item 61 all those in favor say aye aye aye opposed eyes have it thank you 62 thank you so much chairman and council LaShawn Dock development coordination item 62 is REZ 2631 for the property is located at 106 108 110 and 112 north Albany Avenue 108 north Albany Avenue unit 2 2101 2117 and 2121 west Kennedy Boulevard 105 and 107 north westland avenue and 2110 west north a street the request is to rezone from PD to PD to allow storefront residential residential multiple family in all CG uses site plan modifications were required to be made between first and second reading and council you may recall on this one the applicant did agree to underground utilities although it is required by code the applicant did put a note on the site plan between first and second reading committing to do so in addition the applicant is providing as a part of their bonus agreement to provide the affordable units so the bonus agreement did not have to be amended um and with that those changes have been certified the plan has been provided to the clerk and i'm available if you have any questions thank you does council have any questions hearing none applicant good afternoon council Colin Rice for the applicant the law firm of Boulder Lundy 1000 west cast joined today by Dylan Lambert from subtext um i'll just walk you through kind of how this project has evolved from first reading and happy to answer any questions so as LaShawn had mentioned all revisions required in the revision sheet the amended revision sheet had been made uh we feel as though we've addressed everything that had come up from city council at first reading so i'll walk you through those changes so we're both providing 10 as affordable we are committing to the undergrounding and we are committing to additional tree plantings um which i'll show you later and we've even added a condition wherein at the time of the specific undergrounding if there's opportunity for additional tree planting we've reserved the flexibility to maximize that and the height has been reduced on the plan to 75 feet top of structure is really about 70 but that has been done as well um i know there was discussion about loading bursts councilman her attack had some questions and concerns about that so we'd had a number of meetings initially we had thought well is there opportunity along westland we didn't want to lose tree canopies so there's opportunity with our engineers to convert back of house space to accommodate two additional loading bursts that can accommodate amazon style delivery trucks and this is on the plan and our engineers even ran an auto turn to show that the maneuverability works so and i do want to point out as well that note 18 does provide that the trash area in coordination with trash pickup when it's not being used for trash that's loading as well so we have three opportunities now for amazon style and other loading and deliveries and to show you what the entrance and compact roll-up would look like from westland we have 16 foot clear height so ingress egress and the compactor is closed apart from used for collection and then the tree canopy has grown significantly in ways we're really happy about um so with the underground again where the things end up we're going to work with staff to make sure we're doing the best we can with the underground but right now we're showing 20 additional perimeter trees and then the elevation again is showing structural height about 70 not to exceed 75 and some additional renderings just to give you a sense of what this project will look like um again a contiguous commercial and retail frontage along kennedy this is this is westland and just a close-up of uh the retail concept so with that i do want to take a moment to to thank staff uh sean and chris and kate have been wonderful to work with through what's been a very long process here so we're happy about where it's arrived to remind council we have consistent findings from planning commission um from every reviewing agency um and to remind again that this is an evolution of an approved project that was taller that wasn't as safe it wasn't as contiguous it wasn't as cohesive um and we do want to finish by thanking the neighborhood for all of their time investment and communications with us which remain ongoing and will remain ongoing past today um we've we've come a long way in large part due to their contributions we appreciate their feedback we probably won't agree on everything as you'll hear um but we're really proud of this project i'm happy to answer any questions and we appreciate your time today i just say i appreciate the fact that you're underground utilities i wish more developers would come through with those projects on the front end underground underground utilities i think you'll get a lot more um courtesies from this council that developers come through with projects underground it provides so many benefits to the city so great oh and i'll submit these for the record okay thank you council miranda do you want to say anything no i just want to echo the same thing he did a marvelous job and doing the right thing yeah very good okay very good um is there anybody in the audience i know i have somebody on the lines anybody in the audience that wishes to speak to this item i'm going to i'm going to recognize the online speaker nicole because i believe you may be traveling is that my understanding nicole yes i'm in greece at the moment okay nicole were you sworn in no would you raise your right hand please be sworn in by a clerk do you swear or affirm that the testimony that you're about to provide is the truth and nothing but the truth yes thank you okay nicole go ahead uh one moment please i want to make sure i get the i want to make sure you can see my screen we can yes okay so um good afternoon council members i'm nicole leon sinis president of the northide park civic association we supported the 2022 version of this project but we cannot support this revised proposal and we urge you to deny this rezoning we support growth that strengthens our context sensitive neighborhood by preserving shade trees providing adequate on-site parking and functional loading bays and respecting the area's scale and character the beautiful matured tree canopy shown here along north b is what we want throughout our neighborhood and we must protect this neighborhood asset this photograph shows why mature canopy matters replacement trees cannot provide the same shade benefits today the proposal removes all 28 trees including 14 type 1 trees and a healthy grand oak require preserving the grand oak and make it the green space centerpiece and make planting replacements on private property not along the kennedy sidewalk or in the public right of way the 2022 massing comparison shows that the site can be redesigned around the grand oak developer profit should not come at the expense of a lasting neighborhood asset nearby projects set a strong standard rome collective preserved mature trees that were in their parking lot and created a neighborhood pocket park tampa general applied the kennedy overlay with 10-foot sidewalks and shade trees on private property and local tampa should do the same functional loading bays improve safety and keep travel lanes clear without them move-ins rideshare pickups and deliveries use the public right-of-way and create daily conflicts restaurant deliveries need convenient on-site spaces without them private operations fill into the public right-of-way as shown here and the public should not bear that burden north height park already accommodates density five of the six nearby examples are four-story apartment buildings that add housing while respecting adjacent residential areas the one that is five stories is adjacent to commercial areas local tampa breaks that pattern by placing six stories beside residential buildings of three stories or fewer require a four-story step down on north a our requests are specific and reasonable as listed here the local tampa design prioritizes profit over neighborhood compatibility the building should rise along kennedy step down to four stories near residences and preserve the grand oak as the green space center centerpiece this project can be improved do not cause lasting harm and a damaging precedent please oppose this rest 2631 thank you thank you okay in-person public speakers please come to the podium start with your name please good afternoon council carlos tamaris north height park uh good morning uh or afternoon i guess uh i'm a licensed professional engineer and a traffic operations engineer in the state of florida i'm here because the traffic impact study for this development was based on a one percent growth rate that number matters it affects how much congestion we predict how safe the intersections are going to be and the traffic improvements that are needed with this development the city provided the engineer uh the one percent growth rate because two traffic counts uh taking three years apart look similar i understand why that seems reasonable but i want to explain in simple terms why that approach doesn't tell the full story attorney movement count is just one snapshot on one day it's like checking traffic at 5 pm on a tuesday and expecting the rest of the year to be the same it doesn't show long-term growth seasonal changes or how the quarter has been trending over several years to understand long-term growth we use fdot's average annual daily traffic the same data used for planning safety studies and transportation projects it's collected year-round and adjusted to reflect real conditions and when you look at that data it tells a different story you can see that on kennedy boulevard traffic has grown 3.4 percent every year and on howard the annual growth rate is five percent these are not estimates these are measured documented numbers collected by fdot if we use a growth rate that is too low the study will underestimate future traffic that means we underestimate congestion safety impacts and necessary improvements i want to shift over to parking since it is connected to this traffic growth that we're seeing in our neighborhood in 2022 this project was required to provide 452 parking spaces since then the developer has increased the residential density but yet reduced the required parking every multi-family project i've reviewed uses section seven residential uses for parking code that's the section designed for residential buildings and it's a section this project used in 2022 this year however the applicant is using a different use storefront residential which is usually listed under office uses office uses requires only one parking space no guest parking no matter how many bedrooms there are in the unit the office space section they selected is intended for buildings whose primary use is office commercial and secondary uses residential not high density residential buildings in 2022 the parking table made sense by bedroom count guest spaces and the neighbors supported it because it was taking traffic off the streets and the congestions that we're already experiencing under the new interpretation there is no guest parking requirement and resident leases do not include the parking space so they're not going to get a parking space and they're going to find spaces in the street to park we already have a problem in north high park and this is just going to make it worse with 512 bedrooms and employee and visitors for the retail and the restaurant that they're planning we think a better parking solution is needed my request is to deny this rezoning uh not stopping development but about making sure that we have the right numbers and come up with the right plan thank you caroline waiver for mr chairman uh let's see please acknowledge your presence by raising your hand or saying something so i know that you hear sarah gotcia thank you um melina mole thank you aniket thank you beth cotter cotter could you say something is there a name she may not be here okay i'm going to take beth cotter's name out of the list um michelle mastro tataro thank you uh jamie adair thank you uh alison date thank you and pamela jackson thank you one two three four five six seven for a total of 10 minutes okay please start with your name you have 10 minutes okay caroline bennett a little history in 2022 this property was divided in half with an alley the kennedy boulevard half was umu this developer got a plan amendment to change the north half to umu stephen benson found it inconsistent because all of kennedy is umu but none of north a is umu i quote stephen benson city planning i want to provide some additional context to our objection the umu is primarily along kennedy and so it doesn't actually go beyond the alley that runs between kennedy and north a it does not penetrate north of the alley in this area so this would be introducing the umu further into the neighborhood than what exists now and that was the basis of our objection we are citing land use policy 9.6.4 which seeks to ensure that adequate housing is balanced with the equally important objective of ensuring that new development is compatible with the neighborhood character despite steven's objection it was passed along with vacating the alley and approving the rezoning all on the same night it passed because the pd showed a step down of four stories into the neighborhood on north a street neighborhood support was based on that promise it was a deal breaker for them they were also promised a dog park and free garage parking which they were told would solve existing parking problems in the neighborhood i watched all the meetings david singer said we designed a dog park and 10 foot sidewalks we maximized height on kennedy where it belongs we tapered heights into the neighborhood designed a step down a significant step down a major step down these are the neighbors quotes from the meeting they are going to fix the parking problems we've had over the years from projects with not enough parking people parking on the street everybody's parking everywhere you can't get to your mailbox but this has parking for everybody including guests we have people parking on the street blocking traffic they will eliminate that and a doggy place a place to bring all our dogs kennedy floods they're going to have storm drains to take that off the street the developer has reneged on their promises why this is why the theme of this project is cutting corners to increase profits when there's a waiver to remove a grand tree they must show how they would have to reconfigure their site plan to save the tree this is from 2022 this shows their building with the area affected by the tree in light blue here's the step down to the neighborhood here's the cutout for jersey mics this shows everything in blue above the ground floor is type 3 construction what does that mean type 3 construction uses cheaper combustible materials like wood it is only allowed in shorter buildings taller buildings must use type 1 non-combustible things like steel and masonry it is more expensive every tall building being built in tampa is using type 1 fire resistant construction the kennedy boulevard overlay is supposed to activate height on kennedy with a step down into the neighborhood umu is typically 10 stories so why are they building shorter than the typical umu building because they'll make more money with cheaper construction in 2022 they proved they could save the tree and have four floors on north a street even with jersey mics this is their own rendering in 2022 that shows that going to nine floors would save the grand tree and keep a step down to the neighborhood so why not do it because now it's solid red the safer more expensive type 1 construction and there's the rub they want to build as cheaply as possible this is today's project with the cheaper type 3 construction again the light blue is for the tree this clear area right here is for their pool even though they have more land with jersey mics gone they still want reduced loading bursts are killing a grand oak have removed the step down remove the dog park will only build fake affordable housing and are violating the overlay just so they can build shorter and cheaper that's why they won't maximize height on kennedy and they are now charging tenants extra if they want to park in the garage tenants can save money by opting out of renting a parking space then they will just cruise the neighborhood looking for a place to park this is one of the tree reconfigurations from today's project here's the cutout for the tree and the pool it's it's um not i'm sorry where am i eight uh here's the cut it's eight floors type one non-combustible material this is their secondary configuration it's nine floors which is still shorter on kennedy than typical in umu but look voila they can save the tree and actually have ground level on north a with nine stories imagine what they could do if there were 10 stories on kennedy which is what they should build that's the kennedy overlay vision that's why kennedy is umu uh you is umu 60. but if they also built four additional floors on north a like they were supposed to they'd have so much space they wouldn't need any waivers they wouldn't violate the overlay or the comp plan or the code the only reason they need five waivers is because they want the maximum density without height so they can use a cheaper construction standard if you don't believe me believe them this is from their excuse document for removing the grand tree impact summary preserving the grand tree would render the proposed development infeasible specifically would result in converting the entire building to type 1a construction which carries disproportionately higher costs if they weren't trying to build on the cheap they could still have all the density and citizens could also have loading burst trees parking height compatible with the residential neighborhood a dog park wide sidewalks on kennedy and real affordable housing instead of what everyone knows is fake affordable housing but they want their cake and to eat it too the kennedy overlay demands shade and wide sidewalks to promote walkability it requires street trees and they must be planted on private property they are violating the kennedy overlay with a waiver to plant the street trees in the sidewalk which is the city's right of way this reduces the concrete part of the sidewalk to only five feet another overlay violation they also have the smallest setback possible on kennedy five feet they are doing this to further their goal of minimum height by spreading out as far as possible this diagram is from the kennedy overlay you can see the goal of shade and wide sidewalks which are key to activating the walkability vision of the overlay tgh got it right this is what the overlay is designed to achieve wide sidewalks and some space for shade trees to grow and thrive i also want to note that move outs typically occur at the end of the month and move-ins begin the next day with 292 units that's 24 move-ins and move outs each month roughly 48 moving trucks u-hauls etc over three to four days plus there's a restaurant which will have deliveries all day long they need the size and number of births the code requires but