to call to order today tuesday july 28 2026 public hearing for the city of tampa's barrio latino commission welcome everyone i'm susan claus smith i'm acting chair of the commission today if you are here to present a project you will have limited time to make your presentations so we suggest being thorough but concise when coming to the microphone you will need to identify yourself in your relationship to the project the commissioners will not ask any questions during your presentation and your project should be presented in the following order the site plan elevations architectural details and wall sections the staff will then present the staff report and we will then ask for public comment when coming to the microphone for public comment please state and spell your name clearly if you're here to speak for or against a project your time will be limited to three minutes so take some time now to summarize your comments because three minutes goes by very quickly following public comment the commissioners will be asking questions in the same order as the presentation after that the applicant will have five minutes for rebuttal and the public hearing will then be closed after public hearing is closed no further testimony can be given the commissioners will then discuss the case and will make their decision based on chapter 27 of the city code of ordinances the design guidelines the secretary of interior standards historic preservation development review committee or hp drc comments and the testimony given at this public hearing please remember the blc can only act on items that are within our specific jurisdictional responsibility owner agents are independently responsible to obtain any appropriate permits and or approvals now if you haven't already done so please do silence your phones and i will ask my fellow commissioners to introduce themselves starting on my right vivian so laga good morning chase corley and then um i have today we have staff with us uh dennis fernandez ron vila jared varnum and then our attorney dana crosby collier and a stick morning commissioners dennis fernandez architecture review and historic preservation manager uh next i would suggest uh the reading of the minutes from the june 25th 2026 public hearing comments or objections no approve second all in favor aye aye so moved thank you just a couple brief announcements i do have the june 2026 blc staff approvals to enter into the record those can be adopted by motion at the conclusion of the meeting next i did want to call attention to your monthly installment of bricks and mortar our newsletter we did feature the tampa theater this uh month that is uh going through a renovation in a celebration of its uh 100 year anniversary and they're doing an extensive renovation that we thought would be appropriate to feature in this month's preservation and progress and so with that ron will provide that to you thank you good morning commissioners ron vila i'm a planner with historic preservation as dennis alluded to we are going to focus on the tampa theater and office building in downtown tampa so this month's preservation and progress is a look into the current work at the tampa theater and office building this project's goal is to fully restore the tampa theater in time for its 100th anniversary this is the aerial map taken in 2025 of the theater and the office building it's located in downtown tampa between franklin street and florida and in between zach and polk moving to the sanborn map that we like to show this is from 1931 it's a 10-story office building that is on franklin street which is here franklin and then you have florida to the east it connects uh the blocks with the auditorium uh in this sanborn map it shows the colors indicate certain construction types so the the building is steel frame construction with concrete floors and a concrete roof with tile curtain walls this was denoted as a very important building back in 1978 it was listed on the national register one of the first buildings when the preservation ordinance was enacted here's some background uh going back to 1925 when the construction began the architect was john elperson and he did over a hundred movie uh policies within the united states the engineer was r.e hall and he was an architect as well from new york city and the construction manager at the time he came from miami was george miller so in 1926 he got a little fanfare as the building was erected they had these illustrations that were there and they opened in october 15 1926. going back to some of the construction that took place it was amazing that they had some of these pictures as it was erected we go through the burger brother photo collection and and they have a lot of uh inspiration for us to share with everybody here as you can see here the auditorium was under construction the steel frame that i spoke about was in place with a hollow clay tile for the curtain walls in the interior here moving to more street facade is the marble and cast iron office box office and the main entrance off of franklin street and this is circa 1926. the interior was very uh ornate uh it was a major draw this is when air condition first came on onto the scene it had a cooling system had filler uh filtered dehumidification air it also goes to the atmosphere in the background to show that it was more of a of a setting than a theater at that time focusing on the ceiling was designed to resemble the sky with lights that mimic the rising sun and the setting sun with twinkling stars that theater was also uh furnished with an orchestra pit which holds about 20 musicians with a theater organ which provided a score of music that accompanied the silent films at that time some of the unique features that it had the presidium arch that is in the theater some famous sculptures were were reproduced from michael angelo and the figures from his meology here currently they're undergoing some plaster repair the infrastructure of the building had to go through renovation as well these renovations to the theater were increased the lighting levels in the lobby in the stage area with new mechanical and electrical equipment to accompany the theater's expanding educational program more than 3 000 square foot of underutilized also office space and storage space on florida avenue side of the building were remodeled to put in those classrooms and then just to conclude here as dennis stated that with our tamper bricks on mortar you could read more about this publication so with that that concludes and we'll continue down the agenda thank you ron it's hard to believe that at one time that building was threatened for demolition it was actually one of one of one of two buildings that were the first designations in the city of tampa the other being tampa union station so it's great to see the investment going into that building for the next hundred years uh with that we'll go ahead and move on through the agenda we'll next go to conflicts and expert communication and our legal counsel will lead that discussion good morning dana crosby call you from the legal department we'd like to ask if any member has a conflict of interest with any item on the agenda today no great seeing none um has any member engaged in ex parte communication regarding any item i have not thank you thank you uh we do have two continuations to act on this morning we had uh one that had contacted us uh rather early and one that contacted us yesterday so they're not on the agenda so i'll go ahead and work through those two uh through separate motion the first being blc 26 0000117 for the property at 419 east 4th avenue and the request is to continue to continue to the next public hearing on august 25th at 9 a.m have a motion please move to continue blc 26 0000117 for the property located at 1419 east 4th avenue to the tuesday august 25th 2026 public hearing at street and the request came in via email yesterday uh to continue to the august 25th public hearing at 9 a.m continue to tuesday august 25th blc 26 000 if i may add for the property located at 2905 north 11th street for the property located second all in favor aye so moved and just for the record both of those public hearings will be held here in city hall chambers august 25th at 9 a.m thank you thank you next we'll move to the swearing anyone in the audience who's going to be presenting on a case this morning or providing any sort of testimony please stand and raise your right hand for the square and raising their hand in time i do and with that we're ready for our first case blc 26 000071 and ron ron will introduce that case good morning commissioners ron velum staff with historic preservation as dennis stated this is blc dash 26 dash 000071 for the address of 1022 east 12th avenue the request this morning is for a certificate of appropriateness for a single family excuse me for a duplex at that address noted just so you know that the agent had perfected the noticing but left out a site improvements so this project can move forward after talking with legal that you're going to look at the complete um presentation this morning everything that's vertical can be discussed this morning everything else will be delegated to staff if this is to receive a final approval so staff has the ability through the ordinance to approve driveways walkways things of that nature so just because it wasn't noticed properly in that aspect it cannot be heard this morning or a motion in that avenue so having said that i just want to briefly go through the photo presentation uh this is a 1929 sanborn map area in question is circled here you're going to see that the the the density and the fabric that's here today in 1929 and then through urban renewal and the interstate you see how a lot of the density has been removed so we are trying to pick up the pieces now and move forward this is infill property of the duplexes here i'm going to show you what's on both sides there is multi-family in this area so duplex fits in with the fabric that's established this is a current aerial showing the intrusion of the interstate this is to the south of the interstate on 12th avenue looking at 12th avenue to the north then you have two abutting structures this is a period structure that's multi-family to the east this is a single family to the west that's a contributing structure just to share some street shots with you this is looking to the east down 12th avenue you see you see some other historic fabric that is still remaining and then looking to the west you have a series of contributing structures as well directly across the street you have this structure that was constructed after the periodic significance and then this is a contributing structure that's just to sum up the area so you get an understanding of what's there now at this time i'll call the agent up to share his presentation with you members of the board my name is juan quinones i'm representing the uh owner of the property located at 1022 east 12th avenue um i'm going to go ahead and start with the uh presenting the site plan and then we're going to move forward to the elevations so site plan we are located in zoning uh yc2 uh front elevation 10 feet it's our setbacks our side elevations are three feet rear elevations are 10 feet i'm going to swim it into the site plan as you see we got the 10 foot setback from the property our finished floor is elevated from gray two feet to match the adjacent properties we are consistent with the neighborhood in that sense currently we do have a picket aluminum fence all the way around the property we want to keep that we want to make sure we during construction that doesn't get damaged and if it does then we'll replace it accordingly um ronbilla just showed you guys the pictures of that jason property so we kind of consistent with that in our elevations and you'll see that here shortly the walkways we got walkways with scorings they're all concrete our driveway apron is also concrete we do have the driveway on the east side of the property and it can fit two cars in it then i'm going to go into the elevations quickly all right this is front elevation again it's a duplex um i'm going to show the different details that we have here we have um exposed rafters our facials are two foot eight two by eights we're going to have a wood siding with wood trimming we are going to have wood cladding windows we are going to have some brick face at the bottom of the columns and we're going to provide some uh columns as well to match the adjacent properties and whatnot to be consistent with the neighbor we do have some railings the railings are going to be two by two pickets with 36 inch height top rails and bottom rails also we're going to have some gutters and down spouts and the gutters are going to be round um and half round gutters with the down spouts being round so that um our eaves are exposed our rafters are two by sixes exposed we're going to have bid boards at the eaves and the poor ceilings also the color scheme i'm going to run down the color scheme for the building is going to be white this one shows kind of like a topi color matching uh some of the standard colors that the barrio latino has approved previously with white trimming one to one windows the doors are going to be consistent with the neighbor as well there's a few you know 3d rendering pictures here to show you what that looks like as far as lighting goes if we are proposing some type of walls cons on the walls this is kind of something that we are thinking about using but in this case we're going to be using recessed lighting in the porch ceilings this is currently the