The subject property is located in the northeastern portion of the county, north of Lakeland, at 11252 Country Haven Drive, east of U.S. Highway 98, north of Interstate 4 and Creekwood Run, south of Rockridge Road, west of Country View Drive, in Section 23, Township 26, and Range 23. The property is located within the Agricultural Residential Rural Land Use District in the Green Swamp area of critical state concern, where the minimum lot size is 5 acres. Properties 5 acres or larger do not need a special exception for commercial vehicle parking in residential districts. The lot is below the 5-acre minimum, however, is considered a lot of record. This special exception will only allow for one commercial vehicle, provided they conform to the standards in LDC Section 216D. According to the property appraiser's website, the subject site is considered lot 26 of the Ridge Meadows Platted Residential Subdivision, recorded in 1983, with a mobile home later placed in 1995. In 2021, a similar request to park a commercial vehicle and trailer was approved approximately .2 miles south of the subject site, on about 2 acres of residential property, which is outlined in red on your screen. Case number LDLSE 2021-6. Here is the site plan submitted for the record. The truck will be parked approximately 20 feet from the property line to the north and about 55 feet from the neighboring property line to the south. The corner lot has frontage on Country Haven Drive and Ridge Meadow Drive, both local paved roadways with widths of about 20 feet. Access will come from Country Haven Drive, and a commercial driveway apron is required to be constructed and installed. Rock Ridge Road is a rural minor collector roadway and is less than 1,000 feet of travel distance from the subject site. The surrounding roads near the property have no weight restrictions. The applicant's plan indicates the new parking area will not be located in the front yard. The crane will be parked behind the mobile home in between the existing shed and chicken coop. Here are photos from staff site visit. The applicant was cited by code enforcement in the past for parking a vehicle at this location. The owner is seeking approval for parking the commercial vehicle on their property. Since the vehicle parking area will be less than 200 feet from a residential property, it needs to be screened from the adjacent properties with a Type B buffer, landscape buffer, or a six-foot opaque fence outlined in Section 216D of the LDC. Screening can either be along the northern and southern property boundaries themselves or around the parking area itself, minimizing any visibility from the neighbors and public right-of-way. As previously mentioned, a commercial driveway apron will also need to be constructed. So staff is recommending approval based on the site plan provided by the applicant in recent visits to the site. The request will be limited to parking one truck, a 1998 T-Rex telescopic crane, as described in the application and staff report. The closest residential structure is about 85 feet north from the proposed parking area. No other commercial vehicles may be parked on the site. The subject property is located at 5525 Tillman Road, north of Knight Station Road, south of Duff Road, east of Cherry Road, west of Kathleen Road, east of Hillsborough County, and west of the city of Lakeland in Section 19, Township 27, Range 23. The subject site is located in the Agricultural Residential Rural Land Use District. The properties in this area range in size from under half an acre to slightly below the five-acre minimum lot size allotted for Agricultural Residential Rural. The applicant's property is approximately 0.99 acres with ample space for parking. Decent Road extends approximately one and three-quarter miles to the east, providing connections to Kathleen Road. Kathleen Road continues south until it intersects with Interstate 4, which offers connections to Tampa to the west and Orlando to the east. Approximately 1.06 miles east down Decent Road is a small bridge providing an overpass over the regulatory floodway that extends north and south. The weight capacity at this bridge is 29 tons. According to the applicant, the truck and trailer are expected to weigh approximately 11.5 tons. The remaining surrounding road network has no weight restrictions and provides direct connection to Interstate 4. The proposed parking area is not located in the front yard of the property. The truck will be parked to the south of the single-family residence in the side yard facing west so that the minimum amount of vehicle surface is facing Tillman Road. The nearest neighboring residential structures are over 100 feet to the east and 117 feet to the south proposed parking location. The site plan illustrates the truck will be parked approximately 42 feet from the neighboring property to the south and 62 feet from the neighboring property to the east. This falls within the 200 feet from the neighboring residentially designated properties requiring a type B landscape buffer consistent with the width and planting requirements outlined in Section 720. This commercial vehicle parking approval shall be contingent upon the applicant constructing at least one entrance to commercial driveway standards for structural thickness and turning radii in accordance with Section 705I of the Land Development Code. Staff recommends approval. The request will be limited to the parking one truck, a 2012 International ProStar Class 8 sleeper truck, and trailer as described in the application and staff report. So the site is approximately 0.13 acres, located within a residential low 1 future land use district and in the transit supportive development area. This lot is approximately 40 feet in width, which creates further conditions unique to this parcel. So the previous home has damage from Hurricane Ian, and a replacement home is being provided by the Rebuild Florida program. The program operates with a set portfolio of home models in order to be cost-effective as possible and provide new homes to participants as quickly as possible. The old home is approximately 1,078 square feet, and the new single-family home will be approximately 1,410 square feet. So here's the site picture from my site visit. Staff recommends approval whether the variance granted is the minimum variance that will make possible the reasonable use of the land, building, or structure, as the lot cannot reasonably accommodate any of the standard home models required by the Rebuild Florida program without the requested reduction in setbacks. And without this variance, the applicant would be unable to rebuild a residence on the property. And I'll stand for any questions. The property is located at 76 Citrus Ridge Drive, located on Lot 76 on the east side of Robinson, south of the intersection of North Valencia Drive, east of the Citrus Ridge Drive, west of Dancy, within the Citrus Ridge subdivision, northwest of the City of Davenport, in Section 20, Township 26, Range 27. 68 mailers were sent to area property owners on November 24th. One board was posted on the property on November 24th, and a legal ad was published in the Polk Sun News on November 26th. Eric Peterson is the case planner. Is there anyone here to speak? I'll give you a quick rundown here of the case. It's a 5-foot setback going to 0. It's actually approximately going to 1, but when you get that close to the property line, we just net it to 0, so there's no confusion. The site is located in the northeast portion of the county, north of Haines City and Davenport, in a residential medium, off of Citrus Ridge Drive. This is a, this development originally began as an RV park back in the early, or the late 70s, early 80s, and has evolved into a mobile home park over time. It subdivided lots. It was platted, and as a result, you have individual lots. The applicant is requesting a patio cover that will extend from one side of the new mobile home to the end of it. It'll be approximately 10 1⁄2 feet, which will put it right at about 1 foot from the property line. This is the applicant's site plan. This is a survey. This is approximately a cartoon drawing of what it would essentially look like extending from the home. This is what it would look like extending from the street. As you notice, the neighbor has a similar carport that is actually closer to the right-of-way and is also fairly close to the property line. The neighbor on the other side also has a similar patio. It's very common in this area. As you can see, many of them extend out close to the right-of-way as you look up the street, so this is not out of the ordinary. Staff recommends approval. One, it's not going to impact the drive aisle. It's easy to maintain because it'll be open, so there's no encroachments. There's a condition in the staff report that a downspout be provided so they can direct water from the carport onto the street where the way the drainage has been designed. And then the other criteria that was met, it will not confer on the applicant any special privilege that is denied by the provisions of this code, nor have past requests, similar requests, been denied. There have been 34 variances to setback standards in the Citrus Ridge Plan development since 2019. In this phase one, 14 have been approved. So it's not unusual. With that, I'll stand for questions.
