behavior so you know within that one of our recommendations is to work together with other units of government to put pressure on the state extended producer responsibility treating waste through its entire lifecycle unfortunately cannot best be implemented at the county or local level it is best implemented at the state level and the more we can get other units of government to speak with one voice through your legislative priorities and efforts in Tallahassee we know that that there are more mechanisms that we can activate to build a more sustainable community thank you any other assistant city attorney Morgan here thank you thank you Ms. Beggarro tonight's opening remarks and pledge of allegiance will be provided by councilmember Fajan sir thank you council president Horland tonight I invited father John on a Cora Cora Cora from St. Gregory's to lead us in our invocation there is come on up father and then if we could stand for the prey and then the remain standing for the pledge thank you as we pray let us bow our heads in prayer and invoke the presence of Almighty God Almighty God we come before you at the beginning of this meeting to humbly invoke your presence and your love with us look with favor upon this council and upon all who serve this community enlighten our minds with truth steady our judgment with prudence and strengthen our resolve to seek what is right and just send down we pray the grace of your divine providence upon every discussion every decision and every action taken here today may you guide us through your divine will and guide this assembly toward unity integrity and the common good watch over the city of plantation with all its members guard it in peace sustain it in justice and bless it with prosperity that serves all we ask this through Christ our Lord amen allegiance to the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice for all thank you that's all okay thank you councilmember Fadgen all right items submitted by the mayor first up we have an annual review of the city's investment portfolio results all right that's a mouthful you got that Anna yeah okay good good evening mayor council president council members I have with me tonight PFM representative Leslie Webber and she's going to do the overview of the city's portfolio of investments thank you good evening so first I'll start off with making a few remarks about the economy in the marketplace just to set a backdrop and then I'll give a portfolio update and talk a bit about the performance but I would say the first two key things if we think about the US economy as a whole I would still say it's still resilient but it is slowing actually let me get to some of the themes here this is a little bit still dated by the time we send it over so I'll try to speak more to what's been happening recently and then I would say also as it relates to yields there has been higher his higher yields historically so that is creating attractive income for the overall portfolio that we are managing for you so I did mention that economic growth remains positive but it is a little slower if we think about GDP or gross domestic product that's a good health gauge of the overall US economy and it's forecasted to be around two to two and a half percent for the rest of 2026 now historically GDP has been two-thirds of consumer spending or consumer spending so that really has been supporting this growth overall and also business investment and I would say at the moment geopolitics is really taking a front seat the market is really focused on that in the US macro fundamentals is kind of being overshadowed but in the backdrop the economy is still pretty strong and still resilient overall on chairman Powell did state if we did have a long period of much higher gas prices on that it could potentially weigh on consumption overall however again the economy is pretty solid it in the background but the question that the biggest question is how long will this conflict last I'm typically if it's a short oil shock it's quickly absorbed but the longer the longer the duration the inflation risk is there and also that creates a lot of uncertainty with the overall economy and therefore that also causes a lot of yield ball to yield volatility that we've been seeing but that's opportunistic for the portfolio that we are actively managing for you so with the Fed still mandate of keeping inflation low their targets around two percent and maximum employment starting off with the labor market the labor market is cooling and it's still relatively healthy if we think about how many jobs we added in March it's about a hundred and seventy eight thousand or so and that unemployment number is staying steady around four point three four point four percent the reason why that unemployment number is staying steady it's just there's been that shift in immigration retirements and also to get to that break-even level we need less jobs now going forward now with inflation on the left-hand side you see that was for February but what we got in March the CPI or consumer price index this is more the headline inflation that we're seeing came in at three point three percent year over year and that's given the energy spikes that we have seen but if we take out those volatile components of CPI food energy that core CPI is around two point six percent and that it's been hovering around that for quite some time but still above the Fed's two percent target so what does that mean for the pet the Fed and their outlook here so this is a picture of the dot plot where voting members and non-voting members of the federal open market committee places the dot of where they think interest rates are going to be for each of these years going forward so potentially one cut in 2026 maybe another one in 2027 to get to that long-term rate of 3.1 percent which is their neutral rate where they think the economy is in balance so they didn't get again today and they did make the decision again to keep rates steady this is their third consecutive time so the Fed funds rate is between 3.5 to 3.75 percent so where this would affect you all is if you had a bank account tied to Fed funds it would be somewhere in that range or your very short-term investments on that have a very short weighted average maturity it should also be around 3.5 to 3.75 as well but keep in mind I would say this chart is more times wrong than it is correct but it just it gives us insight to where the Fed thinks rates are going to be given where unemployment is and with the rising interest rate or the rising inflation risk the Fed feels pretty confident staying steady until they learn more to see through is are the energy shocks going to stay a while is it not so they could adjust rates accordingly to give you a visual where the yield curve has been and we're showing you where the US Treasury curve has been US Treasuries we do have a good portion of those invested in your portfolio overall because it really meets your key objectives of safety liquidity and then yielded in that order so in the shaded area you could see where yields have been for the past year and where they've been recently I would say the yield curve is normalizing a little bit where the further you go out in maturity the higher the higher in yield that you will have and the front end really tracks the Fed movement so if the Fed does cut again you would see the very short-term maturities go down or up in tandem on where the Fed goes and as it relates to interest rates so I'll turn into turnover to the portfolio doing a quick review here so given even though there has been a lot of market volatility you still remain in compliance against your investment policy so you see all the different sectors that you see on the left hand side you're well in compliance with what your investment policy allows for and in those asset allocations now all these statistics that I'll review with you this evening is going to be as of December 31st 2025 so the size of the overall operating reserve fund is 283.3 million we are managing to a one to three year strategy so that duration is approximately 1.77 years if we look at yield at cost it's 4.28 percent so when we are originally able to purchase those those securities and then the yield at market was 3.73 so in other words if you were to buy the same basket of securities that we had in your portfolio on December 31st 2025 that is what the market was yielding and during the last quarter the fourth quarter of 2025 yields were moving downwards overall credit quality very high credit quality across the board with an average of double A and then you could see the sector allocation on the upper right-hand quadrant there your top three sectors are US treasuries corporate notes and also asset-backed securities to talk a bit about performance so for the quarter the fourth quarter of 2025 the interest earned was approximately 2.93 million now there was a positive appreciation in market value because we saw rates go down so there's that inverse effect there so this is unrealized that so the total dollar return for the quarter was approximately 3.2 million and if we want to look at it in a percentage terms 1.16 percent for the portfolio for the quarter which outperformed the benchmark at 1.12 but because this is a longer mandate we are investing on a little bit longer so if we look out the year it's approximately 14.1 million and total dollar return or a one-year return of 5.52 percent which is really good for the bond market typically you would see this and probably in the equities or stock market and for all those different tenders you see for three years five years out ten years as well this portfolio has outperform its benchmark and lastly looking at total earnings in a different way on an accrual basis earnings so for the past quarter 3.26 million and then for one year 2.1 million so are there any questions or anything else you'd like for me to clarify no thank you horland said it is alas awareness month and the proclamation reads as follows whereas amyothropic lateral sclerosis also commonly known as Lou Gehrig's disease is a progressive fatal neurodegenerative disease in which a person's brain loses connection with their muscles slowly reducing a person's ability to walk talk eat and eventually breathe and whereas thousands of new alas cases are reported every year and estimates show that every 90 minutes someone is diagnosed with alas and someone passes away with alas and resin on average patients diagnosed with alas survive only two to five years from the time of diagnosis and whereas the exact cause of alas are unknown and there is no known cure for alas at this time whereas people who have served in the military are more likely to develop alas and die from the disease than those with no history of military service and whereas securing access to new therapies durable medical equipment and communication technologies is a vital importance to people living with alas and whereas clinical trials play a pivotal role in evaluating new treatments enhancing quality of life and fostering assistive technologies for those living with alas and whereas the alas association is the largest philanthropic funder of als research globally and has committed more than a hundred and fifty four million dollars to support more than 550 projects across the united states and 18 other countries and rest the alas association is committed to making alas livable and finding a cure for everyone everywhere so whereas alas month provides an opportunity to increase public awareness of the dire circumstances of people living with alas acknowledge the terrible impact this disease has on those individuals and their families and support research to eradicate this disease now therefore mayor nick sortle and the city council of plantation florida do hereby proclaim may 2026 as alas awareness month and we encourage all of our residents to support and the mayor uh i am very fortunate to be here because i am uh the brother of uh uh siblings that did not make it uh as far as i have and i've made it a long way i was uh here for many years at the city of plantation and uh my brother lou my sister julie uh died at about 55 years old from als it's a horrible way to go and my sister helena the youngest one was 42 years old when she passed uh obviously growing up with that family history every ache and pain you feel you think okay this is my turn but uh i've was fortunate and blessed to spend 26 years with the city of plantation as utilities director and it is a pleasure to be here i'm still young even though next month i think that said i was going to be 87 but i've developed uh dyslexia and so i'll look at it a little differently but anyway thank you so much for recognizing this uh important issue that we have and uh god bless you all thank you mr entus thank you for your many years of service to the to the city thank you so much i'm up uh and next i'd like to call mr sean lakazo up for move over law proclamation come on jim how are you doing well hi jim all right whereas a superior towing with over 26 years of dedicated service has been a trusted provider of towing recovery and roadside safety services proudly serving the residents businesses and law enforcement agencies of the city plantation and the surrounding communities and whereas a superior towing has demonstrated a continued commitment to public safety rapid response and professional service while supporting critical roadway operations and emergency response efforts throughout the city and whereas a superior towing wishes to recognize all tow truck operators law enforcement officers firefighters public service utility workers emergency medical personnel and highway crews who perform valuable and often life-saving operations along our roadways and those these personnel including the dedicated operators of a superior towing are called to duty at all hours of the day and night often in adverse weather and conditions and dangerous roadside environments and whereas workspace is frequently limited within the highway right of way placing these workers in close proximity to passing vehicles and exposing them to significant danger whereas across the country emergency workers incident responders and highway workers are placed at risk every day often resulting in serious injury or death with the loss of a towing operator occurring every six days on our nation's highways and whereas the towing industry has been identified as one of the most dangerous professions in the united states with fatality weights far exceeding those of most other private industries and whereas although all 50 states have enacted slow down move over laws fewer than 30 percent of americans are aware of these laws and whereas there is a continuing need to educate the public on the importance of slowing down and moving over to protect these work side work side road protect roadside workers now therefore nick sortle mayor and the city council plantation florida proclaim april 29th 2026 as slow down move over day in the city of plantation and commend its observance to all citizens while recognizing the ongoing contributions and 26 years of dedicated service of a superior towing to the safety and well-being of our community and council members and mayor um before i turn it over to sean sean um has been obviously a great partner with city plantation but also in broward county and we were talking about how we could build awareness around this um we've often talked about our um public works um staff members that are out on the roadways and people often don't move over and speed by them and so there's a lot of danger out there so sean's going to speak to that a little bit sean thank you good evening mayor council members and city residents on behalf of our entire team i want to sincerely thank you for the proclamation uh recognizing the importance of the move over law we are truly blessed thank you very much today is just not about our company it's about every man and woman who works on the side of the road and keeps our community safe uh our police officers firefighters our public works and even our towing professionals all share the risk every time they step out of their vehicle traffic doesn't stop and too often neither do drivers for 26 years i've had the privilege to tow for this great city um we've seen firsthand how dangerous roadside work can be and it's an incredible teamwork between all first responders fire police and even public works because they sometimes come out and assist us uh and it's a partnership that that keeps plantation moving and keeps people safe for sure uh the move over law is simple it saves lives slow down move over it's a very easy concept give those working on the roadside the space they need to go home to their families um thank you again for the recognition uh councilwoman horland and and mayor sortle and and the council itself uh and for your continued support for those who serve on the roadway every day uh god bless and please move over i'd like to introduce jim my partner jim jennings uh uh we've been partners for a very long time he's got a couple things to say he's lost three tow operators in the last 10 years 10 years 20 years now 20 years i brought him anyway just to speak on the topic thank you uh thank you mayor vice mayor commissioners uh jim jennings i'm an emerald towing service in pompano beach and sean and i have been uh friends for 30 plus years and and also partnered another towing operation for the past 25 years so um but this is something that's just so important to us in our community in the towing industry uh slow down move over and also for all of our first responder partners um in january of 2012 one of our operators joseph riccadel he's a husband and a father was on i-95 in boynton beach assisting the florida higher patrol that was doing a traffic stop and they did the um decision was made to tow the car right there on the left hand shoulder the state trooper was there two boynton beach police officers plus the road ranger was there helping to direct traffic behind them and a gentleman came along did not slow down did not move over and as joe was putting out his cones like he was supposed to in his high-vis vest the gentleman struck and killed joe on the side of the road so um it's a horrible situation for his family and for our entire emerald family um and like it was said in the proclamation now in the towing industry we're losing a tow operator once every six days approximately and obviously that doesn't count you know what's happening to our other first responder partners and i'm glad you mentioned utility because utility is also in the state's move over law so again thank you very much for doing this for doing this for my friend sean and for his company and for recognizing a great community partner um and also bringing awareness to to slow down move over on behalf of all first responders and the 48 000 towing companies across the united states thank you very much thank you jim audited financial statements thank you sir dennis conklin four five eight one northwest sixth court heavenly host protect you and all of your families um for consent agenda number one um i thought it was uh propitious because when we get the city caffer we also get the cra caffer and i have uh a comparison here for um what i've always since the cra uh launched in 2000 for 30 years uh to request that the city remove the extra millage rate from the property taxes that all of the businesses within the cra which was the old gateway seven development district and let them just pay the regular uh property tax like everybody else in the city and uh the reason i've done that as as you can see um well i provided it um from page 22 of the caffer for the uh cra um you have the tiff revenues and that's the money that we get to keep in that district that otherwise would go to all these um taxing agencies throughout the county and it's for the redevelopment of that same area and uh gateway seven and the cra overlap and um after like the third year the tiff exceeded the millage uh additional rate for that district and now it exceeds it greatly um the uh gateway seven gives uh seven hundred eighty six thousand dollars a year and uh tiff is four million seven hundred thousand dollars a year so i ask that you uh withdraw the extra millage rate again as usual from the gateway seven thank you very much item number two was pulled by multiple people but i go first with commissioner reinstein that's the acquisition of 1040 south state road 7. councilmember reinstein commissioner reinstein yes thank you very much um mr hall yes so as mr hall is the redevelopment administrator for the cra and mr hall we've had a chance to speak about this item previously and really wanted to pull this at least on my part to bring it out for a little discussion in front of the public in regards to the decision or the request for 650 000 to purchase this property and i really want to ask you some of the questions that i asked you privately in order to put them on the record so in the memo and the backup that we have in regards to