picket fence that's out there the aluminum fence kind of give you an idea what that looks like these are the ivor city color pallets so we choose from those colors and get them approved of course by staff if we decide to change those colors these are some typical pictures of the building surrounding or the area showing the vertical you know columns that we are actually using in our project i'll give you some ideas this is next door to us this is adjacent actually across the street so they got the vertical columns and the brick also again adjacent to the property here's a sample of the fence for more projects i just took a lot of pictures of different things columns of a new construction across the street from us and that concludes my presentation thank you sir welcome if you guys got any questions concerns we'll let um staff present their report and then we'll go to the public thank you good morning commissioner ron vila staff of the historic preservations staff finds that this application is consistent with the ybor city design guidelines on page five of your staff report i started with the site plan and remember that those conditions have to be delegated to staff so the location of the mechanical units the concrete pads the step and the walkways as indicated on page five are there the fencing and the gates they're already there but just to complete the request to us one before it goes to permitting that needs to be all indicated on the plan uh the tandem parking was in question at one time for a duplex but after further discussion with the zoning department that is an acceptable solution so he needs to show the two cars on site behind the front for the front setback of the structure not the porch but the structure itself and i think he does have some illustrations uh moving to the primary structure itself i believe that uh the agent has some sections that he could share with you what i'm looking for in the section is a section through the porch calling out the ceiling and the decking itself he did illustrate on the drawings that he has 24 inch overhangs that was a concern early on the paired windows should have a larger mole in the middle to indicate that there was a weight pocket there i don't know what the dimension i didn't see it called out on the plans but if he could go ahead and elaborate on that and then he talked about the columns with a porch section if he calls out what the columns are if they're round or they're square and the dimensions of those columns so we have a better understanding uh he did talk about wood siding he talked about the cladded windows which are appropriate for new construction uh and and one area that we're finding that is kind of lacking in the field is the installation of the siding to the corner boards and uh and the trim around the windows so the siding should be applied and then the trim should be applied over that so you have that shadow line that we're looking for this more period appropriate uh i believe he's hit on everything else uh i'm here to answer any questions thank you very much thank you we'll now open the uh hearing to public comment if anyone does have uh comments either for or against the project you may come forward at this time please remember to state your name and your address uh before speaking is there anyone here who would like to speak seeing none we'll move on to commissioners asking uh questions i'll start on my right mr cahill ms solaco i have a couple of questions the drawings that we received to review shows uh has some comment about gutters and downspouts yet none of the elevations show the locations of those or how they will look or connect has have those been updated on the drawings and staff has had a chance to see that not for the gutters and downspouts um we are going to connect the gutters and downspout we have to have round with the downspouts being round connecting to an ads pipe underground i would like to just be sure that uh that that the drawing of the detail of that is reviewed by staff before proceeding the drawings also make significant reference to thin installed and flange installed windows your verbal comment indicated these are aluminum clad wood wood aluminum clad windows and we would just need to be sure that any reference on the drawing to fin or flange is removed so the contractor is not confused absolutely um and to verify that with staff i also noted that the details of the trim at the windows and the doors are not included in the drawings there's no dimensional criteria in the drawings regarding any of the trim the elevations indicate that you're using wood siding however the section on sheet a1 has a note that says that it is hardy board can you verify which of those materials you will be using wood siding and then you need to remove all references to the hardy board on the drawings absolutely please the elevations and your comments here today indicated that there are single light windows however all of the window elevations on the drawings show divided light and those should be removed if they are in fact not being used i do have to make a comment that many of the details on the drawings appear to be irrelevant to the project at hand and i would suggest that before any of these drawings are submitted for permitting that all of the the irrelevant references from somebody's standard detail package get removed from that set of plans and reviewed by staff before it proceeds any further oh absolutely that's definitely where you're going to be and and quite frankly some the preparer of your drawings should probably have made those notations in the beginning before they even came this far that's it for your questions yes mr corley uh hey good morning uh i just have one quick question just um unfamiliar with uh the the weight pocket on paired windows i'm not sure if that's a question for staff or not i'm just unfamiliar with that term uh uh weight pocket so it's a detail that the train die kind of picks up if we could go to the zoom in there so as we look at the the paired windows traditionally these had weights in it so this window had two weights it had a weight here and it had a weight here and then this window had two weights a weight on the outside and a weight on the inside so the weight pocket in the middle had to be a little larger wider to accommodate the two weights that's a detail that we'd like to see replicated because his vision here is a period home so those details should transfer over as it moves forward so if he would provide us with that dimension usually the outside trim piece is five inches and in the middle is seven inches that's traditionally it changes a little bit you know a half inch or an inch either way but that's what we see in the field other than that it's you have a two a two inch sill you have the skirt board underneath and then you have your header if you look at the header and the sill it stick it sticks over the vertical elements just slightly an inch and that's a traditional detail that's replicated here hopefully that answers your question yeah great thank you appreciate it did you have a question for the applicant at all no so i'm i'm going to address um this first because we were talking about it can you please indicate if you have any details about the window especially the paired windows what the intent is for that middle pocket right so the middle pocket will be seven inches it's a seven inch trim and then either side of the pot windows will be five inch trim i don't have currently a detail but that will be i don't i do not have a detail for that specific trim package but i will definitely have it for staff to review once uh we get to permitting uh speaking of details do you have any details regarding just the siding and trim anywhere on the project um i do not have that at the moment what about detail drawings for the railings for the railings i do not have the details for railings i do have some elevations of the railings do you indicate the materials and the sizes of any of those i do not at the moment but there will be two by two picket fence 36 36 inch high with bottom and top rails are they wood there will be wood absolutely do we have a section through the front porch we have a typical section of the building but we don't have a section through the porch but we are having a big scene of you know beaded tonic roof ceiling uh painted the reason sliding on it let's let's look at that front elevation for the porch so um can you speak about what's happening right above the columns is that a beam that is getting wrapped and we'll see it from the other side in the porch area or is that a flush ceiling condition that goes to the underside of that and so you'll have a beam that goes down and the ceiling will be actually recessed inside okay and then the intent is for the for the trim we talked about it being all wood so that'll that'll wrap all the way around including into the interior of the of the porch that is correct uh let's talk about the columns the column material is also wood or another material uh it's a prefabricated um it's probably like a fiberglass fiberglass but it could also be wood but we think that wood you know in this weather it's not recommended and then um the foundation for that for the for the project if we could go to your typical yes it'll be stem wall concrete cmu with block um zoom out just a tad sure thank you so we'll have stem wall foundations we'll have a concrete on grade on slab and then can you zoom into the lower part of the wall section where it gets to grade right so we'll have a trim okay this will be uh the lattice on it you know kind of to replicate what's happening with the cross typical crawl space areas um that will be placed on on top of the cmu so that will be direct applied to the cmu will you be back painting um the face in what color white white is it your intent to place the trim over the lattice then yes and then the trim slides under the siding at the bottom that is correct can we go to the top of the wall do you have an opening shown on this wall no um so we're thinking the two foot overhand with the trim on the top and then the boards with you know siding is that really how you intend to finish the siding at the top that it stands above the siding not integrated it'll be integrated okay um i agree with my colleague that there is a level of detailing that is needed specifically for this project so absolutely that would be a definite requirement moving forward um in terms of the end of the rafter tails can you just scooch it over just so i can see your notes um when you come down to the end of the rafter tails they are just straight and then you've got a drip coming under but that will change because he's not showing the gutters correct correct so they're yeah again um the detailing is not specific to this project so we you know we are concerned about water weather tightness and and the quality of the construction right i mean that's one of the things we are required to look at we can't tell you how to detail it we can tell you that we have those concerns so that is something we'll want to talk about in our comment period um uh let's talk about the doors go to your front elevation if you would please so the the doors are intended i think you had a colored one can we look at that because that was a little bit more informative to me zoom out just a tad so the the intent for the door is that they're half lights and then they have a transom above them is that a working transom or is that fixed it's a fix okay and then uh the doors themselves what material are they wood wood okay are they stained or painted um painted okay and then we talked about the windows with my colleagues we'll go there um in terms of the the trim you had said that on the paired windows they'd have five inch side what's the the header trims and the sill trim so the sill is two inches and the top piece is five inches okay and then when we talk about the installation of the windows my colleague was you know it's very clear about removing language but what is the intent for the windows within the wall they should be recessed okay to create that shadow line okay that's the intent okay uh so we need this that sorry i'm just going down the checklist no it's okay did you indicate the color of the roofing shingles you said the asphalt but did you indicate the color of those it'll be a darker gray tone okay and then the the porch itself does that have any finish on it or is it just the concrete slab concrete slab and how is that going to be finished uh just the broom finish finish yeah actually it's going to be a slick finish but a little bit of uh broom finish okay all right um and then we talked about the fence um you said that there was an existing fence there is there any new portions going in or a new gate um other than what may need to be repaired if it gets damaged yeah there will be a new gate where look at your site plan yeah let's go back to the site plan um there will be a new gate where the driveway is the site plan doesn't it doesn't show the gates but it will be a gate here by the entry of the driveway and no gate at the sidewalk going into the doors yes the main gate and then there's nothing in the back at the rear of no and is that alley active i think it is correct there are a few of the neighbors that are using it that are using the alley but um it doesn't cut through it's it's um it's a little tough to cut through because of the oh okay so it's not being used for servicing at all so there's no waste collection or anything like that in the rear okay um so the intent currently is no no gate at the rear right okay