all right good afternoon everyone to the uh october 5th neighborhoods community services public health and safety committee meeting we'll start out with introductions and uh with mr delaney please good afternoon y'all phil delaney mayor's office brandon russell council research mary stefablos office of general counsel mother reber council auditor's office philip peterson council auditor good afternoon mona holder at large group one good afternoon matt carlucci at large group four thank you good afternoon tyrona clark murray district nine good afternoon chris miller at large group five hey everybody kevin carico district four ron salem group two at large good afternoon jimmy palusa district seven randy white district oil just visiting thank you um do we have any public comment cards all right plan to start with public comment and then we're going to move uh two bills uh up but before we do that we'll then have after public comment jta presentation and then jta bill number 31 page 19 and then jso number 14 page 10 so that'll be the order at the front of the meeting and then we'll then go through the normal agenda uh so we have four public comment cards carnell oliver jim emory who does not wish to speak but questions only um to to then we have eric adler and uh also keith brown so uh mr oliver um please state your name and address for the record and the time is yours uh yes my name is carnell oliver and my address is on file uh dealing with uh zero seven eighty i just want to say this is the heightened level of accountability that i have never seen in my life dealing with consolidated government it's like every piece on the board is falling and right now we're we're seeing another piece coming before this council asking for taxpayer dollars and for me i want to save this institution because it provides me services it provides services to everybody still in the predominantly real black american communities but if we're going to give them money there's got to be a greater level of accountability for those dollars the employees that are on the verge of being fired i want to see if they can work with our florida delegation and members of congress to pass a clarified 1866 civil rights at you want to know why i'm raising that awareness it's because there are more black people losing their jobs left and right and the only protections that i have i have to bring in the white americans that were here with me and with my ancestors that in the very beginning and the only way that we're going to be able to fight this foolishness is that we got to have the same protections as the native americans that's one of my key points and i've submitted that information to this committee also right along with the select committee my second point is this i want to see what y'all can work out as a condition where the mayor's three seats of appointments to the jta board are elected by the people that's another piece of the negotiation too much consolidated power in the city has not gone check everything is on fire jso is on catching hell you got jea caught hell jta is catching hell who else is going to catch it the problems are building up because we never address consolidation and we're at a point now that we don't have no other choice it's either we address these problems now or we allow them to continue build up now year long my time thank you mr oliver next is eric adler good afternoon everybody my name is eric adler my address is on file i'm the owner of the raven a 13 key boutique hotel in downtown jacksonville specifically the la villa neighborhood when i bought the raven in 2021 the building had been vacant for a number of years and was not living up to its full use spent the next next several years restoring it and ultimately reopened it as a an apart hotel in la villa we were one of the first properties if not the first to start with the resurgence of that area we made that investment because we believe in downtown jacksonville and specifically in the future of la villa and the surrounding neighborhoods however for jacksonville to really thrive and have its downtown thrive it needs to have the basic amenities that people expect in a neighborhood a full service grocery and pharmacy is pretty close to the top of that list i see this from two perspectives first as a business owner we have guests coming into downtown every week having a publics within walking distance makes downtown more attractive and more convenient for those visitors more importantly though it matters to the people who actually live and work downtown like me i live in springfield and i've uh i would love to have a publics within a five minute drive of me if we want thousands more people living downtown we need the infrastructure that makes everyday life possible places to buy groceries pick up a prescription grab a pub sub for dinner and take care of the normal things people shouldn't have to get in a car and leave downtown to do projects like pearl square create confidence for small investors like me when someone's deciding whether to restore an old building open a restaurant or start another small business downtown seeing major private investment happening around them makes it much easier to make that decision the raven my property is one small piece of downtown's redevelopment this project is obviously a much bigger one but we're part of the same effort putting buildings downtown back in a productive use bringing folks downtown to live shop eat and play and creating a neighborhood where people actually want to spend their time right now downtown jacksonville is not that neighborhood i live in springfield i've been there on and off for 20 years we're not there yet we need your support to make it happen thank you so much and have a great afternoon thank you we'll go next to keith brown mr brown your name and address first please my name is keith brown address is on file thank you um i feel like our city needs a lot more done especially in our downtown areas we have everywhere you look we have abandoned buildings uh infrastructures or i mean everything everything is terrible we have homeless people on every street and um the government isn't doing anything about it we we need help and nobody's helping us i'm so nervous i'm sorry it's okay take your time it's all right all right yeah hold the hold the time there for a second for me please thanks i'm so sorry you're all right take your time all right you ready yes sir i'm sorry all right no you're good you're good don't worry don't worry about a thing nothing to worry about all right all right let's go all right again my name is keith brown address is on file our downtown area needs help we have abandoned buildings everywhere we go uh infrastructures are terrible uh homeless people on every street and and our our government isn't doing anything about it how can we get help if the government doesn't help us the people in jacksonville i mean we're struggling uh downtown we we need more shopping centers and more things for tourist attractions but the only thing that we're we're constantly building is uh housing that people can't afford how do we expect people to come i mean come to jacksonville how do we expect people to live in jacksonville if all we if all we're building is uh apartments that nobody can afford um one bedroom go for i mean a fifteen hundred dollars well it wasn't like that um i spoke to a sheriff's officer he said that he's struggling he has four kids and he said he works 40 50 hours plus an extra 70 he's still struggling and and only thing we're doing is is building more apartments and housing and people can't even afford them every single day our homeless our homeless population it grows because we're we're knocking down trees and wood line just to build more houses and more apartment that our our people can't afford we we need help that's it thank you thanks for coming appreciate it and the last card as i mentioned early earlier is jim emery um questions only and that was for or that is for the volunteer life-saving core bill when it comes up okay well we'll now go to uh the jta presentation mr ferguson and and his team uh thank you mr chairman good afternoon sir cleveland ferguson jta just before randall our cfo comes up we just want to uh acknowledge uh the partnership with the administration and the city council uh in uh taking a look at what our board uh authorized in terms of us having this conversation uh related to the local option gas tax two uh we've been collecting those funds uh since uh 2021 uh and this would give us an opportunity uh as we go into fy 27 to get as close uh to zero that is to that 139.2 million uh budget uh start as we move forward and so like to introduce randall barnes our cfo who will take you through uh the points that the council president articulated uh earlier uh with respect to our financial update randall thank you good afternoon randall barnes chief financial officer for jta uh through the chair to the committee thank you for having us here to go over uh the financial condition of jta i thought i would give a quick overview of fiscal year 26 and what happened uh also the budget for fiscal year 27 and then a little discussion about the uh the bill the jta board approved its fiscal year 26 budget back in may 2025 the fiscal year ended uh 2025 showed sales tax revenues were 8.3 million under budget continuing the trend from the prior year with a total shortfall of 19 million even with a smaller budget first quarter of fiscal year 26 showed a continued softening of sales tax revenues and additionally continued to have cost pressures connection plus costs were not budgeted due to expected service cuts and costs for navi and skyway were also higher than expected so all of that led the jta staff recommend amending the fiscal year 26 budget in february to address the revenue shortfall so this slide gives you an overview of the fiscal year 26 budget amendment that was done in february the drivers were lower expectations for sales tax receipts interest earnings and passenger fares and what was cut to uh to balance that budget was operating expense cuts focused on staffing costs and services so there were reductions in force planned employee furloughs and professional services contracts that were cut unfortunately in in hindsight the budget amendment addressed the expected short revenue shortfalls but the plan the plan to cut expenses was not sufficient to address the full cost to provide services so throughout the course of fiscal year 26 uh there were reports made both to the city of jacksonville and to the jta board of directors um here i have the quarterly reports that were made to the city of jacksonville as well as the quarterly reports the uh made to jta plus the last two months of uh of monthly reports in q1 and q2 the reports the city of jacksonville jta reported a year-to-date deficits but staff projected to end the year flat um fiscal year projections in the first quarter can be challenging sometimes uh but we there should have been a better uh more informed projection in q2 q3 their projections painted a more realistic picture in q2 we projected 32.8 million shortfall and uh with the 34.2 million shortfall as of june 2026 at the same time we reported uh a deficit to the jta board of 25.2 million dollars so the j the uh the council auditor's office actually noticed in june that we had been um an error really in our in our financial reporting so the logt tax was budgeted on a net net of debt service level but we were recording or reporting actuals uh that did not take out the debt service so essentially we were over reporting actuals um for the logt revenue we did correct that in uh in july and august at the board level and obviously they were corrected in the q3 report to this to the council auditors and to the city um currently project about a continue to project about a 39 million dollar deficit obviously because we are going to miss our budget this year we will need to amend the 2026 budget with the council so that'll be coming up in the next few months so just in summary the fiscal year 26 budget was flawed uh there were optimistic revenue projections and unsupported costs provide service levels that we had to provide uh the budget amendment in 20 in february fixed the revenue shortfall but but the cost reductions were insufficient to really correct the issue staff did recommend and the board approved route changes and fair modifications earlier this year and those were planned to be implemented in fiscal year 27 throughout changes already and and the uh the fair recommendation in january there were various financial reporting issues that that i just went over a minute ago so there were errors lack of rigor in their variance analysis uh and fiscal year end projections these weren't helpful in informing the decision makers both at the uh leadership team and the board level insufficient revenues led to the depletion of reserve balances and a significant buildup of our payables uh we did get a line of credit authorized to provide liquidity support and that was used to cover some past due invoices and give jta time to make the necessary adjustments and then with leadership changes deliberate action was taken in september to ensure costs were supported uh by available revenues in the new fiscal year and restore jta's financial health the fiscal year 27 budget was approved earlier this year by the jta board set at 139.2 million and was approved by the council just