Welcome to Pinellas County Code Enforcement Special Magistrate Hearings. The Special Magistrate is charged with conducting hearings to determine whether an alleged violation of the county code has occurred. In order to meet that obligation, all parties or their representatives will be allowed an opportunity to be heard on matters relevant to the alleged violation or violations. All witnesses offering testimony and presenting evidence will be required to swear or affirm that the testimony they provide is the truth. The order of presentation will begin with the county presenting their evidence of the alleged violation or violations, and then the respondent shall present his or her case. Both parties shall have an opportunity to cross-examine all witnesses. The Special Magistrate may question any witness. The Clerk will announce the names of the cases from the agenda. When you hear your case called, please respond by coming to the podium with your representative and or any witnesses to be sworn in. When addressing the Special Magistrate, please speak clearly into the microphone. Any person who decides to appeal the decision of the Code Enforcement Special Magistrate with respect to any matter considered at this hearing will need a record of the proceedings, and for such purposes may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based. Such record is not provided by Pinellas County. Please call the first case. Item 4, Department Code Enforcement Matter, Short-Term Rental Violations 58-444-22-319, aye. Case number CCM-26-00116. Officer E. Stevens, owner Coolage Christian. Notice address, Coolage Christian, 4 Dorado Place, Clearwater, Florida, 33764-4861. Violation address, 4 Dorado Place, Clearwater, Florida, 33764. Is anyone here? Is Christian Coolage here? Good step ups. Good day, Your Honor. Good day, sir. Could you state your name for the record? My name is Christian Coolage. Officer? Officer E. Stevens with Pinellas County Code Enforcement. You have witnesses here today. You want to swear any in now, or you want to wait until I can do it when you call them? We can swear them in now. We have, I have Barbara Clare. When all the witnesses are stating their name, if they can say their first name and then slowly spell their last name. Thank you. Officer, if you could give them a step aside, Mr. It'll be, um. Elijah, for a second. On the, Sandor Fousey. State your name for the record. Sandor Fousey. Barbara Clare. Officer Wayne Holliday. And you have a third, another one back there? Fousey. Please come up to the microphone. Kathleen Fousey. Okay. How do you spell the last name, please? F-U-Z-I. All of you, including you, Officer Stevens, raise your right hand. Yourself included, sir. Uh, do you swear a firm that any testimony you give today would be the truth and nothing but the truth? I do. Um. Officer, you could have them sit down until you call them up. It might be easier for you. Yeah, I'll call it at one at a time. Mr. Gleis, you could stay right here. Magistrate. The property where the alleged violation exists is for Dorado Place. It's located in Clearwater, Florida, 33764, located in Unincorporated Pinellas County. The owner, Christian Coolidge, is present for today's hearing. Um. For the case involving the 22319 magistrate, we've come to an agreement. He'll have 30 days to take care of that item. Is this 22319-I, that item? That is correct, magistrate. Okay, so to register it as a short-term rental? Yes. He still has one, uh, website that needs to be addressed, and I'm giving him 30 days to take care of that, uh, with only having to pay the court costs associated to that. So he already has a certificate of use? Yes, he does. And that's the violation for under I? Is that what you're telling me? Under I, it would be the advertisement, sir. Yeah, I'm just checking. I don't have an arrest, I guess. I believe that's correct. Yes. Okay, and, uh, what's your understanding of the agreement to do that? How long? And, uh, we're gonna get, I'm gonna give him 30 days, uh, to take care of that with the, the means of only paying the court costs associated for today. Uh, we also have a case involving 58444. Hold on a second here. Is he agreeing? It's 30 days, 30 days to, uh, comply with the advertising issue, right? Yes, magistrate. Sorry. Just give me a second. I want to make sure I get this. Um, just the cost? Yes, sir. What are the costs? Do you know? Uh, it's gonna be 420. Okay. Go ahead, sir. You were saying? I interrupted you. Um, my, my misunderstanding. Um, we're gonna proceed with the, the other violation of 58444. 584. That's the noise, I presume, right? That is correct. Okay, I'm familiar with that. Um, Mr. Koulage, with regard to, um, what the officer just stated about the advertising issue, is that your understanding you're gonna comply within 30 days? Correct. Yes, I understand. And so no daily fine if he doesn't or anything? No daily fine. Okay. And you're gonna pay the cost of 420? Okay. And just... I agree. Okay, thank you. And what we're doing here now is they're putting on a case that there was a noise violation of the short-term rental, and that's all we're gonna hear now today. Okay. Go ahead. Thank you. Thank you, Madam Secretary. The violation haven't been the current since on or before June 1st, 2026. I would like to enter the notice of rescheduling, notice of hearing, affidavit of violation, composite of exhibit A into evidence, which includes the notice of violation, Fidel's kind of tax collector, property appraiser, D, short-term rental certificate of use, informational letter from divisional manager and housing official Jude Reason, a notice of occupation violation letter, affidavits of unreasonably loud and ruckus noise, Barbara Clare and Sandor Fuzzi, a seller record, rental unit record, Airbnb and VRBO website listings active and in violation at this point in time, that does have any relevance in that part of the case. It does or does not? Does not. Okay. Um, Mr. Collage seen these documents? Uh, yes. You wanna put them all in as one? Yes, they already in as exhibit A, sir. I might have a couple of questions. Um, do you have any objections to the documents? To the evidence itself, uh, the videos, um, I can't dispute them that much, they are what they are, uh. Hang on a second, you say the videos, he hasn't put any videos in yet. So there are some, uh, there are some recordings, but I'm guessing it's from, uh. But we're not up to those yet. Okay. He hasn't tried to put them in yet. Okay, sorry. Just these documents here. Just, uh. Yeah, yeah. Noise order violation, I, I understand everything that's here. Um, my question is, do you have any objection to him putting these into evidence? Not that it's true, not that they're correct, just they want to put them in the evidence that they're relevant. I don't have any objection, no. Okay. I'm gonna accept composite A, uh, into evidence. Okay. We'll call it A. Is that work, Carolyn? Yes. Okay, give me a second here. I'm just seeing this for the first time. So we have an affidavit of Barbara Clare, is that correct, officer? Yes, we have multiple affidavits, uh, from Barbara Clare. Okay. Okay. And we have one from Sandor Fusi. Okay. So we have two different ones, 5-23, 8-7-8-8, those are the four dates, and there's an attachment to it. Is that Barbara Clare? Yes. Um, and you have Sandra Fusi, am I getting that right? Yes. Yes, magistrate. Okay. All right. I just wanted to be, make sure I had it. Okay. Great. Magistrate, would you like me to go through Exhibit A? Through it? You don't need to go through it. I'm accepting the evidence. Okay. I can't do that, whatever's easier for you. Thank you, magistrate. Yeah. Just wanted to make sure. I just wanted to make sure I had everything. No problem. If I, if I may, I'd like to call, uh, to the stand, um, Officer Wayne Holliday. You may. Officer Holliday. Well, are you going to be able to do that with one microphone? Yes. Okay. Sure. You stay right there, Mr. Collage. Officer Holliday, how long have you been investigating this case? Uh, since 06-01-2026, June 1st of this year. And in what capacity, um, have you worked on this case? And, uh, how many times have you spoke to, uh, um, Mr. Collage? Um, there were several violations on the property on June 1st, uh, which included the short-term rental advertisement violation, the zoning violation for previous, uh, material in the back along with a deck that wasn't gone through the permitting or the zoning clearance process, along with a noise case and a, um, a trailer that was on the grounds of the property that wasn't plated. Um, I've spoken with the owner several times at the beginning, let him know what the violations were, um, attempted several other phone calls. Unfortunately, his mailbox was either full or wasn't accepting anything at the time. And then the night of, uh, August, uh, 22nd, I gave him a call again. Then he gave me a call, uh, first thing in the morning on August 23rd. Mr. Collage? You say