december 17th board of county commissioners meeting and would everybody stand for our prayer and then remain standing for the pledge of allegiance please pray with me heavenly father in our hearts we plan our course but we pray that you would establish our steps though this is a busy time of year it is also a season of hope peace and joy with that in mind we place this meeting in your hands we place our hearts and our minds in your hands as well so that you may direct us i pray that as we seek you for advice let us not lean on our own understanding but act based upon your wisdom please guide us lord and i ask this prayer in jesus name amen amen i think we have a presentation mr lebat has a presentation for mr braswell come on come on down the reason why i wanted we're coming here today i'm representing the fraternal order of police of polk county and the reason we're here is i wanted to personally come here on behalf of the fraternal order of police is to thank commissioner braswell as well as the county commissioners as a whole for the proclamation they made for the gold star mother's day event that was hosted by the fraternal order of police in august that event in itself was incredibly incredibly profound and the reality is what these parents look for is that their sons and daughters are just not forgotten what this board of commissioners did ensured that these parents realized that their sons and daughters who were lost in combat they were not forgotten what i'd like to do is if you indulge me i have a short note and i'd like to invite one of the parents up to say a few words because honestly what i have to say is pretty meaningless but what they have to say and how they felt from that event from what this board did is much more meaningful than anything i could say this is from uh uh sue sawyer all right can we just so we catch it on the microphone yeah sorry this is from sue sawyer gold star mother uh she was at our event it's so very important to each and every one of our gold star families that we know that our child's service and ultimately their sacrifice was not in vain but they will always be honored and revered through polk county's proclamation this ceremony showed us that our child is remembered and honored by the people and the state and the officials of polk county that day at the fraternal order of police was lovingly and painstakingly planned for each of our families and they let us know that our loved one is remembered and honored without the efforts of the polk county fraternal order of police commissioner braswell and the entire polk county board of commissioners this event would never have happened with deepest regards and appreciation sue sawyer o'neill gold star mother of sergeant marcus mathis killed in action april 28 2008 and a blue star mother as well to zachary sergeant zachary sawyer morning um my name is ronda smith my son was sergeant keith co he was killed in action april 28 april 27 2010 almost 14 years so this will be 14 christmases that i've had i really appreciate along with all gold star families just that they aren't forgotten because i think of him every single day speak his name tell my grandkids who never met him about their uncle and what he did for our country and and i just want to thank everyone thank you well first of all let me say it was an honor and a privilege to to be part of this um and i believe this is the first time anything like this has been done in polk county uh it was a great event it was well attended commissioner troutman you were there um a lot of people were there i believe there were six gold star families that attended uh all lost sons uh um and and and i think you're right we just need to keep their memory alive uh and and keep them in our hearts and and it's the it's the right thing to do and like i said it was a a great ceremony and i really appreciated uh being there and meeting you guys thank you and this what the fraternal order police what we did is we wanted to present a plaque to the board of commissioners and commissioner braswell in particular because our intent was to try to get a certificate of some sort you know for each gold star family but the board went above and beyond and actually made a proclamation making that day august 24th gold star parents day so i i want to thank commissioner braswell as well as the board of commissioners and this is just a small token a meager token of our appreciation continue on here uh i think we got randy you're up merry christmas everybody of course we're celebrating the birth of christ and i happen to be reading in acts 3 yesterday where peter called jesus jesus the just and uh justice is mentioned more than i think any other term attribute in the bible uh over a thousand times uh god's main attributes are love and justice combined and uh i've been here i guess this is my fourth time and bill i've got a suggestion this time the very first time you said what do i want you guys to do i think there's something very doable that we can do this is the case of leo schofield who has missed about 36 christmases of freedom because of an injustice done and they are you know people do make mistakes uh but i think the unwillingness to deal with our mistakes is a big problem uh this saturday night the 21st at the poke theater gilbert king who wrote the book that well he did the podcast on this murder it's the most it won the ambi award for the best podcast of the year of all the podcasts it has been downloaded over 15 million times around the world number one podcast crime podcast and it's about a lakeland case polk county really there were murders all over the county committed by this one assailant a serial killer that was never really properly brought to justice so anyway this gentleman won a pulitzer prize for another book about four or five black men who were rounded up in lake county and unjustly convicted of a crime they didn't do it that in 1949 well the governor actually exonerated said that's the first thing he was going to do on his first date so i think there's something that you can do as commissioners i talked to the secretary of agriculture when he was here in polk county a couple months ago he's when i told him about this case he said well what would grady what is his position on it so i think if you avail yourself of finding out about this case and then going to grady individually or collectively and asking him to bring it before the secretary of agriculture of florida he could take it to the cabinet and we could see justice done in this case so that's that's the one suggestion i have for you today so thank you for hearing me thank you randy all right consent agenda approved oh sorry excuse me we have uh lakeland i just want to thank everybody first of all for everything that you've done for our neighborhood i know that y'all know who we are because we've been here before um but i do want to thank you for everything that you've done and everything you're doing in the community that's wonderful you deserve the honor for that um the fop is near and dear to my heart too so um but i do have a question i do ask a lot of questions so i'm sure some of the county people have talked to me several times um but my main question today for everybody would be i know that you have a pump plan in place coming to our neighborhood um that you have applied for a couple of grants but where does that leave us in the rebuilding process i can bring up jay on that but you know that's what we have and that's basically it you know and somebody correct me if i'm saying something wrong uh you know at least we're not having a lot of rain right now i think the water level's down but i'm not 100 i haven't been out there lately but uh right now we don't unless somebody says something different i know of we don't have anything else planned other than trying to get some some grants and some uh appropriations we're talking about putting something in permanent so so that's about all i i here comes jay i mean he he might can give us some input on it and i know you probably have talked to him but i do and he's so great he's so nice he patiently puts up with me um but i know that you have a um pump plan in place but it's not for a permanent pump it's just for the line but what are we going to do if the state doesn't approve that where are we at after that that's probably not a good answer right at this moment for that we've talked about it uh we're looking into it and see what we can do you know