this case no magistrate have you got any uh voicemails or emails concerning this case no magistrate all right county may proceed do you swear to tell the truth the whole truth and nothing but the truth i do uh so match state the property where the alleged violation exists is 5248 104th street north st petersburg florida 33708 located in unincorporated pinellas county the owner pearl slayton estate is not present and no one has contacted me before this hearing the violations have been in occurrence since honor before april 27th of 2026 i would like to enter the notice of hearing and composite exhibit a into evidence which includes the notice of violations pinellas county tax collector and property appraiser information the warranty deed and the violation photos hearing no objection exhibit a will be admitted into evidence would you like me to go through the exhibit page by page or go straight to the violation so the first document is the notice of hearing scheduled for today's date the next document is the notice of violation for minimum housing sent to the owner of record notice the violation for the inoperable vehicles notice the violation for trash and debris violation and lastly the zoning violation for the outdoor storage you've got the tax collector document showing the owner of record likewise pinellas county property appraiser showing the same information the warranty deed and then the violation photos the first ones are for the minimum housing where you have rotted paint or rotted wood chip peeling paint you have a awning that the cover had been blown off you have some broken windows or missing vents on the door window the next photos show there's interoperable vehicles on the property you have a truck with no tag likewise a trailer with no tag again you can see the no vehicle registration and no vehicle registration um the next photos show the trash and debris the trailer on the property is full of trash and debris the logs which are still there is still on the right of way you've got multiple trash bags and vegetative vegetative debris on the property uh you also have multiple tools buckets equipments um pilings um just all different kind of um materials that are being stored on the property in front of the door extension cords things of that nature so magistrate the property was re-inspected on october 1st of 2026 and the violations continue photos were taken on that date and i would like to submit them to you as composite exhibit b hearing no objection exhibit b will be admitted into evidence so there haven't really been any changes since the original photos you still had all the extension cords and everything um being stored out front and i'm sorry these are the minimum housing violations where you can still see the chip paint the awning with the roof that was basically blown off the window missing broken screens things of that nature the same vehicles are still on the property you've got the trailer without a tag and the truck without a tag again you have the trailer that's still full of debris and trash um the buckets the bags of trash more bags of trash the logs that are still there on the right of way and just a large amount of equipment um again that's being stored on the property and i've had no contact from anyone so magistrate the county is alaska asking for the allowance of 30 days to comply and have still found in violation to assign a daily fine amount of 100 per day for perk per violation for code sections 22 299 58-270 58-304 and 138-3220 and award the costs in the amount of 230 dollars all right i have not seen anyone enter the hearing room that wasn't there when we started wasn't here when we started um caroline have you heard anything as far as voicemail or emails no magistrate case all right when it's 30 days all right i'm going to find that there is a violation of code section 22-299 order that the property be brought into compliance within 30 days which is november 15 2026 at 5 p.m failing to do so will assess a fine in the amount of 100 per day i'm going to find that there is a violation of code section 58-270 order that the property be brought into compliance within 30 days which is november 11 2026 at 5 p.m failing to do so will assess a fine in the amount of 100 per day i'm going to find that there is a violation of code section 58-304 order the property be brought into compliance within 30 days which is november 11 2026 at 5 p.m failing to do so will assess fine in the amount of 100 per day and i'm going to find that there is a violation of code section 138-3220 order that the property be brought in compliance within 30 days which is november 11 2026 at 5 p.m failing to do so will assess a fine in the amount of 100 per day i will also assess costs the amount of 230 dollars thank you majesty would you please read item number three item three department code enforcement matter short-term rental violation 2-2-2-319-g1-22-319-i2-22-319-i3 case number ccm-26-00085 officer b hughes owner inman justin notice address inman justin 305 dr martin luther king jr street apartment 1311 st petersburg florida 33705-1718 violation address 2067 betty lane clearwater florida 33755 who is here for that case who's here on behalf of the county officer hughes i see no one in the hearing room that i can't identify and know who they are uh has anybody signed in for this case no magistrate have you received any phone calls voicemails or emails no magistrate all right please raise your right hand do you swear to tell the truth the whole truth and nothing but the truth i do county may proceed okay so the