house welcome everybody uh i'd like to call to order the city plantation planning and zoning board meeting for may 5th 2026. it's 6 p.m if the city clerk will please call the roll miss gelfand mr stall yes miss denby burger here mr corman here mr freeman yes mr goldstein here mr de la grange here thank you all right first order of business is the approval of meeting minutes for march 10th 2026 does anybody have any additions or amendments to those minutes hearing none i got motion to approve is there a second and a second for mr freeman please call the roll all right miss gelfand mr stall yes miss denby burger yes mr corman yes mr freeman yes mr goldstein yes mr dela grange yes thank you all right due to the large number of people here we're going to have a switch in the order of the items because the shorter one is going to go first that way the people who are homeowners who have an issue before the board will get their issue resolved one way or the other prior to the lengthy discussion that will occur after so first one is a quasi-judicial item pm 26-0008 consideration of a request to approve a practical difficulty waiver for the mala residence properties located at 10062 northwest 13th court is owned rs 3g residential single family mr attorney if you would read the quasi-judicial good evening everyone if you are here on that item i'd like you to to stand for the duration so at the conclusion of my remarks i will administer the oath if you're here for the item that was just read pm 26-0008 consideration of a request to approve practical difficulty waiver for 10 162 north northwest 13 court p stand all right for the public and the members of the board of adjustment our volunteers please silence your phones thank you they're volunteers they're not paid to be here they're true public servants serving the citizens and their neighbors here in the city of plantation they're here to decide this application they're not authorized to change the city's code only the city council is authorized to do that they're going to be presented certain evidence and their decision is going to be based on that evidence presented here tonight decisions from the board require minimum of four votes for approval short of that four vote approval the item will be deemed denied this hearing is quasi-judicial that means the board is going to hear evidence and testimony under oath the property owner will be allowed to present whatever information or testimony they will have and then the city will go first and making its presentation on the application the board may ask questions of the witnesses and the witnesses may ask questions of the other witnesses at the conclusion of the evidence the board will open the meeting up to the public for our public discussion and close that public hearing and make a decision on the application here tonight with that being said if you're here for this item please stand and raise your right hand if you haven't already started standing you swear affirm the testimony you'll give will be the truth the whole truth and nothing but the truth you may be seated mr chair thank you uh city if you will presentation it's on hello good evening everyone my name is amy denter i am a planner with the city and as we have said we're here to discuss the practical difficulty waiver for the address 10062 northwest 13th court which is located up in that area plantation the owner is michael malay the lot size is 11 184 square feet and it is zoned rs3g and it is a residential single family home the subject site is developed with a one-story 3 658 square foot single-family residence with a two-car garage the house is located in jacaranda lakes on northwest 13th court and it is pretty much located within the entire community of jacaranda lakes 47 properties were notified and there was a radius of 300 feet the applicant is requesting to allow for a unpermitted garage conversion the homeowner has stated that when they purchased the property the garage was already converted and he was unaware of the circumstance that the work was not completed with a permit he also has said that he chose this house because it did have the extra bedroom now the code states that the a family lot with seven thousand five hundred square feet or more is to have an enclosed garage that can fit two cars side by side and then they're also supposed to have a side-by-side driveway parking space as well so this is how the garage looks as as it is right now so you can see where i don't have the light here sorry oops right here you can see this is the area that they had converted the previous owner with the bathroom and then this area over here can no longer fit two cars side by side this is the street view of the house the front of the house they still do have the um the garage door intact so it does look as if there is a garage and you can see here that they also have that side entrance into the garage as well so based on the analysis the request is substantial the code is very clear that we that these houses are supposed to have if they have 7 500 square feet they're supposed to have a two-car enclosed garage it partially meets the compatibility with the development patterns of the community again because the garage is no longer in use to house the cars the essential character of the neighborhood is preserved and the request can be approved without causing substantial detriment to adjoining properties the request can be due to unique circumstances of the property however if they had tried to go through the permitting the original owner they probably would not have been able to get the permit to do the to do the garage and for them to build another garage on their site they don't have the space for that however the staff does recommend denial the request thank you um at this time does anybody have any questions for staff from the dais would the applicant like to present good evening ladies and gentlemen of the panel um my name is michael kadosh and i'm an attorney here in plantation florida representing mr malah and we're here tonight on his request for the variance for the substantial hardship and as the city just presented mr malah purchased this home um not knowing that the conversion of the garage was unpermitted at the time um when he closed the municipal lien search didn't show or give any reason to indicate that there was any kind of a violation or anything that was abnormal and the house was shown and presented to him by the estate of the previous owners who if i'm not mistaken purchased it around 1993 so we're unsure at what point in time they may have done this conversion but we can only assume that it's been there for many years it's not something that was done recently and um mr malah purchased this home because he thought that it would meet his family's needs uh he has him and his wife have four children he has elderly parents that he also cares for and stay with him on occasion out of town guests and whatnot so he specifically chose this house versus others that he could have believing that this would be suitable for his family's needs he was very surprised to learn of this matter and in reviewing you know the city's ordinances we understand that the intent is to have a two-car garage and parking for two more vehicles side by side outside this particular house i don't want to say is different but happens to be with a larger driveway than most in the neighborhood i can show you some pictures i know that they put a picture earlier on the screen it happens to have a cul-de-sac driveway as you can see and also in front of where the garage is there's room for at least four vehicles and in the cul-de-sac you can fit easily two to three more vehicles without creating any kind of a safety hazard or nuisance to the neighbors so this house has a capacity to accommodate six to seven cars pretty easily without the use of the garage so in mr malah's request you know part of the request is also based on that it's not a nuisance it's not going to create any kind of safety hazards or whatnot and i also want to point out that he's been living in the city of plantation for about 35 years or so maybe even a little bit longer grew up here went to plantation high school locally has been a good good long-standing member of the community has decided to remain here raise his family here and you know has been a peaceful citizen hasn't really had problems with the city or anybody else and would like to continue to do so and i think it speaks volumes when you know close to 50 homes were notified and not even one made any kind of an objection so we're hoping that in light of these circumstances you'll take that into consideration and really give it some consideration to not make it difficult for him and his family and to really enjoy what they purchased to be their dream home and continue to stay and reside in the city that he's been residing in for well over 35 years thank you i'm just going to say something very small if you would uh your name and address for the record even though we have it just absolutely find the speaker my name is michael malah resident at 10062 northwest 13th court in plantation like like michael said i've been here for quite a while graduated plantation high school so um and i uh resident here my uh i'm not used to this but uh you know my my statement's really short i mean this this house is a part of our family my teenage daughter lives in that room losing it would be very painful for us be very difficult as it is the substantial financial burden's been tough when i learned about all this i hired an architect an engineering firm i hired in special inspectors i went in for the permit and the building department and all these things to try to just just find that that solution to find that um you know uh the solution compliance to make it right to make it right for me and my family and so i really do pray that that you can you can understand my certain situation and it's not something that i cost uh but it's something that i'm looking to to to hope that um can be can be uh fixed yeah and i thank you for your time really thank you any questions for the applicant from the dais i have a question yes hi hi so um i guess my question is you had special inspectors and engineers did i understand that not meeting code but what about in terms of not meeting our city code but what about in terms of fire safety or whatever and in terms of if you were to have a fire how is that your neighbors and that sort of thing so it would affect other people so what did the engineers you're saying you consulted special inspectors engineers what would be what is the purpose of that because it's not going to be up to code and is it safe at least in terms of fire right that was my that was my primary concern is to make sure that once i found out this is something that was not supposed to be there i made sure that it's code compliance as far as building permit codes and then those engineers came out there were smoke detectors exactly where it needed to be there were egress portions wherever they need to be there were ventilation of the bathroom exactly the way it needed to be and to make sure that all these things met current standard building codes florida building codes the structure itself is something that they had to find underneath to make sure that the floor itself when it was raised it was done properly and structurally sound so to basically in the reality if this wasn't a code ordinance with the city this would be a proper garage conversion and that's really what i i didn't know about the the city code when i went through this whole process otherwise it would have been different for me but that that's what i i researched and that's what i found out i want to make sure that that's the case is that you know it meets all building codes south florida building codes would you be able to provide have you provided the building codes and all the inspections that it is in code fire safety to the city so that's what we did originally in the permit application process and um and i think it's mr sweeney we had a meeting with the architect engineer and he's like listen you know everything's fine but then when it went through zoning it got denied for this exact purpose so the the idea is yes um everything meets code and there you know there's special inspection um letters that are going to be issued you know as far as the you know after the fact type inspections which we are all willing to do you know these people were hired for that reason but we hit this this this wall and i and i will add i mean we're about a year in violations i think it's like 80 000 at the moment and it's you know it's not something that i specifically wanted although at the same time when we spoke you know he said i want to be in compliance here i'm not going against the law i want to be with the law but at the same time you know be able to to to make sure it works so it looks like the rest of the neighborhood if this was something we were allow would you agree to keep the garage door the way it is so it appears that's already a condition oh yeah and it is that way it's it's actually secured that way it can't go anywhere yet secured yeah so no one okay and it's up to code and you'll provide the fire code safety to the city absolutely yeah thank you very much my pleasure um how long when did you purchase the home i purchased it in november of 2024 2024 and you had a realtor with you working to purchase the home so no the home was in a non-livable condition for about a year or so i rented the home at the end of the block at 10032 for about a year and a half and just kept driving by this house it looked it looked just dilapidated it wasn't really owned and um and uh i i contacted the realtor that was selling the home on behalf of the owners so the question the person it was that owned it was an absentee owner but they did have a realtor that you were in contact with when you were renting it so no i rented the home down the street but i was just a resident yeah so there was a realtor involved in the home and was this the first time you purchased a home in plantation yes i moved in with my parents in the 90s i built my own home in plantation acres and got my co in 2007 um and um and then this was the first purchase i'm just curious because um if there was a realtor involved in the sale excuse me i would think that they would have had the history about the conversion and they didn't they didn't know whether or not it was there they didn't know if it was approved or anything like that so none of that was on your closing statement that's right and actually the realtor it's funny because unfortunately but fortunately for me i mean you know i think everything happens for a reason but this specific family who owned this was through an estate and so nobody really knew who the owner was and it actually went to probate and there were months and months and months of things so the realtor was kind of like just a realtor somebody who just put it on mls i think it was a flat fee realtor somebody who didn't really know much about anything if i can chime in um i think i could speak to that as well because i was involved in the closing process and the realtor as as mr malo mentioned she was really not too active she didn't know how to handle it because there were many errors there was a probate involved they had to open up another uh probate for an estate so i assisted the family i helped them find an attorney here locally that can help with that probate process and i really did a lot of the heavy lifting uh on that aspect to help them clear out what they needed to clear title and whatnot um but yeah the realtor did not give any disclosures or there were no uh seller's disclosures uh stating any of this so so nobody went to the city of plantation site to see if um any permits were pulled for any of the changes of the home no i mean i went through the same thing myself and i didn't know and my realtor was similar to the one you had and i was brought before uh not this group but i was brought and i had to pay a fine for the people that i bought the home from so just wondering about that thank you you're welcome thank you yeah just a quick question for staff so what would a denial require of the applicant the demolition of the of the bedroom in the garage yes it would have to be turned back into a two-car garage okay um and mr malek um so do you have any like intention of renting that space i know you said your daughter is currently occupying that so like maybe when she leaves the house you're not going to turn it into like an airbnb or anything i just want to make sure you're aware of the no not at all i also just got remarried after being married for 20 years and we're trying to have another child so with blessing um maybe at one point in time we'll we'll build a nicer larger house implantation i'm never leaving the city i love it here so that's great yeah any questions next so this is a question for staff actually uh and this is where i thought that daniel was going with this with his question uh when we passed our adu ordinance it allows the conversion of the garage into another living space uh as long as the parking i believe and you can correct me if i'm wrong please uh as long as there is adequate parking elsewhere on the property like the driveway um i do believe so yes so if if the homeowner had added a separate kitchen and a separate bathroom to this unit and made it an adu that he was renting for free to his teenage daughter that would be legal and they wouldn't have to it would still need to have been permitted but zoning it would be completely legal and they wouldn't have to come to us for a waiver you might still have to if it michael albert if it met meets the definition of an adu then it would be permitted as an adu it would still have to go through permitting yes right but not to