last month during the budget hearing process the council auditor's office indicated that the revenue assumptions seemed reasonable but had a large number of comments about the expense adjustments uh assumptions sorry um me and my team performed a comprehensive review of existing cost commitments and confirmed that the ability to proceed without implementing significant cost cutting measures was impossible so over the last few weeks we did things that were specifically designed to ensure we were able to stay within the 139.2 million budget and that includes the ability for us to cover our 1.5 approximately 1.5 million dollar debt service on the line of credit and a small contingency to allow us to uh for any unexpected costs that might occur throughout the year any surplus if we have one in 27 will be used to reduce the line of credit or to rebuild reserve targets so what did we do well we cut a significant number of professional service contracts and made planned service changes that add up to about 24.9 million in fiscal year 27 uh today and over the next month we will become a much smaller organization um our reduction in force of approximately 200 employees continues through november 1st has already meant that we have 33 administrative and 26 operators that are no longer with us skyway passenger service will end on november 1st and navi will run through the end of the year we are pausing service not abandoning abandoning the assets and our team will keep maintaining them then we will begin running a modified saturday schedule beginning november 2nd and paratransit service will not change so what are the risks to this year's budget well as with with any budget uh lower than expected revenues is a risk but we think that our assumptions are very conservative and we should be okay on that front uh passenger fare revenue it may be impacted by the service changes so we'll keep a close eye on that but it should be somewhat offset by the fare increase that was already planned for january those weren't originally factored into the budget uh there there could be higher than expected expenditures uh but we believe that with the recent actions that we took we should be able to stay within the fy 27 budget we have also placed systematic budget controls as of october 1st to ensure that spending cannot happen with that available budget that's something that we did not have uh previously and we are implementing a business services unit uh that's reporting to me to control and coordinate all financial related activities with each division that includes contracting paying budget budget tracking variance analysis and reporting and we're going to make sure that the management team and the jta board have the accurate and timely financial information necessary to take swift action should we need to and then finally this bill provides some additional headway to mitigate either risk of lower revenues or higher expenditures so this bill what it does do is it allows jta to borrow up to 30 million of logt2 funds to pay down the line of credit which is currently 25 million or to be used for other eligible expenses current balance of the funds is 47 million dollars and the funds are restricted currently restricted only to logt2 projects jta will pay back the balance of the amount borrowed without interest by september 30th 2037 it'll help us avoid approximately 3 million of interest expense over the next two years or more if jta needed to renew the line and when it expires in two years for a longer period of time it gives jta more time to pay back the amount borrowed and provides more flexibility under the line and in order to manage cash flows which is the typical purpose of a line of credit and it's one that all of our sister agencies across the city actually have what it doesn't do is it doesn't change or delay existing projects and it does not inhibit future discussions about the logt2 revenues or the project plans so that's the end of my my comments here today and we're happy to take any questions that you might have thank you mr barnes um we have one person in the queue and that's uh past president carlucci who recognized thank you mr chair i just want to take a chance or have a chance mr barnes to interject some of my my thoughts um i'd hope to be on the jta select committee or added to it but that didn't work out so i'm on this committee and this is my opportunity uh although i will try to be at the meeting uh i think friday or whenever it is but i may not get to speak for a while as not being a member my question is and it's not intended to get in the jta or the jta board's way the jta board should be up front in handling this as an independent authority and um and and not the council trying to do your budget but as a council member who supported the emerald trail who worked hard to make the amendment and you remember back in those days of uh splitting the dollars that were going to the skyway the the autonomous vehicles and having half of that go to uh the emerald trail seems like oftentimes uh if there's ever an opportunity to try to take money from the emerald trail uh there's always a contingency that uh certain council members who might think differently than i do which is their right uh to take those dollars away or to trim the emerald trail down from this original version uh and some of those pieces that they want to take out are very important because they go through some of the oldest core areas of um jackson's urban core so with all that said uh those are capital dollars i believe uh would y'all be looking at those dollars in order to um and if you are you know i would look at that uh from y'all's point of view because this is uh the the board's decisions uh but would y'all be looking at that uh those dollars in terms of trying to uh put a fix on the issues of uh the budget woes that you have these capital dollars towards the capital woes that you have on on uh on the budget do y'all anticipate that or is that something that you might be thinking about down the road i just am curious to know and and i'll turn it over to y'all thank you through the chair to council member carlucci our desire uh at this juncture is to look at the 2021 collection of dollars that we have collected since uh 2021 that is the 47 million dollars approximately that we have to be able to again get us as close to zero for fy 27 uh we believe that there is a tri-party conversation that should happen between the administration the council and the jta as we look uh to the future uh related to uh our funding uh of you know everything from uh my rides to school to door to store to you know game day express so many of the things that uh the jta uh does for this community uh and not having you know raised fares since 2019 and before then since 2012 so i say that to say that there's a more holistic conversation that that uh we hope to engage in over the next year or so related to how we're funded and not necessarily specifically looking at uh the project that you articulated thank you thank you um i don't see anyone else in the queue and as was as was mentioned um city council president howland had directed that we stand up the financial audit and oversight select committee um to look specifically at at jta and uh i don't know if you uh saw the memo that that went out mr barnes would are you familiar with that yeah yes sir i did i did see the memo uh that went out for the fao it starts on friday correct yes friday at 9 30 so i just wanted to put that out there to make sure uh this is the start um as as the designated chair my my goal is to make sure that we focus on those things that the the city council president has laid out for us to look into but also trying to be mindful as as mr ferguson said working together um not an adversarial relationship obviously but but in a cooperative spirit of trying to work together with the administration and with jta um with you um mr ferguson and the rest of your team um to just go through these areas and let's let's see what we find see what we learn um but my goal is also to be try to not step on each other's toes there are other efforts going on obviously state level uh now as well as things that the board the jta board has initiated audit wise and so we're going to try to be mindful of that as as much as possible to to not step on each other's toes like i said or or be able to get any into each other's business um but to just go through our our steps in a deliberate manner in a cooperative manner so i i just want to put that out there in general for everyone uh that's the way i intend for our for our committee to approach um our responsibilities that we've been given from the president um and we'll get into more of the details as we have each one of these meetings with friday's meeting just being lay being one where we lay out the basics lay out the foundation for our focus areas um and you know look forward to other exchanges leading up to each one of these meetings as you're available so that we can make sure we're in sync with each other so i would appreciate uh you and your team's availability and willingness to be able to work with us in the days leading up to each one of the meetings so we can make sure it's a productive um session for for everyone um so there's no no other speakers in the queue so unless you have something else to add i think we'll leave it there for now and to the chair i just will say we look forward to this uh process and look forward to coming to a cooperative result so thank you very much thank you very much okay we we have 31 20 26 0 7 8 0 we have a motion and a second on the emergency no in the queue all those in favor of the emergency please signify by saying aye those opposed no the emergency passes we have a motion on the amendment uh miss we have motion second on the amendment uh miss oh mr peterson would you please explain through the chair to the committee the amendment will fill in uh blanks and the ordinance and the amendment to the interlocal agreement with the appropriate dates uh and the ordinance number it also clarified that jta operational funds uh will be referred to as non-logt2 funds within the ordinance and agreement basically any other operational dollars available to jta and then lastly striking language regarding the expiration of the first amendment as it will continue for a period of time um beyond the sunset date which is the september 30th of 2027 okay thank you very much knowing the queue all those in favor of the amendment please signify by saying aye all those opposed nay the amendment passes i have a motion second on the bill as an emergency as amended no in the queue please open the ballot and record your vote seven yays zero nays by reaction you've approved 20 26 0 7 8 0 as an emergency as amended okay we'll now go to page number 10 item number 14 and that is 20 26 0 7 0 1 we have a motion second on the bill um there's there's a note here so i want to i want to make sure um we give the auditors opportunity to to cover the note here um you're prepared to do that yeah if you would mr peterson and then we have uh past president salem in the queue yes sir through the chair uh to the committee so the bill was filed uh pulling 23 million four four hundred five thousand ninety seven dollars out of the public safety contingency that was included uh out of the finance substitute that number uh got reduced on budget night funding 4.9 million for affordable housing and then another 200 and i believe it's 37 000 for uh memberships in the association of counties and for the league of cities so that balance is now down to 18 million two hundred and sixty seven thousand six hundred and seventy dollars so to fund this um the projects that are included in this legislation an alternative funding source needs to be identified to make up that gap and and what was that that total uh that would now be needed as you stated it was over i believe five million we would have needed uh before budget night but but given what you mentioned it takes it to over ten million i believe yeah so so through the chair to the committee um the bill so the amounts that were taken out during um budget night equated to five million one hundred thirty seven thousand four hundred twenty seven dollars however last week uh jso found out that the full purchase price of the warehouse that is a component of this is not the ten million that's included but instead is fifteen million four hundred and fifty thousand so a a total of thirteen million one hundred eighty two thousand three hundred thirty dollars is needed on top of the eighteen million two sixty seven six seventy that's included in your bill now whether you fund that from reserves that was a portion of this bill at 2.6 million or if you fund that from debt an alternative funding source needs to be identified to be able to fully fund these three projects okay thank you uh we have three people in the queue we'll go first as i said to past president salem you recognize thank you chair we had a discussion in rules this morning because council member lanon could not be here and i recommended that we use reserves to fund this versus versus debt if you were going to use reserves and i've had these discussions with mr peterson and he can weigh in whenever he wants to but if you're going to use reserves here's a one-time expense you you pay it you're done and we don't have to go out and borrow the money to make up this difference so my amendment would be