Welcome to Pinellas County Code Enforcement Special Magistrate Hearings. The special magistrate is charged with conducting hearings to determine whether an alleged violation of the county code has occurred. In order to meet that obligation, all parties of the representatives will be allowed an opportunity to be heard on matters relevant to the alleged violation. All witnesses offering testimony and presenting evidence will be required to swear and affirm that the testimony today provides the truth. The order of presentation will begin with the county presenting their evidence of the alleged violation, and then the respondent shall present his or her case. Both parties shall have an opportunity to cross-examine all witnesses. The special magistrate may question any witness. The clerk will announce the name of the cases from the agenda. When you hear your case call, please respond by coming to the podium. With your representative, am there any witnesses to be sworn in? When addressing the special magistrate, please speak clearly into the microphone. Any person who decides to appeal the decision of the code enforcement special magistrate, with respect to any matter considered, this hearing will need a record of the proceedings, and for such purposes may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based. Such record is not provided by Pinellas County. You can call the first matter.

Please come up.
John Kramer.
Where does All Over Solutions come from?
So All Over Solutions is the current owner, but these were the original.
Oh, okay. Got it. They're fine with it. I'm fine with it. Somebody goes to... Oh, just you? It's just you? These joint stipulations? Yes. Excuse me. State your name for the record, sir? John Kramer. Mr. Kramer, what is your connection to All Over Solutions? I am the owner of the company. Tremendous. From my understanding, you're reducing a fine here. There's a couple of fines, right? To $906, 69 cents? We're talking about two properties, but one at a time, right? Oh, 900, yeah. But both of them together, you're reducing it to $906, 69 cents? Yes, yep. Okay. I'm good with that. Raise your right hand. You swear a firm that you've executed this document? Yes, sir. Okay. I have nothing.
And you signed it already, right?
I'm going to sign it now. I'm good. It's a new way we're doing this to speed it up. Yep, it's all good.
And then you just step to the side. I'll make a copy and give it to you.
There you go.
Thank you. We have to do something. It's a size to do. Okay. Now it's doing it.
Next one's six, right? Yes. Same kind of thing. Seaside hair.
Weird, right? Does it normally go slow? It's moving really slow. I know. I don't know what it's doing.
Yeah.
It's, I don't know what's going on with it. Well, as long as it just does it, it's okay. It's doing it. It's pretty. Check to meeting you back. Yes. Yep. Okay. And I'll let the office know. Send them a message. You can just send one. Yeah. Combined. The other one. Yeah.
Are you ready?
I'm ready. Cool. Oh, sure.
Item six, department code enforcement matter, lien reduction, case number CCM-25-00057, owner, Seaside Equity Group, LLC, notice address, Seaside Equity Group, LLC, attention, Raphael Herringer, PO Box 226, Largo, Florida, 33779-0226, violation address, 11309, 115th Street, Seminole, Florida, 33778.
Good morning. Your name for the record, sir? Raphael Herringer. Would you raise your right hand, please? Do you swear if I'm anything you're testing me to get today, it'd be the truth, nothing but the truth? Yes. And your connection to Seaside Equity Group? I am a manager for the company. Okay. And entered into an agreement with the county for a lien reduction of $418.70? Yes, sir. Okay. I'll sign the order and Carol will give you the instructions. You're welcome, sir. It's perfect. I got it. Good. Thank you. All right. Do you want it easy? No, it's a lot easier. Nobody's happier than me. Whenever you want. Yeah. If Catlin's ready, we can do it. See if it is.
Item 14. Department code enforcement matter. Short-term rental violation. Case number, CCM-26-00101. Officer D. DeVall. Owner, McEoff Anthony. Notice address, McEoff Anthony, 620-14th Street, Palm Harbor, Florida, 34683-4603. Violation address, 620-14th Street, Palm Harbor, Florida, 34683.
Officer, state your name for the record, please.
Officer DeVall.
And your name, sir? Good morning, Your Honor.
Anthony McGill.
McGill. I hope I get that right, sir. Just waiting so she can get that done because I may need to ask her some questions. Would you both please raise your right hand real quick? Do you swear or affirm that any testimony you get today would be the truth or nothing but the truth? I do. Officer, why don't you tell me what the agreement is, and then I'll ask Mr. McEwee if he's good with that and we'll get you out of here.
We've come into a joint stipulation agreement. He was in violation of not obtaining his certificate as a short-term rental. He has now initiated all of that and paid some of the fees that are due. He is now at a point where he has to schedule a re-inspection of his property, and he is not, he's going to be doing that now shortly, has not yet done that. So we are going to find him in violation of not obtaining the certificate as of yet, but giving him 30 days to comply.
Okay, and let me stop you there. I have October 16th. That would be 25 days?
That's what we have. Is that 25 days? Yes. Okay. We meant to give him 30.
It doesn't sound like that. I'll take 26. Okay.
It's 25 days. Is 25 days enough? 25 is fine, yes. Okay. Okay. My apologies.
We put the wrong date down. So, or there will be a fine if he does not comply by that time, $500.
Daily fine, right? Yes. Yes, sir. And he's paying costs of $420, right? Correct. Is that your understanding of the agreement? Yes, sir. Yeah. Okay. Well, I'll sign the order, and Carol will give you other instructions.
Thank you, Master Chief.
I think a lot of those are all 25 days. So, yes. You might want to check. Okay. Well, 21st, right?
The 21st.
That's perfect. I see how it's set up with the $500 in the second paragraph, too. That's good. It's really efficient.
Move a little bit faster, but it hasn't done it.
Give it a chance.
They're making the copy as soon as it comes out.
Now, you've got number eight next, right? Mm-hmm.
You can stay up here. It won't be that long. As long as it keeps it going. I know. It's like little by little. Okay. Whenever you want. I don't know why it's doing that today. As long as it keeps going.
It will stop whenever she's ready.
You have to worry about me.
Mm-hmm.
Item 8. Department Code Enforcement. Matter. Minimum Housing Code Violation. Case number CCM-26-00081. Officer B. Hughes. Owner. Quinn, Virginia F. Trust. Quinn, Virginia F. TRE. Notice address. Quinn, Virginia F. Trust. Quinn, Virginia F. TRE. 3998-55th Avenue North, St. Petersburg, Florida, 33714-1728. Violation address. 3998-55th Avenue North, St. Petersburg, Florida, 33714.
Good morning, ma'am.
Hello.
Good morning. Could you state your name for the record?
Oh, my name is Virginia Quinn.
You're the owner of the property?
I own the property.
I see that's in the trust. And officer?
Officer Hughes, Pinellas County Code Enforcement.
I understand you have an agreement here. Why don't you tell me what your understanding of the agreement is?
Yes, sir. Ms. Quinn has a big heart and was allowing a lot of people to live in her backyard, which caused a lot of the code violations. So we're to the point. She's been getting some help getting everything cleaned up and taken care of and is no longer letting anyone live in the back. So we're basically just asking for a finding of fact order for 22-298, 22-301, 22-317. And we're asking for the allowance of 60 days, which...
Hold on a second. You would just give me... For violation of what? 20... Give me those numbers again.
Sure. For violation for 22-298, we're just...
22-298.
Mm-hmm. It should be in the stipulation.
I don't have the stipulation. Oh.
You do?
I don't. I don't have them on any of these. It's stipulation.
Right. It's the joints.
Yeah, well, all I have is a trash and debris zoning and zoning, and it's different code numbers.
Do you want to show them the...
I-50... This is Quinn, right? I have property 58 violation, 304 trash and debris, 138 zoning.
Yes, I believe they had on the second page the finding of fact codes.
Yes, it should be in the second page.
Okay, so here's 22. Where do these come from, minimum housing? These are just findings of fact on those, and these are the violations?
Yes, sir. Those are the violations.
Okay. These are the violations, and then we have findings of fact.
Right here.
Different code sets. Mm-hmm. So there's your corrected violations. Mm-hmm. So we're going to correct these violations, which are here. Is it about being here, sir? And now we have findings of fact that these are 22?
Mm-hmm.
22. Do you understand what I'm saying? We don't do that on this step. I mean, here's 22. This is short-term rentals. What is... Right? That's it. Yeah, it's kind of sighting from two different places. That's noise, right, or something? What's 22-298? I don't want to say.
That's for... It was for using the electric with electric cords in the back for the people. This is not a short-term rental case.
No, yeah, I guess... You see, in the... They're admitting to the violations of 58-304, and then two zonings, 138-320, 3220, and 138- another zoning, and now we're getting a finding of fact on something else, and I just don't want to...
Yeah, because she had, I think, in total six violations, correct? Oh, correct.
Yeah, and then 123 minimum housing.
So three haven't come into compliance, and three have already come into compliance.
Oh, okay. It's got to be a little easier if I knew this. You know, I got to...
Yeah.
Do you understand me? Ms. Quinn, so in other words, you've come into compliance on three of the violations, and the county's giving you 60 days to comply with the others? Yes. Okay, and you know what they are? Yes. And you agreed to fines of $420? Yes. Okay, so you'll keep in contact? Okay, okay, well, I'm going to sign the order and keep in contact with the officer within 60 days. Thank you.
Thank you.
Thank you. Sorry for the confusion, okay? We're just starting in this process here. You can go over here and take care of it.
Thank you, Magistrate. I'll go over here.
Yeah, I mean, you need to see this, yeah. You want to see, okay. There's no other way for me to know if the order's right. Yeah, I mean, I either have to see the file or that, you know what I mean? Otherwise, I don't know, you know. I can't tell that from this anywhere, you know. It's appearing, but I don't know if that's what they were agreeing on it. Uh, 21. Here you go.
Thank you.
You're welcome.
I just do what it needs to do.
Sticky days. Is number 11 going to be next? Sure. No, and this one.
Uh-uh.
It's in violation of the short-term. That's why I was a G1.
So you're going to have to do this like this? Look at that.
No, but G1.
Item 11, Department Code Enforcement Matter, Minimum Housing Code Violation, Case Number CCM-26-00096, Officer D. DeVall, Owner, Blackburn Eric R., Notice Address, Blackburn Eric R., 230 Woodlake Wind, Oldsmar, Florida, 34677-2154, Violation Address, 230 Woodlake Wind, Oldsmar, Florida, 34677-2154, Violation Address, 230 Woodlake Wind, Oldsmar, Florida, 34677-2154, Violation Address, 230 Woodlake Wind, Oldsmar, Florida, 34677-2154. Your name, sir?
