media tampa city council to order clerk please call the roll miranda minnescago her tech here young here vera carlson clinton here we have physical quorum thank you we had set a time certain for item number 65 so we're going to deal with that at this point and if you'll look to the podium you will see our very capable attorney mr kenneth tinkler who represented the legal interest of the charter review committee and this and we have asked him as command performance to appear and have the discussion about the recommendations from the planning commission that we accepted as well as tampa city council suggestions and he has a powerpoint presentation sir would you start with your name absolutely good afternoon ken tinkler with carlton fields pleasure to see all of you again uh as you may remember uh back in december you the city engaged my firm to perform two distinctive scopes of legal services the first was to provide outside legal counsel to the charter review advisory commission that work concluded back on september 14th when we transmitted the crc's final report to the city at that time the second phase of work began which is limited to providing the city council advice on charter amendment issues including drafting an ordinance containing the charter amendments that you wish to proceed with proposed ballot language and summary i want to be clear we're not a substitute for the city attorney or the city council attorney they all handle all the routine responsibilities when it comes to processing the ordinance through your normal approval process including providing legal notice working with the supervisor elections and any subsequent proceedings what i've provided to you is both in first in memo form an outline of uh what i'd like to go through here today uh if uh the tv folks can get the powerpoint on the screen for me there we go perfect uh what i also did is convert it to a powerpoint to make it easy i know there's concerns about tech size with this group so i wanted to be as clear as i possibly could i'm sorry you don't look like mr rojero so i think we're okay right i wanted to make sure that was easy for you uh what i'll do first let me make sure this is working for me there we go uh last week at your workshop you walked through the charter review advisory commission's recommendations you indicated which ones you wanted to go forward with i want to go through those quickly just to make sure uh we're on the same page when you give me your final direction as to what should be in the final ordinance that's the first section here the second section you had some questions for me that came up during the workshop i'll address each of those as we go through the items and after that well the last section will be a new language for you based upon the materials that were provided to me after your workshop as to additional items you wanted to have on the ballot uh including a rewrite of the inspector general provision so so mr tinkler in the interest of the presentation if there's areas that you need to pause to get input if you would do that if there seems to be natural areas that you feel like maybe council wants to ask a question if you could if you could anticipate that as well other than that what i'll try to do is ask council to hold questions till we get to a strategic point so we're not you know interrupting your flow absolutely no i appreciate that and then the first items uh hopefully i heard you correctly and we'll be very quick and then we'll get into the more detailed uh discussion uh first item that you wanted to continue with uh from the the charter review commission report regarded section 2.03 it was simply an amendment to the language as adding may deem expedient and necessary and to replace the word compel with require any questions on this one right section 2.08 uh it was simply an amendment uh to uh at present have a process when you have to read the title of an ordinance on two days uh the charter review commission recommended simply in addition regarding the pursuant to the requirements of general law should there be an option to not have a second reading that's allowed under general law any questions on this one marty is there a way of getting the powerpoint on this screen or this does not work over here i don't i don't think it does i think it does anymore okay yeah just want to make sure so you don't they're just trying to be training here all right uh regarding the term uh this was simply to clarify simply the idea of officers is used various times within the charter uh the charter review commission recommended uh changing this to the mayor and city council members as well as deleting uh language related to 1979 uh there were you'll see a few of those that weren't picked up the last charter review board that they're recommending clean that up today before i move forward any questions on that one 6.06 this is another cleanup one uh getting rid of the 1975 language uh regarding the officers of the city making it also clear that a majority here is for at least four votes and it could be done either by resolution ordinance any questions on this one put a pin on that one for future future discussion understood uh regarding this on millage uh the charter review commission recommended making it consistent with state law in accordance obviously it would have to be anyway but they wanted to make that clear that the since the millage provisions are very spelled out in general law to be able to cite that any questions on 7.05 9.02 uh charter review commission found out there is no zoning adjustment board so they wanted to strike this provision that put your chief building inspector on a non-existent board so any questions on 9.02 that's just both well just so you for background the commission went through every section of the charter so if there were edits that's how they got to you i was kidding understand uh regarding 11.03 again this is a cleanup to remove the 1975 language any questions you didn't all right councilman hertech said said you can't kid with a lawyer i'm happy to laugh a lot about this later all right you had a few questions for me uh things items you flagged that you wanted to further explanation where they came from what we were talking about the first one was the oath uh this was an item that was previously passed by the city council uh back in 2018 intended to go on the ballot uh as indicated in a memo you received from the city attorney this did not make the ballot what the charter review commission did was simply forward you all of the items that previously a charter review board gave you uh they didn't get this is no editing from them it's simply to reflect what was already passed by ordinance uh this is also to make it consistent with the fact that you'd already removed the residency residency requirements so now you were requiring an oath where you didn't have a requirement uh i believe the city attorney also issued another memo today regarding this topic any questions on 6.05 okay then in terms of direction i want to make sure that i'm clear that your direction is to proceed with including this in the draft ordinance i i think what we'll assume without any further direction that we're going to accept your language but i'll let's withhold that final answer until we're completed in case there's some buyers remorse or or something circles back around um like that 6.06 you know discussion absolutely no that's fine i just want to make sure we build up a record here that's clear uh when we go to the draft ordinance stage okay hold on say go ahead i'm unclear so we're coming back to this no i'm saying i think i think as he moves through each one of these i think without any input or discussion i think the assumption is the council will accept what has been presented but i said i don't want to i don't want to necessarily say that we're voting on this at this point and directing them to move forward until we actually go to the end in case we have to circle back to something what i would anticipate is if you have an issue with this now speak now well and that's so i'm looking at yesterday's memo from mr steady and it brings into it brings in the ordinance that we that we put on the ballot in 2024 uh that shall revisiting officers of the city who conduct the government apply only to elected officers and so they approved that so i i think um the word officer from my understanding is a member of an elected position is that not correct i think that that was our that was our issue with this one well let me let me give you some further background as to this piece when you put the council put forward the removal of the oath uh the online records reflected this was already gone uh up until this was discovered during the charter review commission process municode online included that so the language that was proposed to the voters and already assumed this piece had already been removed previously okay so that's that is why it's coming forward to you in the same manner because for many years anyone looking up the chart of the city of tampa would have seen this language stricken so we're trying to be backwards compatible yes but again my question is still with the word officer and not because the confusion is officer versus elected now we because we all agree that elected has to be resident of the city but i'm not sure that officer is in there so what we're saying is every every city employee has to subscribe to an oath i didn't know that that was a thing yeah the best way i can point out the officers are defined in 6.01 which includes the mayor city council city clerk city attorney director of finance and goes on and on that's that's where this provision sits so do those folks have to swear an oath the city clerk right there is a an oath of office today in the charter okay just making sure just making sure i just my only thing is i would i would like to it there to be a defining definition or a difference the resident of the city should be an elected but i guess if we take it out it doesn't it does it's it's neither harm nor foul it's correct this is purely to reflect the prior council's intent just talking through it thank you this is okay with me absolutely okay very good happy to uh next next one uh re-employment uh this was solely a cleanup item uh getting rid of the 1976 uh provision uh there are various requirements uh post service on council related to lobbying uh that the legislature has done a lot of that this is very tampa specific about the idea that you would not move into a city paid position uh for at least a year down the road absolutely councilman carlson do you have any emotional connection to 1976 and removing this language i'm sorry council council miranda that's the second time today council council miranda do you have any emotional connection to 1976 that you go very good okay go ahead we had a lot of cleanup uh focus uh with this commission and that was mr tinkler saying chair shut the blank up so we can get through this yeah no all good uh section 10.07 this is another item that was also placed on the uh in the ordinance that was intended to reach the ballot uh in 2018 this is actually what led to uh us finding out that the they did not reach the ballot one of the charter review commission members had asked for the ordinance that is set forth in the blue text basically in implementing ordinance on how you do an initiative and referendum and we found out there was not one uh so that's what started the ball rolling in terms of this analysis so it's simply again to put back the language that was intended to be put on the ballot previously council mccarlson just going back to the residency one i was looking for the ballot language um and i finally found it it says this is what was on the ballot shall the amendment to section 6.01 of the tampa charter revising the residency requirements for the officers of the city who conduct this government to apply only to elected officials as set out and proposed by city of tampa ordinance number blah blah blah be ratified and my point which i brought up to the city attorney at the time is this is misleading and i i know nothing's going to happen because of it but it i think it was intentionally written to be misleading because what it looks like is that we're reaffirming that the elected officials have to be a resident of the city when what we actually were doing is removing the residency requirement for the for the um the non-elected uh leaders of the city had it been written that way it would be a valid um uh way to find out what the public thought but the way it was written here i think it's completely invalid because it was written in in in a way to mislead the public point point made go ahead all right move forward any questions then on 10.07 now we're getting into the proposed language based upon your workshop last week and what i was provided the first one is staff forgive me on the the slides on this one there wasn't a good way to break it down i wanted to show you where this edit is being placed at the end of section 2.04 you're indicated a desire to have additional support staff whether it be for the city council attorney or otherwise within the city council administrative function we added language to provide for including additional support staff for and broadened it from legislative to any city council function uh and put that the funds have to be allocated within the city council's budget this actually was language from the charter review commission that was concerned the word found uh indicated something less than an allocation uh and it did remove the provision that the mayor had to approve that based on the what i heard from your workshop any questions on this provision thank you councilman or check for that language all right moving on this is a new section uh to be proposed uh section 2.15 you indicated the desire to have an override provision uh regarding the mayor's executive orders executive orders are a defined item in section 4.01 when they an order is issued it is provided to the clerk there's a process that's already defined so given there's already a process we've hooked it to that process and we use the term rendered void uh override it doesn't have the best legal connotation so we wanted to find a term there uh that hopefully matches up to the intent that you had we did provide an affirmative vote of no less than five members of the council and that you would act by resolution we also to prevent a vicious circle uh of executive orders being readopted we included a provision that they cannot be readopted without a majority vote of the council uh basically a consent uh during the term