to use reserves to cover this we have a motion second on a proposal the salem proposal to use reserves to make up the the difference um that was just mentioned by mr peterson oh yes please i mean the other part i would make is our our reserves are in good shape i think we've all seen that uh we have slightly more than two months worth of operations in our reserves so that that's the reason i'm pointing to reserves to cover this versus debt thank you thank you um to that point i think it's probably smart are you do you have the that information mr peterson at your at your fingertips or that you may speak to that because i think that's important to note as well through the chair uh yes sir so the additional amount that would be needed to fully fund the full projects is 10 million 587 427 and that is on top of the 2 million 594 903 that is already in the bill and so that would fund the three projects fully the 14 million for the florida blue lease buy down uh related to jso's improvements that occurred over there two million dollars for the jfrd co2 removal system project and then 15 million 450 000 for the warehouse consolidation building purchase um and and how about the the status of the reserves so our reserves at 9 30 uh 25 was um about 420 million give or take um actually number exactly uh was not see that with my glasses but it was about 420 million um legislation went through over the summer to pull 23 million out of reserves and move it towards funding future completion grants uh you might recall a bill went through earlier in 2026 uh that said anything over 392 million which was our september 30 of 2024 balance or 17 of our operating budget needs to stay in reserves and so that 23 24 million dollars got moved to fund future completion grants so um the 6 30 26 quarterly summary so our nine months quarterly summary projected adding approximately another 20 million towards reserves we'll have to see what the last three months actually ended up being but our all that to say our reserves are in a very healthy place um and that's all the emergency reserves of another 120 530 million is on top of that so our reserves in a very healthy place and council member salem is absolutely correct if you're going to use reserves for a purpose this is the type of thing you would want to use them for a one-time project that doesn't have a recurring cost associated with it very helpful thank you very much um are you are you good okay we'll we'll go next to past president carlucci you're recognized thank you mr president uh i had a notice meeting on the um affordable housing and at that meeting i um made it clear that um that that uh i wanted to take the dollars uh from whatever pot it was i can't remember right now but but it was uh the contingency that would allow me to have to only have 10 votes to get the affordable housing through but then it was from the non-union contingency that would have taken the money from the warehouse and capital improvements that the police and firefighters wanted i didn't touch the union money and i said but i would fully support uh restoring that but that i thought it should come from um the um reserves we shouldn't be doing doing alone on this we should just take the money from reserves i've been saying for years our our reserves are in great shape everybody rings their hands when we talk about reserves our reserves are in very good shape and this is the obvious place to use them so we pass the amendment uh as councilman salem has said then we're done with it and they go on and take care of the things that the sheriff's office and firefighters want to do and uh and we don't have to worry about paying interest or loans and we're done with it and i support the amendment fully and i think we should pass it and then pass the bill's amendment uh as as amended and move on to the next item thank you thank you we'll go next to vice chair cluck murray you're recognized thank you chair chief clemens if you would come up i am curious as to just listening to the the increase in the amount of the increase in regards to the lease when did the um building owner the property owner informed jso of the increase good afternoon bill clement jackson sheriff's office and first of all forget my voice i'm getting over something so jso was aware of the purchase price earlier in this fiscal year so we knew the entire amount that was listed at uh i think it was 15 950 with a 500 000 build-out credit um so we had shared that with the mayor's office during the budget planning process so through the chair so it's not a surprise it's it's it's something that you're aware of and now that we are at this point you're just bringing this information to us so that we can make a decision in regards to the additional funding through the charity councilman clark murray yes that's correct all right i was just thank you um to the committee i was just concerned about when they knew in regards to this additional funding so thank you chair thank you chief thank you we'll go next to council member peluso you're recognized thank you chair do we want to vote on the emergency first before we kind of get to the meat of the bill or i'm sorry not emergency uh i thought we were voting on the didn't we didn't we vote to amend i thought i thought there was an amendment to take yeah i thought we were on the salem amendment okay i actually want to talk about the bill do we just want to go through the amendment real quick or do you care chair well yeah yeah i mean no no if you're on the bill we'll wait we'll take the vote there's no one else in the queue okay uh seeing no one else in the queue all those in favor of the amendment please signify by saying aye oh mary before we vote um please signify by saying aye those opposed no the amendment passes do we have a second we have a second we have a motion a motion and a second on the bill as amended uh mr popolis you recognize thank you through the chair to the committee so i just wanted to make the committee aware that as part of that amendment we're going to file a revised bt and a revised cip sheet to reflect that change to the appropriation that was approved as part of the amendment thank you um we'll go next back to council member peluso you're recognized thank you chair uh to the chair to representatives from jso i i too am very surprised at the the increase is is there no public land that we have that we couldn't just build our own warehouse through the chair to councilman peluso we had spoken with real estate and looked at available properties a while back and there was nothing that was the size and the scope of what we needed to encompass the three facilities we're trying to replace and as i look on the gis it says just market value is about four million dollars so i think i'm just a little bit taken aback that it's selling at 15 and it might just be do we have someone from real estate that can maybe speak to this a little bit i see renee in the in the crowd it's not renee sorry uh yeah go ahead yeah yes we work with the city real estate office there's a litany of parcels that are associated with this purchase it's not just one parcel and the the initial we had ordered a working with real estate a quick appraisal um to determine if the price was in the ballpark and i want to say the quick appraisal came back at around 14.5 um but before we proceeded with any purchase real estate typically orders two full appraisals um and that's the number that will be working ultimately i mean it just it seems it just seems a lot more than what we expected uh i mean to the point of what councilmember uh carlucci said i mean i was supportive of this still am obviously in a new warehouse i think we talked about that and the the need to do it but i'm wondering if we're getting a little fleeced here and i'm concerned about that thanks okay thank you anyone else okay before we uh before we go to a vote here i i did want to make a couple comments on this um one of the things i will note and i and i do have a question associated with that um with this change which is very much needed i know i went to one of the the main warehouses in one of my uh my last ride along and we booked evidence into the facility and the place was just just exploding everywhere you went it was all organized it was all well taken care of but there was no room for anything else in this huge warehouse so this is certainly needed um but yes i it is unfortunate those estimates have have gone up but they are where they are uh one thing we didn't explore but uh a positive of this whole process in addition to helping jso get the square footage they need um we're going to also be able to turn two very large pieces of warehouse property back to city ownership and they'll be able to utilize uh which actually amounts to 111 square foot between those two facilities um so that'll go back in the inventory for for use by the city um now back on the square footage i think this gives you all uh almost 45 000 more square footage than you currently have when you add up all the facilities is that enough for your expansion growth of what you projected going forward and if so um how long will that get you i know there's talk about a possible d dna lab at some point hopefully for testing your own cases and and other things but i just want to make sure that what we're proposing here gets you to where you need to be for some period of time yes sir mr chair uh mike shell i'm the acting director of police services um so yes sir it's about 40 000 additional square feet right now we have enlisted the services of a engineering firm prime engineering and they're currently doing a space assessment over there um looking at that space is going to help us with planning both within the space how to allocate it appropriately um it can help us out as well with the projections for over time for how long that can help us out so the the ceiling in this new facility is a little bit lower than our current facility so we'll have to spread out a little bit further for as far as how high we can stack evidence from the warehouse perspective but that is part of what this engineering firm is looking at for us okay thank you um we have past president salem in the queue thank you chair through the chair is it my understanding that you'd lease one of the three buildings you have and you the city owns the other two are you getting out of the two that we own and you're going to transfer all that to the new building are you going to keep the two that we own as they are uh the chair to councilman salem so yes the two of them are city owned and once we acquire this building if we acquire this building we'll be vacating them and turning them back over to the city and then the third one is a is a lease warehouse that we're using for our specialty vehicles the only way out of that lease is if we purchase a facility so this will allow us to get out of that the annual lease on that is north of 300 000 a year i understand the desire to get everything under one roof i mean it makes sense but if those two are those two buildings i mean it would just save you a lot of space in the new building is there a good reason other than wanting to get it all under one roof not to use the two city owned buildings and continue using those uh yes sir through the chair to councilman salem both of those facilities are currently are bursting at the seams our property and evidence warehouse is beyond capacity um it's it's a situation where as of today we have over 755 000 pieces of evidence there the oldest piece of evidence dates back to 1961 and that's a situation that's only going to continue to grow at this point the other facility that is city owned is our police impound facility again that's a facility as of today we are currently under capacity there but that's something that changes every single day more vehicles come in and out i don't think i made myself clear i'm not suggesting add more to those two buildings but why empty those two buildings uh why not maintain those as they are today and then put all the new stuff in the new building that that's what i'm trying to get my hands around so some of that sir would deal with the number of personnel so you have to maintain security at both facilities you've got to track all this stuff yes sir so there's there's other costs involved in maintaining three buildings versus one is what you're what you're suggesting yes sir okay thank you thank you we'll next go to council member holder you recognize um through the chair to mr shell i think to um chairman miller's point of trying to gauge the longevity of this new property you mentioned that there's still i think an assessment or appraisal happening on how long we may be able to stay in that um facility in the event it comes back that it's a shorter period period of time than anticipated will we then look for another property that may increase the amount or can you say more about that process through the chair yes ma'am um obviously at the at the end so the the bill today is securing that funding so we can offer that letter of intent to the property and let them know what direction we're looking to go but if at the end of the engineering review process if this comes back that there are problems that we're not aware of currently um and of course we would be good stewards of the taxpayer dollars and and look for alternatives at that point an alternative within that same price range or what will we then potentially come back and