commissioner cassell here deputy vice mayor burns here mayor carney here we have a quorum thank you very much if you could all please rise for the pledge of allegiance oh yes okay great agenda approval now what do we with respect what are we doing mr long he's going to want to make remarks or i mean what are we doing if you this is a broader term well he's actually foreseeing and that was somewhat deliberate because we do have a legislative presentation from matt forrest of ballot partners concerning state legislative priorities as we've committed for today that will be for b that's all i did that so that's okay perfect yep but right before that of course we have a 30 days 30 year service award to present which is actually quite brief then i need an approval i i i i i agenda approval there any additions i'm sorry um 8b c and d um i am going to be asking i just want i was calling if anybody had any changes oh i thought you were asking for an approval no no no no so 8b c and d i'm going to be asking to postpone um i'd like to do it at the time of the item because i'd like to postpone to a date certain so we don't have to re-notice it those are the pension ordinances the contributions okay so that's eight eight eight b eight c and eight d it's for all three pensions b c and d yes sir thank you we're going to leave them on the agenda i just want to give you the heads up that i'm going to be asking for this moment thank you and i had i wanted to have a discussion regarding the funding for um the dda for the old school square component um um six n to discuss the time i'm sorry six n six n yeah so you're pulling it and making it seven yeah making it seven a a a okay and are there any other subtractions deletions additions wait man i'm sorry oh no that's it's 6k excuse me it's 6k thank you i'm looking at it i'm looking here 6k my apologies so 6k will now be 7a we've gotten rid of 8b and c other b c and d we're going to keep them on but i just want to let you know there's not going to be a presentation fine are we going to be acting on them only to postpone it to a date certain gotcha thank you okay any other any other additions subtraction solutions commissioner burns no none for me then i need a motion to approve the agenda is amended second all in favor aye any opposed we have a presentation uh for tard mccoy for 30 years worth of service let me read the resolution 30 years wow a resolution of the city commission of the city of delray beach florida recognizing and commending tard mccoy for 30 years of service to the city of delray beach whereas tard mccoy began his career with the city of delray beach on december 13th 1995 and on december 13th 2025 will reach a milestone in his career having achieved 30 years of full-time service with the city and whereas tard was hired as a neighborhood improvement tech in the community improvement district department became a sanitation officer in 2000 a nuisance abatement officer in 2018 and in 2024 was promoted to lead officer where he currently serves with distinction and whereas his extensive knowledge and experience make tard a valuable team member in the sanitation division of the neighborhood and community services department he has numerous commendations in his file from the community appreciating his leadership and cleaning up alleyways and overgrown property and whereas charge reliability and calm demeanor in pressure situations make him an outstanding leader he is always willing to help others and looks for new and better ways to help the team and whereas hard has proven to be a valuable asset since being promoted to lead nuisance abatement officer providing excellent customer service and timely complaint resolution he is a self-starter who maintains a high level of output and whereas he displays the highest levels of cooperation and professionalism and holds himself accountable for all of his decisions his resourcefulness is appreciated by all who know tard now therefore it be resolved by the city commission of the city of delray beach florida as follows one that the city commission of the city of delray beach hereby recognizes and commends tard mccoy for 30 years of dedicated and faithful service and two whereas a city commission hereby congratulates and expresses sincere thanks and appreciations to tard mccoy for his many years of service and wishes him the best of health and happiness in his continued employment passed and adopted this regular session this eighth day of years of service in addition to that the resolution that the mayor just read and his supervisor mary wasney is here to speak on his 30 years of service thank you very much thank you mary mary all right um i have to read what i wrote because otherwise i'm gonna get super emotional because all of you that know tard he's an incredible human um and a part of our family so today we're here to celebrate a truly remarkable person and milestone tar mccoy for 30 years of dedication excellence and friendship 30 years is more than just the number it represents countless projects completed challenges overcome and success is achieved tard has been a cornerstone of the city and of our neighborhood and services community services department many people that have worked with the city for 30 years have made their way through various departments tard founded his home in ncs in 1995 he's grown in roles throughout the decades and is a true leader in our sanitation division i've only been tard supervisor for two years but i met him four years ago when i started in sustainability and we bonded over talking about trash he knows every single inch of this city every road every address every business pretty much every single person there's rarely an issue that comes up that when i get the phone call tard has not already handled and knows about everyone that works alongside him knows that his contributions go far beyond the work itself he's mentored new employees supported his teammates participate in countless events and you can't deny his humor and his kindness tard i want to thank you from the bottom of my heart for being a member of our sanitation division keeping us all sane making my job so much easier thank you and i want many more years with you congratulations tard thank you very much and and thank you for your for your great and dedicated service to the city we now have a presentation by matt forest of ballard partners who i'm trying to spot in the room actually if i may mr mayor yes so as we previously reported he is being made available virtually because he's actually up in tallahassee our interest was to offer a timely opportunity to engage i didn't see you in the room but i see you on my screen now he should be visible on screen yes sir lace ladies and gentlemen so ballot partners representative partner would be matt forest to help address state legislative priorities given the city commission an opportunity for consensus and direction accordingly so mr matt forest if you would please take it away right um pleasure to be with you virtually today this is my first uh time presenting to the uh to the city virtually so uh thanks for accommodating me um before i start talking for another hour let me give me a thumbs up make sure you can hear me yep we hear you oh can everybody hear everybody can everybody hear him yes the whole room can hear you fantastic well it's a pleasure to be here um um i always say when i begin my presentations to you guys that this is a horrible setting for a deep dive into legislative talk and it's even worse when it's virtual so i'll try to keep this short and sweet and kind of give you the some key facts some key dates some key bills um start the discussion from there and then just always know um we can talk offline we can talk uh individually and i'm happy to say i'll be back in the area and able to do in-person meetings actually end of this week or in the next couple weeks before the holidays start we are currently in the last week of the pre-session committee weeks it's actually why i can't be with you today i'm in tallahassee for the last committee week of the year there were six pre-session committee weeks that began in october two in october two in november two in december the legislature will take a month off uh from december uh the end of this week uh december 12th and will resume january 13th with the start of the regular session so um definitely right now is the calm before the storm bills are continuing to be filed um committees are meeting but at the really right now we're just now kind of gearing up for the start of the legislative session which will begin again on january 13 and run for 60 days to march 13th that will be the end of the regular session and barring special sessions and things after that that's when the the things will wrap up in tallahassee as of today there are 789 bills that are filed i know that sounds like a lot but it's actually very small compared to what normally is filed so usually there's about oh i don't know 1700 to 2000 bills that are filed so just give you an idea of where we also sit there's a lot to be filed between now and when the session will start on january 13th so well i can give you a kind of an update on a few uh key bills right now i'd also always remind you that there's you know for for what could be our number one priority may not even be filed just yet um one topic i know that's always important to the city is appropriations we are going into a another uh fiscal year um and it it it just may seem like look like deja vu because obviously we just wrapped up the last session and extended all the way to june um and so that was for the current fiscal year when we meet up in tallahassee going into the january session we'll be working on the 2026 2027 fiscal year uh we do have some appropriation requests i'm happy that the city has done well the last few years last year we were able to bring home two projects and get them in the budget and survive the veto pen uh totaling about 1.5 million this year we have worked with the with the city staff and have filed a couple more requests uh we have a beach uh rescue drone program and of course more road improvements to swinton avenue and atlantic avenue so we'll be pursuing funding for those i would tell you cautiously optimistic um right now the legislature the the economic forecasts are for a slight surplus going into the fiscal fiscal year however all revenue forecasts for the year 2027 and out actually show a state deficit so all indications are this will be a very very tight year in tallahassee for the budget they'll be cutting back significantly uh they do not want to um even though they might have a little surplus this year they do not want to incur more debts and more more spending uh going into 2027 so i anticipate a very aggressive very competitive uh a round of funding which is why we go up and take our best swings at the plate um but just kind of always want to make sure you guys know that going in it's going to be a tight year as of right now there's a couple key bills that i want to make sure are on your radar uh one is one called local business