Welcome to Pinellas County Code Enforcement Special Magistrate Hearings. The Special Magistrate is charged with conducting hearings to determine whether an alleged violation of the County Code has occurred. In order to meet that obligation, all parties of the representatives will be allowed an opportunity to be heard on matters relevant to the alleged violation of violations. All witnesses offering testimony or presenting evidence will be required to swear or affirm that the testimony they provide is the truth. The order of presentation will begin with the County presenting their evidence of the alleged violation of violations, and then the respondent shall present his or her case. Both parties shall have an opportunity to cross-examine all witnesses. The Special Magistrate may question any witness. The Clerk will announce the names of the cases from the agenda. When you hear your case called, please respond by coming to the podium. With your representative and or any witnesses to be sworn in when addressing the Special Magistrate, please speak clearly into the microphone. Any person who decides to appeal the decision of the Code Enforcement Special Magistrate with respect to any matter considered at this hearing will need a record of the proceedings and for such purposes may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based. Such record is not provided by Pinellas County. You may call the first. Item number one, Department PCCLB, Matter 22-14-1, Unlicensed Contracting Code Violation 22-14-5, No Permit Code Violation. Defendant, Sergey Rapoport, notice address, Sergey Rapoport 77, Orange Street, Waltham, Massachusetts, 02453. Email address, rapsir at gmail.com. Violation address, 12110 North 93rd Way, Largo, Florida 33773. Sir, your name, please? Sergey Rapoport. Good morning, Mr. Rapoport. Your name, counselor? Good morning. Kirby Kreider, Assistant County Attorney. Present with me is Investigator Nichols. Investigator Nichols and Mr. Rapoport, if you could both please raise your right hand. Do you swear or affirm that any testimony you'll get today to be the truth and nothing but the truth? I do. The county will go first, Mr. Rapoport. You could stand there if you want, or you could have a seat, step away, and I'll give you an opportunity to cross-examine the witness. I'll step in. Okay. Good morning, sir. Could you state your name for the record? Good morning. Investigator Nichols. And how are you employed? I'm employed with the Pinellas County Construction Licensing Board. In connection with your job duties, did you receive any training or experience? Yes. Administrative and field training. And you heard the case that was just read aloud. Are you familiar with this matter? I am. All right. I'm going to begin by showing you one citation. This is citation number CLBCT260465, and you cited the homeowner for working without a permit. Is that an accurate copy of the citation you issued? Yeah, that is correct. And am I correct in saying that you issued a second citation in this matter? I did. Coming up on the screen, CLBCT260466, and that is for unlicensed contracting by the active installing windows. Is that correct? That is correct. Can you tell me how you first got involved in this investigation? Yes. A complaint from the neighbor was reported to our office at that time. I basically conducted a site visit to basically see what work was going on at the house. The homeowner was able to send me photos of the windows being installed by an unlicensed contractor. At that time, when I went out there, the unlicensed contractor was not there. I went out the following day to notice that the windows was already installed, and I verified via looking at the glass to see if it was new and it was installed. I then put a cease and desist stop work order due to the fact when I ran the address, the parcel, no permit was pulled, and I did not see any active licensed contractor. You mentioned that you received a complaint from a homeowner. Did the homeowner submit any photos to you? Yes, he did. Do you want to take a look at these, sir, before I put them in evidence? Yes. Before I asked to put them in evidence? Yes, I have seen those. Thank you. See that this is dated on the 29th? That is correct. And this was received from the homeowner? That is correct. And when you went out to this property, did you observe it to be in the same condition? When I went to the property, the new windows was already installed. Counselor, you keep saying the homeowner is the owner of this property? Yes, sir. Oh, Mr. Rapp. Yes, sir. Please. Go ahead. Is this another photo that was sent to you? Yes. That photo showed the unlicensed contractor installing the windows at the time the homeowner witnessed it. You're saying, I see your question now, when we're seeing the homeowner. It initially testified that this came about by a call from the homeowner is what I said. Oh, okay. I see your question now. Oh, okay. Thank you. And these photos that I showed you were sent to you by the neighbor? That is correct. At this time, I'd ask us to move this in as composite county one. Mr. Rappaport, do you have any objection to composite one of these photographs? Well, this is my house, and I would assume that those pictures were truly taken of my house. Consider that to be no objections. No objections, sir. Okay. I'm going to accept the composite. We'll mark those. County one. County one. Yeah. Should I? Yes. Ms. Reilly. It's usually the different color. Oh. I just didn't want to mess it up. I'm sorry. Mr. Nichols, the photos that we just looked were provided to you by the neighboring homeowner. Did you yourself go out to the site at any point? Mr. Yes, so what I did was I spoke to the complainant, which is the neighboring homeowner, and spoke to him. And once I was able to, I conducted a site visit the very next morning to conduct my own investigation to see if the actual windows were installed. That was on June 30th? Mr. That is correct, the following day. And based on your training and experience and observation, this appeared to be a new window? That is correct. And then we can kind of see the front right here. Was that also really installed? That is correct. And then just a closer, this is the cease and desist you were talking about? That is correct. I, at this point, asked to move this in as county two, composite two. Mr. Rappaport, do you have any objection? No. Are county exhibit two accepted into evidence? Mr. Gator Nichols, is that property we've been discussing in Pinellas County? Yes, it is. And did you verify that by looking at the property appraisers booklet? I did. Three pages, but is this a fair and accurate copy of the information that you reviewed for this address and the citation? That is correct. And Lauderdale, Florida, is in Pinellas County? It is. At this point in time, it asked to move this into evidence as county three. The objection is all, though. County three is accepted at the evidence. Mr. Gator Nichols, did you ever make contact with Mr. Rappaport? Yes, I did. The very same day that I was out in the field, I contacted him that morning. Can you tell us about that conversation? So, it was a brief conversation with the phone number and ask him about the work that was being done. I did allege that there was some work being done at the house. I did ask if he pulled any permit. At the time, he did say no. I continued to ask him just some brief questions for my investigation to who was the gentleman that was working. At the time, he did not identify the person, and I informed him that without that, he would be the one that would be cited for the unlicensed contracting. He did say he was going to call me back to get me that information, but I never received a call. It is what he told you, right? Yes. He said he alleged it. I just want to be sure there. Okay. Well, from what the investigator... If we could just wait a second. Are you offering new documents? Yes, I was about this, Joe. I just wanted to give him an opportunity. Oh, okay. Yeah. Take your time and look at that, Mr. Ruff. Depends on the non-existing window. Yeah, I do object of that exact wording, because the nine windows were... She hasn't offered him into evidence yet. Sorry? She's just showing them. He hasn't offered him into evidence yet. Okay? She hasn't shown them to me. I need to see them. Okay. And then I'm going to give you plenty of time to object to it. Thank you. All right. And it's a little small, so if you come over from the investigator, can you describe what we're looking at here? So what we're looking at, the building department received documents and photos from my investigation. They created a violation that shows that a licensed contractor attempted to pull a permit. While they attempt to pull the permit, the building department was waiting for plans. So without that plans, the permit hasn't been issued yet. So what we're looking at is just an application for permit for after-the-fact window installation. Okay. What's that date in the top left-hand corner? I can't see it online. July what? July 26th. And then you already mentioned this investigator, but we can see here after the fact permit. That is correct. And when you went out to the property and you received the complaint, that was in the end of June of 2020. That is correct. There was no permit. No application was pulled at that time. At this point in time, I'd ask to move into evidence as county four. Mr. Rapoport. I will need to study this document. It's hard to see, but if this document is what the investigator Nichols said right now, then no objection. You say you need what time to study it? Well, exactly what it says. So it was after the permit. That I agreed to. Do you object to the document and to evidence? No objection. No objection. Does it mean it's fact? I'm just laying in at that. Okay. I understand. Thank you. Sorry about that. I guess that'll be four, I guess. Peter Nichols, did you at some point investigate whether or not Mr. Rapoport had any licensures? Yes. So part of our investigation in this case, there's times that the homeowner do in fact have a license. So what I did was I used our system, our database, to check to see if he carries any type of C