he, he, Mr. Collage? The owner, yes. I'm sorry, go ahead. And he had a representative, too, that never returned a phone call, to my knowledge, uh, from the night of August 22nd. Go ahead. Um, did you, uh, recommend some, um, housekeeping or some recommendations for his violations at all at any time, officer? Correct. Uh, our first encounter, we talked about the four separate violations, talking about the short-term rental. I prevented, or I provided a, um, a little cheat sheet on all the recommendations or all the requirements that are needed on the advertisements. When it came down to the zoning clearance needed for the items in the backyard, he was provided with the phone number and a reference for the building department, or DRS. Um, for the trailer, just let him know, either remove it from the property or get it tagged. And then, finally, for the noise, we talked about some sound mitigation. Um, he related, um, that he had sound measuring devices inside the home, um, which I congratulate him because a lot of properties at that time were not using them. But I also suggested some other items were outside, like no speakers, trying to make sure that the tenants that are there are not making any kind of loud noise or gatherings outside. Officer Holliday, have you had the opportunity to visit this property, uh, when there were tenants in place? Yes. Um, can you tell me about that night, and I'll show the video in just a few minutes. Um, so on August 22nd, we received a phone call over the host, uh, compliant hotline for short-term rentals. It was from Barbara Clare. Um, I've spoken with her many times previous to this matter, so I know where she lived and I know what property she was referring to, which was for Dorado. When I went out to the property, I went to Ms. Barbara Clare's property, met with her. Got permission to go onto the property. And then I proceeded towards the back of her property, which is right adjacent to Fort Dorado and started my video recordings. Officer Stevens, we're just here on the noise, right? Yes. Okay. Just following you. And, uh, that's next door. It's number five, right? Yes. Number five. Right next door. Uh, no, that, that's Mr. Fousey's home is number five. Hang on. No, no, no, no. You can't help him with the answers. I'm asking him. Go on. I'm sorry. Ms. Barbara Clare. She's right next door. She, her property's adjacent, but they're not on the same street. Okay. Adjacent. Okay, fine. I got it. Then one's five and one's four. Uh, four Dorado would be the violation property, which is here. I know that. This is five Dorado. This is Mr. Fousey. And then Ms. Barbara Clare, she lives on over here. Oh, okay. Which is a different street altogether. Got it. Got it. That's what was confusing. Okay. She's Pleasant Parkway, right? Correct. And Ford Dorado and Ms. Barbara Clare's property butt up against each other. Right. I was confused with Fousey. Thank you. I feel I was confused. Go ahead. When I showed up from, um, pulling up to Ms. Barbara Clare's home, she was outside on the wall with her hands up, um, I'm sorry, with her elbows on her knees and her hands up on her face. And as I opened up the door, I could hear some loud, uh, yelling, shouting, talking coming from Ford Dorado. I greeted her, asked her if I could take some video, uh, on her property. She gave me permission. And then I walked over towards the property line close to the lake itself. And that's where I conducted, uh, all my, majority of my recordings. Talk to me at what time, officer? Um, 10.22, 10.23. At night? At night time, sir. Okay. And then I, when I went back to my, um, my patrol vehicle to go get my sound reading or sound measuring device, I made phone calls to the sheriff's department along with phone calls to the property owner and the representative. And then I proceeded back to the property line, attempted some measuring of the sound coming from there. That sound was not above, um, what the ordinance states of 55 decibels. Um, but my. It was not. It was not. It was not. And it, there was no loud music per se. It was voices. Administrator, I'm going to show you three videos that Officer Holliday had actually taken, uh, the night of the incident. Is this as loud as it's going to get? Unfortunately. It's not. Can you stop it for a second? When you say unfortunately, do you mean because of technology here? Yes, the technology here. And tell me why I should just, you know, think that it's louder or? This is taken from. I just thought it was under the decibel level. I, a lot of a cocus is something different than just loud. I understand that. Yeah. People yelling, shouting, things like that, but I need to hear that. Right. Okay. I could play another one if you'd like. No, play them all. Go ahead. I just want, I want to know. Go ahead. No problem. Can you take these from the other side of the fence officer? From Ms. Barbara clears property. That's what I meant there. Officer Stevens. Yes, ma'am. So communication said, have, have you put the microphone down to the PC? It's kind of hard to do that. And the, um, show this at the same time. I can listen to him separately. I can listen to it and not see the video. I want to hear it. Okay. Appreciate that, officer. Enlightening. Officer Holliday, would you say that's an accurate depiction of what you heard that evening? Correct. Officer Holliday, do you have any other, uh, information that you'd like to, you know, pertain to this case? Uh, Mr. Fousey, he contacted me shortly afterwards, provided me with the noise affidavit, and we were speaking on, uh, an incident, either on, from 822 or 823 the following day, where the tenants that were staying there, they went out to their vehicles, started up the vehicles. They were playing loud noise. He decided that he was going to go out there and ask them if they were getting ready to leave or not, because of the noise disturbance. The tenants became aggressive and started walking towards his residence, which is at 5 Dorado, and then they turned around and they went back to their vehicles. Thank you, officer Holliday. I have no further questions. I just have one for the officer. What you just said is what he told you, right? Correct. Um, the collage, I hope I'm saying that right. Um, this is your opportunity to cross-examine the officer and anything he testified to. Okay. And I'll let you tell your story during your report. Yes. Okay. So, I mean, um, being a short-term rental operator is not an easy thing, because, uh, we can control so many things. For example... I'm not looking for argument here. Yeah. I'm going to give you plenty of time for that. Do you have questions for him about what he said? About what he said? Um, I wasn't present, so I don't know about that. But you still ask him questions. Yeah, yeah. Just like I did. I think the interaction between you, uh, between Mr. Cousy and the guests, um, about them being aggressive, it's something that I'm not too sure of. Um, in what manner do you think the aggression was going towards Mr. Cousy? Because it's not something I want to happen. Um, and also, I ask... Well, how about just one question at a time? Yeah. I think his question is... Yeah. What type of regret? Yeah, what type of regret? Very good. That's something I... Yeah, I got it. That's going to be something that Mr. Cousy is going to have to answer. Okay. Um, just relating what was passed on over a phone conversation, uh, from an incident that he was explaining to me. Okay. Yeah, he wasn't present. That's why I asked him. I see, Mr. Cousy. He was hearsay to him, right? Go ahead. Um, another question is, um, about noise decibel monitor that the county uses. Um, how does it work? Because the further you are, the lower the decibels will be. So how close do you have to get, to get the reading that violates? Like, is it on the edge of my fence? Like, sort of, how does it work? So the ordinance allows me to go all the way up to the property line. Yeah. The way it works is, is you point the device after you have it calibrated, and you point it towards where the noise is coming from. Depending on the type of noise and how loud it is will depend on the reading that you will receive. So I did two different types. One is your normal, where if somebody's playing a radio. If you can please silence the phones. If someone's playing a radio or hammering, you're going to be able to pick it up. These are distinct sounds. Okay. Where we do octave, which is more like a bass. And I did both readings to see if I could, um, get a reading. And both of them were below levels. Okay. Um, so my interaction with Mr. Holliday, he was really helpful with, uh, he was patient and helpful with getting me to understand what I need to do to comply with the advertisements. And, um, slowly, one by one, all the violations were taken care of. Um, so I'm really thankful for his help and everything. Uh, I don't have any more questions for him. Okay. Yeah. All right. Thank you all, sir. Commissioner, I'd like