code enforcement special magistrate hearings special magistrate is charged with conducting hearings to determine whether an alleged violation of the county code has occurred in order to meet that obligation all parties or their representatives will be allowed an opportunity to be heard on matters relevant to the alleged violations all witnesses offering testimony or presenting evidence will be nothing but the truth i do now you may have a seat and the county may proceed thank you magistrate before we get started i want to make it clear for the record um that citation number clb ct25-00891 was previously null prost by the county back in january so that citation will not be we're not moving forward on that one today so we're solely here for the 892 citation for subcontracting to an unlicensed contractor okay thank you magistrate good morning investigator good morning can you please summarize the facts and circumstances including any supporting documentation regarding the citation we are here for today yes good morning magistrate magistrate magistrate division court uh today uh my exhibit one uh received a call from the sheriff's office a deputy richard trump informing me that at this particular address 2702 bay shore drive bellair beach there was some work being done that permit wasn't pull and there was unlicensed contracting uh so at that time i decided to meet with the deputy out at the property to investigate the alleged um construction that was taking place i'd like to enter this into evidence as exhibit one and before we enter that in investigator nichols can you please um for the magistrate's understanding and for everyone in attendance um go a little bit into what your when your investigation began and and just the background of your investigation sure so my uh investigation started on june 17-17-2025 when i accompanied um the sheriff's office deputy richard trump from the panellas county sheriff's office to mr fuat's uh residence there was uh there was uh not evidence but there were um allegations that um mr kirkiney the homeowner failed to pull a permit and that an unlicensed contractor was building a fence with that i went out there and met with the homeowner and his um wife um he explained to me what he was doing and he realized that he failed to pull a permit the way it worked is because bellair beach we have an interlocal agreement so when they do the paperwork with bellair beach they're supposed to submit that paperwork to the building department to get a permit to be issued to do the work during that time mr kirkiney was building a wall around his property uh property uh without a permit being in an issued status also there was work being done by unlicensed contractor spoke to mr kirkiney he contacted the unlicensed contractor via telephone it was a three-way conversation with myself mr kirkiney and um the unlicensed contractor which is um baldera's masonary and he informed me he had a license i asked for the license number the number he provided to this investigator was a number that normally you would get from sunbiz i informed mr um lewis baldera that that is not a license it basically is just a tax id number that sunbiz give for records or for uh paperwork or if you're a process server or something it's just a business tax receipt he understood that oh he didn't have a license and i informed him that he was not able to work in pinellas county because he's not licensed unless of course he is he applied for his c license through the county or through dvpr he understood that so after that i continued with my investigation through the building department i found that while the work was being done it originally started back in may of 2025 where mr kirkiney was building a fence on the permit it says fence which i'll show evidence later but it's actually a structural wall a six foot structural wall around the property which the building department was kind of confused because on the permit which i will introduce in a second shows a fence with that i put a stop work order on the property and for mr kirkiney that he must obtain a permit and that he must hire a licensed contractor due to the nature of the structural wall he agreed to do the permit permit was eventually pulled and permit was issued in june i'm sorry july 7th of 2025 with that mr kirkiney said that he will continue to work during that time he was issued citation i received a second call from the sheriff's office in november 13 2025 alleging that there was work continuing without a licensed contractor myself the sheriff's office and the city of bel-air beach city manager decided that we were going to visit mr kirkiney's property he did give us permission to go into this property to check the basically what was going on excuse me at that time we noticed that the fence in this case the structural wall was basically 90 95 percent completed again at that time i asked mr kirkiney did he hire a licensed contractor or provide a engineering plan the building was requested and he said no he did not at the time at that time my department pcclb decided we were going to put another stop work order on the property until a licensed contractor and the paperwork for a structural wall meaning the engineer we need engineering plans to show that this is actually structural minded and we needed and we needed a letter from a engineer and submitted to the building department so that brought me to where mr kirkiney was cited again for um unlicensed subcontracting to a unlicensed contractor um for a second time thank you investigator for detailing your investigation can you please