Eric Blackburn.
Property, correct? Yes, sir. Officer Steve Jane.
Yes, Officer Duvall.
You could both raise your right hands. Do you swear from that any testimony we get today would be the truth and nothing but the truth?
I do.
I do. Officer, tell me what we're agreeing to.
We've entered into a joint stipulation agreement for this short-term rental property. Mr. Blackburn has applied for the certificate of use and he has scheduled inspection. The inspection was actually completed today. He was able to check and see that that was done. So, we are doing a finding of fact on this and giving him the actual 25 days to pay his court costs of $420 and per compliance date of 10-16.
That's what the order states. Let me say this. Is that your understanding, Ms. Blackburn? Yes, it is. You get 25 days and you're going to finish up completing the inspection now. Yes, it was completed this morning. Make sure you have it posted and all that. Officer, you're saying that this will get discussed on this G1 thing. Let me just see what that. 0.2319 G1. That's a certificate of use then. Okay. Yes. I'm good with this. Okay. I'll sign the order. All right.
All right. Thank you, Madam Strait. Okay. And she will get you a copy.
Just three hours. Okay. I'll give you a... Well, I'm concerned about it. The same thing we have. Okay. We didn't do yet.
Very good. Thank you. Thank you.
It's G11. Yeah, they got to... They go in possibility because you can't get a number. All right. And so they got to cite them with the other section. Yes. They've been citing them with the other section.
That's for the next stipulation.
For 13?
Yes, that's for one.
Okay. You call 13.
Okay.
Item 13. Department code enforcement matter. Short-term rental violation. Case number CCM-26-00100. Officer D. Duvall. Owner. Casa de Luzo Realty, LLC. Notice address. Casa de Luzo Realty, LLC. 10125 Manatee Avenue West. Unit B4, Bradenton, Florida 34209-3101. Violation address. 183 Shore Drive, Palm Harbor, Florida 34683.
Your name for the record, sir?
Igor Rudikoff.
Say it again.
Igor Rudikoff.
What's your connection to the property?
I'm the owner.
Property is in your name? Property is in the name of Casa de Luzo Realty, LLC. What's your connection to Casa de Luzo? I'm the owner of the LLC. Thank you. And you have authority to sign, right? It's your LLC. That's what I'm trying to get out of here. State your name for the record, officer.
Officer Duvall.
Could you both raise your right hand, please? Do you swear, affirm, that any testimony we'll give today be the truth, nothing but the truth?
I do.
I do. Oh, sir. Go ahead. Tell me what your understanding of the agreement is.
We've entered into a joint stipulation agreement. He has completed all that is necessary and obtained his certificate and paid his fees and fines. So we're just looking for a finding of fact on this property plus court costs. Compliance due date is the 25 days out. I've just confirmed with him he's fine with paying his court costs in 25 days for compliance time frame of the 16th of October.
You went and you got your license, right? Yes. You're in compliance now and you're going to pay court costs and you've got 25 days to do it. You good with that? Yes. You signed for it? Okay. I'm going to sign the order and Carol will give you further.
All right. Thank you. Thank you, both of you. Great.
Who is his name here? Oh, is that where it appears in there? Yes. Oh. I've seen these for the first time. They're a little different. You can keep going if you want. It's totally up to you. I mean, it's easy for me. I just haven't seen this before.
I'm going to have to give you the cases for your life.
Yeah. You want to go? You want to wait? Whatever you want. What's that?
We'll wait.
Okay.
Communications, please stop recording. And then we're doing good timing today.
So what else do we have?
Item 16, Department Code Enforcement Matter, Zoning Code Violation, Case Number CCM-26-00103, Officer E. Stevens, Owner, Sood Anu, Sood Rajiv. Notice address, Sood Anu, Sood Rajiv, 25 Star Lane, South Barrington, Illinois, 60010-7136. Violation address, 1475 Vue Top Drive, Clearwater, Florida, 33764.
Is anyone here regarding 1475 Vue Top Drive, Clearwater? Let the record reflect that the gallery is empty outside of the officer's witnesses. Officer, could you state your name for the record?
My name is Officer E.J. Stevens.
Officer Stevens, keep your right arm raised. Do you swear or affirm that any testimony we give today be the truth and nothing but the truth? I do. Why don't you tell me what we're doing here first in a broad sense? I think this is...
Yes, Magistrate. We're here for a zoning violation as well as a noise violation as well. The property where the alleged violations existed is 1475 Vue Top Drive, located in Clearwater, Florida, 33764. It's located in a non-incorporated Pinellas County. The owner is Enu and Rajiv Sud, who is not present or being represented today.
And you can go through these documents as a package if you want, sir. Yes. I was just trying to see if this was a... You're seeking this loud or a cocus noise or whatever. I'm seeing it for the first time. Yes.
So go ahead, whatever's easier for you. We're going to go through the documents, which is the Notice of Hearing, which is located in these packets here. Yes. The Notice of Hearing. We have the Notice of Violation, which occurred back on 6-9-2026.
This is a zoning violation.
That is correct. There was an original zoning that was pulled previous to this just for the turf. After the fact, they had installed wooden posts around the fire pit. They installed a pergola, a mini-putt course, and a large portion of the backyard was also with porous surfaces, such as concrete, rocks, bricks, etc. They didn't apply for any of these at any time, and they currently have an open zoning case for that as well.
There's an outstatement that you're not here today on this. You're just pointing it out as part of this. That is correct. Okay. You're not seeking that zoning violation today.
Am I seeking the zoning?
You said there's an open zoning. There's also an open zoning case. Are you proceeding with that today? Yes, I am. Oh, okay.
Unfortunately, they have taken their time to try to resolve these issues with our zoning department, so I'm moving forward with it. Understood, officer. Go ahead. Sorry for the misunderstood. No? Go ahead. Right here, I have the tax collector, which shows both of them as the owners, which reside in South Barrington, Illinois. Same for the actual property appraiser and the warranting deed. If you look, both of them are on the deed with the same address in Barrington, Illinois. I'd like to point out that they do have their certificate of use for the county, which is dated, excuse me, which is for the address of 1475 Viewtop Drive. This was the original survey for the property that they applied for, and this is the current one that they're applying for.
When you say this is their survey they applied for?
Yes, from the original zoning clearance that they had.
Oh, okay. For the original zoning clearance? Yes. On just the wooden post? I mean, just the... Just for the turf. Got it. All right, I'll follow you. Go ahead.
And this is just to show the 2025 zoning clearance was for turf only. Got it. And this is the new one that they applied for in 2026, 00551, which is currently in waiting for an adjustment on their application. And when's that, how long has that been filed?
That's been almost for about a month now. Oh, okay. That's where it sits status-wise. Okay. Yes, sir. Go ahead.
And then during that time, I've tried to contact them about the status and have not heard back from them.
Okay.
In front of you here is the affidavit for unreasonably loud and ruckus noise from Ms. Susan C. Elliott, who is present here in the courtroom today.
This is from who?
Ms. Elliott, who is currently in the courtroom behind me.
Susan Elliott. Got it.
Yes, sir. That is just a snapshot of our Acela, which shows what is open and closed for that property. And these are the items that they've added to the property since the turf.
Just give me a second on this, Cielo. Okay, the dates are down in the middle. Okay. I got it. Go ahead.
Oh, sure.
We'll look at it. I'm sorry. Now, the photos? Are you up for the photos? Yes.
The fire pit with the stone and concrete and then the posts behind it that were installed.
Got it. It's all sideways to me here. Turn this. That's what I'm trying. My fault. Sorry, kids. Okay, then I can look there. Okay, got it. So, there we go. This is all new, right? Yes, sir. I got it. Got it. Detainment center there. Is that what you're doing? Okay. Yes, magistrate. Yeah.
Magistrate, the property was re-inspected on September 1st initially and again today on September 21st and the violations continue. A desk investigation was completed on this date and I would like to submit them as composite exhibit B. Okay, so re-inspection was September what? The initial was September 1st. Right. And I did a re-inspection this morning. This morning? Yes, sir.
Okay, give me a second. As to the documents already identified, I'm going to mark those, exhibit county one. Okay. And then we're going to do, you can put it all as a package, everything you've just gone through with me.
As you can tell, that has not changed since the initial September 1st.
No, hold on. You want to go on to exhibit B and I haven't done, finished exhibit A yet, which is everything you've been talking about since you've got here. Okay. So now get me everything you've had now up to this. You want to start with B, right? You're ready to do B. Okay, well put A in together and put an A on. It's C1. Yep. Or A, whatever you want to call it. It's an exhibit. That's all your honor. Okay, so is there any mark? You got it? Yes. You get it, Carolyn?
Yes, we have it.
And we have it. Exhibit A is accepted into evidence.
Yes, it's composite exhibit A, I believe. Yes, sir.
Now you can proceed. Go ahead, sir.
I'd like to accept, submit exhibit B into evidence showing that it has not been approved yet for the permit and it's still outstanding. Understood. Is that all of it? Okay, go ahead. And then on here is for the violation. They're still awaiting their application for the zoning clearance under ZCL 2600551.
Okay, is that all of B? Yes, that's all of B. I'm accepting B into evidence for the county.
As for the noise violation, magistrate, I'd like to call Ms. Elliott to the front, please.
Now, we just have one witness?
We can call her husband if necessary. Okay, give me one second here, okay?
Yeah, I just wanted to be sure. I think you just needed the one. That's right. Please call your witness, sir. Susan Elliott.
I'd like to call Ms. Elliott to the stand, please.
Ma'am, would you state your full name to the record?
Susan Elliott.
And your address, please?
1469 View Top Drive, Clearwater 33764.
If you'd be so kind as to raise your right hand, do you swear or affirm any testimony you give today be the truth and nothing but the truth?
I do.
Okay, so just stand and relax and ask you some questions.
Ms. Elliott, when did the noise problem first begin?
The weekend of June the 7th, Thursday evening. I believe it was the 6th.
And then what type of noise were you experiencing at that time?
They were loud radio music, screaming and yelling, cursing, very obnoxious partying in the backyard.
