purpose before proceeding I'll set forth the purpose of this board the code enforcement board is charged with conducting hearings to determine whether a violation of the code or codes and ordinances of the city of Dunedin have occurred in order to meet that obligation all parties or their representatives will be allowed the opportunity to be heard on matters relevant to the alleged violation all witnesses offering testimony or presenting evidence will be required to swear or affirm that the testimony they offer is the truth the city through its staff will present the evidence its evidence of the alleged violation after the city has completed this presentation the respondent shall afford the opportunity to present its evidence any members of the board the person presenting the city's case or the city attorney may question any witnesses before the board the respondent or his or her representative shall also be permitted to question any of the witnesses before the board and present brief opening and closing statements if so desired the board will then openly deliberate considering only the evidence presented the law and common knowledge by motion duly made and seconded discussed and approved by at least four members of the board an order will be issued the order will contain one the findings of fact to the conclusion of law three from affirmative action to be taken the order will be forwarded to the respondent by certified mail we will now continue with our

board my name is rachel laurel city of dunedin co compliance inspector testifying in reference to case number 25-1650 the property is located at 554 baywood drive north dunedin florida at the october 7th 2025 hearing the board ordered a correction of the violation by october 17 2025 or a fine amount of $50 per day shall be imposed i inspected the property on october 14 2025 and also yesterday and found that the property was uh the violation was corrected so i am submitting the affidavit of compliance to the board for the board's approval thank you do any board members have any questions

somehow yeah thank you my name is brett krasman 554 baywood drive north dunedin florida uh i know you had a meeting in october and i spoke to rachel before prior to it but i was never notified there was never anything posted on my house i haven't been living there i was one of the worst house damaged it damaged in the storm and i'm not living there i'm not getting things things aren't always in the mailbox the mailbox keeps flying open and things keep you know ending up down the street so i was not notified of that hearing but the whole thing started i had to take the boat trailer out because i have to get the boat out but i was using it also to haul stuff on you can haul anything in a boat trailer with a sheet of plywood so granted the fact that i was using that trailer for other things i don't like the fact that i had to go and relocate the trailer but i'll accept the fact that you're gonna if you want to let this go we will but i will state the city has caused has caused several violations on my property and i'm sure you're aware of them uh but you guys might not be but it's in regard with mr stephen stone at 491 baywood drive north and uh just like to uh mention that

who is going to be speaking on that i am miss laurel yes okay good afternoon board members my name is rachel laurel co-compliance inspector for the city of dunedin i'll be showing a powerpoint presentation for the property located at 1209 royal oak drive this is in reference to case number 25 dash 1913 the respondent is klaus o scher his address and he resides at 1209 royal oak drive the zoning is single family home in the r60 zoning district number of violations are two of dco section thirty four dash one paren a environment offensive accumulation uh subsection a it shall be unlawful for any person to accumulate leave dump or store openly on any premises with a residential zoning classification any building materials automobile tires inoperable or derelict vehicles and any and all other articles of personal property which may be seen from the public right away or abutting properties for a period greater than three days unless the storage of such articles on residential premises is specifically allowed under other provisions of the code a second violation number is dco section 34 dash 32 premises to be kept clean a notice of offensive accumulation it shall be unlawful for the occupant or owner of any house yard store lot or parcel of land to refuse to keep the same clean or to permit any trash weeds or other offensive matter of any kind to accumulate in or upon such premises and such accumulation shall be deemed to be a public nuisance a notice of violation was posted to the property city hall and sent certified mail to the owner on october 1st 2025 with a compliance date of october 11th 2025 the certified mail for the notice of violation was signed for by the owner on october 7th 2025 this is my initial inspection on september 30th is showing the front of the house um there's an accumulation of items on the driveway is uh the cones other traffic uh device uh looks like trunk to a palm tree here is the side of the garage um that has a trailer with items on the trailer uh covered up with a tarp uh there's also pallets fence sections uh plastic containers this was on my initial inspection the day that i posted the notice of violation on october 1st showed um concrete bumpers to uh parking spots at shopping centers um other black rubber bumper items behind that concrete bumper cones uh some plastic uh item that's rolled up here's a closer picture shows uh wood um plastic containers coolers uh everything visible uh to the street on his driveway here's the side of the house uh showing the the same items uh the items under the tarp on the trailer fence sections containers here is a picture of my affidavit of posting and notice of violation posted to his front door here's a close-up picture of the affidavit of posting and notice of telling him the items uh needed it to be removed and that i was going to be scheduling him for this month's uh board hearing uh the items still look the same from my initial inspection uh on the driveway here's a close-up picture showing no change again the other side of the uh garage and here's the side of the garage on the pallets the items in the trailer uh here is a picture of the affidavit of posting and notice of hearing post postages front door and here's a close-up picture and here's a the banner page for the certified mail and next to it is the signature uh his signature showing that it was signed for on october 25th at 12 55. this picture i took this morning uh of the of the driveway there's more items um on the on the driveway here's a close-up picture still showing the cones uh the bed uh truck bed uh and wood uh more miscellaneous items on on the driveway and here's the side of the uh the garage he removed the trailer because he has fence sections on it and the items that are on the driveway and on the side or what what was on the trailer so there's pallets uh the brown item up against the garage looks like a shell of some electronic i don't know equipment uh the pallets and that's a inflatable boat um that was on the trailer here's another picture to the bottom of the picture you can see there's a pvc pipe those are the the wood posts he has a permit and that's the next case he's going to be installing a fence in this location um and there's the inflatable boat and uh pallets and other items on the side of the garage and now i'll leave it for
the board to deliberate okay so we have um two separate cases uh before us today um i think what i'm going to do is first uh offer board members an opportunity to ask you questions um and then sir you'll have an opportunity to speak and the same will be true for you okay yep so do any members of the board have questions for the city inspector i do please and chairman rolls for the board can you
take me back to the the slide that shows the the receipt for the initial notice of violation he said
that was sent on what date yeah that was mailed on october 1st and signed for on the 7th of october