our board correct um i mean the way that i see it is that he has the adequate parking elsewhere on the property if it was an adu they wouldn't even have to come to us so he's keeping it as one living unit without making a separate kitchen renting it out separately all that stuff uh that's my thoughts on it i have one more thing just i want to add go ahead because i'm a solution oriented person so i'm like okay then you know what i need a garage let me build a garage and on the right side of the house i have the space where the car is so we have six cars parked outside all the time family a lot of family and my kids but on that right side i actually have the space it's green and 18 by 18 i think is what they say for a garage and i could put it but they talked about after all this stuff the calculation with the civil engineer pervious to impervious areas so i'm like well can i take off some of my driveway and and i think it could have kind of worked if we you know like but that was just my thoughts always through this process if you did that you might need to come back to us for another waiver i don't want that no no thank you i was just gonna say we denied a few just for garages alone um any other questions josh yeah um how for staff how did the city uh yeah figure out that this was unpermitted there were other i believe there were other code cases that had come up there was some other work that was being done um i believe there was a propane tank being installed underground um trying to think there was a couple of others i was actually going to ask about that particular one because it was in there that the stop work order had been put on that correct um i had a question for the applicant which is who was doing that work was it you or previous so actually um there was no and is no propane tank installed on property there is a big propane tank that i got on a discount from somebody who went out of business and i bought the tank and they delivered it in my front yard and so the neighbors thought i was going to explode the the neighborhood you know and so they called code enforcement code enforcement saw the construction debris by the garage conversion um and they said you're doing work they put a stop work order and that was that and so here i am you know a little over a year later so so the exterior propane tank is gone no it's still there just not installed just okay let me ask the question a different way are you were you planning to put that propane tank attached to this piece of property i got two bids from amerigas and from uh propane usa or or some of these companies to put propane but a part of that was renting the tank and i said i don't want to have to rent the tank i want to own the tank so i bought a tank thinking that you know be able to have them installed so there is an intention to put propane there we would like yeah we would like so that is so just to verify that is what is stopped right now that's correct and that particular modification to your home is going through the permitting process within the city yes or no absolutely everything through the city but they stopped at zoning okay sorry josh continue yeah i'm good okay sure just quick follow-up question so you mentioned that um code enforcement came out and they saw construction debris on the ground but the conversion was done before you purchased the home so why was there still construction degree so it's my teenage daughter and she wanted you know different layout because they didn't have any doors to the bathroom at the time it's kind of open to the room so we were putting a pocket door in that space and at the same time she wanted like a closet so she wanted some electrical outlets you know to be able to accommodate the closet but we stopped that we you know we painted it and then the tile the tile that was on the you know floor we had we ripped up the carpet that was there and we were putting down some new plywood you know duroc uh for the tile installation it was basically that it was tile stuff and duroc and you know thinset those types of those types of things the remainder of the garage on that planned view was the red l remainder of their garage you can't get a car in there correct at the moment no it's storage so it's gone from a two-car garage to a zero car garage that's correct which means all of your cars would stay outside and they do yes when you went to buy the house and you saw that particular modification garage door opens up or maybe didn't even open up at all and you're like i can't get a car in here that didn't trigger any suspicion in your mind that this doesn't seem like the kind of thing that would have been reasonably approved honestly speaking living in plantation for 35 years um i've seen maybe a hundred homes of my neighbors and friends that have garages that were made into bedrooms not really understanding the code um i'm sure in this room there are a few but i i didn't really think of it i think anything of it no and i didn't mind not having my cars in the garage and i want to point out as mr malin also mentioned earlier it's the first time he's actually buying a home so it's not that he's in the business of buying homes and knows what to look for most people don't i i i do closings for a living most people and most realtors don't totally totally understand but this is a case where he bought into the violation and so we're in the position of trying to decide whether or not we are going to permit it based upon everything that's presented and so i'm just simply trying to get background on what was happening in the purchase price or purchase way because if in fact you had an owner who for a year you were watching the house go derelict my gut would tell me somebody's not quite caring about the rules here and not quite caring about the upkeep so it's in all likelihood when a garage door is now covering a completely unusable space and the forward door that was put in there the new door in the cmu wall that's talking about is not matched size wise to the previous door which was the fire door from the garage uh that would have triggered something in my head even just from uh something doesn't look right and so part of your attorney's responsibility i would imagine would be to check the history of the house and to see if in fact they have to find whether or not any of this work was justified because if every other house in that neighborhood had a two-car garage and all of a sudden that one doesn't and there's no paperwork for it i don't see how you can justify the modification to the house sure and that makes sense i for sure thinking if it was a modification or if it was ever done by the owners and i kind of i was just kind of dumb i thought the owners because they did have a lot of issues with with this probate thing which i've never been through in my life where like seven people had to agree to sell this house and i thought i was contracting on the house and the next thing you know it's four months later um so i didn't really know and and the reality is i built my house here um i had a four car garage in plantation acres you know i i i had a garage and i had four car garage i never used the garage for my cars you know i understand yeah like curse of living in south florida there um curse and blessing yeah true any other questions from the dais um due diligence so you said that you were part of the real estate transaction in terms of due diligence in terms of all of this isn't that something you can now go back to the insurance for because of the lack of due diligence in this property title insurance wouldn't cover something like that um title insurance would cover if there were uh you know when we ran the municipal lien search for example if there were some kind of a code violation or code lien and i missed it okay because i was negligent and now he's having a problem because of it then title insurance would kick in but that wasn't the case there were no violations there were no liens uh and i had no reason i had no knowledge of this when i was doing the closing i i rarely ever see properties that i'm doing closings on at the time that i'm doing the closings i just see paperwork i see contracts i see title commitments i see municipal lien searches things like that and unless i have something to cause concern or unless i get a seller's disclosure telling me that something was done i have no reason to turn to my client in this case mr mel and say hey wait a minute michael in the seller's disclosure they're talking about a conversion let's let's dig a little bit further into this that didn't happen here i kind of think so as an attorney and a member of the bar i also think that you have an obligation you see a house that has all this construction a garage that doesn't open i think common sense would do a little bit more search for due diligence however that being said you're now aware of it and this point forward so fine depending on on how the board rules going forward you're now nothing without a permit nothing without approval nothing without code diligence yeah and and you're i know i just want to clarify i didn't see this house no no i'm just telling you saying no i should have i have no idea the garage doesn't open i have no idea what's going on again it's not our problem it's not necessarily our issue to solve the problems for the homeowner on this case we're here to determine whether or not there's going to be a difficulty waiver granted um any other questions from the dais vicki how many vehicles do you have right now two i own two vehicles and those are the two that were in the photograph um i don't know when they took that photo but yes yes yes yes unless you be in a sedan yeah it's not an suv but it's a sedan and those two are parked and you still have room for five more cars so you're saying that the it will hold five more cars it has held at least uh seven cars without being on the street are you holding religious services at your home no thank god i'm at chabada plantation so no no okay well no that no ma'am so at one time the teenage daughter will have her own car too right one of those are her car and then my new wife now and myself share a car okay thank you my pleasure see no more questions from the dais do i have any comments thank you uh okay so one item of note for everybody here um please don't clap uh it's not a it's not a win or loss it's rather whether or not um the issue meets a burden of proof for those up on the dais and i say that because the other side of the equation is about to kick in i can assume based on the shirts and everybody else out here that this particular issue that's coming up next this item is uh one of those that is probably going to last a while uh because their feelings on both sides there is a note in the agenda it's not it's not hidden that the staff has recommended deferral however in respect to you the staff and the city this is what's going to happen we are going to have the presentations we're going to hear the presentations then there's going to be a motion that motion could be to approve to deny to defer we don't know what it is but in fairness to everybody who showed up here this evening i think it's best to actually hear both sides of the story and air it out when public commentary comes up every one of you is constitutionally entitled to three minutes in front of us if all of the green shirts i'm only picking that as an example because it's visible from up here if all the green shirts are feeling the same way and there's one person who's going to speak for all of you that would be appreciated otherwise yes by my count we have roughly 60 people here times three that's three hours so um that could run into a long evening that's what we signed up for on the dais hopefully that's what you're in for as well to that point somebody gets up and you agree with them please don't clap please don't boo please don't disparage anybody up here behave like adults any questions cool in that case then public hearing pd25-0005 consideration of a request to approve a land use plan amendment lupa for plantation marketplace the property is located at 7001 to 7181 west brow boulevard and is zoned b2p central business one of one item of note before the city begins their presentation this is a lupa the only question that is being asked today is whether or not the land use should change for this piece of property that's it everything else that's presented is conceptual is based upon desires it is not anything beyond that at this point whether or not we should change the land use designation city if you would uh lisa selk with the city of plantation planning and zoning department lisa what if i may oh yeah go ahead sorry so one one of the things i wanted to just bring up i wasn't sure if you're going to bring it up or not if perchance you all are within a group and someone speaks and they spoke for you for the most part you can still come up and say i agree or disagree to have your your interests on the record for for the city so we've done that so you don't have to do a three-minute speech you can just come up say your name address and say i disagree with the project or i agree with the project and approval of the item and that way you are counted and you don't have to use all the three minutes and you can go home and enjoy cinco de mayo what he said staff if you would okay so again lisa zelk with city of plantation planning and zoning department one of the planners um we did have i think four five e-comments so i have them printed out here if you guys want to take a look okay all the same ones out we'll figure it out it's just somebody or she'll pass me hers okay send it that way if you would thank you okay sorry about that um okay again again this is for a landy's plan amendment pd 25 0005 uh the request is a ladies plan amendment to change the uh landy's designation of a 26.11 acre site from commercial to commercial residential 25 all within a dashed line um it did put on here that we are recommending deferral for more information specifically for the um traffic methodology to be finalized the traffic study to be completed and for a market study for the project to be completed the property is located at 7001 to 7181 west broward boulevard it's commonly known as the plantation marketplace shopping center and the bank of america building okay here's a location map again 26.11 gross acres currently zoned b2p land uses commercial here is the um aerial showing the public notification boundary there were the boundaries a thousand feet and 666 notices were sent out okay here is our overall land use map i don't know if this is working oh here it is so we're looking at this area right here we'll do a little blow up so there's the blow up of it and right here is 70th and cyprus and this is the parcel right here and that's what they'd like to change it to residential within a dashed line okay here is an aerial showing the two parcels together on the left over here is the plantation marketplace is currently developed with 238 000 square foot commercial uh shopping center and over here is the bank of america bank with a uh unused drive-through okay and i just kind of wanted to give you guys an overview of the land use that's currently in the area for the residential so we're just giving you an idea of what other residential areas are here we've got this is um duplex area patios in the park um here we've got this area here is all medium 25 units to the acre over here we've got medium high also 20 uh this believe this is 20 not 25 units to the acre and then we have medium 11.5 in this area which encompasses single family homes and condominiums then we've also kind of broken it down if you guys have any questions about you know which ones are where so we've got lakes in newport condominium here lakes in newport um single family there polo glenn whoops it's not working oh there we go right here number four is plantation royal uh condominium uh condominium here is the uh french sorry this is french quarter and this is polynesia gardens this is a plantation terrace plantation manor royal palm plantation place and plantation club condo and these so far are all ownership i believe polo glenn does have a rental capacity but they're technically a condo here's the survey showing the gross acreage going out to the middle line of the streets and this is the conceptual site plan that was provided with the lupa application and i did have to put north on the left so broward is over here cypress is on the left and 70th is on the top okay ready okay just putting out there the base density for this parcel based on 25 units to the acre would be 652 units uh the applicants submitted a traffic methodology statement indicating that they were planning on 1 705 units which to do that they would have to utilize the affordable housing density bonus that's allowed by the city's comp plan and the county's comp plan in the event that it does get approved these are the conditions that we'd like them to incorporate obviously the affordable housing component the traffic study needs to be reviewed and approved by staff the market study needs to be completed financial contributions to the off-site improvements that will be required by the utilities department would also need to be provided okay um and do you guys have any questions are there any questions for staff from the dais next i i have a few questions um my first is just confirmation that the residential density allowed in the land use plan currently is 25 units per acre in most of those properties surrounding this one and then 11.5 for one when we passed the new comprehensive plan which included the new future land use map right did it keep all those same numbers i know that the state hasn't approved it yet but i just want to know yes yeah it would have kept it like the existing land use that you saw on those maps would be um the