anderson here council member andrew here council member fadgen here council member horland here council member reinstein here mayor sortle here city attorney here thank you very much good evening miss otaniana good evening mayor council president council member city attorney as well anna otaniano city of plantation finance director welcome to the city of plantation forest public budget hearing for the fiscal year 2027 budget before i get into the presentation i need to read some information into record about the identifying the rollback rates uh the proposed rates and the increase above the rollback rate the city of plantation fiscal year 2027 proposed budget is based on the general fund operating millage of 5.7 mills this is an increase of 3.87 percent from the rollback millage rate of 5.4878 mills the voter debt millage rate for fiscal year 27 is 0.2637 mills this is the military required to fund the voter approved debt the plantation gateway development district fiscal year 2027 proposed budget is based on the operating millage of 0.9707 mills this is an increase of 4.55 percent from the rollback millage rate of 1.6364 mills the plantation midtown development district fiscal year 2027 proposed budget is based on the operating millage of 0.9707 mills this is an increase of 2.54 percent from the rollback millage rate of 0.9467 mills the city of plantation aggregate fiscal year 2027 proposed budget is based on the aggregate millage of 5.9258 mills this is an increase of 3.90 from the aggregate rollback rate uh millage rate of 5.7031 mills okay what do we do the fiscal year 2027 proposed budget for all funds is approximately 311 million dollars this is an increase of 4.8 percent for 14.3 million dollars the significant changes are in the general fund which decreased 4.5 percent or 7.5 million dollars additionally capital project funds decreased 12.5 percent or 315 000 increases were seen in the enterprise funds across all enterprise funds water wastewater increased 18.3 percent storm water increased 58.8 percent and plantation preserve increased 45.9 percent the increases and increases across all of these funds were primarily in the area of capital projects and capital uh equipment i will go through all of these as i go through the regular slides this is just the overview starting with the general fund the general fund proposed budget is based on a proposed millage of 5.7 mills property values in the city of plantation increased 5.7 percent according to the broward county property appraiser the increased millage or the increased property values and the proposed millage will generate approximately 85 million dollars additional revenues over the previous fiscal year is approximately 3.95 million dollars of this 3.9 million dollars 26 percent or 1 million and 30 000 is related to uh new construction the proposed millage of 5.7 mills requires a two-thirds vote or four votes from council so in the past we we've come in and we've shown you what the impact of that how that was going to look for certain uh areas in in the city of plantation we tried to do it where we cover most areas um i typically tend to focus on the as an example on the history uh the historical plantation uh so starting with the historical plantation first column is the neighborhood the second column is fiscal year 26 save our home values uh and then the the next column over is the taxes for fiscal year 2026. so historical plantation homeowner in fiscal year 26 had a save our home value of 223 710 reducing that by homestead exemption and additional homestead exemption the uh the uh the millage rate the uh the millage rate of 5.7 mills the uh the millage rate of 5.7 mills generated a property tax bill of 986 dollars and three cents for fiscal year 27 the property in the historical plantation is now save our home value is 229 750 dollars again taking out the homestead exemption and additional homestead exemption this uh property value um will generate a uh property tax of 1016 dollars and 53 cents and that's at the proposed millage rate of 5.7 mills the uh annual increase for this particular property will be 30 dollars and 50 cents or two dollars and fifty cents uh 54 cents monthly now again we like to do it across the whole city so looking at lauderdale west they will see an increase of 12 dollars and 13 cents annually one dollar and one cent annually all the way down to plantation acres who will see a 78 dollar 99 cents increase annually or six dollars and 58 cents monthly now during as when the um when the trim notices go out to the residents we tend to get a lot of calls they ask why are our property taxes going up and they tend to think that the total tax bill is actually coming to the city so we we explain to them we only get a portion of the taxes so again i took the um the trim notice for the historical plantation homeowner to just kind of so people can tie it back in and understand where the numbers are coming from so at the top of this uh slide here on the left hand side it says your property value last year and it has columns for the county school board municipality and independent on the right side it has your property value this year again for the county school board municipal and independent so if you look back at last year the assessed save our home value under municipality for the homeowner and historical plantation was 223 710 dollars taking out the homestead and the additional homestead taxable value on this property is 172 988 dollars this was last year as fiscal year 26 this times the millage rate of 5.7 which was the adopted rate last year generated a property tax bill of 986 dollars and three cents which are these are the numbers that i had explained on the previous slide looking at the right side the proposed uh property value uh property millage rate is 5.7 mils the property value for the save our home assessed value for this particular fiscal year 27 is now 229 750 dollars so it went from 223 710 up to 229 750 this 229 750 less the additional the homestead and the additional homestead brings this taxable value to 178 339 so again it's more than it was in the previous year this new taxable property value now multiplied by the 5.7 proposed military will generate the 1016 dollars and 53 cents the other entities on there have similar millage rates where they take your taxable value and you multiply all of their rates to come up with the total tax bill so looking at that a little closer so people have less information to look at every dollar property tax uh 33.74 percent goes to the broward county school board 28.76 percent goes to the city of plantation 26.56 percent goes to broward county and the rest goes to the north broward hospital district children's services council south florida water management district and the florida inland navigation district as well in the maximum millage meeting i was asked to bring back what the rollback rate would look like and the impact of the rollback rate so the imp the rollback rate for fiscal year 27 is 5.4878 mills this rollback rate and the property value increases will generate approximately 81 million dollars 82 million dollars comparing that to the proposed millage rate of 5.7 mills we would lose approximately 3.2 million dollars in ad valorem revenue the pro the add the rollback rate requires a majority vote which is three votes from council so like the regularly having an impact i wanted to show what is the impact of the rollback rate on the residents so again using historical plantation same save our home values only now we're using the rollback rate the historical plantation homeowner will save approximately 28.83 annually or two dollars and forty cents monthly and again looking at lauderdale west two dollars and 89 cents savings annually 24 cents monthly and plantation acres the ladder of the of the slide 73 and three cents in savings annually and six dollars and nine cents monthly so moving on to the general fund revenues general fund revenues increased 7.5 million over fiscal year 2026 as you can see from the slide our largest our largest source of revenue is ad valorem revenues coming in at 85 million dollars ad valorem revenues increased 4.9 percent or three thousand three million nine hundred and fifty two thousand this is the increase in property values the next category over utility service taxes increased 5.2 percent or five hundred and ten thousand this increase is directly related to florida power and light increasing their rates franchise fees category increase 2.7 percent or two hundred and ninety four thousand again this category uh increase is partially due to fpl franchise fees for electricity so again fpl increasing the rates and then also uh due to increase in this franchise fees for solid waste the license permits and special assessments category increased 7.1 percent or one hundred and eighty five thousand the increase here is directly related to uh engineering fee uh engineering revenue projections for fiscal year 27. into governmental this category increased 3.9 percent or seven hundred and seven thousand increase in here is due to the increase in sales tax half cent sales tax we also have um a hundred and eleven thousand in there which we received a grant which is passed through revenue we received a grant for community paramedic paramedic which is in this category we also um have um we also have a hundred thousand in uh cst which is the communications service taxes as well the um charges for services category increased 8.9 percent or 1.9 million dollars again we have some past true revenues in here in here we have approximately 650 000 in solid waste pickup and recycle revenue that we we collect for waste management so we collect it it goes in here and then it goes out you'll see it going out on on the expense side um also in here we have um 650 000 increase related to ambulance revenues and 250 000 related to special detail the fines and forfeiture category increase 59.9 or 429 000 the increase here 352 000 of the increase here is related to the red speed program 50 000 is related to court county court criminal fines and 25 000 related to code enforcement the miscellaneous category saw an increase of 1.6 percent or 38 39 000 increase here is related to the uh city's investment portfolio and interest earnings general fund expenditures general fund expenditures actually decreased 7.5 million dollars um the decrease is primarily in the capital outlay which i will get to in just a second personnel services um so in the maximum millage meeting i came in and i said we had five uh full-time positions that were being added and one part-time after the maximum millage meeting administration actually put a freeze on hiring freeze and they took away a majority of those positions we do have two positions that are still being added one is a grant fully funded position which is the community paramedic and the other is the assistant director in the parks and recreation which is actually being funded by the position that this person is leaving so it's not fully funded but it's partially funded the increases in the category after that are related to increases for general employees increases for iaff and fop based on their negotiated contracts and then also some increases in medical costs the operating costs increased 3.5 or 1.1 million dollars the increase here is directly related to the increase of cost of goods and services i've said this many times that inflation has come down but the cost of goods and services is not coming down with it capital outlay decreased 66 000 or 66.9 but i want to mention so when we cut the position in personnel we had a savings of 348 000 those monies were put in capital they were actually put over onto the paving so when we came in in max millage that number was the capital outlay was actually a smaller number by 348 000. so when we cut the positions on the personnel side those monies were moved over to paving so paving now in max millage it was a million now it's a million 348 000 so you can see where the money went um as i said we had 66.9 decrease or 16.7 million dollars this decrease is not related to a decrease in capital requests it's actually due to the fact that we didn't have money to cover any more requests we actually cut about 11 million in capital during the budget process so this is what is left after what was cut the grants and aids category increased 22.4 percent or 494 000. increase here is directly related to the city's tax increment payment to the cra tiff and that's related to the increase of property values debt service uh general fund only has one debt service it is the debt service related to the uh the police motorola dispatch center it uh is actually a 28 in that's the cpi increase that's baked into the contract the contract states that every year the the payment will increase by cpi so that actual increase is related to that so we talk about personnel we talk about operations and we talk about capital those are our biggest uh items these are the items but we don't we talk about how much it is i like to kind of go into okay this is where it's going so you know the total cost but how is it being spent so looking at personnel costs 115 million is the total category as you can see from the slide uh public safety is the largest uh cost in personnel costs coming in at 73.2 million dollars so under public safety we have police fire and fire rescue the other categories okay i'll start over to the left uh technology information technology we kind of put them by themselves because they're a very unique department so information technology of this 115 million 3.8 million is related to information technology public works we've got five departments on there here we have public works central service crafts central services facility maintenance landscaping and resource recovery all of those together have a combined total of 11.2 million dollars general government funds the departments that's everybody who's not in any of those other categories so that will be administration finance city clerk procurement engineering planning and zoning library museum all of those are in this grouping and that's a total of 13 million dollars parks and recreation again this is five departments parks recreation tennis aquatics and equestrian total 13.8 million so moving on to the operating costs same category same same groupings uh only this time the the largest cost is kind of shifting around this time it's with public works so of the 31.7 million in operating costs 11.1 million is related to public works again that's five departments under there 7.4 million related to public safety 7.1 general government 3.9 parks and recreation and 2.2 information technology capital costs same thing you can see from the slide parks and recreation is the winner in this category um coming in at 3.4 million for capital items uh information technology 1.9 million public works 1.9 million public safety 1.1 million and then general government 10 000. so digging a little deeper into the capital to give you an idea what they're buying police department has approximately 600 000 in capital items of which 431 500 is related to marked and more unmarked police vehicles and equipment 109 000 is related to police specialty equipment and 24 000 is related to a new canine fire and fire rescue departments capital items is approximately 500 000 uh they have 191 000 in miscellaneous life-saving equipment they have less stretchers aeds life-saving equipment they also have 100 000 in here for the design of a training tower um a fire training tower 90 000 for a skid steer and 68 000 for an extraction response equipment public works capital items total approximately 1.9 million of that 1.9 million 1.3 million is related to road repaving and maintenance 300 000 related to sidewalk and swale tree improvements 150 000 related to the citywide ac system maintenance program and then 68 500 for mowers and blowers information technology 1.9 million of that 1.9 million their biggest item is the 1.6 million for the erp this is the new erp that we are currently in the process of implementing in the finance uh area next will after that will be human resources so 1.6 million for fiscal