Here. Vice Mayor Harriet. Present. Mayor Avila. Here. This time I'll turn it over to Commissioner Avila Vasquez for the invocation and the Pledge of Allegiance and honoring of the veterans. Thank you Mayor. So I'm going to ask everyone to please stand and have a prayer or a moment of silence but please do prayers because we really need it. Thank you. Thank you. I gave you a minute a little longer but I have these two wonderful young ladies in the back who want to volunteer ask me if they could do the Pledge of Allegiance so if they can come forward and lead us into the Pledge of Allegiance. The mic is on for them. We don't have anyone right now to sing the National Anthem but I'm hoping that everybody joins us in singing the National Anthem. I'm sorry Mayor. Anybody want to start it? Oh say can you see us. We can have the commission go to the floor so Maritza or Commissioner Avila Vasquez can honor the veterans. Thank you everyone for that. We need more of that right? We need that more unity working together and you know doing things together here in the city of Deltona. So today I'm not going to read their bio. It's a pretty big one. It's two of our veterans and it's a love story. It's husband and wife. You know me Christina. So today I am just going to read the certificate of recognition and the first person I am going to call up is Dr. Christina Raimundo. Dr. Christina Raimundo, Sergeant U.S. Marine Corps. In recognition of dedicated service, sacrifice, and commitment, deep gratitude is extended for your contributions in defending and protecting our nations. We thank you for your service. Okay that comes later. This time we're going to go ahead and enter into additions and deletions and I have an addition. I have an addition for city attorney. I like an update from over Lucia County Councilman on some of the projects he's been working with some of us up here on and some he's been doing in the city. If that's the pleasure of the commission. We'll go to the super student awards for the fourth grade period of school year 2024-2025 and if I can please have the commission again follow me to to the floor. As that's happening, I'm going to start calling up our first presentation for the first annual Best of Deltona Readers Choice Award Gala, Mr. Joseph Hearn, who knows that he has a time constraint, and you still have some time because they're waiting for the kids to step up. Okay. Perla, the floor is yours. Good evening, Mayor, Commissioner, City staff, and everyone here today. My name is Perla Bello-Crosby, founder and publisher of my Deltona magazine. I'm honored to be here tonight to present an exciting new community event, the first annual Best of Deltona Award Gala, celebrating community excellence. Let's talk about the event. This gala, we honor the people, places, businesses, volunteers, and organizations that made Deltona a vibrant, growing community. It's more than an award ceremony. It's a tool to support small businesses, both Deltona's visibility and strengthens local pride. And importantly, it's bringing people together across sectors, business, non-profits, and community groups, to collaborate and celebrate Deltona's success and expansion. With nine years of success with the Best of Samford Award, this gala has spent our mission to recognize excellence across Seminole County. We celebrate downtown Sanford, Seminole's top businesses, and Sanford industry of the year. Now, Deltona, small businesses, and professional, we've had the perfect opportunity to be recognized for the impact and contribution of the local economy and community development. As the founder of this quality publication, I'm sorry? I think you can go to the next slide. Oh, I'm sorry. Yeah, I'm sorry. So, first off, first off, good evening, Community of Deltona, Mayor, Commission, amazing city staff. I'm just here because I worked with Perla on this event in Sanford for many, many years. And what I like about this event is it really focuses on some of the things that I hear many of you commissioners focus on, many of the city initiatives to really just promote positive, economic, smart growth in our community. You know, Deltona often sometimes gets a bad rap. People think we're just a bedroom neighborhood and there's just nothing but residential. There's no commercial. Well, this is an opportunity to really uplift and really recognize the amazing businesses we have in our community. From Elco Key, Kelly's Automotive, My Greek Taverna, Deltona Trophy, State Farm, Cocky Rooster, J&J Security, so many more I can't even name them all. Independent owners, CPAs, insurance people that really are a big part of our community that service this community. And it's an opportunity to give them recognition that could potentially bring people from over the bridge from our sister community to support their local business here, help the economic influx right here in our community. Along with our major corporations, Halifax, you have held. We have a major hospital right in our community that should be recognized, that should be brought to light as well as involving so many of our nonprofits. That's one thing Perla is doing is, you know, as we all know, I'm a part of the Rotary. She's collaborating with the chambers, a part of our local chambers, and we also have so many nonprofits that— Thank you, sir. Okay. Can we give them a couple more ministers to finish up? Thank you so much. I don't know, Joe, just for full clarification. Thank you. That must have been an inside joke I was not aware of. Listen, no worries. I love the carpet, too, by the way. So, needless to say, she's also making a point to really involve our nonprofits. You know, we have so many organic nonprofits that have started right here in this community that do so many amazing things that really bring the heart of Deltona together as a community, from our Rotary Club that meets right at the center, to our local chambers, to VHA, to so many great organizations that really help support all the great things that we do in this community. So, it's an opportunity to really put Deltona in a highlight position, really bring all the notoriety that Deltona deserves, and some of that positive energy to really help our small businesses, help some of our nonprofits, and really help our smart economic growth and get people to say, hey, they have 100,000 people almost over there. I want to open a business in Deltona because they take care of their businesses and because I see the highlights that they give them. Thank you so much for your time, and I hope we can bring this to Deltona. It's spectacular. We have some questions. Commissioner Villabasco is on the board. Thank you, Mayor. You answered my question. My question was going to be who benefits from all this, and you answered it by saying our local businesses. You know, we have so many businesses here in Deltona that a lot of residents don't even know about. I, for one, in my district, on Deltona Boulevard, probably is the biggest business area in the city of Deltona when it comes to restaurants, real estate offices, and different stuff, medical offices that are opening up. So I think they're going to love the idea that they're going to be recognized and put in the spotlight. And I got to say this, but I was honored to be the one to unveil the first Deltona magazine in Sanford when you guys put it out. And it is a beautiful event, and I'm hoping that we can bring that here across the bridge as sister cities, Sanford and Deltona. For those of you who don't know, we have been sister cities for almost maybe 12 or more years to share things together. So this is, I think, one of those steps that we should have been taking a long time ago. So thank you for the presentation. It was really great. Commissioner Santiago. Thank you, Mayor. Just want to say a few words to Perla and Joe. Perla, my Sanford Gala is an amazing event. I heard very positive information on the gala. And to bring it here to Deltona, I want to thank you, not only as the founder of the event, but to bring it here to Deltona, to start my Deltona magazine, to promote our businesses. You know, this sends not only a message to our current businesses, but our future businesses that are here in Deltona that we need, the positive impact that that will make. So, and Joe, thank you. You know, Joe, thank you. Thank you for always being there for our community. I really mean that. Thank you to the both of you, and I think this is a great opportunity to show our businesses, our future businesses, and I'm excited about it. Thanks. Only thing I can add is I've gone, I believe, two years in a row now. And we actually have some businesses that get awarded on the other side of the bridge. El Coquille, Rivera, Chiropractic, just to mention a couple. And every time they see me over there, they're like, Mayor, when are you guys going to, you know, give us something like that over there in Deltona? So I'm excited about this. So thank you guys for thinking of Deltona and making this a reality. Thank you. Thank you for your time this evening. Thank you. All right. Now it's a presentation. All right. Next, we're going to go ahead and do the presentation for Love Your Heart 5K. It's a check presentation to the American Heart Association. Do I get 10 minutes, too? All right. So earlier this year, the city of Deltona, we organized the Deltona Love Your Heart 5K. And so today we are presenting a check to American Heart Association. And we could not do this without our presenting sponsors, all of our sponsors, in fact. And they are amazing. They are returning. So I just want to give a big shout out to them. We have West Volusia Tourism. We have West Volusia Runners Group. We have the city of Deltona, Runners High Racing and Management. And we have our primary sponsor, which is Halifax Health Medical Center of Deltona. So very quickly, before we present the check, I just want to say thank you so much for all your consistent support. And Ben would like to say a few words. Well, thank you very much. And thank you, Mr. Mayor and commissioners, for allowing us to partner with the city of Deltona as the presenting sponsor for the Love Your Heart 5K. It was a great event. I ran it with a couple of my kids and loved running it with the mayor and his kids, too. And it's great to partner with the community to promote these activities and to raise funds for the American Heart Association. So thank you very much for allowing us to do this. And we look forward to continuing to do this going forward. And I'll concede the rest of my time to make up for Joe. I just want to quickly say that we appreciate you so much. This is the second year. It was a wonderful event. It was very cold, but it was a wonderful event. And I just want to thank you for supporting the American Heart Association, you, the city of Deltona, as well as Halifax Health. And I can't wait for next year. Thank you so much. All right. We had 283 runners out there on that cold and chilly morning. We did have hot chocolate available. So it was a great day. And we had plenty of smiles, awards, cowbells, and chocolate milk that day. And whereas it is the year 2025 marks the 65th annual National Public Works Week sponsored by the American Public Works Association. Now, therefore, we, the Mayor and City Commission of Deltona, Florida, do hereby proclaim March 18th through 24th, 2025, as National Public Works Week. In the City of Deltona, we urge all citizens to join with representatives of the American Public Works Association and government agencies in activities, events, and ceremonies designed to pay tribute to our public works professionals, engineers, managers, and employees, and to recognize the substantial contributions they make to protecting our national health, safety, and advancing quality of life. patching up some of the the streets the roads sidewalks cleaning up our mediums they're the folks that keep the city really running so big congrats and thank you guys for all you do katherine could you put the mic toward you please sorry there's a couple memorial day events that i want to tell you about that are coming up so on the 24th that is the saturday before memorial day vima is is holding their second annual memorial day motorcycle ride so you can sign up now you can sign up day of the event registration day of events starts at 9 a.m kick stands up at 11 a.m this was a huge event last year i think over 100 motorcyclists participated so that's that's a really fun event so come out and participate if you if you all motorcyclists are welcome and then there's memorial day ceremony on memorial day uh that's vsep is is uh is holding that that's going to be at veterans park uh 10 a.m so this is a great way to uh honor of veterans on memorial day so and then as always if any community uh uh organizations have any uh events going on just let me know email me cbarker at beltonafl.com and i can mention them here okay thank you katherine uh hold on is there any questions for miss okay somebody was on the board they took it done that's fine all right at this time we're going to go to the consent agenda item request um there's two requests on the consent agenda item and at this time i'll entertain a motion and attend commissioner cole can you please go ahead commissioner cole i have a question for the attorneys first before i make the motion okay um this group that has brought this item before us are they part of the lawsuit that they just presented to the city uh are you referring to the consent agenda not the consent agenda but the ordinances and public hearings we're in the consent agenda item all right we have pages backwards again go ahead commissioner i'll move to approve the consent agenda a and b as presented okay there's a motion by commissioner lally second it's a second by commissioner uh santiago um mayor just a reminder that you do have to take public comment on this item i was getting to that point is there any public comment on the consent agenda no sir okay now can we vote please vice mayor they're waiting on you motion passes six to one this is your one warning your one and only warning okay this time we're going to go into ordinances and the only uh that still stand okay thank you um i only have to disclose what i disclosed at the first uh hearing for this item thank you commissioner powell i the same like has conversation before the last meeting have had nonsense commissioner rila vasquez um i had a conversation with one of the residents uh that lives in the area it had part of the conversation on email so that's i can't remember their name but that was commissioner howington i talked to jordan smith and doc about a question and i believe robin hayes was there nothing commissioner outside of what we had in the last meeting commissioner santiago same i had a conversation with jordan today i spoke with the developer mr scott banta and uh spoke with resident mary hoover on firwood along with the petitions that i received from the group that lives on north firwood drive thank you vice mayor harriet i have no new no new ex parte and i have no new ex parte either so at this time if the city attorney can do the swearing in yes mr mayor at this time i will swear in any person who wishes to testify on any quasi judicial item so please stand if you are able and raise your right hand do you hereby swear or affirm to tell the truth the whole truth to help you god you may be seated all right this time we're going to hear mr jordan smith with his presentation of staff report and then we'll go to commissioner questions nice and i'll also read the ordinance by title into the record this is ordinance number 12-2024 in ordinance of the city of deltona florida amending the official zoning map to rezone plus or minus 36.46 acres of land located along the north normandy boulevard corridor south and east of the i-4 logistics park within the activity center from single family residential r1-aa to mixed use planned unit development mpud providing for conflicts severability and an effective date and this is second reading good evening mayor commissioner city manager so ordinance 12-2024 passed to first reading and after the mayor commission feedback three key revisions were done in the development agreement these include 160 foot setback between the multifamily buildings and the existing residential neighborhood to the south enhanced storefront design for for walkability and routing semi-traffic away from residential areas and staff is requesting we've spoken to the applicant that um we add big box retails permitted use in the development agreement other than that there's been no other changes between first and second reading all right i know commissioner calwell is on the board with a question and so is commissioner santao commissioner calwell we'll start with you this message is for the questions from the attorney um it was brought to my attention today that there may be a lawsuit against us by the same group um so i believe that the property owner is part of a another lawsuit um that was served on the city uh a few weeks back um related to uh another legislative item that was a zoning in progress it does not specifically relate to this item um so the commission may still move forward with this item if you so choose can i make a motion this time to take because it's a quasi-judicial meeting we have to go through the process but i will when the time comes i'll make sure i call you first i have to follow the quasi-judicial islands commissioner santiago then commissioner harlington thank you mayor yes i have been in contact with um some of the neighbors um on north firwood drive and i know they had some concerns regarding the development being close uh north firwood drive is right next to the development um they were concerned about having sidewalks on north firwood drive um we talked about um one of the main concern was the speeding um we did i did contact sheriff chitwood and captain ignite in regards to the speeding and i know they're going to increase