And where did that noise appear to be coming from? And I'm going to show you, if I may, Your Honor or Magistrate, show a picture of an aerial view of the two properties. Great. This being the property of the 1475 View Top Drive in Clearwater, and then the property for Ms. Susan C. Elliott and her husband at 1469 View Top Drive.
So they're contiguous, right? Yes. Okay. You had a shake in your head. I just wanted to put it on the record. They're next door, yes. Okay. This is your neighbor.
It's, yep.
I guess to you.
The house is next door to me.
Next door. I'm looking at you. Yes. So that's your next door neighbor. Yes. Okay, go ahead. Thank you, officer.
How does the noise affect you and others in the household, if you don't mind me asking?
The noise is continual. This particular party, the noise was continual from morning to night. It is out in the backyard. My office, I have a home office right next door to that house. I was struggling to even work at my desk, and you could hear this penetrating in every part of our home.
You answered the second part of the question. How did it interfere with your sleep, work, school, and other activities? Do you have any young children at home?
I do not.
Does your husband work from home?
He does.
Okay. I see you have submitted an affidavit for unreasonable, loud, and ruckus noise, which identifies dates, times, and also the description of the noise. If I may, I'm going to show a copy of her affidavit of unreasonable, loud, and ruckus noise. Is this the form that you filled out, ma'am?
Yes, it is.
Is this your signature?
Yes, it is.
Okay. And is this the property you were speaking about, 1475 Utah Drive in Clearwater?
Yes, it is.
Okay. Can you tell me exactly what you wrote in the definition of the loud noise complaint?
It was a very large party, multiple cars in the parking lot, or in the driveway, sorry, out front, people being Ubered in as well. They were outside at the pool area all day, starting at about 8 o'clock in the morning, throughout the evening. It started on a Thursday night. It wasn't too awful Thursday night. Friday morning, all day, Saturday, all day, and they finally checked out on Sunday.
Is this the first time this has happened at this property?
No.
How many times a month would you consider that this house is being rented?
Almost every weekend.
Okay. With that, I would like to show some photos, magistrate, of her property, and then the property next door.
You may proceed, have her identify it.
This property is the home of Ms. Elliott. The property to the south is going to be the property at 1475.
Okay, so I'm looking at that now with the black garage door. That is correct. Okay, I see it. And that's one thing to note.
Yeah, this is the fence in between the two properties, the fence for Ms. Elliott, and then the other fence is going to be the property at 1475.
Okay, got it. So they're pretty close together, that house.
And if you're looking from the back, this is where Ms. Elliott was standing in the next videos that were coming up, and I'll show you that shortly. That's the pergola. This is where she sits and enjoys her tranquility of her pool, her and her husband. So you can see the distance between the two.
This would be like looking from the respondent's backyard to yours, right?
Actually, right by the fence is where I'm standing.
I see the truck still there.
So if I may, I'd like to show a video, or actually two videos, Magistrate, of the occurrence on that date.
We'll have her identify her at some point. Okay. Who took this video off, sir? Whose video is this?
It's going to be Ms. Elliott taking the video.
Is your video Ms. Elliott? Yes, it is.
Mr. Stevens, if you can put the audio on your laptop.
Yep, I have it all the way up. When was this, Ms. Elliott approximately?
This was Friday.
What Friday?
Friday, June.
On the afterdavid? Yes. Go ahead.
We're going to play the second media.
Is there a problem, or am I missing something? Nope.
My noise, I can actually unplug it, and yeah, I'll unplug it.
Is this here, like near the fence, and there's a lot of noise coming or something?
It's extremely loud.
Okay. Yes, it's extremely loud. Just so I get up, I want to think of myself.
Well, I was wondering the same thing.
Take your time, officer. Make it. Is this just, in other words, this is noise. There's no video associated with it? Well, that's okay. I don't need to see her feet there. This is just, this is just noise. This is noise that you heard on your side of the fence.
Here's the first video, Matt Strait.
Officer Stevens, I'm so sorry to interrupt. If you can just flip your laptop, and you can put it on the seal, and then it could project.
I'm kind of missing why I need to see her feet. Help me here.
I was just filming the ground while I was walking outside to show how loud the music was.
Got it, got it. So you're showing me your feet here. It doesn't help me. How loud was it?
It was, it was very loud. Like, I could not even turn the music on in my backyard to drown that out, to sit at my pool.
Approximately what time was this? Do you remember?
I started filming. I reached out to the host at about four o'clock in the afternoon through the Airbnb platform to ask them to please get them under control.
And you said them. Who's them?
The, I reached out to the host who manages the property to get this party under control.
The owner under control. And the tenants.
To get these guests under control.
You keep pointing to guests. I just hear noise. I know.
I didn't film the guests. I'm in my yard. I, the music was so loud.
You have to hold the camera up above to do that, right?
Yeah, but I, I.
I'm just asking why. But yes, I would have had to hold it up, yes. You would have had to have done that, right? I got it.
When I reached out to them at four o'clock in the afternoon, I got no response from them. I started filming the, listening to the music in my backyard, walking around my backyard to film the ground, but listening to the sound of the music.
So, really what you've done is recorded noise here.
Exactly.
And your testimony, this is coming from a side of a fence. How far away is, you know, right on the other side of the fence. Right on the other side of the fence. Right up to your property.
Yes.
How loud is it? Did you do a decibel reading? Did you?
I did not do a decibel reading.
Officer, tell me how I'm going to tell how loud this music is.
It's loud enough to disturb the actual.
I realize it does, but I'm just saying here, you're presenting it. I mean.
Yes. We don't have a, we don't have a decibel meter at the time to actually. Okay. Go ahead.
They do it with the property though.
Who does?
The management company that manages that property states in their ad that they have noise detection equipment. They do not videotape their guests, but they can listen to their noise detection to determine if it's loud.
But we don't have any of that.
We do not. They did not respond back to me until midnight and responded back with. Okay.
The officer will get into all of that. Yeah. You want to play that whole thing with the music? Yeah, I'm going to play the new one. Go ahead.
All day.
What's the music coming from? Do you know? A radio or an amplifying system? Or is it a loud? It's not a live band, right? Somebody's playing music, right?
I don't know if they have speakers over there or not. I have never been in their backyard.
You don't know if this was someone's voices or a recording of some type?
So this is the music that I was recording that they were listening to all day long.
Okay. So did you see a band with people playing instruments or anything? No. So you don't know if it was a band or not?
I do not know if there was a band over there. That went on for two straight days.
Well, I'm going to ask you a bunch more points. I'm sure it's, I can tell.
Has anyone else witnessed or experienced the noise?
My husband. Any guests that have come over to my house.
Would you need the testimony of our other witness in the?
Do I need the testimony? I'd like to hear his testimony.
Yes, sir.
I mean, I'd like as much testimony as you can have. Absolutely. Thank you. I don't have a decibel level. I don't know if it's live music. I know very little here. Absolutely, magistrate. And I'm going to require, I might have some other questions for her. Yes. Your name's for the record, sir?
Donald R. Elliott, Jr.
And you're married to Mrs. Elliott over Susan Elliott?
Yes, sir, I am.
You have your right hand raised. Do you swear or affirm that any testimony we give today be the truth and nothing but the truth? Yes, sir, I do. Thank you. The officer's going to ask you a few questions. Yeah.
Pretty much the same questions I'm going to ask you as I did your wife. When did the noise problem first begin? Is this, like, was this the first occurrence or has this been going on for multiple years or months?
Well, it's been going on for multiple years, but not under the current management company and owner that owns it now. But this has been a problem property since about 2008, okay? It hasn't been a vacation rental for that entire time, but it's been a problem property for that entire time. This property's been purchased on the courthouse steps, I believe, back somewhere in 2008, 7, 8, 9, somewhere in there. We've had unique situations that the property's been broken into on three occasions.
I'm going to, this is not responsive to the question, officer. Yeah, I'm sorry, sir. That's all right. And I'm not sure what it has to do with this case, but just try to answer his questions because I want to ask you a whole bunch of questions.
No problem. What type of music did you experience on that day with your wife sitting by the pool?
Well, just the music that you just heard in the video. It's not music I listen to, but it's constant, loud music from my yard. You know, I could be in my pool and hear pretty much what you heard.
With the show of the map there, can you tell me where that noise was coming from, which property?
It was coming from the property south of me, and I was in the backyard, so it sounded pretty distinct that it was in the backyard of the property south of me.
Can you point to the property where it was coming from? Absolutely. And can you point to the area in your property where you and your wife were sitting when this occurred?
Well, we generally sit around our pool and enjoy the pool area, but anywhere in that backyard, even if I had walked all the way to the north side of my property, I could hear that music very clearly.
Okay. And how frequently does it happen, and how long do each episode, does it occur?
Well, it's hit or miss because these are tenants that come and rent for short periods of time. Sometimes I'm blessed with a peaceful neighbor, and other times I'm not. A couple of times a month, not always as bad as we just heard, but it's pretty consistent.
Okay. I'm going to ask you a two-part question. How does the noise affect you and others in the household, and does it interfere with your sleep, work, school, or any other activity that you have?
Well, it interferes with our sleep when we go to bed and the music is still playing. If I'm anywhere inside my house, I'm getting to hear this also. Obviously, it's more apparent to me when I'm outside by my pool enjoying my property.
Okay. Well, I appreciate that. I have no other further questions, magistrate.
I have a few questions, and Mr. Elliot, now, I don't want to get into the history of it. We're not here for that. We're here for our noise complaint. I understand, sir. My fault. And the warranty deed that the officer put in, that this property was sold in 2024 to the present owners. Yes. Well, that's not what you were saying. You said it went back, and these people have been troubled.
Well, we've had problems with this property.
With the property. Well, let's talk about the case. Did anything change in 2024 to get worse now?
Well, because it's the second vacation rental owner of this, it's definitely increased. Okay. And, you know, even the work that was being done back there in preparation for this to be what it is was disturbing while it was being done.
You don't know if this was music being played on a recorded device or an amplifier or this was a live band? Do you know that? You can't tell?
I have a live band.
I have a common...
If he could just answer, okay? Please step away for a second.
I'm going to apply a little common sense here.
Yeah, that's what I'm looking for, yeah.
Okay, it wasn't a band, and I didn't hear commercials, so I don't know that it was a radio. It was probably somebody's...
Amplifier playing something. Exactly.
