Thank you, Mr. Chairman. Thank you, Mr. Chairman. For the members of the public who are here today, the City of Plantation Planning and Zoning Board are members of the public, true public servants. They're here to serve the city and the residents of the city. The decisions before the board here tonight are going to require a minimum of four votes for approval. Short of four votes, the item will be deemed denied. This board doesn't have the authority to change the city's code. Only the city council is authorized to do that. These hearings tonight are quasi-judicial, as the chairman stated, so that means you all must be sworn in in order to speak before the board, and your testimony will be taken under that oath. Um, you have the authority and the ability to present whatever information and testimony and witnesses you have to provide information to the board to prove or disprove or provide information to your case. The city will begin the presentation, then the resident will have the ability to then come forth and provide any information and testimony. With that being said, if you plan on speaking tonight, please stand and raise your right hand. You swear I affirm the testimony you give will be the truth, the whole truth, and nothing but the truth. Good evening, everyone. Good evening to the chair, vice chair, acting, vice chair, board members, assistant city attorney, assistant city clerk, and to the public. I am Shamika Butts with the City of Plantation Planning and Donning Department. I will be presenting on behalf of the aforementioned item for the Nemchek residence. Can you guys hear me good? Yes. Yeah? Okay. All right. This is the location map of the property. The red star represents the site location. It is located at 2050 Southwest 56th Avenue. The owner is Raphael Nemchek. The lot size is approximately 16,693 square feet, or 0.38 in acres. It is zoned RS4G, residential single family. The land use is low 3. The subject site is developed with a 2,586 square foot, one-story single family residence with a two-car garage and a pool. The zoning map to the right indicates the subject property outlined in the blue. The area is bound on the north by residential single family properties, zoned RS4G, then a canal. On the south by a canal, then State Road 84. To the east, residential single family properties, zoned RS4G. And to the west, a canal, then residential single family properties, also zoned RS4G. The area map to the right indicates the notification boundary. Any properties within the purple outline circle receive notification. And there was a total of 28 notifications sent out. The applicant's request number one deals with the front yard setback. It's from section 2772C3 of the dimensional standards on table 72-2. This requires a 30-foot front yard setback for the RS4G zoning district. Our applicant is asking for that setback to be reduced from 30 feet to approximately one foot. The applicant's request number two deals with the location. This is a waiver from section 27310C1, additional prohibited locations. And in essence, it says that accessory buildings or rural accessory buildings shall not be permitted for it of the principal residence. The applicant is requesting to allow an accessory structure in the front of the principal residence. Applicant request number three deals with the aesthetics. That is a waiver from section 27310F. And in essence, that states that all carports or garages, they must meet the same type of material, finishes, colors, and style as the principal residence. The applicant is requesting a metal frame canopy with a canvas or vinyl top to be used as a carport within the front setback. Here's an aerial map from BCPA 2025. And if you note right there in the red square, the structure is already existing. Here's a boundary survey of the property. Right underneath that, I tried to enlarge an area where you can see outlined in the blue there, the covered canopy area. And here's a site plan. It is existing, approximately 400 square feet within the front yard setback. There's an overview plan of the property. And on this plan and the next, it shows that that structure is attached to the principal residence and also some column detail. This is the current street view of the property. And the current conditions on the property right now, the property currently has two open code violations. One for the building safety department, which is the case on the left, CE24-01143. And the case on the right, CE25-01780, is for the code enforcement division. So, the building safety citation is for work without a permit. As what you just saw, that structure was up and it was put up without a permit. The violation was confirmed September 18, 2024. At this time, the owner has received three continuances, all in 2025, in May, September, and October. And this case is currently scheduled for a hearing on December 17, 2025. The case on the right for code enforcement division, that is for an unscreened, improperly secured container and golf cart. That violation was confirmed August 21, 2025. There was one continuance that was granted just past November 2025. In that case, it is scheduled for another hearing on January 22, 2026. Other pertinent information, as of date, I have not received any written or verbal phone calls, any type of notification in regards to objection of the application. The project analysis criteria and findings from Practical Difficulty Waiver Section 2752-G2 are as follows. The request shall not be substantial, does not meet. Will be compatible with development patterns, does not meet. Essential character of the neighborhood would be preserved, does not meet. Request can be approved without causing substantial detriment to adjoining property, meets. And the last one, the request is due to unique circumstances of the property, does not meet. In conclusion, staff recommends denial of the requested Practical Difficulty Waivers. And in the event the Planning and Zoning Board finds that the applicant has proven entitlement to the Practical Difficulty Vareances and Waivers, and recommends approval of the request, staff recommends that the approval be subject to the conditions included in Section 5B of the staff report. That is going to conclude my presentation at this time. I do have the homeowner here, and the applicant is here. He can answer any questions that you may have, and staff is also available.