if the belt developer built taller on kennedy they would not need a waiver for fewer smaller loading bursts if they built taller on kennedy they would not need waivers to remove a grand tree or allowed loading maneuvers in the right of way if they were complying with the kennedy overlay they would build taller on kennedy reduce height on north a have 10 foot setbacks plant shade trees in those setbacks place the driveway in the right place and they wouldn't need multiple waivers to the overlay in other words it would be an outstanding development instead of a burden to the community in closing i'd like to remind council that bonus agreements are discretionary they are at council's discretion this bonus agreement is for 120 ami which is market rate if you want bonus requests for fake affordable housing if you want more of those approve this bonus agreement if you want real world affordable housing deny this lousy bonus agreement please deny this project it is designed to create profit at the expense of the community thank you patrick a technical i'm going to hook up to the hdmi from with my computer show a powerpoint we discussed it before i got it you got it there we go i don't know if it's showing yet start with your name you've got to make sure it's technical yeah that's not can you see it uh technical can you i see it on my screen but not above you have to start with your name before they start okay my name is patrick cimino i recommend you deny this rezoning i was actually approached by an adjacent business person for the rezoning in 2022 and he he i gave him my comments i said number one do you have an attorney and number two there's a plethora of waivers the most worrisome of which for you is the loading base being reduced from four to zero i recommend you deny this proposal a little trick he's got to come up with no i have i have it here on my computer oh i have let me get my thing the paper thank you okay yeah yeah but for the world this is why we submit these in advance better powerpoint anyway so within the last 20 years someone did a vision grand boulevard for kennedy and it would have looked something like this this in fact is a grand boulevard in northern california that was a blighted area that was redone this is not enhancing our grand boulevard if you look this is looking west on on kennedy from boulevard this is looking east from howard on boulevard not much of a grand boulevard i'm really here to talk about the the loading bay uh uh waivers one restaurant i presented this before having studied extensively in hyde park produces at least five to six deliveries three of which are tractor trailers and this is a tractor trailer 50 feet long and this is this is what they're offering these little internal loading bays which they described and these are the dimensions i won't go into them now this fortuitously is a picture from google maps of a tractor trailer looking north on westland i guarantee you we get a lot of beeps from ems garbage and other trucks in our similar streets worse yet if the truck can't go on to the side streets which many of them can't navigate they actually park in the right of way on a major thoroughfare like this is swan what's that going to do to kennedy this is albany going north and notice the no truck sign so this has been another rendering that offered some on street parking for amazon type struck struck trucks i will tell you there are entities in tampa that take loading base seriously this is the burns epicurean nose in with the tractor trailer park unload and nose out publics at platte and armenia has the same setup it can be done if you put effort into it this needs to be denied if we want to grand boulevard thank you sandy start with your name you have three minutes let me see i have a speaker waiver sheet uh adrian laramie thank you uh winston everson winston everson last call winston everson nope um gail everson gail everson no uh anna lenina sorry about that charles dixon thank you um cynthia maloney thank you pam cannella thank you one two three four five plus three is eight minutes if you start with the name you have eight minutes good morning city council my name is sandy de diego sanchez if you look at your handouts first i want to apologize last 24 hours i have been something wrong going to happen everything that could possibly from car trouble to printing problems everything has happened so i'm shaking like a leaf on page one you've seen this before it shows the proximity of the site of the residential single-family homes to the neighborhood it also shows where the other high density picture structures are there do you have a copy to display do you wish to display it i'm sorry do you wish to display it no i've got that's why i gave them to them do you and a copy for the clerk sure well i the thing is i gave you nine what i would like to do then is i'd like to give this to tishina to who because otherwise he will not happen to see what you're referring to i'll give it to him what do you i'm sorry what do you want me to do you want to make sure the petitioner had the evidence that you're submitting i gave him one okay okay can i start over please yes go ahead start with your name please please give me back a couple minutes yeah no you go ahead and start it over start with your name please i believe you had eight minutes right eight minutes okay the first you've seen this this this pictures before nicole the president of the association showed them to you northside park is one of tampa's closest examples to a true urban village combining single-family homes high-density housing restaurants tampa general hospital a major grocery store easy interstate access and the green spine and it's near downtown to preserve this balance the community has worked closely with developers to protect the neighborhood's character residents are familiar with the overlay requirements because the west tampa overlay guides their community a tour of the neighborhood might have helped the developers better understand this well-organized balanced community most of the folks that have spoken here today have vested interest in this project because they either live in north side park community or they live next to a commercial overday corridor decisions you make today the waivers you approve and the important guidelines that you agree to ignore will set a precedent for other projects this size this project should not be an example of what you want for others to follow there are several important areas where the developers have been allowed to bypass overlay standards which makes this project non-compliant on page two on the sidewalks the attached diagram goes shows directly from the kennedy b bullard overlay that the sidewalk should be eight to twelve foot wide and requires trees to be planted on private property clearly defining what is required for compliance the sidewalk verbiage about the encroachment and the paperwork that is needed and the fwb has to be approved on encroachments and this is from the overlay kennedy boulevard right-of-way requires separate encroachment application and additional approval from the florida department of transportation there is no application on file there is note for someone to check the fot but no answer other than a small blurb on the staff about who to contact there's nothing else involving redesigning this to comply cannot be accomplished before between first and second reading nor should it be allowed to wait for permitting to catch it if corrected it makes a significant change in the setbacks and prints of this structure page 3b this foot prints allows 75 677 square feet of impermeable surface and is on a traffic-ready corridor the safety of pedestrians is also the question note the 10-foot sidewalk on the overhead there shows only five feet of unencumbered practice if you look closely you will see that to be the sides to the planters the right-of-way there is a sheltered bus stop also on that sidewalk and then there's a new large restaurant we thought there were going to be a number of retail establishments but there's one restaurant and and the leasing office i do believe the five foot passage does not fulfill the standards demanded by the overlay in the back of your packet stapled is the transcript of the meeting of 7 23 26. so you can review detailed conversation between the development attorney kate wells staff and members of council a lot of questions needed to be answers ironically your answer came from the developer in the top left-hand corner one of the site plans and you'll see it's 3a it reads existing overhead utility lines shall be placed underground prior to issuance of the final certificate of occupancy listen to that the building is going to be finished and then they're going to ask them about the under the the under uh underground wiring in the event that trees need to be shifted to accommodate the underground utilities a revision to the site record shall be submitted for administration approval did that answer in all of your questions adding underground wiring is not a simple footnote on a site plan it's expressed in the transcription and admitted by the developer the installation of the underground wiring will change the landscaping quality of the trees and the footprint this is part of the construction the developer also states they are committed to the underground wiring just needs to know where to locate it again this is not an issue to be relegated to time and has a certificate of occupancy but but and also the developers suggest suggest it cannot be passed off to permitting to catch it it cannot be accomplished during first and second reading even the developer agrees that detail should be part of the site plan and it states it in the overlay the evasion of the overlay standards make it non-compliant and inconsistent where is the documentation the loading loss dots please see on page 4a on the left side of the play shows you reality of the 20-foot foot narrow street of westland the trucks are to scale the waste management truck shows the true turning radius needed to make that turn onto westland where have they they have decided overnight almost to put the two loading docks means you have to basically make an s-curve in that small amount of space can you imagine that with one of the one of the semis or even one of the trucks that are delivering packages it is not feasible that those loading docks will be usable all the ires of concern affect the neighborhood and the city it sends very negative messages to developers that you don't have to comply with code standards but you can build whatever you want so again this isn't about density but about the bastardization of the kennedy business overlay and how this project as it is does not adhere to the overlay the comprehensive plan and the land of both development code approving this is as is seriously harms this community and the city a couple of you praised this project the comments on the transcript do you really want to project to move forward with all of its issues do you want this to be the blueprint of the future a few years ago we were just desperate for housing some of the plans might have been rushed through because the need of housing this is no longer the case recent reports for the florida chamber of commerce states that in the last 12 months florida has grown less than one percent tampa runs close in that same area you can see all the for sale signs and the rental signs when you drive through the city there is no rush to approve this project this is just paper the developers need to go back to the drawing board and do i know how expensive that is yes i do but when finished it will be the result that tampa wants first vision for the future this is not a coat of paint it is complete structure and may i remind you that this the overlay is stated in 27 231 and 27-243 in their overlay in the event of a conflict between the specific overlay standards for a distinct graphic geographic area in which the property is located the provision of this chapter the more restricted standards apply the west hamper overlay is predominant please deny this i've given you a list the last page time's up time's up of the reasons to denial that you can use to change your vote you took two minutes away from me no i didn't we gave it back to you we gave it all back to you we got you you actually got bonus minutes because what you first started didn't count against you you just can't win this pointer start with your name good afternoon stephanie pointer and i'm looking at these loading docks and you know um we're talking about they're talking about straight amazon trucks my mama drove a big truck she was a truck driver and you know how long those trailers are on the regular size trucks they're 53 feet the pups when you see them pulling two behind they're 28 feet and most regular truck drivers who make a living driving trucks could not back into these bays so they're useless the vast majority of them if you're talking about a regular moving company that's driving straight trucks they're not they're not fully certified uh class c drivers or class a drivers or whatever it is i don't remember it's been a long time my mom's been dead for 10 years but there's no way they can get into this especially if they're pulling a trailer especially if they're pulling a trailer because it's 28 feet long where's the front end going to go where's the truck going to go even if they only back straight in they're hanging out in the street and i didn't i didn't see these before now but i just i find it hard to believe that amazon's the only one going to show up when you're going to put a coffee shop or a restaurant or something there i always see cisco i see gordon food service i see those kinds of businesses they don't drive amazon sized trucks they drive full-sized trucks okay let's talk about the bonus agreement which i think is poop we don't have to agree to the bonus agreement and we certainly should not because this is a fake bonus agreement it is with the city of tampa for 120 ami which is eighty seven thousand six hundred dollars a year for one person and then when you do the math you divide it by 12 and then times it by 30 percent you come up with twenty one hundred and ninety dollars for rent and utilities but i pulled all the information thanks apartments.com and my new favorite friend is uh something thunder or something anyway pulled all the data out of apartments.com these are all of the apartments that are um west of west of willow to mcdill to daily on to the south and north to lemon street so this is what's surrounding them now there's some numbers on here that aren't on yours because i didn't go through every single solitary apartment complex because some of these may be smaller like single homes that have been breaking into four units but just these units alone it was over a hundred units available that's how many are available in these and they're all under that 2190 a month we get all the way down to to number 15 and so why are we giving a bonus agreement for affordable when it's not truly affordable that's market rate 120 is market rate let's stop acting like it's not because that's a lie we've got our fake bonus agreement and i want to show you i gave you a list i gave you a review from thank you somebody for another apartment complex who charges thank you for people to park there that's okay that's okay just read the review thank you miss pointer and talk to the parking department that closes public comment applicant would you like a rebuttal colin rice again for the applicant i i hope i don't need it but i would ask for an additional five minutes for rebuttal just for record purposes i probably won't get there but i'd like to ask for what can you tell me for justification for what purpose sure so there were a number of assertions made i have a list of things i'd like to address just to complete the record for protecting my clients purposes i'd request just i don't think i'll need it i'm requesting okay granted thank you so and i'll start we do have an appendix just with some of the history and statistics about the site i'd like to submit for the record it's um applicants appendix so i'd like to zoom out a little bit and think procedurally think historically here about this site um we submitted this application in december of 2025 as you all will remember a couple years back the uh rezoning procedures chapter or 27 149 require notice of filing application which we provided we held our first neighborhood meeting in february we held our most recent meeting virtually august 28th and we posted 12 which i think is a city of tampa record of those giant yellow notice signs for first reading so i just want to respectfully introduce to the council that the idea that this is a surprising just understood project i don't believe is a fair characterization we've been here we've been here since 2022 but this has been a nearly years long one year long uh application in its current form so i do need to just for record purposes tick through a couple of the things that were stated and i of course welcome any of your questions uh can you pause one second sure okay those in the audience if you're talking we can't hear the person at the podium if you need to speak please uh remove yourself from chamber and go out into the lobby to speak and here we just keep our mouth shut and we listen thank you start the clock again and go ahead thank you and then just to reframe procedurally where we are here today at second reading um at first reading we came in with a a consistent staff report from every reviewing department a finding of consistency with the comprehensive planet is umu 60 and a list of revisions from staff all of which have been accomplished and a list of requests from council and in my view those have been accomplished a number of the things stated and asserted today i'm hearing for the first time again i'd like to think that we have been highly available i would have loved in february or june or august the opportunity to speak on some of these points i'm hearing them for the first time today i have not had a chance to review or better receive some of the things that were submitted into the record so specifically we do already have a waiver approved from 2022 for removal of the grand tree keeping it just simply is extremely disruptive to the project dylan lamber is capable of speaking about the design features should you have questions on that front the loading bays are functional for amazon type delivery vehicles which upon first reading was what we understood the the concern to be vetted by bowler's engineered auto turn exhibit again we are in the kennedy overlay and not west tampa uh so the to the parking point the city approached our team about hey this is the parking ratio appropriate for your site we said okay so we did it and under the current calculations we have a surplus prior we had a waiver we have more parking spaces internal uh than units so and dylan can speak to their operations all over the country we feel this is very sufficiently parked for the neighborhood um i i had the risk of going nerd on us for a second i do want to remind the council of our obligation to be