[00:00:00] Speaker 1: Okay, I got a couple of fine ones this this nuggets from Mindy and then I've got a little fun thing from the birthday for from Lucian which is which is really cool and then we get into a serious sentencing just just a little warm-up. We're doing a forensic on this so
[00:00:32] Speaker 2: no he has a forensic on a felony matter so these cases are very over I guess until they get a report on the felony.
[00:00:52] Speaker 3: We're going to refer them for a competency exam on this one too.
[00:01:04] Speaker 4: I've already took those man. I'm an outstanding citizen. What are you talking about? Huh? I'm not sushiing. Whatever man. I know who I am. I have a fully genetic memory. I witness for Jesus and I'm I'm not guilty anyway man. I'm this other judge. Now you're going to slow me out and keep me here longer. That's what you're going to do.
[00:01:28] Speaker 3: Mr. Sorrell, I'm not going to listen to your nonsense. They refer judge, you witness the Jesus. What do you want your first forensic on a felony? That's what I'm doing here. You don't like it. File an appeal. You didn't stop yet. Your anger is just beyond comprehension. You've been in front of me and Judge Hessen time after time after time after time and when you were done being in front of us, you made sure you came back again and again and again and again. Go ahead. Yell all you want. For the record, I've got Mr. Sorrell muted. He's a very, very, very angry minion. We're referring him for a competency exam. I mean, so am I. Send him over for this one too. Bond's continued. We'll set a date that he's able to come back here. We're going to set a date in six weeks. Give me a date in six, eight, six weeks, Heather. Yeah, adjourn. November 25th. November 25th. Yes. We'll do this at 10 o'clock. Good luck, Mr. Sorrell. Good luck, Mr. Sorrell. I'll remove them.
[00:02:51] Speaker 5: I don't know. I don't know. I mean. He wanted to get back to his coffee, so he thinks I'm upset.
[00:03:00] Speaker 1: Karana still has two. Okay. This next thing coming up here was sent to me. They're supposedly birthday wishes. Of course, it's all AI. The voices are excellent. If you're on Discord, you might have heard it. But it's kind of funny because you've got to be a law nerd to understand it. So they're voices that are very recognizable, but the people aren't famous. So if you understand what's going on, you might be a law nerd.
[00:03:36] Speaker 3: I got, I got a word. Is Mr. Gennady ready on his?
[00:03:43] Speaker 4: I don't have a call on his. Yeah, I don't have any.
[00:03:46] Speaker 2: Oh, not right? Yeah, I don't have any.
[00:03:51] Speaker 3: Why don't you take those? If he's not ready on those, take those. Will you please? I got a wedding in 10 minutes. I'm stuck in the other courtroom. I haven't seen him in 50 minutes. Okay. And I just. All right, let me go. Thank you.
[00:04:06] Speaker 2: How many is it? Okay. Is one, is it party? It is. Yeah, you can take that on his phone.
[00:04:17] Speaker 3: What is going on? I mean, is he getting called or what's going on? I'll be back.
[00:04:25] Speaker 6: I got to tell you, if I was just a bit younger, I'd make you rethink that whole marriage thing, if you know what I mean. Wink, wink, nudge, nudge. Anyway, happy birthday.
[00:04:37] Speaker 7: Mike, it's Paul. Long time no talk. Clay Township is not the same without you. The algae wheel misses you. Happy birthday, buddy.
[00:04:49] Speaker 3: Michael, you actually are the emperor of the world. Thanks for the best show on YouTube. You heard me. The best. Now, don't start crying. Happy birthday, buddy.
[00:05:03] Speaker 8: Halo. Talk with Mike. Happy birthday. If I was in Chicago, I would have taken you out for a beer. See what I done there. Happy birthday.
[00:05:10] Speaker 9: Hey, Mike Santa Simpson. I know we've had our differences, but I wanted to wish you a happy birthday. And as a present, I'm not going to evict you from your condo. Well, not today anyway. Happy birthday, brother.
[00:05:23] Speaker 10: Uh, is this like Mark Garvin law talk with Mark Rocks? Um, like happy birthday, you old fart.
[00:05:30] Speaker 4: Yeah, marriage sucks. Hey, Mike. Rod here. I don't do happy and I don't do birthdays. So you're out of luck.
[00:05:38] Speaker 11: We have people that would like to speak. I believe that the victim's family would like to proceed last. So there are other people that would like.
[00:05:44] Speaker 1: Okay. That was fun. This is interesting and it gets wild, but it's sad. Okay. Just it's the way it is. We're talking about a sentencing on a murder one here. I'd like to make statements to this courtyard.