the city lisa lisa hunt um am i allowed to ask him a question now yes directed to thank you am i um right in having heard you said that he is planning to put a fence up and has the permit yes okay that's
for his for his trailer that's the next case okay that's all i had okay thank you uh any other
questions from board members concerning this case has the uh have you had communication with chris
alexander sir before you speak say your name it makes it easier for the transcriber so she just
interested chris alexander has there was there promises to rectify it or to clean it up or anything
was there direct communication i communicate him uh with him on this case on the 20th we usually communicate with door hangers um we do communicate on the phone because there's been prior cases um at this location so this for this case i did leave him a door hanger and i told him that the items needed
to be removed there haven't been any conversations per se conversations yes i did speak to him later
he did call on that day on october 20th and i told him that i can't keep granting extensions i get complaints from the neighbors multiple complaints over the year and a half i've been here um for the
condition of the property were there any promises made or any agreements made about it not in regard to
this case i think he has health issues which is stopping him from i guess complying and i told him i have to take him to the board and get a compliance order so this way it can be cleaned i have an agreement with the neighbor next door that i could go on his property that's where these pictures are
taken at any time no i just went with the with the defendant but okay thank you yes thank you okay if no

sure 1209 royal oak drive dunedin florida i want to apologize to rachel i want to apologize to the board this year's been a rough one i had total knee replacement in february four and a half hour back surgery in march total shoulder replacement last month i'm waiting for my neck i have bone on bone on my wrists i have a really hard time getting stuff going needless to say i know it's been rough i had to wait two months to get all the supplies together because i'm on fixed income military and social security only i have everything i talked to a guy that's working down the street he's going to help me do the fence at cost which is nice of him and it should be rectified within the time allotted
hopefully like i said i really it's been okay you you you understand that the uh city's ordinance refers to trash and debris on the property right merely putting it behind a fence will not abate the
violation well you told me that if i put the trailer that's a that's the separate case we haven't gotten
to that case okay that we'll get to that in just a moment once the fence is up everything is going
to be gone i have another vehicle that's another thing i had my shoulder done last month and i had a bad car accident totaled my vehicle hence the seat belt ripped the heck out of my shoulder that put me
behind another couple of weeks okay so so the two issues that are before us now on this case or the offensive accumulation of the items that you saw in the photographs right are you saying that you have someone to help you remove all of that i have somebody that's going to help me put the fence
up and and help me remove stuff yet okay i have a big van i want to be loading up okay most of the stuff is actually fixable that i fix and donate to the sheriff's youth ranch i donate a lot of things after the storms hit people were throwing away good stuff which is a shame i'm german i know i can fix stuff even electronic stuff i took it and hosed it down drowned it let it sit on the driveway which is a bad thing let it dry out hoses it off again eighty percent of the stuff worked after that okay but you
you you understand that it can't be in the driveway invisible from the neighbors or the public way right everything is going to be gone okay does this does the city have a recommendation as to a date how much time sir do you think you need to do this hopefully within the month okay recommendation for
case number 25-1913 two violations of dco section 34-1 parent a offensive accumulation and dco section 34-32 premises to be kept clean of offensive accumulation requesting compliance on or before november 14th 2025 which is 10 days from today's board hearing for the owner to remove the offensive accumulation items or given the severity of the violation is minor i am requesting a fine amount of 150 per day for each day the violation continues to exist okay so what we have now is the respondent
saying 30 days and the city recommending 10 days for a compliance date do any members of the board have
questions for the respondent mr sure uh dan bolder is there anybody sir that can just come over and help you move the stuff to just get it put away neatly maybe in the garage i'm 70 years old yeah i got
neighbor that has teenage kids and they don't like to work i asked him told him that i was going to pay him a hundred dollars to help me move stuff around he said oh i'll be there shortly well he never showed up so this contractor showed up yesterday wanted to park in front of my house and i said yes as long as you help me pull the trailer up and if you have time to put a fence up for me and he said my brother-in-law is going to do it for you so i already have everything on the line okay like i say defined help i'm german i
like to do everything by myself well you can't do it yourself sir unfortunately because it's limiting you from picking up those heavy items and doing all that so the city's recommending 10 days do you feel that 10 days is enough time to move all that debris and this is aside from the next case which is the trailer we were just talking about the debris do you think 10 days is enough time i'd rather have
until the end of the month okay i don't have any questions any other board members with questions for
the respondent lisa lisa hunt um i understand what you're saying i'm also a veteran and i understand it's hard for you to ask for help but like the gentleman said you really have to i do and if you need to go to your your american legion or your vfw locally i guarantee they will help you so please reach out thank you sir get this done my recommendation is for december 1st okay before we get to a motion do