this item we have set forth the property on peters road a number of properties on peters road that are part of this plan redevelopment part of this plan to also try and provide some fee simple townhomes for first responders teachers nurses and so forth um and i want to again confirm though is that those properties that um that we've previously discussed and have been previously approved have not yet been pre-sold there are properties that we've talked about that we are um looking to we're hoping to to provide for a certain segment of the of our residents that we believe are are looking for for this assistance yes so my concern is that another piece of property now this one on state road seven that we are again we're creating some type of inventory but we haven't yet confirmed that that this group first responders teachers nurses and so forth are actually getting in line to to purchase these can you speak to that for a moment well as i mentioned in our previous discussion um the initial property that we have on peters road for the 14 townhomes that's in the process of being uh platted right now we are it's already went through the process and been vetted through council a developer has been chosen we had the rfp we already have a site plan design we already have the layout for that and also have a site plan design for the other property four three four three six seven peters road so we have a developer chosen that's gone through our free process and vetted that already has done the same process at a cria i used to work for in fort lauderdale so this proven product um we've already discussed had discussions with with police etc on this type of product and there is need there is a demand um i think also during our strategic planning meeting that we had it was also stated that it was something to be used as an incentive for fire and police uh as retention recruitment process also so that's what we're trying to do and with the cr in general as you know we have markets we have workforce we have senior housing in the area so we want to also have ownership within the district and that is part of our strategy for the area so just to confirm though in terms of your response the need and demand though is that we we don't have a we don't have a list so to speak of of interested individuals um we just under anecdotally there's there's a need and a demand and we're hoping that once the once these come into you know the the public you know availability that people are going to come come come for them well as i mentioned before we've had some delays in the planning process if we we didn't want to be preemptive as far as starting uh that process without a developer actually doing the site plan completion planning etc and have that part done um then having conversations with uh and negotiations with the developer to understand pricing etc we didn't want to be preemptive with that and we didn't want to ramp up expectations until we get that part complete as i told you before we've had some significant delays in the uh survey and planning process what we're trying to remedy this week um that has delayed that process will be a lot farther ahead but that's going to be remedied so then we can go to that process of developing that list as was done in the process that was done in sarah and for a lot of there's a process and procedure uh having that list having people pre-approved in that process assistance etc and that's developed and process will go from forth so just on that point i again just my concern is that we're adding to inventory we're adding another property with without yet um being assured of of people to to purchase these townhomes that we're um that we're we're looking at adding to um to peters road and now to state road seven my other question um is in regards to the decision for the cra to fund the purchase as opposed to seeking for a developer to purchase make the purchase and to go in on um go in on partnering with us but put the um onus on the developer to make the purchase instead of this coming out of cra funds why why are we deciding to go this route instead of the other one as i mentioned before um in our previous conversation we have reached out to other different levels of developers that we work with in the district trusted developers that we know we can you know work with until the end of the cra i mean and you're very familiar with them um this property these smaller properties are not really interesting to these larger developers they're really interesting for speculators who want to be the last piece of a larger assemblage so we see the vision you know we see how the public's development 11 million dollars you know upgrade the new er for um hca we even have in rick case actually purchased the property across the street from them seeing the changes that are going on and want to be preemptive because the speculators are there now i mean there's been property property is going to be this company property has already been attempted to be flipped right now and what we're trying to do is be preemptive and get these properties and as you know the process that we've been doing we have not been using any brokers at all we've just been really talking with individuals people that we know in the area some of them are nuisance properties that have had some of them had code issues and basically reached out to the individuals and saying look you may need some assistance etc we can come in and take care of this for you and that's what they're doing it especially when they see the end point they see that it's going to be something that they can be proud of as far as you know that fee simple product they become amenable to that so even in this site this in by itself it's too small for developer what we're trying to do is possibly making an assemblage but even the assemblage is going to be no more than probably like a half an acre and typically um developers that we've worked with like green mills they need at least an acre to do anything so to be too small so for us it makes sense to get these smaller properties preemptively and so that we can fit the footprint of these these fee simple townhomes that would work and since this is strategically you can see from the map it's still very close to the uh the park that we've actually you know we expanded the park so it's an amenity that these townhomes actually exit into the park a great amenity and these other ones on 441 it's just across the street so it works out within that particular area thank you thank you councilman fragile thank you uh i don't know what your title is commissioner orland um so i'm looking at the appraisal report as of january 1st 2026 it's 336 000 the assessed value is 415 000. why such a premium for the property they've had this property since 2004 the pictures look like it's not horribly kept but you know they obviously haven't done anything with it why are we rewarding them um with with such a premium on that price okay i was going to answer that good evening jason automaker cao if you look at the bcpa they've got the building value at 600 000 um so from a landowner perspective it's it's a value to them from our perspective and from the appraiser's value it's fully depreciated it's uh it's obsolete if you look at the development it's got concrete to concrete um there's and as glenn alluded to earlier there's nothing i understand that i'm just saying like if we were just the public trying to purchase this property you wouldn't get it for the land it wouldn't appraise um sure so you know they wouldn't be able to borrow to buy the land so realistically you're going to confine it to a rental status or somebody's going to purchase it for cash and so what we're trying to do and the whole purpose of the cra is to stimulate these these i understand that um and i'm not opposed to that i'm just saying that this is a pretty hefty premium even with the i guess the improved value you're saying it was 603 000 per the property exactly um so we're fifty thousand dollars over that and then our our appraiser said 336 000 yes sir so they were just basically done just on like i'm sorry they were really basing it just on land value basically for that and i agree you know and i don't mind giving a little bit of benefit but they really haven't been a great investor in the uh in the district in the in the gateway so um i have paused with the 650 000 i i think it should have been probably closer to 550 you know um how did we come up with that number well through discussions with them taking into account that there isn't a broker fee uh to have it done cleanly and quickly they're getting the broker fee well but it's not on top of when we've gotten into discussions with folks brokers come to the table put stars in their eyes about what they're going to be able to get it it it clouds the situation we're also trying to act as quickly as we can to get as much done in the next five years in this particular corridor there's a couple of opportunities i mean glenn has mentioned uh you know the hometown heroes project but this this block if you look at the opportunity with the alleyway and the rear if if we were to get more provocative we have the opportunity to transform that that whole block don't misunderstand my comments about what you're talking about what we're trying to accomplish but to the point that there's no brokerage fee um it should have gone the other way in the negotiation so if it's like 600 000 debate you know the you know the the benchmark you know okay it should be a little bit less than that 600 but not so much where it would um where they're still getting a benefit of not using a realtor um in my opinion i i just think the price is too high i think we could have done better with that negotiation i can appreciate that okay um that's all thank you and i think also they they see the adjacent property next door it's as i mentioned to you folks are starting to see the property that could be part of an assemblage and they're creating a value for that and so what we're trying to do now is get ahead of that as we you know we go forward because as i mentioned to you when they see all this other development going on people are getting stars in our eyes right now right and so we're trying to get it at this level and when as i mentioned in in the in the in the memo there's possibilities for an assemblage jason we're going to be meeting with those individuals also to get that before these properties get tied up by speculators and then the last one and then they basically hold people hostage to development in the area it's like the game of monopoly so if we get that parcel it's it's much more difficult for somebody else to make it exactly at this price you good okay thank you commissioner uh andrea thank you that was really my question what is the status of that vacant parcel that's contiguous to this one yeah we don't want to talk about it too much okay i can we'll be meeting with them we already have a um a meeting scheduled with them to discuss the same owner right so the same owner for both those properties yes so is there a possibility that this might come back to us um with some changes and maybe because it's a like you mentioned it's a very small project i'm excited about this this is exactly what i have been asking for right home ownership and not rentals right and to commissioner um reinstein's i don't know if it was a comment or question but you you mentioned anecdotal data but we do have actual data like we have facts from habitat from humanity and uh from the greater fort lauderdale alliance so we have the data where we need housing and ownership is the demand is there right not so much as rentals um so i love these small projects that you're doing in the cra i just want to know is there a possibility that this could come back and we might be able to get a few more units yes but it's a different owner on the two other lots so we've already going to be we've already scheduled a meeting with them to discuss okay possibilities okay that's what we try to do we just we talk to folks and we bring them in and we you know we get away from the zoom get away from the we come in and have a discussion to meet with the mayor and jason myself and we go through the process and um typically we come up with a good resolution kudos to you because i'm i'm very pleased with all of the improvements in the gateway so thank you thank you thank you and i concur we've had this discussion many times and the role of a community redevelopment agency is to acquire blighted properties and redevelop and create a vibrant uh community both residential and commercial so um you know while i did say to mr nunmaker the the the price gave me a little pause but i understand what we're trying to accomplish there and as you said there's a lot of speculation um in that corridor i will say once again um not this legislative session the one previous when we're fighting that cra bill when they want to do with the cr do away with the cras uh the success that we have had in that area because we've been acquiring properties uh we shut down the plantation inn publics took a look at that hca investment publics investment that was what helped us to kill that bill because it showed that we are doing exactly what a cra should be doing so um and just to add to the police officers i will tell you anecdotally it's not anecdotally i had a conversation which two with two of our young sros and they were not aware at the point at that point of what we were doing on peters road and they were very excited and that's when i asked planning zoning to please put together a list of all the projects that we've approved that would be available to our first responders medical staff and such so um i'm very excited about it i see i have two more uh commissioners that want to speak and when i say i don't i actually have not written but i've actually had police officers multiple police officers come to me ask me when it's going to start so it's the demand is there excited about that uh commissioner anderson and then commissioner reinstein so you hit right on your final comments are right where i was going to pick up that is in it totally when someone just tells you something that's anecdote wait why don't we put together a survey of our employees to kind of actually get numbers of our fire and police our first responders who would want them so we can have you know knowing it might take a few years because it takes time out to acquire and clan and plat and build and move in but we should probably pull our our fire and police we should probably get some numbers to see how much we should be doing and i also concur with councilman fadgen i feel it's a little high but i i agree with what we're doing and you've done a phenomenal job the catalyst catalyst is the word if you had to summarize one word we we you're making a catalyst through the area that's what it's for i think it's a little high but maybe you've got other things you're you're working on it and i'll trust you on that um but i think we should ask our employees so we know so we know we keep because we can't can't keep saying we're building for five yeah police and first responders if we only have five on the list we already have more than five we're building yeah and and as i mentioned it before and we would be there now it's just that we've had some really significant delays in our planning process which we didn't account for that we're really uh pressing on it right now an informal survey yeah something we're already in one year two years three years five years how likely like a likert scale how likely would you be to purchase if it was something it just gives you something a little more data to pipeline that's all and again it's a great recruit recruiting tool as well thank you commissioner anderson commissioner reinstein and then mayor yeah thank you i just want to um follow up with my own comments mr i think you're doing an amazing job with the cra uh i think that you whenever you have brought something to us in regards to the cra it's always for the benefit of the entire uh entire gateway area and for me my concern is in terms of the uh the 650 000 and the benefit of the entire gateway and i i think the what we've already talked about previously in regards to peters road i'm looking forward to seeing those getting occupied and seeing how happy all of the individuals are that we're looking to build those for um so it my comments in no way suggest that uh i i think that um your efforts on redevelopment are are any less than uh excellent so thank you i appreciate that and also to add um all those properties that are vacant and being repositioned and even previously we had three homes that are basically you know it's a slumlord situation that we incentivized to be vacated and torn down all those are also sending a good strong signal to the palms that's a 20 something million dollar project who was having difficulties because of the vagrancy when they see that happening that gives them a lot of uh you know reinforcement that the city of plantation really cares about what they're trying to do and when we were having discussions with the case family about you know different options within the area they basically said you know what glenn we like what you guys are doing we will reinvest and they did that five million dollars to buy another nuisance property that was across the street that literally when they cleared out a section there was a homeless encampment so the the biggest um compliment that the CRA can get is when folks are already here are reinvesting commissioner sortle also known as mayor i love commissioner anderson's idea we can do that survey we would love to uh we'll talk to police and fire and get some data on their interest in all kinds of homes cool yes you may just very quick when we talk police and fire i i mean i know it's a generic question generalized but are we talking our own police fire our own but what about ones that live in the city but work in a different city i i think the emphasis is going to be our own first yeah it should be a pecking order but then would they be next yeah no i would think public works and those also yeah it's it's first responders and as you mentioned works utilities go ahead yeah come on i'm sorry because i do want to address that you know the mayor has been engaging with employees through town hall meetings for the past few weeks and we do need to broaden that to include public works utilities parks and rec you know the average cost of a home and plantation is about 700 000 and you don't have to do a lot of math to understand that that's unaffordable for many people we also are getting closer with habitat on the hiatus piece and that if that is a model we can bring to the gateway as well well then you're you're really changing the game because then you're talking about a mortgage payment of closer to a thousand dollars which is very achievable because of zero percent cost as far as the uh mortgage goes so we've got a lot of things we're working on but i don't i didn't want to leave that thinking that we weren't looking to broaden that opportunity for folks thank you and that was our goal with the habitat project to be able to provide for our own employees so if we can we'll have that models in place to be able to expand that to be great um mayor did you have anything else okay commissioner reinstein yeah just one more um mr nunamaker since you just mentioned habitat um did we reach out to habitat in regards to this piece of property we didn't want to be presumptuous so depending on what happens tonight those are discussions we can have and not just about here but to seek out other opportunities the the hiatus property um we had discussions the administration had had discussions with habitat prior to bringing it to us um their interests but we had the property right um we've had general discussions about the 441 corridor because we do want to broaden those ownership opportunities and i'd love to say more about where we'd like to target that but i don't want to understood that thank you that answered my question thank you and also and also too since we have the rfp that was done for that particular property 14 townhomes from talking with um you can actually extend into those other properties without having to do an rfp that's my understanding so i'll leave it at that okay enough said um before uh commissioners we've are there any further comments before i turn over the public okay mr conklin you signed up to speak on this issue thank you i may approach dennis conklin 4581 northwest sixth court um it sounds like uh i should not mention what i was going to mention because it's been mentioned um but uh gentlemen when the gateway seven uh special district was developed is basically because of uh slum and blight and crime and uh this gentleman stepped up and uh the doctor uh he got a lot of uh the visible properties and they are miserable because one reason when the state eminently domained state road seven it completely wrecked a very viable part of the city because that