[8:05] Good morning, Chairman Crawford, Ranking Member Himes, members. [8:09] I'm here today to present the 2026 Annual Threat Assessment [8:12] and joined by my colleagues, the directors of the CIA, the DIA, FBI, and NSA. [8:19] This briefing is being provided in accordance. [8:21] With ODNI's statutory responsibility, what I'm briefing here today does not represent my personal views or opinions, [8:28] but rather the assessments of the intelligence community, [8:32] of the threats that facing the United States, our homeland and our interests. [8:37] In this assessment, we're following the structure of priorities that were laid out in the president's national security strategy, [8:43] starting with threats to our homeland and then shifting to global risks. [8:48] The defense of our homeland is of the utmost importance to the American people. [8:51] And efforts by the CIA and the FBI to protect our homeland from surprised threats. [8:52] This is a matter of course. [8:53] We're here today to present the 2026 Annual Threat Assessment. [8:53] I'm here today to present the 2026 Annual Threat Assessment. [8:53] over the last year to bolster homeland defense have yielded significantly positive results. [9:00] For example, the strict enforcement of U.S. policies at the U.S.-Mexico border and regionally [9:05] have served as a deterrent and drastically reduced illegal immigration. Based on Customs [9:11] and Border Patrol data, January 2026's monthly encounters are down 83.8 percent compared to [9:18] January of 2025. The drivers of migration are likely to continue. Potential worsening [9:25] instability in countries like Cuba and Haiti risk triggering migration surges. Smugglers who often [9:31] operate as transnational criminal organizations view chaos as an opportunity for profit and will [9:37] likely continue to profit from these illegal immigration flows. These TCOs continue to pose [9:44] a daily and direct threat to the health and safety of millions of U.S. citizens, primarily by producing [9:49] and transporting illegal immigrants. The U.S. government has been working hard to ensure that [9:50] these U.S. citizens are protected from trafficking and illegal drugs. Under President Trump's [9:53] leadership, fentanyl overdose deaths have seen a 30 percent decrease from September of 2024 to [9:58] September of 2025. His aggressive efforts to more directly and actively target these [10:04] transnational criminal organizations and reduce the inflow of fentanyl precursors has already had [10:10] a significant impact, which is likely to continue. Mexico-based transnational criminal organizations [10:17] like the Sinaloa Cartel and Jalisco New Generation Cartel dominate the production [10:21] and smuggling of fentanyl, heroin, methamphetamine, and cocaine into the United States. [10:26] Colombia-based TCOs and illegal armed groups like the Revolutionary Armed Forces of Colombia and [10:33] the National Liberation Army are responsible for producing and trafficking large volumes of cocaine [10:38] into the U.S. and European markets, with some indicators that they are now attempting to expand [10:43] to the Asia-Pacific region. Colombia remains the world's largest producer of cocaine, and [10:49] Colombian criminal groups have expanded their trafficking relationships with the U.S. and the [10:52] U.S. with neighboring Ecuadorian and Brazilian gangs. [10:55] MS-13 is well-established in cells in the United States and uses violence to intimidate the [11:02] Salvadoran diaspora, engaging in murder, extortion, retail drug trafficking, firearms offenses, [11:08] and prostitution, fueling increased violence and instability. These and other TCOs present [11:15] a very tangible and individualized risk of violent crime to everyday Americans and contribute to [11:20] regional instability. As the president increases counter-drug and counter-carcinogens, [11:24] cartel pressures, they are likely to seek ways to try to adapt their operations, [11:29] including shifting and decentralizing production locations and trafficking routes and methods. [11:35] The United States continues to face a complex and evolving threat landscape with a geographically [11:41] diverse set of Islamist terrorist actors seeking to propagate their ideology globally and harm [11:47] Americans, even as Al-Qaeda and ISIS organizationally remain weaker today than they [11:53] were at their respective peaks. The U.S. and Colombia-based TCOs and U.S. and African-American [11:57] terrorist organizations are also facing a massive threat to Islamism. The spread of [11:58] Islamist ideology in some cases, led by individuals and organizations associated with the Muslim [12:02] Brotherhood, pose a fundamental threat to freedom and foundational principles that [12:06] underpin Western civilization. These Islamist groups and individuals use this ideology for [12:12] recruiting and financial support for terrorist groups and individuals around the world and [12:17] to advance their political objectives of establishing an Islamist caliphate which governs based [12:22] on Sharia. There are increasing examples of this in various European countries. President [12:28] Donald Trump's designation of certain chapters of the Muslim Brotherhood as foreign terrorist [12:32] organizations is a mechanism to secure Americans against this threat. In response to setbacks [12:39] of their capabilities of conducting large-scale, complex attacks, the IC assesses that Islamist [12:44] terrorist groups have shifted towards focusing on executing information operations to spread [12:49] propaganda and inspire or enable individuals located in or with access to the West. [12:56] U.S. counterterrorism operations are ongoing, primarily in Iraq, Syria, and Syria. The U.S. [12:59] and the U.S. have been working closely with the U.S. and the U.S. in their efforts to [13:00] stop terrorist attacks on Iraq, Somalia, Yemen, and Syria, and have removed key terrorist [13:04] leaders and operatives, degrading the ability of al-Qaeda and ISIS to quickly reconstitute [13:09] its leadership and launch large-scale attacks against the homeland. Strict U.S. border enforcement [13:15] measures and increased deportations of individuals with suspected links to Islamist terrorists [13:20] have reduced access to the homeland and removed some potential sources of future terror attacks. [13:27] Since January, U.S. officials have only had a handful of encounters at our borders with [13:31] individuals associated with terrorist groups and militants. The U.S. and the U.S. have [13:32] also received reports, trzecijds as effective terrorist attack groups inside Iraq in Iraq [13:33] and Syria. This is a positive trend, however, our inter-agency coordinated efforts to identify, [13:39] locate and remove known or suspected terrorists who are already in the U.S. continues with [13:44] vigilance. Shifting to the Arctic, the ICSS is that Russia and to a lesser extent China aim [17:49] to strengthen their presence in the region through increased maritime trade, natural resource [17:53] extraction, and military activity. Russia, which has the longest coastline in the Arctic, has long [17:59] sought recognition of its quote-unquote polar great power status and is deploying more military [18:05] forces and building new permanent infrastructure. China, though not an Arctic country, is engaged in [18:12] more limited efforts in the region to advance its strategic and economic interests. On the [18:17] technology front, artificial intelligence capabilities are rapidly advancing and changing [18:22] the threat landscape. As this is a defining technology that enables computers and machines [18:27] to simulate human learning, comprehension, problem solving, creativity, and autonomy, [18:33] it'll be critical to ensure that humans remain in control of how AI is used and of the machines [18:38] that may threaten to autonomously violate the interests of the American people across all [18:42] domains. [18:44] The ICSS is that China is the most capable competitor in this field and aims to displace [18:50] the U.S. as the global AI leader by 2030. AI adoption at scale across the spectrum of usage [18:56] poses serious risks. AI has the potential to aid in weapons and systems design and has been used [19:03] in recent conflicts to influence targeting and streamline decision making, underscoring the risk [19:08] and likely threats that could manifest on the battlefield. Early developers in quantum computers [19:14] will give countries an extraordinary advantage over the future. The ICSS is that China is the most capable [19:16] in terms of security, technology, technological advantage over others to quickly process national [19:21] security information and break current encryption methodology used to protect sensitive finance, [19:27] healthcare, and government information. The global security landscape is volatile and complex, [19:33] with armed conflict growing more common and posing potential threats against U.S. interests. [19:40] The space domain is becoming increasingly contested, [19:43] with China and Russia developing counter space capabilities to challenge U.S. space efforts. [19:48] The threat of nuclear proliferation and advancing chemical and biological warfare capabilities continues to grow. [19:55] Turn now to the Western Hemisphere, where flagging economies, high crime rates, [19:59] pervasive organized crime, migration flows, corruption, narcotics, trafficking, [20:04] present a broad spectrum of risks to U.S. interests, [20:06] and where strategic competitors seek to gain greater influence in the region. [20:13] The ICSS says that Latin America and the Caribbean almost certainly will see hot spots of volatility in the coming year, [20:18] with the potential to undermine or distract some countries from improving economies and living conditions [20:25] and tackling illicit drug flows and cartels. [20:30] The U.S.-Mexico-Canada Agreement review in 2026 will likely increase uncertainty in many Latin American countries, [20:36] especially those that rely on Mexico as an export destination for intermediate goods for manufacture and onward export to the U.S. [20:44] China, Russia, and Iran are seeking to sustain economic, political, and military engagement [20:51] with Latin America. [20:53] The ICSS says that China's demand for raw materials is likely to drive continued economic outreach, [20:59] while Russia likely wants to expand its current security and diplomatic ties with Cuba and Nicaragua. [21:05] The ICSS says that China aims to elevate its own political, economic, military, and technological power [21:12] to increase its own regional positioning, global influence, and to fend off threats to their interests. increased the intensity of their attacks against local security forces expanding [27:25] their areas of operation and moving closer to cities with the u.s presence african governments [27:32] will use their wealth and critical minerals to seek partnerships that deliver them meaningful [27:36] benefit concurrent conflicts and crises across the continent will continue to put u.s [27:41] citizens at risk and cause further instability [27:46] closing as leaders of the intelligence community we remain committed to providing the president [27:51] and policy makers with timely unbiased relevant intelligence to ensure the safety security and [27:57] freedom of the american people thank you thank you for your comments director gabbard we appreciate [28:03] that we'll now move to member questions five minute increments with that i recognize myself [28:09] for five minutes um director patel our state and local officials are on the front lines of [28:14] increasingly dangerous unrestricted warfare activities being undertaken by [28:18] militants in tony's national such as marijuana grow operations protected by armed militants [28:23] secret police stations engaged in transnational repression chinese operated sim farm sites [28:29] crypto mining facilities and land purchases near strategic locations the ccp is exploiting legal [28:34] gray areas and the lack of awareness at the state and local level to establish strategic footholds [28:40] two states in fact new hampshire and florida are now advancing legislation to establish offices of [28:45] counterintelligence which would bolster [28:48] foreign adversaries without relying on the federal government. Do you support that? What can be done [28:52] to better support the states and local officials? Absolutely. Thank you, Mr. Chairman. So we have [28:59] infused funding into our entire program, taking on the CCP. And while we are well-versed in the [29:07] fact that we have our capabilities with folks like CFIUS when it comes to the purchases of land [29:12] around military bases, that only extends one mile under the current law. So the FBI had to get [29:17] creative. So what we did was directly engage with our state and local partners. And I'll give you [29:21] two examples. A 400-acre farm in the state of Texas was owned by a CCP official. But because [29:27] he was outside the reach of the CFIUS law, the FBI executed an unlawful possession of firearms, [29:33] a criminal complaint, and received it. We seized the land in its entirety. And that CCP national [29:40] is back in mainland China, and we are working to get him back here. In another example, off the [29:44] coast of Louisiana, we worked with Governor Landry's team. [29:47] On drilling sites off the coast of Louisiana, because again, they were outside the whole of [29:51] CFIUS in the one-mile radius. And with the intelligence we were able to provide our state [29:55] and local authorities, they shut down that CCP drilling center, which we believe was actually [30:01] used to provide and steal data and intelligence from American lives. So that's just a little bit [30:04] of an example. On the marijuana grow houses, we have six active ongoing investigations in six [30:09] multiple jurisdictions for specifically taking down CCP-affiliated grow houses from Maine to [30:14] Georgia and across the country. So it sounds like, [30:17] from your characterization of CFIUS, it's inadequate at this point. Maybe we could [30:20] do something legislatively here in this body to provide some broader authority to address [30:24] that challenge? I would love that. [30:26] Okay, great. Excellent. Thank you. Director Ratcliffe, in January 2021, in your role at DNI [30:32] as the director, you sent this committee a letter outlining your concerns about an intelligence [30:36] community assessment in which, among other things, analysts tailored their analysis towards a [30:41] preferred policy outcome. CIA management pressured analysts to withdraw their support from an [30:46] alternative viewpoint. [30:47] And the full body of intelligence reporting wasn't considered. Now