year 27 they also have 143 000 for visualization subscription 36 000 37 000 for an acela upgrade and then 75 000 for network file management software and 75 000 for network servers and devices parks and recreation as i said 3.4 million of which 400 000 is related to playground equipment units 335 000 for shade structures for playgrounds for bleachers 300 000 related to playground safety surfacing and then 100 000 relating to fencing continuing on with parks parks they also have a dugout replacement for 415 000 sports courts resurfacing for 185 000 75 000 for exterior exercise equipment 300 000 for parking lot and walkway resurfacing and then some 243 000 approximately for community center upgrades there is uh some upgrade to the weight room in the central park and then uh a new kitchen for the gym ward moving on to gateway the gateway budget proposed budget is based on a proposed millage of 1.7108 mils property values in the gateway district increased 20.11 percent according to the broward county property appraiser the increase in property values in the proposed millage rate will generate approximately 1 million 13 000 additional revenues over the previous fiscal years approximately 163 000 of this 163 000 80.7 or 131 000 is related to new construction the proposed millage of 1.7108 mils requires a two-thirds vote or four votes from council again during the maximum millage um i was asked to bring back what would a rate of 1.5100 look like that's a reduction from the proposed rate that would look like 893 886 that would that's what would be generated at this rate at the current uh increase in property values estimated loss revenue comparing this proposed rate versus the actual proposed rate is approximately 119 000. now this 1.5100 is actually lower than the rollback rate so i brought you back the rollback rate as well because we wouldn't want we wouldn't recommend going below a rollback rate so i brought you what a rollback rate would look like as well so the reduction of millage at the rollback rate which is 1.6364 revenues that would be generated at this rate are 969 000 and estimated loss revenue compared to what we're actually proposing is around 44 000 moving on to the midtown district the midtown district proposed budget is based on a proposed millage of 0.9707 mils property values in the midtown district increase 5.42 percent according to the broward county property appraiser at the increased property values in the proposed rate we will get approximately 2.3 million dollars which will give us an additional revenue of 79 171 of this 79 000 81.3 percent or 64.3 thousand is related to new construction the proposed millage rate of 0.9707 mills requires a two-thirds vote or four votes from council again during the max millage i was asked if i could reduce bring back what the reduction of the millage uh the proposed millage reducing it by three percent reducing it by three percent would bring us to a reduced mileage of 0.9662 mills 0.9662 mills would generate approximately 2.3 million dollars in ad valorem revenues and that would be a reduction of approximately 11 000 compared to the rate that we're actually proposing the 1.9 or the 0.9707 mills so looking at the midtown development district budget it's got a total budget of 10.2 million dollars this is an increase of 0.8 percent or 80 682 the 80 000 increase is directly in the operations and it's in the area of r&m maintenance contract for the lprs the license plate readers the 10.2 million dollars includes a capital budget of 7.9 million the 7.9 million is spread along all of these projects we have the new river greenway project the plantation midtown bridge improvements the multimodal transportation plan northwest southwest 84th avenue design and improvements the perimeter road improvements pedestrian and vehicle connectivity cleary boulevard drainage improvements and the southwest 78th avenue realignment moving on to special revenue funds we're approximately nine uh special revenue funds in this category which totals 20.9 million dollars this is an increase of 9.0 or 1.7 million dollars over the previous fiscal year amended budget the increases are in the area of the cra and the building fund so the cra which is the community redevelopment agency increased 24.2 percent or 1.2 million the increases in the catalytic investment which is the uh incentive program that we have for business trying to bring businesses into the cra the building fund increased 5.1 percent of 429 000 the increases in the areas of salary wages and employee benefits r&m maintenance contract and cost allocation moving on to debt service funds uh we have two types of debt service we have a non-advalorum debt service and an advalorum debt service the total debt service for both of them is 4.2 million which is a decrease of 0.2 percent or seven thousand five hundred and ninety four dollars the non-advalorum debt service totals 318 000 this is a decrease of 2.2 percent or seven thousand and ninety four dollars the decreases in interest expense the advalorum debt service which is the debt service related to the advalorum bond this is supported by a voted debt millage rate which for fiscal year 27 is 0.2637 mils the total uh advalorum debt service for fiscal year 27 is 3.9 million this is a 0.01 percent or 500 decrease again the decrease is in interest expense moving on to capital project funds like debt service funds capital projects has two types of funds they have a non-advalorum capital projects and advalorum capital projects non-advalorum capital projects total approximately 873 000 this is an increase of 3.5 over the previous fiscal year or approximately 30 000 the increase is related to uh capital projects we have the green mills senior housing heightened pedestrian crossing sunrise and 441 improvements lighting at the bus shelters and pedestrian amenities the actual capital totals 861 000 the difference uh there is there are some costs in operations related to bank fees the advalorum bond capital projects uh total approximately 1.3 million this is a decrease of 20.4 percent or 345 000 compared to the previous fiscal year amended budget this decrease is due to the the progress being made in the bond projects we at the moment for fiscal year 27 we have two projects we have the pop traverse restroom and the central park multi-purpose business multi-purpose building improvements the pop traverse project is substantially complete it's not fully complete it's almost there any money is left over if any from this particular project will be moved over to the central park multi-purpose building improvements moving on to utilities or to the enterprise funds we have three enterprise funds we have the utility funds we have to preserve golf course and we have the stormwater fund utilities is the largest by far of the category making up 86.8 percent of the category the total budget across all utilities is 98.7 million this is an increase of 18.3 percent or 15.3 million dollars when compared to the fiscal year 26 amended budget the increase is primarily in capital but it's also in can be seen in operations for um and in the personnel so personnel costs for utilities are approximately 20.6 million this is an increase of 15.9 percent or 2.8 million the increase is related to the addition of four full-time positions one assistant director one field maintenance superintendent one utility department assistant customer service manager and one assistant budget and contracts manager it also includes the reclass of one utility service worker to an inventory clerk and three percent increases for current staff continuing on with utilities their operating budget across all utility phones is approximately 22.9 million dollars this is an increase of 7.4 percent or 1.6 million the increases in the engineering fees and waste disposal fees the capital budget is approximately 47.7 million this is an increase of 29.5 percent or 10.9 million as i said the majority of the increases here capital projects are spread among four funds 6.8 million in utilities operating and maintenance funds 29.1 million in utility repair and replacement fund and then 11.8 million across the utility water capacity and the wastewater capacity fund moving on to the preserve golf course uh the preserve golf course makes up about 8.9 percent of the enterprise category total budget for fiscal year 27 is 10.2 million this is an increase of 45.9 percent or 3.2 million the increase here again most of it's in capital but is also in operations as well the operating budget for fiscal year 27 is approximately 6.1 million this is an increase of 5.4 percent or 313 000 the increases in outside service fees bank fees tools on the threshold rentals and cost allocation the capital budget is 4.1 million which is an increase of 244 percent or 2.9 million the increase is directly related to the clubhouse renovation which is 2 million dollars and then the bridges and bulkhead project 959 000 the stormwater utility fund is 4.3 percent of the enterprise category the stormwater utility fund which was established in 2013 is supported by a non-ad valorem assessment the proposed rate for the non-ad valorem assessment for fiscal year 27 is nine dollars per eru per month or 108 dollars per eru per year that's an increase from four dollars and 56 cents per year you per month or 54.74 per year you per year during the fiscal year in june 2026 council approved the recommendation of moving from a flat rate residential assessment methodology to a five-tier structure we have as i said five tiers tier one is for anything less than 2500 square feet tier two is twenty five hundred and one square feet to five thousand square feet tier three five thousand and one square feet to seven thousand five hundred square feet tier four seventy five hundred and one to ten thousand square feet and then tier five greater than ten thousand square feet the stormwater utility budget for fiscal year 27 is approximately 4.9 million this is an increase of 58.8 percent or 1.8 million the increase is in several areas it's in your personnel operating and capital personnel budget is a total of 1.9 million this is an increase of 6.5 percent or 122 000 the increase is related to increases for employees and payroll increase in payroll allocations operating budget total is 892 000 approximately this is an increase of 14.1 percent or 110 000 the increases in the areas of communication supplies uniforms permit fees r&m vehicles debris removal and fuel stormwater continue the capital budget for the stormwater fund is two as approximately two million this is an increase of 370.6 percent or 1.6 million this 2 million encompasses four projects the citywide waterway restoration plan basin tree drainage improvements basin 2 drainage improvements and the plantation park roadway drainage improvement so that covers the total budget all the departments so the recommendations for council this evening are to adopt the tentative millage rates the city of plantation proposed millage rate of 5.7 000 mills requires four votes from council the gateway development district proposed millage rate of 1.7108 mills requires four votes from council the midtown development district proposed millage rate of 0.9707 mills requires four votes from council and then the voter debt millage rate of 0.2637 mills requires three votes from council in addition to the millage rates we are recommending that you adopt a fiscal year 2027 tentative budgets for the city of plantation the gateway development district the midtown development district and the community redevelopment agency coming up next we have the final hearing to adopt a non-advalorem stormwater assessment rate which is on monday september 14 i repeat that that's on monday september 14 at 6 p.m in city council chambers the second public budget hearing to adopt the millage rates and final budgets is scheduled for wednesday september 16 uh 20 26 5 30 p.m in city council chambers and happy to answer any questions thank you very much i'll turn to council and then we'll take public comments and then we'll go through through each of those legislative items okay council member fadgen it looks like you buzzed in first thank you very much thank you welcome very thorough presentation as always i appreciate everyone's uh efforts to pull the budget together and come up with a thoughtful budget that's um focused on serving our residents efficiently and and responsibly and being good stewards of our city resources um i kind of went into a lot of detail on this at the max millage meeting but i'm going to go over some of these things again you know um regarding the operating millage starting fiscal year uh 21 the revenue increased 3.9 followed by 4.6 followed by 9.7 followed by 9.7 followed by 9.3 5.5 and then 3 this year gateway it when uh starting fiscal year 21 the revenue went up 9.4 4 followed by 6.8 followed by 6.8 followed by 28.9 followed by 6.5 followed by 4.2 followed by a reduction in revenue last year of negative 2.6 because we voted for a uh reduction in the millage to give some relief to the people that have been long time investors in the gateway district and then we have a 19 point percent uh well 20.11 off your uh slides so i'm assuming that that's because the public's is included in in this one or is the public's not on the yeah is the public's in there yeah yeah yeah okay so that's really what's driving that correct yeah okay and that that's great that's an example of what's going on in that district and uh a lot of good things are happening midtown one point starting fiscal year 21 1.6 percent 1.4 percent 14 16 14 14 and 1 3 um that's indication that you know our job is to facilitate that our property our residential homeowners our commercial properties our businesses are creating this wonderful vibrant community and that that's what's driving our revenue increases um so to remake my request that i made at the max millage meeting i would like to um have the uh gateway millage reduced so that um i'm sorry what is the uh year over year i lost my notes are you looking for the rate for the gateway uh millage uh revenue increase 19 percent or 20 percent i i would like to reduce that millage to get it down to a five percent increase that's that's going to reward the people that have been there a very long time hanging in there while we finally got these this thing rolling and now the property base is a lot higher and we can still um have a hefty amount of revenue from that in order to uh come through midtown i would like to uh target that three percent that i mentioned at the max millage and then for the operating millage i would like a um i would like a full rollback a revenue neutral and i said this at the max millage meeting that the um this is what tallahassee's talking about maintaining the millage year over year over year is not giving relief to the taxpayer the property tax owners taxpayers and uh you know i've i've every year that i've been sitting up here i've always proposed a reduction in the millage it's the first year i'm requesting a rollback and my target has always been two to four percent year over year to be in line with cpi so i think it's way overdue we don't know what's going to happen with amendment three i think that it would be in our interest to show tallahassee if we have to request um appropriations from them we don't know if they're going to help backfill our budgets that's not defined as council member horland told us at the last uh at the last meeting um and i'm just gonna make you know i listen intently to my colleagues on the council um when they make their comments and i try to understand and i and i did a little research and one of the comments was it's very difficult to raise the millage so i don't agree with that i looked up the millage um for the last 25 years actually i looked it up for the last 28 years and in the last 25 years the millage has been raised 11 times it's been lowered three times since it's been kept the same um 11 times and if you go back 28 years it's been raised 14 times lowered three times and kept the same 11 times so if we decide to do the rollback as i'm requesting and i think it's well overdue um we can