and then um i see that you have the ac platforms indicated at the rear of the property so they're properly screened can we scooch down and look at the driveway um how long is that driveway from the front of the it's the front of the building to the back of the drive 46 feet no that's from the property line yeah from the property line so from from the porch yeah to the back is 36 feet um because we got a 10 foot setback 38 so i'm not quite sure but is that long enough to to pull in two cars and have them tucked behind the facade so that they're properly behind those yeah 18 feet by you know 18 typical parking spot is nine by 18 so we got 36 feet area yeah um was this reviewed i'm sorry staff question for staff was this reviewed with transportation it was and there's usually three parts to a driveway there's the apron then there's the the middle part that connects the parking pad the parking pad has to be solid and it has to be 36 feet long if it's tandem so that does meet we were working with those numbers with transportation just to elaborate on the alley the alley is open but unimproved uh when the interstate came through it kind of violated everything initially we looked at using the alley to come into the site to to respect the grid and there's a lot of challenges and there's a tree back there as well i don't know if the trees indicated but you really have to come off 12 avenue okay thank you yes um can you scooch the site plan just up a tad i want to see it to the curb go to the side so i see the front there um so you mentioned the scoring and um for the most part it looks like it it's it's what we would expect i am a little concerned about how the drive from the curb ties in and goes into the the drive within the property line so i would recommend reviewing and reconsidering some of the scoring at the sidewalk um in front of the property line as well and and just look at what's in the neighborhood historically the scoring is appropriate appropriate with it seems within the property lines but you would also have that scoring outboard on a public walkway typically in a historic neighborhood so reconsidering that um then what's happening on the left side of the property is that some sort of storm water management yes okay and that's on both sides on both sides correct okay um did we review hardware no do you have any hardware at this time in mind i don't that looks like the laundry list has been taken care of um any other questions for the applicant at this time no you have five minutes for rebuttal anything that you would like to add or feel like you need to address any of the comments all right thank you sir that we will close the public hearing or public portion of the hearing and commissioners will discuss the case i i would just like to reiterate how much more difficult it makes reviewing a set of drawings when so many irrelevant details are included which only creates questions and raises questions in our mind as to what is actually going to go to the permit department and i you need to please communicate that to the person who prepared your drawings so that in the future should they ever be providing drawings to us again or to anyone that they not burden the reviewer with elements that are totally irrelevant i understand um any other questions yes other than what's been discussed uh no no comments for me thank you okay um do we feel comfortable this time to make a motion and if so someone needs to step up all right i will give this a whirl uh move to grant a certificate of appropriateness for the drawings for the modified drawings and documents that will be prepared uh as discussed and presented at this public hearing in blc 26 000 000 71 for the property located at 10 22 east 12th avenue because based on the findings of fact the proposed project once conditions have been met is consistent with the ybor city design guidelines of the city of tampa oh i started it wrong incorrect you can add the conditions now before before you put the reasons for um with the following conditions for the fall with the following conditions man that the uh gutters and downspouts are added with the following conditions that all of the conditions are uh eventually approved by staff that the gutters and downspouts are added that the wood clad is designated as the siding and not hardy board that all of the irrelevant uh window charts and window details are removed from the drawings that the details the window detail on sheet ad-2 shows a stucco finish in lieu of the wood so that will need to be modified um the uh trim detail at all of the doors and the windows will be included in the drawings that the finish on the exterior cladding will be indicated as smooth the railing details for a wood railing on the on the property will be identified on the elevations and details provided that there will be a porch section through the completion of the porch showing all of the materials uh including the columns the floors the ceilings the light fixture locations and the hardware and i believe that is it if i may um window needs a seven inch weight pocket the the dual hung windows will need a seven inch we stated that in the in the hearing response to questions but the drawing should be okay and in detail where the sighting meets the top and you're delegating site plan to staff i second before moving on to a vote do you understand all the conditions placed on the approval here today yes okay all in favor comp plan amendment recommendation from cmu 35 to umu 60 the address associated with this parcel is 1605 waters court and i want to remind you i'm going to repeat this a couple times this morning but your powers and duties this morning for a recommendation to city council falls under chapter 2795 with regards to the application for rezoning land use change classifications or comprehensive plan amendment to review and recommend reasonable land use changes to the extent necessary to preserve the historic integrity and appearance i'm going to share some photos with you please follow along this area here is a challenging site you're going to see that the historic grid has been modified over time and here is the 1929 sanborn i tried to illustrate with with a highlighter you know the area in question so you have a little bit on seventh avenue on the north as it comes down you have henderson which i'll show you in a current map it does not go all the way to nebraska this is nebraska so you have the face of nebraska still in place then you go up estelle and then it terminates into scott so it's this irregular shaped you know geometric shape that's there um and this is the sanborn map once again i like to show the density the fabric what was there and through time how it's eroded so this is our vicinity map seventh avenue you have henderson then it comes down in between two properties you have estelle on the south side and then scott on the east the current current the most current aerial a lot of this has been removed now this uh housing stock so these are still here once again seventh henderson estelle and scott i tried to simplify this we're going to start here on seventh avenue and the corner is seventh there is a structure that did not want to get included in this uh it functions it's a place that uh people go to eat my son loves this place so he tells me i meet him there but uh it's going to stay this is looking from seventh avenue uh some of the structures that have already been approved for demolition but are still there this is looking down seventh avenue towards nebraska on the north side of seventh avenue you have the soccer fields this is a little better shot of that cave force is there and then you have the central studiano in the background we're on the corner of henderson and seventh avenue we're looking down henderson towards nebraska there's a little shopping complex here that was always underperforming that now it's got some interest to it which is here looking down nebraska that's behind this photo this is nebraska looking to the north this is kind of outside the subject site but i still think it's it's relevant uh the perspective of what's the request is will be witnessed from nebraska and this is nebraska looking to the south you see some new construction over here there is a restaurant that faces nebraska and on the corner of nebraska and henderson you have this now we're on estelle and scott as i stated some of this has been removed and there's new construction over there this has been removed reviewed and approved by this board just kind of showing the massing the density how the building walks a little bit in and out the termination points how it has the that capital on the top we'll get into that through the certificate of appropriateness if it goes in that direction but just wanted to show the uh the scale and the massing on the back side here down estelle you have a school that i want to share what's important here as this project develops they know that they're interacting with the school they had to be sensitive to the drop-off area and how the vehicular access was coming into this building this will be part of their discussion so the project has a couple of fronts this has a back that they tried to deal with uh we've met probably no less than seven or eight times to continue to develop this project at this time i'm going to hand it over we're going to talk about the comp plan amendment but i believe that the pd is is the following case and some of the illustrations will bleed into each other but at the end of the day this this request we need to work on first provide a motion and then we'll go into the pd after thanks ron uh true at gardner gardner brew hudson 400 north ashley drive first of all i wanted to thank staff as as ron mentioned we've been wearing him out with meetings and have made changes along the way that we're excited to present to you um and then wanted to thank you for your time and consideration and we're excited about to present this project to you and to hopefully be a part of the rebirth of ybor city that's been the goal throughout to do a project that you could be most proud of and that we can all be most proud of because we all love the district and are excited about its possibilities we've got a great team many of whom are here today presenting with me are ricky de camps who is with the development team and megan smith also with gbh as well as the architect christian aquato and we are happy to answer any questions feel free to interrupt us if you need any clarity at all we're we're happy to to try to provide that clarity um the property in question is owned by miss k andrews it was the site of the tampa park apartments um there are no historic structures on the site at all it sits on the edge of the historic district you'll see maps that uh that megan's going to present and um as as ron showed the historic grid was broken down when the tampa park apartments were constructed were leaving that same general geometry um in order to keep things like the we have heard a lot of affinity towards the taco shop um so to keep things like that in place but wanted to honor the district through the architecture and the design and the scale and massing of what we're proposing and um throughout this project from the beginning we've vetted it with many stakeholders in ebor uh many council members we just we view this as important and didn't want there to be a misstep so have communicated from the beginning and really have received nothing but positive support which i think you'll see uh here today and with respect i know that we're doing kind of this in two parts but sticking to the comp plan amendment we did have a hearing prior to this hearing in front of the planning uh the planning commission and they recommended unanimously for our comp plan change so we'll present that um we do want to present a little bit of the vision just so you can see it on the rezoning and then we'll get into the nuts and bolts of the rezoning with that element of the request so with that we respect the blc we respect your charge and it's our hope that what we're going to present to you is something that you can fully support and with that i'll turn things over to megan smith and then uh ricky de camp so thank you and again here for any questions good morning megan smith with gardner burr hudson so there we go okay so as truitt mentioned kind of just wanted to highlight in where the site is located within that ebor historic district and you'll see the yellow highlighted that's nebraska avenue that is that cvd periphery line just to give you some context of where we're at in the the general scheme of the city of tampa this site we really feel is a um you know gateway it serves as an important pivotal role from the seminal heights district downtown tampa channel district all fitting into eboard that we know and love and so we feel like this request is a consistent request with the comprehensive plan because it helps transition it from those higher intensified uses into eboard district excuse me zooming in the site is located at 1605 north waters it is in the central tampa planning district the ybor local historic district the central park urban village and again it's less than 250 feet from the central business district highlighted in yellow so any property across that yellow line can actually double their far up to a 7.0 which we feel is an important item to note this map on the left shows the subject property as it exists today cmu 35 the map on the right demonstrates the umu 60 that we are requesting before you guys today the green dash line is the eboard historic district line in that area