[00:00:00] Speaker 1: using it in her house in the form of candy bars or whatever, and you're in the back room with your girlfriend having-- [00:00:05] Speaker 2: - And you have an opportunity for a job? - Yeah, I have an opportunity to do a job. I have a neighbor that does construction, so-- [00:00:12] Speaker 1: - Does your neighbor know that you're doing marijuana? [00:00:18] Speaker 3: - Yes, ma'am. [00:00:19] Speaker 1: - You're telling me that your neighbor wants to hire you and your neighbor knows that you're doing marijuana. [00:00:27] Speaker 3: Tell the truth. - No, ma'am. [00:00:32] Speaker 1: - Here's the other thing, do not be dishonest with me. I do not like when people are dishonest. [00:00:39] Speaker 4: - Kind of dirty. - Okay. [00:00:42] Speaker 1: - All right. [00:00:42] Speaker 4: - Kind of dirty. You said kind of dirty. [00:00:45] Speaker 1: - Dirty for what? [00:00:49] Speaker 4: - Marijuana, I think. [00:00:50] Speaker 1: - No, it's not a marijuana, I think. You know what you were using, so what have you used? Let me put you under-- Can you raise it to say like a hotel motel? That should not be happening, and you know why? 'Cause it sets a bad example for his siblings. And then your home becomes a hotel motel. The only difference is they don't have to pay for it. R6828 State of Texas versus Alonzo Taylor. Can I have parties announced for the record for the state? - Jason Gerehan, your honor. - For the defense? [00:01:20] Speaker 3: - Greg Desmarais, for the defense. [00:01:24] Speaker 1: - We are here for-- - Desmarais. - Could you spell your last name for the court reporter, please? [00:01:30] Speaker 4: - Yes. D-E-S as in Sam. M-A-R-A-I-S as in Sam. - Thank you. - A-R-A-I-S. [00:01:41] Speaker 1: - So we're here for sentencing today. You entered a plea on March 29th of no contest and you applied for deferred adjudication. According to the plea bargain agreement, punish must be assessed at a cap of five years, and the state is silent on your application. All right, have both parties had a chance to review the PSI report. [00:02:05] Speaker 4: - Yes, Your Honor. [00:02:06] Speaker 1: - Yes, Your Honor. - Any objections to the PSI report? [00:02:08] Speaker 4: - No objections, Your Honor. [00:02:09] Speaker 1: - All right, defense. [00:02:11] Speaker 4: - Your Honor, I'd like to say a few words and then call Alonzo and his mother up, if that's possible. [00:02:16] Speaker 3: - Yes. [00:02:17] Speaker 4: - So the first thing, Judge, as you go through this PSI, the thing that sticks out is criminal history, obviously. This young man just turned 20, April 8th. And as we just talked out there, I'm saying this is, you're the perfect candidate for probation because of this. You're at a crossroads. Your life is gonna be defined by what you do from now on. You've already made this thing as since a 12 year old, if you go back with those ages. He does have certificates for construction that he can work. He does have a job. He does not have any dependents. I've talked to him about his alcohol and drug use and he's saying that is not happening. [00:02:58] Speaker 1: - All right, if you're drug tested today, where are the results gonna be? [00:03:02] Speaker 4: - Kind of dirty. - Okay. [00:03:05] Speaker 3: - All right. [00:03:06] Speaker 4: - Kind of dirty. You said kind of dirty. [00:03:08] Speaker 1: - Dirty for what? [00:03:12] Speaker 3: - Marijuana, I think. [00:03:13] Speaker 1: - No, it's not a marijuana, I think. You know what you were using. So what have you used? Let me put you under oath. Can you raise your right hand for me, please? Do you solemnly swear or affirm, the testimony you give will be the truth and nothing but the truth, so help you God? [00:03:26] Speaker 5: - Yes, ma'am. [00:03:27] Speaker 1: You can lower your hand and you're gonna have to speak up so the court reporter can hear. So what are you gonna be dirty for? [00:03:32] Speaker 2: - Marijuana. [00:03:33] Speaker 1: - And what else? All right, before we continue, I'm gonna want a UA. [00:03:39] Speaker 3: - Yes, Judge. - All right. - Do you need to do a UA? [00:03:41] Speaker 1: Do we need to walk you down there? - Oh, they're gonna have somebody come and give him a UA. - All right. [00:03:47] Speaker 4: - You know what? - You can judge me. I'm gonna run around some other court, real quick. [00:03:51] Speaker 1: - Yes, you can. [00:03:51] Speaker 4: - How long is that