patrols and the use of electronic speed sign to help deter um the driving there um one of their other concerns that came up was ruth avenue access if the development in the american the area moves forward um i would really like to advocate for ruth avenue not to be used as an entrance or exit for the new development um and i believe um when i spoke with mr banta earlier today he was in agreement to putting up a barricade there would be there and i'd like to enter that into the developer's order as well among the other items that we had discussed previously in protecting that area so thank you mr howington my question is specifically for the attorney um i am concerned if this particular parcel is listed on the lawsuit that's my concern okay the so the applicant can you speak to that just so this particular parcel is not i don't want to make you walk up if you can just yeah so we have i have no knowledge of any any of any involvement that we have in any action uh in the city at all all we're doing is trying to get it to me city attorney can you clarify this uh so i will of course um defer to the the applicant and counsel for the applicant um on their involvement in another legal matter um it's my understanding that the that they are they are listed as one of the interested property owners in that action uh but certainly i have not i would need a moment to double check whether the parcel numbers match okay so while um if there's no other questions for jordan hold on hold on if there's no other questions for jordan at that time then um there is a moment for the applicant to do their presentation uh commissioner vila vasquez do you have any other questions for jordan um well no for legal okay thank you jordan you can ask legal while mr banta comes up if you like so um zach the um the owner says that he has no knowledge of this lawsuit but the company is part of the lists that we were presented or that we were um with the lawsuit that we were um served with the lawsuit i'm a little bit confused here so if you will allow me a moment um as your colleague had also asked i'm going to be double checking the parcel numbers that are listed in the litigation with the parcel numbers that are listed as part of this application and i'll be able to provide you all with a a more comprehensive and accurate response okay because the name is on the list the name of the developer is on the list that is uh that is my recollection if you as i said if you'll please allow me a moment sure thank you appreciate it we're going to give uh the city attorney a few minutes if you wanted to start your presentation and then i know i have commissioner howington and the commissioner caldwell back on sure thank you scott banta 1111 north ronald reagan boulevard longwood florida i'm here just basically tonight to agree to the terms that we discussed with the last meeting with for the developer agreement and then also say that we're happy to design a wreck to pay for and maintain a barricade across ruth avenue on the north side of south avenue so that there's no through traffic there we haven't totally agreed to not go on ruth but we've agreed between mcbride and south avenue not to have any activity our apartments will go out to ruth up at where mcbride is and then potentially go straight up to rhode island there or possibly further to the east that's still to be to be determined um i can assure you that i'm a hundred percent i'm a partner in the deal and i'm a hundred percent responsible for the day-to-day activity and i have not recommended suggested or had any involvement in any activity against the city at all as you know i've been working on this for about five years now and everything that we've done is in cooperation with the city so it's a name warranty parts solution have got on there i have no idea how that happened the owner listed owner of our 18 or 16 or 18 properties is this warranty parts solution and we have all of blocks one through ten all the lots in blocks one through ten so it's pretty easy to to figure out whether or not we're part of that or not and uh bob coals as you know is our attorney and um i'm not sure we haven't hired any other attorneys for anything i see uh mr good is getting ready to say something go ahead yes um double checking now and um the as the applicant stated they are their llc is not listed among the uh the plaintiffs and the other action so still going through there's a lot of parcel numbers um but the applicant as they've stated they are correct um they their llc is not listed as part of the action okay commissioner howington and commissioner colwell so just to confirm as this is a hearing and you have sworn that you would essentially be honest with us that so you're affirming that you are not suing us with relationship to this parcel uh yes ma'am okay um and i would like to thank you because you did make the changes that were requested in last hearing uh yes we we agree to those plus the addition of the uh barricade okay and that's all that yes we live with the additional roof thank you very much commissioner colwell then commissioner vila vasquez there are how many uh properties are affiliated with this group that we're trying to develop on the 36 acres are any of those parties involved in the lawsuit so as the applicant stated the property owner is warranty parts solutions warranty parts solutions is not listed amongst the plaintiffs and the other legal action i'm still going through the process of double checking the the parcel numbers just to make sure there's not some sort of scrivener's error it would appear um and this is for the property owner so you you're the owner of the entire 36.46 acres a warranty part solutions llc is yes sir um you had mentioned our emma santiago had mentioned that you were going to put a barricade up on roof avenue in the last presentation you gave to us you said that you were going to divert all the semi-traffic around through heaven how will that affect the semi-traffic it doesn't affect it at all you're still going to have access into the all the semi-traffic is going to come in off road island off road island yeah commissioner vila vasquez thank you mayor so rhode island comes out to normandy boulevard yes ma'am so are you going to follow the same traffic route as amazon um yes ma'am so because i passed by there the other day well i always have that's the only way i can get around here um and i noticed that coming out of rhode island you can make a left onto normandy yes you will be able to make the left ultimately that's going to be a very large intersection right but that's the problem so when you make a left you're going to be driving through residential area and you're having um business trucks and stuff going in and out of there because you're going to have warehouses how are you going to restrict these trucks from making a left and traveling through the residential area amazon their trucks when they come from their trucks go in and out of the graves they cannot go down normandy to saxon although you do see one or two that disobey the law um but having that left turn onto saxon boulevard i mean normandy boulevard will take him onto saxon and i know that um amazon has said to us that it's a gps problem that they're having sometimes the gps takes the trucks out on exit 111 and then turns them into saxon boulevard but how are you going to prohibit these trucks that are coming out from these warehouses to travel through our residential area on normandy because from that point on from where you're building to saxon boulevard that's all residential i understand we're going to have the same traffic issue as amazon and i think what we can do is work with your staff and with the sheriff's and the sheriff's department to have a signage that say you know trucks have to come out turn right and go north amazon has 97 truck wells on the south side of their building that are going to come out to that same little intersection and and they're going to be requested or they're going to be told that they cannot drive down that normandy boulevard as well well yeah i obviously can't control that but we can control as best we can with signage well we're expecting you to control it it's wear and tear on our roads and it's a nuisance to our residents that live down normandy boulevard um i can tell you since i've been been a commissioner there has been like four real horrible accidents on normandy but around that area where there's the curve for some reason drivers love to go into other people's garage and their cars wind up in the garage so i can i don't even want to imagine these trailers uh making a fast move and winding up in one of the houses that's what i'm saying a lot of you know normandy has more residential than it has commercial so i mean that's something that i would love for you guys to make sure that as as we've been very cooperative with the city in the past we'll be happy to do whatever we can to control that traffic and and have those trucks go north um as best we can um i can't stand out there you know pointed a truck that may go south once in a while like you said but we can have certainly the sheriffs aware of it and potentially have uh posting you know the sheriff out there on occasion i don't think we're going to have a lot of big trucks we're not going to have nearly the amount of semis that that um amazon has we will have some but we can we can control all of that including amazon is going to have to control their trucks coming out of there too what are the chances of us putting a city manager what are the chances of the city of deltona putting a sign from that point on saying no commercial traffic or no trailer traffic around there we'd have to work with the sheriff's department also to make sure that we have the legal authority to do that but certainly green to handling uh turn only would be acceptable i'm sure very much and we would be happy to pay for those signs thank you sir commissioner lowey thank you mayor um i just wanted to piggyback on commissioner vila vasquez's point um i think and it's i can name markham orange boulevard there's a couple in seminal county where they post um no through truck traffic so it's only trucks that are making local trips to destinations within like a delivery to someone's house like a you know amazon delivery so that was just going to be my suggestion as well if we posted that um and i think because it's our road we other places do it i'm pretty sure we have the statutory authority to do it we just have to put the sign in order for the sheriff's office to enforce it so um i would uh be in favor of that as well and we'd be happy to have uh jordan add that to the developers agreement in in the traffic section of the da so that that's covered all right uh at this time we're going to go ahead and go to uh presentation from people with standing mr mayor people that are on this list if i may prior to opening i would like to circle back to the question regarding the the applicant and involvement in litigation we've looked through the the parcel numbers um the none of the parcel numbers in the litigation match with this applicant or the application before you so definitively for the record there's no involvement there is one parcel where the uh numbers are very close one off um which i think may have generated some of the confusion got it thank you is there anybody with standing city clerk okay in that case we'll go ahead and open it up to public comment kathy bryan please thank you mr banta good evening kathy bryan um well i know this is only a request for rezoning in this area and you guys have made a lot of requests for modifications and everything one thing that i'm wondering if the developer otherwise would be willing to do and i'm glad mr bodgett had brought this up earlier because this is exactly why i signed up to talk on this but um you know as we put these places in there's not no reason why we can't encourage them to use native plantings maybe nobody cares about that but it's very important because we have water issues how many times have we run out of reclaimed water when we've had drought drought times not only well natives and specifically zero escaping which is the use of plants that are used to dry arid environments which ours can be um maybe not necessarily we get humid but in the springtime it can be pretty bad these will require less pesticides which are damaging our waterways so we're less watering and less maintenance for the people that live there the maintenance crews so if the developer thought it might be a good idea i would love to see them implement that in in the input area if you guys approve the rezoning thank you dana mccool she stepped up that is public participation all right at this time we're in the section where we can call for a motion in a second before we do the final discussion so commissioner uh colwell you wanted to be an applicant can we can we not handle him hand him a microphone that's so he's not trying to mr banta you can stay right there it's fine katherine he just put that microphone on the howington and then there there was in the commission i got you i just wanted to ask mr banta if he would be willing to put into the development order to incorporate native plants into the landscape commissioner um santiago so we could give them the courtesy of listening to their uh comment we appreciate it okay only because we're in the middle of a quasi-judicial commissioner of vila vasquez is that could is there an issue with that um you may reopen the the public comment um and these applicant these residents um because of their proximity i'm not sure if they have standing but they may be would have been in that radius and received that letter if that's the case then it is uh recommended that you should okay just to confirm i want to make sure because if they don't know when they're supposed to speak did we do are we making sure we mail this out to the people with standing jordan okay sir where's the gentleman that wanted to speak if you can please come up to the podium you might know we're we're already in the overpopulated area okay a lot of residential everybody drives in the afternoon there's a lot of traffic coming in and out of there there's cars flying up and down north verywood already as it is for the local traffic you're talking about adding now how many units no how many units are we talking about adding i'm in multi-family i i'm in the business of multi-family how many 320 how many stories are we sir we're not you're not allowed to redirect to well what i'm trying to say is you're you're talking about evading people's privacy that live on furwood avenue you're talking about putting monstrous buildings that takes away from the site that we actually purchased our properties to have we wanted that wilderness we wanted the woods back there we wanted the wildlife that walks through there that's what we wanted that's why we purchased our property there on north for on ruth avenue there's two houses that live that are on that corner right there that have access to that street the only reason we go there is to go get into our driveways on ruth avenue it's two houses me and my neighbor i don't want a bunch of traffic flowing through there now suddenly he's talking about the barricades but he's talking about he's not clarifying on what he's going to where he's going to do the barricade where he's going to put it how far how far up on roof you know we're not talking about you know like my neighbor has a pool he wants to be over there with his family has a fence around his yard he doesn't want his privacy invaded by somebody looking down on top of his property so are we really considering the impact that we're going to have in our community versus the tax dollars that's coming in that's what i really want to know i mean that's it that's all i have to say vice mayor harriet were you just sorry were you done commissioner real bascos yeah okay vice mayor harriet first uh thank you for letting the residents speak i think it's important especially for this um also uh mr banta if you don't mind last uh at the first public hearing uh at the last meeting you explained the buffer and the distance between the building and the property uh can we can we explain how far away that's going to be the setback and what's going to be there vice mayor there's going to be 160 foot buffer between the multi-family and the residential to the south we had talked was it just 60 just to 60 feet 160 feet 160 feet yes okay thank you there's no other questions um mr banta just out of curiosity and i know we already did the the ex parte are you is your is your company the only one that's helping with this project right now are you getting any assistance at all from a consultant or anything like that yeah we have various consultants we have civil engineer we have a traffic consultant who did the traffic study that you've all probably reviewed um we have uh geotechnical consultants environmental consultants all of that's done by the way okay so we're clear and environmental we're clear on um the uh the traffic still being reviewed by the city um and we're also working with the county to do an extension of the water line so that there's a loop out to normandy so we're trying to facilitate all this that's what i was trying to get to is uh the traffic portion still hasn't come back correct jordan traffic still being reviewed manner okay so this time there's a motion uh the commission has discussed uh there's a second on the floor so we're going to go ahead and go to a verbal rote uh by the city clerk commissioner i'm still i still have some concerns with traffic and reports are still not in i believe this was uh possibly uh put into a little bit into hay so my answer is no motion fails pushing fails no hearing yes mr mayor uh this is ordinance number zero nine dash twenty twenty five an ordinance of the city of deltona florida amending the general ordinances article eight rental properties of chapter 