faithful to competent substantial evidence um which one piece of that is is the supportive staff report so i would take with um a sense of giving due weights to the things that had been presented whether it qualifies as competent substantial evidence in my view the the record is supported for approval with evidence do we have here we do have on street parking spaces along north a those are carried over from 2022 those remain and with respect to pedestrian safety and sidewalks one of the concerns that had come up can a um ada accessible or a person with uh special needs traverse via via on foot or with a wheelchair around the site and they certainly can the tree grates are not obstructive in any way these are enhanced sidewalks these are walk-up units and we've eliminated uh several ingress egress points uh to the other businesses that were there uh when jersey mike's was part of the plan previously so it is a much safer place to traverse all the way around um and with respect to the types of tenants we have space allocated but there's no indication of which types or which specific businesses will be occupying the non-residential portions of this site so to suggest otherwise at this stage is speculative and we'll certainly work with the community on who's appropriate to be occupying those spaces um i'll pause if you have questions but i would like to invite dylan lambert to speak for a moment i just why don't we finish with your rebuttal and then we'll do the questions and answers okay all right dylan you good okay all right so with with that i'll pause i welcome your questions and ideas and okay councilman moran i just want to clarify something when uh your chairman made a remark about the undergrounding of cables i said i wanted a second it was a wonderful thing i'm not talking about the zoning interior i'm talking about the cable undergrounding that's all we do we were i would imagine you were talking about the cable i said the same thing that i appreciated the developer doing the cable undergrounding that was it okay okay does council have any questions councilwoman yeah um i did not ask for amazon delivery trucks to be in i asked for an on-street parking space that could accommodate a full semi truck that could also accommodate up to two amazon trucks on street okay that was what i had asked for because knowing that that's that's the bigger problem in the neighborhood as we saw today we have large semi trucks that have nowhere to go so you haven't solved that problem it doesn't matter what what's coming you're gonna need solving of of the semi problem um you can have those amazon delivery truck spaces still it's probably not a bad idea because they'll fit u-hauls and things like that but you need on-street parking space that can be the only place that can be used for loading and unloading of a semi and that that's critical i did bring up the fact that the neighborhood i remembered the first rezoning they they were absolutely adamant about a step down to four stories and you all were like no no no they had no problem with it and now i found out that they absolutely do have a problem with it i am not happy because i knew i knew and i never should have approved it i i i regret my vote now because i knew that they wanted to step down to four stories to enter the the neighborhood and that just simply has to happen additionally there's no reason to get ask for a waiver for trees put the trees on your property that's what's supposed to happen you're supposed to do that it's it's not a west tampa overlay it's a kennedy overlay and as we saw multiple things uh examples today the 10-foot sidewalks are critical personally i and i may be speaking out of turn because we've spent quite a bit of time on this already today but i would prefer you go back and and figure this out with the neighborhood i don't know that you can at this point um i don't know what you all think but there is definitely a way to yes because yes it's been gotten to before with this neighborhood so my i'm definitely going to vote this down today unless we have an ability and again i'm going to leave it up to you all i'm i'm fine with doing uh i don't know what that would take and it would take it back to first reading there's no there's no doubt in my mind about that but i don't think that any of these things can't be done i think they can completely be done i think you can save the tree i think you save the tree you make that a dog park space people everybody's happy i mean that's what we had in the other one and this is the last rezoning was allowing for a lot of multiple small retail establishments on the outskirts i do remember that and i i just don't know why we don't have more of that um i know that you all talked about uh step up or apartments that are going to reach um that so you're going to have apartments on the first floor that are actually accessible by the sidewalk instead of interior correct i can speak to that point if you'd like well what i was going to say is if you have those street trees that are not on the property then basically they don't even have a stoop they're just walking right in you need some space there and what would go perfectly there a tree so you could do a tree you could do a little bit of a gap a little bit just it provides i mean the whole point of having a walk in walk up apartment is to have a stoop feel to feel like you are a part of a neighborhood and that you're not just entering straight from the sidewalk that's that's the beauty and the appeal of a of a of a um a unit like that so personally this could be designed much better yes would you have to go higher you should go to 10 feet or i'm sorry 10 stories on kennedy that's the design that's the goal and then you step down you're probably going to end up being able to get more units out of this if you do that if you do it that way the community wouldn't have a problem with that we really want to stick to the vision of the kennedy avenue overlay and what the residents are asking for additionally i know we don't control anything having to do with this but paying for parking is we're not this city is not ready for that we're just not there um i in there's a there's an apartment complex a couple doors down from my house that has parking that's part of the apartments but they also have like an undergrounded space that that's that's shaded and covered and it's also gated off so if you wanted to charge for something extra or special that might be the way to go about it but you know for everybody else they still have a place to park i know we can't do anything about that every zoning but i feel i felt i really needed to say something about that so me personally i would prefer to have them go back to the drawing board i know no is one way to do that but i also believe that that they could get there thank you mr chairman so so colin there's a couple of things to look at here on the one hand you said something that that that has some more than a reasonable basis which is you have to have competent substantial evidence to vote something down this passed unanimously last time and obviously councilwoman her attack obviously has her position she's given her rationale for a perspective change in vote so i'm not commenting on that whatsoever i respect that um and you have a clean staff report planning commission a good record i would say on this issue um but the chance for a continuance is something just to consider and here's the rationale which is typically at this time we don't typically grant continuances after all public comment has been done the distinguishing point has been what you just said which is that matters have been public which would appear to have appear to have on at least one council member in effect on their vote which you did not have access to prior to public comment without public comment now you have it so that for at least me could be the basis for that again your previously stated position is very well taken with me but i would just if you want to consider that just saying mr shelby how do we get this back to first reading if the client the client wish or would like to do that the thing is normally uh there really is no there was no presentation today that really the rule about the presentation really only applies to the first public hearing your initial presentation this is just really in effect council by you having two public hearings on a rezoning what you're in fact doing at the first reading is having a full hearing with competent substantial evidence if you find so to then accept it on first reading and move it to a second reading and an adoption public hearing a second adoption public hearing the way the city of tampa has structured it is still a full public hearing where you can accept uh new evidence and be able to weigh that you are not bound by your first vote if competent substantial evidence supports it in a second vote and that's that's the way the city has it structured so in this case if it's mr rice's decision based on what he has said and the position that that he finds himself to request a continuance it would be absolutely appropriate councilman young just i would say that it seems as though at one point there was a yes um for this or there is a way to get to that and i think if that's a possibility if judging by what you just um said mr shelby if we can have maybe that conversation to go back to the drawing board to try and get to yeah oh sorry to try and get to yes um i think that that is something that if we because it seems as though there there's some things that maybe could just be could be worked through it do you have a request may i have one moment with my client yes can i invite mr lambert to say a couple of words for you it's well mr chairman it's it's council's pleasure whether they would where she yeah i think that's where we are yeah start with your name please and yeah just keep it great uh dylan lambert 3000 locust uh thank you council for this discussion um we want to do a great project here we do not by any means want to rush this through um we've been having these conversations like colin mentioned since uh about december and again we want this to be good for the site and good for the neighborhood um there was a lot discussed today i will keep this very short i just want to make a couple of quick clarifications the previous design like you mentioned council remember her tack was eight stories it stepped down to six on the north end but it did have that break in the facade um reducing the building height to six stories we thought was a good improvement um and i feel like six stories across the site is a lot less intrusive than 10 plus stories on half of it um but i digress there that's a personal opinion um the wood construction is not a cost saving measure cutting corners you can do a very bad concrete or steel project it's a building code mechanism for fire rating and what's required for building some certain stories the loading council member her tech i sincerely apologize i think there was a misunderstanding we met with staff and we did talk about the on-street space um it would have impacted the sidewalk and street trees a little bit so we decided to try and find it internally but i think what we were asked to accommodate was just lost in translation on our end so i apologize for that confusion on the retail again like colin mentioned we don't have uses identified on the prior design it would have all been congregated as well this retail space has not been delineated yet it may be be demised into several small shops instead of restaurants or fast casual we just don't know that yet but we have retail professionals to help us allocate our parking excess you know to meet those needs and it sounds like loading is something we still need to think about and then just with the walk-up units those do have stairs with stoops to separate them from the sidewalk we want those to feel good to those residents and as you're walking along the streetscape okay continue um that's all i had council just a few clarifications um i would i mean based on just a couple of those notes and kind of generally accept your thoughts so we can make a decision here as to how we move forward yeah i think i i'll i'll chime in there for a second i think from the uh i think council and carlstein and myself we've definitely been hitting on this kennedy boulevard corridor of higher intensity along the boulevard you know the boulevard i think that so the misunderstanding about the height we actually want the height on kennedy boulevard and the density of budding kennedy boulevard and then with the step down towards the neighborhood uh councilman manaskapov and councilman miranda and the councilman carlson yeah and the gentleman the attorney you had mentioned at the beginning of your presentation ongoing conversations with the neighborhood on top of the robust conversation that you've had you know it's up to you but if you were to do a continuance and i mean you heard the concerns from the public you heard the concerns of some of the council members instead of just killing the project you know seeing what we can come up with or not me but you and and the neighborhood and further discussions um and try to work it out and come back that's it yeah i think we i think at this point is if the intent is for you guys to request a continuation rather than us thinking about negotiating between them to defend the dais about this project i think if if i'll let the council person share their thoughts so that at least you have that indication moving forward but realizing we're not negotiating from the dais about the future of this project now councilman thank you thank you and counselor you have a beautiful piece of property owner but however on one side on the south side facing south what do you have there people going 25 35 45 even 50 miles an hour you have semi truck you have cement truck you have everything on kennedy boulevard going to make deliveries or whatever they're doing to make tampa look better including what's happening in downtown so but on the north side at day and night you have residential so those people who are not traveling there's no numbers of 20 or 30 semis every hour going by or every day going by there's no cement trucks going by so that's the difference that you have to deal with you're dealing with two things at once that are both needed in the city of tampa and and that's where we're at today okay very good councilman carlson yeah i we in situations like this we don't usually do polls but but i think if if we had to vote we probably would vote it down today and what you're hearing is that um unlike unlike some projects we we think you're not that far that you could talk to the neighborhoods and try to fix this and and the attorneys can correct me but if we vote it down you have a choice of uh objection a lawsuit or you can uh wait a year or however long it is and and having it go back to first reading would save a lot of time and so my recommendation is that you all do that but do you have to ultimately do what you want to do i'll entertain a request may i have that one moment with my client i apologize thank you chairman if i may yes um thank you lashawn doc development coordination and just to give a couple of dates um just based upon the discussion based upon the request for additional changes if the applicant were to go back to the community and maybe incorporate additional changes on top of that to the site plan if a drc is needed the drc would be the october time frame october 20th the request to continue and go back to first reading would be at the december 10th hearing 12 10. thank you in order to give enough time so that just puts the date out um so the applicant is aware actually thank you thank you mr doc so you so this if this were if you were to request and it was a drc would go be a 12 20 10 would be the hearing okay helpful data point just one moment okay mr chairman if i may maybe do they want to step outside and talk or i just let let let this run for a second if i can before counselor hold on hold on are you are you guys done with what you're doing i need a decision i don't have i need authority for that yeah okay when they're finished councilman mr shelby all right mr shelby let me record if i can i just want council to be clear that december 10th the date that ms dock has given you is a night meeting it'll be 501 pm is that council's intention then okay um yes sir and a clarifying question would we have to notice or is this sufficient notice or maybe we don't know that answer yet uh for december i would assume that that would be a question for ms that's a ms johnson milles do you have a oh oh i didn't see him as well stock is on or miss wells either one kate wells legal department that would really be with council's pleasure whether you would want the applicant to re-notice or not my recommendation if if the applicant is receptive to continuing this i would just continue it to the date um if it works for them the december 10th at that point we can determine whether the ordinance has to go back on first reading or not oh so you say continue just as it is at a second reading and you'll be able to know well the type of whether it comes back on the 10th once we see the changes they're proposing we can determine whether the ordinance would go back on first reading and that would be handled with staff yes sir that would be sound advice council okay thank you sounds good okay so colin i'll give you a couple more minutes if you need it otherwise we'll move on okay go ahead we will accept the continuance so the applicant is requested to continue file number rez 2647 to december 10th if i may 2026 at 501 east kennedy boulevard at 50 object 501 pm on at 315 east kennedy boulevard tampa florida third floor tampa city council off uh chambers and i have a motion from councilman vera second from councilman miranda all those in favor say aye aye opposed eyes have it thank you okay thank you well that was more complicated than i meaning evidence or yes we do but it's on my phone i don't know if that's accepted well if it's coming from you again that would be an opportunity for you during the public comment period if this is this is her opportunity to speak if she has evidence that she would like she wants you to speak you need to speak i'm speaking very well i need to translate somebody saying here well i mean you're you're doing all right now we can hear you why don't you give it a shot mr chairman yes sir if she would be more comfortable you could say what you wish in short sentences to your neighbor and then she could say it in english and if there's something that she has to relate to you she'll do it in short sentences so you'll have that opportunity and you'll be able to express yourself more fully if that's how you're more comfortable yes but i thought you spoke english just fine it's up to you how you wish to go yes she said you're speaking just fine she said she'd like to speak it to me okay go ahead go ahead she doesn't want to say something incorrect we've been ignoring all that has happened and trying to live peaceably across the street from um where the applicant owns his property for his business