Good morning and welcome back [16:44] to the freshly refurbished main committee hearing room for the government government reform and [16:50] oversight committee. For the past three years ranking member Mr. Infume and I have worked together [16:57] to understand and to piece together the basic elements of fraud in federal programs. We work [17:06] together we see the problem together but his insight and my insight leads us to where we have to understand [17:18] by associating ourselves with government agencies and outside people of what they see the fraud problem [17:26] is. So how does it happen? How can we fix it? How do we look ahead about what may be next? How do we get [17:35] the experts of people who are in federal government and state government and outside to know that we [17:43] will not allow this to continue? We are here to do something about it. So I'm pleased to announce that [17:50] this work provides the foundation for the Fraud Prevention and Accountability Act which I will be [17:57] introducing today. We think it's a piece of legislation that addresses leading-edge ideas to have the [18:04] federal government more accountable. For too long, too little emphasis has been placed on preventing fraud. [18:12] This legislation changes the paradigm from pay and chase to prevention by ensuring Treasury [18:20] Financial Service can stop fraudulent payments from ever going out in the first place. This is more than an [18:28] idea. It's a concept that had to be worked on by the federal agencies who would be involved and they [18:34] have provided their input. Just as important, if not more so, it ensures the money intended for those who need [18:41] it now stand a better chance to get it. My bill also creates the Inspector General for Fraud Accountability and [18:51] Recovery piece, which in essence creates a permanent home for the anti-fraud analytic and investigative capacities [19:00] developed by the Pandemic Response Accountability Committee, known as PRAC, that was established at the [19:09] end of COVID. I'm hopeful that the provisions of this bill will mark an important step in showing fraud is [19:16] not just a cost of doing business and something we're going to live with. We need to be able to take the ideas [19:23] and issues that we have learned much from and put it into a piece of legislation whereby our partners, [19:30] including the federal government and state governments, know that we are serious. Regardless, [19:36] our work is far from over and we will hear that today. Today we will focus on fraud that occurs in [19:44] federal assistance programs that are administered by states, such as Medicaid, SNAP, and unemployment insurance. [19:53] I want to make one thing perfectly clear, and that is that while we're off on the the fresh off the [19:59] heels of a full committee investigation and hearings into fraud, this isn't about one state. This is not [20:08] about Minnesota. It's not about any one particular area. It is about where the federal government has [20:15] programs that work with the states, making sure we see the alignment of who is responsible for what, [20:23] who does the follow-up, and who is accountable for, if the word whistleblower is correct, to at least [20:31] make sure that we are all aware where we have a problem. So we know that we have problems, however, [20:39] not just Minnesota. There's also Mississippi, in which the state auditor Shad White identified waste and [20:47] fraud in TANF. TANF is a necessary program and one that must be available to those who need it, but the [20:56] integrity of that program is at risk. So while I'm hoping to clearly identify today are prime factors [21:04] about why this happens. It's also who is responsible for pinpointing these. At what point do we follow up, [21:13] and who is actually responsible for working to fix the things that we have seen? Is there enough of an [21:20] incentive for states to aggressively prevent fraud? Do states feel like they can get back to the federal [21:28] government? Is the federal government listening? Or does the federal government turn a blind eye? We are going to [21:35] vet these ideas, and today we have an opportunity to have people who bring real-life examples and ideas, [21:44] including you will hear today about one state where the auditor has done over 400 audits in a year. That [21:53] means that you've got your hands on to programs and the incentives that are associated with those to [21:59] create good behavior. What changes are necessary in transparency in communities is very important to [22:08] us. So we're going to hear from a controller today who sees the effectiveness of the program, but also [22:17] things we need to do. Today's witnesses will help us understand the root causes of state-level fraud and [22:23] lay the groundwork for additional action to ensure that taxpayer dollars are appropriately used. [22:30] So, today we will move directly to the opportunity for members of Congress who are finding [22:39] themselves today stretched as they have their duties done, but I'm going to wave on several members who've [22:47] asked on a bipartisan basis to be here today without objection, Representative Boebert, Lauren Boebert of [22:53] Colorado, and Representative Watkinshaw of Virginia, who finds himself here on a regular basis. I think he likes [23:01] this committee would be the assumption that I would make. So welcome on the committee for the [23:08] purpose of questioning the witnesses at today's hearing without objection. So, I'm pleased to welcome our [23:17] witnesses for today's hearing. We spent a good bit of time yesterday in my office listening to you, [23:25] understanding that the things which you need to bring to us need to be stated. I, Mr. Chairman, [23:34] you understand that I do not have a quick gavel. I want our witnesses to make their points to feel like [23:41] that they can engage this committee. This committee is on a bipartisan basis very, very close to an association [23:53] with each other where we believe each other ask good questions. We believe each other are after the [23:59] same answers. We believe each other have a goal in mind, and that is something that Mr. Nfume and I have [24:06] worked at for a number of years. So, each of our witnesses today that I'm getting ready to introduce [24:12] should feel like that they're in not just friendly territory, but they are in territory where we are asking [24:18] them to make sure that their words are clearly understood. So, I would first welcome Mr. Setbagnan, [24:26] Ann, who is Director for Audit Services and the U.S. Government's Accountability Office, [24:33] Forensic Audits and Investigation Service. At GAO, he leads audits of major federal programs, [24:41] focusing on a range of programs and the integrity of those programs and risk management, [24:48] including fraud. We're delighted he's with us. We then welcome Dr. O.J. Oletha, [24:56] who is the Chief Executive Officer of the State Financial Officers Foundation, a national [25:02] organization dedicated to advancing fiscal responsibility for public policy, protecting [25:09] taxpayer dollars, and promoting economic freedom. Dr. Welcome. We also welcome Alison Ball. She is [25:18] the elected auditor of public accounts for the Commonwealth of Kentucky. In this role, [25:25] she leads an independent office charge with auditing the accounts and financial transaction of all [25:33] spending agencies of Kentucky and protecting taxpayer dollars from waste, fraud, and abuse. And we add [25:41] Mr. Robert Westbrooks, who is currently an independent consultant. Until 2022, he served as director of the [25:49] Pandemic Response Accountability Committee. He previously served as inspector general at the Pension [25:56] Benefit Guarantee Corporation and the U.S. Small Business Administration. Welcome, Mr. Westbrooks. Chairman Comer, Chairman Sessions, distinguished members of the subcommittee, [27:51] I'm pleased to discuss today at a high level, the fraud risk landscape facing state-administered, [27:57] federally funded assistance programs. This landscape has changed significantly and is evolving rapidly, [28:04] not in a good way, in the long aftermath of the COVID pandemic. Massive spending during that period [28:12] exposed significant weaknesses, which persist today, in federal and state capacity to preemptively [28:19] identify and manage fraud risks in multiple joint programs. Illustrating this, GAO estimated a while ago [28:26] that up to $135 billion in pandemic era unemployment insurance benefits, or 15% of the total spending, [28:35] was lost due to fraud resulting from poor controls. Most of these losses were never recovered. Spending [28:44] on federal assistance programs administered by states exceeds about a trillion dollars annually, rendering them [28:51] inherently at risk of fraud. In this regard, two such programs, unemployment insurance and Medicaid, [28:58] are on GAO's high risk list for significant program integrity weaknesses. Other programs such as SNAP and [29:05] TANF face substantial fraud risks and have experienced actual fraud. What underscores the present state of the [29:14] fraud risk landscape is a fundamental failure by federal and state agencies to acknowledge that they exist, [29:22] are significant and require decisive response. This mentality must change and quickly to mitigate both [29:29] the present and future risk landscapes. As symptoms of the failure to acknowledge their existence, [29:36] principal factors contributing to fraud risks at the federal and state levels include absence of [29:43] leadership priority to drive effective responses, weak fraud risk management capacity, such as superficial risk [29:51] risk assessments and counter-fraud strategies, inadequate preventative front and back-end controls, [29:59] especially regarding verifying identity, determining eligibility, calculating benefit amounts and tracking [30:07] their duration, averting duplicate benefits across multiple jurisdictions, and recovering financial losses. [30:16] As I mentioned, pandemic losses were recouped only at a sense on the dollar rate. Then there is fund and forget post postures [30:27] regarding federal oversight of state activities, as well as restrictive program design is very important to make note of, [30:35] precluding stringent controls or allowing loose rules that exacerbate risk, including the signal bane of auditors, [30:45] unquestioned program applicant, self-attestation and certification. In a landscape that offers numerous opportunities for exploiting risks, [30:57] fraudsters are innovative and fast-moving, taking full advantage of technology, including artificial intelligence, [31:05] to pursue their schemes. However, due to the aforementioned lack of acknowledgement, [31:11] federal and state agencies are not keeping up with cascading risk effects. [31:18] I'll close by stressing that the current fraud risk landscape facing state-administered federal programs [31:25] involving potentially significant financial losses is of great concern. [31:30] Of equal concern is the absence of decisive, comprehensive federal and state responses. [31:37] This must be rectified, beginning with an acknowledgement that this is a significant problem. [31:44] Sustained congressional oversight and comprehensive action, such as that contemplated by the oversight [31:50] committee, are essential to eliciting an effective response. [32:24] Chairman Comer, Chairman Sessions, and distinguished members of the subcommittee, [32:28] Thank you for the opportunity to testify today. My name is Dr. OJ Oleka, and I serve as the Chief [32:34] Executive Officer of the State Financial Officers Foundation. The SFOF is a nonpartisan national [32:40] network of 41 statewide elected financial officers across 28 states who collectively oversee roughly 1.5 [32:48] trillion dollars in public assets. We equip these officers to promote fiscally responsible policy and [32:54] protect taxpayer dollars. I'm also the son of Nigerian immigrants who came to this country with nothing. [33:01] Through hard work, faith, and the opportunities that this great country provides, my parents lived [33:07] the American dream. That dream is why I have dedicated my career to public service in ensuring that [33:12] government works for the people who pay for it and that American generosity is not taken advantage of [33:18] by fraudsters, foreign or domestic. In our inaugural oversight report released on February 27th of this year, [33:26] we showed how state financial officers are already saving taxpayers billions of dollars by stopping waste, [33:32] fraud, and abuse. Examples include Florida CFO Blaise Angolia, who identified 1.86 billion in excessive [33:40] local government spending. North Carolina Auditor Dave Bullock, who exposed over 1.4 billion dollars [33:46] in lapsed salaries across 46 state agencies. And Kentucky Auditor Allison Ball, who you will hear from next, [33:52] who uncovered more than $836 million in wasted Medicaid payments. And Utah Auditor Tina Cannon, [33:58] who uncovered nearly half a billion dollars in inappropriate hospital payments. These are not [34:04] isolated successes. State