of office any questions on 2.15 i want to make sure we still have how you're looking to do i particularly like the last sentence thank you so much for um you know anticipating that i'm welcome councilman carlson first yeah i just want to say i'm i'm against this as it's written right now if there was some test to to say that it was that the executive order was in some way um against the charter a violation of charter usurping the power of city council then i would be in favor of it um and and and i in this particular case i don't i i wouldn't support this by the way i was disappointed last week after we last week or week before after we talked the mayor's quote um uh which by the way i hope did not come from city staff since it was political um it uh it said that she was disappointed that we were um trying to do a power grab it's actually been the opposite in the last 15 years by using terms like strong mayor the last two mayors have taken power away from city council and all we've tried to do is put it back and we i can't tell you how many fights we've had over the last seven years and as an activist i helped the prior council fight back but they're it's not it's not a power grab when you're trying to re-establish the charter and the powers that are granted to city council and the charter when mayors usurp that power i think city council has every right to go back and do it and the problem is that because this the mayor controls the legal department and the staff and resources purchasing um they control the tools to try to remedy anything and there's also no provision for us to to have a conflict or deal with a conflict that all this really does is it enables us to to to uh or future city council to um to undo an executive order but a mayor can just if a mayor like the last two is intent on usurping the power of city council they'll just find other ways to do it councilman beer thank you my question to folks is just out of curiosity what are we trying to do with this is there something in particular that we're trying to remedy it is it just a principal issue i i want to inquire on the rationale for this just out of curiosity okay so and one thing if i may i'm sorry mr chair has there been something that an executive order done by this mayor or prior mayor that that's my curiosity i i'm not opposed to charter i think the issue and you know i had this conversation with the mayor as well and the issue is if council has an actual resolution and then the mayor has an uh executive order and they conflict again we that maybe mr shelby would you like to address that a little bit well if if he wants a if he wants a uh a when this happened the the police review commission sure is is the solid one and so we want to prevent something like that from happening again and again because it took all the teeth out of what a council wanted to do and remember five votes and you all know how it's very difficult to get five votes yeah unless unless it's unless something's very very clear council miranda thank you sir and i understand the conversation for the time that that that this has ever been challenged was way back in the mid 70s now i had left here in 79 and i didn't come back to sometime in the early 90s and uh what i'm saying is it was a vote about the firefighters that mayor poe had uh not worked out an agreement with the firefighters and he wrote an executive order not giving them a pay raise if i remember and they called us this fabulous five or the fair amount five or whatever they want to call us in a full page ad that was running the newspaper and they named the five council members who overrode the mayor on this same five vote difference that is needed it's very difficult to get five votes yes very it's not easy the only time i remember it was in the 1975 or 76 when it happened and that's the only time i remember in my 32 years here on and off now some days it's difficult to get four votes and thank you for that yeah okay any other discussion on this councilman carlson yeah the the the example that um council member her tech mentioned is the biggest one that i remember and the the problem is there's no conflict resolution process that was one of the questions that we put to the charter review commission and i guess they decided not to do anything about it but the the problem is what happens if city council and the and the and the mayor disagree by the way someone who's really a strong mayor doesn't worry about the powers of a legislative body because they understand collaboration it's a weak mayor who's worried about somebody taking their power because power is not given by a title or even by a charter it's by negotiating and collaborating but in the in this case in that case what happened was that they ultimately went to gwen young who was the former florida bar president and asked her opinion the problem was that and she's a great person not questioning her at all but she was hired by the city attorney who reports to the mayor and so how do we have an objective body or we we we can't without the city council has no ability to file lawsuits so we can't go to court we can't get a judge to rule we have no arbitration process there's no way to handle a dispute between the mayor and city council and in that case as an activist back then i thought the administration was completely wrong um and and then another case since i've been on council was the idea of naming buildings and structures um the mayor was going to put this mayor was going to put forward an executive order and i made the argument and i think most people agreed that there was nothing in the charter that gave the mayor the right to name buildings and the city representative the city attorney argued with us at that time i went to my own attorneys and asked them and and yeah it was not in the charter and but from a city council versus mayor point of view how did we resolve that finally we resolved it through discussion and the mayor created an executive order and we codified it through an ordinance so it was resolved um except for one part of it which was to prohibit things from being named under people who committed civil rights violations um but the uh the rest of it was and and the point is that we we need a we need a um a process for conflict resolution somewhere it's it's funny i think councilman carlson when you go back and listen to your remarks you'll find you almost make the case for this when you go back and listen to what you what you said because i i think part of it is at least in my opinion i'm more of an analytical guy and it's not about personality and feelings it's about issues and the issues rise and fall some you know you win some you lose some we know and you move on if if there's a an executive order one person makes an executive order and and then five people feel so you know feel like it is so wrong that you can pull pull together five votes to override that executive order that's just that's just policy and government that's governance it's you know same thing that happens between all different types of governments across our country so it seems like this this is just a process and really it takes the personality out of it because okay you know what i understand that you you thought this was a good idea but five of us got together and said it wasn't a good idea let's move on can i mention one more example you haven't exhausted it yet there's i can give a million examples let's go quick but one of them since we honored frank reddick this morning one of them was when the tampa times did their series on what was called biking while black uh frank reddick who i think was chair at the time said on a tuesday or wednesday i am going to propose to city council that we ask the justice department for a civil rights investigation thursday morning at 8 a.m an hour before city council was able to meet the the then mayor and chief and chief of police held a press conference to say they had invited the department of justice to come in and do a cops investigation which is a process analysis not a civil rights investigation they confused the public by going in a different direction and i don't remember what frank did at that point but i think what they did is that they intentionally obfuscated and and took the community in a different direction at that point when that when the times wrote that series we needed to figure out a way to analyze what happened and figure out what mistakes might have been made and then fix it and bring the community together instead it caused all kinds of divisiveness over several months and so that's an example where it wasn't an executive order but the the the mayor and and then the police chief at the time who's now the mayor today um decided uh to not act in the interest of the public but act in the interest of um themselves by protecting themselves from the things that they had done in ordering the police to to enact that program i'm going to still suggest that you go back and watch this again you're going to find out you're going to make our own arguments my point is it's not just about executive orders in that case they held a press conference they invited i understand i understand okay since we've had discussion on this i'm going to say um all those in favor of accepting this language signify by saying aye aye opposed okay clerk would you call that for us so just for the record motion passes with carlson rodino thank you mr tinkler move on thank you the next provision is uh in both section 4.01 existing language and then a new section 4.03 you had indicated that you wanted to include a provision that someone could not serve two terms as mayor and then later return to serve another two terms you also indicated you did not want this effective until the adoption of this language did not affect anyone who may be running for office uh we couldn't find a clean way of inserting it within the overall 4.01 and this is just a snapshot as you can see of a very longer section that won't that would fill up the entire powerpoint uh so we carved it out to a separate section uh to lay it out that if a person has uh served as mayor acted as mayor for more than a total of six years that mirrors the language in the term limits provision in florida that should be it should be eight years we have two four-year terms i understand but then the two the idea is to pick up a partial term uh so that is why six years is indicated that if someone was elected to a partial term of more than two years that they would then also be subject to this this is how the florida constitution deals with this provision and also the hillsborough county charter uh uses similar language i'll defer to councilman carlson because this was if i could just conclude on this piece i'm sorry yeah no problem sorry uh on the time served as mayor that's the last sentence here to prevent this from applying to anyone who has been mayor in the past this would be a going forward uh provision okay councilman carlson and councilman vera yeah i i i hope that the that this mayor and her uh packs like they did last time will run an ad that says this is a devious plot by council to give um give mayors an additional six years um but um this that's what they did against the uh charter provision to the limited city council because it started when it was approved which is what things usually do um i think this is okay the way it is um i believe in turnover um which is why i'm not running for city council again i think it's i think it's okay that people do that but i just i believe in in in giving other people a chance in this case with the mayor which happens to have a lot of power um i think that the way the charter is written there's a balance of power between city council and the mayor's office uh but we've we've we've seen that um that we need a change um every eight years thank you councilman bureau uh thank you very much so i you know last time we were talking about this i had these thoughts and i'll express them now which is i have two concerns about this which is number one in general i actually support a strong term limit for mayor however um there's two concerns that have one is uniquely tailored to the forthcoming election which is this could be relevant as an argument in the forthcoming election i'll leave it at that right another issue is with regards to city council is city council passed charter amendment last time uh for term limits for us that allowed us for eight 16 years to bounce from seat to seat so this is and by the way i have nothing against that people want to do that don't hate the player hate the game i don't care but but my point is this actually makes the executive have more restrictions than we gave ourselves so that's i actually do support some level of stronger term limits for mayor i do i do um but i think it's the wrong year and then it actually again is more restrictive than what city council what we gave ourselves that's my challenge with i put that out there anybody else me councilwoman her take so then okay i see for a more than total of six years okay i i think that that makes sense so basically you're saying if someone serves a partial term they can't serve a a third term right a partial term of more than two years would be considered a full and i actually think that's right and i kind of think that council should be the same way but that's you know i guess not yeah um and i understand um councilman viera how you feel about that but i also feel mayor has a lot more power and so i think that uh you know a council member only has a seventh of the power of this body whereas a mayor is is wildly different so i do support this i think this is good language councilman miranda i saw you looking like you're i'm looking at it and and you know i i see both sides of this thing but for you can serve then five years 320 days and run right or wrong absolutely thank you very much yeah where the where the line you wish to draw is up to i understand there's a line that i'd be drawn somewhere but it doesn't fulfill the eight years correct the language can be you that we can make it two terms uh there was an indication to cover acting mayor or something i'm not i understand the point councilman carlson you wish to speak again yeah just just to the point that um two points that councilmember viera made one is the the the counts the two council positions versus the mayor i think those are two different positions a district position is different than a city-wide position um because there's different responsibilities and so i i i i would say that those are two two different positions but the other thing is from a political point of view i don't