need more dollars um we would need to look and see what properties are available that fit that need at that point thank you thank you uh seeing no one else in the queue i believe we're ready ready for a vote please open the ballot and record your vote seven yay zero nays um thank you very much um by your action you've approved 2026 0701 and uh thanks to jso crew appreciate it all right we'll we'll now go to the front of the agenda and we'll just work our way through uh starting with item number one 2024 0966 is deferred at the request of council member carico item number two 2025 0361 is deferred at the request of council member white item 3 2026 0227 is deferred to request of council member diamond item 4 2026 0320 is deferred to request of council member white item 5 2026 0377 is deferred to request of council member johnson and we have let's see sure okay item 2026 0541 we have a motion and i have a second motion second on the amendment um miss reaver okay we're tag team in here miss reaver please explain the amendment sure through the chair to the committee if you turn to page 20 we have our technical amendments down at the bottom of the page um the amendment will um include a waiver of the public investment policy policy to allow for the completion grant incentives include a whereas clause detailing the project improvements clarify that the completion grant includes two installments which is a 26 million 90 000 payment upon completion of the improvements and execution of a 10-year grocery store lease and a 2 million 160 000 payments related to the opening of the grocery store then we will place a revised redevelopment agreement on file to amend the performance schedule to require submittal of all permit approvals within 90 days of the effective date amend a section pertaining to the completion grant clawback provisions to require the developer to notify dia of any grocery store lease termination within the 10-year lease period and stipulate that the one year restoration period commences upon the earlier of termination of the grocery store lease or the grocery store's failure to operate for 90 consecutive days regardless of when it is discovered by dia clarify that the reporting requirements remain in effect through the completion of the 17-year rev grant and reporting due dates are based on the city's fiscal year amend exhibits b and d to correct the residential unit details revise exhibit c and section 11.2 to clarify to clarify dia's authority to authorize up to a 15 percent pro rata reduction of the construction cost we need to attach exhibit f which is retail space exhibit h conceptual conceptual renderings exhibit j the annual survey we need to amend exhibit m to clarify that the audited financial statements are due regarding the public benefits payment and to specifically name the council auditor's office when referencing the city's audit rights and correct scrivener's errors within the bill and rda we also have an audit auditor concern if you want me to go through that yeah please do our um auditor auditor concern um deals with uh the retail completion grant the 2 million 160 000 the agreement stipulates that the developer shall repay a prorated portion of that completion grant if the grocery store ceases operations within the first 10 years the prorated amount is to be withheld from future rev grant payments but will not reduce the maximum rev grant amount or the term of the rev grant if the incremental property value grows more than what's estimated and usually the estimated growth amount is two percent when we're looking at these rev grants the developer could recapture these repaid funds through future rev grant payments even though the grocery store was not open for the initial 10-year period so our recommended amendment is to reduce the rev grant amounts if they're prorated if there is an amount of the retail completion grant that um is paid back all right thank you very much um is this on the amendment um so uh mr chair it sounds like council member salem is prepared to move the auditor's recommended amendment which would be an amendment to the amendment that was on the floor because you moved the technical amendment first right so if you want to add the auditor's recommended amendment then you you got a motion from dr salem on that did you hear a second on that okay we have a second right so now you are on in the posture of taking up that auditor recommended amendment and whether or not you want to add that as part of the uh other amendment okay and and um would you like to speak to the auditor recommended amendment no i do not thank you okay okay and uh councilman carlucci to the auditor recommended amendment yes i would okay please i'm i'm sure that the auditor's amendment is fine but as we go along with this i want to make sure that we are all on the same page with the administration uh with the uh with the builder developer i want to make sure we're all on the same page so if the administration is not on the same page or if uh the the folks at gateway in the dia they're not on the same page i i want to make sure we're all on the same page yeah would would someone like to come forward to to address uh your perspective on the auditor recommended amendment uh good afternoon my name is colin tarbert i'm the ceo of the downtown investment authority i can speak to the auditor's amendment we had a number of conversations and negotiations on this particular point kind of going through the hypothetical if the grocery store closes for a period of time we reached this negotiation on the point of allowing the developer to um essentially receive the rev grant the full rev grant even if there was a closure in the first year assuming there was enough rev available the reason why we did that was because uh if the grocery store closes through no fault of the property owner meaning the developer we felt like it was reasonable there's a cure period which allows for the developer to go out backfill the grocery store with a public's and or like public's like grocer um so if the grocer closed god forbid that would not be a default of the developer it's really a choice of the operator and the retail tenant and so that's why we allowed for essentially like this cure period if you will for them to backfill the grocer get the project back online and then receive the full amount of rev as it was intended if there's revenue uh available uh per the per the project that means you are okay with the auditor's amendment we do not support the auditor's amendment we would support what was in the um current rdi bill we we had we had a specifically kind of negotiated the opportunity for the developer to recapture that if the grocery store closed and if they cured that meaning they backfilled the grocery store and there was revenue within the rev what the current amendment states is that they would not have that opportunity to essentially cure and receive the incentive uh if they did reopen the grocery store which we thought wasn't necessarily fair to the developer because it's going to be outside of their control what their tenant does okay well so this is a real important project and i support it wholeheartedly but it's real hard for me not to support our council auditors real hard so um i'd like to hear a little bit mr chair uh from our council auditors as to your you know exchange with the dia and is there anything that you know gets it close or is it just a disagreement yep miss reber you're on the queue so i'm assuming that's what you're on the queue for so please um through the chair to councilmember carlucci i just want to point out that we're not removing the 90-day cure period they still have that within the contract we're just we just want a reduction of the rev grant if the grocery store were to close um we've had discussions with dia um with mr parola and we've kind of explained our position and because it's only two million one hundred sixty thousand dollars of this whole incentive package it didn't seem like that much of a big deal so we thought that we were in agreement with dia or dia was in agreement with us so that's why we've added this auditor recommended amendment so mr chair to uh harvard can y'all come to some kind of agreement uh is this a a hard cannot agree or uh through the chair to councilman carlucci this is a business point for the developer so if you know i would say that the developer can speak to this if if they're in support of the recommendation as dia doesn't object to it but um so i'll like to represent them i'm just going to give you my opinion you know i will support this i'll support giving you a completion of reserves whatever but the bridge over the river choir or whatever it is is with the is when it comes to the auditors that's the bridge that i won't cross it i mean i i gotta have i gotta have their holy water sprinkling uh maybe miss trimmer can help me thank you so much cindy trimmer one independent drive suite 1200 on behalf of gateway jacks this was a negotiated condition with dia but understanding the project as a whole is more important if this is a sticking point we we can give in with the auditor's request on this one okay thank you now we're making progress okay the auditors uh strike one up for them thank you miss trimmer and dia uh you'll always be in safe hands with the council auditors i promise you and that'll put you in safe hands with the city council thank you mr chair thank you we'll next go to vice chair okay out of the queue okay we have no one else in the queue so we're we're taking a vote on the uh auditor recommended amendment is that correct voice vote yes mr chair you're voting on the amendment to the amendment and if it's approved then someone would need to move the original amendment as amended and you would get a second on that and then vote okay no one else in the queue all those in favor of the auditor's recommended amendment please signify by saying aye all those opposed no we have one nay uh the amendment passes we have a motion we're looking for a motion on amendment to the amendment you're moving the amendment as amended we have a motion and second on the amendment as amended so this encompasses all those technical corrections that were noted in the original technical amendment plus what you've added now which was the auditor's recommended amendments yes no okay and we'll go next to past president salem you recognize oh okay so okay we've pulled that off for now um no one on the amendment to the amendment so all those in favor of the amendment to the amendment please signify by saying aye all those opposed no the amendment to the amendment passes so you've already done that what you were just voting on was the amendment as amended so now that you've voted on that and it's passed that means you've approved an amendment from the neighborhoods committee that includes all the technical amendments plus the auditor's recommended amendment okay my apologies i thought it was just the auditor's amendment no that was the prior vote that you took and so then you move after you've approved that amendment to the amendment the motion was made to move the amendment as amended it's a very fun part of robert's rules of order that makes all these steps at the at the end of the day mr chair i think unless there are other amendments to be proposed you're ready to take a motion on the bill as amended okay do we have a motion on the bill as amended and a second please okay we have a motion second on the bill as amended we go to past president say let me recognize thank you chair i just wanted to explain my vote on this bill i've had multiple meetings with gateway as well as dia on this bill and believe that uh we do need a public's and are supportive however um i was an advocate during the budget process of uh of putting a hundred million dollars into a contingency for amendment three this is a 28.5 million dollar completion grant on top of the i believe it's 65 million in completion grants that we've already committed through this city council if this vote was taken in uh after november 3rd i would look at it in a whole different way but today i i will not be supporting it thank you okay thank you we'll go back to past president carlucci recognize thank you mr chairman i understand that amendment three is looming out there um but you know what 23 million ain't nothing compared to what we're gonna have to deal with if amendment three passes uh but this piece of this development which includes this grocery store which includes a pharmacy all of the work all of the developments that we have voted for for downtown and that we will be voting for downtown not just the ones that are in the gateway pearl area but for the ones that are coming and that i hope that the lower street trio will be coming but 11 east forsyth and the ones that are already built all of downtown this public's is like the main widow maker artery and we have got to have this public's and this development that will rise above it and if we don't and if we don't strike now while the iron's hot then it may be all for naught and i won't be here i can't believe it but the one time i take a vacation on a council week that i scheduled last year a year from a year ago uh next next week we scheduled to go to vermont a year in advance i had no idea that i would be out of town on this but i think this is probably the most important vote on downtown development next week i wish i could reach my hand all the way from