copy of the final decision on any case on today's agenda if you think you might want to speak during the meeting during the meeting you will need to complete a speaker form once the form is completed please hand it to our clerk my name is barry buenaventura i'm an attorney with buenaventura law in tampa i have been appointed by the board of county commissioners to be a land use hearing officer to hear variants and special exception cases if anyone has a pending case in which i or my firm is representing you please bring that to my attention now as we want to avoid any potential conflicts i don't believe that to be the case but please let us know if you do during this meeting please put all cell phones and other communication devices on silent the cases will be called in the order listed on the agenda unless there is a request for a case to be taken out of turn these hearings are quasi-judicial which means they require due process and the decisions will be based on competent substantial evidence presented during the hearings county staff will present the county's review and recommendation on the case first and then the applicant may present any additional information they would like to provide after the applicant has concluded their presentation i will open the hearing up for public comment this is the public's opportunity to provide information and express their opinions on the application if you have any questions that come up during the presentation you can ask them during your time to speak please do not ask questions or make comments from the audience while others are speaking at the podium the county the applicant and i will note questions you raise during your comments and try to have them answered following the close of public comment when it is your turn to speak either for your case or during public comment please state your name and address for the record into the microphone these proceedings are recorded and it is important that you speak hearing officer meeting i would ask that those be shown as accepted and we will now move to new business and the first item is ldl se 2024-10 good afternoon eric peterson for the land development division ldl se 2024-10 leonardo reyes is requesting a special exception to park a commercial vehicle a 1957 gmc truck at the residence on approximately 2.45 acres within a residential suburban land use district the property is located at 4508 thompson road north of turner road south of highway 60 west of gordon street east of riverview drive north west of mulberry in section 32 township 29 range 23 on january 6 18 mailers were sent to area property owners on december 20th one board was posted on the property a legal ad was published in the lakeland ledger on uh january 8th one letter we received one letter in opposition alia inglima is the case planner good afternoon alia inglima with land development presenting ldl se 2024-10 the thompson road special exception the applicant is requesting a special exception to park a commercial vehicle which is a 1957 gmc truck at their residence on approximately 2.45 acres within a residential neighborhood the subject site is located at 4508 thompson road north of turner road south of highway 60 west of gordon street east of riverwood drive and northwest of mulberry in section 32 township 29 range 23 the property is located within a residential suburban future lane use and in the suburban development area the property has frontage on thompson road thompson road is approximately 20 feet in width and the vehicle will be parked under a carport and will be 20 feet from the western property line the truck again is a 1957 gmc and is approximately 28 feet in length access is proposed to be on the north side of the parcel and the subject site is approximately 0.44 miles to highway 60. a commercial driveway apron is required to protect thompson road from the stretching caused by such a heavy vehicles turning movements on and off the property this vehicle shall continuously meet the screening of buffering requirements listed in section 216 d of the polk county land development code staff recommends approval based on the site plan provided by the applicant and recent visits to the site the proposed placement of the vehicle will be to the rear of the the primary structure and shall meet the screening and buffering requirements a commercial driveway apron is required to protect thompson road from the stretching caused by such a heavy vehicles turning movements on and off the property and the surrounding roads near the property have no weight restrictions and i'll stand for questions do you know approximately um how wide the right-of-way is in that location now you've said the i think you've said the pavement is approximately 20 feet wide but do you know how wide the right-of-way is no ma'am i don't not a hand okay um do you have any other dimensions for the commercial vehicle i think you've given me the length do you have um approximate height approximate weight anything like that i believe it was 40 tons i think um but i'll defer to the applicant to answer those questions okay 40 sorry for is this a code enforcement no ma'am what is the minimum lot size in the residential suburban land use district it's five acres and is this a lot of record yes ma'am um i know you've indicated that um you know a type b buffer would be necessary is there much natural vegetation on site or um would an entire buffer need to be added from what i could see that there is a lot of natural buffering from the trees on site and the car will also be within a carport i believe that is sufficient enough but if it is not then they will have to meet the screening requirements and that gets