to call, uh, Barbara Clare to the stand, please. Ms. Clare? Ms. Warren, Ms. Clare. Use that back front now. Good afternoon, Ms. Clare. Good afternoon. Good. I'm going to ask you a series of questions about your answer that you've had at this short-term when I'm next to you. Um, when did the noise problem first begin? I really don't have an exact date. I started with a complaint to Airbnb. It was the, it might've been in 2024. Unfortunately, I did not keep a record of those. Um, my first encounter was complaints to Airbnb about the noise and not only the noise, about his listings, advertising, sleeping 22 people in a home that only has five bedrooms. Um, and I got no action with Airbnb. Then I started calling. If I could look at my notes, please. Um, I started calling the sheriff's department was my next line of defense. Um, I made nine calls to the sheriff's department about noise, um, all after 10 PM. Even if there was noise during the day, I felt like I couldn't complain during the day. Um, and I only made complaints if I could hear the noise inside my house and we have all our windows closed and we have double pane windows. Um, and those complaints, um, started on March 29th, 2025 to September 6th, 2026. In May of 2026, I found out, um, that there was a short term hotline rental or a short term rental hotline and I started making calls to them. I made four calls to the short term rental from May 23rd, 26 to September 6th, 25 reporting six different incidences. I didn't submit an affidavit for just one specific incident. I put multiples so I wouldn't have to keep going and getting them notarized. Um, then I filed, I had stopped filing a complaint to Airbnb because they took no action, even though Mr. Collage's listing was violating their own policy. So when I found out that there was another neighbor filing complaints with Airbnb, I decided to go back to them on September 7th of 2026. I contacted Airbnb about all of the incidences that I complained about from the end of May to September. They asked me for additional information and I sent them recordings of all of those dates. Um, and it resulted in a suspension of his Airbnb listing for 30 days effective 9-19-26. And also, he was, has been told that he must update his listings, the listing description to remove any language that could be perceived as increased or disruptive behavior. So it's been going on for quite a while. What type of noise were you experiencing? It varied. Sometimes it was just loud hollering, yelling, screaming. Other times it was very loud music. As a matter of fact, the first time that I heard loud music coming from the property, it was, I could hear it from a block and a half away from my home. I was out for a walk in the evening and I thought, well, where is that noise coming from? And it was coming from his property. My backyard faces his backyard. So the house is an L-shaped house and that L, the open space with the L faces directly into our backyard. So all that noise goes into our yard. Uh, when does it typically occur and how long does each episode usually last? Is it more during the day, in the evening or all day? There are some incidences where it has gone on all day. Um, I think I, one of my affidavits does tell you that there was music playing all day long. Um, and it usually would go in the evenings, sometimes until 11, 12 o'clock at night. I'm gonna ask you a two part question. Um, how does the noise affect you and others in the household? And does it interfere with your sleep, work, school or any other activities? It affects me because I hear the music or the bass thumping inside my home. I tried to do a recording inside my home and unfortunately it didn't pick up the sound. My bedroom is on the backside of our house closest to his property. And it's usually when I go up into my bedroom, I hear it when I go to bed, I'm usually in my room around 10 o'clock. And then on top of it, I do lose sleep because I'm calling the sheriff's department, which is upsetting to me. Then calling the short term rental hotline now and then having an officer come out to my house at 10 30 at night. And then you're upset and I can't get back to sleep. I can't say that it has woken me up from a sleep. It's prevented me from going to sleep. I see that you have submitted affidavits of unreasonable loud and marquise noise multiple times with our agency, which identifies dates, times and descriptions of noises. Um, would you say that these affidavits are particularly the same type of noise that occurs at this location? Yes. The talking, the yelling, the screaming, the yelling, the hollering, um, sounding as if they're having parties there and the music. Um, did you take any recordings at the time of these incidences? I took recordings of all of the incidences that I listed on my affidavits. If I may, uh, magistrate, I have two videos I'd like to show, um, that were taken by Ms. Barbara and Claire. Recordings or videos? Videos. Not recordings. Videos. Excuse me. When I say recordings, I... Ma'am, ma'am, ma'am, I'm talking to them. I'm sorry. Yeah. You testified, you took recordings. And I'm just asking what he's, what are you going to put on? You're going to put on the recordings? There are, uh, there are videos that were taken from Ms. Barbara Claire's phone that I have on my computer that I would like to show. Okay. Do you have any recordings from her to put on to her? Recordings are the ones from her phone. Okay. So a video recording. Video recording. Do you have any audio recordings from Ms. Claire? Just the audio that's in the video. Okay. So when you show me a video that's got sounded and I'll consider that a video and audio recording. Okay. Go ahead. On the same page. Yeah. 10.05 p.m. This is just audio now. I don't see anything. This is the noise coming from 4 Dorado Place, Clearwater. It's just audio, right? And I'm not seeing anything. I can't see a thing. Okay. Okay. I'll listen to the audio first. I don't mind doing it too close. What time is this about, ma'am? This time I'll show you the video of that same recording. 10.05 p.m. This is the noise coming from 4 Dorado Place, Clearwater. I'm going to see a thing. I got a blank screen. I don't see anything in there. There you go. That's what I'm seeing. I bet. I don't see anything, but I can look over there. Oh, I got it now. It's just someone's feet. August 21st, 2026. It is 10.10 p.m. at night. This has been going on since 8.30 tonight. This is for Dorado Place. The video that you just saw was an accurate depiction of what you've taken on? Yes. I have no further questions. Mr. Colage, do you have any questions for this witness, Ms. Clair? My only question would be, are these raw recordings just directly from your phone? Because you can sort of tell your phone to amplify the audio recording. So, to me, anything from a cell phone can be sort of edited. You're asking her questions, not making the argument with the woman. Just ask her the question. Is it a raw recording from your phone that's unedited? Yes. That's my only question. And I'll give you plenty of time to explain all that to me. Thank you. Thank you, ma'am. Magistrate, I'd like to call Sandor Fousey to the stand, please. Ms. Fousey, please come up. Just give me a second here. Sandor Fousey. You've already been sworn, Ms. Fousey. You can proceed. Thank you. How you doing today? Pretty good, pretty good. Good. With the map shown on there, can you show me where you live in comparison to the house? Well. Thank you. When has this noise problem first begun? Early after the Airbnb came into existence, it's been quite a weekend event in our neighborhood. It's quiet on Tuesday, Thursday, Friday, Saturday, Sunday. You never know what's going to happen. They have weddings. They have bachelor parties. Constant overcrowding. We have cars coming up and down the street constantly. Sometimes there's 22 cars in the driveway. Sometimes there's 15. Sometimes you get up at 8 morning, there's still 12, 14 cars in the driveway, which means there's more than 14 people in the house. One person per car. That's my math. Okay? What type of noise do you experience when at the Airbnb? Most of the time, it's loud yelling and screaming, partying, hoo, hoo, hoo. We had one incident where they had a bunch of people there, probably 30-something. That's not relevant, I guess. But they had a megaphone going around the yard cheering people on to chug, chug, chug, using curse words every time going on. This was going on all day, all night. Unfortunately, I had a recording, but I don't know what happened to my computer. It went pi-pi. It's constant. Every weekend, you never know what you're going to get. Some weekends it's quiet, which we are happy about. We move there in a nice, quiet neighborhood, and it's not quiet anymore. How does the noise affect you and others in the household, and does it interfere with your sleep, work, school, or any other activities? Yes, it does. Our house faces directly in front of our