explain a little bit regarding i know you mentioned a citation had previously been issued and then you went back out in november um to cite for subcontracting to an unlicensed contractor can you explain a little bit more you mentioned previously having a three-way call with mr balderas mr kirkiney and yourself um please explain or detail a little bit more regarding the november and issuing of the subcontractor citation thank you no worries so in june originally when i went out there he was cited for not pulling a permit and for subcontracting to a unlicensed contractor um those were the two citations at the time due to the fact that the violation occurred during that time myself and the sheriff was out there so those citations was issued to mr kirkiney there was a stop work order issued at the time the citation was paid to obtain the permit that time so the second citation that was issued in november um mirrors the first citation of subcontracting to unlicensed and the reason for that is because when i called mr lewis balderas for the second time this is after we spoke with the three-way conversation mr baldero did admit that he was out there working helping mr kirkiney build the wall the original call was that he was he was building the wall because he was hired by mr kirkiney to build the wall so with that um the citation was issued to mr kirkiney in november because when i spoke to lewis baldera unlicensed contractor he did admit doing the work so with that the citation a second citation was issued investigator did mr kirkiney ever admit to you regarding hiring mr balderas either for the first and or the second citation or second time you were out on the property so yes when i went to visit mr kirkiney uh several times on his property he admitted that he did hire mr lewis baldera to do the work um during my maybe my fourth or fifth visit mr kirkiney said that um that he let go mr lewis baldera since i informed him that mr lewis baldera was not licensed he alleged which i documented that he no longer used mr baldera to do the work that he completed the work himself along with some family members okay um county will go on and move in the email from deputy trump to investigator nichols in his county's exhibit one any objection to exhibit one just coming into evidence i mean you have i mean there's you can contest no i'm just wondering if you have an objection to putting it into evidence it doesn't mean you can't fill in the gaps or that type of thing can i see what this is yeah i mean i have some things that is not correct okay so can i say something am i um we're we're at a point where you either object or not you get it you get an opportunity to discuss that document even if we admit it into evidence yeah there there's a few things that you hear from me as well sorry okay um i'm going to go ahead and admit it as exhibit one subject to in your case you filling in the gaps and saying what's wrong definitely what i heard as far as him coming back in november he didn't he didn't come back june 20th on once i knew he was not licensed because mr bondaris um the way i found out where he was um i found out about him not because i somebody told me but he was in the neighborhood building homes so i took his number and thinking that he's licensed because he actually was in the neighborhood for six months building a a complete structure so when i called him he came in and i went with the mind that he's licensed i knew he had he had a son this further than that i didn't question because he was in my neighborhood and he also built a whole bunch of house in indian rocks so when i found out in june 20th when he when i called him and i said louis are you not licensed because and he was next to me and then that's when i found out he was not licensed so once i got my citation after the june 20th he didn't even want to answer me anymore he never came to my property so the fact that mr trump um and um the code enforcer um mr nicholas says that i brought him back in is completely false all right we'll admit that into evidence as exhibit and we'll consider that part of your part of your testimony what you just said yeah and i did pay the earlier citation but the last sound citation is 892 um which says shows that i brought him back in after finding out he was not licensed that's no no and throughout the whole time i've been very close to with the city of valor beach um kyle i have like 20 emails back and forth between me and him he already knew i was building a block wall uh an inspector came in before they poured the concrete um his name was um from the county he said i never seen anyone do wall this good go ahead and let them pour and there's an email back and forth between me and kyle uh at the bell air that this was not a hidden thing like everybody knew i was um building a wall magistrate county requests to continue on with their case yeah um you'll have an opportunity to present your whole case okay so the county may proceed sorry i don't know the order of things i understand okay thank you magistrate exhibit two is the property appraiser for mr fuet kirkini it showed he's the owner at 2702 bayshore drive delia beach in florida also showed that mr kirkini owned this property he's that mr uh owned this property since 2006 so obviously this property belongs to him and this is where the uh construction's taken place the uh normally with a property appraiser it normally lists the uh permit number a copy of the permit shows that it was applied for on may 12 2025 however the permit was issued july 7 20 to 5. during that time construction was taking place