[00:05:57] Speaker 12: That's fine. You may, you may call them in the order that you, uh, think it is important. I skipped right to the victim impact statements. Do you need a chair? No. All right. Um, please raise your right hand if you're able. Uh, do you swear to tell the truth? Hold to the truth under penalty perjury? Yes. I'm going to put your hand down. Please state, spell your name for the record. Peggy Reese Helmick, P-E-G-D-Y-R-U-I-Z-H-E-L-M-I-C. What would you like me to know? And thank you for being here. I am the niece of Amalia Amazon and I was also a witness and I did note to call them on table.
[00:06:41] Speaker 13: First, I would like to offer my sincerest and heartfelt condolences to the Guyagos family for the tragedy and pain you all experienced. Happy birthday, Arda. Next, I would like to address Jacobo Montalvo. You are a true monster and what have you have done to the Guyagos family is unimaginable and I am so thankful you are getting the sentence you deserve. What I have learned about you is you are nothing but a liar, a cheater, a thief, and a murderer. I want you to know that Aunt Molly never read a single one of your letters from the altar. And then, and let me tell you, I did. What a joke reading the letters where in one sentence you were professing love for her and the next saying horrible and unique things, then begging for help. You didn't get a response from your letters, so you chose to send people to her house. You even chose to send a former inmate, James Ward, to my house, asking for your belongings and claiming your attorney sent him. You didn't stop there. You convinced James to help you file a claim against Aunt Molly to get your belongings and forced several visits to the court in front of Judge McKenna, which allowed James to pick up your belongings from the garage, which is mostly junk, and your motorcycle. You thought you had an alliance with James, but you two had it out in court and no longer communicate, and he came out ahead with all your stuff and probably sold your precious motorcycle. You also attempted to sue Aunt Molly and me making false accusations.
[00:08:19] Speaker 12: Sorry. It's okay. Take your time.
[00:08:28] Speaker 13: You also attempted to sue Aunt Molly and me making false accusations, but that was also denied. You're always looking to place blame and continue to tell lies, even as you took the stand. But you, Jacobo Mantavo, are the one at fault and have nobody to blame for your actions except yourself. One final thing I want you to know.
[00:08:48] Speaker 1: What? Did I get his name? Is this guy, is this guy named Hakuna Matata?
[00:08:56] Speaker 13: Is when you told Aunt Molly you got a good job and you had to go work in Illinois, we know you were doing other things and know about your eight-year-old daughter. And I pray that little girl will never have to know who you are or what you did. This day has been a long time coming and after today, our family will erase you from our memory and hope you enjoy the rest of your life behind thoughts. Thank you. Thank you very much. I appreciate you being here.
[00:09:24] Speaker 14: Next.
[00:09:26] Speaker 12: Please raise your hand. Do you swear or affirm the testimony you're about to provide to me the truth, whole truth, and nothing but the truth of the penalty perjury? I do. Thank you. Put your hand down. Please stay and spell your name. My name is Lisa Clark. Lisa, L-I-S-A Clark, C-L-A-R-K. All right. Take your time. I see you have a picture on your shirt. She was a beautiful girl. L-I-S-A Clark, C-L-A-R-K. L-I-S-A Clark, C-L-A-R-K. L-I-S-A Clark, C-L-A-R-K. L-I-S-A Clark, C-L-A-R-K. She meant so much to our family. L-I-S-A Clark, C-L-A-R-K, C-L-A-R-K, C-L-A-R-K, C-L-A-R-K. L-I-S-A Clark, C-L-A-R-K, C-L-A-R-K, C-L-A-R-K. Although Lisa had her struggles, she was so much more of her struggles.
[00:10:46] Speaker 15: She was a person without heart and a person of personality.
[00:10:57] Speaker 12: She had a whole family that loved her. And she loved her friends and her family as well. One of the things I will always remember about my niece, Elise, was the way that her and her twin brother would see together. In the kitchen, while they were doing dishes or chores. And those are the memories. I want everybody to remember about Alicia. Not her struggles. Not the circumstances of her death. But the person that she was. And the love she brought to our family. There are questions and thoughts that I struggle with every day. I cannot understand how someone could look at a person most most vulnerable and choose to take her life. What makes it even more painful is knowing that after Lise was murdered, her body was just left in the middle of nowhere and she meant nothing. Only a monster can do that.
[00:12:26] Speaker 15: But Alicia wasn't trash. She was someone's daughter.
