And that's why, even with leadership, you know, that's right, Colonel Miller, he's the man. And then with 2025, 0867, Duval County Public Schools, CIP. That's not part of the CRA, Mr. Nooney. Is this the consideration for inactive MCGP grant applicants, resolution, RACRA? Yes, that's the item. That's it? Okay. I don't know how many there are, but, you know, grant applicants, you know, where is that money falling back into which bucket? But in the program guidelines, and, you know, okay, that is another one. But, again, I just want to reiterate, if there is any waterway component with any of this, even with these grants, and we got grants tomorrow in waterways, especially with JU stuff. Did you want to speak to this, Ms. Nazarela? I have some prepared remarks because this is a pretty substantial policy change, if it pleases the chair. Go ahead. Okay. So for this item, you may want to pull out of your Renew Arlington Packages page 22. It is a mandatory compliance grant program process. It may help you as we go through this item. Also, I would like to extend a heartfelt thank you to Carla LaPera, or Carla Shell, I guess now, our OGC. She, we owe her a debt of gratitude for the time she spent in the OED conference room beating this to death and in putting together a policy for you to review today. So we're very grateful. Some background on this. On June 25th, 2019, Ordinance 2019-239 was approved by City Council creating a zoning overlay with specific design and performance standards for commercial multifamily properties located within the Renew Arlington CRA. The overlay mandated that all commercial multifamily properties come into compliance with these new standards as well as for the mandatory components of landscape, signage, and fencing. It was agreed that the deadline for compliance would be five years and 90 days after a grant program was approved to assist property owners with the cost of coming into compliance. On January 28th, 2020, the Renew Arlington Agency Board approved the Renew Arlington Mandatory Compliance Grant Program with Resolution RACRA 2020-03, solidifying the deadline of compliance as April 28th, 2025. This grant is provided on a reimbursement basis to those applicants within the CRA boundary. These properties are deemed to be out of compliance with the requirements of the overlay. It was created to assist them to offset the cost of coming into compliance. Fast forward to today. Here we are over a year past the deadline with many applicants in the program who are not advancing, not responding to staff emails or to phone calls. Our policy has always been if you're in the program and you're moving forward, even though that deadline has come and gone, we will work with you to get you over the finish line to completion, and with that, you will not be cited by code enforcement. However, if you're in the program and you're not moving forward, we cannot protect you from code enforcement and you're putting your grant eligibility at great risk. You have for your consideration our proposed policy to define active and inactive grant applicants, as well as to establish the process for addressing inactive grant applicants, including termination from the program, active applicants, those demonstrating a good faith effort to move their project forward and to be responsive to staff. Inactive applicants are those not demonstrating a good faith effort to make progress on their projects and not responding to communications from staff. Those are the ones we are going to be addressing today as defined in stages with potential termination for failure to act. The quick highlights of their policy are written in stages as follows. Stage one, we haven't received any survey quotes. There are 19 applicants in this category. What does that mean after submitting an application? Their next step is to go and get two survey quotes. The people in this category have not even done that. The applicant is directed to obtain two survey quotes containing all the property information such as topography, tree location, ground improvements, et cetera. They send those two quotes to Brian Wheeler, our OED Renew Arlington Design Review. He comes back to them and says, this is the lowest, most qualified bid. Go with them, hire them, and work on your survey. This category, they have not even done step one. So at this stage, they will be sent an email as well as a FedEx giving them five business days to submit or be terminated from the program. If they comply, they will be allowed to stay in the program. However, from this point forward, they will no longer be eligible for soft costs. They will be required to move all the way to conceptual site plan, at which time they will send it to us. We will get it through the radar process, which is the city review, expedited permitting process, and we will get them through the grant process. At this juncture, they will no longer be required for soft costs. We won't work with them through that point. They will have to get us a conceptual site plan on their own. However, we will cover their project costs. Again, 19 applicants in that category. Stage two, no survey produced. There are 10 applicants in this category. So they submitted the two quotes for surveys, but they never hired a company that we recommended to get the survey completed. In this stage, they will be sent an email, and at FedEx, giving them 10 days to produce a contract from a survey company to produce a survey, or they will be terminated. Like the other, if they comply, they will be responsible for taking it from the survey to a conceptual site plan, at which time they can send it to us. We will get them through the radar process and create a grant agreement for them. However, their