And it was constant.
How... And during the day? 10 hours? 12 hours? Or...
Well, I wasn't home all day, every day, because I work. Okay. But I was told that it was going on that time, and when I came home, these were ongoing into the night.
And you're pointing to your wife. I've been trying to ask her these questions.
She complains to me sometimes that the noise is bothersome when she's home and I'm not.
And how many... How often in a month does this happen?
It varies from tenant to tenant, because... Well, does it happen every single tenant?
50% of the tenants help me here.
A couple of times a month. What's that? A couple of times a month, at least.
In other words, I'm sure they rented... Let's say they rented it every weekend for the last year, okay? Does it happen every weekend or 50%?
No, it does not happen every weekend.
How many times?
I would say two times a month, assuming that there's four weekends in a month.
Approximately half the time. Yes, sir. You're shaking your head. I don't want to give a testimony. I'm trying to get you to answer my questions. And anything else besides the loudness of the noise? Is it just music? You know, just music?
Well, sometimes it's people screaming and yelling and... That's what I'm trying to get out of here. ...and muting back and forth. And they're enjoying themselves.
Oh, so people are partying. People are partying.
Yes, sir. In my opinion, I'm not seeing them. I'm hearing them. I got it. But it sounds like they're having a party.
Got it. Okay, that's what I'm trying to figure out. It's your noise complaint. I'm trying to figure out what the noise is. Yes.
Sometimes it's just loud communication. Sometimes it's music. Sometimes it's all of it together. People talking loud over the music.
Okay. Got it. Okay. Thank you. Officer, go ahead. You're a witness. Can we take a... Just give me a five-minute break here. Sure.
Communications, please stop recording.
Excuse me. For the record, officer, I'm going to let you finish with this witness. Apparently, the respondent has appeared. Okay. I'm going to let you still continue with your case. Okay. My apologies, Mr. and Mrs. Elliott, about that. But why don't you just finish with this witness, and I'll let her step up. Okay. Now, to put her case on, I'm going to let you continue with your case. Don't feel pressured in any way.
Okay.
Thank you. Go ahead. Thank you very much, Ms. Elliott. Now, you can stay here. You might have more questions for you. Go ahead. Okay. I'm just going to... Yeah, you can recall her. Yeah. I have no more other questions for her. Okay. Do you have any more to your case? No, I do not. Okay. Well, I'm going to pull her up here because we're not done with the case yet. Ma'am, could you come up here, please? All right. You guys can step back over. Yeah, you can both have a seat, Mr. and Mrs. Elliott. Thank you. And can you state your... I understand you're here on this case. What's your name, ma'am?
Shosteen. Pavel.
I'm sorry?
Shosteen Pavel.
Let me write that. Spell that for me.
S-H-A-S-T-I...
F-H...
A-S...
S... F-H-F-H-A-S...
T-I-N-E...
T-I-N-E. Shosteen, I hope I'm saying that right. Go ahead. And your last name?
P-A-V-A-O...
Say that slower.
P-A...
P-A...
V...
V...
A...
P-A-V...
O...
P-A-V-O. Pavel. And do you have... What's your connection to 1475 View Tap Drive?
Uh... We are Bell Style Designs and Restoration. We're helping the homeowner rectify the issues that have been placed on the property.
Do you have a letter from them?
I do. That's this right here.
Oh, that's the letter that is allowing them? Okay. Yeah. Just wanted to make sure. Can I make a copy of that? Sure.
I see that. Seen it. No, just... Ma'am?
Yeah, that was to me.
Ma'am?
That was to me.
Ma'am, please.
Oh, sorry.
I want to know if you can be in this case yet and just let me speak to my clerk.
Sure.
Thank you. Has he seen this?
No, he has not.
And I can make a copy of that. I'd like him to see.
Officer Stevens?
I'm going to let you testify.
Okay. Thank you. I apologize.
So we have to apologize. Do me a favor, but make sure he gets a copy of that at some point. It'll be for the zoning. It'll probably be for the zoning only. That's what I suspect that's where this is going, officer.
Maybe I'll copy.
Officer, you can... I'm going to let her... He's already started his case. Sure. We have a noise complaint. We have a zoning complaint here. Okay. Ms. Bonvo. What are you doing for the owners of the property?
So there was a request for the thickness of the... Let me swear you in first.
Raise your right hand. Do you swear a firm that any testimony we give today be the truth, nothing but the truth?
Yes.
Okay. So now tell me what you're doing for the owners of the property.
There was a requirement for the thickness of the mulch that's down. I'm working on that. The permeability of the putt-putt, I'm working on that. And there is a pergola that's under 100 square feet. We've already replied to that.
So... Replied to who?
To the municipality on it.
Okay.
So it's... They kicked it back for permeability reasons, so we're working through that as well.
Well, ma'am, can you give me some dates? When these things were filed? When they were due? How about that kind of stuff?
Can I have that paper? Yes, ma'am. Yes. That's okay. I can make a comment. Take your time. Go ahead. Thank you. I have... I also want to be fully transparent. Yeah. I was just thrown into this last minute. She got... She does not live in town. She was given... She was served this on Saturday. She was given this on Saturday. So she had no time to get a flight to come here, and here I am.
When you say she was given this, she being...
The homeowner.
Okay. And given what?
This mailed correspondence. There was a yellow envelope that was mailed to her, and she sent me the information on it.
Do you know what that was?
It was discussing the... This case number, CCM.
But do you know what it was, ma'am? You're saying she didn't get the service of some document. I presume it's the notice of hearing. I don't know.
I would assume it is, too.
Okay. Well, that was mailed out some time ago, and do you know what she said? She didn't get it?
She said she just got it.
She just got it?
Yeah. Okay. So she got it on Saturday at 3.40.
How do you know that?
Because that's when she sent it to me. She said, hey, I just got home, and I just got this. Okay.
So you're telling me what she told you. Correct. Okay. Go ahead.
Again, I don't know any other information other than what I'm being told. I'm not giving you a hard time. I'm just trying to, you know... I'm just trying to help.
And so how long you... Look, I need dates and times here. Sure. How long have you been doing anything for the owners of the property?
So there's two different violations here with two different... So there's a revision for the second violation, which is the turf, the gravel, and the pergola. That is... There's a permit number, if you'd like to... Okay.
No, I don't. I want my question answered. My question was, how long have you been doing this?
So from the original...
How long have you been helping the owners of the property?
The original violation, probably about seven months.
There we go. Okay. And then just... So seven months ago, you were doing what for the owners of the property? Which violation?
I believe that was the turf violation.
You believe it.
Correct.
So you've been doing this for them.
Correct.
And you believe it was the turf violation. Correct. Seven months ago. Go ahead. Correct. What were you doing for them, trying to...
Getting the permeability rate of it. That there was some string lights that were placed on a fence that they didn't want on a fence, so that we removed it from the neighbors. Little things like that. And now, don't hold me to it. Again, I'm not fully prepared for this. I'm just doing the best that I can. I got it. Okay.
You're not a respondent here in the case. Okay. You know, I appreciate you coming here, but, you know, I have...
So, the second violation, the second notification, which was this particular permit number that I can give you that I have, it was responded to. It was kicked back.
When?
I don't have a date for when it was...
You don't know, so... But I'm asking what your involvement is. Seven months ago, you got involved in the turf thing, right? Correct. And there's a second thing, right? Correct. When did you get involved in that?
Probably about a month ago.
That's where we... There we go. Okay. So, this... And what's the other thing that you've been helping with?
That's the turf, the gravel, and the pergola.
Okay. Go ahead. So, what are you doing with that?
So, we submitted some documentation. They kicked it back for some revisions. The only thing that...
They being the county? Correct. The municipality. Okay. Go ahead.
So, they kicked it back for some revisions. It's currently in revisions, and we're working on them.
Anything else?
That's all that I have.
Officer, do you have questions for...
No, I do not.
Okay.
Thank you.
Actually, I do have one question. How long will it take you and your company to get these permits, and after the fact, permits completed?
You know, if I can have an extension of, let's just say, six months, but we're actively working on it right now.
Yeah, we can't do six months. You've had plenty of time to get this done.
Okay. What would you allow?
I can allow 30 days at the most.
Okay. We're actively working on it.
So, we'll get to that point in just a moment. Okay. I have no other questions.
Ms. Pavo, did you discuss this noise issue with the owners?
They have mentioned it to me, and I live three streets over, so whenever there is an issue, I come and I check on it real quick.
Oh, so you know about this?
Correct.
Tell me about the noise problem over there.
I'm going to be super transparent with you.
Appreciate it. Okay. I do. I don't mean to give you a hard time, but, you know...
That's what you do.
I want to get to... I need answers to questions as opposed to...
So, in full transparency, when I first was on this property, because I was property managing, I was project managing it for the client, I was... I want to use the proper term. I was ambushed by him and his wife. It was honestly very scary. They were very aggressive and finally was able to control the situation. When I tell you there was about 15 neighbors in the driveway, because they just started calling them. And I'm just a project manager. I'm not the owner, you know?
But they were angry and kind of took it out of you.
Correct.
They were angry.
But you know what's so crazy? This is from them directly. Their friend used to own that house and ran it like an Airbnb.
Their friend?
Yeah. And she used to be the housekeeper for it. No problems at that point. No problems at that point.
Put your hands down, please, back there.
But now someone else is... And look, I have no...
I'm not looking for your... Yeah. I don't need the history of what your opinion on the history is.
So this is like...
So you went over... You discussed the noise issue with the Elliotts?
Not with the Elliotts.
Were you asked by the owners to take care of the noise issue or what?
She said that they just got a noise complaint. Can you go over there and make sure everything's okay? I went to the... And did you? I did.
And what was the result of that?
They were outside.
They being... And friends are there. Other people are there.
The tenants were there.
The tenants? It's...
Yeah. The... You know, the Airbnb guests were there.
Okay. So the Airbnb and they were...
But it wasn't late at night. It wasn't anything crazy. Now, did they have some music going on? Yes. It wasn't blaring. You know, I like to listen to some loud music too when I'm in my pool area. I mean, I don't live on an acre of land.
How long were you there?
