[00:30:26] Speaker 36: Transplant was a misnomer here. When we went to the BMC's garden department in K. Westward for inspection of Nananani Park RBI sites, we were told that only the rare trees like the Baal Darbs are actually transplanted. Common trees like mangoes, neve etc. are just stuck. This is because when large trees are being transplanted, they will need to cut most of the branches and sometimes in the end only the trunk is less. And often these trees might die because transplantation is a very tricky and meticulous process. So what they do instead is they plan this happening and they call it transplant. [00:31:06] Speaker 24: We were rushed to the Supreme Court simply because the moment the High Court gave its permissions, they started cutting the thing. They have not even waited for the tenders or the process to be completed. Now that is not really encouraging to see. We were asking the Supreme Court, let us give us a chance to save even 5,000 or 10,000 mangroves. What is the harm in it? It is not an urgent emergency war hospital which is being made where it has to be made today. Now there is a lot of concealment of facts which has happened even before the Honourable High Court. The High Court was never informed that already in the same creek in the adjacent area more than 1,000 mangroves have been lost. For the same project proponent, the Municipal Corporation of Greater Mumbai. All of these creeks, they have very important biodiversity zones. You can't come in and set up buildings and structures inside that. So but the Supreme Court refused to intervene. And so now we have come back to the Honourable High Court and let's see what it says. Supreme Court again goes by whatever is told by the ASG, the government lawyers, who always say that everything which is destructive is in national interest. Project of utmost public importance. Where did judiciary get the idea that the Varsova-Bayandar Link Road is crucial for Mumbai? What does Mumbai need? Mumbai needs efficient public transport for the people who are travelling like sardines, not for the car owners. [00:32:38] Speaker 31: As a result of coastal road and under taxed cars, people like to use cars. Because they get pleasure and also it becomes a status symbol. But it will increase the congestion in the city. Don't do this inducement. I thought you should do the reducement. Pay and park road in the city. Make good bus lanes. I tell you parking will be the key. When you go from your place to some other place, can you provide parking for guests? No. So you have to see all roads are full of one lane, both sides full of cars. Just see the area here. What is it? So parking is the symbol of the car disease. It is like blood pressure. So I feel that if you make a balanced life, you must have enough space. A, space for housing. B, space for recreation like cars, education, health. These are more priorities. [00:33:27] Speaker 11: Rather than coastal roads, why not improve the public transport? Yes. Yes. Yes. Public transport. Yes. Yes. Public transport. We are for public transport. We are middle class people who cannot put it in the car. Public transport is totally inalien. [00:33:41] Speaker 37: Nothing is proper. We are not allowed to do that. We are not allowed to do that. [00:33:56] Speaker 6: Generally planners think that the reason why so many people move to cars is because there is an aspiration. You have the income and how you can buy a car and that's why you buy a car. That is completely not true if you look at compared with other cities. Singapore has a policy which restricts the amount of cars on the street. Whether it's through various forms of taxes or the licenses at the auction or even the amount of public transport that they provide. So it's very expensive to own a car in Singapore. The reason why so many people use cars in Mumbai is because it's very cheap to own a car. Now why has the number of private car users increased? It is a result of deliberate policy to promote private automobiles. You have built all kinds of coastal freeways, ceilings, flyovers, all of which induces traffic. Anybody who takes a basic course in transportation planning knows that the more roads you build, the more you induce traffic on roads. You know, it's not rocket science. And then they start saying all these wonderful things about how this road is going to deconest traffic and how it is going to do mobility and so on. It's all rubbish. That doesn't happen. In fact, you can see that over 20, 30 years, the number of cars in the city have grown. And it is extremely unsustainable for Mumbai city. First of all, a lot of people say that we are trying to make Mumbai like the world class or some like Singapore or Shanghai or whatever. Singapore has half the population of Greater Mumbai, around 6 million people. But it has double the number of buses. You know, if we want to be equivalent to Singapore, we should have four times the number of buses than we have today, which is around 3,000 buses. So we should have 12,000 buses, but just increasing buses is not going to help. You need to have dedicated bus lanes. If you are our user and you see somebody using the bus lane and going faster because you're stuck in traffic, you will say, oh, this makes a lot of sense. So you leave your car at home and you will take the bus. Of course, buses are cheaper. They make more sense. They are very cost effective. They are greener, you know. Mumbai has always had very low cost public transportation, both for the public transport as well as for the taxpayer. [00:36:09] Speaker 8: The transport that is made is used by 1,35,000 people. And every day public transport is used by 35 lakh people. And we are reducing the number of buses which should be moved. You are making coastal roads which is not travelled by a lot of people. It is not even one third of the population using public transport. And I'm not even talking about trains right now. This is just buses. 