and just wanted to make note that there is umu 60 currently in the district so we wouldn't be introducing a new use and really just continuing it and adding that important transition piece from downtown into eboard this is just a quick hit taking a zoom out showing that intensified use to the east west and south subject site of our from our subject sites what this change means we feel like that's an important item to highlight the planning commission and future lien designation there isn't a category between cmu 35 and umu 60 so we get kind of stuck in a little middle spot there it does allow us to go up to a 3.25 far but as you'll see in our next application we are only proposing a 2.9 far so actually leaving about 50 000 square feet out of the proposal it's just there's not that middle category to catch us so that's why we are here requesting the umu 60 which again we do feel is appropriate transportation wise you know showing that connectivity we've got heart route 9 to the west which is a transit emphasis corridor we also have the tico street line car right to the east and so the site is a an apt spot for a residential to come into play an intensified residential with public access to transportation anywhere within the city of tampa that they're looking for quickly i just want to cover there are some comprehensive plan policies that are supporting this development strategically located in a mixed use area higher density development that's compatible with the surrounding character which you'll see later we are proposing and it's a compact city form strategy and so with that when we presented to the planning commission on may 11th they did unanimously support our request to change over to the umu 60. wanted to just kind of give the the safeguard piece of it as you guys know this is one step to this process we're going to come back before you for the pd recommendation and then again as these design details really start ironing out for the certificate of approval so this is just that first step into the process and getting us moving and with that i'm going to turn over to ricky de camps the development team so that he can just talk about why the site was a one that they chose thank you good morning uh ricardo de camps i'm i'm working with the landowner tampa park apartments to on this project i am the developer um to kind of speak to kind of why we've wanted to be here and why our desire is and what we're asking for today we have always loved what ybor represents um ybor represents the people who came to tampa who wanted to create new lives i have family members who have historic ties to this district um specifically to the arturo fuente family and so when this opportunity came to us uh miss andrews uh with her representatives showed us the site we fell in love with it um knowing very well that there is aspects of it that we need to navigate to get to the desired density that we need and so the fabric of what we've done everything we've proposed the team that we've proposed and brought into it is with from day one with the intention of keeping everything we can to provide a project that is that works for this district to continue what's going on and as the growth is going on in this area um we have met many times that taco shop that is owned by frank capote of the capote family we have their support uh they will probably in the next time we come back uh for certificate of appropriation for sure for city council we'll have a letter from them we've met with all the different stakeholders daryl shaw and just kind of told them our vision we wanted to save the retail we believe the retail that's there it has the opportunity to thrive with additional density and so when we started going through this we everything that we looked at as we started working through this is how can we respect the historical integrity but also provide the density needed to support those local businesses that we see happening and continue the positive growth and change that's going on in the area so with that i'll step back i'll i'm sure we'll have some conversations at the next part of the hearing on the pd to tell you what we've done just as we've worked with the community stakeholders but i'm here to answer any questions you may have and look forward to working with you on this true gardner again uh 400 north ashley uh thank you ricky ricky's a very modest guy just so you know the quality of what we're dealing with here ricky was a part of the midtown development um in west shore and then numerous buildings also in west shore when he was with crescent and i've worked with ricky over the years absolutely love working with him he's always striving to do the right thing but you could just see an enhanced level of passion uh with what they want to bring to to ebor and um that will hopefully all come out uh in the rezoning and hopefully it's it's come out in our presentation now so happy to answer any questions on the comp plan and then obviously we'll have the separate presentation on the rezoning which will be a little more detailed focused good morning ron vila staff of historic preservation so if you want to follow along i'm going to start my staff report on page four just to reiterate your duties and powers is with regards to the application for rezoning land use change classifications or comprehensive plan amendment is to review and recommend reasonable land use changes to the extent necessary to preserve the historic integrity and appearance also with us this morning we have members of the planning commission that you could direct some questions to them just to start you know i think we're the front line of the caretakers for the district staff and then you guys as well and we take this very seriously as as it comes forward as we stated this morning we've met many times to continue to massage this request to get it in line with their vision and our criteria on on page four we have some tampa comprehensive tampa comprehensive plan objective and goals is to recognize the historic research resources that are there and to you know cherish them moving forward to preserve and protect is the words that they use here under the last bullet item it says to protect it to protect the integrity of the historic district we're requiring that the number of stories and new development and building placements of primary and accessory buddies within the district complement the historic fabric so we continued they have some illustrations that we worked through and i think they're going to share with you you could they could share it through the the comp plan amendment or or later on but the project started much bigger than it is today so through good development and and uh discussion uh it's at a at a better place today on page four of the staff report as well you know this area is posed as a significant changes can be uh requested for development in this area it's underdeveloped and it's right to move forward from the cmu 35 to the umu 60 we talked many times you know umu 60 gives a lot of opportunity for for scale massing and density which sometimes is not consistent with the district so there's a tipping point there i think the the magical discussion moving forward is that when they're moving forward and i want to share this chart with you and the planning commission could probably elaborate a little bit better than i can but in general terms this is what they have now and this is what they're requesting so from the cmu 35 to the umu 60 you see some intensity that could come here and density in here as well and then it goes from a medium intensity to a high intensity so i think we have to look at that and evaluate what the request is they had stated and i'd like for them to show in more detail that although they have some entitlements under the umu 60 they're not going all the way to the max and i think that's important to see staff finds that this application is inconsistent with the chapter 2795 that i read to you a couple times if they go to the max if they dial it back i think there's opportunity there as it was stated they were looking for some middle ground but there is no middle category there so i think that that needs to be elaborated on as they move forward they share they share this map with you and i want to share with you as well this is ybor city and i changed the colors because the map that is that comes from the planning commission is very hard to distinguish what's what so i try to make it more user friendly here the hats in line is the boundaries for the local historic district of ybor city we're talking over here so all of this here is cmu 35 they want to install a umu 60 that's here and here i was not aware that the umu 60 was here and here when we first started this request usually and it's been in front of you guys that is held to the southern edge of the district along atomo and you see how it's speckled in between here so there is some fabric that's the umu 60. if carefully done you know it's up to you to see if it could go in the section that they're requesting this morning let me look through my staff report i want to make sure that i completed this i think through through your motion and and please get together as a unit and have a strong motion coming forward this is a recommendation to city council um choose your words carefully and and put it in some kind of bullet item that that city council could review and and you know uh kind of decipher in some kind of logical fashion moving forward i think that's that's it for me i'm here to answer any questions if required and i bank commission okay and then we have the the planning commission quinn steel planning commission staff um planning commission unanimously recommended approval at our um hearing this will move forward to city council next month and i'm available for any questions thank you move on to public comment is there anyone in the audience who your name your address and then you have three minutes for comments thank you uh my name is paul vengas um i am business owner at 934 east henderson retro house um you saw it up on the overhead just a few minutes ago um i just briefly wanted to i won't take up too much time um i'm here on behalf of the other three business partners of the business um it's a two husband and wife couples um i just wanted to speak um really quickly on how excited we are for the project um we are also uh very much in love with ybor um the facade of ybor the culture of ybor um as uh relatively new business owners in the to the area we i also have another coffee shop up in temple terrace um i roast coffee um uh it's uh it's a passion of mine um coffee in general is a huge part i think of ybor culture along with the cigars so what we're trying to bring to that little section there um is just some you know something that is unique obviously you mentioned earlier but also something that the people that are moving into that area with um the other developments and now this one uh they're really going to appreciate in a way that says you know this is ybor um i do little coffee roasting uh seminars once a month i've actually got a little coffee roaster right on site um where the the it's just a very small one but the exhaust for the roaster is actually facing the development that you guys are talking about today so um and if i if i'm correct i believe the proposed entrance is actually right there so the people coming and going from that development will smell freshly roasted coffee um every every morning um i think that's really cool and i just am really excited about this um one of the only concerns that we have in that area i think pertaining to you know you guys today in the committee is is just maintaining the image i think of ybor um as a as a you know just a prestige cultural area um uh to make sure that the new people coming in the new faces that we're seeing are really aware of that and they feel safe um uh you know there's there's a lot going on right now in tampa um and we've had some issues with with transients in that particular intersection so um i'm really excited just to see this come in um to send a message to the community that we want this to be a safe community um you know drug free um crime free uh and i think that uh based on what i've seen so far um from the proposals it looks like that's that's really really going to work and i'm excited to be um you know the the literally the face business facing the this uh this development that we're talking about today so thank you guys thank you sir any others that would like to come forward at this time seeing none we will move on to commissioners asking questions and i'll start on my left this time um who would like to come forward we'll wait for the question i guess and see who needs to respond i don't have any you don't have any questions at this time i i i would like to ask the um someone from the planning commission if they could shed some light on the logic and the reasoning behind your decision sure so this site is located near a lot of infrastructure a lot of transportation resources so we thought that higher density and mixed use development would be appropriate for this area also the compact city form and our housing policies to ensure an adequate supply of housing so in approving you're approving their request does that make their property on par with the gasworks designation sure i can actually show you a map this site here and portions of gas work here which is this is umu 60 so they're going to request the same as here and it also goes down here which is rmu 100 which is a higher intensity than the umu 60. okay that's the one that's adopted