I can't attest to that fully. I would allow the homeowner to answer that because he just came from the hearing, and he's been in constant contact with those departments to know if this will satisfy completely. You know, because as far as I see, I don't want to say yes, and then it only satisfies.

Typically it doesn't. Typically what it does is it allows them to then apply for a permit that's required. Doesn't mean they issued the permit, but now they probably can't apply for a permit because it doesn't meet code. So they're not able to get a permit. If you were to approve, they would be able to get a permit based on the approval, but they still have to go through the applications and things of that nature. But obviously if you deny it, then they'd have to come into compliance with the current code.

Well, I guess in no particular order here, but in answer to your question about the other magistrate meetings that I had here, they were continued for both from my request and is also from magistrate, it was Dave Gold who was the magistrate. There were times where I couldn't attend and I didn't have a reliable representative that would come for this. So in turn, it was all in respect to applying for this variance. And mind you, hindsight is 20-20 here. I mean, in the permit process, which I'm in quite a lot of them for the re-venervation of the home. And I would have done it a little differently because I can see where everything's kind of getting to here. But, yeah, so that's why it's continued. To also go into the golf cart C container aspect of it, he's still graded me until mid-January to get those either removed or placed in a different manner. Because the landscaping that I'm doing is part of the overall rebuild of the property and doesn't allow me to kind of move everything around just yet. You know, putting tile patios and just landscaping, et cetera. It's a big project in my concern. So, or my, what's the word I'm looking for, overall goal for where I want the home to go to. Beyond that, going back to the carport itself, this is quite an education process. Thank you, Ms. Plutz. Because I was reading a lot of things that I did not know. But in turn, correct me if I'm wrong here, but my understanding is as long as that I'm compliant with what would be the architectural aesthetics. And then obviously as long as the zoning permits me to have that much of a distance from the sidewalk to the front of the garage. That it would possibly be adhered to. Or is it saying that if we approve what's there on the zoning aspect to one foot, I would have to change the structure from its metal and canvas or coating to something that would adhere more to like a concrete block and roof structure that would match the roof of the building. Someone help me with that one.

So what you're requesting, as is, right now what's existing, it does not meet the aesthetics, which is why you're asking for the waiver from that section of code. So if approved as is, then it will remain as is and you'll pull the permits for it. If it is not approved as is, then the only way for you to get a structure there would be to meet the aesthetics, but you would also have to meet the other guidelines for it, which is the setback and also the location.

I got kind of a second part of that would be that, okay, so let's suppose that be the case and would we be able to define that the zoning setback, let's say it gets approved, however it gets approved, and then since it doesn't, I mean, to me it appears, again, it's hard to define the aesthetic aspect of it. I mean, to me it seems to fit with the aesthetics, but again, if I understand the depth, how it's supposed to be, it's supposed to like match what the structure is like, which would be more of a CBS concrete.

So let's back up because I do have a couple questions for you on this one. So the house is being redone, is that?

That was the first thing that I did when I got there because of my vehicles. I mean, look, I have expensive vehicles, and in the same token, the sun is very powerful. As we all know, we all live down here. But, you know, I face the east, and it just tears apart a lot of stuff here.

No doubt. So as I look at it, and I was looking at the wind loading analysis and everything else, I mean.

And it's, will that withstand a 150-mile-an-hour wind? And the physical structure of it might, but the tarp itself is probably going to come off or get cut or do something because it is made out of cloth. And so when we're talking about certain things like structure and aesthetics, structure and aesthetics are, one, they look good, but also, two, it's not going to pose a hazard to somebody else. Correct. And so as I look at this, no matter how nice it is, it does look to be what amounts to a temporary or a lightweight-type structure. So that's part of the issue. Had you just, like, popped up a party tent on top of it to keep the sun off of your vehicles, it might have been a better idea. But to the question that you asked, yeah, if you wanted to build out to within a foot of the property line there, we could give you the waiver on that one. But to ask for the two items and leaving a structure that seems to be temporary, I'm hesitant to do so for the, yeah, it doesn't make it look like the rest of the community, but it also winds up not being a structure that can be guaranteed safe for your neighbors. If that tarp comes off or something else comes off in a storm, it could damage somebody else. Obviously, roofs can and trees can and landscaping and everything else can here, but our thought is, does it meet the code? Does it, is it reasonable? So having pulled the permits on everything else, you can't even plead ignorance to the fact that, hey, if I'm going to build something on this property, it has to be permitted. So I guess my big question is, other than protecting your vehicles from the sun, what was the thought process in putting up that structure as opposed to extending the actual physical structure of the house or possibly a garage?