it's uh it we had an event that was unbelievable that you went through and a lot of other areas in this county did also and uh we're looking at that one because it did affect a lot but i mean there's a lot of areas in this county that got affected the same way you know not as bad but pretty bad and we're looking at a lot of things yes sir and it's uh i i mean i don't have anything right now other than unless jay does unless unless other than we are trying to get some appropriations and trying to get you know grants to help there but other than that we'll have to see what we get there and then move on you know see what we can do well my question would be next is is water still coming in so it hasn't stopped since the storm i'm i'm assuming that it's on a flow in every area yeah um and that's due to wetlands i'm thinking and uh yeah uh good morning for the record jay jarvis roads and drainage director yeah there is still flow coming through the the basin the watershed that comes through there i think it's when we've driven the area the wetlands are still full there's a lot of ponds interconnections and also you've got groundwater seepage coming through because it is you got such a grade difference as far as the height and the elevation difference and stuff i think you've also got some groundwater seepage coming through so i would say it's uh it's probably going to continue for a while uh one of the things um that we have been looking at is you know it doesn't appear that the water levels are rising it's basically staying where it was if not coming down some from evaporation and seepage into the ground of its own so um that's what we've been kind of looking at for now and with regards you and i've spoken several times you know like the commissioner said we've requested appropriations for some funding to look at options uh relative to that and then you know the the fema has some programs that we would also be looking at to try to do some type of permanent long-term option so those are take years to get in place yeah so where does that leave us in that year time i mean you know because the water is still there obviously it's it's still pretty and water is still coming in and even though it's not rising where i'm at you know it has to go through the first pond and then it hits the second and then it hurts the third which would hit the houses um but where does that leave us what does that what do we do what would be our answer right now there's not a good answer other than i mean i i don't have there's not a real good answer we i see this a lot around this county there's there's a and i'm just saying this because i see it a lot there's a lot of places that you know structures have been put in that probably this day and time probably shouldn't have been put in there and to fix it all we can't do that i mean i mean we can't make this uh pope county flood proof but we understand you know what you're going through and what we have planned well we basically what we got planned is we're trying to get appropriations and to do something about this and i we don't have anything else that they're at this time that we're going to do other than hope that the water goes down and that doesn't help you but that's just the cold hard facts about it we don't have a fix all for that right now okay so we just basically wait it out and see keep your fingers crossed that we get something and we we can move forward on something yeah i would like to add that before the storm the water was so high i mean and i know that they're building a lot of new communities and a lot of those communities their drainage is coming to us so it's not just the wetlands and the different things we're having new uh new communities that are exactly they're being built you know and a lot of those are municipalities are doing that and uh but doesn't matter new communities are coming in and it and it you know it's if that's affecting you then yeah it could be but to answer your question we you know where we're at and what we're looking at okay yeah that doesn't give us much hope but you know we're just trying to figure out what to do because you know we have several people that lost everything in the neighborhood i agree so we're just trying to see what we can do to help them and us so all right well thank you so much chairman may i yeah again just a reminder um if anyone was displaced for 30 days or more there is a process to go through where you can get some relief on your property taxes so if you know of anybody that's been displaced the state put that in place so you can find that information on our property appraisers website with marcia fox um i would like to make a suggestion maybe if it would there be an opportunity for us to come in and maybe talk to a representative and they kind of give us all of these details and i mean that that can kind of help our community because we're kind of flying in the dark we're just kind of figuring it out well other than getting with marcia and what i just told you that's pretty much the details okay i mean i don't have any in depth you know we're we're pursuing funds from the state and fema and us you know getting a game plan to come in there and start moving dirt and changing your whole you know or doing whatever in your area that's not there uh we're not at that point so but we'll keep looking and talking about it but that is where we're at we're going to do what i just said about appropriations and try to get something to help you out along just the same as a lot of places in this county and you hit it you hit the nail on the head it was very very very very wet before the storms got here oh yeah and and when you get the rain that we got just i don't know how many years it's been since that's happened they say a long time but it's going to be probably hopefully a long time before it does it again but that's where we're at and we don't have i don't have anything else to really give you other than that and my other concern because jay and i spoke about this is they were talking about building the road but the road build up on the other side of me that's the uh school bus road that they pick up children and there's children that's in the dark on the corner the freeland the road and lewis griffin road waiting on school buses somebody's child gonna get hit and no one wants their child to die before them for something that can be taken care of again we do need lights i understand it's d.o.t problem but it's everybody's problem when you don't have a light at lewis griffin and highway 60 they put a light at kokomo road in 27 and i have never seen too many wrecks happen there so definitely 60 have a wreck every day we need a light there so those cars and vehicles can go down lewis griffin road and be able to get on 60 other than come through a residential community where children are playing thank you for your time thank you here i just moved down here from indiana as a permanent resident my kids were much smarter they came down like five six years ago this is the act with the cold weather uh when they moved down um off of holly hill road behind the public's in the hospital nothing but orange groves it was beautiful orange groves are gone the the amount of growth is unbelievable every time you turn around there's another subdivision going up and with that subdivision comes another one two three cars apartment complexes are going up all over again one two three cars highway 27 i'm told by people who are long residents past me a five or ten minute trip is now a 20 30 40 minute trip down 27 27 is a is a zoo i know you're not going to widen 27 it would cost an enormous amount of money but i i do understand that maybe alternate routes of roads or something are going to be built i've reached out to mrs santiago i didn't get a response to your email but i see you forwarded to mr jarvis i think because i did get a response from him and i did reach out to him and ask him for an appointment what are the what are the plans i mean my kids live in the two subdivisions at holly hill and north people park in their subdivisions to get to the school it's a parking lot it's just a it's a major major parking lot davenport and holly hill was a mess and it's been lessened by the installation of a traffic light which is great but there's no right turn lane so if you're going south or you're going to the east you're fine but if you want to go west to 27 there's no turn lane doesn't make any sense so the first car dictates