same the only thing that would really change would be the industrial land use and the commercial land use i think the office park land use would be converted to commerce just one but that's all non-residential gotcha yeah um in so this is this is another process question 2023 the live local act passed right it said that as long as 10 of your proposed units are some level of affordable right you don't need the lupa correct do you need the rezoning in that case or do you just go straight i think you know you don't need to rezone you would go straight to either and if it's less than 40 it would be you would have to go through the site plan process right but not the lupa or the rezoning right so if we defer this or deny it could because the developer is proposing 10 affordable they could just skip this process and go straight to site plan they could but they'd still be coming to you probably for waivers for the site plan right i mean you would know they wouldn't be coming for a lupa or rezoning but would they be coming before you for the the site plan right okay whether or not we pass this oh go ahead i want to for the record dan holmes planning and zoning director you said 10 because 40 40 is automatic approval automatic approval 10 allows them to skip half the process and go straight to site plan yeah right okay just want to just wanted to clarify that there is a difference from what i understand and i'm sure that the applicant will address that from what i understand they are committing to 10 percent yeah okay my other question is that the staff's recommendation for deferral from my understanding is based on wanting a new traffic study mostly at least that's what it says here in the recommendation the traffic study and the housing market study wouldn't that be better off being presented during the site plan approval rather than the lupa we'd like to see them both at this point just to make sure that we don't want to get like if the land use was approved per se it and you come back at the site plan you know two years later or a year later and there's not a market for it then we're kind of stuck with a land use that's we don't can't would have to go back to revert it back to um whatever it was before so in this case if it gets that you know designation they've got the residential that is already assigned to it essentially where they've got that so we would have to turn it back to the commercial we could write the ordinance i'm sure quentin can correct me if i'm wrong we could put a reverter clause it possibly in the ordinance if it passes claiming that back if they don't develop it okay the reason why i'm asking is because hypothetically right they submit their traffic study based on whatever the current project is market changes in a year they change the project they still have the same land use designation right but they can completely change the they can go smaller they can go bigger if they use giller amendment uh to provide more deeply affordable units they can go to a bigger project and then the traffic and market studies that they gave us for the land use plan are completely irrelevant to the site plan application so if i if i might you want to be careful with what they could and couldn't do we have information before us and that's what they're proposing so you want to make sure you're careful with stuff that may or may not happen but we have something here on the agenda so you have to make sure you you limit i'm just asking why it's relevant to this step of the process versus a future step it is relevant right now as as the chairman indicated we're looking at a land use plan amendment at this particular point so we're looking at the policy decision of whether to modify the land use and we do need to know whether it is marketable at this point at the 25 dwelling units per acre okay so that that is something that we do need to to take a look at with regard to the traffic analysis there was some different numbers and information that we're just we want to go back and sit with the developer i agree with you that at some point once they decide because at this point there's still some question as to the amount of affordable housing that may be included so yes at the site plan phase there may be another traffic analysis that looks at additional traffic above and beyond what the land uses is looking at what the land use uh would be so you're right there's going to be more analysis based upon whatever that comes in as a site plan okay do you follow so yes so we do have to look at it first just as a land use amendment and that's what the applicant is requesting here tonight okay final question at least for now um if it stays as a commerce land use are they still eligible to rezone for the tod zone or would they need to in order to rezone to tod would they need a lupa to allow under under what our new code or what our new land use uh plan or comp plan anticipates that yes if the tod is approved then the commerce would be an applicable uh you know uh underlying land use for that zoning right and we already sent that to the state it's with the state right now yes okay thank you anything any other questions at this time for staff all right applicant if you would yeah but actually i want you to if you could put up that uh land use the land use map of the surrounding area mr chair members of the board bill laystrom 1177 southeast third avenue on behalf of uh baron development the owner of the shopping center known as plantation marketplace as well as the bank america site next door i'm proud here to be representing charlie ladd i'll give you a little background on him in a minute but i put this up because such the chair kind of started this with um well let's look at the land use and in a minute you're going to see what i'm proposing and it'll look just like this except it'll have a dashed line around our piece of property so that it'll allow a combination of residential 25 units per acre 652 units and commercial both within a mixed-use project and all we've done is apply for the land use and as you can see 25 units per acre is all throughout this area of the city um you know french quarter polynesian have been there for years um polo glenn i did the development for the medium high i think it is a rental or is it it was when i approved it 15 20 years ago so this this area is built for this type of redevelopment and we're planning to take an old beat up shopping center and convert it into a mixed use project now the way this process does work and you've kind of touched on it now is you start with the land use amendment the code used to allow you to file the site plan at the same time but the city changed its code not me so that i don't i'm not allowed to file my site plan until after the transmittal the first approval from the city council of a land use amendment so today you are correct we are here for 652 units if you were to grant the entire site to be uh have resident an opportunity for residential however as part of the political process which is what i deal with i always show you a conceptual plan because i don't want to come back later and have you say wait a second you told us 652 units and you've got this great design to do something much much more much larger combination of every kind of development including commercial back in the front so i always do a conceptual site plan so after we submitted the conceptual site plan as part of the process so that everybody could see what we were doing we then put together our traffic study well for land use amendments the traffic study methodology is not the site plan methodology it is actually a simple calculation based on acreage set by the broward county planning council and it's just based on general square footages based on acreage that's the way the county's always done it for years that's the way the land use amendments are already done we submitted that traffic information to the city as part of our original application and they asked for wait a second you've got a conceptual conceptual plan got me in trouble so the conceptual plan will let we want to do a traffic study on the conceptual plan because if i did a traffic study today on 652 units it would cover the areas of the amount of traffic that ultimately might be developed so we provided that it's in the backup that report is accurate for a land use plan amendment the city has asked for the traffic study so what we did is we said well look we'll go ahead and establish the methodology it's called a methodology letter for that traffic study that will go with the site plan when we submit it why is that important because the conceptual site plan is a site plan that's been designed by people looking at design it has not gone through the drainage review has it gone through the utility review i haven't set it up against setbacks pervious impervious and all those things you hear when i come in for a site plan and i'll be back for that at some point and to mr goldstein's questions so planning for us starts way before filing any of these applications mr lad and i get together we look at what the code is at the time we get started and we kind of make a decision on where we're going and the city has been robustly looking at all of its land use codes its zoning codes i know danny and michael are writing feverishly all the time to make those changes so we had already started in our own mind the land use process live local we certainly think it's potentially applicable here but it's been changing consistently every year with the legislature and only really in the last year or two is there been any real definition on live local so we just we're doing what i call the old-fashioned way at the moment which is a land use amendment for 652 units maximum density of 25 units per acre exactly like what's next to us and remaining with a commercial component as well so that we have we end up with both the concept of the conceptual plan just because it happens to be up on broward boulevard on the right hand side in kind of the orange is our commercial component it'll include a rebuilding of the bank of the bank of america building and our goal is to have a nice new commercial facility charlie is famous for fresh markets we don't have a lease yet that'll be a long time after we do the site plan but it's our goal to have a nice component here why is that important this shopping center is old decrepit it was built under broward county codes i don't i if i remember right this one was annexed in to the city and in fact you know doesn't meet the pervious area now doesn't meet the landscape code and charlie is in the process of undoing all the leases that are there today that's why we were proposing in phases because we have to wait until leases expire before we can continue the development so we were looking to do the uh upper left corner first for the site plan now this again is outside the land use amendment but we're looking to do that corner first and then we would do four four pods of redevelopment as the leases expired um charlie is and i keep saying charlie but mr ladd is devoted to this site um originally in that upper left hand corner was a dollar tree that's already been approved we paid a million dollars to break that lease so that we could have this parcel as kind of a canvas for a mixed-use development which i think is the the better iteration of plantation walk and now plantation city center and i think this one will top it when we get the site plan in now that site plan in all likelihood won't get in until january or february the way the approval process goes later if we get deferred today with regard to the market study market study is typically done with the site plan and you'd want to do the market study based on how many units you're ultimately asking for not the 652 and i just got done doing as i had put in my response to the staff comments at each level development of development review process look we've done a traffic study i've already done a market study for crossroads 2 i did a market study for waters edge showing significant demand for residential we'll do a market study that's probably why the deferral you know if that happens you know we'll have the market study it'd just be a redo of the one that was done for those two and those were approved in november and december so i don't think anything significant is going to have happened since then since i probably represent most of the projects that that do come through so from a land use standpoint we're compatible with the densities surrounding us the staff report if you take a look we've agreed to the utilities we've agreed to all the infrastructure improvements for the 652 units and i think you'll see that staff finds us to be in compliance with all of the i think it's 11 requirements of the code now i do want to go ahead because there are a lot of residents here and answer some questions about well what is going there eventually so they can see what it is as they make their comments they'll be more effective than saying 652 but i know he's thinking it's 1705 so with that i'd like to switch over to my presentation uh yeah and kind of talk talk walk you through the the site um and again we're here to answer any and all questions i've got my traffic engineers here to talk about the different methodologies if that's needed um and what we certainly what we propose to do charlie ladd is here going to give you a little background on himself and we're going to talk a little bit about our outreach program that we've been conducting actually for about the last eight months hey will i'm going to ask you to help me out here let you work that thing so first let's go back to the location real quick very sensitive so here's the location again um same picture roughly is what the staff presented um 26 acres recall that for a land use amendment we're entitled to use the density based upon the uh one half of the roadways that are around us so the net site is going to be smaller than the gross site for the purpose of land use however we've done the calculation i don't think staff disagrees with it and in your backup i saw that they had included our uh gross area uh survey for uh informational purposes so so this is the current land use on the on the property it's all red switch same thing except now it allows 25 units per acre i know that seems like just nothing at all but that's exactly what it's called that's why it's called a dash line amendment because it allows multiple uses within a single area it allows the commercial and it allows the residential we will put a circle in it that says 25 because that'll be the maximum amount of density again similar to most of the properties that are around us next slide so this is the conceptual master plan we did some basic calculations just to show staff where we were with impervious area and started looking at parking because that's always something that they're sensitive to but for the most part at the bottom you'll see we have two entrances into the property one over to the left which is on the west side of the project and one in the center to come into the project you'll have all of the retail areas there's a garage that's part of the retail facility that's used for parking if you've ever been to doc b's that's one of charlie's projects over on federal highway you'll you can't even find the garage but it's there a garage to add additional parking but all the retailers as we found out at plantation walk still want some parking out front particularly if we're going to encourage the grocer to be there so we have put parking out front that will also include the bank of america the balance of the site will be four pods of residential next slide and i i'm going to go into these in a little more detail in a second but i want to just give you some visions of what the project looks like so that you can see the architecture that we've chosen as well as the pedestrian and green spaces that we've included next slide so i'm going to go through these quick but we'll come back to them um in a little bit and i'll explain which corner they're on what the views are from but i just want to keep going keep going keep going and this is the i remind everybody to please just keep quiet during this so we can get the presentations done and so this this site the last one is i just wanted to point out i'll go back fast this is the looking from broward and 70th and the only reason i want to make sure this one was in here is to show that this i really focused on the residential for most of our renderings but this is where the commercial project will be up in this front corner and this was kind of to show the landscaping that we're proposing all along the right-of-ways this will be all the way around the property all utilities are going to be put underground and go back to the site plan real quick and we included in the site plan if you look at the large green area running along the left which is the west those are our nearest neighbors at lakes of newport so we're including a linear park running the entire length there's currently power lines there and utilities that will have to relocate but we intend that to be a passive area buffering us from our neighbors to the west okay keep going so a little bit more about the the site is is part of a entire commercial area the public's is also there the public center these are centers that have been having leasing trouble for years and again we are at a stage where one way or another they need to be redeveloped this is not a site that we would not want to ultimately develop into something the city could be proud of and with the location on west broward boulevard and the amount of uh vehicles that are going by this is a high-end transport and transit uh roadway it's the it's the perfect design for the tod district if it gets approved um that would be our intent uh for the rezoning um if you