determined how and when once they go down and building that'll be determined okay so through the building department yeah yes okay okay thank you is the applicant present good afternoon okay and if i could start by having you state your name please leonardo reyes okay thank you and it looks like maybe we have an interpreter okay um if you could say your name please crystal morales thank you and then we'll ask our clerk to um swear you in place do you swear or affirm that you would truly and correctly translate english into spanish and spanish into english here today thank you mr reyes you've heard the presentation so far um were you able to um follow along during the presentation and is there anything you would like to add in support of your application there is no everything was presented correctly okay can you tell me how you use the vehicle he's saying that it's actually used for recreational purposes it's not a business or for commercial purposes at all okay and how do you use it recreationally he says he takes the truck to car shows but when not at a car show then the vehicle would be parked on your property uh no he said no it does not come off the premises every day it's only for the occasional car shows where is the vehicle currently in miami if the application is to be approved staff has recommended a number of conditions of approval and i just want to review some of them with you to make sure you understand um the first is that if this is approved it would only be approved for this particular vehicle and only this one vehicle not multiple vehicles and not any other vehicle he understands okay and it's only approved while you are the owner of the property if you were to sell the property the approval does not transfer to a subsequent owner if this is to be approved the approval does not include the right to perform maintenance on the vehicle while it's located on the property he says he will not be repairing it there okay and the county would require you to put in a commercial driveway um at the road to protect the road he said he's willing to get the permit and do it okay and um again if this were to be approved um you would have to park the vehicle in the particular location that is noted on the site plan so only in that location that's shown on the plan he says he understands okay um again is there anything you want to add in support of your application any additional information you want to provide he said nothing okay thank you i will now open up the application for a public comment i have um two individuals who have indicated their desire to speak um the first is janet langham okay i am inviting richard griffin up to speak who has also submitted a request good morning my name is richard griffin i live at 4506 thompson road which is joining the property of the person uh what i was wanting to find out is has anybody looked at the condition of the road being designed for that style of a vehicle the condition the road is deteriorating very bad it's a clay base while the asphalt's broken the edges of pavement is being deteriorated and it's you're talking a vehicle that's pretty wide going down a road for residential traffic when you're going around curves people hug the center lines hug the edge of pavement and i just consider it a safety concern because you got a lot of young people on the road right now and somebody's coming around the curve i've had my mirror similar several times being almost glanced by somebody hugging the center line that's one of my concerns the other one is it is not too far from where i live at it started out with one commercial vehicle then it wound up being a parking lot for multiple commercial vehicles i don't want that i don't want it to be a junkyard a parking lot i like being in the country having the peace and quiet you know i don't mess with other people i just deal with my property but i just want to put that out there they need to look at the condition of the road i mean he says this is for car shows but like i said a place down the road started out with one vehicle and it's on highway 60 just a little ways west east of where we're at has started out with one vehicle now it's multiple semi-tractor trailers i don't want that i appreciate you and i work for hillsborough county i've been with them almost 40 years i know the condition of the road it's probably inch and a half thick asphalt have they looked at the height of the vehicle going through the roadway there is some low trees you know i just want to put that out there because i don't want to be the one to be sitting here and saying oh i didn't say anything and then somebody has a situation when you're pulling up to 60 it's very hard getting out there with just vehicles cars trucks pickup trucks when you have a big truck trying to get out it's going to take him a little longer to get out of there and anybody behind them that's going to be the same way if they're making a turn they're going to encroach in the opposite lane going opposite direction so like i said i just want to put that out there it is a safety concern and i've seen a lot of accidents right there at 60 and i don't want to have to be looking at one of them because you know i'll let it just glide by you know like i said he may be looking one but i don't want to be 5 10 20 track trailers coming through the roadway the road's not signed for that so that's basically all i have okay we're here today to consider one vehicle not multiple vehicles on this parcel i appreciate the concerns you have um shared they are noted and um unless you have something else to share we're going to move on to the next individual that's all i have okay thank you okay um janet langham please