taxes uh you might remember i've talked about this in the past this is hb 103 um this has been around for several years uh sponsored by a rep botana from lee county this is a bill through various incarnations has either sought to repeal or cap or definitely impact the way local governments levy a local business tax or a local business receipt this bill is all starting to move already this year so one of the few bills that's already being heard during committee weeks um it's being heard in the senate for the first time uh this week and also in the house so i definitely anticipate this bill will continue to move i know it's on the league of cities radar um i've already put it on the city's radar um we should be looking at ways that um uh the could you could possibly adjust your current ordinances uh to to reduce the impact of this bill for me this bill is one of those it's not a matter of if it's a matter of when i do think eventually legislation of some sort relating to local business taxes and receipts does pass so i want to put that on your radar and now of course the other one is suits against government this is ones related to sovereign immunity of local governments um again this bill passed the house last year but the senate did not have the appetite to bring it up it's moving again this year another bill that i think is a matter of uh of uh when and not if um these caps have been in place for over 20 years i do think eventually they go up as to what number they will be i do not know that's still definitely a debate and if it passes or not but i just know um if it doesn't pass this year it's going to be back again next year it's going to continue to move um and eventually i do think it gets across the line obviously i would be remiss to talk about any legislation that did not include property tax issues so obviously there's been no shortage of media attention and conversations regarding property tax changes as of right now there are only a few bills in the house related to the topic the governor has not put forth a proposal um even though he has now talked about it at numerous press availabilities and the senate does not have any bills really they're moving on this topic however the house has started the conversation and filed eight bills um regarding uh property tax changes ranging everything from uh complete uh removal of property taxes and of course various other versions that increase homestead exemptions one way or the other none of the proposals um um a touch uh school related ad valorem taxes however the the house has filed the eight bills they moved them through one committee uh the next committee they only heard four of them and then this week they'll only hear one of them so at this point really as much as there's a lot of attention a lot of discussion of property taxes there's really no bills in play that are being discussed at a serious level that are that are possibly going to make it on the ballot with that said i do think something eventually does get to the ballot i think this discussion will happen at some point it's just not sure what it will be just yet at this point it won't be early in in session uh the house might hear a bill or two the senate has said they're they're not uh rushing anything along and they said there's plenty of time so i do think there'll be a property tax discussion however i don't think it'll be in january it'll be later in the session quite possibly even a special session into the spring um possibly in april or may so i know that's uh this is probably the number one topic that every local government is looking at is property taxes and what changes they could be at this point it's just still premature to say what exactly the the legislation would be proposing to go onto a ballot so those are the kind of big picture items as of again right now like i said we are a month over a month away from the start of the session and so a lot more bills will be filed um i would say much of the um conflict that uh hung over last year's session regarding the house the senate and the governor is still very much in play um i i was joking with somebody just this week they said is he different than last year and i pointed out last year was not last year last year was a few months ago the last session wrapped up in june of 2025 and so we're back up here now in just december so it's definitely not last year all the same players are in place the same speaker of the house the same senate president the same governor so any of the issues and conflicts that we had going into the 2025 session will be the same as we go into the january 2026 session and so with that i'll i'll pause and try to answer any questions you may have at the same time again would just stress um more than happy to come see you one-on-one as well um either virtually or in person uh as time allows in the coming weeks okay okay um commissioner burris do you have any you have any questions for mr park no i don't know i don't just thank you for the report uh my major my major concern was about the property taxes and you gave the answer to that so thank you thank you okay commissioner casale oh sorry i would say sorry i would say the same questions and i appreciate it and i appreciate you virtually virtually to see you in person uh commissioner commissioner martin yeah thank you very much for the update there are a lot of a lot of that's what i anticipated you're saying there's a lot to come over the next few months and just want to say thank you for being so diligent and and working to get to completion on this so thank you commissioner long well i understand that you get if you win tomorrow you get a month off on your first you get a month off for a month yeah is that what i'm hearing exactly anyway uh no thanks thanks matt and i'll uh hopefully see you soon matt are you finished bro is there any is there any serious discussion about sp 180 going on the old yes there is yes there is so so yes so last year we talked about having a glitch bill or you know corrections act or something such as that so last year there was a bill moved past called sp 180 that did impact um local government's ability to almost do any kind of uh future land planning and changes to your comp plan i have talked to members of the senate of the that were champions of the bill last year that do think the bill probably uh has some unintended consequences they'd like to address i do anticipate legislation being filed at least in the senate to address that however as of right now it still remains questionable whether the house will want to address it but uh for my world uh at least you have one one factor that the the chamber or the senate chamber has said that they're going to look to at least file a bill on it and get it moving that's a great way to start the conversation so i do think there'll be legislation considered that will that will impact it um whether it will pass or not yet i don't know well i want to thank you very much you know i watched the dynamics of all the different things going on up there and i can only say you're running from pillar to post the higher time it seems with all the different factions that i'm seeing up there but really thank you for all the for all looking after our interest in tallahassee and we would like to be able to keep in touch obviously with you and some of us will be up there on palm beach county day and i know you'll be you'll be around there as well so i look forward to seeing you then any other questions thank you very much mr forrest great presentation appreciate it as always take care 4c presenting outgoing vice mayor rob long with an award for his tireless work and dedication to the city of delray beach mr city manager so as the public generally now realizes this day monday december 8 2025 is vice mayor rob long's final day of service to the city of delray beach as an elected official and direction was simply offered to mark the occasion to celebrate his contributions in a very formal setting and he has family with him there's no formalities other than the plaque presentation of appreciation for his efforts and contributions to date along with an opportunity for him to offer kind words about his background and experiences serving the city of delray beach florida i will also recognize his fiancee alex being here as well and he spoke highly of his lovely mother on numerous occasions and we all have had the opportunity to meet her just a little while ago who's actually down from pennsylvania yes so with that a nice presentation mr long you are taken seriously clearly because your mom is here with us this evening at least someone does and that's exactly right at least one person takes you well i'll count two or one and a half alex depending on the situation yes here is the plaque which i would like to read presented to rob long we present this award with deep appreciation for your tireless and unrelenting efforts in the interest of the city of delray beach and to express our gratitude for your important personal contributions during the years you devoted to serving as a commissioner and deputy vice mayor this is from the city commission uh dated this december 8th for the for the for the for the term march 31 2023 through today december 8th 2025 let's get a picture okay mr long you are on all right last time you guys left to listen to me um in this so um this is uh all too real now is it too late to change my mind and pull out of this uh um so i've organized my thoughts here as to not forget anything so bear with me should get through this and 30 minutes max we'll do like a tight 45 um so there are too many thank yous and recognitions to mention everyone specifically so i'll do my best to convey my gratitude generally but i know that my journey here has been effectuated by many dedicated passionate hard-working individuals so i want to say thank you to everyone who's been in my corner over the years but mostly thanks to everyone who works to make this city better whether you've supported me or not so a few months ago a contingent of us went out to denver to try and claim uh the city of delray's fourth all-american city award that experience led us as a team to try to distill down what makes delray beach so special and articulate to folks from all over the country not an easy task because frankly you sort of have to be here to get it right but that trip forced me to remember why i fell in love with this city 17 years ago and i could tell you it's because of our rich history or our diverse neighborhoods or our award-winning beach or our tree canopy or our vibrant small business and non-profit community or the charm and scale of our downtown or our unparalleled arts and cultural offerings or our world-class events brought to you by our amazing parks and rec department but 17 years ago i was just a kid who got here from happy valley that's penn state and i didn't know all that stuff yet really i just felt a certain vibe here and i realize now it's because of the people the people who live here in delray beach you know sometimes we get a bad rap here in delray beach because we can