license. I did not see that Mr. Rapoport had a C license. I also checked the database for DBPR, which is the Department of Business and Professional Regulations. There were no licenses listed there for Mr. Rapoport holding any license. Did you prepare an affidavit that reflects the results of your research? I did. Is this a fair and accurate copy of your affidavit? Yes. And we see that you search for licensures from January 2025 to July 24th, 2026. That is correct. At this point in time, I'd ask to move us into Evanesis County 5. My name is incorrect here, but other than that, what license are we talking about specifically? Which license for what? So the license that we are looking for in Pinellas County to install windows, you need to have a carpentry license to install due to the fact that installing windows is structural. That could be a health or safety hazard to the residential home. So the license, in fact, give them the ability for the building department to do an inspection to make sure that is done correctly. And once it's signed off, then anything after that, if there's any discrepancy, then we will hold the license holder. In that case would be a contractor responsible for any damages that needs to be done. At this point in time, I'd ask to move this into evidence to County 6. No objection. County 6 is accepted into evidence. Administrator Nichols, did Mr. Rappaport at any point in time get back to you with the name of the contractor that he told you he was using? So I contact him the next day, and he, in fact, we did talk again, and he has not yet provided me with the name. What he did tell me that he was in the process of hiring a licensed contractor, and that licensed contractor will pull a permit. But no name was given to the gentleman that was actually doing the work on July 29th. No further questions. Mr. Rappaport, is your opportunity to ask the officer any questions concerning his testimony? Cross-examine him. And I'll let you explain your position. This is your right to cross-examine if you want to ask him. Thank you, investigator. Through our phone calls, was I responsive, and did I pick up and speak with you other than the fact that you are correct at that specific day I did not tell you the name of the contractor, and then you are also correct I did not call you to tell you the name of the after-the-fact contractor that pulled the permit. And since then, you know, the permit has been pulled and final inspection has been completed. But was I not cooperative with you, you know, in this case? I have no objection. He was cooperative. I apologize. I might be asking my question. No, no, you're doing fine, Mr. Rappaport. No further questions. Anything else? Kelly Russ. Mr. Rappaport, tell me your position. Tell me any witnesses you want to put on, I presume. I don't know, you know, if you have any witnesses, you have any documents, or, you know, tell me your position. So, first of all, I'd like to thank the county for the religious accommodation about the date for the hearing. But other than that, I'm just a simple guy who is trying to, you know, to make a living. And it all started from, you know, a couple of windows were not that well there, so it started from that. And then, you know, I was thinking about maybe replacing all of them, and I absolutely, you know, it wasn't my intention to break the law. And I had absolutely no idea that the windows are basically, you know, this kind of, you know, building change that requires a permit. I know adding a room, adding a floor, or whatever it is, but, and therefore, and as you can see, you know, I didn't have any prior violations. And Officer Nichols, you know, I'd like, he was very nice, and he was trying to be helpful. Although, I would like to say that I basically, it looks like that I got two violations on basically, I understand from a different, from a different perspective of the law. Maybe those two violations look different, but, but it looks that both violations are basically for the same fact. And since then, when I, when I, when Officer Nichols told me the story that he just presented to the court, I immediately found a contractor, and, and, and as Officer Nichols stated, that after the fact contractor got a permit, and, and corrected any issues, and, and the, and the final, the final inspection from the Pinellas County Engineering Department, I guess, already happened, and it has been, and the project has been approved and closed, from, from what was sent to me, by the contractor, and then later on I've also called the Pinellas County Department and verified that this is correct, and I can present, I can present the number, the number of that, of that completed inspection. So what you're saying to me is, it's all done now. Yes, and I immediately, I immediately started looking for that, and yes, and Officer Nichols is correct, it didn't happen the next day because, you know, I was looking for it, and, and it took me, you know, a few days to find that. So it's all completed now, and, and I just, you know, now I know that anything I do, I, I better call the county first, and, and see, you know, if, if those changes that I want to do, do the required permit. I can, if you'd like, I can put that on the, on the screen here. This is a printout of, of Pinellas County portal. This is what the contractor sent me, and this is the number, and I called, I called the Pinellas County, and they verified that, yes, this is complete, and everything is correct. Plus, also, I, should I remove it now? Let me try to make this easier. Counselor, do, do we, officer, do we know if it's been completed now? Is that the case? Yes, I did check the building department. They, the inspector did sign off on it, I think, in September, and everything is closed out and passed inspection. They agreed, they're not, you want to put it in evidence and let me know, but they're not disagreeing. Okay, great, and plus also, you know, that contractor, from what he told me, was also fined $500, which I paid, of course. So, so I, I basically, you know, in, in general, I, I understand that Officer Nichols didn't, you know, didn't create three citations for that, and that third fine that the contractor paid wasn't from Officer Nichols, but I, basically, I got three, I paid, I paid, I paid one citation already to the contractor from the county, which I. Do you have any proof of that here today, that there's another citation was issued to the contractor? Well, it's not a citation. He said in order to, to submit an after the fact permit, it was $500, if I'm not mistaken. Oh. As a, as a, kind of, I, I mean, I'm, I'm not sure how to call that. So the contractor, it would, paid additional monies because it was an after the fact. Yeah, well, well, in general, he paid, but in fact, I paid, because I had to pay all that, you know. Otherwise, he wouldn't, he wouldn't, he wouldn't do that. Anything else? And, again, that's what he told me. And, and, and also another thing, again, Officer Nichols was very nice and professional, but, but I received the tickets. Again, I felt I received the tickets pretty quickly that I didn't have a, you know, enough time to, to correct the situation before receiving those two tickets that we are, that are, is the subject of our discussion. Anything else? In all your honor. Mm-hmm. Counselor, you want to make any comments? I'd like to hear some comments about the, the. Yeah, I was going to ask for a brief redirect. Yes. Could we do that? Yes. That'd be just fine. Yeah. Investigator Nichols, we just heard some testimony. I just want to clear it up. Did you ever cite a contractor in this case? No. I wasn't aware of the contractor. So no contract, the only citations issue was two citations to the homeowner, which is Mr. Rappaport. And in your professional opinion, do you, do you think it's fair to say that Mr. Rappaport is talking about the permit fee, the application fee, that the contractor paid? So that is correct. So normally when we send the pictures to the building department, they normally have it in as a notice of violation where they, I think, double the fee, and the, the new contractor, who is a licensed contractor, when he applies for the permit, the application he fills out, he has to pay the fees, all the process and everything before the permit is issued. So what he's talking about is that that licensed contractor paid the building fee to get the permit issued. That's where he is, that's what he's talking about. And why do you think they double the fee? So there's times that- You can answer that, Councilor, if you want. I'm just trying to get the bigger picture here, you know. So the building department, at times, what they do is they can double the fee due to the fact that it's a violation on their part. They did the work without applying for the permit, so the building department have the right to double the fee if they choose to do so. Oh, okay. I got it. So in other words, they didn't do it. I understand that, right? Whether you should have paid them, and that's a different issue, right? Right. Anything else, Councilor? No, I'd just point out that this was an after-the-fact permit. The work occurred without a permit. There's nobody else that Investigator Nichols had to cite, so the county thinks that he is in violation of our code. Do you have any questions concerning what the officer just said to him? No, no. I think he – Or any comments you want to make, additional comments. Go ahead. I think the officer just stated in a better English what actually I was saying. You know, I don't think the officer gave another citation to the contractor. It just so happened that at the end of the day that that amount – that extra amount was paid. That extra amount of – rather than getting permission right away, you know, if it's after the fact, then this was, you know, as the contractor told me, usually it's much less and now it's much more because of the fact that it's after the fact. And again, I'd like to emphasize that if, you know, I think officer Nichols's, you know, did a perfect job other than the fact that given me just a little bit more time because I think I received those citations pretty quickly before, you know, rectifying