change course next year and raise it if necessary for whatever reason whether amendment three doesn't pass and we determine that there's a need that we need to increase the revenue or if amendment three does pass and we we need we have a determination that we need to increase i think it would be wise to start this process that might be coming before us um so i believe that's all i really want to say i kind of went into this in great detail at the max millage meeting i believe it's time um and i humbly request support from my colleagues thank you thank you councilmember fashion so you know we we do listen intently to one another and we disagree on this i'm going to take your last comment um and start with that first so when i stated that it is more difficult to raise the village rate that is because the state legislature passed legislation that now requires municipalities to have a super majority to raise that millage rate so the discussions that i'm hearing at florida league of cities at the florida chiefs association some of those especially those fiscally strained um counties and municipalities are saying we'll have no choice but to raise our millage rate if amendment three goes goes through so i think that i understand your intent um and i appreciate it and trying to bring some relief to the businesses um i fully support and i know mr conklin's been asking for it for years um going with the rollback rate in the uh gateway district um we can talk about midtown and perhaps the reduction there but i think that and i said this during the millage rate hearing with amendment three looming in november i think it would be fiscally irresponsible for us to cut 3.2 million dollars out of a budget when we can potentially be losing 13 million um after if that passes so um and we don't know what's going to happen with the legislative legislative session so as you know because you do your homework as well you know that costs have gone up for our residents the costs have gone up for the city as well so um i know i made some proposals about some other fees that we could cut especially looking at our recreation programs um they're small amounts but i don't think when we take a look at the numbers and i am not um and i acknowledge the costs that we're all the cost pinch that we're all feeling but to cut 3.2 million dollars for our budget when it's going to save i think the maximum would be 70 a year for someone um what i think two dollars would be the savings in lauderdale west is that what i wrote down for home their average um i think again it would be irresponsible when we have amendment three hanging overheads like the sword of damocles so that is my statement on that and i see you buzz back in council member fadgen sure i respectfully disagree we do this we do this dance every year and um davie's um proposing a rollback so um it can be done i'm not saying it's going to be easy it's going to be difficult but i think it's time so okay thank you very much uh council members any other comments council member andrea thank you president horland um i didn't hear the motion but i believe you were i didn't you will no council member fadgen i'm sorry that though you're recommending for the gateway the rollback to 1.6364 is that correct i'm good with a rollback okay i could i can support yeah i said that i would support the rollback on the gateway and i think that you had originally proposed a small um a lower number miss otanianus got that up it was going to be it was going to be less but uh if if we got support for rollback i'm willing to accept the rollback so what i was proposing was going to reduce the revenue to 893 000 um reducing doing the rollbacks 968 000. i can support the rollback rate i'm here to 1.6364 we all are so we appreciate that and i think spirit and i think the concern is too that we'll be losing those cra funds in four years so i think to be able to hold on to a little bit but but to be able to give a little relief go ahead councilmember andrea thank you um miss otaniano i wanted to just clarify um one point and i want to again thank you and your entire staff for presenting a very well balanced budget and taking the time to meet with all of us i don't think the public sees that part but you meet with us individually um for quite a while to go through the specifics and the details line by line um for each of our different areas so thank you for that but personnel in general is that about 40 percent of the overall budget 115 million actually i think it's like 73 oh it's much higher yeah it's much it's it's high well i originally had in my notes that it was 71 but then when i did the math real quickly today i said oh that looks inflated based on your 115 million that would be closer to maybe 37 percent i'm sorry oh i'm not out of alarm hang on i'm sorry it says 72.4 of the general fund expenditure 72.4 percent okay so is that incorporating a raise yes so that is that's my worry though because is this going to be sustainable if the property tax revenue decreases next fiscal year i know that i'm asking you to have a magic ball but um i i am concerned that we might not be able to sustain this if amendment three passes no ma'am the present operation will not be sustainable if amendment three passes and we'll be having discussion on october 21st just 21st just for a 10 30 000 foot view of what that looks like the impact of the city but there will be you know felt service impacts because one of the things we need to do is to make sure that we don't just cut capital and we honestly can't cut capital get there but in the past 08 a lot of capital was deferred deferred and deferred and as you are aware particularly from some of our shade sessions we're still digging out of that hole so we would have to make strategic reductions in service with the idea that maybe in the future we could repopulate those services if the legislature is of a mind to give us some other alternative revenue source i mean administration recognizes the unique nature of ad valorem i mean obviously you can't you can't moderate your consumption of an illiquid asset but that is one of our key revenue sources today and the manner in which this reform was uh passed and put forward there really wasn't uh much of a discussion about what other options there were but but to your your point no that is not sustainable thank you for that candid honest answer um and a question to mr nunamaker in terms of central park and the multi-purpose uh building has that project started yet in various phases yes but we want to make sure that we have a concerted effort to give the building a full revamp um so bless you so we'll be doing that but we also want to kind of get a sense of what what are we going to be doing there so i think november will give us a good idea of the services we'll be running there and i don't want to freak people out because we recognize that as one of our primary parks obviously i mean i think one of the one of the guides will be is how many touch points do we have in a given service area and certainly we get a lot of bang out of central park it's a very valued park so it is our intent to remodel that facility but we do want to have a better idea of exactly uh the services we'll be providing and um miss otaniana or mr nunamaker we will send again this year um an overall kind of budget picture out to all of the residents in their water utility bill is that correct yes we have already got that ready to go okay because i'm glad to see the people who are here and listening and are engaged but there's still so many more that we know um are not present today and i want to make sure that they have a full understanding of this as well yeah absolutely um i too share some of council member horland's concerns i said that at our last meeting um you know i i feel strongly that amendment 3 will pass and um so i want to be a bit conservative so i would recommend keeping our millage rate flat thank you those are all of my comments thank you councilmember andrea councilman ryanstein yes uh thank you very much for the presentation i um you know councilmember andrea who just mentioned that uh while we may not be going line by line and go through um the the details here in in front of uh in front of the public it doesn't mean we haven't done our research beforehand and gone through the entire book and asked our questions um i know for myself um for example is that i don't swim at the aquatic center um i don't play tennis at the veltri tennis center um nor do i play golf um but it um i may be missing out my dad would agree with you but uh it doesn't mean that i don't ask the questions to make sure that if there's a request or there's something in the budget for those items that they're substantiated and that's because i look at it when i review our budget i look at it that we're in the customer service business and so the question is is that you know how are we satisfying most of our customers even if not all of our customers um we know that um that's really an impossibility but we we try and do the best we can um and when when i look at the proposed um 5.7 um remaining the same um i see that that because our our needs increase so even though we're keeping it the same and even though property values go up and we may be bringing in more money we're spending more money because our residents have been requiring it have been requesting it and um i do um i do think that i could agree for the gateway um to see a rollback um and in midtown i believe i heard um a request for a three percent and i could agree to that as well um i think those are um in terms of those two districts those are areas where um uh the the investments have been made but uh some relief um i think can be granted and continue to be granted as as i think we we started to do some of that last year as well um that's where i sit thank you great thank you does that reflect the three percent yes that was requested okay yes you may thank you council member ryanstein so okay keeping it the same it would increase the revenue 79 000 and then the one next to it it's really 68 000 is the increase in revenue there's not a loss of revenue no but compared that word loss because a loss is something you can't control so it's less compared to what we're proposing okay that's what that and that's what i said when i did the presentation compared to what we're proposing it's a loss of 10 000. a reduction of 10 000. a reduction because this is a controlled reduction it's not a loss okay thank you anything else for the days all right i'm going to turn to public comment okay thank you otaniano so we've got mr conklin miss andrade and then um miss bentley mr conklin good evening sir good evening if i may approach you may dennis conklin 4581 northwest sixth court heavily hosts protect you and all of your families um i want to concentrate on the top page okay and i probably gave you my copy included um it's the mountain of money i refer to uh each year um what you're seeing here if you if one of you would hold that up because i think i gave you my copy um the mountain of money since basically about 20 years ago um it went from 100 million it dipped a little bit below 100 million and now it's gone all the way up uh to 388 million bucks now some of it is restricted and a lot of it about 100 million dollars is not restricted so um to deal with uh i think the first proposal was about the gateway seven district and uh if everybody can uh go to your citizens report back there on the desk you'll see page nine that um the the gateway is going to pull in uh over a million bucks at this proposed rate right not the reduced rate and um if you look at the CAFR the consolidated annual financial report year in year out you'll see the gateway has a fund it's a couple million bucks are sitting in there okay um the CRA which uh they finally got coincided exactly overlapping the gateway seven that has uh maybe so the whole district's probably got about 10 million bucks sitting in there part of that mountain of money so you shouldn't be afraid because it was mentioned i always ask for a zero millage not the rollback millage on the gateway seven you shouldn't be afraid to zero out the millage on the gateway seven they will not be and you're spending about every weekly report i'd look and i bring it up here and i says two thousand dollars for water and wastewater from the gateway seven they got a couple million bucks in there okay so that that's for that and uh the other pages in there that i did give you that's going to be discussed on eight and nine okay and uh i'll i'll yield back my time but do not be afraid to zero out the gateway and go with the rollback for the city which i always ask for as well thank you mr conklin all right miss andrade miss bentley on deck good evening welcome hi donna andrade 5592 south of second street mayor and council members i put this uh together before hearing all the comments but i'm just going to go with what i have last year the the city reduced the millage rate from 5.7 to 5.8 the mayor and council members finally voted to reduce the rate after years of tim fadron making the case to reduce the millage so finally there was movement however this barely moved the needle as you know you've been talking about the very small decreases well they're not small to us a small amount from the city from the county over several years it adds up it might be go towards a car payment it's not small to us it matters this year is different as there is the possible the possibility amendment 3 being approved by voters in november if i were in your shoes i suspect this might influence how you vote on the millage rate in case amendment 3 is voted in it seems the city would likely want to get as much cash as possible prior to the possible reductions in the future it seems like you know if i was in your shoes i probably would do the same thing if amendment 3 is approved i have heard of concerns of staff reductions i have been there in the private sector and it is no fun i've also heard the case of parks having limited hours and recreational activities being cut and also the concerns about police fire infrastructure services etc no one is arguing that all these things are not important to the functioning of our city we all want plantation to be a well-run city and a nice place to live however the city county and most of the other taxing authorities have brought this amendment 3 vote on themselves by not doing something about it and it being the millage rate second you are losing and or have lost our trust between dragging your feet on military reductions installing the city-wide license plate readers and yes i know there's a pause but there is an election coming up the land use vote on the big lots plaza by the zoning board and your lack of clear communication of the very creeping in my opinion state live local act and its impact on our city we don't trust you we don't trust you to keep the future of the city aligned with what residents want progress freedom choice and local input for future developments if the only choice is government-induced affordable housing rentals and does not include new home buying options for first-time homeowners what is your real goal for the city where is the rail work and housing affordability the millage rate is part of that thank you uh please no applause from the audience uh miss bentley good evening hello my name is lisa bentley i'm a 22 year resident of plantation and i'm here tonight because i believe plantation homeowners deserve a meaningful millage reduction plantation homeowners are already dealing with higher insurance premiums higher utility bills higher grocery prices higher costs to maintain their homes a higher property assessment does not put cash in a homeowner's bank account it doesn't increase a retiree's social security check it doesn't give a working family a raise but it can increase the amount of property tax they owe and that is why i believe this council has an obligation to be more aggressive with the rollback because plantation owners deserve the benefits from the increase in their property value not simply have government benefit from it and let's be clear homeowners