welcome everybody to the planning and zoning board meeting for the city of plantation on september 1st 2026 can we please call the roll miss gelfand mr joseph goldstein mr b burger here mr corman here mr freeman here mr max goldstein here mr de la grange thank you all right first order of business today is the approval of meeting minutes from august 18 2026 does anybody have any corrections or amendments to the minutes seeing none do i have a motion motion to approve there's a motion a second please call the roll mr joseph goldstein miss denby burger yes mr corman yes mr freeman yes mr max goldstein yes mr de la grange miss gelfand thank you all right first order of business public hearing pp26-0020 consideration of a request to approve a code text amendment to allow an inline donation center in various zoning districts the proposed zoning districts are b-1p b-2l b-2p b-3p m-fcc and i-lp staff if you would good evening board members city attorney city clerk michael albert and term director this is an application from an applicant to propose an amendment to the code the applicant is goodwill industries of south florida inc and they are proposing to allow a donation center as a conditional use in various districts staff finds it periodically necessary to amend the code of ordinances in order to update and or add regulations and procedures to implement municipal goals and objectives staff finds that the code lacks sufficient standards concerning the location of donation center uses and seeks to provide sufficient maintenance and oversight of these uses to maintain the aesthetic appearance of the city so this draft ordinance is addresses amending several sections of our land development regulations including an exhibit a in your backup 2711 is adding a definition for the use exhibit b is updating the master business list table to show where these would be allowed and in what districts and then exhibit c for a few specific use regulations for this proposed use so the exhibits are in your backup but here we're basically showing the definition before the definition after in order to place it correctly in the ordinance but the definition for a donation center and it's a little hard to read but showing the entire table so we're basically looking at allowing this as a conditional use in six districts four of which are straight commercial one is a mixed-use district in the gateway and one is our one of our industrial districts and so also again in your backup some of the regulations for this type of use are proposed here and just to show you where these are here's a map of the city showing the locations of all those four said districts most of them are located along brower boulevard and sunrise boulevard in commercial areas there's a couple near cleary boulevard flamingo and sunrise section over there and then flamingo right at the city's border with with i-595 and then in the east it's it's called the uh mixed-use fcc which is the four corners um designation so that would be all for corners of that intersection of state road 7 and brower boulevard for example where the new publix was installed on the northeast corner there's shopping center on the other corner there's a wawa um in that southwest corner and then there's a range of buildings in that southeast corner so those are the locations of where this would be permitted if this amendment were adopted so um staff feels that to summarize that this indoor donation center as a conditional use in those districts would preserve the essential character of the neighborhoods and it's consistent with the general plan aligns with aesthetics and maintains cohesive and visually appealing environment with respect to signage in general would not be a detriment to adjoining properties and in harmony with the general character it's not out of scale and complements the architectural style because it'll be part of an existing building as far as the standards for reviewing a text amendment we feel that it meets all the stated criteria and generally the use would be compatible with the surrounding development pattern as an inline donation center and that is it is compliant with um policy 1.8.1 and 1.8.3 of our existing comprehensive plan future land use element so therefore staff recommends approval and the applicant is here also to uh answer any questions you may have does anybody have any questions of staff before we we'll just go left to right vicky hold on that then max i just have one i'll be really quick just a quick question for staff is there a reason that we're not including the rest of the gateway district or the midtown district in this update or the midtown district right um generally this use is not a standard use for a mixed use environment in terms of um its appeal and for so for example they did um initially ask to include midtown in here staff felt there there's with having a variety of districts that it wasn't necessarily needed for the midtown district okay and in gateway it's the same situation yes okay one of the prohibited items that's not allowed at the donation center is furniture okay so like often times you walk into a goodwill store they have furniture their chairs small couches and stuff so why is that uh prohibited uh specific use regulations yes please uh just in general a lot of the bulky items sometimes they're left outside sometimes it becomes a mess um it's just generally to make sure everything is kept inside um but i mean that can certainly be discussed but so this is a donation center it's not a store where okay i understand thank you yes uh just want to confirm it it's permissive not i mean it's conditional right so people would have to come back in with you know in case we start getting too many donation sites and the other question i had was the in the definition um of the donation center and i know goodwill probably doesn't have any intention of doing this under subsection d where it talks about sale or resale one concern that i would have potentially is we get a charity who's doing this and wants to just give it away right they've got too much stuff they don't think it's for sale can we come up with some language maybe there just so they can't just be giving it away and having people come and i don't know if i'm being too