in your role as CIA director, [30:52] you have retracted several reports for political bias and not meeting IC analytic standards. [30:57] That's good progress. Retracting faulty reporting is a critical step, but I remain concerned about [31:02] that it maybe doesn't get to the root of the problem. How many analysts were involved in [31:05] the products you recently retracted? I don't know the specific number, Chairman. [31:14] What remediation actions have taken place as a result? Well, I made the focus of, as you pointed [31:20] out, both as DNI, and now as CIA director, focused on the importance of analytic objectivity. [31:30] As you pointed out, when I was the DNI, when I saw conduct from Russia and China, [31:37] the exact same conduct, result in different assessments, [31:41] that's not a good reflection on the analytic judgments. What you referenced in my role as CIA [31:48] director, [31:51] that we went back and looked that didn't reflect the analytic standards that we would expect, [31:57] I retracted those judgments because they show bias and influence for political reasons or otherwise. [32:04] So that has continued to be a focus and will be. I think that that message has been received within [32:11] our analytic community, within the CIA and really across the CIA, because this administration [32:17] has put a focus on taking politics out of our analytic judgments. [32:21] Excellent. Thank you, Director. Appreciate that. I want to, as I made clear in my opening [32:26] statement, I'm just trying to get this done in the little time that I have remaining, [32:30] the Intelligence Community Assessment on AHI is deeply flawed and I've called for its recall [32:35] immediately to start for a fresh start. Similar to my question in last year's session, but I'd like [32:43] to get a yes or no answer from each of you on whether you agree this ICA should be retracted. [32:47] Director Gabbard? [32:48] Yes. [32:49] Director Ratcliffe? [32:50] The, say it again. [32:53] AHI, ICA? [32:55] Yeah. So for the ICA, I understand that Director Gabbard is reviewing that and I've deferred [33:03] all AHI investigations to her review. Director Gabbard, as was well covered yesterday in January, [33:34] you were present at the execution of an FBI warrant at the Fulton County, Georgia election [33:38] office at the direction of the president and to all appearances in connection with the president's [33:44] false claims about the 2020 election. The unsealed affidavit submitted by the FBI made zero reference [33:50] to foreign powers or outsourcing. [33:51] So that's why I'm here today to ask you to clarify, what was the reason? [33:54] And I'll go back to you, Dr. Adams. [33:55] I'm not sure if it's foreign powers or outside interference. I don't want to [33:59] relitigate the reasons why you were there, but I do want to know whether as a result of your visit, [34:04] there is credible intelligence in your possession pointing to foreign interference in Georgia, [34:10] in the 2020 election. [34:11] Thank you for the question, ranking member. As you know, over each of the previous elections, [34:18] there is an ongoing effort by different foreign entities. [34:20] Ma'am, it's a very specific question. [34:22] Is there intelligence in your possession relative to foreign interference in the 2020 election? [34:22] interference in the 2020 elections? Very simple, straightforward question. We are continuing to [34:27] look at previous attempts to interfere in our elections and any ongoing threats that may exist [34:31] for the upcoming elections. Okay, but can I assume that the answer to my question is no, [34:37] that you have no specific intelligence related to foreign meddling in the Georgia election? [34:42] We are continuing to look into this matter. Okay. Director, the ODNI has confirmed on the record [34:50] that your office took custody of voting machines from Puerto Rico last May. I'm not aware of any [34:58] previous DNI taking similar actions. Did your office promptly notify the committee about taking [35:04] custody of Puerto Rico's voting machines? I don't believe we did. However, this was done at the [35:12] request of the Puerto Rico AUSA attorney. And it's a yes or no question. The answer, as you have [35:17] acknowledged, is no, you did not inform the committee about the taking of a territory's [35:21] voting machines. I don't believe we did. However, this was done at the request of the Puerto Rico [35:22] voting machines. Is there a specific foreign threat? And I've read the reporting that you [35:26] were looking for possible foreign threats, but is there a specific foreign threat that drove you to [35:30] take this action? There were questions about whether or not there were vulnerabilities that [35:35] a threat could have taken advantage of, and that was the purpose for their requesting us to look [35:40] into those vulnerabilities. Where are those voting machines now? I believe they are held in a secure [35:46] facility at ODNI. Have you or other ODNI officials taken any other state or territories, [35:54] including Puerto Rico, to take control of those voting machines? Not to my knowledge. [35:59] I want to turn, on the subject of elections, to a paradoxical thing. You will all be aware that the [36:04] U.S. government is apparently going to grind to a halt. The president is going to sign no more bills. [36:10] The Senate will spend two weeks, apparently, debating the SAVE Act. The SAVE Act, of course, [36:15] would make illegal foreigners voting in U.S. elections, which is already illegal. So we are [36:21] to do no more business because of, apparently, the existential threat to our democracy, which is to [36:25] our democracy associated with foreigners voting in our elections. I am therefore puzzled by the [36:31] fact that neither the unclassified nor the classified threat assessment makes any reference [36:37] to risk or danger associated with foreigners voting in our elections. Director Patel, [36:44] how many non-citizens have been convicted of voting in U.S. elections in the last 10 years? [36:51] The conviction stats are with the Department of Justice. I defer to them on that. [36:55] You are the director of the FBI. Give me a guess. How many convictions in the last one year, [37:02] five year, or 10 year? Ballpark. I don't have that with me, sir. Again, it's with the department. [37:06] You don't have that. Okay. Director Patel, how many active investigations does the FBI [37:12] have into foreign individuals voting in U.S. elections? We have a number of investigations, [37:22] generally speaking, ongoing about individuals across the country. [37:27] Yeah. [37:27] I'm out. [37:27] I'm asking for that number. [37:28] I don't have that number with me, but I have a number of them. [37:31] You have a number of investigations. Okay. Is that number 10,000? Is it closer to 10,000 or [37:38] closer to 10? Director Patel, since you don't have the numbers, would it surprise you to know [37:51] that the Heritage Foundation, which is not exactly the Columbia University Faculty Lounge, [37:58] found only 77 instances of non-citizens voting in U.S. elections? Do you have a number of instances of non-citizen voting in the 24 years between [38:04] 1999 and 2023, each of which faced investigation by the appropriate authorities? So Heritage [38:10] has a number of 77 examples in 24 years. Does that number surprise you? [38:17] No, because it's low. [38:20] I don't understand your answer. [38:22] You asked me if I was surprised by the number or not. [38:24] Are you disputing that the number is in the range of 77 examples of non-U.S. citizens [38:29] voting in U.S. elections in a 24-year period? [38:32] I just said that number is low. So why, if this is a meaningful issue, do we have [38:40] no, and I guess I direct this to Director Gabbard, why is there no mention of this thing [38:44] that will grind the American government to a halt for a two-week period in the worldwide [38:48] threats analysis? [38:50] This annual threat assessment was shaped around the national security strategy's prioritization [38:57] of threats to our nation and our nation's interests. There are multiple platforms and [39:02] venues. [39:03] There have been and there will be reporting on threats to our, foreign threats to our [39:08] elections. [39:10] I yield back. [39:12] I'd first just like to say, Director Gabbard, you being in Georgia was a part of your duties [39:21] as DNI to make sure that our elections remain safe, secure and free from every type of influence. [39:28] That was why you were there, is that correct? [39:32] Yes. [39:34] Okay. [39:35] I would argue, I want to talk about some of the points about the strikes. [39:37] The strikes on Iran, the current attacks, epic fury, and I would state that not only [39:44] are there imminent threats from Iran, but there are actual threats. [39:48] And I've been on the receiving end of those threats. [39:50] I was in Iraq in 2005, where Iranian-based and manned and equipped units attacked American [39:58] soldiers, including me, multiple times. [40:01] I will also tell you, I went back in 9 and 10, where EFPs developed by the Iranians, [40:07] struck my soldiers and our equipment. [40:10] I will tell you, the Houthis have continued to strike Saudi Arabia. [40:14] I will tell you, Hamas and Hezbollah has continued to strike throughout the Middle East. [40:19] And although we're not in an armed services hearing, we had that yesterday. [40:23] But I will tell you, because we took out their ballistic missiles and their ability to defend [40:27] from the air, that Europe is no longer under threat from Iran, who showed they will strike [40:32] every one that they can by striking all of their Arab neighbors in Azerbaijan and in [40:37] Turkey. [40:37] And everywhere else. [40:39] With that being said, Director Ratcliffe, I think the CIA has had a great year in providing [40:44] intelligence, whether that's in Venezuela, the initial midnight hammer strikes, or also [40:50] the current strikes in Iran. [40:52] Can you tell us kind of some of the things the CIA has done over the past year that you're [40:56] proud of? [40:57] Congressman, good to see you again. [40:59] Thank you for the question. [41:00] Good to see all of you and be back in the House. [41:04] I guess I'll start by saying, I think you all know there was bipartisanship. [41:07] Bipartisan concern when I took over the CIA that our human collection was in a downward [41:15] spiral and had been for some period of time. [41:17] And you all wanted a more aggressive CIA, one that was focused on core mission, one [41:23] that was collecting the kind of intelligence and stealing secrets that would provide a [41:29] decisive strategic advantage that can contribute to national security and foreign policy successes. [41:36] Right. [41:37] And I do think that the CIA, I agree with you, has had a great year. [41:43] And that's a credit to our workforce. [41:45] You talked about some of the very public successes like Operation Midnight Hammer and Operation [41:51] Absolute Resolve, where our agency contributed to a, frankly, flawless intelligence picture [41:58] that allowed for flawless military operations. [42:01] And I want to credit everyone here. [42:03] There's been bipartisan praise from this committee. [42:07] Even from those of you who may disagree with the underlying policies. [42:11] But I think those successes are really emblematic of success that the agencies had across the [42:17] board on all national security matters, in all national security spaces. [42:22] And it's not just an opinion, it's reflected in our statistics. [42:26] So when we talk about stealing secrets, you need assets and sources on the ground around [42:33] the world. [42:34] We're up 25 percent in that regard just in the past year. [42:37] Our foreign intelligence reporting, meaning the intelligence that really matters to you [42:43] as decision makers and the president as commander in chief, that's up across the board, 25 percent. [42:49] Other categories, specific targets and adversaries like China, it's up 100 percent. [42:56] Areas like technology, it's up 100 percent. [42:59] Issues like counter narcotics, our operations are up by 70 percent. [43:03] With regard to counterterrorism, those are classified numbers that we'll get into in [43:06] the classroom. [43:07] That's the classified portion. [43:09] But those are triple digits. [43:10] We've accomplished more on the counterterrorism front in the past year than in the prior four [43:15] years combined. [43:16] Again, really a credit to the CIA workforce. [43:22] Morale at the agency is high because people are doing the work that they signed up to [43:26] do. [43:27] And this administration is calling on them to do more. [43:29] I would say they're tired but happy. [43:30] If I can steer back the final 45 seconds, I have one question for Director Patel. [43:35] Director Patel, you've been a member of the CIA for a long time. [43:36] The current shutdown that is caused by us not funding TSA, border control, DHS and all [43:44] those things, how hard has that made the job of counterintelligence FBI to protect us here [43:50] in the homeland from threats that came through our borders or internally and already existing [43:55] in the United States? [43:56] Director Patel. [43:57] Thank you for the question. [43:58] When it comes specifically to the combination efforts between the Department of Homeland [44:02] Security and the FBI, we have 59 Homeland Security Task Forces that we have stood up [44:05] in every single state. [44:07] And then some that are co-led by the FBI and HSI, and obviously having a stopgap in funding [44:13] is hurting those abilities to go out there and fight crime and pick up violent offenders [44:17] across the country. [44:19] Even though the DHS workforce shows up every day, I think they've gone one month without [44:22] a paycheck now. [44:24] We also have things like our Southern Border Intelligence Center in Tucson, Arizona that [44:28] is our hub for intelligence collection operations on foreign terrorist organizations, specifically [44:35] the narco traffickers down in McAteer. [44:42] The Trump administration has justified this war with Iran as necessary to stop an imminent [44:48] threat. [44:49] But the administration has not provided this committee with any intelligence indicating [44:53] Iran was preparing a nuclear weapon, planning a preemptive attack on the United States or [44:58] possess any immediate capability to strike the U.S. homeland. [45:03] That raises very serious questions about what the analysis of the IC provided before the [45:07] decision to go to war was made. [45:09] Director Gabbard and Ratcliffe, is there any evidence that Iran intended to conduct [45:15] a preemptive