treasurers play a critical role in stopping waste, fraud, and abuse before it [34:10] occurs. State auditors complement this work by exposing waste, fraud, and abuse after the fact. Together, [34:17] these elected officials serve as the frontline guardians of public funds. Fraud and waste in federal and state [34:25] benefit programs are not abstract problems. They drive up costs for American families. New polling shows [34:31] that 87 percent of voters express concern about fraud or misuse of taxpayer dollars and 83 percent say fraud [34:38] contributes to higher taxes and rising costs for families. Every dollar lost to fraud is a dollar that could have gone to [34:46] run to education or to infrastructure or tax relief. Defrauding the American taxpayer has become a [34:54] multi-billion dollar industry. It's a feature in our system, not a bug. Thankfully, President Trump's task force to [35:03] eliminate fraud, led by Vice President Vance, is fully committed to ending the fraud industrial complex and restoring [35:10] public trust back in the government benefits system. SFOF and our 41 state financial officers are fully committed to [35:18] supporting Vice President Vance and the administration's initiative to root out fraud. SFOF stands ready to [35:24] serve as a resource. I would like to offer five specific recommendations that can help the Vice President, [35:30] the task force, and Congress be as successful as possible. Number one, state financial officers routinely [35:38] identify fraud, waste, and abuse in federally funded programs administered at the state level, but there is no [35:44] formal mechanism to share that information with federal inspectors general. Amend the Inspector General [35:51] Act to require every federal inspector general to establish standing liaisons with state financial [35:56] officers, mandatory data sharing protocols, and joint task forces. Number two, federal benefit programs such [36:04] as Medicaid, SNAP, and unemployment insurance still rely heavily on self-attestation as we just mentioned, [36:09] or periodic checks rather than real-time verification of income, residency, and citizenship status [36:15] before benefits are issued. Number three, federal agencies are still catching most fraud after payments [36:30] have been made rather than preventing it in real time, even though advanced tools already exist. Accelerate [36:36] adoption of modern fraud detection technologies across all federal benefit programs. Number four, many federal [36:45] benefit programs administered by states continue to experience high rates of improper payments and [36:50] fraud despite existing federal rules. Under the current system, states receive full federal matching funds [36:56] regardless of how effectively they verify eligibility, detect fraud, or reduce waste. Expand performance-based [37:04] funding across federal benefit programs administered by states to resolve that problem. Number five, taxpayers are [37:10] elected or taxpayers and elected officials currently lack a single accessible real-time view of fraud, waste and improper [37:18] payments across federal programs. Create a single real-time public dashboard so taxpayers can see exactly where their money is going [37:26] and how much is lost to fraud and waste. The father of the three young children who loves this country, I believe we have a moral and fiscal duty to protect American taxpayers and their hard-earned dollars. [37:44] SFOF stands ready to support this committee, this Congress, the President and the Vice President and the Task Force to eliminate fraud [37:52] and to defend our nation's treasure, defeat corruption, and deliver real results worthy of the American People's Trust. [38:06] Thank you very much, Chairman Comer, Chairman Sessions, Democratic and Republican members of the subcommittee. It's an honor to be here today and I thank you very much for this invitation. [38:14] The topic of waste, fraud, and abuse is not necessarily the most pleasant one to discuss, but I hope to set a positive and hopeful tone while speaking about this nonpartisan issue. [38:24] In just a little over two years since I was elected as state auditor, my office has uncovered over $1 billion of waste, fraud, and abuse within Kentucky's executive branch. [38:33] Fraud is obviously what makes the headlines and I'm more than happy to talk about how we discovered fraud, such as a state employee's embezzlement of $400,000. [38:40] But I also want to make sure that we talk about the more prevalent and I think monetarily impactful problem of waste. [38:46] This is a problem that my office encounters every day, but it's one that is easily fixable and because unfettered waste ultimately creates an environment where fraud can flourish, we must do all we can to combat both. [38:58] In August of 2023, my predecessor began a special examination at the request of the Biden administrators, HHS OIG, in conjunction with three other states. [39:06] When I took office, I saw this examination through both under the Biden administration and the Trump administration. [39:12] This exam revealed that Kentucky paid $836 million to managed care organizations for the same Medicaid beneficiaries whose coverage was also being paid for by another state. [39:26] To be clear, this is definitively waste because one state's payment to an MCO covers all healthcare of all Medicaid recipients. [39:34] So when two or more states are paying MCOs for the same person, only the MCO, not the Medicaid recipient benefits. [39:41] But that's not all we found in conducting the last three audits required by the Single Audit Act. [39:46] We have revealed a plethora of problems that show Kentucky is a target rich environment for waste, fraud and abuse in the executive branch. [39:53] These problems include dead people remaining on Kentucky Medicaid, multiple people using the same social security number to obtain Medicaid, [40:02] and eligible non-citizens receiving Medicaid benefits. [40:05] An executive branch data system housing Kentucky's taxpayers' personal info was hacked in five minutes during a security test, [40:12] and Medicaid-funded long-term care facilities like nursing homes in Kentucky were not being inspected every 15 months as required by law, [40:20] and some had not received an inspection since 2019. [40:24] And that's not all. [40:25] My Office of the Ombudsman Unit, which reviews Kentucky's processing of SNAP, Medicaid, Medicare, and TANF benefits, [40:31] performs a variety of error reviews, one of them being payment error reviews. [40:36] In just one year, we've been able to assist the Commonwealth in dropping its SNAP payment error rates from 9.1% to 3.5%. [40:45] But there is still more work to be done, because federal rules for other programs have been more relaxed, [40:49] until the passage of the One Big Beautiful Bill last year. [40:52] Kentucky's executive branch simply has not paid as much attention to the other programs as it should. [40:57] That's why Kentucky has a payment error rate of 47.5% for Medicaid long-term care program, [41:04] 28.5% for the Medicare savings program, 9.7% for the TANF program, and 5.3% of the MAGI Medicaid program. [41:14] These error rates likely implicate hundreds of millions of dollars in federal funding. [41:19] I could go on and on about waste, fraud, and abuse my office has uncovered, but it's more productive to talk about solutions. [41:26] I recognize that auditors across the country are structured differently. [41:29] In Kentucky, I'm an independent statewide elected official that is constitutionally separate from every other office and branch of government, [41:36] beholden to no one but the people of Kentucky. [41:39] In my view, it's crucial for every state auditor to bring this mentality of independence to their jobs. [41:45] In doing so, state auditors must go beyond just doing legally mandated audits. [41:49] To do this, I've instructed my office to complete a number of what we call special examinations, [41:54] like what we did to uncover the $836 million of Medicaid waste. [41:58] Special examinations are essentially investigations that are not bound by traditional auditing rules [42:02] that can be too constraining to root out the problem of waste in particular. [42:06] As an example, the traditional auditing rule of materiality sometimes allows wasteful expenditures [42:12] that don't have a material impact on an entity's finances to go undetected. [42:16] So, I have employed a multidisciplinary group of auditors, lawyers, investigators, and analysts [42:22] who understand how to tackle waste, fraud, and abuse from every angle. [42:26] And those people need to be well equipped. [42:28] That's why my office has an AI task force to determine how to implement the use of AI [42:32] and all the aspects of our work. [42:34] AI can help us look at whole populations of data versus traditional sampling methods in auditing, [42:39] and will drastically cut down the amount of time it takes to audit, allowing us to tackle more issues than ever before. [42:44] Another part of being well equipped is having the right data access. [42:48] For the Medicaid capitation exam I discussed earlier, HHS OIG gave us safeguarded special access to a federal database [42:55] housing far better information than what states normally have access to. [42:58] And finally, the unfortunate reality is that some people simply won't change their ways [43:02] unless the harm they are causing to their state is exposed. [43:04] Congress is well-suited to hold accountable the nefarious and incompetent state actors [43:08] who waste taxpayer money and defraud the American people. [43:10] And like today, state auditors' offices can assist Congress in doing so. [43:14] This is a non-partisan issue. [43:16] If we take waste, fraud, and abuse seriously, we can ensure that every family gets needed assistance [43:21] without breaking the backs of American taxpayers. [43:42] My name is Bob Westbrooks. [43:43] I've spent the last 30 years in public service investigating fraud cases and auditing fraud controls. [43:50] I'm a retired inspector general and the former executive director of the PRAC. [43:55] I authored the book titled Left Holding the Bag about the pandemic fraud aid experience and the gaps in fraud prevention and detection efforts, [44:05] how we can be better prepared for the next emergency crisis. [44:08] I'd like to highlight a few points from my written testimony. [44:11] Is there fraud in federally funded state-run programs? [44:15] Absolutely. [44:16] Why? [44:17] It's because it's where the money is. [44:18] It's relatively easy to steal, and fraudsters don't sufficiently fear getting caught and punished. [44:24] The prevalence of fraud and the underlying root cause vary among programs. [44:30] Is there too much fraud? [44:32] Absolutely. [44:33] But we don't really know, in my view, the true amount of fraud, true amount of lost, true amount that we have lost to fraud. [44:40] Whatever the amount, headlines involving large dollar loss fraud cases erode public trust and can adversely impact those in need. [44:49] So what do we know about this type of fraud? [44:51] Government benefit fraud unfortunately happens in no program and no state is immune. [44:59] My written testimony contains data from the U.S. Sentencing Commission and some illustrative cases. [45:04] The past few years have given us two prominent case studies. [45:07] One, of course, the $250 million Minnesota Feeding Our Future scheme, which has resulted in over 60 convictions. [45:15] And two, the $100 million Mississippi TANF scandal, which has resulted in the conviction of the former executive director of the State Department of Human Resources and others. [45:25] Unfortunately, federally funded state-run programs, like most federal programs, are big, soft targets for individuals in international fraud ranks. [45:37] The internet has reduced barriers to fraud. [45:42] Offenders can find free fraud tutorials online, can purchase stolen identities for the price of a happy meal, and can file claims from anywhere in the world. [45:52] With automation tools, they can simultaneously file multiple claims in multiple states. [45:57] The prevalence of fraud discussions online normalizes this behavior, in my view, and reduces the fear of getting caught and punished. [46:06] So what can we do to reduce fraud? [46:08] It's as simple as making it harder to steal. [46:12] We can do that a couple of different ways. [46:14] I'm a big supporter of the fact that we don't have all the answers here, and sometimes we can look at the international community for some of the answers. [46:26] And I'm a big fan of the UK Public Fraud Authority, which is a great model that would need to be adopted in the US. [46:34] But in terms of consolidating the best practices, guides, and standardization of counter-fraud activities, not the enforcement side, but counter-fraud activities, I think there's a lot to be gained by looking at that model. [46:48] We can also employ appropriate controls to deter fraudsters from even attempting to file a fraudulent claim. [46:54] Prevent fraudsters from consummating the claim. [46:57] Promptly detect those claims that successfully