to have amongst yourselves okay all right then um can we do a roll call please brittany zach perdo in favor yes yes richard gasser yes benjamin baffer yes peter dwyer yes gregory pitts yes jake liopolis yes chris cabezas yes all right and then we move on to the vice chair and then we move on to the vice chair does somebody have a motion for the vice chair i'd like to nominate richard there a second i'll second you guys have any discussion brittany can you call the roll zach perdo yes richard gasser yes benjamin baffer yes peter dwyer yes gregory pitts yes jake liopolis yes chris cabezas yes all right and then the last one we have is the second vice chair anybody have a motion i'll nominate jake is there a second i'll second that okay any discussion all right let's go ahead and have a roll call please zach perdo yes richard gasser yes benjamin baffer yes peter dwyer yes gregory pitts yes jake liopolis yes chris cabezas yes congratulations congratulations everybody and uh yeah go ahead and pass the gavel to chair dwyer do we move yeah i think you just switched the two of you i don't think anybody else has to move but maybe the next meeting they get switched around do we have to call the meeting to order again no just go ahead and start at uh minutes on the agenda okay we have minutes from the the previous meeting who would like to make a motion to approve the minutes motion yeah okay i'll second okay let's take the roll you can do all in favor on the minutes if you'd like it's up to you but um you're allowed to zach perdo yes richard gasser yes benjamin baffer yes peter dwyer yes gregory pitts yes jake liopolis yes chris cabezas yes okay we'd like to swear in the public at this point if anyone would like to speak on any of the agenda items please stand up raise your right hand okay does anyone have any pub uh public comments not related to the quasi-judicial items that will come before us tonight speakers will be limited to three minutes uh seeing there are no speakers we will start our agenda any presentations michelle okay i'm gonna have to read this this is a quasi judicial hearing this hearing shall be conducted in accordance with the city of delray beach quasi judicial rules the applicant and the city shall be permitted to present their case the public shall be allowed to speak for three minutes each or a maximum of six minutes if the person is representing an organization or group of people who are present but agree not to speak the city commission board members staff and the applicant may be allowed to cross-examine the witness the city applicant will be allowed to offer rebuttal testimony the city or the applicant will have rebuttal the decision to approve or deny an application or appeal may not legally be made upon personal views as to whether a project is a good project or not nor may a decision be based on the number of citizens who support or oppose a particular project the law requires that all decisions must be made on the basis of whether the project meets the requirements of law the comprehensive plan and the land development regulations just before we get started i know we have two new members on the board i just want to let you guys know like as always any questions you can direct them to me um if you you're really just during these quasi judicial items just trying to apply the land development regulations the design guidelines to you know the facts that are ahead of you and um if you have any questions at any time i'm here and that's about it no problem welcome to the board thank you guys okay we'll start with our first agenda item michelle hewitt for the record senior planner and i'm reading into the record agenda item 9a or hb 744-2026 for 236 north pixie boulevard applicant here um chair could you do the ex parte communications before we get started yes um we're going to go around has anyone had any ex parte communication no just the okay no no none none i have the applicant here to present on behalf of the property owner and the property owners here as well so who who would you like us i'm ann gannon i'm actually the property owner i've lived in this house since 1990 i believe it i was trying to remember i think it was built in 1930 um it's a sorry if you can just state your um address for the record 236 dixie you say north dixie boulevard delray beach florida 3344 and please pardon my dress tonight but i just got here from orlando from a meeting so i rushed over here this is a pretty simple application from my perspective we're asking to put the two hvac units on the new structure in the back of the house um and this is uh something i want to do because i'm a master gardener and a gardener and this lot is 60 by 120 with the setbacks on the right side of the house where these two air conditioners would go is six feet um it would it would be very difficult to walk in that area and i propose to my uh construction gardener construction that the appropriate place for this house would be on the back that is not you cannot see it from the sidewalk um and we do have a presentation and i will carlos good afternoon everybody carlos um project manager for gardner building group here in delray um sorry can you just state your last name for the record and your address please carlos rivera um or business address business address is 2100 lake ida road uh suite number two delray beach florida 33445 thank you um so we put together a brief uh presentation here showing the site conditions um and what it looked like previously before we started construction and a little bit of what it looks like now after the addition has been added um we also we went ahead and put some some boxes up on the the roof of the addition which you'll see here in these next slides this is what it looks like previously and as you can see obviously you know we can't put anything in the front yard um on the side of the yard there's the um you know the property lines between both houses are minimal at best and uh in future photos in here you'll see um on the left side of the property her walkway that leads to her her front gate is roughly six feet uh in width and we're talking about ac condensing units that are about three foot square so the sidewalk here on this on the side of the her property to the east you can see it's really narrow um top right top left photo is the old existing uh structure that we demoed so her new structure is actually wider at that corner where you see the downspout so it actually eases further into the egress and then of course lower lower right hand corner um you see her garden is is quite full and she's trying to you know maintain uh the um the aesthetics of it all and so what we can do is uh i spoke with michelle hewitt and she said we would have to do a screening some sort of screening what we can do is an aluminum louvered screen um of course those come with noa approvals and would be installed according to the local guidelines uh of course hurricanes winds stuff like that needs to be uh adhered and secured to the roof in a specific manner so in these photos here it's hard to see is there a way to zoom we we put some boxes up on the roof to kind of um set an example of the heights of these units that one on the left is really um you can see on on the on the left if you zoom in through those trees see those boxes represent the heights of each of the units and of course those will be screened at one elevation right at the highest uh the highest standing ac condensing unit can you point to where we're looking at yeah right in between here all right so this is right in here all right so you can see where the the units would be visible right so you you place cardboard boxes on the roof in the approximate measurements of the they are the exact measurements and exact locations um of of the the units one unit is is uh 36 square in in dimension and height and the other unit is uh 33 and three quarter square by 25 inches in height these sit on top of per code an 18 inch stand so that taller elevation you see of that ac condenser that would be the height of the lumbert screen if you look to the photo to the right that is a representation of the lumbert screen that we would provide it's aluminum uh painted to match the color of the house and again here from the front of the house this is the view can i zoom here sorry first time i zoom in here you can see from the front of our house you see those right up there that's the view from the front all right and of course it'll have the louvered screen and this is this is a bit more zoomed in of course representing what the louvered screen would look like and um i was informed that we need to do a four-sided screen which we can absolutely do that this is what i submitted initially um per the request of michelle and all of you we can make that a four-sided louvered screen it's not a problem and again these are just elevation pages um to represent what what it'll look like structurally pretty basic pretty straightforward this is the actual louvered screen that we can use um it's basically you know a bahama style louvered screen nothing nothing crazy about it i mean basically what we're here for is to make sure that we don't change anything of you know how the neighborhood looks we want to appease you guys and what the law requires for the historic society at the same time you know trying to get the units in a position where they're not going to interfere with her her garden and um of course with the egress on the south side of the house all right so any questions typically we'd go staff and then you can sit down for that and then um public comment and then we'll go back to you guys for rebuttal and cross and then we'll see if you have any questions from the board once again michelle hewitt and this is for 236 north dixie blvd for a certificate of appropriateness going through some pictures and images here on the screen i have an arrow with the subject property outlined in blue this property is located within the dela ida park historic district it is a 1925 mission style structure that contains approximately 1700 square feet it is a wood frame construction and is clad with a textured stucco exterior just briefly going through some project history or property history um in 2005 a coa invariance request was brought through for trellis and wrought iron fence which was never initiated so expired in 2014 a coa invariance request for a free stand and pergola to the west side of the property was approved to allow that pergola to be approximately two feet from the west side of the property line in 2025 the board approved a coa and waiver request for the construction of a 1122 square foot two-story addition to the rear of the existing one-story single-family residence it also included minor ground level improvements to the residence removal of the existing rear enclosed patio and hardscaping around the area of the proposed addition during the permit building the building permit review for this addition it was proposed to locate the air conditioning units on the roof of the second story edition where it was previously approved on the ground level on the north side of the property so the proposal before the board is for the installation of two new air conditioning units with screening on the rooftop of the rear two-story addition on the existing contributing residential structure going through some photos here this is the front or northwest elevation this space is north dixie boulevard you can see kind of in the back that gray piece up there is that history addition um we went out there again they painted and um added some stucco on there to match the existing um this is at the edge of the street looking at the the structure and then even further back this is directly in front of the structure again facing north dixie boulevard slightly further back now you can see that addition uh popped up back there this is the side interior or southwest elevation uh this is the side where the uh pergola is located in the driveway this is the rear or southeast elevation this is where the addition is located is on the screen uh this is the backyard um and you can see there's an additional structure back there on the property and this is the side interior or northeast elevation this is where the um 2025 approved will have those ac units located going through some plans this is the proposed roof plan where you can see those two ac units proposed on that two-story addition in the rear they're proposing an aluminum three-sided louvered screen um on four sides that will be painted to match the uh bluish geelish color of the existing structure this is the side interior or northeast elevation where you can see that screening up there on the roof um behind the parapet wall this is the front or northwest elevation again you can see that louvered screen on the left and its height relative to the new construction parapet wall going through some of our standards used to analyze the request this is the secretary of the interior standards rehabilitation with the applicable standards highlighted so the previously approved requests include air conditioning units along the north elevation as i indicated previously while the units and screening are small they are proposed to be above the parapet wall but not taller than permitted by code we've got a screenshot here from the secretary of interior standards regarding mechanical systems going into visual compatibility standards here we have a staff report excerpt as a horizontal lubricant aluminum screening is proposed around the units it will aid in disguising the units on three sides four sides now leaving the rear open um or as the applicant indicated they will do four sides uh the height of the screening is designed to be the lowest possible to just screen the units at two feet six inches consideration could be given to a different lubra color as they are proposing to do the same color as the structure um differentiating that and creating or utilizing the color that would be more wouldn't create the appearance that the lubra screening was a part of the roofline of the uh the two story edition but again it is barely above the parapet wall and will likely not be visible if at all from the public right-of-way here we have the certificate of appropriateness findings and a site by technical item regarding meeting florida building code requirements for access to the uh ac units on the rooftop and that concludes my presentation all right any public comments uh please approach board uh roger cope for the record roger cope cope architects just the zip code three three four eight three i think congratulations peter richard and uh jake for the new positions i think the young guns are taking over hpb uh which is excellent you know mr baffert's gonna have to keep you guys in line as a senior member up there but congratulations to all three of you and the two new members that are here tonight that you you know introduce later please um i've known ann 30 years uh i gave her a little uh consultation a few years ago when she first conceived of the idea of expanding her house she had me over so i know the property i know the backyard i know how passionate she is about landscaping and and everything this is a no-brainer this is so supportable you guys i drive down that street two or three times a day because i have a job in that neighborhood i can't even see the addition that she's putting on the back of the house that's how harmonious the addition is so to put a little tiny box that's called an air conditioner on top of the roof give me a break this it's very approvable um send her on your on her way with an approval tonight uh and and and if i could stand on my soapbox for two seconds items like this should be changed in the ldrs to be administratively approved so they don't bog down a meeting like this where you guys should be talking about real architecture and real historic preservation instead of air conditioning units so that's my opinion so if there's a upcoming workshop that you can do that and and say to our staff and anthea maybe we can you know expand the ldrs a little bit thanks thank you roger hey george long uh 46 north swinton i don't need to be up here following that but since i stood up i'm gonna have to do this um you guys approved two-story buildings giant additions things like that i have you still you shouldn't see any problem with a little air conditioner or roof thank you thank you george okay is there any rebuttal or cross-examination from staff or from the applicant all right seeing there's no rebuttal uh we will break into board discussion does anyone want to open up the discussion just saying at this point any questions at this point any questions can be asked i i have a question for the applicant i think this is relatively simple and straightforward but the screening material is going to go from basically the bottom of the roof stand to the top of the unit no we per code i don't think we're going to be able to go all the way down to the bottom of the roof deck right because part of having the stand is uh to allow hurricane winds to pass through right we can't have like a sail effect so wind has to be able to pass through the legs of of the stand which is why there's a minimum height requirement for the stands so the the screening is going to be mounted on the stand correct we're going to have to get creative right and we'll have to build a frame to mount these two all of which will be aluminum right okay and how is the roof accessed because i don't think that was covered uh the roof is accessed uh by ladders okay either straight up to the second story or a ladder to the first uh first roof and then another ladder up to the the uh addition roof but there's no mounted ladders no there is no okay um oh sure and then how high above the parapet does the screening would the screening extend at the at the tallest elevation it would be about 24 inches above the top of the parapet wall just a little more the videotape goes right to you so that's why we just want to keep you on and then last question um i know you mentioned that um you're proposing that it be painted the same color as the structure uh staff mentioned a differing but complementary color would you be open to that oh sure okay okay that's it pink well no something that blends with the sky would be good yeah yeah something neutral and i guess a complementary to that to your structure color okay all right thank you so you're requesting them to change their paint color well staff staff had had brought it up so i'm not giving them a color but just asking if they would be open to staff's comment and do we approve the color here it's not pink that's for you guys to decide we just put our comments um in the staff report it's a it's a creamy like light green with blue in it you you could go i'm surprised we didn't bring a sample um the house was just painted um which was it was painted the color was previously my question did you consider anywhere else on the property for the air conditioning um maybe on the side of the house sort of hanging off one of the one of the sides in the rear so i think that would i think that would propose another issue of visibility as well right because you're elevated off that uh the house it needs to be at an elevation where people can you can still walk on that that egress right on the on the eastern side you'd have to have it higher enough so that almost puts you at the fence line of the neighbor so that would propose i think another issue of visibility from the sidewalk more so than the top of the two-story roof that's it for me before the applicant why are you putting it on the high roof instead of the low roof so if we were to put it on that lower elevation roof it would definitely be visible from that sidewalk that you see right in front of uh ann's house whereas on that higher elevation right the placement on that second uh the addition roof is at the back so with the height of the roof and the fact that the units are placed at the back side that really really lowers uh the visibility from the street and from the sidewalk yeah i'm not sure i agree with that i think i think the lower roof if you put it on the lower roof behind the parapet and and painted the louvers the same color as the house you would probably see it less than up against the horizon i don't i wouldn't be easier to access too you don't have to go up one ladder uh i wouldn't agree with that just on uh elevation of that roof it was an image that showed maybe it was a side elevation that showed the height of the lower parapet versus the upper parapet can we see that and so what you're suggesting ben is if you put it all the way to the back of the lower level you think it would it would be less noticeable i'm just looking at look at what the scuppers are relative to the parapet that that lower roof has a much taller parapet than the in the upper room yeah and i that i think would be if it was my house i'd be putting it on the lower roof is that's a good point against the horizon it does look like a little notch on the top but if it was on the lower one maybe that blends into that back wall and maybe you wouldn't it wouldn't be noticeable so i think that's a good point i think the only problem with that is right you're looking at sorry unless unless a question is asked of you from the board um they're in board discussion but i can ask you what what you're what you're thinking sorry um so that that rendering that elevation showing that parapet wall being probably is uh double the depth of the addition is not actually accurate it's not that that if you took a measurement of that and measured it to scale it would say it would show that that existing parapet wall is maybe four feet whereas the um the addition parapet wall is actually two feet tall from the roof line um or from the actual roof itself right from the roofing membrane so the picture or the the uh architectural detail is is deceiving right it's not as actually as deep as it looks if you actually in in if you visited the site and looked at the site conditions you would see that it's not actually that you're saying the lower parapet is not accurate right correct it's it's lower than what is being shown no it's taller it's taller right so it would mask the unit even better no what i'm saying is is that you're going to have the same parapet as the second the the addition parapet wall right if the additional the addition parapet wall is two feet tall from the roofing membrane you have the same thing going on with the addition uh with the existing roof you're saying a bit wall is two foot tall off of the roof membrane correct although it appears more like three or four correct correct site conditions don't always uh match what's on black and white plan sets and could sorry do you have more than one unit or is it just one unit for this entire house it's two units there's one existing unit that she has and then we're adding an additional unit of course because we're we're increasing the living space where is the existing unit the existing unit now is it's not it's not connected we we did away with that unit oh i'm sorry i if you look at this photo here it's all the way previously it was in this alley right if you there's a photo um if you can i scroll through here or it's beyond the gas tank right it's it's down in front of sorry it's down down in front of her gate now if you were to zoom in there can you do that michelle see it's down there in front of her gate that leads into her front yard so as you can see based on that photo right now that three foot square condensing unit that's existing is clearly impeding her egress right i think we could agree to that so the width of this walkway is maintained the same width all the way back to the corner is that white tank going to stay there propane yes yes so something else is impeding the area as well right how much space do you have to walk around the ac unit right now but there's three three feet three feet yeah okay that's that's not too bad but you putting a second unit there you you thought it would take out too much space to maneuver and do you use this corridor a lot yes i do is it your main side that you walk on or do you walk more on the other side but this is until we started this project it was actually landscaped and it has a that is a shower right there um and what's the space between the house and the the property line here it's about six feet six feet i thought this was going to be a straightforward one but now it's getting a little a little interesting any other board members have something structurally could the original structure hold the the could it support the two units um and the roof stand the