life estate good if you want to come over and by the podium over there and proceed yes sir thank you uh michael williams code code officer for alachua county in code enforcement case uh 26-004928 the county received a complaint on 527 2026 regarding the property located at address 2020 northwest 57th terrace in gainesville florida here in alachua county identified by parcel number zero six three five three dash one five one zero one zero the owner of the property is turner flora life estate code administration initiate initiated an enforcement proceeding and found there to be a violation of the following sections of international property maintenance code 304.7 roofs and drainage a courtesy notice was sent to the respondent on 6926 with a compliance date of 7-31-26 subsequently a notice of violation notice of hearing was sent to the respondent uh by certified mail on 8-5-2026 in that notice corrective actions were included the respondent was given a compliance date of 10-31-2026 and it uh my last inspection of the property was conducted on 9-29 it wouldn't it was noted that the roof remains in violation i have good service of notice and statements of violation uh to respond to sent by certified mail copies of the copies have been provided to the magistrate and i request that they be entered into evidence i have had contact with the respondent uh regarding the violations the photographs being um the photographs uh that are being presented were taken by myself and accurately reflect the violations and i ask that they be admitted into evidence the county recommends that the respondent be given uh an additional 45 days in order to comply obtain all necessary permits and final inspections if uh compliance is not achieved then a fine of 75 dollars per day be imposed the county has incurred 140 in cost in bringing this action to hearing that was 140 dollars yes sir okay thank you okay could you tell me who you are in relation to the property my name is flora turn and i'm the owner okay and what's your address are you at that address yes okay so what can you tell me about well my house was damaged during the hurricane which was that helene which one i could speak both of them both of them okay but the first one is identify yourself i'm out for camps okay okay and uh i speak more during that time and during the hurricane and that's where we are at this point okay and so you know the county wants you to get the roof fixed basically and so the question is and it's not cheap i can tell you i haven't done it myself so so yeah so they're proposing to give you 45 days to be able to get and let me ask michael do you do they have to have the roof done or they have to have the permit and started work within permit and start at work so you don't have to what they're saying is get it started okay we're under contract with our insurance and we've been waiting and waiting for the insurance okay so i mean we're at the standpoint right now but the roof will be done and the house will be done but it's on their terms not ours okay and how long have you been fighting with these folks two years yes and then change to catch up there yes and then you know first part our insurance covered at 500 deductible but you know during the storm time it jumped to ten thousand six hundred three hundred and twenty dollars right uh which i have to pay but anyway we've been dealing with that with the contractor and i talked to mr parent our first uh uh agent she got sick and disappeared so she's not working at them but working with a different agent for the contract waiting on the contractor to come forward and start on the house it's the whole roof he's going to do the whole roof and all right yeah they wouldn't do a piecemeal they'd have to do right um now we have a new agent who is mr perry but i talked to him yesterday he said we need to talk to him or anything we need from him so we're just waiting on the contractor just to call us back and just get started okay so how's the county feel if i give them 90 days since they're dealing with the insurance company and they're waiting okay pardon uh are you related to the case no i am related and what's your relationship the neighbor does the county want to call him as a witness or not we understand that um the complainant is is here but um um the county is not we don't really feel like uh additional testimony is is is really required we understand that they are in in violation they indicated that they are in process of um bringing some resolution to the situation but um short of a long story is is this um the county would just like to give them the um ample time to um remedy the roof and if it's not remedied then then of course you know the fines would start um accruing and then a lien would be assessed you know if the fines are not paid but um uh do the respondents have any any documents that that that they could uh present yeah we all we have all our documents uh from the insurance company and the contractor when the work is going to be started and what's going to be processed as far as that if the court needs that i got all pictures we don't have anything as far as property going anybody yard they came to property cover this and covered our back that they covered the whole roof and everything so there's nothing as far as in our yard it's me taking this communicate with anybody uh that part of that kind of thing so we don't have anything and uh mr wheel has been great and the kasha came by the first time and looked at everything and so we didn't have not a lot that we need to clean up as far as anything damaging about the property it's been property covered it's nothing running so that's where we are but it will be done okay um i don't want to take your documents because if you want to put them in the record we need to get copies so we can make arrangements with you to get copies of that since the county would like to see some evidence of of you know that you're going forward at this point i'm not going to let you testify because i don't think that there's anything that they've acknowledged the county's found a violation they're trying to get it fixed the whole story is maybe somewhat biased uh all right i'm going to stop i'm going to stop you there because it's