gonna take? [00:03:53] Speaker 1: About an hour? - Oh, no. Oh, no. They're gonna do a UA. Are you prepared to go now? All right. So they're gonna do a UA very quickly. All right. And yeah, so, Avashan, do we have results? [00:04:07] Speaker 6: - Positive for taste. [00:04:08] Speaker 1: - Okay. [00:04:09] Speaker 4: All right, let's bring him on out. - Do we have a base level or what? [00:04:13] Speaker 1: - No, they can't give a base level. - I'm on Judge. [00:04:15] Speaker 4: I'm working in an area. [00:04:17] Speaker 1: - I know, and you're a teacher, too. - About to teach. - Yeah, well, you know, sometimes clients don't tell you everything. [00:04:27] Speaker 4: - Well, no, and I talked to his mom about that. - Okay. - So, Lonzo right here. [00:04:32] Speaker 1: - All right, we're back on the record. So, when's the last time you used marijuana? [00:04:38] Speaker 2: - About a week ago, there was a candy bar. [00:04:43] Speaker 1: - Okay, you're gonna need to speak up. Right now is not the time to be too cool for school. [00:04:47] Speaker 2: - It was about a week ago, there was a candy bar site. My voice was just kind of deepened up. [00:04:53] Speaker 1: - So why are you doing marijuana when you know you have sentencing, and you know I could send you to prison for five years? Because I'm sure your attorney will tell you, and I'm sure the state will tell you, in this court, age is just a number. I'm not gonna treat you like a child, because you're not a child, you're in adult court. I don't know why people wanna use some drugs before they come to court, and then try to throw their self on the mercy of the court. State is silent, but you're here for a serious offense, where you could end up going to prison for five years. And I will tell you this, if you end up going to prison for five years, it's not your mom's fault, it's not your attorney's fault, because I'm sure your attorney probably already told you that I always, well not always, but usually ask for a drug test, and all you had to do was come into court clean today. And if I were to send you to prison today, which I haven't made up my mind on that, it will be entirely your fault, because your criminal history is just insane for someone your age. - Do you understand? [00:05:54] Speaker 2: - Yes, ma'am. [00:05:56] Speaker 1: - So what are you doing with your life? [00:05:58] Speaker 2: - Well, I'm not gonna say that, you know, in the past that, you know, it was a regret, 'cause jail kind of did help me out, you know, I had problems, it helped me. [00:06:08] Speaker 1: - All right, let's do this. Let's stop saying, you know, after every sentence. I want you to concentrate and try not to say, you know. A lot of people come before me and they say, it's like, well, like this and like that, your attorney is also a teacher as am I. And I will tell you, he does not like his children saying, you know, it's like, so let's try not to have that when we speak. - Okay. - All right, go ahead. [00:06:37] Speaker 2: - Well, I went to school for, you know, construction. It's always been like, I'm having a dream job. You know what I mean? I'm sorry, it's just how-- - May I ask him a few questions, Your Honor? [00:06:49] Speaker 1: - No, I wanna hear him. [00:06:52] Speaker 2: - Well, I went to construction for about three years, but I mean, the school construction, you know, [00:06:56] Speaker 1: it's hard and I'm doing this not to make fun of you, but you have to learn how to speak, not like you speak with your friends, because this is a professional setting. And when you go do job interviews, people are not going to wanna hear, it's like, you know, so concentrate on not saying those things. It's for the betterment of you. So concentrate, not saying that, and not saying, okay, and it's like, and I want you to stand up straight, and I want you to stop mumbling, and I want you to speak so I can hear you, because I'm trying to make a decision on whether or not to send you to prison. [00:07:49] Speaker 2: - Yes, ma'am. [00:07:51] Speaker 1: - So go for it. [00:07:53] Speaker 2: - I went to school for three years for construction. I got, since then, I got my NCCR, OSHA, [00:08:00] Speaker 3: and my car, level and carpentry, you know, cabinets and stuff like that. [00:08:10] Speaker 4: - Do you have an opportunity for a job? [00:08:12] Speaker 2: - Yeah, I have an opportunity to do a job. [00:08:14] Speaker 3: I have a neighbor