'All about VP Duterte impeachment trial': Drilon on Senate majority push for online voting — ANC

[0:00] all right joining us this morning to give uh some clarity uh on what happened last night [0:06] from an observer's point of view is former senate president franklin drillon uh senate [0:12] president drillon i'm still calling you senate president all right first of all did the minority [0:19] have to walk out couldn't they have debated or argued uh their points on why uh there should be [0:28] no amendment to the senate rules what's the walk out necessary and frankly speaking was that the [0:36] right behavior in the middle of a debate yes the walk out was necessary because that was the only [0:44] way to prevent the tyranny of the majority when the minority black walked out there was no more [0:51] quorum and therefore the proceedings or the session could not proceed now but having said that [0:59] really this is a a a brute show of um of of of the tyranny of the majority and it had to be [1:08] adopted quickly you know if uh yesterday morning there was news of uh the ombudsman intending to [1:17] file charges against uh jingo estrada uh and uh if it is plunder and uh uh probable probable cause [1:29] is found by the sandigan to one of the issuance of a one of the veracity is not available uh mr [1:36] senator bateau is out of circulation and could not vote so that's already two uh and then you have fourth [1:44] uh and then there are there is news that uh the villanueva will be charged in the next two weeks [1:52] and uh of course there is still a name the icc on senator bongo on on bongo so all of this [2:03] would indicate that the majority would lose its majority for purposes of voting on crucial issues [2:12] maybe the minority would still have would still have no 13 votes to reorganize but in terms of the issues [2:22] being voted upon then the present majority would not have the numbers to carry out the uh the uh measure [2:32] any motion on the floor specific example if during the impeachment trial uh the uh minority now will move [2:42] that a subpoena be issued uh to amlc or to the banks the presiding officer assuming still uh senate [2:53] president cayetano will deny the motion and therefore the subpoena will not be issued uh uh per the [3:03] ruling of the presiding officer the ruling can be appealed to the floor so it is very crucial now that [3:11] electronic voting be allowed because personal presence could not be possible and master the [3:18] necessary vote to sustain the denial of the uh subpoena on the bank records so this is all connected [3:27] to the uh to the uh impeachment trial okay uh i will repeat yung ilang senador dahilan po sa [4:38] waranto bares ng sandigan or dahilan po nagtatago or dahilan po implementation [4:45] ng icc warrant for whatever reason kung wala pong labing tatlo na senate okay so let's talk about first the rules itself one by one has it always [6:22] been a rule in the senate that when a senator votes he has to be present because their argument is [6:30] to be [6:44] present to vote yeah it is uh tama po yan noong covid pinaya agad po yan o kung mayroong palawang [6:54] covid siguro naman mag-object ang minority na dapat mag-electronic voting ngunit yun pong [7:01] covid ay extraordinary circumstance wala na mo po ang covid araw-araw ngunit ang [7:08] rational at ang ang ang ang rason sa senado ang sinasabi dapat present otherwise karen [7:17] there can be a lot of consequences halimbawa po eh lahat po ka senador na sa nabas maliban lamang [7:23] sa pangulo ng senado ibig sabihin pwede magsesyon ng senado ang katapat ng [7:29] senate president puro laptop at magkakaroon ng debate okay and balikan natin ang kasaysayan no para [7:38] patas si senator lila delima po nung siya ay nakulong she was detained for six years pinayagan po ba [7:48] siya ng senado noon na bumoto kahit siya ay nakakulong kahit po anong klaseng voto hindi siya pinayagan [7:57] siya pinayagan na mag-participate sa committee hearing so isa yun diba isa yun [8:06] just before we lose that point eh kung hindi po kinonsider kung talagang makukulong ang [8:15] or masampahan ng kaso let's say si jingo estrada