technical but i just thought that i could see a religious organization setting up one of these and or wholesalers or something like that who then sell it to ebay people or stuff so anyway that that's my one request that you either explain that what's to prevent someone from doing that or maybe change to that to include like outdoor display and or sale or distribution or whatever well the the keyword is outdoor so we're talking about basically a donation center that would be part of a shopping center or warehouse or whatever it might be um so the intent is to not have outdoor no but in i i but in the in it i'm looking at i thought you said the definition yeah the definition i like right because under the actual there's like four points of what a donation center is it's it's um d okay which is a little awkward and or or but putting that aside but d says everything is prohibited there yes yeah but it doesn't say to give it away you know i that's my but that would be under display i would imagine yeah put it outside and you're going to give it away that would be prohibited then maybe change it to indoor i don't know display i don't anyway like i said it might be being too technical i just didn't want to have a place down the road that's i i would interpret display to include also giving it away or donation so the the point is to not have it outside the store okay yeah okay is that something you i mean if you're comfortable you know okay yeah yeah and oftentimes actually there is an ability for any property owner to submit for a special event application so for different outdoor sales and so forth that that can be accommodated but that's a different process okay josh did you have anything thanks ariel you're good thank you go ahead yes um i i looked at all the the there's like seven different areas if you could go back to that map um and as i'm looking at them i'm seeing the corner of sunrise and pine island sunrise and university sunrise and knob hill and a little bit further east on sunrise boulevard yes are those the shopping centers that you're talking about like the one on sunrise on pine island where um land lovers is that one of those shopping centers yes so those are all um the law all the ones on sunrise either have a b2p a b2l a b1p sorry a b3p or um i lp which is industrial so the ilp the very where where sunrise bends that's industrial so that would be a warehouse situation the others the others are retail shopping centers the others that have those commercial designations are primarily shopping centers i think there's one that has office buildings in it um on sunrise and pine island on the east side um so it's not likely that that would be a donation center but so we're basically looking at the zoning district and some of them happen to not necessarily have a shopping center in them does it say how large these each one is how large how many square feet of the donation center the donation centers there was actually in the the applicant's letter in the backup and they can also address that yeah the exemplar was like 1100 square feet ish what i'm sorry about 1100 square feet that's generally the typical retail bay okay well i do have a question i don't know if it would be either would answer it or the um applicant is there going to be a sign up saying goodwill and what's going to stop people from coming over and saying oh god i really like that piece of furniture i saw it in the window what's to stop the people that are there from selling it to them okay that's more of a question for the applicant okay hold on that because i had a couple first staff okay um just to verify in line is part of the definition here does that just mean in the front door out the back door it means it's part of an existing shopping center it means this in line you remember about a year ago we had a text amendment where we're talking about the donation trailer that was a completely separate not a building it was a completely different mobile structure um so that's the opposite of what we're talking about here got it um all right i'll hold it until the end um does the applicant want to make a presentation or at least answer some questions good evening board members andrew shine with bills and summary representing the applicant i also have nicholas noto uh with bills and representing the applicant as well um yes i i do have a presentation it's mostly duplicative i'm happy to make it if you would like uh but also happy to uh answer the questions that have been posed as well or any additional questions unless there's something extraordinary to be added to what was there then i'd say we're probably nothing extraordinary to add um i i would like to address some of the questions that have been asked um for the the prohibiting the sale i will say i can't speak to other donation centers that may come in goodwill doesn't have their donation centers don't have the infrastructure for selling anything it's all just taken in um and then again going out the back door but to mr goldstein's point and that point um if i could proffer a a simplification that answers both of those um and that would be instead of outdoor display under d just say the display and or sale of merchandise is prohibited um that that that satisfies both indoor and outdoor so i would proffer that if you guys would want to make that change um and that's really it the these are all in shopping centers um the reason that we don't do uh couches and furniture those are done at the more at the the larger goodwill retailers uh these stores are between 1100 and 1500 these storefronts are between 1100 and 1500 square feet they just can't fit all of those those bulky items um so goodwill doesn't accept those at these locations um okay so the shopping center on pine island and sunrise boulevard is that the one where landlumbers is and um okay uh where are they going to be doing the drop-off in the front door or the back door so we don't have any location two minutes from there so i know what the shopping center is all about i want to know where are you going to be doing drop-off funny enough in my presentation i have a similar map and i called out jacaranda square specifically as landlippers on there because i used to go there a lot when i came back home from school um we