house, so we hear all the cars, and that just gets the anxiety going. And when you start hearing the boom, boom, boom with the bass blasting, the window, you can feel the window shaking. That's not all the time, but most of the time. Loud yelling and screaming from the backyard. That's coming over a fence now, which has got probably, what, 50 feet from my house? It's not more than that. It's just hard to go to bed at night. You hear cars beeping, coming and going, 12 o'clock at night. It's just a constant battle to get relaxation. How many times do you think that you've reported this to either ourselves or the sheriff's office? My wife does a lot of the phone calling to the sheriffs. She can come up here and explain it. Every letter. I've submitted several complaints to Pinellas County. A lot of them did not have affidavits filed to them. The sheriffs, I don't know, at least 10 times, 10 times at least. And I've talked to them once or twice, and they said there's not much they can do about it except tell them that they have to keep it down. I see that you've submitted an affidavits for unreasonable loud noise ruckus, which identifies dates, times, and descriptions. Can you elaborate on some of those? Sure. Like I said, it's always a constant battle. Every weekend, something's going on. If it's just once in a while, I would have dates for that. But it's constant. So I should keep more records. I don't. So I don't know if that's invisible or not. But it is a continuous thing out there. I come home from work. I work at a Buccaneers stadium. I do stadium security over there. I came home on 22nd, I think it was, August 22nd, to 22 cars in the driveway. The same video recording that Barbara Clare had. And I heard the loud cursing, yelling, bantering back and forth in the backyard. So I was going back to my house. That's when I noticed a car coming down the street, and the first thing I said to myself, I'll hear more people coming at 12 o'clock in the morning. It turned out it was a sheriff. He came and knocked on the door, told him to keep quiet. I talked to the sheriff for a few minutes. He left. And then about 15 minutes later, the noise just kept going again. Like it never stopped. So that's the kind of things we have over there. Contacted Airbnb many times. At first, they never responded. Just like, yeah, whatever. Just a wolf crying, you know? Mr. Fousey, if you could just answer his question. Okay. I'm going to ask you one more question before I show a video of the sheriff's office responding to their property as you stated in your statement earlier. The morning after, you had actually said that you had a confrontation with some of the people from the short-term rental. Can you please tell us about that? Yeah. That was the, I think it was Sunday? Was it Sunday? Yeah, it was Sunday. That's the second time. You can't ask her to help you with your testimony. Let me help you. Sure. The affidavit complaint day is August 22nd, 26th, right? You signed that, right? Yes. Is that the date you're talking about? I believe so, yes. Okay. It's a description. Continuous and excessive party noise even after sheriff's visit. Right. It says 11.59 PM. Okay, yes. That's it. Okay? That's the date. This is the only affidavit you signed, right? That's the only one I have, yes. Okay, good. The night after, I believe it was, the sheriffs came the night before, the night after, the same group of people were still there. And that night, around midnight, 12, 10, 12, or 12, 11 or something like that, you heard a car alarm going up, beeping like crazy, right in front of our house. That's where our bedrooms are. So I got up, and then the car alarm went off, then everybody was out in front of the yard, talking very loudly, a couple cuss words back and forth, you know, and it was going on for like 15 minutes. So I finally got outside and asked them, what is going on? Are you guys leaving? Please leave. You know? So we're going on, and they started bantering back and forth like, hey, shut up, old man. You're blah, blah, blah. You don't know what you're talking about. And a couple curse words flew out. I told them, just get the heck out of here. And then one of them started coming across the property line to my house. And then, thankfully, somebody else held that person back to come over. So that was the night. I have no further questions. Magistrate. Mr. Collage, do you have any questions concerning anything he testified to? First of all, Mr. Fousey, I want to apologize for the aggression shown on the 22nd of September or August, sorry. A question I have is, why do you think the neighbor west of me, left of me, has never complained about anything, and they are closer to me than your property is? Why do you think that is? I don't know exactly why. I have a suspicion why. Why? I think they're afraid of some kind of retribution from you or something. Retribution from me? I don't know. I can't answer that question. I wish they would tell me. Have you ever had retribution from me, yourself? Not yet, no. Not yet? I'm not expecting it. Of course not. Another question. I don't want an argument here. He answered the question, he gave you the reason why. Another question. Do you speak with Barbara and the neighbor left of you, Ralph? Meaning, do you guys get together and discuss what's going on across the street, for example? Now that we all have our own eyes to see what's going on. We haven't conferred at all until just recently. Is there any encouragement from each other to, from each other to one another, to create, to create complaints against? No. So you guys never talk to each other about, this is, we've had enough and we should do something and all that stuff? No. Not yet. Okay. Well, that's all. I have no other questions. I'd like to call my next witness, Ms. Fousey. I'm sorry, Officer. Who do we have here? She does not have a statement. Oh, she doesn't. Okay. That's quite all right. Can you please state your name, please? Kathleen Fousey. Kathleen Fousey. Okay. Are you the husband of Mr. Fousey? I'm the wife. I'm the wife of Mr. Fousey. I'm the wife of Mr. Fousey. I'm the wife of Mr. Fousey. I'm the wife of Mr. Fousey. I'm sorry. I knew that, Ms. Fousey. Can you tell me when this noise problem first began? No. When it first began is when they started Airbnb, two years ago. And what type of noise were you experiencing since the beginning until most recently? Parties constantly with noise, you've already heard, you know, records playing or music playing constantly, the reverb of the bass is going on and just loud talking. And when you get yourself in a pool area, you've got a lot of kids even sometimes screaming all night. They get loud. And it's not just every now and then. It's every weekend. We can't endure that every weekend. It's ridiculous. I know that your husband stated that the noise affected you and your husband. How does it affect you? It affects me a lot because my bedroom is right where they have all their cars parked. I am listening to the key fobs go off here and there. And then all of a sudden, they come back. They get in their car. They talk outside. It affects me because I hear everything. And I can't sleep. They leave. I'm still awake. I said, this was a private street. We paid to have it redone and everything. But the traffic going back and forth is ridiculous. 22, I think we counted 16 cars in the parking lot. I have pictures here that I didn't know I had to send in. But we had a whole volleyball team in there. They all come out. I have pictures of that right here if you wanted to see them. But it's just too many people in there. Way too many. And they advertise events. We've had weddings. They bring the U-Haul trucks down the private road that we pay for. And they're constantly putting up tents. They built on a nice little area where they could put banquet tables. Banquet tables for what? A wedding? A shower? It's just not. It's more of an event hall than an Airbnb. Is there anything else that you wanted to add? No. Okay. I have no other questions. You'll have to stay here. I have no further questions. Mr. Gallage, any questions? Ms. Huzi, I have the same question I had for your husband. Why do you think that the neighbor to the left of me, I've never heard him complain? Because a long time ago, your husband actually voiced his displeasure directly to me. And I told him I will do my best to sort of calm the situation. How come I've never heard a complaint from the neighbor left of me? Why do you think? I could tell you. But I don't know why because I'm not them. Yeah. But I don't think they want to use the computer or know how to do it or know how to complain. But if I can hear it, I'm sure they can hear it. And they're just those type of people that don't want to or don't know enough about, you know, Gmail or whatever. So I think that's the reason why they're not doing anything. But I don't know. I can't answer that. It's been over. That's all. I don't have any other questions. I