existing roof the existing roof i mean it was a 1925 30 structure they weren't initially they weren't originally on that roof no but but but because it was brought up that well okay so i could theoretically put them there so could that roof support it so these new roof trusses were engineered and in a specific way and planned out to support the roof of the unit so right to what you're saying um that would have to be a whole nother re-engineering going back to uh the architect going back to the trust company and you would we would have to then look at what her existing roof trusses look like and having an engineer say yes or no and then from staff perspective if if it was to require a re-engineering of the roof of the original structure to support potentially to support these two air conditioning units would that have to then go back through staff and an application process mostly depends on if it's going to impact the exterior of the structure so if it can be handled with interior reinforcement that can usually stay at building permits when you're altering the exterior if you can see it from any right of way anything like that okay so i would agree with that if um if the units were proposed instead on top of the historic house the plans that we have aren't for that so we would need to see that and the owner would need to make sure she was okay with the way that looks because there would still be screening i don't think the parapet wall is as high on the original house as it was designed on the addition is that right yeah you're saying it could possibly be a little bit more shallow yes it could be potentially could be maybe a little more impacting on the roof of the primary structure one thing i'll point out is i don't have any issues with the visibility of it but one comment i will make is i mean the site is really tight but it's normally like a last option having it on the roof just from maintenance and any roof penetration might lead to leaks down the road but that being said if if you're okay with it i don't have any issues with it we've talked about that those two units aren't units that leak they're units that blow air on the side elevation what was the height of the chimney in comparison to the parapet wall uh that i wouldn't be able to tell you without having the plans in front of me and actually using a scale to measure that you can see it's at least 14 foot eight inches um you see that the measurement to the top of the dog ear right there on the top corner of the parapet so i would we can't guesstimate what it is but it's at least 14 foot eight inches i i definitely uh see what you're saying where it would blend in but i i'm okay with it up on the roof you consider ductless systems where you could hang a little mini split unit on the wall on the outside yeah again i think that goes back to what somebody else mentioned of hanging see if you look at this elevation here um if we hung something that's at the height or higher than the neighboring fence line again we run into the issue of being able to see that from your side i'm hanging something low that sticks like 10 inches off the wall i don't think it's going to stick about 10 inches i think it'd be more about 16 inches at best and then that's of course being able to get a unit that's really that small that would be efficient to cool uh 1200 square foot addition we also then have the condensate lines running up the wall yes okay any more discussion why don't we take it to a vote and uh does anyone want to make a motion do we have to add the condition for the four sides because the plan only shows the three sides sorry we can make that a site plan technical item so it doesn't have to be a condition which gives them a little flexibility that should something change in design they don't have to come back and get the condition removed and can the color as well because we talked about the in the staff report it was you know a different color than the actual structure could that be a site plan technical item as well yeah um if the board is okay with white or green uh we'll make note of that and coordinate with the owner as well that sounds good okay would someone like to make a motion i'll make the motion um i'll make the motion to approve the certificate of appropriateness hp 744-2026 for the property located at 236 north dixie boulevard del ida park historic district by finding that the request and approval thereof is consistent with the comprehensive plan and meets the criteria set forth in the land development regulations can we have a second i'll second all in favor take the role please zach purdow yes richard casser yes benjamin baffer yes peter dwyer yes gregory fitz yes jake eleopolis yes chris cabezas yes thank you okay we'll move on to the next item on the agenda okay thank you michelle hoyland principal planner for the record um i'd like to enter file number five seven five twenty twenty six into the record and mr bob kubin is here and will present mr kubin before he comes up if we could um ask for ex parte communication any ex parte communication from the board no no none no i just pretty much need to change the screen so just push that one forward to the next screen okay i'm going to use that because it looks simple thank you very much michelle ready to roll right good afternoon my name is bob kubin um i am the owner of 300 southeast 7th avenue in the marina district the home has been uh in the historic register for i believe over 17 years now um it was it's a masonry vernacular home if that makes any difference uh um i guess in this case it may uh vernacular basically means uh it's simple or most commonly used materials to build a home so it's pretty simple place our goal here is to put a windows in in the house replace the windows in the home there are a number of different choices that are out there for windows and we looked at all of them and came to the conclusion of one particular type of window that would work best and meet most of our goals so um we're going to move on here the house is originally okay this is why people over 25 should not do selfies um let me see where we're going here we're going to go back to listen i was hoping to make this the most concise when we hear so the windows that are in the house right now are referred to as awning windows um they are broken up into two panes through the mountain bars in some cases three panes in the bedrooms and in the living room there are four panes top to bottom approximately 30 inches wide by 10 inches tall each pane uh the uh mutton bars are the bars that break up that pane into separate panes that open so they open in an awning sense so they open up outwards in a crank situation so um they currently do not meet the code uh for egress um and um there's also a safety hazard with them i've worked on this house for over 15 years now and i've walked into the awning windows more times that i'd like to talk about in fact makes me a little cranky thinking about it right now so the idea of having windows cranking out is something that is objectionable on not only on the safety uh standard but also with uh uh egress you can't get out those windows so that's where the it doesn't the current windows do not meet the code at all so um moving on to i believe i hope i can get this right um replacement windows option two that we looked at was the side swing casement window so in other words those windows crank open like you would swing open a door in your home left or right um those windows kind of leave us to the same situations we have with the original windows in the home with the awnings where they come out the casement windows crank out it's a safety hazard walking into it's something i'm i'm concerned about it because i've done experienced it um the other thing regarding it is these windows would be used in the three primary the primary bedroom and the two guest bedrooms my experiences with these type of opening side opening casement windows is that they typically open about 40 degrees before they start getting hard to open up i think in my personal opinion if i was asked to crawl through that window under those circumstances in a fire i think it might be not the best option it is an option but i don't feel it's the best one hence going into option three which is a side slide roller window so the windows that you see on the picture you see on the right side is our living room windows and that's an example of the four pane mutton bars going across all four of those panes open up out towards towards the uh towards the yard the windows on the left are the side sliding uh side roller windows so um those windows those that picture of that window does not have mutton bars in it but they can be easily placed in there to match what exists in the house being part of the historic department is important to us in our home so our goal is to match and maintain the integrity of what's on the house as it exists right now with a functionality that not only meets the code but also provides proper and efficient egress of the house um uh then so see where i'm at um that's pretty much where we're at right now we put an addition on the home these are the examples of the windows that we got from the contractors for the window job the you can see this is a three mutton pane window this would be an example of one of the the bedroom windows that face the street the windows on the outsides the far left and the far right would open to the center opposingly the center pane would be solid again with the mutton bars in them to match what it currently exists um so that's what our goal is to do um currently what two two years ago we put an addition on the home uh two and a half car garage with a uh with a small apartment above work with michelle was fantastic it went relatively smoothly according to all the details you have to go through in the historic process in that process they ended up i had a contracted a window contract contractor put the windows in subcontractor they put in side sliding windows in that addition so the addition of the addition on our home has side sliders on it and the house that we want to replace windows we want to put additional similar side sliders into it um i was unaware that this was would have been an issue i just took it for granted that since we had the side sliders in the upstairs it was approved two years ago that it would not have become a pro code issue or a problem but um it has brought us to here so requesting that we can keep the aesthetics and and keep it the way it is um improve functionality improve the functionality of my air conditioning system in my house um and uh and make it safer not only to get out of the house but to walk around the house as well is there any questions sir so what happens next is if you don't mind taking a seat and the staff will present and you can come back very good michelle thank you thank you thank you good evening board for the records of fee reggie planner and training and this is a certificate of appropriateness request for the replacement and installation of windows for 300 southeast 7th aft so here we have the subject property um highlighted in blue with southeast third street to the north and southeast 7th aft to the east the structure is a contributing single family home located within the marina historic district the home was constructed in 1957 in a masonry vernacular style at its meeting of december 12 2020 the historic preservation board was presented with the request for certificate of appropriateness to construct a rear edition the board had concerns and decided to continue the project with direction then on february 3rd 2021 the project as previously presented came to the board with revisions which then moved the project forward with approval from the historic presentation board today the request is for the replacement and installation of 11 windows into casement and horizontal roller windows i'm going to show you guys some existing elevations there's a north side facing southeast third street we have the east elevation facing southeast 7th avenue is up close so you can see two of the windows are going to be changed this is 16 the existing west location area elevation and there's the interior south again the request is for the change of a total of 11 windows into nine horizontal slider windows and two casement windows all windows have a white aluminum frame frame and a clear glass except for one casement window located on the side interior south of the contributed single family home here's a site plan of the site showing also the location of the proposed and existing windows so on the north side of the property facing southeast third street there are two horizontal roller windows proposed and one casement window proposed as well you can see on the bottom as mr cuban said they're going to be horizontal roller windows the middle one is the casement window on the existing east side we can see three horizontal sliding windows being proposed and as mr cuban said again they're going to roll towards the middle of the window facing south there are three proposed horizontal sliding windows and one frosted glass casement window you can see in the middle it's number seven and from the west we can see one proposed horizontal sliding window again all the windows have aluminum white frames with clear glass except for the casement window located towards the side interior of the house which has translucent glass right here in the middle so i want to show you guys the secretary of the interior standards for habilitation and the applicable standards standards one two three five and nine are applicable for this request we have found that horizontal sliding windows are considered a modern appearance and are not typically utilized on historic structures within the delray beach historic district some of the windows are obstructed by foliage making them hard to see from the right away however it is important to mention that landscaping is not a means of two obscure building improvements that are not compatible with the architectural style of the structure as foliage can be revoked later on and the introduction of horizontal sliding windows can be seen as an alteration to the historic integrity of the structure as the proposed window alters the pattern and design that contributes to the finishes and character of the structure here's the visual compatibility standard delray beach in terms of visual compatibility there are no concerns with frame material nor the glass color the translucent white caseman window is located in the bathroom and the board can approve the use of this glass in a case by case basis however there is concern about the use of horizontal sliding windows as they are not appropriate and not typically used in historic districts in delray beach as they are not appropriate for the time frame of the home and have a commercial look in general given the requirements of the florida building code um a compromise could be that single hung or casement windows be utilized in place of horizontal sliding window we'll need to make a determination that the request can be found consistent with the provisions of the land development regulations of delray beach as well as the secretary of the interior standards and the delray beach historic preservation guideline okay and then just a few items um you know when we are bringing an application to the board we tend to say um they may not or um could be considered incompatible so it's the board's decision to make the staff's analysis is that the use of horizontal rollers isn't typically used on historic structures we don't have administrative authority to approve it that's why it's here before the board i did meet with and talk with our one of our structural plan reviewers in the building department to see what kind of flexibility could be given um for other times and the florida building code you know it does cover egress and um ensuring that there's a safe emergency escape via windows and the spacing is 20 inches wide by 24 inches tall um and then we also discussed and i've put these code requirements here which i've also discussed this with the property owner before the meeting so he would be aware that he doesn't have to use horizontal rollers he or sliders as we call them he could use a different window type but the florida building code also allows that if you're decreasing the non-conformity and i'm summarizing here but if you're providing for a new window or window style that's a little bit different as long as the new opening is greater than uh what is existing you you can provide new windows that may not exactly meet the egress requirements which would allow for single hung casement he's absolutely against casement because you walk into those and i understand that um but i just wanted to point out here in the conversation we had the the goal here is that we have a similar appearance on the exterior nobody is replacing windows with awning windows anymore that's just not a typical approach um he could have gone straight to permit with single hung or casement windows um but he was under the impression he had to copy the mutton pattern exactly and there is some flexibility um when you're using single hung windows so i think there was um you know between us his contractor and the property owner he you know went with the horizontal rollers so the board will have to make a decision i think they did do a fair job in bringing forward that mutton pattern so that there was some similarity as to what was existing and just for note purposes the horizontal sliders that were um provided you know on the addition are in the rear of the home um where they're not on a primary elevation this is the one we're most concerned with is the north and east side that we have some consistency with the appearance so that it can be compliant with the secretary of the interior standards thank you any public comment okay any cross-examination from staff or from the applicant i have none do you have any sophia all right seeing that there's none we will have uh board discussion richard would you like to open it up sure um question for the applicant so the first question the windows that are in your addition that are not visible from the right of way from the street those are those were approved as part of your 2023 addition correct we have a covenant on the addition and the while not exactly the same amount of panels in the current windows you are doing a horizontal roller that somewhat mimic the current style of window that's there that was our goal i mean honestly if i was aware of i could have just done a single hung yeah and gotten through this permitting six months ago i would have done it okay but we're committed to this i like this look i like being congruent with the historic look and what was on the house originally um so i wasn't opposed with with going to this and sticking with it and i spoke with michelle and we had a very nice discussion about what options and what we could do and and um and she was very helpful and and we just decided let's just follow through with this and and see what see what happens uh to me and if i can make an addition to there we did put casement windows in the bathrooms it was the best option um uh the other thing is the idea of single hung windows as as um this young lady suggested was um which what she suggested if it's impossible to meet the mutton pattern with a single hung window so in other words if you were to take a 30 inch window a single hung window and divide 30 inch tall divide it in two it's 15 inch per pane you can't put mutton bars that'll match that design or you if you put a single hung then you just have one bar going directly across the window to me aesthetically that doesn't look anywhere nearly as it's nice and being historic is 90 about aesthetics yeah yeah i mean functionality has to take in code has to take priority so yeah i think you did i mean i i in my opinion i think you did a great job trying to preserve the aesthetics of the original windows in a more modern application so i i i'm for it and i've i've no further questions i do just want to say that um great job sophia on your presentation it's very good by the way thank you anyone else i'll say uh that you know i i like the mutton pattern i think it looks good um i noticed that you have other windows um that aren't being replaced that don't have the muttons i would love to see the muttons on there just because then everything would be congruent across the board if it's possible yeah and there are somehow windows that were original that don't have it that didn't have it yeah so and they can be applied of course of course yeah sure that's something i'll talk to michelle about and see what we can in yeah i like the the horizontal slider with the muttons yeah the one difference i see of course is the original was symmetrical three set three panels that are exactly the same size and now the new one has a large window in the middle so that the two windows on the slide could come can slide in so you have openings on either side i guess that's the one area i'm looking at is did you consider doing three equal size panels we did actually and going going back to the aesthetic part about it is yeah and looking at it and making it basically a 50 25 25 window so the center paint is 50 of the opening the two side panels are 25 as you open those windows collectively together they meet in the center but they also maintain the same mutton pattern going across if that makes sense so if you have three lines yeah so if you have if it's three if it's 30 30 30 when you open the windows you'll have the the frames of the windows in the center of the window um as well as the mountain bars will be hanging slightly over so you never get the windows all the way open got it yeah is this 25 50 25 is that the spacing the the two windows in the red windows on the left and the center those are 50 percent in the center 25 25 on the outsides so it gives us a little better view out through the center windows it's a living room in a front front room it aesthetically it look maintains the same one pattern and the same design pattern but offers better functionality now talking about egress the two side windows on both of those rooms well the living room has the front door as egress but the bedroom on the on the left side in red the left side of that building the south side of the building has a side slide open which is i think it's 30 34 inches wide for egress okay on both rooms yeah even though i do like the original symmetrical pattern better i get i get the reasoning for the for the new spacing so overall i think i can support this yeah question for staff did we require the clear glass or was that the applicants yes we had a conversation and they are proposing clear glass yeah and it was required as far as i understand yes are you what about like a low e or something because you know we're concerned about the code the clear glass doesn't meet the energy code so um i don't remember if you were on the board when we had this almost like pseudo workshop item and the board had provided some review and then later direction on what they wanted staff to do with when working with applicants historic structures are not required to meet the energy code requirements of the florida building code so there's an exemption for them that's not just for windows but that applies for your entire prescriptive method of the energy code which is air conditioning roof coverings we've we've been down the rabbit hole on this um learning for ourselves when i say that so the direction is that existing historic contributing structures shall utilize clear glass that was the direction that came from the board new construction where the energy code has to be met can utilize gray glass low e is not a permitted glass finish in historic districts per the direction we were given by the board so we shouldn't be seeing low e on a historic structure because low e usually has a green tint and it's not just that it's the green tint but it comes with reflectivity the color of the green changes depending on your manufacturer i i swear you were on the board but maybe not ben mr batford i just wanted to get the explanation yeah but the we've already seen some low e windows where the house has some low e installed and then they're coming back at two years later for more windows kind of like what mr cuban is in the same position and the greens don't match or you get purple reflectivity while it can be really nice for maybe an art deco or streamline modern newer structure where that color of the glass works the board had decided to stick with the clear as as is allowed per the florida building code thank you