not on you're not identified as a witness yet and stuff you're not on the record so um because you're not a microphone um how's the county feel about letting him testify it's on two years since saline yeah yes okay so i'm not going to let you testify it has no bearing on what i'm going to do because i you know the county has shown that there is a violation they've acknowledged it they were getting ready to remedy it they're waiting on their insurance company which unfortunately 90 of people in florida who have hurricane damage have to deal with um so i appreciate you being here but i'm very very disappointed understood thank you for being here um so much so we'll let you uh we'll like get with the county let you get some copies of that okay thank you thank you perfect yes sir thank you for coming thank you so much i think we can go back to the beginning okay i saw kelly come back so go ahead and recall case number two please case number two six dash zero zero six two six nine alachua county versus griffin kenneth michael mr griffin thank you for being patient we had miscommunication there about whether your case was going to be heard today or not so kelly are you prepared yes okay we proceed case two six zero zero six two six nine county received a complaint on uh august 9th regarding um landscaping is overgrown and junk and debris throughout the property property owner is uh kenneth michael griff griffin code administration initiated enforcement proceedings and found there to be a violation of the following sections of alachua county code seven four point two zero a accumulation of junk and the seven four point three six nuisance overgrowth which is a landscaping the respondent was provided a reasonable time to correct the violations the notice of violation was sent to the respondent that included corrective actions ongoing inspections conducted to date have determined the respondent remains in violation of set alachua county code section my last inspection of the property was september 30th i have good service of notices and statements of violation to the respondent which sent by certified mail receipt or postings copies have been provided to the magistrate and i request to be entered into evidence i have had contact with the respondent regarding the violations which was by email photographs being presented were taken by myself and accurately reflect the violations and asked they be admitted to evidence county recommendation is a respondent to be found a violation of said sections of the code order respondent to come into compliance within 30 days by complying with the corrective actions listed in those violations the fines will be accruing at the amount of 75 days of 75 dollars sorry for the accumulation of junk and also 50 dollars per day for the nuisance overgrowth they will continue and accrue separately until in compliance county has incurred 350 in cost in bringing the action hearing anything else no mr griffin please state your name for the record if you would canis michael griffin okay and you're the owner of the property yes sir so what can you tell me uh there's a need for clarification on on several things one from my knowledge and others for uh the uh maintenance clients um i have no receipt of any certified notification um when i did receive notification i found this on the side of the road next to where i put my garbage pickup on september 17th yeah the state the state statute allows certified mail and posting which they said yeah i understand that i'm just saying this is technically my first knowledge right september 17th um i have the accumulated emails and that's mainly to illustrate the difficulty in contacting someone to discuss this um i don't deny any of it it that's kind of uh interesting how the camera sees it but uh for the clarification part i wasn't able to decipher correctly what the overgrowth issue is because they mentioned something about native species and my property is native florida flatwoods so i don't know what is exempt from that code um as for the junk that's undeniable i have been in the process of removing that um unfortunately i have overestimated my ability to do physical labor so it's taking longer than anticipated so how long would you think it would take in terms of the junk to for you to achieve compliance um for the junk portion of it i'm hoping and i want a reasonable time because what i don't want you to do is have to come back for violation and you know and so you know if you're making progress and i'll ask michael about but you know how much time do you think you need to reasonably uh without having the need to come back maybe a month and they're asking for 30 days right now anyway so does the county have an objection on the junk for 45 days just no your honor you know so so i'm willing to give you 45 days on the junk side of it okay to come if you come into compliance with that you immediately contact the county and let them know it doesn't you don't have to wait to the 45th day right all right now as to the nuisance growth um let me ask um kelly has this florida friendly landscaping been raised at all in this no they have not your honor and the respondent never indicated that okay so it sounds to me like we maybe need to get somebody from the florida friendly landscaping group and i know epd has that ability to to visit with him and talk about you know what you could leave as florida friendly landscaping there's a statute called florida friendly landscaping right that's the part i didn't understand yeah and so it has specific but the nuisance grover growth also if it's not something that's a native then it's going to be a height restriction basically you know exactly material come down so it sounds to me like we need to have maybe somebody come out and actually talk with him and show him what he can state leave and what it needs to come down you comfortable with that yes your honor we will request that okay so i'm going to give that 30 days and that should be plenty of time i think to have the county come out work with you and find them what you can leave and what you would need to do so and then 45 days on the junk okay okay so are you comfortable with that i think hopefully now you know if something happens but