pass, and then correct and respond to fraudulent claims through prompt enforcement action, target hardening, disruption, and recovery. [47:08] There is no one-size-fits-all solution. [47:11] Officials must consider relevant risk factors and weigh program objectives and the operating environment to design fit-for-purpose fraud controls. [47:22] To be frank, it is simply impossible or impracticable to design a 100% fraud-proof program. [47:28] The cost of controls and the impact on the delivery of public benefits would be too great. [47:34] Whether you're running a mom-and-pop store, Amazon, or a government program, fraud risk management always involves very difficult trade-off decisions. [47:45] This is not to suggest in any way that we should tolerate fraud. [47:48] The American public should reasonably expect that public monies are not used to pay dead people. [47:53] They're not used to pay incarcerated individuals or to pay duplicate claims in the same state or across states. [48:01] And that public funds are otherwise appropriately safeguarded. [48:04] Officials should aggressively but responsibly adopt new technology tools in the fight against fraud. [48:12] Finally, safeguarding public money should be supported by a coordinated and comprehensive risk- and data-driven approach, [48:21] leveraging our existing Inspector General structure and other accountability partners to both reduce losses and restore public trust. [48:30] I look forward to your questions. [48:32] Mr. Westbrooks, thank you very much. Very interesting. [48:36] I would move now to the young chairman of the full committee, the gentleman Mr. Comer is recognized. [48:41] Thank you, Mr. Chairman, for always having good substantive subcommittees here, always bipartisan. [48:49] This is a very important subject to this committee, waste, fraud, abuse, and mismanagement. [48:54] I can't think of a better panel. [48:56] I'm going to start with our great auditor in Kentucky, Allison Ball. [49:02] Auditor Ball, you've done a tremendous job exposing waste and fraud in Kentucky. [49:10] In your quest to determine all of this Medicaid fraud, which I've been screaming about for years in Kentucky, [49:18] we support Medicaid in Kentucky. [49:20] You're from a poor Medicaid-dependent region in the state, just like I am. [49:25] We want to support the program, but there's so much fraud and mismanagement, in my opinion, in the Medicaid program in Kentucky, [49:33] and we're just trying to get the backs of the taxpayers. [49:36] And your work has been phenomenal. [49:39] Out of curiosity, has Governor Rashear worked with you any during your audit? [49:46] Were they helpful in turning over information or anything to help come to the conclusions that you came to with respect to the amount of fraud? [49:55] That's a good question, because I really do believe these are nonpartisan issues, and we should be able to work together. [50:00] Unfortunately, I have to say, it's not been a great system of cooperation. [50:05] Boots on the ground people have been helpful. [50:08] When it comes to rising levels of leadership, it does get to be more difficult to get information from them, [50:13] and it's actually only gotten more difficult as time has gone by. [50:17] So the unfortunate answer is no. [50:19] It's actually been disappointing that I've not had good cooperation from the top level of the Beshear administration. [50:26] Do they dispute the findings? [50:28] I know you came out with this a few weeks ago. [50:30] Has there been any communication between the Beshear administration and the auditor's office? [50:36] So that's a good question. [50:37] Their response was mostly that it's not unique to Kentucky, that this happens in other places as well. [50:45] Which, in my view, and that's true, it actually does happen in other places as well. [50:49] But I think that that attitude makes it less likely to be addressed. [50:55] Just because it happens somewhere else doesn't mean that it's not serious and not important. [50:58] And you're exactly right, and the governor's right. [51:01] It's happening everywhere. [51:03] We're trying to do something about it. [51:05] We're serious about it. [51:06] Dr. Olika mentioned the task force that J.D. Vance will lead. [51:13] We're serious about trying to do something about this. [51:16] And there's just an attitude among a lot of politicians, and I'm not going to be partisan in here, Mr. Chairman, [51:23] because you want this to be a good bipartisan hearing. [51:26] But there's just an attitude among a lot of governors and a lot of big city mayors that, [51:32] well, it's okay. [51:34] It happens everywhere. [51:35] It's no big deal. [51:36] It's, you know, why do you care? [51:38] It's government money. [51:39] It comes down like manna from heaven. [51:41] I mean, that's the attitude that a lot of these officials have. [51:44] So I just want to publicly thank you for the work you're doing. [51:49] It's so essential. [51:51] We have an independently elected auditor in Kentucky. [51:55] Not every state does. [51:56] I'm glad that we do. [51:58] It's worked out well in this instance. [52:01] And I hope that the Kentucky General Assembly will take some of your findings and work to reform Medicaid in Kentucky, [52:09] because I don't think it's going to happen administratively at least over the next two years. [52:15] So my next question is to Dr. Olika, my constituent. [52:20] Real proud of the work that you do. [52:22] Your organization, the State Financial Officers Association, can play a huge role in fighting fraud. [52:30] Can you give us some examples of how your organization can work with Congress to help not only identify fraud, but to try to hold people accountable for fraudulent behavior? [52:43] Absolutely. [52:44] Well, one of the things that we try to do, Mr. Chairman, is provide good ideas for good public policy. [52:50] As a 501c3, we provide educational resources. [52:53] And we think that if Congress is able to put some frameworks in place where the state elected officials, again, Auditor Ball and her colleagues can effectively work directly with inspectors general, work directly with these folks in the federal government, you'll see some real reforms. [53:08] One of the things that's incredibly important, I think, for a framework, and you touched on it, you need leaders who have good policy information. [53:15] They also need the statutory authority, but they also need the political incentive or, in a word, courage. [53:21] You need good leadership. [53:22] We have that leadership, obviously, in Kentucky with Auditor Ball. [53:25] We also have it in other states as well with Auditor Foley in Nebraska, Auditor Cannon in Utah and so many different places. [53:33] If you've got leaders like that who are then able to work with Congress directly to work with the inspectors general on the executive side, then you can start to see some real reforms. [53:42] Also, if you've got a transparency website here at the federal level where the American people can see where their taxpayer dollars are going, especially with fraud, that'll help. [53:50] And one last thing, our financial officers actually have trust among the people. [53:55] So when they respond to these issues, people listen to them. [53:57] Well, thank you. [53:58] Don't ever hesitate to reach out to this committee. [54:00] We're serious about trying to prevent fraud. [54:04] We would love to claw back money. [54:06] We would love to hold people accountable. [54:08] But at the end of the day, we've got to reform programs and put more guardrails. [54:13] When there's duplicate payments in Medicaid, when there are people that have been deceased that are still, for some reason, getting Medicaid benefits or providers like we're seeing in Los Angeles County with hospice are still billing people that are no longer alive. [54:32] I mean, that's a problem. [54:34] And there's just an attitude that's breathtaking to me among a lot of government officials. [54:39] They don't care. [54:40] Well, some of us do care on this committee, and I know you all care, and we thank you for your great work. [54:45] We look forward to working with you in the future. [55:52] Millions of Americans rely on Social Security net programs like the Supplemental Nutrition Assistance Program and Medicare. [56:08] We must ensure that these critical programs run efficiently with minimal disruption. [56:18] To that end, it is crucial that agencies conduct their fraud prevention activities efficiently so that funding and services can reach people without unnecessary delays. [56:40] That means effective oversight requires highly skilled personnel and adequate resources. [56:49] Mr. Bagdonian, what tools and resources do agencies need to prevent unnecessary delaying benefits? [57:03] Thank you for your question, Ms. Norton. [57:06] Thank you for your question, Ms. Norton. [57:09] That is a tricky proposition, to be frank. [57:12] You have to thread the needle on this. [57:16] You can't obviously delay important benefit delivery. [57:20] But on the other hand, you have to ensure a certain amount of integrity in that delivery. [57:27] So, technology is part of the solution. [57:31] Expedited reviews that fit within the delivery timeline is important. [57:38] Access to vital data. [57:40] I think, as Dr. Oleka mentioned earlier, it has to be done in real or near real time to make sure that deceased individuals, incarcerated individuals, and other ineligible individuals do not receive that payment. [57:58] But also, I would go back to a point I made earlier. [58:03] It is the culture, the acknowledgement that fraud is a problem that has to drive the response and make considerations of fairness and speed of delivery versus the program integrity, fraud risk management trade-off. [58:20] So, that would be my high-level response to your question. [58:24] Thank you. [58:26] Inspectors General are a key part of detecting and preventing fraud. [58:33] However, the Trump administration has fired 19 Inspectors General robbing their offices of leadership expertise and institutional knowledge. [58:45] Mr. Westerbrooks, how do these firings harm people who need government assistance the most? [58:53] Well, the firings certainly have an impact on the effectiveness of the Offices of Inspectors General. [59:03] With the absence of top-level leadership, you have instances where there may be a lack of strategic direction or commitment to oversee certain programs with the rigor that Congress and the American people should expect. [59:18] As probably more problematic in my view, just as problematic or more than the firings is actually the proposed budget cuts, which are crippling. [59:29] There was a study that was put out, I believe, yesterday from the Partnership for Public Service that the IGs, on average, are being asked to take a 13% budget cut over FY 2024. [59:44] GAO similarly was facing some budget cuts. [59:49] And when you look at the return on investment, I mean, they're the best thing I think the government's got going. [59:55] I know I'm biased in that regard, but I think on average, IGs have about an $18 to $1 return on investment. [1:00:03] And I believe GAO has in the nature of over $100. [1:00:08] I think it's $120 per dollar spent for those budgets. [1:00:11] So it is money well spent. [1:00:13] So we do need the leadership positions filled with the right people that are independent, in fact, in appearance. [1:00:21] And those offices need to be funded to do their job effectively. [1:00:25] Thank you. [1:00:26] We must work together to ensure that inspector general offices are not only full of staff, but also fully funded. [1:00:39] We cannot expect these offices to do the work we need them to do when we do not give them the proper resources. [1:00:48] I hope my colleagues will join me in supporting full funding for inspector general offices to ensure that federal assistance goes to those who need it most. [1:01:02] And I yield back. [1:01:12] It just seems to matter who's in charge. [1:01:15] Everybody wants to point the finger at the other side, but when they're in charge, this doesn't seem as the same case. [1:01:23] I always have said that if we could just eliminate this fraud in these systems, that it would provide for the least amongst us, more of us. [1:01:32] And so, you know, I've been in as mayor of Knox County and things, some things didn't go right. [1:01:38] And I had to stand up and take the hit and admit to it. [1:01:42] And I'm afraid that's kind of what's lacking all over the place up here. [1:01:47] And saying that, I want this to just go down the line. [1:01:52] What are the some what issues do the state and federal agencies face in addressing fraud risk in their program? [1:02:00] And I guess I mean to say what issues that stop them from addressing it? [1:02:04] Start with you, sir. [1:02:05] How do you say your name? [1:02:06] It's Bagdoyan, Mr. Burgess. [1:02:08] Well, you got my name right. [1:02:09] So Bagdoyan, I got yours right, too. [1:02:11] There you go. [1:02:12] That's a first for both of us, probably. [1:02:14] Go ahead. [1:02:15] I'm glad we have that understanding. [1:02:16] So as I mentioned, you know, the culture is very