the situation. Because I would have rectified because from one of the time that he called me, I immediately started rectifying the situation. Anything else, counselor? No. I just underscored that there's no provision to cure. Yeah, I'm kind of – anything else, Mr. Rappaport? No, Your Honor. I'm going to consider the public portion. Are there any costs in this matter, you know, put on the record? I'm not sure what the breakdown would be. Okay. Yeah. I believe it – do you have a figure? I don't need to know the figure now. I just wanted to know. I'm sorry. It's $540. It's $240. That's what I thought I'd pay. Sorry? I'm nothing. I was just speaking to the clerk here. Okay, I'm going to consider the public portion of the hearing closed. I'm going to find that there is a violation of Code Section 22-14-1 under citation CT 2600466 and enter a fine in favor of the county of $500. Similarly, I'm going to find there's a violation of 2214-5. This is working without a permit under citation CT 2600465 and enter a fine in favor of the county of $500 in county's awarded costs. Okay. At 240. $240. They'll – this will be mailed to them? Are you going to do it now or – We'll be working on it now. It might take a little bit, so you can either wait for your order or we will mail it to you certified. So it's up to you. Yeah. I'm not sure I understand exactly. She'll explain it to you. Okay. Yeah. You may be counseled. Thank you. Thank you, Mr. Rappaport. Magistrate, so I believe that was the last one for – CD, right? PCCLB. PCCLB, right. Yes. So then we'll take a recess because we're doing joint stipulations for codes. Up on the fourth floor. Yes, sir. Okay. We're good. Yeah, we can go off the record. Okay. Communications, please stop recording. It's okay. So what we're going to do is we're going to either do the order now – If we're doing it now, we'll be 10 to 20 minutes. She's going to look at it and then – We'll order the legal order. She's going to print it. The magistrate found you guilty? I'm not going to do it, no. Yeah. We're going to do – for the motion to foreclose, we'll really read it then. Moving along to the next case – can you hear me? It would be item number eight, code enforcement. You could both raise your right hand, please. Do you swear or affirm that any testimony you give today be the truth, nothing but the truth? I do. I do. Ms. Lawrence, I understand from my clerk that you had an attorney last time this was enlisted. Is that correct? Yes, sir. You've got to speak. You can't just sit here. Don't be nervous. And he said it was okay to sign this stipulation and make disagreement? Yes, sir. He did. Okay. Officer, tell me what kind of agreement we have here. Sure. I have been in contact with the attorney and we have the letter of representation from him and I've got lots of email communication. But basically what it boils down to is they're agreeing that they're in violation of the 22-231 minimum housing and the site plan 138-179 and to come into compliance by December 18th or have a fine of $250 per day. They've also agreed to a finding of fact order for zoning 138-90. They've also agreed to a one-time fine for code 58-244 for this prohibited sewage into the stormwater and right away at $7,500. They've also agreed to a one-time fine for 22-231 for the prohibited discharge of sewage onto the property for $500. And they've also agreed to pay the court costs of $420. So let's see if we have this straight, okay, commit to compliance on the failure to adhere to the site plan as well as the minimum housing and that's a 250 administrative, so suffer an administrative fine of $250 per day. Is that correct? Okay. Yes. And that can be abated on what date? December 18th. Okay, that's what I'm, I'm just checking the dates to make sure. Thank you. So I have counsel here. Just give me a second and I'll finally assess. 30 days of the order, okay, it doesn't have the exact date in here. We just have 30 days of the date of the order? I can leave it that way. They have to pay 30 days from the date of the order, correct. Yes. Okay. I'm fine with that. But one-time fine shall be paid within 30 days. Okay, that's the $7,500 fine. Okay. And, oh, and the $500. Okay, I got it. Is there anything else they're going to pay the $7,500 on the one-time fine on the discharge and the unsanitary condition, the $500 also? Yes, sir. Okay. It's court costs of $420. That's correct. Is that your understanding? Is that your understanding? Yes, sir. Okay. Um, I said one other question. Um, I'm from Howell, New Jersey. You know where that is? No, sir. I'm originally from Kentucky. Oh, it says Lakewood, New Jersey on here. Is that where the corporation is? Yes, sir, it is. It's in the middle of the Pine Barrens and nowhere because that's where I'm from. And that's, I actually know the street that's on. Okay. Uh, that was a curiosity question. The clerk will have an order for you and make sure the attorneys get a copy of the order. Yes, sir. Thank you. Okay. You got it. Thank you. Yeah, I just saw that in there. I'm thinking it's an ongoing payment. Is it like saying something for you? That's all right. Is this item six? I agree. I really want to make it true. This is number one? Item six. Okay. They do not want to do a joint stipulation, so they're going to go in front of you. Yeah, hang on. What I just did was what? You did the one, two, three. Oh, liquid. Okay. Yes, sir. Order sign. Is this number six? Yes, sir. So we're doing the case? Beth Doyron. We're going to do this case? Yes, and they are here. Okay. Ms. Doyron. You can do it. Ready? Good. Item number six, code enforcement matter 22-299 minimum housing, 58-304 for trash and debris, 138-3220 zoning violation. Case number CCM-26-00130. Officer Hughes. Property owner is Beth Doran. Notice address, Beth Doran in care of Mary J. Doran at 1134 91st Avenue North, Seminole, Florida 33772. And the violation address is 7290 55th Avenue North, St. Petersburg, Florida 33709. Officer, you could state your name for the record. Officer Hughes. Beth Ann Doran. Your name, sir? John Henry Pace. Just say that a little louder, sir, because I can't hear you. John Henry Pace, P-A-C-E. What's your relationship to the property? I am a cousin of Beth. Mother Mary Jane is my aunt. And your purpose of being here today is? I came to take the mother to the hospital and dogs to a kennel. I didn't know we were doing this, but I'm here for moral support. I'm just a little bit confused because my mom has always been able to help me with all my stuff. And she's having kidney failure and not doing really well right now. But I was found, this is where I'm confused, for being incompetent to proceed in court. And I don't know if that has anything to do with this or not. So I don't know if I should get an attorney or what I really need to do. And I'm just not sure. I appreciate that, Ms. Doran, but I can't give you legal advice, okay? Okay. Now, if you want to proceed today, I'm going to swear you in. I'm going to proceed with this case. If, you know, you want to request a continuous to get a lawyer, you know, that's a hard detain. But I can't do that? You can make that request. I have that request. I don't know what answer. Is that it? Okay. And when did you get this notice? This is notice. You got to come today. You knew you had to be here today. Oh, yeah. Yes. When did you get it? You're not going to be able to consult with him to help you. Oh, no. He was holding my paperwork. Okay. Fine. I just can't, you know. It was posted on the night. Okay. I'm going to swear you both in. Raise your right hand. Not you, sir. If you could talk into that microphone, Ms. Doran. Yes, sir. Do both of you swear or affirm that any testimony you give today be the truth nothing but the truth? Yes, sir. I do. Please state why you feel you want to get an attorney or why you want to continue it? Because I'm confused about what I'm to do as far as the law goes. I'm not really sure, like, about signing stuff and everything. I just needed some guidance and help. Why didn't you seek an attorney before today? I went to Gulf Coast. Gulf Coast what? Legal Services because they said that they, and I filled out an application. They said they wouldn't have funds until the 19th, which is today. And I didn't go earlier because it was at 8.30 in the morning. I couldn't go to. You couldn't go over there today. Today, yeah. When I went, they said that they didn't have funds. That's okay. Take your time. Relax. We got time here. Go ahead. Until the 19th. Do you have anyone else that can help you? Not today, but is there someone else that can help you, like this gentleman? He's my cousin. I think he would do what he could. Well, I'm coming from Pineagorda, so it's difficult. Sir, I'm going to ask you to step back, okay, because I haven't sworn you. You understand what I mean? You want to talk to them and give you all the opportunity, but you're not going to make a decision here whether to give you a continuance. I don't want to waste the court's time nor your time. I don't want to be fair here. And do you have anyone else that can help you go to the lawyer to understand what I mean or get legal services? And if it's the gentleman behind you, fine, you know. I have Medicaid that takes me places from my disabled insurance money. I can take a cab and stuff to get to the Gulf Coast. Do you understand the nature of these violations here today, what's going on? I don't know what the nature means. Well, do you know why the county's, do you know what Officer Hughes is doing? Yeah. What's the problem with the property? She wants me to get it better and to look better. A lot better probably, right? Yes. Officer Hughes, what's your position on this request for continuance? So, this has been a difficult case for us because we are aware there, or at least we've been continually told that there are challenges. The problem and the reason we're here today is the property is in Beth Doran's name. The address is in care of her mother, but no one has been able to provide us any documentation that she has a legal guardian or that there's anyone that can. She being? Ms. Doran. We have not been provided any documents saying that there's someone else that's the