place when i moved in well i moved to florida in 81 but i moved into plantation after we were running in 83 that was a very fantastic restaurant row state road southern and the businesses that were ancillary to that in addition when they took uh basically they took their parking lots it just shut those whole properties out and it cast the whole east part of the town city into what it is now and what mr hall has been doing in the few years that he's been here with 30 years of the cra and i look at the calf for every year and you see the money that's there between the cra and the district right they got what 20 million bucks sitting there and it's it's like a glacier and there's no global warming right so i'll basically yield back because the information on the money was in the first one that you can see and thank you i'll yield back thank you mr conklin anyone else conversion and salvation of the mayor of new york um holy land foundation was founded in 1989 and in november of 2008 they uh founders were uh found guilty and uh they had basically monkeyed around with 12 million bucks and uh leaders were sentenced to 20 years in prison um 729 days ago uh april 6 2024 there was a coordinated intifada that began in the united states against jewish people and their synagogues and it spread to the college campuses and to cities um it's basically um since new year of 2025 there's been at least eight jihad attacks in america now hamas is the militant wing of the muslim brotherhood and care uh council on american islamic relations is the propaganda wing they're the two sides of the same coin uh plantation dodged the care bullet in the early 2000s uh sunrise however has succumbed to an islamic center and uh basically they're not um uh houses of worship they're uh non-profit organizations they're um let's see that's uh and coral springs now has uh had the uh uh uncomfortability of two events with their uh anti-semitic and um pro i guess you would say uh jihad uh organization so i request that the city plantation designate muslim brotherhood hamas and care as foreign terrorist organizations and transnational criminal organizations and um question what does 649 585 181 66 and five days ago have in common and the last one was on saturday those are five assassination attempts of president or candidate trump uh 231 uh 231 days ago charlie kirk the christian martyr was assassinated and uh i requested the city of plantation liaison with their three schools that uh three high schools that are here with uh tp usa we have a chapter here in nsu nova southeast university and they now have high school chapters so uh 15 days ago i mentioned uh here that the deep state uh trial that's going on uh they revealed that uh two of the agents were basically subversive agents may extend please wrap up you've got five seconds great uh i couldn't hear the five seconds five seconds all right i'll give you ten i'm feeling generous yes okay uh what what happened i got home and the news that night they indicted the two uh criminal terrorist agents plantation resident and taxpayer for 13 years i'd like to start with the city of plantation's own mission statement city of plantation's mission is to continually improve citizens quality of life through value-driven quality public services that reflect the expectations of plantations residents your strategic priorities commit to transparency and making residents feel welcome and connected to their city government so i was disappointed to learn that the city quietly signed a contract worth almost half a million dollars with axon enterprise without a proper public announcement and very little public input the contract affects every resident daily and we were never asked i want to be clear i fully support our police department i want a safe community crime reduction matters to me my concern is not with law enforcement my concern is with mass surveillance of plantation residents who have done nothing wrong people often say if you're not doing anything wrong why do you care my answer is simple just because i'm not doing anything wrong doesn't mean i should accept a foreign surveillance company recording me tracking me and collecting information on me i did not consent to allow my behavioral data to be permanently owned by a private billion dollar corporation since when was this just part of being an american citizen and that's exactly why i'm concerned axon's own contract states they can permanently own the transformed data their cameras record they can use that content including footage of innocent plantation residents to train artificial intelligence products that they sell for profit that's not a theory that's on page two of the contract courts are actively debating whether this violates the fourth amendment additionally axon is currently named in an active lawsuit raising concerns about components connected to a company the department of defense is flagged as a chinese military entity we are trusting a company under active litigation to safeguard the daily movements of every plantation resident i recently created an online poll asking plantation residents if they felt that their opinions and voices were heard and matter to the city of plantation and i was surprised that over half of them said no they didn't feel their opinions mattered so tonight i'm asking you to change that tonight i'm asking for three things one to opt out of axon's ai data training program immediately if you have not already to hold a public hearing before any cameras are installed the public deserves to know what's being installed all over the city and i think it would help with transparency three commit that decisions of this magnitude will include resident input going forward i want to feel safe in my community but i don't feel safe knowing a multi-billion dollar tech company is monitoring my vehicle without my consent and even more unsettling that my city leaders have made these decisions without properly addressing all concerns and opinions of the public the people of plantation deserve both safety and privacy not one at the expense of the other thank you thank you miss huts to be clear i is this your first time in city hall yes all need clean air and water and green spaces unspoiled by trash i've attended many meetings of the solid waste authority and have been impressed by the transparency and input from industry in the community i've also been very impressed in going to those meetings to realize that our city is ahead of many other municipalities in broward county in terms of the way we manage our solid waste and i thank you for that um i hope you will continue to you will continue to support the plan and do the good work you're doing thank you thank you dr long miss maud king bruce good evening good evening recycling plan for the city of plantation i know the council members are aware that there are many condominium associations in the city of plantation i did not hear a master plan for the condominium associations i understand it's early i do hope that the council will inform the two gentlemen that spoke that there are condominiums and please do not leave us out of the master plan thank you just a approach yes okay dennis conklin 4581 northwest this court um this is my favorite time of the year get to see where the money is see how we uh the city's like a vacuum cleaner and there used to be a phrase uh windfall tax uh that people that worked and made money and invested and made money and so forth and so on they'd get penalized with the uh windfall profits tax but uh i kind of look at this as the the city has a tax windfall and year in and year out first year i noticed uh when i got the kaffir i was still sailing and uh they used to put the helen b hoffman library hard copy so i got to see a couple years before i got off 92 maybe uh 93 but in 1999 the city had for its first time ever broke a hundred million bucks cash and investments and uh for what 30 some odd years um it's been going on um now they're at 388 million dollars and it's just mind-boggling because through all that time the city's been holding on to this money and building this pile of money i call it a mountain of money and the millage rate stubbornly never changed even though all of our property values were going through the roof as always mentioned somebody said average is 600 000 for a house and plantation you wonder why there's no affordability it's basically because the dollar can't buy spit today we're off the gold standard in 72 and it's uh katie bar the door so um what i what i got here uh the mountain of money that i provided each of you and my suggestion which i always make it's about the uh pensions because uh i was in a dying industry i don't know if we got even a hundred american flag ships anymore and now everybody's focused on shipping because what's going on over gulf of oman and straight of uh or moves which i sailed through there but um we had a defined benefit pension plan for the union i was in and then this was in the 70s and they they saw because unlike a government who can print money by either taxing or printing they couldn't keep up with the pension so they started to find contributions and that's basically what i uh tried to impart to the city because basically you can see uh i use the uh city employees can you wrap it up mr i sure can because i use the city employees because you can see that basically it's it's failed once already that's why we're in tier two new york city's failed six times they're on tier seven and um it will continue to do that because you can't chase your tail and catch it and survive so uh my recommendations are as always and uh i mentioned that the police one i didn't do because we can't monkey would contract but it's interesting to note that in the 2011 contract with the police officers they installed a 401k the city never turned the ignition key all right thank you for the additional information you provided thank you and strongly urge you to get out of this defined benefit pension plan which is a death noose around the taxpayers and it's going to be yours too because they'll bankrupt the city thank you city of plantation and the plantation athletic league council member reinstein yes um director otul question please yes sir so this uh this agreement is the one that is formally removing tackle football and the cheerleading associated with it and at prior meetings we've discussed the reason why um discussed that the the tackle football was was not meeting the minimum residency requirements and based on the the cost of the property that was being leased from the school board is that correct yeah my question is that uh is there any further update i i know that you had had plenty of conversations with various representatives from tackle football and they were looking for other locations i just want to confirm that although we're making this this fiscal decision that the the city is still working with them to the extent that we can in order to help them with any practice location or temporary or to advertise for them and so forth yes sir um we're trying to provide fields for them for their pre-season conditioning at uh seminal park um i do know we're trying to facilitate the conversation between pal and the school board um seems like there's positive momentum where they're still going to be able to use pal park it'll just be an agreement between pal and the school board to utilize that facility we just simply don't have the facility to offer football games and practices so we're trying to help them along um we still have the relationship we're just they're still operating under pal we're just removing them from our agreement with pal if that makes sense it does and i just wanted to make sure to clarify that for the public that um you know there was some concern that um i don't want to say that we were abandoning them but that um that was really what they were raising or some some were raising and that wasn't the case and we've laid out the the reason why this agreement is going forth but uh we're making every effort to assist them wherever we can correct okay yep thank you you saw my face confused so this has been a long discussion um when you say that we're removing them from our contract but they're still operating under pal how is that happening pal has their own bylaws i think they have opened registration for football they're trying to have a season um you know so they're operating under pal they just don't have anything to do with the city at this point okay i'm i'm gonna have to i'm gonna need some clarification on how that works with our um contract and insurance and that's why i would prefer that they operate uh on pao field in conjunction with the uh in coordination with the school board and not on our field for those reasons so yeah um and just to clarify for their pre-season that they've asked us to provide fields because they weren't sure if it was going to be worked out yet with the school board um we are getting their coi we haven't issued the permit yet until they provide that proper insurance sub how does the subcontractors work because i'm looking at their rates aren't they subjected to the limitations of our continuing service agreement since they're a sub of the primary contractor and specifically i'm looking at the master consult master consulting engineers inc and looking at their administrative um rate that they're providing in their contract is 180 an hour i wish i was administrative assistant for them um and then another thing 50 premium for saturday sunday holidays or any time between 7 p.m midnight and midnight 7 a.m now i'm not expecting that they would be working those times but for that to be in the contract doesn't that end up on us uh charles spencer for camera director so sub consultants um do not adhere to our contractual categorical rates of our term contract however the sub consultants the prime middle leg in this case cannot mark up sub consultants so whatever rate that they're charging is a pass through to the city of plantation to finish that thought to finish that thought part of the evaluation negotiation handled by the um capital improvements they look at the sub consultant rates as well as the hours from the prime and they negotiate those rates to make sure that the when they're applying their rates to whatever aspect of the contract they're working on it's going to be a higher number on some of these things um and then how do i know they're not getting a kickback where there's this is just a work around uh i'm going to get our subcontractor in there that has a delaware you know um uh incorporation i mean you really never know who they are or even montana don't go to montana um we um trust in expertise and the knowledge of the cap improvements team to understand what's going on and keep their fingers on a pulse when it comes to these i think when we're when we're dealing with our um continuing service agreement con uh you know professionals um i didn't open my water i'll give it to you um i think we need to have them negotiate with their subcontractors that these are the rates that we've agreed to with the city and we expect them to agree to those rates because you know it's our money it's going to them um so but that those two two in particular really caught my eye the one and a half time never seen that for a professional though i wish i could bill one and a half time when i'm working late nights that'd be wonderful so all right i guess that that's all my comments okay anybody else councilmember anderson i just would like to say that i agree with councilmember fadgen that they just can pass through any cost they want so the the primary person is on the agreed rates but the ones they sub it to or whatever they want to charge so i think we should put it back these are big companies they can use their power to say their subs have to match the rates that are pre-negotiated so how do we how do we do that going forward so we can say anything let me be very clear we can say anything but that does limit that could limit what we receive from sub consultants and sometimes the quality of partnerships that the prime ends up with so yes we can leverage that language but it may not always render the best team for a project so what we rely on is the negotiation tactics by the captain improvement teams to make sure that they have their fingers on the polls when it comes back to pushing back on those lump sum and those hourly rates to make sure that they are reasonable so when it's presented to you all so it's not just the prime rates it's also the sub consultant rates as well i just think it's a it's a loophole massive loophole that they can we do the work to price have fixed rates for the one that won the bid which is miller and then they they can sub it out to any sub stuff that can be anything it just defeats the a lot of the purpose of the bid and dib is here he's listening and i'm sure he's going to take that back into consideration when he's negotiating negotiating future rates with sub consultants yes that's it okay uh dib hi thank you for including the updated information we asked for on the bulkheads i appreciate that um when are you looking for us to um weigh in on that well the intent of bringing this item tonight is so we can move forward with the phase one improvements with the understanding that in the future we're going to have a future workshop to narrow down on the bulkhead because i know there was conversation and comments about that and with that we have middle leg on board with us in case you have any questions but the intent is push this phase forward and then hopefully by the end of may sometime do a workshop bring additional reference material so you all can look at and make a determination along with middle legs recommendations for the bulkheads because i know that there was discussions whether we want to use concrete or wood and you know that's the intent well and i think that i was hearing somewhat of a consensus that we'd rather be um not be penny wise and dollar foolish and really get um what we're looking for on that municipal golf course as we're having this conversation yes um i think we all need to keep in mind the new state law um that is encouraging um and allowing uh development on golf courses we are very fortunate to have this municipal golf course that we own it we need to protect it yes we need to make sure that the renovations are up to par because we could lose any of the other golf courses in our city to development yes um and we would not be able to have a public hearing on that people need to understand that it would be administrative approval and we'd have no control so i think the investment in this course is wise and um i i look forward to further conversation on that i see in the back i hate to put you on the spot but louie bartolotti from guidon who has vast experience our management company would you mind coming up i hate to put you on the spot i don't like to do that to anyone but i see you here pardon me we told him you might get called okay he told all right we coached him up hello mr bartolotti how are you it's good to we told him to say what he thinks even if it's not what we think and miss marlowe's here as well and kathy marlowe who's uh manager over at the golf course has done a great job with reserve good evening good evening to see you um guidance done a terrific job over there and you've heard us say that it is a gem in our city and we do need to protect it um i'd like to get your thoughts on some of the improvements and renovations that we're looking to make we did have a i remember out being out on the golf course with you and taking the tour and talking about uh ad nauseum about the gas the grass um but when we looked at one of those bulkheads we i kind of looked at that and said boy it would be nice to have you know some kind of rock or stone there because it's a real focal point and maybe even a fountain somewhere okay so um i'd like to hear your input uh my input on i gave my input to the mayor and to uh great jason on i think it would be important for council okay on the uh on the renovation whatever you're comfortable stating i you know i'll support whatever the city does i'd sure like to be i'd sure like it to be done in one phase it just makes a lot more sense it's going to be a uh 500 000 to 700 000 expense if you do it in two waves okay you're going to lose some revenue from the premier card okay um in both phases on the projections right there it's a pretty long stretch in fact i think 10 months on a couple of them is that about right my experience with doing renovations jacaranta just did the ultimate they opened up they closed down april 1st they opened up november 6th they probably opened up a week or two early you know in my opinion with the condition of the golf course but they pushed it and they pushed it and they got it done and what i see happens a little bit in the golf industry is the private clubs like fort lauderdale country club when they do it you have members that are paying dues who also get to pay for the renovation with an assessment