come across as a bit divisive but it's because we're passionate maybe we're a bit overprotective because we know what's at stake we know how incredibly special delray beach is that's why i can honestly say it has been an honor beyond words to serve this city to protect it and to be entrusted by its extremely engaged passionate residents to represent them up here and i'll never take that for granted now here's the part where i recognize all my colleagues but before i do let me let me set the stage so my first year up here in 2023 i served with a very different commission than what sits here before you today and i'll admit i was blindsided in 2024 elections and not exactly thrilled with the outcome tom tom and julie remember you all won because of that damn slogan for sure you guys came and you guys came in her you guys came in hot and you know listen these were not the candidates i supported at the time right we had very different visions for delray beach back then and i thought i'd be utterly miserable for the next two years after that and at first i was and i made it pretty obvious to anyone paying attention um but you know what i had to do what i was forced to do compromise i was forced to see things outside of my own perspective and i'm a better leader for it so thank you tt and jay we've we've certainly had our battles up here but we've also find a lot of common ground and we've accomplished a lot together for instance i'm just going to go over a couple things here the commission oversaw the implementation of of streamlining our permit process we're soon to be groundbreaking on a new water treatment facility with the addition of 14 million dollars and p fast settlement funds finally addressing the golf course and new police headquarters returning american legion 188c to its rightful owners on our way to rebuilding pompey park our beach receiving multiple recognitions and awards and many other things that i'm so proud to have been a part of and by the way big thanks to our staff who really makes all this stuff happen we're just like really good at taking credit for it so all right let me get to individual comments for each of my colleagues i'm going to start on the far end starting with you commissioner cassell strap in so so so listen it's super inappropriate so listen oh that's fair so some some may say we haven't always gotten along up here um a lot of folks don't know though that our political disagreements started long before i ever got up here um and that that's why i ran in 2023 right but here's where i want to give you credit commissioner you lost in 2023 but then you jumped right back in the fray in 2024 and took back a seat up here and i gotta admit that takes grit i was obviously less than thrilled about it but i gotta give it to you you're extremely determined committed individual that speaks to your passion for delray beach we might not agree on much up here but we both love this city we i think we ended up agreeing on more than we anticipated for sure um and you more than anyone knows how brutal this whole thing can be up here and you keep showing up to serve our residents so i won't say it's always been a pleasure but i respect your perseverance and good luck up here and take it easy on poor terrence all right moving down the line deputy vice mayor burns so we ran together back in 2023 and i think that's when we first got to know each other a little bit and i saw what a compassionate and hard-working leader you were and i think we were equally blindsided by the arrival of uh tt and jay up here crying but you just handled it with much more grace and diplomacy than what i did in fact you're probably the only one up here that hasn't had hasn't completely spun out at some point on this dais that's probably why you were unopposed in your bid for re-election that and your steadfast commitment to this community it gives me great comfort that this city will have your cool-headed well-reasoned leadership and tireless advocacy for another three years and i'll truly miss serving with you thank you for everything you do thank you all right mayor carney so we were actually friends before you got elected we were but then we became friends again um no the truth the truth is even though we've had our fair share of disagreements up here you and i have always retained a mutual respect and maybe i'm being presumptuous um we've had some serious debates up here about serious stuff but regardless of how they shook out i always felt like we could shake hands and joke around immediately afterwards folks that is the basis of good government civil debates carried out by passionate individuals who don't make it personal mayor i think we've come together on some really important issues up here and i commend you for your leadership in terms of addressing delray's economic viability improving our schools the city's long-term vision and many other things your historical knowledge previous commission experience legal expertise and ability to bring levity to any situation is a blessing up here and i'm proud to call you a friend all right commissioner market dude i knew nothing about you before you got elected uh i just knew you were taller than me which never happens so i was immediately threatened and i sort of wanted to hate you but you're such a good guy you like made it impossible uh but seriously it's been really inspiring to watch you come into your own up here you bring such a unique and critical perspective to this commission i've had a lot of fun sitting next to you no lie some of my toughest moments on this dais were made manageable because of your friendship and we had our disagreements from time to time but again it was never personal there were even some times you changed my mind on some stuff ask my fiance or my mom that like never happens so i'm very grateful to have served with you and i feel that i've made a lifelong friend uh also by night watch wherever books are sold tom's new book i just bought my car we got we often got to stick together um all right terrence you're up bro i'm gonna miss you i'm gonna miss sitting next to you too i'll miss your overly verbose way of explaining everything i'll miss our chats about watches and sartorial craftsmanship i use that word for you um terrence you came into this city at a very tumultuous time and about lasted like the last nine or so city managers um i believe that's because of your resourcefulness your experience your professionalism but most of all your passion for delray beach since being hired four years ago you bought a home here which you don't have to do by the way you met a wife here which you definitely don't have to do um and i see you guys out everywhere you decided from day one you wanted to understand this city and really have a stake in it thank you for that we've been lucky to have you thanks for dealing with all of us up here i know it's like hurting cats often i know i've given you no shortage of headaches but no i'll always be in your corner all right lynn it's your turn all right goodbye scarecrow i think i'll miss you most of all lynn you're the mvp up here you're the one that holds this all together keeps us out of litigation sometimes you're my de facto consigliere my sometimes therapist but mostly just a good friend and i'm afraid if we don't continue our monday morning phone calls i might have a full meltdown so keep that window open in your calendar uh seriously you are you are so impressive up here i've learned so much from watching how you conduct yourself and solve problems you are the constant voice of reason and i don't think folks know how vital you actually are to this city but you've truly been the compass that guides us up here so thank you for everything okay so now i'm going to go through very briefly just touch on our directors for a minute so i want to try and mention everyone sorry if i miss anyone anthea missy sam alexis jay hassan gina dwayne chris janai mary jeff noemi and fire chief martin police chief hunter sorry if i missed anyone it wasn't intentional our directors and their teams are the reason this city functions as well as it does they show up every day to solve problems serve residents and keep delray moving forward they are the steady hands behind the scenes and our community is stronger because of them and let's be honest you guys do the real work commissions come and go with the seasons your steadfast leadership and hard-working teams make this city the incredible beacon that it is it's truly been an honor to work with all of you i know i'm really milking this guys i'm in the home stretch i promise um if i'm fortunate enough to head to tallahassee i already know the work i want to take with me i intend to file a bill a pfas bill to help protect our drinking water and our firefighters a bill to help attract and grow businesses here in florida a bill that safeguards our ability to manage sober homes responsibly and locally no matter what committee i'm on and what building i'm sitting in i will always fight to protect home rule because the people who live in our communities deserve the right to shape them i'm also following appropriations for the american legion post 188c and exploring opportunities for the reef institute and community greening so we can keep investing in our veterans our environment and our neighborhoods i will always fight for delray i'll always be your friend and your advocate and i ain't going anywhere this is still my home and of course all this is entirely contingent on me winning the election tomorrow but i'm feeling pretty good about it right now you're all invited by the way all of you uh come join us at bounce from six to nine to watch the numbers roll in and have a drink and i expect to see you all in tallahassee in january all right only six pages left home stretch uh so uh you have a decision to make my replacement tonight not that i'm replaceable um you there are multiple great choices to choose from i'm not supposed to comment on who i'd i'd recommend but on unrelated note i am wearing my coco golf delray new balances tonight anyway i can't afford um all right my final my final thank yous are to my amazing fiance who inspires me every day puts up with me beyond all reasonable expectations and pieces me back together after my routine breakdowns she's agreeing with you oh yeah you of course she is um and my mom who flew all the way in from punksatawney pennsylvania to be here uh thanks for always believing in me mom for showing me by example what public service really means and now they probably want me to shut the hell up so we can walk over to dada and get dinner so i yield the remainder of my time ladies and gentlemen commissioner long we're saving our comments for later after he leaves the room just let you everybody know commissioner long is leaving the auditorium going to dada's where he's buying everybody drinks later on thank you rob we now have a presentation on clear gov which is a new system that we are going to be adding to this i'll let you take this but a new system which is going to add greater uh clarity to the people dealing