that does construction, so. [00:08:17] Speaker 1: - Does your neighbor know that you're doing marijuana? [00:08:22] Speaker 3: - Yes, ma'am. [00:08:24] Speaker 1: - You're telling me that your neighbor wants to hire you, and your neighbor knows that you're doing marijuana? [00:08:30] Speaker ?: - No, ma'am. [00:08:31] Speaker 3: - No, ma'am. - No, ma'am. [00:08:37] Speaker ?: - Here's the other thing. [00:08:38] Speaker 3: Do not be dishonest with me. I do not like when people are dishonest. I do not like when people are dishonest. [00:08:46] Speaker 1: You cannot do construction and use drugs. If you do, something's gonna happen. If you do, something's gonna happen. Either there's gonna be an accident at the job, and I have relatives who do construction work. I have relatives who drive. Anytime there's an accident, the first thing they want them to do, whether it's their fault or not, is take a drug test. And if there were an accident at a construction site, they would have you take a drug test. You would be positive for marijuana like you're positive today, and you would be fired. And they will be looking at a civil suit because someone is on their site using drugs. Do you understand? [00:09:28] Speaker 2: - Yes, ma'am. [00:09:28] Speaker 1: - And are you living with your mother? [00:09:30] Speaker 3: - Yes, ma'am. [00:09:31] Speaker 1: - I know she doesn't want drugs in her house. [00:09:35] Speaker 3: - Yes, ma'am. [00:09:37] Speaker 1: - Can I see his mom? [00:09:38] Speaker 4: - Absolutely. Ma'am, come on up. [00:09:40] Speaker 1: - Here. [00:09:42] Speaker 4: - And you had requested her, Judge, and you made sure she wanted to be here as well. [00:09:46] Speaker 1: - Thank you. Can you raise your right hand for me, please? Do you suddenly swear or affirm the testimony you give will be the truth, that nothing but the truth will help you, God? [00:09:56] Speaker 7: - I'm gonna sit down. [00:09:57] Speaker 1: - All right. If you can lower your mask and state your name for the record. [00:10:01] Speaker 7: - My name is Tracey. - All right. [00:10:04] Speaker 1: And are you his mother? - Yes. - What does he spend his day doing? [00:10:11] Speaker 7: - Well, just normal, sleeping. He goes and helps me with Ubering. [00:10:19] Speaker 3: - How does he help you with Ubering? - He delivers the food. [00:10:24] Speaker 1: - Does he have any friends over? [00:10:27] Speaker 7: - Not really. - Does he have a curfew? - Well, he has a GPS on, so he doesn't get to leave. He's just gone from two to 10 and then he's at home. I don't really have any. He's different. He's calmer. [00:10:41] Speaker 1: - Does he help you clean the home? [00:10:44] Speaker 7: - He does. He cleans his room. That's the most important thing is keeping his room clean. That's what I care about is every kid can clean their own room, washer, don't own dishes. That's great with me because that is the most important thing is if he can make sure he cleans his room because I know he doesn't make a lot of the mess that's in the kitchen. - It's not him, but when he does, he's very good at cleaning. He's different. [00:11:13] Speaker 1: - All right. Who all is in the household? [00:11:16] Speaker 7: - So it's me, it's Lonzo, my three other kids. My friend comes around once in a while, but he doesn't live there, but he does. [00:11:29] Speaker 1: - So are the people in the home just his siblings? [00:11:32] Speaker 7: - Just his siblings. His girlfriend comes, but she doesn't stay. [00:11:36] Speaker 1: - And I'm hoping she's not in a room, in a bedroom with the door closed with him. - Yes. - Oh, that needs to stop. I don't know how parents do it today, but what I can tell you in my household when I was growing up, number one, there were no boys in bedrooms. - Yeah. - Number two, they were only in common areas. And number three, they had to call before they came. And when my grandmother would babysit me, my aunt had a boyfriend to come over and you know what ended up happening? He overstayed his welcome. And you know what my grandmother told him? No one is going to come into my home and try to out-sit me. And she put him out from the common area. - Now he hung around and now he and my aunt have been married for like 30 years. So I guess he was like, I'm going to take what your grandmother's is dishing out. But he should not be in a bedroom with a door closed with his girlfriend. You know why? Because