guardian that we should be contacting. Right. She's allowed to, she owns this property. The deed is in her name and she's able, Ms. Doran lives there. There's no one there that's taking care of the property or in charge of the property other than herself. So, we honestly have no other remedy. We, again, in November of 2025, we've been trying to gain compliance. Has it been to court yet? This is the first time. Okay. So, the problem has been that the area officer has been trying to work with her. There's a lot of people and she has had a lot of problems with people living in her backyard. Whether she's allowed them or whether people that she's allowed to be on her property have allowed them. It's just, it's something that's been happening. As a result, there's a large amount of trash and debris. And that's really the main reason we're here. I can see that from the photographs. Yeah. Yes, sir. We've, I've made multiple visits. The area officers has made multiple visits. The deputies have made many visits. We, we're only here because after trying everything we could to get it in compliance is why we're here today. Anything more you want to tell me, Ms. Dorian? Is that, is what everything the officer said true? Um, bits and pieces, yes. I mean, for the most part. Um, I don't think they know what's going on, but, um. No, I don't think they do either. Yeah. But, um, sadly, that's, it's been, um, a not so fun time for myself either. Nobody wants to live like that. And, you know, I have asked for help from them numerous times on getting somebody, um, trespassed. And just like when she was there the other day, um, somebody was there and all he had to say was, oh, I pay rent. And the next thing you know, they can't do nothing with him and he's still there. I can't tell you, give you legal advice whether they have that right or not. Right, I know. And this gentleman, and this gentleman behind you came all the way from Punta Gorda to help you? Well, my mom's, my mom's in kidney failure, so he's really good. Helping, all right, yeah. That's nice of him to do that. Um, anything else, officer? No, sir, I, it's, you know. I understand the situation. Yeah, again, if, if there was anything else I could imagine to do and not be here, I would. I just don't know what else to do. I got it. I sense that. All right, here's what I'm going to do. Um, we're at the end of the road, Ms. Dorian. Do you understand what I mean? So what, we're at the end of the road, right? Mm-hm. And, uh, I'm going to grant your request for continuance, okay? And if we could get a date for that. And when I say the end of the road, the case will be heard, okay? And, uh, I suggest you get some help, okay? I can't tell you where to go. I don't want to get legal help, that's fine. But get some help because it's not going to go away, okay? And so, you, you, the, the, the, the officer would be all, oh, you know, they've tried for a year here until you get here. But this is the end of the road. It's begun. I understand that. You got that? Yes. Okay. Can I have a date? We have, um, November 16th as well as November 20th. I don't know what date you would like. Um, is that on my list? Probably, right? Yes. I believe you, you have it. Um. November 16th is our day for, for, for, uh, code enforcement units. Is that the Monday, Monday? Yes, sir. Yeah, let's see that day. November 16th? Okay. At 8.30? Fine. Or, actually, no, because it's a joint stipulation. So, I mean, not a joint stipulation. So, um, I don't know if you would like to see if she would like to, or whoever's with her would like to do a joint stipulation, or, um, we can do the same thing we did right now. So, I can either put her for 8.30 or 9, or 10.30. That's up to you. I have no idea where we're going to be, so I can't say whether it'll be a joint stipulation or not. We tried today. Okay. Uh, Ms. Doyrat, would you, would you mind coming in at the same time? I don't know if your cousin would be. I don't mind. I'm fine. You're okay with that too, sir? I'm, I'm fine. Yeah. You're listing those at 8.30? Yeah. 8.30. Okay. Yeah, let's, let's do the 8.30. Do the 8.30. Okay. Yeah, that's fine. Now, do you have, um, we'll do an order, are you going to do an order for that? We'll do an order of continuance. Mail that to them. Mail, we'll mail it to you, um, for November 16th, which is a Monday at 8.30 a.m. Do you have my, um, mom's address? Cause that's my mailing address. Let me make sure what address we have. We have now, it's 11134 91st Street Avenue North in Seminole? 91st, just no street, just 91st Avenue. Oh, sorry. I said 91st Avenue. Perfect. That is your address? Um, that's my mailing address. That's your mailing address. Perfect. Okay. Thank you. You're welcome. Ms. Dorian, do you have the officer's phone number and contact information? Yes, Your Honor. Yes, sir, I do. I highly recommend that, uh, if you get some help here, whoever's going to help you to contact the officer before then. Okay. Okay. Most definitely. All right. And, um, you'll be back here on the, I believe that's a Monday, the 16th of November. Yes. Okay. Write that down. Thank you very much. I will write that down. Okay. Thank you, officer. Thank you, sir. Thank you. Thank you. You can wait if you'd like. I can do the order and you guys can wait for it. I don't know if you can wait about 10, 15 minutes. Is that okay? Yeah. I will. You will wait. Yeah. I'd like to see that she gets the order. Okay. Thank you. So take a seat and I'll be right with you guys. Okay? Yeah. That's your next one. What? Number seven. You're going to seven. Yeah. You can call it if you want. Okay. Next item is item number seven, department code enforcement, section 22-299 minimum housing. Case number is CCM-26-00132. Officer Duvall, property owner is Francis R. Chase Estate. The notice address, Francis R. Chase Estate at 6060 138th Avenue North, Clearwater, Florida 33760 with the same address for the violation of 6060 138th Avenue North, Clearwater, Florida 33760. Officer, would you state your name for the record please? Officer Duvall. And your name, sir? James Hanley, H-A-N-L-E-Y. H-A-N-L-E-Y. H-A-N-L-E-Y. What's your connection to this property on 138th Street Avenue North? I'm the son of Francis Chase, but I'm in the middle of where I've got to go to probate to get my name put onto the property because right now her name is on it still. Have you done that yet? No. So there could be Will, maybe there is, maybe there isn't. Yeah, that's what I'm looking for. That's what was taking a lot of this time is because before she had passed away we had something, but I've been looking, you know, but regardless of, I don't know if I should be talking or not, but we had talked with her and I'm, you know, my next step from out here is to get, you know, to get the probate, you know, and the stuff that they want. And your name, sir? If you could speak in. My name is Michael Hanley. I'm also the son of Francis Chase. I want all three of you to raise your right hand. Both of you step up to that. Do you swear a firm that a testimony to give today be the truth and nothing but the truth? I do. I do. I do. Okay, so you haven't started in the estate. So you have no authority to represent the estate. For all I know, there's a will and it's being left to somebody else, right? Do you have any legal connection to this? I'm sorry, it's your mom, but there's been no estate started? No sir. No. When did she pass away? In June 2023. Where do you live, James Hanley? I live at 6060 138th Avenue North. You live at the property? Yeah, I live there. I take care of my girlfriend in Arcadia, you know, but every week or, you know, no more than two weeks, I come every weekend to help out with the property. And you Michael Hanley? Yes, sir. Same question. Where do you live? I live at 6060 138th Avenue. And you haven't done it? Neither one of you have done anything on the estate? We haven't been able to find the will before she had passed. We had an idea of where it was in her closet, but we've been searching and still haven't been able to find it. I know it's there. Were you aware of these violations? Yes. How about your brother? Were you aware of these violations? Yes. We received it about a week ago or so. That's the first you heard about it? Was it a week ago? No, no, no. We've known about it. Well, how about one of you speak? Okay, you tell me. When's the first time you knew there were problems at the property? Oh, it's been a couple times to where we've gotten violations, but we patched up, you know, the things that were wrong with the house, but then because of the different rain issues that we've had, we still got more to do as far as patching up parts of the property. And you, James Hanley? Same question? Um. In other words, you've known about these violations? You've done anything about them? I've been trying, you know, we've been, you know, I mean, it's been rough with the situation that we were put in because of our older brother. Your older brother? Yeah, Rob. Uh, that was the one that I was here with last time. Um, uh, he ended up getting schizophrenia and, you know, a long story. Officer, was this case continued? He said he last time. Do you know anything about that? Uh, magistrate, this came before, uh, special magistrate back in, I believe, 2024. Oh, okay. A couple of years ago. Okay. Yes. Okay. Um, is this the whole case here? Yes, that's what was given. Well, gentlemen, I, you know, I don't see any, your, any legal connection to this property at this point in time. And, uh, you're more than welcome to sit here and let the officer put on her testimony and, and, and listen to it. And, uh, I presume the officer will chat with you after I've made my decision. Okay. Uh, officer, would you do that? Absolutely. Okay. So if you both have a seat. Okay. Thank you. Yes. Officer, uh, if you could raise your right hand. Do you swear for him that he does make it today be the truth, nothing but the truth? I do. Okay. What do I got here? All right, magistrate. Uh, the property where the alleged violation exists is located at 6060 138th Avenue North in Clearwater, which is in unincorporated Pinellas County. The owner of Francis Chase Estate is, uh, not properly