don't pay a millage rate they pay a tax bill a homeowner should hear we lowered the millage rate and then they open their tax bill and discover that their property tax actually went up that should not be happening that isn't a meaningful tax relief if the city can responsibly operate at a lower rate then that money should stay with the people who live work and pay taxes here so i'm asking the council to go further don't stop at 5.7 give plantation owners a real rollback not just a lower number on a budget document plantation owners have seen about the value of their homes increase but that doesn't mean their ability to pay taxes has increased they should not be punished simply because their homes is worth more on paper it's about recognizing the financial pressure families and seniors are already facing it's about giving homeowners some relief when the property values increase it plans if the city of plantation holds an existing budget surplus those funds can temporarily act as a cushion to offset the initial revenue gloss brought on by amendment three passing homeowners deserve a meaningful millage reduction i'm asking you tonight to give that relief roll the mill millage back further thank you thank you very much for coming out tonight please keep quiet thank you uh miss otanano can i ask you a couple questions before we move to the items please you've heard a couple of people uh and mr conklin uh mention our reserves do the bond rating um companies moody's and standard and poor base their rating of our city based upon the reserves that we hold it's one part of the calculation yes it is and so we've talked about the percentages i think from um the governmental um accounting uh fine finance officers association um i was going to use the acronym and i got caught up in it so yes do you have to do it um one of the recommendations that they make uh especially for south florida more vulnerable to hurricanes is to have a um percentage of our general fund kept in reserves correct to be able to usually say uh two months of operating expenses okay and that also applies to any other things that we may encounter such as covid uh infrastructure breakdowns such as that the last couple of legislative sessions we've seen bills much to miss morrison's chagrin um for sovereign immunity increases it failed last year we do believe it's going to come back a little bit stronger this year if the sovereign immunity um increases were to be put into um effect would we then have to take possibly some of those reserves and move those into risk management because we are self-insured yes well we actually have a reserve for that okay so that is part of the impact some of that okay um thank you for that i wanted to just ask a couple of those questions and one other thing we do have the um we're codifying the transition of paid into our um that's later on the agenda tonight and i noticed one of the things in there because i i know that you had asked for an additional person in finance that was a discussion we had early on um i know that's been taken off the table but you had not asked for an additional uh personnel in 20 years correct what i want to ask you and and we can discuss it further we get to that item but it is of concern because what you do is vitally important for the city i see that you are now going to serve as a treasurer overseeing that special district so is that um to assume is going to increase the workload in your department it will uh but not just my department is going to increase it in engineering certainly engineering okay definitely finance yes all right thank you for that um do you any further discussion on the dais or do you want to go ahead and read those items in or mr ezra will you be reading those i'm happy to if you'd like okay thank you let's go ahead and um council members we had i want to see if we have a consensus on the gateway development miss otaniano i'm sorry i'm going to ask you to put the gateway up again just so we get the rate correct please so this is going to be item number one fy 20 27 7 tentative millage resolution for the plantation gateway develop development district correct yes okay mr ezra got that that's 1.6364 mills okay do we have a motion i'll make a motion uh that we approve uh item one with the rollback rate of 1.6364 mills thank you very much do we have a second we have a second okay go ahead do you want to read it do we need to read it there's no legal requirement to read the title of the reso all right because of the reso so we have a um we have a first and we have a second mr conklin you're on your feet well no i took the public comment for the budget at the beginning you want to come back up you can come back up that's the way we had the separate slips tonight go ahead uh dennis conklin 4581 northwest this court i did find my own it was buried uh in the eight nine issue um again uh i want to thank you for voting the the rollback um i wanted to explain you were talking about reserves um that mountain of money okay that includes the reserves which are restricted but there's a hundred million dollars in there that are unrestricted that's what i'm talking about to pay off pensions and to cover these uh reductions in millage rates particularly as i always ask for the gateway seven since the cra creation three years into it it vastly exceeded the money in that district and they should have been receiving the relief all along um i noticed that if it goes through uh the the millage rate is going to produce at the at the lower rate i think it's going to produce uh what is it eight hundred ninety three thousand something like that their budget is only 398. you see what i'm saying so there's a half a million bucks that goes in to the mountain of money reserved understood but uh you can you can go for a zero rate and i'll yield back on number uh what is this number one thank you number one thank you mr conklin other further comment on that hearing none miss bigaro please call the roll on item number one council member anderson yes council member andreyu yes council member fadgen yes council member einstein yes council member horland yes item number two is a the fiscal year 2027 tentative millage rate resolution for the plantation midtown development district and it um i'm hearing the consensus to reduce that to 0.9662 i make a motion to approve the reduced millage of 0.9662 second thank you any public comment on that miss bigaro please call the roll council member anderson yes council member andreyu yes council member fadgen yes council member reinstein yes council member horland yes and i heard no changes proposed for the um debt service so that's item number three i'll make a motion for the rollback rate okay can i read it fiscal year 2027 tentative millage resolution for the city of plantation operating budget and voted debt service oh i'm sorry yeah one debt service you certainly did um that's on the voted dead service motion to approve okay do we have a second second okay any public comment on that um miss bigaro please call the roll council member anderson yes council member andreyu yes council member fadgen yes council member reinstein yes council member horland yes you know council member fadgen i want to apologize it was the operating budget and the voted dead service on that one oh i kind of had a motion out there so did that count mr aswell how would you like to proceed there was a no second on the motion that was made there was a motion and a second there was a vote there was a vote taken um if uh you want to reconsider it somebody who voted in favor of it could move to reconsider it i don't want to reconsider obviously did not want to vote yes for that that was i would like to redo the vote what do i have to do you voted in favor of it you can move to reconsider it i would like to make a motion to reconsider it second thank you okay i'll accept the reconsideration so you can get your your vote in all right so i um need a um roll call on the motion to reconsider please on the motion to reconsider this council member anderson this is just to reconsider yeah it's not about yes council member andreyu yes council member fadgen yes council member reinstein yes council member horland yes that's just to give council member fadgen the opportunity and i'd like to make a motion to do the rollback rate for the uh the uh general millage and then the uh keep the uh voted debt millage the same do we have a second just for point of clarification can you just state what the numbers are just so we have them we pull it up so you want the rollback millage you want you would like to hear the rate okay so the proposed rate is 5.700 the rollback rate is 5.4878 and then the debt millage is 0.2637 so my my motion would be for the 5.4878 council president may i ask if we can maybe bifurcate the i don't know if that's possible it's one resolution it's one resolution right okay so it's it's um the rollback rate you want to keep the debt rate yeah go to debt rate i don't think we have a choice in that one there can be another motion so after this fails do i have a second i'm confused what you're saying i made a motion i know he wants but then you said bifurcate and you can't for the voted debt because it's one resolution so if that motion fails we can come back on the then split it no it's it's all one thing so in the resolution it's 5.7 mil for the and then you have the voted debt millage rate of zero one zero point two six three seven but my motion is for the rollback rate of point five point four eight seven eight with the um voted debt millage rate of point two six three seven looking for a second do we have a second on the rollback rate i'll second it for the rollback rate yeah okay any further discussion councilmember anderson yes councilmember andreyu no councilmember pageant yes councilmember reinstein no councilmember horland no all right um item number three we will um i'll make a motion to approve the 2027 tentative millage rate resolution as it reads for the city of plantation operating budget and voted debt service and we need four votes to pass that miss otanana okay um do i have a second second okay any further discussion public comment councilmember anderson yes councilmember andreyu yes councilmember fadgen no councilmember reinstein yes councilmember horland yes thank you very much i don't remember you uh for reconsidering absolutely no problem i'm sorry about that little glitch there no i got confused too a lot of numbers yeah um which you should abuse be used to as a cpa uh item number four fiscal year 2027 tentative budget resolution for the plantation gateway development district do we have a motion i'll make the motion to approve we have a second second any public comment any further discussion ms bagarro please call the roll council member anderson yes councilmember andreyu yes councilmember fadgen yes councilmember reinstein yes councilmember horland yes item number five fiscal year 2027 tentative budget resolution for the the city of plantation plantation to the plantation midtown development district we have a motion motion to approve second okay any further discussion public comment hearing none ms bagarro please call the roll councilmember anderson yes councilmember andreyu yes councilmember fadgen yes councilmember reinstein yes councilmember andreyu was that a recent buzz in or was that old and i missed it okay sorry about that oh okay bifurcation okay item number six uh fiscal year 2027 tentative budget resolution for the city of plantation consolidated do we have a motion i'll make a motion to approve do you have a second second all right uh any further discussion or public comment all right mr big girl please call the roll councilmember anderson yes councilmember andreyu yes councilmember fadgen yes councilmember einstein yes councilmember horland yes thank you very much um ms otanano community redevelopment agency mr conklin you had indicated that you wanted to speak on this one sir where'd you go dennis conklin 4581 northwest this court um my public request is i ask the six directors of the cra to kindly speak with the five city council persons and the mayor and have them zero off the plantation gateway development district extra millage i'll yield back my time thank thank you mr conklin uh motion to approve the fiscal year 2027 tentative budget for the cra thank you do we have a second i'll second it um any further discussion ms bagarro please call the roll commissioner anderson yes commissioner andrews yes commissioner pageant yes commissioner horland yes commissioner reinstein yes commissioner sortle yes thank you very much it's 6 51 uh that's the end of the cra budget meeting we'll call the cra meeting to order ms bagarro you want to call the roll one more time yes commissioner anderson here commissioner andrews here commissioner pageant here commissioner horland commissioner reinstein still here commissioner sorrell here city attorney ezra here thank you thank you very much ms bagarro um the cra consent agenda consists of two items uh tonight mr conklin you wanted to speak on consent agenda you have to start sitting at the front of the the chamber not consent you don't want to talk okay you want to get up for public comments on cra all right all right so we have two items on consent agenda they can be passed with one motion motion go ahead motion approved the consent agenda and it was one and two would you like to be the second yeah councilmember commissioner fad all right um any further discussion no public comment on that miss bigrow please call the roll commissioner anderson yes commissioner andrews yes commissioner fadgen yes commissioner horland yes commissioner reinstein yes commissioner resortle yes thank you very much okay public comment on the cra mr conklin you're up sir thank you dennis conklin 4581 northwest six court uh i request that everyone praise the director glendon hall and his cra development team uh i mean you're right the difference is night and day can we vote on that you you can make a motion if you like i can't make a motion um but um seriously um when the cra was uh installed and approved by the state and the county uh 2000 we had basically 30 years to get this thing right and we'd been kind of spinning the wheels and whatnot uh until the arrival of mr hall so hat tip um and as was mentioned in the uh consent agenda you can see that uh in one of the weekly reports boom they spent two thousand bucks on water and wastewater and uh there you go uh in the um oh the cra is is not that i take it back never mind that's coming up on gateway apologies you'll back that's okay thank you mr conklin okay at this time 653 cra is adjourned and we're back to the city council meeting all right um mayor we're gonna move to uh items submitted by the mayor would you have an objection if we moved the sickle cell awareness month first thank you very much councilmember andrea yeah you're doing the diaper again not me must be you oh the kiwanis is that where we got the pie okay you're doing the diaper um containers again oh you didn't thank you president horland for changing the order around i know that andrea has to go to another commission meeting to also receive a proclamation so we are honored to welcome the founder and members can you hang on i'm just going to ask everybody in the chamber to um please keep your conversations down so we can how are you good okay i just wanted everyone to be able to hear the proclamation thank you we have shacks hope foundation with us and they'll be telling you momentarily about a huge event they have coming up this weekend but i'd like to share the proclamation with everybody in the chamber i'm a teacher so i'll wait the proclamation reads as follows whereas shacks hope foundation was founded after shakira martin who dedicated her platform and voice to advocating for people battling sickle cell disease and whereas shacks hope foundation was established in service of individuals and families affected by this invisible disease a condition that too often goes unseen and under resourced and whereas sickle cell disease disproportionately affects communities that have historically lacked access to adequate