i think when we saw the notice for this hearing okay hold on a second okay so we're confused does she is she the one that's asking for this vacation or she lives adjacent to this no she's opposing the application okay then yeah then you are both public comments so is there an applicant in the audience for this is there an applicant online for this no opposition i don't think we should do anything with it somebody yes can you guys step if you if the two of you could step over to the side please martin shelby city council attorney are you aware if the applicant is present no i think ross may be on the line and be able to answer that mr sammons are you aware have you been in touch with the applicant they they they were informed that they were to either um show up in person or register to present virtually and you have not heard from this person i have not mr chairman i have to i could sign chapter and verse unless um somebody has it before them but if the applicant does not appear at a public greeting it could be first public hearing it could be deemed withdrawn that's my understanding uh it's been noticed for today obviously the applicant i'm sorry ron wigginton legal department the applicant has a responsibility to demonstrate that the vacating serves a public purpose so his absence here does require a motion from one of our council members to withdraw or is it automatically withdrawn which it which is better to move forward it's better to deem it withdrawn i should find that section i haven't used it in a long time um because obviously if he doesn't present a case or continuance or we're not there's nobody there's no question there's nobody here to request to continue could you uh inquire just how many by a show of hands how many people are here to address this matter mr chairman okay and then the the app okay i heard a lot of noise back there that's why well if it's withdrawn then let's wait for all yeah marty give me a reason to withdraw hold then hold this for a minute while i pull the the um okay we're going to delay the continuance of this hearing until after we hear item number 64 then let's move on to 64 while our legal attorney looks at this item number 64. good afternoon carl brody from legal department i'm here to present an ordinance amending the current tree trust fund ordinance i would like to go through the changes we're making and then maybe address some of the concerns that were raised go ahead all right uh so for the new tree trust fund ordinance the focus really was on clarifying because some of the terms in the old uh ordinance were not crystal clear in terms of where trees could be planted we clarified that with this ordinance and expanded so that the trees could be planted using tree trust fund money in additional locations that's one we also want to create more transparency because i know that was a concern we're requiring we're requiring any um use of the tree trust fund to come before city council for their approval that way we provide transparency to the public and transparency to uh council and then finally to provide some greater opportunities for use of those tree trust funds so that's the purpose make the tree trust fund more efficient and effective to getting uh trees in the ground some of the concerns that were raised we would have um we would not suggest making changes to the ordinance that you're considering now i know one of the issues was uh increase uh changing to say primarily type one and two trees we have a concern there because we wouldn't have any definition for this which would result in potentially creating unnecessary um cause of action unnecessary confusion and the whole purpose of the changes to this ordinance was to get rid of that confusion by putting language in stating that your primary we're primarily going to plant type one and two trees um doesn't allow staff to come forward before city council and explain uh what trees through motion to get an approved uh city council through motion explain what trees it intends to plant in what spaces and as we've talked about before right tree right place is very important for the city so it would uh create some kind of confusion with that because that would possibly create a um a violation if it's determined that we aren't primarily planting type one and two trees there's also a question about uh the but not limited through language that really is just there for flexibility to allow the departments come before you to uh use tree trust fund for any purpose that's going to advance the purposes of the tree trust fund is provided which is planting more trees um in the city and finally there was concern about um about your approval of it and we think that city council approval is a good thing because it creates that transparency has to be on the agenda that means the public knows the change is coming you get to review it you get to approve it and um you get to ask questions and it just creates more of an open forum for understanding what the plans for planting trees in the city are so we request that you approve the ordinance um for first reading as drafted and um also if you approve it we request that you bring it back october 15th and we request that extended time because um another purpose is um another purpose is for us to provide this ordinance to revenue and finance so they can do a study to determine what an accurate 2026 tree mitigation fee would be because the last time the fee was um updated was in 2009 so for those purposes we just requested to approve the ordinance as drafted and bring it back on october 15th thank you sir okay councilman carlson yeah i i'm happy to make a motion to move it for all the folks who from t tag and others that have the concerns i'm also happy to set up a phone call with mr brody to go through he you explained why not on some of them but maybe we could set up a call with t tag and have a separate conversation that might end up in some additional edits later sorry to keep the process going but uh for now it seems like we we need to move it forward to get what we have is there anybody in the audience that wish to speak this item that hasn't already spoken to it i know several people spoke to it i had a couple things you had something to say yeah okay go ahead so uh mr brody i mean you you answered what i was going to bring up and in regards to t tags objections uh one regarding the primarily type one and two you said it would create confusion uh the but not limited to to leave it in there and the question that was brought up was how much have been how much of the money has been spent on plans which was like 151 000 i think and people are concerned that why is it not all going to trees number one and then um another thing and you said it for the sake of transparency the tree trust fund may be used by for funding a department request upon city council motion and approval of an agenda item so the people can see what um you know where the money is going if there are any changes made but these were the objections that they brought up you've rebutted that already and explained it you know even before i mentioned everything because you took notes um so that's it that's it for now thank you okay thank you um anybody else okay um tree hugger pointer are you a tree hugger now no i'm not a tree hugger but my friends are but i i don't understand how it would be oh sorry stephanie pointer i don't understand how it would be confusing to say primarily one and two type one and two trees because there's a list here's type one here's type two and over here's type three shouldn't be very confusing maybe you want to put in a percentage i don't know but it doesn't seem to me i don't i don't understand how something that's black and white which is these are type one these are type two these are type three there's never been any discussion debate or anything else to address that there was any question about which one's which so you know maybe you want to put in 10 percent 20 percent 50 i don't know but it just seems like we just keep dragging this joker out and as carol ann pointed out this morning um this this money is not put aside for making plans or planting around freaking veterans memorials or anything like that this is to repopulate our tree population and um and it shouldn't be this hard it really should not be i mean you can pass it for a year i think we talked about that before too i mean these ladies have done a whole heck of a lot of homework i generally don't get up and talk about it but they already have but i want to remind you that these ladies did a lot of homework and they've talked about this stuff and they've talked to you about this stuff and they live and breathe it and in this particular situation you got a pot of money and nothing's being done with it hell i can't even get trees at the gca for god's sakes there are places all over the place you know that's what nrac supposed to do but the problem is that until you start moving something forward instead of putting it on the back burner and i'm sorry type three trees type three trees i'm sick of hearing about them let's let's deal with the big mama jamas and then if we have money left over then we'll figure that out but to just go ahead and say oh we're not going to deal with this because we can't it's kind of vague well make it concrete you guys can make a motion to say anything you want about how you spend this money but it certainly should not be let's don't spend it let's wait another year or two to get our together sorry council steve mccolini the builders put the money into the account the money needs to be spent but transporting and moving that between accounts should be more restrictive uh we've already seen where the city seems to like to move money around uh sort of uh willy-nilly but uh i think it ought to be more restrictive that's my only comment the type one type two trees we'll let caroline and crew fight that fight but the money is there it should not be transported or moved and used for alternate purposes thank you thank you um i i want to strike um the but not limited to so i will make a motion to strike the but not limited to which is i which is line item 29 on page two it's section d subsection one i have a motion council and her second second councilman bureau discussion let's discuss that for a minute what is that exactly when you look i heard type one type two trees no no no this is not about that this is this says selection acquisition installation and maintenance of trees shall include site preparation soil amendment fertilization irrigation suspended pavement system tree grates and tree guards they didn't want it to expand beyond that because when you say but not limited to so the idea is to take out the but not limited to to focus solely on planting trees i got no problem with that okay i have a motion and i have a second is there any further discussion mr brody would you like to respond the only response i would have is i mean we can strike that the only purpose of but not limited to is to provide more flexibility for city council in terms of uh the uses that some tangential uses that we might not have specifically designated but you can come here and ask us for that if you need that well that we we couldn't because i mean we're still and that's one of the things we have to remember we're still limited when i say we i mean city departments are going to still be limited by the language of the ordinance so that's that's by design right right no no yeah but what i'm saying is if the ordinance says we can only use it for those seven categories city council can't go they can't breach what the requirements of the ordinance are okay okay i'm still fine with that no no no i know okay i have a motion i have a second is there any further discussion hearing none this is a vote on councilwoman her text motion to strike but limited to all those in favor say aye aye opposed the ayes have it um and then i page number three uh line 26 and 27 the tree trust fund may be used for funding department requests upon city council motion and approval of agenda item that goes without saying actually um i mean we put that in there specifically so that there would be that additional transparency and clarity as to what the funds were being used for that's why that's there just kind of finds what we want yeah but see i don't i don't think that should be there um is there a problem don't you see something well i just want to take it out i don't think that i find it problematic because department requests upon city council motion could be literally anything it could be any types of trees any type of thing and i i'm i really think that for now initially we need to be planting what we said we were going to plant which is replacing the trees throughout the city not necessarily part of a department project but just replacing the trees any any problems yes of course they're going to have problems with that i i heard the i heard the problem that he had i was in the back listening a problem with no i'm good again ordinances your ordinances the the purpose of this was really for transparency and provide an opportunity for city council to have direct approval over the use of the funds if that's not desired we will strike it okay i have a motion to strike that language from councilwoman hertech is there a second i have a second councilman bureau is there any further discussion hearing none all those in favor say aye aye opposed and then i have one more thing um back on page two item number or line number 26 it says um that you added that you can plant on selected school board of hillsborough county owned land upon request oh upon request from neighborhood associations to plant and maintain up to 10 trees on private property i wanted to change 10 trees to 10 trees annually there are some neighborhoods that are going to take this and run with it and they're really going to be able to plant more trees every year so i'm afraid that by saying 10 trees in perpetuity that that's going to stop people from planting so i think that setting a maintain on i on line 26 it says and maintain up to 10 trees i want the word annually put after that because there will be neighborhoods that will absolutely want to plant more than 10 trees a year that makes just so much sense i'm not going to even ask you to hear your opinion on that i wrote it down council on her tech is our second second councilman if you're all those in favor say aye aye opposed um and then i do i'm fine with leaving out primarily type one and type two trees um i i think i'm happy with where it is right now if if there is more things that we need to debate we can do that between first and second reading okay very good thank you for those additions is there any further discussion on this item okay who would like to read this is your baby um ordinance being presented for first reading consideration an ordinance of the city of tampa florida amending chapter 16 article 5 section 16-86 of the city of champa code tree trust fund providing for annual distribution of tree trust fund monies for the benefit that the tremendous program and others i don't know why it just says tremendous repealing all ordinances or parts of ordinance in conflict therewith providing for celebrability providing an effective date i have a motion for councilwoman her tech i have a second councilman maniscalco all those in favor say aye aye opposed the eyes have it thank you and that we come back for second reading on october 15 2026. okay good very good thank you so much okay and where is our lawyer is he here no okay we're still gonna okay how about uh i guess oh yeah we did we pulled we pulled the two but that was councilwoman her tech yeah well it was a separate vote she didn't she just wanted to vote against it but she's not here uh is is there anybody from the administration that wants to do the update good afternoon council richard mutterback contract administration uh here to give an update per councilman vieira's request regarding the k bar parkway cut through status i would just like to remind council that this is not this is a developer project this is not a city project we do not have an agreement or contract with the contractor to enforce which limits our control and leverage somewhat in this case but i did reach out to the engineer of record he gave he gave yesterday he gave an update of at this time the entire road has received the first lift of asphalt and all street lights have been installed very close to completing but rains and testing delays have had an impact i asked for a little bit more detail and he sent this more as of this morning he said as of this week we are moving with moving forward with testing and certification expect that to be completed in the next two weeks flushing and testing are intended to occur week of 921 after that testing is complete we'll move through the rest of the project finalize the testing for formal certification once the utilities are all tested and accepted we expect the contractor to finalize the second lift of asphalt and move towards city inspections for a formal opening councilman vieira and thank you mr mutterback it's always a pleasure to work with you always such a nice guy and and a professional always appreciate you so um i have some challenges number one whenever it comes to the contractor things get delayed stuff like that happens there were some rain issues etc but let me ask you if i may um what date are they giving us as an approximate date this time around uh the he didn't give an actual date he said pushing hard from all sides probably within a month to have the second lift of asphalt okay um so so my big challenge is is that we're seeing this as a to the extent that we inquire on this issue we're seeing it as a construction compliance issue this is a public safety issue so you know and and you know this obviously sir and i think everybody here knows this which is that the new tampa has the longest response times in the city of tampa with tampa fire rescue four out of the five stations where the longest response times are in three three six four seven um and when i asked the fire chief a couple of months ago what's the best way that we can address that i was told to cut through and then from the best of my recollection and observation no one in the administration really knew the status of this cut through which we were just told is the best way to reduce response times life and death issues major issues of public safety so um i i i then found out that it was about halfway done which is marvelous lovely right um so then we're told about september 15th which is great um the date comes i do the memo around that time i think monday or tuesday that sets stuff off my in terms of those emails that you talked about my issue is is that we need to be very proactive and aggressive whatever department it is with a contractor while we may not have any jurisdiction on enforcement we certainly do have our bully pulpit which is that this is a matter of public safety and we want to make sure that when a promise is given on a contract and on a strike on a road project that will significantly reduce response times for a whole region three three six four seven