am i able to put my trailer behind the fence like it said right yes i have one issue i helped my parents build that house in 1978 when i got out of the military the new neighbor there's been a few new neighbors on that side on the right side facing the house and he put up his fencing and said his little fences on his side of the property and the trees that are there the hedge we plant it and he says no that's my property so i've been taking care of those hedges since 78 i have an issue can the city
come out just stay focused on i'm staying focused we're not about the hedge it's about the trailer it's
a big difference on where i'm going to legally put my fence is there a way the city can come out there and verify the lineage on it absolutely i think that he's encroaching yes absolutely when
you file for the permit you're you're required to provide a survey for the fence right okay and that'll state the property line okay someone from the city can come out and post and mark to make sure that both parties of the side of the fence that would be very appreciative because like i say i don't
want to put the fence in the wrong place because i'm putting it in with concrete yes so the the
inspectors that would come out after the fence is built they would also look at the survey that you provide when you when you submit the permit and it has to match that right right so if you need somebody to come out prior to make sure that the survey is accurate for me in the front but sir it's your
responsibility to obtain the survey yes well okay so technically i just go off that board and measure
it from side to side you would be best to have a proper surveyor do it he has walter sweetser do you
have you applied for a permit yet yes that's what i was going to say he has a permit he picked up his permit he's he's ready to build the fence so he provided what was needed he needs to go off of what was on the permit right as far as the location because you could build the fence in it doesn't
have to be right at the property line you could be a foot i mean you're you just can't cross the property line okay we have that permit we're we're getting away from the issue that's before the board
on this case which is the trailer well in order for example look one second before we continue the actually the the fence is important to this because in order to park the trailer behind the fence to be in compliance correct and that's the that's the point he's making is he may need additional time to obtain a survey to make sure that the fence is built in the proper place correct he has his permit
so did you provide a survey to the city yes okay so he has then we're good you need to just follow what's on your survey okay and your permit myself and then when you do a final they'll come out and they'll check and make sure that it's installed correctly otherwise your neighbor will be calling
like he has before okay maybe i can help move this along so sir how much time do you need to erect the fence and get the final inspection from the city the same as the property stuff so you're putting
up the fence yeah i like i say i don't know when this guy's going to be available to help me do it like i said i can't do it myself we we understand that if we're going to go forward we're going to
find that there is a violation and we're going to be giving you a date by which you have to correct debate the violation which is why i'm asking you as a courtesy how much time you think you need to get the fence in a month 30 days yes sir so if we use the same december 5th date that we used on the previous case on the previous motion please that would be adequate time for you it will be yes sir okay good okay um if there are no further questions i'll entertain a motion jeremy reynolds
i move in case number 25-1915 city of dunedin versus class so sure that the board find the respondent violation of city code section 105-27.1.1 subsection f subsection 1 and 5 relating to the dunedin zoning district design standards for houses and duplexes and storage of utility traders boats recreational vehicles and other equipment i further move that the board ordered respondent to bring the property located at 1209 royal oak drive into compliance by december 5th 2025 if the property is not in compliance by that date a final fine of 150 dollars per day shall be imposed beginning on december 6 2025 the cost of and the fine should not exceed the cost of enforcement and continue until uh compliance is verified the respondent would be ordered the contact code compliance office for re-inspection to confirm compliance with this order i so move thank you
a second oh council so just to because this is not your order your motion is not necessarily laura you need to speak clearly and loudly his mr reynolds motion is not necessarily the same as your template motion so just to make sure every board member heard specifically what his motion was he said the fine shall accrue daily not until compliance is until compliance you do not use until compliance is met i believe you use the language shall not exceed the enforcement cost correct correct so so the intent