attack on the United States? [45:17] And I ask this because 13 service members have been killed in Trump's war, including [45:22] Captain Seth Kovale, a husband and a dad from my state of Indiana, and my constituents [45:28] want answers. [45:29] So is there any evidence that Iran intended to conduct a preemptive attack on the U.S. [45:34] prior to beginning this war, yes or no? [45:41] Congressman. [45:42] The answer to this question needs to be reserved for a closed hearing. [45:46] I will say, however, the intelligence community does provide the assessments of the threats [45:53] that exist to the president so that he can make that determination within the body of [45:58] information and intelligence and activities within the region that ultimately he is responsible [46:04] for. [46:05] What is an imminent threat and if there is an imminent threat, what actions need to be [46:09] taken? [46:13] Congressman. [46:14] As the DNI said, there is a body of intelligence that we will be able to cover in the classified [46:19] portion of this hearing that reflects, that does reflect that in the likely event of a [46:25] conflict between Iran and Israel, that the U.S. would be immediately attacked, regardless [46:31] of whether the United States stayed out of that conflict. [46:35] Shifting gears to ranking, Member Heim's point, let me read to you from the 2025 Annual [46:40] Threat Assessment under your watch last year. [46:43] Quote. [46:44] Moscow's malign influence activities will continue for the foreseeable future and will [46:49] almost certainly increase in sophistication and volume. [46:53] Moscow probably believes information operations efforts to influence U.S. elections are advantageous, [46:59] regardless of whether they affect election outcomes. [47:02] By contrast, this year's threat assessment makes no mention of foreign threats to elections. [47:08] Meanwhile, the IC has been publicly warning about foreign powers interfering in our elections [47:13] for nearly a decade. [47:14] So, the omission is very striking, and to that point, sitting here today, I'm not aware [47:19] of any intelligence products in the past year dedicated to foreign plans and intentions [47:27] toward current and future U.S. elections. [47:30] Director Gabbard, yes or no, ma'am. [47:32] Have you directed or been directed to stop or limit dissemination of intelligence reports [47:38] or finish intelligence reporting concerning foreign plans and intentions about upcoming [47:43] U.S. elections or foreign threats to the midterm? [48:39] The reason I've said that is twofold. [48:42] Number one is when I assumed this role as Director of National Intelligence, through [48:47] the confirmation process and beyond, many members of Congress rightly [48:51] Director of National Intelligence, my responsibility is to report the intelligence community's [48:55] assessments objectively and to make sure that they are not politicized in any way, shape, or form. [49:02] Unfortunately, there are those who, for one reason or another, have tried to mischaracterize [49:08] the intelligence community's assessments and saying, well, this is just a political view [49:13] or trying to misdirect from what the intelligence community is reporting. So I took the opportunity [49:18] to state that from the outset, that this is the intelligence community's assessments. [49:23] Thank you. I also wanted to ask this because this week there was a high-profile resignation [49:27] of Director of National Counterterrorism Center. Now, I want to be clear from the outset, [49:33] I've communicated directly with President Trump my support for Operation Epic Fury, [49:37] and I was very, not only disappointed, but how inappropriate this letter was. And I want to read [49:44] a statement and get your personal assessment. [49:48] Whether you agree or disagree with that. And that's this. [49:51] Early in this administration, high-ranking Israeli officials and influential members [49:55] of the American media deployed a misinformation campaign that wholly undermined your America [49:59] First platform and pro-war sentiments to encourage a war with Iran. This echo chamber [50:04] was used to deceive you into believing that Iran posed no imminent threat to the United States and [50:09] that you should strike now. There was a clear path to a swift victory. This was a lie and is [50:14] the same tactic the Israelis used to draw us into a disastrous Iraq war. [50:18] Now, I cannot say how much I disagree with that statement. Do you agree or disagree with [50:24] what this letter was put out by former Director Kent? [50:29] He said a lot of things in that letter. Ultimately, we have provided the president with the intelligence [50:35] assessments and the president is elected by the American people and makes his own decisions [50:42] based on the information that's available to him. [50:44] But do you agree with, does that statement he made blaming Israel concern you? [50:48] Yes. [50:49] My next question is, I want to touch on the rise of terrorist attacks on the homeland. [50:55] In the month of March alone, there were multiple high-profile Islamic terrorist attacks. [51:01] You had Temple Israel Synagogue in Michigan, you had in Texas, you had an ISIS-inspired attack [51:07] where they threw an IED in New York City. What is your assessment as to the rise of Islamic terrorism on the homeland? [51:14] As you've pointed to, Congresswoman, this continues to be an extreme [51:20] conflict between the Islamic community and the Islamic community in the United States. [51:20] I'm concerned not only because of the rise of these attacks, but the mechanisms which [51:25] they're carried out and the challenges that the intelligence community has in being able [51:30] to try to detect some of these threats and attacks in advance. [51:35] I'd like to defer to the FBI director on some of this because they have been very successful [51:39] in many cases over the last year in detecting them and preventing these attacks. But due [51:45] to the nature of the challenge in, in, in, in the, in the, in the, in the, in the, in [51:51] many of these attackers, not having contact with known foreign terrorist [51:58] entities or individuals makes this [52:00] a much more challenging threat to deal with. [52:03] I want to turn to Director Patel. [52:05] I think that's a good, important segue to get your assessment. [52:08] I also want to add another aspect of the question. [52:11] We're working on a 9-11 commission review, 25-year review. [52:14] What other tools do you need to make sure that we are able to have the most robust, effective CT efforts? [52:21] Thank you, Congresswoman. Just real quick. So last year, we had 2,300 arrests related to [52:25] foreign terrorist organizations. We had 700 counterterrorism arrests, and the FBI had 640 [52:30] counterterrorism disruptions where we stopped attacks on the homeland. Specifically in December, [52:35] we stopped four in an 18-day span. What I need is specifically highlighted in the Norfolk attack. [52:42] In Norfolk, an individual who was convicted of terrorism and sentenced based upon that conviction [52:48] should have still been in prison. The Department of Justice in the first Trump administration [52:53] sought a sentence of 240 months. The judge in that case downward departed and gave a variance [52:58] to nearly half that sentence. If that had not occurred, that individual would still be in prison [53:03] and a member of our uniformed military service would still be alive. I want to work with the [53:08] legislature to figure out how to increase the sentencing for convicted terrorists and also [53:12] work on the denaturalization process for someone who should not be in this country who wants to [53:17] attack and kill. I want to start with a [53:30] question about Iran and discuss first how the war began. Secretary Rubio told us that Israel was [53:38] going to strike Iran regardless and that doing so would have triggered Iranian retaliation against [53:44] U.S. forces already in the region. And Director Ratliff, you seem to affirm that in comments [53:48] just a few moments ago. So rather than tell Israel to stand down, the president joined the war. The [53:55] Congress and the American people still don't know what the president's actual goals are. And yet we [54:01] have lost 13 U.S. service members. But here's what we do know. The president has said that he wants [54:07] a deal. He said Iran wants to make a deal and that he's not ready because, quote, the terms aren't [54:12] good enough yet. Yet they just killed Ali Larijani, the de facto leader of Iran, who, while not a [54:20] friend of the United States, would have been the person to negotiate any agreement with. The [54:25] president explicitly said that the United States did not strike Iran's energy infrastructure because, [54:30] in his words, having to rebuild it, quote, would take years. Yet this morning, Israel struck the [54:37] South Pars gas field, the world's largest natural gas reserve, triggering Iranian attacks on Qatari [54:43] gas facilities. Oil prices are up 15 percent in the last 24 hours. In San Antonio, my hometown, [54:50] where I represent, [54:51] the cost of gas has gone up nearly 40 percent in three weeks. Last night, the president said that [54:58] the United States knew nothing about the attack and called on Israel to stop similar attacks [55:03] on energy. Israel denies this and says that the attack was cleared by the United States. So my [55:10] question is, what does the intelligence community assess Israel's goals in this war to be? And are [55:16] those goals aligned with the goals of the United States? I'm thinking carefully here about what can [55:31] be said in this open setting versus a closed setting. I'm thinking carefully here about what can be said in this open setting versus a closed setting. [55:33] I'm thinking carefully here about what can be said in this open setting versus a closed setting. Are the goals aligned? [55:36] The objectives that have been laid out by the president are different from the objectives [55:43] that have been laid out by the Israeli government. And how do they differ? We can see through the [55:50] operations that the Israeli government has been focused on disabling the Iranian leadership [55:58] and taking out several members, obviously beginning with the Ayatollah, the supreme leader, [56:04] and they continue to focus on that effort. How does that differ from our goals? [56:08] The president has stated that his objectives are to destroy Iran's ballistic missile [56:17] launching capability, their ballistic missile production capability, and their [56:23] navy, the IRGC navy and mine lane capability. So the death and destruction continues, [56:30] the economic cost to the United States, to Israel, to the Gulf states, and to the world [56:35] continues to increase. So I want to ask you, to the best of your knowledge, do you know [56:39] whether Israel is supportive of the president's call to make a deal with Iran? I don't know the [56:47] answer to that. I don't know Israel's position on that. And to what do you attribute Israel's [56:53] decision to strike Iranian energy infrastructure, despite president Trump's call to keep those [56:58] facilities off limits? I don't have an answer for that. So they ignored the president. Do you agree [57:14] with that? I'm not privy to any of their deliberations or what went into their calculus [57:24] in launching this or other attacks. I'm not. We are. We are. We are not privy to any of their [57:29] not involved with the in the operational element of this. We're providing continuously on a daily [57:34] basis the intelligence assessments of the events that are occurring and I guess I know the FBI can [57:41] because they're domestic but can anybody else at the table provide any insight into that? I guess [57:51] I'm not sure what the question you're asking Congressman Castro. I guess a couple things. [57:57] The goals that the president set out are clearly defined. The DNI related those. What was not [58:04] included is a goal of the U.S. campaign. Well director let me start with this. Let me start [58:09] with this question. You asked what my question is. On April 19th FISA goes dark. 702 goes dark and it's been talked [58:49] about many times but up to 60 percent of the president's daily briefing is derived from FISA [58:55] 702 and we look at the successes that we've had in protecting the homeland and also [59:02] the conflicts the U.S. has been involved with. The flawless operation in Venezuela. [59:07] Operation Fury in Iran. Troop protection. The successes we've had on the battlefield in Ukraine. [59:18] The recovery and release of the Hamas hostages in the tunnels in Israel. All derived from FISA 702. [59:27] There is not a military operation that we've been involved with where FISA 702 was [59:34] not as Director Ratcliffe has said been indispensable to the United States and the [59:39] protection of our country. Director Patel has also said FISA 702 is indispensable. [59:46] We're 30 days away from it going dark. Director Ratcliffe can you clarify the president's position [59:53] on an 18-month clean reauthorization and how that's going to proceed moving forward? [1:00:00] Congressman thank you. So the president is in favor of [1:00:07] clean reauthorization of FISA 702 and I would add to that uh I'm heartened by the [1:00:14] fact to hear that the chairman of this committee and the ranking member are in agreement with that [1:00:20] and I know there's bipartisan uh support for that and and there should be and I know this is an [1:00:26] important vote for you to take but i would ask that that you all consider when you do that [1:00:30] that um when you look at the fact that former DNIs and former CIA Director and former FBI Director's [1:00:37] directors and DIA directors and NSA directors across Republican and Democrat administrations [1:00:46] are in support of FISA 702 in its current form. [1:00:50] These are the people that are making the decisions to keep Americans safe. [1:00:55] And so I wish the reauthorization was longer than 18 months, Congressman. [1:01:00] I think that this is something that I wish you all would consider for longer than that, [1:01:04] so that regardless of who the president is, who the president is in the future, he or [1:01:08] she would have the benefit of, as you said, a tool that's indispensable across administrations [1:01:15] provides more than half of the important actionable intelligence that the president and the commander [1:01:22] in chief relies upon. [1:01:24] Thank you for that. [1:01:25] Director Gabbitt, you're supportive of the 18 month extension the president's seeking [1:01:28] without a warrant requirement? [1:01:31] That is the president's