22 businesses to provide a regulatory framework for short-term rentals consistent excuse me county councilman i hate to call you out but i need to be able to hear go ahead zach uh amending uh excuse me uh providing a regulatory framework for short-term rentals consistent with florida statutes updating definitions and updating the process for business tax receipt applications inspections and approvals providing for conflicts codification severability and an effective date this is second reading between first and second reading there were some changes made by the planning staff in coordination with the fire department and the fire inspectors to clarify some of the regulatory authority and add terminology relative to uh high risk occupancies which is a defined under florida statute and uh provide for additional infections okay at this time i'll entertain a motion before we begin discussion there's a motion to approve by commissioner colwell is there a second a second second second by commissioner lally jordan mr mayor um good evening so staff would like to make another amendment to the proposed regulations um in terms of the vacation rentals would like to reduce the required re-inspection interval for registration for vacation rentals from five to three years um this will help ensure continued compliance with property maintenance life and safety that's the only other change that steph has recommended okay is there any questions from the commission commissioner lally go ahead oh i'll withdraw my second if you want to amend that i can't hear it that's with so that's with the reduction time between the inspections from five years to three years is that what it is so we're going from five years required inspection from five to three years correct to be consistent with the long-term rentals i'm still good with my motion okay so there's still a motion by commissioner colwell and i'll second the change and there's still a second by commissioner lally commissioner howington you're on the board i spoke to you the other day about potentially increasing the inspection fee because there was a discussion of potentially starting it out at fifty dollars initially and then increasing it in a matter of just a few months from now if there's a potential to increase it in a few months should we start that from the beginning at an increased rate rather than starting it at fifty dollars and then increasing it because this is for-profit business within our community because once we implement i don't know that i want to revisit in two or three months to raise the price again so mayor um what commissioner howington is referring to in ordinance section three we have some interim fee um schedules um established so the fee for a long-term rental license fee is three hundred dollars the long-term rental inspection fee we currently have at fifty dollars the vacation rental certificate of registration fee is three hundred and the vacation rental renewal registration fee is 150 amendment certificate of registration fee is 50 the vacation rental inspection fee is 75 dollars i mean right now we have it at 50 um and these are pretty consistent with what other municipalities currently have on their books and the concern that i have was that it wouldn't be enough to cover the cost of the inspection for the pay for the employee as well as accounting and things like that that go into management of this inspection process this is the second reading correct correct so i think staff's recommendation would be to raise the long-term rental inspection fee from 50 to 75 dollars and the vacation rental inspection fee from 50 to 75 does that cover what commissioner howington is requesting that should cover yes okay commissioner are you finished commissioner howington we have commissioner vila vasquez and then we might have to amend your motion and you're gonna withdraw your second so go ahead commissioner vila vasquez who are we charging these fees to the renters or the owners it'll be the property owners property owners yes correct and um so as we know a lot of the houses rental homes here in deltona owners are not local they're out of state and um i know that we currently have a problem when there is a problem with a rental notices i give it to the renter and then when the owners are faced with a penalty charge they have no idea what they're being charged for because their letters never reach them how are we going to keep track that these um notifications go directly to the owners of the house even if they have a managing company local so commissioner that's a great question um we will be working with the firm um a company that currently does our um foreclosures and vacant properties and they also do um rentals as well um they will help us manage that program um and ensure that the property owner or management company is responsible for any violations so manage their management company in addition to the owner themselves will be notified of whatever so someone's gonna have to register the um particular unit whether it's the property owner or management company uh but we'll be working with um a separate group to manage all that and we get uh commissioner lally to withdraw his second and commissioner colewell to amend your motion please withdraw i have a question before please go ahead jordan at what rate will increases increments happen every year is that the 75 dollars the bottom and then 150 the ceiling for example these are one there's no rate increase so we're not going to raise it every year is with the consumer price index it would only be raised um upon the commission um amending the fee resolution which will come to the commission um in a couple months i amend my motion to include the uh rate rate start at 75 dollars as discussed there's an amendment by commissioner colwell i'll second that second by commissioner lally is there any public comment gene armstrong please thank you um i am gene armstrong and i am the um broker owner of century 21 armstrong team and also i am the president-elect of the west volusia association of realtors the legislative committee and i am also a property manager it has been some time since i've been up here uh to speak to this issue it has been brought up before in a little bit different form this um if i'm not mistaken was originally supposed to be for vacation rentals and short-term rentals and now it's uh grown with an amendment to include regular rentals uh any property manager that's worth anything keeps an eye on their properties and excuse me and if they don't shame on them because that's not right i have no problem giving you every property that i manage then if there's a problem and it comes to me it will be addressed because that's the way we do business i'm trying not to have the problems in the first place there's a few facts here that i need excuse me to bring up and again this is about long-term rentals not short-term number one most homeowners who rent their property already pay higher property taxes because their homestead exemption and any discounts they've lost them second of all the homeowners who pay who rent their properties are also paying mortgages most homeowners who rent their property are paying property managers and they do not live as they do not live either close to the property or they're not able to manage it themselves most homeowners who rent their property are not making very much if anything after expenses are taken out and that includes property taxes insurance the basic mortgage which is principal and interest and whatever repairs are required whenever they recur we do long-term rentals and that's a year or more our leases are professionally prepared by an attorney firm and the tenants are also given specific instructions on the care of the property also if they have any problems we request that they advise us immediately so they can be addressed that includes problems with plumbing because that stuff needs to be taken care of these people the homeowners cannot afford home inspections or an inspection after every tenant leaves they aren't making much money in the first place so you start tacking things on to them and it hurts them and it's going to really cause a lot of them to turn around and sell their properties instead so we're going to have a huge turnover um as a property manager i'm not speaking against advising the pro the city of what properties we are managing so with us telling you you can advise us we know then and we can get it taken care of as i said um this ordinance has some vague language in it and which thank you ma'am okay is do we have anybody else that has public comment go ahead go ahead mr social let's not forget to fill out the form please that way we're keeping order i forgot this was on here no there were no uh things back there okay just one quick two quick questions one when you have these inspections done obviously it's going to be third party through whoever the homeowner is or homeowner's business whatever so they're going to absorb the cost of that and who gets to pay it whoever's renting the house so of course we talk about affordable housing all the time so that's going to jack up the rates of the rental properties okay but my question is we're charging a 75 fee but the one question i didn't see asked was how much are we going to have to pay this firm to record to monitor and do any type of work regarding these rental ordinances because it seems like we're just throwing money out of the air we'll charge 50 bucks man that may not cover it let's do 75 do we actually have how much it's going to cost cost the residents because we'll pay that if you don't charge enough the renters are going to you know not have affordable housing if you charge too much so i think we need to know what is the initial cost this organization is going to charge us to monitor the rental properties dan mccool please i wanted to bring this up because um during my time with the city we talked about this at length and didn't want to be overly restrictive but some concerns that i have i want to make sure that we have a good baseline to start with because i know for a fact that we do have um we have bad landlords in deltona and this is not meant to be restricted to professional organizations however they are as responsible as everyone else for the state of rental property in the city of deltona we have mitigation that costs us an arm and a leg when we have to go in and abate properties that aren't covered we oftentimes give people break on fines because we have a new owner come in oh i'm going to do better and we've let people in financial circumstances off with these financial obligations they all add up we also have a lot of people who unscrupulously do file for their homestead exemption i had three in my own neighborhood and i'm not talking district i'm talking neighborhood people that filed for their homestead exemption they had renters in there and then we were not privy to that tax base also so while i'm sorry the professional organizations are getting caught up in this i have had rental property also i know what i made on rental property and i know what i can afford and it goes towards our tax base is as such that the average person should be paying according to statistics about twenty one hundred dollars a year we're on the low end in property taxes we have a tax base that is probably 52 percent between zero and five hundred dollars tax base so every bit of revenue that we get from managing handling or abating property we need that money here in the city of deltona responsible home owners have to pay the price what we talked about also is matching up rental property the the name on the lease to the water bill to understand that if this isn't on the water bill this is not the person paying another way to hold people responsible and i'm talking about unscrupulous landlords is the water stays in their name if they take off about paying the water i'm sorry but it's they should have a good deposit when they rent but we have to do something to get rid of the freeloading mentality that sometimes we have as far as that goes i'm not painting everyone in a bad light but it is a reality that with the city these taxpayers shouldn't be responsible to those that have gone with our money when it comes to our tax revenue so i'm asking that we do that we start a baseline that we somehow match up these properties you know how many vrbo's we have here you know how many properties that are being homesteaded people occupying other than the owners no we don't know that we but we need to look into that so as to establish a true baseline for this so i'm very supportive of this i'm very supportive of this measure i'm sorry about i don't want to invade anybody's privacy but as um as someone that was affected by this meaning that we had to make decisions on this this is good 75 i'm sorry but it is a drop in the bucket to somebody that is renting out the property um in order to for us to understand what responsible property ownership looks like so thank you for this jordan i have a question and then i'll go to commissioner howington so i the 75 that's does that cover what we're paying for for the software or the folks that we're using or are we already well i heard you said we're already using them for something else we're already using another company for foreclosures and vacant properties and these calls should be offset by um they're going to be responsible for the registration um and helping with the application as well because it was a fair question i want to make sure that homeowners are not going to be responsible to pay for a fee that's going to be charged to renters so these fees will be charged to the actual not the person i just want to make sure we we have we're collecting enough correct so if it passes if uh so we're not passing the buck down to homeowners within the city and staff sees that these fees are not if they're too low then we can always bring it back to uh for commission consideration in the future okay commissioner howington was the intent to hire out the inspections or to ensure that we use staff who are properly trained to do these inspections it is the intent to use staff for the inspections after they get the certification and the training okay and you may or may not know this answer but uh typically a home inspection is what between 150 and 300 when you're purchasing a home is that it's been a long time since i bought a home it's higher than that so it would be safe to say that 75 once every three years would be a below the typical cost that we would see for home inspections thank you commissioner vila basquets thank you mayor i think i lost you when you said that is this going to be charged to the owner of the homes not the renters not the renters correct okay because i think i've sort of heard you say if you can't get through the rent the owner it'll bounce back to the renter no it'll never the intent is um once they you're going to be required to register to an application and the property owner who registers will be responsible for the fee okay and i don't know if this has anything to do with this as well but when they mention the water does that include when somebody leaves a rental in they have an unpaid water bill who's responsible for that unpaid water bill does it follow the rent of the left it might not be so yeah commissioner if i may that's um not really on the topic of this ordinance uh happy to address that at another time okay i would just somebody mentioned water bill so i thought maybe it might be tied if i can please have the city attorney read section c yes mr mayor this is ordinance number 25-2025 an ordinance of the city of deltona florida amending the general ordinances section 1-15 general penalty penalty continuing violations of chapter 1 general provisions to update penalties and enforcement mechanisms and section 38-73 loud disturbing or unnecessary noises of article 3 noise of chapter 38 environment to eliminate the requirement for sworn affidavits providing for conflicts codification severability and an effective date this is first reading as you all may remember there was some public concern regarding the enforcement of the city's noise ordinance which we discussed at length in uh during a workshop setting and the city's attorney city attorney's office received direction to move forward with amending the city's general penalty provision of the code of ordinances which ties back to the noise ordinance after coordination with uh general counsel from volusia county sheriff's office they found that our revisions are an acceptable and enforceable provision that they will be able to enforce the city's noise ordinance um throughout the jurisdiction i do want to flag that um between first and second reading or tonight if you'd like um in the general penalty aside from eliminating the um possibility of punishment by imprisonment um not to exceed 60 days we also added an administrative fine graduating from one thousand dollars for a first violation uh five thousand dollars for repeat violation and fifteen thousand dollars if the violation is found to be irreparable or irreversible in nature this is a general penalty so um this also ties back to several other provisions in our code and these dollar amounts are the maximum thresholds that are set by florida statutes um based on our city's population if you all would like to reduce uh any of these in this schedule you are certainly able to um but so i just wanted to flag that for you tonight as as you move forward with your discussions thank you at this time i'll entertain a motion and i see vice mayor is on the board thank you mayor um i'd like to make a motion to approve i'd like to make a reporting of of noises and stuff like that and if the sheriff's department shows up they can take actions on their own whereas before the problem was that there was no nothing in writing to say that they were allowed to do this from the city so is that going to be part of the second uh reading so