have no further questions. I have no further questions. Okay. Magistrate, I'd like to show one video of two of the Sheriff's Office body cam responding to the property. Is it taken by the Sheriff's Office? Yes. Their body cam. Okay. Mr. Collage seen these? No. I provided a for him discovery, but he had never picked it up. Is that correct? Excuse me? What was that? When you come to court proceeding, there's a thing called discovery. You can ask for all the evidence and admin in advance. And I provided a USB along with all that information on it. I received this maybe as soon as after I walked in. I haven't had a chance to look at it, but I'm open to seeing it now. Okay. You gave it to them. You told them it was available previous to that? Yes. Is that what we're talking about? If they don't pick it up at the office, we just bring it here for them. What? Do you send them a letter telling them it's there, or how do they know it's at your office? We don't send that information out. Well, how are they going to know it's at the office if you don't tell them? I mean, help me here. I mean, what's your process? In other words, you're going to use the video. You're going to present it as evidence. That's correct. You let him know you got that. I'm just trying to ask you how you let him know. No, I'm asking you how do you let him know. I did not provide that information, so that would be on me, Magistrate. Okay, so he didn't know. But you're fine. Take a look at it. I'm okay with seeing him now for the first time, but I've had no time to prepare any sort of rebuttal to it, but we can move forward. It's okay. I'll give you time after you see it. If you want some time, you let me know. It's okay. It's fine. Just let me know. Put it on, officer. I can take a look at it over here if he likes prior to that. I just offered that to him. It's okay. We can move forward. It's fine. We're good with that. Yep. Magistrate, that was one of two for that evening. That was done by the Pinellas County Sheriff's Office. I have no questions at this time for Mr. Coolidge. You have no questions of him yet? He hasn't testified yet. That's all I'm saying. I'll let him testify first, then I'll ask some questions. Yeah. Okay. Anything else, officer, part of your case? No. No, I do not. You're good. Okay. Mr. Coolidge, this is your chance to... Okay. I'm going to let you put on any evidence, or you can testify. You can testify as anything that you saw, seen, heard, and things like that. And then I'll go back to the sheriff and ask him to make an argument, and then you can make an argument, too, or just... Okay. Okay. So tell me what I need to know. So what you need to know, pretty much, this home has been a short-term rental for about two years. I'm going to say August of 2025, or no, August of 2024, it began. Shortly after, short-term rental certificates were introduced, and we all, not we all, but I applied for it, got approved for it. Even though the adjustment period between an unlicensed Airbnb and to a licensed one, it took a little bit longer than expected, meaning adjust the advertisement, adjust the language that we're using to market our homes. And that's sort of why they're seeing more guests than we're supposed to have, because if we go on the platforms right now, and we search homes with 16-plus guests, you're going to see thousands of homes in Clearwater and Pinellas County that are still not in compliance. So me seeing them not in compliance made me think that it's like monkey see, monkey do. If my competition is offering 16 guests, I'm going to offer 16 guests, because otherwise I will lose. So that's sort of why the overcrowding happened, because I'm just looking at my competition and just to keep up with them, sort of. And you're telling me about the overcrowding, not because they're only seeking a noise complaint here, but overcrowding, that's why it's so loud because there's a lot of people in there. I would say, yeah, an extra five, six people to a group can cause... It makes it louder. Okay. I got it. Go ahead. Since I began Airbnb in 2019, I would say I've been one of the first ones to use noise decibel monitors in outdoor patios and indoor areas as well. Any time a guest after 10 p.m. I see decibels over the threshold that I've set, I let them know. It's a family-oriented neighborhood. We can't have this. This was before even the ordinances were in place. The majority of the time, they follow suit. They move it inside. Sometimes I just don't know what to do, because on 22nd, all the evidence that we're seeing today was from one occasion. Right. It was just a ruckus group. They wouldn't answer my phone calls. I sent people there. They just wouldn't comply. So I don't know what to do. So at that point, I can kick them out with the police, but then they leave me a one-star review. I'm sorry, say that again? If I kick them out with the police, they will leave me a one-star feedback, which is sort of damaging to the reputation of the home. Understood. So let's say I host 1,500 people throughout the year. I'm going to get a group that's just a rotten egg. I'm going to get a group that just doesn't comply. And there's good and bad things to being a short-term rental operator. For example, I do cause economic stimulation locally, because there's 1,500 people coming in. They all spend 1,000 bucks a piece, dinners, cars, rentals. So I'm causing a few million dollars of just circular movement of money between different merchants and stuff. But the bad part is I have caused disturbance to a few of my neighbors. And I'm trying to balance it. Moving forward, I'm going to take a hit personally income-wise by hosting just the right amount, 10 guests. I'm going to limit any sort of, if I see a sign of a gathering, I'm going to not allow them. So in sake of their peace, I will take the damage portion of it. So my request is, if there is a fine to this violation, a reduction would be ideal for me, because moving forward, I'll keep it in mind a lot more. My second portion is, how do we regulate noise? Because if Mr. Wayne Holliday's decibel reader didn't pick up above the threshold, how do I know that, like, cell phone audio recordings are really tough to understand, because I can adjust treble, bass, mid-bass to sort of pick up more and less, you know? So just some, like, clarification on how do we actually decide what's an acceptable noise level, besides a cell phone, which can be adjusted or tampered with AI and so on. So it's like, I'm not sure what else to say. We still have many homes that are out of compliance. I understand you have to follow complaints directly, which is why I'm here. But I also request the team of code enforcement officers to get on the website, get everybody else in compliance, because if my competition is 10 guests, I'll be 10 guests. I don't mind. But if I have my home that's 500 feet away from me, advertising 16 guests, birthdays and events, why should I have to comply on data? I understand the complaints from the neighbors, but I request that the team of code enforcement officers picks it up and makes it an even playing field for everyone. Anything else? That's all. Okay. I'm going to ask the officer to just tell me what he's looking for. And if you think it's something, I'll give you another, you can respond to that. Okay. Officer, tell me, but what are you looking for and any summation you want to give me? I'd like to cross-reference what he just spoke about, if that's all right. You say cross-reference? Yeah. Cross-examine. Yes, you make the cross-examine and any facts that you get. Thank you. Do you have any, I understand that you have a decimal reader inside and outside the house. Do you keep track of that? Yes, the application does keep track. It's like a graph. It just shows 50, 60, 70, 80 decibels and yeah. When was the last calibrated and who calibrates it? It's done by the software. We pay a yearly plan to the software company and they sort of track and it's a top one. It's a top monitor used in short-term rentals. I believe it's not faulty. It's periodically updated by them. Are you fining these people or removing these people from the property if they're creating a large gathering and creating a lot of ruckus and a lot of noise in your Airbnb? I am not fining them. Removal, I have done it before. It's too costly penalty-wise from the marketing platforms we use. They penalize us heavily if we remove someone mid reservation. All I can do is bleed and beg to reduce the noise. No problem. I understand you're a businessman. You try to make money on the Airbnb and you're contributing to the Clearwater and the rest of the Tampa Bay area with, you know, having the Airbnb. But you just admitted that you're renting the property with the intentions of violating the short-term policy that you signed and you were given for large gatherings at that point. I'll take that as argument, officer, as opposed to a question. Okay. I think you're making a point and I