know if we have to use the live local if it works then we use it but that you know we're not here to talk about live local at all i'd rather talk about a land use amendment and just getting it approved so next slide so uh charlie ladd is uh the president of baron real estate development charlie's developed all throughout broward county uh the walk in coral springs but i'm going to have him come up a little bit just to give some background into his development and his vision for this site um i think you'll find that he is very enthusiastic to get this uh property rebuilt and has put his money where his mouth is to again buy out dollar tree and um let uh the shopping center uh leases expire so that he can get this project built charlie good evening everybody i'm charlie ladd my residence is 442 northeast 7th avenue for lauderdale um i've done quite a bit of commercial development over the last 40 years here in south florida most of it has been in the coral springs area and in the downtown for lauderdale area of note and coral springs are the walk which is a mixed-use office retail complex with barnes and noble trader joe's and a variety of other tenants and office users we've also done charter place at the corner of sampling university which was our office complex that was built for state farm and then in downtown fort lauderdale a number of projects we've done quite a bit of development on las olas including louis bossy lululemon earls planta warby park or yeti we're doing a ultra luxury hotel on las olas currently and then we've done a number of developments as part of the redevelopment of federal highway uh in the downtown victoria park area including winn dixie the fresh market shopping center across from searstown the cbs at broward and federal the fedex at federal highway so a number of them and that was over a 25 year period to restore that area that for those of you who have lived in south florida for a long time was really a nasty disgusting area so um we started getting into these shopping centers for a reason in that there's no more land left in broward county and when you read the county statistics and you see the laws that the county is passing these arterial roads is where the redevelopment is going to occur and there's going to be residential replacing the i don't know i would say obsolete commercial space and you can read about the county pfam report and that type of thing that talk about that and that's kind of what inspired us to start buying these older centers also as somebody that's heavily involved in retail development i realized that the core of retail in this market is the university corridor from broward boulevard down past south of 595 that's where all the big boys go costco the big boxes best buy etc etc etc etc that's where it's going to stay so these ancillary places like here are kind of left to just see who they can get as the as it devolves so you look at this center it came out turned into big lots and a law law firm that went defunct and covet big lots their entire chain died winn dixie died and we got food fair instead cbs has been working to go to freestanding stores dollar tree shows up not to me uh anchor to create an upscale experience so we look at this as a potential site that can be redeveloped that's primary residential with a right size shopping center that's a more upscale use in conjunction with the general neighborhood that's around this area that has always been a great neighborhood so that's what we're trying to do here the apartments that are drawn are conceptual the architects always draw the max and then you kind of go from there as to what actually works i think there's some important things in that site plan in that all structure all surface parking for the apartments is gone it's all garage parking similar to the ellsworth and some of the newer apartments have been built here in plantation which is a much nicer experience we've created a lot of beautiful common areas with the linear park as well as the there's an ellipse in the middle all the uh overhead lines are buried and the properties lined with wide sidewalks and landscaping so there's a bit of a trade-off when you take density you also get those amenities that can make a place much more special than what historically you've seen i think one of the examples i've seen in plantation of this being done is 82nd avenue on the old amex land that those streets are pretty pretty inviting and it's turned into a pretty nice neighborhood and i think that's what we want to try to achieve here what actually gets built you know we want to do that first phase where the drive-throughs are it does not really impact a big chunk of the shopping center and then the next phase we would be able to do would probably be on the northern top where amped fitness and brick america are now they have shorter term leases that can be canceled that would that would entail the food fair going away which we hear they do okay so i don't know they could be gone i don't know how long they'll be there so if there's any questions i'm happy to answer them but that's kind of where we are thank you you're standing up bill so it was but if you have a question well let me ask it this way is the applicant's presentation finished okay then continue okay thanks i assumed as much okay we'll back uh keep going keep going go to the next slide so our project team includes uh uh architect busy hernandez she's done a number of projects in our uh in our portfolio of projects we've done here in plantation and architectural alliance has done our landscaping civil engineers are flint engineering of course myself and uh we have uh two traffic engineers both uh john mcwilliams and uh suzanne danielson john is doing the the lupa uh work and suzanne if you have any questions about the traffic methodology that would be done at the site plan we're happy to discuss those next slide all right so now let's see what we're working with so i put these slides together to kind of give an indication of of what you have today so this is the corner of 70th and cyprus looking into the bank of america parking lot next line this is the parking lot center of plantation marketplace very little landscaping very little pedestrian connectivity no connectivity to for the most part to mass transit or any of the transit options along um broward boulevard next slide so this is the shopping center if you're looking from lakes of new court looking east this is what you have is the back of an old old shopping center the main building there in the center is the food fair next line just a different angle one of the reasons i wanted to show this is the linear park that we're proposing basically runs directly through the site uh along the along the back here that's what we converted this to um so that it would have the linear park next slide so these are just some additional slides showing uh the plantation marketplace uh looking through the site keep going i put the site plan back up charlie kind of took a little bit of my thunder so part of the purpose of this was to create something that was walkable something that had amenities so you'll see in each of the uh residential quadrants they've got their own amenity area including the pool they are all interconnected with um sidewalks we'll have bike bike rooms bike paths all of the things that you would would expect in a modern mixed-use facility plus of course now you see the uh linear park running along the western property line on on the left um next line so outreach so outreach consists of a number of things first the easiest one is you have your um meeting with the residents that i call the community meeting so we held our community meeting we had probably 10 10 people um some that were there because we had already met with the board of directors for lakes of newport certainly expressed because we're showing the master plan not just the land use amendment and certainly had uh questions for us concerns about the height of the buildings certainly had questions about the traffic we indicated to them that we would do some more work with the traffic and so what charlie did was go ahead and commission two separate traffic counts so we went over the ellsworth which is one of the most recent apartment buildings the good news with all of these for the most part they have a single entrance in and out so it's very easy to count the traffic we did that we also went to plantation promenade which is a full shopping center at knob hill and cleary both are my clients so we could get access and did counts there so that when we do the site plan we can compare what a full shopping center would be to and and and residential to what we're proposing here and what you're going to find in the land use amendment first is that there is a tremendous drop in traffic and then once you're going to find when we do our do our site plan as you see in the methodology it'll be less because the number of residential units went up from 652 to what we would study is 1705 and at the end of the day as i said we haven't done the actual site plan yet because that's not the process implantation anymore so i may not be at 1705 i may be at you know some number below that certainly on our side we hope not but we certainly understand that when you add all the codes in it typically i've never had one of my projects get get larger so we've gone the extra step to try to provide the data that goes with our contention that the traffic will actually be reduced with this project and we believe it will be i understand but remember this is 235 000 square feet of retail retail typically generates 100 100 trips per thousand square feet we're going down to probably about 53 54 000 square feet of of commercial so think of that and then if you think of residential i use rule of thumb it's not completely accurate but 10 it's 10 cars eight cars per single family home and i believe about six for a an apartment so when you do the math that's what will that's what you will see now what we agreed to do as part of our traffic methodology is we're going to go out we're going to do traffic reviews all the way to turnpike to the east including east tropical way we're going to do 70th going north i think we went at least a fifth we may have gone further we can ask the traffic engineer if it makes a difference and so once we have the site plan then we'll look at the impact on all of the roads around us in the land use again the land use shows about 4 000 trip reduction but that's to allow 60 000 square feet of commercial y60 which it's 10 000 square feet times six acres that's how you get the 60 000 square feet and then the 652 units so for traffic we think we're we're ready to present um at any time um it's just two different methodologies these are used because that's the way the codes were written and i can't submit the site plan yet even if i wanted to so here we are with our outreach i'm gonna kathy are you here kathy go don't see her so we went out we also started knocking on doors so we went to um businesses throughout we went to hawthorne village for their board of directors meeting we went and knocked on doors these are folks that we've knocked on um and are um supportive of our project um we also have three video we have three videos we want to present uh which include three testimonials i found that that's an easier way to uh get somebody to tell you that that they're supporting of the project and i'd like to run those now if i can before you run those can i could just get one point of order clarification you've mentioned the number 1705 a couple of times now i'm looking at your engineering submittal from march 10th phase one the 450 units phase two says 1750 is it 1750 or 1705 so we were asked to do the maximum calculation for uh calculation of erc fees which are basically drainage fees so i just told him to be high and do 1750 but it's not 1750 plus 450. right i mean but but i guess my question is what is your max is it 1705 1750 652 450 or 450 for phase one what's up so your max so so our maximum is 1705 1705 thank you if we get to the site plan process no it doesn't matter skywork the resident of uh skywork developments and architecture design and construction firm we build high-end projects from high-rises to super luxury residential projects all throughout florida plantation in miami and we're super excited about plantation marketplace it's going to do a lot of great things for the community it's good for my family good for our business good for all sorts of things and just you know allow small business to come in and all different types of business and then also give place for a young community to grow plantations transitioning from an older community to a younger community people my age and younger a lot of my staff lives in plantations looking for more housing implantation and this will be huge for all of us thank you not our architect by the way so my name is sam jacks i own pelican insurance agency on off of broward boulevard at northwest 70th avenue we are a general lines agency primarily focused on the commercial markets throughout the state we do some local business as well we moved here this this uh this street uh 32 years ago it was a central location it was easy to get to 95 to uh university to turnpike and um it was it was a very convenient place to be i've seen uh the plans for plantation marketplace i think that uh i think that it looks comfortable and um and uh very amenable to the area and i think it would be a very good fit for for our for our neighborhood hi my name is ingrid baker i live at 7314 northwest first court in lakes of newport plantation i have lived here for 33 years i was one of the original home buyers i came from canada and buy directly into the lakes of newport i was shown all the beautiful pictures and upgrades that's going to be taking place in plantation marketplace i think it's an excellent idea it's going to enhance the neighborhood and raise the property value in lakes of newport uh next slide will so i i wanted to um so let's keep going will so this is the linear uh linear park running basically uh north and south along the lakes of newport with the landscaping along the uh western boundary uh you know placed for um you walk your pets place for enjoyment for the community we do always include artwork and different types of um i call it pedestrian friendly uh design options um in addition each each building will have its own exercise room and all the typical things associated with um each phase next slide this is the corner of cyprus on the right and 70th just to kind of give you a vision what the landscaping and the and the buffers will be next slide again this is one of the interior shots kind of showing again the connectivity the number of sidewalks the uh um units on the first floor that kind of interact with the path as well as some of the interior design concepts of the buildings and the um porches next slide i showed you this before but this this was really designed to show kind of our front front entrance concept behind it would be the um commercial uh properties next slide this is our um oval in the middle um also pedestrian friendly tending tending to be a landscaped and quiet area within the middle of the project but also allowing easy uh transport each of the uh residential buildings will have its own garage for parking next line and of course here's what you see today for the linear park next line and here again a different view but looking straight down the the same same area next slide so during the course of our meetings with uh residents of lakes and newport there was a discussion about being able to have at least i call it one-way access into the project because we would normally construct a solid wall running the entire district so we have designed and at least proposed to them a gate system where they would either have a combination that would lakes newport would have or some other form of uh getting back into their neighborhood but not allowing just general the general public from our site to be able to get in we will be listening today to all the comments and to the extent that we can accommodate those comments as we move along we certainly will do that i want to touch on the last thing which is affordable housing we are committed to the affordable housing housing we will actually i think be above 10 percent but again i haven't gotten to the site plan yet that's not part of the process so right now my application is for 652 and certainly i will commit to 10 being affordable because i know that's important to the city so with that i'll be happy to answer any questions take a look at charlie see if he has any last words so we're we're good to go so all right we're compatible we meet the standards in the code and we would ask for your support and i'd like to have maybe just five minutes to to wrap up after public comments any questions at this time from the days seems like old times mr laystrom um how much how much commercial space is going to be there so the land use amendment allows for 60 000 square feet okay and um the closest community the lakes of newport those are the homes not the condos it's it's uh townhomes there's also condos right there there are condos there that's right and did you um contact i mean if you contacted the president of the association did other no we contacted all there's multiple associations we we contacted them had a meeting with all the folks who were there which were multiple board of director members and then kathy you know our outreach person that we've used in the past knocked on doors within probably a block to two blocks of the um you know that's how many she could get to um you were talking about plantation promenade that's 100 commercial correct you were talking about ellsworth that's 100 residential and the closest commercial to them is a one-story office