don't have a location for this there's no location picked out so the answer is depends on where the location is different shopping centers some have loading bays in the back some don't uh it truly depends on the shopping center and i think when goodwill or any other folks come in to actually put forward a conditional use that's when details like that would be worked out we don't have any use any location picked out right now okay so um if i open my garage door now you'd see a lot of stuff that i would love to donate um so i'm going to go to a goodwill center and there's going to be a door and the front door is going to be open for me to walk in and drop off things and then they'll give me a tax receipt if i want it and then i leave so there's not going to be any sales there's not going to be any cash there's not going to be any venmo nothing and the employees there are going to take it in and that's it that is it and you have plans to open how many uh there's no no plans right now in plantation there was a a plan to open one um the throughout this process though that lease they it was at least the space was leased to somebody else ideally i would think one maybe two in plantation there are about a dozen throughout broward county and another couple uh one or two dozen in miami-dade so this is an ought this is uh a tested operation already um but one maybe two in plantation the goal is not to inundate you know a city with with donation centers it's to put them in strategic places so that people who do want to donate don't have to drive 30 minutes in order to do it because that you know it takes them go to my garage i don't care don't die okay thank you for your uh any other questions anything specific you'd like to make note at this point no additions any comments from the gallery all right public comments are closed there do i have a motion i'm going to make the motion to recommend approval of the item with the edit of uh definitely the definition of the use letter d uh removing the word outdoor uh making the edit that the applicant recommended of changing the the written letter d of the definition of the use to go from outdoor display to just display removing the word outdoor i'll second i'll second that yep go ahead i'd ask staff does that raise a concern i know i'm the one to raise the issue but that might imply indoor display right according to him it was both like literally the applicant i didn't know the applicant but this is going to be a definition in our code and i just want to make sure that staff would be do you want just that's all i just want to hear i think it would be inclusive we would interpret that as being inclusive displays display whether it's indoor or outdoor now do i have a second i'll second i have a motion and a second please call the roll mr joseph goldstein yes yes miss denby burger yes mr corman yes mr freeman yes mr max goldstein yes mr delagrange thank you thank you miss miss gelfand thank you sorry all right uh the next item is quasi-judicial yes sir this is a quasi-judicial item i'm going to ask that the members of the audience and public um bear with me while i go over the procedure uh the board is here to hear the application that's on the agenda pm 260027 consideration request to approve practical difficulty waiver for carlofic resident property located at one two three zero zero northwest 12th street and in its own rs1p residential single family estate uh the board is not authorized to change the city's code only the city council is authorized to do that decisions from this board for approval require minimum of four votes of the members of the board short of that four votes that this item will not be approved these hearings are quasi-judicial that means that all evidence and testimony will be under oath and we will swear in all witnesses who may speak tonight at the conclusion of my remarks the order of business tonight will be the city will make the presentation the applicant will have the opportunity to present whatever information testimony they have and then the board chair will open it up to the members of the public who wish to speak and then the item will be closed and decided here tonight the board may have the ability to ask any questions of either the city or the applicant all witnesses shall be subject to cross-examination if you choose not to answer any questions that testimony you provide will will not be considered for the record um the board will decision will be delineated in a written order uh based on the decision of the board tonight the board also has the authority to continue a matter to a designated time to allow for additional research or review with that being said if you plan on speaking on this item please stand and raise your right hand you swear up front and testimony it will be the truth the whole truth and nothing but the truth mr chairman thank you and just to verify the zoning is rs1 ep rs1p and i just want to verify okay residential state hi good evening everyone my name is amy denter i'm one of the city planners and i will be making the presentation this evening so as we know this is a practical difficulty waiver this is the location of the property one two three zero zero northwest toll street and it is zoned for rs1 ep it is a single family home and the subject site is developed with a one-story three thousand four hundred seventy square foot single-family residence with a two-car garage and a swimming pool the surrounding properties are all rs1 ep and there is one other property next to it to the west and then you have south flamingo road i'm sorry north flamingo road they are asking for a side yard setback reduction so in our code we have um the pool deck or patio and their side setbacks should be 25 feet from the property line they're asking to reduce the side setbacks from 25 feet to 15 feet on each side and that is a 40 reduction and this is to accommodate a 60 by 117 foot tennis court so this is the survey of the property you can see i've outlined the home and then they have um their swimming pool directly up against the house and then they have a fairly large backyard this is their site plan so you can see where the house is in conjunction with the proposed tennis court with the 15 foot setbacks what staff is