that we are all on it i sure as heck was on it because that date was burned in my brain as well as in uh the the memories and the the heads of other folks in uh three three six four seven so what i'm looking at is a sense of real aggressive urgency from folks on this because this is abc public safety this is a very very big deal um like i always say you tampa we pay our taxes on time and we got to make sure we can do everything to make sure that the fire response there is on time and this isn't a big thing to do but again it's the the lack of knowledge or awareness originally right and then now that my memo set off a whole chain of events i want those chain of events to continue to go so i'm going to be continuing to check up on this you know stay very very close on it but again that's my frustration for the contractor things get delayed i'm not out to scapegoat them or anybody i just want to see that sense of vigor urgency for new tampa that's a big deal so that's all so i i appreciate it so we're going to continue the dialogue with with the contractor and um and that's and hopefully we can have it in a month again delays happen that's fine i just want to see that sense of urgency because this is a big deal but richard always appreciate your professionalism you're always a gentleman thank you sir thank you mr moniback okay now we're going to move back to the two items that were pulled from the consent agenda items 12 and 13. yes sir good afternoon council eric du felice tampa police department uh i am here to address any questions or concerns that you might have about the state attorney's office grant to the tampa police department for the acceptance of funds for the purchase of paragraph did you explain to us what the program is and what it does and what the technology is yes so i can start by saying what it is not it is not a camera or surveillance system it is a program software program that allows us to integrate our data into it and then it collects it sifts it sorts it and puts it out to us to allow us better utilize our resources and connect the dots what data what where is the data derived from so our internal programs such as our cad computer-aided dispatch our rms record keeping bwc which is our body-worn camera and any other programs that we can put in we take all that information we have it uploaded into the software and then it goes through it and is able to connect dots that typically it would take you know a long time for a human to do traffic cameras um those aren't ours so i don't think those would be included so no fbi data no no any other data so so i think the question becomes i mean can we guarantee it's not traffic data i mean this is solely internal nothing external at all when you say traffic data it could be traffic data that we know i'm talking about the the cameras i would have to double check on that to make sure that it isn't but it isn't our information we don't own it so putting it in there that would have to be something that the city department in charge of that would have to do so um i know this is coming the contract is coming in two weeks for us to approve so i would really prefer to continue this until then so we can get those specific answers if you don't mind be fine so if there's anything else we'd be more than happy to answer i mean from my understanding i thought it was coming back uh i believe um miss newcomb you're there i i want to say you you said october 1st ish or maybe we were aiming for november 5th okay well can we do it november 5th sure okay yes because this is just accepting the grant yeah the actual program contract hasn't been completely but that's what i'm saying that way we can do it together so i motion to move items 12 and 13 to the november 5th date to be next to the contract item okay so i have a motion to housewoman her tech to continue items 12 and 13 to november 5th 2026 to to come to ride alongside the approval of the contract on that agenda item okay is there a second i have a question we have a second councilman miranda okay i have a motion i have a second councilman here for a question yes sir to to to you all over here so tell me again exactly what this does this is not cameras or anything of that nature it's more yeah they didn't know that can i since it's continued and this this this is offline for questions between no no because i i do have a question it's a question on my vote which is so so let me get down to the to the brass tacks which is do you all object to the continuance will it put any sort of budgetary issues with public safety the state attorney's office at risk because if there is any potential of that then i will not support the continuance that's frankly councilman it's unclear because what this is this is an acceptance of a grant from the state attorney's office there and it's a grant coming from the state so i wasn't able to see anything in that grant that requires us to accept it in fiscal year 2026. i mean so it's possible but it's not clear from reading that that's why we put it on for 2026 just to be uh prudent it looks like as long as this is purchased between july of this year and june of 2027 then i believe that the grant funds will be available that's my best understanding but that was the the thought behind voting on just accepting this grant first and then when the when the details of the contract come before council and i had spoken with councilwoman her tech we were happy to present individually to you all what this program is between now and then because it really is just a data sharing platform yeah but that i hope that addresses your question there could be an issue i don't think there's clearly an issue but that was our reasoning i'm putting it on today just for the acceptance of the grant not at the same time with the contract so does is again does this continuance in any way hinder it could it could that's all thank you councilman carlson well assuming that the continuance goes through the we got one email uh from someone who is concerned about this being uh connected to national immigration databases and searching and so it when we when you come back you might want to address that for whoever is interested in it okay so i have a motion and a second to continue this to november 5th 2026 any further discussion councilman thank you mr chairman does this have anything to do with ice and what's happening on the federal level i've i've been told no i just want a clear answer on that it does not okay because that's very important to me because if it did i wouldn't vote no i'd vote hell no but that's very important so just just to get that off the table thank you to go into a rabbit hole but just to clarify since you answered that question that way if this is data compilation and we are obligated through what is it 287g for cooperation how can you honestly say that's not that it's not a possibility well we determine who we would answer that question at the next hearing well we would determine who that information is shared with but pursuant to any lawful order we would have to comply with that correct that's what i'm saying yeah exactly okay very good so yeah okay go ahead if i may which is under that order a city cell phone right could be subject to that this data anything could be subject to that so that for me that is a uniquely different issue which is this is not data that is shared with ice as a matter of course and scope correct correct and to to clarify that all the data that would be in this platform we already own so if there was going to be a request made for it we would already have it and that being said i think this is prudent for us to just if the intent is to continue this that we continue we do the continuation we have that off offline conversation we gather the information amongst ourselves and have this conversation on november 5th i'm going to then motion for um if it's okay with everyone just to make a motion that they come back and talk to each of us individually okay i mean i know they might do that anyway but if with the motion it makes it better so you've added that your original motion so what i will add to the original motion is also that before november 5th before it comes back that they meet with each of us individually to explain what this program does and a briefing like an individual briefing so council miranda do i still have a second from you on that fine okay i have a motion i have a second all those in favor say aye aye opposed okay motion carry with viera voting no okay very good okay thank you very much thank you here we go now mr shelby did you get an answer some call at that yes if you could just recall um okay now we are we are going back to item 63 and the applicant is not present for those of you paying attention to the agenda yes uh mr sammons has been in touch uh with the um the engineer who's uh i guess charged with this and for whatever reason is not able to be here um and this is under not under chapter 27 by the way and i did find that section uh chapter 27 150 appearance by applicant but this is not a quasi-auditial matter this is a legislative matter so my recommendation uh after conferring with uh uh council would be um mr wigginton would be to have this continued to november 5th of 2026 um and uh the time is what time would it be 10 30 10 30 10 30 um and i'm i certainly can't 315 east kennedy boulevard in tampa florida why don't you do the whole motion for us no i don't you want to do it and then the other thing is that's part of this continuance it requires it be re-noticed okay okay so i move to um continue vac 26 11 to 10 30 a.m november 5th no yes that's what he said no but you said november 5th not october november 5th 2026 3 15 east kennedy boulevard tampa florida three three six oh two third floor um and to re-notice i have a motion from councilwoman hertech i have a second from councilman vera all those in favor say aye aye opposed the ayes have it okay and if those i don't know whether council mr chairman whether you inform those people that it has been continued so they should be for those of you that are in the audience that were listening to item 63 it will be heard again by this council on november 5th notice at the 10 30 public hearings november 5th hopefully we'll get to those sometime before lunch on november 5th here we go item number 66 67 68 and 69 we are hearing together brad baird good afternoon city council uh brad baird administrator of infrastructure mobility um i believe uh brandon is uh passing out a hard copy for you all um and and mr baird just i i kind of concur with something i'd heard earlier and councilman hertech said the same thing is there anybody in this in this on the dais that has not made up their mind about these issues is there anybody here that doesn't know how they're going to vote if not i would say keep the briefing as brief as possible you don't have to like beat a dead horse okay and i do have a very brief abbreviated presentation this time it's less than half of last time yeah just don't be a dead horse i think you're not you're not persuading anybody today okay got it all right we do have our team here for a question and answer uh please hold the questions to the end and if i could get the presentation to be pulled up please it was up it's up for you there we go once you start um talking it should it should pop up okay there you are okay thank you um all right quickly uh current total costs are 100 million point four gmp is 92.7 um you've seen this picture before uh primary features a 10 by 10 gravity box co terminating at the ami pond it includes secondary pipelines that connect the selman expressway and a 72 inch pipeline relieving uh parkland estates it's uh also a legacy project that serves some that will serve in the future some of the downstream neighborhoods and that cannot be done with a force main has been proposed um so we designed this project for a five-year eight-hour storm the city engineering standard by which we designed for what does this mean it's equivalent of a 5.3 inch rain in eight hours so just uh one month and a half ago we had a storm that was uh smaller than our design storm this is what it looked like um keep in mind these are folks that have paid into the stormwater improvement assessment for at least 10 years have flooded two and three times in some cases but yet to receive relief um so you've seen this slide uh before as well um you you've heard uh the rhetoric that phase one provides no relief for palmacy of pines i want to stress that is simply not true you can see on the left palmacy of pines has numerous structures that have been flooded on our design storm and on the right no structures are flooded you still have some street flooding so that statement has been said well over 10 times 20 times it's not true um let me uh uh move on to our uh quick and i don't have it here so i'm on the monitor here but if i could oh there it goes okay so you can see as it as um the flooding occurs at five hours um the flooding starts to go away on the right and um by eight hours all the flooding is gone three hours you heard earlier one of the options is okay live with the flooding for two to three days this is three hours and the flooding is gone it's an order of magnitude different um this one reiterates that we have 16 feet of fall from parkland estates and and palmacy of pines floods been pointed out numerous times that they those two neighborhoods reside in two bowls um so even during helene when the elevation in the bay was at eight feet um this project would have only uh the flow would have only been reduced by eight percent and that's huge because i've heard several times um people get up and say that no when you have this storm surge this project won't work again that is not true 92 of the flow 100 of the flow will happen 92 of it will be um the same speed at or a little bit less speed at six and a half feet per second um so this is our success stories bottom left is henderson dale mabry and um that present value of that is 71 million so it's certainly in the range of what this project is um in all six of these pictures the flooding was solved it's fixed and by the way we've used a box culverts in all of these projects and we've used large trench projects projects in all of these projects business assistance plan i'll go through this quicker than i did last time the biggest thing is that first bullet we have smaller construction areas work will be limited to sections of about four to six hundred feet at 24 different phases this has never been done on a city project before we'll restore areas quickly behind each section that's completed so at each phase and then we'll open that that phase or that section as quickly as possible we have a dedicated business support team we've talked about with four people that will help the businesses stay open and accessible they'll work directly with the merchants to solve construction related issues including coordinating and handling deliveries of course clear signs detours we'll monitor construction vibration which is is going to be very extensive i heard one person say that they are required to do a pre-imposed we will be doing that for each structure on howard we'll monitor vibration including monitor cracks if any of them change we stop work we figure out a remedy remedy and then move forward um and then we maintain of course pedestrian access reduced construction noise marketing support and then we have a soho open campaign um to help the smaller businesses so uh maintenance i've heard many many times um that but maintenance alone will not sir solve this problem the city and the design engineers have evaluated 24 alternatives including the five added by the business alliance the added alternatives all of them are more expensive less feasible to build more disruptive less effective none of them move near as much water as the proposed solution and so the proposed plan easily protects more businesses homes uh and families than any other alternative and um getting toward the end i want to address the soho business alliance alternative which sounds like today um part of it changed a little bit from going down to rubido to uh upgrading possibly upgrading with no size mentioned uh the cleveland system however the vaults didn't change and and the other parts of the project didn't change first it does not achieve the project's flood relief goals in fact it doesn't even come close it's 35 percent longer which equals more time more cost runs through neighborhoods which has already been denied by city council which would result in tree removals it relies on and this is the big one three vaults and pump stations and those vaults would be 12 foot deep construction of the ami vault would require demolition of the parking deck over top that is uh not owned by the city city part of it runs next to csx tracks today that's very unlikely to be permittable the csx crossing has several issues as well that route has been studied internally in 2019 and 2020 and was rejected for the same reasons um to read more on this please go to s h s h h h h h h h h h h h excuse me stormwater.com two more slides on myth and fact lack of maintenance is the cause of flooding our modeling and real world world conditions show capacity is the cause of the flooding phase one doesn't address palmasia pines i just mentioned this it removes all the structural flooding and significantly reduces flooding in palmasia pines again that's phase one the proposed oh i'm sorry the proposed project takes too long to provide any relief any relief this is the shortest distance uh on all the alternatives and it is the quickest way to provide relief the city will use eminent domain again not true the box can be built within the existing right-of-way following four more the csx crossing include included in the gmp today does not meet csx technical standards we have received a recent email from csx outlining what we need to do and that we if we do those things it will meet technical standards so that is not true um the funding plan wipes out funds for other projects that's not true mr rojero we'll cover this in a few minutes the cost benefit ratio is not close quote unquote once again simply not true the business alliance analysis includes the original five by ten box covert not the 10 by 10 plus a much higher cost than we show in the gmp the csx spur serves mcdill air force base it does not construction schedule um and this is my second to last i'm sorry can you do that construction schedule simply a yes that's an excellent so a yes vote today means we would issue a notice to proceed in no in october a no vote today means the gmp expires in october it's really that simple um and then to finish going through the construction schedule i'll hit every other one uh march i'm sorry november we would start utility relocation uh of this year march track can you pause a second we got something going on here we can i can't pay attention i'm sorry we got just somebody's being really loud pause the proceedings for just one moment i have one more slide after this go ahead okay um so the the the big one is uh the box culvert instructor is the big one that's when the box culvert starts construction and