building across the street because i go there twice a week for physical therapy so i see that there's uh high-rise apartment buildings um or whatever you want to call them why if if you think you're going to do x amount of apartments and you go i mean that's why i'm saying we've done this before and you say okay we're going to have a thousand apartments everyone says there's not not in my backyard so you go okay well we're going to deal we're going to go a little further we're going to go lower we're going to do 600 and they're still saying not in my backyard and you already know they're going to say it why would you start a plan that says a thousand or 1700 apartments when you know that that the neighbors are not happy that the community does not need that many more apartments when the ones they have now they can't rent so so so the definition please reserve the comments from the gallery the question i want to know is why don't you start at where you think it's going to end up so let me start with the the part about ellsworth and so all we do with ellsworth is we count the number of cars right we divide by the number of apartments that are there and that becomes the number per apartment we then multiply that number by the number of apartments for ours to get an accurate total number for the residential the same thing goes for a full shopping center we want the maximum amount of traffic that our 60 000 square feet could develop so we take plantation plaminade we count the cars we divide by the square footage and then we come up with a calculation as to how much traffic is generated by a commercial uh you know 10 10 or 100 square feet and we multiply it by the 60 000 square feet so it was the whole purpose of those is just to get an accurate count because i think you would be absolutely shocked if you sat at the ellsworth out and and i'll sit with you and when we do vignettos afterwards but i'll sit with you and we'll we'll take a look at the cars that are coming out because the the perception of the public that these apartment buildings are creating the traffic just is not correct and so that is that is just and and you're kind of saying the same thing so on our project on our project until quite frankly tonight and hearing mr mcmillan a couple of times speak and if i didn't say the name right i apologize we haven't heard this outrage and and there's there's comments from lakes of newport i'm very sensitive to but as you as you get further and further out this project this site needs to be redeveloped to something and so the 652 units is just because that's what your land use calculation allows me to ask for it but again the thing is 652 units over three buildings how many stories there's nothing in the area that i can see except for the lakes of newport or the condos they're about a quarter of a mile half a mile away are the only high rises close by vicky and then you have to go further east that's what i'm confused about if if i could i just want to remind you and everybody else and everybody on the dais the questions about the lupa whether or not we just change the land use because part of what frankly bothers me about the picture that's up there and everything else it's all conceptual none of it is set in stone none of it is there it's simply a ghost of an idea right now and that ghost of an idea does not happen until this step occurs i'll also remind everybody on the day i said in our advisory capacity we're not making the decision on the lupa we're passing it along with an advisory to city council and that city council is going to have to hear it so everything at this point at this point is very very preliminary and if the question is the issue of methodology which might be what you're getting at that methodology is one of the reasons that staff asked for deferral so that it could be examined in detail so i'd almost want to put a pin in that question right now because it's just not going to get answered based upon what the issue is that we have to address and with now 70 something people in here to speak i'd kind of like to get the comments going so that we might be able to focus questions right at the end after mr laystrom speaks so to that point the way are you done i'm done just if there's any other questions we're going to wait on comments from the dais until after everybody's spoken we're going to give the public a chance to speak obviously there are many of you who would like to speak the way the late 1990s so i appreciate your uh your service to the public the uh the concerns that i have about the project is the potential number of residential um it is a shopping center i think is ripe for redevelopment um but uh putting 1700 units there is not in keeping uh with this community uh mr corman you uh you identify these are all pretty pictures that really don't mean anything they're not going to bind the proponent when the time comes god forbid the mr lad have a problem or something and he goes belly up and he sells this to somebody else at the end of the day they want a land use plan amendment that's going to authorize apparently with the calculations and the bonuses 1700 units and that's going to be spread over not 26 acres over 20 acres because the other six is commercial okay that's 85 units an acre now i don't know how you do that and keep it low rise at all i do know that the city of plantation may have passed the city of fort laurel for the worst traffic problem that exists in the county and that's that's at university and 595 okay and i don't want that to to go into broward boulevard i live less than a mile from this location you know i don't know if we made mistakes or not but what happened on university drive really should not be repeated i would be interested in examples uh and i won't take right now maybe i'll contact staff of places that have been developed at 85 units an acre keep in mind he's emphasizing 25 units an acre is in the surrounding area none of those were developed 85 units an acre i mean that is almost that's over three and a half times the intensity okay so i think that is a a significant problem i think an available tool for the folks here up on the on the dais is i went and looked at irreg res i guess that's an abbreviation for irregular residential i saw 3.4 12.6 20 21 25 it's almost an ad hoc apparently assignment i may be 100 wrong on that but i would suggest that if what they're if what people are comfortable with is 650 units that you then establish the number that he gets his land use plan amendment to if 10 results in the actual number with bonuses of 652 that's respectfully what i think you should do let's not open the door to 85 units an acre and i and live local you know that shopping center at unit at the turnpike in broward it's about four acres that means they can have 340 units there okay that's crazy parcel of land right now it does need improvement but i agree with the prior speaker that traffic is currently an issue already how many of you leave in the morning and sit at broward and university and wait three traffic lights to make a left-hand turn happens to me almost every day imagine 652 more units or 1705 units additional traffic additional waste of resources the building height is tall for the neighboring building buildings in the area there's single family homes that would be on the borderline of that that parcel yes i understand that there's going to be a linear park but just how wide would that linear park be um that's looked like a bunch of trees a row of trees that would not capture hiding from the the six or eight story buildings that will be surrounding us imagine being a homeowner and having a high-rise building looking into your backyard um with all sorts of neighbors all hours of the night um and into your windows for for that matter also um the current commercial site is underutilized but there's much potential the owners could revitalize that shopping center right now it doesn't have to wait for uh uh residents to be built there that could be done right now to improve our existing um commercial area right there uh this is just way too dense for the community uh the commercial properties are are closed in the evening so traffic ends and noise ends in the evening at least we have that right now when when the buildings are built we'll have neighbors with music and renters are not homeowners there's usually a distinction with how they take care of their property in addition to that um there's a reason why we're hearing 1705 units versus 652 because that's the goal or a middle middle road area for for that plan it's not going to be 652 otherwise we'd street um we've been here about you know 50 years 31 years so we do this for a living this is actually our livelihood i am in property management and have done it since 1991. i can tell you having apartment communities is very different than what people are saying so i know this living inside and out he's on the development side i'm on the management side i do the software side now but yeah so i can tell you i have a couple questions so how many units what is the breakdown of the 1705 are they all three bedrooms are they one bedrooms are they studios that makes a difference because how many people are actually coming in so i'd love to know the breakdown because that also makes a difference on what the car count is going to be um and then you talked about the affordable component i also happen to do affordable housing and like high rises and you know luxury communities as well so the type of affordable housing how many units is that going to be you said 10 and the type of affordable housing what type of affordable housing is that going to be i would like to know um what are the requirements for it to be managed um and how who's governing that like who's like screening the residents and overseeing what requirements it is is it workforce housing is it section 8 is it hud that does make a big difference of the type of resident that is moving in again i do affordable housing for a living so i know um i did see eight stories i did see that it does not fit in this community at all i live right here in patios in the park we talked about meeting with the board i never met with anybody um linear park who's going to police that area that's very scary so i did see potential gate so if it's left open trust me i do this for a living that's a big violation i mean a big risk leaving it open of people just kind of walking in there and then someone brought it up and asked me to ask about the city is why is the existing owner of the plaza not fixing the plaza like ask to enhance the plaza so we can get more people to kind of come in and make it better right improve the businesses that we improve that plaza now so we have more businesses that want to come in into that area and then the last thing is traffic right so i do live on patios of the park on fifth street so let's think about that so that's everybody coming down fifth street past patios in the park right going to sunrise to get on the turnpike because you know everybody's not going to be living in this area they're going to have some they're going to be in the area but not a lot so we're going to have a lot of people going up just down fifth street on 70th and fifth that's gonna be a lot of traffic like a lot of traffic going there like we can't even do it today i can't even get out of my community just to go across at all today let alone adding all those more cars we just added plantation walk-in we have the other building that went over by american express and then to add all these other units coming in that's a lot of units coming into our community thank you thank you some of those some of that information was in the backup packet so if you go into the backup agenda that information will be there and otherwise mr laystrom can address during his time hi i'm don korman but there's no e in my korman i'm just k or a couple of those in my family too so i live at 631 northwest 71st avenue which is secluded gardens and we back on well that our development backs on 70th avenue one of my concerns is 70th avenue contains peters elementary school the pal field the middle school and the high school and as was pointed out by our last speaker people come across from broward boulevard to get to sunrise and with the addition of the amount of people you're talking about that's going to become a very busy road and it's going to be dangerous kids cross that road parents are dropping their kids off at the elementary school so that's a problem as was pointed out broward boulevard is already deadlocked around the rush hour you know they can do a traffic study and it may be the two o'clock in the afternoon a shopping center generates more activity than residents but at eight o'clock in the morning when people are going to work or at four o'clock in the afternoon when they're coming home in the hour each way that's a very different story that's going to be a situation where we're going to have a tremendous amount of traffic in an already deadlocked area another thing is while there are some buildings around with the density level of 25 that was before plantation created midtown i thought the whole purpose of midtown was that was going to be the area where you're going to have density not the rest of the city so that's that's my thought thank you thank you mr chairman members of the board for the record my name is shannon estinos i live at 424 farmington drive where my husband and i have raised our children for uh 30 years now um it's great to be with you this evening thank you so much for your service i um you know the implication from the gentleman who represents the developer is that he's because i live on farmington drive and i'm not immediately adjacent to the site that he's not going to be sensitive to my remarks so i'm asking that you consider being sensitive to my concerns um this is our neighborhood so i live on farmington drive but this is our grocery store our pharmacy our vet our sunday morning uh diner our friday night wings and pub this is where we live this this corner these corners here it's where we bank um and so my mother is an 81 year old who lives in the french quarter so very very close to the site we're representing her as well um and so i wouldn't be standing here if this were a reasonable proposal so to miss gelfand's point if this were a reasonable proposal to redevelop this site which which i think it could use redevelopment redevelopment potentially if it were reasonable if it were sensitive to the nature of our community then i probably wouldn't be here this evening but it isn't 1750 units that is so far outside reasonable and compatible with the character of our neighborhood that it feels frustrating to have to come here on a tuesday evening and and say what seems obvious to me let me tell you directly that when from my perspective on farmington what's going to happen is the residents of this new community are going to discover plantation woods park and you know how they're going to get there they're going to come up cyprus they're going to drive 35 miles an hour which happens now not 25 35 and then they're going to cut up farmington they're going to cut up fig tree and they're going to cut up bayberry can you address the board please yes they're going to cut up farmington they're going to cut up fig tree they're going to cut up bayberry in order to get to plantation woods park that's we don't remember we are historic plantation that's one unit per acre density in that neighborhood and we're going to be directly impacted by what could be 2500 cars and it could be that many if you've got 1700 units and 50 of them have more than one car so we don't have sidewalks in our neighborhood so we have baby carriages and bicycles we all walk on the street we can't handle um that kind of additional traffic impact in our neighborhood and it will impact us even though we are not immediately adjacent it will certainly impact my 81 year old mother's neighborhood this doesn't have to be 1700 or nothing um i would hope that the developer would come to our neighborhood and by the way we don't need somebody to come in and make our neighborhood awesome our neighborhood is awesome and we need a person who will come to our neighborhood and respect it for what it is um and want to be a good neighbor to the rest of us thank you ladies gentlemen i am reverend dr david massey i live at 5601 southwest third street i recently retired from the plantation presbyterian church which is located at 901 northwest 70th directly across from peters elementary school i speak against you're changing the land use besides that another point about the land use changing even to commercial it was great to see that foxy brown was one of these operations from foxy brown itself port lauderdale is closing its doors on may 10th due to the increased rent costs thank you hi good evening my name is richard grosso i also live at 424 farmington drive just down the street from this uh i used to sit on this board many years ago appreciate the service and this is hard work um i'm also a land use attorney i know comprehensive planning stuff pretty well i claim and this is a massive comprehensive plan amendment a massive policy change this isn't the kind of thing where we comply with the code so you have to say yes this is completely distant from that the um redevelopment is not an all or nothing thing right everyone agrees this needs to be redeveloped this is way way way too much i thought so after i read all the agenda materials for tonight i'm more alarmed now that i see the site plan flashed up here yes it's not a guarantee that's what's going to happen but it's a rendition of what the would be allowed by the plan amendment if this plan amendment is is approved your staff points out we have designated redevelopment districts for a reason that's where we intended this