represented, uh, for today's hearing. The violation has been in existence since on or before June 3rd of 2026. I'd like to enter the notice of hearing and composite exhibit A into evidence. Exhibit A can, uh, includes the notice of violation and ownership confirmation through Pinellas County tax collector, property appraiser, and the deed. And we also have inspection photos. I think that's what I have in front of me, but. It's not a big packet, um, compared to some of the others. Let me just see if I, I don't want to go too fast. I've got the notice of hearing. Yes. First four pages are the notice of hearing. Yeah, go through it with me, please. Okay. First four pages are the notice of hearing. Right. Uh, sent to the property for today's hearing. And the next is the notice of violation for minimum housing, code section 22299, for the dwelling not being maintained in good repair, uh, to include but not limited to the rotten wood on the exterior structure, dilapidated roof, fascia, and soffit areas. That was sent again in, uh, in June of 2026. God, is it just the one violation? Just the one violation? Just the one violation. Ah, okay. That's what I said. Go ahead. So we do have, um, Pinellas County, uh, a tax collector still, again, showing, uh, the estate listed as ownership. We have property appraiser here, Francis Chase Estate, the warranty deed. At the time it was, uh, for, I believe it was for, yes, Robert and Francis. Both are now deceased. Robert, uh, died before Francis. Got it. And then here are just some photos showing the exterior of the property. This is a double-wide mobile home. Um, we've got one of the backsides is extremely bad and the roof area that is very bad. Uh, a lot of, uh, rotten wood they've been trying to replace as they go. Um, there is still more rotten wood and the bare wood from where they have done some replacement. And then, again, this, this area of the roof is very concerning. It's right over the front door area. So, Magistrate, I did re-inspect the property on October 9th and the violation does continue. Uh, photos were taken on that date and I would like to submit them as composite exhibit B. Okay. I'm going to accept composite exhibit A into evidence and you may proceed with B. Thank you. So, as of that date, October 9th, um, we had, had a little rain in the local area. And, uh, the back side of the property, as you can see on these, uh, two pictures on the left, top and bottom, uh, are showing what was once a repaired area that is now, uh, completely pulled away. The wood is very rotten. I can only assume that, just make an assumption that the roof is causing a lot of that issue where the water is going down, uh, onto the side walls. But, um, and it's, it's in pretty bad shape. And the, the roof, uh, over here by the front door is still, uh, continuing to sag and is, uh, displaying rotten wood as well. So, magistrate, the county request, you find the property in violation and issue an order to have the property brought into compliance. Accept exhibit additional photographs, composite photographs as exhibit B into evidence. Um, anything else? Uh, just my summation. Yeah, please. The county is asking for the allowance of, um, um, was trying to show a little bit of flexibility and give them 60 days to continue to try to repair and initiate some probate, uh, which is much needed at this point. So, 60 days to comply and if still find in violation after that, assign a fine in the amount of $100 per day for the code section 22 to 99. Plus, right? Plus cost, please. Um, I'm going to consider the, um, public portion of the hearing to be over. I'm going to find for the county that the, uh, respondent is in violation of 22. There's 299 minimum housing and impose a fine of $100 a day. That fine can be abated if there's compliance within 60 days, which would be December 18th, 2026 by 5 p.m. And, and I'm awarding, uh, the county costs. Thank you. Thank you, magistrate. I don't have this anymore. I guess I'll put that. I can keep it for you. Yeah. So are we going to item number 3? Um, we'll go to the foreclosure. Okay. Which I think is with the last one. Good. Yeah. Huh? The foreclosure. Thank you. You're welcome. How are you doing? Thank you. Hi. Mm-hmm. Ready? Yeah. I'm good. Moving on to item number 14. Code enforcement. The matter of a motion to initiate foreclosure. Case number CFC dash 26 dash 00005. Officer Hughes. Property owner is Patricia J. Harrington. Notice address, Patricia Harrington at 882 Park Street South, St. Petersburg, Florida 33707. And Patricia Harrington, no one has responded to the call of the list. For the record, the gallery is empty. I have before me Officer. Officer Hughes. Officer Hughes, if you could raise your right hand. Do you swear or affirm that the testimony you give today will be the truth? Nothing but the truth? I do. You may proceed. I have the motion to initiate the foreclosure in the document. So if you want to take me through that. Sure. Okay. Thank you. So, um, so, um, pursuant to Chapter 2, Article 8 of Pinellas County Code and Chapter 162 of the Florida Statute, we are seeking, um, a motion to initiate foreclosure against the following respondent, Ms. Patricia Harrington. The property where we are seeking foreclosure in action is at 882 Park Street, South Pasadena, Florida 33707. It is not a homestead property. It is a non-homestead property in unincorporated Pinellas County. Um, the first document we have is basically the notice of hearing for the motion for today's date. We have the signed motion to initiate foreclosure by the housing official. And then we have the exhibits that, um, are in conjunction with the motion. The first exhibit A is basically Pinellas County property appraiser showing that Ms. Harrington is the owner of record. And it's not homesteaded. It is not homesteaded. It wasn't true 2025, but not now. Yes, sir. In 26. That's correct. Exhibit B is the warranty deed showing her as the owner recorded in 2022. Exhibit C are the notice of violations that were sent to her in April of 2025 for the minimum housing, for the outdoor storage, and for the trash and debris violations. Exhibit D is the notice of hearing for the hearing that was held on November 10th of 2025. And the affidavit of violation and request for hearing that was in conjunction with it for the same violations. And we have the posting notice for that hearing, both on the property and at the courthouse. Exhibit E is the order assessing the administrative fine until compliance is achieved. Exhibit F is the affidavit of compliance for all three violations of minimum housing, trash and debris, and outdoor storage. Exhibit G is the lien that was filed in February of 2026. We do have the condemnation notice for them habitating on the property without legal power, water, and the unsanitary condition due to the hoarding situation. We have Exhibit I, which shows images of the property on August 18th. Basically, you can see all the items, including even inside the vehicle, that are stored on the outside of the property. There's more pictures showing the same. If you notice this satellite image from January 10th of 2026, this property right here is the property we're discussing, and you can see the amount stored in the front, back, and along the side. There was a joint stipulation for this at one point, right? Didn't they stipulate to come into compliance? Oh, for the initial order? Yes, sir. They were here. They were here. No, I know they're not here today. Yes, sir. Okay. Go ahead. Exhibit J is basically the, oh, so let me state that the property did catch on fire. Fortunately, everyone got out safe except for their dog, unfortunately. But they were able to exit the property. The reason I added this exhibit is it just coincides with what we had said, that a full 360 unable to be complete due to the home having a large amount of clutter on the exterior of the house. There was limited access due to more clutter being kept indoors and other debris that was also fully involved with the fire. The conditions of unkempt clutter was also needed inside making advancement through the house too difficult. The condition of the house is both interior and exterior limiting access for the firemen. They were not able to safely enter the house due to the hoarding conditions. So these are just the fire reports that were added. No, no, no. And then lastly, I did go to the property afterward. So on September 29th, you can see that there's still a large amount of debris. You can see the damage from the fire. That was September 29th? Yes, sir. September 29th of 2026. And again, you can just see the amount of debris that's still there and the damage from the fire. I have, the only good news to this is I have spoken with the property owner. She is actively working to sell the property. I have actually spoken with the realtor and I did explain that today was a motion that we would be filing and they supposedly they are, they do have papers hoping to sell the property this week or next week. We did want to continue with the foreclosure motion and I did explain that to, to their realtor and to her, but that we would hold on to it for 30 days as we normally do anyway to see if the sale actually moves forward and the new owners bring the property into compliance. Okay, just for the record, when you say I want to continue with it, you mean proceed with it? Yes, proceed with the foreclosure motion. That's a big different meaning to me. Yes, sir. I apologize. I would like to continue with the foreclosure motion. Okay, so you're still seeking the order, right? Yes, sir. All right. So. Give me a second here. Anything else? Basically, just to summarize, the property is still owned by the respondent. It is still a non-homestead property. The petitioner has interest in the property by virtue of Pinellas County code enforcement liens in the amount of over $20,000. The lien is accruing daily fines in addition to interest. The petitioner has provided respondent with notice that the property was found to be in violation of the county's ordinance and I have kept in a lot of contact with her. The petitioner provided respondent with notice that the property remained in violation of the county's