proposing is that they change the orientation of the tennis court from east to west to north to south in this location they wouldn't have to ask for a waiver it would fit in on the site and they'd still be able to keep the size of 60 by 117 feet so the analysis we're saying that the request is substantial at a 40 percent reduction and it is not meeting the code the approval of the practical difficulty waiver would not be compatible with development patterns as you can see in the report that we uploaded there was one other property that had a tennis court it was like 645 or i can't remember exactly the feet but they also had a much larger lot and they were meeting setbacks the essential character of the neighborhood would be preserved and the request can be approved without causing substantial detriment to the adjoining properties the request is not due to unique circumstances of the property in conclusion staff does recommend denial all right um does anybody have any questions for staff at this point uh in that case then we'll let the applicant make their presentation and then we'll handle all questions as they come up so staff or apkin if you would when you approach if you just give us your name address and that you understand the rules alciona karlovich one two three can you hear me say it one more time alciona karlovich one two three zero zero northwest 12th street plantation florida three three three two three hello i am i am evo karlovich one two three zero zero northwest off street jason wilson pillar consultants engineer record for the project uh five two three zero south university drive davey florida three three three two eight woody hilaire general contractor of wh builders helping the clients here five five zero zero pine terrace plantation florida all right so whichever one of you would like to make the presentation and fill us in on your side of the story please help yourselves okay hi um so we we wanted a tennis court on our property um my husband he was a professional tennis player he always he moved to the acres because you know of the land space and he just wants a tennis court it's just that simple and we have the land space so we we just wanted to do the tennis court and and we wanted east to west because we plan on doing additions to the house which wouldn't interfere with the plans if we did it north to south oh okay okay so we we looked at the plan that they currently had um in the staff report it also mentions the possibility of not just rotating it but maybe reducing it in size but due to the ex pros nature i think a full size court is really what he needs for the for the site um in the end of the staff report there is a series of letters from the neighbors in support of this and there's an additional one that just came in this evening from a fourth neighbor who is a direct neighbor of of the applicant when we process this project through the plantation acres improvement district they noted during the survey that the this is right here that the the site was actually a lot higher than what it was supposed to be this was not due to the applicant they bought the the lot that way it was already naturally high or somebody had filled it previously so what we did was we compromised and not normally we have tennis courts in the 50 low area but we designed it in such a way and i believe the drainage plan is in your packet but we designed it so that it becomes part of the stormwater feature which also leads to why it's actually orientated this way opposed to in the north-south condition and then finally in the in the staff report which was very thorough and great they mentioned that they looked at one other uh property that had um a tennis court nearby about 600 feet away and that had met the 25 foot setback here we're requesting a variance or a waiver of 15 out of the full 25. however on multiple streets i have a list of addresses we have we have tennis courts that are merely six feet to eight feet away from the property lines and these were only took me two minutes to find there's many instances probably i would say about three percent of the homes have tennis courts that are not only not in the backyard but visible within six feet from the front property line and i know that doesn't set precedent but it's something to be considered one last thing is a contractor one who's done the work done several projects in plantation acres and understanding the process of going through a variance and understanding at the end what the city would like to achieve and turning it north-south just as the engineer record mentioned where that would be the simplest but as in communication with the homeowners and knowing not just their current plans but things that they want to do down the line where i'm in consultation and communication where there's always additional things that homeowners are looking forward to doing in their property where there are things that the city may be looking at now but they're not taking into account other things that may be coming down the line that i know with building multiple different projects in the acres there's certain setbacks that definitely won't allow where if we do turn this north south the additions modifying the pool those definitely won't fly or they won't fit and now we've solved one problem to now create three other problems and then we're back in here trying to request variance on other things that are way more difficult to achieve than one that we've already worked out with the plantation acres improvement district to make sure that this design matches the drainage requirements which is a very big requirement in plantation acres to now if we do turn it north-south it still has to go back to plantation acres improvement district where they now may say it doesn't work with the drainage requirements the city may be okay but now the drainage doesn't work and there are other things to consider beyond just the north-south orientation and that's the only thing i wanted to mention all right sorry just one final thing um if we do get a positive recommendation this evening we've read through the conditions that staff would put on it and we agree with all of them i appreciate your time thank you are there any questions from the dais for other applicant or staff