35 lakh people versus 1 lakh 35,000 people. You are comparing. And the grants which are given to the public transport is way, way lesser than the 14,000 crores, which is good. [00:36:51] Speaker 31: Something I learned from China, what they do. They say that entire road building to be financed by car taxes. We don't do that. What we do, we do from treasury funding. That reduces the money available for health. That reduces the money available for environment. That reduces the money for protecting your mangroves. All these things don't have any money. They have only money for coastal roads. Don't forget the economics. Because the economics won't forgive you. [00:37:26] Speaker 18: So the cost-benefit analysis is a very important financial document which tells us that a project will be profit-making or loss-making and whether a project should be undertaken or not. Now this document which is drafted is very flimsy in terms of the basic hygiene factors. Such as uniformity of units of measurement, uniformity of time frames, calculations of the NPV, which is the net present value. Now, if you look at the cost section, the main cost is the loss of the mangroves. Now, we all know that 45,000 mangroves are going to be lost, which is equal to the area of 11 lakh square feet. This whole area is just valued at 15 crores in a city where a flat can be bought to the value of 15 crores. The mangroves provide a lot of ecosystem services as well, such as they save us from floods, they clean our air, clean our water, capture carbon. And BMC's own mangrove restoration plan values these mangroves at 40 crores per year. So, you know, we ran the numbers and we came up to a figure of at least 551 crores, which should be the loss that should have been counted in the report. Secondly, the report estimates that the loss of livelihood for the Koli communities will be just 1.5 crores. Now, if you see, the stretch from Varsova to Bhaiandar includes multiple kolivadas or where the kolis conduct their fishing activities and where they live. We know of at least two significant kolivadas in Varsova and Charkop and counting 5,000 families with a livelihood of 5,000 rupees per week. We think that the loss can extend to at least 1,500 crores across 20 years. [00:39:15] Speaker 38: This is the North Postal Road. We are seeing it. And how is it going? It will get a big road to Mumbai. 60% traffic from Western Express and to decongest it. Now, let's talk about the benefits of the project. [00:39:42] Speaker 18: Various government authorities, courts have been telling us that this project is in public benefit or this project is of public importance. Which means that this project is going to result in so much of fuel savings which justifies this massive scale of environmental destruction. Now, how do we quantify this fuel savings? The report says that the fuel savings benefit is going to be to the tune of rupees 2,570 crores. And where does this number come from? The report says that 50 lakh people daily are going to benefit from this road. Now, if you closely look at other data to verify this. There are only 29 lakh cars in the MMR region. And let's generously assume that 20% of those cars are going to use that road. Only 6 lakh cars daily are going to use the Scottsdale Road. BMC in their other report have also said that the road itself has a carrying capacity of just 2 lakh cars. So, if the road has to benefit 50 lakh people, 25 people have to travel in each car. The math is not math in here. It's just very weird. So, it's this easy to shatter the argument of public benefit. Based on this faulty analysis, the BMC concludes that the project is going to be very profitable at 4,400 crores. But quite the contrary, our analysis says that it's going to run into massive losses of 560 crores. And we're not even considering the qualitative factors, the impacts and the risks that we just spoke about. Don't you think the costs have been underestimated and the benefits been severely overestimated? The report is so flimsy that it does not take into account various risks and losses such as risk of climate change, sea level rise, loss of carbon sequestration, risk of property prices crashing in those areas, risk of flooding and the risk of health and well-being of the people in those areas because you're endangering their lives. And this is one of the main documents based on which governments and courts give clearances. [00:41:50] Speaker 13: The manner in which the project has been implemented itself is a scam. What they have done is, instead of treating the entire coastal road as one project, they have segmented it and broken it up into different stages. So, stage one was Bandra Verli, which was also opposed by us and the fishing community. Stage two, the South Coastal Road from Tunisia Street Flyover to Overli was also opposed. And in fact, the High Court had stayed the project and cancelled appearances. Unfortunately, there was an Identity Remorder of the Supreme Court, which stayed the Bombay High Court Order, which has still not been located. And for all practical purposes, the road has been completed. But the greenery and the plantation had not even started. So, that actually shows you how serious government agencies are about complying with court order. They make lots of promises, but they are not being implemented. And now, even the Bandra Varsova project