsay was using this [1:37:51] notebook to communicate back and forth with the nanny about calent's care um she she had different [1:37:57] notebooks she always had a notebook that she would uh resisting the bottle if it won't if he won't drink it after 45 minutes of [1:38:15] trying please text me to let me know put down for next nap one hour after he wakes try to put down drowsy [1:38:22] but awake but if he cries pick him up and rock bounce or hold him until sleep then put down he usually [1:38:28] sleeps 45 minutes but let him sleep as long as he wants those are very detailed notes that lindsay is [1:38:34] sending uh to the nanny correct yeah and then she also wrote if you have time washing cut up veggies [1:38:41] sweet potatoes one inch cubes peeled broccoli small pieces peppers one inch piece plastic ziploc bags to [1:38:48] put them in next bottle two and a half hours after the first bottle correct i believe what you're reading [1:38:55] yeah so very particular [1:39:36] um so again very specific times for for putting him down and when to get up and and uh very and [1:39:42] asking her to do additional work like laundry and things like that correct yeah again uh october 6 [1:39:54] 8 at 8 15 fell asleep at 8 40 changing tables now in the bathroom if he wakes before 9 40 give him 15 [1:40:01] minutes to settle himself back to sleep i'm hoping he will sleep till 10 15 if he is still asleep at 10 40 [1:40:06] wake him feeding at 11 a.m first try bottle he doesn't take it after 15 minutes make oatmeal [1:40:13] two tablespoons of oatmeal make thin with breast milk can heat for five to ten seconds again very specific [1:40:18] directions on what she wants done and how she wants calen cared for correct yeah and throughout this [1:40:24] notebook it's more of the same correct or have you even seen that i haven't seen it yeah i have nothing [1:40:39] further thank you which nanny was that uh that would have been uh elaine rossi and elaine rossi how long was [1:40:46] she the nanny for you guys a month or two yeah probably two months and then she just needed more [1:40:52] hours and and moved on and lindsey was home so yeah i yeah i think she preferred more hours we [1:40:59] couldn't really give it to her and uh lindsey was home anyway so and um as far as the uh records are [1:41:06] concerned it's fair to say that lindsey has a concerned mother would would give instructions to [1:41:10] people that would be taking care of her infant yeah i would have done the same [1:41:15] uh a lot of discussion about the these prescriptions and scripts from the different doctors and one of [1:41:21] the things you referenced was that you believe that she was on trazodone and if i suggest to you that [1:41:26] there was a doctor is that harayara cave on on november 16th of 22 that prescribed 50 milligrams of [1:41:36] trazodone while she was on buspirone and floxetane does that refresh your memory that in november she was [1:41:42] prescribed 50 grams of trazodone yeah i remember trazodone being um like a part of the medication [1:41:51] plan for a while and one of the things that you did as we talked about is you went to cbs and you got a [1:41:56] list of all the drugs right right and if i suggest you saw that this is just a an easy reference with [1:42:02] different colors for different doctors of exactly what the cbs provided does that appear to be fair and [1:42:08] accurate scripts yeah yeah can i see which one that is please no objection okay that may be admitted [1:42:17] that's all i have sir thank you okay