i do um you've lived you've lived how long have you lived in your home over 10 years or something like that how come you never built one before if he's a former where do you play tennis now i am uh if you would i was used to um atp uh uh player and my and my highest ranking was uh uh 14 in the world and i was always uh uh traveling so so i was not here and then when when when when it was covered you know then i kind of was uh able to create more of an image how i would like my home to be with a with a with a tennis court and then in the last two years we've been um waiting on um on these applications and uh uh rules so yeah here we are do you also teach tennis no no so you're not planning on opening a tennis school in your backyard no no no no no no i would like to you know uh i would like to have it that uh at my home so i can train with my kids okay that's it and putting it in the other direction in the backyard is nothing you wanted to do that would eliminate a swimming pool then yeah it would eliminate that and also even though east west isn't ideal but uh um on this yard it's uh what uh what uh makes more um uh sense okay thank you thank you question about the drainage so if you you're you're saying drainage is an issue but if you build it this way you're then going to add more uh property to the structure so that would also affect drainage i think i understand yeah with the the orientation it is now this is the most efficient for the overall drainage of the area especially once everything gets built down if we were to twist it sideways the drop off from the back of the pool where it currently exists their small pool it would be very steep i mean not steeper than four to one but it would be pretty well a drop off immediately down to the the lower deck level of this proposed tennis court again leading to why we wanted to rotate it so we had a more gradual backyard before it gets down to that low area i think her question so at the back of their yard that back area is the lowest point in the yard and the way that this tennis court is designed is basically to sit very level at that lowest point if we turn it horizontally or vertically the other direction that actually starts at a higher elevation just think you're working downhill and now you have to play at a tennis court try to make that not downhill we actually have to cut into the the earth and now have to have a steep slope or drop off in front of the tennis court not only is it aesthetically not pleasing but i know doing things in paid what they would require is then to actually mound up and accommodate and adjust for that um area that he's losing so from the drainage standpoint it's something that makes it a little bit more complicated which is separate than the setback limitations that are in our opinion it may be a bit easier to do it this way then and all the engineering that he's done to make sure it works at the back of the drainage rather than turning it for the sake of that little bit of space they were getting and i know like i said also i think what she mentioned about the it's not that they would lose the current swimming pool it's more of what they want to add it would have to move the swimming pool and once you move that now that swimming pool either wouldn't fit or you couldn't have it and that's the it's the additional issue of that so hopefully i answered your question just just to be clear there's only one application before you tonight it's just the tennis court so all this future potential maybe we're going to we're planning we're working with people that's good information but it's really not relevant to the decision for purposes of the evidence because there's really no evidence of any of that other stuff other than what they're saying any other i guess for staff is is approval by paid a condition precedent to coming and asking for this waiver yes it's a condition for the permit approval yeah i didn't see anything in the backup relative to pay so do they i don't understand what you know in theory their process is for deciding what what they choose to when they choose to waive their own rules but i find it like a little bit concerning that i hear constantly from acres residents how we have to maintain the character of the neighborhood and how we have to have these large estate homes but then every time an individual homeowner wants to wants an exemption from them they seem to approve those so i just i'm having a hard time balancing those those things and i didn't see any letter from from paid in the backup so i just wanted to ask okay i think in the um applicator i'm sorry in the permit application itself there was a paid stamp so they don't necessarily provide a letter they just provide a stamp on the plans that they've approved it i also have one just housekeeping measure for staff um this item we are actually approving or denying this practical difficulty waiver right this is a recommendation that goes forward to city council this is it correct okay thank you i i i i had the same thought about other because i've been in the acres a lot running and exercising and seen a lot of tennis courts um and so i'd like staff to comment on that how many variances or do we know within the acres completely have tennis courts that are also less than 25 feet so our department historian is miss selk and she says not much and she's been here since 2004 we haven't had a case of a setback uh waiver for a tennis court and the other thing despite uh i'd like to hear from the applicant you've been there 10 years you're talking about you know expanding the house what is your current intention or what is your current plans as to what you want to do with the rest of the property like the city attorney said that's not relevant necessarily it's it's it's background information but it it's it's really not an issue for the variants because that may or may not happen and we have a case right here right now that needs to get decided so well i think i think because i've asked her to say what her current intents are and the thing that concerns me the most is is section e right that it's got to be you know the strict requirement of the code unnecessarily burdensome and quite frankly because you'd prefer to have extra space you know besides it