one, he's not ready to have a child because he's using marijuana. He has all this criminal history and any mother who would allow a girlfriend to see someone with the baggage he has when he doesn't have his life in order, I question that mother. And he may end up improving his life, but the way his life stands right now, it's chaos. It's chaos with the GPS, it's chaos because he's looking at five years prison and you have some girl coming over in his bedroom with the door closed. - That equals possibility of children. And are you ready to be a grandmother from him? [00:13:24] Speaker 7: - No, they both take care of themselves to the point where they are not having their kids. - No, no, they don't. [00:13:30] Speaker 1: They're young. And young children tend to do dumb things. Whether they have been raised by Mary Poppins or not, they still do dumb things. And I'm just going to be honest with you, right? - I don't understand how parents allow children who are not married to come into their home and treat their home, as my grandmother used to say, like a hotel motel. That should not be happening. And you know why? Because it sets a bad example for his siblings. And then your home becomes a hotel motel. The only difference is they don't have to pay for it. [00:14:10] Speaker 3: - They do. [00:14:11] Speaker 1: - So that needs to stop. [00:14:13] Speaker 3: Do you understand? - Yes, I understand. - All right, thank you. All right, here is your choice. [00:14:30] Speaker 1: I can give you deferred adjudication. If I give you deferred adjudication, if you are revoked, you want to be looking at 10 years in prison. Or I can send you to prison for two years, and you will be done. Which would you prefer? - Adjudication. [00:14:45] Speaker 3: - Right. [00:14:46] Speaker 1: And what I can tell you is, Deputy Laura tells me all the time that she doesn't know how people do probation in this court, because probation in my court is difficult. Because if I give you probation, I want you to be rehabilitated. Do you understand? [00:15:04] Speaker 2: - Yes, ma'am. [00:15:05] Speaker 1: - All right, the court is going to sentence you to five years deferred adjudication. There's a $1,500 fine that will be probated. There should be proof of employment within 30 days. There should be no employment as a home healthcare provider or with minors. There should be regular reporting by Zoom or in person. There should be regular UAs, I'm going to want him tested for levels. Those levels have better start going down. You understand? [00:15:47] Speaker 2: - Yes, ma'am. [00:15:48] Speaker 1: - And is this girlfriend you have, is she using as well? - No, ma'am. - Another reason why she shouldn't be with you, it sounds like she doesn't use drugs, but you do. And then you have these criminal cases, and you've just been placed on deferred for felon in possession of a weapon. You need to ask yourself, why is she with me? And if it's because she sees something in you, you need to ask yourself, what does she see in me? And the fact that she's taken a chance on you, you need to start doing better. - He's going to remain on GPS. I'm going to want a curfew. The only exception to the curfew is if he's at work. So he's going to be in the home by 8:00 PM. And if he's not working on weekends, he is to remain at home on the weekends. So there will be no parting for you. [00:16:43] Speaker 4: - Your Honor, if I may, so the construction job with his neighbor that he was talking about, he was saying that, how is that going to work with GPS? Because I don't know if that person, well, that's what we need to find out. We need to talk to him and see if he can arrange his schedule. [00:16:56] Speaker 2: - It's on a, it's on a, the problem we have with the GPS, it's on a school campus and they go around the military bases and they do the roost. [00:17:05] Speaker 1: - Oh, we'll figure it out. [00:17:07] Speaker 2: - We'll figure it out. [00:17:08] Speaker 1: - Yes. [00:17:09] Speaker 4: - They want you working. They want you using your craft, but you also got to show this court that you're going to be doing what you need to do. [00:17:16] Speaker 1: - All right. So it's partial GPS. [00:17:18] Speaker 4: - I get it. [00:17:19] Speaker 1: - All right. It's partial GPS for employment. I'm going to want field visits one time per month, 200 hours of community service, restitution. Probation. Is there anything else he