the unlicensed contractor at the time and basically the description of the work says that my neighbor and i our wooden fence was destroyed by hurricane milton and halim and that they're building a fence however it was unclear to building what type of fence until we decided to go there's i'd like to enter the property appraiser and the permit attached as evidence county's going to move solely for the property appraiser printout in as county's exhibit two and we'll move for the permit printout in as exhibit three with an additional document that nick that investigator nichols um still needs to address so just moving in exhibit two is the property would you show it to uh mr kirkini yes what's your exhibit two is admitted into evidence three shows that uh mr kirkini signed the permit with the building department to build the fence in this case the structural wall there he signed the owner contractor affidavit which a person who is um homestead he can sign to do the work at their own house however there are stipulations in here i highlighted number six which every homeowner or consumer that signs this understands that i understand that i may not hire on a licensed person to act as my contractor or to supervise a person working on a building or residence county now moves the permit printout in and the owner builder affidavit in as county's composite exhibit three any objection to exhibit three um in a nutshell just high summary what is what is exhibit i heard what he said exhibit three is the printout from the building department of the permit application and just the acela printout where it details the permit and then and i'll put it here on the screen and you should be able to see it on so it's clear for the record and then the owner builder affidavit with your signature and then the secondary page stating okay we'll get to that as the hearing goes on exhibit three will be admitted into evidence here i'd like to introduce exhibit four uh when i spoke to mr kirkini he provided or showed me a copy of the contract draft bid on his phone and that he would send me a copy of it showing signatures between mr lewis baldera and mr kirkini however what he sent me was a rough draft showing mr baldera's son masonry that is the unlicensed contractor uh bill to joseph joe mr uh fuet is referred to as joseph showing the work that will be done to the wall and the cost on it i requested an original copy of the contract bid quote he showed me but at that time he said he was not sending it to me he did send me this rough draft and along with this rough draft it shows that during my investigation that baldera's and sun masonry is an actual business listed in the sun biz that we spoke about earlier and also that mr lewis baldera is the owner he is his electronics industry show he's the owner of baldera and sun masonry and a google shot showing that mr baldera and sun masonry is a company that is located in the tampa region ruskin i'm assuming that south of tampa of us-41 i'd like to enter this into evidence exhibit four and investigator nichols regarding the conversation that you had where you were shown a photo of the contract when approximately did this conversation occur with mr kirkini the conversation thank you was it it was june or was it in november well it it was originally this was provided to me in june 20th okay county moves for the documents in his county's composite exhibit four any objection to exhibit four yes so at exhibit four he uh the the term he used was a contract this was not a contract this was an estimate that i got from him that shows me what it takes for him to get the work started so there was no contract written contract with my signature and his signature on it all right i understand the distinction that you're raising uh we will admit exhibit four into evidence five this normally as an investigator what we do is we tend to check databases we check our system we have a system through pcclb we also check dbpr which is a licensing database for the state and numerous other sites to see if mr lewis baldera holds any type of license for any structural um licensing while i checked there was no listing or no license appeared in any of the database showing that mr lewis balderas is an unlicensed contractor to do the scope of work that he was doing in pinellas county also i checked because mr kirkini is a homeowner he is the owner builder that pulled the permit i checked same database to see if mr fuet kirkini holds any type of licensing for structural engineer and i checked our system dbpr through the state and other systems and there was nothing came back showing that i either party held any type of licensing to build a structural fence county moves for the affidavits of non-licensure and his county's composite exhibit five any objection to exhibit five yeah again uh i object because again terminology he's they're using the terminology of a structural wall this is a basin or six foot uh fence wall that goes around structurally it's not whole like to me the terminology of structural means it's holding a structure it's not it's just a fence around around my yard so terminology means a lot to me and that's one of the issues that i'll get to determine i suspect um we'll go ahead and admit um and one other thing up to four composite exhibit five exhibit five yes one other thing that um i heard from him earlier there was no structural engineering drawing there is a structural engineering drawing i hired the company uh because when i did a supplementary uh uh permit to the existing permit the the county told me that i need to have a