I was there for probably about maybe 15 minutes, maybe 20 minutes. I went in and I spoke with the guests. I said, hey guys, we're having a noise complaint. Can you just tone it down a little bit? And they're like, well, it's not even loud. And I'm like, look, I get it. Let's just... You know, you guys are going to be gone in a couple of days, but the homeowner is going to be here forever. So... And this home is a home that she plans on retiring into. So it's not just a business for her. It was something she bought. She lives up north.
Oh, there's the owner now.
Correct. The owner lives up north. She purchased it for a retirement property. And that's just where it is. I mean, I don't know anything.
How many times have you been to the property responding to noise complaints?
Maybe about three times at the most.
And that's over what period of time?
Correct.
Over what period of time?
Oh, I thought you said one period of time. I think this has been about a year.
So in a year, the owner's asked you to go over?
Correct.
And so, what were the other two times? You told me about when you went over the last time. What were the other two times? Was there noise there?
There were noise. They were in the pool. Mainly kids. The kids were like in a little tube and they were jumping in and splashing and doing all the things. They were, you know, being kids. And I just asked them to tone it down a little bit. I'm sorry?
Keep the noise down. Yeah.
I said, just keep the noise down. It wasn't at nighttime or anything. And it wasn't anything excessive. But, you know, they were listening to music and the kids were being loud. There was like four kids. So they were being loud.
And so the owner of the property called you up and said, look, you obviously have a relationship with them and go over. I'm getting a noise complaint. Did the owner say where the noise complaint came from? Was it the Elliot's?
I don't know who it came from. They didn't divulge that information to me. I'm in a group message with the property manager also. So whenever there is an issue, because I live three streets over, they're like, hey, can you run over real quick? And I run over.
And who's the property manager? Was the property manager?
Josh and Shea Green.
Does he know about what's going on today?
Yes, he does. Because we're all in a group message together.
He's not here. He's right.
He's not here. No.
How long has she had a property manager?
The entire time. I also want to note that on the property, there is a noise meter. So if the noise reaches a certain level, it automatically notifies the property manager and the property manager is like, hey, tone it down. You know, the noise meter has, you know, notified us it's too loud. So, and none of, and I asked for a report on that and there's no indication of extreme high.
When you say you asked for a report, you think this noise meter keeps a record of that?
I believe it does. Yes.
Really?
Correct.
And you don't have a copy with you today? I don't have a copy with me. Again, I'm not prepared. Do you know why the, do you know, did you ask the Josh for it or anything?
I asked for it a while back. Nothing recently. I didn't know I was coming here for a noise.
No, I got it. I'm not picking on you. I'm just trying to, you know.
I didn't know I was coming here for a noise complaint. I just, I didn't even know they were here. I walked in and saw them and I was like, oh.
I don't have any, I appreciate that. Officer, I've heard enough as I don't have any other questions.
Yeah, I have no other further questions.
Okay. You could stay and I'll even give you an opportunity to make an argument on the back end as a representative in light of the fact that it's a noise complaint, but the officer's already put in his, put his two witnesses on, you know.
That's fine. And ultimately, I respect, this is, it's a tough situation and I respect everyone's, I mean, I live three streets over, so I respect it, you know.
No, that's not a problem. Okay, thank you. You can have a seat there. Officer, you're right. You can do whatever you want. You can recall your clients. You can just make a closing statement, whatever you like.
I'd like to recall Ms. Elliott to stand, please. Ms. Elliott, on how many occasions have you had contact with, with Festine?
Never.
You've never had any contact with Ms. Festine?
Never.
No confrontation or anything?
I was never a housekeeper at the property. I never had that conversation.
Okay. I have no further questions. I have any questions.
Thank you, Ms. Elliott.
Magistrate, the county requests that you find the property in violation and issue an order to have the property broadened in compliance. Because of the interrent and transient noise, I'd like to also state some of the articles of noise if you'd like. You said you'd like to state some of the articles. Yes. You mean, give me an example. Would you like me to repeat the articles of noise?
Oh, you can if you want. Yeah, I know what the statute, the code says, that's for sure. But yeah, go ahead, tell them.
Under 584041, the definition of interrent and transient noise means a noise, whoever's sound pressure level exceeds the ambient noise level for a short or non-permanent duration or while traveling from place to place. The terms interrent and transient may be used interchangeably in this article. Irreparable and irreversible violation means a code violation due to the nature lacks a legal remedy or cure or to prevent the county from adequately enforcing the violation code provision. The terms are irreparable and irreversible may be used interchangeably in this article.
I'm familiar with the definitions. I have them right in front of me. I've read them numerous times. But you want to point it out and just, I thought you wanted to connect them to it. Yes, I would just like to point that out. No, I got it. Tell me what you think is loud and rococcus noise there, not to put you through it.
Because of Ms. Fastine's testimony, the county is asking for the allowance of 30 days for her and her company to comply. And if still found in violation, assign a daily fine of $500 a day for the violation of code section 13890. And then a fixed fine amount of $500 for interrent and transient nature under the code selection of 58444.
Plus, I presume, right, officer? Plus cost, right? So you're looking for $500 on the noise violation and $500 a day on the zoning? Yes, plus court cost of $420. There you go. Officer, let me ask you this. I'm very inclined to give the fine on the noise violation, that's for sure. What do you feel $500 a day on the, it seems like a lot for zoning with wooden posts and things like that. It seems like a lot per day. I've done these before. Is that because it's associated with the noise issue?
Yes, I would have no problems with maybe.
I'm going to make it, okay, got it. That's what it sounds like. I think they should be kept separate.
Not a problem, I can do that.
At least in terms, okay, all right.
And I'm going to give her my card, and as long as they keep in touch with me and do that, and as long as they're working towards getting it done and keep in touch with me, we can work on that.
Ms. Fustin, do you mind coming up? Thank you, officer. Ms. Fustin, is there anything else you want to tell me? I'm getting ready to make a decision here in this.
No, nothing at all.
I'm just giving the opportunity to come out here today. On behalf of the owner of the property, you may want to chat with the officer later, okay? Of course. It might help everybody, including the county, as well as the owners of the property. Okay, I'm going to consider the public portion of the hearing concluded. I'm going to fine for the county on the 138-90 zoning violation. I'm going to enter a fine of $250. I make it $200 a day. That fine can be abated if there's compliance within 30 days by 5 p.m., and that would be?
Maybe October 21st.
And with regard to the noise ordinance, I'm going to fine the owners of the property in violation of noise ordinance. I want to give you that code section, and the imposed a fine of $500. I'll give you the code section. Officer, what's the code section on the noise? 58-444. That's what I'm looking for. You have a 58-444. Yes, okay, and the county's awarded costs, and I believe the officer said $420. Thank you. What are we going to do with the order here?
We'll go ahead and mail it out. Okay. We're going to mail it out? Yes.
Okay. You want to tell if she's going to get it in the mail out? Yes.
We'll do. And if I can have, I don't know if the property management company has an address that we can mail it.
Yeah, you might want to take Josh's, provide it with Josh's number, too.
Perfect, thank you.
Thank you, officer.
Thank you, Mary.
Yes, she's the operation.
Oh. Stephanie at Valencia. 444.
DM.com.
Always have it right in front of me. I can never find it. Oh, it's right there. 444.
You got it? You got it. Okay.
Thank you. Yeah.
Sure. We'll do. Perfect. Really? So, you know what happened?
I want to show you how even this came to the client.
So, did she get her mail? Are we going to continue? In two.
Yes, so that's why I wanted to show you. You see how it says in the, I'm sorry?
Yeah, that's not going to work.
So, she has to give her. Have her. Let's go.
Okay. Yeah. Of course, you're only going to ask them.
I posted that off.
Which one?
Does she have to read her knowledge?
Because some of those are going to be rescheduled. Yeah, yeah. Just read them and then we say reschedule them.
Should we do these others and get them over?
We can continue, yeah.
Yeah, whatever.
And then we'll just give you the orders. I'll drop them off with the other orders. Whatever is easier for you. Yeah, that would be easier.
I don't mind. You can do the.
Yeah, so we can go.
So, you're going to do these offers and, well, I signed some orders. I don't need them, but we're only some of the ones. Yeah. You're going to drop these off that we're doing now. Okay. And you owe me three others, right? Correct. Yes, I do. Well, let's call them and get them out of here then.
We're continuing the hearing, guys. Item 1, Department Code Enforcement. Matter 22-299, Minimum Housing Code Violation. 58-270, Inaple Vehicle Code Violation. 58-304, Trash and Debris Code Violation. Case number CCM-26-00076. Officer B. Hughes, owner Tarr Charles S. Notice address, Tarr Charles S. 12-120, 114th Street, Seminole, Florida, 33778-2545. Violation address, 12-120, 114th Street, Seminole, Florida, 33778.
Excuse me. Carolyn, I don't have any of these here, right? Not that I need them.
Do you don't have Mr. Charles Tarr?
What is it?
Charles Tarr.
No, I forgot. Cavani, Woodland, Neisotas.
Bill, you can get a little coffee. I apologize.
That's okay.
Give me your coffee. Just don't make the payment. These are there.
Tarr? Oh, okay.
Oh, sorry. This is someone else, but this is Tarr.
That's a different violin.
Yes, sir. Okay, yeah.
Go ahead, officer. Okay. Number one. Let the record reflect that there's no one in the gallery and no one has responded for 12-120 South 114th Street. Officer, you may state your name.
Officer Hughes.
Raise your right hand. Do you swear or affirm that any testimony you give today be the truth and nothing but the truth?
I do.
You may proceed.
Thank you. So the property where the alleged violation exists is 12-120 114th Street, Seminole, Florida, 33778, located in Unincorporated Pinellas County, and I have not had any communication with Mr. Tarr. The violation has been in occurrence since on or before June 9th of 2026, and I would like to enter the Notice of Hearing and Composite Exhibit A into evidence, which includes the Notice of Violations, a Condemnation Notice, Pinellas County Tax Collector and Property Appraiser Documents, the Warranty Deed, and the Violation Photos.
You can proceed with one document and go through them real fast.
Great. I'm going to go ahead and show you the violation photos. The first is for minimum housing, $22,299. It's mostly for chip paint, peeling paint, and some rotted wood, and again, more photos showing the same, some rust, things of that nature.
Got it.
There are multiple vehicles on the property that are all inoperative. They're all full of garbage and have flat tires and are basically buried within, or in the driveway and buried in the yard.
Yeah, I see that.