vermont down here and push my green button i'm going to tell you and i have missed vacations to vote i missed the vacation because i was afraid there wouldn't be a quorum when the university of florida vote came up i missed a daggone vacation for that because there was a threat there may not be a quarrel but some people may not show up so i stayed made my wife real happy try that one sometime with your ride but i i i will just tell you this with all of my core that if you love your downtown and if you want to make your downtown work this public's is going to be the engine that makes this locomotive work it's going to make this downtown propel that's going to make everything come together in the puzzle look beautiful and in five years if this amendment three doesn't pass our jacksonville the city we love is going to be the reflection to the world of what we've been working for for so long and i don't want to see us go backwards and i don't care if we pay for all this with uh with a cash reserves in a completion grant i don't care this has got to happen if it doesn't happen in the long haul in history we're going to look foolish we will look foolish and i don't want my kids my grandkids saying what the heck was my dad thinking when he fouled up on that boat and they're not going to say that because they're going to say my daddy was a leader except he went on vacation i don't know what they'll think about that maybe they're going to say i had my priorities straight but i just urge you to hear my voice now and hopefully hear my voice next tuesday night and remember that vote is going to be one of the most important votes that you'll make on this city council when it comes to propelling our downtown to what we've all been working for and so many other prior councils have been working on since consolidation thank you okay we'll go next to councilman uh peluso you recognize thank you chair and uh uh i want to echo some of the sentiments of councilman carlucci this is a very exciting time in our city um there are real concerns to be had when it comes to completion grants we've talked about that a lot right philosophically we've had those conversations within this body for a better part of a year and a half now and i think there's a general consensus that it's it's concerning to to do as many as as we have done but we do them for a reason consolidation um was not kind to the downtown area and we consistently as a city invested in rear seat centers in town center in other areas within our county that basically were direct competitors to our downtown area which by all accounts is kind of the center of commerce our financial institutions back in the day insurance institutions and our cultural center right all of our museums and a lot of our major exhibitions and and facilities are here all of our government facilities are here so we really kind of could have hurt ourselves for many many years so these these grants are necessary because the the amount of council members we have 19 many of us don't necessarily directly represent the downtown area for the at-large as they do and obviously for myself so as the district council member i have heard from a number of my constituents the need for a pharmacy is great the need for a large-scale grocer is great but more than that the need for a massive amount of residential properties is great we need more density in our downtown and this helps solve that problem i also want to give credit to the downtown investment authority um we we created the dia for a very very good reason because we didn't want to have to get in the weeds as a city council on every single development deal we wanted to make sure that we empowered experts and staff to do only the downtown work and they've been doing a great job of it and so for the for some of the conversations i believe we've been having recently some of it has been hey you know maybe we we change the deal or we do all these different things well we have a dia board that we all approved for a reason we have a new ceo who we approve for a reason and we expect them to do the work that they're supposed to do and they did they put together this deal working in tandem with the developer the administration and staff to make sure that they they gave us something that we could work with it's gone through the ringer quite a bit and even today we threw in a few uh needed amendments because the auditors found some issues and i'm glad that they did but let's be clear it's not always for us to completely change what we asked dia to do they provided us with a bill we need to pass this bill we need to move this this this forward and we need to finish the work that we've started so many years ago we got to you you want to you want to bring back downtown you got to create a hub of activity and i think one of the questions or one of the concerns i keep hearing is about how much public money goes into this project and i don't know if anyone can answer this if the auditors can answer this in terms of the total scope of the project how much are completion grant dollars compared to all the private dollars that are going in do we have a percentage or a dollar number through the chair to council member peluso um not for all the projects that are going on downtown i think for this specific project it's in the probably 15 to 20 range um maybe miss trimmer knows yeah if you don't mind mr i think i think i meant one ones that we were investing in directly but go ahead and mr through the chair if that's okay cindy trimmer one independent drive suite 1200 on behalf of the applicant we ran through the numbers of what's been awarded to date and what is outstanding in terms of their existing asks and it would bring the total cash completion grant asks to 87 million 196 that is 6.8 of the total development cost of what gateway jacks is investing in pearl square their total investment is 1 billion 269 million 518 000 for one i didn't even know the number was that intense to to the body that's private investment to to a number of us who i believe have said hey you know do we always want the public sector to lead on stuff well in this case we're not the private sector is leading on this they're just asking for a little bit help because as any of us know about downtown development projects if you're a financial institution especially these days you don't want to take a risk at all so anything in a market that's really not established yet seems risky downtown's not established yet with this it will be on top of that the public's itself based on my understanding and maybe i'll see some head nods public's the grocery itself when that's opened up there's going to be a number of other retailers are going to be saying yep we're going to jump in on this project as well and i believe miss trimmer can speak to that if if i may have a moment the total of pearl square is over 1200 residential units over 200 000 square feet of ground floor retail and restaurants all of which are going to pay property tax and sales tax into the city i also shared with everyone this morning i want to make very clear not a penny of what is in front of you today goes to public's directly this is an incentive to build a high-rise tower with more than 250 residential units and more than 32 000 square feet of space that then will attract a grocer to occupy that space we also shared with you in terms of economic impact of putting that development in what is known as a halo effect that we had a third party consultant verify what we had shared with everyone previously in terms of the economic impact of bringing a grocer into downtown and that economic impact within a walking distance so about half mile to a mile of your existing properties will yield an additional 330 million on the conservative end up to 500 million in additional revenue to the city by making the investment in this building which will allow a grocer to come downtown but again the investment is in the building and the shell not for the the tenant through the chair that thank you for that miss trimmer because that was that i believe that is a good annotation because you're right we call it the public's deal it's not about the grocer it's about the entirety of the project and keep in mind because we talked about the possibility of hey if the grocer does close at a certain time this concept has been used in other cities throughout the state including water street down in tampa this concept is going to work and you see the amount of retail and and and walking activity that you see down there and to the point of what mr mr brought up a second ago like the amount of value that we're going to get from these properties taxable value substantial to the point of consolidation issues with our downtown a lot of the buildings here are public facilities right it's all government buildings we've got libraries we've got museums it's all buildings that are you know untaxed this gives us real opportunity to finally put money and investment back into the downtown area at a large scale almost all at once and and that to me is exciting i think we can have real conversations about where the future of completion grants are in this city personally i would love to see if completion grants are only to be used for historic properties or for future affordable housing developments i understand that that might be a conversation the rest of the body needs to kind of get behind or figure out on their own i think this developer has proven that they can develop in the city of jacksonville and i'm going to be very honest i think with the exception of vescore gateway's been the only developer that i've seen to do what they said they were going to do in the years that i've been back home since 2015 and honestly all you have to do is look outside to see if they actually do the work they say they're going to do oxen group didn't do independent life right we didn't see that get done even though we did an incentive sure didn't see steve atkins do his project after we gave him an incentive there's so many folks that come to this podium and say look what we can do and they've never done it we've got projects that are about to come online and new residents coming to our downtown and it's exciting to me i'm sorry i'm speaking a lot i'm sorry it's it's it's my district and when i got elected i specifically talked about downtown development and how we need to do it and we have a real opportunity to to put in one major nail in the coffin to ensure that we have just that that kind of density that you're looking for so very supportive of this uh uh please let's vote it up thank you go next to vice chair cluck murray you recognize all right thank you chair thank you thank you council member peluso for all that information because it's very important to to extol the importance of this particular project and i want to talk about the the facts the the data so we're looking at a roi return on investment of 1.1 to 1.4 and that's something that i know people like council member lane and they look for what is the return on the investment and then let's look at the rev grant aspect i think typically and i and i cut my teeth on the four seasons deal that's the first deal that i read from beginning to end in regards to rev grants so it's typically like 20 years here this developer is saying 17 years and we're looking at 25 75 in regards to the property taxes the main thing that i look at when wanting to approve this type of deal is the capital investment what is that developer willing to invest in the project helping him or her to have that incentive to bring the project to fruition so we're looking at 140 million in capital so i don't see why anyone would say no to this because it's going to benefit us as a city in multiple ways and it's going to benefit our residents and that's what they're looking for their city government to do thank you chair thank you no one else in the queue um i will i will also say um certainly very much won't go into all the reasons why i think this is a great project a lot of you have said what those reasons are a very important project for for our downtown my concern isn't the project it's the the timeline and where we are right now and i know finance chair the president city council president had asked the dia team to go back and assess if there's another way we can provide the capital that's needed another incentive package they did that a lot of effort went into that over an extended period of time and i appreciate that but we ended up in the same place we were from the the very beginning and um i get the numbers they walked me through that and i understand uh why they are where they are but from my perspective given the vote that's coming up on november 3rd to me it's a timing matter i i think for us to be basically responsible here we should know what the vote is on november 3rd before we go forward with any final approvals on any more completion grants and so um i'm gonna i will also not be voting for this out of committee um but i'm making it clear on the record i'm for this project very important project i'm just not for the timing um if it were up to me i would say we go to the next cycle and then we'll know for certainty what the impact is on the november 3rd amendment 3 ballot vote and what the impact on a revenue stream will be which could be up to the neighborhood of 200 million dollars off of our revenue stream if approved in the year that we would need this 28.25 million