property where the alleged violation exists is located in unincorporated pinellas county three four i apologize i just realized i think i grabbed the wrong folder that's right i'm just going to wing this here okay so um where the property exists is the 2067 betty lane um in unincorporated pinellas county and the owner is mr justin inman and i have had uh conversations with him the violations have been in occurrence uh since honor before uh the in the initial violation which was sent um on june 15th of 2026 um i did reach out to mr inman or excuse me he reached out to me when i posted the property and uh had stated that he had never received any notices of violation so upon uh researching it i realized that the original notice of violations that the area area officer had mailed had actually been sent to the wrong apartment number so as a result i told him that i would re-notice um the property and hence the reason that you see the notice of rescheduling so um uh we rescheduled it from september 14th i went ahead and resent the uh notices of violation on september 12th and have remained in contact with mr inman uh the entire time and i'll i'll get into that in just a minute so um so basically we have the notice of rescheduling to today's date we have the initial notice of hearing in that packet that had gone out on september 14th and then we have the new notices of violation that i sent with the correct department number the 1311 like as i said the first ones went out with just apartment 13. so we had the notice of violation with the minimum housing violations for the certificate of use and for the advertising we have the tax collector documentation showing that he's the owner of record and his correct mailing address uh same with property appraiser with the same address we have the general warranty deed and we have the email communication that i've had with him when he had initially contacted us um he wanted to know how to come into compliance and i had basically explained to either get the certificate um or to remove the listings or or change it to more than 30 days um in the uh in the advertising so um anyways so we were communicating back and forth um i went ahead and just to include them in the documents you've got the notices that were sent to him originally through uh the housing or from the housing official just letting them know about the short-term rental it does show that his short-term rental advertising listing is active and then a minimum nights of two so showing that it was in violation and then you have the actual advertisement um from airbnb showing that he's listing the home as a short-term rental with a minimum two night stay and you can see that he's got reviews showing that people are actually staying there uh so magistrate um the property was reinspected on october 6 of 2026 um he was still using the property as a short-term uh rental or and was advertising it at that time so i'd like to submit them as a composite exhibit b hearing no objection exhibit b will be admitted into evidence uh so basically again it just had my um my emails to him letting him know that it was rescheduled for today's date i have had communication with him he has decided that he doesn't want to continue to use this as a short-term rental that he is going to change it to um long-term rental for 30 days or more and he he stated uh that he has um by email actually changed it but it hasn't updated so um anyways for for right now we've got our email communication obviously um you've got showing that his active his listing is still active which i verified today again the minimum of two nights his uh listing still showing a minimum of two nights and that uh stayed a few nights stayed a few nights so showing that he is using it or was using it as a short-term rental so when he emailed me to let me know that he was going to turn it into a long-term rental and not the short-term rental i did tell him that i would still be moving it forward today and asking for the allowance of uh 30 days in that um i need that uh website to be updated so i can verify that he has actually changed it so magistrate the county requests that you find the property in violation of 22 319 g1 and is asking for the allowance of 30 days to comply and have still found in violation to assign a daily fine amount of 500 per day per violation for code section 22 319 g1 and award the cost of 230 dollars about the other two relations um because he is changing it i'm just going for the for the certificate of use violation code when is 30 days november the 11th all right um i haven't seen anyone come into the hearing room since we started this uh have you got any voicemails or uh emails concerning this no magistrate all right i'm going to find that there is a violation of code section 22-319 g1 order the property be brought into compliance within 30 days which is november 11 2026 at 5 p.m failing to do so we'll assess a finding the amount of 500 per day i am going to dismiss the violation of code section 22-319 i2 and 22-319 i3 without prejudice well says cost the amount of 230 dollars please read item number four item four department code enforcement matter minimum housing short-term rental 22-319 g1 case number ccm-26-00121 officer b hughes owner brito howard notice address brito howard 3211 stevenson street plant city florida 33566-9517 violation address 3442 azalea place largo florida 33771 is there anyone here for that case did anyone sign in for this case no magistrate i don't see anybody in the hearing room that i don't know who they are and why they're here um