Yeah, and there's some more of the vehicles, yes, sir. Additionally, we have the trash and debris violation. It is very overgrown with vegetation growing into the street. There's vegetative debris, large amount of leaves, trees. The overgrowth is quite significant. Even all the vehicles are full of debris. There's debris on top of the car, again, overgrowing into the street. The back of the tracks all have debris. So, Magistrate, the property was reinspected on September 16th of 2026. All violations continue. Photos were taken on that date, and may I submit them as composite exhibit B.
Okay, just for the record, I see the three violation notice June 9th, just like you said on the three violations. I see a condemnation notice June 10th.
Yes, the condemnation notice was completed due to the no power and no water back when he was living there. I don't believe he's living there anymore.
Okay, the violations are pretty clear. I accept exhibit A into evidence for the county, and please proceed with exhibit B, which are updated photos, I presume. Oh, I got it. Oh, yeah?
So the violations continue. There's been no change to the property. There's still the pure and paint discoloration on the awnings, some rotted wood. All the vehicles continue to be present with flat tires full of debris. The overgrowth continues. Vegetative debris continues. If anything, the overgrowth is getting worse.
The vehicles have moved an inch.
Yes, sir. So they're all still in the same condition. So, magistrate, the county is asking for the allowance of 30 days to comply and is still in violation, assign a daily fine amount of $100 per day for code sections 22 to 99, 58-270, 58-304, and award the court costs in the amount of $420.
Consider the public portion of the hearing closed. I'm going to fine for the county on all three violations and oppose a fine on the minimum housing 22. There's $299 of $100 a day. However, if there's compliance within 30 days, which would be?
October 21st.
October 21st by 5 p.m., that fine can be abated. Similarly, with regard to the inoperable vehicles, 58-270, I'm posing a fine of $100 a day. However, if there's compliance within 30 days, that fine will be abated, which would be the October 21st. And then lastly, I find for the county on the trash and debris, 58-304, and pose a fine of $100 per day. That fine can be abated if there's compliance within 30 days, which would be October 21st. Counties are awarded costs of $420.
Thank you, magistrate.
I have one more here. Go ahead. What do we have? What's next?
Item 2, rescheduled to October 12th, 2026. Department Code Enforcement, Matter 138-90 and 154-231, Zoning Code Violation. Case number CCM-26-00068. Officer B. Hughes, Owner, Clearview Oaks Management Condo Association, Inc. Notice address, Clearview Oaks Management Condo Association, Inc., 9887 4th Street North, Suite 104. St. Petersburg, Florida, 33702-2521. Violation address, 40th Avenue North, Kenneth City, Florida, 33709, and parcel ID 04-31-16-16110-000-0001.
Let the record reflect the matter has been rescheduled to October 12th, 2026. Yes, we're doing number four?
Item 4, Department Code Enforcement, Matter 58-270, Inoperable Vehicle Code Violation, 58-304, Trash and Debris Code Violation. Case number, CCM-26-00074. Officer B. Hughes, Owner, 3732-137th Avenue, LLC. Notice address, 3732-137th Avenue, LLC, 3876 Island Way, St. Petersburg, Florida, 33705-6449. Violation address, 3732-137th Avenue, North, Largo, Florida, 33771.
Let the record reflect that there's no one in the gallery, no one has responded to the call of the list. Officer, state your name for the record, please.
Officer Hughes.
Raise your right hand, please. Do you swear for him that any testimony we give today be the truth and nothing but the truth?
I do.
Okay.
I notice here, just before we start, I see a John Carter Esquire on the notice of violation. Did you see that?
Oh, I believe he's the registered agent, sir.
Okay. I just wanted to...
Let me double check that I'm not lying to you. That's okay.
I just, there's a lawyer's name on there. I just wanted to get heard from him or anything.
Yes, he's the registered agent.
Got it. Thank you. Please proceed. You do this as a package just like the last case if you want.
Okay, great. So, again, the property where the alleged violation exists is 3732 137th Avenue North, Largo, Florida, 33771, located in unincorporated Pinellas County. The owner from the 3732 137th Avenue LLC is not present, and I've had no communication from anyone from that LLC, including the registered agent. The violations have been in unincorrent since on or before May 26th of 2026, and I would like to enter the notice of hearing and composite exhibit A into evidence, which includes the notice of violations, Pinellas County tax collector and property appraiser information, the general warranty deed, the sun biz, and the violation photos.
Okay, so I'll show you photos representing the violations.
So, there were multiple inoperable vehicles on the property. There was basically a trailer that appeared to have been in an accident that obviously is inoperable. The whole side is ripped open, and there was an inoperable vehicle that was there without a tag affixed, and it looked like a flat tire.
Now, this is A?
Yes, sir.
Okay, I've got B here. They had handed me. Somehow I got it backwards. Go ahead. Okay.
So, these basically are just showing the inoperable vehicles, either with no tags, flat tires, and unable to operate due to the ripped-out wheel well. There was a large amount of trash and debris. There were, oh, excuse me, this actually, it was overgrown, so I didn't realize this at first, is a partial trailer, but it had the tires. You can see all the tires around the side, all the furniture that was being thrown away, and some overgrowth beside the building.
All right.
Again, more trash and debris violations, just showing, again, the more tires, just more items that were, you know, discarded around the property. So, magistrate, the property was re-inspected on September 16th of 2026, and the violations for the inoperable vehicles and trash and debris continued. Photos were taken on that date, and I would like to submit them as composite exhibit B.
Okay. And just give me a second here. I see all the notices were going out to the registered agent or whatever. In case you were doing inoperable vehicles, trash and debris. Okay, I'm accepting exhibit A for the county. Okay, into evidence, and please, let's proceed.
Move on to B.
Yeah, let's go to B. I think I have, is this B here?
Yes, sir.
Okay, I got A and B.
Okay, wonderful. So, yeah, so exhibit B just shows the same. And we still have the trailer that would be inoperable tire and no tag displayed. There's another trailer now on the property with no tag displayed. And you have the partially dismantled trailer, again, with no tag displayed that's obviously inoperable.
Did they do any work on the trash and debris at all?
Yes, a little bit.
But they brought more, some additional trash and debris, like the tires and stuff, right?
Right, so they cut the grass, as you can see here. So there's not the overgrowth. But you still have debris. You still have the tires beside the property. So it's better. And you still have the trailer with the, or the, excuse me, the tire over by the dismantled, partially dismantled trailer. So the trash and debris is better, but it's still present. There's still quite a few abandoned tires and a few miscellaneous items along the front. They did, as you said, cut the property. But we still have at least two, or excuse me, three inoperable vehicles and still some trash and debris. So, Magistrate, the county is asking for the allowance of 30 days to comply, and if still found in violation, assign a daily fine amount of $200 per day per violation for code sections 58-270 and 58-304, an award cost in the amount of $420.
Thank you, Officer. I'm going to consider the public portion of the hearing closed. I'm going to fine for the county on 58-270 inoperable vehicles and pose a fine of $100 a day. That fine can be abated if there's compliance within 30 days, which would be October 21st by 2026 at 5 p.m. Similarly, with regard to the trash and debris, 58-304, I'm going to pose a fine of $100 a day. That fine can be abated if there's compliance within 30 days, which would be October 21st by 5 o'clock, 2026, and grant the county costs of $420.
Thank you, sir.
Thank you, Officer.
Item 5, Department Code Enforcement Matter, Minimum Housing Code Violations, Case Number CCM-26-00094. Officer D. Duvall, owner Nisiotis Dimitra, notice address Nisiotis Dimitra, 36750, U.S. Highway 19 North, Apartment 2074, Palm Harbor, Florida, 34684-1239. Violation address 36750, U.S. Highway 19 North, Number 2-106, Palm Harbor, Florida, 34684.
Let the record reflect that there's no one in the gallery and no one has responded to the property at 36750, U.S. Highway 19. Officer, state your name for the record, please.
Officer Duvall.
If you could please raise your right hand. Do you swear or affirm that any testimony we get today be the truth and nothing but the truth?
I do.
You may proceed, Officer.
Okay. Thank you, Magistrate. Magistrate, this property where the alleged violation exists is located at 36750, U.S. Highway 19 North, and it would be in Apartment 2074, which is located in unincorporated Pinellas County. The owner, Dimitra Nisiotis, is not present for today's hearing. Magistrate, this violation has been in occurrence since on or before April 22nd of 2026. I'd like to enter the notice of hearing, affidavit of violation, and composite Exhibit A into evidence. Exhibit A includes the notice of violation, the NOVs, excuse me. Exhibit A includes the notices of violation, ownership confirmation through Pinellas County tax collector, property appraiser, and the deed. And there is also included, we have warning notices and advertisements because this is a short-term rental.
If I could just interrupt you for a second. So you're seeking a minimum housing violation so they don't have a certificate of use?
Correct.
Okay. And an advertising violation, right?
I am actually no certain. This is, I'm only going for the certificate violation. Oh, okay.
That's what I'm trying to figure out. Is that what you're seeking to do?
Yes, and I did misspeak. I'm sorry I didn't correct my scripting here. I do not have an affidavit of violation and request for hearing. I simply have the notice of hearing, the notice is a violation. Oh, okay. And ownership. Okay.
So you're just seeking the, I guess that's 22319, right? Correct.
And I'm actually going to be, as we move through this, going for a finding of fact. The property is now. Got it. Got it. Okay. Sorry to interrupt you. Just very quickly to review, the first four pages of Exhibit A are the notice of hearing sent to the property owner at the address of record, and this is the notice of violation sent to the property owner back in April. And then we have Pinellas County Tax Collector just confirming ownership of this property by Ms. Nestosis Demetria, and property appraiser reflects the same. This is the deed from the purchase back in 2004, and this is all from Innsbruck because the property is located inside the development of Innsbruck. So this is a warning notice that was sent to the property owner saying you need to apply for your certificate, and this was the advertisement confirming that they were using it as a short-term rental.
Right.
And then again, just more warning notices that were sent out by the county trying to stimulate some activity from this property owner getting them to apply.
It's a condo unit, right?
