[1:35] Kasi, for example, kung sa Malacanang ka naka-assign, and parating may intelligence funds ang Malacanang, [1:42] and whether, I don't know how much they usually withdraw, whether it's 25, 50, 100. [1:48] So, if they always do it, then it's usual, right? [1:51] Yes, sir. [1:51] If it's just a one-time that year, oh, unusual, bakit suddenly, right? [3:21] Is it usual for DepEd to have confidential funds? [3:26] Your Honor, I believe that this is the first time that DepEd received confidential funds, Your Honor. [3:31] Yes, in fact, here in the Senate, in caucus, [3:34] ako lang halos ang nag-object. [3:36] I think dalawa lang kami o tatlo. [3:38] Ang sinabi ko nun sa chairman namin ng Committee on Finance, [3:41] if the Vice President needs that amount, let's put it all in OVP, [3:48] same amount na nire-request niya, [3:50] kasi at least, doon usually naman talaga meron kasi nga, or pwede, [3:55] kasi ano siya eh, Vice President siya eh. [3:58] And then, kung siya ay nasa Security Council, [4:02] or kung siya ay nasa any law enforcement, [4:05] ang argument ko nun, if you put it in DepEd, [4:09] paano pag napalitan yung Secretary, will we continue it, et cetera? [4:12] So, anyway, I just agree with the other senators here that, [4:16] as we go along, let's help the public understand the difference between [4:21] covert, suspicious, and usual, unusual, [4:25] para lang walang conclusions that are made that are prejudicial [4:29] to either the prosecution or the defense. [6:42] Last July 15, the Honorable Aquino asked a question before this Court [6:47] regarding the procedure. [6:49] If, after each article, we will hear both the prosecution and the defense, [6:53] and the presiding officer responded in the negative, [6:57] citing as basis the precedent in the Corona impeachment trial, [7:01] the only trial that actually went through the whole course, [7:04] wherein the prosecution finished presentation of their evidence [7:10] with respect to all of the articles of impeachment [7:12] that they did not withdraw. [7:14] Thereafter, the defense presented their evidence [7:17] with respect to the articles of impeachment [7:19] that were not withdrawn by the prosecution. [7:22] Sometime last week, the presiding officer, [7:25] based on some of the suggestions by some of the senator judges, [7:28] called for a sidebar with the lead prosecutor [7:33] and the lead counsel for respondent [7:36] to throw a question at them [7:38] if they're open to changing the procedure [7:41] to the one suggested in open court by Senator Bam Aquino. [7:45] However, subject to one condition, [7:48] that both parties should be agreeable, [7:50] that both parties should agree. [7:52] We are in receipt of a manifestation. [7:55] Actually, just a reminder to the council, [7:57] to the panel for prosecutors, [7:58] you filed a manifestation, not a manifestation. [8:03] The manifestation dated 7-27 [8:07] and the response of the respondents dated 7-28, [8:12] wherein it is clear, based on your written manifestations, [8:15] that there is no agreement between the two parties. [8:18] Therefore, we shall proceed as originally ruled by the chair [8:22] from the inquiry of Senator Bam Aquino. [8:24] We shall finish with the presentation of the evidence-in-chief [8:28] of the prosecutors for all the articles of impeachment [8:31] that they will not withdraw. [8:33] I'm saying that only because of the corona impeachment experience [8:37] we had wherein some articles were withdrawn by the prosecution. [8:41] Thereafter, we will hear the evidence-in-chief of the respondent [8:44] for all the articles that remain, [8:47] or all the articles that evidence will be presented by the prosecution.