i don't think we're going to get a hurricane and so waste waste things are going um but if something happens to you health-wise or you know we get a storm and something creates a problem um let the county know don't lay it running up against the deadline and then say i can't so can you stay in contact with kelly okay appreciate your help okay a couple notes here and okay let's go on to case number three case number two six dash is zero zero five four zero form elato county versus curry willie l is someone here representing mr curry thank you please come over by the podium excuse me when you're ready case two six zero zero five four zero four county received a complaint on june 10th regarding um parking a recreational vehicle property is located at 2100 southeast 51st street gainesville in lateral county identified by parcel number one six one eight six zero four one zero zero zero owner of the property is william curry code administration initiated enforcement proceedings and found there to be a violation of the following sections of a lateral county code four zero four point eight two point five parking of trucks recreational vehicles and trailers the respondent was provided a reasonable time to correct the violations notice violation was sent to the respondent that included corrective actions ongoing inspections conducted to date have determined the respondent remains in violation of the set a logical county code section my last inspection on the property was september 30th i have good service of notices and statements of violation to the respondent sent by certified mail receipt or postings copies have provided to the magistrate and i request to be entered into evidence i have had contact with the respondent regarding the violations last conversation was on september 10th photographs being presented were taken by myself and actively reflect the violations that have to be admitted to evidence county recommendation is respond to be found a violation of the said section of the code order respondent come into compliance within 30 days by complying with the corrective actions listed in those regulations fines will continue to accrue at 75 per day until in compliance county has incurred 350 dollars in cost and bringing the action to hearing and i did want to let you know your honor the as far as parking of the trucks recreational vehicles and trailers there's setbacks on both sides of the property away from your neighbor and so i have verification from zoning that he is um in within his setback so that part of it the parking part of it is fine he just needs to close the push outs on the pop outs yeah yes your honor because it needs to be road worthy okay so other than that he's in compliance okay so that's the only thing that you're really looking at at this point is to bring in the slides yes and he mentioned he has problems with the slides he's going to get them i'm very familiar with that problem so okay go ahead identify yourself for the record please willy curry thank you for being here sir um you're you have the rv yes i own the rv i have a brother who has constant problems with the slides so i'm familiar with yes yes yes so what they're saying is if you can put the right then you're in compliance so i've actually got the front like i got pictures i took this morning where i had my mechanic come out he's been working on it actually for a few months now um we got the parts needed to get the front slides closed so they're actually closed i closed them this morning so i got pictures here um that i took this morning and the rear slide we can't get it to close all the way so that right now that's the only issue right now is the um the real one okay um well the county's giving you 30 days to get them on do you think you could do that with your mechanic by that time well he told me that he's having a hard time because it's an older rv sure and there's a certain part that he needs um and i got his information here too but he said to let you guys know that he's um in the process of trying to find like a used part that's needed to close that um rear um slide so how far is it sticking out and i got the measurements i got yeah two measurements everything i didn't realize that the measurements was okay i went and took a lot of measurements it's about two feet out two feet out okay it's two feet because it was a few inches i don't think we would be equivalent about that so it's almost two feet a little under two feet okay so yeah but um so do you tell me time was because we don't want you to write the money so i said that um and they're saying 30 days but it sounds like you know he sounds gonna have to get a part off the ebay yeah i would is it possible to get 60 days maybe so yeah just please stay in touch with her oh yeah if you're making progress and it sounds like you are um so yeah so if the part comes in let her know you got it and that they're working on it so i'm comfortable the county's comfort so we'll give you 60 days now i do have a question so i want to make sure that so am i incurring fines right this second right no if you don't come come in compliance within 60 days okay the fines will start okay okay until then if you get it into compliance and as soon as you did as i heard earlier tell her as soon as you got out of compliance because that immediately stops it once they can come out and confirm that you're in compliance because it's a minor issue in in a sense that as soon as you get that slide in give them a shout okay okay all right that works good thank you for coming okay so i guess now let's go on to case number four case number two six dash zero zero five six four eight alantua county versus neil ruby heirs is someone here representing the heirs of neil ruby someone representing the heirs seeing none county please proceed case two six zero zero five six four eight county received a complaint on june 16th regarding abandoned vehicles in yard old trailer with blue chart and someone running a generator property is located at 2329 southeast 45th terrace gainesville in alachua county identified by parcel number one six one eight nine zero zero two zero three one owner of the property is neil ruby heirs code administrative administration initiated enforcement