any more questions from the board does anyone want to make a motion make a motion to approve uh you'll need the the document yeah we can put it up on the screen for you since if you were not adding a condition of approval and you were moving to approve it would be item b okay or if you wanted to deny that would be d make a motion to approve certificate of appropriateness hp 0005752026 for the property located at 300 southeast 7th avenue marina historic district by finding that the request and approval thereof is consistent with the comprehensive plan and meets the criteria set forth in the land development regulations do we have a second i'll second back perdole yes richard casser yes benjamin baffer yes gregory pitts yes jake liopolis yes chris kabasis yes peter dwyer yes thank you okay we're going to move on to the next item i'm going to go ahead and enter it into the record while um the applicant if they could please mr linares if you could come to the podium the item is hp 952026 which is a coa for construction of a new single family residence mr carlos linares is here from randall staff to architects okay any ex parte communication from the board no no no no no i do know carlos but i have not had any discussion on this project none no okay good evening uh carlos linares uh staff architects uh we are proposing a uh new single family home uh this project is being proposed at the northeast corner of northeast third avenue and northeast uh northeast fifth could you just state your address for the record uh 42 north swinton avenue thank you the uh uh current property is vacant and has been vacant for quite uh i believe 1979 i believe uh is how long has been vacant for uh the site is approximately 13 000 square feet uh 0.3 of an acre we are proposing a um two-story uh single family um obviously the two-story is very very small compared to the first floor uh the house is approximately 5 000 square feet on their air uh including uh plus the the garage the proposed design is a vernacular style um architecture with which is uh one of the uh acceptable styles for the historic uh district uh we've worked with michelle for quite a bit and uh you know she's given us quite a bit of um points uh they're great great points that that we've been able to to accomplish a much better um architectural piece and uh i think that you know we we've come to an agreement and and this this is where we are now um there's a couple of items in the report that she's put together that we'll speak about that later on uh we are meeting all the criterias setbacks lot coverage uh and um obviously there's a line line of uh the elevation plane that we have also um worked out with michelle as well um i go to the next line i'm sorry just press this go to the next perfect okay this is the uh proposed renderings uh one a little bit more skewed towards the garage but still showing you the uh the front door the other uh rendering shows a little bit more of the front door uh facing uh north northeast uh northeast northeast fifth court i'm sorry uh while the garages are facing uh northeast uh northeast third avenue this is the aerial view of the uh of the property uh the dash line represents the uh property that we are uh proposing the proposing for the uh structure this is the site plan as you can see the front entry uh faces the fifth court garage is facing the third avenue uh in the back we we we would have a a beautiful pool very private um for this home uh we are also proposing an accessory structure in the back that is also um well within the required uh setbacks uh square footage this accessory structure is attached with a trellis uh to the main home home second floor uh just to give you a little bit of uh of the footprint of the second floor how much smaller it is compared to the first floor uh overall roof plan um and this is the street caves obviously that's what's required off to the left on the top top uh elevation as you can see the other two lots are currently vacant uh and the other um side we have been able to outline the existing structures uh this is just a study of the building height plane uh that is required by a city uh we are not asking for any any special uh exception here um there is a the orange the very top slide the orange area is the only item that encroaches into the line um a plane site um but it is within the 25 percent that is uh required by the city i believe is uh uh eight percent i believe well we we are definitely under um two-dimensional elevations um the very top is the uh the garage which is the east um elevation the bottom is our front which is the north north elevation of the home uh just black and white elevations of the same uh the additional elevations this is uh basically facing the courtyard and obviously the uh rear elevation of the home this is the um the accessory structure the elevations the obviously the accessory structure is uh in the same style as the main home and that pretty much concludes our presentation any public comments thank you carlos okay okay michelle hewitt and this is for 542 northeast third avenue hb-95-2025 and this is a certificate of appropriateness on the screen here i have the subject property outlined in blue with northeast fifth court to the north and northeast third avenue to the east some really quick history the current property um and had a structure on there that was constructed in 1921 it was a single family home and garage but was demolished in 1979 and the current lot has remained vacant since then the request before the board is for construction of a new two-story masonry vernacular single-family residence with an accessory structure along with ground level improvement so you can see on the screen here just an aerial like a floating aerial of um the subject site or the fifth court there on the right and the northeast third avenue and then here just another angle um fifth court closest to you and then third avenue on the left there on the screen on the left i have the survey where you can see the area proposed for the new construction on the left and then on the right is the proposed site plan here is the first floor plan on the left and then on the right is the proposed second floor plan on the bottom there you can see that accessory structure this is the roof plan going through some renderings elevations this is the proposed rendering this particular side faces northeast third avenue and then on the right there is northeast fifth court this elevation here is the east elevation this space is northeast fifth court i'm sorry northeast third avenue um it's indicated in the stop report but when determining what the front for setback purposes is it's usually the narrow narrowest side of the lot however the applicant has submitted for a limited access easement which indicates which is in in the code indicates that if there is a limited access easement on a side then the other side would be considered the front for setback purposes and so the front for seven purposes is northeast third avenue and the side street is northeast fifth court so here you can see the elevation the east elevation which is front for setback purposes here we have the north elevation this space is northeast fifth court here we have the west elevation this space is um interior to the site this would be where the rear setback is located um and the uh accessory structure there is boxed in on the bottom right corner so you can see that elevation and then we have the south elevation this space is the vacant lots um and then you can again see the outline of the accessory structure um so you can see the south elevation of that and these are the remaining accessory structure elevations this is the east this faces the back half the back portion of the main structure and this is the north elevation this faces the pool here we have the streetscape plan on the top is northeast third facing northeast third avenue again those vacant lots to the left there and then on the bottom is facing northeast fifth court where you can see its massing compared to the other structures along the street we're discussing some materials um the first floor is proposed to be smooth stucco painted sharon williams creamy and simulated stucco siding is proposed for the second floor the window and door frames are to be painted bone white and the shutters are to be painted celestial blue the shutters railing any gates garage doors and window frames are proposed to be aluminum the accessory structure will have a smooth stucco siding painted creamy with white frame aluminum windows and doors the roof of the principal and accessory structure is proposed to be a standing seam metal in a mill finish the natural appearance of the metal and then at the base of the structure there is this blackstone water table proposed as the site does have a slope the proposed size of the blackstone water table is smaller relative to the overall structure so there's no concern with any of the materials or proposed colors or textures i'm going to the secretary of the interior standards for rehabilitation i have highlighted uh two standards that are looked at for this particular request looking at uh standard nine specifically a majority of the structure is one story where the two-story portion of the building comprises less than 40 percent of the square footage of the ground floor um generally it is a larger structure when looking at the overall streetscape but the lot is also substantially larger at 0.3 acres the proposal also does involve additional design mitigation strategies to ensure compatibility with the del ida park historic district such as several porches and balconies offset walls um meeting the scale of building requirement which requires additional setbacks um generally with new construction the goal is that 50 years the structure could be considered a future contributing resource to the del ida park historic district so it's important that appropriate construction appearance and so on and so forth is um considered when designing these structures going to vision compatibility here we have a staff report excerpt regarding the architectural style the proposed masonry vernacular design situates the main massing of the structure along the front and side interior setbacks for the ground story and the second story rests atop creating an l plan shape which is a characteristic of frame vernacular style architecture um so the board needs to make a determination that the proposed architectural style um size and appearance is appropriate for the district um additionally on the elevations where the garage doors are located they face north east third avenue the arch style garage doors could be seen as a design element more compatible with a mediterranean revival style structure where a more rectilinear garage door would be most appropriate for the vernacular style structure here are the delver beach historic preservation design guidelines regarding vernacular style architecture and then race new vernacular and then another staff report except for visual compatibility there are some expanses of blank walls particularly along the first floor south elevation and the second floor north elevation the introduction of additional openings along the second floor of the north slash front elevation would help improve the rhythm of solids to voids and then um there is a garage that is proposed again previously on the northeast third avenue um with a golf cart and that is slightly setback to incorporate a trellis to provide visual interest um so consideration could be given to recessing the car garage the garage uh portion um further to the west uh which could aid in softening the structures massing along north east third avenue here's that rendering again the certificate of appropriateness findings and some slightly technical items we have concludes my presentation okay any public comment rebuttal or cross-examination none from staff we'll go into board discussion then um who would like to open it up about greg i'm not picking on you but okay um you know carlos i think you did a great presentation i love the design um and uh the accessory structure you said it was attached with a trellis system or that that is that is correct uh there is a small space and you you may be able to see that uh there is a trellis um more of a garden feature is what we're trying to do not that it's required but i it's definitely a very uh nice detail to be able to do that there's no rain protection there is none no have you located the hvac on the roof just kidding too soon yeah where are they located that's good they they are uh by the accessory structure and over to the other side it's it's definitely um not not visible from the road okay beautiful design thank you yeah i i second that i think it's it's a beautiful design and i definitely applaud you for um adding a lot of features and really going with all of the sort of neighborhood compatibility and i understand that that's there's significant cost to adding that um but it is you know an investment in the neighborhood and and i really think it's going to be a beautiful home um question for staff the front door is technically on the side lot or side elevation correct yes so the front door which you can see in this image here is on the north elevation so that is on fifth court um as the corner lots develop whether you have them on the side street or what feels like the more main road in this case third it really we try to look at it with the architect as to what is the development pattern of happening on that street because these lots um here are vacant you know they had an option to do either but the building fit better for them having the front door face north you'll note in the staff report there's a limited access easement that's going to be put in place on the north side so that they um actually are using third as the front so it's on paper that way but in the field the front door faces north yes gotcha okay yes yeah well there's the the door deck i think it goes into the dining room there's the yeah michelle could you please go to the 3d rendering um so in the development tac process we worked with the applicant to explore adding that porch and balcony the original design had it a little bit different but to add interest and give that feeling of the delida park district initially those were windows there but they were changed over to access doors so that they could um come out of it is a dining room or it is a dining that is correct dining room um but it's set back and really not intended to operate as the front porch i think once the plants grow in and things like that there shouldn't be confusion and there's not going to be a walkway there there is that is correct and then one one last question um staff recommended or or gave a comment about the arched garage doors would the applicant and ergo the developer and architect be open to heating staff's advice on a rectilinear garage door in that spot um yes yes so we we did look at that um obviously that came into the report it wasn't while michelle and us we were working together this just came afterwards um so we would have been able to um submit a rectilinear garage uh door um which we have uh printed um i don't know whether i may be able to pass this by um could i um that's definitely acceptable uh it definitely looks looks uh really good with the architecture as well so we are definitely open to that yeah i think that that design is as much i agree so for for staff that that would be a condition once it's around i'll take a peek at it and probably if if it went that way then that would be a condition of approval yes okay there was also a staff comment about some i think some blank facades that maybe could use some extra openings um especially in the front this which is this is the front of the house you see that second story area um it i think it could use some some breakup in that area for more interest is that is that also something that can be considered so in the front um which i to to the right um that is pushed so far back it's obviously you you may be able to see so much better on the rendering on the perspective because we're trying to make that second floor very minimal and so we're pushing that all the way back there so it's not visible from the street um if we could go back to the rendering if you don't mind you would be able to see that there's another shot of the other angle i'm not sure whether you could show that um but that's the intent and that's that that's the reason that we're not really emphasizing any openings on onto that wall yeah i'd like to see the other the other rendering i think there was the a powerpoint that we provided for you yeah if you don't mind there was also i think it's the is it the south elevation it looked also very very plain in in the next one the next one down yeah as you can see how how far that that wall talks and we're just trying not to emphasize anything there um we want that to sort of disappear okay i i agree with that um the other blank wall that it looks like it's facing the neighbor's side to the to the south right um will that be visible from the street like a just a blank it will not be visible from the street but we're definitely open to introducing some additional windows i mean that is a club room um it's not facing any anything um i actually know that is the master bedroom but we could definitely um introduce some windows i don't see any problem with doing that again i i didn't think that it was that important just because it's not really facing the street but we're definitely open and well um if i may yes because you asked the question um it while it's facing an interior lot line it's facing a vacant lot so until the other two lots come through for redevelopment you will see it from third um once the fence and landscaping and all that grows in um you know we typically don't make the case that landscaping should be used to obscure a blank wall right um but it eventually will become an interior lot once the other lots are built out so they're difficult to see yeah and here's the floor plan so you can see um the garage right is the piece that's more forward closer to third and then in the back is where we have this um gym office accessory structure almost pool house um where they have um a bathroom and some other elements inside there um the second floor you can also see on the south elevation which this is tucked way back in or way north on the top of the building um so it's giving that articulation that you know has siding on it it may not be as um impactful but the garage and the accessory building is what you'll see at the ground level okay well overall i think it's a beautiful design i think it fits the neighborhood well it fits in the historic character um those those few items and i guess i'm not too concerned about the back unit if once those other houses which i believe there are plans for those other houses on the other units other lots is that a question sure uh we've only had pre-application meetings at this point we haven't had any um submittals yet that's it for me thank you anybody else um yeah i do want to say it's a beautiful design and i'm happy to see something happen on those lots i drive past them a lot but um yeah it's a great design you guys are a talented firm and i'm excited to see it be built thank you ben do you have anything just think it's a just a great example of new construction that fit nicely into that neighborhood all right um does someone want to make a motion i'll make the motion yeah thank you chris let me get there i'll make the motion to approve certificate of appropriateness request hp 95 2026 for 514 northeast third avenue delida park historic district by finding that the request and approval thereof is consistent with the comprehensive plan and meets the criteria set forth in the land development regulations we have a second second did we want to add in the garage yes that's right i'll amend my motion to include um the following conditions that the garage um the garage design will be the rectilinear option okay just a second on the amendment great zach purdow yes richard casser yes benjamin baffer yes gregory pitts yes jake liopoulos yes chris cabezas yes peter dwyer yes thank you thank you uh the motion carries and we'll move on to the next item i will need to recuse myself all right somebody can take the hot seat okay the record i'm katharina palavota senior historic preservation planner i'd like to enter items hp-20 293-2026 and hp-298-2026 into the record um it's for 14 george bridge bridge boulevard it's items uh 90 and 90. just just for the record the um there's two items here they're going to do them at the same time if that's okay with the board um but because of that they'll have like the 30 minute time limit so they have the 15 from each um hopefully they'll go under but you never know but they have the 30. and and just to confirm these are motioned separately there'll be two motions two motions exactly and then i don't know did we say ex parte communications does anyone have any ex parte communications to disclose no no just the emails we received maybe the owners are here kim dwyer is here to present okay i'm gonna go as fast as i can and i apologize i will go very slow during question and answer i have to cover demolition and two coas in 30 minutes if you could just state your name and address for the record please miss dwyer kim dwyer 109 dixie boulevard and i'm here to discuss 14 george bush okay um we met with most of you i met with most of you four weeks ago when you approved unanimously the 75 foot split of the lots the waivers and we went to city commission and city commission also agreed thank you for your recommendation and they agreed and unanimously voted for the waivers as well so those two things have been approved we won't be talking about those today but now we get to talk about the fun stuff and the not so fun stuff which is the demolition of a contributing structure that's on this park property so our goal in this is to remove the void that we talked about and create two neighbors for this community it's to reinforce and reflect the contributing styles of delida park it's compatible and honestly differentiated building a 2026 sensitive appropriate infill homes that are resilient that meet the florida building code for wind and elevation standards and again that create a community so i want to tell you that this was not our first approach on this property when we originally were approached to help with this and then we ended up buying it the idea was which i have done helped other people before was to divide the parcel and to save the original historic structure there were some things that came up that changed course this is the existing front elevation of the existing home it sits as we've discussed back on the property the garage is at 65 feet back the front door is at 85 feet back and the parcel is 120 deep it's unreinforced concrete block and stucco it's slab on grade construction from the 1940s it's the finished floor elevation is below the crown of the road i'll show you the topographical survey for that the flat roof is actually two by six rafters they're the all the air conditioning equipment is literally on the roof including the ductwork the windows are mostly jalousy and needless to say there is no insulation in this house either so sitting way back it serves as a catchment for the road all the water it's anyway four feet from the very back of the property and it disrupts the rhythm of the street there is also i will mention that there is no significant lack of ornamentation on this house and no character defining features i'll go over that more in a minute so it's not within the rhythm of the street it doesn't contribute to the streetscape that's the ac on the roof this is the west side of the house this is the south side of the house that is the wall to the neighbor's yard that you're seeing right beside at four feet this is the east side and this is the interior pete dwyer is six foot three on a good day and you can see the doorway height on the inside of the house that is in front of the garage i do think a picture's worth a thousand words which you may be used to by now but i'm still going to use a lot of words um okay so the original structure if we go back in history was actually this staff was so great they have dug and dug through history and they found this um this was the original drawing now there's a reason that this was submitted because this was built and then they added a garage so the original structure is about 1240 that's just us estimating off of the um the lines there and what they have now and then we took that and so this was