understood it very well. How do you plan on improving the property with the camera system or anything like that? I can add additional noise monitors further out into the yard because the noise can be, they're large properties, half acre plus. So, like, the noise can go a hundred feet away to where my patio reader doesn't pick it up. So, I'm going to add more devices to monitor the noise. I believe if I adjust the marketing angle of it, I can have more family-oriented gatherings, I'm guessing. Besides those two, I'm not sure what else I can do. Kicking them out, of course, it's always an option. But if we're all kicking out our guests, then Clearwater isn't a vacation destination. I mean, in the last six years, it's become like Santa Monica in California. It's a lot of short-term rentals around. It's a huge part of the city's culture, city's environment now. So, it's going to require teamwork between operators and enforcers to make sure everybody's in compliance, not just someone who is picked on by neighbors or someone who is. So, yeah, moving forward, I'm going to do a better job at hosting. But I also request help from the city to maintain the level playing field. I know that you asked the question, how is it possible that somebody's cell phone can be manipulated through AI and different things like that. I just wanted to let you know that Officer Holliday's phone is a government phone that is regulated by our PTS system, and it can't be altered. I understand. Yeah. I have no further questions. What are you looking for, Officer, here? Let me do a closing statement. Yeah, it's on, Matt. Okay. Magistrate, in closing, you've heard the testimony from multiple witnesses today, including two neighbors who live in close proximity to the short-term rental property in question. The video evidence presented clearly demonstrates the type of unreasonable loud and ruckus noises generated from this location, as well as the volume levels occurring inside and outside the home. This includes testimony and video provided by Officer Holliday, along with body-worn camera footage from Deputy DiNuzio of the Pinellas County Sheriff's Office documenting two separate disturbances occurring within 30 minutes of each other. I would also like to emphasize that our agency alone has investigated nine separate incidences at this property between 14 July of 2025 and the most recent occurrence on 22nd of September of 2026. During this period, Officer Holliday has repeated correspondence with Mr. Krishna Kulaj regarding these violations and the necessary steps required to bring the property into compliance with our local ordinance. The ongoing failure to abate these issues is what brings us before you today. Furthermore, I'd like to acknowledge a considerable time and public resources that this single property alone has required over the past year. This includes multiple complaints to the short-term rental hotline, repeated investigative responses by our officers, and the involvement of the Pinellas County Sheriff's Office, often diverting attention from higher priority calls for service. Magistrate, for these reasons, and based on the evidence and testimony presented, the county is asking for a fixed fine amount of $1,000 for the code section 58444. Mr. Kulaj, anything else you want to say in summary? There's not much. I mean, considering it being that it's the first time it's gotten to this escalated level, I would like to ask for a reduced fine. Besides that, I said what I could. That's all. Okay. I'm going to consider the public portion of the hearing closed. I'm going to find for the county. I guess that would be on this code section 58-444. Am I getting that right? Correct? 444. Yes, ma'am. And propose a fine of $1,000 in award the county costs. And she'll tell you how you get your order. We'll mail it out. And I just want to make sure, just confirm, for 22-319I, it's 30 days to come into compliance. October 30th, 2026 is the compliance due date. And how much was the daily amount, if not? It's going to be, it's only going to be fixed, or I'm sorry, it's only going to be court costs. Okay, so there's no daily fine? We're not expecting that. We're doing a $1,000 fine and one fine. Right, but the 319 doesn't have anything. So there's 30 days to comply and then? Yeah, right. No. Okay. No, well, no, he's got a $1,000 fine, you know, and he paid like any other fine, and he's got court costs for the, uh. There's two violations. Yeah, the 319 we discussed earlier, and we had an agreement. Oh. That is only going to be court costs. Yeah, just the other one's court costs, right. I'm sorry, I forgot. But with 30 days to come into compliance? No, it's just court costs he's paying. Oh, just court costs. So that one, is it a finding of fact? I mean, what do we write about that one? Um, they've reached a degree, but why don't you just add those costs to the costs on this? That is correct. So what are the two numbers? Uh, the 420. Four? Yeah, it'll be 420. Just, we'll just do a finding of fact. 420 costs on both of them. Yes. So the magistrate is saying it's a finding of fact for the 22-3199? Is that what you're looking for? Yeah, we'll do that. And what was the violation of the first one? That's the advertisement. Yeah. He only had, uh, to fix the, uh, the VRBO website. That's it. I'm not too concerned about a, and you're not concerned about a finding of fact. No, I'm not. Just put it down as the increased cost. Okay. And just put agreed cost in the order. Agreed cost. How's that? Got it. That's fine. Alright, thank you. You'll get your order in the mail. Is your collage okay? Is there a way to pay now? Um, you can, you have to give us time to put it in the system. It has to be cashier's check or money order. Um, you can pay it now. I can give you that information. Um, but it has to be cashier's check or money order. Let me see. If you can. No. Are we done on this system? Nicole, we done? Yes. Okay. Right then, the information in the back. Magistrate, I put your other cases there. Right there. Oh, you want to, you want to call the next one? Sure. Okay. Hold on one second. Let me just get this in. Okay. This is, um, collage. Just give me one second. Sure. It's collage. Good. We can do the next one. Okay. Oh, yeah. Item one, department code enforcement matter. Short-term rental violations. 22-319-G1. 22-319-I1. 22-319-I2. Case number CCM-26-00111. Officer, B. Hughes. Owner, Horn-Nicholas, Horn-Barbara. Notice address, Horn-Nicholas, Horn-Barbara, 11956, Fontberry Street, Parker, Colorado, 80134-7758. Violation address, 12467 94th Avenue, Seminole, Florida, 33772. Let the record reflect that no one has responded for 12467 94th Avenue, Seminole, Florida. Uh, there's no one left in the gallery. And, uh, officer, could state your name for the record? Officer Hughes. We got here number one? Yes. Okay, officer, what are we looking at here? Oh, raise your right hand. Do you swear, affirm that any testing we get today be the truth and nothing but the truth? I do. Okay. I have, I guess we'll call it composite A for the county in front of me? Yes, sir. Can you take me through that? Sure. So composite exhibit A consists of the, um, of course we have the notice of hearing. We have the, um, notices of violation. We have, um, the Pinellas County tax collector property appraiser information. Okay, just to interrupt you here, officer, so you, we've got an operation of a short-term work. There's no certificate of use, right? That is correct. It's no certificate of use and they don't have the required statements in the advertising. Um, and additionally, um, they added items to the property. So you're talking 22-3-1-19-I-1 also? Yes. Okay, go ahead. Well, just to let, yeah, just to clarify, the only items I'm going to be asking for today are 22-3-19-G-1, 22-3-19-I-1, and 138-90. 