Welcome to Pinellas County Code Enforcement Special Magistrate Hearings. The special magistrate is charged with conducting hearings to determine whether an alleged violation of the county code has occurred. In order to meet that obligation, all parties or their representatives will be allowed an opportunity to be heard on matters relevant to the alleged violations. All witnesses offering testimony or presenting evidence will be required to swear or affirm that the testimony they provide is the truth. The order of presentation will begin with the county presenting their evidence of the alleged violations, and then the respondent shall present his or her case. Both parties shall have an opportunity to cross-examine all witnesses. The special magistrate may question any witness. The clerk will announce the names of the cases from the agenda. When you hear your case called, please respond by coming to the podium with your representative and or any witnesses to be sworn in. We don't always follow the exact numerical order on the agenda for a variety of reasons, so listen up when the clerk calls the cases to see if it's your case. Good morning, magistrate. The property where the alleged violation exists is 11302 60th Terrace, Seminole, Florida 33772, located in unincorporated Pinellas County. The owner, Brenda Purdue, is here today, is represented, or is present, excuse me, for today's hearing. The violation has been on, the violations have been in occurrence since Honor Before, August 13th of 2024, and I would like to enter the notice of hearing, affidavit of violation, and composite Exhibit A into evidence.

Okay, so I will be testifying shortly that everything is in compliance, and we're just going to be requesting a finding-of-fact order. But just briefly, there were some minimum housing violations with some of the stucco and algae-like substance and a hole over the ceiling on the porch. Again, there was some disrepair, rotted wood, peeling paint. There was debris on the property, and some overgrowth, and some fence debris. And lastly, the fence was in disrepair. There were picket smiths-ing, and part of it was on the ground. So, magistrate, the property was reinspected on December 1st of 2025, and all the violations are now in compliance. Photos were taken on that date, and I would like to submit them as composite Exhibit B.

Okay, so she did have a lot of work done. All the algae-like substances were completely gone. There was new paint on the house. Any of the overgrowth and debris had been removed, and the fence is now in compliance as well. It was repaired. So, basically, the county request that you find the property was in violation is now in compliance, and the issue of finding a fact order for Code Sections 22-299, 58-304, and 138-3703.

The owner of Revocable Family Trust, LLC, is not present for today's hearing. The violations have been in occurrence since on or before, August 12th of 2025, and I would like to enter the notice of hearing and composite Exhibit A into evidence.

Okay. So we actually had brought this property before and actually had a motion to foreclose approved. However, because of an issue with the deed being not recorded properly, we had to start all over. So this property has been in violation for a long time. You can see with the minimum housing, everything is boarded. You have the soffit falling down. You have holes in the property. There have been stop work orders put on by PCCLB for a new roof that was put on without a permit or licensed contractor, and same with some plumbing work. So again, there's rotted wood, peeling paint. The soffit is coming down. You have broken windows. Everything's boarded, and this is just the stop work order from PCCLB. There's trash and debris on the property. There's overgrowth and just discarded lumber and just different miscellaneous items throughout the property. Again, some more overgrowth, more overgrowth. The fence is in disrepair. There's missing sections, rotted wood. Part of the chain link fence is all mangled and in disrepair. So magistrate, the property was re-inspected on November 3rd, and the violations continue. Voters were taken on that date, and I would like to submit them as composite exhibit B.

So basically, there were really no changes. This inspection was in preparation for the original hearing that got continued. So I'll just flip through them briefly. It basically shows there's no changes. Everything's boarded. The windows are broken. There's still rotted wood. This area is actually getting worse, where the holes are getting worse. Again, the same trash and debris, and some overgrowth is still present, and no change to the fence. So magistrate, due to the continuance request, the property was re-inspected on December 5th, and the violations continue, and I would like to submit them as composite exhibit C.

Okay. So basically, again, no changes. It is, they still have all the broken windows, everything's boarded, rotted peeling paint, the esophage falling down, the siding is continuing to get worse. There's still trash and debris, vegetative debris on the property, and there's been no change to the fence. It's still in disrepair. So magistrate, the county requests that you find the property in violation and issue an order to have the property brought into compliance.

The violation has been in occurrence since on or before, September 4th of 2025, and I would like to enter the notice of hearing, affidavit of violation, and composite Exhibit A into evidence.

So we've had continuing issues with this property off and on for overgrowth violations. These are just images where the grass was growing into the street. You can tell from the neighboring property, however grown it is, and it's halfway up the mailbox. It was growing into the driveway. Pretty much the entire yard was overgrown, another example, and growing into the concrete on the driveway. The vines were growing all over the side of the house and over covering the windows. There was a large tree branch on the property. And actually this property has been in violation for the same violation off and on. And they had multiple lot clearings which brought the property into compliance. So there's a total of one previous, two previous. So two previous lot clearings and several notice of violations. So, Magistrate, the property was reinspected on December 2nd of 2025, and the violation is now in compliance. Photos were taken on that date, and I would like to submit them as composite Exhibit B.

So when I did return, the overgrowth was cut, the trash and debris was removed. However, we are requesting a finding of fact order for 58-304 for the overgrowth and debris, being that this has been a property that we have continuous problems with. So, Magistrate, the county requests that you find the property was in violation and now in compliance and issue a finding of fact order for Code Section 58-304 and approve the court costs.