with the city greater transparency with the people dealing with the city and it's going to be a dramatic improvement i we hope in the people's experience as they try to sign on and see how to do things and where they are status wise etc etc so if you would like to you would say something yes just briefly i'd like to introduce all involved so mayor my compliments you actually provided a fairly nice overview in terms of the basis for clear gov and why the city of dairy beach elected to engage in this process we actually discussed this during the proposed budget process for the current fiscal year providing a platform whereby residents and stakeholders can easily and more transparently access information regarding the city's budget the basis as to why we are where we are so with us this evening is of course chief financial officer henry dakwis and i would also like to introduce some of you have already had the privilege of meeting budget manager sabra avery she's actually been with us since july and one of her mandates was to help us get to the place in which we can introduce this platform so what we've made available this evening is a brief overview as to the functionality of clear gov why it makes sense for the city of dairy beach and anyone interested in our community miss avery i'll give you the opportunity please okay i'm not sure if you can hear me yep okay put the mic on make sure to make this up it is okay bring it close bring it close okay no problem it's my first time up here so bear with me um anyway as he stated my name is saber avery and i've been here for five months i come here with about 30 years of financial experience about 20 of those in the educational sector i also worked several years in the utility sector and some multinational corporations early on in my career this evening i'd like to showcase our new digital budget book the city contracted with clear gov in the spring of 2025 to provide easy to use software to help us improve our budget book presentation materials they provide as i said an easy to use software to help improve budgeting they have over 1300 communities that they work with and several of them are in florida as they're showcased on here like palm beach county city of coco coral springs henry county schools and saint john's county um slide four is a summary of some of the highlights of why we chose this product cleargov has multiple presentation formats for optimal viewing to better engage our citizens it has pages that we can easily customize and they are very accessible for us and our viewers to use so there's no developer or designer needed to do the programming cleargov also provides several templates based on best practices that we can choose from to display our data it allows our city's budget team to collaborate interactively so we can work on the book at the same time in our own assigned sections we're able to add notes update statuses as we complete our tasks as we upload our financial data to cleargov the product automatically updates the charts tables and graphs which saves us time and reduces errors it also contains a built-in gfoa or government financial officers association distinguished budget award checklist to ensure that we're meeting criteria i'd like to mention that we've won this award 28 times the next few slides contain some screenshots of the finished product slide five this is a highlights an example of revenue categories and histories as you can see up in the top left if you hover over the areas on the chart the data pops out to show more detail so again revenue categories in history the next two pages are showing department and division expenditure summaries up on the top left financial highlights in the middle and accomplishments on the bottom as well as staffing levels the next page shows departmental mission statements and org charts as well as program pages so a lot of this is very similar to what we were collecting in the past is just that we're automating it in a web-based platform the next slide shows that these are the different formats so that's what the budget book would look like if you're using a mobile application on the left the top is pdf so you can easily download it or view it on you know a pdf format and obviously web and the software is also ada compliant i'd like to also thank communications for allowing us to use their data for the presentation and i'm going to go ahead and link out to our web page just to show you briefly what it looks like so here's our cover page if you want to download a pdf copy you can click over here but this is basically the table of contents with introduction city manager's message our awards the city vision what's included in the document it goes on to have some um you know summaries of our executive team budget calendar developing the annual budget all of our policies and procedures this section has a budget in brief which summarizes basically the entire document which is over 400 pages in length and has a lot of revenue tables these are consolidated fund summaries and more revenues then we go down to departments which show what i showed in the last couple of slides it also contains the capital improvement plan some supplemental information such as demographics and an appendix with a glossary hopefully that gives you an idea of how the document is structured any questions or concerns let me just have one or two points i think it's a great overview um the advantage is really on two sides one is it's very interactive for the users that are working with the data so as you clicked on things you get details you can zoom in on areas of greatest interest to you but the other side is for our preparation when we're updating data and it automatically ripples through all the graphs and all the detail with cross-referencing automatically it saves us a tremendous amount of time especially when we are finalizing or making changes it's a powerful tool we've used it for about a year um interestingly we implemented it for a year and then this year clear gov changed their platform on us so it was lovely it was almost like a second implementation this year and we're very excited we think the users will have a better experience and we know we'll be able to do more with less as we're always asked to do thank you great uh and to the commission any comments to our finance board uh commissioner yeah no no thank you thank you for the presentation the structure appeals to different learning modalities so thank you very comprehensive thank you commissioner mark no questions looks good commissioner casal uh i i'm excited about this because as all of us who's done this for a while when you start looking at your budget and you're you're you're faced with 500 pages this process will allow you to zoom in which is what i looked up today if you can actually zoom in on little bits and pieces that you need to look at much more quickly and have a instead of saying yes it's on page 369 at you know halfway down the page type stuff so i'm very excited about you know getting it implemented so that we up here can understand better you know what our numbers are and where they are and how they relate by the way it it how it relates with the other numbers uh in the system is really very interesting the software so i want to thank you very much for this presentation and for the getting it's into the 21st century on at least in terms of that i'm getting there i'm getting there anyway thank you any other any mr moore no i yelled at this time however i think i'm next you are next yes great as far as clear gov it's a beautiful opportunity to be engaging and transparent with regards to various opportunities as it relates to the proposed and adopted budget so look forward to a greater level of interaction and working closely with the department of finances outline thank you very thank you both very much thank you all uh we're now to comments and inquiries on agenda and non-agenda items uh there will be a public comment immediately after these presentations of the city manager's presentations mr city manager yes sir i actually have one item and it does pertain to the department of utilities relative to billing administration based on some comments and observations haven't been shared however before we facilitate that presentation mr hajimiri you can go ahead and prepare your slide i'd just like to offer a brief footnote relative to non-profit partnership administration so we've talked about this during the past couple city commission meetings or so and as it turns out most of them are to be executed by the office of the city manager administratively via amendments etc likewise only one requires city commission approval and s in relationship to ours garage which is one of your consent agenda items so i'm thankful to the office of the city attorney mr orris and everyone else involved getting that all squared away what i wish for everyone to be aware of is that as the agreements are executed all non-profits have made arrangements for electronic processing of payments via ach structure and thereby we will be able to quickly process transactions accordingly so very pleased to provide that background given the concerns haven't been expressed regarding the matter i hope that alleviates respective outlooks and observations accordingly so we're well positioned to get that taken care of otherwise the presentation at hand clarity regarding utility billing payment administration recent questions relative to how that actually works and why some people may have had difficulty or challenges inconveniences associated with transactions and of course working with mr hajimiri and his team we decided to come back before you as quickly as possible to offer clarity accordingly so mr hajimiri if you would please that wasn't me neither was i i think we're responding to what you were saying my thing picked it up thought it was a question so whatever it is it's the highest priority yes thank you good evening mayor commissioners hassan hajimiri utilities department um thank you for the opportunity to provide you with a brief overview of how our utility building customer service staff handles our customers daily needs these staff the utility building staff are the first point of contact when our customer needs assistance in either starting a new water service account uh changing their account paying bills closing accounts and so forth so they work very hard to make sure that the requests are processed uh accurately and documents are verified today's presentation will cover the basic step that um staff follow um for each type of request at the same time protecting our customers information great um opening account um there are many ways to do that one by using the website the link is there that they can easily go to the website and um start um opening a new account they can apply in person they can actually come here to the city hall if they don't have access to the computer and our staff would help them to um subject account and um the document that they need are basically for to open an account is warranty deed or a lease uh document um for a