listened to a gentleman get up and talk about to the budget and the revenue generated from the actual public notice was only like a .006 to the budget which then had me scratching my head and he actually said why why are we wasting our time here right and then I got up and spoke about how it's important that we continue to give our citizens access right and and what I'm hearing is that we here in Polk County and by the way my name is Jim Flagler I am the regional president for the USA State Network so I'm representing the ledger but also the newspapers throughout the state of Florida and I was totally against it because once again I'm here for the citizens of Florida and for our readers because we don't want to not give them access and if it goes on the government website alone based on the reach of the government website I was against just once again not being able to give proper access to the to our readers and citizens since then I heard that you guys are considering or moving towards not only just keeping them in local newspapers but adding them to the government websites which then gives the citizens of Florida more access so if that's the case and that's the road we're heading down I am actually in support of that idea plus and I also shared this the last time I was here by taking the public notices out of the newspaper we kind of break the system because currently now these notices are running in the newspapers it's where our readers have been getting these public notices for decades and they also go to a statewide site called floridapublicnotices.com which is desktop friendly mobile mobile friendly the Florida Press Association has made a monster investment in this technology to give access throughout the state of Florida so once again if it went just on the government website we would it would break that system where the notices will not going on will not go on the statewide site so I'll wrap things up appreciate all you guys do up up there at at your level it does not go unnoticed it's a tough job you guys do a great job thank you and I'm in support if we continue to run the public notices in newspapers as well as the government website discuss why there is still a hearing today July 2nd with the lawsuit group after the meeting on May 31st during a BOCC meeting agenda that all the current places before June 1st 2024 were going to be grandfathered in or discussed there was supposed to be a letter sent out about this when it was ready to be done by Randy Mink and he was going to send it out to everyone once it was done now we are continuing with yet another wasted hearing when they are supposed to be waiting for the county ordinance to be put in place I can't seem to figure out why we are continuing to waste the taxpayers money on something that was supposed to be put on hold until the ordinance was put in place the county has spent $215,000 at the last updated breakdown of cost for the county attorney fees when is this going to stop are we going to put this on hold because the meeting that's going on today with the court was not requested by those in the lawsuit it was requested by the county to continue this okay I feel like there may be a lack of communication in the process of how this is getting resolved after watching the May 31st meeting I was interested to see where this tax break comes from for the fire department for the $268 per property I think that's a great idea with the fires going on out there and everything else this will help give back to the county just a rough estimate there are 1,683 listed zero river ranch properties and $268 taxes charged to each one of them brings the county in $451,000 to give back to this county okay you have another 66 listed under Lightsey Ranch Road that's $17,000 there's another 161 listed under zero Samkeen Road which brings in another $43,000 for a grand total of a half a million dollars $511,880 you guys could bring in between Southside and Northside River Ranch for this county to make a difference the county could benefit from this tax increase and this could potentially help the county bring in more funding when are we going to make this stop and wait for this ordinance to be put in place instead of continuing to waste the money and continuing to waste the time until you guys get the chance to put this ordinance in place thank you Mr. Chairman this is it's no easy matter to solve or resolve it's gone on now for 50 years back when I was a boy it was going on and it's kind of snowballed and there's some concern about it you know even getting bigger and wider if we don't address this it's my understanding and I appreciate your research and maybe you can continue to do some research and find out about other properties out there that are basically paying zero tax and they should be paying school tax they should be paying property tax they should be paying the same thing that everybody else that resides in this county but outside of River Ranch are required to pay and that's a goal of mine and so if you want to work on that and keep refining the numbers I do appreciate it but we'll get to it okay thank you thank No, sir No, it's not Fascinating Thank you Take care Mr. Beasley Mine will be a little bit more fascinating Mr. Chairman of the board Good morning The manager's office will have three items for board consideration this morning Item number H1 is to request the board approve a construction contract with Mid-South Incorporated out of Bushnell, Florida in connection with the Decent Road Lift Station and Force Main Improvements Project This proposed contract will be a one-time capital expense not to exceed $2,307,365.50 Today's board action will include an amendment to the Polk County Utility Division's Community Investment Program and a transfer from