added in 1948 so you have two separate structures now you had two lots then this is what exists today so i simply placed it over the top of the existing house and we don't know where the blue part came from because it doesn't match what was on the drawings but maybe they built something different than what they actually had drawn but then there were three more additions made to this property when the people moved out of the house in june and it was cleaned out they found these plans and they gave them to us and so the plans show that this connector which is the one in the middle the kitchen which is the one on the left and the craft room were added on in 1971 very simple construction the drawings are two pages that's it so it's just slab on grade with walls that was attached to the house that's there so the reason that's important is because now there are five one two three four five structures at least that have been put together to make this one structure then and i want you to see from the top you can actually see where the roof lines are and where it was connected and when i do that you can see it even more and we can see it p climbed a ladder to see it from the top um so then we had the topographical survey done and we looked at it and this was done of course because it was required by staff and we found that the elevation of the house is actually 21.12 and the road is 2116 2143 and there was another shot as well the surveyor confirmed that these are indeed the heights and that it is the crown of the road is higher than than the structure so as we looked at what we were going to do and we actually had we're working with soft architecture and they did do an initial drawing of how we would try to divide the lot but save the portion of the structure and um carlos astutely pointed out you you know that you're going to hit the 50 rule and now everything has to be brought up to code and so then we started taking a look at what would have to be done in order to renovate and repair this existing structure and add on to it and we were and honestly i'll go to this next slide and then come backwards we talked to a bunch of historians and experts and we ended up talking to kathleen kaufman who has been on the national register she's um the the historic planner for gainesville she's worked in miami she's been all over and she said you know this is a great candidate for demo and not a great candidate to be saved quite frankly so why demo um the finish floor is below the crown of the road 50 rule is triggered and in order to raise the structure um lifting and moving a concrete block 1940s built home on a slab already has very low odds of success they've been lifted in this city and they crumbled when they were lifted but remember this is five structures that were put together they're not reinforced with rebar and and designed to withstand being lifted so then we looked at what if we what if we rebuild it well your slab is 19 inches below where it needs to be so you've got to take it out you've got to remove the roof raise the tie beam for all the doors and windows and and in the end my people who i consulted said what have you saved him what have you saved so a couple of blocks of concrete so um we also looked at it and said well gosh is there any lore is there history in this house has somebody famous lived there why was it put four feet from the back and we went and talked to bill bathurst and linda oxford and if you know them they're you know legends in this community and they had no stories and we called lots of peoples and finally i backed off after three months of searching and said okay i'll go the hard path and i'm going to ask you to let us demolish the structure and we're going to come up with two new designs so now i'm asking you to um and i think i've got the wrong ldr there but anyway i'm asking you to uh grant us demolition for ldr 4.5.1 f6 because the structure is not of interest or quality that would reasonably fulfill the criteria in fact it was noted on the surveys that were done three different ones that it is not eligible for the national register it's not of the design craftsmanship that it can't be easily produced it's obviously easy easily reproduced it's not the last of its kind and it it does not promote the general or value um general value of a culture sorry as i mentioned we did ask and there was no lore no specific history so we do have plans i'm going to present those tonight and we're going to design a structure that is safe and conforming for the people who live there all right moving on whatever what we're going to show you now is i'm asking for two certificate of appropriateness we're going to go with lot one first which is actually item e on the agenda and then we're going to do lot two um lot one so the we're going to show you that a two-story home is appropriate as you just approved one um there have been many many many two stories i'll show you that delida park is a mosaic of seven different styles and i'm going to talk about the extreme step step step backs that have been used to dissipate if you will the massing at the street these are the prominent styles and the period of significance so importantly in 2009 to document and recognize mid-century design and architecture across the country historic districts extended their periods of significance to 1965. that is when this house was incorporated so in 2009 this house was marked and deemed a contributing structure it is classified as in some of the surveys as a mid-century contemporary and then because of the additions it's also noted that it could be a ranch vernacular so if you look at the bottom i want you to note that back in the 20s there were a whole bunch of mission and mediterranean revivals so 28 of the contributing homes are in the spanish influence then in the middle this minimal traditional frame vernacular which is more the style that you just saw approved is about 20 there's about 29 of those and then you have the contemporary and the ranch masonry masonry vernacular which in the contributing structures which i went through the whole resource survey those are typically the ones that look like the mid-century modern contemporaries because they are from the 50s so contributing two stories you would think that all of these were contributing at least i did and then staff corrected me and it's actually there's only three contributing two stories in the district and staff challenged me on this so that's how we ended up having this conversation there are indeed over 20 two-story structures in the in this part of the district and all of them are highlighted in blue only a couple of them are actually from the period of significance or are contributing like i mentioned most of these are info infills so we looked back and we said this is what we have for two story structures this is what they look like in the community and we wanted to do something that was compatible and appropriate this is the block directly behind us with two story structures on it and this is another structure that's literally you know stone's throw away this is a recent award winner which was also done by staff similar to the one that you just saw it sits on the corner right here and there are single story structures all around it that's all i'm pointing out here is that this is a uh two story with single story structures around it um same thing here now this is important and i'm i know that every project stands on its own and that one is not a precedence for another so i'm only using this to give you a perspective of what a house looks like from a 2d drawing to a 3d in the field so the drawing at the bottom is their two-dimensional architectural drawing and that is what it looks like from me taking the picture on the sidewalk i'm not on my knees i'm standing up and that's what it looks like you can see the second floor stepped back the reason this is important is i'm going to use this as a benchmark for what we're going to show you so that you can see what it'll really look like in the field okay our new homes are set back to re-establish the consistency of the block rhythm reinforcing rather than disrupting the street edge and you will also see that we have 16 to 31 foot extra setbacks on the second floor so we will re-establish the rhythm of the street as we talked about we will create that wall of continuity continuity that gives you a neighbor you can see each other when you're taking out the garbage you can wave you're all right up there and it feels safer it feels natural when you're walking down the street to be walking past the front of your neighbor's house and not a big void which is that is a picture of the lot on the right right now that's kristen finn's house who's here tonight and then the next door neighbor is a two-story that has been modified so it's not considered contributing so for lot one again here's your two-story spanish and here's the house for proposing it reads like a one story from the street the second floor is pushed way back it is predominantly and consistently spanish mission style throughout so again for the architectural style is consistent i wanted to show you that staff made some adjustments to the structure and we accepted all of them and agreed that they were great additions they asked us to change the little hole up there at the top you can see the arbor over the garage the windows all of those modifications were made and and the strip the um the project looks better so thank you for them they also asked for the arbor to be extended over the garage and all the wood to match which we also did they also asked for windows to be added on the side which we again did it looks great and nothing in the back except making the wood match and then on the left side also adding iron in that opening instead of what was there to have it feel more mission so we did all of that um the proposed height of the building does meet the building height plane and um i wanted to show you again the um the drawing of the again perspective at the bottom and the top the top of the roof for us is actually the parapets at 24 feet their top of roof is 26 3 our top of first floor parapets at 12 theirs is at 13 so i'm just showing you that that this house is going to meet and be an award winner in the community that really is lovely it's gorgeous um the second floor setback is 46 6 at the closest point then there's an additional 10 and an additional another additional 15 from that for the other two parts and i'll show you that this is you know you're walking down the street and what do you see and if you look um on the right which i don't think the little circle there it is this is um ann's house she lives to the right that is the side of her house you walk down the street steps back to the front door right here is the front and then you step back even further to the second floor and further again to the next part of the second floor so to the person walking down the street this is going to read as a primarily one-story structure with big setbacks for the garage and a little step back for the office on the front so the proposed residence meets all the criterion we aren't asking for any setbacks or waivers this is a comparison of the house from a front facade proportion perspective to other neighbors in the district as well as next door so i want to show you that the house directly below the proposal that is the house kristin lives in two doors down from where this one will be and she's on a hundred foot lot massing is is similar in the width and then that's ames architecture up at the top it's actually on dixie boulevard the next one the white one is actually directly behind and touches the property on the back corner and this one on the very bottom touches the um west side of the property the proportion of the openings to solids and voids and the porches i'm again pictures worth a thousand words you can see it feels natural it feels very natural then the material color and the textures again i'm going to ask you for bronze windows and staff's going to say as it is their job that white was the original color and i'm i'm going to ask you for bronze and say that it's been used and it's a 2026 infill and it's a differentiated color so we'd ask for that okay the scale the pink is what's required the white is what we're giving you that's the first floor and the second floor you can see how far we're stepped back very very far um please approve the coa for house one lot one that is item e on your agenda and the request for demolition each one you have to approve the demolition twice this is a coa for house two now this is going to be fun and i had a timer but i didn't set it so i don't know exactly where i am 14 minutes oh perfect 14 minutes left okay yes that's what i mean that's great i can do this um okay we are going to repeat and reintroduce mid-century modern this is the first time this has come in front of a board so this is a little tougher for you because it's not what everybody else has been proposing i'm going to show you that i'm going to try to make it easier for you um i didn't pick this because i'm in love with mid-century modern i picked it because the existing home on this property is a mid-century style so i'm asking to remove an existing historic home i thought i should at least put it back in the style that it came from so that is why we were going with we are going with this style um you can see minimal traditional is a you know less than a third and then um what has been what is all the infill all the infill is this style only three homes have been anything but this style and those were missions and so we just and honestly our neighbors came to us too and said please don't do another vernacular please don't just do something different do something that fits in the community in a different way so again didn't take the easy path might have done that differently just like the guy with the windows now um 24 of the homes are contemporary there is one two-story contemporary structure in the district and this is it and it obviously has a lot of windows it is not contributing it was not built in 1950 it actually was built in 1972 that's an error in my slide and it has been proposed to be contributing these are the guidelines we followed them building material you can see that they they wreck they ask for one or two stories they ask for ribbon corner windows in metal or casement continuous bands of windows that create a horizontal emphasis so this is the guidelines that we used with staff as we set out to design this home now this is the fun part okay these are a bunch of the contemporary homes in delida park some of these you're not even going to know are there but you're going to now drive by and you're going to see them so i even have the years on there and you can see some of the different streets now this is an example of the shed roofs or the slant roofs that you see a lot on fifth street also on seventh street and i'll also point out if you notice the pipe columns on the right hand side over there that's on almost every home on fifth street on the west side this is the slant roofs these roofs roofs tilt just a little bit and some of them tilt both ways like on the one on dixie boulevard and then you could also see from here some of the eyebrows like you see the eyebrow above the fifth street door and then over here you've got the outriggers and the stepped roofs is tim here i thought tim was coming anyway tim owns this house on dixie boulevard such a cute house and that little one down at the bottom on fifth street very very cute this is the house that we're proposing on george bush so now i'm going to show you how we came up with all the elements the proposed home is consistently in the mid-century quote contemporary out of the guidelines style for all of the different elements the shed roof comes from fifth street the um outriggers the pipe columns you can see those on the right hand side we incorporated as many of the elements as as the design would allow um the eyebrows the cantilevered sections the breeze block that is in the guidelines and in um highs and bottles uh right up about delray beach and this period so we incorporated the breeze block also to give you some relief from the large windows that are in the front this is dixie boulevard tim's house 240 north dixie so cute um here's another one with the house on second street you can see the bands of windows there bands of windows on this house on fifth court and second avenue and these are the changes that staff requested they felt that this style was a little too um modern industrial and they asked us to make all of the eyebrows and cantilevers thinner and so we went through and the staff team reduced the massing of all of those and they took out if you notice um this one over the garage there's a piece that was coming out sticking out right there we got rid of that all together so to slim it down and make it feel a little more like the homes in the district compatible but differentiated this is the left side of the house this is the back of the house this is the right side of the house and then we're going to talk about the height and i'll go through this quickly um that we meet all the building height planes um again i'll compare it to the other structure it's shorter it's actually only 25 7 because of the and then the meet the average is 23 because of the shed roof um the first floor is only at 12 versus 13 on that other house that i showed you second floor again is set back um to 46 and 5 16th um the front facade this is has a stepped massing strategy so does the other house very similar to the mission houses that are three horse two houses down all of them use that stepped massing strategy um we have the the wing walls and the main corridor again walking the dog down the street you can see kristen finn's house on the left her house actually comes out to 20 feet um in the front and you can see the first blue line is what you'll see of hers then the first orange line is what you'll see of this house and the second one is like i said step back 46 almost 47 feet and then further and further also you have i'll show you how to have the setback on the left side too so um this is comparing the front facade just like we did before same houses and this one and then we're going to talk about the proportion of the opening solids and voids and the porches um again introducing you can see how it fits in how it blends with the homes in the in the community i even i'm not going to dodge that there are these little mission houses next door so i even showed that because you can see the proportion of openings to solids on kristen's house reading left to right there's actually a lot of openings there and so um this is different because it is a contemporary mid-century modern home which again is going with the style that was there before but it does it is compatible with what is in the district and what is um on the streets so this is second avenue this was built in 1953 this is royal court proposed built in 1972 and then finally the materials we are using smooth stucco we are using breeze block we are using white overhangs accents and then there's some pops of color which is similar to a lot of the contemporary homes in the district these are the elements i actually gave this to carlos and randy and said incorporate these into our design please wherever we can so that it's compatible with the district these are the colors on some of the homes you can see the bronze you can see the blue and and the really cute dog there too and then the roof shape roof shapes the layup because they're all flat roofs we did that on purpose because we didn't want to overwhelm the little houses next door so that they feel the same so that's why we went with the flat roof and chose designs that would actually have flat roofs the scale again this is what's required and this is the second floor of what's required and you can see how far it steps back i also want to note that the sides you can see there's initial side setback that's on both houses as well that's also required based on the size of the lot okay and then this i this is really my last almost my last slide i promise and um this is important because the house i showed you that's the award winner that i kept using to compare is actually the house on the top and you can see the little um whatever that's called that style that's i call it art modern what anyway you can see that on the left side and you can see that it doesn't overwhelm it and in fact how far it feels stepped back the house at the bottom left is actually the award winner that's on six and swinton it uses a stepped massing strategy as well and you can see the little house next door um and then you can see on the bottom right i mean over to the right that house was built before we started doing the step to step back strategy that actually touches our property in the back and looks over the back pool but it still doesn't overwhelm the little historic house because the little historic houses sit forward farther on the street but regardless that's some examples and i'm just showing you that we are going to fit in and be differentiated but compatible and i would ask for your approval and i appreciate your time and i promise to go slower on any questions thank you to staff for all of your work hard work with us okay so this is a certificate of appropriateness and demolition for um two applications both for um 14 george bush boulevard so the subject the subject point 41 acre property is located on the south side of george bush boulevard it contains lots 20 to 22 block one of the delida park plat the property is zoned r1 double a in the situation situated within the delida park historic district the lot currently contains a 1948 contributing single family ranch architecture style um residence so mr wyra did mention that um august um last month you um the board did review two waivers um that were recommended to city commission in order to split this lot so here we can see um this is additionally the three lots this is blocked um lots 20 through 22. um the request was to split the lots into two separate i think 75 inch um 75 foot lots and then um build the two single family homes but it also required the demolition of the existing single family residence the waivers were approved by city commission on the 18th of september so now we go forward with the uh two certificate of appropriateness is in the demolition request okay so i'm just going to briefly go through a few images i know miss dwyer also um had a few of these so this is the north uh front elevation so here you can see a little bit of the um the elements for the front to the front door jealousy style windows okay this is the area to the northeast this is also north elevation where you can see the existing garage this is the east elevation existing side this is on the west southeast elevation this is the south you can see the southwest elevation with the pool so this is the existing survey so here you can see uh the three existing lots and the existing single family residence these also show the original home the garage and the the 51 and 69 additions okay here's an existing site plan of the contributing structure to be demolished with that pool and any hardscaping will also be removed from the property so this is the demo plan and then here are the existing elevations so you can see the front and the east side of the existing ranch and here is the rear and the west side okay so i'm going to go over the east parcel first this is the site plan overlay showing both proposed residences so we're going to just go over the east one first and then go into the west so this is the proposed east parcel you can see that they've reconfigured the driveway added a new pool and they're proposing a two-story contemporary style residence this is the proposed first floor and as mrs dwyer did mention um the second floor is stepped back so it does meet um height specific height requirements as well as the building height plan requirements okay here's just showing the um the first and the second floor just so you can differentiate the two from the roof plan including the elevations again okay so this is the proposed front proposed east the rear and the west side these are the proposed materials i will note later with materials um the roof um it is standing seam which is appropriate for the historic district but they are requesting um the slate blue which normally if the roof was in a mill finish it's um common in historic districts and that's something that's um admin approvable or would go straight to permit but because it's in a specific color um we just wanted to