[00:12:30] Speaker 12: She was someone's twin sister. Someone's sister. And she was someone's niece. Someone's friend. And a beloved family member. She had people who loved her. We loved Alicia. We still love her. Alicia deserved to live. She deserved to breathe. She deserved the opportunity to overcome her struggle and have a future. Her struggle did not take away at her value as a human being. And certainly did not give anybody the right to take her life. I am angry. I am heartbroken. And I am still trying to understand how God can create someone that can do something so terrible. I know that Michigan law determines what punishment can be imposed for these kids. And I am asking this court to do or to impose the strongest sentence allowed by the law. I ask that this man never have the opportunity to hurt another person or another family member. I ask the court to hold him accountable for what he did to Alicia and to recognize the consequences of his actions will stay with our family for the rest of our lives. I wish the monster responsible could understand the pain he has caused. Not only by taking Alicia's life, but by taking away birthdays, holidays, family gatherings, memories, and all the moments we share with her. He took Alicia's future. He took someone we loved. But he can't take the love that we had for her and the memories that we will carry with her.
[00:14:28] Speaker 15: Alicia deserved to breathe. Alicia deserved to live. Alicia deserved better. And I ask this court to remember Alicia. For who she was.
[00:14:40] Speaker 12: I just want justice for her. Thank you for being here. She will not be forgotten. She lives in all of you. And I appreciate how strong you are coming and being her voice. Thank you.
[00:14:58] Speaker 15: Yes.
[00:15:02] Speaker ?: Thank you.
[00:15:32] Speaker 15: All right, who's speaking?
[00:15:54] Speaker 12: Please raise your right hand. Do you swear or affirm the testimony you're about to provide me the truth, whole truth, and nothing but the truth, and the penalty of the perjury?
[00:16:02] Speaker ?: Yes.
[00:16:02] Speaker 12: Do you have two states by your name for the record?
[00:16:05] Speaker 16: My name is Andres Begos, A-N-D-R-E-S-G-A-L-L-E-G-O-S. Thank you.
[00:16:13] Speaker 12: What would you like me to know?
[00:16:15] Speaker 16: Really quickly before I get started, I do want to expend a great appreciation for the jurors, the detectives, the prosecutor, really everyone who's had a hand in this whole situation. I know it's not ideal, and you guys probably do these things more often than we do. But I do appreciate the hard work of dedication and long hours you all put into this. I know the outcome wouldn't be possible without it.
[00:16:53] Speaker ?: Thank you.
[00:16:54] Speaker 12: I appreciate you saying that. We don't hear that enough. They do do a lot of work. They did a lot of work in this case. When we went back and talked to the jurors, so you know, they also recognized how much work was put into this and how much care. Absolutely.
[00:17:11] Speaker 16: I'll try to make this quick. I'm the twin.
[00:17:19] Speaker 15: And how are you doing?
[00:17:26] Speaker 16: Good. As good as can be expected. Before I actually start, I would like to address my topic very quickly, if that's okay.
[00:17:38] Speaker 12: You may. Let me just say, why don't we move the microphone over by you? The court reporter has to hear you, and your voice is going to have a trajectory that way. So just make sure the microphone is really by your mouth. You certainly may address him.
[00:17:58] Speaker ?: Wow.
[00:18:00] Speaker 16: Got a lot of nerve and no shame. How dare you? How dare you? No, I'm speaking. You've taken a dump.
[00:18:12] Speaker 17: You say one more word. It's 93 days, and we'll be back in 93 days. One more word.
[00:18:17] Speaker 16: You've taken a dump. You've dragged us out long enough. I don't care. How dare you? Your crocodile tears are for you and you alone. You don't care about what you did to my sister. You are the hardest thing from a human being that I know to exist. You're not just a monster. You're not just a horrible person. You lack empathy. You lack compassion. I don't know what kind of sadistic fuck you have to be to do that to a person and still sit here in this courtroom, closing your eyes, because you can't look at me. You can't look at this family. You don't care about what you did, but you will. You will. My last piece of advice to you, Mr. Montavo, my hope for you, beyond anything, is that you get exactly what you deserve. At the end of your life is about the exact same way that hers was, alone, without any family members, and off in some woods somewhere where no one cares about you, empty like a piece of trash. That's what I hope for you. I would like to just speak a little bit about my sister and who she was.
[00:19:25] Speaker 12: You may.