what the other seven or eight cars want to do same thing on north avenue proceeding west towards 27 from holly hill you did put up a traffic light which was great but there's no right turn lane so if the first car wants to go straight or turn to the south and the six or seven other cars behind them want to go to the north too bad you're going to sit there for four five six minutes i don't understand why you wouldn't put a turn lane in when you put the traffic lights up and i don't know if that's something that can be remedied or or not finally a a question here my kids bought their houses they were told to go to haynes city post office to um get their key for the po box their post office and said you live in davenport here's davenport but they live in haynes city their taxes everything's haynes city but their mailing address is davenport so sometimes they get their mail sometimes they don't get their mail it all depends what address is put down who would i address something like like that to does anybody have an answer to that question because i don't i believe it's the u.s postal service okay i mean other than the u.s postal service i went to them and they said it's out of their hands yeah that's they said we we don't deal with that this is what your deed says that was registered with by the uh closing companies and that's what it says says you live in davenport but they don't the taxes come from haynes city and so sometimes they'll get an envelope that says haynes city and sometimes they'll get an envelope that says davenport and sometimes they don't get their mail at all if i did on the four corners area with osceola county and polk county there are some residents that have had a similar issue but on those they were able to address that with the u.s postal service so i'm not sure maybe asking somebody more senior management at the post office should be able to help you out because it has been an issue in the past okay so there's no one in county government that can change the deed or do what i got to do i mean i guess i called the dispatch for both police departments and they said no they live in haynes city but they have a davenport mailing address i it it's not like they're in unincorporated they live in haynes city they would have a davenport mailing address because they're being serviced by the davenport postal post office so that that's once again goes back to the postal service well we we also have that in the poinciana area so it there are different pockets of areas that for somewhat reason they share the post office or they have different posts kissimi or osceola or whatever or in your case haynes city and davenport so yeah it's an issue throughout the county it is yeah i'll just go back to the post office and figure that out absolutely okay thank you for your thank you just one other comment on that you're for the 9-1-1 addressing just to make sure again from uh kind of your record side of things you may want to follow up on that if you want to call to my office i'd be more than happy to help you out with that i've been in law enforcement for 42 years and i i called non-emergency last night and number h1 is to request the board to approve a contract with the central florida health care organization for the purchase of various medical equipment in connection with their primary mission to provide community health care services to low-income county residents the county's total expense towards these new equipment purchases is not to exceed one million five hundred and fifty three thousand eight hundred eighty two dollars and 99 cents the central florida health care organization is a federally qualified health center providing primary and specialty care dental and behavioral health services throughout polk county central florida health care is contracted with polk county to provide services to low-income polk county residents this specific contract will become effective retroactively from october 1st 2024 through september 30th of 2025 funding provided under this contract will be to reimburse for the purchase of medical dental diagnostic and pharmaceutical equipment for the central florida health care's davenport dundee frostproof haynes city lake wales lakeland mulberry and winterhaven clinic locations replacement equipment or equipment for expanded services includes the need to support pharmacy medicine dispensing efforts auto claves utilization mammogram programs various gynecological surgery and procedural equipment to support the women's health program as well as a wide range of exam tables this funding request was presented to and is endorsed by the citizens healthcare oversight committee funding for this initiative is available in the county's fy 2425 energy health care fund so mr chair members of the board consistent with the board's i think strong commitment to improve community health initiatives i would request that the board approve the proposed contract with the central florida health care organization for the purchase of designated medical equipment in an amount not to exceed one million five hundred and fifty three chair members of the board item number h2 is to request the board approve the third amendment to the existing contract with the winterhaven hospital center for behavioral health for continued behavioral health services these continued services will be provided at a county cost not to exceed one million five hundred seventy six thousand two hundred eighty dollars annually the winterhaven hospital center for behavioral health provides behavioral health services to qualified county residents whose income is at or below 200 of the federal poverty guidelines care is provided via the specialized community care treatment team services include but aren't limited to bio psycho social assessments treatment plan development individual family and group therapy case management psychiatric evaluations and medication management the care team serves individuals in a clinic setting as well as an in-home setting and is comprised of a licensed therapist a master's therapist a case manager and a psychiatrist or and or an advanced practice registered nurse the contract's first amendment increased funding to support the telehealth platform during the code 19 pandemic years the second contract amendment aligned the cost reimbursement structure similar to other behavioral health contracted providers and exercise the option to extend the contract for two one-year renewal terms extending the term through september 30th of 2024 the proposed third amendment extends the contract two additional years through september 30th of 2026 increases the annual funding from a million twenty two thousand six hundred and twenty five dollars to one million five hundred and seventy six thousand two hundred eighty dollars and adds genetic testing as an additional reimbursable service this request was presented to and is recommended for approval by the citizens health care oversight committee funding for this initiative is available in the county's fy 2425 indigent health care fund and will continue to be programmed in future years so mr chair members of the board i think again consistent with the the board's commitment to community health care initiatives i would request the board approve the third amendment to the existing contract with the winter haven hospital center for behavioral health to provide continued behavioral health services as as provided by this uh specialty uh community care treatment team at an annual expense not to exceed one million five hundred and seventy six thousand two hundred eighty dollars move for approval second motion and a second any further discussion all in favor all right opposed motion carries mr chair members of the board item number h3 is to request the board to approve another contract with winter haven hospital center for behavioral health this one in connection with site-based services to those adults with mental health needs the county's total annual expense in support of the winter haven hospital's provision of these designated mental health services is not to exceed 470 000 the winter haven hospital center for behavioral health operates a mental health hub of polk operates the mental health hub of polk county located in winter haven the hub provides site-based services to adults with mental health needs designed to empower participants for success participants can seek services at the hub for education support resources and skills training it