make sure to note that the board does need to approve um the proposed color for the roof okay i'm just going to show some color elevations this is a rendering this is the rendering to the rear this is south elevation okay now we're going to the west parcel so here we can see that it's a proposed mission style two-story residence uh also reconfigured um circular driveway um pool in the rear as well this is the proposed first floor the second floor is also step back this is the first and second floor there's some elevations these are the proposed colors and materials for the most part for i believe for this one minus the bronze windows uh staff had no concerns with regard to any type of materials or styles that went into the proposed mission style so here's some color elevations okay the rendering okay so these are their secretary and interior guidelines um as the contributing structure is being proposed for demolition um for for that specific structure um we wouldn't apply the secretary of interiors because the request is for demolition um however there are concerns um it's noted that the building would require um the finished floor to be raised mrs reyer did mention that um if they were to come in and possibly rehabilitate the structure uh raising the raising the cbs structure would require an interior raise which would mean they would have to take the trusses off and the roof and when we're doing that with historic structure that immediately uh results in a demolition request anyways so if they were to come in and rehabilitate the structure um that would have been the demolition route they would go they would go to if not they're going this route but the way staff analyzes request and the work that is being proposed for the site um especially to come into compliance um either way they would more than likely be before you um with one or the other version of demolition so um the board is going to need to make a determination whether or not um this request for demolition is appropriate for the district uh these are the visual compatibility standards um this is reviewed for both parcels so going into the east parcel for the contemporary style um there are specifically concerns um not specifically with the architectural style but with the height um as mrs dwyer did go through all of the different structures within the district uh as well as we did when we were doing our review um as well as the history of contemporary styles within the delray beach there are no second story there are new to no two-story contemporary styles so we did have concern with that our contemporary style structures specifically within delida are usually one scale or small scale and they're usually one story um we did have concern um because of the small scale that um the board's going to determine whether or not and let's see i can go to looking at the streetscape um you can see massing wise we did have concern looking at the historic streetscape not specifically the two-story new new infills that have come into the district but specifically the smaller scale even two-story structures within the district um the proposal had a larger massing okay with regard to colors and materials um we did mention that they were requesting bronze frames windows on there is concern with that it is more of a modern style uh within the district just so within it's our hopes that when a new info comes in within the 50 years that it's constructed that it does it is constructed appropriately with correct materials um correct color materials so that it too could be a contributor one day so um the bronze gives off more of a more of a modern style look and it's not considered appropriate for the historic streetscape i did mention the roof earlier the roof is proposed to be slate blue so the board's going to need to decide on whether or not the um the roof color is appropriate for the district um i as i previously mentioned there is concerns with massing and then this is the streetscape rendering again so here we can see the contributing residents one story and then the proposed we're looking at specifically for the east parcel on this one but um concerns with massing for the larger side of the two story um within the historic streetscape was an issue okay going into the west parcel this one we also had issues with regard to massing so visual the streetscape and then for the most part i believe the mission um material wise uh we did work with the applicants a lot on this they did originally propose another contemporary style and um per our comments they did go with something a little bit more um common within the historic district and mission two source um structures um are very common so we didn't have an issue with um the style okay so for demolition um we did note and i think i previously put this in the report that um they would have to raise the structure if they were to demolish it um there is a note when you're looking at the the planned environment of the historic streetscape um there are other structures that are historic within the streetscape uh we did note 125 dixie boulevard um that are further back on the lot and it kind of goes with the historic pattern of the district um so our concern is the removal of a structure that steps so far back on site um would somehow destroy the historic pattern of the street as everything is coming up and conforming and becoming more cookie cutter these are screenshots for the secretary of the interior guidelines and this specifically discusses the not recommended approach for removing a historic structure these are also noted in the staff report so these guidelines are in place to protect the historic structures we do also know in our always delray comprehensive plan let's see here we notice one of our goals is to increase the number of historic resources so this request needs to be considered seriously the demolition of a contributing resource is a very very serious matter when it comes to historic preservation specifically into our code these are his our certificate of appropriate findings includes my presentation any um do we have any public comments public comments or do you do do you have no public comments first then rebuttal yeah public comments hi i'm rhonda sexton i live at 2439 southwest 35th avenue and were you sworn in yes i was okay i was here at the beginning okay very good got a check um so as some of you may know me i have actually served on this board off and on for 26 years i'm not currently serving obviously but a couple of things that i wanted to point out that i felt were important for you to keep in mind in 26 years of being on and off this board i don't think i've ever seen a property come in that had less historic significance is it in the historic district yes was the shed style building put in in the 40s yes but it doesn't have any architectural features it was you know back in the 40s i did a house over on southwest first avenue and they didn't even have materials to work with because it was after world war ii we had a a roof that was two layers of drywall with tile on top so there are a lot of things that were built in that era so that are not really deemed as significant um to a normal builder or somebody looking at the structure and i think kim did a good job of pointing out some of the other problems that they were running across so i would highly recommend this be allowed to be demolished whether or not you know you have to look at the other structures the other thing i need to point out to you is they have asked for no waivers on this they they've gone through the city uh commission they've gone through you all as far as dividing the lot and there are no waivers on the size of the scale of this property and we just saw one that came through and breezed through this board just a few minutes ago that was much more grand i love that they're representing two of the significant periods this del ida area has two periods of significance and if you're new to the board that may not have come into play before but um so the first period of significance was back in the 20s that's why you see so many mission styles and then delray took a downturn financially the the city itself and it wasn't until the 50s when the soldiers came back from war and they had the gi bill and they could get mortgages that they started building again in delray beach and that's why you see this mid-century modern these simple styled homes with the sloped roofs no embellishments and i think that they've done a good job of presenting both the mission spanish style uh and the mid-century modern style for this uh neighborhood and i hope that you'll approve them thank you thank you steve polutniak i live at 25 george bush that's across the street from this whole historic district so i'm not historic you were sworn in yeah i was here too at the very beginning uh i'll try to do this very quickly because you know what my hair was going back when there she is right there when kim was talking you know when the board approved the split to two lots in a commission unanimously approved it there was some semblance of belief that there would be something really good put on these two lots this property is a jigsaw property that's what i call it when we moved in in a non-historic district uh 11 years ago we felt that was the uh that was the what do they call it the the the scary house on the block i mean that was just a mess i mean just look at the way the staff presented it it's the same way it's a jigsaw piece it's just three four pieces that's why it should be demoed and then having to do with the two story homes they're magnificent they're absolutely beautiful and just like the prior lady said um this massive 5 000 square foot house that you guys just approved i looked at that and i said what the hell how is it that you're approving something that big that actually was magnificent and there's even a thought that these two homes would not be approved that's it thank you kristen finn 102 george bush boulevard first want to say congratulations to zach and gregory i served on the historic preservation board for three years ben was chair during some of my tenure here um yes i live at 102 which is directly east of this property of my husband and i have lived there for 22 years um we love our little 1925 spanish mission but i just wanted to come up here and emphasize how excited we are about the prospect of having two new homes on our street that actually i feel like align more with our street the current house in its condition sits so far back um i literally i have long arms but i can stretch my arms out and touch the house in the fence at the rear and one section um and it just it feels out of place for the street um i want to emphasize too that the dwyers have been um so mindful of all the ldrs um they live in the historic district they live on dixie boulevard they've been our neighbors um you know we we we have a very tight delida park neighborhood and they worked diligently with their architect and with staff um there again want to emphasize what ronda was saying they're not asking for any waivers any variances as most of the board will know that's rare even for new construction um we are very much in favor of the home styles that they're proposing um they we feel it will complete our neighborhood and make more sense on the street than the current home um i know the current home was pieced together over the years and i feel like the only contributing the only reason it is considered a contributing structure is the age it's 50 years old um and i'm asking for your approval with the ecos and the demo tonight thank you thank you if there's anybody else that needs to be sworn in that hasn't been sworn in you could just stand up and raise your right hand and get sworn in as well i do i'm scott cohen i'm i'm at 17 george bush i'll be pretty sure everything's been said about you know the house across the street is is just a mess um i'll be very glad to see it go um you know i like the idea of the new house i've seen you know i walk my dog all through lake ida every day and i think you know the houses that are going up there as good as they're going to get so that's all i have to say thank you good evening shirley spader i was sworn in and tonight has been quite an education i appreciate that especially from my new neighbors um you could just state your address for the record 801 north swinton avenue in delray thank you very much this is good taste and i'm really excited to see these homes being built um what and occupy a space that is currently an eyesore and i believe poses danger and i say danger to the neighborhood um as is so i am in full support of demolition of this property it it by all appearances offers no character um and that's a stretch it's i'm very pleased to to and excited about the prospect my full support again for the full demolition and the building of these two properties thank you thank you george long 46 north swinton well when i look at that from a subjective point of view i think well there's nothing here to save people that's correct technical point of view same thing you can't do i think that house easy enough now as for the uh proposed residents these these buildings uh just have a big sense of belonging when you look at them a um a spanish mission and this mid-century uh house that this looks absolutely perfect and it's it's not too far from where we've got people putting up the what i call the lake ida coastal defense buildings with the huge huge squares moving out right to the street this is perfect thank you anyone else for public comment all right we will close public comment and any rebuttal from the applicant or staff okay the only rebuttal i there's two things um one is that the comment was made that there are no two-story contemporary um in historic delida there are no two-story contributing contemporary in historic delida that's true there is one non-contributing two story structure in delida however there also are no two-story minimal traditional or vernacular contributing structures in delida so some board somewhere way back when made the decision to allow in 1975 the um minimal traditional that's on the corner the white one i know michelle knows the name of that one and someone allowed the 1972 well that was before this was deemed a historic district so those were built before then so those two were built before this was deemed a historic district but they're not considered contributing so that's the point there the white one that is like a rental apartment on the corner of northeast of fifth street and second avenue that white one i consider that minimal traditional you know that one and then the two-story but they're both from the 70s but they're not contributing but if you look at history for some reason everything that's been built is the the minimal traditional the only other thing i want to talk about is um you talked about 125 north dixie 125 north dixie um i we divided that lot so i know that structure well um our best friends built the house next door and they live next door to me now um it's a frame house it could have been lifted it wasn't below the finished the crown of the road um it had a story boy does it have a story um so obviously i took that into consideration because it can be done where you build something cool with a rear set home this just wasn't that case thank you ken so i have a few items um and i'll try to be swift with them uh so we did misstate that there are no two-story contributors in the district or however it was said the way it should be said is that there are no two-story contemporary or mid-century modern residential structures in the district that are contributing there's one um that that was shown on the drawings for 250 royal court um which was i think tot's office architect um he built that for himself so we don't have a lot of comparison to make um the other thing is the um slide and if if you could exit and bring up um just so we're all clear there was a comparison slide being made to the jeff wooster um property could you go back to the file folder i just want to go exit out yeah thank you sorry no i need to go the file folder in our city presentation i see so anyway the wooster example the drawing that was included in the applicant's uh presentation was an earlier iteration of that house on fifth and what you know they did come to the board three different times to alter the bulk and massing of that structure so the overall height of that building is 22 foot tall which is to the median of the building height and this isn't going to load but ultimately that building sets in on the sides it's not built all the way down to the first floor side walls so that isn't a fair comparison exactly and i just wanted to be sure that we were comparing apples to apples here um the bronze windows yes those are have been approved by the board on a case-by-case basis for other structures the predominant window material in color is aluminum and white when we're doing replacement or new construction the proportion of openings that was made in comparison to the mission style to the east is the proportion of openings on this building are much broader than what is on the mission to the to the east so i just want to make sure that we're clear in how we're comparing the architectural elevations of these two buildings from the member of the public miss sexton all due respect she did say you know in post-war soldiers were coming back and we had new homes being built in the mid-century and what was happening at that time was the country was in a period of recovery post-war but also post-depression and so we typically did see architecture that was very simplified not a lot of architectural detail that is a style or characteristic of the mid-century style structures and i'm glad that the applicant showed the examples on fifth because those are all our one-story structures i'm not going to be able to pull this up in time to keep this on track because we got a lot of items tonight one second please if you don't mind oh saying that a structure doesn't have architectural detail or character is not one of the standards listed for demolition if you read in your staff report there's very specific standards we have lots of structures in our historic districts that are very plain and simple but they are a collection and represent a period of architecture that is important in our country's history that example's on banker's row where you have grandeur on the west with the 20s mission and spanish style and then you have the simplicity of the cottage vernacular style on the east side of the road that is historic preservation not all buildings and structures are the most beautiful but they do represent a period of time as far as the period of significance goes with historic districts every so many years we restudy and look are there buildings that could now be considered historic and we start with a 50-year threshold which is why the period of significance range sometimes extends just like we communicated to the architect in the previous project the new construction the hope is in 50 years from now it will become a contributor so um that is a uh continuum um that is ever changing um i think that's the the main points i wanted to make on in rebuttal thank you okay well now we'll go on to board discussion do you want to lead it off i think the applicant kim did a great presentation very very persuasive very well done um i and i also appreciate the the neighborhood coming to support the project i think that's great when when people from this um historic neighborhood come to to voice their opinion so appreciate that um i have no issue with the demolition of the property i do think it's doesn't really have any character worth redeeming um learning more of the history of how it's just a a piecemeal of different of different properties it's set so far back if you raise it it could uh it it you might demolish it anyway so i have no issue with that for the two proposed properties the the spanish mission style i think looks beautiful that fits the street there's other spanish mission uh designs and and styles on that street um i do think a variety is also nice i i do love the mid-century modern i think it fits historic neighborhoods um i guess my only concern the only item i keep looking back because i keep going back to the to the elevation and the rendering of the the mid-century modern and one of the the staff's comments about how usually those are one-story buildings and this is a two-story kind of elongated um it the architecture the design feels a little busy to me um visually i see there are there are these poles or these columns next to the garage that seem a little odd um overall it's nice overall i do like introducing this this style to the street but there's there is something about it that i can't quite put my finger on i'd love to hear the architects and jake's um point point on that or or opinion um but overall i i'm mostly in support i just have this one um concern about the style of uh the mid-century modern one yes i'll go next um i do agree with what he said about the demolition typically i would try and i wouldn't support it and i would suggest taking at least the original part and saving that while also subdividing it but this is a different case for this lot and i i was born and raised in lake ida so i so it was kind of the the scary house i didn't go there on alleyway but um but all jokes aside it i do think this would be a great fit and going to what chris said about the mid-century modern one it is it is a lot going on i know you mentioned you're thrown in the the columns in different styles from different houses i don't think it's too much going on but it is a lot and maybe it's the the teal getting thrown in there too it it gives you a different different sense of what it could be going for my actually the the issue that not the issue but the thing that's stood out to me was the the slate blue roof i i'm not huge on that but it's also it's not a deal breaker but um all that being said these are these are great proposals for what's currently on the site i will add i'm i'm okay with the bronze on the spanish mission i do think the white frames would work better on the mid-century modern um that is my opinion and i probably would love would like to see that change to white i think that frames are white on the mid-century modern are they no they're bronze on both of them mr baffer do you have any comments yeah i mean i think like we're all feeling about the demolition we we hate to lose a contributing structure in the historic district um but i feel like we're um sacrificing one for two future contributors i mean it you know it just makes sense um you know i i really love both of these homes i i mean i i gotta applaud the applicants for just having the guts to you know to go with the all-out mid-century modern new construction i i i they asked that this is going to be the coolest house in the city um and and i'm i'm really okay with it with some of the non-traditional features of both of these um you know whether it's the bronze windows or the or the slate blue roof because we don't necessarily want to build pure replicas right we're not celebration florida we're not disney we we we want to build a you know a 2026 take that pays homage to to the to the traditional historic homes in the area and that blends in well with it i think that um that that these are both just really perfect examples of that all right mr pitts on the spanish project what is the height of that fence and on the wall on the right what's the overall height if you had to profess and michelle what is the height in the historic district for a new fence a new wall on the front so um a fence or wall that falls within the front yard setback has a max height of four feet so you couldn't have a fence that goes down the side and across the front more than four feet in the front yard setback to me just looked a little taller than four i don't know why it falls outside of the front yard setback um if you're outside of the front yard setback you can have up to eight feet actually okay um okay well i mean i i love the mission project i i think that is a beautiful aesthetic very in keeping with the community um actually you're right i'm i'm wrong my apologies it is in front of the outside of the front setback am i reading that correctly that that is correct uh carlos lenares uh stuff architecture um so i believe it is a either a five or six foot uh high wall uh it could definitely be reduced down to four if that is what is required good catch mr pitts that wall does need to come down to four feet at least where it's outside of the front okay