add that part from the sheriff's department we already have confirmation from general counsel for the sheriff's office that as written this is enforceable the previous issue was the uh possibility of imprisonment of a criminal penalty um which the city did not have an active um contract with the public defender's office or with the with the state attorney's office for the prosecution of those ordinances if you'll recall during the workshop discussion it was directed that uh we should move forward with decriminalizing the the general penalty rather than with um pursuing those other agreements so with that resolved um after a second reading this will be um it will be all ready to enforce okay thank you mr any public comment kathy bryan please kathy bryan um i'm curious does this include fireworks and before all the firework loving people out there jump on me i love fireworks too i don't mind fireworks fourth of july new year's eve the people start two weeks early go on for another two weeks you you hear them every once in a while so is this something that can also be controlled and maybe included uh it's a separate item in that because again special occasions a couple nights a year fine but boy there's a lot of people out there with agriculture that use those fireworks legally the other thing is is you know people have gotten hurt with fireworks i've worked trauma for years i've seen a lot of stuff happen bad things happen with fireworks so but that's getting out of the noise ordinance never mind um but thing is fireworks you can hear them not just like your next door neighbor but you can hear them from several miles away it affects people with ps ptsd people who've been in the military with psttd i can't say it right i'm sorry pets and the outside animals so i would really appreciate it if that could be included thank you dana mccool thank you very much i want to thank the commission city manager thank you for pushing this and i am not going to mention this resident's last name but um jeff this is also for you because you know he started out with a problem he started out with a problem we uncovered a situation where there was some muddy water between vso and the city as to what we could enforce um i want to thank our local uh vso district office because they said this is why we can't do this and there was some very robust discussion after that um regarding this so i want to thank you all for taking this so seriously because you know 10 o'clock 11 o'clock midnight i mean it's time for everybody to go to bed and i agree with what kathy said regarding the fireworks i'm just as loving of them as everybody else but when you get them going on until 2 a.m it's just crazy so thank you guys for this mechanism to enforce uh this for all the reasons that kathy just said but um jeff i i'm saying this also in public comment citizens do matter okay residents do matter because look where we are now we are now drafted implementing and passing an ordinance that started out because the resident have a complaint so these complaints and resolution we work through the resolution process we work through the resolution process is effective when we work together so um jeff you'll hear this probably after the fact thank you so much for uh bringing this to my attention um so that i could bring it to the attention of city manager so that you guys could get this um and thank you for doing it so quickly it's been relatively quickly that this got done once it was brought to the attention i know that everybody says that the wheels run really really slow but here we are this was mid-february march april may we're you know 90 days to fines that zach told us about i think a thousand dollars for a first defense is kind of steep um i know that it also depends on your neighbors you could have somebody that complains about every little thing so i think i think you should pass this definitely but i think that you should revisit the the fines especially for a first offense you know continuing is habitual but the first time could be any number of things and a thousand dollars is a lot of money for a noise complaint thank you adrian crutchfield hi i'm adrian crutchfield in daltona i'm in support of this bill i think the penalties are appropriate i hope the bill will encompass events that are held here at city hall i live within a mile of this complex and when there are car meets and there are special events here at city hall the noise is so loud it makes our windows rattle all around on adalia drive and providence so i am hoping that this will encompass that so in the past when we've called the volusia county sheriff they said there is nothing we can do your windows rattle your doors rattle and we can't do anything about it so i'm hoping this will encompass it so when city hall has events and they blast the speakers out in all directions that the sheriffs can take action thank you we have a closed public comments all right commissioner lully then commissioner vila basquist thank you mayor um i just wanted to clarify because i heard a comment um and if you could just confirm it's it is illegal to discharge fireworks in deltona unless you have a permit is that that is correct um again there's the agricultural exemption um and certainly enforcement is challenging um but if we can take a look at the ordinances and work with vso as they've been very collaborative on this other challenge and see if there's any uh anything that can be changed would you recommend um adding it to this at the um next reading or revisiting the actual fireworks ordinance itself what do you think is best so the city's noise ordinance already has provisions for um decibel levels and for um unusual loud and disturbing and unnecessary noises which would likely encompass uh fireworks uh i don't do not believe it's necessary at this juncture to include it in the noise ordinance but we can certainly look at the other code provisions and see if there are uh other uh strategies that we can employ okay um thank you appreciate that uh and just another comment um there was another public speaker who who brought this gentleman up i do want to um thank my constituent jeff who reached out and and brought this issue to us um and now we're as a body um deliberating this and hopefully getting a resolution out of it and i appreciate everyone's time uh working through the issue because i know it's a layered and complex situation with the enforcement so thank you appreciate it thank you mayor commissioner vila vasquez thank you but my uh comment or question um was brought up by commissioner alali which we do have a policy for fireworks that they're not following it's a different story but um we do have a policy restricting the type of fireworks that are used here in the city of deltona for just to uh just to reinforce them a little better and i think the sheriff's department does a lot um because i did a drive talk to the audience i did a drive-by uh with the sheriff's department during july 4th and i can tell you that they are very strict and they they enforce our policies but i can tell you i was a witness to how disrespectful people can be to our sheriff's department when they're being told you can't do this and their answer is this is my money i spend it i can do whatever i want so and i bought my fireworks in orange city but orange city sells the fireworks you cannot use them in deltona parks and facilities of chapter 58 streets sidewalks and other public places to provide for rules and regulations pertinent to city parks and facilities providing for conflicts codification severability and an effective date this is a another ordinance that arose out of workshop discussions with the commission in which the city attorney's office was directed to bring back both an ordinance that would ban smoking in municipal parks in accordance with florida statute and also to provide for regulations on metal detecting within city parks and facilities in response to some resident questions and desires so this establishes both that prohibition on smoking and regulations on the permitting of metal detecting for recreational purposes okay this time i'll entertain a motion commission commission or vice mayor harriet thank you mayor um i want to clarify uh real quick that the provision in this ordinance for metal detecting is not limiting it's not intended to limit the activity of metal detecting is to prevent people from digging holes in public parks that's the impetus of that component is so that we don't just have random holes dug in our the middle of the motion parts so i'd like to make a motion i'd like to make a motion and hereby adopt ordinance number 26-2025 at first reading i'll second that there's a motion by vice mayor harriet second by commissioner lally and commissioner vila basco is this on the board thank you mayor so um i was a little confused when we are restricting smoking in the parks but it's okay to smoke cigars in the parks and i did a little research and just fyi i know that this motion is going to pass but i just want to let everybody know that in my research i found out that cigar smoking is just as dangerous or even more dangerous than smoking cigarettes um not only to the person that's smoking but more to the person who is having secondhand smoke uh inhaled i know i see a little a couple of heads shaking out there but i got this information from the mayo clinic um so it's no different i'm guessing that whoever put up this uh um policy or whatever up in tallahassee is a cigar smoker so he wanted to make sure she that cigars were not banned but just i just wanted to put it out there it is just as dangerous as cigarettes thank you no more commissioners can we go public comment p b brian please case number 2021-11135-cidl this is a walkaway settlement the maverick bench media and their exclusive manager creative outdoor advertising of america will dismiss their claim in return the city will dismiss our counterclaim the city would continue to receive revenues under the agreement until a new solicitation and vendor are selected and we are recommending approval all right this time we're just for the record my vote on the prior item was yes and this time i'll entertain a motion i move to approve resolution number 2025-58 i second there's a motion by commissioner lelly and a second by presentation um and however i do have some additional comments or a recommendation can we do a motion first before we go into discussion nope i make a motion to deny the request there's a motion by commissioner santiago to deny there's a second by commissioner vila vasquez go ahead with your discussion and then we'll go to commissioner vila vasquez i just don't think currently right now we're prepared to make a decision in this topic um there's still a lot of unanswered questions um it was great presentation but i feel that we need to be very responsible on how the money um is especially when it's not budgeted um one of the problems is that um we don't have any data right we don't have any data i think we need to um collaborate not only with um vss volusia county sheriffs um the school board um i i and i understand that currently the tpo has received some grant money that we can look into some more safety improvements um although i'm not sure on the details of the grant if it does or it does not include um sidewalks but it's something that i believe we should not make a decision right now look into it um i've also talked with sheriff chitwood they also have a program with the sidewalks and i'd like to further investigate that um program and see how um it'll help in our community um and that's basically it i mean i i don't think right now we don't have enough information to be spending you know close to possibly up to fifty four thousand dollars on an item that we don't have enough information on um and it's not budgeted so i really think we should just um table it until we get all the information collaborate not only with the school but with the sheriff's department and uh and with tpo and get all the information before we move forward with this thank you commissioner vila vasquez and then commissioner hamilton thank you so a lot of the the comments made by commissioner santiago um i agree with you know they talk about school crossings that's something that is run by the board of education and they have their own crossing guards um so are we going to be taking paying for crossing guards as well as this vso has cameras we don't know where they are but they're all out there to monitor what goes on in the city of deltona every entrance into the city of deltona has a camera um and also uh vso gives us a report every month every i think it's two or three months they have the um come step meetings here it gives us an upgrade of everything that has been going on in the city of deltona and we're able to participate in that meeting so i don't want to go on i mean i'm a lot tpo with the uh you know the crossing lights that we have on the streets and stuff i just think that it's um duplicating some of the stuff we already have and um again like commissioner santiago said it's not it was not on the agenda so i think we need to look at it a little bit further if we even want to consider something like this um to be approved um all stuff like that that's part of tpo and we have a great commissioner here who does great representation for the city of deltona when it comes to tpo and crossroads and stuff like that so you know that's my saying i'm not saying that we should never look into it but as of right now i don't agree we should uh spend our money like that commissioner howington and commissioner lowey so just to get clarification this item was just to consider the possibility of participating in the program and not a definitive answer as to whether or not we were going to participate is that correct i believe commissioner was for the commission to choose uh if they'd like to use utilizing any of these jordan based on the may 5th um commission meeting um it was a discussion item to consider whether or not does he want to participate and we will be participating during the budget next year's budget year is that the thought process yes so we would have some time if we chose to table it today to look into more of the options that have been kind of discussed here yes would you consider possibly tabling instead of denying absolutely no absolutely we can if we can get commissioner vlavascus would you like to withdraw your second i would table it but it's not a priority right now okay so the answer is no she does not withdraw you don't want to withdraw your second correct okay commissioner lelly um yeah i was just i didn't come into this thinking that we were um we were making any sort of budget amendments tonight or even um selecting the areas that we would want to be the priority areas for the focus of this i was thinking we were going into this to provide the direction for staff to um identify us um if if there was a need for this or where that that we would like the areas to be looked at so um i was i was a little surprised when we we called for a motion just because there wasn't any motion recommended in the actions for the item um i also i don't know if tabling it is is is too vague i would i would like to provide at least some if it was will the commission provide at least some sort of direction such as as um because we are in the budget season if we could maybe suggest that staff prepare us professional a professional recommendation um for this for consideration during our budget deliberations this summer that doesn't mean we're necessarily going to going to uh incorporate that at this time but i i would like to be at least a little bit more um specific direction unless the direction was not pursuing this at all but i i i at least wanted to have a conversation about the specific areas if possible but that's that's not the will of the rest of the body then so goes it vice mayor harriet and then we'll go to public comment thank you mayor um i've received actually a number of emails from residents uh primarily in district one but some that live in other other districts that urged us to pursue this programming um i know that uh there are a lot of nuances with some of the grant funding opportunities available and things like that that are out there um and whether they are only allowable at specific intersections but i think that this is something that we need throughout our community i think uh increasing walkability within our community connectivity within trails this is uh there's a there's a lot that that we need to make improvements in this category within our community so uh interesting to hear all the comments from public comment so this time we're going to vote there's a motion on the floor and there's a second we are voting to the vote on the floor was to deny and there's a second on that motion so if we vote yes we're voting to deny motion to deny passes four to three right at this time we're going to go ahead and go into the item that we had originally um we the addition that we really originally did in the beginning of the meeting which was eight e as an edward for a county update if we can please have our county rep come to the front and then we'll continue with the regular uh nine c as in charlie afterwards thank you mr mayor and commission for adding the agenda item and thank you for mayor for calling me out earlier i appreciate the the strict enforcement of things including me um but thank you council i recently i did talk to the mayor just so you know and asked for what if you could give me a few minutes if you all would approve it because i wanted to just kind of address some topics that have been brought up here by you all and some of your constituents over the last few months and i have several updates and probably a couple new things that i think would be important to share with you all at once and some of the public that may have brought up some of these inquiries and if i may may i want