my name is janet langham i live at 4506 johnson road my concerns i'm going to start with my concerns first one there's already a tractor trailer on the property first of all second all as he mentioned that place on 60 started out with one it is now basically a truck stop it has a food truck come in there it has tires being changed and all over the place you have a mechanic and you even have a barber shop there and it started with one truck that's one concern the other concern is at the corner of espo and thompson road on that corner they had one vehicle is a van with rose on it now there's four trucks there's semi i don't know if it's stucco or cement mixers in the back at least three to four and there's another something there i don't know what's there they also had six to over six white vans long vans that they use for you know the farm workers to carry in that's there and it only started back in 2024 on the corner and this is on a different parcel that you're describing that's near yes but i'm just saying nothing was said at the time and now it's to this you see what i mean it opens up a big can of worms those are my concerns my safety issue is at espo and 60 if you look to your right if you're coming out of esco and turning right uh turning left onto 60 there's a hill there even got pictures if you need to see it there's a hill there they're going 60 miles an hour and they're coming up over this hill now you have i have trouble i have a little vehicle even with a truck i can't if i'm in the middle section i look i can't look right i can't see i have to wait till that truck gets out of the way and that's a picket truck i have on this side i have willis road coming out there's another one on the other side of the thing coming out and then that the slope they're going 60 plus miles an hour very hard to get out as is okay now it's true that the state put turning lanes and everything else but even with the turning lanes the turning lanes will block your view all right now if i'm coming out of espo i'm going to turn right onto 60 the lane is right here like i'm having trouble with you know for example they had this big trucks when they're doing the trash pickups those big black ones i couldn't see he couldn't turn because i was in the way okay and that's down it goes down like this i can't see i literally had to back up at least three car lengths to let them go and luckily there's no one behind me now the road is not and the roads on the side at 60 even when they added on it's all grutted out because they can't make the turns without going into the next lane and that's just we're talking smaller things okay the problem is there's already a trailer there and you get a a truck that's wider than a regular vehicle and they're turning that corner on that corner itself this if you look at the sign it's laying because someone is laying on the side because someone bumped into it and on the sides it's like you can see where ruts are on the side where they go like this so my concern is my safety i can't see to get out of there you know yeah i know that state concern but my life is what i'm concerned about i can't see to get out of there and that is a major concern and i don't see the state putting a what do you call a traffic light there anytime soon and they really should because a lot of people don't realize back in our back section these are the people who are taking the espo back to thompson road you got two subdivisions back there i know of for a fact and you got two trailer parks back there all of them are using coming down thompson road to espo so during the morning time that is backed up luckily i don't work anymore i don't have to deal with it but i do have to deal with it when i go to the doctors or go get groceries the the reason why he's talking about the road is at our mailbox i do a lot online i tell you the truth right now because i'm going to help at the road where the mailbox are and the trucks the mail trucks and everything it's all broken out they had to add patch it and they're going to have to patch it again and they just patched it four months ago the road is breaking it's got breaks in all over it clay base gets wet guess what you got another rut another hole you say well what's so big deal about that i don't know have you ever been sleeping and let's say the uh lawn country companies that has the trucks come by they hit that how it goes bang you hear that a lot when they go and hit that hit a rut so my concern is one is the turning into espo from 60 with a large vehicle either way i'm going to be blocked from seeing and it's going to cause a problem even with the turning lanes we have wrecks there because they can't see a 60 mile an hour truck i'm a car or truck coming over that hill and when it's coming up from the valley if you have someone in that turning lane you're not able to see i have a low vehicle yeah i don't have a truck and then when you're going on to espo to thompson road well as is now with a regular regular turning they're turning into my lane where i actually back away from the stop sign so that they do not hit my front car and this is with cars and if you got a truck you're going to have to swing way out and come over and you're going to be in my lane okay so my healthy this the safety of me is very important to me okay but also all those a lot of people don't realize that road is a main road out of there and you have a lot of traffic on there most people don't realize that now i had rich mentioned about he says well it's clay base the road is going to do that it is not geared for semi trucks like highway 60 and you see what happens to highway 60 between county road and 39 i got a broken