um inside the front setback i guess my other question what is happening over the the two windows to the left of the front door what's that detail above the window that is uh painted tile arches that is that is something that uh staff had also um requested for us to take a look at it was more in line with this style home so it's just adding some detail to the windows that is what we requested not specifically the tile we had originally in the previous iteration the windows were squared and there was a hole i think the applicant showed it in their presentation there was a hole at the top of the arch and there was a lot of space between and we asked if they could look at the proportion of that space um and you know they said would you be okay with tile and you know sure let's see it and so this is the iteration that we saw we didn't specifically say do tile arches have you shown a detail of the tile the color the is there a detail in this presentation or i don't think that we have specified the specific tile no but uh it's it's you know it's going to be a hand painted tile that is going to be well in line with this style home okay i feel like we may have it on the color of material form right yeah here we did talk michelle about the fact sorry if you're going to speak you might got to come up to the lectern please michelle we did talk about the fact that it would be something similar but that we would put this on the you showed tile i i remember it too i do i'm in this presentation so it's in the backup um that's attached to your staff report okay um it is there a concern that you have no no i'm just wondering i think it's a nice detail i just was curious wondering if it had been presented and evaluated yeah we we have looked at some ideas but it wasn't finalized okay and would we incorporate that within the let's see if we did approve it would be subject to review by staff or yeah i think there's some design flexibility allowed um their color palette that they're using is this green or teal color so i think allowing some flexibility for creativity it's a it's a great detail it really is um going to the contemporary project on the east parcel a question um i was wondering if if the roof was changed did i see somewhere that it could be silver or blue or specified as blue but was so it is it is uh specified as a slate blue uh it's just a name it's not necessarily blue it's just a dark almost like a charcoal uh gray roof uh we're definitely open to suggestions not we're definitely not married to that it just gives it a a beautiful contrast uh that is why we typically go with a darker roof uh but we're definitely open to that i mean i don't think that it's really going to be visible from the street anyhow um you know you may be able to get a little hint um on a 2d elevation as you can see that's the only elevation that you're able to really see it so it doesn't really stand out but we're definitely open on this elevation how big is that how wide is that door is am i reading that correctly there's a window and a door there on the at the bottom uh floor yeah on the bottom floor uh so so the windows are probably a little large uh they're probably four feet to or maybe even five feet to where the door is only to wait to 36 inches okay i mean it's it's not going to be seen from the street anyway so not a big deal i just then that falls in line with the proportion of openings um and then i think my final question was what is the material of the screening in the front of the house is that aluminum stucco that that is uh cmu breeze block okay painted looks looks really nice is that custom or do you is that available off the shelf they they are available off the shelf uh there are many different companies that are making them they're very super popular now um obviously this is a little bit more of a tropical wave type of um pattern um typically you don't see these type of patterns but there's many options there but we just thought that it fit really good with delray ocean you know so that's how we related this pattern is that is that the actual breeze block that's going to go in like that exact one yes yes uh we we could provide um the manufacturer if you guys need to absolutely so yeah so definitely feel the same sentiment about demoing a property in delray um you know at the same time i think you made a very compelling argument uh for why to demo it uh especially it being cbs and lifting it being pretty hard and then the 50 percent rule and everything you you added in um also uh really uh when i first looked at this over the weekend i was thinking wow these these are big homes for the lot but after you know your presentation and uh talking about how there you know there wasn't any um real variants asked for or uh you know that you you fit within the setbacks uh so you know i think you've made a compelling argument with that and then i i do this has really grown on me the more i look at it um so i i think the the you know the mid-century modern contemporary there's not a lot of it around like you've said this is kind of like almost like a new take on something that's old and i i think it's it's kind of maybe because it might be something that might be a trendsetter um in the community so um uh yeah it's a it's a very cool home um and then uh yeah the the mission style um home yeah i don't really have much to say about that one but that's my two cents thank you um so i've one question or a couple comments again you know i think we've spoken about the original structure it's doesn't have any historic significance um so i'm for the demolition the mission uh style home i think is beautiful i think it fits within the neighborhood i do agree with staff about the mid-century modern that this would be largely the first of its kind um and if you could go to it's slide 123 but i think there's a a better one that shows the east facade so this one here um it it it does call attention to actually if you could go to 120 119 i think there we go perfect i think that pitched roof really draws attention to the fact that this is a two-story home and it's it's a really cool architectural feature um but i think in keeping with staff's comments about the lack of mid-century modern two-story homes and that they are typically one-story homes because that's what was built in the 50s as budgets and styles and lot sizes and development necessitated i know we're not trying to design from the dais up here but would it be possible to maybe even that out or would that be something that could be considered or is that a really prominent feature of the plants that that pitch up actually i think that this is one of the more attractive features of of this style i mean as you could see any reference that kim brought up have that slanted roof um and and this is almost the feature that makes it um that style so i mean we could definitely look look into that um i don't think that it's going to read well or as well as as as what we're presenting today but uh we're definitely open to looking at options but i still feel that this is going to be a better better design okay yeah i mean they're just there's there's the the the pitch roof is a tenant of mid-century design and you have at least in the front facade no other pitches that's the only pitch so calling that the big reference to mid-century i think is just my professional opinion it as a real estate developer i think is who really loves mid-century architecture and um i think is is not completely accurate again i won't i won't disqualify anything from it um it reads a little more california lodge to me with the pitch the one pitch up kind of looks a little like a brady bunch house with that one pitch up but again i won't i won't disqualify it so um other than that i think the massing is is fine i think it matt it you know really fits within the uh the neighborhood i don't see any anywhere where that would stand out and i really do applaud you both as the property owner developer and the architect for really taking your time to study the various homes in the neighborhood find specific examples um and come forward with a plan that and plans that uh really are complementary to the area and i think as as a couple other people have said that in if we're looking for homes that in 50 years are going to be deemed historic and deemed contributing i think these two uh really will will be that way um also i know that staff had mentioned um the size of the homes and and kind of the massing but um you know these are new homes that are being built and people looking at new homes have certain needs and certain wants um so you have to you know kind of can't get that in a one store you have to go up to to add that in um a lot of times and i think this is a prime example of where the two story works for um both the design and and the needs of modern home buyers and today's home buyers so um i'm in full support of of everything as as proposed thank you could we go to the one rendering that has the angle looking from the garage side and just where the angle or you're sitting in the driveway looking in the front this one not this one the angled one where we're to the to the right um i think we need to go to the applicant's presentation so just give me one second i'm looking at it on my screen here there's one portion of that front facade that has the waves that when you start to walk through the front to the front door it's just a solid a solid wall and it feels very blank there i'm i'm wondering if that that patterning could continue around the corner of that entry it just felt like a very blank entry up to the front door or or if a gate could be put there or a gate yeah what's happening what's happening behind those walls because i can't get mine mine kept crashing to here i finally yes that that thank you the bottom i think our wi-fi is struggling right now the bottom picture okay you see where i'm where i'm saying where the with a wavy wall then turns into the front door and it's a blank this one it's just a blank wall and then it goes to another blank wall yeah i i believe that that was just something that we miss on the rendering um obviously we're concentrating more on the front but definitely it should definitely wrap around continue the patterning correct okay and behind behind the wall what's happening there uh it's just garden it's just the landscape you can you access it through the the side gate that is correct did i see because we aren't able to see what your wi-fi is not working that little oh just bringing the breeze block around okay okay thank you so much is everyone okay with the bronze on this one yeah they had that rendering of the windows and white did you try this one with the white windows to see how it how it felt with the the rest of the architecture uh no we did not um we we didn't think that it would um you know with just the colors that we have it we felt that the windows would pop a little too much you know you you have the the wood trim and then all of a sudden you had the white in there uh i think that the bronze makes the window disappear a little bit more um i mean it we could definitely look into that but i it may just pop a little too much i think with the white windows if no one else has an issue then i like it okay i'm good remind if i could remind the board that the decision making should be made from a place of whether or not the project is considered compatible and consistent with the ldrs not whether or not you like a project or dislike that was the quasi rules just as a reminder thank you we need that sometimes all right is there any other board comment board questions for staff or the applicant right someone like to make a motion and we're making a motion for each agenda item yes that's correct so a motion and then a vote and then another motion yeah i'll make the motion i will make the motion to approve the certificate of appropriateness and demolition hp 293 2025 for the prop is this the right one no 298 298 is d i opened the the wrong one so i'll leave it from 298 um for hp 298 2025 for the property located at 14 george bush boulevard delida park historic district by finding that the request and approval thereof is consistent with the comprehensive plan and meets the criteria set forth in the land development regulations with the condition of continuing the pattern of the front block around uh to the front door does that need to be in there is there a second and then you can discuss it a second um so d is the east yeah so we got to add the um breeze block wrapping the corner as you're asking but also that any fence or wall in the front setback be no more than four foot high right i will add that um those are the only two things i had that you were sure you wanted yep that's on each property or the height is on each and i forget which one's which so this is the east we're on east so this is the one with the wraparound block we have done this the whole time we've reviewed this project so i apologize okay so um you've amended is there a second to the amendment i'll second okay and then are you guys ready for a vote okay call the vote zach purdo i approve richard casser yes benjamin baffer yes gregory pitts yes jake linopolis yes chris cut basis yes now moving on to the west parcel which is this one yes sir okay i move to approve the certificate of appropriateness and demolition hp 293 2025 for the property located at 14 george bush boulevard del ida park historic district by finding that the request of approval thereof is consistent with the comprehensive plan and meets the criteria set forth in the land development regulations subject to the condition of the uh any walls in the front setback shall be no taller than four feet we have a comment about the tile is that on this one we have to do a second and then discussion yeah and the tile detail to be supplied to the do we have do we have a second second yes then i need to amend to include the tile detail for staff approval yes second okay any other comments to this motion please call the vote when you're ready zach purdo yes richard casser yes benjamin baffer yes gregory pitts yes jake elliopolis yes chris cabezas yes congratulations thank you thank you um can we take a five minute recess we were just gonna ask yes okay all right so we'll reconvene at 805 thank you accuse myself on this one i'm the landscape architect on the project see you guys later thanks chris i am going to read into the record addenda item 9f for 23 south swinton avenue this is a level two site plan and coa file number hp-487-2026 we have the um architect um for their project here to present on behalf of the property owner if he could before he starts um yes any experts a communication no no no no no no let me my name's donald morris i'm a architect i'm a licensed uh with an active architectural license however i've really been actively retired for about four years now uh my son purchased this house on 23 south swinton avenue and called me up it was a hey dad call hey dad i need to uh bring you back into the bullpen you think you could help me out on this project he said well you know in my 40 some odd years of architecture i've really never ever done historic house just because of the time and the sophistication it takes to be involved with such a project so the last two presentations boy i'll tell you that's going to be a hard act to follow but i'll do the best that i can could you state your address for the record please 23 south swinton avenue thank you yeah um this picture here i don't even know what i'm looking at to be quite honest with you uh i don't see i guess this is this is uh the swinton house behind the cyber truck okay he recently went through a level one alteration which consisted of painting changing out the windows with uh single hung windows and the same opening size as the original windows were with clear glass uh non-reflective he the house is a single story uh house it's a wood frame home built with two by four wood stud construction it stands sits on a raised wood floor with a crawl space below it has a hand frame two by six wood roof truss system it's a clad with lap siding and it has a standing metal seam roof which i'm sure is not original to the building probably at one time had a fiberglass shingle roof or perhaps a tile roof but the level one it also has a an attached carport and an enclosed patio in the rear of the structure so the level one proposal and has been completed as this picture illustrates is that he also added a hardscape to the front with stone pavers undulating knee wall which is about 20 inches high which is pedestrian friendly where you could people invite people and sit depending on what the actual occupancy will be in the end the tenant and he brought in very mature trees and you can see from this picture that it almost blocks out the four story parking garage that's located on the other side of the alleyway in the rear of the parking it's about a 40 foot tall monolithic structure and to the south of it as well as another 40 foot monolithic structure so oh let me see what else we got going here here um okay well this is another angle look at south swinton it's the one with the light green tree in the front this is uh the site plan or the area plan and in the heavy red circle uh it shows his property and to the right side where the arrows pointing is where the four story parking garage is located you could see on the top picture here that was the original site plan showing the house and you could see the rear covered patio that was enclosed i'm sure without a permit there's no code that would have allowed the construction that enclose that particular structure uh so what we're proposing to do is to remove the that existing handicapped ramp and the enclosed structure and replace that enclosed structure with a new enclosed structure which we're going to call the air condition linked link between the original building and the proposed two-story structure now that link is in the same footprint the same dimensions as the original uh enclosed porch is and it's going to be built with wood frame not two by fours because code doesn't allow by two by four uh framing anymore we're going to use two by six but it's also going to be on a raised wood hard uh floor joist with a crawl space below and a standing metal seam roof above and that's going to be the link between the the existing and the new proposed two-story structure you can also see in this the parking uh there's two parking tandem parking spaces in front that's going to be dedicated to the residential portion of the project which is on the second floor of the two-story addition and we're proposing four uh parking spaces in the rear off of the rear alleyway one being a handicapped parking space one being as compact and then two standard stalls this is uh the floor plan of the proposal you could see in the front is the existing structure you could see the link in the middle with the double doors leading out to the landing that goes as at the top of the um uh handicap new handicap ramp and then the rear portion the first floor of the two-story addition is primarily commercial with the finished floor being flush and continues with the link and with the main house uh with the exception of a cutout in the rear for a stairwell which leads up to the second story residence you could also see in here that uh to the bottom of the stairs there's a pair of french doors which will be the trash can receptacle area for the residence you could also see where we're going to be placing the uh on the south side of the building you could see we're placing the two condensing units one for the upstairs uh residents one for the commercial space in the link this is the upstairs residence you can see as a stair comes up it opens up into a into the kitchen area we have a living room with a double door going out to a little balcony that looks at the beautiful four-story parking garage it's a two-bedroom residence which my son is actually going to be going to be using is one of his places when he wants to come up to delray beach uh to have dinner he's going to be using this he's not renting this out this is for his own personal use but it's a two-bedroom two-bath uh unit this is up above is the original um have my i guess this is the north elevation yeah existing north elevation on the top you could see the handicap ramp going up to that enclosure which is you see that you could see the carport sticking out and then to the left of that is the rear uh enclosed uh enclosed existing enclosure which we're going to rebuild and then you could see the north side of what we're doing here ground floor is going to be stucco second floor is going to be hardy board siding uh the roof is going to be standing metal seam roof uh all the windows are single hung windows with clear glass non-reflective uh shutters with shutter dogs on it uh we've really tried to lower the profile uh working with michelle and the crew the structure is in the back is is uh concrete slab on raised grade the second floor is going to be made out of pre-stressed concrete hollow core structure and the upper floor or the roof structure is going to be not wood roof trusses but metal roof trusses because we're going to try to keep the building non-combustible so that we won't have to put a fire suppression system throughout the building you could see here that there's a two-in-one line of site from the property line on swinton avenue from the property line and you could see that we're well below that two-in-one slope you could also see i think it's a 33 or 35 foot i don't recall uh maximum height which we fall well below this is the um um can you anybody read what side i guess that's the south elevation that's the south elevation you could see on the bottom right corner the double doors for the trash containment uh we also have some faux windows where the shutters are in the closed position there's no actual window behind it it's just to break up the space and to make the rhythm of the architecture look a little bit uh less blank um but it has the shutter dogs in the place as if the shutters could actually open and be held closed by it this is the front elevation uh it looks the second story looks like it towers over the ground floor but we have over the iterations of this project lower the floor to floor heights significantly lower the pitch of the roof to two and a half and twelve um and with the extent of mature landscaping that he brought in you're not even going to see it anyway from the swinton avenue as you could see going back to those pictures you'll barely see it if any this is the rear elevation um facing the parking garage uh we have a water table horizontal water table stucco band uh which is placed at the actual height of this the first floor commercial space so you could see where the front door to the residential stairwell is located as well below the finished floor elevation of the existing main house in the commercial space i passed that through engineering and all and they said they were good with that being below uh the minimum required finished floor elevation uh all the windows you could see again are single hung muttons clear glass this is the streetscape view on the bottom and above is uh that's the new massing the shaded area indicates the area of the new proposed uh ramp handicap ramp the link and the two-story structure not quite sure why that cut out for the stairwell is in hatched but i'm a hand drawer by the way i've never done one of my projects in autocad i'm one of the last guys that i'm sorry but your time is up we'll give you another minute or so okay i think that's about it uh that's a roof plan showing that it's all hip roof uh that's one rendering we've got of level one and you could see the two-story behind it there's another perspective uh without the trees that was without the trees they asked to see what it looks like without uh all of that uh this is the night view of what's there now what he did with the the trees and it looks lit up and bright and ready for pedestrians to come and enjoy themselves there okay that's enough well everybody has a time limit so unless you have something else we'll have to cut you off thank you for hearing me sorry about that if there's something else you'd like to say no i've uh said about as much as i need to i think okay thanks very much yeah sorry okay um staff will will present once again michelle hewitt senior planner this is 23 south swinton avenue for level 2 site plan and coa on the screen i have an aerial with the subject property outlined in blue to the west south swinton avenue to the east is an alley it is located within the old school square historic arts district