ordinances after the respondent was afforded due process and given a period to cure or remedy the violations of the county's ordinances at the property. The respondent had actual or implied knowledge of the process and procedure employed by the petitioner, its code enforcement division and special magistrate for imposition of the code enforcement lien. So, magistrate, in summary, based on the evidence provided in the motion, the county requests that you issue an order granting Pinellas County the ability to initiate foreclosure. Anybody else? No, sir. That concludes my testimony. Review the documents, listen to the testimony, and I'm granting the county's request rental an order initiating the foreclosure on the property. Thank you, magistrate. Thank you. The officer is going to be requesting it to continue. Yeah, man. Yeah. Thanks, you're getting out of that. Yeah, you can call this one. Go ahead, sir. 12? Yes. Be ready. Next item is number 12, Code Enforcement 22-319I, Minimum Housing Short-Term Rentals, and 138-90 Zoning. Case number CCM-26-00136. Officer Stevens, owner is Truckee, Truckee Properties, LLC. Notice address is Truckee Properties, LLC. W2009, Finnegan's Ridge Lane, and Freedom, I believe that's Wisconsin, 54130. Violation address is 8262, 132nd Street North in Seminole, Florida, 33776. Let the record reflect. No one responded for the respondent, and the gallery is empty. Officer, state your name for the record. Officer Stevens. I understand you want to request a continuance. Am I getting that right? That is correct, magistrate. And have you spoken with them or whatever? Yes, I spoke with a representative that was with the management team. He was not a legal representative for the company, and I just wanted to let you know that they were in compliance with the 138, or I'm sorry, the 22-319I. The only thing we're waiting on is the approval of the zoning clearance, which should be done within 30 days. Okay. November 16th, 2026 at 830 work for you? That would be fine. Okay. Carolyn, can we continue to that date? Yes. Perfect. Go ahead and order then. You'll get the officer in order or whatever. Do that today or whatever. She'll tell you what. Thank you, magistrate. You're welcome, sir. I'm sorry? We can go in order now. Okay. Sounds good. I think I'm up. So we can go to the lien reduction now? Okay. Are we up to now? Are we ready? Which one are we up to? Number three. There we go. Reduction. Item number three, code enforcement. The matter at hand is lien reduction. Case number CCM-25-00019. Owner is Daniel D. Driscoll, Jr. Trustee, 3043 58th Avenue North Land Trust. Notice address is Joseph Chavez at 4900 48th Avenue North, St. Petersburg, Florida 33709. We have Carolyn Gonzalez here, and how can we help you? So, um, Carolyn Gonzalez is a special magistrate liaison with code enforcement. Mr. Joseph Gonzalez, uh, Joseph Chavez was the applicant, and he did not show today. Um, we do send an email if they requested via email, deliveryjoe at AOL.com. I sent an email on October 8th, 2026 at 1803 to deliveryjoe at AOL.com. It was sent through our, uh, Acela information database, and with the lien reduction application letter. It does date. Oh, there we go. In the letter. I haven't seen any of this, you know, the first time I've seen it. Yeah. Um, this is just a general letter that we sent out, letting them know that they are. Oh, October 19th. Okay. Yep. October 19th at 830, and then it does if, you know, please be aware with prior notification to our office, you will be allowed one continuous to the next available hearing date. I did not receive any notification, no email, no phone call. Um, so if you are a no call, no show on the initial date, your lien reduction application will be denied. So I'm requesting a denial of this lien reduction application because I haven't received any information, and they were summoned to come here today. Okay. Um, is this how we're doing them now? On the lien reductions? Yes. Is this a new process to me? Okay. Yes. They would come in and they would actually fill out the joint stipulation. Got it. And everything. You didn't mention that to me. Yeah. Okay. Um. This is the first one that hasn't come over and hasn't requested a continuance for another date. The, um, just to be, make sure we get this right, not to be picky, but on the notice here on the agenda, the owner is Daniel D. Driscoll, Jr., CRE, but then it goes on, 304358th Avenue North Land Trust. I suspect that's not the address, right? Correct. We have, um. I mean, did they get it? In other words. Yes. Is that the right address? Is that the right address? Yes. Mr. Chavez, so he is the applicant. Oh, there you go. There you go. So it's Joseph Chavez for the current owner. And then we have documentation. Before this even goes through to anything, I make sure that they are legally represented. They are able to do it, and I have a. No, it says land trust here. I find that to be hard to be a street address. 304358th Avenue Land Trust. Do you see that? Yes. I don't even see that in your paperwork here. I think that's. I do have, because that's the original owner, but this gentleman has a power of attorney. Oh, that's an owner. Okay. All right. Yes. As long as you're getting it right. But no, right on your cover sheet, you know, I'm fine with it. Yeah. The power of attorney, and then Joseph Chavez and 6K Holdings Group. Oh, okay. And it's from Daniel Driscoll, and it's been notarized as well. Got it. Okay. Super. All right. So we're dismissing it, I guess? I'm requesting it denied. Application denied, right? Yeah. Yes. Can I sign an order? Thank you. Let me make it more difficult. I just want to make sure we're doing it. I'm going to do it. I'm all set. Thank you. Could have done it right. Four or seven? Yes. Ready? Caroline, we can go to four. I'm sorry. Yes. Yes. We can go in order. Okay. Next item is number four. Matter at hand is 22-299 minimum housing, 58-304 trash and debris, 138-3703 zoning. Case number CCM-26-00126. Code officer is Hughes. Owner is REO-2025-NR1 LLC. Notice address is 2-REO-2025-NR1 LLC in care of Select Portfolio Servicing, Inc. at 3815 Southwest Temple, Salt Lake City, Utah, 84115. The violation address is 5331, 80th Street North, St. Petersburg, Florida, 33709. Let the record reflect that no one has responded to the call list and the gallery is empty. Do I have a copy of this or do you just use who's going to go through it? I'm sorry. Yes, you should have a copy of it. It's okay. This makes it quicker if I haven't tried it. Correct? Yes. Sorry. State your name for the record, officer. Officer Hughes. Raise your right hand. Do you swear or affirm that the testimony we get today be the truth, nothing but the truth? I do. The package here. Can you just briefly go through it? Sure. So, basically, we've sent the notice of hearing for today's date. They've got the notices of violation for the minimum housing, the trash and debris, and the fence and disrepair. What's fence? Okay. Of course, all the Nels County tax appraiser and tax collector documents, the certificate of title, the SunBiz information, and images of the property. So, basically, the violation photos were originally taken by me on September 15th. The property was in very poor condition and has been for a long time, actually. We had hopes when this property sold that they would bring it into compliance, and unfortunately, it hasn't changed. It's gotten worse. So, we have broken windows. We have windows that were just basically had either metal or boards put over boarded windows here. We have just trash and debris throughout the property. There is an individual living there who is continually bringing out trash but has no trash service and is living there without power and water. A squatter, probably? I believe he used to have a relationship with that property and just never left, and the new owners have done nothing to bring it into compliance. No, go ahead. I was more curious than why not. Yeah. So, I guess, technically, it would be a squatter. And then the, just more trash and debris, it's just everywhere you look on this property. The fence, right? There's a fence. And then the fence, yes. So, they either use materials that aren't a fence to try to make a fence, as you can see here, here. You've got the gate that's basically, and the fence along the outside of the house is basically falling over and using blinds to create a fence. Got it. Uh, so, Magistrate, um, would you please accept, accept Exhibit A into, um. Yes, sir. So, deposit Exhibit A and, well, documents are accepted into evidence. You could proceed with B if you have some other newer photos. Yes, sir. All right. So, the property was re-inspected on October 9th of 2026, and I would like to submit those documents as composite Exhibit B. Please. Got it. I got it. No, and I mean, I just, when you put them there, and it's, Gotcha. I can see, and it's pretty clear. Yes. So, basically, there's no change whatsoever to the property. Um, there's still trash and debris everywhere. There's still the boarded windows, broken windows, um, just a lot of filth everywhere. And there's still smoke in there, as you can see, right? What's that? By your left thumb there. You're still smoke in there. See, right in front of you? Yeah. Oh, yeah. I was just wondering, of all the pictures to take. I was like, um, and I had that there because of the fence, but yes. It makes me a little nervous. It looks like a firetrap right there, you know? Yes. Yeah. This place is a definitely a firetrap. No, I got it. I just wondered. All the pictures to take. Go ahead. So, Magistrate, the county is asking for the allowance of 30 days to comply and if still found in violation, to assign a daily fine amount of $250 per day, per code section of 22299, 58-304, and 138-3703, an award cart cost in the amount of $420. I accept Exhibit B into evidence. Anything else? No, sir. That concludes my testimony. I'm going to consider the public portion of the hearing over. I'm going to find for the county. I'm going to find there's been a violation of 22-299, 58-304, that's the trash and debris, and 138-3703, the fence, the zoning code violation. Opposed a fine of $250 for each of the three violations. That