windshield and he does too from that because the roads broke down and it's not going to be able to fix to later on yeah that stayed but now i'm looking at this happening on my road now so that i'm concerned about my safety i'm concerned about unless they get a traffic light up there my safety's in their jeopardy so that's the reason i'm bringing it to you because most people don't realize how busy that road is they don't live there they don't have to get out of there onto 60 and that's my way out so what am i going to do when he wants to turn in if i'm in the center thing i can't see past him he can't turn to go on to espo because my car is in the way and i can't see so we've got a standoff here i'm going this way he needs my lane the center lane to turn to get in there so that's a big concern with me so i'm bringing it to the tension if anything happens with accidents i don't see you being able to put a traffic light up there because it's state so my concern is big so that's all the reason why i'm here today is mainly for my safety so that's all i have to say thank you for listening thank you is there anyone else who came today to speak regarding this application either for or against okay seeing no one will close public comment um i do have a couple questions for staff um can you tell me what the speed limit is on thompson road and on espo drive please uh posted speed limit is 30 on both of those and you asked earlier about the vehicle weight it's 9 000 pounds gross vehicle weight according to the registration four and a half tons does staff have any information about um the trailer that is um that has been stated to be on the property no ma'am when we did a site visit we did not see a trailer okay um i have a couple questions for the applicant please if you could come back up did you understand the statements from um the two individuals who just spoke he said more or less okay um so it was mentioned that there is a trailer that is parked on your property is that so he said she might be referring to the rv he has on the property but it's not it's not another 18 wheeler or another commercial vehicle like this one he says he only has one registered to him and it's just this one okay are there any restrictions on um an rv being parked on a property recreational they're not living in the rv it can stay permanently on site so no issue with the um recreational vehicle correct um i'll give you a final opportunity to add anything you would like to add given what has been said so far he said he didn't understand 100 of what the comments that were made were but he said he still doesn't have anything to add to it okay uh I think the troca is going to be worse. The woman said that when she is out of Esco Road to 60, that when she leaves, there is no space. And when the troca comes, or she has to move, or possibly the troca grama. No, I don't think that that's a problem. Because you have to go by the street, and you can't go by the other side. You can't go by the yerba or anything like that. I understand what they say, but that comes out from a bank. You know, that doesn't come from a bank. I understand what they say, but you know, I also need mine. He says he understands the information regarding the road and accessing Esco Road from 60. He said it's not really in his hands regarding, you know, accessing outside of his property. He said he's willing to do his driveway, but other than that, there's not much he can really comment on. And the truck doesn't really leave the property very much. It only leaves once in a few, you know, days out of the year for car shows, and that's it. Okay. Thank you. Anything else from staff? No, ma'am. Okay. Thank you. And we can move on to LDL SC 2024-11. LDL SC 2024-11. LDL Alvarez is requesting a special exception to park a commercial vehicle, a 2022 Cascadia Freightliner, at their residence on approximately 1.86 acres in the Agricultural Residential Rural District. The property is located at 727 Saddlewood Boulevard, north of Interstate 4, south of Dean Still Road, east of Rockridge Road, west of Moore Road, north of the City of Lakeland in Section 12, Township 26, Range 23. On January 6th, 16 mailers were sent to area property owners. One board was posted on the property on December 20th. A legal ad was published in the Polk Sun News on January 8th. We've received one letter in support. Kyle Rogus is the case planner. Good afternoon. Kyle Rogus with Land Development presenting LDL SC 2024-11, the Alvarez Special Exception. The applicant is requesting a special exception to park a commercial vehicle at their residence on approximately 1.86 acres within a residential neighborhood. The subject site is located at 727 Saddlewood Boulevard, north of Interstate 4, south of Dean Still Road, east of Rockridge Road, west of Moore Road, north of the City of Lakeland in Section 12, Township 26, Range 23. The subject site is located in the Agricultural Residential Rural Land Use District, where the minimum lot size is 5 acres. Properties 5 acres or larger do not need a special exception for commercial vehicle parking in residential districts. The lot is below the 5-acre minimum. This special exception will only allow for one commercial vehicle provided they conform to the standards in Section 216-D in the Polk County Land Development Code. This site was developed as Phase 1 of the Saddlewood Estate Subdivision. Then the subject site is located off Saddlewood Boulevard, passing approximately 26 residential properties. Many of these properties in this area are similar in size. While conducting our site visit, no other commercial vehicles were seen. Per Excel, a special exception was approved at 943 Saddlewood Boulevard, 