a couple things i'll start with the howland road repairs there was discussions about uh howland boulevard where we had a lot of fracturing happening specifically between providence boulevard and leading up to the wolfpack run area that is scheduled to be doing i think they call it some rectangular patching because if you look at it there's just it's in the areas where the tires actually ride on and they've been patching it over the years just the simple stuff but soon they're going to be scheduling some rectangular uh that's a better type of correction um and that's scheduled to be happening soon um there's been discussion and development around howland boulevard also near i4 where we're having all that construction uh i want you all to know that in our recent uh approvals for road projects we funded a study for that entire interchange there uh including you know where the wawa is the starbucks uh the mcdonald's and because that area is i don't want to say failing it may be failing but it's got problems if we drive it in the mornings which i do often it's a mess um and it's in the afternoons also so it's we've already funded the study to see what improvements we could make in the future to alleviate some of those pressures because we know more is coming in that area as a commercial development occurs over there so that's already been funded deltona high school i know i already said that but deltona high school is coming soon once school is out we'll hopefully schedule the construction for the safety improvements with the railings with the crosswalks um the decision was put forward to make that a blue crosswalk uh because it was mainly because of deltona high school's colors are blue um we're looking someone through the idea up there of maybe making up was it wolf the wolf pause across the street uh they're checking to see if that correlates with dot regulations if it does then we'll probably implement that there in front of the school there for you know for the kids i highlight deltona high school i know we have other schools and we know we have other high schools and in due time hopefully we can we can get to those so that's going to be coming forward in the next few months uh staff told me that they are close to a uh design concept uh to send for my approval um there's been discussion about rhode island extension i wanted you all to know that that that is in our work program also the county had an old plan that's been in place and the county has acquired right away over the years to facilitate that rhode island extension mostly on the orange city side but it is on our priority plan uh for the county to consider rhode island extension to also work with dot there's been a lot of discussions whether ultimate i-4 continues to come down i-4 in what style we don't know yet is it going to be just an off-ramp uh i know there are people that are advocating for a full interchange uh dot is pretty strongly against a full interchange so you know because of the proximity to uh the 472 interchange so uh i think it's highly unlikely we will get a full interchange so what we will fight for is the next best thing to alleviate that traffic and give people the out uh a way to maybe solve some of the other concerns that some of the residents have been saying here saxon boulevard we recently did some of the improvements in saxon boulevard i think there's still more to go what had occurred there i think there was there was some sinking of the road there we had the metal plate um it turns out that there was some pipes and that got and affected with the water with all the rains and it basically gave away to all that i know there was concerned about sink holes and stuff like that it was nothing that so it was more of the pipes in the water that facilitated that so they've already started those repairs and they may be done i'm not sure yet doyle road near osteen elementary i know that's been a hot topic here um i know you all take the blame for some of the flooding that happens there i take the blame for some of the flooding that's happening there um specifically in front of uh osteen elementary um at the last county council meeting i asked for consensus from our council and they unanimously support it to get our team to work with the school board team and to work with our grants team to find a solution to that area those of you that have been here a long time know that that area has always flooded uh the road itself and the school used to flood and then they rebuilt the school on a little bit higher ground but the area still is prone to flooding so i'm proud to say that that first meeting is already scheduled i think it's in the second week of june the school board member who worked well together we've been on site twice together and um that meeting is already ready to go i hope we can kind of find some solutions to take uh some of that those problems and solve them so we'll see what comes out of there i want to remind the commission and our senior staff echo funds the next uh the next wave is coming very very very very very soon uh i would be very very sad that if we don't have any deltona projects on that list i know uh that we had some parks improvements i went to the parks meeting about two weeks ago you guys have a lot of good ideas that are coming forward i i certainly hope that you do not give up on the opportunity for me to vote for some echo funds for you guys the money's there uh transform 86 that's coming soon too the next wave uh so be ready for that hopefully encourage your staff to be ready for that because there's a lot of money available for volusia i could fight to get for you guys i just need you guys to apply so go big or go home right somebody said that so go big and i can fight for you uh and another topic mr mayor council is the hosting jpa uh i know some of you attended the meeting that occurred in osteen about a month ago maybe now and that topic is scheduled for the county council tomorrow to discuss the next steps on that um i want you to be aware that i am going to ask the county council to table that discussion tomorrow uh county council has to agree the reason for that and i know many of you talked to the osteen residents there's there's an organized group that wants a little bit more time uh and i'm compassionate to that time that they need because i'd like to settle this osteen conversation whichever way it's going to go in a way that people felt that they were a part of it you know we're not going to get 100 agreement on it i can assure you that but once we make a decision i hope we can move forward for whatever the city and the county decides for the future of that 415 osteen corridor so tomorrow i'll make that motion to table it and hopefully we get an uh an affirmative vote on that and give them a little bit more time but it'll be time certain i just want you to know it won't be open-ended uh mrs bryant i just added this mr mrs bryant comment about the u-turn i already talked to her we'll figure that out this week and i want to announce one thing and the mayor if you want to ask any questions i'm certainly open to it for anybody but um i want to announce mr mayor because we have a lot of you have veterans here and uh at the county council a few weeks ago um i put forward a proposal to do a road designation program uh to designate roads not change the name of the road but to designate roads um specifically there are county roads after individuals that we want to recognize but i'm going to be putting forward for deltona a veterans committee to select the first veteran in volusia county and i'm going to encourage them to select someone who's alive so we can honor them while they're alive to designate a county road in deltona so um i hope our veterans i know you know the tough part reason i did that because there's so many great veterans and how do i pick right and i was struggling with that but i hope to get a body of veterans together and have them submit names to me to designate a volusia county road in the city of deltona to a deltona living veteran so more to that to come soon and if you have any questions for me if there's any questions from commission no questions awesome thank you thank you for the update all right this of renovations exceeding fifty thousand dollars at city facilities okay this is only a discussion so we don't need a motion right now uh city manager did you want to take over but mr colwell brought this up last meeting commissioner colwell uh sorry we can't hear you if you all would like to move forward with a motion on this item uh you may okay did you want to have any discussion or you just want to go into discussions after the motions okay is that how we're doing it now or not yeah but we initially have this done as a discussion that's why okay you can go ahead though if you want to make your motion motion to approve why not there's a motion by commissioner colwell to approve uh renovations exceeding fifty thousand dollars to come back to city hall is there a second second by commissioner howington commissioner santiago is on the board thank you mayor just to understand what this means discussion of renovations exceeding fifty thousand dollars at city facility are these items that are already in the budget and it's been approved already that is correct okay why are we repeating the approval process um i don't think there's that we need to have a second approval on an item that we already approved in the budget i think it's going to hinder the process um we need to move forward with the city on items that have been already approved in the budget um and by bringing it back we have to stop staff needs to stop what they're doing put in the paperwork wait wait another month probably two months and it's just going to hinder the process of the items of the items that need to move forward in the city of deltona so for that reason i am uh denying the request commissioner howington then we go back to commissioner cole and then we'll do public comment and then we vote afterwards obviously one of the concerns that i have with this and one of the reasons that i agree with commissioner colwell is i have been asking for actual expenditures to actually see what we are spending on projects and outside of the budget which as we all know is more than a hundred million dollars so when we look at a list which i just received today and i just have one line item of we spent four million dollars here we spent two million dollars there i don't know what those items are and so for us to actually be able to manage the business we need to be able to see what what is actually happening and i feel like right now we're not really getting that visibility thank you that's what i had to say commissioner colwell the actual budget that we approve under the line items is it listed what the projects will be and what the cost of them are or is it just listed as an expenditure it should be listed what the project itself is that's the only way that we can actually move forward uh without a second vote because i don't see that in here i'm going to use an example like dory who's there um city manager 2.8 million dollars last year can you use any of that for projects no uh i would like to come up and explain a little more it would be detailed any project that we would be working on because i know we don't have a detailed copy until when june 27th so how do we know what so that's a summary what you have before you is just a summary so it's a summary total line item at that department level and the total expenditures at that department level so this the detailed budget my understanding is part of your june 23rd you'll receive probably the week before two weeks before i think they're trying to get that out around the 13th to 17th to provide you a detail of the line items of the current year budget as amended at mid-year and any other adjustments that you've received and presented current year year to date as of that point in time and then a proposed budget so that would be part of that process so that would come out to you at that time as part of the major process this past year as well as each of the quarterly updates that you've received and you've adopted um you've also had line now line item information and details as part of that so um but that's at this point that's what's been provided the problem i'm seeing is we're spending a lot of money on renovations park uh renovations things like that what are we doing for infrastructure well there are projects that are ongoing the project list i believe is on the attached to that report and we can bring you back another report but we did do a small update when we actually discussed cip some of that also happened during the mid-year we talked about the infrastructure like stormwater projects i believe there were eight or ten that were closed we talked about those and then jim also spoke about the same amount eight to ten projects that he actually had begun in different phases some of that was infrastructure some of that may have been purchasing different equipment for infrastructure so it was various items at the mid-year so we can bring that back and discuss it again but those items were presented but um additional information i mean if we want to go over the current year items i think one of the items on your agenda for march 29th was to discuss stormwater projects also just discuss your um some of the um infrastructure projects um and it's just getting that item back onto a future agenda so if i recall correctly and i may not have the exact names of what we call those on the march 29th meeting i would still like to review any projects that are brought to the city for renovations is there any public comment commissioner santiago and then we'll go to public comment really quick um so you have your line items correct on the budget yes ma'am and under that line item is you're going to see your projects that is correct so what we're what we want to see is the detail information under that line item because right now i'm looking at the fund right but if you want the details you can print it for us and say here are the details this is the project and this is what we've done so far that is correct so my understanding in working with the city clerk in reference to requests if it's an item that's being brought to you at a current meeting right then that goes through you i'll present to the city clerk um a request if it's an item that we're not discussing meaning you're asking for a detailed budget report or something um and we're not in the middle of a process then that's a public record request correct um we have to redact it the budget is probably if i were to print line items oh it'll be a million pages correct but if we have a question on a project or a question let's say city hall you can specifically go to that line item and say okay at city hall this this fund this is what we spent so far that is so it's a matter of that we just have to request it yes ma'am okay thank you and and the commissioner dory uh howington did ask for a budget this last week we had a request come in a week before last i don't want to misstate the date um for some general information so we do have that request in um and we have provided the summary at this point in time all right we're going to go to public comment then we'll come back to commissioner howington and then commissioner lilly no public comment okay commissioner howington the commissioner lilly to not have to sorry we don't have to print everything out there are a way for us to come in because i know i know probably not every member of the diocese is going to want to see that level of detail i'm probably an exemption to that okay well so obviously i'm not the only commissioner who's interested in that information we can pull it up and and let you go through that data and see that day that's not an issue we can get read-only access to the system or something so that we can view no so we can we can again we can have a staff member or someone set there sure that's always an option um the challenge we run into um and i don't really want to state the policy or the state statute so i'm sure that our attorney could but the concern we have is printing out information has some of the information that's considered cyber security so if it has a name of a software on it if it has the name that we use i mean some of our information might be in those minutes or those justifications within the system but we also have another area that we can also do that so we're just being very cautious in reference uh to not reference a software uh presenting that out there and putting it out there now if we do know or if we find out this is probably directed towards zach that that information is already out in public through minutes budget whatever for software are we really protecting anything by not allowing somebody to have the name of a software i mean we use tyler technologies everybody is aware of that i'm going to do a point of order we are going completely away from emotion and then i'm not trying to be rude anyways is we're talking about emotion about stuff that exceeds fifty thousand dollars and we're jumping into budget talks i just want to make sure we're steering right back to where we're going if there's a point that correlates to this we need to make it because we're completely steering off the discussion the correlation is i've asked for actual expenditures and i'm not getting it and this is actually requesting the expenditures for renovations over fifty thousand dollars so that's a full circle okay because you're talking about software not renovations good well again because i'm being told the reason i can't have it is because they don't want to announce what accounting software we use thank you that's all i have um and i i understand that you have a request in and actually worked with staff today on on a response um to you that that we're happy to provide uh relative to a to security and cyber security um as far as the