position and that is the position of the intelligence community. [1:01:35] And you would support that? [1:01:35] You will be supporting that, correct? [1:01:42] Director Gabbitt, we implemented two years ago a number of reforms, actually 56 of them [1:01:48] that were part of the Reforming Intelligence and Securing America Act, RISA, and that was [1:01:53] done in a bipartisan way. [1:01:54] That was a reflection of what we thought were problems with FISA 702, going back during [1:02:01] the first Trump administration and even before that. [1:02:04] These reforms that have been in place. [1:02:05] These reforms that have been put in place and that you have helped implement, we wonder [1:02:09] if you could talk specifically about those reforms on the cutting down of FBI agents [1:02:15] having access to querying of FISA information, the fact that there are criminal penalties [1:02:21] now for FBI agents that are engaged in inappropriate activity as it relates to FISA. [1:02:26] Please tell us some of those reforms and how those have been implemented. [1:02:29] Director Patel. [1:02:33] Sorry, I thought you were asking for TNI. [1:02:37] Absolutely. [1:02:38] We have gone above and beyond what RISA requires since I became director 13 months ago. [1:02:43] We not only require supervisory special agents to approve the query request of U.S. persons, [1:02:50] we also require the general counsel's office and lawyers to come in and agree with that [1:02:54] request before we can proceed. [1:02:56] Also we used to, before this, had a default which allowed queries when we were utilizing [1:03:03] our system to say it automatically searches 702. [1:03:06] You now have to actually opt in. [1:03:07] And select that box to make sure that you are intentionally doing so. [1:03:13] On top of that, we've reduced the number of personnel at the FBI from 6,600 before I got [1:03:17] there to 3,500 that have access to it. [1:03:20] Not that use it, but that have access to it. [1:03:23] And we've also gone above and beyond what RISA requires in terms of if you misuse it [1:03:29] unintentionally or recklessly. [1:03:31] If you use it unintentionally, misuse it unintentionally, like you typed a name wrong in terms of spelling [1:03:35] or whatnot. [1:03:36] Yeah. [1:03:38] If you misuse it and be retrained, if you recklessly use it, you're immediately terminated [1:03:41] your access forever. [1:03:42] Thank you. [1:03:45] Mr. Crow. [1:04:25] Mujtaba, the son, is particularly close to the brutal Islamic Revolutionary Guard Corps [1:04:29] and their most hardline commanders, correct? [1:04:31] That is the intelligence community assessment. [1:04:34] He was involved in ordering violent crackdowns on Iranian protesters, including their murder, [1:04:39] correct? [1:04:40] Yes. [1:04:41] And he will continue his father's religious ban on developing nuclear weapons. [1:04:44] Is that correct? [1:04:45] It is unknown at this time. [1:04:46] You testified before this committee last year that the elder, now deceased, Khamenei had [1:04:54] in 2003 banned the nuclear weapons program or suspended it, correct? [1:04:58] There was a fatwa in place that stated that. [1:05:00] And that fatwa remained in place last year when you testified before this committee, [1:05:04] correct? [1:05:05] Yes. [1:05:06] And that fatwa remained in place recently, correct? [1:05:09] As far as I know, it has not been lifted. [1:05:11] Yes, you're aware of no information that would lift that fatwa? [1:05:15] I'm not aware of any intelligence reporting that states that. [1:05:19] To be clear on Mujtaba, the son who has been named to replace him, it is unclear of his [1:05:26] status or his involvement. [1:05:29] He was injured very severely through one of the Israeli strikes. [1:05:33] And so the decision-making is unclear about what's happening in the Iranian leadership. [1:05:38] So it's unclear. [1:05:39] So we're less certain of the positions of Iranian leadership in their intelligence? [1:05:42] We're less certain of their intentions than we were 60 days ago, correct? [1:05:46] That's an accurate assessment. [1:05:48] One of your jobs is to create products assessing Iran and the threats it poses to the United [1:05:55] States, correct? [1:05:56] Yes. [1:05:57] And that includes potential outcomes for military action, correct? [1:06:04] It includes potential outcomes of a variety of scenarios. [1:06:08] And the likelihood of those outcomes? [1:06:11] Yes. [1:06:12] Generally, when you make assessments about threats facing the United States, you're not [1:06:16] going to look at any of those. [1:06:17] You will look at, in Iran in any instance, the likely scenarios that have come out of [1:06:21] military action, correct? [1:06:23] The intelligence community takes all of those factors into account when they create these [1:06:27] assessments. [1:06:28] When you look at the threats posed by foreign countries, you also assess timelines to those [1:06:34] threats, correct? [1:06:36] What do you mean by timelines? [1:06:38] Like a breakout time, for example, for nuclear weapons or the development of ballistic missiles? [1:06:42] Yes, based on the information available at any given time. [1:06:45] In the timeline also for potential terrorist attacks, correct? [1:06:48] Broadly, yes. [1:06:51] Assesses all matters available. [1:06:52] It is common practice for the IC to assess the timeline of all threats. [1:06:57] Nuclear weapons development, ballistic, right? [1:06:59] Yes. [1:07:01] Ballistic weapons development. [1:07:03] Based on the information available, yes. [1:07:05] Terrorist attacks. [1:07:07] Same applies. [1:07:08] Cyber attacks. [1:07:10] Timelines for all of those, correct? [1:07:13] When there is information available that point to that, yes. [1:07:15] In likelihood, as well as the timeline, correct? [1:07:20] Based on the information available. [1:07:21] Timing is important, is it not? [1:07:23] It is an important factor that goes into the assessment. [1:07:28] So it is your position sitting here today that you made no timeline determination as [1:07:35] to threats that Iran had facing the United States, correct? [1:07:42] It's a very broad statement, but where the information is available, the intelligence [1:07:46] community factors that into their assessment products. [1:07:48] Did you or the IC make any assessments as to the timing of potential threats facing [1:07:54] the United States from Iran? [1:07:56] In the last 90 days. [1:07:57] I'm sure there was timelines factored into the intelligence assessments that were delivered. [1:08:05] Did any of them show imminence? [1:08:08] The imminent nature of a threat is determined by the president based on a totality of the [1:08:14] intelligence and information provided to him. [1:08:17] Did any of them show that there were attacks anticipated within the next 90 days from Iran? [1:08:23] It's too simplistic of a statement to say that because it depends on various scenarios [1:08:28] occurring or not occurring. [1:08:29] Did those assessments show timelines for the threats that Iran posed to the United States? [1:08:37] The totality of threats, yes, there were timelines involved where it applied and where that information [1:08:42] was available. [1:08:43] But again, to your question about the determination of imminence, the president makes that determination [1:08:47] based on the totality of information and intelligence. [1:08:50] The bottom line is there was no imminent threat and you know that and there's no product that [1:08:55] shows that. [1:08:56] I yield back. [1:08:58] Thank you, Mr. Fitzpatrick. [1:09:06] Obviously it is the imminent issue right before us. [1:09:10] Will expire in a month, unequivocally the most critical national security tool our nation [1:09:15] has to keep us safe from fentanyl, from foreign wars and everything in between. [1:09:22] Mainly to, you know, to Director Ratcliffe, but any of you can answer this, one of the [1:09:26] most perplexing debates that I've been subject to. [1:09:29] Over my time here is this debate over what warrants are and when they're needed. [1:09:35] In the 250 year history of this country and going back to the very origins of law enforcement, [1:09:41] we have always had a warrant requirement, always had a warrant requirement on the collection [1:09:47] of evidence. [1:09:48] We have never had a warrant requirement on the querying of already lawfully collected [1:09:54] data, which is why we don't require police officers to get warrants when they run license [1:09:58] plates. [1:09:59] Query. [1:10:00] It's why we don't require police officers to get a warrant to enter the evidence locker [1:10:09] in their police precinct, which contains already lawfully collected data. [1:10:13] It would literally shut down the system and that's not a warrant requirement. [1:10:17] That's a secondary warrant requirement. [1:10:19] That's a warrant requirement on steroids. [1:10:21] So Director Ratcliffe, or any of you, I know you've been subject to these questions as [1:10:26] well. [1:10:28] Is it just a confusion over the difference between the warrants and the steroids? [1:10:30] The difference between the collection of evidence versus the querying of our already [1:10:35] lawfully collected data? [1:10:38] Is it a lack of understanding of what incidental collection is, which is a fundamental precept [1:10:44] of law enforcement? [1:10:46] But if we have a warrant requirement on steroids, for now, the querying of already lawfully [1:10:50] collected data, just by the numbers, that would require an expansion of the federal [1:10:55] judiciary by a factor of a hundred. [1:10:57] It would literally shut down our law enforcement apparatus. [1:11:01] Yeah. [1:11:02] It's one of those dangerous times in our nation's history. [1:11:04] So Director Ratcliffe, or any of you, if you could just walk me through your analysis there. [1:11:08] Well, I'll start, Congressman. [1:11:10] Thanks for the question. [1:11:11] Again, thanks for highlighting this important issue. [1:11:15] And as has been pointed out, reforms should be implemented where they're necessary. [1:11:22] And I think, speaking for myself, and I know Director Patel supported the reforms from [1:11:26] two years ago to make improvements, and they did. [1:11:31] Yeah. [1:11:32] And I think that should be considered. [1:11:33] A warrant isn't one of them. [1:11:37] And with respect to the reforms that have been implemented, we're talking about, when [1:11:43] we talk about Fourth Amendment rights and privacy concerns, we're at a 99.9% compliance [1:11:50] rate with respect to that. [1:11:52] So I would start by saying, why are you trying to fix what's not broken with something that [1:11:58] I can tell you from this seat, the fix would not work? [1:12:03] And I go back to my comment before, DNIs, CIA directors, FBI directors, the people that [1:12:10] have been in all of these chairs before, on a bipartisan basis, agree that a warrant won't [1:12:15] work and don't advocate for it. [1:12:18] Again, Congressman, you're correct. [1:12:21] This is lawfully collected information. [1:12:24] And these things come at you very fast, and you have to make decisions very quickly, and [1:12:30] sometimes in a matter of hours. [1:12:32] Yeah. [1:12:33] You have to act on the information that you have lawfully, that has been lawfully collected [1:12:40] to interdict drug shipments or terrorist activities, and a warrant requiring you to go to the court [1:12:46] to seek probable cause for information that has already been lawfully collected only prevents [1:12:52] that from happening. [1:12:54] I understand that it's well-meaning for people that are proposing it, but again, I would [1:12:58] defer to the people who sit in these chairs and make these decisions who would tell you [1:13:03] that it doesn't work. [1:13:34] And then when we query a U.S. person term, we're not querying for U.S. person information. [1:13:41] We're querying for foreign intelligence that has already been evaluated at least once to [1:13:46] contain foreign intelligence in the database that's being accessed. [1:13:50] And then the final piece that I think is important is that both the FISC and the Department of [1:13:54] Justice have established robust legal and compliance rules that we adhere to and that [1:14:01] is audited by DOJ for everyone. intelligence assessments are not colored by my personal views director and [1:16:39] that's exactly what i am responsible you still believe that war with the round would be so [1:16:43] costly and issues to color or bias the intelligence reporting that we deliver to you and to the president [1:17:00] director gabbard um in this hearing one year ago [1:17:05] i asked some questions um and i'll paraphrase um my exact question it's like we should keep politics [1:17:12] out of this even if the president disagrees um with a directive if it goes against his personal [1:17:18] wishes if he's considering an order that potentially is unconstitutional or illegal [1:17:23] or compromises our security i want your word that we will you will always provide and give [1:17:29] the honest advice to the president even if it will make him angry i asked you that question [1:17:33] i'm going to read your answer um and to your specificity [1:17:37] to your specific question the answer is yes i will inform the president of that accurate timely [1:17:43] unbiased intelligence reporting whether it is something that agrees with an assumption or a [1:17:48] view or an objective or not that's my responsibility to him and to the american people director gabbard [1:17:55] did you there is no imminent threat of nuclear breakout did you deliver that assessment to the [1:18:02] president i have delivered the intelligence community's assessments to the president there was [1:18:10] no imminent nuclear threat to the united states there was no evidence of imminence that iran [1:18:16] was going to attack american assets that was different from anything they've done over four [1:18:21] decades that was going to attack our homeland there was no imminent threat imminent is defined [1:18:27] in the dictionary as something that is about to happen not something that's been happening for [1:18:32] four decades not something that is going to happen three months from now not something that's going [1:18:37] to happen a year from now imminent said this is about to happen did you deliver that assessment [1:18:40] to the president i delivered the intelligence community's objective analysis of the threats [1:18:46] the severity of those threats and the scope along with assessments of the different scenarios and [1:18:52] contexts that exist within the middle east the president owes it to the american people to go [1:18:57] on television to explain to the american