being substantial as staff said it's it's much more inconvenienced than burdensome but at least like to give you whether we can legally consider at least like to hear you say it under oath what is your present intention as to the expansion of uh the you know the property the house or a separate especially considering you know you've been there 10 years and you haven't done that yeah um i was there but uh i was always uh on the tour so that's why i was not able to actually do it but uh i would like to add a new pool which will which will be in front of the house and also i would like to uh do uh uh additions on the house extra living room extra uh bedrooms and and i know you said earlier i mean usually tennis courts are going to be east to west because of the sun i mean it's going to be brutal in the morning and in the afternoon you know if you do this that way but you're a professional tennis player then you know that yeah okay thank you true uh okay so i got a couple questions here what is the actual standard size of a tennis court because you mentioned that this one's a little bit bigger due to the professional nature of the applicant shorter 60 by 120. so this one's actually shorter yeah then okay um is this house on septic or sewer where's the tank and where's the leach field relative to what we're looking at right up there the septic the septic tank is in the front of the house okay um do you see that yeah do you see where the house number is yes all right um now a question for staff when the uh setback code that you put up there it said pool deck or patio yeah tennis court was not on that list no so are tennis courts governed under this particular paragraph they count as a patio correct is that how it works yes that's how we are interpreting it so we don't have anything in our code specifically for tennis courts but because it's like a paved area that you could put tables on and if you want to grill we count it as that okay cool that answers my questions um any other questions comments any comments from the gallery any last things anybody wants to say before i close comments public comments are closed oh sorry josh if if we were to deny this and they were to bring back a more comprehensive plan that had the renovations could they ask for the same setback or would that be prohibited because it was in the same it was already been denied you can if you do deny it you can put that as part of the order that way we can get around that part of it because it's it'll be a different plan it'll be a different variance at that point anyway so i think they would be able to but you want to make that clear for the record as well if that's what your intention would be all all being said and considered does anybody have a motion i'm going to move to approve subject to the conditions found in section 5b of backup i'll second i'll second that all right we have a motion in a second please call the roll i'm sorry who's the second okay mr joseph goldstein uh no no miss demby burger no mr corman no mr freeman no mr max goldstein yes mr dela grange miss gelfand thank you all right uh now question considering the motion was to approve but it was denied that mean we can we still put in place advice to if they in essence can they reapply with you can make another motion and reflect those comments so that it's part of the the actual order that will be written um whatever those comments may be um with the motion so the item won't be approved but it will be denied with whatever would that be a new motion or yeah it'll be a new motion does anybody want to do that do you want sure i'd move to um let the record show that the the board would be open to considering a slightly different setback or even the same setback as part of a larger plan um that would show why there would be an undue burden on the resident on the homeowner do i have a second for that is it so you're you're you're saying you're you're recommending that this be denied in its current form with the uh ability for them to come back prior to 365 days um subject to them bringing a more comprehensive plan for the property so that you can evaluate their requests a little bit better correct that that's what and i'll go second to that can i ask the question of the applicant though because i'm just curious like how soon do you plan to make those other improvements to the property the extra swimming pool is that within a calendar year do you plan on doing that well we were speaking with the contractor to do but we wanted to do the tennis court first um but this is within this year we want to start it right away the tennis court and then within the next two years to start on the the project okay but the motion was within a year right no to have a plan within a year okay well the code the code generally states that if you are denied a variance you can't reapply for the same variance within a year so that's where the year comes in so the motion then is to allow them to to do that as well if they if they choose to okay and i just want to point out one thing also we had an item before us three months ago for a pool deck that was installed now if they didn't come for a variant and we made them remove that so for a setback issue same issue for just about three months ago so i just wanted to point that out to you guys that it's it's not that we don't want you to take advantage of your property but we're trying to be consistent uh and and and we did that recently so i encourage you to come back with a full plan show us that how about that thought okay because we had a motion in a second we still need to take the vote on that amended second yeah right there and then he had a question or did you not okay fine then i seconded it so we have a motion in a second all right mr joseph goldstein yes miss denby burger yes mr corman yes mr freeman yes mr max goldstein yes mr de la grange yes miss gelfand thank you all right so the bottom line is while this particular variance was denied it's opened up the potential for you to come back to us within a year with different plans that are more holistically driven and then we will rehear the issue so any other business before us um no other than the next meeting is october 6th perfect in that case then meeting is adjourned today okay