important. [1:02:20] So that drives whatever happens below. [1:02:24] But it is essential to have a robust fraud risk management capacity. [1:02:30] You have to have the leadership. [1:02:32] You have to have the strategy. [1:02:34] You have to have the controls and execute those effectively. [1:02:39] But at the federal state level, many times, as I mentioned in my opening remarks, you have this issue of program design, either statutory and or regulatory restrictions on what a state and a federal government can do. [1:02:55] Or a permissive attitude as well, which allows extensive reliance on self attestation, which, as I described as the bane of any auditor. [1:03:05] So that is something that really needs to be looked at. [1:03:09] I think you have a question follow up. [1:03:12] Well, actually, I just go down the line and ask that and then I'll come back on my follow up. [1:03:16] But thank you for that. [1:03:17] Yes, sir. [1:03:18] I might offer actually the same response. [1:03:21] There's a challenge sometimes where state elected officials aren't aware of all the resources available to them. [1:03:27] For example, the do not pay list. [1:03:28] It's a great resource that has the federal government support effectively outlining. [1:03:33] What is the do not pay? [1:03:34] I know what it is, but I'm sure the rest of the committee does not. [1:03:37] It's a resource. [1:03:38] That's a joke. [1:03:39] I don't know what it is. [1:03:40] Go ahead. [1:03:41] It's a resource that allows states. [1:03:42] It's compiled by the federal government. [1:03:43] It's a resource that allows states to effectively look through folks that they shouldn't give benefits to, that they can actually review it to make sure that there is no implication of fraud. [1:03:53] If you were to give some folks some resources, you can utilize that tool and it can be expansive based on the data that is given to it from states. [1:04:02] So you pass data back and forth when you've got a policy response. [1:04:06] In that way, it increases, it makes more robust the resources that are available. [1:04:11] So if state financial officers in particular had access and knowledge to that, that can help things as well as the statutory authority. [1:04:18] There's a single audit act for Medicaid that effectively put state financial officers, auditors in particular, in a position where they've got to audit Medicaid. [1:04:26] If you had once a year. [1:04:27] If you had that for every program, then you are more likely to find fraud. [1:04:31] So those are some instances as well. [1:04:32] Ma'am. [1:04:33] So I'm going to piggyback a little bit on the culture issue because we found that on this $836 million of waste that we discovered, [1:04:42] because when we started doing interviews with boots on the ground and then with leadership, we found out that people that were actually doing the work were told, [1:04:48] hey, this is not that big of a deal. [1:04:50] It's low priority. [1:04:51] If you get to checking somebody's residency, you know, that's good, but it's really not that big of a deal. [1:04:55] So it really did expose that the attitude at the top really does make a difference. [1:05:00] I think that's why it's really important today that we're here because you are indicating to all the American people, hey, this really matters. [1:05:06] And that has a cultural response and a cultural change. [1:05:08] So I would say the culture is important. [1:05:10] I also think that we need to be reviewing things at all levels. [1:05:15] So as we've started to get more aggressive on reviewing the error rates, those error rates have begun to go down. [1:05:20] We saw that with SNAP. [1:05:21] We went from 9.1% to 3.5% error rates just because we were actually involved in the process and we were identifying particular errors. [1:05:29] I think that has to be part of it. [1:05:31] And then another thing, actually this piggybacks on what O.J. was just saying, the real-time review was a serious problem on this particular audit that we did [1:05:40] because they were doing what was called Paris Alerts who were getting from the federal government from a program, but it only happened like once a quarter. [1:05:47] So it wasn't real-time by any means whatsoever. [1:05:50] People were also being told, hey, just ignore it for the most part. [1:05:53] So we need a greater level of access to as close to real-time as we can get. [1:05:58] There's a program called TMSIS, T-M-S-I-S. [1:06:01] We were able to use that in our audit. [1:06:03] Normally we can't, but we were permitted to use it. [1:06:06] HHS OIG gave us special access, and that gave us much closer to real-time and it was much fuller information. [1:06:12] So we were able to look and see do they actually live in Kentucky or not. [1:06:16] That kind of access is a game-changer. [1:06:18] Thank you. [1:06:19] Mr. Chairman, I'm out of time, but if I could yield, let Mr. Westbrook say something. [1:06:23] I saw him making some notes, and he's sort of got an orange tie on, and I'm from Tennessee. [1:06:29] So if I could let him just say something, that'd be all right. [1:06:32] Go ahead, brother. [1:06:33] Gentleman's recognized. [1:06:35] Well, thank you for that. [1:06:36] A couple of comments from my experience in government generally and then during the pandemic emergency. [1:06:42] There are eligibility databases that are out there, and it's very frustrating for anybody to say, [1:06:47] why aren't we catching dead people, incarcerated individuals, et cetera, and duplicate payments? [1:06:52] So food stamps or the SNAP program has the National Accuracy Center. [1:06:58] You have with unemployment insurance. [1:07:01] There is an employment data hub. [1:07:04] The problem is the 50 states and the different territories, they've got different information systems. [1:07:10] So sometimes it's very challenging for them for the data systems to talk to each other. [1:07:15] They don't have the funding or the resources to connect in real time that we would like for them to have. [1:07:21] So that's one of the challenges is why these tools are not being fully implemented. [1:07:25] The other thing I would say is, and I don't think this can be overstated, is the level of sophistication with international fraudsters and organized crime rings is a significant drain on states. [1:07:38] And I give you an example in the pandemic, the one that sticks with me, my home state of Maryland. [1:07:43] Governor Hogan announced in July of 2020, when the heat of the pandemic, when they were completing all these claims, there was an international fraud ring that had submitted 46,000 fraudulent UI claims for $500 million. [1:07:59] So while the agency is busy making sure people have unemployment insurance to put food on the table, they're also getting hit by these very sophisticated fraud rings that they have to deal with as well. [1:08:10] So that's why I think we really need a much more coordinated approach. [1:08:13] Thank you. [1:08:14] Real quick, are they mob related or are they international terrorists? [1:08:17] You have both. You've got state sponsored bad actors and you've got fraudsters. [1:08:21] Yep. [1:08:22] Thank you, Mr. Chairman, for your indulgence. [1:08:24] And my friends across the aisle, I appreciate Charles indulgence. [1:08:27] Thank you. [1:08:28] Thank you very much, Chairman Burchett. [1:08:31] Ms. Randall, you're recognized. [1:08:33] Thank you, Mr. Chair. [1:08:35] And thank you to our witnesses for being here today. [1:08:38] Combating fraud where it exists and ensuring proper stewardship of taxpayer funds is a shared responsibility amongst all elected officials at the state, local and federal level. [1:08:48] And a responsibility I wish was shared by this presidential administration. [1:08:54] I'd like to quickly point out that the U.S. is currently spending one billion taxpayer dollars a day for a war in Iran that the president chose to start. [1:09:03] Not to mention that Trump has personally profited four billion in his first year back in office through crypto schemes, shady property deals and selling products like Trump Bibles and watches. [1:09:14] Some of my colleagues on the other side of the aisle and this administration are quick to demonize so-called blue states. [1:09:21] But it's important for the record to reflect that blue states like Washington are taking fraud issues incredibly seriously. [1:09:29] For example, when it comes to Medicaid, improper payments and potential fraud, Washington has moved from a reactive system to a proactive data driven integrity model. [1:09:39] As a state senator, I voted to codify oversight expectations for the health care authority in their administration of Medicaid. [1:09:46] And I also supported funding for Washington's fraud abuse detection system. [1:09:50] This law combined with elevating program integrity into a dedicated division established focus leadership and accountability and integrating audit and program integrity functions has led to 178% increase in fraud referrals and over $300 million recovered across two years. [1:10:09] Another example of the work Washington state is doing can be seen within the long term services and supports programs where the states recovered over 99% of improper payments. [1:10:18] When it comes to childcare programs of the over 63,000 families who received a subsidy in Washington, 2.6% of those families who were ultimately investigated, 13 individuals were prosecuted through the state's rigorous audit process. [1:10:34] These are just a few examples of how Washington state, a blue state is being very thorough and intentional in continuously improving and evolving their best practices to make sure that not only is fraud being addressed, but that fraud is also being prevented. [1:10:49] An example, one example of 50 like some that we have heard here today of how our states play such an important role in maintaining the integrity of taxpayer dollars. [1:11:01] What I want to make sure we are all very clear about, though, is that when there is an overpayment or an improper payment, that does not automatically equate to fraud. [1:11:13] Mr. Westbrook, is it fair to say that most improper payments are paperwork issues rather than fraud? [1:11:19] It varies by program, but absolutely. That's the very challenging thing about when we use improper payment as the error rate is that includes overpayment and underpayment. [1:11:31] And it includes situations where the claim was actually valid, but there's no documentation in the file. Fraud is a part of that. [1:11:39] And one of the things that frustrates me in the SNAP program in particular is where we're seeing a lot of the fraud is on the retailer side, retailer trafficking of fraud, and then stolen benefits. [1:11:52] Neither of those are captured in the error rate that we have when we talk about improper payment. [1:11:58] Improper payment is just a payment that on the surface somebody looks at it, shouldn't have been paid, or is in the improper amount. [1:12:05] Thank you, Mr. Westbrooks. I've mentioned before in committee that I had a sister with really complex disabilities who relied on Washington State's Medicaid program. [1:12:14] And I can think of a number of times where my mom didn't submit paperwork in time because Olivia was in the hospital or had another bout of pneumonia [1:12:21] or had any number of health complications that meant that her stack of paperwork on the kitchen counter just got bigger and bigger and bigger. [1:12:28] And those improper payments sometimes are just a struggling family trying to keep their kid or family member alive and healthy. [1:12:37] Mr. Westbrook, it seems to me that one of the underlying premises of many of our hearings on fraud is that states are not incentivized to properly oversee federally funded programs. [1:12:49] Given that states share in the cost of improper payments, what evidence suggests that states are not incentivized to oversee their programs? [1:12:58] I haven't seen any evidence, and I can't say that it doesn't exist. [1:13:06] I will say, just frankly, at 30 years in government in this business, I don't find many or any state, local, or federal officials that don't seem to care about fraud. [1:13:22] They seem to care about fraud. It's the fact that they don't have the tools available. [1:13:26] And I think that there's opportunities for the federal government to standardize and make these tools available, whether it's making sure that data systems talk to each other, [1:13:35] or just providing guidance and enhancing the general workforce and skill set of counter fraud professionals across government, state and federal. [1:13:45] Absolutely. Thank you so much, Mr. Chairman. I yield back. [1:14:01] But we're trying to address today federal and state programs not related to any political section necessarily, [1:14:12] that we believe that this is a nationwide problem, that we believe this is not a blue versus red state, [1:14:20] but rather things that we can accomplish by working together. [1:14:25] And so I want to thank the gentleman woman who has a strong record of not only working for that benefit, [1:14:32] but today, once again, we're highlighting some