know of anybody who will have the money or interest in using this as a wedge um in in a campaign um if they're speaking about this they're losing yeah because because the the candidate you would be talking about has enough issues without this to be to discuss yeah i i i'll i agree with what councilman carlson just said about the council council positions generally i'm not a big fan of term limits by the way because i think you see what the mess that's created in tallahassee that being said the appetite in tampa is there so i'm not going to speak against the will of the people i do think that there's a difference and we do have term limits on for us i can each person can only serve two terms in the in their position and then they switch and then y'all made a charter amendment capping that at two and two right so you you can hold each position twice right nope you can you can stay out for four years and pop right back in okay well that's interesting well you don't have to worry about me i i'm going to run for one more term which will serve my two terms and i'm done so yeah take that you can put i will write that in stone for all of you you can find me on the beach in spain so uh very good uh should we let's let's do that i can set this discussion let's have a vote on this one what's that unless you don't really feel the need for a second you just want to do it by just put it out there i was because i was going to do a general vote at the end based on accepting everything we did but we do is there a motion to accept this yeah okay one thing that council member vieras said that that part of 403 could be used in this election no as a political thing talking about it it can't be used that's why it should be recruited until after the election so i'll make it fair so marty just so you understand like in what my position was we were going to basically reach agreement or not agreement and then not have a definitive vote on each one of these for the record until the ends in case we have to go back and revisit something we don't have to reopen it and do all of that so we'd have one vote at the end accepting all of our recommendations okay so all those in favor of this language signify by saying aye aye opposed nay a 403 name okay what's this it's it's it's four to uh five to two with councilman vieira and councilman miranda uh opposed it's not an official motion but it's for the record but you could say like the uh the cons um uh intent of council or something like that okay we'll have the official vote at the end accepting the resolution which ones were accepted which ones were not okay go ahead understood this next section amendment to 6.03 this is to change the power of removal of officers that's presently vested exclusively in the mayor to provide that the council may have removed an officer appointed under the section following we did include for due process stake the granting the mayor and the officer's opportunity to be heard at a public meeting and then an affirmative vote of no fewer than five members of council we also had a again to prevent a circle uh included a provision that an officer removed cannot be granted an interim appointment and nor remain an employee of the city well this is one i know that has probably some of the most energy and i know i spoke with the mayor and of course the mayor feels strongly against this and other folks that i've spoken to so and i know councilman miranda you had expressed strong opinions so i'm going to let you speak on this first my feeling is this who are we going to get to serve in this city of tampa the position of director of whatever that pointed anything else that you must follow something because with five votes any one of the clean five votes of the council you're going to get the best to come work in the city of tampa do that at your law firm the answer is no and tell my any big law firm has got maybe 100 200 500 thousand two thousand three thousand you take this to the best and best and brightest they're going to go somewhere else then i've got the same logic i'm going to tell a general that with five votes of five sergeants you're out of the generalship you're not a general no more than you have to vote i'm just going to simplify it sounds great when you look at it but when you put it to reality and practicality whoever has the brightest or the ones least councilman mascalco i was thinking about this and i remember when we maybe in the time of code it was the previous term uh when we were hiring a cra director and we hired a cra director i think from like the orlando area and the next day you weren't here yet it wasn't in the time of being so the guy well whatever we're at the convention center and uh we hired an individual and that person probably watched us in action refused it the next day so my question is yes it's hard to get five votes but things get political and who would want to take the job meaning who's going to relocate here you know if you want to get the best and the brightest and they're from out of town or you know maybe i'm overthinking it but i think back to that time when that individual said yes and then no so that's it that's where i stand councilwoman well that was the last council and the last council we were a little more um interesting well we didn't we didn't see eye to eye a lot on that particular council so um this council works better together it's it's a little different but my thing about this is all of all this means is that the department heads need to work with each of us as much as they work with the mayor and right now we don't really seem to have a huge problem with that there are a couple but overall it's not something that people have to worry about as long as they're working with everyone and so what i think that does is is just encourage that i don't think at all that um because quite frankly the mayor can fire someone tomorrow i mean whenever you work at a job you have the expectation that that your employer doesn't have to keep you even if it's only one person um so i don't think to me that that argument is not is not an argument that that sways me councilman vera thank you mr chairman and and you know i i always like to talk about my philosophy with the charter there are people that talk about the charter like it's the u.s constitution i don't see it like that james madison didn't write this thing you know this isn't something that some heralded uh arc of the covenant thing for us i said it wasn't brought down by god on a plate mount sinai yeah no by charlton heston down my mount sinai or whatever um i and so again that's so i i'm not opposed to amending the charter i remember last time uh we overrode the mayor i think it wasn't five uh vetoes i voted to to overwrite all five i'm not philosophically the for those that i voted for um i'm not philosophically opposed to this my challenge with this is this um i wouldn't be opposed to some level of accountability for appointees if it was more strictly defined as as like impeachment on the federal level where it's high crimes and misdemeanors there's some something that can be that can be relied upon where a person goes man if they impeach me i got it coming you know what i mean whereas this this is just five people don't like it they can kick you out and again the issue is who's going to come and work for the city and relocate leave a job whether it's with the county or whether it's coming from kentucky or anything of that nature so again what this is coming towards i'm sympathetic to but as written i i think it grants us too much discretion that comes at the expense of somebody's willingness to you know pack up everything and get into the wagon trail or whatever and come to tampa that's my challenge councilman carlson yeah just to reach out i challenge you to complete your entire speech without mentioning one person's name the problem with the the the ultimate thing here is that um why is it that we have so many mayors where there's no chaos and then we have two where suddenly there's chaos at city council it's not created by city council it's created by the mayors usurping the power of city council and then city council has to push back and then because they control the communication department they control the legal department they control the political department they can push and tell everybody in the community that it's city council's fault and then from the text message we have which yes we do have madame mayor come prove to me i'll show you the text messages i'll show you the proof you can send as many emails as you want but those text messages exist that they stir up trouble on city council and they've done that it's illegal and unethical for them to do that they should have been fired i've appealed to the chief of staff multiple times the city attorney the the hr department the mayor herself and she refused to fire people who behave badly if i had if i had an employee who was being investigated for uh uh terrible hr complaints and then we had to pay a huge fine to the to one plaintiff and when there's several more in line i would fire that person why is it if a mayor if a mayor does not have the guts to fire somebody who we had to pay a big fine to a plaintiff a former employee uh because of that situation why is it that city council doesn't have the right to fire the person we should when we get complaints from our cra staff and others that the mayor herself is calling people and and cursing and screaming at them why do we have no recourse in that we can't fire the mayor i would have fired her a long time ago because what she's doing is unacceptable um uh what we what we can do is fire the people that are actually doing whether they're doing it on her orders or somebody else's orders they shouldn't be doing it why is it this morning that we had a situation where we had t-shirts being printed uh florida law says it's illegal to politic why is it that we're having that why is it that that we have text matches and other evidence from south howard where out of out of the thousands of people just in south tampa that were flooded why is it that we have 200 people who are angry calling for investigations and all this stuff because we had two or three people in the mayor's office who were stirring up trouble creating conflict among people whose houses flooded how terrible is that we should have fired those people immediately if i was the mayor and i saw them do it i would have fired them the fact that she doesn't means that she's complicit in it that she wanted it uh come down here and tell us that you didn't order them to stir up problems among people whose houses flooded how terrible is that the city attorney we've had multiple city attorneys one of them in 2018 declared in a two-paragraph memo that city council was not apprised of that that's the mayor the city attorney no longer had to get approval for uh for settlement agreements that was completely illegal completely against the charter we had to spend six months fighting one or two different city attorneys to get that undone and we finally did they that person should have been fired we had a city attorney who decided not to put the charter amendments on the ballot that the city council and the charter charter group how is it that there's no recourse for city council to deal with that how is it that if we if somebody how many employees do we have to have that make complaints they go to hr and then suddenly the mayor's office gets involved and undoes hr and protects people that that are are yelling and screaming and doing other things discriminated against employees what what is our recourse supposed to be how are we supposed to protect the employees of the city if the mayor herself is not willing to protect them how are we supposed to protect the citizens from from uh from city attorneys who openly break the law and misinterpret the law we've got to be able to have some uh teeth in the charter to fight back against that to protect the citizens and to protect the employees of the city think yeah let's do mine too and then i'll hand up to you um a couple of points i hear um what you're i hear both councilman miranda and i actually hear what everybody's saying but i hear i hear the points for council miranda's objection i also see the other side of this where um you know you have a carrot i say the carrot and the stick as as members of tampa city council we one of the expectations citizens have is they call my office to resolve issues they have with the city their trash didn't get picked up something happened you know so how we are able to resolve that issue is i can turn around and call city staff to resolve that if you get into in a situation where city staff refuses to speak to you refuses to call you back you can't do your job and i actually when i first took office experienced that same situation i experienced that situation where i had a director of a department just would not call me back and so that was what first got this in my headset and now i will say that that i no longer enjoy that you know displeasure uh you know i i find that staff has been very responsive to me subsequent to that and that was one particular individual so i see where there is there is definitely a systemic issue that and i know there was a time that was a previous uh mayor now this is anecdotal so maybe somebody will tell me that i'm wrong that actually had an edict out that their senior staff was not allowed to or their staff was not allowed to speak to city council that was supposedly revoked soon afterwards when they found out how chaotic it became but they were actually forbidden by the mayor to speak to city council at some point so i i see that point as well but i'm also very sensitive what councilman vera said and i definitely do see it now in black and white city in front of the screen that i don't necessarily want to say that you know i don't like john bennett i'm gonna get round up five votes to fire john bennett without cause because i think you should always have cause so i would actually maybe challenge mr tinkler to insert language that would you know show some you'd have to show some type of cause of that action so it's not just me disliking somebody personality but there has been a cause i know there was a mayor some years ago which we all know and love that had a problematic employee that ended up going to jail over some things but refused to fire that person that person because they felt they were they had a strong connection to that person they refused to fire that person even that person committed a criminal act so i mean you've got those situations and i think if we had this type of