0.5 miles from the subject property. And then here is a closer look at the site. And then the truck will be parked approximately 50 feet from both neighboring properties to the north and south. The southern property line is heavily vegetated and extends the length of the proposed parking area. Buffering on the north property line will be required to extend along the entire proposed parking space, minimizing any visibility from the neighbors to fully meet this requirement. The applicant site plan indicates the new proposed parking area is not located in the front yard of the property. The truck will access the backyard on the west side of the property and would be parked behind the mobile home. And these are photos sent in from the applicant of the proposed commercial vehicle. The commercial vehicle will access the property off Saddlewood Boulevard. The commercial driveway apron is required to protect Saddlewood Boulevard from the stretching caused by such heavy vehicles turning movements on and off the property. And then staff recommends approval. The request will be limited to the parking of one truck, the 2022 Cascadia Freightliner, as described in the application and staff report. No other commercial vehicles may be parked on the site. The special exception shall be for the operator, Adriel Alvarez, only and shall not run with the land. Commercial vehicles shall only be parked in the area designated on the site plan and shall continuously meet the screening and buffering requirements listed in Section 216D, Commercial Vehicle Parking and Storage of the Polk County's Land Development Code. And with that, I will stand for questions. Do you have the approximate dimensions and weight of the vehicle? Yes, so the weight of the vehicle is 52,000 pounds, and then the height would be 13 feet, and length would be 26 feet. Is it 5,200 pounds or 52,000 pounds? From the Accela application, it shows 52,000. It doesn't give a measurement, but it gives the 52,000. The tear weight is 8 1⁄2 tons, just the vehicle alone. It can carry 50. Oh. And what's proposed is just the vehicle, not a trailer, is that correct? Yes, there was no information provided for a trailer, but if there is, I would leave that to the applicant to further address that. Okay. And the proposal is that they would come along the south-ish side of the property, and pull up behind the home? Correct, yes. Okay. Part of the property right here. Okay. Thank you. He said he's a truck driver, so he's constantly on the road. Okay. So, about how often would the vehicle be on site? The truck in the property. The truck in the property. So, if you're working, how many days are you in the property, how many days will I be there? The property. The property. The property? Yes. The property. The property. It's not often. Okay. So, you are away overnight with the vehicle, but not for long periods of time. Yes. And is there a trailer as well, or you're just asking permission for the vehicle? No, only the part in front. Okay. And we'll move on to our last application, which is LDL VAR 2024-59. LDL VAR 2024-59. Marshall Smith is requesting a primary structure side setback reduction of 10 feet to 4 feet for the construction of a 24 by 36 attached garage. The property is within a rural cluster center residential district. It's on 0.42 acres. It's located at 344 Sunshine Drive, north of Highway 638, south of Highway 640, east of Highway 27, west of Scenic Highway north and south of the city of Lake Wales in section 35, township 30, range 27. On January 6th, 25, 12 mailers were sent to area property owners. One board was posted on the property on December 20th, 2024. A legal ad was published in the Polk Sun News on January 8th, 2025. Staff has received no response. Kyle Rogas is the case planner. Good afternoon again. Kyle Rogas with Land Development presenting LDL VAR 2024-59, the Smith variants. The applicant is requesting a reduction of the primary structure side setback from 10 feet to 4 feet for the construction of a 24 by 36 garage extension. The subject site is located at 344 Sunshine Drive, north of Highway 630, south of Highway 640, east of Highway US 27, west of Scenic Highway north, south of the city of Lake Wales in section 35, township 30, range 27. The subject site is located in the Rural Cluster Center RX Land Use District in the southeast Polk Village Center selected area plan in the rural development area. The lot is 0.42 acres, which is below the 20,000 square feet Tier 1 average residential lot area in the Rural Cluster Center RX Land Use District. Because of the small lot size and orientation of the home, setbacks restrict further development without impeding on the 10 feet setback. The site was developed as part of the Crooked Lake Park subdivision in Track No. 3, approved on January 25, 1957, prior to the adoption of the Land Development Code. There are no easements on the property, according to the plat. Right-of-way setbacks are maintained, and the proposed garage will stay within the confines of the existing driveway foundation, remaining 10 feet from the neighboring structure. The home was built in 1972 with an unfinished garage of 55 or 550 square feet of the 27 total single-family properties in Track No. 3 of the Crooked Lake Park. 37% have obtained either an attached or detached garage or carport addition since the approval of the plat on January 25, 1957. The additions began as early as 1961 and most recent as 2022, apart from LDLVAR 2024-56, which was approved on December of last year. If the proposed garage was detached, it could be located 7 feet from the property line without a variance. Since the proposed garage is attached, it must be measured as the