soft costs will not be covered, only their project costs. Stage three, there are 16 applicants in this category. We have received no quotes for design professionals. At this stage, staff has created a mutually agreed conceptual site plan that was approved through the radar process. The applicant must now obtain two quotes for design professionals to take the conceptual plan and create plan specifications for the permitting process. In this regard, they have 10 days to produce two price quotes for a design professional. If they produce the two quotes for review, they can stay in the program. But again, soft costs will not be allowed as part of their grant agreement. They can get us a finalized agreement. We'll get it through radar process and create a grant agreement covering just their project costs. Lastly, stage four, no design contract at all. There are eight applicants in this category. They have provided the due quotes for a design professional. However, they have not pulled the trigger on the one that we recommended that they hire to move them forward to the next step. They will have 30 days to hire a design professional and move forward. Otherwise, they will be terminated from the program. Once the grant applicants have been terminated from the program, the notice is final and non-appealable. This is for your consideration to move some of these folks forward. We have to make some changes and get those through the process that are responding to us in earnest. With that, I'll open up for any questions you might have. All right. Council Member Clark-Berry. Thank you. Through the chair to Ms. Nasralla, good afternoon to you. Why do you think there has been such a lack of progress or lack of, yeah, lack of progress on any of the applicants' part? Do you think that they maybe need one day or a series of days with personnel who can guide them through these aspects? What do you think, why do you think they haven't responded in the way that they should, and what do you think a solution might be? Through the chair. I can only speculate because they're not responding to us. I think the biggest problem is change is hard for people. They don't want to change, and they are putting their heads in the ground like an ostrich. And I guess they think if we're not there to enforce what we need to enforce, they're not going to move forward. We are there as staff. Every stage of this process, we walk them through it. We have e-mails that give direction. We do Zoom calls. We are there with them from A to Z. There is no issue with us abandoning any kind of a grant applicant. We spend an amazing amount of time with each one of those independently. These that aren't responding, they just don't want to change. That's my guess. But because they don't respond to us, I have no way of knowing. They won't communicate with us. We have e-mails that we have sent them over the years. I mean, this is going on, some of them from 2023 to current, that they're just not responding. And we have to move on. There's a lot of need in Arlington. There's a lot of things that we need to redirect money and move forward if they don't want to participate. So be it. We can't force them. Thank you for that. And does this have any direct impact on the reason for the bill that's going to be before us today in regards to expanding those boundaries? Is it related? Through the chair, we're not, not to my knowledge, we're not expanding any boundaries. I don't, I don't, I'm not. Oh, the bill for city council? No. No, no, no. In regards to your CRA. Oh, for the, that's just for advisory board members. We're not expanding the boundaries for the CRA. What we are expanding is we're making, we're extending out the criteria and the area for which we can have a larger pool for candidates to be considered to serve on the board. Okay. All right. Just to respond to Councilman Clark-Murray, I think at the beginning of this process several years ago, there was an impression that if you got an application in to this process, you'll be okay. And I think there are people that weren't real supportive of this process that got in an application and they've just sat on it and done nothing since then. So I, I frankly think that's what's going on. And I think most of these, and Ms. Miserola, were probably very early on in the process and they've just done nothing since. Is that correct? Yes. Through the chair. Yes, sir. We have it documented of emails that we've sent that have gone, um, that they haven't responded to. And we try everything because we want them in the program. We want them to move forward. We want to make Arlington better, but we can't force them. And it's now time to either make a decision to remove them or. Unfortunately, I think they were given bad information that just getting an application in solves the problem. And, and that's obviously that's not the case. Well, through the chair, that bad information wasn't coming from staff because we gave them deadlines. Of each stage where they needed to be and respond to us. So I don't know where it came from, but. I have my suspicions, but they're, they're simply suspicions. Thank you. All right. To the district councilman, Ken Amaro. Thank you, Mr. Chair. Through the chair, just to give some context as to the number of applications that are now pending and, and those that you're working on as to why this is an urgent adjustment to the program. Because, uh, the dollars can best be used going forward if we clean up, and that's what I'd call it, a clean up, by getting these guys who are not willing to participate, getting, getting them out of the program. And if they do decide to stay, then the penalty is a soft cost they will have to absorb themselves.