and is um it's zoned old school square historic arts district and is within the old school square historic district the property contains a one story 890 square foot frame vernacular structure that was constructed in 1938 as a single family residence the structure is wood construction on a concrete foundation with double hung windows horizontal wood siding and a standing seam metal roof going through some brief history on september 3rd 1997 the historic preservation board approved a site plan landscape plan and design elements associated with the conversion of the single family residence to a law office which included a roof change from asphalt shingle to standing seam the approval also included a waiver to reduce the landscape ship along the north property line to three feet adjacent to the driveway where five feet was required additional improvements in approvals include a color change in 2018 and then again in 2026 along with landscaping and hardscaping improvements the subject request is for a level 2 site modification coa and waivers for alterations in construction of a new rear addition the addition includes construction of a new 2440 square foot two-story rear addition containing 1010 square feet of commercial space on the ground floor and 1330 square feet for the residents on the second floor that includes the stairwell and the first floor and on the second floor combined with the existing 890 square feet the structure will contain a total of 3230 square feet with 1900 total commercial space ground level improvements also include landscaping hardscaping in a reconfigured rear parking area and new handicapped accessible ramp and there are two waivers with this request one to allow the reduction of the overall required landscape buffers and secondary and support in it going through some photos this is currently after its level one approval this is the front west this space is south senton avenue you can see some of those improvements the um applicant uh was mentioning including repainting of the structure uh replacement of the roof um and the shutters and papers on the uh ground level here we have another angle on the other side you can see those windows that went in in the door this is the side interior or north this is where the existing carport is located another angle from behind in the carport this is a little hard to see there's a lot of lush vegetation um but this is the side interior or south side you can see a window and this is the rear or west the alley is back here um where you can see the existing uh parking area that ramp in the back and then the rear of the structure on the screen here i have the survey of the existing conditions with the blue indicating the footprint of the existing one-story residence um that would ramp um just behind and to the north there um an existing non-conforming carport um concrete driveway concrete walkway and then that rear parking area and this is the existing site plan again the existing structure and that uh porch in the back highlighted in blue the ramp existing parking configuration and overhangs carport elements here is the proposed site plan again blue is existing and red is proposed so the existing porch is to be redone uh to connect the two-story addition in the back the ground floor is to be commercial expanding the existing commercial space and then the second floor is to be residential uh on the left there is the approved level one uh site plan application elements and then on the right by the alley which requires dedication um it's the new proposed parking configuration you can also see the removal of the existing ramp for a new ramp on the north and in between that connection this is the route plan you can see the existing on the left and on the right and behind is the proposed this is the first floor plan again blue is existing red is proposed the ground floor is fully commercial um and those steps in the back along with that trash enclosure areas proposed uh closest to the parking area and this is the second floor plan we just left the footprint of the ground floor of existing structure on the left there so you could see it in comparison and then uh the uh on the right there is the proposed residential space going through some elevations this is the north elevation this side has the carport on it and you can see where the ramp currently exists on the top and on the bottom is the proposed again blue existing red is proposed for that two-story addition here we have the south elevation where you can again see the elements proposed removal that connection in between the existing and proposed and the rear addition this is the west elevation this faces south swinton avenue where you can see uh there is a ramp that currently exists in the back but the new ramp that's going to go there on the bottom left of that right image and then the addition relative to the uh existing structure and this is the east or rear elevation the space is the alley um the additions directly behind the structure therefore that's going to encompass majority of this elevation and we have on the screen a streetscape perspective um is what was submitted but we also included what the west elevation looks like from a just straight on elevation to the top there so you can see the massing relative to um the perspective drawing here we have the materials and colors go through those for you so the proposed roof is to match the existing structures standing seam mill finish roof um they will continue to use the same colors that were approved on the level one application including the white and blue uh the white on the facade and then the blue on the shutters and some of the trims all windows are to be clear no tint on reflective nolo e with white frame aluminum and these shutters are to be comprised of an authentic material that indicated either wood or aluminum there's no concern with the proposed colors um on the ground floor of the addition is proposed to be stucco and then on the second floor it is proposed to be a hardy lap siding to mimic the appearance of wood here we have a rendering west facing south swinton avenue this is just a standing perspective where you can see what the proposal will look like in a real world condition and this is it without landscaping you can say relative to adjacent structures going into the secretary of interior standards rehabilitation i've highlighted the standards that were used to analyze the request so the existing structure is one story and would be most appropriate to retain the one story scale when executing an addition yet the addition could be removed in the future without impacting the central form and integrity of the existing structure additionally the subject's property is in close proximity to the city's downtown and central business district consideration could be given to the structure setting as a transition between surrounding uses slash zoning going into the visual compatibility standards there is concern with the addition being taller than the existing structure however the proposed roof shape does aid in reducing the impact of the two-story structure as the ridge facing swinton avenue decreases the amount of roof visible from the elevation and i will show you what i mean right now so existing has the ridge facing uh north and south so the expanse of the roof is highly visible from south swinton but they've turned it 90 degrees so less of the roof is impacting the massing of the addition of that second story there another visual compatibility uh staff report excerpt again a one story edition would be most compatible in scale and have less impact on the historic district again the addition is situated in the rear of the existing structure and smaller and within the existing structure going into the waiver findings findings for each of the waivers these are used to analyze the request and are required prior to any action on a waiver so as i mentioned earlier there was a waiver that was approved for the north side or the existing driveway and carport are located and the proposal is requesting a reduction in the required landscape barriers on either side of the parking proposed parking reconfiguration going into the analysis of the waiver findings um there is already existing parking in the rear it is noted that the parking law is for private use and has existed in the current configuration for decades the development proposal involves reducing the existing non-conformities to additional site and landscaping modifications in order to comply with other parking requirements should they be required it would likely result in reducing the parking by an additional parking space to meet requirements and the existing driveway and carport on the subject property previously received a landscape waiver to reduce the landscape strip on the north property line going into the second waiver for secondary and subordinate we've just got two images here um of the rendering and the proposal next to each other the elevation next to each other so this is a waiver to the visual compatibility standard uh 451 e 7 m6 for a secondary and subordinate requirement as requested it's not considered a secondary and subordinate approach however the addition comparatively does not stand out in the mixed use zoning and closed downtown structures this particular architectural style is just as commonly seen as a two-story while the addition itself is holding the existing structure it is directly behind the historic structure there's also no concern that the proposed addition can be removed in the future without impacting the form of the existing structure consideration could be given to additional height mitigation to reduce ceiling heights or modified roof shapes these are the certificate of appropriateness findings as this is a commercial property there are additional findings of performance standards required for this level 2 application that you can see on the screen here as well as additional required findings and concurrency this also went through a landscape review and photometric review and all of those requirements are being met and or indicated in the site plan technical area to uh comply here we have the standards for site plan and or subdivision plan actions that were used to analyze the request and the site plan technical items and that concludes my presentation thank you michelle do we have any public comment george long george long george long 46 north swim i i know the block well i walk up and down there quite a few times the thing that's really great about that whole block and what he's preserving is that you have that row of historic houses how often can you have that where you have the whole almost the whole block house after half the house because i've been going to a lot of historic districts going through once in a while they're all broken up with with the infield that doesn't doesn't sit but what i saw before i heard your part uh when i looked at the picture i said this is great because it's not sticking way out you know wider than the house is staring essentially leaving the little house as it is and it is a little structure and it is little it calls for the the addition thank you thank you george anyone else have you been sworn in and you have to approach the lectern you'll have to come all the way up here to the microphone please and then state your name and address for the record okay mary morris you already invested in me as a new producer or friend of the testimony you're about to give is the truth absolutely thank you um i was the president of ria vista and also i was a very active person on the historical board on the historical board in fort lauderdale and i am a strict preserver of history at homes and preserving them i had to leave fort lauderdale because i was a tree hugger to stop everybody from building downtown and destroying these historical homes he was an architect and i got him to put plaques on the houses in ria vista saying they're historical so they had to get go to the historical board to change things so i appreciate your job it really means a lot thank you so much okay any rebuttal or cross-examination from staff or from the applicant none from staff any rebuttal from the applicant okay you don't have to um all right we'll move into uh board discussion um if someone wants to lead off sure i i think that the um the plans are are real i mean trying to come up with the right word but i think that they're they're very well done um and i think that it was it was a testament to um maybe the connection to the property and and connection to the owner um but a lot of care appears to be have have been taken um to make sure that everything is is conforming and they based on the renderings it really looks like though the new building was always there um so i am in support of it and i have no no comments otherwise yeah i was going to say almost the exact same thing that um you know it's it's literally impossible to do a two-story addition to a tiny one-story house and make it secondary and subordinate but um the the design follows all the rules and and really good use of the hyphen a really good use of the um the articulation with the stucco on the addition and the the water table and and just a lot of a lot of little tricks and techniques uh that that preservationists use that you know for someone that that has practiced architect and never done a historic um project do all that you you've done really well and i mean it's it's as good as it can get i mean there like i said there's no way to no way to disguise a two-story addition behind a 800 square foot structure but um this is uh just just follow follows all the rules well thought out plan and um and i i i think it's uh just a you know just just a good just a good example of of of how how how to follow the rules and and have a good good plan well he kind of nailed it on the head there there's not much more to add to it but it's a it's a beautiful design um and it's fluid and like you said you came back after retirement and you got a historical one under your ballot it said you knocked out the park it looks great anybody else i had a question on the parking uh is the uh the size of the parking spaces remain in the same you'll have to come up though to to answer i'm sorry we can also answer the question okay there is a slight adjustment of the parking in the rear um to accommodate the the required spaces what as michelle hewitt had said the previous approval had um approved that configuration of the back out on the alley which is what we actually look for to maximize space so that's a slight adjustment okay yeah no i i think the project i mean the whole front historic building was so well taken care of and renovated and i'm sure the back addition is going to follow suit so it looks great yeah i would just add that uh i've been over there and actually uh been in that front area the courtyard with the little knee wall and it's it's such a great design um and it's nice that it's offset and then yeah you guys have done a really good job designing it so that um it stays low from your site and uh i mean you also have the the garage behind that's a big structure which really kind of you know takes away from most most of everything that's the visual you see if you're looking up you know you don't really get to see that addition so i'm all for it i really like it um great example of preservation and renovation and rehabilitation in conformance with the ldrs and the the waiver for the landscaping is a very small ask to preserve an additional parking space which we know we need so much downtown so nice job on the project i'll make the motion to approve the level two site plan modification certificate of appropriateness and waivers hp-487-2026 for the property located at 23 south swinton avenue old school square historic district by finding that the request and approval thereof is consistent with the comprehensive plan and meets the criteria set forth in the land development regulations second zach purdell yes richard casser yes benjamin baffer yes gregory pitts yes jake eliopoulos yes peter dwyer yes terrific congratulations congratulations the motion carries you must be very proud good job terrific great job great job dad because the landscape was so good right that sealed the deal thank you welcome back all right we'll go ahead and move on to the next item thank you so much hi there please state your name and address for the record oh i need to enter the file into the record you're gonna enter me one second for the record again i'm katharina palvota senior historic preservation planner i'd like to enter file hp-139-2025 into the record it's for 703-115 northeast third avenue and it's a level two site plan certificate of appropriateness demolition and waivers and the owner is here briefly to with the with her agent to present hi i just want to say thank you to the board for hearing our presentation tonight and thank you to everybody at the city for all your pre-op meetings and getting us here my name is dr lauren o'hagan and i own a small independent dental practice in the del aida neighborhood i've been practicing here for 11 years and um in this building here and sorry can you just interrupt for just one second yes is there ex parte communications any exports a communication no sorry about that no no no no none nope and prior to me um buying the practice it's been here since the early 80s and prior to that it's actually um from the first dentist in delray beach dr monroe farber so we have some history to our office um so i love being in historic district we serve the neighborhood and the local community so a lot of our patients come from the local area and i just really love being in this neighborhood the only problem is my building is kind of old it's not ada accessible and just time for some updates so working with my team here we came up with some updates that we're going to present to you tonight and the project turned in a little bigger than we initially expected but it's going to include the restoration of a 1930s historic cottage which is the adjacent dental lab the demolition and rebuilding of the dental office which is non-contributing and a redevelopment of the site so it has better parking and better landscaping so my hope is not only to have an improved practice to work in but also to enhance neighborhood and to leave a nice building nice couple of buildings um long after i'm there so um here with me tonight is brian check is the site planner and michael polka the architect so they'll be presenting the details to you members of the board for the record brian check is principal i plan and design uh add principal address 823 north olive avenue west palm beach i have been sworn in uh as dr uh o'hagan uh spoke uh to we are doing the opposite of what you heard tonight we're combining lots we're not splitting them to make a comprehensive plan that's going to integrate contributing structures additions and demolition and construction of an updated dental office building so with that we are located in the northeast corner of the delighter historic district specifically on lots 28 through 30 um we have the fec right away to our east our frontage is northeast third avenue we have a commercial rental property to our south it's a residential home but it's a it's a rental property and to our north is a city of delray beach a public works lift station who accesses their site through our site now and i'll speak to that in our site planning part of the presentation quickly the southernmost lot is 703 northeast northeast 3rd avenue it's the one that contains the uh contributing structure that structure is about 900 square feet originally it was 700 square feet it was a 1930s kester cottage that has had a 182 square foot addition to it years past its original construction the central lot lot 29 and lot 30 is where dr o'hagan's current dental office is located and the northern lot is a parking lot that serves us but it's also serves as the access point for lot 31 which is the city's public works lift station as you can see in the photograph on the left hand side you can see the lift station on the left side of the picture and then dr o'hagan's office to the right what we're proposing to do is to demolish the 2264 square foot office building one story and replace it with a roughly um 3 700 square foot uh medical uh dental office it's a partial one and two story structure uh further we're going to pull back the 182 square feet of from the contributing structure to bring it back to its original uh design and we're proposing to add um about a 1017 square feet to the rear of that uh existing cottage very quickly just to fly you through the site and how it's improved with these modifications proposed for the architecture on the site um the the site programming includes uh today for our driveways access these three lots we're going to be eliminating three of those driveways and there'll be one main central access that accesses all the uses on the site uh parking's been pulled to the sides and the majority has been pulled to the rear of the building adjacent to the fec right-of-way uh we have full of code today we would be proposing fully code compliant access through the site and providing that same code compliant um access to the uh city's lift station north of us on lot 31 it's very strong pedestrian connections from northeast third avenue into the site to both buildings as those buildings aesthetically and functionally um access from the front uh and can be accessed from the front and um and there's a lot of pedestrian access to the side of the building where there is going to be um an outdoor courtyard for private use of the employees who are working in the historic building for the first time in a long time there's going to be extensive landscaping in that front yard 25 foot front yard area in front of both buildings and more so the um the contributing structure will be more ensconced today uh ensconced and landscaping as part of this redevelopment than it is today which has uh basically a u-shaped driveway that wraps around the entire building and we are maintaining uh the majority of the of the existing native trees in the fec buffer uh and along the south buffer adjacent to that uh contributing structure as part of this we are asking for two waivers one of the waivers is just a functional waiver waiver one is a request to eliminate the required loading space it's a dental office we don't require a retail style of loading area so we put that extra circulation and asphalt area into landscaping and pedestrian circulation the second waiver request is to uh it's a very minor one in the northeast corner of the site we have a landscape island requirement of nine feet wide we're asking for the very tip of the island uh to be reduced to 8.5 feet and this is just a function of the site being shaped as a parallelogram and our parking angling uh parallel uh perpendicular to the rear lot line it gets pinched the very very tip of that landscape island it's out of sight no one will ever see this maybe if you're passing by the train but even then uh we're not losing one landscape uh uh plant in that island it'll fully comply with all the landscaping standards staff is uh with their findings performance standards uh we believe our application is consistent with with the following ldr sections 3.11a through 3.11d that's for the land use map consistency concurrency performance standards and your land development regulations with the approval of the waivers um we are we believe we're uh we are consistent with the uh comprehensive plan and staff did note seven items of site plan technical items that we need to follow up with them on we're full compliance with that and we agree with that and we have no problem providing uh your uh your staff with that information we're seeking your approval this evening of the level two site plan certificate of appropriateness demolition and the two waivers and with the certificate of appropriateness i'll hand it over to mr michael polka from lca architects and he can talk about all the wonderful architectural changes thanks michael polka i've been sworn in um with lca architect with lca architecture uh 1975 sansbury's way west palm beach florida 33411 okay these are uh existing shots of the uh current contributing structure and its non-contributing uh addition to the rear uh in the the uh let's see the uh north elevation if you can see zero three uh you're gonna see a little shed that's a non-contributing addition uh much much later than the original home um and then behind that there's uh about approximately 182 square foot um i believe um in the 90s uh edition um and it's also