let's say si joel velenueva nasa custodian po nasa [8:23] custodian ng custodian ng custodian sila nung sandigan kailangan po ang permiso ng [8:32] custodian para po makaparticipate sila at bumoto so this is dapat po naman pag-isipan yan na po ba siyang bumoto kasi senator po siya noon hindi rin pinayagan okay former [9:21] senate president one po si enrile nung naglabas ang sandigan bayan ng warrant di ba siya po ay [9:27] voluntarily he surrendered nung wala po siya sa senado noon so was he allowed to vote no i don't recall [9:35] an opportunity but uh certainly he was because uh uh ponzi and really is a stickler to the rules [9:43] kung ano po yung reglamento yan po ang susundin niya hindi po niya wala po sa kanya yung tyranny of the [9:51] majority in the senate talagang sumusunod siya sa tradisyon ng senado so kaya ang gusto ng mayoria [9:59] which was uh the proposal of senator rodante marcoleta was to amend that particular rule ngayon [10:07] no may 11 they uh he's already brought to the floor that proposal and it was supposedly referred [10:14] to the committee on rules so yun yung una eto gusto ko uh senator maintindihan ng lahat ng pilipinong [10:21] nanonood so yun yung una ang sinasabi ngayon is ng mayoria is to take up that motion on the floor [10:30] hindi yun bagong motion sinasabi ng mayoria nag start na ang proseso hindi pa nga nagko-convene na [10:40] ang committee on rules okay ipaliwanag niyo uh uh senator drilon is it a point of view okay [10:51] ang isang legislatura ha ang legislature uh senado including works on the basis of committees [11:01] ibig sabihin kung ano man ang trabaho sa senado bago po dalhin sa plenaryo yan po ay [11:08] nire-refermo na sa committee para pag-usapan at pangalawa pag napos ng trabaho ng committee [11:14] yun po ay gagawa ng report para po kapalakayin sa plenaryo halimbawa po yung issue [11:22] ng flood anomalies hindi po may labas-labas yung report ng blue ribbon taylan sa kulang ang [11:32] piruma ng mga senador la miembro ng blue ribbon at ganoon din dito dito worst karen [11:44] ang membership sa committee on rules all vacant dahilan sa nina-organize ang senado there was the [11:52] motion to declare all positions vacant including the committees eh so sa ngayon wala pong na-organize [12:00] the committee on rules ngunit ganoon po man talagang in abuse of its discretion inabuso po ang [12:07] kapangyarihan ay ipinilit po na ilabas ang report kahit po hindi na buo yung committee on rules ito [12:15] po'y baliwanag sa akin na pag-aabuso sa discretion at dapat po makialam ang court suprema daylan po sa [12:25] pag-aabuso ng kanilang kapangyarihan bilang na sa majority okay now they are supposed to adjourn on [12:34] monday they are supposed to resume they've already adjourned so ibig sabihin kagabi yung panukala yung [12:42] hiningi ni senate president alan kayatano to divide the house was essentially hindi po yung natuloy nag walk out [12:50] ang minority at ang nangyari na adjourn right na adjourn for monday at 5 pm so magkita kita po sila [12:59] muli pag nag resume pag nag resume ng monday ng 5 8 pm do they still need to go to the supreme court [13:09] or okay karen kung sa pag alam ko mayroon pang session na mayang hapon merkeles tayo ngayon eh so [13:17] mga mayang hapon mayroon pang session kaya pinipilit nila na maaksyonan ngayon dahilan sa [13:24] majority sila so it is up to the minority to employ today senator kasi it's a holiday it's a holiday [13:33] i forgot yes it's all right it's a holiday because i watched the whole debate and at the end the [13:39] presiding officer senator lauren legarda she banged the gavel and said we resume on monday okay i i take [13:47] that back okay it's all right it's okay ano mayayari sa lunes ipipresenta ulit na ang majority [13:55] ang proposed amendment at ipipilit na pagbabutohan sa lunes bago po mag mag mag mag recess [14:06] at yan po nasa nasa minority yan how to prevent a vote uh employing parliamentary procedures and [14:15] techniques in order to prevent a vote and ultimately if they if they are if they do not succeed bring it to [14:24] the supreme court uh we assume that the vote will be to approve the proposed
