east case number 26-582 and this is a repeat violation i believe the third time the respondent in this case is matthew and kelly roell trust they reside at 1419 primwood lane in lutes florida 33549 and the zoning is a duplex triplex fourplex located in the mf15 zoning district there's one violation at this property it is a repeat violation for dco section 103-14.8.1 transient uses within certain zoning districts conditional use bed and breakfast intent it is unlawful for any owner of any property within the multi-family zoning districts of the city of dunedin to operate a bed and breakfast without obtaining a conditional use permit from the city's board of adjustment and appeal i posted the property in city hall with an affidavit of posting and notice of repeat violation and a copy was also sent to the owner of record on june 24th 2026 i received the certified mail delivery confirmation excuse me for the notice of repeat violation on june 26 2026 at 12 26 p.m i posted the property city hall with a notice of hearing and sent a copy certified to the owner of record on july 13th 2026 the mail was unclaimed and being returned to sender on august 1st 2026 at 9 40 a.m and i posted the property in city hall with a second notice of hearing because we needed to to postpone in senate certified copy to the owner of record on july 20th 2026 the mail was unclaimed and being returned to sender on august 10th 2026 at 106 p.m this is a copy of my repeat notice of violation that was delivered to an individual at the address this was a copy of the first notice of hearing that was unclaimed and being returned to sender and this is the second notice of hearing that is unclaimed being returned to sender as of today on may 6 2025 case 25-1279 was brought before the dunnean code enforcement board for repeat violation of code section 103-14.8.1 transient uses within certain zoning districts conditional you spend breakfast intent the respondent was not present the board found the respondent to be in violation for two days and was fined one thousand dollars and the fine has not been paid on june 23rd during a routine inspection on rentalscape i found on airbnb that they were advertising their property nautical landings west this is a four unit complex and they do say 90 day reservations however when you go to book it wants you to have a three night minimum stay so i i'm investigating them if you'll look at july they have that blocked out which it's booked but normally the whole year is blocked out so i would just like to take you to august you can see the 26th or the 22nd 23rd and 24th was booked if you look in september the 19th through the 26th in october you have the first 10 days the last maybe 14 days again this is a 90-day rental you can see their bookings in november and december i went to that page again and they had turned it off so i found them on vrbo nautical landings west and this was on august 10th 2026 again trying to book the property from october 12th to the 16th you can see it's the same listing with the arrow to the left it's one of four suites and nautical landings which can only rent 90 days or more and again it took me to the payment page for four nights i went on that same website this morning and tried to book the property from november 19th to the 22nd again confirming that these are the four suites and it took me again to the payment page um on this calendar it shows a different view of the calendars and how many times they have booked through august and september october this year november this year we've got december and they're already booking out into january february and march of 2027 and at this time i'll let the board deliberate do you have any questions sweet sir so am i correct that this was in violation back in 25 and that that fine was unpaid to date so a thousand dollars for this actual the same property owner we'll go back to 2021 um they became before the zoning board to try to have it rezoned when you're when you have a property on the causeway in this particular um street saint joseph everybody that lines the water is multi-family 15 so you're 90 days or more if you're more inland you're considered a tourist facility so you can have the option to rent the lesser than 90 days but he doesn't have that and they denied his request in 2021 i brought him back before the board on february 8th 2023 and he ended up complying i brought him before the board on may 7th 2024 there was a fine for four thousand dollars he paid that fine i brought him back before the board on may 5th 2025 he was fined one thousand dollars and that fine has not been paid alexander if i recall when he came up he was just apologetic oh it was a mistake right and very pleasant individual yes okay that was the same person the fine has not just a quick question the fine has not been paid but he has come into compliance from the prior case correct the 2020 25 um it changes and then he goes back into violation it's just non-stop again he's been to the board the 23rd 2023 2024 2025 when now we're in 2026 okay so he came into compliance at some point and now this is a new case that he's now in violation okay correct okay do you have a recommendation i do so my recommendation for case 26-582 violation being one repeat violation for dco section 103-14.8.1 transient uses within certain zoning it's you would need one person totally dedicated to this situation throughout the city i recall that conversation yes so i don't recall the outcome with their recommendations made to city staff okay well despite those recommendations city staff is still able to cite the violations and yes of course there might be some alternative ways that is correct okay seeking an injunction maybe that's kind of something that coming up maybe nuisance activity as well that can be taken administratively um but in the future correct those are alternative remedies available to them but code enforcement is still one of those um available enforcement tools and remedies per se of course um you have a date certain so essentially you know you they can do date certain compliance to assess the total fine or number 26-000245 respondent is iona capas resides at 180 milwaukee avenue dunedin florida 34698 zoned r60 single-family residential number of violations are two violations first one is land development code section 105-27.1.1.1.1 b1 i3 site standards for horses and duplexes vehicle parking standards all types required parking every residential house or duplex shall have two required parking spaces one of which may be inside a garage no parking is allowed in or on any city right of way or sidewalks and curb lawns second is international property section international property