is that 150 fine would run per day until compliance is met if he meets compliance within the time frame then than the total cost of enforcement the total cost of the fine would not exceed cost of enforcement
okay okay but maybe i can make this easier it sounds as though mr reynolds that you have drafted your your own motion rather than using the motions that have been prepared by council and put before each of the board members i think uh in the interest of consistency it would be best if you use one of the prepared motions um that is before the board rather than your own well chair i really didn't do anything
outside of what the format is other than to add that the fine should not exceed the cost of enforcement where that option is within discretion of the board but not represented within the template we either a need to make the template that's dynamic it'll abort that or b the template actually pins in the board and
doesn't allow it to extra flexibility okay the the the costs of enforcement are not a matter that this board has any jurisdiction over again we're not trying to take the cost of enforcement we're trying to
dictate the the amount of the fine which is within our discretion the the fine is a matter of statute
again if you cannot use the prepared motions that are before you i would either ask that you withdraw your motion use the prepared motion or i'm going to put it before the board for a second and we'll
see where it goes oh thank you thank you um board chair may i add uh mr ernell is within his authority to amend the motion so long as it properly identifies the case the property the location of the property and so forth uh just wanted to let the board know this motion is not the same as your template motion and it does create that maximum shall not exceed the enforcement cost so it does create that maximum of the accrual of the fine to them we don't know what the enforcement cost is at this time um you know it potentially may be lower than what we've seen before i just want to put forward that to the board because i think that was not noticed on the prior case um however you know once again the board is free to second the motion if it has support or and vote on it vote it down if it does not agree okay so where
we are procedurally is that we have a motion uh it contains language that is not set forth in the template motions that are before you uh it includes an unknown variable which is the cost of enforcement um i'll ask for a second if there's no second we'll move forward do i have a second i don't hear one mr reynolds what's your privilege do you want to use a prepared motion no sir i i i i respectfully uh
decline i think this board does have an onus to to limit the scope of those fines whenever there are extinguishing circumstances that was the purpose and intent and to to be chastised from the board chair for for trying to go above and beyond to to help an individual who's in a dire spot i i really don't
appreciate it thank you it was not my intent certainly would not wish to chastise you i i i respect the amount of time and effort you put into this um the problem is that your motion had an unknown variable which this board doesn't have control over we're a hearing body we're we're not part of the city we're not part of the enforcement process okay so we do not have a second i'll entertain

um take a look at the the written communication that goes towards um respondents and if we're not putting them on notice not to do ex parte communication can we add that piece to it could you repeat sure so so like when we're quasi-judicial board right so when somebody does like a development application they're put on notice hey this is what ex parte communication is please don't do this i don't know if that's present in our code enforcement process i just want to make a suggestion that it
should be okay we'll take that under advancement and we can propose a policy cool okay thank you
any other board member comments no um so 6ab would be city attorney comments laura you have something to
follow up on the memorandum that was yes sir i do uh we do have a finalized memorandum regarding the presentation from our october hearing um our city attorney is doing the final stamp of approval we are intending to share this memorandum with the city manager as we think it's best fit this is mostly beneficial for city staff and the city manager to have a copy of um you know our goal is to share this with you weeks prior to our december hearing so you'll have a written copy that's the goal right now i think most of you have my email so feel free to share any questions you may have once you get a good look and get to read that finalized memorandum but as of now we're working towards that final stamp of approval and we are hoping to share that with city staff and our city manager