proceedings and found there to be a violation of the following sections of alachua county code four zero four point eight two point five parking and trucks recreational vehicles and trailers and seven four point two zero b on service of vehicles the respondent was provided a reasonable time to correct the violations notice the violation was sent to the respondent that included corrective actions ongoing inspections conducted to date have determined the respondent remains of violations said alachua county code section my last inspection of the property was september 30th i have good service of notices and statements of violation to the respondent sent by certified mail receipt or postings copies have provided to the magistrate and the request to be entered into evidence i've had no contact with the respondent regarding violations photographs being presented were taken by myself and act to reflect violations and asked to be admitted in evidence county recommendation is to respond to be found a violation of the said section of the code order responded coming to compliance within 30 days by complying the corrective actions listed in those violations fines of 75 per day for parking and trucks recreational vehicles and trailers and 50 per day for unservice of service of vehicles fines will continue accrue per day for each violation until in compliance county has incurred 350 in cost and bringing the action to hearing okay again someone here representing the heirs see men let's go on i believe now we're going on to case number six yes case number two six dash zero zero zero six six two five and that is okay that's uh mr brandon beerman i'm sorry okay someone here oh thank you all right yeah it's coming up it takes a little while there you go okay ready good morning i am officer lonte biggman code officer for alachua county in code enforcement case two six zero zero six six two five the county received a complaint on july 15th 2026 at the property located at address one two one seven southwest 76 drive parcel number zero six six six eight zero two zero zero two three code administration initiated an enforcement proceeding and found there to be a violation of the following sections of alachua county code of ordinances seventy four point three six nuisance overgrowth the respondent was provided a reasonable time to correct the violations a notice of violations was sent to responded that included corrective actions ongoing inspections conducted to date have determined that respondent remains in violation of the said section of the county code my last inspection of the property was on september 29th i have good service of notices and statements of violations to respondent sent by certified mail receipt or posting copies have been provided to the magistrate and i request they be entered into evidence there has been no contact with the owner i did attempt to reach them by knocking on the door on september 18th when i posted a notice of hearing but there was no answer the photographs being presented were taken by myself and accurately reflect the violations and as they be admitted into evidence so i will like to note that these photos is of the cul-de-sac where that property lies as you see it is not meeting the requirements of that the residential outlook of the neighborhood all his neighbors grass is cut you can see they have their shrubbery uh beautifully manicured so he is the only property on that street that looks the way that it does the county recommends the respondent be found in violation of the said sections of the code or the respondent to come into compliance within 14 days by complying with the corrective actions listed in notice of violation if not complied then pay a fine in amount of 125 for each day the violations continue past the date set for compliance the county has incurred 420 cost and bringing this action to hearing okay anything else no sir okay please state your name for the record brandon beerman and what can you tell me um so i do actually have photos of my current cut yard if you want to see them sure if we have an overhead projector here if you would like to put them up so yes these this is reflective of the photos that i've been taking over the past few months so they're not coming up on the screen oh yeah he just switched it he just switched oh okay yes so these pictures were taken today this morning this morning okay all righty well so go ahead and speak to them so um i do acknowledge that a lot of the issue was lack of communication my household just pretty much all works nights so most of us are going to bed around seven eight in the morning um which the original posting we did trim cut the yard but one of my roommates is very particular about like natural flowers and stuff like that so we did leave like flowers and stuff along the back which i think that's part of the reason why we were still in violation so we clear cut those and i took the photos so my my question is is this again another florida friendly landscape issue in terms of you know if it's got flowers and stuff that they've left the only section i could say like yeah i do understand that this could be considered florida friendly landscaping but um with the bushes and the shrubbery they do have to maintain those and manicure them because as you see my previous photos it was tremendously large and overgrown into the neighbor's property um another issue with nuisance overgrowth it calls it can cause bugs critters onto your property which can increase on your neighbor's property so as long as you all um just keep it cut once a month and just please don't allow it to get as bad as it was i don't see me coming back out and giving you guys any more notification um i mean i will definitely admit that although a lot of it is native and stuff my yard was very overgrown so like i feel like even i appreciate your honesty play i really do yeah but but there is but i would recommend that you get in touch with especially your roommate who is very interested in this get in touch with florida friendly landscaping folks because they can give you guidance on how to do it and how to maintain it so that it benefits the native plants but also kind of stays in compliance with the county code um and they're it