provides a safe healthy environment for personal growth including long-term recovery support problem resolution and authentic human connection services eligible for reimbursement under this contract are for adult polk county residents whose income is out or below 200 of the federal poverty guidelines and who are uninsured or underinsured including those polk healthcare plan members services will be provided by a team of qualified mental health clinicians and includes education services support counseling connection to additional behavioral health services case management transportation connections as well as skills training this contract will become effective retroactively beginning october 1 2024 through september 30th of 2026 a two-year term the center for behavioral health will be reimbursed at a rate of 70 per participant per recovery support day this request was presented to and is recommended for approval by the citizens healthcare oversight committee funding for this initiative is available in the fy 2425 indigent healthcare fund and will be continued into future program years so mr chair members of the board here again in keeping with the board's commitment to improved community health initiatives i would request that the board approve the proposed contract with the winter haven hospital center for behavioral health in connection with the provision of site-based services to adults with mental health needs in an amount not to exceed four hundred and seventy thousand dollars annually move for approval second motion in a second any further discussion all in favor aye those motion carries mr chairman make a comment it's just good to see that h1 h2 and h3 so almost 3.5 million dollars that is being used from the oversight committee which is basically the money that's provided by our citizens being poured back into the community for the needs of our citizens so it's good to see this i think it's a it's a good thing for polk county anyone else mr chair members of the board item number h4 is to request the board approve a florida communities trust grant agreement provided through the florida department of environmental protection assigned to polk county this grant agreement represents a one-time state revenue source totaling one million seven hundred seventy five thousand dollars the management of water quality and quantity issues in the upper peace river is a priority for the region and polk county continues to seek ways to address these water quality and flood management challenges in addition to the peace river there are several tributaries that have great influence on the water quality of this overall surface water system the phyllis branch was identified as one tributary where stormwater infrastructure enhancements could have a positive effect on water quality and water management entering the peace river the phyllis branch flows into the lower saddle creek and subsequently joins with the peace creek canal to form the headwaters of the peace river through polk's environmental lands classic initiatives parcels have been identified that could assist in the implementation of a water quality improvement project and provide additional community benefits having identified potential parcels polk submitted a grant application to the florida department of environmental protection as part of the florida communities trust program and has been awarded one million seven hundred seventy five thousand dollars to be used for full fee acquisition of select parcels the identified parcels will provide an opportunity for water quality improvements possible flood mitigation protection of wildlife corridors recreational opportunities and possible regional trail connection and will further assist the implementation of polk's comprehensive plan which aligns well with the florida community trust goals the terms of this grant agreement requires polk county to provide a a match of one million seven hundred seventy five thousand dollars for a total project cost of three million five hundred thousand polk intends to meet that matching fund requirement by using a previously awarded federal grant in the amount of one million nine hundred twenty one thousand seven hundred forty nine dollars which was identified for stormwater initiatives within the peace river corridor funding for this initiative is budgeted in the special revenue grant fund within the fy 2526 adopted five-year parks and natural resources community investment program so mr chair members of the board i think consistent with the board's commitment to environmental preservation and improve water quality across all of polk county i would request the board approve the florida community's trust grant agreement number f 2407 made between the florida department of environmental protection and polk county for receipt of state revenues by way of the reimbursements in connection with any or property acquisitions of approximately 426 acres located along the phyllis branch tributary to the peace river body so moved second motion in a second any further discussion all in favor aye opposed motion carries mr chair members of the board item number h5 is to request the board to approve an infrastructure agreement in connection with the north ridge trail roadway extension project this infrastructure agreement represents a county reimbursement commitment not to exceed one million four hundred and fourteen thousand two hundred and thirty one dollars and eight cents the land development and county engineering staff have concluded negotiations for an infrastructure agreement between d-h-i-c citrus ridge llc the developer and polk county for the design and construction of the north ridge trail roadway from legacy park boulevard to poitras number two road a road segment of approximately one half mile the developer is the owner of certain real property located south of poitras number two road west of us 27 and east of the county right-of-way for the north ridge trail roadway in addition the property is located within the north us 27 select area plan where district a the northeast impact fees are available to pay for costs associated with the design permitting and construction of certain road and access improvements the developer's property is currently being developed with multi-use multi-family and townhome uses that will gain access directly to note to the north ridge trail roadway once completed the developer is willing to design and construct certain non-site related transportation improvements for the extension of the north ridge trail roadway project the total estimated cost of all anticipated roadway improvements is two million two hundred and thirty nine thousand four hundred ninety dollars with no more than one million four hundred and fourteen thousand two hundred thirty one dollars and eight cents to be reimbursed by polk county via a combination of impact fee credits and cash for the actual cost incurred in completing those transportation improvements the remaining eight hundred twenty five thousand two two hundred fifty eight dollars and ninety two cents will be the developer's contribution towards all required roadway improvements this agreement we believe will allow for these improvements to be made more rapidly by the developer and at an anticipated reduced costs polk county does agree to reimburse the developer of those actual costs incurred via a combination of impact fee credits totaling seven hundred and eighty two thousand four hundred dollars and six hundred and thirty one thousand eight hundred and thirty one dollars and eight cents in cash the project cast contribution is budgeted and available in the adopted erosion drainage community investment program budget so mr. chair members of the board consistent with the board's commitments to address improved traffic mobility across all areas of polk county i would request that the board uh approve the proposed infrastructure agreement between dhic uh citrus ridge and polk county in connection with the north ridge trail roadway project uh extension from legacy park boulevard north to its intersection with portress number two road so moved second motion in a second any further discussion i i do mr chairman is there any way that we can add the word road to the northeast trail road it it creates a lot of confusion especially in the northeast area people think it's a recreation trail and i have to explain no it's actually a road is is is is that possible yes ma'am well i if you notice in my narrative