we received in our package two two diverse two two maps correct one that says it's adopted and one that says it's proposed correct so the difference between the two is what this is the existing i understand the definitions of the of the terms but is the adopted the one that you just approved we don't approve anything we're just a recommending body so this is what is current today this is adopted this is what they are proposing and then if city council chooses to approve it this would be the then adopted feature lanes got it got it okay so just to confirm the language proposed means it's what the agent applicant is proposing it is not what a governing body of the city is proposing it's not a proposed amendment to the comprehensive plan correct any other questions no that was it no thank you um i have a question for for anyone who wants to answer this maybe staff um when we look at the the uh allowances under the the different proposed future whatever use land use going from 35 to 60 um is there anything within the code that or the the zoning that speaks to the height or is it just a density um discussion within the ordinance i can't speak to the code i don't know if maybe lauren the city staff and right now we're considering the comp just the column correct understood but so we have the little matrix right that staff went through it says it talks about the far it talks about the intensity slash density and it also notes that um residential projects are determined by either density or floor area but i'm wondering if there's another piece to that if if this is mixed use urban mixed use 60 or community mixed use 35 typically mixed use means there's other than residential and so this only highlights residential components if there are any commercial retail components what is the discussion piece around that right and if there's anything that includes discussion around the actual height allowed under those two designations yeah so lauren vasquez city planning department the specific height setback and things of that nature are regulated by the zoning district so at the time i i believe the applicant indicated that they were going to pursue a planned development district so that would be discussed at that time as well as the specific uses that are allowed so um okay this is a mixed use category so both commercial and residential are allowed that would then be regulated the overall intensity of that is regulated by the floor area ratio the far but the specific uses and what is allowed is determined at the time of the rezoning okay thank you so much so for staff the applicant stated that they are seeking a 2.9 far rather than the the allowed 3.25 far under the urban mixed use 60. um is that something that we would state in conditions if we were to approve this or no no ma'am dana crosby legal department this is a comp plan amendment um the zoning is completely separate the dense everything associated that would come under the pd when you approve this comp plan amendment yes ma'am the the maximum non-residential development potential is 3.25 far it does not get reduced by any action of any board that is the that is what can be built on this site what whoever rezones it in the future that is their maximum development potential okay thank you um that's it for my questions thank you so much all right any other questions for anyone at this time nope you have five minutes for rebuttal if you would like to add anything to this sure gardner 400 north ashley drive again here to answer any questions and appreciate those so far um and i certainly understand ron and and the board's uh need and desire to be the gatekeeper we want to present something where you're not just giving us a blank check uh we were just actually looking at the language when you compare cmu 35 um to the umu 60. it's similar it really jumps up when you go to that rmu 100 it's more of a high-rise category these are both still mid-rise unfortunately the density that's allowed under the existing cmu 35 just isn't enough to make this a financeable project and so we need that additional density the reason why we're here sometimes you see it in different ways where the complement amendment will lead and then the rezoning will trail separately and i i know that the cmu 35 if that's approved we get what we get but really that bundle of entitlements isn't released until that rezoning so we're putting those together to you today so you're not just cutting that blank check that you get have the safeguards right behind it so i know there's a little bit of leap of faith because you've got to take this vote before you hear the rezoning request but that's why we're bringing those two together and so we can hopefully provide those safeguards um just a couple more things and i think we've touched on most uh with respect to gas works our umu 60 is consistent with the least intense portions of gas works as you go south they get to that rmu 100 that far more intense far more high district um we think this request is appropriate given all that's happening here and in particularly given the unique location of this property and that it's sitting on the edge of the district it's 250 feet from the cbd periphery and it has no historic fabric as far as any buildings at all uh i don't think we'd be in front of you with this request if we weren't checking those boxes and again the pd will come next it will hopefully provide those safeguards and i'll just close with we thank this group the planning commission for their unanimous support and i hope for the same for you and look forward to presenting the the pd next thank you mr gardner thank you we'll close the public portion of the hearing now and commissioners will discuss the case concerns something we should discuss well i think my only comment to you as my colleagues here is that when you look at the land use the proposed future land use map and you see the designations of the surrounding properties it is actually stepping down as it goes northward into the more residential districts so it allows this and goodness knows that nebraska avenue needs all the help it can get um that i i i believe that this will allow this developer to do a very positive thing for the area and hopefully encourage others to fall in line behind them my concern is the leapfrogging it's the what it's the leapfrogging placing placing it squarely and i understand what what gasworks was able to get when they came forward and started their project but that was a different makeup of this board um for me the fact that it is squarely in the middle of the 35 and it does have that potential to attract more of that rmu 60 and you know just bleeding in and taking away that lower that lower density which i think is important for the live work that we continually talk about in the city whether or not we're talking about historic districts um i understand that there are there are potentials for other modalities of transportation for the city in the future i just am worried about the historic precedent and and the fact that there is the rmu 60 in the northern portion of the historic center of ybor city is a surprise to me as well i have to i have to believe that there is goodness in the souls and the hearts those who are who are coming forward and seeking the rights to develop this to a more appropriate density to to see an roi that's positive i understand the financial harmony that comes with development especially larger parcels um so i just wanted to make that comment anything else anyone wish to make a motion at this time and in doing so again very clear about the intent and what we're what our you know our recommendation is to the city to city council okay do you want to take a stab all right i will take a stab then uh i move to recommend to city council the approval of blc 26-0000113 forward slash tacpa 26-01 for the property located at 1605 waters court ybor city for the proposed land use change from cmu 35 to umu 60 any conditions for the reasons that it will present to the historic district a an ability to upgrade the western edge of the of the district it is a property that does not presently hold any historic properties and it is a designation that is similar to reasonably adjacent properties second second that motion um since there were no conditions we won't ask if there's any questions or concerns we'll move to a vote those in favor say aye aye aye those opposed nay nay motion carries three to one thank you we'll move on to the next good morning commissioners ron and vila staff with historic preservation our next agenda item is blc-26-00114 slash rez-26-000060 this is for the address of 1605 waters court the request is for a recommendation to rezone the property from yc2 to yc9 yc9 is a pd within the historic district of ybor city it's site plan controlled you're going to look at the scale the massing the setbacks and the footprint of the request coming forward they are going to share some renderings with you at this stage renderings are not required you're going to see a little more design development than that's required just focus on we're here for the yc9 in front of you yc2 to yc9 and if you have any questions we can make that clear i think that now you're going to get a little more clearer look into the future you looked at the comp plan amendment you're going to see a rezoning and if all moves forward this will come in front of you again for a certificate of appropriateness at this time i'll turn it over to the agents good morning again truett gardner 400 north ashley drive thanks for your trust on the comp plan amendment this is now the the fun stuff so we'll get the boring lawyer out of the way and let the uh the development team and the architects speak to it uh but again we'll be happy to answer any question as ron mentioned um your vote here will proceed to council and then obviously we have to come back to you for the certificate of appropriateness which will really delve into the details but this has been a project that there's been so much excitement and and such a desire to get it right that we've advanced it probably further than you're seeing most at this level uh and i'm happy to share those because we really uh want in uh and respect your feedback so with that i'll turn things over to megan uh the same batting order but we're also going to add the uh the architect as well good morning megan smith 400 north ashley drive with gardner burr hudson sorry one okay back again so again we're talking about 1605 waters court the site is 3.33 acres in size and we have frontage along east 7th avenue eastern east henderson avenue scott street and east estelle located located across from washington elementary and it's in close proximity to the public library robert w saunders senior public library in the park that's right there as well um to our east is law union and the stevedore as um previously mentioned the the google aerial shots have not been updated yet so those are have been changed over what we are proposing is a 325 unit multi-family residential structure the far proposed is 2.90 so that's approximately 420 000 square feet it's going to have a structured parking garage wrapped by residential units with ground floor walk-up terraces or terracitas and a tiered building design with 18 foot step backs at the 45 feet height set just for reference here's our pd site plan you'll see ingress and egress along east henderson avenue that's going to be for the structured parking access and then loading in solid waste is going to happen off of estelle there's a courtyard in that middle area of the building so it's wrapping around that pool courtyard area and then there's also a green space behind the taco restaurant as well with some nice seating and fire fitting areas as a part of our request we do have two waivers they are both loading related one is for maneuvering in the right of way and one is to reduce down to the two 12 by 30 loading spaces and feel that that is adequate and will meet the needs of the neighborhood and keep the trucks off of the streets we've had multiple design meetings with historic preservation staff appreciate all of their time development coordination staff city council really have made an effort to have meetings with the neighborhood stakeholders surrounding property owners and from that we've made several revision changes from the original design to address the unit count garage height upper floor setbacks street activation materials landscaping and garage screening just to name a couple there and with that i'm going to hand it over to ricky de camps so that he can really kind of go into detail of those neighborhood meetings and the changes that have generated from those conversations thank you uh rikadale camps ricky de camps uh i'm uh i'm the developer for the project working closely with tampa park apartments on this rezone so we held a good number of neighborhood meetings of meeting with um uh our direct neighbors with the developer of of gas works um meeting with our own tampa park apartments who uh they are obviously um very closely tied to this neighborhood on a bunch of businesses in this area and so we originally started with you know uh a number that after feedback from neighborhood groups that might be not proportionate with uh what the what we could do so we reduced the unit count from 344 units to 325. um in addition we met with ron uh on the next slide uh i guess that would be me uh we met with ron a few times uh probably five or six times where he expressed um just the just the concerns of and specifically as his job is as the gatekeeper of the district the protector of