structural engineer verify it so i did get the structural engineering sealed document they never mentioned it but it's in it's in the books all right thank you to talk about exhibit six this is on june 20th dated june 25 june 20th 2025 when we originally got this complaint myself and deputy richard trump went to the property this is a before picture as you can see this is his front entrance where he is building part of a fence structural wall uh staircase here you can see that it was started on june 20 or actually this is when my investigation started this is june 20th a stop work order was placed on the property this is june 20th we moved to november 14th as you can see june 20th i was on this side of the wall or this side of the staircase now i'm on the inside where i took a shot of it on the outside showing that it was completed this is a november shot i took this picture on november 14th as you can see the before and after here is the site of his house june 20th we have basically a rough working off what appears to be a staircase that goes into his backyard june 20th november 13th it's basically basically completed the second shot here is june 20th he is considering this a fence obviously inside the buildings apartment talking myself this is considered a structural wall that he is building there is already a fence there but he's building an alleged fence this is june 20th 2025 this is me taking it facing looking towards the back and here's the fence november 13th i'm in the back taking picture forward showing that basically the fence or in this case a structural wall was completed this stock work order matters because as you can see the stock work order was written on 11 13th that's the day myself the city of bel-air and deputy trump went to the property the picture was taken on november 14th that's the conversation i had with mr louis balderas i called him numerous times leaving messages it's important he finally called me back this is the day he told me he assisted he helped him finish the wall or build the wall why i went back out there to put up a stop work order because mr baldera's testimony to this investigator informed me that he did help build this wall like to enter this into evidences six county moves county moves for the photos from june and november in his county's composite exhibit six any objection to exhibit six yes so um these pictures are all perfectly dated i i don't have any um objection to that but what i what i why we are here is we're for that citation number eight nine two then thinking that i bring mr louis um benduras back to build this uh to finish this which is false he never came back to do this wall the stairs um um and the wall was never done by him he never even stepped the footprint nor him or the crew in my property to say i brought him back to finish this all right and that's why i'm here right i understand what the issue is um we will uh admit exhibit six because all it is is the photographs thank you magister if we could have just a minute as we're locating a document your honor mr kirkini mentioned the um engineering plan so i contacted russell roland it's an engineering firm um the important thing that that i wanted to touch base with to let inform the court about when i touch base with him the engineering firm originally that allegedly designed the wall it says our signed and sealed plan is for the actual structural design of the intended wall here but we are not providing any approval of what was actually constructed so what they're saying is what he constructed they are not putting their signature on that i have not received any information after the engineering plans were sent to this client so basically mr kirkini sent a copy of a this is their this is what the engineering firm sent mr kirkini and what mr kirkini have as engineers plan they are not putting their signature or name on that because that's not what they approved i'd like to enter this into evidence as exhibit seven seven county moves this in his cop county's exhibit seven any objection to exhibit seven so yeah as i said earlier when the county asked for me to provide uh engineering document this is the one that i call russell and roe and i've been in business with him in the past and he did provide me for the supplementary uh permit that i applied but what i want to show you here is when i said when when i was um i don't know if you can see it in the in the screen magistrate this this is more what you're going to present in your case okay right now we're just talking about this exhibit seven yes so then you'll have an opportunity to cross examine investigator nichols and ask him questions no no worry but i just want to um just as a last thing i want the the engineering um drawing that you see there it was for the wall that he showed the picture earlier which it's it's an area where i put for like a barbecue area and the reason why i didn't get a structural drawing for the larger wall it wasn't necessary because i i have an email here where the inspector looked at inspect the wall before we poured and he said it looks really good which is may 15. so everything was all in the open um nothing was again i thought we were here for me bringing bolderis back that's what we are but um yeah in a case like this they have to lay a foundation and that's what they're doing that's fine but i i have my evidence okay thank you exhibit seven will be admitted into evidence investigator nichols i know that you discussed in november having a conversation with mr balderas stating to you that he finished the wall on the property is that correct so