fine can be abated if there's compliance within 30 days, which I believe is November 18th. Let's just make it for 30 days. Yes, November 18th. Okay, by 5 o'clock, the awarding of the county costs of $420. Thank you, Magistrate. Very good. We have, like, a five-minute recess. I need to explain something to you. Yeah, about that. Yeah. Communications, please stop recording. Okay. Back to item number 10, Code Enforcement, Minimum Housing, Short-Term Rentals, 22-319G, 22-319I2, 22-319I3. Case number CCM-26-00134. Officer Duvall. Owner is Daniel J. LaMera. Notice address, Daniel J. LaMera, 12, excuse me, 1512 Foxboro Drive, Palm Harbor, Florida, 34683. Violation address, 1512 Foxboro Drive, Palm Harbor, Florida, 34684. Here. Just check. Hang on. Let the record reflect that no one responded to the call of the list and the gallery is empty. Officer, if you could identify yourself with the record, please. Officer Duvall. Raise your right hand, please. Do you swear, affirm, that any testimony we give today would be the truth, nothing but the truth? I do. We've received a couple of emails regarding this matter to the clerk, Carolyn. Could you tell me what your understanding is about any last-minute requests regarding continuance or otherwise? So the request, the way I understood it, was to withdraw or dismiss the case. So I explained to the respondent to come to the hearing and request their withdrawal or continuance for the case at the hearing. It was part of an ADA request, but the ADA request was to continue or withdraw the case. There was no mention of any type of accommodation for it. It's my understanding that you sent an email on Thursday, October 15th to the owner of the property and offering accommodations as well as could have done this by Zoom or otherwise. Otherwise? Yes, Magistrate. Okay. We'll just keep these with the file, these documents, and Officer, you may proceed. All right. Thank you, Magistrate. This property where the alleged violation exists is located at 1512 Foxboro Drive in Palm Harbor, which is unincorporated Pinellas County. The owner, Daniel Lamara, is not present for today's hearing. The violation has been in occurrence since on or before May 26th of 2026. I'd like to enter into evidence the notice of hearing and composite Exhibit A. Exhibit A includes notices of violation, ownership confirmation through Pinellas County tax collector, property appraiser, and the deed. And I also have the advertisements showing it as a short-term rental is also printed up included in the evidence packet for Exhibit A. So happy to go through it page by page if you'd like. I'm just going to go through it quickly. Just, yeah, just go through it quickly. Okay. First three, four pages are the notice of hearing set to Daniel Lamara at the property of record. Violation notice back from May of 26th. We have property appraiser. This gentleman does have a protected address, so it reflects here on property appraiser as a bunch of asterisks. We were able to locate the property that he does use as his homestead property, which is also 1512 Foxboro. That's the mailing address. Okay. Notices were mailed to that address. It's the warranty V for the time of purchase in 2023. We have several warning notices that were sent to this property owner from our vendor that we use, Host Compliance, which monitors the short-term rentals for Pinellas County. Right. These were back from 2025 when the program was getting, was up and running, and we were notifying all people that were identified as short-term rentals that they needed to get themselves registered, and there were time limits and deadlines and so on. This is from Airbnb. Actually, this is from Host Compliance showing that this property is not compliant through the listing that they identified as Airbnb. We have a minimum night stay as three nights. Could you help me with Host Compliance? Host Compliance is the third-party vendor that the county has hired. I heard that last time. I was just trying to remember. Yes, to monitor and they monitor all of our short-term rentals. Basically, they're receiving complaints when citizens will call about a short-term rental. There is a hotline that they maintain for us. They do our mailings for us for warning letters. They continue to look at all of the advertising platforms, everything from Airbnb, Booking.com, BRBO, all of them, to determine if a property is compliant by then registering with the county and obtaining their short-term rental certificate. Okay, so when I look at this page here, okay, in other words, this is, I could see that it's 1512 Foxborough Drive, and this is by one of your vendors, but the only one, the way I know it's been advertised somewhere is because. I'm going to continue on with my next showing. Oh, I was just saying it's usually never highlighted there. Right, and that's exactly what I'm going to do. Oh, okay. This is just from them. Just from them. This is just a good overview showing this is what they're looking at the property to be in violation of. They're non-compliant. They have not obtained their certificate as of yet. Right. Maximum sleeping capacity, that is a compliant thing because it's less than 10. Right. Minimum night stay, it says 3. What they do is they give us a documented activity timeline showing what has gone on at this property. And I've highlighted here on my copy, these are documented stays. All of these stays were back from 2025. These are all documented stays at the property. At the property, correct. That were booked through and advertised through Airbnb. Correct. We're still going to get to that. Go ahead. Correct, we're still looking at Airbnb specifically, and this is the platform. I guess that's where I'm going. You said we're now looking at Airbnb specifically, and so far the only way I know is from some. No, no, no, not yet. We're still looking at what the host compliance is providing us to show that they're non-compliant. Got it. These are all of the documented stays that host compliance found for this property. Got it. Okay. So this was all in 2025. Right. So there was no certificate applied for or obtained. Right. We had all the warning notices go out to them telling them they needed to get a certificate, and we also had now the documented stays showing that there was activity at this property. So then this is from Airbnb directly. Okay. All right. So this just continues to show that. So you show me the court in both ways, both ways. Correct. I'm showing you what host compliance is telling us that brought us here, that shows them as non-compliant, and Airbnb reinforces that back in 2025 this is what was going on with this property. Okay. So now this first page I know is Airbnb. How? Airbnb, it doesn't show this on my printout, but this is, when I clicked on that URL site right there from that other page, this is. I know. That's where I'm going to with this entire comment. I had this issue last night. I think it was cut off at the top. Yeah. Well, that's what I thought. It's always under the. They only advertise through Airbnb this particular property. And I know that it's under the paper clip all the time and I can never find it. Right. It is. Yeah. This is, I mean, I can bring it up right now. No, I know it looks like Airbnb in terms of the style and everything. I don't need you to bring it up. I'm good. So this is, as you can see, is hosted by Dan, Daniel Lamar. Right. He's been doing it for seven years and he's had a fair amount of activity on this property. So what he has done, if we, so this, this here shows he's stocked home, open to entertain. You get lots of good details about this property shown right here. We have here that you can see that he has certain dates and maybe it's difficult to see on this. I can see it. But you can see where they're ticked off, where he's got reservations or bookings that he's reserved things. And this is all, it's all showing that he's functioning in as a short-term rental. Right. So, and then lots of good reviews. So people are enjoying staying at this property. So as I review this now, Magistrate, recent reviews show that this gentleman, because he's been claiming he's only renting this particular property as once a year is what he's had so far. Once in 2026. He is staying, he is now stating this is a long-term rental with minimum short-term stays. According to the county ordinance, a property owner can rent up to three short-term stays without obtaining a certificate. So when I go back and I look at what post-compliance is showing me, he has only rented this property one time in 2026. And he has gone in and now talked about the space specifically saying that this is a long-term rental. So he has changed it to long-term. Right. And he has only rented once in 2026. So, what I would like to do, what the county is asking, is for a finding effect on this property. Showing he was in violation in 2025. He never obtained his certificate and he was actively renting. But he is now in compliance because he has changed it to long-term and he's only rented one time so far this year. Okay. So that does make him compliant. Okay, remind me of that when we get to the end. All right? Okay. So, remind me of that when we get to the end. Are we not to the end? I'm just about there. No, we got two cases. I want to get it straight in. Okay. And plus, going forward, I want to recognize, you see, you deal with them all day long. You know what I mean? You come to me with something new and I got to like do it like this. I have to see it more than once, you know? No, I understand. But, so in this particular case, so my re-inspection, my desk re-inspection on Friday, was that 9-14? On 9-14, I believe it was. I did reveal, this is where I did find that he had inserted that he, because he said he was only renting long-term, but I said, well, your advertisement needs to reflect that. And that's when I did pull up, so I guess this would be my exhibit B, showing that the property is now listed as a long-term rental. And I believe I can go back to what host compliance from the original review from them shows one documented stay so far in January of 2026. So, he's, in my eyes, he's good. Got it. Yeah, I understand. So, Magistrate, the