the district how can we work together to figure out a way to get a more appropriate or just a project that feels more in line with what was happening um so we originally um because of that height we had a seven-story garage very similar to what you would have seen in in outside of the district for a five-story wrap project and we actually reduced that down to six stories um and covered it uh actually lined it with units so that it's not you're not seeing along henderson along seventh street just a structured parking garage you're seeing more home you're seeing homes you're seeing balconies you're seeing the building uh we added um the fifth floor was a big uh condition or a big concern uh naturally so specifically on seventh and henderson so we worked together with our architect to see hey what can we do what can we change to make that feel to the person to the pedestrian walking that it's not just this massive massive you know a building on top of it so we actually took the fifth floor and set it back uh by 15 feet uh for a total of 18 feet from the proper line setback um so we kind of have that setback that fifth floor uh obviously it changed the the kind of geometry of the building but we did that along east henderson 7th avenue and east scott street in addition this is probably one of my favorite things i mentioned that i have um uh one of the reasons we love this district uh is uh as a proud hispanic this is the only historical uh hispanic district in all of the united states okay it's uh my family is from the dominican republic i have an emotional tie here my parent my mom grew up in tampa uh they were came here as part of the cigar industry and so one of the things you'll see in latin america or you see in areas that have popular hispanic cultures is what we call terracitas terracitas are areas where you can get together it's a front porch if you will not something that you see a lot in our residential buildings um and this is actually something that we went with with city council uh when we were before we even submitted anything we actually spoke to them and was actually something that we think could could enhance the walkability of this neighborhood i mentioned in our previous item that we want to encourage walkability to the neighboring supporting stores and so having these front porch stoops these these areas for people to do not something you see usually in multi-family apartment housing but we did it here and we believe it's very important to to the the scale of our project and what we want to do here um in addition to that we told ron that we wanted to do everything in our power to strengthen that four-story building facade we did that using brick and masonry um we believe it is important to show and mute back that fifth story set that back mute it as much as much as possible but still uh represent what uh historic ybor may have been especially in this as we extend this this part of the district that's extended into this part towards nebraska signage is really important and i want to show you here this is again very preliminary signage we believe in this we've been studying 7th street uh as much as we can and we love the signage and want to be consistent with what ebor signage provides it's very important it's very important to the businesses that are there on 7th street uh but it's also going to be important to us and so one what you see here we added blade signs along 7th avenue uh what you won't see on this rendering again it's just too early but something that we are committing to is studying how the painted brick signage that you saw that you it's very consistent in ebor any murals that are painted or anything like that uh get really incorporated into our building to just promote that this is an extension of 7th street even along uh on this part of the facade um um another thing and our christian uh our with our architectural group can can talk about this really focus on improve the articulation uh of the building as much as possible this is the shot facing henderson street uh what's you know you'll see it on scott and estelle as well but how can we improve that and that's through changes in material and color um we talked about this a little while ago added aligner units along east henderson uh for the walkability uh for that face feel so you don't see a garage and created a median for the garage entry this is a rendering of what you see on the full on the ground floor on henderson street you'll notice that we are continuing and again this will come back to you for a certificate of appropriateness but the idea of extending even the brick uh paver the paver pattern of 7th street even though we're not in the central business district of ybor city as i would call it we're just a continuation of it and continue that through 7th street and even into henderson also while historically ybor city has not had a lot of shade trees you know they really focused on the buildings itself we believe there's an opportunity to we have to encourage walkability uh we want to encourage pedestrian connectivity so we did have an enhanced streetscape along henderson and 7th avenue so uh i'm going to pass it on to christian uh okato with uh cba who's our architect for the inspiration on on what we're doing here at ybor good morning uh christian aquendo with cba architects uh 1770 fennel street mainland um i think ricky ricardo stole my thunder and explaining the architecture he kind of did a really good job so i'll kind of repeat a little bit of the elements that he has put forth and maybe kind of point out what we were trying to do um kind of like stepping back at the beginning of the conversations and i think you know ron was made a really good job because you know at the beginning we were looking at what was happening outside of ybor and what we ended up you know kind of like pivoting to was what's happening inside of evil right what are the elements that eboard 7th street and it really categorizes the historic district so in here um kind of rehashing a little bit you can see the terracitas you can see the the hex pavers that you know we will we will commit to it in in subsequent steps you can see the the balconies and the exterior balconies protruding right from the from the building the big storm building the gas bar uh grotto as well the high hotel i'm gonna go to the next one uh centro espanol and hotel haya yeah there's we could not fabricate you know create a picture that will actually show what we're trying to do in terms of massing in style but if you can see our clubhouse in henderson in the top left that one it's a little bit more closer to centro espanol right but then if we go back real quick where the terracitas are that one is a little bit more to hotel haya and what we're really trying to do here is break out the massing of the building not only by balconies and steps on the building but really articulation right we we will not see a building that is 300 feet with a single style this building although respecting the front you know the urban front we will actually be breaking the style as it moves horizontally as well utilizing you know what's really happening inside the historic district again center espanol and hotel are probably the one the two elements that we are using the most um and here we can see the picture on the bottom right as you you can see the the red brick and essentially the white brick happening next to each other and we are emulating to to a different scale we're emulating what's already happening in igor which is this urban fabric being created across the years right um the other concern that ricky alluded to was the top floor so we introduced the step back of the building on seventh and henderson that one differentiated with color with a darker tone color so it kind of disappears with the step back but really just emphasizing the fourth floor which is the massing on seventh and and and henderson and in terms of uh criteria compliance and you know we went through back and forth multiple things this building will have all of the elements that we definitely need to hit in the fourth story street wall is probably was the probably most uh uh uh discussed right during our conversation the facade divided into distinct bays balconies no balconies living rooms etc the window groupings and and the balconies as i said and then the corners which essentially is where the main entrance is the seventh you know all these elements are carried through throughout the building with the help of of staff and to hone in a little bit more into the massing we we have the setback and the step back of the building on the top floor in order to really enhance the visual of the four-story mass right that is happening specifically on henderson and and seventh half orientation and site coverage so the building um it's really fronting almost every site this is kind of unique because we have one two three four you know streets you know surrounding this building so it was it was definitely a good challenge to to resolve in order how to do that but you know going back to the renderings real quick the whole point of it was activating the street bringing the terrace does and then connection to really to really the street and activating the street frontage um and then courtyard amenities will be happening you know within the building which is kind of responds a little bit to that patio espanol or spanish you know internal courtyard and patio that you know is very historic in nature um the service and vehicular function are consolidated as in a single spot um i believe with through discussions with staff the main entrance is in henderson consolidated in there because it did not really want to near the school but then the services are happening you know on the on a stelle and i think that's it for me megan smith with gardner hudson again so again wanted to just highlight once more of where we're at in this process this is the recommendation for city council for the rezoning application while we did give you guys a lot of detail i feel this design's progressed a lot as we've had these conversations but we will come back again with even more detail for the certificate of appropriateness as this um if it proceeds forward and we do feel like at this point we are making every effort really to preserve that historical character that we all know and love of ybor um so kind of a here we're at for blc and then from here we would go to city council with those recommendations from you guys today and with that i will give it over to truett gardner for a close i just wanted to thank you again we're here for any questions while i'm a lawyer i think i'm a frustrated architect at heart and i know i'm biased here but i think they did a great job of the brick facing seventh and honoring that and then where that grid was broken on henderson of taking a little more liberty to do that landscape streetscape uh along with those terracitas i can't say it nearly as beautifully as as ricky um but did a great job of of taking some liberty there where it's where it's not in that historic grid but doing something that hopefully honors the district uh so with that happy to answer any questions and um and thank you again for your for your time and consideration thank you mr gardner good morning commissioners ron villam staff with historic preservation focusing on the staff report just to reiterate uh your powers and duties under chapter 2795 it's the same language with regards to the application for the rezoning lane use changes or comprehensive plan amendment to review and recommend reasonable lane use changes to the extent necessary to preserve the historic integrity and appearance i have some conditions listed here on page four i'd like to go through those now uh they gave you a more elaborate presentation that that's required as i stated i like to keep focused they they showed you a lot of you know window placement and and pavers they showed you porches things of that nature but this part of the process moving forward you're going to deal with the height and width the massing and building form setbacks orientation and site coverage rhythm alignment and spacing so i went to the ybor city design guidelines pulled some information out there to share with you this morning so dealing with the height and the width which is the first one the proportion and the size of the new buildings compared to other buildings in the district and you should use those as historic reference which they did today i think there's a hard stance on this moving forward as you look at this you're you're really looking at the massing the bulk the height the the setbacks the height shall be held to a datum line of 45 foot that is consistent along 7th avenue yc1 although this is a yc2 which is associated with residential this little pocket has no longer been residential for a long time it's changed over so hold that datum line of 45 and if they're going to add an additional story that that that additional story be set back 20 foot from all facades and that's a hard stance that staff has taken on that continuing on the massing and building forms that the relationship of the building massing and building forms to others within the district i think there's examples out there that you could use either historic or new construction and they provided some this morning another hard stance is that when you have a long run either horizontal horizontal or vertical that it must be broken up into different segments to relate back to the historic fabric while dealing with contemporary challenges that we have today they illustrated the setbacks they