language that had cause in it and that um maybe that would be palatable any thoughts i'm going to go to councilman miranda and then we'll go back for round two thank you chairman i've had the pleasure of working with five mayors they were all different yet they were all the same what do you say different in the same yes different in attitude different personalities different in getting things done however they're all for them so therefore it gave us what we have today a successful study however that being said there was one mayor that knew how to work and understand what was going on that the personality of the individual there's a vast difference in how you present things that mayor would come and talk to every council member and tell them this one thing no matter what you think you need or what you think you have to talk to me about i don't care how small it is or how big it is no matter who's in my office you tell the receptionist that you want to see me and i'm coming out to talk to you and you know who that was dick grickle he never had a problem with one council member that i can know of not one because they could always call him he'd come out no matter who was talking to i don't care if it was the president united states of america he would come out and that's what made him who he was accessible some have personalities some have don't have personality and that's all based on personalities to me it's you know and a time in history one mayor poor thing we had to lay off 750 some people that was pam maori so she was had to play defense on everything she did she did well for the city of tampa by doing that so everyone has to face the military service that you have like a compact zone if you don't have the ammunition you can't win the war and the mayor and the council has got to work together you may have differences if i got to tell the matter go to hell i don't care who it is i go tell them personally i don't wait for anything else but that's over as soon as i do that and that's the way you have to be thank you mr chairman for allowing me that thank you and i and councilman young hasn't spoken yet so we're going to go no so actually what the point that you brought up was actually what i was going to to ask to councilman vieira's point having some kind of it sounds like some kind of like system or scorecard or or like a just reasoning why um you know we would would make this decision so that was actually going to be my question but also understanding um councilman carlson your point of having some kind of recourse for things you know that happening you know i've been on this uh council the shortest amount of time but you know i've had instances where you know you're talking to department heads and it's like ah we're trying to work together we're trying to get things done um so i think that this just has that accountability but also you know we all at the end of the day i think we all want to work together and kind of have this you know camaraderie to get you know move the city forward but i think having a language in there that has like some kind of reasoning it's not like i just don't like that you were no offense um but i think that would be good to have that in i don't like that you're wearing i love your blue tie charlie i promise councilman councilman bureau then councilman carlson thank you mr chairman so so again you know with with issues as discussed where there are conflicts with department heads and so forth it's too subjective um even the threat this is the problem is even five votes is a lot to get but even the threat of four votes or three votes will really scare somebody a lot um potentially unjustly one thing i thought of there is no method for impeachment of i use the word impeachment so whatever um but of city council members i mean why in the world don't we include council members under this as well for whatever standard if we pass it for department heads so what's good for the goose is good for the gander um you know the the we we we have that in in legislative matters and other bodies we have the executive matters and other bodies um i'm just putting that out there um you know if we're throwing so much spotlight and so much scrutiny on department heads which again i'm open to some of that why not look at council members as well i'll have impeachment of the mayor yeah it would be the same thing councilman carlson yeah that's um i agree with council member miranda about and i've had conversations with him about it you know he would say my my phone he said i would pick up the phone call people i tell them to come talk to me um you know and and if you're if you're enlightened and if you have a strong personality you will listen to people who disagree with you and you'll try to work things out if you don't then you force your opinion and that's that's what has causes conflict because um whoever's mayor has to realize that they're not king or queen they this is a is is a is a legislative body none of the seven of us agree with each other much less with the mayor and what somebody's got to do is build consensus among all of it i like the idea of having something like of of cause but the mayor controls the hr department the the legal department and uh and all these other departments they also they also control the um the purchasing department and the and ultimately the funds once they're approved so we can't even do an investigation of somebody without some process this is the the flaw with all this so then it's all going to cut off but by the way the mayor does have the ability to impeach city council members she did it twice and tried to do it three times in the last uh term uh use city resource to get to work against uh city council members i believe illegally but we didn't have any recourse to fight back against that they didn't even want to pay legal fees for the for the city council members to defend themselves i paid 20 something thousand dollars in legal fees and i got reimbursed like five um uh it's it it was a horrible situation that the city the mayor's office was using city resource to attack three city council members and almost four um it it i mean we we should have been had the right to uh if we had the right to impeach the mayor she would have been impeached back then but um but we should have we should have been able to push back especially against the city attorney out of all of the all of the um the uh the appointees the one that the charter clearly says also reports to city council as a city attorney but until scott steady that really hasn't happened and and they're all great people i i i love them all and had long conversations with i think all of them since then but um but whoever's the mayor controls them and pays their bills and tells them what to do and we need to have a balance of power with that if we if we say it's for cause but then you know every complaint i've made the city attorney has said well i can't investigate it and the city council has no power to do anything so what are we supposed to do it doesn't matter if what the city staff are doing is illegal or unethical and then what they do is they use the communication department to fight back and say oh you have conspiracy theories or it's a personality conflict or whatever no um running a political campaign using taxpayer monies is against the law that's clear the last thing i'll say is um uh we don't we dealt with the scarlet lopez case i recommend people read the depositions of the scarlet lopez case if you read that it's absolutely disgusting and i feel badly for the employees of the city that have been subject to that to that kind of um treatment not just in that department but across the board and city council has no power in the charter whatsoever to protect employees in the city and it's terrible that we're not able to do that and when you read the when you read the depositions of the mayor's staff and how they treat it and how they worked again it's horrible um a couple of things one you know in this fy 27 budget we now have money to be able to do legislative investigations associated with our legislative per charter our legislative authority and do we have the right to hire them without going through purchasing yeah we we have we have the right to hire staff to assist our future council the legal the legal staff to be able to help with that um and that's what and we had that money put in so i have that in council and council's budget for fy 27 so that should resolve part of what you just described the simple easiest answer is if if if if if clinton is the chair of city council and he goes to the mayor whoever the mayor is and says hey one of your staff members is doing something illegal the mayor should look into it if they're doing something illegal fire them that's the simple way to handle it but they don't it's it's interesting because honestly i kind of feel like i have that relationship right now with i with it it was a rough start for me when i first started but it's it's it's smoothed out over the last three and a half years and i've had i've had some we've had some i've had contentious meetings i've had some really contentious meetings but i think generally when i've come with with with concerns directly for myself i think they've been addressed i mean an example of that was what we just described about the stuff that was happening um at hannah with the issue on the agenda today i mean that was addressed by our city attorney staff and that that's been that's been killed and won't happen again so i mean that was all through the discussion i guess you've had this i didn't know that because of sunshine we weren't able to talk i guess you've had those discussions as well i've had those discussions i brought those concerns up and it was been it's been resolved by staff um anyway so without spiraling further into discussion here i mean i kind of feel like i heard that if this was for cause if there was something are you are you comfortable taking this language and trying to find that language to insert in this i believe i need more direction as to whether you're looking in other words we know the council would have the ability with five votes to remove with cause if i could i heard two different processes one would be simply to include language regarding cause within the language we have here and the second was more of a trial of impeachment that kind of thing so i want to make sure i'm understanding what the i think that's a bridge too far but may i yeah go ahead thank you um and again i'll be i'll be frank all of the discussion on this has really turned me away from this a lot i'll i'll talk if i may mr chair you talked about your relationship with the mayor with mayor jane castor i voted override five of her vetoes after hurricane milton she and i on some issues we disagreed a lot and we had some heated conversations in case if you all didn't know on fire stations we disagree right on certain things i've we've had a lot of disagreements i've always gotten along with her i think she's an amazing person i do i you know whatever i do i think she is a stellar person um a person of humility and so forth but we've had big disagreements on issues big disagreements when i see the rationale for this i see things that could turn out to spiral out of control okay um for me taking somebody out with cause quote unquote that's too subjective that's way too subjective you have something that's better defined with more scrutiny with more accountability if we're going to remove somebody there's got to be a very detailed process a very detailed process which would include some sort of a hearing um you can't have a city council meeting and get five votes without basically hearing and their language they've inserted that they have due process rights of being able to come and be heard i mean it's i think i think the devil's in the details of what language mr tinkler if he was able to insert into this maybe there's language there that gets you to where you need to be call me a skeptic okay well okay first place is let's let's do it let's do a vote i'm thinking that there's not enough votes to accept it as is without language so if if the attorney was able to insert cause type of language into this and we still have another bite because we don't have to prove what comes back but if there was if the perfect language existed that there was some cause inserted in here would you support this change to six point zero point three all those in favor say aye aye opposed hey yeah at this point can i just want to see it has to come back yeah can we just see what comes back we can see it just 20 10 seconds if i may i'm a very very big skeptic i'm going to vote no i'm open to seeing what comes back by the way if you vote no it's not coming back we have four yes no do we do we have four who's the four well let's let's do a roll call and then but again i'm open but at this point okay so we have so let's let's do that again just just raise your hands if you're in favor of it coming back with language for us to look at it again raise your hand okay so it's it's four it's four to three with councilman miranda maniscalco and vera voting no councilman i haven't really spoken much during this one i really think something about cause but if there's any specificity in other charters that you think might be i mean having listened to this conversation if there if there's some other specificity that you think might be helpful that would be great we'll absolutely look into it okay thank you and you're comfortable with that you're comfortable i i believe i have direction from four of you to pursue other language related to cost okay councilman no i just again because i just want to see what comes back because i now as as i'm listening to you all i really can see both sides for the yay and the nay so my vote was you know simply just to see what comes back to us and then go from there okay thank you okay so we move past 6.0.3 next can i just say one quick no let's please move on you've had a lot to say just it's not going to affect this mayor anyway i know but let's move on go ahead sorry all right moving on to section 7.07 there was a desire by council to remove the provision regarding upon the recommendation of the mayor regarding budget changes we did add language along the lines of in the manner consistent with general law simply because chapter 166 has a certain process that you have to follow when you're amending the budget and didn't want to appear that we were conflicting with that provision okay any questions okay is all those in favor accepting the language change for 7.07 say aye aye opposed okay vote was unanimous