[00:19:28] Speaker 16: It's no secret that she had a hell of a life. My aunt said it really well. She was not for a certain chance. Her life wasn't more. Her life was more than just the last three to five years of her struggles. She meant more. God, trying to summarize the whole life into a paragraph is impossible. She wasn't always very easy to understand, but she was very easy to love. My sister was stubborn as hell, but she was always a great source of courage for me. She just had a unique perspective on life and how to live it. And I carry those pieces of her with me to this day, standing up here. It is hard. But my other sister said it best. You know, my sister already went to the hardest thing we're ever going to go through in our life. The least we can do is stand up here and let people know who she was. And she wasn't just a drug addict on the side of the street who was suffering or having just a hard time. She was a mom. She was a twin. She was a daughter. She was the best friend. And despite what people think, she was a good person. She never hurt anybody. She never tried to hurt anybody. It's just not who she was. She could walk into any room and make friends with anyone. Easy. She was maybe too trusting. I think it's her biggest fault. But she was a beautiful soul. And she didn't deserve it. No one deserves it. In fact, I spent so many months afterwards, and I hate to say it, just wishing it was anyone else. Anyone but my sister. That just makes me look you. I don't want that for anyone else. I don't want this for anyone else. No amount of years served is ever going to pay us back. You can't pay back a life for this. We are never going to get her back. We were robbed of her future and the many memories that we were supposed to have. And of all the things I could accept, this is just not one of them. I love her, and I hate this man. And I will carry it with me for the rest of my life. But I miss her. And I want everyone to know that she was a beautiful soul. Beyond what we saw in the videos for the past few weeks, she was a person undeserving of these actions. And I'm happy that we are getting justice over her.
[00:22:41] Speaker 12: I have twins, sir. And there is a twin telepathy, a twin conversation. You twins live in a different world than the rest of us. We do. So I do know she's standing with you. I know that you hear her voice all the time. I know she can't be with you, but you certainly have honored her. And you will live for both of you because she's that little angel always on your shoulder. And you two have got a lot of things to laugh about that your family doesn't even know about. And she's laughing with you right now saying, remember, whatever it was you two did, which other people won't know, because it's a twin thing, right? It'll shake that way. So she's going to stay alive in you forever and your family, of course. But I thank you for being her voice and her champion. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son.
[00:23:32] Speaker ?: And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son.
[00:23:36] Speaker 12: And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son. And I thank you for being her voice and her son.
[00:23:50] Speaker 15: And I thank you for being her son.
[00:23:51] Speaker 12: And I thank you for being her son.
[00:23:52] Speaker 15: And I thank you for being her son. And I thank you for being her son. And I thank you for being her son. And I thank you for being her son. And I thank you for being her son.
[00:23:57] Speaker ?: And I thank you for being her son. And I thank you for being her son. And I thank you for being her son.
[00:24:00] Speaker 15: And I thank you for being her son. I don't really know what to say. I thought about this thing. Almost three years.
[00:24:16] Speaker 12: I would like to address this monster. Again, you may just keep the microphone at least by the side of your mouth so you can pick up what you're saying. Okay? Thank you.
[00:24:31] Speaker 15: No words. No words. No words. Any of us can say. Can do any justice. No. Nothing these courts can do. Will give you what you truly deserve.
[00:25:00] Speaker 2: I hate you so much. I don't. I don't hate anybody. I've been through a lot.
[00:25:11] Speaker 15: Alicia has been through so much more. She never hated anybody. She never hurt. Shut up. Don't. Don't make a facial expression. Stop. You don't get that. You have taken so much time. And so much time that she don't get to. She don't get that. You have taken so much time and money away from everybody in this courtroom. From the state of Michigan. From the state of Texas. You are a horrible man. A horrible. You're not even a man. I don't know what you are. You are worthless. You are worthless. And I pray. That God gives you the grace. Because I can't. I hope. I really do hope that everybody you come across. Any jail that you get transferred to. Any prison. I hope they show you what it's like. You don't deserve to breathe. No one deserves to even look at me. Or any of us. We're worth this piece of trash. And I'm so glad you have nobody here for me. That warms my heart a little bit. It does. That makes me feel a little better. Don't nobody care about you. And that shows. And maybe that's why you did what you did.
[00:26:46] Speaker ?: I don't know.
[00:26:53] Speaker 15: But my brothers with Dre is right. I don't wish this on nobody. None of my worst men than me. Alicia did not deserve this. No woman, no human being deserves this. What did she do? Nothing. That was shown she did nothing. You were just so, so mad that night. So high on drugs. Because I'm sure that part was true. You were ready to kill. And you didn't care who it affected. You just seen this vulnerable woman. Maybe you have seen her in the past. Maybe this is something that has been a continuous thing. I mean, Lord knows in Texas, right? That you've heard wrong school women. Yeah, we know about those. Oh, we know about those. Don't act stupid. I'm not going to name that because they're human beings too. But we know those three, four women. There's probably more. There's been a long time coming. And it's so sad. Alicia had to be the one to bring you to justice. For the state issue. In their eyes. You deserve to die. But clearly, Texas couldn't do that. Fuck you too. You going to give me the middle finger? Fuck you too. Did he just give you the middle finger? He did. He went like this, ma'am.