showed the introduction of the porches at the ground level to activate all that will come in later on but you can see the scale and massing how the buildings are broken up the percentage of blocks that have the coverage it's reiterating that those longer facades shall be broken up it's it's a hard stance that we're taking to it talks about when you have the residential core where the rhythm alignment and spacing to introduce porches bays balconies and other facade elements that are existing and in the core and within the district as well there's a last caveat that we put on most of our pds or yc9s moving forward is on page five it's the last condition that if this is proposed to as a favorable recommendation moving forward that this should travel with your approval if if city council determines that the rezoning request from yc2 to yc9 should be approved a note should be added to the request that would allow that the archi the the borrowed latino commission to adjust the setbacks on each elevation for up to 10 percent during the certificate of appropriateness process so that's kind of your saving grace i think that i i know that they have some illustrations showing where it was at in more detail where it's at today but then you will also have that liberty to adjust future facades by a 10 percent to get that breaking of the massing that we're looking for as well and then we could go into the window placements materials and all of that at the certificate of appropriateness thank you for your time i'm here to answer any questions thank you ron move on to public comment is there anyone here who would like to speak for against seeing no one we'll move on to commissioners asking questions i will start with commissioner so i'll go this time i'm i'm not i'm not ready to ask a question yet all right oh my gosh commissioner oh i'm good for now thank you all right um i forget who presented this but could we look and i know renderings were not required but um there was a statement that there was a six-story parking garage but in the elevations and in the initial wall section shown it only showed five stories for the building so can can that be pointed out in the site plan and then if it's in any of those elevations sorry about that megan smith with gardner burr hudson so it's actually kind of really hidden by the wrap system it's solely within the garage so behind the if you can see my cursor garage entry is right here the garage is wrapped by these units there's pieces of the garage interior it still does not breach the fourth floor or the fifth floor residential so it's nothing popping out above it is a portion of it below green no how is it six stories i only see five stories in this rendering the way the garage is sliced is different than the way the residential is understood i've done parking garages but i'm trying to understand so where is where is the relationship of the top of the so it really should say six tiers not six stories because it's tiers in parking language parking garage language okay um so the the tiers obviously are lower they're probably 10 10 foot floor to floor heights in the parking garage structure at this time with architecture um yes essentially 10 foot 10 foot and eight inches but yes okay and then your your current idea for story floor to floor for the residential units is it consistent from the first floor all the way up or is the first floor a different floor to floor height in your mind at this time so it is fairly consistent but it will be a little bit taller on the first floor any uses that require height we will take units on the second floor as well to mitigate that and trying to keep the massing as low as possible and currently there is an idea for mixed use so is there some retail at all um the reason so as it stands our project stand alone has no retail okay but the reason why we one of the things that we we had an opportunity and we're going to buy the little taco shop parcel what we want to do is actually we're working with them to they are our mixed use portion while they're not on our lot specifically we want to our building is intended to be almost like an extension of supporting their businesses and we've been in touch with their with the owner of that lot for a few months now talking to them about how to best make that work and so the idea is that they are the retail the project across the street the coffee shop the yoga shop that's or the yoga studio that's going there that is all of our retail that we're supporting okay um can we look at the the initial wall section again i know it's a work in progress and you're not required to present it one thing real quick that i think on the parking garage question that you asked it's really important to note on that yes and you can see it a little bit here why where it's stepped back and it's six tiers all all in and um again the we are still we have a parking requirement we want to everything to be successful we do want to meet uh a parking requirement that meets city code and meets usability i'm glad you're saying that because i was going to be a follow-up question i know you have the two waivers at this time you believe you will meet code for the number of units that you're designating in addition to not only meeting the number of parking spaces that we need for code we are also proposing parallel parking along henderson scott and estelle so the project will take care of it the project will take care of it we are paying for again it's two we're i'm a while i am a developer i'm also a i'm a civil engineer by trade and an urban planner and i believe in that the way you promote walkability is parallel parking shaded streetscape shaded sidewalks and walkability to your unit so yes it's very important to us and it was a non-negotiable when we started the project and then you had noted in the presentation that in that corner where the taco the taco slash old garage chapel's tacos if i can give them a a free ad if you haven't gone you should go those chapel's tacos it's on my list we haven't stopped yet but now that now that we know that staff hangs out there we might go um so the the plan is is that that that that you have some parklet kind of feature in that corner that bleeds into the the facade breaks that facade at that corner and and and allows for the existing business to sort of integrate with your block a little bit absolutely and so if you look at the shape of our site right it's not a rectangle it's a really wonky trapezoid they're great challenges there are great challenges on the site squares and rectangles not me uh the only the only shape more difficult than this would be a triangle um and so what so what we are trying to do is yes you'll notice that we obviously we do have setbacks to contend with but the idea is well let's just not just have a landscape area in that setback let's use it for walkability for our residents to be able to go there um you know figure out a way to kind of create that break it up make it look like a like if you were walking in some places in eboard where you're walking and you see this kind of cool cut out area open space breezeway let's make let's celebrate that and that's what we did here um in terms of the parking garage you said that the main entry is on henderson correct and our only access point is off of that's an in and out there's only one in and out in and out divided by a median that we are we're proposing okay and then at the rear on estelle that's a service area where your loading would be correct loading unloading given that that's where the school is right uh we believe as a father of three kids and having to drop off my kids and pick them up i don't like to see all that traffic onto estelle in addition to that we can control or at least work with trash collection and we can control move-ins as to when uh that loading space can be used and when it can be activated so that's why we did that understood um i would like to understand and this is mostly for the seventh avenue facade where the three foot setback comes from a historical precedent within the district this is specific to the seventh avenue yes um so i do not believe that it comes exactly from a historic president and the conversations initially was zero lot line but um there is a power line going in in henderson that kind of curves in there there's also a little bit of buffers and conversations with city staff as well so we thought that will benefit the building to have if we can see um where those balconies are on the second floor right to have the attached balconies that are very historic to eboard and then canopies etc without having to go over the property line we set back the building three feet in order to allow us to articulate those so on seventh avenue side are you saying that there are potential overhead utility lines that you're going to have to contend with is that what you're stating um no not on seventh no actually there there is on there is okay there's on seventh and henderson there are overhead electric lines and they're going to remain overhead not not go underground on your property uh we are working right now with tico to study the what it'll take to bury them uh we have we can't commit to burying them right now but we are working really hard to get them buried and because we know that you're going to have to have osha standards and just to build the building right from an energized conductor it's very have an actual picture image of the pr i know we we had a whole property review do you have an image i believe you probably have some photos from on the agenda item for the comp plan there were some existing photos of henderson and i think you had a view or two that looked down seventh towards the grass you want to keep on with your questions if i find involved well my question specifically to seventh is is i i am questioning the three foot setback at at seventh that you know historically the record shows especially within the the local and landmark district uh along seventh the fabric that we have left and you know the the historic record that we have zero lot line is what we would expect and so i question it along seven so you're saying uh if i understand you and christian maybe you understand this you're questioning why we're setting back at three feet at the street level you would historically you would say ybor has a zero setback line correct okay along seven if i may uh it's just the the ins and outs of the building and the articulation that we were initially designing for um you know getting a three foot seven from the building that allows to go in and out and create a little bit more vibrancy without requesting essentially air rights over the property line now if you can see in this in the image we are essentially designing it as a zero foot setback it is a sidewalk that will be continuous all the way to the face of the building so in theory it will not be felt as there is a setback or a buffer it will feel exactly as the other area i i just want to remind you the code allows for three feet encouragement of architectural features beyond the property lines so the air rights question really doesn't jive with me um but if indeed there are utility issues then i could buy into that so this is seventh as you turn on to henderson okay so you'll notice the aerial lines right there do you see that yeah and so again utility compatible trees you want to create that streetscape now in a world uh on seventh i think we could definitely study pushing it and reducing that setback obviously i do think we want to create some sort of again i've mentioned that a few times in my presentations already that walkability that where you don't feel too tight especially as you're turning from henderson one thing that was not to discuss on henderson there is going to be a bike lane right there's the city transportation department is working on a bike trail along seventh that along henderson that's actually going to connect under 275 and go straight over to uh armature works into the trail so again multimodal try to connect can encourage that walkability something we can study i am not personally i'm not afraid of of i use i call them license agreements or encroachment agreements obviously they create a legal headache but again we would own and maintain everything as we would want for our project because we want to maintain everything we just don't want to do something that will ultimately constrict and the flow of that pedestrian field but it's something we can study for sure as with more detail all right um i think we can probably table that to a coa if this is to move forward uh but there that concern is specifically for the seventh avenue elevation henderson i really don't feel i mean i love what you're doing i think it's great but for me for seventh avenue there's an opportunity here we've we've already said hey you get more density hey you get to do all these things to meet you roi my concern is that we give a lot yeah you know i'm a citizen i've been here a long time this is pretty much my adopted city i've lived here longer than any other place in my life and i feel very rooted and committed to this community and that's why i sit on this board and i've sat on the arc and i think if you've been in the room with me before you know that and so my concern here is that we give back what we can when we can absolutely and if there are opportunities to restudy the seventh avenue uh both the proportions the scale the massing and the architectural features that help break down the massing then we we as a commission have that it is under our purview and we really should take that duty very