needs? [00:17:39] Speaker 6: - Yes, he said 8:00 p.m. to 6:00 a.m.? - No, no. [00:17:45] Speaker 1: He, he, my understanding, he's going to be working throughout the week. So he doesn't leave the house till 7:00 a.m., and he's back at 8:00 p.m., but if he's at work, then he can work. [00:17:59] Speaker 4: - And Judge, I appreciate your thorough thoroughness. I just need to make sure he understands this. You're saying you're saying, if that construction job, if he doesn't, if he cannot have the GPS, you're saying, then he cannot work that job. Is that what you're saying? [00:18:11] Speaker 1: - Well, let's just see, I don't believe in crossing bridges until they're, they're built. So let's see where we are on that. And then if there's an issue with that, then he can come back to the court. And this court to be successful on probation, communication is key. So if there's an issue, talk to the probation. If you're not able to speak with probation, or you feel like they're not addressing your issue, then come to court and address it with me. [00:18:36] Speaker 2: - Very good. Well, the issues on the construction job side is not with this side. That's the reason I haven't been able to work yet. [00:18:46] Speaker 1: - Okay, I don't understand what you're saying. [00:18:48] Speaker 2: The issues on the construction side, that's why I haven't been able to work yet. [00:18:52] Speaker 1: - Like, what is the issue? [00:18:54] Speaker 2: - It's the monitor of me being around, you know, got to be on a school campuses, military bases. It just doesn't look right in the field. [00:19:02] Speaker 4: - So you need to talk to that boss and see if that's a no go. [00:19:07] Speaker 1: - I mean, get some big boots, get some big boots on, pull your pants leg over the GPS. Here's the reason why you're on GPS. I don't just put people on GPS. Sometimes people who are on probation, they get taken off of GPS. The reason why you're on GPS is because you are not even doing what you're supposed to do with this hanging over your head. You knew that I could send you to prison for potentially five years, and you chose marijuana over having a better shot at not going to prison. And I'm going to want a tap evaluation. [00:19:43] Speaker 7: - It was already... [00:19:45] Speaker 1: - Oh, that is true. What are they recommending? All right, what I'm going to do with you, I'm going to want 90 sober meetings in 90 days, and those are all over the city. You understand? [00:20:05] Speaker ?: - Yes, ma'am. [00:20:05] Speaker 1: - Are you able to stop using marijuana or you need some type of intervention? [00:20:09] Speaker 2: - I'll be able to stop. [00:20:11] Speaker 1: - All right, probation, is there anything else? Is there anything else you need from the court in order to be successful? [00:20:17] Speaker 3: Speak now or forever hold your peace? [00:20:26] Speaker 2: It's just my concern is about the job. You know, it's kind of my dream job. [00:20:31] Speaker 1: No, wear long pants. And I've said it, I'm going to say it again. And maybe the marijuana is clouding your mind, but this is what I'm telling you. Wear long pants, wear bigger boots. If there's another issue where the construction job is saying you cannot wear GPS to work this job, then that means that bridge has been built. Your attorney can come back to me and we can address it, but if they are saying that construction, you can't have that with construction, you're going to need that person to come into court or either do an affidavit with your attorney or directly speak to your attorney to say construction cannot be done with this. Do you understand? [00:21:15] Speaker 2: Yes, ma'am. [00:21:16] Speaker 1: All right, showing you what's entitled trial court certification of defendants' rights to appeal. Did you review that with your attorney? Did you understand it? Did you sign it? Yes, ma'am. [00:21:26] Speaker 4: Yes. One more. Thank you. [00:21:29] Speaker 7: So my son passed away. How long? It was four years ago, but I wanted to do something with my family for his birthday, and that's this Saturday. And I wanted to find out if that would be okay. All right. We're going to the Live Oak Park. Okay. [00:21:49] Speaker 1: Can you make sure that they're allowed to celebrate her, I won't say celebrate, but acknowledge her son's passing and that he's allowed to attend? So Saturday, whatever their plans are, he's allowed to attend? [00:22:04] Speaker 