successes that can be made by states that they have in contact. [1:15:06] One of the biggest problems with federally funded programs funded by the taxpayers, run by the states, [1:15:15] lack of incentives for states to be good stewards of taxpayers' hard-earned money. [1:15:20] And I'm building on comments that have been made already. [1:15:23] It's all too easy, I think, for states to treat the federal government as a piggy bank that pays for the lion's shares of programs, [1:15:31] which allow states to tolerate a much higher amount of fraud than if their own money was at stake. [1:15:38] And I think this applies to government agencies as well as the individuals involved. [1:15:43] It's wrong. [1:15:44] These programs are all funded by the same taxpayers. [1:15:48] Here we are on tax day, and we're reminded that nobody gets to choose to pay taxes to their state or their federal government. [1:15:55] The same taxpayers must forfeit their pay to both levels of government. [1:16:00] There's no, quote, federal money or state money, but rather taxpayer money. [1:16:05] Therefore, all levels of government have the same obligation to be good stewards of taxpayers' money. [1:16:12] So what prevents state agencies from implementing stronger guardrails for detecting and preventing fraud in programs that receive federal funds, such as eligibility and identity checks? [1:16:26] What kinds of checks could state agencies implement quickly to help verify eligibility and identify as part of these programs? [1:16:36] Thank you for your question. [1:16:39] So the response is multifold. [1:16:42] I think I will keep going back to the culture of accountability, which drives everything else. [1:16:50] You can have very elegant fraud risk management systems, but if you don't have the leadership to make that happen, [1:16:56] nothing's going to work. [1:16:58] So that's an important thing. [1:17:00] The other one which was manifested during the pandemic is unemployment insurance, [1:17:06] where states were just overwhelmed. [1:17:09] I think as one of my fellow witnesses mentioned with massive claims for benefits. [1:17:15] They didn't have the systems. [1:17:17] They didn't have the expertise. [1:17:18] They didn't have the data to respond to that onslaught. [1:17:23] But what happened, unfortunately, after much of the benefits were dispensed, [1:17:29] the federal government provided funding as well as expertise. [1:17:33] These are called Tiger Teams from the Department of Labor that helped stem some of the more egregious problems, [1:17:41] including the self-attestation issue that I mentioned earlier. [1:17:46] So that showed success during the pandemic, but I don't think it's being sustained at this present time. [1:17:52] But we could have had in the law, you couldn't self-attest. [1:17:57] We could have put that into legislation that you couldn't do that, correct? [1:18:03] You can, but it has to be verified. [1:18:06] Right. [1:18:07] That's where states fell short. [1:18:08] You know, I attested myself as being eligible for unemployment insurance. [1:18:14] I signed my name, but, you know, who's going to verify that? [1:18:18] And then data analytics is very important, real-time data analytics. [1:18:23] But you also have to respond to the results of those data analytics. [1:18:28] Thank you. [1:18:29] Ms. Ball, you talked about the culture, and I think that is a very important issue. [1:18:35] I do think there is a culture of, well, it doesn't matter. [1:18:39] So how can we do more here to prevent the improper payments from being made in the first place [1:18:49] without the federal government having to take all the responsibility for making sure that this happens? [1:18:57] So that's a great question. [1:18:58] I really do think there's a partnership element with somebody at the federal level and then somebody at the state level. [1:19:05] So I like to use my example because I think it's worked pretty well. [1:19:08] I have myself as state auditor. [1:19:10] I'm responsible to the people of Kentucky. [1:19:12] I am independent. [1:19:13] And I am very interested in accountability, transparency, and exposure. [1:19:18] So that kind of exposure, that impacts the culture. [1:19:21] I think that people that were working on this were embarrassed to find out that suddenly it's reported. [1:19:26] There were actually comments made, this is not a high priority. [1:19:30] It's a low priority. [1:19:31] If you get to it, great. [1:19:33] But it's really not something we're that interested in. [1:19:35] And once the public becomes aware of that, then there is a desire and incentive for a cultural change. [1:19:40] So I really do think there's got to be somebody at the state level who is keeping an eye on these things, who's incentivized to do that. [1:19:47] I think auditors work well for that. [1:19:49] We have an ombudsman as part of our office. [1:19:51] And I think that's really added a lot to us because we're checking error rates all the time. [1:19:54] And we check what type of error rate it is. [1:19:56] So I would think it would be a partnership like that. [1:19:59] One quick question. [1:20:01] Excuse me, Mr. Chairman. [1:20:03] How many North Carolina has an independently elected auditor? [1:20:07] How many states have independently elected auditors who should be held accountable and can be held accountable? [1:20:16] That's a great question. [1:20:17] I know not every state has elected auditors or somebody who functions like that. [1:20:22] It's actually probably more a question that Dr. Aleka would be more well versed to answer than me. [1:20:26] I know kind of here and there who is. [1:20:28] He might know the full body if you want to do it that way. [1:20:32] Do you mind, Mr. Chairman? [1:20:35] Gentlemen's recognized. [1:20:36] This is why we're here and the gentleman is actually moving in on a very important subject. [1:20:42] So gentlemen's recognized. [1:20:44] Thank you. [1:20:47] Thank you for the opportunity to answer that question. [1:20:48] It's a tricky question in the sense of the names have different titles. [1:20:52] You could have a comptroller in Texas, which is extremely powerful, but doesn't have the title of auditor. [1:20:57] What we've seen in terms of our 41 state financial officers across 28 states, we've got roughly a dozen or so that are auditors. [1:21:05] Probably a little less than half than that have the type of authority that Auditor Ball has, that Auditor Bullock has in his state. [1:21:12] Pennsylvania has a strong auditor in Auditor General DeFore. [1:21:16] Utah Auditor Tina Cannon is very strong in that regard. [1:21:19] So there are a few. [1:21:20] One of the things that could make this issue a little bit better is if you had stronger auditors, as you just pointed out. [1:21:26] I also quickly want to touch on the culture issue that you mentioned, because while people say this isn't a big deal, obviously this body knows this auditor knows. [1:21:34] Let me tell you why this is such a big deal in terms of the American people. [1:21:37] When you have a culture that defers to fraud and allows it to stand, then you spend more money. [1:21:43] When you spend more money that then mandates based on your political philosophy an increase in taxes. [1:21:48] So if you increase taxes on hardworking families, now they're faced with the choice of putting gas in their car, paying diapers for their children. [1:21:56] This is a real cost that families have to go through all because fraud wasn't detected. [1:22:00] And it also sows distrust because you have people who are trying to survive on WIC or SNAP or government benefits. [1:22:08] And they look to their left and they see one of their neighbors who's a fraudster riding around in a Benz buying as much food as they can. [1:22:14] So when you don't have a culture of accountability, when you don't have the type of leadership that Auditor Ball and her colleagues across the country have, you sow distrust. [1:22:23] You have discord in the public and you also have a culture of tax increases, which takes money out of the hands of the American people. [1:22:29] Thank you. Thank you, Mr. Chairman. [1:22:37] Thank you, Mr. Chairman, and thank you for your indulgence again in allowing me to join the subcommittee. [1:22:43] And thank you to our witnesses. [1:22:46] Mr. Begdoyan, the GAO testimony includes five principles of fraud. [1:22:53] Probably all four of you are familiar with this from the International Public Sector Fraud Forums Guide to Managing Fraud for Public Bodies. [1:23:02] A really wonderful five principles there. [1:23:05] I would add a six that I think the chairman has demonstrated today. [1:23:08] A fraud prevention effort has to be apolitical and nonpartisan if it's going to get the kind of buy-in necessary to succeed. [1:23:18] And Dr. Aleka, I really appreciate you and your organization and your commitment to this work, your commitment to working on the vice president's initiative, [1:23:28] which I sincerely hope is successful in accomplishing its stated goal. [1:23:33] I do think we have to just speak the truth here and say that the president of the United States in describing that initiative, [1:23:41] this is a direct quote, said it would, quote, focus primarily in blue states. [1:23:46] And I think that would violate the principles of everything that we're discussing here. [1:23:51] I hope that's not the direction that it goes. [1:23:54] Auditor Ball, you made a very powerful comment. [1:23:58] You said that it's crucial for every state auditor to bring their mentality of independence. [1:24:04] And you probably would agree that if Governor Beshear were here today, [1:24:08] he maybe would have a slightly different response to the question that Chairman Comer gave about his work. [1:24:15] And that's okay. That's good. You're independent. You have your own perspective. [1:24:20] He can't fire you if you say something that he doesn't like. [1:24:23] I want to just reiterate concerns that some of my colleagues have shared about the diminution of the independence of our federal IGs. [1:24:36] And one aspect of that that hasn't been specifically addressed is with the mass firing of 17 of them. [1:24:44] Many have been replaced by acting IGs who don't have the same statutory protections that those fired IGs have. [1:24:54] Three quarters, three quarters of the federal IG positions are vacant today. [1:25:00] So the very people who are helping to do this work, Mr. Westbrook has laid out the savings, are not on the job anymore. [1:25:10] And we've talked about the budget. [1:25:12] Just the HHS IG is facing in the president's budget a potential $13.7 million cut. [1:25:20] My concern, Auditor Ball, is if those kind of cuts to the HHS IG and others are put into effect, [1:25:27] the next time a state auditor like yourself wants to partner with the HHS IG to identify and reduce $800 million of fraud in Kentucky, [1:25:39] they won't have the capacity or the resources to partner with you or one of your colleagues around the country. [1:25:43] Mr. Westbrooks, based on your experience as a federal IG, what kind of operational impact would it have if you were told that your office was going to face a 12% budget cut in one year? [1:25:56] What would you have to do? [1:25:57] What would you have to scale back in terms of your work to prevent fraud? [1:26:00] As an immediate impact, the immediate impact on your audit operations are on prospective engagements. [1:26:11] You have to look at what you're going to be able to audit in the future, in the short term. [1:26:16] On ongoing engagements, now you have to re-scope, potentially and most likely re-scope those audits, [1:26:22] because you're not going to have the staffing or resources to do the fieldwork that you need to do. [1:26:28] You know, our federal audits, particularly the big agencies, you're doing fieldwork around the country. [1:26:33] They're not desk audits. [1:26:35] And then the really difficult thing and the challenging thing is when you have this disruption in the community, [1:26:41] you have very experienced OIG auditors that are leaving government. [1:26:45] And so the brain drain from what we've experienced in the last year, it's very hard to overstate. [1:26:52] Some of the most experienced auditors that I've worked with are no longer with us, [1:26:56] but had still plenty of years left in federal service that they should still be in the job, [1:27:01] but now they're in the private sector. [1:27:03] Thank you. [1:27:04] And Mr. Chairman, this morning I sent a letter to Cheryl Mason, who's the relatively new, I think, chair of CIGI, [1:27:14] to be asking for clarity on how these vacancies, firings, and budget constraints on the IG community [1:27:20] are affecting our ability to prevent and detect fraud, waste, and abuse. [1:27:26] And without objection, I'd like to submit that letter for the record. [1:27:29] Without objection. [1:27:30] And thank you, Mr. Chairman. [1:27:32] If you'll indulge me, it's just me and you. [1:27:34] I wanted to just ask Mr. Begdoyan one question. [1:27:38] Your testimony noted the many recommendations GAO has made. [1:27:44] I think you said that maybe 40% have not, are open. [1:27:49] 40% of 