i when i use the term you did a roadway because you're right many people have moved in that area thinking it's a two it's a just a paved trail exactly it's a two-lane road but yes ma'am we can do a better job communicating that we could even do it right put it in our documents so when people read it they said they know it's a road it's not a trail just may be glad to thank you anyone else um i would just again as the gentleman smoke spoke earlier this is our efforts to try to alleviate some of that congestion on highway 27 so it's a much needed um project and i commend um the county for looking at this through developer agreements because i do believe it happens faster and for less revenue takes to get it done anyone else okay we have a motion in a second uh all in favor all right those motion carries mr chair final item for the morning uh item h6 is to request the board approve the construction manager at risk guaranteed maximum price addendum number one with wharton smith incorporated in connection with the northeast regional wastewater treatment facility expansion project specifically the phase a dewatering and construction expansion project components board action today will reflect a one-time contract expense not to exceed and this is where i want to call the board's attention to a scrivener's error or a typo that was made uh uh we didn't pick it up until late uh late late friday early saturday initially the board was breached on a 44 million dollar contract it's actually a 41 million 641 133 dollar contract that there was there was a typo area i had reported it as a 44 million 644 thousand one hundred right way yes yes sir it's headed down but um yes sir we haven't been able to correct the agenda i wanted to call it to the clerk's attention this morning and the board's attention stacy so just for clarification it should be 41 million 644 000 133 dollars correct and that is what's reflected in the actual agreement that's in your packet so thank you in december of this uh 2023 the board entered into an agreement number 2023-074 with wharton smith to provide pre-construction construction manager at risk services for the northeast regional wastewater treatment expansion from a 6 million gallon per day facility to a 9 million gallon per day facility initially that we envisioned to be completed in two phases in september of 2024 the board approved an amendment number one to the agreement to adjust the entire expansion project from two phases to a four-phase project to reflect cost efficiencies and what we believe will be good incremental improved plant capacities the created four project phases will be delivered in multiple construction addendums uh each of the of which will be brought back to the board for final board approval pre-construction services for the phase a deep uh a deep bed filter program chlorine contact chambers and the dewatering chemical feed building which includes design and bidding services are now complete and wharton smith has provided the proposed guaranteed maximum price addendum number one in the amount of 41 million 644 thousand 133 dollars the total contract time uh for construction set for all phase a work has been set at 603 calendar days due to what we believe is the rapid growth in the service area the construction of these phase a components will increase plant capacity incrementally while the designs of the guaranteed maximum prices are being completed for the anticipated subsequent construction phases funding for this significant and important project is available in the utilities five-year adopted community investment program so mr chair members of the board i think in keeping with the board's commitment to address utility growth needs across all of polk county i would request that the board approve the guaranteed maximum price addendum number one to agreement number 2023-074 with warden smith in connection with the northeast regional wastewater treatment facility phase a dewatering and construction expansion project requirements in an amount not to exceed forty one million six hundred and forty four thousand one hundred and thirty three dollars i get a question okay great when when this is all said and done what do you think the total price is going to be on this commission braswell i'd be surprised if it's less than 120 million i think we're that that's the ballpark somewhere between 110 120 million it it'll be between 120 and potentially even as high as 150 it's it's going to be a costly project and this i don't know if the i wasn't looking at the screen did you show the service area did it yeah or the first i think the first slide so does this account for i guess you'd say everything that can be built in that service area it is everything that yes yeah this should be it but however if if the area developed or if we ended up taking additional areas or the develop at the area develops at a higher density we are planning for it to eventually go to 12 mgd there are plans just in case but we don't expect to go to 12. this this facility can do that and then yes my other question is haynes city goes all the way up to your doorstep there just about are haynes city utilities providing all that service or do we overlap with haynes city in some of this right now they're doing they're covering their service area we're covering ours i mean sometimes we do have overlap where they ask of us to take their area or we ask to take theirs but right now there's no agreement like that and and and knowing what's coming there it probably wouldn't be a good idea to agree to taking much of anything from anyone correct right yeah right we again you are our master plans uh we account for our area only so we have not considered anything out of our area all right thank you thank you just said one other sorry one other question with respect to going from a two phase to four phase um understandably that gives us better chunks to kind of go to does that extend any or increase any cost uh when we look at the total project costs going from the two to four phase no we don't think it's going to cut we actually think it's going to be make the project more efficient and cost effective perfect thank you anyone else all right i like to say you know with sadness the passing of one of our sheriff's deputy deputy greg maynard um so thoughts and prayers for his family as well as our other law enforcement officers with that loss and then nextly i was um contacted from by the owner of leroy's bike he owns a business that is greatly impacted by the use or lack thereof use of the lois harp park and i would like to know do we have any idea of when this park will be used for recreational be open for recreational use because again without that this gentleman number one cannot recreate there as well as others but he is having a financial impact on his business i see miss gay walking up gay sharp director of parks natural resources you are correct we sympathize with everybody out there um how this impact is we are working with uh roads and drainage on the debris site issue we are looking at possibly being able to open it up for a few days but we're still in the tentative talking moments right now with them but we we hear the pressure we hear the public and we're doing everything we can to try to come up with a tentative schedule as we're moving forward on that part there was some discussion about whether or not it could be open at night when the trucks are not coming in and out of there is that any type of a possibility that's the possibility but remember at night there's no lights so they really can't ride except maybe in an open area you really can't ride the trail itself at night so again i wouldn't want to dark right now that's but but we understand and we're we're trying to we've uh my calendar and michael teats have been discussing every week you know trying to work through this to move forward as soon as we possibly can and it's safe okay thank you sure mr brazil well start with merry christmas oh you're happy just around the corner uh i'm gonna i'm gonna i want to start my shopping in the next few days and knock it out uh a couple of things uh we all went to fac was that last two weeks ago two weeks ago florida association of counties uh interesting uh as always uh but it just always reinforces uh to me how uh good we have it here in polk county when i look at these other counties and how uh discombobulated they are how financially unstable they are in some cases and we're pretty