available reserves in the amount of $250,000 Polk County has completed the public solicitation process seeking qualified contractors to construct a new lift station manhole and add approximately 10,700 lineal feet of forced main piping and 275 feet of gravity main piping along Decent Road Briarwood Estates has an existing agreement with the county to abandon their failing wastewater treatment facility and replace their private collection system In exchange Polk County will construct a lift station and accompanying forced main to connect those wastewater discharges into the county's collection and treatment system Bid number 24-279 was issued and six contractors submitted bids The lowest responsive bid was submitted by Mid-South in the amount of $2,197,491.50 The recommendation of award was issued and no protests were received in accordance with resolution number 13066 $109,874 is included in the proposed contract award to address contingency and work allowance conditions Contract time for this project has been set at 300 calendar days for final completion This project was initially budgeted at $2,411,250 after addressing design, engineering and right-of-way acquisition anticipated capital operating expenses estimated all at $353,884.50 The project available balance totals $2,057,365.50 Therefore community investment program amendment is required totaling $250,000 This project is partially funded through the federal government's American Rescue Plan program funded through the United States Department of Treasury in the amount of $1,500,000 upon approval of the budget transfer from available utility reserves sufficient construction funding will be available to complete this project So Mr. Chair and members of the board in the interest of providing public wastewater utility availability to those residents along the western end of Deason Road I would request the board approve a construction contract with Mid-South incorporated in the total amount of $2,307,365.50 to include an amendment to the utility division's community investment program and a transfer from the utility division's expansion fund reserves in the amount of $250,000 all of which is in connection with bid number 24-279 Move approval Second Got a motion and a second for approval Any questions? Yeah Mr. Chair members of the board item number H2 is to request the board approve subcontract amendment number 13 between the ounce of prevention fund of Florida and Polk County in connection with the provision of healthy families Polk services for fiscal year 2024 2025 this action will reflect receipt of one time state revenues totaling $1,585,843 dollars and 75 cents with a local Polk contribution totaling $400,000 in December of 1998 Polk County approved the initial contract to partner with the Ounce of Prevention Fund of Florida Healthy Families Florida to support Healthy Families Polk which is a home visitation program that promotes positive parenting self-sufficiency healthy child development and prevents poor childhood outcomes such as abuse and neglect due to the 26 year success of the program Polk Healthy Families continues to receive annual funding from the Healthy Families Florida Ounce of Prevention Fund Amendment Number 13 will renew and amend the Ounce of Prevention Fund of Florida contract retroactively beginning beginning July 1 2022 through June 30 2025 Ounce of Prevention Fund of Florida Healthy Families Florida will provide one-time non-reoccurring funds in totaling $139,290.75 in addition to the base funding of $1,446,553 Polk County via Healthy Families Polk will provide and maintain a minimum of $361,638 or about a 25% cash contribution match. Currently, Polk's cash match is $400,000 which exceeds the minimum in order to contribute to the funding of the salary plan implemented by the State of Florida in FY22-23. Funding for this longstanding state partnership is included within the county's special revenue grant fund. So, Mr. Chair, members of the board, in order to maintain this longstanding relationship with the State of Florida and to strive for positive healthy child development within Polk County, I would request the board approve amendment number 13 between the ounce of prevention fund of Florida and Polk County for the provisions of healthy family Polk County services. Mr. Chair, members of the board, the final item from the manager's office this morning, item number H3, is to request the board approve a lease agreement between Ruthven's Business Park 2 LLC and Polk County, all in connection with the Polk County Sheriff's Office and the county commission's joint use warehouse storage needs. This is an initiative that will have a first year annual expense estimated at $236,000 and actually four cents. The Lawrence W. Crowe Jr. building located at 455 North Broadway Avenue in Bartow was constructed in 1960 and has outlived its useful life. It is in need of repair and environmental remediations that are cost prohibitive. All administrative functions have been relocated to other facilities and its current use is to support climate controlled storage for the sheriff's charity program items. Due to the growth that has occurred within Polk County and the additional growth expected to continue to occur, the county anticipates that the 10th Judicial District will expand along with the county administrative area needs. The county is moving forward with a five-year community investment program to construct a new sally port to maintain the sheriff's inmate transfer operations which includes the demolition of the existing Lawrence W. Crowe building expected to start within the coming months. For cost efficiency and to accommodate the planned demolition schedule, the county seeks to lease warehouse space to accommodate the sheriff's storage