215 recommendations you all have made to federal agencies are not open. [1:27:54] One of those, or maybe this is, maybe a number of them are in this category, [1:27:59] that an agency designate an entity to lead fraud risk management. [1:28:04] You cite that as a recommendation. [1:28:05] Maybe that's a recurring recommendation. [1:28:07] It is. [1:28:08] I think that would surprise most members of Congress, [1:28:12] that an agency doesn't have an entity designated to lead fraud risk management. [1:28:19] I mean, if the Secretary of HHS were here and we asked them that question, [1:28:23] would they say, no, we don't have any entity that leads fraud risk management? [1:28:29] Well, for HHS, they do have the Center for Program Integrity. [1:28:35] But again, fraud risk management is a huge agency. [1:28:38] It is rather dispersed. [1:28:41] But yes, that is a very important thing to have in place. [1:28:45] Dedicated entity, that implies dedicated to fraud risk management. [1:28:50] What we do find often is that that responsibility is devolved to existing units based on other duties as assigned. [1:29:02] Ah, okay. [1:29:03] They don't have necessarily the expertise, the bandwidth to do true fraud risk management. [1:29:09] And that is apparent when I mentioned earlier in my remarks that the capacity to manage fraud risks is on the softer side. [1:29:19] That means you don't have the right controls in place. [1:29:23] And that, in part, might explain, might explain why some of these agencies are still lagging in implementing our recommendations. [1:29:33] So, I hope that is responsive to your question. [1:29:35] Thank you. [1:29:36] Thank you, Mr. Chairman. [1:29:39] The gentleman yields back his time. [1:29:41] I'm going to yield to myself now. [1:29:43] I want to thank each of you for being here. [1:29:45] Yesterday, we received a rather in-depth and robust opportunity to allow you to speak. [1:29:52] And I've thought about this overnight and have, obviously, a number of questions that we do want to make sure we approach by asking questions and getting answers and moving to that. [1:30:03] And I do accept the responsibility that primarily this falls on Mr. Infume and myself to make sure that we talk with each other, that we look at things. [1:30:15] But it is a robust, robust marketplace of ideas of things we don't do. [1:30:22] And I think that perhaps we tend to think that we inhibit ourself based upon either the law or common courtesy. [1:30:34] A prime example is perhaps how we identify people. [1:30:39] The Internal Revenue Service has a heck of a time knowing who they're talking to, who they are going to meet with. [1:30:47] And, of course, you and I don't have to agree, but I think that we have ways to identify people, biometrics, our eyes, our fingerprints. [1:31:04] Look, we've got a lot of other things to get into, but, Mr. Westbrooks, tell me about leading edge techniques and some pushback or your view as an auditor about utilizing technology as opposed to just data that's gleaned from a sheet of paper or personal information. [1:31:25] Yeah, on identity verification, there are a lot of tools out there. [1:31:33] And it's not my personal view, but my experience in the community was there's a lot of public debate. [1:31:38] There's some privacy issues related to that, where things that might be common sense, people object to. [1:31:47] You know, some European countries have a national digital ID card, which would go a long way if we had a similar concept here in the U.S. [1:31:55] It would go a long way to reducing identity fraud. [1:31:58] But that was just dead on arrival for whatever reason beyond my comprehension. [1:32:04] The other thing it's important to note is, you know, these international fraud rings utilize AI and other tools, and they can afford to make mistakes. [1:32:17] Right? [1:32:18] The government has less opportunity. [1:32:21] There's less forgiveness if the government aggressively utilizes AI and makes mistakes and people's benefits get cut off. [1:32:29] And there was a big scandal in the Netherlands related to this, where they very aggressively use this algorithm and many, many, many people were cut off from benefits. [1:32:39] Some included committed suicide as a result of it. [1:32:43] So, you know, we talk about ethical or responsible use of these tools. [1:32:47] Unfortunately, I think that's the reality. [1:32:49] I think government may always be a step behind the fraudsters who can afford to make mistakes. [1:32:55] It doesn't cost them anything. [1:32:57] Well, let's zero in on that. [1:32:59] Perhaps, Auditor Ball, you can get closer to this. [1:33:02] One of the things I learned from you yesterday is I asked the question, how do you find a lot of these problems? [1:33:09] And you said, whistleblowers, people call us. [1:33:13] No one likes to see that whether they're sitting in a room with other people or that they see things that happen, that they want these things to happen, where fraud would be involved. [1:33:25] But we just vetted out and heard maybe some European models might be something good to look at. [1:33:32] What's wrong with requiring or having a database where you have to present your finger? [1:33:38] And I know we've talked about this with voting, and that is where we get into the states are responsible for that. [1:33:46] But federal benefits, we've got a robust amount of data with fingerprints. [1:33:54] What would that seemingly do to this issue? [1:33:59] So, honestly, I have to say it's not something that I have analyzed very deeply. [1:34:04] So that's kind of a brave new world looking at that kind of information. [1:34:07] And from a personal perspective, I get a little bit nervous about presenting biometric information to a database, [1:34:13] and it's housed somewhere in the kind of security issues that you have. [1:34:16] Well, you go to the airport. [1:34:18] That's true. [1:34:19] That's true. [1:34:20] You go to the airport, and they take your picture. [1:34:22] And it is true that they agree then not to keep that picture. [1:34:26] Right. [1:34:27] But it presented itself as a way to identify yourself. [1:34:31] And I think we've got to, I'm asking the questions I want you to give the answer, [1:34:36] but you ought to present evidence who you are that is certifiable before you gain these benefits, [1:34:46] not show up and self-report. [1:34:49] Right. [1:34:50] I do think there needs to be a secure, reliable identification process. [1:34:55] What that is at this point, I don't necessarily have the answer. [1:34:59] There are so many technological advances that are occurring rapidly right now. [1:35:03] And there are confidentiality and security issues that kind of coexist with those type of situations. [1:35:09] I will say for us, in our experience, it's not always proving that somebody is who they say they are that's the problem. [1:35:15] It's other kinds of breakdowns. [1:35:17] So my focus has been on the problems of, well, we know this person is dead, but they're still listed as eligible, [1:35:25] and issues like that. [1:35:27] So I would say you are correct. [1:35:30] That is part of the problem. [1:35:31] But my focus has been on a lot of other problems, duplicative payments for one person, issues like that. [1:35:39] And I would say those may be the greater issues of concern right now rather than someone pretending to be somebody that they aren't. [1:35:48] Well, we've got to certainly go back and cobble together the information we've got. [1:35:53] All four of you, I could just ask a question. [1:35:56] I'm not trying to get you to jam into all the answers at the same time. [1:36:00] But the PRAC, the PRAC has some 1,700,000,000 pieces of data that is not indicative that it is broad, [1:36:11] but it's indicative that you need to ask or gain more information. [1:36:16] You need to know that this is maybe the term red flag may or may not be appropriate. [1:36:23] But an indication, please go look at this. [1:36:27] And that should be an indication perhaps where we would start with wandering into the world. [1:36:35] Do we know who you are? [1:36:37] Do you need to come and present yourself? [1:36:42] And I've just gone through Social Security issues and they vetted me to make sure they knew who I was. [1:36:51] It would have been nice if I if they had said, please come in Waco, Texas, to the Social Security office. [1:36:58] But not everybody likes that. [1:37:01] And there's a line between what is required and what is requested. [1:37:07] I just think we've got to get closer to understanding. [1:37:11] So talk to me about the use of PRAC data and information as this helps itself to get closer. [1:37:21] Mr. Westbrook. [1:37:22] Yeah, thank you for that question. [1:37:24] So the PRAC has an enormous amount of data, as does the Treasury's Do Not Pay or Payment Integrity Center. [1:37:31] The way the system is structured, though, the states would really connect with Treasury's Do Not Pay to do. [1:37:38] That's where the connection point should be, where you would check eligibility against the various databases. [1:37:44] I think the PRAC needs to be and is working towards being closer aligned with Do Not Pay and the Department of Treasury. [1:37:51] So it's not a pay and chase after the fact. [1:37:54] It's on a much more real time basis. [1:37:57] But I do think it's critical that we have that centralized government data system. [1:38:03] The other thing I will say related to this, and it's something you should be thinking about, is as bad of a job as we do in preventing fraud. [1:38:12] I submit to you we do just as bad of a job in protecting information. [1:38:16] You know, my like probably many people in this room and many federal employees, you know, my top secret security clearance information was all stolen by a hostile nation state. [1:38:28] And I was on, you know, credit check monitoring for several years paid for by the government. [1:38:35] So that's one of the things that we need to look at when we balance this idea of centralized repositories for identification is who's going to be holding it and how secure is it? [1:38:45] Because it can do irreparable harm. [1:38:47] That's why we're seeing these international what's the repercussions? [1:38:50] These these bad these international fraud rings are literally buying personal information for the cost of a Happy Meal on the dark web because of these hacking of government systems. [1:39:02] So that's the thing that concerns me as much as fraud is the information of personal protection of personal information. [1:39:10] Thank you. [1:39:11] I agree. Mr. Bagdoyan. [1:39:12] Yes, I would echo much of what Mr. Westbrook said. [1:39:16] There are a lot of data sets out there that can be crunched to yield results. [1:39:22] We look for indicators of potential fraud. [1:39:25] That's how GAO does its data analytics. [1:39:28] But once we present our findings to agencies, we expect them to respond to the results. [1:39:36] And many of them, unfortunately, don't do that. [1:39:39] So that is a huge problem. [1:39:43] And I will use one example from the VA's community care program where there's a lot of providers from outside the VA who tend to veterans health needs. [1:39:56] And we flagged several thousands of them several years ago that posed problems based on their background. [1:40:05] They were convicted of fraud. [1:40:06] They were convicted of patient neglect and abuse, things that would be disqualifying. [1:40:13] We made the referral to the VA and they promptly lost the referral. [1:40:19] So when we followed up with them, they'd never heard of the referral, so they hadn't done anything with it. [1:40:25] So that is a huge problem. [1:40:26] You act like we're busy. [1:40:29] I would now yield to the gentleman, Mr. Wikenshaw, who is requesting this opportunity. [1:40:35] Gentleman's recognized. [1:40:36] Thank you, Mr. Chairman. [1:40:38] Mr. Westbrooks, I'd want to just ask you to go back to your PRAC experience. [1:40:45] And I apologize for asking a question that perhaps is answered in your book. [1:40:49] I'll have to get a copy of it. [1:40:52] You know, talk to us about, from your perspective, the future of PRAC. [1:40:58] Do we still need PRAC? [1:40:59] The pandemic is over. [1:41:01] What role did PRAC's relative independence being constituted of IGs hosted by Siggy Play and its success? [1:41:13] Is it important that that independence continue if we should continue PRAC? [1:41:20] Just give us your answers to those questions or thoughts on those, please. [1:41:24] Thank you for your question. [1:41:26] When the PRAC was created, it was created, you know, the pandemic hit. [1:41:31] And in a matter of a couple of days, the Senate drafted a bill, which include the CARES Act, which included the PRAC provisions. [1:41:41] They took the PRAC provisions from the Recovery Act and just dropped it into the bill. [1:41:47] So there's a lot of lessons learned from the experiences that I had from April 27, 2020, when I first got appointed through December of 2022. [1:41:56] If you look at the CARES Act, there's a lot of things, lessons learned on how we can improve. [1:42:01] It's absolutely critical that we've