non-contributing and is extraordinarily badly damaged by termites as i witnessed myself inside um one of the things you'll notice is it's uh i believe it's a minimally traditional um clapboard siding shutters uh six over six single hung windows um it's a two by four wood structure um and it has that uh so well that's enough for for that slide um the existing plans you can see now maybe a little bit more clearly um the to the right hand side the plan view the pretty squarish uh part at the rear that is the non-contributing portion and then there's wrap around concrete uh relatively recent um handicap ramp uh that's there now um and as you can see in the very front um the lowest part of the floor plan is the existing staircase which is not which is perpendicular to the front facade which is a little unusual and demolition wise uh you can see that uh 715 that'll be of course 100 demolition uh that's uh 2264 existing square feet of uh the existing non-contributing uh commercial dental office and then 703 um the contributing structure um we are eliminating about 182 square feet with the shed and the um termite infested uh portion to the east of the main existing old uh kester cottage uh contributing structure and that's it for the demolition now as you can see um after removal of the non-conservant contributing part um we added our um office building to the east toward the east and um we tried to uh minimize uh from northeast third avenue the um the impact of the new um structure as much as we could um but there wasn't a lot of space left over so we had to widen out a little bit so we at least widened out far too uh as far away from northeast third ave as we could uh for the new structure and the new structure of course is all uh masonry it's concrete masonry unit structure and uh it is it is going to be a more standard slab on grade uh construction um with stem well foundations and part of the reason for that is to get up to the level so we are at the same level as the existing structure which is all wood it's got a crawl space and so we're bringing that new masonry and concrete structure up to the level exact same level so that we have a fully accessible route throughout including we have a new handicap ramp that will be able to have a full accessible means of egress and all the way to the public way i think this slide is to show that we working with staff they told us that um really most of the buildings especially the homes they have the straight straight on stairway to the front door and not perpendicular so we went ahead and changed that and we added another one to for access and egress to the rear part of the structure if you can see on the right hand side of the top right uh elevation um this this is probably a good elevation to show how um one of the things that steph mentioned was that um working for continuing the of the existing uh shutters uh and to the new structure and the clapboard siding to the new structure we're going to give you a few more minutes oh go ahead oh am i am i almost almost oh that's that's what that's sorry two more minutes okay all right so uh the new pretty much matches the existing um and with the shutters uh we work with staff because the existing shutters on the existing contributing structure have little cutouts that are kind of kind of cute kind of like a keyhole cutout and uh apparently there are there is precedent for the uh cutouts to be in the form of card suits like uh uh club hearts diamonds and spades so that's that's what our new cutouts are so each facade has a different card suit whether spades hearts clubs or or uh diamonds here it is in color we're essentially using the same uh color palette uh as exists now as dimensional shingles lots of texture yeah and and pretty much all the uh the windows are not all of them i guess they're mostly uh six over six but uh some some of the more narrow ones were just four over four uh all single hung and here's the rendering so you get a better idea of how that the color scheme etc now here we are uh looking at the existing uh 715 to the north and the top right is uh showing the uh the lift station uh here are the plans it's essentially uh mostly one story approximately one-third is a two-story the second story being a private office and stairwell and um we pretty much matched the 703 the contributing historic structure in terms of clobbered siding and in terms of single-hung windows um not and okay all right okay so you see the existing dental uh building in the in the inset and our design here thank you we're gonna do a quick shared presentation just because i was super geeked out about the history on this site um so 703 and 715 northeast third avenue this property is located on the north side of third avenue combining three lots which we've heard from the applicant but what's pretty cute do we have a front view of the house yeah there we go thank you um so we were doing our our research as we do of historic sites um and we came across um building permits referencing kester cottages and we didn't know what that was so we went down a rabbit hole and what's really cool and you see that history in your staff report in addition to the storied history of delida park and the streets being named after presidents but you the two of you haven't probably heard this before but the rest of you have heard the same history we share but what was pretty cool is that this was a kester cottage and it was located down in the deer field pompano beach area um and you'll see in your staff report there was a small photo i meant to put it in the presentation i forgot but they were all oceanfront um cottages that were built by the kester brothers and they settled in florida in the 20s kind of had this vision of building cottages that local workers could work on and local people could afford to live in and that would also bring winter residents to the area um they had as many as 150 and a few have been saved and relocated elsewhere throughout pompano and deer field including um the pompano beach historical society but interestingly del rey got one i don't know how i think we may have gotten three um but once we found that this was here we stopped our research and pivoted um so kind of cute and yes the card suit cutout was a thing that they did on all their cottages so when we found that history we shared it with the applicant and they brought it forward um so nice storied history we don't get that kind of background to share often so i wanted to take a moment to share it with you but this site has been utilized as commercial um since the early 1990s when it was converted to a dentist office aka dental lab back then it was known as skinner dental labs and some of you might have remembered dr skinner um and we did have some administrative approvals that occurred over time but what we're looking at now the presentation involves addition to the back small demolition to the back of the historic house addition to the back of the house demolition of the non-contributing structure on the north side of the property construction of a new commercial office building they all have a bit of that residential influence which is crucial to the delida park historic district with its ro zoning and katharina is going to take it from here so that's just a quick background i wanted to share i'm going to go through quickly and show some images of the existing structures so this structure was um it's the 1930s contributing one vernacular one story um frame vernacular style structure so here we can see the south elevation and you can see the um with the shutters the little clubs in them so to the rear you see this is the south so this is the rear of the structure but you'll see um to the west of it that's the non-contributing structure that's being um requested for demolition okay and then here's the rear this is showing the newer edition that's going to be removed you can see another side of it northeast okay and this is the existing non-contributing structure the structure was built in 1972 it's not contributing it's one story and it's a masonry vernacular structure um this was uh once utilized well i think it's continuously been utilized as a dentist's office the structure has a flat roof with a barrel tired mansard roof um stucco exterior and bronze framed windows okay here's existing south side elevation is a southeast this is the rear of the building this is the north side and then this is just an image um i know the applicants did briefly discuss it that um to the north of the parking lot and the two structures there is a city lift station where um they the city does access the lift station through that site so there is a a proposed easement that's um going in for the site with this approval okay and this is a northwest elevation okay here we can see the survey with the two existing structures on site and then to the north of it is the existing parking lot here's the existing site plan so you can see where all of the hardscaping is and the existing parking lot for um the three lots the demolition will be 100 of the non-contributing structure and then 19.8 of the non-contributing structure here we can see the site plan overlay with the demolition of the non-contributing structure the addition of the new construction for 715 as well as the the addition to the rear of 703. this is the proposed site plan so you can see the new reconfigured parking with the addition and the new construction the proposed floor plans you can see the um this is the floor plan for 703 so this is the contributing structure um to the rear you can see the addition the smaller addition has been removed and then they have a larger addition to the rear this is the existing and proposed front elevation so you see from the rear of the property it's a little obviously pushed further back on site the the new addition okay this shows the the newer part of the existing structure to be removed and the addition to the rear west and this is the existing side north elevation and then you can see the proposed with the addition okay existing south elevation you can see the addition to the rear of the non-contribute or the contributing structure being removed and then they have the larger addition to the um to the side of it these are the proposed materials and renderings the materials and colors are to match at the existing um there is no concern with regard to any of the materials um colors um and then architectural style for the addition so here's the proposed elevation and then on to the new construction for 715 so we can see the larger area this is the first floor and then the smaller step back area is the second floor which will be used for private office and then the rest is going to be for um dentist's office here's the proposed front elevation the um the architectural style for the new proposed is going to be framed vernacular will match um the existing contributing structure so the styles are appropriate this is the proposed rear elevation this is the side south side north and these are the proposed colors the materials are also meant to match the existing contributing structure there's no concerns with regard to materials of color for the non um the new the new construction and here's the proposed rendering these are the secretary of the interior standards that apply for um the original historic structure and with the hopes that the new that the new construction within the 50 years of it being constructed will also be um considered historic um this was uh the standards were also um looked at in regards to that and these are the visual compatibility standards that are applied for both structures so there are no real concerns with regard to the existing structure the existing structure does have the addition to the rear um it is considered secondary and subordinate it's placed further back on site um there are no concerns um with regard to the style any of the materials um and then with regard to the new construction it is noted that it is a two story versus the one story existing on site however there's no concerns because the structures are so separated um they're essentially between three different lots um the placement is appropriate and it the massing um isn't considered overwhelming to the existing one story structure so here is the proposed streetscape with two of the structures okay so for demolition um because it's non-contributing uh according to our code it's four five one uh f um if it is a non-contributing structure the requirements the additional requirements and supplemental documentation within this code is not applicable um for a full demolition of a non-contributing structure um for the contributing structure the demolition of um the 182 square foot um it has to meet at least 25 to um be required for public notices and additional documentation so because it's under the 25 percent um the documentation is also not required for the demolition for a portion of the contributing structure so the application also includes the two waiver requests applicants did note this um the first one is for a loading zone um the loading zone is required per specific square footages for um different commercial properties um this one totals about five thousand um 508 square foot so they would be required one birth um however they did know um and these are the waiver findings for 2411 b5 uh we did note that both the structures being office being professional office and dentist office um they don't really um require to generate like a larger volume of deliveries or larger vehicles so um it's not really necessary for this property um which also could be a positive because this is in ro zoning district it includes a mix of residential and office use so the use of larger trucks and things like that um could actually adversely affect the area versus um not having it so there were no concerns with regard to this waiver the second waiver request is for the reduction of a landscape terminal island the requirement for the width of it is nine foot they're only requesting uh it to be 8.5 this was reviewed with both our landscape our senior landscape planner and engineering there were no concerns um these are also the waiver findings um there's no concern with regard to the smaller island um plantings are any type of required plantings would still be able to be placed in the island um and specifically for the reconfiguration of the way that they've done the parking lot um looks more towards the preservation of the historic structure on site um so there's not really too much of a loss in like parking or landscaping because there's such a lush um area um protecting the existing historic structure so that we had no concerns regarding the waiver as well these are also the certificate appropriate findings and then these are the findings um with regard to um level one through four um site plans as well as the required 311 required findings these are all noted um in depth in your staff reports and these are the required site plan technical items and that concludes my presentation thank you do we have any public comment at this late hour any rebuttal staff or the presenter applicant no okay on to board discussion who's still awake we made it to the end you want to start i can start off um i think uh this this property you know meeting all the standards and everything uh it's it's exactly like what you want to see in a historic neighborhood where you're doing an addition and new construction i think it's uh a testament to the staff and everything that this this project's a really i think in my opinion and hearing maybe that it conforms with everything and you know besides the small waivers that they're asking for it's it's a great project so i concur fabulous project and um i think one on the only question i had was could we do a six over six window for the 715 property to match the 713 it's a small element but i saw it on the streetscape that and they might align a little better but again the project's beautiful both buildings are beautiful um yes i don't think there's any problem doing that we could do that anything else well i love seeing the renovation on this street on north northeast third avenue i think it's uh it's a it's an interesting street that has a lot of commercial in a historic in this historic neighborhood um there's some other commercial areas i think it could use more renovation and this this is going to trigger that and i love this project it it conforms to all the interior standards it's really bringing back this classic architecture it was great to hear the history of that cottage which is really interesting um so yeah i applaud the project i'm okay with the waivers um so this will all be one office or this is multiple is this all one business in the two buildings or will they'll be separate businesses separate we met we met a long time ago didn't we i remember y pad yeah yeah that's right um so dental office will just be in 715 and 703 will be professional so not sure exactly who that's going to be yet i have a little bit of interest um but definitely a professional office low volume okay yeah congrats on assembling the properties too i think it's it's great so i'm in support yeah i i agree with the other comments um terrific job on the architecture and the site planning um the i think it's really cool that you agreed to incorporate the suits in the uh in the um shutters kind of as a nod to the the kester cottage i think that's a that's a really cool feature um and i think these are going to be beautiful buildings very was driven but but appropriate within the neighborhood um and hats off to you guys maybe they should be teeth instead so they originally had the teeth um they could have gone forward with it uh it would have been part of a master sign program and i was disappointed that you didn't come back with that you could work the teeth in as kind of an easter egg you know somewhere in the building that would be fun on the interior on the interior everybody would know about it yeah that's right there's michelle she has the answer whoops all right well i'm in full support a great project really close to where i live so very familiar with this street specifically glad to see the investment in the area i think it will spur other development on the street and surrounding areas so i think it's a great example of again preservation rehabilitation um the things we strive for in the district and uh best of luck thank you how about a motion i will make the motion thank you chris if i find it here let's see i went all the way to the bottom it wasn't there there we go i'll make a motion to the approved level two site plan certificate of appropriateness and waivers hp 139 2025 for the property located at 703 and 715 northeast 3rd avenue delida park historic district by finding that the request and approval thereof is consistent with the comprehensive plan and meets the criteria set forth in the land development regulations do we need the condition for the window in there is that staff if that's what you would like to do you'd have to add that as a condition let's um make that a condition i'll suck it zach perdo yes richard casser yes benjamin baffer yes gregory pitts yes jake eliopoulos yes chris cabezas yes peter dwyer yes okay congratulations congratulations uh i apologize if i had to thank you very much thank you thank you thank you okay not to drag it out that's not my goal but this is at your um primarily for your benefit mr perdo and mr pitts the schedule for the upcoming meetings we only have three left in the year um but we meet the first wednesday of every month so you can plan unless there's a holiday i think sometimes rosh hashanah might fall on a conflicting date so we'll move the meeting um but please keep this uh for future reference we also send the agendas out one week prior to the meeting so they always come out on the wednesday prior sometimes a tuesday but it's not often um to the meeting so you have a week to review there's links um kelly britney myself katharina michelle we're all here to support you so if there's questions or something comes up please don't hesitate to ask you are required to track your own absences too we are not going to track them for you and they can stack up pretty quickly and if you hit the threshold it's automatic removal from the board there's no um leeway on that so those are just a few things i want to let you know we are also going to put together an email with some training videos that you can go and watch about historic preservation but i foresee in the future we're going to need to renew it we haven't had training in a while so we'll do a training coming up soon and i think that's pretty much it for me that i can remember there were a few questions about code enforcement cases that had come up with previous board members and those are in process and we're working with the code enforcement team to handle those items so if you have anything for me please let me know i would just say thank you for a um a full agenda it was refreshing and i think everyone was engaged and uh and i know there must have been a ton of work behind the scenes so thank you we've been working late nights um all good project i mean we're not supposed to say good products but i just want to say tonight every one of these projects were just really really ready to come it's been a lot of work yeah and i'm sorry i know that you ask and you've stopped thank you asking every meeting what's on the docket but the perfect storm i told you and that one meeting i said it'll be a perfect storm and i'm sorry it happened on the night of your project but um that's karma it's good it's good to get these this isn't normal but it's it's better when they're all when the project when they're good projects yeah it's good to get them off our plate so that the next round because there's so much so i would say they're well vetted yeah well well vetted perhaps i mean there's a lot more in the queue so hopefully they won't descend on you all in the same meeting and we'll be able to space them out a little bit more but we are very busy very busy so but i'll also kind of add to that email and send you guys some legal powerpoints and things that we've done in the past um but if you guys ever have any questions please feel free to reach out um you can call our office or email me um in our office like anybody can help you but i mean they'll normally put you through to me but if i'm not there then another attorney in the office could help you um i would say just when you look at your you know agenda for the week like the week ahead just just take a look and see like you know you've never worked on the projects or like you're not like the exact next door neighbor or like things like that if it if it's or there's a relative you know if those things come up just give our office a call and let us know you know can you look into this for us and we're happy to either look into it ourselves or like get you a ethics commission opinion or anything like that and that obviously goes for the whole board um but thank you guys i'm excited to have you happy to be here and just was that the planner and training was this her first presentation yeah she was so good so good i was give her give her my my props again i will tell her um she wanted to hang out and i'm like you should go yeah it's been a long day um but yeah she did an amazing job for her first time so that that is a great feedback she's going to um so we have planners and training that work with each division and then they shift and the goal is that they can get experience with each of the divisions so we have current planning long-range planning historic and then our development permits manager we're like floodplain management and bpoa beach property owner reviews happen so these planners switch between the divisions every six months the it's a limited time position so they don't work here forever that's 18 months to 24 months and when they're done if there is a job opening they can apply um but there's not always that case so they they tend to move on and we've had a lot of them come back so we've got um staff that have served in this role and it's really a nice um opportunity i think for the city to have it's almost a paraprofessional a little bit above an intern um where we want them to have this experience so she'll move i think on to maybe current planning next and be ready to present at sprab or maybe long range with pcb i mean we want to give them that opportunity to grow and learn but that was impressive i did not expect that at all great yeah she did a great job her name is sophia yeah yeah anything else we'll adjourn the meeting then thank you thank you so much thanks everyone