people to the service members who have died in action [1:19:03] serving our country why we are at war with iran he needs to go on television and explain that [1:19:08] directly to the president [1:19:11] american people what the imminent threat was gentleman's time has expired i would advise the [1:19:18] members that a driver named lalitha talanda hall drove to a house near [1:20:28] columbus ohio to pick up a package she had no idea that the 81 year old man who lived there had just [1:20:33] received a series of phone calls from scammers who had threatened to kill him if he did not give the [1:20:38] woman coming to his house twelve thousand dollars in cash he killed the lady so she's dead he now [1:20:45] has a life sentence he's dead he's dead he's dead he's dead he's dead he's dead he's dead he's dead he's dead [1:20:47] are you aware of any action or investigation that the justice department has taken to pursue [1:20:53] justice to bring the scammers and put them and make them pay for what they did i think you're [1:21:00] referring to congressman scam centers and scam compounds that are wreaking havoc on our citizens [1:21:05] i'm referring to this individual case this lady was murdered and a man now has life in prison [1:21:09] i can't speak to that individual case i can tell you united states of america thank you very much for the question congressman i committed to all of you [1:22:00] before taking this role that i would execute on that to bring back odni's focus on its core mission [1:22:07] to cut the fat to cut away any detractions away from that and to ensure that our intelligence [1:22:13] committee was providing objective timely and relevant intelligence to the president [1:22:17] and to policy makers [1:22:20] i conducted a ground-based review of the mission the capabilities and measuring effectiveness of [1:22:26] odni which resulted in a reduction of force by roughly 40 percent and a narrowing of focus and [1:22:34] reorganization that consolidated and coordinated the experts within the odni in order to be able [1:22:41] to deliver those effects leaking continues to be a prolific problem across the ic we have and continue [1:22:50] to be able to implement tools and capabilities within the zero trust framework to be able to get [1:22:56] after those leakers and refer them to the department of justice for investigation and [1:23:02] prosecution we've seen we are continuing to focus on the issue of analytic trade craft and the [1:23:12] integrity of it once again to make sure that the analysis that's being conducted is not being [1:23:17] colored by anyone's political or personal views on any of the issues that we're dealing with today [1:23:21] and that's a very significant issue to that effect we have and continue to conduct invest [1:23:26] re-looks at different intelligence products that have been provided in the past [1:23:31] as the chairman mentioned one related to anomalous health incidents to identify politicization of [1:23:38] these products in the past and also make updates to intelligence community directives to ensure [1:23:44] that these things don't happen again could you speak briefly to china's presence in the caribbean [1:23:51] the western hemisphere uh i'll be able to speak to this more uh in the classified setting sir okay [1:23:58] right right cliff i'm gonna have questions for you there as well um we do not we have not heard much [1:24:04] about haiti lately in the news but it's very close to the united states my understanding is that one [1:24:09] in four haitians about two and a half million people now live in an area controlled by an armed [1:24:14] group uh can you speak to what is happening in haiti uh yes sir this was something that uh [1:24:21] we talked about within the annual threat assessment [1:24:24] haiti along with cuba continue to be areas of volatility haiti as you mentioned specifically [1:24:31] is being controlled by a gang and we've seen increasing threats on u.s persons within haiti [1:24:37] these two countries continue to create challenges where with increased instability [1:24:42] may be one of those drivers of increased migration flows to the u.s thank you all [1:24:48] for your service gentlemen's time's expired now recognize mr gotheimer thank you thank you very [1:24:55] much mr chairman [1:24:56] uh if i can start uh by talking about uh something i was disappointed in from the [1:25:02] administration about comments made by members of of the administration that israel drew the [1:25:07] united states into conflict with iran seeming to buy conspiracy theories that scapegoat israel [1:25:12] while dismissing that iran poses a persistent threat to america and our service members and [1:25:16] diplomats in the region well the president then clarified this is not the case and that [1:25:21] america entered into a joint operations with our ally under our own accord many still seem confused [1:25:26] about what precipitated this conflict and the threat iran posed to us directly so if i could ask [1:25:31] director radcliffe just a couple questions yes or no if that's okay with you is the iranian regime [1:25:36] committed to america's destruction in your opinion yes does the iranian regime have american blood [1:25:41] on their hands since its founding in 1979. yes has iran plotted assassination attempts against [1:25:45] americans on american soil yes was iran developing a nuclear weapon prior to our military action last [1:25:51] june and did iran remain committed to developing a nuclear weapon in the lead up to this conflict yes [1:25:56] yes so i want to clarify on that uh because scapegoating them for u.s intervention in iran and iraq [1:27:24] director what role do you anticipate mr caldwell playing in shaping intelligence assessments or [1:27:28] internal discussions related to iran and israel and can you guarantee to this committee that no [1:27:32] individuals in your leadership are undermining the objective objectivity of intelligence at this [1:27:37] critical moment uh sir my understanding is one of my elements sought to hire dan caldwell months ago [1:27:46] for a purely administrative role that would not have any position over the intelligence analysis [1:27:52] or assessments on any topic thank you director as you [1:27:57] know the iranian regime has been responsible for the deaths that we've talked about of scores [1:28:00] americans since coming to power in 79. iran's terror proxies must be crushed i've been clear [1:28:06] on that point in the last weeks and throughout my time in congress i supported the decisive action [1:28:11] taken on february 28th to remove key regime leaders and degrade iran's ballistic missile [1:28:16] and naval capabilities however i think it's really important the administration make its goals clear [1:28:20] subcommittee chairman of oversight and investigations [1:30:32] where the investigation of ahi is and has been a central oversight effort and so i am going to ask [1:30:40] a quick question about this director [1:30:42] Cliff. During the Biden administration, the CIA very poorly, in my opinion, handled this issue. [1:30:48] Since then, a CIA doctor has provided perjured testimony under oath and obstructed our [1:30:55] congressional investigation. A quick question for you. Do you affirm that the CIA personnel [1:31:00] are under no direction to make false statements to Congress in order to conceal CIA equities or [1:31:06] activities related to the handling of AHI during the Biden administration? [1:31:16] As a member of this committee, I also have a regional responsibility that includes Africa. [1:31:22] I'm very concerned about the radical Islamic terror threat that exists there and is growing [1:31:26] by the day. Whether it's Al Qaeda affiliated groups such as JNMI, AQIM, Al-Shabaab, or ISIS [1:31:34] inspired groups such as ISIS West Africa, ISIS Shahel, ISIS Somalia, or Boko Haram. [1:31:39] These are radical, [1:31:40] dangerous, [1:31:40] dangerous, [1:31:41] dangerous, [1:31:41] dangerous groups that want to kill Americans. After four years of an open border during the [1:31:45] Biden administration, where we know countless individuals with terror ties, many to these [1:31:51] groups cross our southern border, and at a time when we are actively engaged with the largest [1:31:57] state sponsor of radical jihadi terror, can you confirm that the threat to the American people in [1:32:03] this setting is much higher due to the Democrats' current defunding of the Department of Homeland [1:32:08] Security? [1:32:09] As I highlighted earlier, Congress, [1:32:11] the FBI works hand in glove with the Department of Homeland Security and our 59 established Homeland [1:32:18] Security Task Force around the country, and those officers are now going one month without pay, [1:32:22] but they're still showing up to work. Anyone that feels inclined can answer this, [1:32:33] but according to the Council on Foreign Relations, another Africa-related question, [1:32:37] 51% of global terrorism-related deaths occurred in Africa's Shahel region, including the Lake Chad, [1:32:42] Basin. Does the intelligence community assess that Boko Haram, ISIS West Africa, and other terrorist [1:32:48] groups operating in the Lake Chad basin are a threat to the US interest, whether it's here [1:32:51] in the homeland or a regional US interest? If so, how does this lack of counterterrorism cooperation [1:32:58] that we're currently experiencing with the allied states of the Shahel, Niger, Mali, and Burkina Faso [1:33:03] impact that? And tied to that, how does the rise of alternative security forces, such as Russia's [1:33:10] Wagner Group or now, Africa Corps, impact that? And so, for example, in the United States, we're [1:33:11] currently experiencing the lack of counter-terrorism cooperation that we're currently experiencing with the [1:33:11] or now africa corps how has that impacted our counterterrorism efforts in the region [1:33:20] congressman the continued rise of these islamist terrorist groups as you've pointed out [1:33:25] in africa west africa and around the world continues to be a serious concern and major [1:33:29] focus of the intelligence community the challenges within the region are very complex because they [1:33:35] have to do with governance challenges in many of these countries they have to do with economic [1:33:40] challenges as well as external influences both with funding and equipping of these [1:33:46] terrorist organizations so yes it has made our counterterrorism long-standing counterterrorism [1:33:52] efforts in these regions as well as those of our allies in this fight such as the french [1:33:57] and other countries far more difficult because of the very real threat within that region to [1:34:05] u.s persons if we are not able if the u.s if the department of war is [1:34:10] not able to coordinate with and get the support of the governments of these countries in order to [1:34:16] tackle this terrorist threat then it's not it's not a safe or operable environment uh for them [1:34:21] to continue that fight thank you and the assumption i'm working off of too is that [1:34:26] uh the russian influence via wagner or africa corps has made uh it very difficult for us to [1:34:32] develop those relationships and get those agreements so that we can uh continue to um [1:34:36] you know make sure that we're not this is not being brought home to the homeland is that correct [1:34:40] that is a fact [1:34:41] thank you i appreciate it i yield back um miss hooligan thank you um my question is [1:34:53] basically starting with some hr questions in there for first for director patel um if you [1:34:58] could help me a little bit understand i come out of the military military family as well [1:35:03] um but i don't know very much about the fbi's hr process or the uh growing up of an fbi uh expert [1:35:11] could you help me understand how long it takes for a senior counterintelligence expert especially [1:35:15] the one maybe focused on a very narrow threat to be developed how many years i guess would be my [1:35:21] question thank you congresswoman that varies sometimes right out of quantico new agent [1:35:26] trainees are placed on the counterintelligence mission set and some people come in from the fraud [1:35:30] section so the answer varies it could take a couple months to a couple years and the next [1:35:35] question is when a person comes up in your system in the military it was always the needs of the [1:35:39] navy or the needs of the air force it was never the needs of the airmen or or the soldier or the [1:35:44] sailor in terms of prioritizing already [1:35:46] this in terms of making sure that we have met the mission is the fbi similar it is similar ma'am [1:35:53] it's a dynamic threat landscape so we flux and surge based on the ci ct cyber threats and other [1:35:58] threats to the homeland and violent crime mission has seen a surge as well so my specific question [1:36:04] is that there was a report that came out in february from cnn that the fbi had let go or fired [1:36:11] dozens of agents and staff members from a counterintelligence unit tasked with monitoring iran [1:36:17] and apparently the reason at least reported in the press was that these individuals had been [1:36:22] involved in the investigation of classified document handling from president trump uh at [1:36:26] mar-a-lago uh and that this was the reason why they were summarily let go first of all are you [1:36:33] aware of those firings and are you uh do you concur with the rationale or reason for those firings [1:36:39] i'm aware of that and i know there's a pendency of litigation so i'm not able to comment on them [1:36:44] did you yourself order those firings the fbi [1:36:48] i every time there is someone who violates our code of conduct or ethical standard conducts an [1:36:53] internal investigation with the careers there and they present a decision point to me the iranian [1:36:58] threat mission center has seen an increase of 43 percent in arrests for iranian spy actors so the [1:37:04] iranian threat mission center has never been stronger so i'm not asking about i'm asking [1:37:10] about whether those people were fired because they were involved in the investigation of the document [1:37:15] handling by by president trump not for any behavior issues [1:37:19] is that your understanding as well again ma'am i can't comment on them because those [1:37:23] are in pending litigation i guess i'm a little stymied here director because it feels as though [1:37:30] right literally when there was a possible pending war i'm outside of this uh intelligence circle [1:37:37] in in many ways even though i serve on the intelligence committee [1:37:41] you collectively must have been aware when these firings happened that there was a meaningful [1:37:46] chance that the u.s might be engaged with a war in iran and having these very expert super [1:37:51] qualified folks uh summarily districts dismissed at this time it just feels like an odd choice in [1:37:57] timing were you aware at the time that this was going down that this may uh end up weakening the [1:38:03] mission and the readiness of that group the mission as i stated has never been stronger [1:38:07] when you see a 43 increase in counter-intelligence arrest and 21 percent increase in cyber arrests [1:38:13] against the iranian threat mission center my focus is on providing the american people the [1:38:17] strongest fbi as possible i don't work on timelines i work on pre-evidential [1:38:21] events that's presented to me i guess my concern is that it feels as though and i very much honor [1:38:26] the the tone and tenor of this hearing that this is about making sure that um that we depoliticize [1:38:34] um what is the most important thing that we all do which is keep us safe and it feels as though [1:38:40] this issue is a political issue and i just am worried that we are taking really good [1:38:45] really qualified people and picking fights with one another across across um party lines [1:38:52] rather than making sure that we protect ourselves and keep ourselves safe with the remainder of my [1:38:58] time director gabbard i have a question regarding the fact that the secretary of the treasury [1:39:02] loosened restrictions this week on russian oil exports uh and now that the russians are able to [1:39:07] sell oil again did the ic assess that clearing the way for increased russian oil sales would benefit [1:39:13] moscow possibly i don't believe there's been a formal ic assessment on this topic yet as it is [1:39:22] underway so i would highly [1:39:25] encourage that because it feels as though by easing these sanctions we are directly providing [1:39:30] the kremlin with revenue uh the revenue that will be used directly to kill ukrainian soldiers [1:39:36] uh and an increased likelihood that putin will be successful in his war with ukraine [1:39:40] i thank you for your time and [1:48:55] So you're saying tomorrow the president of the United States can say China is an imminent threat and then he can take his own, no matter what the intelligence says, he can take his own action. [1:49:06] So that's what you're basically saying. [1:49:08] Okay, let's go on. [1:49:10] Director Gabbard, you said that. [1:49:11] North Korea has intercontinental ballistic missiles that can reach the homeland. [1:49:16] Yet the Defense Department said that Iran was at least 10 years away from achieving an intercontinental ballistic missile that can reach the homeland. [1:49:28] Which one is a more serious threat, North Korea or Iran? [1:49:35] These threats are taken within the context of the total body of intelligence reporting. [1:49:41] So that's it should be. [1:49:45] And that's my point. [1:49:46] It's not just about having the capability of building a weapon. [1:49:52] It's if they can actually deliver that weapon. [1:49:55] If they have the intention of doing that. [1:49:59] How many weeks away are they? [1:50:03] We haven't heard that there were weeks away. [1:50:07] We haven't heard that there are months away. [1:50:10] But that's what we're waiting for. [1:50:13] Imminent to me means that they're mobilizing troops. [1:50:18] They're moving positions. [1:50:19] They're moving things into position. [1:50:21] Artillery. [1:50:22] They're getting ready to attack. [1:50:25] But everything that we've heard is that this is not the case. [1:50:38] It's a marvel that just one year of strong leadership from the White House has shifted [1:50:41] the conversation in this room from that of appeasement and passivity from the Biden administration [1:50:45] to that of American strength brought about by the doctrine in Venezuela and Operation Epic Fury in Iran. [1:50:52] And it's not lost on me that as we sit here, we have one side of the dais talking a big game [1:50:58] on threats, and yet they're unwilling to even fund our Department of Homeland Security. [1:51:02] I want to thank President Trump's leadership in each of your efforts. [1:51:05] Because of your efforts, Americans are safer today with two less despots to deal with. [1:51:09] Nevertheless, there remains work to be done. [1:51:11] While Venezuela and Iran are in decline, aggression from adversarial nations like China and Russia [1:51:15] and near constant threats of terrorism and cyber warfare continue to persist. [1:51:23] The Chinese Communist Party in particular remains a top adversary. [1:51:25] It routinely deals in bad faith, and this was highlighted most recently by White House [1:51:29] Office Director of National Drug Control Policy Sarah Carter when she delivered recent remarks [1:51:34] in Vienna saying, quote, We know that China's weak export controls and lax enforcement allow [1:51:39] its chemical industry to foster friendships with the drug cartels. [1:51:41] At the same time, China's overtly overly effective controls over rare earth minerals wreak havoc [1:51:48] on legitimate industries, end quote. [1:51:50] Of course, we're now seeing reports of a new synthetic opioid called cyclorphine that is [1:51:56] said to be 10 times more potent than fentanyl and undetectable on fentanyl test strips. [1:51:59] As you know, President Trump may meet with President Xi in the near future, where trade [1:52:04] and export controls will most certainly be discussed. [1:52:08] Director Gabbard, what is your assessment of the quality and quantity of AI compute [1:52:14] that China can indigenously manufacture? [1:52:22] The majority of this question should be addressed in a closed hearing. [1:52:27] The intelligence community's assessment is that China continues to be a very powerful [1:52:30] country. [1:52:31] China continues to rapidly advance its AI capability. [1:52:34] Do you assess that export controls on semiconductor manufacturing equipment and AI compute have [1:52:38] been effective, slowing the development and deployment of Chinese AI? [1:52:44] The intelligence community's assessment is that one of the effects of those export controls [1:52:49] is China has increased its focus on developing its own organic capability. [1:52:56] What do you assess would be the economic and national security impacts if the U.S. decided [1:53:00] to loosen export controls and allow the supply of the U.S. economy to expand? [1:53:01] Well, I think that's a good question. [1:53:02] The U.S. policy is to allow the sale of NVIDIA, Blackwell GPUs or large numbers of [1:53:06] H200s to China. [1:53:08] I don't believe there is an intelligence community assessment on that specific scenario. [1:53:13] I think that these national security implications should be weighed heavily when conducting [1:53:18] these talks, considering that fentanyl overdoses are only down in the U.S. thanks to the president's [1:53:23] leadership in securing our borders and taking the fight directly with the cartels in our [1:53:26] hemisphere and not the empty words and actions of the Chinese Communist Party. [1:53:34] Our adversaries are constantly conducting cyber operations and taking a risk to keep [1:53:34] China safe. [1:53:35] Do you think these things are going to greatly reduce our costs of [1:53:35] affordability for China? [1:53:36] on U.S. government and private sector networks to steal information and money or conduct [1:53:41] disruptive cyber attacks. We've just been tracking the Chinese typhoon actors for several years. [1:53:47] And just last week, the Wall Street Journal reported that salt typhoon actors, which were [1:53:50] responsible for targeting U.S. telecom, may have accessed sensitive FBI networks. I may have more [1:53:55] to follow up on in the closed session. For now, I want to discuss how the overall U.S. government [1:54:00] posture is going to change based on President Trump's cyber strategy, which was released last [1:54:04] week. I've been frustrated for some time about the unwillingness of prior administrations [1:54:08] to decisively take action, including the use of offensive cyber operations. Director Patel, [1:54:13] beginning with you, what can we expect from the FBI moving forward to be more aggressive [1:54:17] on both defensive and offensive cyber activity? Thank you, Congressman. So as you stated, [1:54:22] the president just launched a new national security cyber strategy. And within that is [1:54:26] what the FBI just launched 60 days ago. It's the most comprehensive cyber program we've ever put [1:54:31] out called Winter Shield. And what we do, connecting Pillar 1 and Pillar 4, is to [1:54:34] go on offense and defense. And so what we've done already is while we are always going after [1:54:41] nation state actors, we also have to engage with the private sector communities because they are [1:54:45] going after the private sector as well. We've held 355 engagements in the last 60 days with [1:54:51] enterprises across America to harden their networks. And as you recall, just a couple of [1:54:55] months ago, our banking infrastructure was hit by a ransomware attack from overseas. In one weekend, [1:55:00] the FBI disrupted and kicked off every one of those bad actors from that [1:55:04] network, saving the American people their valued billions in those bank vaults. So this is some of [1:55:10] the things we're doing, but we need constant engagement with the private sector. Great. [1:55:15] General Hartman, what efforts are underway at NSA to bolster intelligence collection [1:55:18] and threat detection in coordination with other federal agencies to target adversary [1:55:22] cyber operations? Congressman, thanks. Significant effort to really focus our [1:55:30] cybersecurity director working very closely with Director Patel. [1:55:35] And our cybersecurity collaboration center, which has thousands of analyst-to-analyst relationships [1:55:42] with private organizations across the country. We need more work, not just from an offensive [1:55:47] standpoint, but working across government and certainly working across private industry. But within that context, on CNBC, Steve Witkoff said on a recent call with President Trump, Russian leaders denied they were sharing this target information. Let's hope they're not doing this. Just from your own sense, and for many of you who have been fighting in the Cold War for a long time, a long lost sense of a Russian, of a Reagan doctrine, just general, it is your sense that you can take Putin at his word on anything involving military, diplomatic, or intel assessments? [1:59:21] Mr. Gabbard, let me, I understand that you have to put your own personal views aside in your position, but I honestly think that the issue our grandchildren are going to be most upset, [1:59:32] said about us with is climate change so you know you know your quote and when you talked about [1:59:38] climate change uh as a member it threatens the safety and security of the planet especially in [1:59:44] places like hawaii where we are already experiencing its devastating effects but respectfully it it's [1:59:50] not in worldwide threats used to be in worldwide threats so let me help me just help me understand [1:59:58] who makes the final decision on what goes in here and what is a threat congressman it's a collection [2:00:07] of the intelligence community's assessments that the national intelligence council and our experts [2:00:12] there work on this year we've structured the annual threat assessment around the president's [2:00:17] national security strategy to address the most tangible and direct threats to our security and [2:00:24] our interests i get that part did you make the case that maybe climate change should be considered [2:00:31] a worldwide threat [2:00:32] when we are this collective process did you make the case with what you said not that long ago yeah [2:00:39] once again we focused on the most tangible and direct threats given the complexity uh of those [2:00:45] threats that exist here and on the homeland and around the world so that's stating that there's [2:00:49] that climate change isn't in any way a tangible threat now or in the future it's it's basically [2:00:55] saying we think so little of it as a threat we don't even mention it i think the changing of [2:01:01] the climate the weather the [2:01:03] environment is a factor that goes into the different intelligence community assessments on [2:01:09] effects gentlemen sign has expired ms tinney thank you mr chairman and thank you so much to our [2:01:18] briefers and for your service to our country and multiple cases for some of you and everyone who [2:01:25] serves in the intelligence community to give the support to everyone that's serving i fully support [2:01:31] president trump's efforts uh through your agencies over the last 18 months 18 days 18 days we have to [2:01:36] It's only been 18 days, and I think it was a courageous decision, and to the American people, I know many have recited this, but for the past 47 years, Iran has been the world's largest sponsor of terrorism. [2:01:51] The Islamic Republic of Iran has operated with impunity. [2:01:55] They've destabilized the Middle East, brutalized their own citizens, and have the blood of countless Americans and others on their hands, and now they're paying the price for that despotism. [2:02:05] And I want to thank our service members and President Trump in making these difficult and stunning decisions, but it is also stunning what the Iranian people and so many in the Middle East and around the world have suffered from the regime. [2:03:04] Can you characterize what the access would be to the Internet? [2:03:09] Or cell phones for those in Iran who have no idea about anything and are only receiving the propaganda from the regime? [2:03:17] Congressman, I can expand on this in the closed setting, but I will say briefly that throughout the period of protests that we saw previously, and during this ongoing conflict, the access of the Iranian people to basic things like power or Internet or cell phone access is extremely limited. [2:03:44] The internet suppression by the Iranian regime is an objective that would be protecting the Iranian Revolutionary Guard Corps? [2:03:53] Yes, ma'am. We know that many, many on the foreign terror watch list in 2024, 358 suspects were found [2:04:20] and arrested on the northern border. Fiscal year 2025, that number has been reduced to 307. I want [2:04:26] to ask Director Patel, how would you characterize the type of those types of people that you have [2:04:33] obtained, arrested, or encountered on the northern border? Cartels, Islamic terror, organized crime, [2:04:40] how would you characterize those people, if you can? Thank you, Congresswoman. With the [2:04:45] solidification