next section would be in addition to the charter uh new article 12 section 12.01 regarding in the office of inspector general i've broken you have the the full outline in your memo i've broken it out sections to fit within the slides i'm not going to read everything here but to give you the the general sense of what is here obviously establishing an individual as the inspector general as well as an office uh regarding the various measures that you wanted this office to look into a non-interference provision calls out obviously using some of the language that was provided to us we added in language that the office may utilize the services of the human resources department but not be subject to its authority because there was some discussion about being overridden by the executive we also included language about that the council had asked for regarding the various officers not being able to direct this individual or impede them council indicated that you'd like to have an implementing ordinance for some of the details here we did include some basic provisions using the miami beach model that was recommended to us along with others that some minimum standards as to what this ordinance has to include which includes having this inspector general selection committee the membership procedures process for appointment and reappointments that this be an open merit-based process also that this ordinance would set the number of personnel for the office provide for initial funding because obviously there would not be a budget at the time this was established and provide that the office the employees the office be entitled the same benefits as similarly situated employees this is language that also appears in your city clerk provision so we were mirroring that to be clear since this section sits outside of both the legislative branch and the executive branch we included a provision that this office doesn't exercise powers of the other branches it has access to the individuals but does not usurp their powers it does though grant them specific powers in the next section as far as initiating an investigation audit or review or acting on its own initiative we gave the office the discretion to decide whether or not they wish to proceed if something is in the public interest or not uh and also that they had the power to file ethics complaints for firm matters outside uh independent obviously of the rest of the city for subpoena authority uh given the desire to include that uh we looked again to the miami beach model and they had some interesting language there that we thought was useful about making sure that they could seek judicial enforcement of subpoenas but we also had some caveats that they had to inquire whether there was a companion criminal investigation going on as to not interfere with that uh it was a very interesting provision uh sub two that talks to the fact they can't use subpoenas to battle somebody else with subpoena authority over them uh again trying to prevent a vicious circle next section regarding cooperation requires cooperation obviously city officers employees contractors uh as to appointment you indicated you wanted five members of city council uh upon nomination of this selection committee you wanted a five-year term uh we also included then five year five votes to remove uh and also a basis for termination and the ability to respond is this a good time to pause um is there a way that you could look at this j portion when we're talking about what we just discussed earlier that did just pop into my mind okay that's why definitely we will build that uh thought in i like redundancy don't we all it helps in charters i'll hold on so it looks like we're pausing for a couple questions absolutely yeah i just i just want to mention um i yesterday unsolicited i had a um a former um retired auditor who's very well respected i'm not going to say the name but someone who's very well respected who's worked with lots of big government agencies and went through a bunch of recommendations on this and he said one of the main things he said was if you if you create a position like this you need to get rid of the internal auditor because they basically do the same thing um because what you're going to do otherwise is set up a fight between the internal auditor and the and the inspector general in reality the the the auditor um the the way it's set up now the auditor reports the mayor and really what they do is process analysis uh they don't do in-depth audits the way that other government agencies do as i as i talked to him he's worked with a lot of big in small government agencies um if we're uh you know we have an auditor and and ceos of organizations like to say oh well we've got an audit auditor that comes in but you know look at arthur anderson and a bunch of other companies the auditor will come in and they don't look at every document and they don't they specifically say in their documents they don't look for fraud and so you have an inspector general and an auditor but if the auditor is looking at process inspector general is looking more deeply then we need to figure that out the other thing is so my recommendation is that we combine them and whatever we're going to call them so there's not two departments fighting each other um and then the uh the other thing is that in most organizations especially in the private sector the the auditor and the inspector general reports to the um the board uh we are in a corporation where the board the mayor is the ceo they report to the board to prevent because this the the city council and the board have no authority to run the day-to-day activities we have no oversight to it other than the reports that we're able to get from them and so the purpose of the auditor is for the for the board and for the public to be able to have a line of sight into it the other recommend he had a lot of recommendations but another one was that we should look closely at the um uh the state inspector general and maybe even get in it get some advice from the state inspector general on as to how this should be structured um so that it's not set up to provide conflict i i don't support separate um combining because it's it it might appear to be two of this you know the same function but it's the audit department is much more different much more different it has a totally different function than what at least how i perceive what the ig would be so i think that they perform some very distinctive functions and not not the function of what an outside inspect inspector general would be looking at how much more do you have after this slide we have this slide and one other uh no no just on this section here you have one more side on this correct okay so i'll just real quick how much does this differ from i believe it was board member creighton who championed this with the charter review i believe it was him i spoke to my appointee who was mr stephen benson i think he mentioned creighton and creighton did um uh send his recommendation to to all of us how different is this from what he proposed meaning what the board discussed and did the board vote to support moving forward with an inspector general the board did vote and included recommended inspector general provision in their final report uh there were many versions uh proposed during that process so i i don't know if this matches up exactly to bobby's or not but it is substantially different uh that provision that provision restricted the inspector general to acting on a complaint basis uh as far as their they had to receive a complaint in writing uh in order to proceed with an investigation your indication was you wanted them to be act on their own initiative okay so mr mr creighton or the board's proposal was that it had to be a complaint driven not that they could that the inspector general could initiate their own i i don't want to put words in any particular member's mouth because they had a a very uh intense discussion about this the adopted version that came from the commission uh had much more had many more limitations as to this role okay including that provision so the adoption provision no subpoena power except for documents uh things along those lines so this here says subpoena power correct which what authority does an inspector general have to receive you know to issue a subpoena receive a response wouldn't they have to because it says here if not they would have to petition the court or go to a court and get a judgment wouldn't that be the case anyway or does approving something like this or if the voters approved this would it give subpoena power by law could they be created or do you always have to go through a court and have a judge sign off how does that work what you're creating here is the ability for the inspector general to issue a subpoena an enforceable subpoena or somebody can say well you're not a judge if i miss you know right if i may to issue a subpoena to enforce that subpoena then that will require using the legal system and involving a judge okay the grant right now there is no authority granted to this individual without this language to issue subpoenas that is an exception not the rule and then for the creation of the board or the appointees that would then select the inspector general would that come to applicants would come to city council and we would create that board or how would it be created how and i'll just give you the comparison the charter review commission set forth a specific board by title okay your indication to me was you wanted to defer on that and set it by ordinance as to who is a member of that committee and their process okay and then the board would select the inspector general correct the board under your provision here right under the charter review commission it was a combined board and mayor uh appointment process under your provision it is solely the council and then last question i believe i saw it in order to remove the inspector general could it be done by motion of city council is it by super majority five votes or is it four votes what what protection do we have you know for the city and for the council uh let me go right to that provision go removal you had it uh on five affirmative votes uh you had to provide the individual with a resolution that outlined the basis for termination and give them the ability to respond both in writing and a public meeting and the fact that you didn't like the report was not a basis yeah okay very very good thank you uh i was gonna say this because i was acting as chair at the time um but what really happened on the charter review commission is people were starting to go in different directions so they decided to just put something on so it could get to us and they did expect it to change substantially in which what we and that's what we did so okay it was counseling what did i tell you first thank you uh chair uh so with um and mr tinkler again thank you for your work and your professionalism and you've put in a lot of hard work so thank you uh we all appreciate you very much so and i may have missed this i apologize the appointment so council by a vote of five will um confirm what have you the the selection of this individual by the committee do we know who's on that committee at council okay so that'll be part okay good yeah yeah um and i like the fact that um the removal has specific criteria because we want to guard against um you know any abuse of council power with this uh with this individual reversi or he may be so yeah so no that's it good stuff thank you councilman miranda thank you we uh not only do we have the internal department that does the internal audits but we also have external auditors that come in from whoever we do business with in some area in the government to give some facts or whatever monies that we get received from whatever divisions they give us to facilitate our needs and those that i've been here i've never seen one from the external auditor or the internal auditor that did have something that minor little things there were so many days to correct whatever it was and then you follow up on it and they tell you exactly what happened it's cleared out uh there may be delayed by whatever situation it was that the the paperwork wasn't done at the correctly time it was supposed to be done or whatever it was but there was never anything that i knew of that was criminal intent or any action like that in my years of service and i can only tell you what i've seen uh from the internal division this one the one prior to this one and the external orders i've never seen one where anything was blown out of proportion that there was something corruption in any form of government that's all i know councilman carlson and let's wrap this up there there are five more provisions to go through on this okay together yeah if you want to wait we've got something on this you know you know two two things about that though the um the internal auditor from the ones i've seen are mostly process analysis and that and audits um are they take they take samples of data they don't they don't look at every piece of data they take samples of data and they also explicitly say that they're not looking for fraud that's every so you would have to have an investigation to look at fraud and right now we have no capability to do that the second thing is that um my uh my son is going away for several months about 3 30 and so at about 20 minutes hopefully i'm going to leave so i can say goodbye to him mr tinkler continue let's let him finish the rest before we talk yeah we can get the powerpoint back on uh provision regarding vacancy uh just wanted to highlight we we simply took the provision uh regarding vacancy that came from the commission uh it does not provide for an interim uh position a person in this role the commission's feeling on that was that interim was not appropriate i just wanted to flag that though that is unusual we did include language since there is a provision in the charter regarding internal audit that this was not meant to otherwise interfere with that provision uh we saw this as distinct in that the inspector general has an audit ability but is not the auditor so that was the reason for the clarification there the funding provision there was an indication of desire to have some independence on the funding but obviously we're restricted as to how state law requires you handle a budget so we included language that the office would submit a budget to the mayor for inclusion within the annual budget notwithstanding any contrary authority that the mayor has it would be presented as fully recommended by the inspector