Welcome to Pinellas County Code Enforcement Special Magistrate Hearings there. The special magistrate is charged with conducting hearings to determine whether an alleged violation of the county code has occurred. In order to meet that obligation, all parties or their representatives will be allowed an opportunity to be heard on matters relevant to the alleged violation of violations. All witnesses offering testimony or presenting evidence will be required to swear or affirm that the testimony they provide is the truth. The order of presentation will begin with the county presenting their evidence of the alleged violation and then the respondent shall present his or her case. Both parties shall have an opportunity to cross-examine all witnesses. The special magistrate may question any witness. The clerk will announce the names of the case from the agenda. When you hear your case called, please respond by coming to the podium. With your representative and or any witnesses to be sworn in. When addressing the special magistrate, please speak clearly into the microphone. Any person who decides to appeal the decision of the code enforcement special magistrate with respect to any matter considered at this hearing will need a record of the proceedings and for such purposes may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based. Yes, I do have a request for a continuous judge. This is a first request, first time this has been called up. Um, I was literally just retained on Wednesday. I am the registered agent, but all of the prior issues that are in this case have been going straight to the P.O. box, um, the Certificate of Service of the Notice of Hearing was August 1st. I have the, uh, the actual envelope with me. It went out on the 5th in my records for my office, which I keep because I handle the mail myself. I'm a solo practitioner. Came in on the 11th. I was in a trial with Judge Covert on Tuesday all day, so I first really saw this. On Wednesday, my client got it apparently the same day, called me, asked to hire me officially, not just as registered agent on this. Um, so I did that. I immediately reached out to your offices asking for a continuance, but because we're in the seven days period, they informed me I need to come and show up. Um, I've spoken with the officer here today. Um, plus my client's not here. He's already up in New York moving his daughter into college, into her dorm, and he's not going to be back until Tuesday. So I haven't really been able to investigate everything. But I did have a very good conversation with, um, Madam Officer here, and, uh, I fully understand the case and the issues in it. Um, and I, we did come up to a pseudo-agreement. She can't agree, but she's not going to oppose the continuance judge until 9-5 if my client and it's put in an order, um, hits the major parts that need to be done by securing the property and cleaning overgrowth, which seems to be the biggest issues. Um, so we would ask for a continuance based on that stipulation to have that done within two weeks, and I would assert that's a good cause, Your Honor.

I did explain the one reason that I was hesitant to the continuance initially and that I was going to argue against it initially was because the, uh, building is not secure. The back door is open. One of the apartments is open. There's a broken window that people can climb in and out of. Uh, when he did agree to ensure that all the, um, entryways that, and I know from the neighbors also that, um, people have been going in and they don't have to break in. And they're just walking in and using the facility, they can see, um, uh, people lighting things up in the evening. No, I got it.

Uh, the way the building inspector put it as possible sinkhole, you can definitely see that the, um, basically what originally happened with the, when the code enforcement area officer first went in, that there was a tenant there and the floor and the wall had basically separated. Um, part of the ceiling had caved in. Um, so that's when they had the building inspector take a look. They did condemn it. And, um, it's my understanding, except for people that have broken in or walked in because it's not secure, uh, no one actually has been living there. They haven't been renting it. So part of the violations are going to be the minimum housing violations with the condition that it's in. And there is soffit, um, the root that's falling down the, um, the whole inside of it. It's been partially gutted. There's basically mud on the floor on the inside. So, um, minimum housing will be part of the violations. Uh, the overgrowth is part of the violations and the fence and disrepair will be part of the violations.

And obviously I'm going to advise my client with the, the status of the squatters or interveners. He's in much more, uh, personal liability on it, on the corporation is.

The Respondent, he purchased this back in November, and this was the time where the violation was posted. So when they got it, it was a hot mess, if you will. And that initial posting, they didn't have the, I guess, cognizance during the transition of taking over the property. And so they missed that initial hearing, I believe it was back in January. And since then, they got notice of the property again, but they've done substantial improvements of the property. And I have a picture here that you can compare to. And so they're just asking that the $600, I think 603, 604, be waived, and they have a little more time to fully have everything in compliance. I think as of now, they have three things in compliance. I have the picture here, if I can.

So there's a lot with this case. If there have been improvements, I haven't seen them yet. So before the pictures get submitted, I would like to actually look at them. They were, stop work order was placed on the property because they don't have permits from unlicensed contracting board or investigator. Therefore, depending on what work they're doing, whether it requires a permit, I'm not sure they should be doing it anyway until they get permits. So I would like to actually present my case and have you decide.

Yeah, they are in the process, if they haven't already contracted with a GC, the property prior to them purchasing it, like literally during that time, contemporaneously, there was a trailer home in front. And that trailer home, I guess, blocked the back part of the house and all of the debris. I mean, if you could imagine, you know, maybe you've seen it or whoever was out there. It was like a stockpile of trash. So I think the motivation with the client at that time was just to actually get everything out. I mean, I have, you know, it's just, it's been massive improvement. And they are aware that they have to get a GC to get to pull the permits to continue renovating the home. But, I mean, from the time that they got it, I mean, it was a real eyesore and it was a hazard. So I think their motivation was to hurry up and try to get that stuff out. But now they have contracted with a GC.

Well, Mr. Dick, Mr. Pinson, they're not willing to waive the cost, okay? So then I'm going to put the, my only alternative is to, and generally they don't, okay? It's taxpayer dollars. Put the case on and I'll decide whether there was a violation at a certain point in time. And if so, you know, most likely, depending on what the testimony is, you can put that all on. You know, I'm going to, if you, if there's found to be a violation, I'm going to incur the cost. But I won't know that until I hear the case. And you want an opportunity to chat with her about it. I doubt if she's going to change the cost just because I know she probably doesn't have the authority. I don't. And as far as the other violations, you know, if you want a few minutes, you think you're the last case here. So you want a few minutes to chat with her because I suspect she's probably willing to give you a certain amount of time to do everything else. Okay. And maybe she could work on that. That's up to you. Otherwise, I have to, I have to hear the case to decide the cost.

There has been communication with the adult son who lives at the property. The property owner has been deceased for several years, Sandra Key. I have had communication with the son. I was going to try to meet him this week, and that never did end up happening. He never did show up at the property. This is an overhang that has had wood replaced and no protective coating put on it. The entire parcel is extremely overgrown. Again, a front shot. We have a very large debris pile in the front right by the road, and these are properties. This is a picture of the side of the property. This is probably as tall as I am out there. This other side is probably about knee-deep to me, and this is just an up-closed picture of some of the debris that's been gathered up by the road. And the fence violation, although not extreme, we do have some broken fencing that is chain-linked. We've got some bent rails. Some of it may even be from the overgrowth that's pushing it out. This long runs, as you can see, right along this sidewalk here.