and reinforcement of the southern border, the northern border has become a target [2:04:49] of opportunity for foreign terrorist organizations, cartels, those that wish to conduct espionage [2:04:56] activities, basically all of the above. How would you characterize the partnership of our Canadian [2:05:01] friends to the north and their willingness to stop these individuals, especially in the last [2:05:05] year or so? At the FBI, we have engaged with the RCMP and their intel services that [2:05:10] have worked at these levels that have never been seen before to specifically focus on the fentanyl [2:05:15] productions north of our border. The cartels have shifted their operations to produce the lethal [2:05:21] fentanyl that kills so many Americans. So that's one example where we're focused and locked in with [2:05:25] our partners north of the border. Thank you very much. I appreciate that. One last thing I just [2:05:30] wanted to ask. Upstate New York is now the new home to Micron, one of the world's three leading [2:05:33] memory manufacturers, and the only US leading memory company. Memory produced at Micron is [2:05:39] integral to our lives. Can you give us a little background on that? So, let's start with the Far出 [2:05:40] and integral component of the GPUs used to train America's dominant frontier models. [2:05:46] I'd love to find out, Director Ratcliffe, what would be the economic and national security [2:05:54] implications if China were to catch up on the U.S. on memory, GPUs, critical minerals, [2:05:59] all those things that go into everything leading up to this, including the advent of AI? [2:06:06] Well, what you've seen, Congresswoman, is that when China can take advantage of things [2:06:11] in the supply chain, like critical minerals, they'll do that. This is particularly problematic [2:06:19] in the area of all emerging technologies and AI in particular. Obviously, whoever is dominant in [2:06:27] the technology fields in the future will dictate the rules in the international marketplace. It [2:06:32] would be devastating if China were ahead of us. Is that correct? Do I recall that correctly? [2:07:01] Generally, yes, sir. [2:07:02] How many days before we invaded Iran did you know we were going to launch an invasion? [2:07:08] We can get into those details in a classified setting, but I work with my colleagues, [2:07:12] across the spectrum here, to give me advance warnings so that we can reinforce. [2:07:16] Was it two days, three days, a month? [2:07:18] It was sometime before that, sir. [2:07:20] Sometime before that. With that knowledge, why did you fire at least a dozen agents in [2:07:27] Counterintelligence Unit 12 that specializes in Iran counterintelligence, which makes us much [2:07:32] less secure and safe with this war going on from Iranian attacks potentially against our country? [2:07:38] As I said earlier, Congressman, I don't work on timelines when these terminations occur, [2:07:42] they're internal investigations conducted by the careers of the FBI that highlight unethical or [2:07:47] inappropriate conduct, and it's up to me to make the decision. But our Iran Threats Mission Center [2:07:52] has never been more resourced, as I've highlighted, a 43% increase in counterespionage arrests from [2:07:56] Iran alone, and 360 ongoing terrorism investigations with Iran-affiliated individuals. [2:08:01] And the people you fired, those 12 people, they were experts on Iran, were they not? [2:08:05] I don't believe so. [2:08:07] They worked in counterintelligence, did they not? [2:08:10] I'm taking you at your word, sir. I'm not familiar with every single word. [2:08:12] You're the chief director. I'm not. [2:08:13] You are not. [2:08:14] At least you know the answer. It said, quote, [2:08:53] Iran's large conventional forces are capable of inflicting substantial damage to an attacker, [2:08:59] executing regional strikes, and disrupting shipping, particularly energy supplies, [2:09:04] to the Strait of Hormuz. It seems the IC was entirely correct in its assessment about Iranian [2:09:10] retaliation in the Strait. Did the IC's assessment about Iranian capabilities in the Strait of [2:09:16] Hormuz change in the past year? [2:09:18] No, Congressman. [2:09:19] Does Iran still have the capability to threaten shipping in the Straits of Hormuz? [2:09:25] Hormuz with missiles, mines, and small boats? [2:09:29] Their capabilities have been largely degraded, but yes, they still have means to threaten [2:09:33] passage to the Strait of Hormuz. [2:09:35] And how long can they keep the Strait closed? [2:09:40] Based on current events, I'd have to get an updated assessment from the intelligence community on that. [2:09:48] Did you have an analysis of the impact of a war on global supply change and the price of oil and gas? [2:09:53] I believe that assessment may have come from the Department of Treasury or Energy. [2:10:00] It didn't come through your office? [2:10:45] is responsible for making the decisions based on the totality of information and intelligence that he has available to him. [2:15:47] Prohibited case files are basically files that prior directors had created to essentially hide what was going on. [2:15:54] Right. [2:15:55] They do not exist in our sentinel systems. [2:15:58] And if you search for that specific case, it won't even come up, which is why I, as the first FBI director to do so, have terminated prohibited case files. [2:16:06] And as you know, I'm wed to constitutional oversight here at Congress and have delivered 50,000 pages, which is 400% more increase than my two predecessors combined. [2:16:14] Director, would ensnaring individuals or organizations based solely on their political affiliations or viewpoints be a potential violation of the Fourth Amendment? [2:16:23] I believe so. [2:16:24] Have any of the personnel associated with these activities? [2:16:26] And I understand that investigations may be ongoing. [2:16:28] Have they been removed from duty pending the outcome investigation? [2:16:32] Yes, many have. [2:16:34] Okay. [2:16:37] Moving on. [2:16:38] I'm concerned about a lab that was found in a clandestine Chinese bio lab that was found in California and then one that was found later in... [2:16:47] Las Vegas. [2:16:49] Yeah, Nevada. [2:16:50] And I'm wondering, are you concerned about a lack of vision or imagination in agents that are involved in the investigation? [2:16:56] Yes. [2:16:57] Are you concerned about a lack of imagination in agents that solely work on a case and can't see that China has the, you know, has the capability and the impetus to do these things all around the country and things like those things? [2:17:09] And have you done anything about changing that training or that operational conduct of agents? [2:17:16] I can only speak to what I've done. [2:17:18] And this FBI is keenly aware of it. [2:17:19] We're the ones that figured it out, not just in Las Vegas, but places like Michigan, where we arrested multiple individuals who were pretending to be researchers at the University of Michigan while bringing information to the FBI. [2:17:25] Okay. [2:17:26] While bringing in lethal pathogens and trying to steal our trade secrets and our agricultural secrets, which is national security. [2:17:32] So this FBI is laser focused on the Chinese threat, especially related to bio labs and agricultural theft. [2:17:38] Appreciate the response. [2:17:39] I yield the balance. [2:17:44] You know, I would be remiss if I didn't mention Operation Absolute Resolve and the arrest and capture of Nicolas Maduro and his wife. [2:17:52] It was incredibly complex. [2:17:54] It was bold. [2:17:55] It was unprecedented. [2:17:57] It was a wild success. [2:17:58] It really hearkens thoughts of Radon and Tebby 50 years ago, except this actually remarkably exceeded that in its success. [2:18:08] It was historic. [2:18:09] And it altered undeniably the geopolitical landscape in the United States' favor. [2:18:15] So our military and our IC should be lauded. [2:18:18] And I want to offer a hearty and deserved congratulations to all of you that are testifying before us today. [2:18:27] Thank you. [2:18:28] Director Ratcliffe, I want to just visit with you a little bit. [2:18:30] First, I do want to take a point of personal privilege. [2:18:33] I attended Coach Holtz's funeral one day. [2:18:35] He was very proud of you. [2:18:39] How long has Iran been pursuing a nuclear weapon, Director? [2:18:47] Congressman, let me respond. [2:18:49] I appreciate the kind remarks and also want to congratulate the people of the 4th District of Texas for getting a lot better representation than they ever did from the guy that was previously in that seat. [2:19:00] Notwithstanding, as I talked about, a fatwa that was issued, I believe, in 2004, Iran has had a dedicated nuclear program beyond civil limits for the development of nuclear weapons. [2:19:18] They currently possess at least 440 kilograms of highly enriched uranium at 60 percent weapons grade that would be capable of putting together 10 nuclear weapons. [2:19:29] Director, what nations do you support? [2:19:32] The United States has achieved 60 percent enrichment and then not produced a nuclear weapon. [2:19:38] I'm not aware of any. [2:19:39] There's none. [2:19:40] You get to 60 percent, there's a reason you're at 60 percent, because you are pursuing nuclear ambitions. [2:19:45] So we have sanctions have been imposed in the past, and yet that pursuit continued. [2:19:51] Their economy was teetering. [2:19:53] The pursuit continued. [2:19:54] Their people were suffering. [2:19:56] The pursuit continued. [2:19:57] Under the Bush, Obama, Trump 45, Biden now, Trump 47. [2:20:01] That went on. [2:20:02] That pursuit continued. [2:20:03] Then last June, Operation Midnight Hammer. [2:20:07] Nuclear program was dealt a significant setback. [2:20:10] But not only that, the autocratic illegitimate regime in Tehran witnessed firsthand that the American resolve under this administration should be taken very seriously. [2:20:21] I want to read you a few quotes. [2:20:23] Iran will never be permitted to build a nuclear weapon. [2:20:26] Barack Obama, 15. [2:20:28] The message to Iran should be loud and clear. [2:20:30] We will never allow you to acquire a nuclear weapon. [2:20:32] Never. [2:20:33] Hillary Clinton. [2:20:34] Iran will never get a nuclear weapon on my watch. [2:20:36] Iran can never develop or acquire a nuclear weapon. [2:20:39] Joe Biden. [2:20:40] Make no mistake, as president, I will never hesitate to take whatever action is necessary to defend American forces and interests from Iran. [2:20:49] Kamala Harris. [2:20:51] So last June, we have Midnight Hammer. [2:20:54] And not only did they see the resolve, I mean, they saw that we were committed to actually taking action. [2:21:01] And not just the words this time. [2:21:03] And even after all of that, did they abandon their pursuit and their nuclear program? [2:21:09] They absolutely did not, Congressman. [2:21:13] I think you point out the success of Operation Midnight Hammer is that one of the things that we assess in the intelligence community broadly is that since that operation, Iran has been unable to enrich a single kilogram of uranium to 60% since that operation. [2:21:32] But as you correctly point out, Congressman, notwithstanding that, our intelligence is also clear that they have not lost their ambition. [2:21:42] And that the activities to rebuild or reconstitute their nuclear facilities and centrifuges is something that the intelligence, there's a body of intelligence that I think confirms that. [2:21:57] Then we had eight months of negotiations and attempted diplomacy. [2:22:01] They proved fruitless. [2:22:02] And you know what? [2:22:03] And yet the pursuit continued. [2:22:05] And then, Director, is there any intelligence or evidence that the Supreme Leader and his thug mullahs, after all that, at the beginning of this year, were going to finally stop their pursuit of their nuclear weapon in their program? [2:22:21] No. [2:22:23] So we have some folks here that are splitting hairs about imminent threat. [2:22:26] You know what? [2:22:27] Was it a grave threat, Director, in your opinion? [2:22:30] Nuclear weapons are a grave threat in the hands of religious ideologues. [2:22:35] 60% enrichment. [2:22:36] No nation state that achieved that hadn't produced a nuclear weapon. [2:22:39] We can either talk about it, kick the can down the road, and let them get a nuclear weapon and get danger close to it on the precipice, or we can take action now, and this is what this administration chose to do. [2:22:53] Every day the brave men and women of our intelligence community, armed forces, and federal law enforcement work to protect our homeland from a constant and evolving array of threats. [2:23:00] But since Democrats chose to shut down the Department of Homeland Security, those threats have grown more acute. [2:23:05] Our country has already experienced four terrorist attacks since the shutdown began. [2:23:10] The consequences are no longer hypothetical. [2:23:12] They are unfolding in real time. [2:23:14] At a moment when the global threat environment is intensifying, terrorist organizations are resurging, and adversaries continue to encourage violence against Americans. [2:23:22] Congress should be reinforcing our defenses. [2:23:24] Instead, Democrats have sidelined the very department responsible for keeping the homeland safe. [2:23:30] Not a single Democrat here on this committee voted to reopen the Department of Homeland Security. [2:23:34] That was not an accident. [2:23:36] It was a political decision made at the expense of the safety and security of the American people. [2:23:40] As threats to our homelands rise and our enemies grow more emboldened, this decision has weakened our defenses and replaced action with dysfunction. [2:23:48] Each day the threat environment worsens, and with it the risk to the American people, which is indefensible. [2:23:53] Do each of you agree that the reckless Democratic shutdown of the Department of Homeland Security has affected your agency's ability to detect, deter, and respond to threats against the homeland? [2:24:03] Specifically, has it impacted intelligence sharing, operational coordination, or your capacity to prevent attacks? [2:24:09] General Hartman. [2:24:10] Congressman, it hasn't had a significant impact on the foreign intelligence mission of the National Security Agency. [2:24:18] Director Patel. [2:24:19] The shutdown has had a significant impact on how we protect and defend the homeland. [2:24:23] Director Gabbard. [2:24:24] This has directly affected the intelligence elements within the Department of Homeland Security negatively. [2:24:31] Director Ratcliffe. [2:24:32] I would agree with the Director of National