dollars as well as other completion grants that are they're proposed so i just want to explain my vote up front so it's on the record um so with that no one else in the queue please open the bow and record your vote five yeas two nays by your action due twenty twenty six zero five four one um as amended just as amended yes okay thank you very much we will now go to item number seven twenty twenty six zero six four four motion on the amendment oh i'm sorry you no one no one let me know there was a there was a bill you're waiting on i'm sorry about that past president white yeah please no no sure i'm fine it's really not my bill but but it's important to me it's item 16 if you can let's go there let's go there thank you yeah sorry about that i thought you were you were interested in these i was interested but i'm through i've had enough interest now okay got it so we'll go it's is it it's item number 16 that's council member diamond's bill uh 20 26 0 7 0 5 we have motion second on the bill um i was already added as a co-sponsor earlier um so any anyone in the queue on that one okay please open the ballot and record your vote yeah sorry i threw them a curveball they need to be able to get get to that bill um yeah it's not up it's not up there we are seven yeas zero nays by your action you've approved 20 26 0 7 0 5 and my apologies again to past president white thank you okay we'll go back to item number seven i believe it is okay we have uh we've already listed that so we have motion second on the amendment um who miss reber would you explain the amendment please through the chair to the committee the amendment will attach the planning and development department's historic preservation section report as a new exhibit okay thank you all those in favor of the amendment please signify by saying aye all those opposed no the amendment passes the motion second on the bill as amended no one in a queue please open the ballot and record your vote seven yeas zero nays by your action you've approved 20 26 0 6 4 4 as amended item 8 20 26 0 6 6 2 was that a motion oh please go ahead the scriveners are just listed for your information but they're handled administratively okay so do i have a motion i have a motion a second on the bill no one in the queue please open the ballot and record your vote seven a's zero nays by reaction you've approved 20 26 0 6 6 2 item number nine 20 26 0 6 7 2 is deferred at the request of council member pittman um item number 10 20 26 0 6 7 3 um we have past president carlucci in the queue you recognize her thank you mr chair uh this was a really good bill and um i was disappointed that uh in one committee it didn't get through committee um because of a three to two vote and one of the two no votes wouldn't vote yes just to get it out of committee so i would have a chance at council but i decided not to make a big deal out of it at council because it was budget night but um it's been a um long-standing tradition that usually a council member uh old school tradition that um somebody would vote yes to get it out of committee uh particularly when the council member and the author of the bill couldn't be there um to allow that council member to have an opportunity uh to give his bill a shot and um i'm just saying that not out of um any kind of a anger is too strong a word but but uh frustration whatever but just maybe out of a little um institutional knowledge historic uh knowledge that's a courtesy to give your fellow colleague chance simple as that and that's what we should all do i've done it many many times uh but as i heard that uh it was said by multiple council people they just weren't going to change their vote well i would have done it for them so with that said anyway um i will uh i'm just withdrawing the bill and i will come back and allow uh i did by the way have a notice meeting on this bill on a council day which would have made it very easy i think for uh council members to show up and everybody was sent an invite and um but nobody um had uh the people that had strong um opinions against voting for it uh didn't have strong enough opinions to show up and listen and hear about the bill uh it's a great bill and it's one that's very much needed and it speaks it's a bill that speaks to parents and i just want to say this that what this bill does is it gives an organization a chance to speak to the parents a lot of our kids that are at risk go to have programs through kha for at-risk kids and they get training as at-risk kids but then they go home to parents that are dysfunctional and the parents need help and that's what this program was for and it's highly successful highly successful and never got a chance well it's going to get another chance this coming year and uh you'll get another chance to redeem yourself so but i move withdrawal thank you we have motion second on withdrawal uh this is a ballot vote i see no one else in the queue please open about and record your vote seven yes zero nays by reaction you've withdrawn 20 26 0 6 7 3 item 11 the committee the amendment will provide additional clarification in the bill title and in the explanation of appropriation indicating that 751 657 is being appropriated for the osprey river in four project and 419 295 dollars 80 cents is being appropriated for uh forgivable loans and then correct appropriation fiscal year to 26 27. thank you um we have vice chair uh clerk murray you recognize thank you through the chair to miss reaver so this bill and the previous bill we're just basically these these are the appropriations for the bills that we passed earlier in regards to these developments right um through the chair to council member clerk murray this bill is actually appropriating additional dollars just for that first installment payment um for the osprey river in four which will go along with that prior bill that did move those fundings out of a contingency account into just a regular regular account for this to be paid during the year all right thank you thank you too thank you um let's see we need to vote on the amendment yeah all those in favor of the amendment please signify by saying aye all those opposed no amendment passes we have motion and second on the bill as amended no one in the queue please open the ballot record your vote seven yays zero nays by your action you've approved 20 26 0 7 0 6 as amended item 18 20 26 0 7 0 7 we have a motion and second on the amendment miss reaver please explain the amendment through the chair to the committee the amendment will reduce the total appropriation amount to 181 333 and 85 cents and the reallocated amount to 48 438 438.85 based on available funds um attach provides exhibit one which is the bt to reflect that reduction and place the federal award agreement on file to be compliant with the municipal code and correct uh the appropriation fiscal year okay thank you all those in favor of the amendment please signify by saying aye all those opposed no amendment passes motion second on the bill as amended we have vice chair clerk murray you recognize thank you chair if mr jeffrey's with jeffrey would come forward just to give us a little bit of an explanation in regards to how these funds are going to be used i think how they're going to be used is really important we don't think about homelessness in in layers we also we often think about homelessness as someone just being on the street but if you would explain how this bill these funds are going to be used hey good afternoon travis jeffrey housing community development division uh through the chair to councilwoman cal clark murray uh this is our second allocations of our esg emergency solution grant rush funding and we're hoping that we're going to use these funds for emergency shelter operations that would be you know intake um cops or beds um and supportive services as well and thank you for that and once again these are us dollars and then they have some um funds that are in a sense leftover can you explain just that leftover portion um we just did some reconciliation on the on the we we received our first allocation was one million dollars i'm sorry through the chair um one million dollars and we had we just did a reconciliation had like forty something thousand dollars that we placed into this pot as well okay right thank you so much for that and please add me as a co-sponsor thank you all right no one else in the queue please open the ballot record your vote six jay zero nays by your action you've approved twenty twenty six zero seven zero seven as amended go next to item number nineteen twenty twenty six zero seven zero nine we have a motion do i have a second on the bill a motion second on the bill i see uh past president carlucci you're you're on the queue you recognize sir all right um testing uh can somebody explain this bill i think i understand it but i'm afraid i might i understand it so um it so what happens if like got a committee of seven and four people show up so what does it mean through the chair to council member carlucci thank you for asking i'm happy to explain it so previously the council adopted what a piece of legislation that was offered by council member boylan that made a number of changes to the council rules with respect to council member attendance at standing committee and council meetings and also as part of that um original bill it revised the quorum requirement for standing committee meetings to state that previously it had been four members the majority of the committee was the quorum but it revised rule 2.210 to state that the quorum of a standing committee would be five members so it changed the standing committee quorum requirement to five except where there are two or more excused absences for a standing committee meeting at which point it became four so what that's required is that we keep an eye on absences who was excused who is unexcused and that address that that will tell us how many you need for a quorum council member gay's bill proposes to amend rule 2.210 to go back to the original quorum requirement which is just a standard four members irrespective of the number of absences whether they're excused or unexcused so the original rule required that there be four to be a quorum the long-standing rule prior to the boylan bill was four okay and then uh councilman boylan's bill uh got kind of tough on us and we had we had to put tardy notes um to the principal's office and uh so that we we'd have to have five people to be in a committee which you would still under the other amendments under the boylan bill would still be required to submit your excusals it just means that we won't have to keep an eye on who's excused or unexcused to ascertain what their quorum requirement is for a particular meeting because he is proposing councilmember gay that it just before no matter what okay um lord jesus you know i don't care who's upset um i i think we need to get away from um being our brother's keeper and people ought to come to the daggum meetings period and they ought not to have to be required to put in a tardy notice they ought to know better anything's supposed to be here and be here um so i don't know um if if if um um i'll uh i'll probably vote for it and be glad i'm not here for this one tuesday okay anyone else um i will just say real shortly i will be i'll be supporting this but i also want to make it clear i i get what councilmember boylan was was working toward and uh and did achieve because as was pointed out um by mr popolis there were a number of adjustments and um yeah i i you shouldn't take measures to get us to come to the to the uh committee meetings to make sure we have enough to do the people's business but uh i think there were some provisions in what he passed got passed uh that were very positive things to to just make sure um so i i support that but i also i supported that but i also support the adjustment that the council member gay has has uh recommended here it's not undoing all the other things that have already been passed it's one element of that and so i will be supporting uh this today so with that said uh please open the ballot and record your vote seven yays zero nays um i think we have a um miss vote here um vice chair uh clark mary you recognize i need it thank you chair i i need a motion to reconsider thank you okay we motion second uh reconsider all those in favor please signify by saying aye all those opposed no uh the the motion passes so open the bill open okay we got a motion do we have a second on the bill a motion and second on the bill no in the queue please open the ballot and record your vote five yays two nays by direction you've approved 20 26 0 7 0 9 uh item 20 20 26 0 7 2 0 we have a motion on the bill we have a motion second on the bill no no one in the queue please open the ballot and record your vote seven yays zero nays by your action you've approved 20 26 0 7 2 0 we'll go next to item 21 20 26 0 7 2 1 um yes uh mistop mistopolis before you take up the amendment the funding source for this legislation is no longer available so you may want to inquire of the office of economic development whether they want to propose an alternative funding source that could be addressed by the committee otherwise the funds aren't there to support the legislation okay uh mr randolph any any position comments on that on an alternative funding source otherwise we we don't have the funding available to support the bill that's being reconsidered here mr chair i can take that if you