minimum of six months in case if they're a tenant and they want to open an account they have to bring a copy of their lease that they say they live in that um house or unit or apartment and it has to be for more than a six months lease so um which almost 99 of the lease are one year at least so that's for um but we need they also need to have a valid uh government id either uh driver license or government issued id um and they have to fill out the water and store uh service agreement for paying the bill uh there are also many ways that they can do that they can pay online i even have tried it even i don't live within a city i have tried it you go online easily uh 243 uh 7100 and if you push two number one one is for english two for spanish the second number one is to pay your bill so very very easy in order to do that you have to have some information about the account um which is very normal they can do that um by in as again um in person here they can come here they can pay their bill uh customer service are here to take it and we're going to go uh in the next few slides of if somebody else wants to pay somebody else's bill how we're going to deal that i know that was your concern mayor so we get to that um if they come in person here in city hall and they want to pay the water bill they at least need to have the address or account number we cannot just somebody come and say hey i want to pay the um speak into the night i'm sorry pay the bill um for mr abc they have to have the address and they have to have the account number and also we have a drop box right up front ready for them to uh to drop the payment this is a challenging part in case if somebody wants to change the account because in many scenarios either throughout the separation or one party moves out they want to change the account so the account information may be provided in person or over the phone after the person is able to identify themselves as somebody who is related to the account to remove the name from the account is either through separation or somebody's deceased so that person that is wants to make the change into the account again they have to provide the documentation either the divorce or the certificate of death unfortunately in order to address those issues and to change the designated account holder is the same thing because there are many times that um a party they separate and one person moves out and they want to change the account detail um so in in that scenario same thing they need to provide their um required supporting document that why they are doing that pay somebody else's bill you are welcome to pay anybody's bill i know last time you said you were going to pay vice mayor's water bill if you want to do that all you need his name and address so we'd be more than happy to take you what we won't be able to provide you is his account number in case if you want to have the account number then you have to provide your documentation why you want the account number or why you want to know this account is overdue we do not give you the detail on the account unless if you provide that provide documentation that hey you really related to that account holder so that has been the scenario a lot of time that people call said hey you know i want to pay the bill but i don't have the account number especially on the phone i don't have the account number and my name is whatever they don't have the account number so we don't know who you know who they are we don't know who they are and we will take the money from them if they want to pay that okay give us the address at least if they give us the address and we find the account number here we will accept the payment but we will not give them the account number because you know if they want to pay just go ahead and pay but the account information are crucial and we're not going to share it with anyone unless if a joint account holder or somebody as a result of the divorce or separation or death as as i mentioned so these are basically what i mentioned and for closing account it's the same thing um is the closing account is very easy for the tenant they need to uh show the cancellation from you know and then the government id that the lease is over and they're going to pay owners they just have to show the warranty deed because they when the tenant moves out the balance automatically if they don't pay is property owner's responsibility to pay so if the water is there and account has not been closed these are the scenario that we get into because the tenant they just move out we get to the three four months or two months and right now even after two months non-payment we process it for cancellation and then we find that the tenant has moved out but that the owner would know because the owner is the first one that notice when the first rent payment is missed so it's their responsibility also to notify us hey you know this person has moved out you got to close the account because we still have the charges on that account so that's for um again same thing they have to provide the account number and a final service date this is for the tenant they come and tell us okay we're going to move out the next month so we close the account effective the date that they are going to move out however we build them based on the time that we read the meter typically it's going to be pretty soon after they move out however if it's in their account and we go there like a week later they are responsible for that pay and also if they have put any deposit or so it will be returned to them just like any other utilities some contact information there they can call 243-7101 these are the person is not a computer that they would speak to them i'm laughing i'm sorry because you always give people your cell phone answer their calls on saturday and sunday 24 hours a day you're accessible to our residents i appreciate you i appreciate that i'm glad you didn't put your cell phone up and i also have my i have two business card holder here at the window if any of the customers that they got issue if they ask for the supervisor supervisor is not available my card is there they can pick it up my cell phone is on my business card and i don't mind at all if i can answer the phone i will answer it and we get into it in many scenarios i have been instructing the staff to go over the weekends and turn the water back on for our customer so they can come back next day to pay for it we do get it but when you when you run a utilities i mean uh i hate to say it but before a year and a half ago we had more than a 2 000 delinquent account yeah in our billing in our billing so that's why for the past 14 months we have been able to recoup 1.4 million dollars of this money that it was out there that was not being collected right i know our customer didn't like it in the beginning you know they they they honestly they told me we did what do you mean we didn't think you were going to shut the water off i said yes but you did get a lot of notices you did get a hang well first we were putting it hangers on the door now but we stopped doing that it just takes too much time because when you get your bill on the top it says delete coin account so you got to pay attention to that it just like your cell phone if you don't pay your cell phone next month your bill is down if you don't pay fpl but the water was being kind of pushed to the side we had customers for over three years of non-payment right and the water was going on and we do have you know so i went through all those lists and right now we are close to less than a four percent delinquent account and we hoping to that those are normal um so we we're doing that and one thing that i did i notified city manager that during the holidays i shouldn't be announcing it we're not shutting the water off and that's during the christmas new year and thanks we're not doing that because um but we will be back on december i mean on january 5th we'll be back to do that and that's basically what i have if there is any question yeah we'll be more than happy to answer mr markren any questions no sir that was good commissioner burns any questions no thank you hassan yes ma'am commissioner casall no i was going to bring up how much money you recovered for us and how much we appreciate you all the time i'm not quite sure why we keep i think sometimes someone comes in with one comment and then we have our highest paid staff doing pretty elaborate presentations and i feel like we need maybe these are more one-on-one things that we should do because i think there's a lot for mr hodge mayor to be doing actually that was for my direction if it comes up publicly during a city commission meeting as well as previous members of the public asking questions about it i think it is in fact productive to provide an opportunity for leadership to clarify the facts in this regard not to mention it's good for the city commission to be aware of the leadership and guidance that's being offered in this regard so i don't think it was a tremendous burden on part of mr hodge mary to offer the presentation in fact when he and i collaborated in this regard he insisted that he be given the opportunity to state defects respectively so it's a tandem collaboration and i think this is productive again i've made a coaching commitment a few months ago to do more to clarify resident concerns stakeholder concerns publicly otherwise we do meet one-on-one and it is within reason and i think this isn't within reason thank you mr hodge mary and mr moore thank you i just want to make one comment our customers are extremely intelligent and they really working with us when the issue comes up um they are very happy to see that at the end you know the problem is resolved but at the same time sometimes they just have to you know pay some money in order to get up to that point we do not i have not sign of any waiver or any money to be just be paid to them let's say to make them happy every every penny that we spend is either let's say through the leak detection we have a leak adjustment credit and we have been able to credit some of our customers um because they have had leaks and they have to ask for the plumber to come and fix it and we do understand that uh but in but no uh we no other adjustment has been made to the bill if there is no merit to it i i'm continually impressed by your response i mean i every once in a while i'll get an email from somebody saying you know but whatever the situation was they got their water turned off and usually over a weekend and they would write me back saying how impressed they were to get it all done hopefully they came current with their bill the following monday but um yeah i'm just your response time has been really samir the water is very important a lot of us we do not appreciate the water how important the water is each time we go we turn the faucet on the water comes out excuse me we flush the toilet is gone but when when for one hour that service is it interrupted people forget everything right and they want to have that water service and i get it so i do not want any