doesn't cost anything they're more than glad to work with you but ifas extension which is the state extension office has florida friendly program as well as epd here at the county does florida friendly work as well too so i would encourage your roommate to have him come out and work with you so are you comfortable he's in compliance now or oh yes sir he's in compliance now and i do understand right with the work so you can issue a notice of compliance yes i can issue that today basically i'm not going to issue an order because they're finding you in compliance based on your testimony okay but so it doesn't crop up again have your roommate or folks get in touch with florida friendly and they can give you a schedule and tell you what to leave and what not to leave and it'll also help you with your neighbors as well if they understand it because you can get a florida friendly landscape sign as well too okay okay thank you so much thank you for being here um thank you guys sure i'm sorry to make you get up this early in the morning i think that's all the cases that we have for new business right so this you want to call penalty hearing let me read a statement here first excuse me non-compliance hearings are strictly to evaluate if an order has been created by the special magistrate has been followed or not been followed i will not rehear the case as the special magistrate has no authority to revisit its previous action the policy for conducting a non-compliance hearing is as follows determine if a respondent is in compliance or not in compliance give the county and respondents an opportunity to speak on the compliance or non-compliance and make a decision regarding compliance or non-compliance and if found in non-compliance replacement of a lien so call the case and penalty hearing please case number two six dash zero zero zero eight zero three alachua county versus manning geneva airs is someone here representing the airs would you want to come over by the podium there please kelly please proceed case two six zero zero zero eight zero three manning geneva airs property location is six one one seven southeast 215th street in hawthorne property is guilty but in compliance so the total fines are one thousand five hundred and fifty and the county would like to request a lien be placed okay so please identify yourself for the record in relationship to the property i'm the hairs of the property there are manning there are manning okay i'm one of the legal hairs of the property okay all right so the county says you're in compliance you paid the prosecution costs if i understand according to my record so they're asking for a lien for the fines which are total of i believe five one thousand five hundred fifty dollars are outstanding right now um one of the procedures we have is that you have the ability to come back in and seek a reduction of the fine based on the county's code and requirements and we don't have one today for you to see but typically it's writing to the camp here to come before me and ask for a reduction of the fines but right now what the county is saying is that they would like a lien placed because the fines have not been paid and so that lien would go against the property until it was either paid off or you come in and ask for reduction and i and if i granted a reduction i could reduce it as well can we make one statement the guy that's on the property don't even want us on the property say again we have a cousin supposedly living on the property and he threatened to get off his property and stuff oh so you have somebody who's just he's a squatter oh you have a squad well there is a statute and the state has the ability for you to have squatters removed uh that's what i'm in process of doing not getting him evicted i have a margin meeting on the uh okay so well the only issue here is payment of the fine and so the squatter and stuff so you know um you have the ability uh because i'm going to grant the lien request um but you have the ability to pay that fine down and once the fine is paid off the lien is removed or you can ask for a reduction that if there were circumstances that prevented you from being able to do the work that somebody passed away there was insufficient funds things like that come up um you can so you have two paths pay the fine or you can seek a reduction and whatever it reduced to if it's reduced then you could pay that amount and the go the lien would go away it's not going to affect it's not going to affect the lien is not going to affect your ability to use the property in any way we're not using he's saying it's his property he said for us to get off of his property understood but that's not what's here before us today what's here before today is the is the fine that accumulated right before it came into compliance and that's the only thing that's here today so basically what he's saying is once you have that eviction done you can ask to come back before him for a reduction or pay the fines or they could just pay the fine while he's there when you come back use that as um something to tell the magistrate you had to evict the person from the property that's what he's trying to explain to you yeah that would come into play when you ask for your reduction so i'm assuming that the reason we wouldn't bring in compliance was because we had the squatter and it was creating difficulties is that correct yes okay all right yeah so that's clearly grounds for seeking reduction um if you had somebody who squatted it caused a problem for the property okay okay so so at this point you don't have to do anything as soon as you get the squatter off then you can come in and ask for a reduction it's simply writing a letter to to the address you have there and asking for that reduction and then you would come back before me and we would hear your case and in most cases we grant a substantial reduction if there's good cause yeah we're comfortable with that yes okay thank you for coming i appreciate it yeah thank you for all your work sir appreciate it yeah and i'm sorry to have the issue of you but there is a substantial squatter statute now that allows you to to have them removed are there any other cases all right i'll close this hearing it call at 9 50.