don't okay yes please mr delaney uh yeah um you know obviously the funding source is different the funds were never spent um they have just rolled over uh i might suggest if someone were interested in just taking it out of reserves obviously that changes the vote count and everything um so we don't have we don't have a source attached to this this bill um mr popolis that is correct currently as it's proposed the funds the funding was is no longer available what mr delaney is proposing is that somebody could move an amendment to pull the dollars from the general operating reserves we have a second we have a motion and second to fund this bill through the operating reserves um do we have any comments here on this yes please um past president salem you recognize thank you chair this is the same bill as we voted on before is there have been any change other than taking the money out of reserves for this no is auditor somebody through the chair to council member salem this is the same bill the only change would be the funding source okay i voted against it before i i don't think we should be doing this and uh doggone sure don't think we should be taking the money out of reserves so i'm a no thank you okay thank you i've been a no thank you mr delaney you recognize there is on yep okay i just wanted to point out uh it was deferred in this committee last time it did fail in the other two uh just looking for a vote in either way all right thank you sir go next to vice chair clark murray recognize thank you chair i am going to change my vote just to move it out of committee and i think that's what we're looking to do because it did fail in the other committees i don't i think it's going to go down in flames so that's why i'm going to change my vote today thank you chair we'll go next to uh council member peluso you recognize thank you chair i just so even if it does move out of this committee it's still up to the president to to bring it up to the the full body correct no if you voted out today it was only held in committee because neighborhoods didn't have a vote for four members one way or the other so if there's a vote today of four members yay or nay it'll go on the council agenda for next tuesday understood but now it's going to be with this new funding source which requires a super majority right right so yes if you if you didn't approve the amendment that's on the table currently to pull the dollars from reserves we would be recommending that at council unless it's withdrawn you would need to move that amendment at council because it doesn't have a funding source otherwise is anyone through the chair if you don't mind is anyone here from the uh from the company from jack seattle charters appears as though not okay i mean if we want to no i'm going to vote now yes please uh past president carlucci recognize um okay thank you mr chair is there anybody here that can speak to this and uh through the through the chair to my friends and uh miss reber for the auditors is there any other uh pot of dollars that we can pull from for this whopping seventy thousand dollars that maybe we can put this uh nice um saint john's river quality of life event you know to work um through the chair to council member carlucci being it's the fifth day of the fiscal year i really don't have any pots of money available but i could offer up the council operating contingency that has a balance of a hundred thousand okay i i uh i'll consider making an amendment towards that um but uh tell us about this and what what it does and um and ed and you know how many people it serves and so forth i mean look this is our greatest natural asset how many people use this um and uh so let's hear about it if i can through the chair i'm sorry mr chair i didn't go through you yeah please go ahead yeah sure good afternoon ed randolph oed uh through the chair to councilman carlucci so um as i presented to the committees a few weeks ago on this project we basically looked at this like we're doing any other project trying to help a small business in a distressed area um anywhere else in in the city um and in this particular instance dia their programs do not allow for them to um go ahead and help out non-brick and mortar locations or businesses so this purveyor the the actual owner of the boat looked at some other small businesses downtown restaurants clubs the like and they were getting um incentives to help them pardon the pun but stay afloat kind of keep their business moving um so they were actually they came and spoke to dia dia said we cannot help you we don't have any programs on the books that could address your request uh this specific request is related to a every two years um as the owner of a ship of that nature of which serves hundreds of people a week basically um it's a publicly open cruise to to the to the members of the public that's parked downtown um they've had to undergo every two years this uh required u.s coast guard um review and approval and repairs if needed based on uh u.s coast guard um criteria so with that they looked in jacksonville they actually moved the boat from new york um after a long period of time they owned the boat many years in new york did a similar cruise there uh the the husband of the wife and husband duo uh team he actually came to jacksonville after getting um care at mayo clinic so they ended up in jacksonville love the city but right now the foot traffic in which they're experiencing um downtown is not sufficient enough to cover their bills so they went ahead and went and had the repairs uh cost they got cost and estimates in jacksonville there were two facilities that could accommodate them bae systems which is was unable to accommodate them and then fincantieri another shipyard here um quoted them over 150 000. they actually had to travel savannah recently to get the these repairs done in order to keep their ship afloat um and business moving um so that's where they incurred a hundred thousand dollars in the past they've experienced closer to twenty thirty thousand dollar cost for this two-year um exercise if you will so right now they've come in and said we may have to go to savannah some other we want to be in the southeast but right now jacksonville just does not pencil out as it relates to the amount of income and and folks getting on the boat and we just looked at the amount of uh investment we put downtown all the other small businesses downstream that they support caterers florists musicians laundry services a whole host of other downstream small businesses that they partner with in downtown as it relates to each of their cruises um so we just looked at it as being a worthwhile investment again to have that dinner cruise have that asset downtown um so at this point um that that's how we looked at it from an underwriting perspective okay so um the reason i made the motion i i want to get an idea for mr randolph um if this is not a good investment and i withdraw my motion and all that but the reason i want to talk about it is because um you know a cruise on the st john's river is a nice thing uh for people who love downtown who love our river and like a nice evening out we're moving into the fall which as i understand it is a time when we might get cooler weather still waiting on it but uh that's what i understand uh do you think uh how long have they been operating and do they have is there any uh history uh um that shows what um what kind of draw they have for their their boat their yacht whatever sure through the chair to councilman carlucci so basically they've been in business a little over a year now downtown um and they're hoping that just word of mouth and and they have been seeing a ramp up in activity but uh as of the last couple months it's just not to the point to where um they deem their long-term success to be all that greater at least in the next year or two so that's why they came in so i think they're definitely seeing more foot traffic but um you know as as everything else downtown there's just so much going on that i think it's probably going to be another year or two possibly before we've got enough critical mass to really keep them um in the black so again they've approached us and said they're contemplating leaving the market uh we just thought based on you know hundreds of millions of dollars of investment in our waterfront you know most downtown successful downtowns have at least one dinner cruise type activity and offering like this so we just looked at it as through that lens do you miss chair if you don't mind uh another question for mr randolph okay please um so um the last few months uh do you think the heat um has anything to do with you know pushing back on that draw and do you think that moving into the cooler months and into the spring uh that might help them that they're able to get these repairs and and the maintenance done i what what i guess i'm saying is is it worth a a chance because we should have something like this on our st john's river we should i don't want to throw water i don't want to throw um i don't want to throw good money after bad but this is something we should have it sounds like to me um i would like to give them an opportunity i want as much activity on the st john's river as possible and so you are the economic development um expert i am somebody who likes to see activity and opportunities on that st john's river so i'm kind of leaning on you as to your um advice um your thoughts on this to uh our body and um in what you think sure through the chair to councilman carlucci no pressure we're gonna we're gonna wrap we're gonna wrap this up after this one we have a member that has to leave so i'd like to vote on this i would just say that i think yes as the weather cools off i would imagine i think their volume does ramp up in that it's more hospitable it's more accommodating for folks to be outside and especially in in the open air and in the sun but um i mean i can't speak specifically but i would think yes definitely in the coming months with the holidays and the cooler weather they would see a ramp up in activity so again we just treated this like any other grant or small business come to us with um a request as it relates to uh the possibility of not staying in the market and and that's how we view it and where do the grant dollars usually come from and i'll end with that mr chair uh through the chair so we have a lot of its northwest trust fund is really where we see a lot of these things where we do these types of grants for small businesses um again this is a total anomaly in that it's a boat so you know you don't it's more fixed bricks and mortar locations that we do but again this is a small business just happens to be on a boat so that's their infrastructure um but then we do have other we come before this body to get approval city council for other smaller grants for small businesses but for the most part we do have at least one fixed um account and that is the northwest trust fund of which ultimately requires city council approval all right all right thank you mr randolph thank you very much um we're going to go vote on the amendment here um do you want to speak on this yeah past president say let me recognize i have to leave and i'm trying to stay so we can make sure this thing gets out one way or the other but number two uh councilman carlidge i urge you to go back and watch the last neighborhoods meeting where we spent 20 minutes and the people were here and you may get a better feel for why there were so many no's okay all right thank you um we're we're voting on the amendment now right mr chair the amendment on the floor is um to pull the dollars from reserves in lieu of the original proposed funding source okay um all those in favor of the amendment please signify by saying aye all those opposed no no um the amendment fails um so mr chair you would still want to take up the original auditor's amendment which was the technical amendment to remove the emergency language and correct scrivener's errors so if that was if that could be approved when it comes to council next tuesday because the funding source will still be at issue either the bill would have to be amended on the floor to address the funding source and a member would have to offer that or the other option would be to just deny the bill or to withdraw the bill we have motion and second on the auditor's amendment all those in favor signify by saying aye all those opposed no the amendment passes motion and second on the bill is amended um council member puso you recognize thank you chair i'll make this quick to to my colleague mr carlucci i would ask that you you try to meet with the the jacks yacht folks like you i agree that this is a this is a value add to the community it's just about where the funding source comes from i also think we could talk about dock fees and uh you know what they pay in maybe we can give them a couple years of that for free or something like that there's other ways to maybe make them a little bit more whole because of the amount of money they put into it but i personally did get a lot of emails from folks saying hey i don't think it's right that we're putting money into this to that end i think it's because some people don't know about the dia incentives that we do already um there's just more to this than meets the eye and i'm gonna vote no right now uh i think a lot of people might want to continue to vote no right now this could pass out of here if