there's no sense of urgency and i hope in this project that we put a little sense of urgency on the timeline that's being done okay so i'd like to see them done in one and there's another thing that i'd heard a little bit about was the grass um i know we're looking at a past palom grass excuse me i'm sorry let me let me okay go ahead address that that comet made has not been a determination as of yet we're still evaluating miller lake team actually has an agronomist on board to review and analyze all the different potential options okay so that's yet to be determined just to want to clarify that right and as i said at the workshop and we've got a great team but i want to make sure that we are consulting with you know someone who has vast experience and in the golf industry and manages that course when we talk about grass okay yes and that's why you're here and that's why i called you up okay do you want me to finish with the grass a little bit okay well i'll finish with the grass important we hear from you past palom is a great grass it came to florida in about the 90s it's real good for high-end golf courses it's definitely more expensive it doesn't do as good with traffic it does real good with solidity and we put it in at jacarand our pet at plantation in early 2000s jacaranda put it in on both their golf courses miami shores is a public golf course course pembroke lakes is a public golf course they've all got past palom there's not one of them that's going to keep it and golf course hasn't been in very good shape and i take a bit of that blame but the grass the the funguses the diseases as that grass has it's very hard grass to take care of unless you have big dollars so i'd hope that'd be taken into consideration because past palom grass is just expensive bermuda grass is common in fact i read something last night there's three about 300 230 golf courses in south florida 45 of them up to 45 half past palom it's more expensive to buy because there's not as many sources to get it so hopefully that'll be taken into consideration do you know what jacaranda did they do bimini they did bimini and they did uh tiff eagle on the greens yeah and the only reason they redid their golf course was because of the signal grass and past palom anything you also you would like to add no can i prompt him sure absolutely mayor thank you very much uh first off to be clear um procurement in the entire city is open to evaluating all forms of bidders when it comes to grass so we may mention something here but okay it's wide open we don't have a ruled favorite so no but i think it's important that we hear from someone who is and so my bigger point my bigger point is um my thinking is that we that hole seven is vital and has to be done very soon and we do hole seven with the temporary green and then do everything else the next go around and that keeps you open and the golf guard was one to work but but evaluate it i want to hear a few things that works or doesn't work and why it does or why it doesn't to do one right um i instead of three does is is one a deal breaker is three if that makes sense let me back up i'm sorry golfers hate temporary greens if you play and you get to one temporary green it just can ruin your ground go ahead close to the pen yeah which i never was so yeah so your question is would you do one green instead of doing the three does it make sense financially what's what to get that vendor in there to do one project and not do the three so i think all those things need to be weighed out um it's gonna be a challenge to get golfers around anytime you have construction anytime you have construction on a golf course it's just you know some golf courses will do nine at a time that is i've never seen them do two three holes at a time the other question that might come into consideration when you start buying grass for three greens a year before the next year you buy that same grass you're not going to get the same plot you're getting a little different you're getting a little different seed than you're getting right sure so but you know if it needs to be done we'll support it either way but i think we're all in agreement we'd like to get it all done as soon as possible it's gonna be a group decision yeah i'm glad you read that law that uh or that yeah i've been fighting it that and building on change the golf industry that and building on church properties yeah no it's a real threat thank you so much for coming up uh on such quick notice any other questions or comments council members anybody from the is another one similar to what council member fadgen said about uh the golf course i feel these fees are very very high for an architect to bid just the planning of windows for dyke auditorium first i talked to uh friends that own and operate very large window companies and said it's very inflated time and cost for the architect that's one person's opinion but they're in the industry for a long time 69 000 essentially to draw plans yes they have to attend meetings yes they have to go to pre-bidders conference yes they need to do some things 69 000 so i have a question for charles first charles why don't we put this out to bid for the whole job planning designing and executing everything if i let me keep going while you're gathering thoughts if you're a homeowner you don't hire and you want windows you don't call an architect you call a window company and they have an architect or they contract an architect and they have an engineer they get the signed drawings from and the prices are way way way lower so why do we do it this way where it feels extremely inflated that is a few thoughts um one we have to understand this is a grant project so uh with that with that being people's money no i'm not disregarding that part of it but it also means we have to uh forward fund certain things so we get information to the granting source so we that we can proceed so outside of that little scenario um you also have to contend to certain right project right bidding type right so what you're talking about is a lot of design build processes and things of that nature and these projects are typically smaller um from a dollar perspective we don't get a lot of teams architects and contractors bidding on them because of just the monetary value tied to the project um when you want to do a design build or a cmar or a ton of other progressive type of uh bidding avenues which we support um they still need to be tied to a monetary value of total project in order to be lucrative for the company that was going that's going to be bidding it if you engage companies like that you're going to have a huge inflation when you're talking design build projects it's just too small i understand if you're going to design build like a building from the ground up this is windows window companies do it all day long they have many different sizes they can custom make them they have architects they have engineers usually on staff if they're big if not they have their subs that they go to all the time design build is i know it's the analogy of design but this is windows you're designing windows you're installing window you're designing i mean they have to look at our ads built an older building there's definitely that time involved i just feel this is math this is just the architecture fees is 70 grand i feel it's massively inflated and so does my friend like massively five at least five times so i won't speak to the age of the building i'll leave that to dib and um the characteristic work looking at old plans correct that requires some more time but i still doesn't think don't think it justifies the cost i just don't know what to say some of these costs we've been getting over the last few years i know think there's inflation but that's just architecture fees for example let me just look at some of my highlights i mean the meeting after meeting after meeting when you walk the building it's not going to take so many hours and then again and again and again um i also notice there's an asterisk on many of these for the times but nowhere do i see what the asterisk usually at the bottom it would tell you what the asterisk means so it says like asterisk two hours but it doesn't say what the asterisk means so it's hard to say um so council member for example like here's one to just upload the drawings that means you go to our building department and you drag and drop the drawings they want four hours of the principal architect the project architect at 250 an hour they want four hours they want thousand dollars just to upload it and email it that's it's crazy um i mean you can go to anybody can pull these are right online pull it open it i just go down and down and down so many hours for so many things the hours seem quite inflated so go ahead so just thank you for your thoughts right um number one just to talk about design if you look at their actual proposal the design portion of it is only about less than half of the 68 000 that's being proposed the rest of the other half is for construction administration threshold inspection which by the way is required through the grant requirement so which requires an engineer as well to be on site do inspections that's part of the grant requirements and it also includes bidding and permitting assistance because part of that's putting together the package so that we're getting ready to go bid in coordination with our procurement department as well as permitting agency comments because they're going for permitting they address comments through agency and with that i've never submitted a set of drawings in my entire life for doing this profession over 20 plus years where we submit a set of drawings and it comes clean without any comments it's usually one to two rounds of comments so that involves time so just for transparency less than half is for the construction document side now just to give you another background as far as daiki i did a little research because again i'm new with the city so daiki was built in the 70s um and then there was an addition added um on alteration in the early 80s where they added another meeting room part of that large ballroom area on the north side that's in 1982 1983 since then the only renovation that was done was inside the rest the the facility in 2014 give or take so 12 years ago and that renovation was the remodeling of the restrooms reconfiguring some of the office spaces storage and and some uh alterations in the kitchen area but aside from that there was nothing else done on the exterior so those are the some of these are the original windows and doors just to give you a little insight so part of that process from the architectural standpoint is the the time they're going to take to go out there look at the eos build the existing condition to field measurements and coordinate with us as well as it's not just put getting a company to come out there at least in my experience to put windows and doors if you're going to do windows and doors you have an idea what type of windows and doors you're going to go with what type of product they're bringing in their expertise a licensed professional that's going to engineer the envelope for the window capacities and the design pressures as well which will be part of the requirements that goes out to bid that we're going to be strictly here the contractor too which helps us on our end to track and manage the project accordingly so just just for transparency that's why i want to i know you see the whole picture 68 000 um but half of that less than a half is just for the design the other half is for the other things that we need as part of the project what you're right right before that thought you said something about um i'm not sure what you said um but what that they're that they're designing for the wind load that's exactly what a window company has to do with through their engineer and architect you're buying impact windows for the exact same wind load so that they do the exact same job i don't understand why this is different well part of that is the licensed professional they're bringing in as part of their services to evaluate the actual envelope of the building what what a window company does it just looks at the opening and just based on the location comes up with some sort of rating they're the license professional going a little further deep into that and tell us okay based on the analysis we're going to recommend this type of window system that best fits your needs as well as operational and then based on that they move forward with the design process for engineering all right i'm almost done but a window company would also have they have they have to have an architect that has signed drawings and i did my house don't they have signed drawings so i did my house all my windows are impact my doors right when i contacted that contractor they what they do is they actually reach out to the manufacturer and say hey based on the location this is we this is the range of parameters for the the requirements and based on that they have what they call noas for providing a set of windows and doors and that's based on me as a homeowner telling them okay i want this type of window system each manufacturer has similar um characteristics but at the end of the day this is a public facility we want to make sure and it's not just regular window size we're talking about some of the exterior windows on the east side on the south side they're roughly about four foot panels by eight or nine feet tall so they're not your typical conventional window as well so it's a little different than just a window system so if we if this went out if we did this where we put it out to bid for the total job how much time would that add on to it would that put the grant application that's the other reason why we're pursuing with this is because of the timing the the grant that we're currently engaged with applying through our grants coordinator uh has a strict timeline that the project has to be completed by june of next year which doesn't give us enough which barely gives us the durations that we need to put together the design go out to bid evaluate the the bids award a contractor issue my notice to proceed and then on top of that once the issuance is submitted for the contractor to start he then has to provide shop drawings signed and sealed that we have to review and evaluate to make sure it's in compliance and then put it um place the order before they can install so there's a timeline uh tied to this as well you're talking 14 months right 14 june june of next year yeah i don't have any other questions excellent questions and comments councilmember anderson councilmember reinstein yeah thank you councilmember anderson for those um those those questions and the comments i just wanted to emphasize your last point regarding the timeline there's been a lot of frustrate frustration with dikey auditorium i mean this has been um a uh you know i don't want to boondoggle call what you will but um i mean it's there there have been so many instances where there have been surprises uncertainties delays and whatever you are doing in terms of ensuring that the current timeline that you are working with is not only kept but to the extent that um it is done the right way but it is sped up in any possible way so it can get back to our residents um please please do so that's where um again as a new hire you know i've been brought in to look at this as a global picture to try to evaluate and you're part of the solution so we appreciate it let's just keep keep insurance brokerage services term contract the city's agenda backup materials note that the 12-22-25 scoring meeting um procurement verified the numbers identified a scoring discrepancy and uh the designation changed because of that um my um my my thing is that um i'm requesting that this be pulled and uh continued the city's pricing worksheet uh which i gave you a copy of um shows that the it was scored uh using fee points which were applied using a lowest price proximity formula and our concern is is that this method doesn't align with the rs rfsp stated fee evaluation factors um which affected the outcome so i'm asking for a short continuance which would allow the city to confirm the evaluation record and ensure the award action is fully supported uh before approval and execution thank you thank you mr biggill so let me just state because the procurement process has concluded if we were to defer this item it would put the entire item in limbo and we would not be able to do anything so you know that there's an appeal process in place so that would um if the council were to go ahead and approve the item and then you could appeal for the the appeal process okay go through which is 200 bucks if i'm not mistaken once that is received then there's a process that we inform him of and we go through of establishing appeal an appeal committee and that has his own embedded process with that and i didn't hear any concerns with um from mr mcgill in regards to going through the appeal process sounds like he was aware of the appeal process and um he's able to and and nunamaker i think i heard from you um a commitment that there would be um a city liaison or a liaison from miller leg that would be available or uh that their presence would be made known to the public so that if there were any issues or concerns uh regarding the construction near the golf course around the golf course that residents would know who to contact i didn't see that specifically in the workshop minutes so i really wanted to um publicly ask that that be added the request for that liaison and make sure again that there's a commitment from the administration on that yeah and appreciate that now that we've got this phase one moving forward we'll start those efforts commencing with the workshop to be scheduled for that outreach just to make sure everybody's on the same page and they're aware that there's a process and keep folks informed and i i believe that it was it was also discussed in terms of maybe something on our city website so that there would be an easy contact so that residents wouldn't have to go searching for the the schedule of the plan and so forth yes sir so we have some signage with a link to go to the website and we're going we're doing links instead of the qr codes to avoid fraud and all that stuff very good so um i'd ask that um that reference to the request and the agreement from the uh administration be included as a as an amendment to this allowed the city to create a bulk water rate to be able to sell bulk water so we hired our consultant gov rates uh that went out and they did a study to determine the rate and set a rate tonight before you is the ordinance to approve setting that rate so this rate doesn't have no it'll have no impact on our residents or our commercial businesses this only pertains to sale outside of the city so if we were to enter into a contract with a city to sell bulk water or within the city limits to sell sell bulk water an agreement would be drafted and made that way to sell you know this just sets the rate based on the study and in your backup you'll see the rate and while it says fiscal year 26 27 and it goes into 28 we'll be doing another rate study in 2027 that'll be brought before council to evaluate it so the numbers that you see for fiscal year 2028 in your backup could change as a result of the next rate study that we'll bring before you council members do we have any questions for there at uh the uh southeast corner of west brower boulevard and south pine island road again the address is 100 south pine island road uh the agent uh for this application is chris lock the owner is uh brown capital uh the size of the parcel is approximately 1.68 acres the underlying zoning here is the city's npm which is the mixed-use plantation midtown as you know the existing use is the the wawa and the underlying land use designation is commercial adjacent zoning districts to the north east and south are the npm district and to the west is the prd 25q which is a planned residential uh designation this is an aerial photo of the site again you can see the area to the west is uh characterized by a multi-family residential to the east there's uh the alex j alexander and the einstein location that they're proposing uh to locate the uh the ev charging stations uh just a little bit of background on may 11 2022 the city council approved through conditional use site plan uh to uh the development of the 6 119 square foot convenience store and the fueling stations uh and approval included uh city council condition for five percent of the required number of off-street parking spaces to be designated as electric vehicle charging stations the applicant indicated that the 10 parking spaces facing broward boulevard would be designated for electric vehicle charging stations we just want to give you an update uh since we've since modified our our code and some of the things we've done with regard to ev charging stations in light of senate bill 1084 which kind of preempted us from uh you know requiring