city citizen anyone any of our customer to be without water but unfortunately after five or six times um reaching out to them um we don't have no other uh recourses to except well thank you for providing clarity i know this was a comment that we got from the public a couple weeks back and and it's and i'm glad you were able to at least address the issue and yes it's good i mean the person that told me they couldn't get the bill paid remotely it was not accurate or they didn't understand it or maybe what they wanted to know is what's the past due amount and you wouldn't tell them that you just want to tell them what they what was due so there's there's i'm sure there was a good reason for it because as you explained it and anyone wants to pay my bill at my i can give you my address outside later we'll give the number we'll give you the number i know i take a lot of showers so it is on the high side but it's good i'm helping pay for the water plant faster um thank you very much mr hutchman i don't let me get past one over the years oh i never did i never did okay are there any more mr city man do you have any more comments i yield at backstop giving instructions to their kids and he was back there telling his little kid what to do and his his son looked back at him and strike one he looked back again strike two tears start coming he looked back at his dad again strike three i was so hurt because the little fella struck out trying to get instruction from his dad so i go up there i told him look if you want to coach you need to get out here and coach and stop doing this i say this little kid struck out do you know he's been working in our league ever since that young man graduated from college got a big time job and todd is known as the pitch count king and he umpires in our t-ball league and he's been there also his stepfather was tuck which my kids raised raised by bubba tucker and the katherine strong they call it tuck center my kids still refer to that as tuck center so you i just want to point out the caliber of people that you have working for this city and todd is just one example of those coaches that we have and umpires that are city employees and i couldn't let it go without mentioning i didn't even know he was going to get recognized but i was so happy to see it and then you he's probably gonna kill me but i don't care it won't be the first time but thank you for that and just understanding delray you have some people that really work and this young man who just gave that presentation is a good example and i just couldn't let it go so thank you for honoring him homegrown and look what we have developed here thank you so much thank you very much mr michael weiner 33446 i'm here on behalf of the greco properties uh not the dealerships these are the properties that mr greco owns locally in town they are at 1191 north federal highway and 702 bond way why do i have to do this real quick in three minutes we have a very unusual ordinance in delray beach florida it says before i can even request to ask for a change in an ordinance i have to get a sponsor now let me explain something about this sponsor he does not or she which i'd be very complimented if it was a she um does not need to vote for it all i need is an opportunity under this ordinance uh 2.4.7 to be able to present to a workshop i'm not even even setting in my application yet but i can't send in my application until i get one sponsor now this are very interesting pieces of properties these are interesting pieces of property they're on the north side of town above george bush boulevard we've got a neighborhood plan that goes back to 1999 when amazon was selling books and nothing else um there's a design up there that really doesn't fit one of the pieces of property is in medium density on the comprehensive plan map it's zoned low density and i'm not even allowed to ask for anything more than low density because of one of the ordinances that i will explain in in when i get an opportunity to do so um i think if nothing else you'd want to hear why in transitional and general commercial you still have as permitted uses tobacconists and modeling studios if nothing else you want to take an interest in the northern federal highway corridor right so i'm hoping i can get a sponsor who doesn't necessarily need to vote for me and that we can move on to making an application thank you so much can i ask a question i know this isn't typically q and a time but and in in the future you probably want to contact us individually and ask for a sponsor and then relay that but what um you're going to utilize it's commercial and you're going to utilize it for commercial continued commercial are you looking to make it right if you if you want to preview i know it is going to be all residential but there are so many difficulties currently commercial the front part is commercial quite honestly the front part is it at best you're you're you're talking about a 7-eleven store because of the size of it and some other things but it's what we want to do is we want to do residential the north side of town is getting much better uh there's a preview of of what you and i think you do need to consider it because it's the whole area that you need to consider i understand that what we're requesting for might have an impact elsewhere but it is trying to get the north end of federal highway to look as good as what we've done with the other two sectors of federal highway so that's what we are going to be asking for you'll you'll in connection with this you'll see site plans you'll see everything else but again and i suggest that you take a look at 2.4.7 because this particular gatekeeping is is is not something i see in other jurisdictions and it's it may be beyond what you really want to do i would have three hearings just to get to applications when you're talking about these considerations of these new um property tax situation i'm i'm not i'm not going to um forgive me i'm not sponsoring it that's fine thank you would anyone else like to it's public comments so we don't i know i asked if i could ask mr weiner wants to reach out to each of you individually and make his request in writing typically you've done this before you bring it before doing your comments and then you can get consensus from your colleagues thank you very much my name is rolf sievertson 33445 it's in reference to the barwick road project you're probably tired about hearing some of this but i will anyway um i live on francis drive and what's what's kind of worrisome a little bit is uh there's four corners on francis and maurice on the east and the west side and one of the things is a the discrepancy in the width of curb to curb uh and the the big one is francis i think is 19 feet the west side the east side of francis is 19 feet the west side of maurice is 25 feet and um the i've met with isaac your project manager for that site he came out and actually walked the site with me um what he told me was the radius on the curbs got reduced on francis from 20 feet to 15 feet that was and that has to do with traffic calming which i get that that makes a lot of sense um just some average radiuses of cars a vw is 17.7 a honda ridgeline which is what i own is a 21 foot seven uh suburban is 23 foot 23 or 24 depending so the 15 foot radius on our corner of francis and barwick on the east side i've pulled up to the stop sign had to pull forward just a little bit to get the view past the hedges which that's kind of a separate issue but still a little bit of a problem and i've also had to back up when there's a car turning either from the north side or coming from the south i've had to back up for the people to be able to get around the corner if you don't do that there the back tires usually the front tires will make it over around the curb the back tires go over the curb and on the sidewalk so um the uh i guess that's really it is just the discrepancy of the four corners just the width of the streets and then the the 15 foot radius and we're there's a lot of people in our neighborhood that are very concerned about it and the traffic calming makes sense but what would be interesting is if somebody from the city or two or three people from the city could come and just bring a average size car and just do what we have to do every day or two times a day so anyway thanks for your time thank you very much good evening michael walsh 33445 i appeared here about a week ago i live on francis also it is a disaster i sent the mayor a picture last sunday i was coming north on uh best gate and uh there's a car coming out it was a van actually and had come out he was stopped it was raining and there was not enough room for me to turn in so i'm stopped in the middle of the road and i'm waving and it's raining trying to indicate please come out and turn in front of me because i needed the room to get in he couldn't really see me the person behind is blowing their horn moved they don't understand why i'm stopped in the middle of barwick road finally the van comes and pulls out and someone pulls up right behind them so i'm waving again now the person behind me is giving me the finger why don't you get out of the way and this is the traffic calming that's been created now prior resident mentioned from atlantic to lake ida i believe there are 12 intersections and that strip ours is the narrowest i don't know why that is our main way to get in and out because francis is a dead-end street one of our neighbors lives at the end of it she's here so it's our main way to come in and out of our community i passed around a petition complaint form whatever everyone on francis signed it i mean you folks run for political office how many times do you get 95 percent of people in favor of anything we're not trying to be pains it is very difficult to navigate and my question is why because it appears to we've been on this issue to some extent for two and a half months complaining to the city council about this so far other than sending the engineer to chat with us there's been no proposal to make a change to it and i don't understand why you folks are so committed to this issue when your effect what you're doing is governing we don't live in the city francis is not in the city of delray so you folks are very very committed to traffic quieting in a neighborhood that you don't govern and if you look at almost it i just when i pulled up first and first it's a nice generous intersection i i'd venture to say if there's a 2 000 intersections in the city of delray i don't think a hundred or as narrow as ours is so please examine why are you so insistent in not making some changes to make it much easier for us to get out because we're not even in the city you're you're you're you're laying down a law so to speak that we have to live with every day and you're not our management we'd like you and three other people here to speak thank you thank you mr welsh hello everyone my name is patricia wright my zip code is 33444 my concerning question is to the mayor i was not in attendance for the cra uh special meeting when it was last Tuesday i