[00:28:20] Speaker 12: Contempt. 93 days. I'm going to let you all finish. I'm going to keep him here. That'll be 93 days. You'll serve. It will not go against your sentence in the MDOC. We'll keep you here for the 93 days. Verbal. Physical. I don't care. You will not disrespect this family. You have taken away their child. Your freedom will be taken away forever. And you will respect this courtroom and everyone who speaks in it. You are no longer in control, sir. Everyone in this courtroom is controlling you. And you are going to a place where you will be controlled every single day. Ma'am, you may finish. If he acts out, I hate to drag this out for the family, which is why I'm not going to take him right now for the 93 days. But if he does it again, it'll be 93 days and I'll ask you to come back. I hate to inconvenience you. Y'all.
[00:29:16] Speaker 1: Yes. Yes, I agree, D-Man. It doesn't mean anything because he's going away for life anyway. However, however, I like it. I like it just conceptually. It's just a good public smackdown on top of the life sentence.
[00:29:33] Speaker 12: Closure, but he needs to learn some respect. You may proceed. She is right.
[00:29:41] Speaker 15: You will learn some respect. Every, every man will show you what you shouldn't have done. And I can't wait to hear about that one day.
[00:29:53] Speaker 18: Fuck you.
[00:29:55] Speaker ?: Excuse my name, Sharon. So, okay, it's your time to speak.
[00:29:57] Speaker 18: It's acceptable in my courtroom.
[00:29:58] Speaker ?: Maybe not somewhere else. I'm working with that because it's a sign of anger.
[00:30:00] Speaker 12: It's a sign of all the trauma and everything else you've gone through. And ma'am, I just want you to know, I know people say it's not okay to hate. You should release things and live your life and not living that hatred. But I don't tend to agree with that.
[00:30:25] Speaker 1: You'll see later the judge agrees with you.
[00:30:27] Speaker 12: Because of so much grief and trauma. And I think that I want to say to you that the hatred you all feel is really just a sign of how deeply you loved her. And that's what it is reflected about. Not true hate, but this absolute grief and love. So I appreciate that.
[00:30:51] Speaker 15: Thank you, Your Honor. I would like to finish by just saying a little something about Alicia, of course. She was my only sister. She was my older sister. She was the person I looked up to. She taught me how to do makeup. She taught me about fashion.
[00:31:18] Speaker 11: What did you say? Fashion.
[00:31:20] Speaker 15: She taught me about fashion. She taught me how to be strong. A lot of the things that she's been through in her life, I'm not going to speak about today. Alicia deserved more. She deserved more than what we could give her. There's been so many people that have hurt her in her life. So many men and monsters, like this one behind me. Alicia is the reason I am not as strong as I am today. Seeing her go through what she's gone through has made me a stronger person. I wish I could have helped her. I wish she wasn't as stubborn as all of us, but, you know, nobody deserved this kind of treatment. She was so bright and so beautiful. She is bright. She is beautiful. She still lights up every room that she's in. I didn't think I was going to be able to get through talking today. But she's here. And I'm so grateful that I'm able to say my piece and close this chapter. I don't want to deal with this anymore, but the reality is it's there for life.
[00:33:13] Speaker 18: There's nothing that can change that.
[00:33:27] Speaker ?: I don't want to deal with it. I don't want to deal with it.
[00:33:28] Speaker 18: I don't want to deal with it.
[00:33:29] Speaker 15: I don't want to deal with it.
[00:33:30] Speaker 18: I don't want to deal with it.
[00:33:31] Speaker ?: I don't want to deal with it. I don't want to deal with it. I don't want to deal with it.
[00:33:34] Speaker 15: I don't want to deal with it. I don't want to deal with it.
[00:33:36] Speaker ?: I don't want to deal with it.
[00:33:37] Speaker 15: I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it.
[00:33:42] Speaker ?: I don't want to deal with it.
[00:33:43] Speaker 15: I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it.
[00:34:09] Speaker ?: I don't want to deal with it.
[00:34:10] Speaker 15: I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it. I don't want to deal with it.
[00:34:28] Speaker ?: I don't want to deal with it. I don't want to deal with it.
[00:34:30] Speaker 15: I don't want to deal with it. Thank you.
[00:34:54] Speaker 12: Thank you for being her strength, her voice. And I know that she will always be the rock star in your life who will guide you. She's with you here. She will always be with you. And God will put you together soon enough. But meanwhile, she wants you all to live your lives as if she's there dancing with you.
[00:35:15] Speaker 15: Absolutely. Thank you. Next.