that's uh in the march april may time frame after gasperilla and then uh by may of 2028 we should uh reach the csx crossing february 2029 west morrison avenue intersection will be reached on october 2029 swan we get to all the way to swan may 2030 parkland estates and that's that 72 inch i mentioned um september 2030 uh we anticipate substantial completion so last slide if brandon could hit that so just like you saw in the success stories flooding would be a thing of the past as you can see with the list of bullets uh a project would be a game changer okay mr i'm gonna have to ask you to stop the presentation okay i am ruling the folks that are in our offices that are being disruptive to city council procedures out of order i have asked them to leave the premises they have refused to leave the premises i'm going to call a recess i want everybody to remain in their seats until this disruption has been uh resolved and we're going to stop the presentation for one moment please due to that disruption and we're waiting for security to clear the room your patience i also okay yeah i'm just so the situation is still it's outside of the security realm so i want you all to remain in council chambers until i give you the all clear but i'm going to gavel us back into session and so that we can continue with the presentation so council is back in session clerk please call the roll thank you thank you mr baird thank you for your patience continue please thank you chairman so in summary we have one of the best contractors we have a phased approach and a comprehensive business assistance plan and a project designed to pick up flooding from other neighborhoods um east and west of howard the project is not getting less expensive and the flooding is not going away so um i would respectfully ask for your support on the project thank you and we will take questions or you can turn it over to mr rojero to do the funding plan either one for council this is my proposal i do believe that as i asked earlier before we started i think most everybody's made up their mind i think what we should do is do a five minute round and then just call for the vote is yeah i mean i'm saying five minute rounds of questions statements whatever you want to do and then call for the vote is that is everybody amenable to that okay uh councilman brand i saw your light first councilman i'm sorry i'm i'm sorry council miranda then maniscalco then her tech i mean this is very difficult it's uh who's right and who's wrong but it can't be two wrongs or two rights uh when you start looking at something like this and you hear part of the testimonies that i heard well what about flooding in my area well i got news for all of us this flooding is in a lot of areas and we have to start somewhere if we don't start guess what you're never going to finish so we have an opportunity to start here i realized what happened two years ago a year and a half ago i realized what's happening now uh the last three days but flooding is everywhere and part of it is our fault all of us for getting nature and taking advantage of nature this is a result that we get not only here look throughout the whole country look throughout the whole world what's happening all the earthquakes we never had that before we never had the flooding we had all over this country we never had the rainfall we had over this country different states and so happens that this is one here in tampa so these are the things that we're looking at and if today if i look at everybody in the audience had a wonderful opinion and i guarantee you if i put those who were four to be against and those against to be four i'd have the same result for the public stand still zero don't move forward and don't go backwards we have to do something sooner or later and sooner just arrived that's all i'm going to say thank you councilman miranda councilman matuscaco thank you very much i'm looking at the timeline here of how it starts from bay shore and it works its way up from what i added up by the days by phase we don't reach swan for about two years or so that's correct and at the salmon expressway and howard is the longest period of closure which phases nine and ten together lead up to like six months um four months plus two months because it's 130 days plus 50 days almost six months um well right right around there that's that's a long time however on morrison morrison will be kept open during that time morrison i see a nod from kimmins yes there are i believe no truck signs on morrison is that correct because you're gonna have to have food delivery and solid waste and everything else well if there are no truck signs will those be temporarily removed to allow passage considering the situation we have john you want to address so no large trucks i believe no h20 trucks is that correct and then so the delivery trucks would could come in that way and then and then kimmins equipment would handle you know the delivery to and from the establishments okay so my question i asked this the other day to someone else palmacea pines had significant flooding parkland estates has significant flooding we don't get to swan and howard and then to that area for two years if everything goes to plan on schedule as we talked about if there's a yes vote today what happens in the meantime if we have heavy rainfall does it continue to flood until we get to that point because right now it's a capacity issue and we don't have the drainage to alleviate that i someone said the other day as we work our way up howard it will alleviate the flooding but if there's no connection for two years if everything goes on schedule how is any of the flooding i mean they're gonna they're gonna be flooding for the next two to three years until we get there or is something else taking place they will be flooding in the next two years so it was said earlier you know when it flooded i think 2015 2016 and then when it you know then with the hurricanes what changed 11 years ago other than we passed the the capital improvement assessment and everything in 2016 why did it start flooding in 2015 what triggered that and i brought up in the last when we talked about this the first time a few weeks ago i said when i used to go to school there when i used to hang out there in the 90s i don't remember any of that flooding 30 years ago councilman miranda said a lot has changed in 30 years and we there's been a lot more building 30 years ago but in 15 is when we had that when it was mentioned that parkland flooded significantly and it's been like that ever since what what changed yeah so so two things storms have become come more intense and yes we have had more impervious and uh with that i'll let amanda if we have anything to add on that i'm sorry amanda phillips with acondralis i was just going to say development in general all the impervious area that's been put out there now somebody had mentioned earlier about cleveland street and that being backed up and that pushing the water into palmacy of pines which then rolls south and goes into parkland does that have anything to do with it is it a lack of maintenance or it's an overtaxed system because of all the development i'm talking about cleveland yeah sorry cleveland street um it's also the same issue with development it's now undersized so the water can't the amount of water that comes into palmacy of pines can't leave quick enough so that it backs up into and there's no way instead of tackling this as a how a south howard project that we not focus on cleveland i understand it's probably going to be much longer going in the other direction but wouldn't that make sense to alleviate that pressure so that water doesn't keep going south well with the addition of the south howard project we would now have two outfalls okay so it actually makes a system in order to do that correct so i'll end with you know we looked at other success stories and and i've been here since that stormwater vote and that was exciting too but um you know dale mabry and henderson which was united and i did go to christ the king many years ago so and and my dad had his business right there at neptune and dale mabry so i i i saw the flooding forever that was fixed and i haven't heard of flooding since yes there will be water on dale mabry but when they clean this was a kimmins project i believe when they shut down dale mabry and henderson it was done in like a 48-hour period is that correct it was very quick to get through that intersection for a total shutdown is that right john said that's correct yeah okay the thing with that is you have north south east and west dale mabry and henderson and you have other access points the difference with howard is and this whole area is you have dead-end streets you have one-way streets and then you have the crosstown which creates this dead end where the epicurean is at and all that area morrison is a cut through but you have the crosstown that divides it that makes it very difficult not just for the businesses but then for the residents um you know and i'll close with this why is it that we can't do anything to alleviate the flooding like an immediate fix now because they're going to be waiting for years until you know the howard avenue project gets this one there's nothing i mean we talked about this two years ago with the hurricanes i mean i know it's it's not a maintenance issue it's not an ami pond issue i mean i've heard so many things but there is nothing that we can do immediately you have to make the outfall bit the outfall bigger where the water goes bigger first to be able to get the alleviation up in parkland and palmacy either way either direction you go okay thank you very much there's really nowhere for the water to go um okay so uh chairs out i'm chairing but it's my turn so i'm going to go um so i have a question for mr o'hero um because we heard quite a bit from east tampa residents today and so i wanted to talk to you about the 1.5 million for the broadway avenue um project that that uh those residents really want to make sure goes through will we still have one and a half million dollars to do that project if we do this project there i'm sorry dennis rojero chief financial officer good afternoon council we intended to use about a million dollars available balance from that particular project for the south howard project i understand and i'll defer to stormwater but i understand that a way has been found to proceed with that project without this balance funding we were going to use is that accurate okay okay thank you so that i appreciate that question thank you um that that was my question um for you uh thank you so for me um i heard a lot today about the loss the cost of business loss for howard and i i completely understand that and i am concerned about that as well um and i appreciate that they were able to do an economic impact study but what we weren't able to do is an economic impact study for how much has been lost already for the businesses on swan for the hospital for those patients for the residents that are already have dealt with flooding and so for me to be able to use a number like that i need both and i really believe that the cost uh for the cost for um sorry chaos today um the cost for that for that will just continue to rise it's not going to go anywhere um and then also not only do is it the city's job to find a solution to this i mean this is literally why we exist cities exists to solve the problems of infrastructure for neighborhoods and businesses but really importantly and i don't know why they're not here and i i'm sure it's political but not being able to access a hospital is just not okay anything we do we have to be able to access a hospital so um so for me my vote hasn't changed at all during this i definitely support this project it's not perfect but it really has to happen we have no other opportunity this is what we do as a city this is our job as a council sorry i'm still anybody else um councilwoman young i mean i'll just say i've been pretty consistent um since you know we've been talking about this project um i do have a question regarding the um the cs the cs csx crossing so and i don't know if we spoke about this before but in the event that that is not granted what happens in the event that csx does not permit that um first i would say that that is is extremely unlikely given what we've received so far from csx they have given us a response that indicates that what they've seen so far and by the way i have never received a response within days from csx and usually they require us to complete our design or at least get to 90 percent before we can apply for our permit that's just how the permit process works but based on that response where we have i think there were four requirements that we do they said if we do those requirements we will get a permit that's basically what that email said um to that was sent to kimmons uh within the last couple days um if we don't if we don't get receive a permit for the 60s micro tunnel we still have the five by ten box existing box under those under the csx crossing um to be able to use that will still provide um significant uh relief to palmacy of pines and to parkland states i meant to say that in a reverse order um so i don't know if if amanda wants to cover some benefit costs associated with with that but it is significant okay hold on one second i'm sure just for the public's information we still have a security issue but it's outside of the double door so we're okay in here but i want to let you know that tampa pd is controlling it out there so we're all fine but i just please do not leave until you hear from me that it's it's it's safe to leave okay okay very good continue amanda phillips with akandrialis um so if we do not get a csx permit which is highly unlikely i mean that we will we will get a permit but if we don't the five by ten is still adequate to provide sufficient relief to both neighborhoods um with just the five by ten um we will still take out care of all 96 homes in the five-year eight-hour flood uh during a hundred-year storm which is just below like a hermit key milton storm out of the 272 homes uh flood we will be relieving 131 of those and with that um in a hurricane milton situation with 333 homes that flooded we would still remove 192 of those with just the five by ten boxes without the 60 inch i would also like to add if i could we've had i and i didn't go back and count them for the last 40 to 50 years we have had 40 at least 40 to 50 csx crossings we have been 100 successful in receiving permits from csx 100 percent councilman carlson um i realize that you that the state allows for the ccna process but can i just ask a yes or no question did we actually do an rfp on on this hundred million dollar project or did we just use the cna did we actually do an rfp on this hundred million dollar project we um followed the consent consultants competitive negotiations act process which is a competitive process to select design build teams or design teams and that means that that a review of maybe three or more um firms was looked at in the beginning before any budget was set to it but for a hundred million dollar project we didn't actually have a bid we don't know what anybody else would have bid we know that kimmins is a great firm by the way i'm not criticizing them but we don't know how much somebody else would have bid for the hundred million dollar project correct we it may have said ten percent we saved ten percent that might have been it's a it's a choice by the the administration it's legal to use the ccna process but we might have saved taxpayer money to use that um also um i'm working with lisa because my aid is out today so don't hold any slides i'm going to say against against lisa or guido but um could you put up that slide number one so in your myths on page um 13 if we could go back to the myths on page 13 i find these myths really offensive um there's nuances to all of these and i can go through and refute each one of them but i think it's really a bad idea for a government to criticize the public which is in effect what this is doing to page 13 under the myth in fact so i'll just say this one of the myths says the funding plan wipes out the funds for other projects well last time uh the cfo testified that um from 20 i think from 2032 to 20 um 43 or something it does not wipe out the money and i've got some other evidence on that if i have time but lisa could you just show this slide uh you know what what he then said was that yes between now and i don't know if this not that slide the um the uh the one with the numbers on it sorry the one that i just caught up yeah the the one with the numbers sorry sorry oh yeah so i wanted to show the myth first it says the uh the funding plan wipes out the funds for the other projects i mean really it does over the next uh that's the wrong slide sorry i gave you the wrong one anyway what it um what what we found from the the cfo's office last time or cfo last time was that it does wipe out all the money for between now and 2032 anything that's in the cip or this project is getting funded and we can move things out of the cip but the reality is that we don't have funding for other projects so i think it's ridiculous to put in that there's a myth that the funding plan wipes out of the projects when it does for the next five or six years i mean let's just be honest with the public the other thing is on the myths on the same page it says the csx first serves mcdill air force base um i don't know if i'm allowed to say this but i believe that the last remaining client serves jet fuel and i would be surprised if they don't supply mcdill so i don't know who made that statement if i'm wrong somebody can say that i'm wrong but um uh no we don't respond from staff yeah we don't respond from the audience okay so this we're just talking amongst ourselves uh the other thing is the lack of maintenance we know that lack of maintenance caused flooding all over the city and i'll show that in a minute but also it's really offensive i was the first person to go into palma sea pines uh just after the first person for the city to go in palma sea pines after the after the flooding and i toured around with two of the folks in the neighborhood and we saw the lack of maintenance everywhere we saw debris everywhere that had not been cleaned up and we know that that had an impact i mean the better answer instead of trying to prove the public wrong is to say well maybe it had a 10 impact or 20 back but just saying it didn't have any impact is not really fair or accurate the other thing uh lisa can you put that the slide back up the one that had that uh blue the blue line sorry it's number two yeah i mean this i had jean duncan uh comment on this a year or so ago but on the right you still see that the the blue shows that in palma sea of pines houses are still going to flood and you might say call it the structure there's not going to be structural damage but if somebody has one inch of flooding it's still going to affect them and it's only 70 percent for a milton style event which means 30 percent which is still very uh bad um can you just put up the uh the the last