the financial software um we can have another conversation about that as well um and you know certainly whatever we can do from the attorney side to assist um you know staff and the commission with with moving forward with the correct information where we will be available to do that commissioner lully hi um okay so uh i'm trying to um in my brain here figure out a uh a compromise in respecting my colleagues motion and i've actually i told him so that i've learned a lot from him listening to the topics of the um champions um what would would it be a possibility or would you guys be willing to have individual one-on-one meetings with the commissioners regarding this topic as opposed to necessarily bringing it back as an official item on an agenda would that be something that would be reasonable we're available at any time yes we'd be glad to meet with anyone on any of the items and i would even suggest maybe making it um making it a little more like formalized i mean just just actually having those meetings when comes up and i'm gonna tell you why um i i have to wear these you know sitting here because i can't hear now if i'm sitting out there i can hear so there is there is a a and i when i was elected i promised to be all smiles and no you know no trashing the city so i'm going to say this nicely there are some challenges in this in the city hall one of them being that i can't hear over here um upstairs we have you know the administrative staff who work in essentially a hallway which was the first for me when i ever came in this building and i've been in a lot of city halls um so there are some challenges i think in this building i think there is a need for renovations again what the scale that is you know is yet to be determined but i i do believe there's a need for that but i just wanted to see if there was an opportunity for us to have maybe not quite as formal as what this motion is but but more formal than just saying you know someone calls you up to ask because it is an important thing um and i think it is good to collect feedback from us about what we've observed like i just shared you know you wouldn't know this until i told you so um i think that's all i have thank you vice mayor harriet and then we'll go for vote i appreciate commissioner lola's comments um there are a lot of a lot of in the spirit of staying positive there's a lot of opportunity for improvements for customer service at city hall i it is very welcome to see deltona water moving to city hall the fact that a resident can show up to city hall and not accomplish all of the business that they need to with the city perplexes me um i think that that's a very fair compromise commissioner loli i would also like to see um maybe a presentation on some of the improvements that are being pursued at city hall rather than changing a policy um i think there's a lot of really good things and improvements being made at city hall i want to i phrase it that way because they are absolutely necessary improvements um and and they they will make conducting business with the city more streamlined easier it's a benefit to residents um so i i would very much support um the request for a presentation on um facility projects at city hall versus changing policy thank you vice mayor at this time we're going to go ahead and go for a vote the motion on the floor by commissioner colwell is to uh approve the the fifty thousand dollars threshold to come back to the commission which was seconded by commissioner howington the motion to approve fails three to four this time we're going to go ahead and go into section d which is uh if i can have the city attorney read it yes mr mayor this is item 9d discussion regarding the commission travel policy and the city commission operating guidelines and meeting rules and procedures and i believe this is regarding the scheduling of that discussion not the actual discussion itself city manager and then we'll go we got a couple people on the board yep thank you mayor uh yeah this was uh something to talk to each of you uh about a little bit we've tried to schedule some workshops and i know there's been discussions some commissioners uh weren't excited about saturday uh meetings uh we tried to to pick out a monday unfortunately the first two respondents said they weren't able to make it which leads to a great point for us to discuss tonight is if we schedule a workshop we like to have seven commissioners at a workshop is well four is obviously a quorum but you can't make decisions at a workshop so one could actually show up and still be a technically a meeting but how many is it that the commission would support that's one of our questions first of all saturday meetings but when we have a workshop how many is is a quality number our concern going from the staff standpoint is we can have a workshop four commissioners show up we spend two hours going over that topic we kind of come up with a consensus at the end not a vote but an idea where we're going bring it to the next meeting and three commissioners that weren't at that meeting spend the next hour and a half two hours at a regular commission meeting discussing the things that they want to discuss where they weren't at the workshop which goes to what this original question was can we take one or two of these items and actually put it at the end of an agenda for discussion because if we're going to spend a lot of time at a workshop spend a lot of time at a commission meeting we're just kind of doubling up the same effort so three parts we're kind of just want you just if you could help us with direction is our saturday's interest or not interest potentials uh every other monday obviously potentially to have workshops but we already asked for one and at least two commissioners weren't available so is there a threshold that the commissioners all feel safe with how many people should be at a workshop and uh could we actually take some agenda items and just put it on at the end of the the meeting like the travel policy if we added that to the next agenda at the end it could take up time but it could take up time anyway even after we do a workshop it could be brought again back to the table so just a few ideas for you guys to mr doherty can you clarify what the questions are and then i'm going to go by who's on the board and then the ones that haven't lit up the board i'll ask him that way we're not being redundant saturday potential what other questions because i'm gonna ask them to answer i know it's a couple yeah saturday's the first one uh taking some of these uh discussions and put them at the end of a regular agenda or how many and how many people when we have a workshop what do we consider acceptable enough to properly have a workshop commissioner caldwell we'll start with you then vice mayor harriet then commissioner vila vasquez and commissioner lally what is our current city policy state as far as for a workshop is there a mandatory seven no i since there's no voting if you're gonna have nobody so why couldn't we have a workshop with um six or four we could and now it's when when we put that out the other day for the next couple of mondays the first two respondents that can't make it and we're going to be out for the next week which made us say okay we don't want to we give people special privileges because they couldn't be here no our objective is to get seven of you at a workshop so we don't do exactly what i said which is spend two hours at a workshop with four commissioners and then at the next meeting when that item comes up we end up having the workshop over again because it doesn't say that in our policy that we have a workshop during the week and saturday if necessary i believe you can have a workshop anytime you'd like to have a workshop but it currently says in there that we can have a workshop during the week and saturday if necessary and i understand last time we had a saturday workshop there was a lot of people that were not supporting the workshop for the wednesday then what's wednesday for the stopping that's or thursday or tuesday oh well when we asked for that monday we already received response this discussion today because we asked specifically for a workshop yes they had consensus to do that so a workshop should have been scheduled and we tried to so the question again is saturday is that valid date for commissioners to do a saturday workshop as needed you're asking me i had no problem okay because two other commissioners couldn't make it no workshop during that meeting i think it was pretty clear that commissioners weren't you know positive with the saturday event but we're back to monday we could have the uh middle of the monday uh june do we have enough commissioners what is is there a maximum this commission if if four is all you're looking for we can we can set up some workshops and back to back and knock them out but i don't know if four is acceptable so to commissioner coble's point i don't want to interrupt you is you're okay with any dates that are set up okay and as long as we abide by the policy which means a minimum of fours of quorum you're okay okay and then there was a third question i'm sorry to ask you that again uh just end of meeting some items have some of them towards the end of the meeting if we have a slower agenda we can add an item on there too it's not all agenda not all workshops need to be two hours some things might be 30 minute discussions so so what i understand is you want to break up the travel policy into separate sections they have discussions about certain parts of it after the end of each meeting or you want to discuss the whole no no the travel policy would just be one item yes okay so why can't we have it on a workshop and understand we could i'm asking well my answer is to have it on workshop okay vice mayor harriet um let me ask you the questions and then you can say what you need to say i've got the question okay go ahead so the question about saturdays if i if i don't have if i'm available yes absolutely i'm okay with saturdays i don't have a problem with saturdays um our current policy does say the workshops will not be longer than two hours i i don't believe that this commission can have a workshop less than two hours i just don't i don't think that's possible i marissa made some some great points at the last the last workshop about it dragging on all day and you know i think that's very fair all of us up here do have full-time jobs and families and we also did take an oath to do this job and i take that very seriously but there's balance and and i think that there is i don't think it's fair to have a workshop with four commissioners because to the city manager's point this commission will then essentially have another workshop when it comes back at an agenda on an agenda um to the question about every other monday same thing if uh everybody if the majority of the commissioners can be there and and sure technically four is a majority of this commission but um you know i don't think any of us want to be that commissioner that can't make a workshop and then proceed with four and not have any our input noted the third question end of meetings absolutely yes i have already blocked off the first and third monday for city business from here to the end of term i think it would absolutely be appropriate to put any of the items that we have asked for for workshops we have asked for so many different items on workshops i think putting them at the at the end of a meeting as long as we're not expecting the meeting to go past you know 11 10 11 midnight i think it's absolutely appropriate to put them at the end end of uh i would request at the end of a lighter agenda but i think absolutely it's appropriate to put them at the end of a city at an agenda so thank you vice mayor uh commissioner vila vasquez do you need me to i saw you writing down so you're no i got it and i'm going to go off a little bit script here i'm sorry when we went for office and we were elected we took an oath to run on the city schedule i don't think the city runs on our schedule okay that's number one side of the options options to me is not a problem i just don't want to spend all day here on a saturday i have a family so the last meeting we had it was a commission meeting and a work schedule the commission meeting which was not supposed to have taken place took the majority of the time of the work schedule so i don't have a problem prior commissioners we had a meeting on the first monday a workshop on the second a meeting on the third and a workshop on the fourth didn't necessarily mean that we had two workshops that month but that that was the schedule we elected officials knew what the city schedule was so we made sure to schedule our personal agenda around the city schedule because that's this is our job this is our job this is not an option if you can't keep up with the city schedule then you shouldn't be sitting up here so when the city manager has all these schedules out there for city workshops we already know the next month there's a meeting agenda meeting agenda so we schedule ourselves and the city the city manager might come back and say we're not having an agenda on the fourth but we have an agenda i just want to say that we have enough time to have these workshops and notify the commissioners so they can put it on their personal agenda there's no reason why you city manager should be working around our personal agenda i lost track of all the workshops we have requested we haven't had any no idea what is on the agenda for a workshop i honestly believe that if we go back to the way it was meetings workshop meeting workshop perfect it'll fit into everyone's uh personal agenda and you will be up to date on all the workshops that are pending again it doesn't necessarily mean that we have to have a workshop two workshops a month but at least one will bring us up to par on everything else that we have pending you shouldn't be asking us work be asking us that question we're just hoping commissioner to have seven of you at the meeting and not have three or four or five and and then say i didn't get a chance to come this put my input in so staff was just looking for direction from if that's a consent to the whole commission of scheduling who shows us shows we're willing to do that we're just kind of hoping to try to find some seven on that's my opinion that's my you know um i answer all this end of the meeting no absolutely not i'm here from five from six o'clock five o'clock because i come at five o'clock to have agenda review and i don't want to walk out of here at 11 o'clock because now we're going through a workshop item so no absolutely not at the end of the meetings and we have a time for another meeting and we can only we can only extend it once commissioner finish we can only extend we've been extending it twice and three times so we can only extend it once saturday is absolutely half a day i don't have a problem uh falls of quarantine if we need to uh well too bad so sad you know we have poor people up here who care about the city and then at the end of the month at the end of the meeting absolutely i do not personally don't agree with that okay thank you commissioner vila vasquez commissioner lully thank you mayor um i've had uh public feedback um both ways but i think the majority was not in support of saturday um what commissioner vila vasquez brought up with you know every every monday sort of being dedicated to the city's schedule um and if we don't need a workshop for that particular monday um then we don't hold it i i'm in support of that um i certainly want to have the rest of the the body's opinion but i don't have a particular um thought or or demand for a certain uh number of attendance so i would be fine with it either way but i would generally not be in favor of saturday more in favor of what commissioner vila vasquez said and i do think there's some predictability to that um and again some residents have expressed feedback to me um that they would more support that versus random saturday workshops did i answer at all yes okay commissioner howington so to kind of echo what others have said i ran for this position i've accepted to be here when we have meetings i would like to know from this body who can make the june 9th that was put forth to us because if we have the four people do we move forward with the june 9th workshop so that we can start moving things along rather than waiting because i know i can make it and i think that's what a monday night it is monday night and i want to order real quick address that my family my father has scheduled surgery for that day i will not be here i'm i apologize to anybody that takes offense to that it has nothing to do with dedication to the city whatsoever so i take offense that it is insinuated that because i can't make it because of something going on with my family that i'm not dedicated to the city um but to answer your question that is why i will not be here and if we have a situation where there's three commissioners that can't make it that might not be the smartest day to have a workshop all right am i good to move on go ahead sorry so obviously there are times where people will be sick i mean we have regular meetings and i we have a lot of meetings where we don't have an entire commission here so to just stop having workshops because we can't all make it that to me does not make sense i would love to have all seven of us here i think that's important but i think to be realistic we are putting business on hold for things that come up and yes i do understand one of those days it could be me get that people have family members that die people have family members that get sick people end up hospitalized whatever the reason people take vacations but at that point you just have to accept that there will be days that we will not be here and business within the city should not stop so with that said saturdays i prefer monday nights i'd rather not give up my