was treated as a third phase. And the Varsova Bhaiander is now fourth. And ultimately, they are going to extend the road right up to Wadavan. So, God knows how many phases this whole coastal road has been segmented. Which actually is contrary to a circular issue by the Environment Ministry. Saying that you cannot keep fragmenting a project and you have to actually treat the entire project as one consolidated project. But obviously, they have other pressures that dictate to them and tell them what they should do. And if that had been done, if the total environmental impact of all the coastal road segments put together had been assessed right at the beginning, Maybe this project will never have happened. [00:43:21] Speaker 28: The other thing is under CRZ notification and EI notification, there is a threshold of 100 kilometers for road projects. So, you need to take care of between of the projects into small, small pieces to avoid going into the EI post. [00:43:36] Speaker 39: 1991 was the first time when CRZ notification had come about. Largely to protect eco-sensitive coastal roads. [00:43:45] Speaker 6: It has different categories. You know, the marine areas with CRZ 4, the intertidal with CRZ 1, the coastal belt, you know, 500 meters, now it's 200 and so on. That is CRZ 2. Rural areas, you have the coastal belt, which is CRZ 3. On the landward side, in this protected belt, it's specified low development intensity. So, you couldn't do redevelopment, essentially, but the buildings could stay, right? [00:44:12] Speaker 39: Essentially, there are some exceptions under which construction can happen. For example, if you want to put an atomic power project, or you want to build a sea-linked road, not a coastal road. You want to build a naval base, right? There are certain exceptions, but not everything can be built there. [00:44:30] Speaker 6: When the government wanted to build the MSRDC ceiling, at that time, there was a CRZ amendment, which allowed that to happen. And that's how they got a go-ahead and clearance for the ceiling. When they wanted to build a coastal road, what is very interesting is that there was a problem. Reclaimed roads were not allowed in the coastal road. So, they had a choice. You know, they could either change the design of the road to not build reclaimed roads, or they could change the amendment. So, they went and they changed the CRZ instead of changing the design, right? [00:45:02] Speaker 39: In 2018, the Bombay High Court again realizes that, okay, while regulation is being relaxed to accommodate development, there still has to be some constraints, right? Mangroves are not expendable swamps. They have an importance, right? And the High Court somewhere recognized that, okay, the regulation is being a little too losing. So, let me just step in and kind of make sure that mangroves are in essential framework. And in order to cut them down, you will need a High Court order. And that is basically Justice Oka and Chagla order that we know, that BEAG got. A lot of organizations went to court. They objected it. The Bombay High Court set aside the matter saying that, you know, it's not scientific. DIA seemed rushed. Supreme Court intervened and said essentially, no, no, let this continue. [00:45:50] Speaker 6: The problem is that when you create a change in the CRZ for Mumbai, you also create the same change for the rest of the coast as well, right? So, you can now have reclaimed roads and ceilings all along the coast of India, which is not good for coastal ecology, of course. And by 2019, the CRZ, the new notification was out and basically that allows redevelopment in the coastal areas. The protected area landward side is now effectively gone. [00:46:23] Speaker 24: If you see the order of the Bombay High Court, Honorable High Court of Bombay. In the same connected matter of mangroves, the judge, Justice Mohitha Dere, ma'am, she has correctly observed that every project proponent comes to the High Court after spending money and say that now we cannot go back. So you have to give us permissions. This amounts to blackmail that you have to give permission. You make a mockery of the process. And best part is that now the High Court is become a single window clearance system. Not officially, but every department which is clearing it, whether it is the Maharashtra Coastal Zone Management Authority, whether it is the MOEF. Everyone inserts the condition, you have to take permission from Bombay High Court. They don't want the blood on their hands. And the High Court is caught in a dilemma whether we should clear it or whether we should oppose it. Now the High Court least it can do is to say, no, no, you have to compensate adequately, which they have done in their order. But again, what we are trying to show is that this compensation is not compensation. It is a pass which is being pulled off. We are trying to show the law. In that certificate, they wrote that VIPPL has collaborated with some government products, highway, etc. So, the certificate was given by VIPPL, and then the steel authorities gave them a contract. And then, VIPPL, who signed their MOU, it was a subsidized steel, and then sold the market rate to other companies. This was not a small or small, it was about 100 companies involved. The estimated scam cost is approximately 100,000,000,000. This is not the fact that VIPPL has said, but the certificate has written to you. They have many government projects, they have a sealant project, and then they have a record. This is not a claim. The Central Vigilance Commission has said in 2023, that the certificate that they gave was fraud. In Lokpal, in 2024, it has been given evidence.