when i contacted mr balderas on november 14th he was not giving me all the information he did when i asked him again did he finish the wall or did he come back to do the work he told me that he came back to help mr kenny kirk kenny finish the wall build a wall the original time when i spoke to him he said he was he he basically had an agreement where he was paid to build the wall which he started the wall that conversation in november 14th he only said that he came back to help mr kirk kenny build the wall so he didn't do it by himself he assisted mr kirk kenny when i asked him on november 14th and regarding mr balderas are you aware or did mr kirk kenny and or mr balderas tell you anything about mr balderas's w-2 status with respect to mr kirk kenny if he was employed by mr kirk kenny as an employee so i asked mr kirk kenny was mr balderas on his payroll or a w-2 mr kirk kenny said no he was not he was not aware about the w-2 but he was never on his payroll and in november when you were having conversations and went back out to the property did you have a conversation with mr kirk kenny regarding mr balderas yes i did i asked but he was upset at the time because myself the city manager and the sheriff was there and i get where he was coming from that we were all in his property but he wasn't giving me the answers i was asking he basically asked us to leave his property that he was done with all this all right i have okay you'll have an opportunity to present your case i have no further questions for investigator nichols all right mr kirk kenny this is your opportunity to ask questions of investigator nichols if you don't have particular questions of him then you'll have an opportunity to present your case so i do have a questions number one um starting from the very last statement he said i asked them to leave i'm very respectful to the city i work with kyle kyle was there he's the city manager i would never tell people get off my property and leave that's completely false i'm not saying that that's important for this case but i'm not that type of a person to kick people out of my property when they were there so to me that's a broken glass whenever you see a broken glass there's other things maybe happening when i see a false statements like this could that be carried throughout the whole whole uh hearing here did you have any questions of him uh because you're kind of presenting your case right now which is you're going to have an opportunity to do that yeah so my question to him is i called uh lewis um many times he never returned my calls um after june 20th when when he was in my property on on june 17th i was aware that he's not licensed uh he never came back and i asked uh mr nichols can you show me evidence what day he came here because he was never here and i don't remember what you said i mean did you say he was here at this day because i don't think i mean you didn't know when he was here there either like you have no evidence to show that he came to my you're arguing now i want you to ask him a question that he can give an answer to can you please show me the evidence that uh mr lewis boulders was in my property after the 20th because that's why we're here so he did ask that question and i said that i don't have the evidence that he was on his property however i did tell mr kirkini that on 6 17 that's when we spoke to lewis i attempted on 6 20 6 23 7 1 and 11 14 where i made numerous calls and he called me back and i told him those are the dates i tried or attempted to call mr balderes and he returned my call on 11 14 20 25 where he told me that he assisted mr kirkini to put the wall up and that's the very day i also went to his property to put up the stop work order all right that's his answer but he was never there you may not agree with his answer yes and you can bring up your own i need to see evidence basically okay other than what he said i'm i'm the one both of you need to show evidence to so but do you have any questions of him before you proceed with your case yeah questions mean you ask him something and he says yes or no or this is what happened so just a general question this was my first experience with the county and doing something permit permitting something and i i will come to my questions and then i hire somebody that who was in the area doing work like wouldn't them know that like this person was doing homes in the area for years i i have three homes that i know he did like why would he be doing other people home not running into any issue but me that's my question i don't understand then you may overrule i think you understand the question i do yes would you please answer it so mr kirkini did mention to me that mr lewis bilder has built all these buildings i did inform him that i only investigate the complaints when they come in this complaint came in on that specific date where he did not pull a permit and he had a unlicensed contract and this complaint came from the sheriff's office what that's when i investigated if he would have filed a complaint with our office alleging mr lewis belderas did those work i would have initiated a investigation to see if he did so we don't just go around because he say she say he did the work here and there i am investigating the complaint as they come in now i did take it into consideration however when i attempted to call mr balderas on the dates that i provided to the courts i did not get a response from him until the 14th only asking about this specific work he did at this house that was my concern that was the investigation that was the complaint that's why