ev charging as part of our site plan so the applicant is coming forth on on their own to uh to put the ev charging stations in the current request uh again is approval to modify the parking lot and implement landscape modifications uh proposed modifications uh would include the installation of the three ev charging stations to service six parking spaces reduction in the number of parking spaces from 40 to 39 construction of two equipment pads with related equipment removal of installation of some landscape material uh along broward boulevard and they're reducing the required landscape buffer as along broward boulevard as well uh to develop or to construct some of the equipment that's necessary so this is the uh site plan that you see here uh for the for the project um you can see here this is again the the location that uh they're proposing to locate the uh the ev um chargers and this is the actual uh site plan itself again these are each of these uh kind of identify the location of the of the ev charging stations and this just shows some of the landscape uh that's being impacted here so the uh applicant uh some of the uh equipment and stuff that they're putting in in terms of the pavers or what have you requires them to modify some of the landscaping that exists uh in this area of the site these are the uh proposed ev charges that uh they're putting in um staff did have uh we did have some issues somewhat with the color uh of them uh and uh we kind of went back and forth to try to see if there were different colors that they were available in uh the applicant has indicated that uh these are the colors that these chargers come in so there's no uh leeway there but we were kind of and these are some pictures of of kind of uh where they have been installed in other locations uh at the top left there is uh location in hollywood florida uh at the bottom there is location in fort pierce and then there's a location uh shown here in braidington florida these are some of the other applications that we have the broward mall which is uh not you know a little smaller in size uh and the colors that we felt kind of fit in a little a little more uh so they don't stick out uh so much and then these are the ones that we have at the fountains that we felt uh you know kind of fit into that environment a little better so we those were our primary issues because they're kind of large and very colorful so we had some issues with regard to how they might stand out with regard to the site again the landscape waiver as i pointed out the landscape waiver would be from section 27-86a10b3i which requires a minimum width of the landscape strip of land located between the surface parking areas and an abutting public right-of-way to be 15 feet so basically that would require the area located along here to be about 15 feet again because of the improvements that they're making here it would reduce that down to six foot one inch so they're requesting a waiver to allow the reduction to the six foot one inch as opposed to the 15 foot required uh buffer there and uh we just know for for the record to date we have not received any written objections or phone calls with regard to the request and that other concerns at this time the subject site does not have any reported violations or anything on the site that we needs to be brought to your attention and based upon the above we would recommend approval of the ev charging stations so i'm happy to answer questions as you see here the applicant is here as well and can probably answer any questions that you might have relative to the equipment or anything of that sort thank you mr holmes um i'm going to turn it over to council member fadgen and hold my comments thank you um i guess i need to make a genuine disclosure i get coffee there every morning and i did look over there after i looked at the site plan so it won't influence my uh my uh vote um man those things are ugly yep you know is the landscaping going to be able to shield it and what i remember when we are approving this and and we talked about this like new urban design is as you put the building to shield the pumps now we how many of these things we put they're putting in there's three of them but there is also other equipment um that would be located there and that was my other question does you have to put a transformer or your transformer is adequate yeah the transformers the transformers by the building now does that get replaced or is that adequate to because i just remember plantation ford he had to put this massive thing in for i forget how many charges he put in like maybe three or i guess he put in three too but um does that is that that landscaping doesn't have to change for where the transformer is uh there i think there is is is uh there is some change uh in terms of some of the landscaping uh here that is that we're kind of trying to place here to uh you know to make sure that the transformer is obscure so if i remember correctly i think there's some modification here but most of it a bigger one in a bigger transformer it's a new transformer over yeah over on the board come on uh over here yes yes yeah please under introduce yourself and say you understand the rules good evening this is austin bouchard with kimley horn i understand the rules thank you um for clarification that is a new uh private transformer with fpl next to the existing transformer for the wawa it is a separate utility service and there is a switchboard up to the north that'll be shielded with the landscape so it's already there or it's going to be put in everything in black will be proposed so this shows the new proposed landscape along with the new proposed transformer and switchboard so that's the two new pieces of electrical equipment the new transformer it's by the building where the existing correct sir okay so they're okay they're gonna be able to i don't really necessarily have that much of an issue with that because i didn't really because i actually looked at the transformer this morning so i guess i didn't make uh a jennings disclosure well i looked uh so the transformer i don't think is really my issue but i mean those uh the stations themselves i mean it part of the cell to us or the pitch to us was that you know the building hides the pumps and now we're going to put the new pumps the new the new world pumps i guess so i guess that's my my comment anybody else in the days i would agree with council member fadgen and i thought some of the more recent ones that i've seen um they just look a lot more high tech and you know they i've seen a lot of advertisements now i guess that's how they're even generating dollars so is there a reason you only could go with this type of ev charger i know it's what you've used in the past but is there something preventing you from using another type this is considered from our client this is considered the partnership that wawa has with our client ayana this is their type of charger that they're implementing across the nation so it's an exclusive it is exclusive it's they just want to keep the brand that they currently have for proposing and they're going for this retro feel which understood there are no ev chargers at the wawa at state road seven i don't think so no no there are not okay i don't have any other comments everyone's at a loss for words councilmember reinstein thank you so if if this was uh passed but however with the um position taken by the department requesting the subdued colors then would it be the applicant's position that they could not go forward with adding these extra ev charging stations because it's contrary to your agreement in previous correspondence they did not agree with changing the color we can present it to them again however based on previous correspondence is not allowed right so um maybe this mr holmes so that if if if they determine then that they're not willing to make the the change um it would just mean that they can't add the ev stations if it's voted down yes no if it's vote if it's voted up but with the with your provision that they must have the subdued colors so and then they don't go forward with it because it doesn't fit well well let me go back and explain what our our take was as we were going through the drc process we went back and forth many times with them uh with regard to the we even had some issues with the size of it as well but the colors and we kind of looked at uh what we had in other areas of the city and uh we'd asked if at least they could uh find if they you know they could paint it white uh so that it wouldn't stand out as much their response to us was that these this was the color that the uh you know that the charger came in that it wasn't even available in another color that's what was told to the planner uh that uh was working this right so if if it's the staff recommendation is approval um of the site plan subject to the conditions so again is that if it is approved subject to the conditions and then they decide that they don't wish to adhere to those conditions then they just would not be able to move forward with the evie stations i'm asking you mr well i i mean that's that's on them i can't say whether they could or couldn't but i guess if you're asking that's the only colors that they have that would be correct if you were to to uphold staff's wishes or our our concerns with regard to the color of it uh yes that would be within their decision not to move forward with adding the with the ev equipment and the ev stations how does that affect the initial approval right because the first time this came before us wasn't that part of the requirement yeah but i guess that would have to be uh i probably would have to have legal chime in on that because our understanding pretty much was that because of the change in the statute that i'm not even sure you mean requiring them to put in the ev no i i when it when it was first approved it was approved with the understanding that they were going to put it in right right so now if they're coming back to us asking for waivers and we have a condition they don't wish to go forward based on the condition right um it would mean that they the the initial approval would stand require i'd have to see that approval i don't i don't know how it was written am i reading am i remembering that they had agreed to put in the uh the ev charge it wasn't it wasn't a requirement it was their agreement right right it was approved initially that's with them agreeing to put it in without the rec the the request for the waiver the modification but without going super technical they're here to put things in and if we're not allowing them to do so have they met whatever the original agreement was i i don't know i have to look at the the document that's what i'm trying to understand based on the what if if uh moving forward okay thank you yeah and i want to clarify staff's position on it uh too i mean we like i said we did go back and forth there was considerable discussion with them on this i mean reluctantly overall i mean i really weighed heavily on us but we did think that having the ev chargers there you know i mean we're kind of looking at uh you know building i guess uh ev sort of platform within the city we do have some locations we think that this would be uh in addition uh to those locations and overall would be beneficial to to have it uh with within the city right we'd like the ev stations as your position but based on their position of the color and size we we've hit a conflict it was snack but overall we just said let's move forward we'll try to deal with it right we'll we'll try to deal with it with the landscaping or what have you but the condition also requires the subdued colors and i that's what i want to be clear on is that if we were references for the subdued colors but if we can't do it we're okay with moving forward and we'll try other means to try to uh you know buffer it okay i'm sorry to belabor it but that's not how i understood what you wrote what what's in the memo because if the way that i understood is that if we approved it subject to the conditions one of the conditions is um the request for the subdued colors the colors to be approved by the city so it's not a it's not a maybe it is part of it's a condition yes okay so that's our preference i want to be clear on that our preference is to have it subdued okay but uh i i it's not our desire to really have it it killed but that's one of the things the word matters we've dealt with this before mr holmes and so this that's why i'm asking for the clarification because if it's only a preference then it is not a condition it is a suggestion um it's not something that's required so are are you are you telling us now that the condition is not a requirement for the subdued colors right i would modify that to our recommendation or suggestion because it we did recommend approval on if i was holding strong to that we probably would have recommended denial okay thank you council member fadgen did you have anything else just real quick the original approval it was for capable not ready right so we asked them to i think it was for capable i have to go back and look capable so i mean okay i can't yeah that that's that's what i remember okay that's it thanks okay i i understand that this is the only option with iona and i i understand the um the branding that they have but this is a major intersection in our city um and removing some of that landscaping is going to make that even more visible um i also don't think it's consistent not just with the midtown district but with the design of the wawa so um i understand we want to build that network i am unless you are able to come up with some way to shield these from view which i know also goes uh in opposition to what you're trying to do is to attract people and let them know that you have them um i can't support it because i just don't think it's consistent with what we're trying to achieve in the midtown district so um with that if there are no many no other comments on the dais i'm going to open up to public comment mr uh mr corman did you want to come up and comment on this go ahead welcome sir rob corman 11095 yes i understand the instructions um so a couple of things on this one when we when it came through yes it was issue of capable and the assumption was that they would actually go ahead and put charging stations in because obviously law changed now all that's on the table so what we have is a business that's that's willing to put something in do i love those colors no but at least they kind of match the dolphins so you have some kind of basis to say yay go local team um it is a marketing decision that was made by wawa i don't know why they decided not to go with their own colors but i do get the idea some ways that that looks like a gasoline pump which allows people to make the connection on the image that had the landscape plan what they're talking about is decreasing the buffer from 15 to roughly six feet but if you looked they had what i counted to be roughly 20 something black circles that are in there that are going to be some kind of covering covering plant that is not currently in place if that is the case and if it's something on the order of a calusia that you could actually grow to a six or seven foot height it would still allow you to see the wawa building to know what it is but it would functionally shield that particular those particular devices from the general roadside view and what you would be where you would be looking at it is if you were actually driving the back side which i guess is technically the front side of that wawa uh going around the building so really the question shouldn't be whether or not it fits but rather whether or not as a city you want to prioritize ev charging in any way possible because you can't count on corporations to keep the general design aesthetic moving forward especially as technology changes so if in fact the conduit is laid the transformer is there and all that's involved is swapping out a machine at some point somebody in the wawa boardroom might very well come to the conclusion that these don't fit with where we're going we do actually have as silly as it seems and out with the colors because we can shield them effectively and if we can shield them effectively from the roads that's what's going to protect the view and the aesthetic of midtown as opposed to saying we don't get why this corporation is particularly doing that so my personal opinion is if that had come before planning and zoning those same questions would have been asked but conditional because you are correct councilman ryanstein that that suggestion versus condition is something that needs to be made well if it's a recommendation that they're going to put those in then we can make it conditional that the landscaping that's around there truly does hide it from the road because it will not impact the wawa signage so it will not impact the company that's my opinion on that one thank you mr corman and that would be my suggestion if someone's going to make a motion that that be a condition uh anyone else from the public right do we have a motion council members can i make another comment please sure mr corman thank you for those comments um and i'm not going to make the motion but i if anybody who does i would suggest that it does include the conditional um landscaping because that makes sense to me i've said a number of times that i'm not a fan of micromanaging when a when a business wants to have a certain color or they want to do something a certain way as long as it doesn't stand out in a way that would negatively affect the the general area in the community and i i would like to maybe just ask the applicant in terms of the ensuring that the landscaping would do the job of of maybe of blocking the view or protecting it or of at least um responding to what we've talked about can maybe you can just come to the the microphone is that something that we have the um that if that motion is made would we have the assurances would that be something that would be agreeable uh from the applicant yes sir thank you very much so i'll leave it up to my colleagues all right do we have a motion all right i will make the motion uh for discussion uh i'll i'll make a motion to approve with the conditions set forth that the landscaping that is put in will effectively shield um but with the first condition as to to staff's comments uh that all attempts be made to try to lighten that color and i i know that may not be able to be done but um most effectively to be able to shield that with landscaping the view from broward and pine island do we have a second i'll second that i i do want to can i uh a point of order um and i want to mr holmes uh and again just from maybe from some past experience right is that based on this discussion and the the detail of the motion is that something that um that your department uh understands at least have we given enough detail in terms of what is being sought from the dais as it stands right now basically you're asking to make sure that the landscaping that is put in which is calusia which we think is an appropriate hedge which which we did talk about in terms of the size that could grow out and up to kind of cover uh that area which so we think that that is appropriate but that you're asking to make sure that we have an appropriate landscaping and that we there be attempts to for them to continue to look at uh maybe if they could get a different color to go in uh so approval based upon uh those conditions very good thank you thank you thank you councilmember anderson sorry the uh perfect occlusive that's good because um but do we aren't those pumps taller than six feet tall they are do we have a code that says our hedges can only be six feet tall so therefore we have to enforce our own code on ourselves on them if it is our desire to this can be a part of the you know the requirement the condition that you're saying now that it must cover the the pump i understand but if don't i think we have a code thing that says our hedges can't be taller than six feet tall our motion includes an exception it there for commercial we do have provisions for like uh walls and other things that the council does have the ability to modify that uh so that is within the code as well for buffering purposes so just like with our our walls and stuff uh so i'm just i'm just making sure we take that into consideration and right so we are consistent with with this this would be consistent with the provisions in our code okay what is the height of the actual ev charger it's about my height it's a little my height right would you like would the applicant like to answer when you see a man standing there and it's way taller yeah yeah it's a shorter i don't know if that's me not it's approximately eight feet tall excuse me council members the applicant has answered they're eight feet tall yeah approximately yeah if you look at to this i mean so you you have this pump if you look at to this uh little uh apparatus here it's uh that's showing about eight