family time but if it's scheduled for a saturday i will be here if i'm able as for a quorum i'm good with four but again i'd like to have all seven but i think that's unrealistic to say that we can always have seven people here and as far as the end of meeting i would actually like to see more opportunities within our workshops for subject matter experts to speak and for us to go through an entire meeting i mean here it's 9 15 almost to expect those people to stay at a meeting until this time of night to speak to us and offer their opinion as a subject matter expert to me i don't think that's fair to those people a lot of them are business professionals who are coming in specifically about a specific topic and i just don't know that that's efficient of our time or their time and we do need to hear from these people because i don't know everything about stormwater or road construction whatever's going on that we're talking about so i want to make sure that we open it up to hear from those people who do understand those issues and i think if we cram it at the end of the meeting that won't be possible commissioner santiago thank you mayor just make it quick saturdays is fine monday is fine and four is the quorum i agree with thanks no so i'll answer is i'm the last one left i prefer the mondays i'm okay with saturdays if i need to take away some of that time and four is the minimum so i'm sure at some point we'll hear what the other missing commissioners opinions are whether they hear or not it still gets repeated anyways and i prefer not to be at the end of a commission meeting so i think you have uh your your direction sir thank you very commission all right uh moving on uh city attorney comments that was a discussion yeah because um that was a discussion item there was no action taken there's uh public comment is not required okay sorry let's go ahead and hear the public comment anyways but thank you i appreciate the public comment because you know you've got two different sides to this and and in some ways everybody's right but here's a thought for you sometimes you guys get in your own way the complaint is is you know you you guys don't want us to speak and that's one of the things we're going to talk about in the workshop meeting you guys want to limit our ability to speak etc but why not but then you put in a lot of proclamations you put the school students you put the band all in the regular meeting that's your business meeting why don't you do the workshops on your meeting nights keep your public comment where you know at the same time and then have you do that every other monday have your celebrations because we're talking people are coming in and then you've got to take time to let people go out and and then you know sometimes people are going out and you can't hear so think about it but and and if you don't have you only have four people at a workshop for the other people it's your responsibility go look at that workshop what did they talk about what did they find out so you're not asking the same questions and coming up with the same stuff or or asking questions that were already discussed does that make sense so sometimes we're maybe about to be the get back guys but i don't come up here and yell at you guys i don't call you names and i don't i'm gonna point out the truth and be blunt you get those that do that but you know what free speech a lot of us have a lot to contribute and you guys waste more time than we could ever think about have a good night thank you matthew bergens please good evening so this uh travel policy has been on for for a while it's been on since the end of the year i've been here for every meeting for it i've have over 20 years experience with uh first responders for travel policy i've written policies for over 17 years i come to these workshops to bring my expertise and i get two minutes to speak i have security experience i have a cyber security experience i have i can uh tell you that uh you pick up a cord off the ground and it's more a hundred dollar cord is more more trouble than knowing the software program for your stuff i can tell you all that but i i get two minutes to speak so the workshops are more beneficial bringing your experts forward than bringing it into the meetings here so knowing when the those meetings are whether the weekends or the mondays that's more beneficial to bring those experts up there than you know everything else when we had those those workshops every other monday or whenever they were they were shorter having them more often was was better so when you put more out there then they're not that they're often look at public comments today 15 minutes it's a lot a lot easier when the stuff's addressed we brought up the solicitation when's the last time that was brought up again we keep dropping things off so bringing the workshops up and bringing them up more often we get things accomplished instead of talking about something for one workshop and then we don't talk about it again for another six months so having them more regularly is the issue that we're having so i think that we need to have the workshops more regularly whether they're once a month or twice a month but at least have them scheduled and then use that time when wisely when we need them if we don't use them then we don't use them but we need to have workshops more often and and just have them scheduled for when they're there but this travel policy has been up there since february and it needs to be addressed all the other policies we wanted to go through all the other policies as well we need to get to all those other policies as well and we haven't touched any of them thank you for your time and like i said i i hope that we can get more experts out there david sosa please i can't clap for when you say because i don't want to be ejected by vso but i agree with everything you said okay now that being said since i've been watching commission meetings for probably the last decade as a commissioner there was always consistency in the meetings you had your first and third mondays were always commission meetings unless there was a holiday but that was scheduled the prior year the second and fourth were always dedicated to workshops should you not have an item for a workshop there just was no meeting that day okay now most workshops are scheduled for two hours meetings were scheduled for four hours under your new policy you're looking at curtailing your meeting nights tonight this meeting should have been over 20 minutes ago because you're looking to go from a four hour meeting to two and a half hour meeting that's in your new policy so to add commission comments or workshops at the end of the meetings it's just not feasible if you approve these policies okay now my thing is is when elected you said you commit to be in here now davidson family issues will arise will you always have seven folks there probably not i can tell you a ton of commission meetings where you were missing commissioners the mayors missed some you know everybody misses something for whatever reason but you always have a quorum otherwise you have no meeting now the workshop same scenario do you cancel workshops because you don't have seven people no you may never get seven people all at one time but if you have your four for your quorum then you should have the workshop now here's where i do i can't make every meeting right now with my schedule so what do i do i watch them the next day or the couple days later i get up to speed on what's being discussed just like two people dismissed what i thought was an important workshop with the cip you know i hope they went back and reviewed that i'm i'm sure they did because i know both people and i know they want to be up to speed on things now i know there was a comment made that commissioners are not happy with the saturday workshop this last one because it took forever and a day i thought i'd be in and out of here in two or three hours i had stuff scheduled that day three hours later and we're still on the first meeting so that tells me one thing you cram too much into one workshop basically that is his responsibility for time management okay he tried to put what should have been the equivalent of 10 workshops into one saturday that's where the frustration comes in it's lack of time management each workshop should have one or two items you discuss it for an hour each item and you should be done you have multiple ones so that way you're not here all day on a saturday because we failed to have workshops okay now i already discussed you're looking at cutting the time off of meetings you're looking at cutting public participation time and i don't agree with that you're looking to cut my time down from four minutes to two minutes workshops maybe if you're lucky you get two minutes if not maybe you get a minute depending how long we speak it's just kind of ridiculous some of what you guys are doing as far as restricting public comment i'll go ahead and then now because i've only got 10 minutes but just remember it all comes down to why time management and it's his job to schedule the workshops corny crossbaricos please there we go um i guess a lot of what i'm going to say at this point is repetitive but uh number one i agree with maritza one thousand percent um which i know will surprise even maritza but i do she came up with a lot of exactly what i was going to say myself um i think saturday was horrendous that meeting but again like somebody else has already said it's because we haven't been having workshops so everything got crammed into that day so it was extraordinary i don't know how you guys did it it really was um kathy's idea of making maybe moving the the kids in special presentations to another evening dedicated just to them would maybe be a good thing especially when people get colorful in public forum this way the kids wouldn't be here to hear that um and we could be like even though i do have to admit tonight tonight was wonderful the singing of the national anthem the kids awards they were also adorable it's a feel-good thing but it's something that we could think about you know doing it on a special night so it's all dedicated to them that they don't have to deal with all the rest um they can have a good view of of the of the government um but i uh echo everybody else here i think that you should go back to the four mondays and if you don't need the extra one once you get caught up you probably won't and of course davison if you have a problem but there's also and i don't mean this for your father but there's also times that maybe you guys can't be here but you could attend through zoom or at least for part of it is it not your dad you know i get that but i'm just saying that there's other times maybe you're on vacation or whatever and if you're not doing something at that particular time you could join in you know via zoom and and at least listen even if you don't have anything to say but i mean it would be in a perfect world we would have all seven of you but as we all know it's not a perfect world um and if it's important to you again i'm not talking about emergencies you'll you'll try to maneuver your schedule to fit it here um just like with any other job you know when your job requires new davison i know during emergency storm seasons you have to do all kinds of crazy things um so it's just a matter of what you signed up for which you all knew you were getting into and and i i hated working saturdays so i would have rather stay extra any day of the week than having to come in on a saturday but you know i i think you all care and i think that we can make it work and i think once you get caught up like i said it won't be such a toll on any of you thank you opposed public comments okay at this time city attorney comments thank you mr mayor um i would like to request an executive session in the anson et al versus city of deltona case matter which is the stone island litigation um and if you all are okay with that i'll work with the city clerk in setting a simple ea from the commission to have an executive session yes okay thank you and i just just wanted to provide an update on two ordinances that have been discussed in previous workshops and commission meetings the first is the solicitation or no solicitation ordinance i've had now two meetings with city staff to make sure that we're providing regulatory framework that is appropriate and enforceable so we're still continuing to work through that language before it comes back to you just wanted to make sure that you are all apprised of the process and the same goes for the lobbyist registration ordinance we've been working and crafting that and hope to have that able to be advertised for first reading coming up soon city manager comments thank you mayor just real quick as a reminder of a county of what took place uh we had a workshop for that saturday had a number of items a lot of them were quick little discussions it was in that last week or so we had developers that were looking to come in to work on some projects that in speaking with each of the commissioners and the mayor discussed to have a zoning in progress uh for the overlays which we did i don't think anybody expected it would be three hours of our morning uh so uh the budget or the meeting was not scheduled to to be eight hours long by any means but we did spend a lot of time on that those first topics that were not scheduled until those last few days uh golden book was questioned earlier it is online you can actually go to the website and see the golden book page and actually be able to print the book out online and at that point we can update some minor corrections that we've already found and just another piece that's hanging out there it always seems that our city is waiting for something to happen uh there is a request of over 30 million dollars that's that's at the federal level at this point with the army corps of engineers it's really in reference to the cra one issue we have with the cra for those that may not be aware in uh and i believe it's district three is the deltono plaza the boulevard up normandy and down sax and i4 that a lot of those areas are on septic and restaurants cannot come in to a septic area so you're looking at possibly up to 30 million dollars putting in sewer throughout that area which is not something that we have handily available but our request is in and it's actually moving through the channels pretty well and from what we just heard recently some of our elected officials are pushing army corps of engineers to make final decisions on florida water projects so that they could make their way to the president's desk so before we renovate the cra area and and put some funding into it uh which we have some funding in the cra we want to see what happens with this step which we should hopefully know in the next month couple months at the most and then then we'll move forward with whatever we need to do at that point that's it tonight mayor thank you okay now i'm going to go to city commission comments or request and because there seem to be a lot of issues i'm going to go back down the list to make everybody's life easy commissioner nick lelly thank you we make making life easy um i would like to uh revisit something early in the meeting and get consensus from the commission because i don't think we got that um if it's the will of this body i wanted to see if we could get consensus to have that presentation about the city hall renovations and as well as scheduling um as commissioners requested those one-on-one discussions um as we go through that so what i could i get a consensus on that sure simply yes yes yes yes thank you um keep deltona wild um the process is ongoing for that a consultant is being brought on board um to work us through that process so uh progress is being made there um i know recently we we've talked a lot about native plants tonight but plants in general um i know we gave away a lot of trees uh and plants late uh recently here at city hall would love to see those photos um see everyone getting those planted and how they're going in your yards i know we had some rain recently but we're back to those dry days so maybe once we get the rain started again and things are looking nice and green um and i think that's all i have tonight thank you thank you commissioner lally commissioner steven caldwell yes i'd like when the uh the travel policy and stuff brought back up to us i'd like to see a copy with strikethroughs and additions yeah i believe we'll have both the okay it's it's drastically different i believe compared to what you've had for for so long but yes also i'd like an update on uh code enforcement i'm starting to get a lot of phone calls of campers trailers things like that and yards lots of cars are we still doing sweeps or zones i guess they called them we can have code enforcement at the next commission meeting and give me an overview where they are and get some latest numbers all right thank you statistics for you thank you okay commissioner uh dory howington we had um some questions come in from some residents do we have five million and unencumbered funds for parks and rec that parks and rec has been asked to spend so i do believe at the mid-year it's about four point i don't have it in front of me 4.6 4.8 um that was residing out in the parks and rec budget at that point in time um so those funds would be available for parks and other operating functions we'd have to look into the details and bring that back before you okay as to whether or not it's encumbered or unencumbered that is correct those were available funds so those were not encumbered at that point in time does not mean that they're not for operating though so we'd have to look at their operating budget to see um you know i mean at this point to tell you whether those contracts have been encumbered those numbers would have already been pulled out of that and the way that the reporting is so i'm going to