Correct. Correct. Just one bedroom, one bath, relatively small. So this was when I started working. I pulled directly from, I believe this was Airbnb, showing this is noncompliant because they had not applied for their certificate at that point. Yeah, I see all that in there, yeah. So basically, magistrate, I did a desk inspection, and actually I've had some communication via email with this property owner, and they have removed the advertisement. They have decided to no longer use it as a short-term rental. And, well, first, I do want to make sure that we can accept Exhibit A as is.
I was getting ready to rule on it. Sure. Exhibit A, the documents, as well as the, I guess I'd be, I don't know if that's Facebook or whatever you're looking for. Not Facebook.
Right. And that particular one is in Exhibit A, and then this is going to be my Exhibit B.
I'm going to, just for the record, I'm admitting Exhibit A, the Notice of Hearing and All the Associated Documents along with Airbnb documents into evidence. Okay. Exhibit A, please proceed with B.
So I did, through communication via email with the property owner, and then continued research of this is Airbnb. The property is now compliant. They did remove their advertisement as a short-term rental, and it was removed, the listing was removed as of the 15th of September. So I do acknowledge that. And then, as of this morning, I came into an email that was sent rather late on Friday. I did receive an affidavit of ceasing rental operations as a short-term rental for this property signed and notarized by the property owner. This came via email to me. So they have removed it. That makes me feel satisfied that they don't need to continue to try to pursue to get a certificate for short-term rental. So would you like the, is Exhibit B?
I'll take Exhibit B into evidence.
This is just showing clients.
You got it. I'll give this to you. No problem. What are you seeking, officer?
I am seeking a finding of fact, magistrate. Got it. Finding of fact for code section 22319 G1 for not obtaining a certificate. They are showing that they're not going to rent it short-term any longer, but that doesn't mean that at some point they may not try to return to doing that.
Give me one second. And I understand totally. I'm going to grant that. Finding of fact on the 22319 G1.
Yes. And I am asking for court costs of $420.
Costs for $420. Anything else, officer?
No. Just court costs payable within 30 days, which would be October 21st.
Anything else?
No, magistrate.
Okay. I'm going to consider the public portion of the hearing closed. I'm going to find for the county since there has been compliance. I want a finding of fact under 22-319 subsection A, subsection G, subsection 1 regarding the short-term license, certificate of use. I'm going to award the county $420 cost payable within 30 days, which would be October 21st. Thank you. Thank you, officer.
Item 7, Department Code Enforcement Matter, 22-231, Minimum Housing Code Violation, 138-90, 138-179, Zoning Code Violations. Case number, CCM-26-00084. Officer B. Hughes, owner, 12340-66th Largo, LLC. Notice address, 12340-66th Largo, LLC. 1515 Pine Street, Suite 100, Lakewood, New Jersey, 08701-4993. Violation address, 12340-66th Street North, Largo, Florida, 33773.
Now, do I have this file or anything on this? This is a minimum housing?
Yes, minimum housing and zoning.
It's one, it's just Largo? I don't have anything on it.
Sir, magistrate, this is one that we agreed to continue. Oh, is that why I don't have anything on it? That's why you don't have anything on it.
Oh, figures I wanted to see it. I'm probably the only person that knows where Pine Street and Lakewood, New Jersey is since I live down the block. I actually do know where it is from Howell. And, okay, so we got a continuance on this? What's the date for the record of the continuance? Anybody know? Cut up here.
Because I have witnesses coming as well, it's September 30th.
September 30th, same time, same place, right?
I believe the September 30th hearing is at 1.30. At 1.30? It's an afternoon hearing.
Okay?
Thank you, officer. Thank you.
Item 9, Department Code Enforcement matter, lien reduction. Case number CCM-22-00023. Owner 7025 Harmony, LLC. 13801 Vermont Avenue, LLC. Notice address, David Zlatelow, manager of 7025 Harmony, LLC. CO, James A. Schmidt, 2904 West Bay-to-Bay Boulevard, Tampa, Florida, 33629, paralegal at schmidtlawoffice.com. Violation address, 35801 U.S. Highway 19 North, Palm Harbor, Florida, 34684.
And no one's here for it, or no one's here for it, or no one's appeared for the lien reduction? It must have resolved it. Sure, it's been more resolved or something. We just dismiss it?
No, no one signed in.
All right, well, we'll dismiss it then. Then let's sign in. We'll wait until Kyle comes back, and we'll ask her if we have to reopen it. She's coming back, right? Yes. Go ahead. I'm sorry.
Item 10, Department Code Enforcement matter, minimum housing code violation. Case number, CCM-26-00093, Officer E. Stevens, Owner, Mule, Pamela A. Notice address, Mule, Pamela A, 414 Tampa Road, Palm Harbor, Florida, 34684-5461. Violation address, 414 Tampa Road, Palm Harbor, Florida, 34683.
Your Honor, we'd like to dismiss that case. Okay, let the record reflect that there's no one here for 414 Tampa Road, Palm Harbor, Florida, 34683. And at the request of the county, we'll dismiss the case as being dismissed.
Thank you, Madam Strait.
Thank you.
Item 12, Department Code Enforcement matter, short-term rental. Case number, CCM-26-00098. Officer D. DeVall, Owner, Kolkarni Veibhav, Wade Gonkar-Ridika. Notice address, Kolkarni Veibhav, Wade Gonkar-Ridika, 1822 Harris Avenue, San Jose, California, 95124-1123. Violation address, 1518 Wexford Drive, North, Palm Harbor, Florida, 34683.
We skipped 11.
We did that one earlier.
What's that?
It was a joint stipulation.
Okay. Excuse me, officer. This is number 12. Let the record reflect that the gallery's empty and nobody's responded for 1518 Wexford Drive, North, Palm Harbor. Officer, if you could state your name and raise your right hand.
Officer DeVall.
Okay. Do you swear if I'm ready to testify to give today, but it's nothing but the truth?
I do.
Okay. You may proceed, officer. Okay.
Thank you, magistrate. This property, where the alleged violation exists, is located at 1518 Wexford Drive, North, in Palm Harbor, which is in unincorporated Pinellas County. The property owners are not present for today's hearing. Very difficult names to pronounce. I can try them. I can try them. Okay. Okay. Okay. Okay. They're not present for today's hearing. Okay. This violation has been an occurrence since Honor before August 10th of 2026. I'd like to enter into evidence. I'd like to enter the notice of hearing as composite exhibit A, which also includes the notices of violation, the ownership confirmation through Pinellas County Tax Collector, property appraiser in the deed, and we also have other related advertising to show that this is a short-term rental.
What are you exactly seeking in this case?
In this particular case, I'm going to be seeking a violation of Code Section 22319G1 for not obtaining the certificate.
Understood. Is that it?
Yes, just that one code section, sir.
Okay, it makes my job a little easier following you. Yes, you may proceed and do this all at once in terms of the documents.
So the first four pages are the notice of hearing sent to the property owners at the address of record. They are not local. As you can see, the notice of hearing went to San Jose, California. We have the notice of violation. That was sent to the property owners back in August. Yes, sir. All of this documentation is showing property ownership as a mailing address of San Jose, California. We have confirming that through Tax Collector and property appraisers saying the same, and the warranty deed as well. These are the notices. So it appears that there was an ownership change with this property.
In December of 25, I see that. Yes, sir. The California that was going to Fort Worth, Texas. Correct. Got that.
So, and the way that it works now, the county has set this up that even though the prior property owner obtained a necessary certificate for advertising and operating as a short-term rental, when the property is sold, it does not transfer over.
I understood. That is how the code reads, right?
So, yes, I did include these, and honestly, I probably should not have because it did go to the previous property owner, but it did show that it was operating as a short-term rental, and now it's continuing to.
Well, let's see if I get that. Let's just chat about that for a second. It's operating now, is it a short-term rental? Correct. Okay, good enough. Yes, sir.
It sure is, and we have existing advertisements showing that it is currently working and operating as a short-term rental.
You're just saying you didn't need the early one from the previous owner. No, I got all that, but it's operating that way now.
So, as we see here, this is a nice advertisement showing that it is operating for 10 guests, four bedrooms, and so on, all of the amenities that it includes.
And when's that taken? What's the date? Generally, I always just look at the dates.
This particular one, this is a current advertisement. Yeah, that's kind of why I was looking for the date. Yes, sir, and I don't see a date from when I pulled this off the website, but it is current. Let me see if I get a date on all of this. See, this one says two weeks ago, three days ago, from some of the reviews that were left.
Well, go ahead.
So, this 138.90, if you happen to have this, this has been complied and taken care of. I didn't even pursue a zoning violation for this case. I see here I have attached something that I don't know if you have it in your package, but it shouldn't be there.
This is the last page?
Yeah, they had set them up for a, or sent out for a zoning violation, which we were not going to pursue following through with.
I have this violation.
Right, it would be the last page. It just got stapled to my packet.
The last page of mine is that.
Okay, I think good. I just stapled something to mine, not to yours.
That's okay. That's quite all right.
I apologize.
So, let me just ask you this. Do we, it's a short-term rental now, but we have nothing with the date, but did you search it and see that it's being offered now?
Yes, sir. And I have additional information here. So, if I can have Exhibit A accept?
Do you accept Exhibit A and have it marked into evidence? Okay.
So, the property owner was sent the notice of violation, and they did start the process of applying. I don't know for sure. I have not had any communication with them, but I'm thinking that maybe they thought it would carry over from the old owner. So, they, when they received their notice of violation, they did, and I was going to submit this as Exhibit B, they did apply here.
You go, if they're applying, we know they don't have one.
Correct. So, they did apply back on August 21st for, you can see it says short-term rental application. They did go through an inspection, and they need to do a re-inspection. So, their current status is a re-inspection is required, basically. They need to make some corrections to the property. I don't know what exactly those corrections are.
Opposed human notice or something, yeah, I got it.
But they need to schedule for a re-inspection, and then there is a fee associated with that. So, that's kind of the stage that they're at at this point. So, that is why the county is still, and there is no re-inspection scheduled as of Friday the 18th when I did my desk inspection. So, they have not yet scheduled for the re-inspection nor paid the fee. So, therefore, the county is seeking to fine the property in still violation of Code Section 22-319-G1, and seeking a fine of the $500 until compliance is met. We're looking for a 30-day compliance time frame, and we are also asking for the cost of $420.
So, you're looking for a $500 fine within 30 days of payment? Correct.
Correct.
And I'm sorry, did you say cost of some of it?
Yes, costs are also $420.