needs as well as the county's needs, especially during natural disaster recovery periods until a county joint-use-wide warehouse facility can be constructed. County staff, along with representatives from the Polk County Sheriff's Office, have reviewed multiple warehouse properties and a facility was identified which could accommodate the intended storage needs of the sheriff and the county. The property located at 315 Drainfield Road in Lakeland consists of five bays containing a total of approximately 16,000 square foot of dock-high climate controlled warehouse space. The owner of the property has presented a proposed lease agreement for the rental of the space for an initial term of three years commencing August 1, 2024, with an option for two consecutive one-year renewals. The first year's monthly rental rate totals $19,666.67 and reflects a base rental fee along with planned capital upgrades, common area maintenance fees and applicable taxes and insurance fees. Only the base fee will increase by 4% each year through the term, including any renewal periods. The county attorney's office, the real estate services administrator, and the Polk County Sheriff's Office have reviewed the proposed lease agreement and collectively recommend approval. Funds assigned to the Sheriff's Office general fund will be budgeted over the next three years to accommodate first-year annual payments totaling $236,000.04, the second year annual payments totaling $242,559.96, and a third year annual payments totaling $249,382.44. So, Mr. Chair, members of the board, in the interest of developing an interim solution to the long-term strategy of a joint-use storage warehouse between the Polk County Sheriff's Office and the Board of County Commissioners, I would request the board approve the proposed facility lease agreement to reflect a three-year annual average lease payment of approximately $242,600. And just to mention as that was brought up at the very beginning in the public comment section on the consent agenda there's actually another item that was adopted by the board that requires and has directed staff to both publish online and in the newspaper under that resolution. So although this is allowing us to publish in lieu of the newspaper we do have that resolution at this time that is directing staff to publish on both and it is recommended for approval. Because the resolution is a this ordinance is basically a catch-all for all the ordinances resolutions that require publication. What this ordinance basically is doing is one is basically saying that the notice that is published online is the controlling notice for hearings and purposes in case there's a difference and also it I guess only it would allow it only just basically runs with the public accessible website that that's the controlling but ultimately the resolution is direction to staff so staff has to follow that direction of the board to publish both online and on the website I mean in the newspaper Does this apply to the constitutionals also? No no this would be optional right they can join on or whatever it was My question to the clerk but it's how will this affect if any your operation requirement that you have numerous obligations for public notice and variety of things how does this affect your operation? This particular ordinance that you are passing does not control or deal with the clerk's requirements and so the clerk follows statute as far as whatever statute has for those publication notices there is a current statute that does allow for online publications in addition to but not in lieu of actually I think the law allows for in lieu of if I remember right correct Randy because that's why you all are passing this ordinance the ordinance at the higher level to allow for it if you'd like and then you have a resolution that is directing staff how you want staff to do it this ordinance only controls our ordinances it's kind of a catch all so we don't have to go back and amend all our ordinances and resolutions and we can do that over time as they come forth and I guess we need to point out this also doesn't apply to our land development code that's a separate matter that will be coming to the board but it wouldn't control anything that's required under statute are they a higher hierarchy that have higher standing that require publication that somehow these items that under our jurisdiction are lesser hierarchy that can be not published and only on the web are some notices more important than others that's my question go ahead Randy for the county you got the budget and if you read the statute it actually says it has to be published in a newspaper so our interpretation of those statutes and there's several statutes that actually says published in a newspaper of general circulation one or two weeks those we would still I think that still is required although they had passed this other statute those are required so budget may be one of them that you talk about the hierarchy that's something that's very important that has to be published in both the newspaper from our position from our interpretation everything is going to be both available on the web online as well as print publications for the county stuff yes sir but for constitutionals if they have courts they have certain things that they notice that will be based on whatever the statute says some of them say published in a newspaper of general circulations some of them say published in accordance with chapter 50 which that makes a reference to the publicly assessed website so you actually have to look each statute where's the economy if we're doing both what's part of the motivation for the economy of not paying well for the county the economy is neutral at this point for other for the courts and stuff