assume at this point based on what i can remember but we'll bring that back before you so that i'm not giving you false information okay thank you i appreciate that um impact fees do we have a consultant on board for that yet we've been working on this now for about six seven months and it sounds like we have one on board for keep deltona wild which started just what a matter of two months ago do we have so the impact fee we've uh should be finishing up their scope within it with one of the contractors with one of the vendors that scope goes out to a selected number of other vendors in the area or or professional folks that do qualify they'll give back a quote so i believe we're on schedule to uh see that sometime in june and then that would bring back bring that back before council is that just the stormwater piece and the wastewater does that include the fire parks so we have several in there so there are different portions of that right to different firms because they all have their specialty um so i believe the fee schedule is a different firm versus the other impact fees and then um stormwater and those will also be a different one so and are we paying attention to the legislation that potentially might go into effect effective october 1st which would prevent us from increasing our impact fees based on the exception we have we've looked at that and that's included in there we know that there's restrictions based on the fact that if we have not had an impact fee i believe it states right now within the last two years and five years okay if we haven't updated in the last five years we may not be able to count its exceptional changes but if we change for the next year then we could look at exceptional for the next year so are we on track to be able to finish this before that legislation goes into place because that is a huge concern it's been 10 years so that legislation could go into place july 1 so i mean we won't have an impact fee study back by july 1 so now if there's another date on some of those and i don't know that i've seen those dates i don't know if the city attorney has i know some of the also the language talks about back-to-back years from a legislative point so i think there are several different options out there i don't know that we have heard anything else um yeah i would honestly need to get back to you on an effective date for that legislation um but we can do that research and make sure that the commission is still working its way through it was october first i'll get you the information thank you very much but we need to make sure that we do not let that slip through our grasp just because this is an important topic it's been worked on for several months and we need to be making progress to ensure that we protect our residents and their tax their tax base as well and i know the consultant is very much aware because they brought that to our attention also okay and then um the ai advertising a lot of residents have been kind of upset about the golden book and the ai feature that we had is there any way i mean we have a pio they do a great job they do wonderful videos we have several commissioners who do videos do we have staff or potentially alternating through commissioners to let us do videos or something if we're explaining like with the golden book we could have each stepped in and done a section or something rather than using ai yeah we did that on we did that on purpose uh for a moment for people to see what's actually happening uh with ai most people just hear it they hear the news they hear something it actually gives you a chance to see uh people actually discussing whatever we put in the agenda as far as talking points they could speak any language that you want and it's it's an amazing system but it was just one of those put together by staff just as a fun item to just look at so i gave the okay of you know let's put it out just for this exact reason for people to understand that's fake but it's real and it's going to get more real as video games as you saw from the old days to today that anybody from anywhere can be into believing uh anything so clearly it's not super tight but we understood that but that was kind of the concept it wasn't to replace communications or replace the commission it was basically one of those i don't think deltona residents have ever seen something like that like i said it could be japanese in a second saying the same thing that's where ai is going it's amazingly scary thank you for it i appreciate that um and then the farmer's market can somebody reach out to claudia perez to see about getting the farmer's market back on the schedule well she has two scheduled already for the center and has had them scheduled for the center for the uh i believe the end of summer and then the fall uh we're trying to hook her up with the deltona plaza and some other locations where would be more inviting uh for her but i'm not sure what the final outcome is just a point of order we took care of that today today yes and then um just one other one is kind of an announcement uh 101 paws and claws is actually having an open house on may 31st they just received two new foxes it's an exotic animal um facility here in deltona and so they are doing kind of a meet and greet for the new foxes if you're interested check them out 101 paws and claws it's a 501 c3 organization and so it's it's pretty neat they have lots of animals there that you can check out that's all i've got commissioner vila vasquez thank you mayor first of all i just want to and most important of all um i had a note here that i left out when i was making the comments about our responsibility to show up to work commissioner davison and my note was advanced missing commission meetings and not being part of commission meetings is only acceptable if you have given advance notice to admin about your time or vacation or emergencies and i had left that note so if it was if i offended you i apologize for that absolutely what what you just told me is absolutely a priority um you know over the city so again my apologies if i offended you so um first i just want to give a shout out to our pio department they did a great job helping me put together the hurricane awareness program i know that a lot of people didn't show up but it was televised so i hope a lot of people uh got a chance to see it i want to thank clint from the uh county emergency uh area for coming and joining us he gave such a great presentation um and he loved being with us at the same time so hopefully we'll be going to doing we'll be doing more events together i want to give a shout out and congratulate all our graduates from all our schools who graduated this year especially to my granddaughter graciela she graduates next week so i also want to give a shout out to the boys and girls club event i went it was a great beautiful event i had a good time um going back to the yellow book i got a call during the weekend about a dog that was left at the um the pet store in providence and stuff like that um i you know going back and forth with danny we got the problem resolved the animal got picked up but the question they posed to me was they looked at the yellow book and they couldn't find anything on animal control in that book or where to call until i don't know who they reached out to and told them to call the non-emergency uh number for vso so if we can add that as well to the yellow book it would be appreciated um let's see what else i got here um i also want to make uh make it very clear that my motion no to smoking was not to stop smoke not uh stop the motion from not smoking the parks my motion was for if we can't smoke cigarettes then why are we allowing to smoke cigars that was the reason why i voted no on it um totally for not smoking in areas where people like uh children and and events could take take place um again be a vima bike ride please join us it's a fundraiser for three veterans are in need of financial assistance um the 26th is memorial day uh at the veterans park our guys here will be doing the event it's going to be awesome and we welcome everyone who would like to bring a wreath for a member a family member a loved one that they lost and they want to bring it to in honor of their name they're more than welcome to drop it off at the veterans park i think that is it for now thank you you everyone for being here tonight commissioner santiago thank you mayor um just uh to reiterate reiterate what county councilman santiago said about the echo funds and transform 386 if we can get i attended those meetings for uh the parks department and there is a lot of wants so if we can get those uh submitted and we can apply for those grants that would be great um i do want to do a quick shout out to the veterans that are here tonight i thank you so much for being here i know it was a long night but thank you for your service i appreciate you guys thanks have a good night vice mayor harriet honestly tonight's one of those nights you could forget no it's um i'm gonna try to keep it short but there's a couple things on my list um a follow-up to the fertilizer ordinance request that i had made a few meetings back um i worked with uh our city attorneys uh and i want to thank zach for being so diligent and quick with that uh the county already has a fairly robust fertilizer ordinance um that does uh include all of the incorporated cities within the county so we we are covered by the county fertilizer ordinance and that ban i believe on fertilizing does go into effect at the beginning of june so if you're gonna fertilize your yard you got two weeks left um i uh this afternoon before the commission meeting i presented um the water safety proclamation so thank you mayor for allowing me to do that i presented it to swim with becky one of our local providers for swim lessons and survival swim lessons as well as the fire department and dcf was also represented there as they're the ones that are responsible for doing those death investigations when there is a drowning death of a child we had it was actually a phenomenal discussion regarding some of the efforts going on in the community um to bring awareness to that and and opportunities to improve and i look forward to reporting out some of those things here in the near future as they start they continue to develop and then um would also like to share that i have gotten a lot of positive feedback from residents on the relocation of deltona water customer service to city hall that is uh seems to be a very um it is a very positive improvement and i've heard that from quite a few residents actually uh which is unique because for all the things that i think that we would get feedback on um it was very welcome to hear it on something that was already done uh and then uh commissioner lully thank you for bringing up the tree giveaway i think it would be absolutely absolutely phenomenal if we could um our pio could work on getting some pictures of of trees that have been planted around the city and um and how they're doing so i think that'd be a cool cool little neat highlight segment so um i would i would like to see that and then um last uh and probably the most important um there were some comments uh made after the last commission meeting where i had shared some confusion about um kind of economic development and commercial development within the city uh regarding halifax crossing development um that development item was not option a or option b only it was the currently approved option uh currently approved zoning pud which is very very similar to option a with the exception of half-size commercial lots so that we could have uh i believe uh can i mention the names of the business zach would uh i believe that at least one of the businesses is an option b is subject of an nda so there i'll i'll keep it generic so there were there were two businesses uh that are looking to come to deltona that i would argue are not fast food although they would be fast uh because the reason they need half-size lots is so that they can have the drive-through um and so i don't understand why this is turning into a political thing when uh it's essentially keeping it how it is but making it more friendly to additional businesses or option b which is to further reduce the the multi-family residential and allow for the opportunity of a potential big box store um so that being said i i would like to see i'd like to get consensus to bring that item back to the commission at the next um commission meeting uh it is important to me and i know for a fact that it is important to um district one residents that we bring more commercial businesses to this city vice mayor point of order just so you know i believe and they can correct me if i'm wrong the applicant has requested to come back for the second meeting in june is that the case um yeah i believe that they have submitted that request um certainly if there's a consensus from the dais um you know that's that's uh able to to occur tonight as well i'm fine with the second if they're asking for the second meeting june i'm fine with that i just want to make sure that that request does come back to us because we have all sat up here and discussed uh commercial development and how how much the the city lacks commercial development opportunities for businesses and i think that that was a a strong misstep um on this commission's part at the last commission meeting um and mayor that's that's all i've got thank you i got three things are very they're very quick um i just want to request doc when they when you guys come to us to talk about our parks on harris saxon uh could we include a conversation in there so the whole dais can give an opinion on probably expanding uh the building for harris saxon because it's it's badly needed um banners for the american legion for veterans are available if you can please reach out to mr king uh i'm not going to mention his lovely spouse because she gets thrown into everything automatically um but if i'm sorry no they could still get more orders and in time for uh more to be done so if they can please approach it has to be very quick because we have very little time and the last thing i have is very important we've already received the first 17 banners we have them already i just gave them to phyllis tonight we'll have them to be putting them up in a few days really he has them but we have been told that when the banners get up a lot of people will start to see them and other people are going to want banners so we're ready for that we will take their orders and if we can get the orders quick enough we can get those banners done and they can put them up by fourth of july so that's what's going on right now we're looking for another group of people in the next few days thank you we have time for this okay mr rosario has application so please reach out to commissioner mr king or mr rosario for the application the last one is actually a motion we discussed this at length the former city manager mr chisholm had received direction from this dais or from the prior diocese i apologize and this has been discussed at length our veterans are extremely frustrated about this and i think we just need to get this done so i am going to at this time make a motion for the sergeant david l or g ledgerwood american legion post 255 be given a hundred year lease at a dollar a year same thing that the city has with with whoever does the property here and allow them to own their building not the museum but the building that is my motion and it's to be directed at uh for them to get with legal and our city manager to work those deals out so at this time i would like to hear a second i'll second for discussion there's a second by uh vice mayor harriet and then commissioner of you have a question and then if anybody else wants to ask thank you so i'm a little confused what he the um they're not owning the museum this motion is not about the museum is about what is going to be called a land lease am i correct so it's a land lease that we're going to be approving for a dollar um a year a year so i have no idea where the museum comes in i i don't want there to be confusion between people thinking so if they build their building they can keep it's their building we don't we don't want they're not trying to keep the museum i just i want to make sure there's no confusion when the language is drafted that oh you know we're giving them the the museum no so this motion is just about the land lease and for when they build their their building they own their building their building right it's their building just like we do here in city hall correct okay okay vice mayor harry you're on then commissioner lully and we got eight minutes by the way so and then uh commissioner howington i'll be real quick i just that was a clarification that that it's not they don't want to own the museum building they you just want to own the building that you are going to build correct 100 agree thank you commissioner lully i'll be quick as well um i completely support this i am going to be a wet blanket i i'm not sure i i agree with the process for how this was just done just because i feel like others have been denied the ability to make a motion during commissioner comments for an actual um disposition of a thing i would prefer process wise for this to be on the next agenda just to follow the process because this is wonderful but tomorrow it's something that is not wonderful so i just have concerns about that if i can get the person to meet the second to withdraw their second yes i'll go ahead and amend my motion to put it at the very next commission meeting uh to go through the process i just want to make sure this gets done because we we keep dropping the boss absolutely i couldn't agree more okay uh commissioner howington so just to confirm the city's not paying to build the building okay okay and that's my last question okay can you please do a verbal vote on fair too let her do yes commissioner