7: And as far as the monitor, so I completely understand what, why you want to have the monitoring and not, but I will tell you that a lot of interviews and so it is very difficult to wear a monitor to, and people want to give you a job. And so his friend was explaining to him too, because I overheard the phone, and I overheard you say something too, and it made me think about something, because a lot of people judge something that they don't know the whole story about. And that's an unfortunate thing, because we've been dealing with this for a very long time, and I'm still dealing with this, and this is one of the things that have caused a lot of problems for Alonzo. [00:22:56] Speaker 1: All right, here's the thing, I understand what you're saying, I'm internalizing it, but I want you to understand something. He needs structure, he doesn't have structure. And I am not trying to question your parenting skills, but this is what I see. Parents are trying to be friends with their children, they're acting like their friends, their children are their friends in adults. You're not technically an adult, you know why? Because you can't take care of yourself. You're living at home with your mother, you're using her home as a hotel room, and she's letting you use it as a hotel room. You've been having issues since you've been a juvenile. We got the resisting arrest and search, criminal trespass, criminal mischief, unauthorized use of a vehicle. They'd identify another resisting arrest and search and transport. I'm ignoring that because that was taken into consider, I mean, that was taken in consideration. And then you've been to TYC before. And you know what that tells me? That tells me a little bit that one, you need structure. And mom, you are not his friend, you are his parent. And you need to start laying down the law because otherwise, he's going to end up in prison. And if you violate the conditions that I've set for you, what's going to end up happening is, you could be looking at 10 years in prison. Here on out, everything that you do in your life, every decision that you're making, you need to ask yourself, is this something that could result in me going to prison for 10 years? If the answer is yes, don't do it. If the answer is maybe, don't do it. Because what I can tell you is, and Deputy Laura will tell you, Deputy Mejia, and Ms. Abrams will tell you, at some point in time when people violate conditions in this court, they always end up getting caught. You may not get caught the first time you violate it, but ultimately you end up getting caught. Because I'm serious about probation coming out doing field visits. And when they do, and something happens, you know what ends up happening? I receive a motion to revoke. And when I get that motion to revoke, if it's in proper order, I check the box, and a warrant is issued, you are picked up by the police, and you are taken into custody. And either your mom makes bond for you, or she does not. If she doesn't make bond for you, you are brought over in orange after having been at the jail with other inmates, sharing toilets, sharing clothing. And then I hear your motion. And if it turns out that it is true, and I find it's true, then you're looking at 10 years in the prison. Do you understand? [00:25:38] Speaker ?: Yes, ma'am. [00:25:39] Speaker 1: So, your mom is allowing you to do things that she should not be allowing you to do. So, you're going to have to check yourself. I don't know if that's something that young people still say, but that's what they said when I was growing up. You're going to have to put yourself in check. Because your mom looks at you. Your mom loves you. Your mom looks at you as still as her little boy. You're an adult. So, if you love your mom, you're going to have to start doing things appropriately so your mom doesn't have to come to court begging you and not seeing the fact that she has a son who came to court for sentencing, and you're using marijuana. And you're probably using it in her house in the form of candy bars or whatever. And you're in the back room with your girlfriend having whatever. And you're going to end up, if you continue on that vein, you guys are going to forget something. And you're going to end up bringing a grandchild into this world for her and she's going to end up caring for it. And that grandchild is going to be stuck with the father who has all this