Intelligence. [2:24:35] General Adams. [2:24:36] Yeah. [2:24:38] It has had no significant impact on the Defense Intelligence Agency and the foreign threat that we analyze. [2:24:46] So, Director Gabbard, you, in your opening statement, talked about the threats to the homeland and the changes that you've made as it relates to the border and the changes that the President has made. [2:24:54] After four years of open border policies under President Biden, during which cartels and gangs expanded their operations into American cities, what specific actions has ODNI taken to disrupt these criminal cartels and networks and stop the fentanyl poisoning and murdering units? [2:25:08] Secretary Tom Carr. [2:25:09] Thank you for your question, Congressman. [2:25:10] We've taken several actions to be able to get after this threat that the President made a priority, number [2:25:23] One being making historic shifts in intelligence collection towards addressing this threat. [2:25:24] I believe it is the biggest shift in intelligence capabilities that we've ever seen, or certainly in a long time. [2:25:29] The integration and cooperation between our national counterterrorism center and our intelligence base這邊. [2:25:37] center with the DEA and other Department of Homeland Security elements is also unprecedented. [2:25:46] We have taken and coordinated the collection of individuals, known and suspected terrorists, [2:25:52] known and suspected cartel members, leaders, and inputted that into the TIDE system, which [2:25:57] has radically increased and improved our ability to identify those who are cartel and gang [2:26:02] members trying to enter our country and those who may already be in our country. [2:26:08] National Counterterrorism Center has been working again in coordination with our interagency [2:26:12] partners to get after the financial networks that these cartels and gangs rely upon to [2:26:17] be able to continue to fund. [2:26:21] As Director Patel has spoken about, we have national counterterrorism elements that sit [2:26:28] within the Joint Terrorism Task Forces and support the interagency efforts to continue [2:26:32] to carry on. [2:26:33] We will continue to get after this threat very effectively. [2:26:35] Thank you. [2:26:36] Director Patel, Mr. Cohen was asking you about a recent firing of counterespionage agents [2:26:41] with Iranian expertise. [2:26:44] You and the FBI are taking and will continue to take all required steps to keep the American [2:26:47] people safe during President Trump's historic military action against an oppressive and [2:26:51] evil Iranian regime. [2:26:53] Is that correct? [2:26:54] Absolutely. [2:26:55] And there's 36,000 people employed at this FBI. [2:26:59] And I reject the notion wholeheartedly that the termination of those that were weaponizing [2:27:03] law enforcement are the only ones that can do the mission. [2:27:05] There's a 43% increase in counterintelligence and espionage arrests just related to Iran [2:27:09] alone, which is a record year for the FBI. [2:27:11] Well, and you plussed up nearly a thousand agents in the field throughout the United [2:27:15] States since this has occurred. [2:27:16] Yes, sir. [2:27:17] And there's a document that you posted on X, and I think that's what you have in front [2:27:22] of you, about all of the wins and the changes that the FBI has made under your leadership [2:27:26] and President Trump's leadership during 2025 and the little time that I have remaining. [2:27:30] Could you just highlight some of that for the American people? [2:27:31] Sure. [2:27:32] Thank you. [2:27:33] Under the Trump administration, this FBI has literally had a historic year. [2:27:37] We have 112% increase in violent offenders arrested last year alone, a 20% decrease in [2:27:43] homicides, 20% decrease in robberies. [2:27:47] We have disrupted 1,800 criminal gangs. [2:27:49] That's a 210% increase. [2:27:51] We seized enough fentanyl to kill 178 million Americans. [2:27:54] That's a 31% increase. [2:27:55] We have gone after the most vulnerable in our society, protecting children, a 490% increase [2:28:01] in arrests. [2:28:02] Those that prey on our children online. [2:28:05] We have located, found, and identified 6,200 missing kids. [2:28:09] That's a 30% increase. [2:28:10] We have dismantled and taken down 1,700 child predators. [2:28:14] That's a 17% increase. [2:28:16] And those that wish to traffic our young American citizens and women, 300 human traffickers [2:28:22] have been arrested. [2:28:23] That's a 15% increase. [2:28:25] And seven, seven of the FBI's top 10 most wanted fugitives in the world have been apprehended [2:28:32] in the last 13 months. [2:28:33] To put that into perspective, there was four in the prior four years. [2:28:36] So this FBI, under President Trump, is fully stocked to get after every single fight we [2:28:41] have. [2:29:14] Myth number one has to do with 702 versus FISA Title I. [2:29:20] Trump was targeted with FISA 702. [2:29:22] Is that a myth? [2:29:24] That's a myth. [2:29:25] It's not true. [2:29:26] Well, it's just real quick. [2:29:28] How was President Trump targeted under a crossfire hurricane? [2:29:32] Under FISA Title I, Title III authorities. [2:29:34] Inflation. [2:29:35] Inflation. [2:29:35] Inflation. [2:29:35] Inflation. [2:29:38] I think it's worth [2:29:54] pointing out that whether this process was FISA or in regular court, it was still lies [2:30:04] told by the people trying to get the warrant. [2:30:04] It had nothing to do with FISA. [2:30:06] It was simply the people trying to get the warrant were lying. [2:30:06] Okay. [2:30:06] A query means that we're spying on Americans, means we're reading their inboxes, we're getting inside their text messages, all of that. Is that true? [2:30:17] No, I'm going to borrow General Hartman's answer. A query of 702 is pursuant to lawfully collected information of non-U.S. citizens overseas. [2:30:28] Right. So if you query an American citizen, are you accessing their inbox? [2:30:33] No. [2:30:33] Now, you're just seeing if they have spoken to somebody who was a foreign intelligence officer, let's say, and you would know they've spoken to them because they would show up as part of that conversation. [2:30:45] In foreign intelligence collection. [2:30:46] In foreign intelligence collection. So if, and if you wanted to get inside their inbox, you would have to get an actual warrant under current law, right? A U.S. person. [2:30:59] A warrant or a subpoena process. Yes, sir. [2:31:01] Okay. So that's a really important distinction. [2:31:03] Congressman, if I could just. [2:31:05] Sure. [2:31:05] But you wouldn't use F.A. [2:31:07] 702 to do that. [2:31:09] Correct. [2:31:10] To get in the, I just want to be clear about that. [2:31:12] Yes, you would not. [2:31:12] There is. [2:31:13] You would use your regular court process. [2:31:14] No authority under 702 to collect intelligence intentionally against U.S. persons. [2:31:21] Right. [2:31:23] Yeah. [2:31:23] So when somebody, and let's say their name rhymes with, I don't know, Tucker Carlson, is claiming that the CIA is spying on him, I would, I'm going to guess here, because I don't know, I'm going to guess that the most likely scenario is that in the process of him speaking, [2:31:39] with Iranian intelligence officials, it is incidentally collected. [2:31:43] Nobody is spying on Tucker Carlson or his inbox, to my knowledge, at least. [2:31:47] Number three, another myth, a warrant requirement, should it be required by law, is it's for a simple query that should be easy to get, right? [2:31:58] What's the problem? [2:32:00] It's easy to get a warrant. [2:32:01] We do it all the time. [2:32:02] Would it be easy? [2:32:05] In my opinion, no. [2:32:07] But. [2:32:08] And the reason it wouldn't be easy is because oftentimes these queries are not easy to get. [2:32:11] Right. [2:32:11] Right. [2:32:11] Right. [2:32:11] Right. [2:32:11] Right. [2:32:39] To connect the dots from the outside actors, which we can collect on. [2:32:42] They have no powers. [2:32:42] have no constitutional protections but you're removing our ability to connect them with the [2:32:47] inside actors which is kind of where it matters it's like it's like giving up when you're when [2:32:53] you're when you're right at the goal line that makes zero sense to do and that's exactly what [2:32:57] this would do do i've already heard director ratcliffe's answer on this but 18 months uh [2:33:04] reauthorization clean reauthorization does that i don't know where that number came from but [2:33:08] would you rather have it longer as director ratcliffe said i'd like five or ten years [2:33:13] okay me too um quickly and well i yield back thank you mr hill thank you chairman thank you [2:33:25] panel for being with us this morning and uh let me start with director gabbard you've heard from [2:33:31] mr stuby you've heard from admiral jackson you've heard from miss tinney all this aspect of who we've [2:33:37] encountered at our borders north and south and during the bite administration with the open [2:33:42] border that has been overly discussed today at length um there's this known and suspected [2:33:48] terrorism i want to congratulate you on that and i want to congratulate you on that and i want to [2:33:49] congratulate the trump administration for getting i think 1300 people identified out of the country [2:33:54] under your 13 months so congratulations on that but for three years uh in both classified [2:34:01] unclassified sessions here i've raised this issue that we don't have the data and we don't track it [2:34:06] in a fused way meaning border patrol tsa fbi and follow-up doj and prosecutions and we don't really [2:34:16] have that at our fingertips for oversight purposes [2:34:20] i asked you last year's worldwide threats would you commit to helping us achieve as the od and i [2:34:27] that fused data you agreed but it was only three days ago i got that commitment to [2:34:32] from you in writing so let me ask you again can you help drive that process across the bureaucracy [2:34:38] to get that regularly provided to the intelligence committees [2:34:42] sir thank you for the follow-up on that we have continued to work to improve that consolidated [2:34:50] use of systems that will better help us identify who is in our country who are known or suspected [2:34:58] terrorists to include those who are members or leaders of cartels and gangs and drug traffickers [2:35:02] and and we're continuing to uh we're continuing to pursue that particularly with the department [2:35:09] of state and their screening and vetting practices as well as the department of homeland securities [2:35:14] i will say that there has been a drastic improvement in our own screening and vetting [2:35:20] systems and that coordination is occurring but there are still some silos that need to be broken [2:35:25] down also in follow-up to the discussion today i heard my friend from california mr barra assert that [2:35:34] president trump's action in epic fury was unconstitutional do you think it was [2:35:38] unconstitutional the decision taken by the president uh that's a legal question sir that [2:35:43] i i believe has been asked and answered by uh the white house council but don't you think in [2:35:49] article two power on the war powers act the president has the right to defend [2:35:52] american interests allied interests he does and he can do that for 60 days and do you did the [2:35:57] president and you consult with the gang of eight in congress before the president took military [2:36:03] operations uh my understanding is the secretary of state uh fulfilled that responsibility i think [2:36:10] that's clear i don't recall president uh obama for example declaring war for seven months of [2:36:16] operations in libya so i think there's a lot of hypocrisy here as we try to defend american [2:36:21] interests um [2:36:24] mr klein asked you about and made a good comment i thought about uh and he talked to director patel [2:36:31] about this on this issue of winter shield and doing a better job of coordinating offensive [2:36:40] and decent defensive cyber here in the homeland and i think that's another place director where [2:36:46] i think you should play an outsized role to coordinate again this issue of all [2:36:51] operations i'm very concerned that we don't have a fused i'm going to use that word again [2:36:57] to address some of the issues that we have already discussed this morning um i'm very concerned that [2:37:01] we must emphasize that the fbi is in no way the only person who could make a choice between [2:37:05] uh civil defense posture on cyber defense because we're too compartmentalized we're too siloed [2:37:12] between who's with the military and not with the military who's got classifications and who doesn't [2:37:17] would you work with me on trying to design a way for our governors our private sector the fbi to [2:37:24] work better on countering state actors in our private sector yes sir i would look forward to [2:37:28] this would have to be done in conjunction with the Department of Homeland Security and CISA, [2:37:32] given their statutory responsibilities. The integration and coordination with the private [2:37:37] sector remains one of the biggest imperatives, but also in some cases challenges for folks who [2:37:44] choose not to work with the U.S. government. I agree. I sit on the CISA subcommittee here, [2:37:49] and I'm very concerned about it. And I think our whole committee has been concerned about [2:37:53] the assessment we have on offensive cyber, so we look forward to that. Finally, Director Radcliffe, [2:37:59] thanks for you being here, and it's wonderful to see you. Thanks for our decade of friendship. [2:38:04] I want to say that I've traveled significantly with the chairman to Latin America, and I want [2:38:08] to say your stations throughout the Western Hemisphere are doing an outstanding job. [2:38:13] Would you say that we're back on track countering great power rivals in the Western Hemisphere? [2:38:19] I would. Thank you for the compliments for the workforce that I'm privileged to [2:38:24] lead. [2:38:24] And I do think the president's policies in making the Western Hemisphere a priority are really [2:38:32] clear. Obviously, the success of Operation Absolute Resolve, it's funny, Congressman, [2:38:39] no one's talking about Venezuela because things are going so well in Venezuela. [2:38:45] But it really shows the commitment that the president has to taking care of business [2:38:49] for American interests in our own hemisphere. And it's not limited to Venezuela. It's [2:38:54] throughout Central and South America. And I think that you'll continue to see continued [2:39:00] progress with respect to that. Thank you.