general to you in the annual budget process it doesn't mean you don't amend it or is the amendments aren't down the road they just amendments don't occur before it gets to you in the recommended budget but that is a change to your budget process next provision regarding legal counsel uh given the city attorney represents the city as a whole we included they may utilize the services of the city attorney's office or may retain independent counsel subject to limitation of funding in their annual budget the rest is regarding implementation it simply puts you on a clock as to how if should this pass the timeline to get the ordinance passed in order to get uh the committee spun up and be able to proceed uh with activating the office that's the full provision there's i think questions on that i think you've you've fixed a couple of the holes that we had and so i appreciate that work as well i think you've done stellar work on this is there any other input on this councilman councilman oh yes sir thank you sir for um confirmation it's only city council does the mayor have any say in this whatsoever whoever he or she may be in the future okay just okay okay i mean technically yes because we're writing an ordinance and she has to pass it she has to sign the ordinance yeah and i mean in the future we'll be subject to inspector general too oh no no i mean i i would imagine and by the way if i may if i may mr sure i know i see mr greco here mr cohen is there any other um if just if any of them have any well we're still we're still moving on whenever i'll give them an opportunity yes sir thank you sir okay i have one more section uh okay one section on the ig no one more just in clarification as direction this that's the last of the charter language okay just a couple more slides and so is this that's it for the ig though yes so is there all those in favor of accepting the ig language as a proposed say aye aye opposed the vote was unanimous okay continue just a few items that we need your direction on as we're proceeding uh the first uh the city has used two different paths in in the past as far as how to handle these kind of charter amendments you have done comprehensive ordinances obviously the last time you did that some items did not make the ballot uh the alternative is an individual ordinance based upon topic i definitely lean that way uh but i wanted to it's not my call it's the client i'll call for that vote all those in favor of the individual ordinances aye aye it was unanimous good man uh the other just just so i can let you know and um council member her tech can correct me if i'm wrong but when she and i were on the charter review commission together in 2016 but when and then city council voted of which there are three members here now but as i recall there were like 16 changes we made and those were condensed down to like four amendments and 18 18 down to four no 18 amendments we had about 18 18 but what but then so anyway something happened where they got dropped off so um uh we need to make sure that however it's defined that it is accurate i read one a little while ago that i thought was completely inaccurate well that's going to be our i'll tell you that that'll be mr shelby's responsibility no i'm just kidding um it'll be our responsibility i mean we need to we need to accept that responsibility because we're also we also have a timetable and all this was this entire process when we started this mr kapeski mr shelby and myself putting the structure together and hiring and getting the team together our facilitator our lawyer we started on the date when our supervisor collections could take the information that we're going to provide translate it into spanish and have it ballot ready we took that date and we started backing up and that's how we've gotten to where we are today so when we get this back we're going to have to meet those deadlines for craig latimer to be able to get this on the ballot so we're going to have to accept responsibility to make sure we read this and make sure that it's right okay continue we can bring the slides back up the other piece you gave me some direction here on amendments i just wanted to make sure that uh you're not anticipating another workshop on this that your next my next appearance would be regarding bringing you the ordinance at public hearings so this is this is my assumption is when we when we finish this i'm going to call for a vote on the having you go back and finish up this draft language into ordinance format once that comes back you'll bring it back to us for a vote at a regular city as a package or you know and maybe we have november 5th so as when that happens then we will be moved we'll be on the fast track to move forward i don't think we need another workshop on this i think we're done um is there anybody that opposes that no mr shelby well let me let me chime in with the what ifs because you do have another meeting and i don't know what could be accomplished between now and the 15th of october so you could at least have a status report of somewhere that's what i was that's what i was going to ask well because because if you get into a debate when this is an ordinance form presented to you for first reading consideration it's going to be almost an impossible logistical task to be able to amend that on the fly okay okay so i make a motion to have an update at the next city council meeting which is october 15th during staff reports second and we can do a time certain if necessary with time starting oh at 130 130 again that way um that way uh you know and we know can you state what the expectations of that update would be um to take all of the questions and concerns and instead of doing the entire thing like you did this time uh actually do exactly what you did this time anything that were changes you you bring back to us in this very same format which was very easy to read i also appreciated having the um presentation beforehand so i got to over look over it even though it's just the day before it was perfectly fine so um uh that would be my request i have a motion is there a second i have a second councilman Miranda a council on her um no just wanted to uh give an update so i was tasked with the ordinance regarding um section 7.2 which was the progress of the city projects and also like number 22 for the questions that chair clinton had i did talk to attorney study and we should have it if not by our next council meeting before um by the the 15th so we'll have that in addition to these things perfect is that is that charter is that ordinance it's going to be an ordinance but just it'll just yeah but yeah we have there's a whole bunch of we have a bunch of ordinances on the on the hot sheet ready to come okay first of all did you have a question madam clerk yes it is your intention to return correct and that's 1 30 time certain time certain on the 15th on okay and i just want to share council and just just to put this in context you only have two regular meetings in the month of october and that is the first and the 15th and then actually quite after that the next regular meeting would be when this is scheduled to be for first reading correct well hopefully we're all going to need one of that yeah one 30 meter time set i have a motion i have a second all those in favor say aye aye opposed eyes have it um thank you mr tinkler thank you very much very good work i mean honestly really really good work exceeded my already high expectation your reputation was well deserved i appreciate it council thank you for the direction and i'll see you in two weeks now i have members of the charter review commission um i would like to hear from you guys um how many do we have here i see two is there somebody hiding behind mr tinkler because he's a big dude okay would you do would you guys like to speak do you guys have anything you'd like to say at least recognize you i see uh mr alan cone and mr garrett greco afternoon you've heard people talk about your grandfather today a few times yeah um on the charter review uh say your name garrett greco i was the district one appointee for the charter review commission i would say that council's headed in the right direction as councilwoman hertech stated i think the proponents of the ig felt this was a sort of compromise to get it to city council it seems that council is going a little bit in a stronger direction and so i i think that's a good thing speaking for myself i would say we tried to keep it independent of political influence and one of the things we sent to you guys had the mayor and a member of council i think the chair picking a seat on the selection committee that probably should be removed when it comes back to you guys again it was okay good um lastly was the special zoning hearing master i know that council had no appetite for that i tried to express that to the commission i was the only no vote on it um i i will say the commission i think the public and all of you recognize the contention behind land use decisions at council and the best way to fix that is fixing our antiquated and suburbanized land development code and we have our first meeting back tomorrow at 10 a.m it's the land development code advisory team meeting at tampa city center at hannah councilwoman hertech you've been before 10 a.m i'd encourage all of you to show up or send someone there to check it out so thank you and uh alan cone i am councilman navier is appointee to the uh charter review and also vice chair of it and as garrett was saying uh responding to uh councilwoman her talk we did want to leave room for the city council to make the changes that it felt uh important to the inspector general uh to make it your own um we did have suggestions of of having uh giving the city council and the mayor an opportunity to have a participant on the panel that would select that person uh for the reason that we wanted both sides to have buy-in on uh the the selection but uh given the decision of the city council this is going to be a a strong uh system in terms of picking the right person uh for this uh position and also uh you know one other point we also wanted to make sure that we were not taking resources away from the city whether it's in the other or auditors department or hr uh which we recognize has other responsibilities and we wanted to make sure that uh the inspector general had its own staff and ability to pursue the issues that um that need to be pursued and one other thing i'm i'm also really glad that uh and councilwoman young has has been um and her appointee to the uh charter review uh push for a system of transparency in terms of of finding out what the development status is of different projects i am glad that the city council will consider this by ordinance we think it's very important that this happen in the city it may not be in the place of the charter to do it but i'm really happy that it's going to be done by ordinance so thank you very much thank you okay before we leave this issue i think we need to address um city council compensation uh mr shelby would you please there's there's an issue with it because we had that in the charter and we we said we said ordinance and then we found out we maybe we can't if we go back to where we were could i could i ask mr tinker to bring up 6.06 i think that because this is going to affect i want to be clear on what council's intention is and what the charter will provide presently provides and what is proposed there is a change to 6.06 and so council didn't take any action on just just a refresher so we had some proposed language that would amend the charter putting in a formula that would create basically a salary sled between a council salary and the mayor's salary because of existing charter language i've been advised by our city council attorney and city city attorney staff that it that that language could not be done by ordinance that we would have to amend the charter so that's why i'm bringing this up now oh councilwoman hertech so from my understanding the only part that we can't continue with is basically setting a setting parameters around how it moves forward it might let's just basically say it has to be done by resolution well yeah right we can do a resolution as as of right council has to set their salary martin shelby city council attorney as of right now and and mr vaskey who has worked very closely with city council in preparing the the ordinances excuse me the resolutions that are in effect today he may be able to do it but if you could go to 6.06 because you did phrase it there is a change to correct it to put in what was missing that was not presented to the voters that does allow it to be changed by ordinance is that correct if we can bring up the slides as we have you to go through it there you go i'm here as we speak here today the ordinance is missing the language or ordinance of the council recommended and approved in writing by the mayor so as of now with the corrected um muni code uh ordinance as uh as in effect it does not allow it except by resolution and mr chuck mr vaskey that's correct okay i see him nodding so what that means is that if you ultimately wanted to create a formula by ordinance that would be done by city council by public hearing and approved by the mayor consistent with this section and that would be subject to whatever you choose to do and that could that could would only be changed then uh it wouldn't be set in stone in the charter but it would be available to be changed and amended depending upon the circumstances depending upon the city council so it looks to me that when you reviewed this and i saw that you passed by it i would think that that change would then allow you to then after this is accepted assuming it is accepted by the voter to then create by ordinance the formula that you would want in effect it let me interpret your legal speed because i've been involved in this i don't know so i'll i'll speak in clear english so this is this is i'll do it so what we're what they're saying is the existing charter only allows this council to set salary by resolution if we wanted to accept if we if let's say to today there's two options by based on what mr shelby and mr vesquez have said because of these restrictions if we have two options we can change the charter to include the proposed language for you know setting setting the salaries based on a formula or this moves forward and if this passes we would have the ability to pass an ordinance and after this passed so those are two options if you want to resolve it now and put it on the charter that's an option if you want to just go with this language and wait to