feet right there okay i'm not sure if that comes as part of the pump or not if it can be removed does the top piece have to be on it looks like it's like a number yeah it's to help to note the stall number as well as the plug type there are two different type of plugs on the market so some kind of sticker on there instead of this thing it makes it taller it is part of the branding i will say there is a great difference from the berm and the public right away we're trying to brand new town yeah fair enough okay anything else council 0003 consideration of request to approve zoning waivers for fort lauderdale country club the property is located at 415 east country club circle and is zoned s dash gc golf course i'd like to go ahead and make a jennings disclosure i did visit the course and see this site and it will not affect my decision good evening council mayor city attorney city clerk michael albert assistant director the applicant's request is for site plan modification to construct a new 4 000 square foot prefabricated metal maintenance building with a corrugated metal roof for golf course operations that is not constructed in the same style quality and appearance as the principal building there are three waivers from chapter 27 of the city code property is located here south of broward boulevard north of peters east of the turnpike on the fort lauderdale country club site just the golf course itself is zoned for golf course sgc it and it's a commercial recreational use neighboring properties beyond the golf course are pretty much residential single family zoning districts as depicted on the slide and also the community facilities so here's an aerial map and we we zoomed in to because it's a very small building on a very large property it's roughly 228 acre site overall but beyond the golf course limitations surrounded by single-family homes on most sides of the property there was a 500 foot radius denoted in the purple line 15 notices were mailed to surrounding property owners there were no objections and here's the location within the golf course site so roughly 229 acre parcel 4 000 square foot metal building with a corrugated metal roof and it is screened by landscaping and hidden from view of patrons and surrounding homeowners and it is also deep within the site so here are some drawings of the specifications so the waivers are from section 27 300 a 4c which states that the exterior walls constructed with metal panel shall not be allowed metal buildings shall not be allowed section 27 300 a 4d which states that metal roofs visible from the building exterior shall not be permitted however standing seam metal roofs shall be permitted and section 27 300 a 4e which states that accessory buildings whether attached or detached from the principal building shall be constructed of the same style quality and appearance as the principal building based on its location within the site staff feels that it is compatible that it is compliant with the comprehensive plan and it is consistent with the criteria for the waiver and therefore we recommend approval thank you mr albert i'm going to jump in first since i did visit the site i don't know if any of my colleagues did this is in the middle of the golf course you cannot see it i went out on a golf court cart you cannot see it from any homes it is obscured by trees um to me it made sense to have a metal bill i mean there was no bathrooms or anything it's really just to store equipment so i just wanted my colleagues if they had not visited to be aware i mean this is not visible from anything and for it to be what our code says it must be compatible with the main building i mean if you look at fort lauderdale country club um be a little bit ridiculous to build a building that looked like the country club and match that in the middle of a golf course to house equipment in my opinion so i just birthday mr albert all right and i just want to say if you haven't been out to fort lauderdale country club they're doing some great uh work out there it's absolutely a beautiful restoration item number 20 pp 26-0012 consideration of a request to approve a zoning waiver for cairo works injury center the property is located at 69 91 westbrower boulevard number 100 in his own b-2p central business mr albert michael albert again this is um presentation for cairo works this is a waiver request from section 27123 which requires 79 parking spaces based on all the uses on the property to reduce the required parking to 64 spaces which is an 18 percent reduction property is located here at 6991 west broward boulevard it's commercial zone surrounded by other commercial zones except to the south where it's which is single family across broward boulevard there was a 500 foot radius for notification 21 properties were noticed applicant is requesting a waiver to reduce the required parking from 79 to 64 with an 18 percent reduction the waiver will allow a chiropractic medical office in unit 100 the space is 3 373 square feet it's a permitted use in the b2p zoning district the change of use from general office which was a real estate office previously to medical results in an increase of 11 required parking spaces and upon investigation of the required and provided parking spaces for the entire building staff determined that a four space deficiency currently exists on the property therefore a waiver of 15 spaces is required to accommodate the proposed use and bring the center into compliance these were in your backup also but just showing the the difference with the pat vance realty office and then with the new proposed use for the cairo practice center we feel that it is compatible with surrounding development and meets that criterion that it is compliant with our comprehensive plan and meets that criterion and is consistent with the practical difficulty waiver criteria and meets that criterion and therefore we recommend approval we have not received any written or verbal objections and there aren't any code enforcement cases on this property so as i said we recommend approval and subject to staff conditions in section 5b of our report thank you mr oppert mr uh mr council member reinstein thank you one of the last things that you mentioned was there's no um no code enforcement violations um my my question concerning that is that in the staff comments um specifically set forth that there's an existing non-conforming box sign of the building explained to me is that if if there's a non-conforming box sign that would sound like it's a violation of our code since staff comments planning and zoning under number five signage b and you bnc and you have a picture of the non-conforming box sign okay so maybe there's somebody who can comment as to how we have a non-conforming box sign but no code violations yeah we'll have to look at that if it's been there and if it was legally installed and our code has changed and becomes legally non-conforming then uh there's no violation and i'm not quite sure what uh staff was trying to identify there yeah yeah so my guess is that it's legally non-conforming i don't know that for sure and i think that's probably what they were getting at uh in terms of the staff comment so it it's it's legally conforming then uh it's currently not it's non-conforming if we were to apply legally non-conforming would mean that at the time that it was built it was consistent with the code a permit was pulled and it was done legally we have subsequently changed our code and so it no longer complies with our current code but at the time it was done it was legal so we call that legally non-conforming and it's allowed to uh remain well that that's that would be my question then is that if it's allowed to remain then it would seem that they don't have to change it so is it saying change i didn't catch that shall be removed they're changing the face of it i mean that it says shall be removed which would seem to tell me that our procedure for that is that they have to get a signed permit for the face change for the name change it was just replaced whatever panel was in there before okay so if we were to approve it subject to um planning and zoning's comments then they cannot proceed until they make this change correct okay so again i just want to fully understand the process is that um who then verifies this i mean how tell me just how we do that in terms of our city process they would have to come in and pull a permit to change the face on it and then we would go through the process of approving it they met you know all the other criteria color wise and everything else has the applicant agreed to this i mean is it is there an understanding of the applicant that this is required i i don't know if staff talked to the applicant this was this is in the report right so the applicant has been given a copy here of the report yes it really is good evening guys i'm dr motoro so they made me aware that um i have a clinic 50 feet away from here so it's an urgent care so i'm expanding and the the owner of the building needed it zoned and developed now he told me that it was approved years ago but he said exactly what you stated stated that you guys might say something about the color or um but he told me i need to get it zoned properly so and just to be sure i mean you were sworn in you understand the rules and um is that correct doctor correct okay so again just just understand the process is that i read the backup that the department gives us and the department has this information here and i just want to make sure that whatever we leave here with today it's clear as to what's required so that you're actually fulfilling what is being voted on tonight so based on on what's set forth here is that if it's approved subject to the conditions whether it's you or the landlord whoever is going to make the change to the sign as required by our current code right you'll be required to pull a permit and comply with the standards to replace i know you understand that item number 21 pp 25-0022 consideration of a request to approve a zoning waiver and site plan amendment modification for 8601 west sunrise boulevard redevelopment the property is located at 8601 west sunrise boulevard and is zoned b-7q planned community development mr helms okay thank you uh as indicated uh as indicated application pp 25-0022 this is a site plan amendment uh request and as part of this amendment request there is one uh additional zoning waiver from chapter 27 of the city code uh the uh the item the uh site is located 8601 west sunrise boulevard you can see it there located on sunrise uh just uh east of north pine island road the uh size of the parcel is about 13.723 net acres and 16.83 gross acres the uh underlying zoning is the city's b7q plan commercial development district existing use uh is now a vacant property as you know previously uh the atnt training facility was there it was uh demolished uh in 2025 so it is now vacant uh the underlying uh land use is commercial and uh in terms of zoning to the north is uh zoning that is within the city of sunrise to the south is the prd 16q and to the east is b7q and to the west is b7q and b2p and this is a aerial map of the site so you can see the the property there um the uh again to the north uh there's single family residential in the city of sunrise uh to the south of the site uh is the uh sunrise boulevard and jacaranda heights uh living assisted living facility to the east are office uses uh which consists of the pine island commons and the social security administration office and to the west is the canal and commercial and office uses again you see in purple the public notification boundary there which is a 500 foot boundary for this site within there there are 171 notices mailed uh to surrounding property owners uh just to kind of go over everything uh the site plan amendment uh approval is to modify the previous site plan approval which primarily provides for a overall less intensive site development uh it includes a reduction in dwelling unit count uh decrease in building height uh on the site and a decrease in uh some of the commercial leasable space as well which i'll kind of go over in a little more detail in fact that's this this chart kind of uh summarizes uh what some of those changes are so first of all the number of residential buildings in the previous site plan there were eight buildings uh that comprised the previous site plan which i'll i'll show that in just a moment uh it's been reduced uh from eight buildings to seven the number of retail buildings uh because of the reconfiguration uh has been changed from three buildings to four the overall uh unit count there were 512 dwelling units approved as part of the previous plan this plan uh has 385 dwelling units commercial uh leaseable area has reduced has been reduced as well because of some of the reconfiguration from 25 477 square feet to uh approximately 12 105 square feet the tallest building uh on the previous site plan was eight stories now we have uh like six stories and some four-story uh uh multi-family buildings uh the garage uh kind of went up to eight stories so because of the overall reduction in the number of dwelling units uh the garage comprises uh two stories so that's a significant reduction there garden apartment buildings uh in the previous plan there were five three-story garden apartment buildings in this plan there are three three-story garden apartment buildings townhome ownerships we actually ended up with one additional townhome under this plan and uh there were changes also based upon uh some of those uh the changes in the building heights and the building heights or what have you in terms of the unit mix the previous plan had 28 studios uh this plan proposes zero studio units the one bedroom uh unit count under the previous plan was 296 this plan proposes 180 two bedroom count uh under this uh previously was 80 under this proposed plan it went up to 150 uh units and the three bedroom unit count uh decreased from 93 units to 39 units so that's a overall pretty good summary of uh kind of some of the changes uh this is the uh current approved site plan uh so you can see this very similar in terms of the overall entryway and general layout there have been some modifications uh under the old site plan this was some retail uh that was located here but the uh this uh sort of remains uh as as part of uh the multi-family building again some of the uh three four story multi-family is still located uh in this area and we have the townhome units uh which remain in the rear of the site which was also uh under the previous plan again as i indicated uh uh there's some additional but because of some of the reconfiguration of the retail here uh there are four retail buildings uh the retail before kind of snaked around here uh a little bit so there was three buildings so they added uh additional building and there's a little small uh retail building that's located uh here at at the entryway uh as well and then this was a previously approved plan just so you can see i cut we kind of did uh it's a little smaller there but uh we wanted to kind of give you a picture of what was changed from the previous plan to the current plan in terms of some of the configuration again you'll see here that uh some of the the retail that was here has changed again you see the two retail buildings here there was one uh retail building located here one retail building here there's still uh retail building here with a smaller building located there uh and some of the reconfiguration of the multi-family in the center here has changed a bit uh and again the uh the townhomes remain uh at the very rear of the property to the to the north so not there's some modification but overall there's a general layout and theme that's very similar to the previously uh approved plan they're also proposing our phasing as part of this uh so as as phase one they're proposing uh installation of all the site utilities under phase one and then all four retail buildings and the surrounding parking areas uh and also building two which consists of 107 units and surrounding parking areas so this is uh building uh two which is located here and then you've got some of the retail and again of course they would put in the site utilities and stuff uh under that first phase second phase uh would be building one which consists of 142 units uh the parking garage and some surrounding parking uh area there um the time frame that this estimated for phase two is 20 i think i forgot to mention it the time frame for phase one was 18 months and then phase three would uh be the very northern end uh of the parcel uh construction of buildings three four five six and seven which is approximately 136 units including the surrounding parking areas with an estimated time frame of 22 months to construct uh phase three so that kind of gives you uh an indication of the of the phasing that's proposed these are the elevations uh the architecture has not changed uh much at all very similar to the to the old plan uh building height of course has has come down uh as as indicated uh and the the retail uh continues uh uh with with the same architectural style the townhomes are very uh similar architectural styles the previously approved plan as well and again this is just some of the uh elevations uh of the various buildings there and uh the the colors pretty much remain consistent with the previously approved plan as well more pictures there and this is the landscape plan uh and that's just broken down into four different sheets so we'll just kind of put that in there just to show you a little more detail of some of the landscaping uh and as indicated uh the waiver the waiver uh pretty much uh deals with um just building six and seven um and it deals with the building height and uh you'll see that uh the required building height is a setback based upon one and a half times the height of the building uh so for these buildings and i'm going to go back to kind of show you that the height because of the way the townhomes are built you can see that uh this point uh here along uh the very north is higher even than than this point so that's why you see the difference in uh the setback that's required on the north versus the west and the east and while you have a difference in the height that's requested there uh in terms of the setback so on the whoops so on the uh the north you'll see that there is a uh 30 foot uh setback that they're proposing the required is 42 and on the east and west uh the required is 39 they're proposing a 32 foot setback on the west here and 32 foot six inches uh on the east here and that's again based upon the difference in the height of the of the of the roofs there uh community meeting was held on december 4 2025 at the central park multi-purpose building uh the uh the applicant uh the meeting was held for the applicant to present the plans again to city residents to kind of go over the modifications that were proposed the provided sign-in sheet indicated that there were four persons in attendance at the meeting uh to date the department has not received any emails phone calls or any communication objecting uh to the proposed plan and also in terms of concerns issues or other pertinent information at this time we know that the subject site does not have any reported uh violations on the site just like with the previous plan we found that uh this this uh plan is uh is generally consistent and compatible uh it's compliant with the comprehensive plan and is consistent with uh various sections of the code dealing with the site plan and the uh practical difficulty waivers and based upon that we would recommend uh approval council member andreu and then council member fadgen thank you president horland what was the commitment to affordability mr holmes for this there was 10 percent um let me go back in i thought we identified it in one of those in terms of the overall number there was uh 10 percent which uh it's not uh on there which amounted to 51 30 it's in here hold on 38 38 38 units out of the total here and it's going to be 10 for each of the different unit types okay do what do you want me to wait until we hear from mr laystrom i don't know if he was mr laystrom i'll wait mr holmes is done you may and you might answer some of my questions in your presentation bill laystrom i understand the rules 9701 c turtle um thank you for the evening tonight i probably everybody's looking at this smiling you know we should have done that the first time i won't i will accept that um so related had the opportunity to re-look at the site plan you know look at market conditions absorptions construction costs we actually you know go out for pricing um came to the conclusion that the project needed to be we call it right sized so we've reduced the the height which i know was a extreme issue when we first met from eight to six what we did with the retail was we the only retail we took out was retail that was in the eight-story building uh little nuances we also if you remember there was those weird two townhomes that were