fortunate uh to have that going on my last question is about debris pickup the natives are restless um everybody's getting antsy they want it picked up before christmas we knew it was a hurricane everybody seems to have forgotten that uh they forgot that this county's 2 000 square miles but my question is this um are we we holding the trucks here or are we we starting to lose them again or uh it seems like we've kind of uh started slow picked up pace now we've slowed down again um i don't know who has an answer john you got an answer to that john's uh more on top of the types of trucks uh kind of the arrival of some um in a nutshell i don't think we've lost any we haven't gained as many as i thought we would get given the progress that's being made in the coastal communities but john i mean i know i know saint p all that's still a mess over there every day on the news it doesn't look like they've moved anything over there but i know they have over a million yards just in pinellas county i think yes sir you know and you've heard me say i think it's a matter of assets and resources quite honestly and we we are not our residents have become accustomed to past storms and we just don't have those same resources right now the if you the big doubles that i've spoken about you know in past storms we've had over 100 or right around 100 we've had on average 20 during this storm i think we did get some recent ones last week until we got up to like 25 26 we got a lot of the smaller vehicles so uh the trailers the the pull behind so they just don't they they can't get as much material we do have those debris management sites that are important we have 10 i think we added an 11th one up on dunson road so we're which means they can go shorter trips and then come back you know of course when daylight savings hits those things affect us as well because they can't operate at later hours and longer hours but they're they're running seven days a week um unfortunately it is taking longer and um we we we see what you see and and hear what you hear and um i think it's frustrating for all of us but we're we're absolutely pushing on the on the hauler uh to get more assets in here but we're we're we're competing quite honestly we're competing not just with other counties in florida but other states yeah and i understand that there's north carolina there's there's i mean there's there's a mess all over the southeast um would you say it's fair to say um it's probably going to be closer to february before we get things picked up i think that's realistic the the we did get a 30-day extension on the on the 100 reimbursement the 90-day 100 reimbursement now i think it's february the 10th so i would expect that we could we'll clearly be operating most of january i would imagine yes sir all right thanks appreciate it yeah john let me ask a question you know back in the uh hurricanes years ago uh when could have been ash bright come in i don't know who the contractor was in had the big trucks but everywhere you looked was uh uh small trailers with plywoods on the side and individuals hauling and i is it the contractor not doing that as much or just can't get help i mean you see what i'm saying i mean we had a lot of those everywhere now you don't see hardly any of those and you'll see the the double haulers there are there are some of those i know what you're talking about sort of the more mom and pop type operations there are and they do exist however they have to get certified through that fema process and and some of them just aren't okay don't meet some of them right so yes sir they have back then they didn't have fema that much and now that's i understand now they probably can't get certain well when we first started too we didn't have a monitoring program now you've got a whole separate monitoring program consultant contractor that's that's watching what the hauler is doing because the whole idea is that you're going to get the reimbursement right um at least as much as you can okay all right anybody else for john yeah i know we had requested additional communication i think with the county and that's key uh hopefully our next press release or update if we can include that february 10th or february 20th give them a date so at least they're backing into it because i think we're putting out good information but it's not clear enough there's some ambiguity potentially on when the conclusion date is so at least you know for me out from my residence i still have hurricane debris down the entire street i'm fine with that i know it takes time and i've told all my neighbors like look give us till march first just because i want to err on that side of caution and i certainly appreciate uh the county's efforts in you know doing this timely so we can get that reimbursement from fema and it's a process and to everyone's point you know we are competing for those resources and the certification process through fema i've talked uh spoken to some that wanted to get through that it's a 90-day plus process so you can't you know even if you want to go grab a dump trailer and go help pick up you you aren't going to be able to do that this cycle and help the county so i appreciate that but i think definitely let's make sure we give a a date um for residents to hang their hat on per side yeah i have um well first of all merry christmas to everybody and happy new year we'll see you all next year definitely but i also have a green leaf um issue that is continues to come up that's in reference to the boiling of the water uh for green leaf and i know that that is a privately owned um by mr scott house however it keeps coming up so mr beasley may be um i know tamar was here somewhere maybe she you don't need to come up that's okay but maybe later on we can meet and we can kind of you can kind of explain to me exactly what's going on with this water issue and to see how we can help the the the people in green leaf and i see mr bart out there also maybe we we can talk he's the one duck in his head maybe we can talk about this i really would like to see this resolved one way or the other i just keep getting a lot of emails about boiling water and what's the issue so forth and so forth so maybe we can come to um a solution with this you can add to commission santiago we can set something up quickly good thank you okay that's it only one other item i'll tell the merry christmas and happy new year we get a little bit of a break there uh with respect to storm water design criteria i know the residents are concerned from the flooding that occurred from milton but do realize as a county we are looking and evaluating at some other design criteria that would bolster us in a better scenario moving forward uh to commissioner wilson's point there's nothing we can do to flood proof the entire county but what we are actively looking at is what can we do to make the county better moving forward and so we'll continue that commitment and certainly lend the expertise and uh willpower green or turquoise box this is a county owned parcel that is used for water retention and there is some wetlands to the north of the site the current land use designation of residential and office center is unrealistic as the county has no no desire to develop the site so this change to preservation will memorialize the parcel as a stormwater retention area it will also allow for the facilitation of development of the office center property located to the east as it will change some of the buffering requirements this is a large-scale comprehensive plan amendment that was sent up to florida commerce we received no comments the planning commission has unanimously recommended approval and at this adoption hearing staff is also recommending approval all right uh this is a public educational component to the property therefore the institutional land use designation is necessary this is a small-scale comprehensive plan amendment and this is an adoption hearing your planning by a mine but it was designated as phosphate mining the intent is to continue to use the property for residential purposes so the the land use change would recognize the intent to use this for residential use the planning commission unanimously recommended approval and this is an adoption hearing and staff also recommends approval any further go ahead commissioner how um so this was designated phosphate mining but back in the day imc or whoever didn't ask for it to be designated right so this is this was because