they will have a choice whether or not they want to publish online or in the newspaper so it's not for Polk County based on the board's direction we're going to be publishing on both so there is no savings at this time other than there is savings I need to correct that based on our agreement with the son the son has agreed as part of this our agreement that they will publish those notices that are not required free of charge so there is savings by us working with the son on this if in the future the ownership changes of the son or their business practice changes then that would revisit this currently we have a five year agreement at the end of that term presented by Deputy County Attorney Miss Sandy Howard morning Sandy Howard for the County Attorney's Office this is a public hearing to consider adoption of an ordinance granting an economic development ad valorem tax exemption for an expansion of an existing Polk County business Public Supermarkets Inc and to approve a performance agreement with the company Publix plans to invest more than 47 million dollars in the construction and operation of its corporate headquarters office location at 1936 George Jenkins Boulevard in Lakeland land this location is within a federally designated opportunity zone where new investments in the economically distressed area may be eligible for preferential tax treatment in addition to its purchase of the land the company will invest approximately 218 million dollars in construction costs and equipment purchasing while also retaining current jobs in Polk County the company plans to create 10 new full-time jobs as a result of the expansion the new jobs will pay an average annual wage of $59,326 which is 115 percent of the county's current average annual wage both the Lakeland Economic Development Council and the Central Florida Economic Development Council have provided a letter to the county in support of the project based on the board's approved guidelines the project qualifies for a 50 percent reduction in applicable ad valorem taxes for a seven-year period running from 2026 through 2032 the property appraisers report estimates that if the exemption is granted approximately $137,300 in ad valorem taxes will be lost each year of the seven-year exemption period the county would recognize the remaining 50 percent of value as new ad valorem tax revenue during that time additionally MSTU school board and swift mud new tax revenues are estimated to be just under $265,000 collectively the item does require a public hearing and thank you I'll stand for any questions any questions I know three of you stood up and took the development code to implement standards for plumbing fixtures and appliances as well as irrigation systems the water star program is a collaborative effort with the southwest Florida water management district as well as the building community this amendment has been discussed at length with with both agencies and a number of cities across the county have adopted the ordinance this ordinance is continuing effort for water conservation efforts throughout the county the planning commission recommended approval unanimously and this is your second hearing and following any public comments or homeowners that are fortunate enough to buy a home built to Florida water star standards because they're going to realize the savings on their water bill for many many years to come it's one of the tools that we have to work collectively to address increased demand for water with unprecedented growth that we're all facing and the challenges that come with that because it provides some some relief of the pressure on the upper floor and which is our source of water our primary source of water so I would just tell you that you're joining 14 municipalities in Polk that have already implemented this and in my mind this kind of brings it full circle and provides consistency for builders countywide so that they're building to the same standards wherever they're wherever they're constructing so I thank you in advance and looking for favorable adoption thanks thank you we're all about saving water I do have a question go ahead Ben let me ask you this question if this is passed and this it's a standard then every every new facility will have to have this in it or is that not correct what I'm saying if I'm building a house on a piece of property myself I have to put this in this is the standard is across the board that is correct that is correct and the way we have we have constructed it or have written it is that it will be a voluntary certification that the development community will do so this will not be something that that our staff will be inspecting it'll be an affidavit that is submitted to the building permit to the building division during permitted but it is a standard for irrigation systems and for plumbing fixtures during construction I want to point out that on the plumbing fixtures we can only control what happens during construction if a homeowner purchases another fixture and does you know swaps out their their washer and dryer or swaps out an appliance a dishwasher we can't control that and that's not built into the ordinance so this is at the time of construction for the fixtures but it's also at the time of construction and alterations for the irrigation systems so during the time that I'm just say building my house I can choose what I want because you're not gonna you're not going to come and inspect it we will require an affidavit by by a builder or a and what if it is a irrigation standpoint what if what if they did I'll defer to mr. done on the building okay Benjamin done for the building division building director so essentially we would hold the certificate of occupancy if we were to find out that that did not occur we