principal structure of the home width. Due to the inadequate parking garage parking, the applicant utilizes the existing driveway for parking. It is in the intent of the applicant to extend the existing garage to enclose the existing driveway, where they currently park for full coverage of their vehicles. Placing the garage in the side is reasonable and aligns with the driveway, which is aesthetically better than the front yard and could be in violation of other setback requirements. Here's the site plan submitted. Note that the dimensions of the garage will be 24 by 36 feet in length. The variance is a request for four-foot setback and a one-foot overhang measured from the foundation to the east property line. The distance of the proposed garage expansion to the abutting property line and residential structure, as depicted in the site plan, varies as both homes do not run uniform with the property lines. The proposed garage is at its closest point to the property line with 37 inches measured from that 12-inch cantilever, and the longest distance or furthest distance is going to be 64 inches measured from that 12-inch cantilever as well. This photo is taken from the edge of pavement looking south. In this picture, you can see how the applicant utilizes the existing driveway for parking, and staff recommends approval. The request will not block or limit the view of traffic. There are no easements on the property. The garage in the side is reasonable and aligns with the driveway, which is aesthetically better than the front yard and can be in violation of other setback requirements. The reduced setback distance will not diminish the safety of the public area involved. And with that, I will stand for questions. The 37-inch measurement that you provided, that is to the overhang, I take it, and not to the vertical wall? Correct. So this site plan here, depicting that 37 inches and 64, that is measured from that overhang, and then this I tried to illustrate that 4-foot and 6-foot distance from the actual structural wall. Okay. I believe you said that the average lot size was 20,000 square feet in this area. What is the minimum lot size? Minimum lot size? Okay, so then the minimum would be 20,000 square feet. Okay. Is the site is just under that, I take it, at .42? Correct. It's like 18,000. Okay. But I take it it's a lot of record? Yes. Okay. Plavid, correct. Okay. Is the applicant present? Good afternoon. I'm Marshall Smith. I reside at 344 Sunshine Drive. Okay. So having heard the presentation so far, is there anything you would like to add in support of your application? Well, what our hope is, is to add an existing or add a garage to that existing footprint that we park on today. You know, we think it would be more aesthetically pleasing for our neighbors, not to see our vehicles out there, just to have a closed-end garage that attaches to the house and fits in with the current structure. So that's our hope, so we can kind of get in and out of our vehicles without being out in the elements. You know, we're retired now and as we get older, you know, we'd like to try and avoid the rain and be able to get in and out of vehicles without being rained on or other issues. Okay. Are you not able to use the garage that you currently have? That garage is at a right angle, and you really can't get either one of those vehicles in it. Plus, it's got a lower height. The proposed garage that we're going to do is a 10-foot garage, and it'll allow those SUVs to be able to get in it. So the garage that you're proposing, it looks like it's two bays deep? I mean, it's pretty large? It is deeper, and we may end up with a third vehicle is the reason for that. So we could have all of them inside, but that just takes up the existing footprint of the concrete that's there. So we just tried to mimic that. The reason I ask is it's the back corner that pushes you even closer to the property line. It does, and that concrete slab that's there today is very close. I mean, we're actually coming a foot off of that. I believe it's a foot off of where the existing slab is today. One of the requirements that staff and I have to consider when reviewing a variance application is hardship, something that is unique to the property, to the conditions on site that justifies deviating from the code, which in this case the code requires a ten-foot setback, and you're asking to reduce that to four feet. Can you describe hardship as it relates to your circumstances here? I guess the hardship would be is that we're having to park the vehicles out in the elements and out for the neighbors to see. You know, it would be more aesthetically pleasing for the neighbors, and it would be more convenient for us if we could have an enclosed garage there. You know, a lot of the housing developments today you have to park inside a garage. I mean, it probably would increase the property values of the houses in the general area. You know, the other option is to put just a garage cover over it, which several of our neighbors have done that. I think you guys mentioned one. Those are not as aesthetically appeasing as what this would be. You know, this will fit in with the house, and it will look like the house was built with it. Okay. Anything else you'd like to add? The only thing that I would add, and I don't know if I touched on it enough, but these properties do run nonlinear to that property line, so that does create that closer setback requirement on that southern end than the north end. If you were having to run flush with that property line, you would be creating that irregular-shaped garage, which would potentially limit the parking of two or potentially three garages in this case.