Well, I just want to clarify, I'm by no means pleading any degree of ignorance here. Okay, just so everyone's on the other page, I produce live, large concerts for a living. You're all familiar with UltraFest, you're all familiar with, you know, stuff that happens at the stadium. Temporary roof structures are kind of my thing. So yeah, I totally get it, and we have weather evac plans, et cetera, that we exhibit all the time, we put into play all the time, whether for short-term evacuation or for long-term. But yeah, anything that's going to be that kind of wind load, we deal with anything above 35 miles an hour. So that being said, you know, it is a temporary for that aspect, and if we were under the understanding, be it for a weather watch or wherever we know, that there was this kind of wind coming in. I'm not just pulling that roof down, I'm taking care of every other thing that I got around here, including the vehicles, et cetera, boats, because 150-mile-an-hour wind, nothing's going to understand that. All right, so this is where I'm going to be clear that, you know, again, that's where my knowledge base is. And I'm happy to comply, you know, both Ms. Butts, Pearl Rogers, everyone that I've dealt with in the city up to now, right, has been very helpful in my planning stages, and I always am open to more suggestions as well, too, to be able to comply, let alone, you know, build something that makes sense. I have no quorum at all in rebuilding the structure, that I have something that I can cover myself, my family, that when I leave the house, like taking even today, for example, prior to coming here, I dropped my daughter off at dance, when we left the home, it was pouring rain. I didn't, even if I were to come out the main entrance to go to the vehicle, we all would have been wet. Yes, I'm sure umbrellas, et cetera, and I'm not the only person, obviously, that's dealing with this, however, for the convenience, and we'd go out the garage, and I don't get a single drop on me, and I go into the vehicle. And that, again, was part of my initial reasoning to put it up there while I would be able to construct around the house and make it a better living situation for all my family and myself. I'm also very much into the aesthetic pleasing for the neighborhood. I love plantation. I'm not originally from, but I also have a home in the acres where my kids and their mom live. And just, and I'm not just saying this for anything, but I just want to be clear that just traveling in plantation, you know, seeing the canopies of the trees, et cetera, I love that. I want to adhere to that, and my neighbors, majority of them, at least that I know of, you know, are understanding of where I'm doing and getting this house to be better. Those are actually older pictures. Those white walls are now down, and it's like, in fact, I have a picture here if you care to see it. The front entrance is definitely much more pleasing as well, too. And I mean, obviously, landscaping, whatever I need to do to make it look nice. I do not want to live with a sea container in my yard. I have plenty of them at my warehouse. That was just basically the house, some of the things that I could not put out yet until I finished the deck. But, and again, I had this conversation already with Magistrate Gold, and he understands, and so I have another month to pull that out of there. Is, that's under, Mr. Corman, as far as why I did it, or?

No, literally a utility easement, an area of land designated as an easement, because part of the comments is that no permanent structures can be located within a utility easement, so there's a utility easement out to six feet other side of that, like you can't, you can't even, you couldn't even build an extended structure there.

Good evening, gentlemen and ladies. Uh, my name is Jim Brigham. I live at 2041 Southwest 56th Avenue in Plantation Landings. I, uh, my house is next door to the one in question. I've proudly lived at that address in Plantation for 33 years. My first appearance before this group, I am not a troublemaker. But most, I am important, I'm very much in sync, being a long-time resident of the, the property values, insurance costs, appearance of our car, our beautiful community. I have three points to try to make to you guys. The first is, um, the negative appearance and impact on our neighborhood of a big brown tent put up in our cul-de-sac. It's so ugly. I'm sorry. Um, it really sticks out as a difference. If you look in our end of Southwest 56th Avenue, from there, from 16th Street, every house has a two-car garage. Most people, and I'm not sure, don't use it for their cars. It's a storage room or a extra bedroom. And, uh, that disturbs me a little bit. I, the house I bought, I bought from George Donald, who, uh, is, I don't know, some of you are, may remember George. He was the builder that built my house, this house, and 300 other houses in plantation landings. He built every, you know, home with a good front yard, a two-car garage, and all of a sudden, people are not using them. And that disturbs me. The second point I want to make is the issue of wind damage. You know, when I put in my garage door, uh, or a replacement, I had to go through hoops to, uh, with the, with the contractor to get the right code requirement, so that a hundred mile wind don't blow in my garage. We've been through ten hurricanes in my 33 years that affected plantation. I think that structure next door to me is a wind sail. Uh, I, I cannot imagine what would happen in a hundred mile an hour wind to that big tent. It'll, you know, it'll blow out. I don't know where it'll go. Mile direction, somebody else's direction. I don't know how you can get insurance on that. And, um, if this, uh, is, there's a waiver and we, uh, we decide all of a sudden you're going to get a lot of applications for people who want to add another 200 to 400 square feet into their home just by putting up a tent in front of the house to shade their cars. As far as rain and umbrella, that's what a garage is for, not a tent in front of your house.

So I want to register my strong objections to something that is a, um, violation of an existing code being put up in our neighborhood.