138-90. That's for the zoning clearance for items that they added without getting a zoning clearance. Okay, let me, just hold on because that's not what my agenda shows. So you're looking for the G-1, which is certificate of use, the I-1, which is the advertising. What's the last one? Uh, 138-90, a zoning clearance for adding items to their property without getting the appropriate clearance or permit. Okay, and that's, oh, it's right here behind it. I'm sorry. Okay. Look, I've seen this before. The putting green, bowling lane. Okay. I got it. Okay. All right. Please proceed. Okay, thank you. Pull it up. So again, we've got the 22-3-19-G-1 and I-1 notice of violation, the 138-90 for the zoning clearance. And the reason for that is they added the putting green, the bowling lane, the pickleball court, basketball court, and outdoor shower without any zoning clearance. We've got the tax collector and property appraiser information, the warranty deed. All right. I saw that. And then we have showing that it is a short-term listing by the listing status showing as active and the minimum of nights being under 30 showing that it is a short-term listing. All right. And then we've got the advertising showing that they are actually advertising for that without the required statement. Got it. All right. The review showing that people are staying there. Just another listing, same thing, active with the minimum number of nights being under 30. This happened to be three. Right. And again, just the listing showing that they don't have the required advertising in it. And then finally, we've got the satellite image. It just shows the property beforehand. What am I looking at? All right. This is the property right here. You can see it's all grass. It's satellite. This is as of January of 2025. Oh, I got it. Okay. And the following one, again, this is the property. You can see where this was all grass. Now they have the pickleball court. And you can see the same pool included. Oh, oh. It's just sideways all the time here. You've got to look up here, up and down, right? Okay. So the first one, just so I see this. Sure. I'll go back to the first one. Top left-hand corner, it's correct, right? December 24th, January. So that's correct, right? Yes. So this one here is January 2nd of 2025. And you can see it's all grass. Right. No pickleball courts or anything. Got it. You can see the circular drive there and the pool with the cover. But then when you go to the next one, which is January 10th of 2026. Big difference. You can see the impervious material. I got it. Okay. Yeah, it was a little hard to call on my experience. Okay. Those are those violations, as I only got it. Yeah. And then, of course, you've got the website that shows the same thing right on their website, the different items that were added. Understood. So, Magistrate, may I submit those as composite exhibit A? Yes. I'm accepting composite exhibit A into evidence for the county. Okay. So the property. Do you have a copy of that? Yes. Go ahead. Okay. So the property was re-inspected on September 29th of 2026. The violations continue. They still have short-term rental listings and advertisements without the short-term rental rental certificate, nor the correct statements in the advertising. However, even though I've had no contact from them, I did find a zoning clearance application for the items that were added to the property. And I found a short-term rental certificate application that hasn't been completed. So it appears that they actually are working on getting into compliance. They just have not contacted me. So they went on the website to do that? Yes, sir. Okay. So if it's okay, I would like to submit the zoning clearance, the short-term rental application information, and that they're still listing as a short-term rental and advertising as one as composite exhibit B, and I can go through that quickly for you. Please do. Go ahead. Oh, and I've got it. I have your copy. Sorry. I can see it. Thank you. So basically, you see that they did actually on September, I've got the date here. September 3rd. September 3rd. Was when they submitted the application, which was shortly after we posted the property. September 3rd. Yes, sir. And what do you see that's September 3rd on there? Oh, it's right here. Sorry. Oh, just for future reference. Yes. The file date. I got it. Go ahead. So currently, they're still waiting for payment. Got it. That's what this is up here. So it's not being issued. I thought that was payment received or whatever. Okay, 9-3. Got it. And the file date is the date they submitted the application. Sorry. Got it. The next document is just showing that they have actually done the zoning clearance application. It is currently in review. Right. And then it just shows that they are still, the listings are still active and it's still less than 30 days. Right. They haven't taken it down. Right. And they still don't have all the required requirements in their advertising listing yet. And I'm sorry, did you accept exhibit B? I'm getting ready to. Thank you. Thank you. We'll call this additional package of County Exhibit B and I'll accept that into evidence. Thank you. So, Magistrate, the county requests that you find the property in violation of 22-319-G1, 22-319-I1, and 138-90. We're asking for the allowance of 30 days to comply. Rule three? All three. Go ahead. And if still found in violation, to assign a daily fine amount of $500 per day and to award the court costs of $420. Anything else? No, sir. That concludes my testimony. I'm going to find for the, consider the public portion of the hearing closed. I'm going to find for the county in this matter, with regard to 22-319-G1, similarly for 22-319-I1, as well as the zoning clearance of 138-90, I'm going to impose a fine of $500 a day. That fine can be abated if there's compliance within 30 days, which would be October 30th by 5 p.m., and I'm awarding the county costs of $420. Thank you, Magistrate. Item 2, Department Code Enforcement. Matter, short-term rental violations. 22-319-G, 22-319-I. Case number CCM-26-00118. Officer B. Hughes. Owner, Van Norman Elijah Caleb. Notice address, Elijah Caleb Van Norman, 6010 41st Avenue North, St. Petersburg, Florida 33709-5205. Violation address, 6010 41st Avenue North, St. Petersburg, Florida 33709. Let the rep reflect that there's no one left in the gallery and no one answered for this case. Officers, could you state your name and raise your right hand? Officer Hughes. Do you swear for me that any testimony given today be the truth, nothing but the truth? I do. Okay, we have item two here, and I have a composite A here, so go. Okay. So we do have the notice of hearing for today's date and composite exhibit A. Composite exhibit A includes the notice of violations, Pinellas County tax collector, property appraiser, the warranty deed, the short-term rental notices, and the short-term rental listings and advertisements. So if I may, I'll go to the... Just give me one second here. Yeah, go ahead. I was going to say, if I may, since the other documentation is in your packet, I'll go straight to showing that the listing is active for a short-term rental, showing a minimum of one night, and advertising 17 people. It also shows the advertisement listing doesn't have the required advertising in it, and just a second listing with the same. It's another listing showing that it's less than... Minimum days, too, right? Minimum days, too, right? Minimum 30 days, yes, sir. Minimum 30 and active. Right. And doesn't have the required advertising statements in it. So, Magistrate, may I submit that as composite exhibit A? Second here, Officer. Sure. You're going to be looking for the 319G, right? Yes, sir. Yes, sir. The notice of violation for the operation of the certificate is 22319G. And I is... And just... Yes. And we're... Then I'll just also be asking for 22319I. Okay. So, go ahead. Yes. Positive exhibit A is accepted at the evidence. Thank you, sir. So, Magistrate, the property was reinspected yesterday on September 29th of 2026. The violations continue. The short-term rental listings and advertisements continue. I have, however, within the last week, spoke to Mr. Van Norman, who is the owner of the property. And he first found out about these notices because he does not have the correct address and Pinellas County property appraiser and tax collector was when the property was posted. So, he has since contacted me. I have emailed him all the information he needs. He said he wouldn't be able to attend this hearing. And I did tell him that I would be asking for 30 days or a fine of $500 and to just stay in contact with me. And if he has any questions and getting the certificate and correcting the advertising, to just contact me and let me know. Like I said, he now has my contact information. And I've sent him all those emails. So, his mailing address is in 6010 41st Avenue North? Yes. Oh, as a matter of fact, I forgot. I'm going to submit, if it's okay with you, composite exhibit B and go over it with you. And it does include, actually, the email that I sent to Mr. Van Norman. You testified that his address was wrong on the county records. And I'm just trying to get the correct address. The mailing address. He was, when I say wrong, that was not entirely accurate. In property appraiser, he's using his short-term rental property. The mailing address is the same. So, he doesn't live at 6010 41st Avenue. So, he doesn't live at that address. He's renting it out. Okay. Yes, sir. That's been taken care of. So, we have his regular address for the court. The only thing I have right now is his email. I told him that he would want to get that corrected and that I would send him the email information. Okay. So, which I have. So, if I may, I'd like to submit that as B. Yeah, please. I'm good with exhibit A. Mr. Hughes, can you spell out his email address so we can put it on the record? I absolutely can. His email address is V as in Victor, A as in Alpha, N as in Nancy, O as in Oscar, R as in Romeo, M as in Motel, A as in Alpha, N as in Nancy, E as in Echo, L as in Libra, I as in Indigo at