research funding medical care and public awareness and about one in 13 black babies are born with sickle cell trait and whereas shack's hope foundation has committed itself to advocacy education and support for those living with sickle cell disease and their loved ones and whereas the foundation stands as a source of hope dignity and tangible assistance for individuals navigating the challenges of this disease and whereas the compassion courage and dedication behind the foundation's founding reflect a commitment to ensuring no one faces sickle cell disease alone now therefore global food crisis and inspire action to combat hunger and whereas since 1981 feeding south florida and other organizations have worked to address hunger and food insecurity in the city of plantation and throughout broward county by providing immediate access to nutritious food and other vital resources and support and whereas hunger does not discriminate it knows no race religion or age in south florida approximately 1 million individuals face hunger food should not be impossible should not be an impossible choice for our residents in the city of plantation nor in any community anywhere whereas feeding south florida leads hunger and poverty advocacy efforts in our community while also transforming lives through innovative programming and education that provides economic growth and overall well-being whereas the city of plantation is therefore committed to supporting feeding south florida so that together we can achieve a hunger-free south florida therefore through the mayor and by the city council of the city of plantation we proclaim september 2026 as hunger action month in the city of plantation and we encourage all residents to partner with us in volunteering at a local food bank donating or helping provide meals and to raise awareness about hunger in america and we ask everybody to give a round of applause and support for feeding south florida as they accept this proclamation would you like like to say a few words please hi everyone hello uh good evening i want to thank the city of plantation for this wonderful proclamation we are honored to be recognized uh as the main um food bank in the local community we do serve broward palm beach county miami-dade and monroe and unfortunately the um the need is rising and continues to rise and we are exceptionally happy to have the city of plantation bring awareness to hunger action month we do ask everyone to help out by volunteering donating wearing orange and you can find out more information about us at feed in south florida.org thank you can i ask you a question before you leave so feeding south florida was a wonderful partner with the city of plantation during the pandemic where we held several drive-through events hosted by our parks and recreation department are you still doing uh drive-through events in other cities how are you primarily distributing food uh so we primarily distribute food through our partner agencies uh they partner with us we have they're either other non-profits or other uh civic organizations um and those agencies that partner with us they do distributions twice a week for us do you know um and i don't want to put you on the spot but do you know if any of those agencies are in the city of plantation i am not 100 sure at this very moment but i can get that answer i would appreciate that thank you very much so while while we don't have that answer for you right now um we can tell you that there are many residents of the city of plantation that do volunteer with uh feeding south florida and um while he signed up for uh for public comments i brought up one of those volunteers to speak about feeding south florida as well and you can introduce yourself mayor members of the city council city attorney ezra and city clerk miss begrow my name is jonathan reinstein at 220 northwest 11 avenue and i'm here tonight to thank you for the proclamation recognizing feeding south florida during hunger action month for the past nine months i've had the opportunity to volunteer with feeding south florida and it has become something that i look forward to many times i volunteer there with my dad and we spend our time sorting packing and preparing food to be distributed to people throughout south florida who need it organizations like feeding south florida are so important in helping address food insecurity in our community and throughout south florida what i really appreciate about volunteering there is that you can see the impact of your work firsthand after each volunteer shift they show you how many pounds of food your group has helped prepare and how many how many meals that food will provide i'm proud to say that throughout my time volunteering with feeding south florida my service has contributed to providing approximately 55 000 meals to people in south florida who need them knowing that the work that i'm doing can directly help a family in our community is what makes volunteering there so special to me i want to thank the city council and the city of plantation for recognizing feeding south florida during hunger action month and for recognizing the important work that they do there every single day thank you great job thank you council member reinstein all right that's it for proclamations we are moving on to school zone camera safety annual report oh yeah you're not you're not up yet i'm sorry i know you're i know you're anxious yeah no you're not yet no it's it's still mayor no we no you're you're really not yet my apologies um good evening chief i know that uh it's time for us to submit our annual report to the state and you're here to present it this evening yes ma'am uh we did already submit it to the state great so uh good evening council president council members mayor city attorney the plantation police department is providing this update regarding the city's school zone camera safety program and its annual reporting requirements for florida statute 316 1896. a 30-day warning period began on march 9th of 2026 with the program officially going live on april 15th of 2026 the attached reports provide the enforcement statistics and other relevant data during the required reporting time frame which the statutory reporting time frame was july 1st 2025 to june 30th 2026 obviously our program was not active but for a month and a half from april 15th to the beginning of june or yes the beginning of june as part of our education and outreach efforts the department published five social media campaigns across each major platform before and throughout the duration of the program an educational video and a question and answer were also published on the city's website additionally principals at all the schools located within the city school zones were contacted and provided with educational materials for dissemination to their staff and parents the department will continue its education outreach efforts to promote awareness voluntary compliance and enhance safety in and around plantation school zones now the reports that were included in the backup and that you all have there's nothing different in them from what was submitted before again this is only statutorily required to put it on the agenda so just like before there was 22 887 notice of violations issued there were 10 contested uh at a hearing 10 of them were upheld at a hearing there were 12 at the time uh issued as a uniform traffic citation and 14 22277 notice of violations were paid thank you chief is there any questions yes council member vagin from the day yes go ahead sir thank you council president horland um thanks for the report chief yes sir i do have some questions regarding this so 22 887 notice of violations issued 14 277 paid notice of violations issued as uniform traffic citations 12. why particularly at this point in time like how come they're not turning into uniform traffic citations some of them are between the time that this report was pulled until now or this is not a current report it was current as of when it was pulled in uh given to place on the agenda so is this it doesn't it has this report drawn like do we know i'm sorry i see the period but as as of you know because that i would say that the uh the notice of violations turning into uniform traffic citations kind of is a rolling process you know you have that 30 days once the notice of violations given then it turns into the utc that has to be approved i guess but i would assume that there the gap between notice of violations paid and the notice of violations issued would be a lot narrower there should be a greater number for utc's is there a reason for the uniform traffic citations not being issued i don't know why the numbers at 12 and not higher than that but i can look into that and give you that answer that'd be great and i want to like we had a conversation and maybe it didn't resonate with me when we were talking about it but the public safety initiative the 556 000 that's the money that we get yes sir and did you say we're not deploying that money at this point in time we have not and why is that well we've had the discussions around it but again the program had only been active for a month and a half at the time yeah but there's a half a million dollars there um i'm just curious like are we is there a reason we're not using the money sure so jason automaker cio there's a couple programs we're looking at one and i think our priority is going to be getting flashes on the secondary roadways so first we wanted to see those red speed going to absorb that there's some language that could be interpreted different ways as to what's required if they're not going to absorb that then that's something we want to actively fund we do anticipate i think as you all are all aware we're going to be funding one complete sro this year the consolidation of plantation middle and plantation high school in spite of our objections in spite of our request for additional consideration is not going to be funded at all by the school district so that's certainly a viable expense and we'll be bringing more of those types of things forward to y'all i'm a little early on the sro because typically these we wouldn't want to fund recurring expenses with these funds so we're going to have to take a longer term perspective on our sros but if the school district's millage rate passes we'll be approaching them again on that but we do plan on bringing you more broadly our public safety initiatives back for council's consideration as well are there any lawsuits that are pending a ruling regarding the the um the uniform traffic citations someone uh a resident called me about that are we aware of anything i think that would be a question for the city attorney well yeah to my knowledge there's none for uh our program there has been a number there has been uh there was one recently in uh uh hollywood had one uh they use a different vendor sunrise had one would that be affecting us uh i haven't looked at the case in a while but there is a case that's on appeal i believe to the fourth district court of appeal because a local county court judge ruled uh the statute to be unconstitutional so some cities are are we're all we're all watching that case okay so i hope we're going to be kept informed which i assume we will be as soon as there's a ruling i have a question regarding florist statute 316.1895 4b a school zone maintained by a municipality shall be periodically inspected by the municipal police department or any other qualified agent determine whether or not the school zone is being properly maintained and if you don't know the answer to this you can get back to me so when we're inspecting the school zone i'm assuming what that means in the statute is that it's compliant with all state law for signage etc inside the school zone um are we inspecting the signage that we're saying that it's improper it has the proper setbacks it has the proper distances between the um uh the signage whatever it might be does it have the rep the proper retro reflectability uh i can't think say the word but the reflectability of it are we doing all that so for 316 1895 i don't have all of the answers my guess is i'm going to take a quick guess okay that's okay is um the inspection of the school zones to determine whether uh speed enforcement should go in there uh was done prior with um speed studies and that was presented now i got to read the rest of it and i will get back to you okay with you coming back to us or coming back to me with that that um question kind of related but um uh but has to do with school zones is the is the school zone i don't know the proper terminology has the school zone been remapped on sunrise boulevard in front of plantation middle school i was turning on uh westbound off 65th and um the signage there says you're entering a school zone but i don't think we're entering a school zone anymore and then that there's the camera that is um precedes the uh passing of plantation middle school is that is that camera coming down so the camera should be down already now it's the the city the city doesn't designate the school zones the county does and then the signage like the big sign with the big flashers on like right at 65th fdot installs that we have put in the request to have that removed okay it's not active it's not flashing no what's going on with the camera is that camera in front of plane you know the one it's like right in front of the jcc before you cross the plantation middle the camera's still there when is that going to be removed because that's not an area where it should be taking speed cameras i i guess my question will be and you can follow up with me on it is it off and when is it coming down well i'm not going to argue with you whether it's still no i get it um it should not be there and but i can guarantee you that it's not enforcing anything okay i want to confirm that yes no i can guarantee you that right now that it's definitely not enforcing anything then i'd like to know when it's coming down um thank you chief yes sir council member ryanstein and council member andrea thank you chief um my my comments and questions go um towards signage and this is something that um i've i've raised a number of times and um i've raised some concerns about the signage that is there as well as the signage that is not there um you you have mentioned and uh councilmember fadgen referenced one of the statutes in terms of the signage inside the school zone i'd like to bring up again my concerns with the signage outside the school zone meaning that we we've talked about and i've raised my concerns in regard to the signage that has been put at the entryways to our city i personally drive on knob hill just about every day and i encounter the sign at the entryway by the city of plantation marquee that says notice speed limit photo enforced ahead that sign is um gives no real sense of where that speed limit photo enforcement is taking place and you know normally um even if i put on my my lawyer hat the concern with notice is that you you you you you want to make sure that you're you're you're given um uh knowledge as to something that may occur in this situation um i'm concerned that um the notice is is just is too early it's too premature it's premature and in this sense um if you get off uh if you enter a plantation on um at state road 84 or off of 595 on knob hill and you see that sign you're driving quite a while before you get to any actual speed enforcement zone and so you may drive all the way to broward boulevard you may turn off broward boulevard and you're looking you may be looking the whole time if you don't normally drive past past the school and wonder where is that speed limit photo um enforcement zone and so um i i i raise it again i still believe that that signage should not be in that place um i i've raised previously um my concerns as to what was there before and shouldn't have been removed but if we're just talking about this signage um i i again um will say to you and say to the administration that um i think that signage is in the wrong location i think it's confusing to our residents and it doesn't give the the actual notice that it's intended to thanks