believe but everyone voted yes and you voted no and i wasn't surprised but i'm still stunned and still confused about why you feel as if the set transformation plan shouldn't be adopted that's my question to you thank you i was expecting an answer to the question so i'm sorry i delayed we don't give answers but thank you i got it i got it well uh my name is miguel poveda i come from 33445 and just like mr walsh and mr severison i am a a resident on francis avenue and i know that there's a situation there i i went to the city when they were proposing to make the changes three years ago the proposal showed the diagrams but it's not until they actually did the work the biggest problem there is that from barwick they extended the sidewalk that intrudes into the intersection at francis so now you created a funnel area we're getting in and out of francis drive is a problem we have two feet left uh that's been removed from each side of the road and then the sidewalk has been extended out that actually extends into the intersection that means that every car that's coming in and out whether we're going northbound on barwick or whether we're coming northbound on barwick and turning right we don't have enough turn for the radius now i have videos also of the gov of the uh garbage truck that comes in we have trucks coming in there it's it's a small community we happen to be in the county property not in the city but i i don't have any hair so i can't say i'm the red-headed stepchild but that's the way that i feel because we're being ignored you've created a dangerous situation in that area now i do some volunteer work for carver middle school i'm a lawyer i work in the courthouse we bring the students up to do some mock trials and train them and i know that the traffic that comes from these students are coming across the sidewalk you've made a large sidewalk to make it easier but i think it's more dangerous when the sidewalk intrudes into the actual intersection where the children are not going to be able to stop a little bit earlier to be able to watch traffic that's coming by so it's created a little dangerous situation for pedestrians it's definitely a problem for the residents that are coming in out and all the service trucks i can't imagine how the fire department is going to come from uh lake ida coming down the road for an emergency on francis and they can't make that turn because the truck is too wide to turn and navigate that area so it was already tight before but it was navigable now the new construction has intruded into that intersection and it's making dangerous for people and it's just as a lawyer who also does personal injury and does other work i hate to see some future accidents happen in that road because people are having a hard time navigating it and that's the city's going to be unnoticed because i don't like to sue municipalities but if that's what needs to be done to make a change that's what's going to happen here because the situation is now dangerous at that intersection but right now i'm just asking for relief because we can't get in and out safely we there have to watch as a as the garbage truck goes in the left lane to make a right turn and then we have to stop at the intersection to allow someone to go through there's actually no room to come by what i would like to see is someone to come by and visit and check the site for themselves thank you for your time thank you very much sir hi there katherine bell granites 33445 i too am a resident of francis drive in kingsland and i just want to reiterate some of the safety concerns that we have with the current design i understand the importance of the safety project for the pedestrians and the cars on barwick but that has now in in turn led to safety concerns for the residents trying to get in and out of our community as it was noted already to even get out of our community there's multiple times why we pull up to the stop sign to try to turn on barwick and we have to reverse or find a way to get over to let people in it doesn't allow for two cars to pass safely at one time which we had before the construction started second when you do get an ability or a gap to get out of the community um we have to to avoid the curb and taking the your damaging your car you have to turn into the other lane to give enough radius that there is a concern uh for me i'm going out that uh somebody else is going to come this way and i'm going to have a head-on collision um so those are some of the safety concerns we have with the project totally understand the benefits of it but we also want to make sure that our our community and our safety concerns are accounted for too in this project so again i too would like to ask for somebody from the city to help us to be our partners to figure out a resolution for this that's safe for everybody for the pedestrians and notice from the city thank you for sending this regarding some uh requests for changing of zoning uh for a variance for a home within 500 feet of my home mayor and um is that for today is that is that for the for the for the hearing later today is today december 8th yes so that's a quasi-judicial five o'clock no yeah you're looking at the one that's part of a quasi-judicial hearing that's later on you'll have an opportunity to to speak on that matter when it's called on the agenda i misunderstood thank you no no you're here i mean you can i can would i be allowed please are you giving me permission i didn't understand i think it's yeah you're going to speak later on i mean i i know okay you're i misunderstood i i thought this was a public part thank you it is except for quasi-judicial items and so that will be a public hearing in and of itself so you will be you would be participating at that my apology no no no apology necessary sir understand uh george long three three four four four i'm here to talk easy money for the city i found an opportunity for the city to gain some income from one of your parks and what i do is propose a rock skipping range at the intercoastal water intercoastal waterway at veterans park um it's not anything too difficult you just mark off some spaces on the seawall um you can project lines across the water so you don't have to you know put put ropes out anything like that you can have a rain safety officer show up to make sure nobody hits any boats that coming by or manatees or anything and also you can host night events if any no really if anything's still alive out there in that water you can uh take advantage of the bioluminescence and just count the green splashes that go across and right offhand i probably doesn't sound like a really good idea but we should take it consideration and i wish you would give it more consideration than you did the last time i proposed something like this and that was to um put a roundabout at swinton and atlantic and charge sell tickets to watch all that but thank you for your time thank you good evening mayor remaining commissioners it's paul cannon 33483 um just a really i've got one question uh procedure here because later on in the agenda you will be uh wanting or seeking to appoint an interim commissioner to fill mr long's seat but in the meantime you'll be considering some land development uh waivers and some various other things that without wishing to preempt how you vote you could deadlock on those decisions as a remaining uh four votes uh i just question whether it's appropriate to bring forward the or at least give you the opportunity to try and appoint uh an interim commissioner so we can fill the fifth seat and stand a better chance of getting a proper majority vote on some of those issues that come up thank you thank you are there any other members of the public wishing to address the commission seeing none public comment is closed i need a motion earlier so um so it's no longer run consent uh we now have former item 6k 6k which is now 7aa and who will be making this presentation i guess by default i could it was my agenda item mayor um i mentioned to you this morning so you did um so uh as part of our agreement with the dda we have an interlocal agreement with them the city appropriates certain amount of funding each year typically it is um it is appropriate at october 1st and it's it's given to the dda um because of the audit that was commissioned by this uh commission um we held off on making that payment pending the final resolution of the audit and since the audit was concluded last week um we placed this item on the agenda ilas have to come before the city commission for any type of amendment so the other non-profits in the city spady um santa way house the city manager can execute those so once the commission appropriates that funding we can just uh administratively issue those funds but because this is an interlocal agreement with another governmental agency we do bring it before you um each year for the annual appropriation okay i pulled this because for discussion purposes because i'm not arguing we've already agreed on the amount of money that's going to be uh contributed vis-a-vis the ila but one of the things that the audit you know showed was that there's a a number of policies that need to be updated and or and or formulated and my view is that when some of those policies are not having you know your credit card policy you're not having this policy or not having that policy that it is not prudent to give a hundred percent of the money when there is an obligation from the entity to provide these documents which they have agreed to provide over the next 60 days or 90 days i guess they may do it sooner my whole point was i'm i'm agree i think that a partial funding is up you know i'm obviously fine with the partial funding but i think the complete funding should be contingent on them complying with what they would say they were going to do in terms of establishing policies to look after taxpayer dollars which i'm confident that they're going to do even if they just decide to adopt the city's uh policies so can i make one point of order i don't think that the audit provided a timeline typically an audit will you know i think that one of the responses was they were planning to have it in i don't remember what the thing was right i don't so but obviously to give when the audit exposes you know certain deficiencies but don't overblow you're you're totally overblowing the deficiencies mr mayor i know you think so i do no no to be clear i do think so i know you do and and you know this is this has been on your mind for a long time there clearly is some kind of agenda going on with you and that's not fair mr mark no one understands it that's not we all want to understand it but my agenda is but you keep bringing this up over and over and over again and i i as a resident as i as a commissioner would like to know what is going on with your attitude toward the downtown development authority you take a swipe at them every time you can we just finished an audit i was hoping today you'd be coming in apologizing to the dda that we put them through an audit and oh by the way for everybody sitting out