kind of thing to happen what we saw tonight is exactly what we planned our city planned for the midtown and the gateway redevelopment designation districts this is not the character of our community from a matter of height matter of density a matter of traffic um there was an issue that um and steph's right by the way comprehensive plan amendments require an analysis of the adequacy of traffic so they're right about that the law requires that an argument that says we're going to reduce traffic because right now the potential the commercial designation would allow x amount of development yet on the other hand the applicant is coming to you saying commercial is not happening there so which reality are we supposed to make the decision on i think that's a false claim that theoretically max commercial on the site would give you more traffic than what we'd get with this that's not the reality they're talking out of really contradictory claims there um there's no way cyprus can handle that development uh the traffic if you are relying on wells and buffers and trees you are incompatible with the surrounding development this is way out of scale for our neighborhood for all the reasons that you've already heard the other folks talk about this morning affordable housing credits six market rate to one affordable housing your staff had said they're not even meeting our most biggest need for affordable housing all the commercial are we getting a net increase in affordable housing or are we generating more affordable housing demand because of the commercial and market-based stuff than we're getting with the one unit per six that might be approved with this the net results probably worse for affordable housing needs in this in this city overall you have policy discretion you should exercise it to say no direct this developer to come back with a significantly downsized project i really appreciate your time this evening thank you very much dennis conklin 4581 northwest 6 court heavenly host protect you and all of your families uh i want to thank the uh chairman for figuring out which was the actual number because in the three documents i looked at it was 652 2200 and 1705 so thank you for that um i'm i'm really against the uh uh recasting this um the the word that has popped up is the a word but no o word and that is affordability and not ownership and uh when you get into the backup you see that the neighborhood the median income is 57 000 which is below the county which is 68 and um if you go for affordable housing right uh those are the figures so per month that would be 5 700 bucks a month for that neighborhood which breaks out your rent or your mortgage at 25 of that if you want to ever live and own anything would only be 1400 bucks a month ownership affordability what the heck now the other thing is uh the census in 2010 when the original figure came out for 2011 652 was 84 955 in plantation 2020 it was 91 750 and 2026 the census bureau says plantation is 104 997. um a few years back plantation tried to collapse the whole city into one flex zone i live in flex zone 73 neighborhood east of the turnpike i live in plantation park east i bought there because single family homes and no pud's no uh hoas and basically the city was set up that way when we moved in here because before ownership my wife and i rented in lauderdale lakes and lauder hill and what's happened now last wednesday the state redistricted for congress and i don't know if you know this but prior to the redistricting most of the population of plantation was in district 25 but if you look at the maps they took n012 out and put it into my congressional district 20 which puts us even deeper under the thumb of high rises of lauderdale lakes and lauder hill because that is the high density area of plantation it literally flipped the population uh concentration and landmass area into my district which is very compact so we're not going to be represented as single-family homeowners and we do own mr conklin there's i'll give you back my thanks because it's a long line tonight i appreciate it hi good evening says build better not bigger and we are all for development i think that uh plaza needs to be fixed go for it uh you need some dwellings go for it but we would like my family and i and most of my neighbors is no more rental apartments there's still several apartment buildings that have been approved that have not yet been built so that take that into it into consideration with these now coming why can't we have some town homes why can't we do some low um standing condos where we can have people buy um property and build up our generational wealth in our city so i agree with everything everyone has said um and just those extra points and thank you so much for your time thank you my name is dr larry seaman i'm a retired physician uh thank you for the opportunity if you would your address oh i'm sorry 7601 northwest 6th street plantation hills um came here 40 years ago i practiced in this community i did well i liked the people that came and just the idea of being in a place called plantation offered me a vision of open spaces calmness nice breezy saturday afternoons a nice walk in the park a nice calm comfortable atmosphere just to make a couple of points this new uh development that's being proposed is going to create i would imagine a lot more tax revenue so my my question would be is where is that extra tax revenue going to be going and what is it going to be used for is it going to be brought back into the community is it going to be brought back into uh rebuilding or or improving infrastructure roads and whatnot number two second point right now we probably have less than 100 people maybe less than 50 people that live in this area that looks to be redeveloped 50. a lot of people that come and go because they work there but as far as people that live there seven days a week 12 months a year maybe less than 50. how much of a traffic impact does 50 people have in a community the roads that border this property if you go from broward boulevard to university to sunrise to the turnpike those are probably the only more than one lane roads in that entire area every area that you want to go to if you live in that geographical boundary area you have to go through one lane streets you have in order to get to a main street in order to get to a major artery that's either going to take you north south or east so if you go from 50 people in a community that that maybe there's 50 that live in this geographical area and you're going to put in let's say 500 homes that's 1 000 people that's a thousand more cars minimum that are going to come and go at least twice a day during a time of the day that's already overcrowded not to mention the service people that are going to come and service those people amazon the post office fedex instacart any of the other drivers and trucks that are going to be on the roads are going to add to congestion and again thank you for the opportunity of voicing my opinion thank you cynthia bush 30-year resident plantation 700 southwest 78th avenue which is the midtown 24 building rental i'm also the vice chair of the midtown development district board so we hear about these projects all the time and discuss them all the time um i obviously would recommend deferral at a minimum for this project um the potential for 1700 units seems quite stunning to me we're not we haven't considered anything that size in midtown recently um and um my as a 30-year resident i also lived in royal palma states with you know robin who spoke earlier i know richard grosso i agree with everything he's saying um the whole we actually redeveloped the entire golf course and put in a linear trail so that we did not have to have development in this area this area this area was meant to be something different from what was going on over in the midtown area and we have challenges in the midtown area serious challenges with pedestrian friendly sidewalks with bike paths with mobility issues i know max is on this all the time here um and so my concern i guess about this project is it's sort of being plunked down into this area that really doesn't have any like many areas of plantation um proper crosswalks sidewalks there's so many things that need to be considered um with the transportation plan with the traffic plan with the pedestrian plan which inevitably are going to come from 1700 units um in addition i reviewed sort of the some of the um they were referring to sort of bus lanes and transit routes that really are not in the vicinity of this project the base the bus 81 is not within a quarter mile of this project the light rail is not within a quarter mile of this project those large building projects that my understanding from midtown were going to be on 441 and down sunrise because that's where the light rail was going not on broward boulevard that doesn't i'm not quite sure i understand exactly how mass transit really is going to be helped with this project it just seems like we are gonna we're not quite there yet is my opinion thank you hi my name is carol bennett i live at 1039 east tropical way which is one of the danger zones if you ever walk that street today um i'm glad you clarified the number of units i think we still don't know how many it's going to be i am against a changing the um property to be multi-use um i disagree that that's not an area for commercial property i see the town center does very well if you get the right stores and rent is right people will come to that shopping center now if you do change it maybe a few homes would be okay but i definitely think we need more ownership this is not midtown it's not intended to be midtown midtown does have a lot of problems and i don't think it's been all that successful um the traffic would increase on the major roads we've already know that all the neighbor local neighbor roads that people have mentioned you know it's going to be um the tropical ways for sure 70th avenue fig tree cypress road these are all going to be impacted by this and it's dangerous on our streets today we have to fix the today problem we can't add more traffic so a smaller proposal yes you know but not this this is not the right place for it we are not welcoming this at all thank you thank you hi my name is robin vott i live at 7300 southwest 5th street in the eldorado subdivision first i want to say i have to make a right-hand turn if i want to go west on broward boulevard f after three o'clock in the afternoon you just cannot get out of our subdivision but i wanted to talk to you i want you to remember right now we have 16 816 rental apartments in plantation in the pipeline we have 2572 that are already approved we don't what why can't we do townhouses and condos people live in there that mid i go to um plantation walk three times a week to go to the gym beautiful huge big apartments big central area you can't the buildings are closing the businesses are closing faster than they're opening we we can't we're not sustaining what we have look at the broward mall we we need to have like a place where there's uh i'm thinking like in weston where they have pods where there's townhouses and apart at condos not apartments we have enough apartments and plantation that's my speech thank you thank you hi uh matthew mcintosh 601 northwest 82nd avenue for those that actually show up to planning zoning board meetings you'll be more used to see me up at the dais um but i'm just here because i work in an office building across the street i support this development and say it's not only fits the character of the neighborhood but improves it uh someone mentioned that there's a difference between homeowners and renters i'm a renter in midtown and i'm a long-time member of this pzp i've been to almost every pzb meeting this year and haven't seen 95 of the people in this room today in any of them there so i guess my concern here is that there's a lot people saying listen to the community listen to the community but are the all the people that are coming out today actually represent the community if you look through it it's no there i feel like the people here trash midtown which is where i'm from without ever actually stepping foot out of their car to visit it there are baby characters in midtown believe it or not there are people that are young there are people that are building their lives there and then when you have all these comments saying oh i have mine i got mine 30 years ago take it away from the young people don't build anything there i find that's ridiculous and i don't think that's really should be acceptable you wouldn't discriminate somebody based off their race gender so on and so forth but you're going to discriminate based off the housing status of being a renter versus a homeowner i say nonsense to that walk around my shoe before you kind of throw a rock at me it's like what and you're concerned about apartments generating traffic if you actually step out of your car in midtown you'll notice the apartments are in walking distance of a public's so i walk to public's i'm not the one generating the traffic it's the people that drive everywhere and complain about the traffic that are the traffic generators that's it and i work in the office building me and all my co-workers walk to the public's because the office is in walking distance of the of the public's so if you're going to oppose like building more housing by schools you're encouraging more people to drive their kids to school generating more traffic so that's the logic it might be foreign to people that have been living in a single-family home for 30 years hooray for you but if you actually well if you actually take some time and actually come to some of the workshops that plantation has at the same exact time we go over the issues and the solutions uh to those issues that are facing the city so please like don't like let this loop up thing be the last thing that you come out to actually come out to stuff and be engaged with the community instead of trashing the ones that you don't know about thank you thank you matt hi i'm paula pompa i live at 880 east plantation circle i was born and raised in plantation i mean 70 in july and i'm a real estate broker and property management and i agree with everything except that last gentleman and he might have a point too maybe we should go out and look around and see what our neighbors are but no no no no to that project no if i wanted that i would live in north miami or aventura and and this is why i'm here and stayed here because i could live anywhere and this is the best place there is thank you good evening joe n 944 northwest 92nd terrace i do want to thank uh the people on the board as well as everybody in the community who has come out tonight uh it's really uh amazing to see this much emotion and attention and care for a community not all places have that so in that sense i'm really happy to see that and i'm glad that that is a thing and i would encourage them continuously to stay involved as mr mcintosh mentioned as well on other issues in our city because that passion that engagement that these people have many people who have come up here though i may not agree with all of them have expressed actual issues that this city has and we can't get those things done unless they come out and convince board members convince city council that these are issues that they care about if they're coming out seeking about um about traffic about uh safety on roadways about congestion of some kind about buildings or something so in reference to this lupa the largest potential number does come across as a concern when you look at it in its own picture if it were inside midtown as others have shared you have the connectivity you have the ability to reduce a substantial portion of that in car traffic here i think you can actually reduce quite a bit of it especially if you get some anchor stores and things that you can do that you don't make all your trips be driving especially if it is within walking distance of some parks of a at least one market restaurants office buildings things like that banks as well the challenge is that we aren't there to a fully cohesive connected community we aren't yet paris right paris is a place in the old town where you can have this kind of density without it being very tall buildings and you have a wonderful degree of walkability one of the reasons why the density seems so amazing and incredible that it even would be there is that this lot is just parking lot it's it's the broward mall's parking lot shrunken down and stuck somewhere else i spent a lot of years going there i trained in martial arts in the corner and when i was doing pow soccer i was at the pizza center after games we won and after games we lost and overall i think that we should be considering approving a lupa for this but with a consideration of density that respects the people in the area to their satisfaction to a degree of satisfaction and for those who don't want this here but say it should be a midtown come on out and support that guys thank you hi my name is dawn causa 7321 northwest 10th court i'm born and raised in here in plantation four generations three homes 65 years ago we've seen the city grow incredibly the comment about this is just a ghost of an idea i agree but the problem is it's the ghost that can turn into reality um i think a lot of points have been brought up but things there needs to be answers to questions like so everyone really knows a lady had mentioned it but what exactly has been approved how many units apartments are being built 100 approved and the works are getting ready to start then you've got uh unincorporated fort lauderdale that sits right on the east side of the oh excuse me yeah east side of the turnpike they're going to tear that down where the archery center is and i think it's approved