slide please don't want the map with the dots this is can you just move it up this map i got from storm water about a year or two ago uh it's hard to see uh but the red is the houses that were flooded because of storm surge and there was a comment from from someone who uh who said that uh this neighborhood was the only one that flooded from freshwater flooding you can see clearly that maybe thousands of people got hit by storm surge and we should have it work on a solution for that but there is none but if you see all the rest of the houses which go all the way up to east tampa and new tampa there were significant all those areas in the middle of the peninsula on up all that is green and you see that there's high concentrations of them and i've said before there are 20 or so places depending on the concentration you want to you want to catch but every one of those dots represents a family that flooded and what we're doing is we're saying all of those families except this one area has no chance of getting any any help all those hundreds or thousands of families have no chance of getting help in the next five or six years because the city is overpaying for a bad project thank you thank you councilman carlson councilman vera thank you mr chairman hold on a second lisa if you go out this way if you let them know have them tell me when the situation is resolved please okay thank you councilman yes sir thank you mr chairman really quick yes and no um does this project wipe out future stormwater funding and revenue sources within the next five to seven years yes or no no no and uh dennis has the details on i'll take that exactly yes what is left what is left remaining for revenue over the next 20 years thank you and just very briefly so i can speak i mean we spoke like the chairman said just five seconds have at it again good afternoon council dennis rojero chief financial officer uh and again in order to clarify i believe uh councilman carlson is correct in what he said i'm looking for the slide right here fyi we are status we're good to go so if anybody feels like they're being held captive you are no longer being held captive feel free to leave if i if i can have the wolf up please i believe what this funding plan the way we envision it and what's been presented to you i believe councilman carl said no other funding other than the five-year recommended cip that's been submitted to city council for fiscal year 27 to fiscal year 31 you see it by year you see it by project category it totals about 30 million dollars this plan funds that as councilman carlson said it does not fund anything other than that except for as i've said the debt service we are already obligated to so this plan allows 30 million dollars over the next five years for stormwater thank you mr chairman and go ahead thank you i'm just laughing today so weird um so so and thank you guys for that so couple of couple of issues here i i really really appreciate the folks that came but especially two groups number one the businesses um they're advocating when i say for their interests i mean their interests of running businesses and creating jobs nobody here begrudges that okay um i appreciate the homeowners who were flooded and came here and spoke out of their deep trauma i appreciate that a great deal um and i've said this a million times there's black and white and then there's gray there's a lot of gray on this issue but again like i've said before for me the overwhelming things that i see lead me to support this there have been some things said in public comment that i wanted to address just comments that kind of fly in the face of how i see it somebody talked about the free market and flooding no no no no that's not not applicable here at all um someone else said they could sell no no no no no no no that's not good um and then this idea that and this wasn't really said today it was said last time that we should look at this as district versus district i don't do that i represent newer north tampa and and i try to advocate for the interests of everybody as i see it people can disagree with my interpretation of those issues and i respect that but that's as i see it i represent a district that was badly flooded north tampa i fought really really hard i was the first one to bring up the issue of getting millions of dollars for working class and middle class and lower income folks who lost everything for flood assistance going well above and beyond what fema did we've taken care of pumps out there we're doing what we can out there but for me i don't look at this as east tampa versus north tampa versus west tampa versus south tampa i i don't do that i try not to be parochial to the extent there's a call for that because last time not today but last time there were but with regards to allegations that we're going to be spending all of our money on this project a project that's not going to work so we're pretty much telling the public that the city of tampa is using all of its flood money for a project that's not going to work how stupid of a municipal government are we if that's true so god forbid right that's what i say god forbid um and so again my issue with this is i try to come from the heart on this before milton i was more of an agnostic on this i'll be honest you can ask my former aide brandon jordan lazio on this i did a uh community meeting for uh flood victims and a lot of folks who had briefly spoken with me on this issue came there dressed up in t-shirts and looking like they just came out of noah's ark and it was like a week later and my heart went out to them and i would visit with these folks and i got involved on this issue from my vote here on tampa city council and that's where i come on this at um there's a lot of appeals that have been made i don't think that there's been any negative appeals today that i would object to um again a lot of the businesses on south howard they're advocating not only for their interests but for their interests that affect the greater welfare that is a significant issue that i know i certainly have a lot of respect for the biggest issue is this two things people have come to us who have gone through hell some of some of y'all i remember speaking to y'all and seeing y'all immediately after milton here in tampa city council you guys were crying and you're still here and you're still dealing with the trauma and for me that's the overwhelming issue that i personally stand beside i also say that as a local government we can't abandon a neighborhood in effect to be flooded right whenever there's heavy rain in this area it gets flooded are we just going to say no we're just going to give this up i can't do that in good conscience so that's my vote and i wanted to explain that and go into detail because the bug stops with us and and all of us i think are going to do what we think is right including councilman clinton who we're all going to eagerly hear from thank you well well well so i actually prepared remarks this is what i was doing at 2 30 this morning so this has been one of the most difficult decisions that i've faced since i've been on council this makes baseball look easy and after everything i've read heard and questioned i keep coming back to one fundamental principle and this is really was as the basis of my decision that the most basic responsibility of a city government is to protect the safety and security of the people that we serve that means police and fire protection it means emergency response but it also means protecting homes and businesses from flooding keeping streets passable and making sure people can reach hospitals and medical care and first responders they can reach them flood protection isn't simply an infrastructure issue it's a public safety issue i spent weeks examining the south howard flood relief project i've challenged the cost and the assumptions i've examined the engineering the flooding data the construction impacts and the alternatives when we're talking about this much taxpayer money i've looked under every cushion to see if i could find and make sure that they're spending the money wisely and i've also listened i've listened to the people who've watched water enter their homes and businesses and who and who worry about what the next major storm will bring but i've also listened just as carefully to the residents and the businesses who will bear the burden of the construction and the people that worry about the access the parking the deliveries the traffic and whether their businesses can survive that disruption those concerns are real that's why i keep asking the one question was there is there another way is there a less expensive or less disruptive alternative that provides the protection this community needs i really wanted the answer to be yes i've also struggled with the unresolved uncertainty involving the csx railway i don't like that we don't have the issue completely resolved it bothers me and i've made that very clear to everybody concerned but difficult decisions rarely come to us with every uncertainty eliminated so i've had to weigh the uncertainty against something else that is very real the consequences of doing nothing doing nothing is also a decision we know homes and businesses are vulnerable to flooding we know streets can become impassable and we know severe flooding can affect people's ability to move safely through the city and reach critical services at some point you've got to ask the questions study the alternatives listen to the people on both sides challenge the numbers and then you have to make a decision i know some people in this room are going to disagree with me to those residents and business owners i want you to know this i heard you your concerns made me dig deeper they made me ask more questions and they made this decision much harder but we weren't elected only to make the easy decisions we're elected to make the difficult ones based on the facts before us and what we believe is in the best interest of the people that we serve after weeks of research questions and frankly a lot of soul searching i've reached my decision i believe the greatest risk is failing to act to those who have lived with the flooding and the next generation that will benefit from this project i stand with you and to those who disagree with my decision i respect you and i heard you and my questions will not stop tomorrow i've done my homework i've listened i've questioned i've struggled with this decision and i recognize that there are still uncertainties but based on the facts before me and our fundamental responsibility to protect the safety and the security of tampa's residents i plan to vote yes okay i would like to hear a motion to approve resolutions 66 67 68 69 i have a motion for councilwoman her tech i have a second for councilman viera roll call please miranda oh council miranda yeah carlson yeah miranda yes meneskako her tech yes young no viera yes clinton yes motion carried with carlson meneskako thank you thank you all for coming out thank you okay we have two more agenda items on the schedule um for those of you i've the individuals that were making disruption they could be downstairs just please don't engage if you if you encounter them thank you working nine to five what a way to make a living what's that yes yeah there you go let's have one one two two two oh really yeah oh i know we're gonna give it a second for everybody to leave take care okay okay for those of you that are still here we still have two more hey everybody hey we're still actually meeting we still have two more agenda items and thank you guys i appreciate it but if you could carry the conversations out into the lobby i'd appreciate so we can get rid of these last two issues and it'll be martini time we're done don't vote for today for today at least thank you okay item number 71 i see mr fowler thank you mr fowler for being here and thank you for your patience glad we were able to have have a little side show for you and entertain you best show in town right here must see tv and thank you junior for everything good afternoon ted fowler parks and recreation director and it was a show to say the least so what i have up is a drone shot of tappan park track and what we can see is right here where i have my pin is the only thing that the city of tampa parks and recreation department maintains it's a nature based park that swift mud about 20 years ago came in and did a lot of upland improvements they planted and restored this entire group of mangroves as well as created these tidal pools and this nature area so 95 of that park is untouchable by anybody on my staff um some of the ideas that i have i've discussed with michelle and pam i think the most prudent thing to do is to get somebody from swift mud who's qualified to come out here and look at the overall health of the park it is due for inspection every 10 years the last time it was inspected was 2019 i don't want to wait until 2029 so my plan of action is to ping somebody at swift mud and possibly get them to come look at the overall health of the park did the hurricane damage it has it failed in some way because of any other outside influences so that's the first thing that we're going to do to get them as soon as possible out here and say yes these tidal pools are working the way they should these mangroves are providing as much natural protection as they can and and just assess the overall health of the park mr fowler is there anything that we're doing on that upland city portion that you described that city controls that is affecting water flow or is there is it and what are we utilizing what are we doing there that what why is why are we getting involved in that section we that is what per the agreement we maintain and when we maintain it it's a contract mower and my team goes by periodically and and make sure there's no litter on the ground and no mattresses being dumped or are we changing the grade or doing or digging ditches we don't have the authority to perform work in there without permission from swift mud okay so those as has a city in the past changed anything in that portion not the city there was a joint agreement i believe in night started in 1999 and finished in 2002 that swift mud came in there and made all these these upland and wetland enhancements made sure the mangroves were healthy created the tidal pools things like that did the salt grasses that actually attract birds to come and be a natural estuary as well as wildlife okay councilman carlson council miranda oh yeah so councilman carlson um yeah thank you thank you for um doing this and uh michelle who's still an audience her house is right there to the right of that that red line yeah right there um so there there was a it maybe yuan can answer this but that to the to the south of this picture there was another area that would that was changed i think maybe for some real estate development would would that have been part of the park or was that just a stormwater thing and and what response so i went to this neighborhood the way i met michelle is that i went to her house like the day after the storms too that whole street was wiped out i think the street behind was wiped out too you're talking about from the storm yeah okay and so uh i think like an eight-foot wave came across all the mangroves and everything so what responsibility or help could the city provide probably to you want about about protecting those houses to keep them from getting hit by the water sorry um good afternoon council yanny stormwater services director and i concur first i uh we really appreciate the concerns from the residents regarding the house and the nature of this park uh as as tied mentioned about this is undeveloped nature preserve and the city-owned and maintains a portion of the park but really the regional agency southwest florida water management district they do have the uh regulatory oversight of the entire park so we have to any any change any alteration of the net nature flow and the journey surrounding this area we have to go through their environmental resource permitting process sorry to cut you off before he cuts me off do you think that just on the on the section we could see is there something that the city working with swift mud by the way i know three or four of the board members but if you need the help but um if you is there anything that the city or swift mud could do to prevent those houses from getting flooded by a wave of water coming across uh we we did some research i i i just wanted to present some fact first and please and this is really the female flood zone and let's be realistic and this this the whole park is uh about the uh the bay and the elevation of the the at the park is between uh sea level to two feet so this is the most vulnerable coastal area of the city probably is subject to a coastal hazard including both high tide and stormwater surge and and you can see here the um the base flood elevation of this uh of this park is this area is probably 10 feet and adjacent to that as a coastal flooding will probably raise up to 14 to 15 feet during the search so it's really a most vulnerable place in the city as you mentioned before and both davis island and other coastal areas are subject to similar coastal hazard is there anything though that and and this this map could you hold that map just for a second this map shows the part to the south also that i think michelle has shown pictures in the past about that part being changed did swift mud or the city change that who would have changed the the topography of that part to the south i think the resident previously concerned about this portion that's a hybrid that's a apartment complex uh that was developed several years ago and it went through the rigorous uh environmental resource permit by the district and we evaluated their permit application a bunch of my staff engineers were uh looking into the application and all those kind of communications between the swift mud and the applicant of the whole thing and they did meet their standard for the development so so is there anything if if swift might gave us the okay if we partner with swift mud the part to the north end the part to the south is there just from your experience is there anything that we could do to to slow down or prevent the flooding it you said to the left where tap tap park is that it's zero elevation and then a couple blocks away it's ten um is is there a way to slow down the water or stop it i know there's a little tiny ditch there but is there anything else we can do well to be honest the most physical solution for for flooding relief for the coastal area is to raise the home that's the only um i will say that's the only permanent solution that can resolve this kind of flooding because we also are subject to the sea level rise we periodically encounter the high high tide and the stormwater surge i do have a table that's showing you the the major storm surge events of tampa bay so i believe the the home of the resident is at around five or six feet and as you can see from this figure and then the charts theoretically that they they make they may face the stormwater surge and high tide so really raising