[00:35:23] Speaker 12: Please raise your right hand. Do you swear or affirm the testimony you're about to provide with you the truth, whole truth, nothing but the truth, under penalty encouraging? Yes, I do. Put your hand down. Take all the time you need. Please state and spell your name for the record. Brittany Harmon, B-R-I-T-T-A-N-Y-H-A-R-I-F-O-R. What would you like me to know?
[00:35:50] Speaker 15: Um, I'm gonna try, I'm gonna try. I wrote something down. It's okay. I'll read it. Alicia was my best friend since I was not being that.
[00:36:05] Speaker ?: I'm 34.
[00:36:07] Speaker 14: Her babies were my babies.
[00:36:11] Speaker ?: We didn't, we didn't get the time.
[00:36:18] Speaker 14: So many memories.
[00:36:28] Speaker 15: And I have said for so long, I, I want to address him, but I can't.
[00:36:41] Speaker 14: I can't look in that man's face. I can't look in that monster's face.
[00:36:48] Speaker 5: But I, I would see her after and I just, I just hope that there's one day that someone makes him look the way that she looked.
[00:37:06] Speaker ?: Because that's not okay. Because that's not okay.
[00:37:09] Speaker 14: I'm gonna read it on her behalf.
[00:37:23] Speaker ?: So this is Brittany. We've been friends for a very long time. Alicia was my best friend.
[00:37:26] Speaker 16: She was my best friend since I was 12 years old. 34 and I. We might not have been in connection the whole time, but I kept my same phone number for that girl the whole time. And any time a random number has ever called my phone in the last three years, I've just been quick to answer. I am so sad that I got used to it not being her, but I will forever keep this number for her. Because she knew my number and she knew if she called, I would, I would answer even if that's all I could do, um, was answer. She knew that she knew that's what I would do. And when she called me at midnight and had nowhere to go, she got a ride in my house because that is the one place she could go. Because I would never in my life turn my baby away. We had so many good times when we were little, we would beg our parents to let us stay at each other's house wherever we were trying to stay that night. We would beg and beg and beg until it was yes. Because there was no other choice we could not be a part of. She was either at my house or I was at her house. I remember times when we would stand on Waverly because we lived.
[00:38:44] Speaker 15: We lived right there.
[00:38:46] Speaker 16: We had, uh, pom poms and we would cheer for cars going by. Uh, in the winter time where she lived, she had a big hill in the backyard and we would make it in igloo. Uh, I wish we had pictures of us in that area. And then we got older and I was with my son's dad and she had my goddaughter with her now. Uh, and they lived with us when she had her second form, Isaiah. After that, her life got very toxic and chaotic. No one, not even her, could control them. She's fine. And then one good time that she tried to get her life together, it was taken from her so very dramatically. No one deserved what she went through. Especially her. She had children she would struggle there for. This man not only took a mother that was trying to be there for her three children, but there for her mother and all of her siblings along with herself. Felicia was my baby and I should not have had to say goodbye to her in that bag. Her children should not have had to do that. 24 years going and I will never change my number just for that. She had so much life left to live and so much more to give and that was taken from her so early. That's not fair to her children or her family or her friends.
[00:40:08] Speaker ?: Thank you. Thank you.
[00:40:09] Speaker 15: Thank you for your strength and for being here and for being to our voice. Next. Please raise your right hand.
[00:40:22] Speaker 12: Would you swear or affirm a testimony you're about to provide me a truthful truth and nothing but the truth under the filter. Thank you. Can you hang down with the state's starting name for the record?
[00:40:36] Speaker 18: Rachel Diago. R-A-C-H-A-E-L-H-I-D-A-L-G-O. Thank you.
[00:40:42] Speaker 12: What would you like me to know?
[00:40:44] Speaker 18: I'll get that present.
[00:40:46] Speaker 1: Well, big dummy is going to get called up here in a little bit so you get to see the defendant.
[00:41:15] Speaker ?: I'll forgive you. You might not know God now, but I promise you you will want to know him.
[00:41:17] Speaker 18: You will need him. I'll forgive you.
[00:41:19] Speaker ?: You might not know God now, but I promise you you will want to know him. You will need him. I'll forgive you.
[00:41:22] Speaker 15: You're living in spiritual repentance where the best part of your life is now. After death will be the worst. You don't have to believe anything I'm saying. I'll forgive you. I'll forgive you. I'll forgive you. I'll forgive you.
[00:41:29] Speaker ?: You might not know God now, but I promise you you will want to know him. You will need him.
[00:41:31] Speaker 18: I'll forgive you. You might not know God now, but I promise you you will want to know him. You will need him. You will need him.