county, again, is asking for a finding of fact. It's going to be for Code Sections 22319G, for not obtaining a certificate, and also for 22319I, for the advertisement. All right, hang on one second here. It's the short-term rental units advertisement requirement. Right, because his advertising is compliant, showing he's advertising, specifically showing limited short-term. So, that's I-1? Yes, sir. Is it I-2? It's going to be I-2 and I-3. Okay. It says L-2 and L-3 on my agenda. That's why I'm trying to make sure. Oh, I'm sorry. That's I, no. No, I think that's you. We should use different letters when they made the code. Okay, that's, go ahead. I got it. Okay. So, we're asking for the finding of fact for those code sections. All three of them, right? Yes, sir. And then also allowing the court costs of $420. That is all from the county. Okay. To accept all of those documents with the evidence, not that I really need them, but why don't we put them as a package call and see one, I mean, yeah, county one. You have the, you have the evidence package? Yeah, the evidence package. I can use this. Yeah, I can use this one. I'm good with it. Okay. The only other one that I was going to, where did it go? Was for the, just showing that it's now advertising as long-term. Is that one extra page? Just this one page. Yeah, if you want, you can just give that to me. We'll consider that to see one. Thank you. Caroline, I'm going to add that to this package. Okay. Okay. I'm going to find for the county on 22-3-19-G. After a finding of fact in favor of the county, similarly with section 22-3-19-I-2 and 22-3-19-I-3, and findings of fact that the respondent was in violation, and award the county $420 in cost. Correct? Okay. Thank you, Minister. Thank you. Appreciate helping me here, getting that done. All right. Now I want to get it right going forward, but then I could do it faster, you know. We're going to do number nine now? Yes. Item nine, department code enforcement, minimum housing, short-term rentals. Code section 22-319-G, 22-319-I. Case number CCM-26-00133. Officer Duvall, owner, Daniel J. LaMera. Notice address, Daniel J. LaMera, 1512 Foxboro Drive, Palm Harbor, Florida, 34683. Violation address, 2618 Sunnyside Circle, Palm Harbor, Florida, 34684. That directly reflect that no one answered the call of the list and the gallery's empty. So I'd like to point out that this is the same individual that owned the previous case, which was agenda item 10. And I'd like to address the same issue we were discussing the other one about. So I'll call on the clerk here. Carolyn, it's my understanding that both this case and the previous case, there was some communication. Yes. If you could just state what you stated on the previous case in terms of their request for this last minute. So there was a request via email last week. I believe it was October 14th requesting an ADA request to withdraw the case and to continue it. I stated that since it was last minute in the sense of the week prior, we said to come to the hearing today and do your request at the hearing. Sorry? That's it. Yeah. And for the record, you know, we've offered to make accommodations. We would have done a... That's correct. I offered to make... Zoom or team meeting or whatever. Yes. I offered accommodations and I didn't get any requests for that. So you may proceed. If you state your name, let me just wear you in for this case. Sure. Officer Deval, Pinellas County Code. Do you swear or affirm that any testimony you give today be the truth? Nothing but truth? I do. You may proceed. Thank you, Magistrate. The next property owned by Daniel Lamara is where the alleged violation exists is located at 2618 Sunnyside Circle in Palm Harbor, Florida, which is in unincorporated Pinellas County. Mr. Lamara is not present for today's hearing. This violation has been in occurrence since on or before September 21st of 2026. I'd like to enter the notice of hearing and composite Exhibit A into evidence. Exhibit A includes the notice of violation, ownership confirmation through Pinellas County tax collector, property appraiser, and the deed. And we also have or I've also included the rental advertisements through VRBO. I've got the package here. Okay. Would you like me to go right to the advertisements or just go ahead and review these quickly for the record? I think in light of the fact we just did it before, you can go right to the advertisements. Okay. We've got the notice of hearing here and we have the violations. Right. Notice of hearing, NOV here, and all of the ownership confirmation that Mr. Lamara. Again, he's using a protected address on this, but we have been able to figure out that his mailing address is the 1512 Foxboro. Understood. All right. So this is the, through our host compliance, this is what they have given us showing that the property owner is non-compliant. We have an active listing. It is through Airbnb, which I will show their listing as soon as I show what host compliance is pulled for us. We have minimum nights of four nights showing, again, that this is a short-term rental. All right. Airbnb. I see it there. All good. I see the documented stays in this property. And then very similar to the other property. Matter of fact, I almost thought that I had a duplication because the pools are so similar, but they are slightly different. And this is from Airbnb as well. All right. Showing, again, hosted by Mr. Dan. Everyone that has stayed there has been very happy with the accommodations. Again, his little, little show more here with the well-stocked home and all of the good beach vibes and so on that exist at this property. Yeah. Different bedroom furniture though. I see. Yeah. I have a small snippet of how you can see he's got some- I can see the dashes through the dates through there. The dashes through there. The dashes through there. On my copy. And then just some positive reviews for this property. Right. So, Magistrate, I did a desk review, basically a desk inspection by going back into the Airbnb site. I did that on the 14th of October. And I do also want to add that I did have a conversation with Mr. Lamara, a very long conversation, over an hour, talking to him about his properties. How long ago? That was, again, that was on the 15th. 15th. That was on the 15th. Just like Wednesday or last week. Okay. Yes. And explained to him that exactly what I was going to do, that Foxboro I was considering as complied and doing a finding of fact, going for, asking for court costs. But this particular property, I told him, I said, Mr. Lamara, you are still showing, you're trying to tell me you're a long-term rental, but you are still showing short stays. I'm looking at October, November, and December for the remainder of the year. Mm-hmm. And I am seeing several short stays. Again, just reinforcing that the county is allowing three short-term stays for a property owner during the course of a year. Understood. As long as it's three or less, they are not requiring them to get a certificate. And that's what he's saying he's doing. But I said, I have evidence to show, through looking at your bookings, that you have five short-term bookings right now on the record, and I'm looking at it right now. Does that go calendar year, or does it go from when you get your certificate abuse year? It goes calendar year. Calendar year. Yes. Okay. So that's why the other one I said was complied, because he had only had one booking all year long, and that was back earlier in the year. So my Exhibit A shows that he is in violation. I'd like to see if you will accept that into evidence before I continue with my B. I will accept Exhibit A into evidence. Yes. Okay. So again, just to reiterate that on the 14th, I did a desk investigation and found and discussed this with him. This is how the bookings look right now. I'd like to enter them in as B. May I? Yes, please. So right now, during the month of October, it looks like he has a bit of a longer stay here, a few weeks. He's got these all ticked off as reserved. Right. And then in November, he's got the first week of November, and then he's got the week of Thanksgiving. So it's three stays in these two months. That's three stays, correct. And then in the month of December, he has? Three more. Three more. So, well, it's actually one, two, yes, sir, three more. Sorry, I thought it was two. It is three more. So I explained that to him. I said, I'm going to go and I'm going to ask for 30 days for the magistrate to find you in violation due to the evidence that I'm seeing. And if you'll happen to notice here at the very bottom of that, I did a screenshot and I grabbed the date and time, this is at one o'clock on the 14th, that I took this. 14th of October. Okay. Yes, sir. So, and then I spoke with him the next day. And I said, I'm looking at this and I'm telling you. And then I even brought it up on that day when we were talking and it was no different. So that's when I screen captured these. What did you tell him you were going to do? I said I was going to ask to find your property in violation and give you 30 days to modify your reservations. You still are allowed two more reservations over on your other property because you've only had one all year. The other property. The Foxboro property. The Foxboro property. Go ahead. I said if you manipulate your reservations a little bit, maybe tell your people that you have another property that's available. I said that could be an easy way for you. Oh, you're giving him an out. You're giving him an out. I'm giving him an out. That's why you give him 30 days because this is done in the past. I got it. Interesting. Interesting one. So I'm giving him 30 days to try to make this correct. Do you suffer a fine of $500 per day for the violation of still acting as a short-term rental without a certificate? So that would be 22319G, G1, no certificate. And 22319I is advertising. Which she's actually doing, right? Which she's actually doing. And then we're also asking for court costs at 420. Understood. I'm going to accept your exhibit with the... That would be. That would be. Yes. Okay. Here. See that Kyle and I would be here. I'll put it with this. Anything else? No magistrate.