see what the voters do with this and then the next but then the next council is still going to have to vote on their own salary councilman bureau can we because i i you know i've i've how can i say this i've been dealing with this issue for a while and and i i felt very strongly about the idea that we should not be uh burning for no but no no so first though that we shouldn't be voting for a pay raise and we should have something like the 27th amendment to the u.s constitution in tampa but there's a lot there's an issue that is just as important to me which is is that city council should have a higher salary because most people can't have two jobs this is a job that requires a lot attorneys i'm an attorney i'm very lucky that i can manage my practice and do this it's hard but i do it but a lot of folks can't do that so is there any way that we can go ahead and raise it for next term to a certain level just to have it done the next council doesn't have yeah i and i'd be willing to to motion for that by the question that that would be yeah yes exactly notice the quiet gesture of mr tinkler uh can i just point your attention back to the screen that says what is presently in the charter it says that the salaries may be increased or decreased at any time by concurrence of the mayor and a majority of the entire city council by resolution so mr vaskey with that introduction justin vaskey legal department the formula that you that you've come up with we could just do that by by resolution and we can do it in the future for the next term of office but we would be keeping the current resolution in place until such time that we have the new resolution okay so so my my question is we have we have this coming up on the um november 5th but it says um return with the proposed ordinance could i change that since it's my motion could i change it to legal department to work with chair clandinen to return with a resolution regarding city council compensation so that is my motion for the november 5th meeting to change the words proposed ordinance to propose resolution i have a motion from councilwoman hertuck and i have a second from councilwoman young any discussion hearing none all those in favor say aye aye opposed and then i like this ordinance language okay council uh would you please read the vote please motion passes with my men's cargo voting now thank you ma'am mr chair mr council yeah and again i want to emphasize how important this is which is that if you're on tampa city council it's really hard to do so many people are precluded from doing this and so we're doing this for the next council so that more people can run for office and be part of the civic process because the way it is right now you preclude forget about the expense of running for office which which really sucks but you also preclude people from ever taking office and that's just unjust and so that that's why i'm very supportive it's the right thing to do any other business on the charter are do you have your marching orders and you're good to go everybody's happy okay very good we are going to move on to sam print out the newer documents sam thomas please bring the newer documents to council chambers yes i'm going to take off to go see myself is there any way i could make a motion to accept the form a b second okay yeah so we have a motion okay we have a motion from councilman carlson to accept his uh form a second from councilwoman hertech all those in favor say aye aye opposed eyes have it thank you thank you um so in front of you was proposed um rules for filling district seven i made a couple very scribner kind of modifications one was putting the ex the uh date uh that the application was uh due on the top and on the bottom of the signature okay councilman councilman miranda would you please bring your conversation to the lobby and for those of you that have a copy that doesn't say draft please shred it tear it up because i don't want it to get like mixed up with other things so that it doesn't get floated around as a as a valid uh yes exactly so before you just one second yeah go ahead miss scharf can you please bring my um personal phone thank you so before you is a is proposed guidelines for filling the district seven vacancy we had an aggressive schedule in an attempt to minimize the amount of vacancy period that district seven has on council with all the big issues that are coming before council it's always good to have somebody sitting in all seven seats um just so you know the difference between the documents you have now with drafting and the one that you had previous is it has as you can see on the bottom applications must be submitted to and accepted by the city clerk by 12 p.m monday november 9th and i also have that same line underneath where they have to sign so that there's no clear there's a clear indication and on the top of the form as well so it's in two places on the top of the forum on the bottom of the form the uh what the is anticipated if you when you turn the page over that the applicants will fill out the hard copy form and they will submit a business resume all of those rules are included on the back of page one so page two and it's the policy procedures what is expected for them to include in their application which is a filled out application which has the declaration of how long you've been a resident city and how long you've been a resident of district seven are you registered voter do you sit on any of the boards and then their basic contact information the date of birth blah blah blah their resume will have all of the details that we consider as far as their background experience for informational purposes now if you turn to page the front page the cover page the top half is just a summary of the related laws of how we fill those positions the timeline and the summary of the project that's the meat of the matter the problem is we've got holidays we've got you know there's a whole bunch of things happening here the big i'll call out the complexity right away off the top so you know what we have one problem and that is the uh november 12th november 12th is a cra day meeting and a night meeting what this let me show you what we were trying to accomplish and if anybody has any other ideas we can talk about that so we on thursday october 15th council approves the selection process well here we are on november two chairman that's not true that's not true no because today is the first i'm sorry this is a draft and i should also point out mr chairman just a reminder because you and i had a private discussion the application right now is also a draft correct and what we i think and if i can have an opportunity to speak just briefly uh when the time has come um uh it needs to be amended the application and and quite frankly the public should know that this application uh will actually not be available to um to the until the date of the vacancy we're going to get there i know that but i just want people to know yeah okay so anyway so we're on the 15th we'll approve the process and timeline on the third the city clerk will make the application available to the public at 9 a.m that's tuesday november 3rd on monday november 9th the application deadline is at 12 p.m noon applicants must be uh must applications must be submitted to and accepted by the city clerk by that deadline on tuesday november 10th and the reason why this compression is because wednesday is a holiday so the the clerk would get us the members of city council the uh the compiled applications distributed city council no later than 10 a.m on thursday november 12th this is what we did what we did here's the problem city council days what we're trying to do is swear these the successful candidate in on the 19th and first order of business and what we wanted to do is vote them in and then give them time to come to council with their family and make it a big deal right so we didn't want them like you know kind of like what we did with you know so we didn't want to like okay now you're going to our city council tag come take your seat you're going to start working given a week hold on one second i'll get right to you give them a week that gives me an opportunity to schedule the new person with mr shelby for the briefing on legal stuff hr miss kapeski getting all of the background stuff trying to get them as a one-week training on how to be a city council person um so trying to build in that week the dilemma is again the 12th my proposal would be we gavel in a city council meeting first thing in the morning on the 9th on the 12th at 9 00 a.m get that done and then go right into cra okay i'm done councilwoman um first of all that can't happen because um on the 12th there is a mayoral forum that goes from 8 to 10 so i'm going to be late to cra and so we'll bill so yeah so just telling you right now that's not going to happen because of that secondly um reverse it well it's already said like i i don't know i'm saying maybe we could do the you could but do the election after that but here's the thing uh these are well attended things the cra is a big deal we have that's our major night meeting we need a break between those two things so my recommendation and it's worked for me this is how i got appointed we had the appointment on a tuesday on the 17th a special call meeting and then i was sworn in two days later it worked just fine i mean it that your first council meeting it doesn't matter how prepared you are you're not prepared i was just trying so hard i know but i know you're trying not to schedule another meeting but um the room was packed it was it was it was i know it was city-wide but still people care about this they're i mean it's district seven nobody cares about this oh you said the quiet part loud but not only that i mean i'm sorry but if you look if you look at sorry maura sorry alan if you look at the cra we have seven staff reports i mean it's it's we and one of them is the tampa bay raise so i'm sorry but i just don't see how this happens yes now i don't see how this happens i think it's i do not think it's a good idea to put this on a council day i just even if it's a short meeting on the 17th it could be a 9 a.m special call we could be out of here by noon but but what that allowed me when i came to do that is to i mean there were there were press that wanted to talk to me i got to go back and look at my office i got to come up here and take photos with my family i mean we still did all that stuff on the 19th too on the thursday um because my mother actually came down from gainesville for that but but really it was a great it was a good day for me it worked really well and it's the only person who's experienced this i really think that worked for me the 17th i'm open at nine i don't know how else the 17th is but i really for me that was enough time it wasn't enough time there was no never going to be enough time i mean i think even councilwoman young can say there was not enough time and she had she had a decent gap between uh when she got appointed or when she got elected um it there's there is no amount of preparation that you can do i just think that putting it on a cra date where we're voting on the raise um what if we did a 4 p.m on the 12th the problem is we don't know that it's only going to last an hour it's it's it's district seven it's not citywide so you have to get get out of the citywide thing but still i mean you could have 14 people apply yeah okay if you don't think so i mean i'll i'll accept at 4 p.m but so the problem is how late what what are our what are our evening ones on this well what's 4 p.m 4 p.m meeting 4 p.m to make the special call and what time and what time is this the evening meeting five o'clock five oh one i would i i just think it's probably a bad idea to do that you're asking for trouble i i tend to agree no well because you don't know that you can we're going to be able to start at five i i still i just still think a special call is is an easier way to deal with it that's just me okay so i make it well i mean let everybody look at the calendars but i make a motion that we um that we have a special call meeting on november 17th at 9 a.m to uh elect or to appoint a district seven new district seven council member i agree i'm just checking my schedule yeah yeah two hours throughout but but we may but the problem was you voted for me in five minutes but you don't know that's the other thing there could be a three three stalemate you have no idea how long this could go they predicted that mine was going to go over 30 rounds i've got elected on the second round but that 30 round thing scared the daylights i just can't see this but you never know alan when you when you're like oh this will take an hour that's what i'm not pushing back just i thought i'd be home by now okay i have a motion i i have a motion chair if i may mr councilman bureau yes sir so so i have a obviously a lot of thoughts on this so i i um i made this motion so that we could talk to the public talk you know be transparent on what's going to happen let people who are going to apply we obviously you know elephant in the room we have uh alan cohen and morris lopez here who have filed for the seat i know patricia alonzo is also filed for the seat um you know you have candidates out there right now who are working very very hard knocking on doors making phone calls coming to council meetings doing all kinds of it's it's a really really really hard running for public office um i i would say by the way i'm not going to be here so maybe i have no standing to suggest this but i'd love it if we um did it before um that uh maybe uh take a look at a special call on monday tuesday or wednesday i do not believe this is going to take more than two hours i i i really really don't you know and again i i have no standing to say that whatsoever um but but i don't believe this is going to take the longest um we are going to have more people who are um going to seek this who knows what the proposed arrangements will be i know there's people that are looking to potentially run if they get the appointment which i find to be very cynical and lazy by the way but um especially in light of everybody out there doing the hard work right now but um but i would say as soon as possible so that we you know get something early mr shelby martin shelby city council attorney one of the reasons that this is considered a draft and that we're coming back in two weeks to finalize it is there may be conflicts that we don't know about for instance i was just informed that tuesday morning the blc is meeting in this room with a notice public meeting so uh monday is clear the