history, who doesn't have their life in order. Do you understand? Yes, ma'am. All right, so probation will go over conditions with you. [00:26:48] Speaker 2: Thank you, Judge. Excuse me. [00:26:50] Speaker 1: Yes. Are you Mr. Ramirez? Yes, ma'am. Sean, you once entitled motion to revoke community supervision. Did you review that with your attorney? Did you understand it? Yes, ma'am. Are you the same Edward Ramirez who was placed on community supervision in 2021 CR 8399W for the offensive theft under $2,500 enhanced on September 17, 2021 for a term of two years? Is that you? [00:27:15] Speaker 8: Yes, ma'am. State? Violating condition number four on or about the first day of June 2023 in Bexar County, Texas. The defendant Edward Ramirez has been in there failed to conduct himself in a properly and orderly manner and that he did not comply with the instructions of the supervision officer and court in violation of condition number four. [00:27:34] Speaker 1: How do you plead to that? True or not true? [00:27:36] Speaker 8: No. No. All right. [00:27:39] Speaker 1: Do you have any objection to the state's waivers of the other allegations, counsel? [00:27:40] Speaker 8: No. [00:27:41] Speaker 1: All right. [00:27:42] Speaker 5: Mr. Ramirez, did you understand by pleading true to violation of condition number four, the court could find it true, grant the motion and sentence you to one year in the state jail facility and up to $1,000 fine? [00:27:52] Speaker 1: Did you understand? Yes, ma'am. Knowing that, do you still wish to plead true to violation of condition number four? [00:27:55] Speaker ?: Yes, ma'am. [00:27:55] Speaker 1: Knowing that, do you still wish to plead true to violation of condition number four? Yes. You need to speak up. Yes, ma'am. The court would find violation of condition number four. True. Is there an agreement? No, your honor. We were going to open to the court. All right. State, what are you requesting? State, you're pressing one year in the state jail facility. All right. Defense? Sir, tell the judge how long you do that. Tell the judge how long you do that. No, your honor. All right. All right. State, what are you requesting? State, you're pressing one year in the state jail facility. All right. Defense? Uh, sir. Tell the judge how long you do that. Yes, ma'am. Thank you, ma'am. Thank you, ma'am. [00:28:23] Speaker 5: Yes, ma'am. [00:28:24] Speaker 1: Thank you, ma'am. Defense? [00:28:26] Speaker 5: Sir, tell the judge how old you are. [00:28:29] Speaker 1: You want to raise your right hand for me? Do you solemnly swear? That's okay. That's okay. Do you solemnly swear or affirm the testimony you give will be the truth and nothing but the truth, so help you God? Yes, ma'am. All right. You can lower your hand. [00:28:44] Speaker 5: State your name for the record. Defense? Okay. And what is your age, sir? My age is 60 years old. And do you live with your parents right now? Yes, ma'am. Yes, sir. Are you disabled and unable to earn an income? Yes, sir. And do you basically take care of your parents, who obviously are older than you? Yes, I sure do. Are they also infirmed or disabled? [00:29:05] Speaker 9: They're disabled, especially my mom and my brother. That nobody wants to take them to their doctor's appointments or nothing. I'm the only one that's better. My probation officer knows. All right. [00:29:17] Speaker 1: Can we get to the issue of the circumstances surrounding violation of condition number four? [00:29:24] Speaker 9: Which is why I left that day, when I was here in the courts now. [00:29:29] Speaker 1: No, I mean, the violation of condition number four, you've pled true, and it is that you, you failed to conduct yourself in a proper and orderly manner. So what is that about? [00:29:47] Speaker 9: Well, you tell me, what did you do? My son, ma'am, I just came over here to the court court when I had it on the first of June. And then I was, I had gone and ate breakfast that morning. So I think I had to, I had to run some, I spoke to the lady over there and I asked if I can go to the restroom. And she said, no, you cannot leave the building. So then a guy came over and took my ear analysis. And then I asked her again, if I can go, and she goes, just don't leave the building. But the only reason I left the building, man, was because I wasn't going to come back into the courthouse, full of poop on my pants and everything, because I did poop