[00:41:35] Speaker ?: You're living in spiritual repentance.
[00:41:45] Speaker 18: You are saying to you right now, Jesus is real. You have mercy on your soul.
[00:41:55] Speaker 15: thank you very much next
[00:42:01] Speaker 12: we have the people is there anyone else from the family or friends who wishes to address the court all right we have the people what would you like me to know thank you
[00:42:25] Speaker 11: I did not know the person she was I like the jury see a very short moment of time in her life but I could tell after hearing the family statements about her that if she was anything like her family she was amazing loving caring
[00:42:59] Speaker 1: the statements that they made here do not look for purpose at law talk with Mike
[00:43:09] Speaker 11: today in court for the very essence of who they are as a family I spent a lot of time with them throughout the trial how they were through that trial I could see the pain that they were in but I could see that they were happy to finally be at the end of that process and as a prosecutor it's hard to understand what the family goes through because I know as a prosecutor I can only get the family to that point I can only get closure but a step closer to closure because the end of a trial is not closure it's only a step closer to closure because a step closer to closure is only helping them through that process and I'm hoping that this trial and the verdict the verdict is a step in the right direction for them is a step in the right direction for them and hearing their statements today hearing her hearing her hearing her mother her sister her best friend her aunt even piggy everyone was here for Alicia and it goes to show that there is a lot of support in our community for our victims everything I had to say about the defendant I said at trial he wants to play the victim he always wants to play the victim we heard it today already I'm sure we'll hear it again I don't think he's pulling the wool over anyone's eyes but his own so I hope that this was the chance for our family today to start that next step it will never be closure sadly but I hope that that gets them closer to it thank you thank you
[00:45:40] Speaker 12: Council if you and your client could please come up - Now, so what would you like me to know?
[00:46:02] Speaker 19: - A couple of things, Your Honor, first and foremost, I know Ms. Montalvo does profess is innocence, Your Honor, and I certainly respect that, but at the same token, we have to respect what 12 members of the community heard and listen to me will get a chance to appeal this case and we'll see what happens from there. Certainly this tragedy here that this woman is dead and certainly sympathy on behalf of the defense team to the family, loss of a life is difficult. As regards to Mr. Montalvo, who came up here to try to restart his life with a new friend. At this time, he does profess his innocence. And I guess at this point in time, he'll have to deal with that in the appellate court, Your Honor. Thank you.
[00:46:52] Speaker 12: - Anything further?
[00:46:53] Speaker 19: - Nothing further, Your Honor.
[00:46:55] Speaker 12: - Sir, did you wish to address the court respectfully? - Yes, I do. - What would you like me to know?
[00:47:01] Speaker 20: - I mean, listen, there's a killer out there. You guys are sentencing the wrong man. There's a lot of evidence that has been overlooked, that's been ignored, that wasn't even presented. But it's okay, because in a way, the truth will come out. It will come out. It will not stop until I find it. Until I prove it to the family. I never met this woman. I don't even know who she is. And God helped whoever did it. Because hopefully it wasn't me. But it's fine. Irrigation could be turning at me. I mean, I've lost all my family. I came up here. I've done nothing but help people. I'm not no monster. I'm a decent human being. I've never hurt anybody. I will do whatever I have to do to make sure the truth comes up. To this gentleman here that said, my client, my counsel, they never did it. One thing did I ask you to do. Not one thing you've got to do. You're smart. You act like you're helping me. You didn't help me for shit. Neither would I do that.
[00:48:47] Speaker 12: Hard to defend a guilty man, sir.
[00:48:58] Speaker 1: Yeah, this is not the defense attorney's fault. He went out there and caught a spear like a pro. What else do you want him to do?
[00:49:09] Speaker 12: In Jesus name, you would have not done what you did. I only wonder what God is going to say to you if you go that direction at all. So there is a clear escalation in your record. You have a lot of gun charges. You have gun charges? Why are you out carrying a lawful carrying weapon?
[00:49:45] Speaker 20: That's a bullshit.