it fails i just based on where we're at i'm voting no okay uh mr reber you recognized and then we're gonna vote through the chair to the committee i did offer up the council operating contingency as a funding source but there is also a mayor's operating contingency that has a hundred thousand balance as well that could be used instead of operating reserves okay no one else in the queue please open the ballot record your vote one yay six nays um by our actions uh you have not approved uh 2026 zero seven two one as amended all right we'll go to item number let's see we've already we've already taken up 22 correct let me see okay i had a line through my apologies i know we need an amendment uh item 2026 zero seven four zero we have a motion second on the amendment um no in the queue please and uh all those in favor please signify by saying aye aye all those opposed no the amendment passes we have a motion second on the bill is amended no in the queue please open the ballot record your vote six jay zero nays by your action you approve 2026 zero seven four zero as amended and okay this is item 23 2026 zero seven four nine is on second read but i've gotten three didn't people bring this up as a possibility for an emergency um is there anyone anyone bringing this up i know the auditors uh and general counsel spoke with me right before the meeting started uh first i've heard about it but also i know we have mr mr hagan is here on this i'm not sure what communication has occurred my concern i heard from staff was they haven't had time to review this and do their due diligence given it was listed on second read um i i'm not sure what to do about this right now because i in one hand mr hagan i want to honor that request to be considered but on the other hand i want to make sure staff has been able to do their due diligence mr chair because it was listed on second you are correct the auditor's office has not had an opportunity to review the proposed agreement and the legislation to offer any technical corrections that might have to be carried to the extent a member was prepared to offer an amendment to add emergency language and then have this taken up as an emergency they can do so it would just mean the auditors would have to complete that due diligence before next tuesday and it would likely mean that there would be a floor amendment and potentially some committee work that would have to occur on the floor of council on tuesday um yeah i know this is okay uh vice chair clark murray you recognize thank you chair i would just be opposed to the emergency aspect because of the fact that i have not had a chance to read the bill and if you all haven't realized it yet clark murray does not like voting on anything that she has not read because i want to make sure i understand what i'm saying yes to and what i'm saying no to so i am not in favor of it being moved as an emergency thank you chair okay um mr hagan do you do you want to make any comments i just want to i'm in agreement with what i'm hearing up here um but i also want to give you an opportunity because this is brought up twice right before the meeting is this okay procedure wise okay yes please mr hagan yeah thank you mr chair chris hagan 200 north lower street uh representing the jackson zoo i appreciate you considering having the conversation real briefly i know it's been a long meeting um this was a conversation that i had with philip peterson we tried to work through it i know that it was going to potentially come up as an emergency the night of the budget and that probably wasn't the most uh attractive thing to do at the time just because i know there was a lot of stuff to work through that night so um this the other suggestion was to have it introduced as an emergency in committees um i don't want to put us in a bad posture if the staff's not ready then and then i completely understand um and i want to make sure that everybody's had ample time to review the bill okay thank you i appreciate that and uh yeah i i don't i'm not sure as far as understanding and communication you know where things went with that but thank you for your understanding okay well we're gonna we're gonna leave that given what's been stated we're gonna leave 20 260749 on second read um 20 260751 is on second read 20 260752 is on second read also 20 260753 second 20 260755 is on second read as is 20 260765 and 20 260778 and also second read is 20 260779 and uh let's see we have already taken up item 31 and then we let's see where we go here i think that's it any anything else um past president uh carlucci you're you're recognized uh thank you mr chair i'll try to make this quick uh this doesn't have anything to do with the bill that we're considering now but it would come before this committee and in case some folks are getting any uh emails or communications regarding the saint john's marina which is the uh in the boat ramp which used to be down uh just west of the old river city brewing company it's the boat ramp that serves the downtown area um uh there had been lots of considerations on how to improve that and uh one of my constituents had a proposal that uh would have cost perhaps seven eight million dollars it um also included a retaining wall uh which um was um a big part of the cost but i've been working with the recreation department uh daryl joseph on that uh actually the boat ramp there is not in bad shape but it's old it needs you know to be redone and refreshed and so much of the the bulkheads down there is being redone new anyway uh the ramp needs to be extended so the dia right now is putting together plans to extend that boat ramp um further out and they have the money for the plans and the design in the engineering on that daryl joseph who is a master of applying for find grants uh is applying for those now and there'll be two grants that will be applied for and he's certain that we will get those and those grants will actually pay to completely redo that boat ramp to extend the boat ramp out uh the engineering and design will include possible uh having a retention or retaining wall the problem though with the retaining wall that goes out into the river changes the direction of the current as it goes back and forth and that is a real expensive um that's very expensive to construct and it's very expensive and it takes according to mr joseph of several several years to permit when you change directions of the natural flow of the currents of the saint john's river and it might make putting a boat in a little easier but i've used that boat ramp many times i've been down there three or four times since working on this in the last seven or eight months and i've talked to many people who put their boats in and asked is it pretty good boat ramp is it working is it safe and everybody says yeah we don't have a problem and i've talked to people putting in large boats down there but uh my well-meaning constituent um uh is very determined about the retaining wall and that's fine i mean i i i get it he's put a lot of work into this and he's got a lot of pride in the work he's putting into it and that's fine but uh it adds about seven eight billion dollars to the project and what mr joseph is doing and what i happen to agree with and the way i've been working with them with him on it and talking to the users of the boat ramp including i've used the boat ramp before when it's done in 2028 even without the retaining wall everything's going to be new refreshed there'll be some additional parking places down there it's going to be fabulous and maybe you all have not heard much about the boat ramp boat ramp down there but lord have mercy i've had so many uh emails from some people some that actually weren't real but some people down there uh that are confused and uh and i just want to put it on the record that that boat ramp is going to be fabulous and it'll be ready to go in 2028 but between now and then it's not going to be usable but it is going to be um it's going to be a wonderful quality of life um amenity to uh our downtown thank you all right thank you we'll go next to councilmember pulso recognize thank you chair and chair i'm sorry to do this i'm going to ask us to to reconsider uh uh 2026 0541 to add a friendly amendment that uh was supposed to be added earlier in today's debate so i'd like to reopen that up and uh miss trimmer i'd like to kind of come up here it's basically an easement agreement with the city of jacksonville it's very it's friendly to the administration it's friendly to the dia it should be very non-controversial so move to reconsider second okay mr chair you have a motion on the floor to reconsider item 2026 541 i have a motion and second uh to reconsider 2026 or 541 voice vote all those in favor please signify by saying aye all those opposed no the um move the motion passes just a second and let him announce the result and then i'll tell you the next step okay what was that i didn't mean to interrupt you mr chair but i didn't want motion passes thank you so this means now that you've opened reopened it through reconsideration you start over from the beginning so my recommendation is for expediency if the committee wanted to that instead of just moving the technical amendment you move the technical amendment with the auditor's recommended amendment together because as you recall on this item you took those up as one as an amendment and the other as an amendment to the amendment but you would need to take those up either together or separately and then mr peluso can offer his additional amendment which could be rolled up at the end if that's the will of the chair or the committee and then you would go to move the bill but you have to start over are you moving both mr peluso the technical and the recommended no uh what as i indicated we need to start from the beginning and there was a regular there was so i take that to mean mr chair that what's on the floor are the technical amendments that were marked on your agenda and the auditor recommended amendment which were all approved the first time the bill came yes so if you want to take a vote on that or deliberate on that then yes no one in the queue all those in favor please signify by saying aye all those opposed no the motion on the amendments passes now it would be appropriate if miss if you wanted to recognize council member peluso to offer his new amendment council member peluso to be recognized thank you chair and thank you for your patience uh miss trimmer do you mind speaking to uh to this amendment that i'm going to be offering thank you so much cindy trimmer one independent drive suite 1200 and i apologize for the confusion we had two little pieces of cleanup and the auditors did too good of a job and caught one and we thought that both were in one was to correct the permitting date which was done as your technical amendment 4a the other is to include the streetscape easement that is adopted through all of these development agreements downtown it allows gateway to do the improvements in the right-of-way from the back of curb to the right-of-way line and then it also gives a public access easement over the portion of the sidewalk that crosses over into private property so these are standard easements that are on all of the development agreements and it was just missing from this exhibit at the first time any any comments from the uh otters on that uh through the chair to the committee i'm i'm good with those okay thank you and thank you miss trimmer we have a motion to amend and a second no in the queue all those in favor please signify by saying aye those opposed no the amendment passes mr chair may we roll those up please please do so then at this point you would be properly postured to take a motion on the bill as amended we have a motion and a second on the bill as amended no in the queue please open the ballot record your vote six yay zero nays um by your action you approve 20 26 0 5 4 1 as amended and with that i what's that what's that oh man i'm in wanting to hurry up i pushed to push the wrong button so motion yes um all those in favor reconsider please signify by saying aye i was opposed no no this juncture mr chair if you want to make one motion for the auditor's recommended amendment the auditor's technical amendments and the peluso amendment just as one you can just move them all as one amendment no so mr chair the amendment thank you it's an emotion on the amendment so if you want to just say the motion would be to move the auditor's technical amendment the auditor's recommended amendment and the peluso amendment as one amendment we have motion and second um all those in favor please signify by saying aye i was opposed no it passes and we have a motion on the second and second on the bill as amended please open the ballot record your vote apologize for that thank you for the catch five yeas one nay uh by your action you've approved 20 26 0 5 4 1 as amended and as i said earlier i support the project it's the timing waiting on the november 3rd amendment three vote is what i'm concerned about that's why i voted now so with that i believe unless someone else has another amendment to the amendment to the amendment and reconsider to the reconsider no no no we're adjourned the city hall and can't get to you uh you know whatever but i think it's a great idea and i think it would motivate the community as well knowing that you're out there doing the work for us so i hope that this is just not one thing you