the case is open it wasn't about anyone else no complaints came in there's nothing in our system showing there is a complaint that a unlicensed contract is working on other houses it was mainly at the property at 2702 bayshore drive that's my investigation that's where i was doing my my my investigation my evidence why i came in contact with mr kirk kenny and i investigate talked to him interviewed him he gave me the answers the questions everything and i'm that i'm presenting today in court again we're here for a citation that's 500 and i'm rejecting that's what reason i'm here um he's he's saying that i brought him back uh after june 20th i he never came back i never brought him back i think it would be nice for you it's much easier to follow to focus on that because i did pay the other fees uh not having a license working with without having the even the permit was in place in the queue but they it was it wasn't there quite i paid for all of those fees but the reason why i'm here is the citation ending with 892 they're saying that i brought him back in after june 20 and i'm just saying i didn't bring him back okay i understand what the issue is any other questions and then you have an opportunity to present whatever other i don't have any other questions okay you may have a seat thank you you may proceed to supplement what you've already told me yeah so um early in may um may uh 15 right around may 13 the city of uh bel-air and me we had like 20 emails here i don't know if you can just see within that same week and i asked kyle to send me somebody before we pour the wall and he did the inspector came in the only reason why i'm showing this we we weren't building this is may 13 we weren't building a like a what they described fence i may not pick the the right uh application pull down when it says what are you building uh i don't know if the option was there for masonry wall but they knew way back then in may 13 this was a masonry wall so the inspector came in he looked at the i told kyle that he was here and this morning he came and gave me a wearable approval he liked what he saw he said it's okay to pour concrete tomorrow which is i scheduled the morning tomorrow and so that was it and then kyle said this is an excellent news thanks for sharing i'm glad it worked so like i've been in touch with them they know what i was building the only thing that i was missing and i didn't know about i thought i had a even a permit uh the only reason why i didn't have the permit apparently i was missing uh this affidavit signature one pager that i was missing uh when i uploaded all the documents to the county so i just wanted to give you this little background um because uh the the con the the city and the county knew what i was building they even sent me inspector to to to look at the structure of the wall and they said let him go ahead and pour um so i'm just going to mainly focus on like this citation that i'm rejecting to pay which is 892 they're saying that they talked to mr balduris and he came in and helped me with the wall that is completely false nobody within his crew nobody him not nobody in his uh team came in and helped me with a ball wall i did not hire him back and that's what i'm gonna just have to um like basically um um say as far as that goes because it's it's false it's he he was never came back and i wouldn't take what he said over the phone to him that oh okay i came back i need evidence that he was on my property and there was no activities going on and when he said that officer trump called him on the november 15 or something there was no activities going on in my yard i hired somebody came in and do a a stucco uh kind of wall which was a shoulder i don't know if he got convinced uh if they got um misunderstood this was a builders but builders himself period never stepped in my in my yard after june 20th that's it okay any cross-examination by the county good morning mr kirk kenny good morning um if you could just clarify again what you just stated you is it correct that you said that you had someone come in to finish the stucco portion on the wall is that what your testimony was so the the there was a stucco work happened um in the uh a smaller wall which was um like i have pictures of it to it but anyway it's it i don't want to go too much deep in the stucco because it's not part of this larger conversation i'm only saying that because i don't know which day they were there too um and they're um i don't know if that is that why the reason he got a call but it was not mr belder is finishing the wall and so who did finish the wall if you're alleging that it was not mr belder is who finished the wall there was nothing appropriately done on the property after june 20th period i i have four boys me and the boys we we work and and finish what was left it was like 15 bricks and i was able to do that it was all done independently okay so sorry can i have your remove your computer screen so on this photo from june 20th we can see that the wall is partially finished and then and these are photos that were already entered into evidence and then and on november 13th the wall is completely finished is that correct yes so what's what's what's what's missing from what was missing from this wall i think they were like almost like a 12 or 15 bricks which is end up finishing the wall and this was what needed and so you said that you and your sons finished we were able to to do this the key is i did not bring belder is to do that well are magistrate fuller my name is officer hughes i'm the magistrate officer with the code enforcement