in that building the part of the reason for the setback is in addition to adding a unit we moved those two to that back row so that they're all together so there are no townhomes in the front building anymore um we also when we did do that if you look at danny if you could put up that just the site plan um because i wouldn't know how to use that anyway so on the retail very quickly you'll see the i call them the black dots what we did is we activated the the retail with the idea of doing restaurants and so the black dots are actually outdoor seating so you see what we did even though the square footage was reduced we actually increased the kind of activation of of a restaurant that would be on the lake and also one that would be at the basically the south side of the other building so the buildings got smaller but we kind of took the restaurants out of just a solid building and so that they actually get to stand alone a little bit but otherwise the site plan is almost identical to what what we did the same architecture if i said if i said that there were any changes there were two three-story buildings in the dead middle and that those two three-story buildings were now turned into one four-story building it just worked better we centralized the pool component the the townhomes are still for sale i repeat for sale as i was looking at the phasing plan i did see you know i wanted to make a commitment on just to make sure that we we put those in if you want to make a condition i thought perhaps that condition of approval is that we pull the building permit for the townhomes at the same time we pull the building permit for the balance of those apartments that way you can ensure that you get both being done at the same time i think staff would probably do that anyway because it's all part of one phase we have all the utilities in the first phase and the retail i will go in with the first phase as well i'd like to answer any questions uh if you think about the traffic the traffic goes down significantly with this i will still do the same affordable housing commitment and yes we we are intending to make it consistent ten percent of each of the different components so there would be ten percent of the one bedrooms two bedrooms and three bedrooms as part of this approval and i've kind of shortened it up i do have a presentation that i'm going to skip which basically does a comparison page for each of the buildings each of the elevation but they look identical the townhomes are the same and again the setback is merely from the very edges i did send the plans to mr lethbridge um miss gelfand and uh the city of sunrise both the the zoning director and the uh community development director um ms gelfand at least at the um at the uh citizens meeting was happy to to see that the project was was being reduced and certainly clearly indicated to me that i should have listened to her before yeah thank you mr laystrom um councilmember andrea you have further questions i don't know if you're at liberty to answer but can you share the reasoning for the right sizing so so when you when you take a look i i let me also add this comment because when some of us made the request initially right we were told financially it wouldn't work that's correct so how did it work out financially now so so when you take a look at the construction costs and the way the construction costs get added in you'll see that the garage went down six stories those garage spaces are thirty thousand dollars a piece because by taking the units down we could do mostly surface parking and the same thing goes with the retail the retail parking it was was in the garage as well which let us reduce the the garage so it it basically is a is a cost thing um trying to make it as i said kind of fit the sweet spot for most apartment buildings you'll see that i brought forward are in the 300 to 400 units and the five five twelve was just too much you also with the eight stories you end up with the costs of what i call a high rise instead of a mid-rise although the city has some in-between requirements for smoke evac very expensive um that go as well but i have uh mr john ronko with related here he's happy to kind of go through their their cost assessment process we do a cost analysis at the very beginning of a project as part of making that decision but those are very rough costs then we go out and we start getting bids and then the bids tell you how much the the building's going to cost to build okay thank you council member fadgen thank you council president orland um first i'm going to make a jennings disclosure i spoke with the applicant today and it won't affect my uh vote um so the first thing the phase that was addressed uh retail is going to come first correct okay where's the parking for the the retail i mean i see the parking on the east side is the park is the parking that's on the uh the street that's west of the roundabout is that going to be open for public parking hey oh okay sorry i no so we have the parallel parking parallel parking here oh yeah yeah that's what you wanted right top left corner yeah yeah so so for the retail parking we have parking here parking here we'll also be using part of the parking here and then these are all parallel spaces okay so that's parallel yeah so i kind of recall on the previous plan like the street that's on the east side was that is that going to be gated or can try to get my arrow okay so i'm on the east side yeah but if you go north okay all the way up no you're going west yep that's what i said okay so i mean hey this is your site plan right so so you mean to going down the going down to well i'm looking at the road that's along the uh the apartments to the north of the retail okay keep going to the right yeah so is this like reserved parking for the residents this will end up being for the residents yes but the retail people might have access to that and yes i don't believe we have a gate okay so is the parking that's on i just want to make sure that we get we get an answer for you in the record but yeah so so that that parking will be basically available for both oh it'll be available for the residents and for people that correct trying to go to the retail right okay and then so the the road that's um west of the roundabout that would be available to the general public who are going to the restaurants and such that is correct okay um sorry i keep this thing work i think this plan is a lot less busy than the last plan i i told uh mr laystrom today that i kind of regretted my vote i regretted my vote um so i'm glad that you guys reassessed this and you kind of determined that less density it's calmer i think it's going to be calmer for the people are going to live in there so the only thing i really have a concern about at this point is and i'm happy that you added a townhouse to it you know pulling a permit for the townhouses is great it shows some sort of commitment but i mean you guys run out of money you're not going to build them so i mean like i don't know how can we get to make sure that those townhouses get built because you know i don't recall us approving anything or even being proposed to us for ownership so i appreciate that you've incorporated some ownership in this development um because you know i've said it i think we've all said it like you know renting is not going to get us out of the crisis it's got to be ownership well and so let's let's talk about what i call the investment is the reason i tied the building permits is because the building permit fees alone for us to get to the point to pull a building permit do all the construction drawings probably going to have a quarter of a million dollars in yes sears had permits though too we'll also well yeah but for these are 16 townhomes not you know 20 million dollars in construction costs and and remember at the very first we'll have put in all the infrastructure so not only what you see on site but we'll have built a eight hundred thousand dollar lift station we'll have millions we're building a a force main that runs from this property down to the mercedes center so the the investment will actually be overwhelming but i'm we're open to is there any way to and i kind of is there any way to include the townhouses part of phase one i kind of understand people might not want to buy for a construction site for the next three or four years but and they'll be trapped behind the the construction work for the rest of phase three would be the challenge i know where you live so yeah and i know where he lives okay so i'll get you and we all know where mr we'll go down and go to the head head head dog yeah but council member fadgen that the townhouses were in the previous one i just oh i thought you made a comment that they were not they added one they just added one okay added one and move two yes thank you council member reinstein um first wanted uh while we haven't spoken recently i did want to make a jennings disclosure from our prior conversations in regards to the project and those conversations won't won't affect my vote uh just just to be clear in terms of what's before us is that uh the project was previously approved and you're now coming to us to reduce the size of the size of the project that is exactly and so hypothetically is that if the reduction wasn't granted tonight you would still have the project in its prior form we would have to plan to go forward with the larger project and so um if i recall correctly from at least my comments in our prior discussions and i actually voted against the project in um there were a couple different sections to it uh and my biggest concern was the size of it um and uh you you're now reducing it which i appreciate because that was that was some of the biggest concerns that i had heard from residents as well and those were were my concerns as well thank you for for whether it was because of the the uh the cost or because you were listening um either way it uh moves in the right direction we'd like to think it was both thank you thank you any comments council members council member anderson uh attorney morgan do if we made a jennings disclosure disclosure on the other one do you have to make it again if i've not talked to them in the meantime the the prior approval no because he already approved but if you want to just say the prior approval you spoke to him and i want to affect your vote on this but this is a new application yeah right and i haven't talked to him about this i mean i read it all i read but i read the documents that's publicly available just just to be safe just make just make it i will i don't think you have to really require but to be safe you're saying do it okay so i'm making jennings disclosure i prior long time ago met with the applicant on a much bigger project and this is scaled down and it won't affect my vote thank you i'd like to also make a jennings disclosure i met with the applicant and spoke to him on the previous one but also um read his email regarding this one as well and responded and it will not affect my vote thank you i'll make the jennings disclosure i did see the updated plans that will not affect my vote so um any other questions for the applicant all right we have a couple of uh members from the public mr corman did you want to come in on this one and then up on deck will be mr millen sir rob corman i understand the rules um oh this one ticks me off a little bit and it ticks me off because when all of this was going through the process the issue of affordability was brought up with the developer and the developer basically held the line hard saying nope we're not going to give you 15 we're not going to give you 18 it was hard at 10 for 519 units so 51 units were going to be affordable and everybody's argument was look how this we're going to get 51 units and 15 townhomes that were ownership and the ownership component in a lot of ways distracted people to say hey look there is this ownership component so this is going to be great now they put one extra ownership component in there took out the design flaw that they had in their own plans which was pointed out in this room at a hearing here uh why are those two here and not put in the back oh because this is what we're going to do with it in addition to really large square footage on what's pink on that diagram right up there a little bit of the same thing was just thrown at you and i don't know if you noticed it because if you take a look at the layout of those four buildings one of them is small i'm assuming it's a coffee shop of some kind we live in south florida most of the time it is not 75 degrees and comfortable so in the summer time when it's humid and it's raining the argument is that all that outside seating is going to be useful and practicality probably will not be as such that is going to impact who goes into those spaces and what the actual revenue is going to be for it but the bigger issue is that the pink has been reduced and what we have now is residential that is clustered into what amounts to five buildings up there the question was made why do we have separate buildings before well they that's just what they wanted to do we brought 519 units down to 200 and or 300 and whatever it is uh therefore therefore cutting down the amount of 296 total there were we flip the slide back one so i can see what the actual number was because we used to have studios there there are no more studios the ones that were argued to be the most cost efficient for purposes of affordability so now we have 10 of one bedrooms thank you so we went from 296 to 180 so that's 18 one bedroom apartments no studios went down went up from 80 to 150 on the two bedrooms okay that's that's nice lost 60 something sorry 57 56 uh on the three bedrooms so we're not getting a lot of affordable housing with this yes we're getting a little bit of ownership but we're not they're not living up to the promise that they put in there the building as it looks architecturally they said hey we've put this beautiful uh design in place so that it will hide the fact that it was eight stories and i actually agreed with that on an aesthetic point same thing exists for what's going on the only benefit really is that the parking garage is going to be decreased so since i get to uh ask uh i guess cross-examine what's going on there my question is i get from an affordability standpoint that this developer is decreasing the size and the number of the units my question is why should we as a community approve this change when functionally that property has deviated extremely from what was originally promised to everybody here also can somebody clarify the build out time because if i as i did the math it was more than five years thank you mr korman mr ronko because i had a question about the um the studios can you address the um studios and where those one bedrooms are going to be located are they going to be interspersed throughout the park the property and is there the ability to take some of those and create uh studios john ronko from the related group i understand the rules um yeah so the one bedrooms will be dispersed throughout the property in the six-story building the four-story building and the three-story building um when looking at the floor plans and looking at the building layouts um we felt that it was best at the one bedrooms um were more they laid out better in the buildings and i mean we can go back and take a look at um changing the studios perhaps for some of that mix but for the most part we thought the best value and the best overall product to the renters would be a one bedroom product okay um i'm glad mr korman brought it up because that's what i had my notes and i'd like for you once we get to the discussion about approval or not um i would like to see some of those studios brought back in um while this council has spoken about affordability quite a lot and we appreciate the commitment to that uh i we've also spoken about home ownership um and so i'm glad that we have the extra townhome in there i'm willing to trade that off because we do have some other affordable projects that are coming uh also in that area especially on university and uh sunrise so if we could do a swap with some of those uh one bedrooms and turn them into studios that would be great okay another resident so i may have some more questions for you okay mr mcmillan and i'm sorry can he also address mr korman's concern about five years the timeline thank you for bringing that up can you address the the math didn't seem to end uh add up on the um build out is it five years if you wouldn't mind mr korman would you thank you council member andrea yeah so we're phasing it out in three phases first phase will be 18 months from uh commencement of construction right phase two would be 20 months and phase three would be 22 months that's all from commencement of construction so it is five years until those town homes yeah 16 months okay well it'll be two years are they consecutive yes it would be yes it would be commencing at the same time oh okay right so they're concurrent yes they're concurrent so it's not going to be one after the other okay and i think that's what wasn't wasn't clear okay great thank you makes us all feel better all right mr mcmillan i'm sorry about that okay good evening sir it's nice to stand j mcmillan west tropical way and i understand the rules um i wish you great luck i i like where it is i like what i see of other projects so i hope it's it does well for you i just have some questions because mr laystrom is going to be on a project later in front of you that that i don't really want to see but uh uh the there's some some numbers i'd like to get clarified the traffic study i don't know who reviews it here for this project for this project yes i'm going to question this project okay some numbers for later that i'll use um the the new external trips reduced to 1230 for this project under the documents presented that equals 3.2 per unit trips per day now if you compare that to water's edge and crossroads which you all approved and their traffic studies which are comparable in size in scope to the project without the commercial element their trips per day are 4.7 and 4.6 so i'm trying to understand how this project could be so much lower than the other two projects which are equal in scope as far as the amount of traffic and i don't know who in the city reviews i know we send it out to somebody else to look at it and they verify it we usually have a traffic engineer that looks right at it so is that your that's one of my questions okay let me have our city engineer come up and see if she can address that for you oh you do okay thank you good evening samira shalan the city engineer of city of plantation so as mr holmes indicated this project resulted in overall in a less intensive development so what we asked the applicant is to do a supplemental traffic study um comparing the existing approved project to the less intensive project and as a result of that comparison that was the reduction in uh trips generated by the current site plan presented in front of you uh to answer your question the traffic study was submitted to the engineering office and it was reviewed by the city engineer the assistant city engineer and our consultant and was approved so if you would like a copy of this traffic study i will be more than happy to provide you a copy of the details the conclusion is based on what we call the international traffic engineering book so trip generation based on the usage of the site so there is a residential component there is a commercial component and we use the what we call the ite book to generate the trips and as i said i would be more than happy to provide you that traffic study for this project and comparable with the other projects too okay thank you mr and i know it's late it's okay go ahead the density calculations the letter that that mr lindstrom sent you know i need a trigonometry to figure it out but um i do have a question concerning that they use 16.8 acres for the calculation um is that a dash line calculation i mean i don't understand how they came across because the tax authority has the dense has the acre just 13.7 acres which would mean your your your density is above would you like to yeah thank you mr lindstrom so so when you look when you take a look at density under the because broward county sets the regulations you actually review the acreage of the site plus one half of the right-of-ways around the site with the assumption that you probably gave that property to the county or the city back back in the day so for this one you'll have a net acreage which is the site that you see but for density you also get to include the half of the right-of-way which in this case would be sunrise boulevard so my guess is that would be what would make the math work and then in this particular case we did flex units with um the affordable housing component and of course you get a a density increase for that thank you mr lindstrom mr mcmillan so it's it's a county rule not a city rule but