clerk informs me and i don't know about councilmember carlson who is absent but it is what it is and also council let me just take two seconds to just tell you the most operative term here and this is why the um the process is going to be that the the um once it's approved next week excuse me in two weeks once approved by the 15th i suspect your direction will be to have the application made available but the clerk will not be accepting the clerk will not be accept because and i want to point the attention to section 10.01 which is on the sheet in front of you the operative statement there is that the term shall be filled by a majority vote of the remaining council members you don't become a remaining council member until there is in fact a vacancy so what you're doing now is allowed by law preliminarily to get the process in in in in in effect and there was a question asked could we actually do this even beforehand and the and the truth of the matter is no and and and because of that uh council member viera can participate in this uh process moving up but obviously he will not be making the appointment because by his departure he will be creating the vacancy and that's when you will then be the remaining council members who can go through accepting the applications and making the decision in an open public meeting see and i i believe that we could accept the applications we just can't make this election until after the no and why argue with me if it's a great that's why i'm not arguing because we're setting because it just compresses the schedule so much now doing this the charter the charter i thought if you look has is a very tight turnaround says vacancies filled by appointment must be made within 30 days from the time of the vacancy exists by your schedule mr chairman this is 16 days and the reason but the reason why we don't have much flexibility to go further out is because of veterans day and thanksgiving yeah so that's what kills us uh council councilman her so um how long does the do you said blc how long does that meeting go um so why don't we do a 1 30 on the 17th that might be better for our conference too yeah because if you've got something then yeah that's monday and tuesday well i guess that's better but 1 30 that's probably better yeah 1 30 then so let's say 1 30 on the 17th november 17th i have a motion council on the her tech to what was that i'm sorry okay so what i'm gonna do is say i would like to could you amend your motion yeah sure accept this language with the amendment that will change thursday november 12th to yes tuesday november 17th at 1 30 p.m streetcar okay yeah sam we'll have to cancel the streetcar form no but this is tuesday this is tuesday okay so so um we will i accept this um uh draft with the change that the two-minute presentations will be on instead of thursday november 12th they will be tuesday november 17th at 1 30 p.m in city council chambers motion i have a second all those in favor say aye aye aye opposed the ayes have it thank you darling can you please make sure that's on the calendar november 7th tuesday november 17th and by the way you'll be able to finalize this when i bring it back on the 15th yes okay great okay so is i believe that is finished with our new our old our business correct are we done charlene you concur we got everything done yes ma'am can your office make sure you reach out to councilman carlson's office and make sure that date's good for him in time yep sam would you please reach out to dossie to coordinate with carlson's office on that take care guys okay that concludes our regular schedule program councilman viera new business yes very briefly if i may um i want to put on the uh october 15th um calendar docket whatever it may be it's nothing that will require any presentation just that mr shelby i want to have that day with the consent of council all of the appointees transmitted what have you for the veterans committee from the mayor and council um if with council's consent if i did that um what would be the proper uh method for doing that just have a resolution yes bring a resolution all right so your request is for city council to take action yes sir on the 15th yes sir then um then you can do it by resolution uh and i can uh have that as long as i can get that perhaps by the weekend before i can do that thank you sir so if i may council my motion is for october 15th um for mr shelby whoever the person would be to create a resolution for um ratification what whatever the term may be for the veterans committee appointees and that means that the mayor's office and all council members should have their appointees in time for that um just to get this done before i leave you to have those names for being incorporated into a resolution technically by next thursday okay yeah okay okay now the question is then um could could the clerk also forward that motion to the mayor's office and her staff so and my office can we can my office can help too okay thank you they go okay so for the medias listening councilman carlson and the mayor's office you need to have your appointments for the veterans committee and by next thursday and if i may and i'm yes sir i apologize mr chair for sebastian if you don't mind letting councilman carlson's office no and the mayor as well thank you i have a motion from councilman bureau i have a second councilman maniscalco all those in favor say aye aye opposed the ayes have it thank you very much um second i have a request from acting chief brett owen and pursuant to the state statute or requirement for an annual staff report on the city's red light camera program i request that the said report be placed on staff report section at the november 5th regular meeting of city council here but someone get to enjoy that there's one space left that's all you want it for that one right okay for november 5th yeah why why are we doing it it's state it's required by statute apparently okay yeah god it seems like we just did it no no okay gosh man i have a motion from councilman of your second councilman miranda all those in favor say aye aye opposed eyes have it and then if i may last one uh judge paul huey who's a 13th judicial uh court circuit court judge it is one of the best guys i know he's retiring and i want to give him a city council commendation i'm gonna just have lunch with him next week and surprise him with it but that's okay an off-site presentation councilman bureau of an off-site presentation uh second from i heard both so my councilman maniscalco all those in favor say aye aye opposed the eyes have it thank you council that council woman young thank you um so there i wanted to um there was some i'm gonna sit back there was some um we have some public comment today uh specifically about the east tampa and sulfur springs area one regarding the 56 and broadway project i think i may have spoken about this a few times on council but to anyone that's still watching and just as a reminder i have met with our mobility and storm water department to discuss that project along with uh east tamp two east tampa residents who were present in the meeting to talk about that project and they what was pretty much what happened is after two attempts of speaking with the business owner that owns the easement that was needed to do that project because they didn't want to give up the easement and we're not just going to take it from them that is why the project ended up being canceled what happened is that the spoke with brandon campbell and they were amenable to reaching back out to the new owner because apparently there's another owner that was there but also since that meeting there's also been another solution that may be a path forward that they are exploring um so that is is is happening and we have we've met about it we've spoken about it it's not something that is forgotten and it is a project that is still that we're still working through um also in regards to sulfur springs i i want to um also thank the council because we had a fantastic budget meeting and we know that there's a a little bit over i think probably three to four million dollars that are going to go that's going into sulfur springs for fy 27 going towards the sulfur spring neighborhood action plan park improvements housing stability programs crime prevention we're getting new sidewalks around sulfur springs k through eight so we're doing a lot um in that community in addition to the 150 000 that went from surplus funding to go towards the sulfur springs neighborhood action plan um there's also a sulfur springs fresh food market too that has been started to kind of address um the uh the food insecurity in that area but there are still other initiatives that are happening in the sulfur springs area um and i will also say from that 150 000 that we allocated towards the sulfur springs neighborhood actually plan out that surplus funding out of that came a number of sweeps um that have happened in the sulfur springs area to address a lot of the legal dumping in the area which has been very successful and also out of that came the sulfur springs stewards which is a program that has been employing residents and they have been going around in the community telling people about the sweep so we've been doing a lot of great work um in that community um i also want to say um you know the youth program that when we had that budget meeting the 175 000 towards the youth program that wasn't going to be in fy 27 which we asked i asked for to be put back in a lot of those students in that program first we raised the number from 30 from 30 to 70 and a lot of those students in that program that were interned over the summer were from east tampa and sulfur springs i actually had two interns in my office that were from east tampa as well so this council is doing a lot um and i will also say uh the district representative for district five is also doing a lot so um so i just wanted to put that out there for anyone that's still with us but no but know that we are doing a lot of work in that area um and we we see the need and i think that there's going to be a lot of progress and great things that are going to happen in there so for anyone that's listening um just so you know that you have a council that cares you have a district representative that cares and we're doing a lot thank you well thank you all that in one breath mr chair may i add something to that go ahead thank you mr chair and i just wanted to say that that i i in politics is what it is but i saw the attacks and and you are just you're doing a great job councilwoman young you you you wear it well you you wear it with vigor and to quote bruce springsteen and growing up when they tell you to sit down you stand up so i mean you're doing great got to be proud councilwoman her check okay um i have heard some conversation about um the special call workshop on the 12th being not necessary um the city council special call workshop on reallocating the remainder of funds for the fy27 general fund and cit fund i've heard that some people may want to move that till after the vote because it's only three weeks yeah so it was on my spot that was going to be i was going to bring that up too so okay yeah yeah after the amendment three vote there's only three weeks i'm happy i'm happy to move that um to later in november that's fine with me um or we can just wait and see if it passes and then set it so i'm just going to remove the the october 12th city council special call workshop for the general fund okay good to see what happens to the election and then motion and set it okay we need to yeah yeah i have a motion councilwoman her check i have a second councilman i'm gonna scout call those in favor say aye aye mr chair very briefly only thing i would say and i know this is taken for granted that if we do that if god forbid this thing passes make sure to have a district seven person in whatever you do that that's all sure not a problem um and so this one this is a staff this is a staff request um i made a motion to continue the peregrine agreement with the state attorney's office and the peregrine grant agreement to november 5th 2026 so chief owen can meet with each council member prior to our vote staff has requested that these items be moved up to october 15th 2026 and to travel together so i move to reschedule both of these items to october 15th 2026. okay i have a motion from councilwoman her tech i have a second from councilman miranda i've actually asked chief owen for some additional information after my meeting because i was concerned so all those in favor say aye aye aye opposed the ayes have it okay anything else okay thank you for that councilman i don't know chief owen well enough i was gonna when he called the other day i was gonna answer 9-1-1 what's your emergency but you know i'm not that comfortable yet so first i just want to say uh district five district five does have a wonderful representative and a great legislative aide i know you're always always working and so you do a great job um i want to wish my niece and goddaughter mia a happy 13th birthday i'll make sure to pull this up on youtube so she can see it and i'd like to make a motion to present an off-site commendation to the tampa catholic class of 1976 for their 50-year reunion in november i believe it's november 14th and i'm gonna they've invited me to present it there okay i have a motion from councilman maniscalco seven councilman miranda all those in favor say aye aye opposed eyes have it councilman miranda i skip but i suppose i have an off-site uh presentation accommodation but it's lost in the office somewhere she's not here so i can't find it so i can't talk about it thank you we'll do we'll hit it up on the next time okay i have a couple of things councilwoman her tech if you take the gavel please yes chair um i would like to request to continue or i'm sorry to continue the rescheduled noise item from the october 22nd 2026 workshop to the january 28th 2027 workshop so that the consultants can attend um can can sam reach out to kelly because we're working with the tampa heights neighborhood right now to make sure that they don't want to still have something next thursday okay next thursday on the it would be october 22nd so is there a way you could hold that motion until one more meeting sam okay i'm gonna hold that i apologize that's okay we've and so we've actually uh both tpd knows about it so we've we're kind of working with them so yeah just hold it till next okay well i'll hold it till next week till we thank you for their information okay i've got a request from shuban law group pa on behalf of the applicant that city