maintenance code section 302.8 motor vehicles an operative or unlicensed motor vehicle shall not be parked kept or stored on any premises and vehicles shall not be at any time be in a state of major disassembly disrepair or in the process of being stripped or dismantled a notice of violation was sent certified mail and posted to property posted to city hall and emailed to the property owner on 3-24-2026 with a compliance date of 4-3-2026 i received a certified mail confirmation for the notice of violation as being returned to the city on april 14th 2026 at 1 24 pm a notice of hearing was sent certified mail posted to property and posted to city hall on 7-10-2026 and then a second notice was sent because we had to to postpone uh the first hearing um was sent certified mail posted to property posted to city hall due to revised hearing date uh 7-24-2026 i received certified mail delivery confirmation for a notice of hearing for the first hearing date return unclaimed august 4th 2026 at 1 35 pm and for the second hearing date a reminder for redelivery august 1st 2026 at 12 pm here you can see the notice of violation that was sent certified mail 3-24-2026 and returned on claim to the city april 14th 2026 at 1 24 pm notice the hearing sent certified mail 7-10-2026 and then returned unclaimed 8-4-2026 at 1 35 pm this is the second notice hearing that was sent certified mail that was sent certified mail on july 24th 2026 with a reminder to schedule redelivery august 1st at 12 pm this is the property appraiser for pinellas county verifying her mailing address as 180 milwaukee avenue in dunyeden florida as you can see there is an unlicensed silver dodge caliber parked on the right-of-way grass on 39 2026 directly beside the no parking sign at any time as silver dodge a caliber parked on the grass with no tag present on vehicle checked with david and this this car is not registered to the property owner at all so an unlawful tag was placed under her wiper blade on march 10th of 2026 as you can see the front bumper is missing and it remained there march 12th illegally parked on the grass right by the no parking sign on the 18th of march i went back and the unlawful tag was removed and replaced with a pink note stating that somebody was interested in purchasing the car on march 18th vehicle remained illegally parked on the grass by the no parking sign on the 23rd the vehicle remained illegally parked on the grass with the no parking sign then the night of notice the violation was posted to the front door march 24th of 2026 and on that date march 24th 2026 you can see that the vehicle remains illegally parked on the grass beside the no parking sign and the pink note was removed at this time april 1st 2026 the vehicle was moved to an unkept gravel area beside the neighboring driveway april 13th vehicle remains unkept on the unkept gravel area and now has a cover on it april 22nd vehicle remains in the unkept gravel area with the cover on it april 30th 2026 vehicle remains uncovered and in the unkept gravel area again on may 13th the vehicle remains on the unkept gravel area may 26th it remains may 29th still parked in the unkept area june 19th it remains so a notice of hearing was posted to the front door for july 10th of 2026 and you can notice the front of the home uh were showing the posted notice of violation and the notice of hearing nothing was removed from the door and that was july 10th july 10th a vehicle remains covered on the unkept graveled area july 15th it remains uh covered on the unkept graveled area remains unkept on the unkept gravel area july 22nd so the notice of hearing uh was posted to front door july 24th of 2026 that was the second one july 29th the vehicle is still there as you can see it hasn't been maintained i went back today and took pictures for updated uh the the vehicle remains covered on the unkept gravel area property is also overgrown and this is august 11th and this board for the same thing uh by by uh previous inspector mr kepto um now when i spoke to the engineering person david schultz he said that she was told she could park there but it had to be maintained on a regular basis and contained well at the time in 2018 it was done and it it was done she put gravel down she did not contain it um and it hasn't been taken care of since so it's been overgrown i mean she just keeps running back and forth there's a um in the front portion there's a water meter of some sort for a sprinkler system that just keeps getting well obviously the car's not moving you can see by the pictures that i had so i mean all the city wants her to do is get a tag on it get it registered with the state and she can park it there but she just has to maintain the area um and put new gravel down and contain it that's it that's all we need her to do so yes okay thank you do you have a recommendation i do thank you my recommendations for case number 26 dash 000245 for the number of violations being two land development code section 105-27 uh 0.1.1.1 parenthesis b parenthesis 1 parenthesis i parenthesis 3 site standards for housing and duplexes vehicle parking standards all types and international property maintenance code 302.6 exterior property areas motor vehicles requesting compliance honorable for july 28th of 2026 or given the severity obviously not july um august 2026 or given the severity of the violations is minor i am requesting a fine on the amount of 150 per day per violation for each day the violations continue to exist okay board members i'll entertain a motion clarification sweet so it's august 20 yes my my apologies typo yes okay august thank you so is it 150 per day per violation because there's two violations yes okay thank you got it okay i can make a motion jillette so i move into case uh 26-245 for the property located at 180 milwaukee avenue fine respondent iona campus in violation of the city don't even codes sections ldc sec 105-27 1.1.1 b 1 i 3 and ipmc 302.8 to order the respondent to come into compliance by august 28th 2026 um if not compliance a fine of 300 hours will be imposed until uh per day until compliance is met the respondent is ordered to contact the code enforcement the code compliance officer for re-inspection of the property to verify compliance with this order just so we're going to need to specify that it's 150 per day per violation just to avoid any confusion because it is a 250 mats but you can you can do them per violation but it's still 250 mats so we don't want to avoid that confusion of the 300 um being above so just if you would like to amend yeah just propose a friendly amendment to violation so just be like amend the 300 to the 150 per day per violation okay i'm making that i'm making