gmail.com. Thank you. So, again, I did speak with him. I sent him all the information including the notices of violation and everything to him that shows him how to gain compliance with the short-term rental certificate and the correct advertising. I did check yesterday and confirm that the listing is still active. It's still short-term, advertising minimum of one day with a maximum of 17 people which is over the maximum of 10 and that the listing still has not been corrected for the required advertising statements and such. I'll accept exhibit B of the evidence. Thank you. Anything else, Officer? So, yes, sir. So, Magistrate, the county requests that you find the property in violation of 22319G and 22319I. We're asking for the allowance of 30 days to comply and if still found in violation to assign a daily fine amount of 500 per day per violation and award the county the cost of 420 dollars. So, the public portion of the hearing closed. I'm going to fine for the county on both violations and impose a fine of 500 dollars on both separate violations of 22319G as well as 22319I and impose a fine of 500 dollars. That fine can be abated if there's compliance within 30 days which would be October 30th, 2026 by 5 p.m. and award the county costs of 420 dollars. Thank you, Magistrate. Thank you. 3. Item 3. Department code enforcement matter. Short-term rental violations. 22319G, 22319I. Case number CCM-26-00120. Officer D. DeVall. Notice address. Salus Samarher, Salus Abdallah, 502 Shore Drive West, Oldsmar, Florida, 34677-3420. Violation address, 502 Shore Drive West, Oldsmar, Florida, 34677-3420. State your name and raise your right hand, please. Officer DeVall. And do you swear or affirm that any testimony given today be the truth nothing but the truth? I do. You may proceed, officer. Okay. Attorney, Magistrate. This property where the alleged violation exists is located at 1209 Sunset Point Road in Clearwater, which is located in unincorporated Pinellas County. The property owners are not present for today's hearing. I do have the violations that have been in occurrence since... And not to interrupt you, I apologize, but the violation is 502 Shore Drive, Oldsmar? No, the violation address is 1209 Sunset Point Road. Give us a second here, Elvis. The Oldsmar address is the mailing address for the property owner. Address? We just have it wrong on the agenda. I just want to get it straight, officer. Can you repeat the violation address, please? Sure. 1209 Sunset Point Road in Clearwater. Sunset Point... 33755. Thank you. Uh-huh. Okay. Go ahead, officer. Okay. This violation has been in occurrence since August 14th of 2026. This is going to be for a short-term rental. So I'd like to enter into evidence the notice of hearing and composite exhibit A, which includes the notices of violation or the notice of violation. We have ownership confirmation through Pinellas County tax collector, property appraiser. We have the deed, additional warning letters from the county, and the advertisements for short-term rental from Airbnb and VRBO. I've reviewed composite A as the notice of hearing as well as the code enforcement letter that went out. So I'm satisfied that I've accepted exhibit A into evidence. Okay. So you are accepting A? I am. Yeah, I see the numbers there. Okay. See the dates. Thank you, Magistrate. Is there anything further from A you would like me to show? Did you re-inspect it at all? Yes, sir. I do have a... It was actually a desk inspection done of the database and of the... Yeah, that'd be great if you just go through that room. ...advertisements from Airbnb and VRBO. I'd like those to be my Exhibit B. And that was done yesterday, which is September 29th. So before I go over them, would you like to have a copy? Just nothing's changed? Nothing has changed. There's still advertising as a short-term rental. I was able to go in and confirm check-in dates and check-out dates and reserve, tentatively reserve dates. They showed that there was availability for this property. Occupancy is not an issue because it is a small property. So it is advertising for less than 10. But they have not applied for any type of a short-term rental certificate at all. They have nothing within their advertising that has the necessary and required statements that the county needs put into an advertisement such as your vacationing in a residential area and so on and so forth. Right, right. You say it's below 10? The whole occupancy of the house. It's a very small property. Right. The occupancy is, I think, a total of six. I'll accept the composite be into evidence for the county. Okay. Thank you, Madam Strait. So the county requests that you find the property in violation issue in order to have it brought into compliance. The county is asking for the allowance of 30 days to comply and if still found a violation, assign a fine of $500 per day for the two code sections of 22319G, this is for the certificate, and 22319I for the advertising. And costs, do you have those? And costs, 420. Anything else? No, magistrate. That is all. Thank you. I consider the public portion of the hearing closed. I'm going to fine for the county on both violations, 22319G and 22-319I. I'm going to oppose the fine of $500 a day. The fine could be abated if there's compliance within 30 days, which would be October 30th, 2026 by 5 p.m., and county's awarded costs of $420. Item 5, Department Code Enforcement Matter 58-304 Trash and Debris Code Violation. Case number CCM-26-00119. Officer D. DeVall, owner Dreslin David G. 2nd Estate. Notice address Dreslin David G. 2nd Estate. 1525 Meadowdale Drive, Clearwater, FL 33764-2504. Violation address 1525 Meadowdale Drive, Clearwater, FL 33764. With the record, reflect that there's no one in the gallery and no one has responded to the call of the list. Officer, if you could raise your right hand and state your name for the record. Officer DeVall. Do you swear or affirm any testimony you give today be the truth nothing but the truth? I do. The trash and debris case, right? Yes, Magistrate. We're going to go back to some of the other things that we do. So, this property where the alleged violation exists is located at 1525 Meadowdale Drive in Clearwater, which is in unincorporated Pinellas. The property owner, David Dreslin II Estate, is not represented for today's hearing. This violation has been in occurrence since on or before May 12th of 2026. I'd like to enter the notice of hearing and composite exhibit A into evidence, which includes the notice of violation and ownership confirmation through Pinellas County tax collector, property appraiser, and the deed. Inspection photos I have also included, and if you are accepting of these documents, I will go right to the photos to show you the condition of the property. I just went through the documents. Why don't you just tell me about the photos and deposit A. Right now, the property is vacant, and we have the neighbors pretty upset about the condition of the, or lack thereof, maintenance that's being done at the property. It's extremely overgrown. These two pictures here in the front are the front of the property. We have a circular driveway, so you can see the property here behind it with a large tree here. Circular driveway behind this middle island is very overgrown. This is just another angle showing the overgrowth there. This is the overgrowth and lack of upkeep and maintenance with all the leaves and whatnot that's on to the right side of the property. This is the left side of the property, the lower right-hand corner picture. It is fenced. We can't see it completely into the backyard, but we do have the neighbors complaining that the backyard is also very overgrown. Okay. So magistrate the county requests. You find the property in violation. Oh, I'm sorry. I skipped. I skipped forward. My apologies. That's okay. I'm going to accept the notice of hearing composite exhibit A into evidence. Okay. I presume you got a B, so I'm free to close. Yes, sir. I sure do. All right. There we go. Yesterday, September 29th, property was re-inspected and the violation continues. Nothing has been done to try to abate the overgrowth in any way. I see that. It's exactly the same as it was. I'll accept the composite B, one page, new photos September 29th and 26th of the evidence. What are you looking for, officer? So magistrate, the county is asking for the allowance of 30 days to comply and if still found in violation thereafter, a fine in the amount of $200 per day for the code section of 58-304, trash and debris. 420 in cost? Yes, sir. And court costs of 420. Okay. We're going to consider the public portion of the hearing closed and a fine for the county on the trash and debris 58-304 and impose a fine of $200 per day. That fine can be abated if there's compliance within 30 days, which would be October 30th, 2026 by 5 p.m. and I'm awarding the county $420 in costs. Very good. Thank you, magistrate. Thank you. Communications, please stop recording.