have you received any voicemails or emails concerning this no magistrate all right who's here on behalf of county officer hughes please raise your right hand you swear to tell the truth the whole truth and nothing but the truth i do county may proceed thank you so the property where the alleged violation exists is located in unincorporated pinellas county at 3442 azalea place largo florida 33771 the owner howard brito is not present for today's hearing and i've not had any communication from him uh the violation has been in occurrence since honor before august 18th of 2026 and i would like to enter in um i would like to enter into evidence the notice of hearing composite exhibit a which includes the notice of violations pinellas county tax collector and property appraiser databases the warranty deed the short-term rental notices and the short-term rental listings and advertisements hearing no objection exhibit a will be admitted into evidence thank you okay so we have the notice of hearing for today's date uh we have the notice of violations uh for the short-term rental certificate and for advertising back on august 18th of 2026 we have the tax collector information showing the address of record property appraiser with the same the warranty deed we have the uh notices from the housing official uh letting them know it was a short or had been identified as a short-term rental and what was required for the certificate warning notice and then we have the short-term rental listings it shows that the listing is active minimum of one night just all the different documented stays it shows the listing itself um with basically the advertising as a short-term rental they had another listing on airbnb showing the listing is active with a minimum of two nights and then you have the airbnb advertisement showing the pictures of the home showing that the entire home is being listed and then showing all the different times that it has been uh rented out so magistrate the property was reinspected on october 6 of 2026 the violations continue short-term rental listings and advertisements continue and i would like to submit the short-term rental listings and advertisements as composite exhibit b hearing no objection exhibit b will be admitted into evidence so after i posted the property i did get a phone call from the property managers that uh run the short-term rentals for the um the owner uh they did not dispute at all that it's not being that it is being used as a short-term rental uh you can still see that the listing shows active minimum of two nights for the first listing and again they're the property managers are not disputing at all that it's being used as a short-term rental um basically got showing that the house is being rented again just showing that they people are renting it leaving reviews the other website showing it's active minimum of one night and again just their their listing and showing that the documented stays and that they don't have all the required information on their listing so the property manager who has been in contact with me uh does want to bring the property into compliance they're having a hard time getting contact with the owner so they're going to be continuing to try to contact the owner they need some kind of documentation allowing them to apply for the certificate of use from the owner so they are actively working toward doing that so as a result magistrate the county requests that you find the property in violation of 22 319 g and 22 319 i and is asking for the allowance of 30 days to comply and if still found in violation to assign a daily fine amount of 500 per day and to award the county costs in the amount of 230 dollars on the agenda all i have is elation 22-319 g1 the notice of violation is for 22 319 g and 22 319 i and that's the reason why i was asking for those vote violation codes how many days are you requesting for compliance um i had asked for 30 if the property managers are able to get contact with the owner and need a little more time i'll certainly be flexible and work with them but for right now 30 days sir when it's 30 days november the 11th all right i haven't seen anyone come into the hearing room since we started this carolina have you received any voicemails or uh emails no magistrate all right i'm going to find that there's a violation code section 22-319 g order the property to be brought into compliance within 30 days which is november 11th 2026 at 5 p.m failing to do so failing to do so will assess a fine in the amount of 500 per day i'm going to find that there is a violation code section 22-319 subsection i order that the property be brought into compliance within 30 days which is november 11th 2026 at 5 p.m failing to do so will assess a fine in the amount of 500 per day i will also assess cost the amount of 230 dollars thank you magistrate is there a file for item six so item six i believe the um magistrate officer hughes is going to come up and she's requesting a continuance for that one please read item number six item six department code enforcement matter 58-444 noise ordinance code violation 22-299 minimum housing code violation case and why they're here um it's my understanding uh officer hughes that you are requesting a continuance yes sir do you need me to explain why yes please so the reason for the continuance is you don't necessarily need to get a short-term rental certificate if you live at the property and he's claiming to live there however he has a different property as a homestead address and so we're just trying to get clarification and i told him