got a centralized repository for government information that has the authorities, legal authorities, to share that data with state and local partners. [1:42:11] I think that was the secret sauce that we had with the PRAC was we could aggressively use our legal authorities to share with state and locals and federal law enforcement partners data without entering into complex data sharing matching agreements. [1:42:27] So it's critical that there be this repository, that they have the appropriate legal authorities, that they have the independence to do their work, they're appropriately funded, they're tied to Treasury's do not pay system, they don't operate independently. [1:42:42] That's not much government value to me. [1:42:46] And I think those are the keys for success. [1:42:49] I don't know. [1:42:50] This is my personal opinion. [1:42:52] I'm retired from government, so I can speak freely on it. [1:42:55] I don't know to what extent it needs independent investigative and audit authority. [1:42:59] I think the analytic data center of excellence authority is a prominent role. [1:43:08] But unfortunately, it's the investigative authorities that give you the special legal rights to share data with your law enforcement partners. [1:43:15] So there needs to be some smart lawyering and legislative council thinking on how to write the law on that. [1:43:21] But I do think it's critical that there be a center of excellence that can share, not just with the feds, but with the state and locals. [1:43:29] And it'd be somewhere where the state and locals feel like they're, or GAO, feels like referrals are going to be taken serious and not lost in a file somewhere. [1:43:40] Thank you. [1:43:41] Thank you. [1:43:42] I want to just shift gears to IT systems and IT modernization. [1:43:45] And Mr. McDoin, your testimony highlights some of the challenges states face, especially with respect to UI programs being implemented by legacy IT systems or outdated IT systems. [1:44:00] And I'm curious, Auditor Ball, I mean, is that something you have experienced in Kentucky, where maybe you say there's fraud in this program, [1:44:09] and we need X, Y, and Z controls. [1:44:12] And you talk to the IT folks and they say, sorry, we have a legacy system that just can't do it. [1:44:19] Have you experienced that? [1:44:20] That's definitely an aspect that we deal with. [1:44:24] We actually have a division that deals with IT audits. [1:44:26] So we look to see all the time this legacy software program that you have available. [1:44:31] Is it up to speed? [1:44:32] Does it do the work that we can do? [1:44:33] Actually, lately where we've seen breakdowns, though, has been when they've been eliminating a legacy program and incorporating a new one. [1:44:40] It's the switch that has created the opportunities for breakdowns. [1:44:44] And we actually just saw this with our Department of Revenue. [1:44:46] We've had just all sorts of problems with bringing on our new program on every level. [1:44:53] So that's its own problem. [1:44:55] Okay, great. [1:44:56] And then for Mr. Begdoyan, what is it that the federal government or Congress can do to better incentivize or support states who are trying to get their IT systems in a position where they can do fraud prevention in the way it needs to be done? [1:45:11] Yes, thanks for your question, Mr. Walkinshaw. [1:45:14] Again, going back to the UI experience, we designated that out of cycle as a high risk area in the midst of the pandemic, in large part driven by data and technology issues, among others, like service delivery and so forth. [1:45:32] And what worked during that time was that the federal government provided funding and expertise to, among other things, states technology system upgrades, which relatedly eventually caught up with with the integrity issues and help mitigate them. [1:45:56] But as I mentioned, by the time that happened, most of the money had already been dispersed. [1:46:02] So something like that is should warrant close consideration so that, you know, the states can have skin in the game, but also have some federal support to make things happen. [1:46:17] Thank you, Dr. Aleka, anything? [1:46:19] I apologize for going over my time, but you're literally itching to jump in on this question. [1:46:23] I can tell there. [1:46:24] Well, just to echo what Auditor Ball was saying in particular, I think there is an opportunity for states to utilize the new technologies that you were talking about as well to make sure that they have all the tools and the resources that they need. [1:46:36] One of the things that the chairman was mentioning in terms of potential new technologies, I would offer if you have a stronger, deeper relationship between state leaders, the state treasurers and auditors in particular, treasurers obviously on the front end in terms of verification, eligibility, transparency of how money is being spent, [1:46:53] and the auditors on the back end with regard to investigation, examination and obviously audits, then I think you can see a lot of that cooperation. [1:47:01] Also, I wanted to respond earlier mentioning that you hope that the vice president's task force is successful. [1:47:06] And of course, so do I, I was able to meet with some of that leadership last week. [1:47:11] Now, again, it wasn't an in depth conversation. [1:47:13] I don't want to certainly suggest that there was more discussed in there than there was. [1:47:16] But I can say that that team is very serious, very focused on these types of conversations. [1:47:22] How do we get better with technology? [1:47:23] How do we get better with cooperation and partnerships between the state and the federal level? [1:47:28] And it wasn't from a partisan perspective. [1:47:30] So there, I think, is a great deal of opportunity here from this committee, state leaders, and also this task force led by the vice president to get really good, [1:47:39] serious, systemic change done on the fraud issue. [1:47:42] Thank you. [1:47:44] He yields back. [1:47:48] Before he leaves, I'd like to, if I can, do a follow-up to what the gentleman was asking, [1:47:53] because I think it's a valid point. [1:47:55] So, Mr. Westbrook, probably I would ask this. [1:47:58] We began discussing a little bit more in-depth prac. [1:48:02] We discussed a little bit more in-depth about its existence, its seemingly integration into the law, [1:48:11] and how it's become effective. [1:48:15] Do we want to keep prac? [1:48:18] Do we want to expand its knowledge and use it and to make sure it's still and ready to go? [1:48:25] Maybe made permanent? [1:48:26] Thank you for your question, Chairman Sessions. [1:48:29] And this is the central premise of my book, quite honestly, was the frustrations in the early days of the pandemic [1:48:39] to reinvent the Recovery Board's data analytics capability. [1:48:44] You can't just flip a switch and create something. [1:48:47] It needs to be on standby. [1:48:48] It may not need to be as big as it was during the pandemic, but it was incredibly, incredibly challenging [1:48:54] to get the, it's called the PACE, the Pandemic Analytics Center of Excellence. [1:48:59] It was unbelievably challenging to get that stood up in a very short period of time. [1:49:04] So I would hate to see that capacity gone, because there will be, not only will there be another emergency crisis [1:49:10] that we'll deal with, but just on normal operations, you need that capacity. [1:49:15] We want that capacity. [1:49:16] We want that capacity. [1:49:17] It's, and it's a, it's a relatively low cost for it. [1:49:20] Thank you. [1:49:21] Well, I think the main point I'd say is it exists day one. [1:49:26] And the last part, which I am not here to shill for, but I have a piece of legislation that I'm dropping [1:49:32] today that makes it permanent. [1:49:34] So thank you very much for amplifying that. [1:49:37] And of course we need to pass it out to members of this subcommittee also. [1:49:41] I will yield back my time now, go to the distinguished gentleman from Florida, gentleman, Mr. Frost. [1:49:47] Thank you very much, Mr. Chairman. [1:49:50] In the fiscal year 2024, over $10 billion of federal government spending on SNAP was lost [1:49:57] due to improper payments. [1:49:59] The One Big Beautiful Bill Act included a SNAP provision that's nicknamed the Alaska carve-out. [1:50:07] This was a political move that was made to get the One Big Beautiful Bill passed over on [1:50:12] the Senate. [1:50:13] The Alaska carve-out delays the cost sharing requirement for states with high improper payment [1:50:19] rates, like my state, the state of Florida. [1:50:21] It makes absolutely no sense. [1:50:23] Essentially, it penalizes the states that make good faith efforts to improve integrity [1:50:28] and reduce their errors. [1:50:29] And it rewards the worst performing states in the entire nation. [1:50:33] We're already seeing people take advantage of this loophole. [1:50:36] In Maryland, a whistleblower claimed that senior officials were trying to leave correctable [1:50:41] errors uncorrected to keep the error rates up. [1:50:45] It also kicked the problem for the worst performing states down the line by creating a two-year delay. [1:50:50] And this is important to me because I'm from the state of Florida, which has some of the [1:50:54] highest rates of improper payments on SNAP in the entire nation. [1:50:57] Mr. Westbrooks, how does the Alaska carve-out discourage low-performing states with high [1:51:03] improper payments, like my state of Florida, from making the necessary improvements and [1:51:08] actually fixing the problems? [1:51:10] Thank you for your question. [1:51:14] I can't speak specifically for Florida officials and what any state official might be thinking. [1:51:20] I would look at it from an audit perspective. [1:51:23] I would look at the effectiveness of any intervention. [1:51:26] When we're talking about penalties and incentives, are they closely tied to the behavior to drive [1:51:33] the desired results? [1:51:35] Just on a personal level, I'm a proud father of five, and it strikes me as giving my D student, [1:51:43] dinging their allowance, my D student, but then letting my F student pass and say, just with a finger [1:51:50] wag to say, well, next year, I'm going to cut your allowance. [1:51:54] So in terms of the direct tie to the behavior, I think that's going to be a challenge. [1:52:01] And I look forward to auditors, GAO, and other officials looking at how effective that carve-out is [1:52:08] in practice in reducing fraud, which is the ultimate goal. [1:52:11] Well, I doubt it's going to be effective. [1:52:12] I mean, it wasn't a move made to fix anything. [1:52:14] It was a political move. [1:52:15] It was, you know, pretty reported on. [1:52:17] We all knew about it when it was going on in the Senate. [1:52:19] You know, in my state, our governor, Governor DeSantis, has allowed the program to essentially [1:52:25] crash and burn. [1:52:26] I mean, the Florida payment error is over 15%. [1:52:29] It's unacceptable. [1:52:31] And because of carve-outs like the Alaska carve-out, states like Florida are getting rewarded for [1:52:35] running a horrible program. [1:52:37] There's no reason to believe that even with a delay that states like mine can get their act to [1:52:42] come together and finally turn things around. [1:52:43] And this is important because it really impacts working families and the commitment we've made [1:52:48] to them. [1:52:49] Mr. Westbrooks, do you have any indication that states that are receiving this carve-out are [1:52:53] actually moving towards compliance? [1:52:55] Is there any indication of that? [1:52:57] No, I can't speak to that now. [1:52:59] I haven't seen anything on that. [1:53:00] Thank you. [1:53:01] And how do high error rates impact Floridians and just Americans in general who depend on [1:53:06] the vital programs? [1:53:10] Well, as you know, in the act, depending on the level of the error rates, there's certain [1:53:16] percentage of cost sharing that has shifted. [1:53:19] I guess some of the criticism that I've seen of it is that you're relying on an error rate [1:53:24] that includes overpayments and underpayments and includes what we talked about earlier [1:53:30] about documentation errors. [1:53:31] So there's a cost implication or a penalty associated with a, one could argue, an imperfect measurement. [1:53:40] It's the best that we have, right? [1:53:42] It's the improper payment rates, error rates is the best measure that we have. [1:53:46] But when you tie it directly to financial penalties and in a different timeframe, I think that's [1:53:53] where some of the debate has been on whether it will be effective or not. [1:53:57] Thank you. [1:53:58] What do these errors mean for like a working family? [1:54:00] I mean, I think we all understand, I think we can all understand what like an underpayment [1:54:04] can mean for a family. [1:54:05] What does an overpayment mean for somebody? [1:54:07] Well, an overpayment just means that the state made an error in the calculation and so they [1:54:16] get overpaid and the way the SNAP program, data quality program works, if it's, if the error [1:54:24] is under, I think it's $58, then it is, it's deemed as not material, so it's not factored [1:54:30] in. [1:54:31] So that's, so you might have instances where there's a large number of under $58 errors, [1:54:37] overpayment or underpayment, but there's a systemic issue underneath that, that will never [1:54:43] be addressed because it doesn't meet the error. [1:54:46] But, you know, all of the error rates ultimately, like I said, it affects, as you know, affects [1:54:52] the state cost share amount. [1:54:55] And anytime that there are, this is any government program, whenever there are penalties associated [1:55:01] with anything, you always have to worry as an auditor that people are going to game the [1:55:05] system in terms of their statistics. [1:55:07] And that's always going to be a risk and data quality is always going to be a risk [1:55:11] in that program. [1:55:13] And I think any other federal program. [1:55:15] Thank you. [1:55:22] You've given us not only a laundry list, but I think some good direction that we need [1:55:30] to go. [1:55:32] I am interested in making sure that I follow up with each of you on not just your ideas, [1:55:41] but that I provide you feedback about how we're getting there. [1:55:46] We cannot fix this without each of you auditors who see things and direction we go. [1:55:55] But I think that you see some sense of opportunity that lies within the members here that are truly [1:56:03] concerned about over and under payments. [1:56:06] Perhaps an underpayment is very difficult for us always to quantify. [1:56:12] I'm not sure we pay as much attention to those, even though our congressional offices have to fight [1:56:18] many times with people who want to be recipients on those matters. [1:56:24] We can consume ourselves if we do not fix this problem. [1:56:30] We can take away from the availability of money. [1:56:35] And we see that when we look at the national debt. [1:56:42] This chance that we have, however, I think Dr. Oleka needs to be brought front and center to people who are like you, [1:56:52] who are auditors, who then openly express their delight or their problems with what we're doing. [1:57:01] I'm very much interested in Mr. Nfume and I in this subcommittee getting closer to this. [1:57:12] But we have to start with more than just looking at the PRAC or looking at making legislation permanent to save it. [1:57:20] And I think Mr. Westbrook's point that I took under advisement that I wholly agree with is why would we do away with the data we have? [1:57:30] Why would we not move forward on that? [1:57:33] But I think the question is, and we have vetted that here, that this staff and I have spent a great deal of time of wondering what is that key word? [1:57:43] Is it fraud that we need to focus on that says because of a question of fraud, not fraud, but a question of fraud, will that allow us to receive information across the board and other agencies to where they could do business with each other, where they could verify things? [1:58:04] And I think it's our hope that weakens my last question to you today. [1:58:09] I think if we were to ask a question, not assuming we know the answer, us asking a question, would that mean that the entities, no matter SBA, VA, wherever it is, [1:58:26] they could then go and vet that question a little bit better and ask for data to certify who people are. [1:58:36] Is that really the answer to where we would ask people and take the 15 minutes and vet them and then have the tools to where we could go and double check what they said? [1:58:50] Death certificate, voter registration, license information. [1:58:56] There is a lot of information that is out there that they should have access to, even if it's to their own state. [1:59:03] Help me be down that pathway. [1:59:06] Anyone? [1:59:07] Mr. Westbrooks? [1:59:12] I can share my experience as IG of the Pension Benefit Guarantee Corporation. [1:59:17] We had, and it's a very imperfect analogy and model, but with death master file data, you have currently existing matching capabilities, right? [1:59:29] And you want to build a system because that data is very imperfect, right? [1:59:33] So you build the system so that if there's a match of two or three elements, I think our agreement with them was there are two elements match, that's a flag. [1:59:41] You cannot take action unilaterally on a flag. [1:59:44] The flag has to be adjudicated and resolved, but it's at least a flag. [1:59:48] What you don't want are agencies taking action. [1:59:51] And this is sometimes I think folks act too precipitously if they haven't been working fraud cases. [1:59:57] A flag is just a flag and there are many, many, many false positives, many false positives. [2:00:02] So you, but you want a system and build an environment where the flags are identified very quickly and adjudicated very quickly. [2:00:11] You don't want an, you know, an adverse impact on a claimant, but you don't want to get into a pay and chase situation. [2:00:17] So that, that's how it worked with the death master file data. [2:00:20] It's, it has to, it can't just be one, you know, a misspelling on, you know, you didn't put the S on the end of my, my last name. [2:00:27] Um, it's got to match two elements. [2:00:30] Then you adjudicate. [2:00:31] I think you make my point very eloquently. [2:00:35] And this is the point that whether you're going on veterans benefits, whether you're taking out an SBA loan, whether you're going in social security. [2:00:44] The, with the mistake that the, if it's not vetted properly up front over long term becomes a huge issue. [2:00:53] Auditor Ball. [2:00:55] Uh, absolutely. [2:00:57] There needs to be a thorough and accurate vetting process. [2:01:01] I don't know that it means that you have 15 minutes with each person who reaches out to you because a lot of times what we find is it is a red flag. [2:01:08] It's a notification. [2:01:09] It's an alert that then gets ignored. [2:01:11] Um, when we start to dig into our systems, a lot of times we actually know someone has passed away. [2:01:16] They're a deceased person because it says it in their file, but it also says that they're eligible. [2:01:21] So I think a lot of it really does boil about down to making sure that you're acting on red flags. [2:01:27] There's a good system in place for what you're supposed to do when there is a red flag. [2:01:30] Um, it really is having those controls and then following through on those controls. [2:01:34] Is there a timeframe associated with that? [2:01:37] Is there a limitation associated with that? [2:01:40] Is there a one red flag does not indicate something, but it might indicate that question and you keep going. [2:01:48] I mean, certainly someone who is committing fraud has multiple failures across questions and challenges that would be asked. [2:01:58] Right. [2:01:59] Sometimes that's the case where there are multiple red flags and sometimes they're not acted upon. [2:02:03] So I think you need to have very, very clear guidelines and controls to ensure that you're treating those things seriously [2:02:09] and you're doing the things in the timeframe that you're supposed to do them. [2:02:13] Do we need to help with that and say these need to be cleared? [2:02:18] Hmm. [2:02:19] That's a good question. [2:02:20] I, I think the work that we've done is starting to highlight the breakdowns and it's going to be good to see in the next year and the year after that. [2:02:29] Okay. [2:02:30] We've highlighted the problems at the state level. [2:02:32] Are they fixing them? [2:02:33] Um, I, I don't know that it needs to be spelled out at a greater level at the federal level. [2:02:38] In some instances, it may. [2:02:39] Um, sometimes it just needs to be the oversight on the front end to just make sure they're actually doing it. [2:02:44] Yeah, because I can, I can envision circumstances where multiple failures were recognized and someone gave up on it thinking maybe they had pushed too hard. [2:02:54] Uh, we generally expect someone when challenged to go, whoops, I got caught. [2:02:58] I don't think that happens. [2:03:00] I think that there's a continuation of this. [2:03:03] Mr. Olathe. [2:03:04] Yeah, I think what the auditor is saying is exactly correct. [2:03:07] There is, um, obviously a belief in federalism. [2:03:10] I think among this crowd allow the states to figure out what would make the most sense in terms of a lot of the controls. [2:03:16] And then potentially what could happen is that you and your colleagues at a baseline. [2:03:20] And I'll give you an example, uh, in Mississippi, treasure, David McCray, he was able to figure out an issue regarding citizenship for unclaimed property. [2:03:28] Unclaimed property is a financial asset that you can give back to the people if they've lost it. [2:03:32] A lot of treasurers have that authority. [2:03:34] So he was able to put in some guardrails to effectively make sure that there, there wasn't a lot of fraud, uh, based on citizenship. [2:03:40] So he was able to do that. [2:03:42] Now you couple that with a lot of the new technologies that we've been discussing, it becomes iterative. [2:03:47] So then when you have continued types of fraud, if it's verification or eligibility. [2:03:52] Now, because of technology, you can actually batch different queries where if the red flag, as you were mentioning, is a set of issues that regards to paperwork, [2:04:01] you're able to answer those in a lot different way if it is a couple of red flags that are results to very clear out and outright fraud. [2:04:08] So based on what Auditor Ball and her colleagues are able to do within their states, [2:04:12] then again, working in a congenial relationship with the federal government, the necessary partners, [2:04:17] you can figure out a lot of that stuff without having, without having to mandate it. [2:04:20] Some things obviously though, it needs to be a clear, compelling mechanism. [2:04:24] Uh, but I think that's where the conversation can go back and forth to figure out what that ought to be. [2:04:28] And we ought to drive that to a conversation of common sense. [2:04:32] Mr. Bagdoyan. [2:04:33] Yes, thank you, Mr. Chairman. [2:04:36] I would agree with, uh, all the comments that we just heard. [2:04:40] Uh, data analytics is at the heart of this. [2:04:43] You have to look for those red flags. [2:04:45] And as I kept saying, uh, throughout my, my presence here today, you have to act on the results. [2:04:52] Uh, back in December of last year, uh, we issued an interim report on our review of the Affordable Care Act, the federal, um, exchange. [2:05:03] We flagged the most egregious flag was a single social security number that had 127, uh, ACA policies associated with it. [2:05:14] And when we presented that example to CMS for an explanation, they told us that they didn't perform that sort of, uh, analytics. [2:05:23] They were surprised by the result, but they weren't planning on doing anything about it because they were concerned about kicking the wrong person off that policy. [2:05:34] So, you know, that is a pretty significant example of a massive red flag that, at least for now, that particular agency is not going to take any action on. [2:05:47] You have to act on those red flags. [2:05:51] You can't say, oh, it's a red flag. [2:05:53] Well, okay. [2:05:54] But, you know, we're, we're good with it. [2:05:56] And that's the temperament that has to change. [2:06:00] I know you're right because I, early in my career, had an opportunity to have people who, uh, collected money, offered service. [2:06:14] Uh, and if you did not give them the available answers, they quit vetting things. [2:06:21] It's no different than a police officer that arrests a criminal and the judge lets them out by the time the nighttime shift is done and they see them back on the street. [2:06:32] There have to be ways that are common sense, cost effective, reasonable to where people can understand the system and the outcomes. [2:06:45] But it does mean that I and this subcommittee have to do our job. [2:06:50] And I found out yesterday, Mr. Westbrooks, I did not have a chance to meet with you yesterday, but I did the other three witnesses that are today. [2:06:59] I found out that they have placed a great deal of confidence that we can make progress and work together. [2:07:06] I asked Mr. Olathe a question yesterday and again this morning about the follow up, about how we're going to come and actually engage on this issue properly. [2:07:18] And certainly we recognize the vice president is engaging walking in, in this, uh, shadow also of making sure that what we do is bipartisan, is not political, is driven by, uh, data that can be sustained. [2:07:38] Uh, and this is where we're moving. [2:07:40] So I want to thank each of you for taking time, not just to get on a flight and come here, but to, to take your very important time away from the duties that you have that helped save this country. [2:07:53] Uh, the embarrassment of systems that, that are frail or do not work properly. [2:07:58] I look forward to touching base with each of you, uh, on, on, on future activities and how we can best work together.