when I went to the original on myself. So I was going to come smelt in the original, like, like poop, right? So I called my probation officer and I told her that I had an accident here at the courthouse and I wasn't planning on going and embarrassing myself inside the courthouse. And she says, well, I don't know what I can do for you. But I did call. [00:30:56] Speaker 3: All right. Any questions for this witness? All right. Probation. [00:31:02] Speaker 6: The recommendation for probation scan at this time is to extend his supervision by 18 months and am in for SADF, followed by aftercare. All right. [00:31:23] Speaker 1: And State, what are you requesting? [00:31:24] Speaker 8: When you're in the State Jail Judge, the reason for that is because he's already shown that he would not listen to the courtroom correctly told to stay for your analysis test. [00:31:35] Speaker 9: Yes. I did stay for your analysis test. I did take your analysis here on the bathroom and check that out. [00:31:42] Speaker 6: Your Honor, he did, in fact, submit his analysis on that day. It was positive for total pain. All right. [00:31:49] Speaker 1: And then he left. [00:31:50] Speaker 6: And then he left. [00:31:51] Speaker 1: I don't know how you're able to take care of your parents and you're doing drugs. That's not a good thing. [00:31:55] Speaker 9: Man, I guarantee you, I did that because I had so much. [00:32:00] Speaker 1: No, you cannot be taking drugs when you're on probation and you cannot be taking drugs and taking care of your parents. I understand that. And I don't allow people to take care of their parents. It was just that one time. No, it's not just one time. [00:32:15] Speaker 9: And you know how I know it's not just one time. I remember now, but that day, that time, the first time it was, it was not my analysis that they had took. We can get to the point that I knew that I was doing at that time. I know. [00:32:33] Speaker 1: Here's the thing. This is not the first time that you've used cocaine. The end. I mean, it's not. So how often have you been using? Not that often. [00:32:45] Speaker 9: I mean, I get, I get, uh, I get anxiety attacks and I get also my nerves are too high. [00:32:56] Speaker 3: I, uh, get off. [00:32:59] Speaker 9: All right. [00:33:02] Speaker 1: You have a choice. I can sentence you to 10 months in the state jail facility, or either I can extend you, but you're going to still be in custody because you're going to be sent to SATA. And that's an inpatient drug treatment. And that's an inpatient drug treatment. [00:33:16] Speaker 9: Can I just get at least a year of probation more extended and then I can, I can, I can prove to you and I can show you that the judge is not going to put you on probation. [00:33:28] Speaker 5: Well, just not going to remove you, be in a incarcerated program, no matter what. [00:33:32] Speaker 3: Well, well, how long are you requesting that he be extended? 18 months. 18 months. [00:33:43] Speaker ?: 18 months. [00:33:44] Speaker 3: 18 months. 18 months. [00:33:46] Speaker ?: All right. [00:33:47] Speaker 1: I'll deny the motion alternate men conditions extend you for 18 months, and you're to go to SATA, and there he is not allowed to live with his parents. [00:34:03] Speaker ?: 18 months. [00:34:04] Speaker 1: And you're not allowed to provide care for your parents because you cannot do that and you are using drugs. Is there anything else he needs probation? [00:34:14] Speaker 3: No, Your Honor. [00:34:17] Speaker ?: I'll miss you. All right. [00:34:19] Speaker 1: And he's to remain in custody until transfer to SATA. Yes, Your Honor. [00:34:26] Speaker 5: I did see what's happening. Yes. [00:34:28] Speaker 10: In Behar County, Texas, Judge Stephanie Boyd held a hearing to review a man's community supervision. The man, in his 60s, had been placed on supervision in 2021 for a theft-related offense. The state said he broke the rules of his supervision and asked the court to send him to a state jail facility. The man explained he had a medical emergency at the courthouse and left the building without permission. Court records showed he had failed a required drug test that same day. Judge Boyd questioned him about his history and decided not to send him to jail. Instead, she extended his supervision by 18 months and ordered him into a treatment program. She also placed new limits on his living situation for safety reasons.