for over 300 apartments that's not part of plantation but it's sitting right there then you've got the mall the famous mall so if they're proposing 1700 units in this little parcel of land what's going to be proposed over there thousands five thousand eight thousand ten thousand so i don't know how we can even discuss this it seems like a mute point because i thought plantation was supposed to be suburban this is what everybody in miami where my brother lives says they all die to come here they want to be in suburban land they don't want to be in miami and for god's sakes we do not want to be in fort lauderdale anymore a crying shame but that's the facts it's overbuilt it's got major problems um the proposal that you see with all the pools and landscaping all that takes money to maintain so what's that going to look like 10 years after the fact and what is that rent going to go up to and i really think that the word affordable housing is now the new carrot i understand it's an issue i'm not denying it but it's the hook it's the sales pitch it's the way to reel you in like a crazy fish and everybody to jump on board and buy in in two seconds to everything because they hear the word affordable housing and i may be mistaken but i thought we heard them say and maybe i'm wrong fresh market is that correct would be a part of that possible property okay how does fresh market equate to affordable housing that's pretty funny right so if you can't pay your rent you're going to shop at a gourmet grocery store um thank you for your time one of my one on to move note before the next speaker comes up when i said it was a ghost of an idea it was exactly that because you can't trust any of those images is what i'm saying and with garcia affordable housing affordable housing component allows for bonus density so without approving any affordable component the amount that could be built on there would be much less so in a way the developer uses affordable housing to get the extra units so it's it's solves two problems at once so that's i just i just wanted that one out there just to address your those two elements next speaker please good evening jay mcmillan west tropical way there are 47 let's talk lupa there's 47 zoning districts listed under section 27 for 71 of the city land development regulations article 6 commercial and irregular residential 25 all within a dash line is not one of them so by using the dash line to determine density and and the proponent is circumventing the policy of 120.5 ii of the comprehensive plan that's on page 123 i don't believe the dash line should be used here i don't know why we're using it here it's great in midtown it's great in gateway it doesn't need to be here there has been no significant change in population social economic factors or physical development of property nearby where the zoning is affecting the subject property which has created a present problem or opportunity that justifies a change of land use classification on the subject of the property the established character of the predominantly developed areas should be the primary consideration when a change of land use classification is proposed the site is bound by single family i'm sorry i had it on the wrong page the site is bound by single family residential areas to the south that are three per acre to the west you have newport you already seen that and the display from the city on the zoning map shows the the uh polo glen as 25 when the city's own zoning maps show it as 15 not 25 density so i don't know where that came from that was recognized as an error during presentation okay um the proponent has owned the shopping center since 2022 in that time little effort has been taken to enhance the appearance or viability of the shopping center it appears a long-term goal of rezoning and developing would be better served by allowing the sector to decline and underperform thus satisfying staff to the need for redevelopment unfortunately i only have 33 seconds uh mr lad did you give a interview last year mr lad you can't you can't you can't cross-examine doing this this is just i'm just i'm going to state an interview from mr lad that's fine okay that you can do you can't cross-examine last year mr lad gave an interview with the sun sentinel and he talked about the development winding down in fort lauderdale he said that fast-paced growth has finally hit its skids for a number of reasons including rising interest rates nationwide downturn volatile financial markets and developers who share their insights with the south florida well unfortunately what he's saying is uh all the apartments are going down in fort lauderdale in the city of fort lauderdale they're they're they're not developing thank you so naturally he's going to come here thank you good evening my name is ana cameron i reside at 235 northwest 75th way here at lakes of newport um i was not going to speak but i felt compelled to speak on behalf of my neighbors my family myself um i moved here to plantation uh six years actually literally over six years ago after serving the military i retired from the army 20 years um thank you and so um i have lived in many cities many states many countries and nothing has compared to the city of plantation specifically this area i chose this for my kids um so when i think about coming to plantation i come to a place where i can relax i can have my kids play ride bikes whatever so um one of the things that i've noticed in the past six years since i bought my home is that traffic has gone out of control many high-rise apartments are going up and i believe that that is totally insane so for that reason i totally disagree with the lupa i do agree that that uh commercial property needs to be um beautiful um you know has to go through the beautification process just like uh other properties like the one where ole ole mexican grill is and the one over there in sunrise and university um i think that we have potential to make it better but i don't think that this is the route to go um just coming from work just it takes about three lights to just make that left turn into lakes of newport and if i go a little bit past lakes of newports into the plaza i have to make a left on 70th and it takes about the same amount of time so i just want you guys to think about not only us but also to uh think about the future of our children you know because this is where i plan for my kids to grow i do want to be one of those residents like say proudly that i've been here for 30 40 years hopefully i can make it that far but um just basically just to think about all of that thank you so good evening uh bonnie chow 340 west tropical way i know that uh i've heard two of my neighbors on east tropical and west tropical come up so we are a corridor we are this the the housing right across the street from where this development is going to happen the traffic has gone up crime has gone up as well so you know see the blotters on instagram with plantation police we follow that closely so we're we're happy with the transparency but this is just going to continue to increase especially with the development of this size does that shopping center need to be redeveloped a hundred percent it really really does um ownership is definitely a plus because to the point that someone made earlier tonight when you're an owner you take different care about what you're doing to that young man who talked about the 30 years and being a renter hopefully his goal is also to be in plantation and be an owner as well we've been here 22 years we've raised our daughter but we've noticed a lot of changes especially with the traffic my office is right across the street from the ray armstrong park and even just going home being less than three minutes away to west tropical way there's traffic and it takes me 10 to 15 minutes to get home at five o'clock when i close my office because of the traffic that's increased we have more than enough apartments let's look at developing this into something that we can be proud of and that really speaks about plantation and the reason that we came here 22 years ago and the reason that it was a neighborly town where you went to church and you bumped into people you went into publics and you bumped into people that that's losing its feel and we don't want to do that especially because of the investment as homeowners that we have done and if there is going to be additional traffic studies there should be traffic studies done for east and west tropical we are the gateway to peters road and broward and people cut through there 50 60 miles an hour those bumps that are there do absolutely nothing we have children who play in the streets we have dogs that have been killed because of um the high traffic coming through so that's not something we want for our neighborhood at all thank you all right good evening everyone i'm roberto fernandez i'm a parent of a plantation student a former plantation high school social studies teacher and for the record i'm a resident of sunrise um and would your address i my address is protected under florida statute 119.071 okay then so be it i'm also a military veteran so that's kind of why i'm here to briefly raise a concern about school capacity as our community continues to grow with the consolidation of plantation high school plantation middle school along with potential of this new residential development memory many families are anticipating increased enrollment and potential strain on our existing facilities i understand that school construction decisions are made by broward county public schools not this board but as you review development and plantation you play an important role in considering how growth impacts our schools so my request tonight is this as you review current and future development proposals i ask that you consider the impact of residential growth on local school capacity and encourage coordination between the city of plantation broward county public schools and developers to explore solutions one possible solution if aligned with the school district's needs could be a partnership where new development helps support additional education facilities i'm thinking new buildings on school campuses i offer this not as a demand but as an idea worth exploring and i think this board is in the best position to be able to engage in those conversations at minimum i hope that this concern is reflected in the public record and considered as part of long-term planning considerations thank you it will be i also you encourage you to go to the education advisory board meetings and attack it from that side as well thank you good evening thank you for your service um my name is linda chaska and i live at 1410 campanelli drive plantation i don't live in this neighborhood i live west in lauderdale west but i have been in sunrise implantation since 1982 the proposed units four buildings 652 units four buildings 1701 how many floors will be needed for maximum profit the reason being we are plantation who are we ask yourself do you want our city to turn into a concrete jungle um the i live near shallamore and cleary has everything is set back for some reason they put homes three feet away from the street i don't know why okay back to traffic i use university drive north and south from this area south of 595 at least four to five times a day a week and east and west on broward two to three times a week this development is two lights east on 70th avenue two lights east of university university and broward right now between 3 p.m and 7 p.m is almost always bumper to bumper now east and west it's not as bad but it is growing now you're proposing to put a potential of 1701 that's two cars per family or car car and a half per unit at what point do we max out our traffic our streets and all of these nice people here have been talking about their individual neighborhoods increasing 70th avenue be a racetrack thank you very much thank you hi i'm glenda geist and i live at 1020 west tropical way one of the cut throughs that will be affected by this development my next door neighbor and i are both retired firefighters so one of my first concerns is in the firefighting and ems situation i know we're a volunteer department and i come from a we both come from paid departments and we know what it's like to have a busy station busy crew busy area and it will get busy with with this uh development i thought that the presentation that the gentleman did at the beginning that was very long and very flashy and had all kinds of beautiful drawings that may or that are ghost drawings that may or may not happen um all the beautiful trees around it they also said that they would be asking for more variances i know we had a couple of i came from miami-dade county near aventura and we had a development right one block over from me and they got variances for fewer parking spaces fewer trees and it and it was a mess like and the and the units are built almost on the sidewalk it's terrible so i'm wondering what variances they're going to get they have a linear park oh the neighbors can use that no they can't there's a gate so no they can't um and the buildings if they're eight stories tall what kind of buffer is there baby trees put up some 80 foot trees that are already mature to block those ugly monstrosity but i think of king kong when i look at those big tall buildings in this nice neighborhood of of individual uh one-story homes and i'm like it's gargantuan and no privacy for those poor homes that are right next to it that the that the upper floors are going to be looking down into their backyards i think it's awful um and the numbers that everybody says between the 650 and the 1700 that's ridiculous it's horrible it's maneuvering it's slick it's a shell game and and as somebody else already said there's already designated spaces for this kind of density and like the other gentleman said that was very knowledgeable because i don't know a lot of this stuff um 85 units per acre 85 that's not 25 that's 85 and that's completely unacceptable for all of this neighborhood everybody who's here will forget it and if this construction company this building company is so good at all the beautiful commercial spaces that they said that they've built then redevelop this into a beautiful commercial space not a high density residential thank you thank you hello my name is peter kaneski i live at 7051 northwest six court it's in secluded gardens and it's right off 70th avenue the part of 70th avenue that goes to two lanes and is now four lanes which is about four blocks from this development by the way uh i noticed that when the developer talked talked about the traffic study went up to fifth which is like i said four blocks from here because when once you get across fifth then you're in the two lane section and um i can't even use that road 70th avenue now because when school is in session and it's getting out or people are coming to drop off students the cars are lined up on 70th avenue for like a for like a quarter mile or half a mile so can you imagine that you add 652 apartments or or 1700 apartments what that's going to do when i travel throughout the country and i talk to people or go anywhere i tell about my neighborhood and people aren't came to plantation and live here because of the quality of life that we have we're a tree city uh we've got a suburb suburban feel we can move around freely because the traffic is not out of control that's changing fast because i noticed now on broad boulevard going west during rush hour takes three traffic lights to get through it can you imagine what 1700 apartments would do if you look at statistics the statistics show that take that for most household the average household has 2.6 people in the household and each person that household takes four trips a day so if you have 652 apartments uh that's 60 60 700 trips a day and if you have and it's 17 000 trips a day if you have 1700 apartments that's you know and we're told that a traffic study is showing us less traffic i mean who paid for the traffic study you know i mean go to any court where there's expert witnesses one says it's white and one says it's black what it is who paid them that's what it is so that a lot of judges have said we have to use common sense okay because someone tells you something you just got to use common sense if there's if there's if they're making all these trips per day there's going to be way more traffic plus as the gentleman pointed out there's going to be you know always delivery services coming you know and and they're using other services where people come uh to their house uh so those are the things i'd like to point out and i ask that you uh do not um you know change the land use uh to wreck our way way of life uh to allow our roads to be congested beyond become a fort lardale or miami which we do not want here thank you if most of you guys have been here for a long time i think the precedent has already been met here a very famous individual wayne huizenga bought plantation golf course wanted to put condos all over it and what did the city of plantation say no i mean like i said i've been here my whole life i've seen it change the footprint that they want to put on that corner doesn't fit our city okay and if i looked it up on chat gpt and the neighborhood i live in i live in plantation park they say that's over 200 acres there's 600 homes there that's the total footprint of what they said i'm not exactly sure chat gpt is not always right but if you even say if it's 160 acres and there's 600 homes they want to put in 1725 acres and they're saying it's not going to cause a problem doesn't sound like historic plantation i appeal to you as councilmen you have the responsibility toward the city of plantation and you call it plantation where the grass is greener this is an appeal please say no don't residential