yes sir i appreciate that thank you councilmember andrea thank you president horland um chief i know that we spoke about exactly some of the issues that councilmember fadgen discussed about plantation middle and you are going to repurpose the um flashing signs to another location that are on sunrise boulevard that were for plantation middle but that hasn't been done yet but that's still the plan correct well again you mean the big flashers right at like 65th so they're not ours we put a request in to have them removed and again as mr newmaker pointed out earlier what we're looking for is actually to get flashers on all of the signs to let everybody know that they're entering the school zone and then also the speed limit signs themselves and i know i guess that's not you either but has that request been placed as well because because it is confusing i i travel that road pretty much daily and even today i got off a little earlier and people were slowing down because they were confused because the speed limit sign is there it's not flashing and so people were still starting they just were confused and so it was slowing traffic down in general when it didn't need to necessarily be at 15 miles per hour i understand and again we've we've petitioned the county and fdot for removal of everything that talks about the school zone there for plantation middle okay and then um i had some other questions but i'll speak to you i know you called me back yesterday sorry i missed your call we'll speak about that offline but i did want to just state this fact and this is what was concerning alarming to me that during this time period of just three months 90 days in essence um there were almost 8 000 people speeding during the 15 mile per hour flashing time zones 8 000 at the various schools throughout the city and they're going exactly 10 miles thank you councilmember anderson so they're doing a minimum of 25 in a 15 26 in a 15 while it's flashing while they know it's 15 miles an hour that's i just can't even comprehend that um but thank you for the data i always find it helpful so um i appreciate the report and the work you're doing um in terms of you know getting the signage corrected i know that you did a lot of you fixed some of the inconsistencies that uh councilmember fadgen and councilmember reinstein had pointed out i know again i drive by central park every day and those signs were corrected so thank you and your staff yes ma'am thank you councilmember anderson could you clarify since the it's the same spot i pass it every single day is does that do we not have the flashing signs for the charter school that's right there that's what i was thinking about renaissance so why isn't it why isn't that still being utilized for the charter hours still a school zone right we because we as the city of plantation or the police department don't designate what is a school zone the county has to do that right but i wonder if that's their hesitation because it covered the charter school and the middle school and just because the middle school's gone there's still a charter school right there across the street so i drive through it and i'm unsure and i just tap the brakes and air on the side of caution when i go through there so but you're correct that may that may be one of the issues reasons why they're not removing that um chief thank you again for the report i know that we did ask red speed when they were here on the record um about those flashing signs and i had referenced the ones in sunrise that gives you actually your speed which i think you know we've said repeatedly up here our goal is to slow people down it is unconscionable as council member andrea said that people are speeding through those zones uh whether it's school zone or not um at the rate that they are so we need to be able to slow them down is there anything that we can do to try to motivate red speed because while we do have that um you know the funds available the public safety funds um i'd really like to see the onus put on them right i don't i don't think so at this point um they are responsive uh in their communication with us uh we have put in that request with them and all right we're standing by and i will definitely let you know okay we appreciate that chief i do have uh one public comment signed up uh miss tiffany hudson would like to speak on the red speed and statutorily typically we don't take comments during uh mayors i may all items but because uh per statute with this report comes up we do take public comments so miss hudson are you here okay miss hudson you signed up i've got two sheets for you but they both say red speed okay but you're only okay okay good good evening hi tiffany hudson plantation florida um i found some really interesting things about red speed because i've really been going in deep diving into them um i wouldn't trust i personally don't trust the numbers because i've seen the numbers that the data that you guys said was very convincing i went through the data and i don't know what's going on but there were like six schools that had the exact same numbers um and if i had my paper i could tell you those exact numbers but i can email them to you i'll post them online but um like seminal and tropical had identical numbers like identical number of people that were violators at the identical like everything was identical like copy paste identical and two other schools had the same issue same zone yeah that's not is seminal and tropical the same zone same zone okay so i have a problem with that because seminal and tropical are not excuse me right next to each other like right next to each other imagine uh and was it clever oaks is that two different they're right next to each other i get that so i'm questioning that questioning also why the company that was being hired was also allowed to do the test i don't think that's i don't know and after seeing the emails from captain brown to red speed saying that the numbers were messed up just a few days before makes me not feel comfortable that so i think the whole thing just as i'm looking into it you know i don't think that is accurate in determining whether or not that's a that's an area that needs to be um looked at as far as putting these speed cameras not only that but i've been uh looking over their history you know they're being sued in georgia for racketeering um they're being sued actually by two different people in georgia um they have a long list of you know just leaving a bad taste in everybody's mouth palm bay fired them um they've been sending out they sent out hundreds of tickets that were from a completely different county um manatee county fired them there's just a lot of a lot of things i don't trust about them and on top of that when they were here at the last meeting that we had uh they completely contradicted what uh red speed first came in and said for example one example greg park said in uh 2024 you were asking about how you know how much data is being collected like does it ever turn off and uh greg park said no it's on 24 7 always collecting data it's the videos on your on your website so the guy from red speed or maybe it was the chief that said it um was saying no it's not it's not going 24 7. data's not being collected all that time but i remember council member reinstein specifically asked that question so there's a lot of these that it just seems i don't know how else to say it a little bit sketchy to me so that's all i'd like to say thank you thank you very much coming chief you have anything else okay you're good all right thank you all right thank you very much chief for the report speak on red speed i don't have anything you didn't read right that you were and what's your name my name's glenda glenda yeah you didn't indicate what you were going to speak on but come on up so glenda just identify yourself okay my name's glenda guys i live at 1020 west tropical way and i have three things first of all like the sign when you come into the city that says that your speed is monitored i don't mind that because then it means that throughout the entire city i will be careful because i don't care where the cameras are i'm going to be careful it doesn't matter number two i drive peters road a lot because that's where tropical way is and i you know leave and go all the way over to pine island and when i cross university there's those signs that say um that the school speed zone is from 7 to like 330 or something and but there's no speed limit sign so you know during the flashing time it's 15 but during the rest of time it's the regular speed limit there's no speed limit sign and i'm like well what the heck is it i have no idea so when you're heading east on west west on peters when you come up pine island and make a right on peters i think the speed limit sign is like right there but if you're like looking for traffic and not looking right there the rest of the way it's not there so we can have and i'm pretty sure that west of university as i'm crossing go by publics and then you keep going west on peters there's no speed limit signs i'm always looking for well what is it i have no idea so that was a suggestion please put up some speed limit signs so we know what at least what we're supposed to do and the third thing is the time starts different in different school zones correct one is 655 one is seven one is whatever but the flasher doesn't start till 7 30. and i'm just making an example like it starts at 7 but 7 30 is when the flasher starts i'm wondering because you said there's so many violations during speed zone could it be from 7 to 7 30 they're enforcing the 15 when really the flashers aren't on yet so when does the flasher when does the 15 when is the 15 enforce is it just when the flashers are on or is that 30 minutes before when it actually starts at 7 and then when it's done it's say 2 30 but it goes till 3 like they're enforcing it till 3. do they do those machines know exactly when those flashes come off so they don't have to uh enforce the 15 so i'm wondering if that's like a glitch that might be causing more 15 mile an hour problems so the i think it was actually in the last uh batch of stuff that i sent to council uh the the county sends us what the flasher schedule is and then it is all entered so those all those individual flashers does know do know what the county's schedule is and that 15 miles an hour is enforced during those times okay i just want to make sure it's not going over to that extra 30 minutes before and after right because my daughter got a ticket on peters road west of university and i'm like you know it was she went one mile over or whatever and i'm like well did you know what it even was and she didn't so i mean i paid it already but like it's not fair it doesn't have a speed limit but thank you for bringing that to attention i'm sure chief will check that out so thanks so much for coming um and i just wanted i do want to play a little devil's advocate and because it's been brought up about the signs that have been replaced i i understand that administration's intention was to because i saw the first draft of what the sign proposal was uh to draw attention to it because i know there have been multiple concerns raised about the signage um unfortunately um mayor i think i'm correct in saying that fdot overrode what was proposed and put up that basic sign which i don't think anybody's happy with but i understand the intent was to let everybody know that they're entering the speed zone and to slow down so i'm hoping that we'll be able to get those flashing lights that give us the speed but thank you for everyone uh for participating um councilman reinstein something final god bless you based on your last comments i just want to make sure that we're we're clear here um i believe those signs were put up by the city and not by fdot um and fdot had to approve them um so i i'm not sure that i that i received all that information when when i asked about them um but there still is a is a concern and you heard mr nunamaker already mentioned in terms of the issue of of signage and responsibility and we've talked about it before is whether red speed is responsible for signs or we are um so i still want to make sure that it's clear is that um that the administration did put up those signs um it probably should have been red speed to put up that that that we put the onus on them for those signs and regardless the sign shouldn't be there i'm not going to argue at that point what i want to say is that the i understand administration's attempt was to add some clarity um and i agree with their their original attempt was to add the clarity after the concerns were brought up on its dais and unfortunately fdot overrode what that sign would look like so you have a basic sign which doesn't add as much clarity we've liked so okay thank you all right we'll close out that item thank you very much all right moving on um to uh parks and recreation miss o'tool would you like to come up i know we're all out of order tonight we apologize for that you know when we have that little break in between meetings uh it's hard to get everybody back on track minutes and please use your time efficient sufficiently if extra time will be needed to conclude your remarks please ask for it as your time is expiring and not prior to beginning your remarks uh we have signed up mr conklin on deck miss bentley and after that mr wigan mr conklin you changed there we go thank you good evening again uh dennis conklin four five eight one northwest court if i may approach uh in one day it will be a year 364 days ago 9 10 2025 that charlie kirk the christian martyr the founder of turning point usa the christian ministry to college campuses was assassinated by a violent radical transsexual cultists charlie went even further done be good to your neighbor and love your neighbor he also said as the bible says love your enemies his widow erica kirk forgave his assassin request one is that the city interact with tp usa the broward chapter to hopefully establish high school chapters which i didn't know they existed until after charlie was assassinated in two days it will be 25 years since september 11 2001 aka 9 11 the evil islamist al-qaeda terrorists attacked america massacring 2977 innocents in hijacked planes two world trade center towers the pentagon and in shanksville pennsylvania by the way uh public service announcement st gregory's is going to have on the uh 9 11 they're going to have services at 6 30 p.m if any of the person who's want to attend um it's been 12 246 days over 33 years since the february 26 1993 bombing of the world trade center by the evil islamic terrorists al-qaeda um blah blah blah i'll jump down to the request five days ago care demands in texas state board of education to rewrite the nation's history were defeated you can see the scores on the various elections for the various grades and for the subjects request number two plantation to designate the muslim brotherhood hamas and care as foreign terrorist organizations transactional criminal organizations that are primarily funded and they use their base and guitar request three the city of new york finds itself with a mayor that advocates this stuff and a request may extend just very quickly 15 15 seconds okay very quickly uh i'll jump to uh i've requested number four uh that the mayor administration and city council members read and sign the great burton declaration which i included a copy of it because you can see it's harmless it basically what it does is it restores what a concept consent of the governed and i'll yield back my time thank you mr conklin miss bentley and then mr wigan good evening again um hi my name is lisa bentley and i'm a long-term long-time resident of plantation you have told us the city has been rewriting the entire 20-year comprehensive plan for the past three years you held workshops and meetings and hardly anyone showed up well we are here now and we are paying attention the name comprehensive plan sounds like paperwork it is far from that this is a high density new development plan that will become the rulebook governing plantation for the next 20 years and this plan