now the resident is stuck with was was on clarification from sorry shonda bennett land development division it was part of a mine plan and if it was part of a mine plan in 1991 it got phosphate mining so the mine plan didn't mean the mine owned it right or did they it meant that they were going to mine it if it was a mine plan that mining companies didn't have to own all the land they just had to at least own it or it being a mine plan so it legitimately got phosphate mining right it's just the current that but the mining company didn't purchase it after 1991 and now the current owner wants to change it yeah no i i get all that it's just it seems like an unnecessary burden on the landowner to come through this whole process to get it changed back to something that it was never going to be anyway even though just because imc thought well we're going to mine everything in pole county we changed it all to phosphate you see what i'm saying do you have any idea how much it costs the resident to do this uh i don't remember the fees but somewhere about 25 to 2500 or 3000 yeah i mean personally i just see and i know this happens all the time uh but i was only recently aware of just how much it would cost for someone to come in just to change their land to what it's always going to be you know i think we have somebody in the audience if you want to do you have an are you the land owner no okay yeah no big deal i'm just the the point is it just seems opposite situation where we have a a piece of land that has been used for gypsum stacks and has been a part of a mining operation but during the adoption of the comprehensive plan in 1991 it was designated as agricultural residential rural the request is to change that to phosphate mining to continue to operate as part of the mosaic nichols phosphate mine this is a large-scale comprehensive plan amendment so this is a transmittal hearing your plans planning commission unanimously recommended approval and following any questions or comments staff recommends that you approve the transmittal to the florida department of commerce any further questions ladies and gentlemen this is a public hearing if you wish to speak on this matter please come forward and state your name and operations the site is located near the nickels residential community which was a a mining town that was was set up generations ago for the mining operations the request is to use the land for an industrial purpose to use some of the existing structures that are on the site for an industrial purpose this is very common with land that was previously mined important to note that there is a land development code text amendment that is a companion to this item that will provide additional buffering and use restrictions on the property specifically adjacent to the residential nickels community this is a large-scale comprehensive plan amendment which requires transmittal to florida commerce this is the transmittal hearing your planning commission unanimously recommended approval and following any questions or comments staff is recommending that you approve the transmittal to florida commerce any questions for bent ladies and gentlemen this is a public hearing if you wish to speak 2500 linear feet so almost a half a mile of this enhanced buffer adjacent to the nickels community this will establish a 200 foot wide buffer and specifically limit uses within the buffer zone and add special landscaping to again provide additional enhancements and buffering for those residents this is a land development code text amendment on its first reading so no action is required today and you will hear this at second reading at the adoption hearing of the map amendment in a few months all right we still knew the public hearing ladies and gentlemen this is a public hearing if you wish p1 p2 together yes sir good morning chairman commissioners for the record my name is shauna bennett with the land development division i'll be as mr mink said presenting p1 items p1 and p2 which are ldc pal 2023-13 and ldct 2023-24 it's a comprehensive plan text amendment and land development code text amendment related to the implementation of house bill 1379 and briefly for present for advertising purposes both cases were published in the polk sun on november 27th 2024 house bill 1379 expands and improves water quality protection protection protections with an emphasis on the basin management action plans resource assurance plans and pollution reduction plans a lot of things you hear from tabitha beale through more stringent requirements for septic systems and wastewater treatment the law requires us to do three items three things one is to include within our capital improvements element of our comprehensive plan a list of projects necessary to achieve the pollutant load reductions attributable to the local government as established in the in those basin management action plans and tabitha beale with natural resources provided that with to to us to put in the comprehensive plan and you hear some of that those activities um through what you hear her present on regular basis the second is prohibition of installation of new septic systems within these bmap areas on lots of one acre or less unless it is through an enhanced nutrient reducing system that achieves at least 65 percent nutrient reduction the last item of the bill which is the more difficult one for staff to have achieved within the timeline the state law required was to do a wastewater connection feasibility analysis for developments of 50 units or more with one septic tank per acre and basically basin management action plan or all these other plans i'm mentioning they are plans to restore the water quality of impaired water bodies and they contain strategies and projects to reduce the pollutant loadings from various sources such as wastewater facilities stormwater runoff septic systems and agricultural practices the map that you see on the screen is basically from a data viewer from the florida department environmental protection it just shows the different water bodies in the state of florida that aren't meeting their nutrient load they've got some impairment to them that all the jurisdictions have to pay attention to and the appearance if you will of this house bill 1379 come out of the different federal and state laws regarding clean water etc so i just wanted to give you a little bit of that context so as part of our changes to the conferencing plan that was transmitted in july included adding this map which we're calling a nutrient restoration plan overlay and it basically just displays the basin management action plans the restoration plans uh and the pollution reduction plans in the county the text amendment to the conference plan just i just wanted to show you this as the different elements that it touches the future land use element the critical area worst resource management plan the conservation element infrastructure element capital improvements element and the glossary so the one item that was a concern of the state after we transmitted the text amendment in july involved the analysis of the communities that had 50 more units in them with one septic tank per acre and that's those communities are identified on this map and what we had what we first did with with utilities working with utilities and working with natural resources drainage division we hired um dewberry consultant and helped us analyze these these communities and we had to look at them regardless of utility service area and then the next step is we have to assess how far they are from the nearest wastewater treatment plant and then what's the cost to connect all these communities to that wastewater treatment plant so we had to look in the service areas for lakeland and winter haven and lake wales and bartow and hate city etc but what we couldn't do fully i'm not expecting you to read this but just to give you an idea we had to we actually had to put a table like this into the comp plan we met with dep and they expected us to list all the communities that met that criteria the closest wastewater treatment facility their capacity for that treatment facility and the estimated cost of connection but the next step and so we had to verbalize that in the policies that you see on the screen i'm not expecting you to read that just to give you an idea but what we were not able to do by today but we've told in our policy cr and dep that they've accepted by july when we'll bring to you the