seriously and when those opportunities present themselves to allow us to help stitch back even if it's just by form not by style absolutely right and those are those are features that add to that walkability that sense of place bringing the scale down and all those things and i love that you you said all that you said because i'm right there with you but as an architect as a person who's lived in in very dense urban environments what you do to bring it down to the scale and meet the person at the street is really important right when we're talking about and i think the really one of the important things is that kind of feedback for us is something that that's the first time i've heard that and actually i i do i christian's a close personal friend we will definitely study and i don't think if i'm understanding it right what you're saying is accelerate that a little bit more push it up don't have a three-foot setback what can you do use the historic fabric yeah absolutely find solutions um i know that's not a question but it it came out of that question and so that was really my only question for the project in addition to that if i'm not mistaken i think it also just helps celebrate that setback on that fifth floor um even more so i don't see i personally i definitely want to i'm just a civil engineer and a planner who got into apartment development but i'd like to confer and make sure with our architect that there's nothing that we're stepping in but i think that's great feedback and something we'd encourage and more you know that kind of information from the board is really important for us so one more for the architect in terms of the setback i imagine that you had a lot to do with developing the facade and the setbacks right going to the fifth floor that last level how did you arrive at the 18-foot setback so i'm trying to find a good yeah the section is the section is fine too so essentially the the fifth floor we have a typical depth of unit is 35 feet right uh between 32 and 35 feet depending on where you are on the building the 15-foot step back or or 18 feet from the from the property line comes from a big the units at the top floor becomes too thin that it just you know it's just not a good unit overall right now we are creating special units on the top floor in order to have the windows etc the next step of that will actually be just crushing it all the way back to to unusable space to not get windows etc on that top floor so that's why we were you know going for the 15 foot because it will make a livable unit on the top floor instead of pushing it too much in addition to that that was feedback that we heard from ron right if if if the if the goal is to feel you know more of that massing i mean we stepped that back 15 feet because that was again showing that we're we want to work and hear feedback if there's um you know if it's something that is too much we can figure out a way where we we we need that density ultimately to hit what our goals are for the density that we want to hit and i as a reminder we could have gone more we don't want to we want to keep it at that 2.9 far but we still want a livable unit that's comfortable for a resident or a family to live in so is that is that consistent on the 7th avenue side it is consistent on the 7th avenue side and so we have that along 7th and can you show the site plan again thank you uh this will probably show a good idea but is that cut at the ground i assume it's cut at the ground level not at the higher level correct it's at the ground level that that cross section is this right question yeah and so you'll see that's this is essentially henderson but uh this could have another cut right here to show 7th avenue um but a good portion go back to the site plan please the good portion of 7th avenue is that corner and that corner has a lot of meat to it when i look at it um the reason why i'm i'm and again 7th avenue is the thing that i find uh yeah and and and currently the upper the upper image is the current intent for that corner of 7th avenue with the park parklet on the left side of that is that correct correct okay you can stay at that image if you don't mind go back that's a little bit bigger the the two images together is great because i have a question about the other one um right there so this is this is a great start but to me i still feel like and i i i want to ask the question specifically on 7th avenue is there an opportunity to increase that setback from 18 feet to at least 20 feet in your mind or not when you look at the site plan and i know it's not a done deal it's not fully baked there seems to be more depth in that area at the upper levels potentially for that last level yeah yeah we i mean right now we're showing so right now sorry we're yeah that's okay i know i feel like we're negotiating on the dais which is not what we want to do uh but well better to ask you the question now absolutely wait for our comment period and we say all sorts of things agreed agreed i just want to make sure that i'm not saying anything that's incorrect so i don't miss anybody so if we get if we move along so let's just take seventh as a component if we move seventh and decrease that okay uh or decrease the setback to zero feet right now you're at an 18 foot setback from the property line it's still a 20 foot in my mind on seventh yeah so that's my question what you're asking is can we go down can we go to 20 there increase that to 20. are you asking for that on henderson as well could we actually i said very clearly this is only in regards to seventh avenue facade yes we could study that what we would like to request and and is that we actually would maybe increase the or decrease the setback on henderson from 15th maybe to 13 just to give a little bit of that addition but henderson currently is at 18 as well isn't it it is the same consistent as right now what you're asking for is on seventh which i think is a fair request can we get that to 20 and what we're saying yeah we could definitely study that and most likely can do that but could we get henderson can we get some of that back for the lost because those units along seventh which i think are great views and great views of seventh street will have a little bit of a wonky feel we just don't want to corner ourselves into a unit design that is just not livable in and we like some flexibility we agree we don't we don't want that but i can tell you from my learned eye that there's some fat in that in that section i agree that we could probably flex on the henderson side i'm not so sure that it's 13 feet maybe 15 feet is more comfortable if if there's going to be a step back especially if you want to put uh rooftop terraces up there just to allow for a little bit of distance because um once you start encroaching on the roof line of the fourth floor even with railings and we we see kind of see-through railings but we know how projects go it's as early uh right we would want uh some sort of metal railing that's consistent with right and of course during this c you know the certificate of appropriateness process should this move forward we can we can get into those nitty-gritty things but uh we also don't want to put ourselves in a corner for anyone that might follow us and understand understand that your concern is setting a precedent that could be followed and i think as you look at this district you look at the area that we are it is a unique site um and every site should be studied individually as they will have to come to this board on an individual basis but we understand what your mandate is and and agree i think we can increase decrease that setback on the ground floor to zero and if you're asking on seven on the seventh floor we can go to 20. um but we'd like some flexibility to during the certificate of appropriateness on that fifth floor on henderson and if you recall i just want to go back to here and maybe this is an area as well that we can discuss we also have this same setback on scott so we have we've kind of respected that if we can get that back i think we can figure out if we can easily get the 20 feet on seventh and even even maybe keep the 18 feet on on henderson but definitely something we could do yeah i i think there's probably some negotiation there um it's definitely more about the continuity of the fabric along seventh because it's such a high highly visible corridor and everybody wants to be on it now and celebrate seventh we it's the unfortunate thing it's such a small facade for us like but we're celebrating it all so much so we have a lot that we want to put on there but we believe we can do that and work for sure to get a better plan to show it in certificate appropriateness agreed um so for staff i just want to be clear during this process of the rezoning from the yc to the yc9 we do have the opportunity to speak to the setbacks currently being discussed and i noted your notation about a proposed condition so you do have the ability to discuss the setbacks that's part of what the pd is all about the yc9 so i listed the five uh caveats that are included in the ybor city design guidelines where the height the width the massing the setbacks the orientation and the rhythm alignment and spacing but i think the catch-all is that last condition that that proposed condition i think that needs to travel with this uh approval moving forward and that will give you the latitude and the language that you're needed at the coa but we could do both correct um so i'd like the applicant back up uh the architect and the civil engineer can we go back recovering civil engineer but yes um can we go back to the image that had the page that had the two images stacked sorry because i'm going to ask lots of lots of another question i'm going to pass it i'll let you go i couldn't find it oh i saw it i saw it too there we go there you go all right um so we talked about the setbacks uh we have to talk about the massing of the last floor that is when you do the street view it's so lovely the renderings are so spot on and then you pull back and unfortunately you will be alone for a while um and this is just not in keeping and consistent with the district guidelines and i would ask that there be variegation in the upper floor to align with what you're proposing for the four floors below that means allowing for a little bit of flex step back in that facade so maybe that's where we go with that adjustment request right maybe you do get 10 feet in some spots 15 in another so that we get an average but there has to be some facade rhythm readjustment here that that isn't anything consistent and and if you have a historic reference that you would like to propose right now that we could talk about i i give you that opportunity to respond with it but as i see it right now this is like a glaring issue so we we do not have a historic you know precedent for that it was probably the focus was on making that top floor as anonymous as possible so the massing is felt as a four-story you know building more than having that fifth floor we will be more than happy to go in and out and kind of play it a little bit in order to to bring articulation to it but the initial stop stop that we took was can we make it just a homogeneous you know area so it just almost you know just stays consistent and doesn't call too much attention and and i'll just say this as the developer your feedback this is the last time we see you until the certificate of appropriateness right we do not have nor do we want to do something and go along a route that we come back here to this come to this group for the certificate of appropriateness and you're like whoa whoa whoa so that feedback is great feedback like christian said we've been trying to mute that as much as possible but if if it's if the call is hey i think you need to kind of continue it so it doesn't look homogeneous that is not a concern of ours it's actually something we we want a very good looking building uh we we want to encourage and contribute to that fabric and we are more than happy to to definitely study that and bring that to you on the certificate of appropriateness time okay i think i've asked enough questions i i actually have a question and this is just for my knowledge um with that setback especially on henderson one of the things that we notice is that we don't have i mean you have that big setback with the uh on an opportunity of of putting balconies or anything in there is that something that is something we could discuss on that fifth floor or is that no you want to keep that full you know you definitely want to give or take but the balcony is kind of extent balconies up there i don't i again we didn't do anything up there because of the desire why wouldn't you i mean those are we would love to we just didn't i don't think anybody could tell you that you couldn't do it we certainly don't have purview over that i would suggest that you and your architect go back to the codes absolutely understand what we could do that we just you know if there are there are exclusions or other things you have to do to get there you know really understand that and come back to us it's you know if this goes forward at the next hearing and we talk about it then but you know i can't give you my professional opinion well we would love that we just again and the reason i'm asking that question was because of your previous comment where you said hey you're not it's just homogeneous it's we could call it just boring and the reason it's boring is because we were trying to mute it as much as possible understanding the historic significance of and what we're