units it's a balance that balance is officially gone if you approve this looper i'm asking you to represent the people who already live here not the people the developer wants to move here that's okay i've been a resident of plantation for about 32 years all my kids have been born here i have four children we love plantation i've lived here over 30 years own property here have businesses here um i am pretty much here on behalf of the tenant something that hasn't been mentioned um you know there are over i want to see close to 18 to 20 families that live off of this community this center you know whether it's the lady who makes the thai food which i eat there often or amp fitness where i try to work out and push back the aging process or where we get the yummy delicious um you know the conch fritters i mean that community has been part of you know my family and my life for quite some time uh where i have one of the mailboxes there i'm in the process of you know seeing how we can help him keep his business going um my question to be would be ask these you know and i love development i think the building design was beautiful i'm in construction i'm an interior design i'm in this type of field and i don't know that it's a fit for plantation i agree with what the people are saying it's it's a beautiful development it's exciting to see it but the location is when it becomes a jarring monstrosity we're going man is this greed or is it really something to beautify the property um and after speaking to many of the families who live in that who live and work what's it's called plantation town center that's what it's called the people who work i've been going there 30 years i don't even know what it's called i just know that there's people who we go there food fair and everything else and asking them you know have you been spoken to is there any and i don't know if there's a question you guys would ask of the developer is there any kind of right of refusal or any provision for these families that are just going to be basically brushed aside when this place gets demolished and turned into a parking lot people that have had their businesses there for 20 plus years 30 plus years uh you know ron is one of the guys who's there he's been there 30 years and you know he doesn't know what what the future holds for him and so i just wonder is there a provision that the developers making maybe he is and maybe it's wonderful but we're not aware of what that is um you know when they decide to do what they're going to do in that place are those families going to be cared for is there going to be anything for the tenant to actually make the community what it is and i want to just end with this after speaking to people at amp fitness speaking to people who who who live there who have their livelihood having their businesses there um they all have a cons you know the feeling is a consensus that they feel and again not accusing but it feels like they've allowed the property to dilapidate on purpose you know and so they're like we pay top rent here and we you know the the the leases are strict and we're not really we're not really given a place where we can have our business and provide for our families and the place just it's like they're just letting it turn into a ghost town almost on purpose and that's not plantation residing in plantation since 2001. my son was born here plantation is a very peaceful a suburb it has its own character with parks and golf courses okay so i don't want to disturb the neighborhood with this project this project is going to be a disaster for all the neighborhood and then we live in peace here our peace is gone after this project so please oppose this project thank you very much thank you one more is on the way my name is ed mcgraw and just repeat that into the microphone okay i'm sorry my name is ed mcgraw and i live at 200 east tropical way and i've been a resident of plantation for 58 years so i'll have to find it give me a second on my phone here i hadn't i was upstairs a minute ago and i saw a sign on the wall and it says our vision to be unrivaled as a city where community thrives economy excels and green spaces abound and i think that sums up everything myself and my friends feel about the plantation we need we need to make some changes but we don't need to change the city itself because there's plenty of apartments around townhouses over 55 houses something like that but we need to keep plantation what we what it is and what it's been to me my whole adult life thank you very much thank you all right nobody's making their way up so i'm going to do going once going twice all right public comments are closed on this particular issue mr laystrom you wanted five minutes thank you mr chair members of the board two parts of this i want to respond to some of the comments that i picked my favorite one is amp fitness just because i represent amp fitness i represented them when they signed their lease i got their conditional use approval i believe right here and they were aware that the property was going to be redeveloped i will tell you this las vegas is my favorite restaurant that just happens to be mine and i've talked to mr ladd repeatedly about the businesses that are there the businesses that should remain but we are trying to get rid of the larger leases that's why the the space is empty so that we can provide that space but quickly on affordable housing because there were some comments just on that in general look government just chose to try to incentivize affordable housing and the way they did it is through the providing of market rate units our proposal is currently to do 120 percent of average median income which is the moderate income level end up with a typical uh family income 95 000 to about a hundred thousand dollars plus or minus the staff report does recommend again part of the site plan process but does recommend us looking at 80 units which we then get a bonus of nine units for every one uh affordable units and at the low which is 60 percent of ami we would get 19 units so we're certainly open to all of those incentives that the city and the county have chosen to put before us we've picked the the 120 percent we thought that was a nice compromise but certainly we're listening to those things but going back to the very essential where the chair first started is this is the land use amendment it's for 652 units it's for 25 units per acre which is compatible with what the land use is around our project the land use process i come here i go to the city council i go to the county commission while i go to the county commission i then find my site plan we're talking about a year and a half worth of approvals by the time i get through with this then we come back to the city for final approvals and so while everything is a ghost you've seen what our vision is for the site will it stay at 1705 i don't know but you're not approving that today you're giving me the opportunity to present a site plan at 652 units with up to 60 000 square feet of commercial and if you look at each of the standards that are set forth in the staff report including our applicants response which i ask that you include in your record the staff reviewed each of them and found us to be fitting within all of those criteria to get this property redeveloped it's not our intention to run it into the ground but we are going to leave space vacant because that's the whole purpose of the redevelopment of the site we can't do it with ongoing leases and with that i ask for your support i'm happy to answer any more questions i will stay afterwards for the public so that i can answer any individual questions because i did mark a bunch of smaller issues down um that i'm happy to stay and answer and have uh charlie and my team here as well thank you very much all right so we've heard from the public we've heard through clarifications from the applicant are there any more questions from the dais vicki i don't have a question i have a comment um several years ago i was a one woman band fighting against the development and plantation it hasn't been completed yet it's going to be but it's not going to be what they originally wanted and i started coming to city council meetings and i came to planning and zoning meetings and um i'm so i'm happy that you were all banded together and i'm glad that you all were here took the time out of your day and your evening to show that you feel the same way that we all do that we all love the city of plantation and i welcome you to come sit with me at any city council meeting i'm all the way in the back in the comfortable chairs and show that you love your city show the people that we elected to be our representatives that you love your city and at city council you have three minutes to speak but i personally thank you all for showing up tonight any other comments so under the similar vein again i just wanted to take like two minutes i took a lot of notes because you guys i really appreciate this i appreciate all of you being here and i just think for a moment it's 250 years the fact that we can sit here and debate and argue that and the diversity of our city and our panel like that's that's pretty cool and this is a privilege and so i am so privileged to hear from all of you and all of you this is what makes plantation i also want to stay with that status i think there's some confusion no one's saying that being a renter is bad or you don't have the same status what we're saying is we don't want you to have to rent we want to give you ownership a pathway to generational wealth by renting you're just paying money to someone else like we i want you to own when i the reason i chose plantation is i saw that it did not look like the other cities tropical way all the different old plantation to me i wanted to live in plantation acres i can't afford it i want to live in some of old plantation i can't afford it but it's a beautiful place so i chose what i was able to afford so i want renters to be able to afford and i also want us to acknowledge i thank mr ladd and mr laystrom from being here because actually choosing to build business in our city is very important spirit just closed and we lost 4 000 jobs in this county so this is a very very delicate balancing act of development to build businesses but also keep the plantation where i can see sunsets and i can go and see beautiful grounds so that's one major issue and mr ladd i've seen your work you can do beautiful things and i really love this slogan build better not bigger that's brilliant mr ladd i'm challenging you come back and offer to build this plaza better but not bigger make it plantation personal to us and then i think you'd win over a lot more people i also just really quickly last point public servants so why can't i afford to live in plantation acres or the beautiful old plantation i'm a public servant my address is protected too the people who work here are lovely staff they can't afford to live here either our teachers can't afford to live here either and mr ladd i know in fort lauderdale that you have special rates for public servants and i've tried to bring that up to plantation i know that's one thing that has to go to the city and i know miss relation says don't talk the live local act whatever but i would like to see that and by the way it was public servant recognition day this past i think it was this past week and so i think all the lovely staff of our city um and with that i think this is really a balancing act and i think all of you i think it's a privilege that we're here and i think every single one of you for being here and i think that debate is what makes our country great and it's a balancing act and i love that slogan and i'm totally stealing it build better not bigger i love it and i'm challenging mr ladd come back and make it better but not bigger and a pathway to ownership and we want public servants we want police and teachers living i want them to live in our community too so i challenge you all right awesome yes max go ahead so i'm going to make a few comments the first is directly to the developer this is just a suggestion for going forward you know regardless of whatever we vote for here uh when you end up going for your site plan approval process please try to do some sort of transportation demand management the main comment that we've been hearing is traffic and if you can prove that you have a plan not just a traffic study that says it's but you know a plan that you're going to work with all parties relevant to actually reduce the amount of car travel from your community because you propose this with like 3 000 parking spaces that proves to us that you're expecting 3 000 cars um so in the future you know try to reduce that parking count try to subsidize bus passes talk to bct they're actually doing their network redesign right now at the same time it's this meeting there's another meeting in davie where bct was having their public meeting about the bus network work with bct to make sure that route 22 can go straight from your developments in downtown fort lauderdale to here every 10 to 15 minutes and that way you can actually reduce the number of cars coming in and out of this property so that's my general advice going forward i don't like that parking count um now i'm going to say a few things that are probably unpopular with the crowd here the first is this ownership versus rental debate if you're asking for us to put some sort of stipulation that this be an ownership product you're asking for a completely unaffordable development right now with property insurance being what it is all the building codes being what they are it is impossible to insure or finance a condo building in south florida right now if you do you're the the benefit right now is being a renter being a renter you're saving 40 percent on your cost of living in a built environment versus ownership uh if i move from where i currently live i'm going to be a renter because i cannot afford to be a homeowner uh especially not in plantation uh that being said for this actual lupa site plan which is what we're debating not the 1700 unit project just the the land use plan amendment we literally just sent a new comprehensive plan to the state along with passing a tod ordinance that had a map attached and it shaded in red every single site that we wanted to rezone for tod for mixed use development along transit corridors and this site was one of those big blocks shaded in red so we passed a plan and we sent it to tallahassee saying this is what we wanted to do we have to be people of our ward and actually go through with what we promised tallahassee we were doing that's my comment all right i actually have some questions um with regards to the presentation maybe staff can address it in the engineering section marked in red it said there are inconsistencies throughout the submittal that need to be addressed to ensure accuracy and alignment with the project requirements under the first paragraph it said they submitted a new document prepared by kimberly horn title application to amendment city plantation brow county land use plan on page 18 of this document the applicant included a table indicating that the proposed land use amendment will result in 4 950 fewer trips than current land use entitlement based on that conclusion the applicant states no additional traffic studies will be provided however we previously requested the applicant prepare traffic methodology for this product that methodology was submitted to engineering reviewed by our consultant on page 11 the methodology report the analysis shows that the proposed land use will generate 1300 13 more trips in the existing land use scenario so clarification on that is that one of the reasons why the deferral was requested because there were differences in numbers as to what was being proposed as to what they gave you and the ability to correct it that's correct we actually we had a meeting with the applicant a couple of days ago dealing with engineering's comments and we've been talking about how to resubmit the traffic analysis consistent with with engineering's recommendations so right now there's just a gap in that understanding which was the reason for the deferral yes okay um is that an element that is covered in the drc development review committee traffic analysis yeah yes so is there a reason that wasn't addressed in the drc before coming to us well there was a discussion about what the traffic analysis should be i'll have to ask the engineering department uh subsequent to that and to the approval and what they were expecting why they didn't get back what they were expecting that's something that engineering would have to address okay thank you and i'm not even going to go into that next one because it doesn't bear on the question at hand which is the lupa but in light of the fact that there is that question there is read on this application and that staff requested the deferral and you have the best interest of the city at heart i'm going to make a motion to defer the question is do we have to do it to time certain or not this isn't quasi judicial so you don't have to do that okay um but if you if you want to do that obviously you can and it may limit some of the additional costs and it'll let everybody know when it to expect it to be heard again i'm not sure what time that would be because they have to get information staff has to review it there may be some discussion so we may not know when that would be do you have a recommendation based upon the discussion that we had uh it was felt that uh it could be uh back uh for the june meeting then the june 2nd that is june 2nd is that date could be or will be will be all right in that case then i'm going to make a motion to defer to the june 2nd meeting 2026. i'll second that we got a motion and a second please