the home is the only permanent solution that area that's south of the tarp that's undeveloped who owns that i think the city owns the property so that can you put that other map back up there that looks like there's canals carved into it i have another map here that probably showing the greater context this region yeah okay interesting yeah go ahead um if swift might came in and put a thousand more mangroves in there would that have slowed it down or or if somebody put a swell would that have tidal surge though and we can definitely reach out to swift matt paddy's cracked and and the stormwater also conquer we should reach their uh swim program that's surface improvement uh and the management program of swift man and we can request that they do a fully evaluation especially we encountered the hurricane two years ago and it's probably uh it's a good time to do a full evaluation gets the professionals opinion whether we need to consider the restoration efforts related to the hurricane damage those kind of things and also we also uh did some research regarding the grants opportunity there is a sea uh sea grant opportunity and this resident florida to restore the living shoreland those kind of things we can talk to those agencies and also talk to swift man to do the free evaluation that's going to be the basis for the grant application should we vote to ask you to do something or would you come back to us at some point and ask us to do it how do you recommend proceeding either way we'll be reaching out to swift man yeah just just to be i mean based on my understanding is that this this this flooding is caused by rising water and what the what the mangroves and the living sea shoreline would be more for wave action you know it creates obstacles for wave action but you if you have if the gulf of mexico and and in turn the tampa bay is rising none of those solutions would work for rising water but it would it would be able to be breaks for above the sea above the surface water so any kind of wind action wave action kind of stuff that would be a solution so if the problem was wave action mangroves and living shoreline would be effective but if it's just rising water the water's barring having dams out there the waters we're not we're not holding back the gulf of mexico can i make a motion yeah go ahead um help me make it so that it um meets your criteria how long so what i'd like to do is make a motion to to ask i don't know if parks wants to engage too but at least the stormwater engage with swift mud and whatever other agencies um to see if they can help to mitigate some of this um with planning or and or money and um or or implementation and then how how when should we ask you to come back how soon could we ask you to come back uh maybe in couple of months december is that i would give them longer time if they have to coordinate with swift mud january how about january 7th is that okay i'll second the motion i have a motion to get uh to have staff returned back to city council on january 7th with the report on potential mitigation efforts associated with uh tappan park as swift mud although a motion a second all those in favor say aye aye i oppose the ayes have it okay very good thank you thank you all thank you for your patience okay abby feely it's the abby feely show good afternoon council abby feely administrator of development and economic opportunity i'm here today to give you um the update on tampa forward and where we are with the land development code update process as a reminder this is a multi-year effort to comprehensively update modernize and reorganize the land development code and we are completing that work in installments installment one um has made substantial progress it is not done one of the main issues we're still evaluating with clarion on that was a proposal for the rs50 and rs60 to go to the rsu which is residential single-family urban we've heard a lot from the community on that and we're still working through kind of what our options are as far as that consolidation and really balancing that with the city's needs for missing middle housing because that was one of the proposals clarion made so we're still working through that how do we preserve the character and predictability for residents expecting to be established in neighborhoods while creating appropriate opportunities for housing so that work is still underway and we're going to come back with a clear response to the community as the evaluation is completed there are also a few other installment one items that remain under review so i just want to be clear this is iterative and we're still working nothing's closed out someone did comment on the web page the other day that the feedback for installment one was closed that will be reopened so you can still comment on all of that throughout the process so at the same time the ldc has been moving forward the comp plan has also been moving forward and i know that is now on your agenda i believe for october 22nd for adoption which definitely helps in sequencing for the land development code so um installment two installment two is scheduled to go out to the public on october 1st and we will be having the what we typically do is public engagement starts right after that and we will have our technical advisory team so clarion normally comes in once the installment goes out and tells them here's what's in the installment so you know as you're looking through the installment um what to expect so that will be happening on october 2nd um and then we will are looking to have our technical advisory full meeting at the end of the month october 29th which would give them a month to work through that and then clarion typically comes and meets with them along with our public meeting which would be that evening so all of this is being updated on the web page now um and over the next few weeks we'll we'll see that start to take place thank you does council have any questions of miss feely no i appreciate the update thank you so much appreciate it you missed this last time and i don't believe i come the first week in october which would be good i would be coming in november to to fill you in on all of that and and how things work on so thank you thank you so much okay um we'll see new business councilman carlson councilman vieira councilwoman young and you always do as always okay a couple of things um number one one the great american teaching is on november 19 2026 uh so we participated um when we did the first time and then we started council at 10 a.m or 11 a.m to give council members the opportunity to participate in the great american teaching if they wanted to is that something that we would like to do again do i need to make an emotion you do okay so i make a motion um for our uh regular city council meeting on november 19 20 26 to start at 11 a.m um in um observance of great american teaching so our council members have the opportunity to participate i have a motion from councilman young a second from councilman maniscalco all those in favor say aye aye you have to speak at a couple of schools i have to go to my team my uh my wife's school they want me there and then someone from the community asked that i speak at their son's schools yeah that's great and i i wanted to bring it up because we've been getting emails and i was like oh we talked about it at the last minute but we didn't make a decision okay great we did the same thing last year perfect okay um i'm sure all of you i wish ted was here he just left um i'm sure all of you saw this email um that went out i was talking about um some moving of some monies particularly a lot of particularly from sofa springs for a certain project um i did i've had several conversations with um our parks director mr ted fallow we actually had a meeting yesterday with the sofa springs pool committee pool committee we meet quarterly um and we also discussed um you know talked discussed uh the email and all in all there are not any funds that are come that are moving from sofa springs projects toward this uh the swan park project in fact some of the projects that were listed um in that email some of them are already moving forward and have contracts and designs and all of these things so um so that is not just to put that out there there was um we had the sofa springs uh pool committee some members from the neighborhood the sofa springs action league and then also just some residents that were there in that meeting and then also um councilwoman uh her takes uh yeah was there as well so yes also not yes so we had a lot of discussion so just to put that out into the air um also for the 56 in broadway project um i had a meeting with our mobility director mr brandon campbell along with um two of our east tampa residents to talk about that project specifically um and there's actually there may there may possibly be i've been given this information there may possibly be another route that can be explored that will not have to um hinge on getting the approval from the business owner to use their easement so there is another option which is what i did ask the ask them to do and that's what they did so um so there is no so there there is still possibly a path forward and um mr brandon campbell did say if that opportunity presents itself that we would that the city would go and could pursue it so just an update for that um also just to put this out there i've been getting a lot of feedback from constituents in the district regarding the extended time for home repairs for up for unkempt residential homes i know this is something we've talked about before i don't know if you all have been receiving that maybe it could be a conversation we have later on down the line but i know that there are certain processes and things that we have to go through with our code enforcement office i talked to um our susan winnoway daily about this but i just want to bring it to council's attention because it's something that we're getting a lot of calls about people are saying we've been calling and calling for years um and there's they feel like there's nothing being done so just to put that out there so that's all it's a repetitive issue i know yeah yeah so that is all thank you councilwoman um nothing major i just wanted to do a personal update because people keep asking me about how i'm doing so i thought i'd just tell people every now and again um i completed my third um infusion yesterday and i'm feeling really good but i will have to say this morning in the shower i started to find some hair so this might be the last time you see me with my real hair so it's okay but um so yeah i know welcome to the club but other than that i'm feeling really good i'm doing what i can and i really appreciate everyone's well wishes remember god just gave the pretty ones more face and we continue to pray for you i'm wearing pink today specifically for you if it's not a ribbon it's something pink and uh i wish for your uh for for you to get back to good health and uh and quickly and that's it council miranda thank you same thing i pray for you every day and i think you're doing much better and uh let's go on with the rest of the show because you're doing one hell of a job and so take care of yourself thank you i would like to make a motion to move the convention center presentation from september 24th workshop to the november 19th regular council meeting under accommodations and presentations thank you that was my question so good you answered your question before i had to ask it we would get it for you thank you we have a motion from councilman miranda a second from councilwoman her tech to move the can tampa visit tampa bay and convention center presentation from the workshop on september 24th to november 19th 2026 all those in favor say aye aye aye opposed eyes have it anything else that's it sure speaking of that workshop we had previously this is for the clerk we had previously in a motion the last meeting had moved both of the noise ordinance issues to the same meeting i see that on the workshop schedule the one is still there it needs to be moved to yeah we made we made a motion last time but it's still on it's still on the agenda so if you guys could check that september 24th the second item on the agenda city staff to present suggestions proposed enforceable rule changes that should have moved along with the other noise uh noise issue that was a motion by councilwoman her tech no it was oh it was the councilwoman oh is your okay yeah okay very good okay um speaking of swan park i know there's a lot of misinformation about that they're going out there and they're working on this has been a project that's going on forever i know councilman carlson had had it for a little while i picked it up a little bit i will i will say one thing in defense of this area there's no been no investment from the city on any park investment all the stuff that you ever see in that area has been privately investment so investment in parks we should not push back on and and and they have very little park areas in that area anyway so oh but the issue that the residents are having is you know the art folks were promised an art building i don't know they have jcc the program but the jcc isn't enough they need more we need more space okay but if you like so i mean i'm sorry but this this is not this is not done there is not even one iota of anything in the parks master plan about this park but again if you're i'm just saying okay okay but again if you were to look if you were to look and we talk about equitable distribution of resources around the city of tampa this particular area of tampa has gotten almost nothing we just gave two and a half million dollars to south tampa parks not in this area of south tampa this is i mean this this is a this is a significant area that there has not been any investment in but i'm just saying i just i keep hearing this information about swan park i just want to know and by the way i worked with the the arts center yesterday people i wanted i'm i took an iou from them to talk about ted fowler to have some space reserved so that if they because they're talking about doing some private fundraising to build an art center and what i would like to do and i'm going to and i don't know if it's possibility but i took the iou from them that i'd work with parks and rec to see if there was space that we could reserve within that area so that if they were able to raise the capital to be able to construct something like that that we could have convertible space that would be able to dedicate it that so that was i thought that might be a win-win kind of solution so i i took that i you so ted fowler if you're still listening probably not you're in the car but if somebody tells you that i'm gonna my office is going to be calling you to have that discussion um for that so in front of you all um mr shelby passed out uh the the questions are the information that we had submitted to the charter review commission um from council for them to consider uh when we have that uh workshop on september 24th i would like you all to review those council uh suggestions and be prepared to discuss that along with any other issues you would like to discuss reference the council charter review commission recommendations mr chairman yes sir so i'll go over these questions i will answer them you know one by one can i get you know five six minutes to just go down and say yes no yes no and quick explanation it's you know it's going to be a workshop okay so we're going to have a dialogue about these things but i i just wanted to make sure it didn't catch you by surprise so that you could spend the time between now and then having that you know internal conversation and research to try to refresh your memory about what we had suggested so because just as a reminder uh we're in the charter review process the chart we handed the charter review process off to the commission that we put together that commission has made recommendations it's coming back to council council will be able to do a vote up or down on those recommendations but we also have the opportunity to create our own recommendations so this is this is part of this discussion so that's what we'll that's what we'll kick off on that workshop on september 24th of 2026. um and i know i just had something else i was going to say and i can't go ahead yes because that happens to me all the time oh i'm sorry thank you uh councilman young so a couple of things if i may um i i a lot of us know vivian kitchen who's just a wonderful community leader and so since we can't talk about this i had spoken to communicated with her son um she's obviously being honored by the naacp which is marvelous and i wanted to have something here off-site that that we could do and everybody at council could be to honor this so i i i do this just to get it out there present it it's your district glad to have you do that but no no no it's we can all do it but yeah so accommodation yeah but off so a motion a date to be determined yeah a motion for off-site date to be determined to miss kitchen second councilman metaskalco all those in favor say aye aye aye opposed i have it thank you because i cannot remember what the second thing i was going to say i'm going to have a motion to receive and follow me oh wait i'm not done oh if i may you'll be done when i tell you you're done no oh you're done six more weeks give me kindness give me kindness i know right six weeks i'll be done no but just really quick if i may um i sent you all a letter on an issue with tampa fire station one in a renaming i've talked about this before with franz warner and isaac royal just take a look at that i'll be motioning for it'll come after i leave but just fyi and then i i i wanted to i don't know council how to handle this which is i've heard different things about the special needs internship program and um i want to talk about that at the budget hearing in terms of what the city plans that should i do a motion to have that on the docket or okay so if i may i'll have a motion to put that on in our in our forthcoming hearing on the special needs internship yeah and that's it that's what i wanted to say i want to remind people about the hearing now thank you just glued there yeah aren't you glad i'm i'm going to suggest um councilman that you just make a note to bring it up and advise council okay that's fine because because this is a very formal process for the second reading and that's fine so let it be known so let it be written be ready thank you yeah part of the discussion so that that is a good reminder that was the issue i wanted to remind everybody that we have our second reading of the fy 2027 budget next tuesday night at 501 pm here in tampa city council chambers so that is the second reading of the fy 2027 budget there's been a lot of moving parts but most of those moving parts will come back to us after next tuesday i know councilwoman hertech myself and others have been very involved in ensuring that those things occur um is there anything else a motion received and file for council matascalko second from councilman miranda all those in favor say aye aye aye opposed eyes have it i missed it by 25