division of pinellas county pursuant to article two or excuse me chapter two article eight of pinellas county code and chapter 162 of the florida statutes pinellas county is seeking a motion to remediate code violations against the following respondent j scott fisher the property in which the county is seeking remedia remediation action against is located at 507 11th street palm harbor florida 34683 this property is a non-homestead property in unincorporated pinellas county the county would like to submit into evidence the motion to remediate violations which consist of a history of the case and the attached exhibits okay so we have the notice of hearing um for today april 17th at 10 30. we have the motion to the remediate the code violation and i'll go through what's included on the um for all the exhibits exhibit a includes the um pinellas county uh property appraiser document showing the owner of record we have the warranty deed um showing mr fisher as the um owner of the property we have the notice of hearing that exhibit c is the notice of hearing showing the original hearing date of august 22nd and excuse me august 8 of 2022 we have the affidavit of violation and request for hearing um for that uh hearing back in 2022 it was for the trash and debris violation 58-304 um exhibit d is the order assessing the administrative fine until compliance is achieved what was recorded on october 26 of 2022 exhibit e is the affidavit of non-compliance showing that it was not in compliance by the deadline date exhibit f is the lien that was recorded on january 9th of 2023 for the uh trash and debris violation exhibit g are the um photos of the trash and debris violation which includes the overgrowth um just to give a little history i have attempted to get a hold of the um the owner mr fisher um i made a couple of phone calls have never since last year and have never been able to get a hold of him we did reach out to pinellas county public works and they did clear the right of way at one point um but of course we needed the remediation order in order to go further we do continue to get complaints from the neighborhood on a regular basis hence the reason we're seeking the remediation um additionally i have been told by the um the neighbors that get whether you consider this hearsay or not um and not that it really matters that he's actually not residing at the property they do see him occasionally but um apparently he's been living with his mother over in east lake um so anyway these are images of the overgrowth you have a shed in the back um that's pretty much covered with overgrowth you can see um right here is the adjacent property and um what's next door is um full of vegetative debris and overgrowth you can see in the right of way um other than the right of way that was been cut by the county it's well over several feet tall there's quite a lot of dead vegetation that's lying on the ground and around the property again just more images of large amounts of overgrowth and vegetative debris same there's a car that is actually registered even though it doesn't look like it's moved in quite a few years um that's just surrounded by overgrowth overgrowth you can barely see um the structures that are on the property anymore from the amount of overgrowth just more pictures showing the same and um this is basically just from the front of the house again there's the car that's pretty much buried you can't hardly see the house nor the shed that's behind it so i did go back to the property on april 16th uh basically yesterday just to see if um he just hadn't contacted us and perhaps had brought the violations into compliance and there's really been no change i've just got a few pictures showing the same it's well over several feet in height pretty much throughout the property other than that area within the county right of way that they've been cutting so the property does continue to be owned by the respondent the property does not currently have homestead status um i don't know if you need that submitted and i don't know if it really matters at this point but they did uh remove his homestead status and i do have um the property appraiser document showing that that let's go ahead and put it in the record okay so i will we need to get all this stuff admitted into evidence too oh i'm sorry sir yes i do have the exhibit h and give it to nicole okay okay so we're admitting into evidence exhibit a exhibit b exhibit virtue of pinellas code enforcement special magistrate lien in the amount of well over twenty thousand dollars this lien is accruing daily fines in addition to interest the petitioner provided respondent with notice that the property was found to be in violation of the county's ordinance petitioner provided respondent with notice that the property remained in violation of the county ordinances after respondent was afforded due process and given a period in which to cure or remedy the violations of the county's ordinance of the property the respondent had actual or implied knowledge of the process and procedures employed by the petitioner its code enforcement division and special magistrate for imposition of the code enforcement lien the property has remained in continuous non-compliance for more than three years following the magistrate ruling and no efforts have been made by the respondent to bring the property into compliance with the executed order magistrate based on the evidence provided in the motion the county requests that you issue an order granting pinellas county the ability to make all reasonable repairs to bring the property into