and i'm i'm happy to because i know the other project and by the way we have the same traffic engineer so she can can we can address your comments i'm happy to sit down and go through the calculation either thank you mr lindstrom thank you go ahead mr mcmillan last question i'll get us all out of here on affordable housing uh the lena apartments right down the street from you all um are you going to market your apartments because they're similar in scope and size at about the same prices market right right so lena has 32 units still open the average price for a one bedroom is 2100 to 2800 for a two bedroom and 3500 for a three bedroom the county rent limits for affordable housing under 120 percent which is what they're getting their bonus density from are 2500 for a one bedroom 3100 for a two bedroom and 3500 for a three bedroom which are all well above the market rate so my question is if the market's below the affordable housing rate what are we giving a bonus for in it and since we have 11 new apartments coming online in the next few years that have already been approved do we all think the rates are going to continue to rise dramatically or go down so that's my question is if the market is already above or if the the market is already below the affordable housing rate who are we helping mr playstrom would you like to address that so i first i'm just going to say that i don't have those numbers you can certainly provide them to me and i'll help i'm not a professional too by the way for a response but typically what happens with the affordable housing component because it's based on median income rents will vary all the time year by year and sometimes it'll be very close but most times the accordion it's like an accordion it goes further away so what you'll find is is the rents do get closer and go further away um i would be shocked that we're upside down um that's why i said i'd want to take a look at at that issue but i'll put that calculation together and try to have it for next tuesday okay i know i know so but i'll try to have that i'll have it for next tuesday at least to make sure i have it because again we'll use mr duke for uh affordable housing and our uh market studies thank you mr leicester okay come to the mic come to the microphone please we do a conveyance for affordable housing is that how it works like how do how do we as a city know that a person in need is getting the affordable housing so the do you want to answer that i i could answer it but i'll let you go ahead and answer it because go ahead so so so the first first part is is we have to do a deed restriction for 30 years uh for each of each of the units it's one deed restriction for all of them but basically there'll be a deed restriction that requires us to limit it to 120 percent and in the case of the uh where the county has provided those units as well we have to provide a certification um every year stating that we've followed you know the rules there are some nuances for instance okay well how long can you stay in the apartment after you're over 120 percent uh do you get do you have to immediately be let go the answer is no i do that on an annual basis because every lease is usually a year so but at the end of end of that year you have to qualify again so the county audits you so we're new to affordable housing units the county does audit the affordable housing that they control but the city of plantation we haven't had an audit yet but i'm certain that we will do it and the city will have an option to do that um if they want to do and we've got to create a staff to to do it but yes okay thank you mr leicester thank you oh no it's all right thank you mr mcmillan that's what we're here for council member fadgen then council member uh no no the mayor and then council member fadgen i'm sorry um somewhat related to that what would the estimated cost of the townhomes be and i know market is crazy could you have a range um after reviewing the comms starting at probably 750 000 for the townhome yeah okay okay council mayor fad um just to the point of the audit i was talking with danny i don't know if we spoke about this in a meeting but at his office we're talking about the city actually doing audits of the promised um affordable housing units so um looking at those leases annual on an annual basis um hopefully developing a process to make sure that they're doing what they're promising they're doing so thank you um seeing no more uh member no no more members of the public have signed up to speak on this item any more discussion on the days do we have a motion well i'll make a motion to approve um predicated and we could take a look at swapping out some of those one bedrooms and adding some studios do we have a second second is that include the other conditions staff got okay um mr morgan yes yes sir yes ma'am um pursuant to uh florida statute 286.011 i'd like to um request the advice of the city council concerning pending litigation aka a shade meeting uh for wednesday may 13th 2026 beginning at 5 p.m the matter is mary lee's versus city of plantation that's briar county cac e 2600 6427 to discuss specifically settlement negotiations and strategies related to litigation expenditure in that matter if agreed to um a notice will be provided consistent with the statute listing all the appropriate items needed for that notice so agreed council so agreed all right okay thank you mr morgan for that thank you all right um comments by council members council member andrea would you like to go first this evening thank you president horland um just a few items so the alcee hastings exhibit opening will be tomorrow from 3 to 5 pm at the african-american research library and cultural center so anyone who can uh attend that event i will be there also looking forward to the interfaith prayer breakfast next tuesday may the 5th at jacaranda country club um i am very excited because pastor barry will be joining us this year too yes sir so uh we're looking forward to him attending as well and hga west side is having talk about because it's taco tuesday talk about breast health from 7 a.m to 6 p.m so you can get your mammogram you don't need a prescription or a primary care provider so great event taking side at hca west side um also we already said it but may 7th we'll have the ribbon cutting for the hca emergency room and the jamaica 5k will take place at miramar regional park saturday may 9th at 7 a.m with the council general and we're having also that same day the united methodist tea party at noon uh and i just want to wish a happy mother's day to all of the mothers and mom figures grandmothers aunts um so enjoy hopefully a relaxing day with friends and family thank you oh i'm sorry one more thing um we had a discussion at our um meeting our strategic planning meeting regarding the vacant lot that the school board owns on broward and hiatus and i remember that mr nudemaker and the mayor sent a letter to the superintendent and his staff requesting uh right of first refusal i don't think uh we've done anything since then but if we have i'd love for us to get an update in my conversations with mr nudemaker and i believe he's spoken to staff over at the school board um this property might be available via some type of bid or solicitation i don't know if we ever reach consensus but i would like to hear from my colleagues in the administration about this um i really would love for the city to purchase this property i've mentioned it before about doing some type of performing arts center on that piece of property or something else but um owning that piece of property i think would be a great asset for our city and also allow us to control some of our own destiny so just like to hear from my colleagues would you want it here or do you want us to get some homework and coming to you and put it on the agenda for two weeks um we can do a better presentation well i'm sure we have some um input so maybe okay an agenda item just offering it up yeah jason we'll have a discussion item okay just to give you the current status according to the school board they indicated that and this is as of 3 24 26 they indicate the consultants finalizing the remediation plan uh for the county review and approval specific remediation identifying this plan will commence following approval upon commission uh completion of the remediation and all clear from the county they will advertise the property for sale tentatively by summer 2026 the district has received offers from various interested parties but ultimately will it will be advertised for sale and we we never did get a response but that's kind of typical right okay and i do think that the consensus as strategic planning if i recall was that we did want first right refusal on that and we had talked about um you know and mr corman because we don't take comment at the stage of if that were to happen then we would have we would have discussion we could yeah go ahead and and put it on um an agenda item in the very near future because i think that we're going to see some movement happen relatively quickly and i just would hate to be sitting on the sidelines i agree give us give us a week to do the math and then yeah i think we can talk about it more intelligently okay yeah and i agree yes um i would like us to get our ducks in order for that to see if we would take action on that but i also brought up at the strategic planning that i would like to talk to the county regarding the vacant property on fig tree and peters across the street from heritage park for the possibility of a performing arts center or and and or more and senior center um primarily because there are no community centers south of broward boulevard and um in addition to that and i haven't talked to the fire chief about this does it make sense to move a station to that property as well um primarily hopefully have better access of the volunteers to get to this station whereas i think a lot of the uh volunteers that are going to station four coming from royal palm estates etc i don't i don't know so that's not conversation and and i we don't have to have that conversation right now but i i know we had discussed that as well i don't think a determination needs to be made on any of that just that we want to be open to in conjunction keeping our eyes open for that property yeah i think that's the main the main issue okay oh no absolutely we just want to make sure that we're looking at that property i'll wait my turn it doesn't mean that we have to purchase it but we need to uh see what's available yes while we're discussing increasing our operational commitments is this a signal as we are moving the budget process forward we have a commitment to our current operations then we want to expand those there's just a lot going on so i just want to make sure as we head into certain headwinds we were committed on that okay i don't even answer that but i just want to put that out there you're absolutely right we have to think about that not knowing what what's coming down the pike i think if we're considering purchasing a very expensive piece of land which i'm not sure like how the how the school board could give us first right of right of refusal i think they would we'd have to be in a bidding process at least as a taxpayer to the school board i would want them to try to maximize what they can get for that piece of property um i hear you on that but i'd want to confer with the city attorney to see for our purposes if we were to negotiate directly with a governmental entity we have certain latitude that we wouldn't normally have i think that's kind of the information we're trying to look for now regarding i don't know if it's possible but i would like to know what the county's interest in in um partnering on that sure piece of property because with live local i'm scared to death that they're going to put some kind of high dense you know they'll they'll just give it up because it's some um parkland that's not it's never been developed for as long as i've lived here since 1980 so um i want to play a little defense and actually put something in a part of the city that does not have uh a facility like that okay and i don't mean to be antagonistic but i just want to make sure that we're going in the right direction um as we explore these items well when we're talking about performing arts center for hiatus and broward we've we've deployed a lot of money out west out there and we got a pretty significant facility at volunteer park maybe we need to relook at that facility is inadequate you know i'm just sort of thinking like east and south of broward boulevard really needs to have some heavy consideration and i think i think with that property if the county's interested in partnering with us you know we can get more bang for the buck where we're not all fully on the hook with it now i know there's some trade-offs with that that you know not no preferential residential fees and stuff like that but um i think that's something we should be putting these all on the table for exploration i'm not saying that the school board property we shouldn't pursue i want more information on that but i also want more information on the fig tree property well and i think the point is that uh councilmember andre is bringing to our attention our attention that it's coming up and uh as mr nanomaker confirmed so that we can take a look at it and then and no decisions are being made um about parkland um as a member of the broward planning council we just put some protections in that i think parkland cannot be developed by right yeah well it's it's in the plan right now can't tell you what the legislature will do mayor mayor just real quick just just so you all know there are several properties that we often talk about have on the table go back and forth that we don't tell you all about that are kind of in the mix and if it ever gets developed into a plan you know we'll bring it here so there's stuff rolling around in the back of my head that's what i'm trying to say sure and and again no and i can't expose it yet but sure yeah and and we're just taking a look at all of that we just want to have our options yeah so there's there's more than those two right councilmember andrea did you have anything else on that okay thank you councilmember anderson um earth day celebration on april 18th um it was nice it was fun um i when i was principal tropical actually yeah i used to take it upon myself to whenever i well before i was even on council i would take uh city events and push it to all the principals and tell them to put it into their newsletters and push it out through parent links because especially events that are kid friendly and education kid friendly and um i i i still have done it after i left tropical but i haven't done it as much and i missed that one and i just felt there wasn't wasn't as many kids that i would want to see there being so close to tropical and plantation park so i don't know what we do to push specifically asking a favor to the principals to push it in their newsletters and things it's just to really get i mean that's all about educating the kids i was disappointed i mean the ones that were there was fun we did that that um that what was it the butterfly and feeder and yeah it was put on well i just wish there was more foot traffic that's what i'm saying last year we did it at rock the park remember we did it as part of rock the park right and that kind of that didn't work so that's why um i i did ask miss diaz and she told me that she had 1380 attendees so i thought that was much better than the previous year but i think to council member anderson's point and years ago um being involved in the school system the schools used to get that information i don't know if it came from administration or parks but i think that would be important for the principals to get out in their newsletter because i think we're we're missing a whole population of students that's how we got that award so i guess we have to up that communication um on that note yes you're not done i know but on that he brought up the earth day and i have some thoughts about the earth day and i thought we did a good job with it um i don't know i was there an hour and a half or so and it didn't look heavily attended so maybe a lot of people came afterwards um i felt like re relay for life co-hosting it with other cities really is it seemed to be the most lively one since covid um i don't know if we want to consider seeing if we want to co-host the earth day because dhl for example you're asking about the bicycles well they were somewhere else so um we make it easier on someone on a company that's a big supporter of it and be able to deploy all their assets to whether we're hosting it or davies hosting or whatever but i think that would be worthwhile um to try to increase our participation because i think we were competing against a bunch of cities so um and i'm sure they're all good but it can't be everywhere so okay thank you councilmember anderson any more comments yeah relay for life um it basically what councilmember fadgen said it's it's resurrecting it's nowhere near its heyday um especially considering that we're combining other cities um what's did i what cities were in were there with us it was it was davy weston cooper city cooper city but not sunrise no sunrise hasn't been with us for a few years yeah no last year they weren't it was the year before was that two years it was the same cities last year yeah they didn't participate last year yeah i know it seems like anyway it's doing better but again that's another one where as principal we really push the schools at it i i it's uh i know that sarah rappaport and um well once the american cancer society decided that they would not do the overnight that's when they lost all the schools it's very because the kids loved that you know camping out experience so anyway it was nice to see everybody there and still for a good cause and and and by the way this isn't a reflection the earth day was still done well by the city it's just we're trying to get we want to do such a great thing we want people there to yeah so thank you you're good okay councilmember reinstein uh first just want to quickly get back to the prior letter regarding the right to first refusal to the school board i i heard that there may be a question as to whether they can actually offer it or not but it may be worthwhile to follow up anyway and let them know that we still are interested in that property so whether it's a right to first refusal or it is just please keep us um advised as to what's going on um it may be worthwhile to follow up anyway and maybe just to let them know that um we would appreciate if they would respond to our correspondence the question in regards to earth day i believe that parks and rec had sent a correspondence out with a survey or had asked us for some of our thoughts in regards to earth day i know that i responded to that and just throw it out to director o'tool is that uh at some point in time whether it's the next strategic planning or whenever it may be is that maybe we can have some further discussion as to what worked and what didn't uh and as well as to the the vendors and um had some issues and concerns that i raised in my response but i'd like to make sure that we deal with that before the the next one um lastly is that april 29th which is today is observed annually um as uh end jew hatred day and we didn't bring a proclamation this year we did do one last year and um a lot of people ask what why is such why is such recognition necessary and if you were watching the news just this morning and saw that in the streets of london there were multiple jewish individuals that were stabbed by person searching them out in the streets and not too far from that location there were also synagogues that were being burned and unfortunately we're seeing that all around the world the increase in anti-semitism and violence against jews is only um is only rising and so while we didn't do a separate uh proclamation this year the grassroots initiative aimed at raising awareness and combating um rising anti-semitism through education public action and solidarity still continues so i just wanted to for for the record um bring our residents attention to our proclamation from last year and share the same words and the same message as the hate and anti-semitism have only increased and so for that reason we must continue to to say today and every day that anti-semitism or hatred anywhere is hatred everywhere thank you thank you councilmember thank you um my mom was in the hospital a couple times over the last several weeks she's doing fine she's getting back into a regular routine but she was at hca uh west side and i just want to compliment them her care was spectacular and uh nobody likes being in the hospital but uh they made it well and i thought that they deserved to uh be recognized uh because sometimes you only hear the bad things so um so my compliments to them and uh that's all i have have a good night thank you and i have no