will affect residents daily life for a very long time it means more cars on already crowded roads more pressure on our schools and utilities more demand on solar systems and more strain on our stormwater infrastructure which is already under pressure these are the roads we drive on the neighborhood we live in and the infrastructure we depend on every day the city has done the bare minimum legally required for public notice but minimal legal notice is not the same thing as meaningful public engagement most residents did not understand that the city was replacing its entire 20-year plan or the scale of what was being proposed now some of us do we're asking you the council to do this to do this properly we're asking you to file for a 180 day extension with the florida commerce use those 180 days to educate residents explain what is changing and make the necessary amendments to protect plantations infrastructure and the quality of life most importantly the plan needs to be amended to include an annual development growth cap if the city is going to permit high density development there must be a limited on how much development can be added each year and where development can happen much faster than infrastructure can be expanded once development is approved you cannot simply undo it when the roads are overwhelmed the sewer systems is strained and the neighborhood begins experiencing drainage problems and flood problems that is why this decision matters now this is not a request to stop development it is a request to make development reasonable and control and proportional to the infrastructure available to support it so tonight i'm asking you the council to do three things first follow the 180 day extension all right 15 seconds to wrap up okay second give residents a clear plain language explaining of what this new plan changes so that they have the opportunity to understand and making suggested suggestions towards making amendments third amend the comprehensive plan to establish an enforceable annual development growth cap tied to the infrastructure capacity you have spent three years working on this plan take 180 more days to get it right do not rush the 20-year decision because you have reached a deadline file the 100-day extension because once this plan is adopted the consequences will be felt by the people who live here for years to come thank you miss Bentley all right thank you uh mr wigan uh miss ramatar and then mr bright on deck good evening good evening gordon wigan 1040 west tropical way i have basically a foundational comment it's about mainly about the constitution and the reason why i'm doing it is because i believe we need a better relationship with our public servants and we're trying to establish that so here we go fellow people of plantation members of the city council and neighbors we gather today not as spectators but as people in whom all legitimate power ultimately resides every member of the council took an oath solemn public and binding to support the constitution of the united states the constitution of our state and to fully discharge the duties of the office the oath is not ceremonial theater it is a promise to place the interests of the people above the cities i'm sorry above the city personal ambition party pressure bureaucratic convenience or directors from higher levels of government that exceed their authority the duty is simple and non-negotiable work for the people who live here that means protecting property rights maintaining public safety managing tax dollars with restraint keeping the streets service and functional defending the ability of the residents to govern their own local affairs when the council members honor that oath decisions stay close to the people who must live with the consequences when they forget the city begins to become a mere administrative outpost of distant agencies too often state county governments overstep the sovereign rights of the prop of the properly belong to local communities and the citizens themselves higher levels of government impose costly requirements on housing density environmental reporting or social programs while leaving the the bill to the local taxpayers no realistic ability to refuse consider preemption statutes that strip cities over authority zoning short term or basic land use decisions that directly shape the neighborhood character property values consider county state regulatory schemes that expand permitting inspection and i'm not going to be able to finish this all right the practices of road the principles of government closest to the people is most accountable local sovereignty is not a slogan it is the practical expression of self-government when a state and county actions treat cities as subordinate implementers rather than independent political communities they weaken the very structure of the constitutional system was designed to protect your oath requires you to push back when the higher authorities overreach demand clear legal authority before accepting new burdens may i finish go ahead and wrap up thank you refuse to implement measures that lack local consent or proper funding insist the decisions affecting our homes businesses and daily lives remain subject to the people of the city work for us not as agents of the state or county but as trustees the residents who you elected these people are watching and your oath still stands come on city council show us what you're made of thank you mr wigan miss ramatur and mr bright mr bright doesn't want to speak any longer mom to ramatur plantation resident i want to talk to you or actually i want to ask you guys why haven't we fought for live local act if someone let me ask you if someone comes and starts taking apart your house lot by lot are you guys just gonna sit back and say oh it's progress or are you gonna fight for your house or your home plantation is our home we entrusted you guys to protect our home why haven't you guys taken up a fight against the state to say this is unconstitutional a law that can over it can bypass the local government and the public opinion to decide what is best for us and you guys just accept it how could you guys do that how could you even not even try hillsborough has filed a lawsuit miami city has instructed their attorney to fight for it hollywood won a live local tower suit against the state what are you guys going to do every single one of you and you guys know that the city is not happy at all with what you guys are doing so we expect you know the seats that you have doesn't make a council it's the people that sit in there so do something that the people are happy about that we are proud about if you're walking down the street and a resident stops you and says council member thank you you know you guys are doing the right thing then and you're on the right track so please look into it thank you thank you for coming out anyone else signed up for public comment so we will move on to the consent um what's your name oh tiffany you had you were signed up twice for red speed tiffany i asked you that question so you're coming back up for red speed okay come on up i wasn't expecting to talk about red speed um tiffany hudson plantation florida so first of all i would like to i have my list now of things that i wanted to present so you guys were aware of um red speed a little bit of their history but i would like to say i'm very disappointed in the mayor although i can't address him personally um i did have a lot of you know questions and publicly asked them you know emailed them but never heard back so i'm glad he's okay um but tonight uh i want the plantation residents to understand who red speed is maybe the council is not aware again i mentioned palm bay florida problems with the school zone cameras citations um and they had to do a ton of citations and refunds because they uh they were sending out the wrong things loss of trust they ended up getting rid of them i talked about manatee county uh jonesboro georgia 968 tickets were issued using the wrong speed limit so um that was seventy six thousand four hundred dollars they had to refund red speed um is fighting litigation in georgia involving claims including fraud and deceit money had and received and georgia rico allegations and those allegations uh are for racketeering um the point is that plantation should have been scrutinizing this company and i feel like due diligence might not have been done because a lot of these things were already happening before red speed was um granted this contract um i'm really not okay with the the uh i'm gonna have to look into this too and i'm talking to someone about it about looking into the validity of that test and the fact that i i believe that it could have been done differently i'm not sure how legitimate that is um after especially after reading uh captain rudolph brown's uh concern over the wrong numbers just days before he came to present in front of council um and and the question i keep coming back to that i think is pretty common sense i saw just now in the budget that you guys are banking on making millions of dollars off of people getting citations and this is supposed to be a violator uh funded program i think it's personally i don't think it's a legitimate way to uh make up for i think it's uh what the the property taxes which i think is when this is coming along um i think it's disgusting to be making money profiting off of people that are getting tickets um some of them have no idea why i think that's on purpose can i have a few extra seconds please so um and the biggest question i have is why the city is in business with a bracketeering um unethical company i mean you just have to google them and i don't feel comfortable with them being in our city i don't think that i think that plantation deserves better than that thank you thank you i don't have anyone else signed up um moving on to the consent agenda agenda which consists of five items does anyone member of the council wish to pull an item hearing none um mr conklin would like to pull item number four do we have a motion you'll wave okay so items one through five can be passed with one motion motion to approve the uh consent agenda item thank you do we have a second second all right thank you miss big girl please call the roll council member anderson yes council member andreyu yes council member fadgen yes council member reinstein yes council member orland yes thank you very much moving on to the legislative items there are nine items listed item number nine is simply a memo of deferral so there will be no public comment on that because that's a deferral item so we have item number six which is codifying the plantation acres improvement district mr ezreal this is first reading of an ordinance of the city of plantation florida codifying the plantation plantation acres improvement district special acts as ordinances of the city of plantation pursuant to chapter 2026-215 laws of florida amending the language from the special acts to conform to the provisions of the special acts and to the district now being a dependent district of the city of plantation florida as reflected on exhibit a providing for severability codification conflicts and an effective date thank you very much um any discussion from council council member fadgen um section 29-5 f each year in february or as otherwise provided by resolution on the um of the board the board shall elect from its members a chair and vice chair from among the supervisors can we just change that to say that the council president will sit as the chair well and i'm glad you brought that up because i was thinking also it's very similar with the cra is there a reason we can't just do all of that in november i mean it's really ministerial how yes you can and i believe i was under the impression that we did this for the cra in february so the answer to the question is we move the cra to february so it's it states i'm sorry to interrupt you it states in the code that it's um um that the chair is elected as to the creation the time of the creation of the cra which was done in february so we it was this was matched up so that's why we match so we could do that all at the same time okay in february and i thought that we did it we had moved to timber and that's why we added flexibility by allowing you to change it by resolution okay so we can so we can change it you can change it by resolution i mean so so once it's codified and right so again again the goal was to deal with a monster of a document special acts and if i might just say one other thing we had difficulty with the document so between first and second reading there's going to be a little bit of cleanup there's nothing substantive but some of the underlines didn't come through some of the strike throughs didn't come through some of the text from the special act that's being deleted didn't come through i didn't want to give it to you in advance in anticipation of additional comments you might have but just as a heads up okay uh that will be occurring council member fadgen so we don't need to make any changes to this we can just by resolution say that the change in our later day okay i'm fine with that thank you for that i did want to ask a question and my computer um let me pull it up but um there was the segment in there that talked about uh expenses that may be incurred by the director um does that need to remain in there uh it would help me yeah i know i'm sorry and i can't pull it up right where it was you know what mr ezra yeah if you can see it thank you march well enough um let's see i think it no i'm just trying to um oh uh here it is uh it's e it is uh 29-5e the board may provide by resolution for compensation including expense reimburses to its members right i don't know why we would need that unless i hear differently that's up to you that could be removed i would like i believe that might have been i think it was probably existing it was probably well no it this probably existed exists in the cra ordinance because we tried to make it somewhat consistent okay but if you there's nothing i don't even i don't see why any one of us would incur expenses for the so you agree with that i mean if that's a discussion with you and administration that it needs to stay but i don't see why it would need to stay okay i'd like that stricken please okay any other further discussion on that anyone from the public no all right um do we have a motion motion to approve um okay subject to the change thank you thank you very much all right uh ms beggro please call the roll councilmember inderson yes councilmember indreyu yes councilmember fadgen yes councilmember reinstein yes councilmember portland yes and thank you very much for your work on that mr ezra i know it has been a heavy left all right item number seven ia ff pension plan cessation of contributions upon attainment of maximum benefit this is a second reading mr ezra yes this is a public hearing second reading of an ordinance of plantation florida pertaining to the subject of retirement amending the general employee's retirement system by amending part one chapter 18 article 2 division 1 section 18-22 cessation of contributions providing for severability codification conflicts and an effective date thank you very much any discussion on the days any public comment mr conklin please come up sir as mr conklin comes president roland um can i i i know i've said this before and it's an administrative decision but i don't think the drop should be automatic i do think that each director should base that on the needs of their department and i'm all for increasing it but i think it should be based on need okay thank you dennis conklin 4581 northwest this court if i may approach yes mr conklin thank you uh the package that i just handed is a hard copy of what i sent each of you um yes in an email uh you got each of those uh i guess you get to look at a portion of them um this started basically back with the july uh 29th meeting uh agenda point 20 uh with the report date october of uh last year and it it proceeds up through last uh month uh september 26th with um three three uh agenda points 14 15 and 16 of which tonight you're going