that we would continue it till november 16th so we can get clarification of where he resides um and to ensure that we actually um need to move forward with the um short-term rental certificate violation all right that sounds reasonable um and since he's not here to object to it i will grant the continuance to november 16th 2025 thank you sir 2026 2026 at 8 30 number ccm-26-00129 officer d deval owner polina sotio polina roina notice address polina sotio polina roina 889 marcen court glenn ellen illinois 60137 violation address 795 claudia lane palm harbor florida 34683 anyone here for that case i don't see anyone in the room that i don't recognize and know why they're here uh did anyone sign in for this case no magistrate and have you received any voicemails or emails concerning this no magistrate who's appearing for the county officer deval would you please raise your right hand you swear to tell the truth the whole truth and nothing but the truth i do you may proceed uh magistrate the property where this alleged violation exists is located at 795 claudia lane in palm harbor which is in unincorporated pinellas county the owners sotio and rowena polina are not present for today's hearing the violation has been an occurrence since honor before a july 2nd of 2026 i'd like to enter the notice of hearing and composite exhibit a which includes the notice of violation ownership confirmation through pinellas county tax collector property appraiser the deed and the advertisements through airbnb and vrbo platforms hearing no objection exhibit a will be admitted into off um evidence okay the first four pages of exhibit a are again the notice of violation sent to the property owners at the address of record we have the notice of violation sent out back in july tax collector confirming ownership of uh said owners of the polinas and we have a property appraiser these are reflecting the same the warranty deed of when they took ownership of the property dated back from february 22nd of 2022. we have here this is from airbnb confirming they are a active uh short-term rental this is their history of uh documented stays and listing dates and so on it's a very active property it's a very large beautiful home and this here just then it does confirm we have uh we have here that it is hosted by a lady by the name of helena i have spoken with this pro this representative for the property i was hopeful that she was going to be here today because she has been active and engaged in getting this property into compliance there is a short-term uh rental certificate that has been issued for this property but it is the advertising that had continued to be out of compliance that brings us here today so we have here this uh extensive listing here from uh airbnb one of the violations was the carbon monoxide alarm showed that they did not have it and that was a requirement that it not only had it but it was listed and shown in their advertisement they also did not have the necessary uh disclosures to state how many people were maximum capacity uh parking limitations and also the statements stating that they were uh in a residential location and to be courteous of noise with the neighbors and so on this was uh all of the advertisement here through uh very extensive advertisement through airbnb and they were lacking all of those things this is through vrbo and it was the same type of thing uh they did acknowledge the maximum capacity of 10 which was correct and what was what what was allowed but they did not not have the other disclosures um statements uh and so on that was needed and required even again in important information uh it did not have what was necessary so after working with the property uh representative and a desk inspection that was conducted on um october 9th the property is in compliance at this time um all of the the advertisements are now reflecting the correct identifiers and statements and all that is necessary and it is also only being advertised on airbnb and not not vrbo so i did pull here that they have um all of the necessary it says occupancy of 10 parking for four their dvpr license their uh str certificate number all of that is properly documented um of course they have many many reviews because this is a very popular rental so all of that is being properly listed and i had i guess i just blew this up a little bit making a little bit easier to read and then they did have the please note your vacation or residential area um disclosure and notation that needs to be uh basically to respect for the noise level respect the neighbors and so on so all of that is now present in their advertisements so county uh magistrate the county is looking for a finding of fact for this property for code sections 20 or code section 22-319 i section one and two of subsection i and to be awarded court costs of 230 dollars all right i haven't seen anyone come into the hearing room since we started this hearing um have you received any uh voicemails or emails since we started the hearing no magistrate all right i'm going to find that there was a violation of code section 22-319 i subsection one and subsection two that it has been remedied so this is a finding of fact i will make no further order concerning it but i will assess costs in the amount of 230 dollars thank you magistrate all right that um concludes the agenda for today do you want me to adjourn the hearing before we get the orders done yes so everybody can leave um are there any county attorney matters hearing none the hearing is closed and adjourned communications please stop recording