Anything else?
No magistrate.
I'm going to accept Exhibit B into evidence also. If you consider the public portion of the hearing closed, I'm going to fine for the county on the 22-319-G1 violation, which is no certificate of use, impose a fine of $500 a day, that fine can be abated. There's compliance within 30 days, which would be October 21st, 2026, and impose costs of $420. Thank you. I need to say it.
I'll just put it here.
Is that what we're up to? We're done.
We have a couple. We have three.
We have three. I was going to say it should be more. Go ahead.
Item 15. We're scheduled to October 16th, 2026. Department code enforcement matter, minimum housing code violation, case number CCM-26-00092. Officer E. Stevens, owner Avila Fonseca Giovanna R., Vaccaro Highland Elizabeth. Notice address, Avila Fonseca Giovanna R., Vaccaro Highland Elizabeth, 4505 Lake Place, Parish, Florida, 34219-5050. Violation address, 10437-52nd Avenue North, St. Petersburg, Florida, 33708.
This has been rescheduled?
Yes. She had her inspection today, and she did pass, so I'm asking for the 30-day reschedule.
Okay. Matter's been rescheduled to October 16th, 2026, I presume, at the same time or to that date. Okay. Thank you, Madam Chair. Great work.
Item 17. Department code enforcement matter, short-term rental violation, case number CCM-26-00104. Officer E. Stevens, owner Booth James J. Let the record reflect that the gallery is empty. No one has responded for 8532 42nd Avenue North, St. Petersburg. Officer.
Yes, magistrate. The son-in-law of Mr. James J. Booth was here earlier today. He wanted to, he is taking care of his affairs but did not have anything on file, notary, for taking care of his, so that's why we're extending it to a reschedule for 30 days from now.
Carolyn, I have no problems with that. Yeah, I will schedule on what date you want to pick, a date or?
Rescheduled, affair dates.
The 30th, if we have room.
Of this month?
Oh, I'm sorry, let's take it next month, I apologize.
We have the 16th and the 19th, so whichever one you guys, no, I'm sorry, the 12th and the 19th.
Whatever date you guys, no, we have 12th and the 19th.
I sent an email on Friday on that.
It's supposed to be pretty quick, right? I mean, we're the 21st already here, right?
Yes, the 19th.
The 19th is even shy of a month there.
Yeah.
Not that I care, I'm not sure what, if it's my case, yeah.
Let's do the 19th, if that's all right with you.
Okay, 19th at 8.30 a.m.
You're getting there, right?
8.30, right, yes.
We're getting there, right? Through the end? Yep. Yes.
Item 18, Department Code Enforcement Matter, short-term rental violation, case number CCM-26-00105. Officer E. Stephens, owner, Woodland Property, LLC. Notice address, Woodland Property, LLC. 902 8th Avenue NW, Largo, Florida, 33770-4102. Violation address, 4986 Woodland Drive North, St. Petersburg, Florida, 33708.
Let the record reflect the gallery is empty and no one's answers. 44986 Woodland Drive North, St. Petersburg. Officer Stevens, please raise your right hand. Do you swear if I've heard any testimony today because you've said nothing but the truth? I do. You may proceed, officer.
The property where the alleged violation existed was 4986 Woodland Drive North in St. Petersburg, Florida, with a zip code of 33708, located in unincorporated Pinellas County. The owner, Woodland Property, LLC, is not present or represented for today's hearing. Understood. Thank you. The violation have been in the current since on or before May 7th of 2025, and I would like to enter the Notice of Hearing, composite Exhibit A into evidence, which includes the Notice of Violation, the Pinellas County Tax Collector, property appraiser, deed, the Division of Corporations, an information letter from our Pinellas County Housing Official dated March 28th of 2025, another information letter from our Pinellas County Housing Official dated August 15th of 2025, the rental unit record, the seller report showing an expired STR application, and an active Airbnb website listing showing active.
Yes, you can proceed with that. I think I have all those documents. I might be missing one, but go ahead. Go right, sir.
The first four pages are going to be the Notice of Hearing, Woodland Properties, LLC.
And not to interrupt your officer, but you're just seeking a mandatory fine on the certificate of use? Yes.
Okay.
The 222-319, I guess that's... That's G. G. That's correct. And is that what all these other notices said G, or does it say G1? I'm fine with G1. It's G1. It is G1. Yes. It's mistyped on this. Go ahead. But go ahead. We'll figure that out. Go ahead.
And as you can tell, the people that were actually served this Notice of Hearing, Catherine Anderson, who is a registered agent, and also will be on the Notice of Violation, which was delivered. We have a Notice of Violation, which was dated of 825-2026, and this was authored by Officer Holliday, who has had numerous contact with via email trying to resolve this issue. Next couple pages, the Pinales County Tax Collector, which has Woodland Properties, LLC, with the address of Largo, Florida, and subsequent property appraisers with the same name and address of record, and the warranty deed with the same name and address of record. Also, the Division of Corporations shows that the Woodland Properties, LLC, has the address of the Woodland Drive, and then also the mailing address, which it was sent to, and then the registered agent, Ms. Catherine Anderson. This is the first information letter that was sent out by our housing official, Jude Reason, dated August 15, 2025. The second one, same identical letter with a different date of March 28th of 2025. This is from the Airbnb website showing and stating exactly the property and who is the host. It would be Catherine as well. It is showing active.
Is there a date on that anywhere? What's that? Is there a date on that anywhere?
This would have been the date of September 2nd. I have an updated one in Exhibit B.
Okay, good. This is going to have a date somewhere. Go ahead.
And again, this one currently showing an STRA, which was closed and expired, and my Exhibit B will show that there was a new one opened up on August 28th of 2026 this year. Thank you. Here showing the Airbnb, the property, does not have any of the required information for our ordinance. And as you can tell on the last page, this property, as of the September 2nd, could still be rented for the price of four nights at $1,191.
Officer, can I just ask you this? There's one document here, which is part of Composite A, page 10, activity timeline. What is that a page from?
The activity timeline comes from the actual host compliance website that we have that monitors all the short-term rentals that we have. That particular timeline will show when each time that property was rented for a particular short-term rental.
So every time they rent it, they notify the department?
It automatically kicks it to the short-term rental host compliance website that that property was actually rented for that day. I just never noticed that before.
Okay. Thank you very much. Oh, you're welcome. As more general sense. Go ahead.
Magistrate, the property was reinspected on September 2nd initially, and again on today, September 21st, 2026, and the violations continue. As of this morning, a desk investigation was completed on the state, and I would like to submit them as Composite Exhibit B.
Yes, I am accepting Exhibit Composite A into evidence. Yes, you can proceed with B. Thank you, Magistrate.
For the record, as you can tell, on September 28th, a new short-term rental application was applied for, and it's currently in the inspection process as we speak. This is as of this morning. Again, this was taken from the host compliance website, showing that an Airbnb is being rented. The most current... Oh, that's what I'm looking at. Right, yeah, go ahead. The most current one was 9-13 of this month. But that reflects that she is still continuing to rent the property, knowing that she does not have a short-term rental certificate on file. And as of this morning, as going through her Airbnb website, nothing has been updated since the date of September 2nd of 2026. And as of this morning, I was still able to register or rent a property for six nights at $1,525, according to the Airbnb website.
I'm going to accept a ban to evidence, County. Can I ask you this curious question? If someone, if they don't have a certificate of use, you know, a certificate, yeah, a certification of use, who's notifying you that they're renting it, you being the county? If they don't have one file that's a certificate of use, who's notifying you, telling you when they're renting it and not renting it?
From what I was told, Magistrate, is each one of the websites, like VRBO, they will tell, they'll be able to extract that through our host compliance website.
You keep saying host compliance. I mean, that's what I'm asking. Does Airbnb do that voluntarily? They have to put it out there. And then what happens is... You say they have to put it out there. I believe so. Okay. I'm just curious.
Yeah, don't quote me on that.
No, I think, I thought perhaps once you registered with the use, there's a allowance in there and you tell Airbnb and then they got to send it to you. I mean, you're telling me they said, you don't know if they send it to you just because you've asked them.
No, as far as I know, the program that we pay for, Oh, okay. Which is the host compliance.
Oh, okay. There's a program host compliance and this governmental unit. They go out and extract that information through a, let's say, like a program.
I got it. I got it. And then, okay.
What they do is, you know, calculate it and they'll tell us exactly what it is. Okay, so the county's letting you know when they do it and you just to be doubly sure, you check and say, well, can I get five days or whatever and then you know it.
So on that document that I showed you that you questioned about, on top of that, we'll have each of the websites that is dedicated to that actual property itself. It could be Airbnb, urbobooking.com. And what they do is that calculates all the information. It'll tell them what day that property was rented for that parcel.
They're harvesting it from all. Yes. Pretty interesting. Okay. All right. Anything else? What are you seeking? You're seeking, go ahead.
Magistrate, the county requests that you find the property in violation initial order to have the property brought into compliance. The county's asking for the allowance of 30 days to comply and if still found in violation, assign a single day of the fine amount of $500 per day and the court costs of $420 for the violation of code section 22319.
It's G1, right? G1. Yeah, this is the violation, just so we're clear because it gets a little confusing there with the other ones that are closed. Okay. Anything else?
No, magistrate.
Okay. So the public portion of the hearing closed. First, I'm going to find that the property owner is in violation of 22, there's 319, G1, imposed a fine of $500 a day. That fine can be debated if there's compliance. My filing certificate is within 30 days, which would be October 21st, 2026, and granting, awarding a cost of $420 to the county. Thank you, officer.
Thank you, magistrate.
Magistrate, and item 9, which is the other lien reduction that was a no-show.
Hang on. Yes, ma'am. He dismissed it.
Excuse me. They, every lien reduction, when they apply for it, we let them know that they have one, one continuance, so if they do not show, they can still continue it for one time only. So I'm going to reschedule them for October 19th at 8.30 a.m., and then if that's missed, then it gets, we don't do the lien reduction, that one gets dismissed.
Rescheduled to what day?
October 19th, 2026, at 8.30 a.m.
Okay.
The, okay, that's fine.
I believe we are set today.
I mean, I didn't do anything by saying dismissed on the record, right?
No.
I don't know, we still have the application. I don't have anything else not dealt with yet.
Okay. Communications, please stop recording.