to re rehash i guess or reopen uh number 16 and 15 from the last meeting which i wanted to point out a few things to you um we're going the wrong way in about three different ways as i mentioned the mountain of money and then as you go through particularly to get to page um six and seven of the package okay you can see that the amortization which means you have to take out a mortgage to pay the pension off because it's unfunded to a certain amount that is increasing and also the funded ratio is going the wrong way because the unfunded liability is going the wrong way and basically this is all about the general employees okay so you you can see the chart for the general employees and if you go for the definitions okay from the federal government about pensions you have three statuses endangered which ours are pretty much constantly uh better than 40 percent of the time endangered critical which our police officers uh were for three years around 2011 which i believe is when they put in the 401k into their contract which was never started because you can see that the plan is funded percentage falls below 65 percent of the meets other financial distress criteria the plans trustees must implement rehabilitation plans you look at page five in the assumptions if i may extend please wrap up okay they use the same uh assumptions okay which is investment returns half of what the s p 500 has made roughly half because it's 11 15 percent and inflation of 2.5 inflation average for the last 66 months is over four percent so everything in this is haywire and it needs to be rescued you can look at the mr conklin please okay you can look right here okay with the warnings that i've been giving you particularly when they first brought this up um you you could have paid off both pension funds fully to 401k status which means they're not getting ious from the city they own it thank you for your comments mr conklin it would have been done for only seven million bucks you're you're in for basically a hundred million bucks unfunded okay i'll i'll uh thank you thank you mr conklin i'm going to speak on nine we appreciate uh no i said nine was a deferral memo i'm sorry eight you're coming up for eight whatever whatever the ones i put in on my request thank you you said nine but you're coming great thank you okay um god bless you uh we have a motion and a second and public comment uh miss bigaro please call the roll on item number seven i don't have a motion or a second i thought we had a motion nope i'll make the motion do we have a second second this figure i'll please call the roll okay councilmember anderson yes councilmember andrew yes councilmember fadgen yes councilmember reinstein yes yes thank you very much i remember a tier command iaff establishment of pension tier for eligible fire rescue command personnel second reading mr esrault public hearing second reading of an ordinance of the city of plantation florida amending chapter 18 pensions and retirement of the code of ordinances of the city of plantation by amending section 18-17 definite definitions and terms section 18-1 21 member contributions section 18-7 retirement dates section 18-28 normal retirement benefits section 18-30 early retirement benefits section 18-30.1 supplemental benefit and section 18-30.2 monthly supplemental benefit providing for severability providing for codification providing for conflicts and providing for an effective date thank you mr esrault do we have a motion motion to approve okay i'll make the second and mr conklin did you want to come back up on that item yes thank you uh on number eight you'll see the package is listed and if you go to uh pages six and seven okay you'll see that the the date of that was august 12th in last month the report that uh august the 20th had had projections that are basically worse than the report that you're getting on the 12th okay and if again if you'll just compare the the two reports okay and the two pages i'm asking for six and seven what you're looking at is the mortgage payment jumps to six million six hundred fifteen thousand seven hundred seventy nine in what's before you now okay it was six million six hundred fifty six thousand eight hundred forty in the most recent report okay so you go to you go to uh page seven and you see that the unfunded liability jumps to uh in in what's before you're now sixty four million forty nine thousand eight hundred eighty six but in the later report which has probably got extra figure in whatnot sixty four million six hundred ninety eight thousand fifty eight which the if you look at line j okay funded amount is 77 four on what's before you but on the one with the more updated uh report 77 two which to get back it winds up in the critical i mean excuse me not critical oh goodness no endangered so what does that mean it means that the let's see that's the police it means that where you were starting to recover it drops you back down into here so we're here now and it's it's projecting it's telling you this is where it's going and i'll yield back my time thank you mr conklin no further no i forgot if i may recover 16 seconds um i explained here that there are services that you can educate people on i i came from the boonies in new york state appalachia region okay i didn't know squat about investment or ownership i only knew banks savings and loans which crashed and burned in the 80s and insurance so that's where i had all my money i get down here thanks be to god because margaret decided she would put up with me and everybody as soon as they saw her phone number and zip code they were in a hurry to come and talk to us and teach us and instruct us it removes fear it it how do i want to say it it sort of like in dune if you ever read dune trilogies and stuff like that fear is the great killer that you get knowledge it removes fear and the difference i can show you in my own self right when i got out of those products which were all debt or ious and into ownership it makes a big difference thank you mr conklin i think those 15 minutes have expired or 15 seconds the minimum uh payment average okay is uh mr conklin 20 mr conklin thank you i'll yield that thank you sir but the difference is like 28 000 a year instead of 130 000 a year thank you thank you we do get we do get the point thank you very much sir all right we do have a motion a second this time uh miss spigaro please call the roll council member anderson yes council member andreyu yes council member fadgen yes council member reinstein yes council member horland yes thank you very much all right moving on to comments by the mayor sir mr anything yes um first and the the biggest is friday uh we're having the 25th anniversary of september 11th um event and we're going to live stream it and it's at the fire station 2 in in that area and um we've gone through it'll be a short program but i i think it's meaningful second um this week uh melanie griffin the head of the dbpr for the state came in and visited us which is very nice how how you doing and everything and um what i found interesting is that the biggest thing they're having issues with are restaurants and alcohol restaurants violating the clean air act in other words people smoking restaurants and people serving alcohol when they don't have a license so um that and and she's very proud of the condo ombudsman and saying that they're they're doing better and they're looking at a condo resource fair sometime soon okay so i'm glad to have that relationship in that conversation that would be great we had that condo ombudsman come and we had done it town hall several years ago and i thought it was very valuable um and i think since we've seen what happened um in miami that it would probably be time to do that again yes so very good um that's all i got okay thank you mayor i'm gonna start left to right and i've skipped council comments the last two meetings you're not gonna be so lucky tonight so councilmember andrea i'll turn to you thank you uh i know tomorrow we also have he means business uh jacaranda country club and that's sponsored by our plantation chamber of commerce um so i'll be attending that and as the mayor mentioned of course september 11th we will never forget uh and want to wish happy rosh hashanah beginning at sundown on september 11th right um also and that's wishing all of our jewish uh community a sweet start to a new year that concludes my comments thank you thank you councilmember anderson okay councilmember reinstein i want to thank the the city for um acknowledging and for holding um on on friday on september 11th the memorial um i i i think that uh you know as time goes on um we we too often um get so caught up in every day that we forget that uh there are still people today suffering um from um the aftermath of september 11th and um yet i i read the other day um a very wonderful story where um two individuals two young kids at the time who lost um parents um in the towers that uh they found each other um at a at a grief forum and um and have since married and um they have found um you know each other after this grief and uh this terrible tragedy and it was uh it was a beautiful recounting of how um we have opportunities to uh you know when we have opportunities to live it's up to us to um take hold of it and uh make the most of what we have before us uh and with that um i will add also my greetings um for all who celebrate a shenat which is a happy and healthy jewish new year so thank you thank you councilmember badger uh i have nothing thank you okay thank you um so first i want to start by passing on uh commendations to both the fire and the police department i was contacted late this afternoon by a resident from gatehouse on the green um who you may remember um was uh one of the individuals when we adopted the dog that i put up and that night and the next day he adopted the dog that i had featured and um he had made contact with one of his neighbors and they would take their dogs to the dog park together beautiful husky sent me a video of it today and he hadn't seen his neighbor in a couple of days and he grew concerned and he placed a call to the police department yesterday and um unfortunately they went in and the woman had passed away four days ago and was in the apartment with her cat and her dog um but he really called to say and while he was sad that he lost his neighbor the dog has been adopted by one of the other neighbors he couldn't get over the professionalism the kindness and the um thoughtfulness of not just the community service aid that came out but the fire and police officers who came out detective followed up today and so i really wanted to say chief todd and she schlegel you know we know the great work that your people do but this resident took the time to reach out and really wanted me to pass on his um gratitude so thank you for the sensitivity for your your departments and the way they handle that um i want to congratulate my colleague um lewis reinstein for being appointed the development code compliance and redevelopment policy committee um i haven't had anyone join me since the mayor got too busy to be on a policy committee so i'm thrilled that you'll be there i think it's important for uh the city of plantation um and as you've heard and you know that we have been fighting against preemptions for quite a few years so i'm happy that you'll be there on that policy committee um i've been asked by um the new president of florida league of cities to chair the advocacy committee which has been my baby for a while and live local has been one of the issues we've been fighting um as well as beyond the municipal operations and i did send out an email to some of the directors today we have an opportunity to put together some policy proposals for the legislative succession so if there's anything that you see um that could be changed legislatively please um take some time to send that information to me um several years ago i invited plantation resident long-time pal soccer coach jeff rosnick to visit us here he had received an emmy if you recall for his open dialogues black voices and black stories um documentary and tomorrow night jeff is premiering a reading of his play the resurrection of reuben stacy who was an african-american man who was lynched on davy road in 1935 so i'll be attending tomorrow with the rise in white nationalism and anti-semitism and hate against so many groups in the united states the lessons i feel in this play are more relevant than ever so i'm excited to go support a plantation resident as he premieres it's very important um play hometown beer hero banners are up and i just want to share and i want to thank public works for getting those out and for parks for facilitating um i'm so proud that we did this and i just want to share a story there's a a family long-time plantation family that i've been helping with a couple of other issues last couple years dad was a marine um and he passed away a couple years ago the the youngest daughter lives with mom and they lost one of their sisters a year ago and she sent me an email that they piled um all the grandkids in the car and mom and drove by and just were so incredibly grateful to see his banner hanging there so it matters to people so i'm really um proud that we passed that this is the third group and i look forward to honoring those residents when they come into city hall when the banners come down um again mayor so grateful and the fire department that we'll be doing something on september the 11th i'm wearing a pin tonight um it's a pin that i bought at trinity church in the lower east side of manhattan 24 years ago and it's the 911 miracle cross pin if you recall when the buildings came down there were steel girders that were still remaining in in the shape of a cross um and the purchase of this benefits the new york city police and fire widows fund and also the michael father michael judge fund and i just thought it was appropriate to wear it tonight as we remember those that were lost 25 years ago and finally i just want to say we've heard some comments up here tonight and at the last meeting about the comp plan and about live local and um i pride myself as i know my colleagues do on responding to residents and i think that this council and this administration has been extremely responsive oftentimes i send very detailed emails back but i found myself getting a little back and forth with people who are trying to tell me about live local by simply putting it in chat gpt and i i i feel that um we're being pulled into a little bit of disinformation campaign and what is upsetting to me is our processes being circumvented um i'm thrilled that people are getting involved but when you try to explain information they're still going with the disinformation and i think it's incumbent upon all of us up to here up here to um try to clear up some of those misconceptions um if you will because it's sowing distrust in this governing body and we've worked too hard to come out from under the shadows than we've been placed under in the last several years but it's also sowing distrust in our staff and our processes most importantly i see other residents that are being dragged into this unknowingly because i called several people that were sitting here last time and asked why did you ask for a deferral income plan and they said because i was told to and for me that's unacceptable so i think that when people are you know we're explaining to them um you know that we've been fighting live local for three years um it is not the position of this city to jump on every lawsuit and i'm sure the city attorney um might concur the way that it works is we try to fight the legislation and when other cities and counties sue to stop some of this preemption then you know the hope is that we will be able to benefit from that but um i certainly don't feel that we should be jumping on every lawsuit but i do feel council members that we should be doing our best to quell the disinformation because i don't like what it's doing to our staff and um and to the city so with that um i will conclude my comments thank you very much and it's 8 28 and we're out meeting adjourned