revised comprehensive plan for transmittal the next steps which are to get with all the utility providers public or private and ask them about can they connect these communities to their wastewater treatment plants in a 10 year and a 20 year time period that's the next step so certainly staff has to work very closely with utilities and natural resources because this is quite layered project the land development code text just references the the requirement that if you're in what we're calling the nutrient restoration plan overlay all these b map areas that you have to use this enhanced reducing system instead of the standard septic system if you're on an acre or less if you can't connect a sewer so with that i'll stand for any questions on this enhanced is this the one that we're trying at a fire station or whatever um it's you can actually put a meter on it if i don't believe it was too cost prohibitive for the fire station but there is one i believe at the mulberry um the redlands redlands christian academy there in mulberry that we are we're talking about that technology yes it's similar technology i don't know if it's exactly the same but it's it's reducing the nitrogen and it can expand on site if needed yes it's that technology where you instead of using septic it's using aerated it's almost like a little mini wastewater plant for each use well i guess why i'm asking the question what i recall about that is the system was capable of handling more than one home you could handle multiple homes yes the the they make them in different sizes they make it for one home or they make it for a whole subdivision and we are just i guess we're following the state guidance here we're just doing what they're telling us making it available one per one acre or less household is that correct i mean is there any merit in saying hey if you're going to put a subdivision in it's going to have these less than one acres loss why don't you do this big collective system where there's one that services 10 homes or one that services 20 homes would that not be a better idea i'll let you think about it yeah it may certainly environmentally sound like a better idea but i can believe it's going to raise the cost of the site development because now you've got collection distribution piping and so forth well i mean i i guess my thought was the opposite if each person has to buy their own unit it's going to not be cheap and if you have one master unit per 10 or whatever you know i don't know it's just just a thought but i guess right now we're following the state guidance okay i have a question just out of curiosity shana how many areas did you all are inclusive in that table that that we cannot read thank you very much for recognizing that but it looked like from that shot right there a lot of communities a lot of subdivisions there's there's about the table that you saw i think there's about five sheets of those tables that we had to put in the comp plan so i don't have the number but that's a lot um we have a very unique situation than i'd say any other or more than at least three other counties in the state because we are the fourth largest in square miles in the state we have a lot of communities in unincorporated pope county and we have a lot of utility service areas so it's it's we had to work closely with dep we met with dep trying to talk about the layers certainly work utilities is going to have to coordinate with all these utility providers we've been told we even have to coordinate with the private utilities as well in the county so we've got a lot here today it's the county's received a petition from austin evans as authorized representative for ge investments of polk to vacate portions of platted and unmaintained rights away shown the map of ar highfield's addition to the city of crooked lake recorded in plot book 4 page 71 and the plat of stevenson's addition to babson park recorded in plot book 29 pages 28 and 28a the map of ar highfield's was filed in 1920 depicted various rights away throughout the plat that are presumed to be public due to a lack of dedication to the contrary the plat of stevenson's edition filed in 1926 dedicated various rights away throughout the plat to the public the petitioner requested the vacation of portions of kansas avenue and yarnell avenue which are here in the center and across the top to accommodate the development of residential home sites however during a review it was discovered that right away lying to the north which is just north up here and to the east would have left remnant sections of right away and staff is requesting that they be added to the petition the property owners adjacent to the east and north have both been notified one did not respond the other did consent to the request the appropriate county divisions and utility providers were notified and no objections were received staff recommends the board adopt the resolution to vacate the platted rights away shown on ar highfield's edition and stevenson's edition as more fully described in the legal description containing the resolution and i'll remain standing for any questions i also believe the office the next item is a public hearing to consider adoption of an ordinance granting an economic development ad valorem tax exemption for an expansion of an existing polk county business aldi florida llc and to approve a performance agreement with the company aldi plans to invest more than 87 million dollars in the construction operation of an approximately 300 000 square foot cold storage warehouse and distribution facility located off scenic highway south and haynes city the company plans to create 450 new jobs as a result of this expansion at least 10 of which will be full-time paying an average annual wage of 60 000 which is more than 150 115 percent of the county's current average annual wage both the haynes city economic development council and the central florida development council have provided a letter to the county in support of the project based on the board's approved guidelines the project qualifies for a 50 percent reduction in applicable ad valorem taxes for an eight-year period which would run from 2027 through 2034 the property appraiser's report estimates that if the exemption is granted approximately 251 thousand dollars in ad valorem taxes would be lost each year of the eight-year exemption period the county would of course recognize the remaining 50 percent of value as new ad valorem tax revenue during that time and additionally mstu school board and swift mud new tax revenue gained are estimated to be just over 477 000 each year collectively thank you i'll stand for any questions questions when when do we know or do we know when the expansion will start taking place i believe um i have number here 2027 was when they were expecting that yes date of commencement well they put on their application the date of commencement of construction of improvements would be the fourth quarter of 2024 but i'm guessing it's well i'm sorry the 2027 i think martha was when they were expecting it to complete yes the effect that was 2027 when it's completed correct when they're getting an operation that's that's when they right correct when the exemption would begin i um they have on their application that they'll start improvements in the fourth quarter of 2024 so if that's correct i guess next week but um under the ordinance they're not allowed to start any type of construction until this is approved if they want the exemption method of the levy collection and enforcement of non-ad valorem assessments the proposed resolution which must be adopted prior to january 1st of each year satisfies the county's statutory statutory notice requirements for using the uniform method of collection i.e the property tax bill for the imposition of newly imposed or modified non-ad valorem assessments these special assessments cover services such as solid waste fire street lighting road and utility improvements nuisance abatement efforts and other msb use created by the county the adoption of the proposed resolution does not bind the board to create or levy future special assessments but it does put the public on notice that if levied such assessments may be collected on the tax bill collecting non-ad valorem assessments of the tax bill is the most efficient and economical method of collection and if approved following the public hearing the resolution will be sent to the poll county tax collector the poll county