[00:49:47] Speaker 12: Well, that's what you say, sir. But I got Texas. We got, you know, Texas is pretty, actually, you're very, very lucky you're in front of me. And you're very, very lucky you're in Michigan soil. And you have these fine attorneys and this fine family. Because in Texas, I would have to order you to the gas chamber. Well, we don't have the death penalty here. Texas uses it frequently. They got a down pat, unlike Tennessee. In other states, Texas knows what they're doing. And that's exactly where you would be, sir. And your attitude would go along with you. You have been nothing but disrespectful throughout this whole process to your attorneys, to the court, to the family who lost a beautiful human being. And your record shows an escalation. And yes, it's true. There are a number of victims. Law enforcement did their job. Probation did their job. Your history is here. There were many, many accusations that never ended up in a trial. I suspect that people were afraid of you. They didn't want to come forward. When you left Texas, they didn't want to bring you back. They left you sadly in Michigan for us to deal with you. You like your drugs. You like to fight against law enforcement. You like to fight against anybody you don't have control over and show that you're the bigger man. Well, who's in the shackles now? It's you. And forever in your life, you will be in a cage in the Department of Corrections. You need to be accountable for what you did. You need to be respectful of law enforcement. There will be a lot of deputies and corrections officers in prison, sir. And if you want to make sure that you are in solitary confinement where you have no communication except for maybe an hour a day, just keep acting badly. They'll make sure that they put you in a proper place. I have to look at punishment, the victim, deterrence, whether the sentence is proportional. And sir, the sentence that I'm about to impose is within the law and makes you accountable and not a danger to others because the escalation that you have shown throughout this record here and in court and even at the sentencing shows that you are a danger to others. You will remain a danger and you cannot be a free man for the rest of your life. As to the contempt, you will serve 93 days, no one gives a finger to a victim impact statement in my courtroom or to anyone else. I told you to be quiet. That is nonverbal communication. So you get 93 days for that, which will not count against the days you've already served. As to count one murder in the first degree, you have life without parole. You have credit for 1,089 days. As to count two unlawful imprisonment with habitual second, you will serve 176 months to 270 months with credit for 189 days served. I have gone over guidelines, but I think that is proportional to your behavior, your lack of accountability, your insults, your demeanor, the escalation, the danger. And these will run concurrent. While you are incarcerated, you will participate in sex offender treatment, substance abuse treatment, anger management, and mental health treatment. You have 42 days to appeal and to request appellate counsel. Is there anything else I need to give to him?
[00:54:03] Speaker 11: Yes, Your Honor. Defendant, we would ask he paid for $9,116.67 to the Crime Victim Services Commission for the funeral and bereavement costs.
[00:54:18] Speaker 12: He will be provided, or will be ordered to pay a restitution in the amount of $9,116.67. How old was her daughter? She has a daughter, right? She has three children. And how old are they? 15, 13, and 11. Okay, so she is going to pay $9,116.67 in restitution for the funeral expenses. She has three young children. And I don't know how much counseling they're going to need, but they're going to need some. I don't know if they can quite understand the loss of their mother or what you did. I don't know if they are really going to understand that they did have their day in court and the whole family spoke on behalf of her, of their beautiful mother. So I'm also going to order a copy of this transcript, three copies, one for each, be sealed and given to their guardian for later use in their treatment so they understand how much their mother was loved and that it was not their choice. It was not her choice to leave them, that it was your choice at your hands and that all she wanted was to love her children and live her life. And that was cut short at your hands. They need to understand that she's not with them here or for the rest of their lives, but she is with them in a different form and loves them just as much today as she did. When they were all together. So you will pay for the cost of that and the family will let the crime victims unit know where those sealed transcripts go. And if they want more than just the sentences, the sentencing, they certainly may have that as well. I think at those tender ages, they need something when they're older, when they really say, I wish mom was here at the birth of my child at my wedding. During these struggles, why isn't she here to understand? She still is with them. But justice was served. And it wasn't her choice to leave them. And that's going to be a tough pill to swallow at every age. The transcripts go away. I want them to have it if they want to, but they should read it with a trained therapist to go through it when they can, if they ever can. They can burn it. They can use it for their use. So as to count two weeks, 176 months to 270 months with credit for 189 days. As to each count, he'll pay a $68 state costs and a crime victims assessment. Just one crime victims assessment will be $130. The restitution and the cost for the transcripts will be paid before the crime victims and the state costs. If you have 42 days to appeal to request appellate counsel, counsel, please hand him his appellate rights.
[00:57:45] Speaker 19: Judge, I did provide Mr. Montella with a copy of the program. You have that copy, Mr. Montella?
[00:57:50] Speaker 12: Do you acknowledge receiving your appellate rights, sir? Is there anything else on behalf of the people for the record?
[00:57:59] Speaker 11: No, thank you, Your Honor.
[00:58:00] Speaker 19: Nothing else on behalf of Mr. Montella? Nothing further. Thank you.
[00:58:04] Speaker 12: Thank you. That is all for the record.
[00:58:21] Speaker 1: All right. There you have it.
[00:58:23] Speaker 18: I thought that was interesting.
[00:58:27] Speaker 1: It was sad. It was serious. But it was interesting. Thank you all for coming out. I appreciate it. The construction continues over here. I'll see you soon.