there audits aren't free get your wallets out because you know what we got now now we got a state audit coming get your wallets out boys and girls we're going to pass the hat around again well so in the interest of saving money you're not it's distracting to the city it's demoralizing to the city they're finding nothing yet you keep pounding and pounding and pounding the people out there want to know what is going on first of all they didn't it wasn't the effect they had three different findings one of which says they had all of which look like a normal audit finding i don't know how many you've gone through yeah i've been through a thousand of them i have two i have two in the finance but where where did you go through them in my banks where where's your bank well i haven't seen it where you're not in your corporate world where's the bank where's the branch i missed it where where is it where's it been i'm not going to argue with you about my background come on man you can look me up and i did i did oh you didn't see carney bank here in delray beach uh you can see it it ain't new right but where'd it go well your question was how many audits have i been but the point is go the point is mr market some of the findings were that they didn't have they didn't have complete records they didn't have policies that related to credit card expenditures and other reimbursement policies and if while you may think that having incomplete policies as it relates to the spending of taxpayer dollars is nothing i don't well you're spending money on these this audit and now you got the state coming in the delray residents are doubling down on what you're going to pay get your wallets out again and now we're asking the state to double down on the money and it looks bad for our community let me finish you're the mayor of this community you're right and you're right i'd like i want financial accountability for everyone i brought the same issues up as it relates to the city of delray beach and and spending in this budget so my point is there are findings here now it may not bother you where someone says um there was no fraud well they admitted and in the documents they didn't have all the receipts so how do you not have any fraud if you can't show that you don't have all the receipts and you know what i would say i would say whoop-dee-doo to that having come out of the world we audited people's expense reports where they were occasionally missing an expense right we found it and we went back and we found it and we verified it and they're doing the same thing well the good news the good news is come on man the good news is the spending of public money is different this is public money you're spending on these audits what do you think this is free i'm saying dude it's not free get your wallets out ladies and gentlemen they talked about commingling of funds they talked about a number of other you can diminish you can say it doesn't matter but if you were in a federal audit if you were in a bank audit if you were in any other audit where there were repercussions for spending taxpayer dollars you would say well you know we should probably get these corrected before we give them more money now you may not agree with that but everybody in the financial world does i i i'm not in your private world in your private finances a fortune 5000 companies that report to wall street you're darn tootin i've done that correct that's you're darn tootin that's not public money it you're reporting requirements who do you think who do you think owns the shares it's the public it's not public money it's not public taxpayer money it's not taxpayer money well yeah public money man well let's make the distinction wall street let's make the distinction it's taxpayer money and all i am saying is that i would like to see them comply with getting the policies and procedures in place before we give them full funding now you want to say don't do it that you i want to say mr mayor can we stop spending money on this witch hunt that you're behind and oh by the way i want to just be i want to be clear i'm going to call mr bernard this week sure and i am going to talk to him and find out exactly what has caused this audit if it's just you i want to know that if it's not just you i want to know which friends of yours or which other members of the circle approached him so that we can find out what's going on here because there's more than meets the eye are all the way up conspiracy theories don't suit you they do suit me and i think that they're i mean i'm sure that you find it was okay that for example the dda paid ten thousand dollars to put a band up in a hotel when it wasn't part of their contract but it's okay you went to the concert you enjoyed yourself so all i am saying to you is this is public money and i treat public money differently than i treat private money and if you think it's okay not to have credit card policies if you think it's okay not to have reimbursement policies if you don't think it's not okay it's okay not to have gift policies if you think it's okay not to have all these policies because you're dealing with nice people i'm very sorry that i just disagree with you this is public money you're disagreeing with the audit that you commissioned i'm not you don't like the results no no do you have three five you don't like the results i'm quoting the results they said they did they there was all trivial tom all trivial coming of your funds is not trivial what you're describing is just barred you're not going to get disbarred excuse me if i that's a total yes i would total reach may i jump in then you just don't know the rules uh i know more than you think well evidently not well may i jump in you may where how much money have we paid them to date and how much are we holding we could not pay them until these this amendment got um adopted was adopted by the city commission okay we're three months in though so how much would we typically how do we normally typically do quarterlies yeah we used to do it quarterly now you're doing wanting it 100 i have an idea but i want to i want to go back to quarterly i i'd like to speak for one moment i i i understand mr market's concerns and i'll tell you because from day one like these are our partners we need to have a better relationship it never feels like we have had the good relationship watching the hearing today you see other cities up there i've watched other hearings and organizations in the city are being supported by their city our organization is up there because of our city um and you know mayor i sat up here when they agreed to take over old school square and they were kind of given a lot of leeway and and i am with you 100 i believe there is room for our city to improve its policies and i think the dda should improve its policies but i do agree from day one this has not been a good look for our city as the mayor of our city you have been out there pushing information that's not true not true you said 60 of their budget is their salary and benefits that's factually inaccurate 40 46 no no no don't say again don't you can't keep saying inaccurate things to the residents you put it in a sun sentinel article and it wasn't i will put it to you it was not inaccurate it was in it's you have a marketing department that does marketing they hire an outside firm to cover all the stuff so they can say we're not hiring you continually said they were engaging without a contract well i don't know which they were allowed to do excuse me i'm speaking you consistently said they were engaging without a contract which was improper which they were allowed to do under their ila you've consistently made statements disparaging them from the dais i'm not disparaging you yes you i just want accountability please don't say that was asking for accountability it made assumptions without the final finding you were making statements about how they were handling their finances having not received the report that is not something a mayor in a city should be doing to one of their partners even if you think there's all kinds of misconduct you should have waited till the results came in never said there was misconduct your quote in the sun sentinel says there is a i'm not no this it's not an exact quote but you said they have serious financial issues yeah that's what you said well i think spending money on non-public purposes which is part of their not my point is i think spending ten thousand dollars to house i'm speaking please i'm speaking please and mr i'm speaking please and i said mr hartwell does not deal with i did what no you don't get to speak it's my time i'm not going to be accused by someone who doesn't know you said inaccurate things and you've done it you said them in emails you've been caught up here so many times with a super majority saying inaccurate things with a deficit saying inaccurate things you keep on doing it and it's not right and the worst part of it it's a violation of our code of conduct i'm happy to stand by my numbers please stop you violated our code of conduct representing yourself as the mayor in the sun sentinel and speaking on behalf of the city without getting you said i'm the mayor of delray beach right that was the context in which you sent out that sun sentinel article you did not represent our voice look at you're out you're allowed to go ahead and give them all the money without it's not about giving them the money it's asking for professional and courteous behavior we're dealing with this from the mayor and from the dais i'm asking for professional courteous behavior going forward because i haven't appreciated this i'm going to stay on point i want to stay on point i'm allowed to finish my statement i'm not out of order oh this is on point mac bernard got a call one month ago at exactly the time we all found out that this audit wasn't going to produce misconduct fraud or misuse of taxpayer funds how do you say fraud when you don't have all the receipts if i don't have all the receipts how do i say there's no today he named you in the very beginning of his he said it came to him from you well he read it from the paper i'm sure mayor listen all i'm saying to you is these are our partners they're working for us they're presenting all these events in the city taxpayers came in here and said they want to pay that millage and they want to to embrace the dda and i'm sure there's no problem i don't understand why you want to eliminate them i've had four different people text me that have spoken to you that said point blank he wants to eliminate or reduce the district and i would just like to know why just answer the question it's obvious why what is the benefit to reducing the district don't listen i think i've talked about i've talked about curbing their the the jurisdiction of the district to not include west atlantic so that west atlantic can finally determine its own future and not have people that don't really care about west atlantic determine their mr bernard put in his notice quote is it legitimate at this time to question the continued necessity of its existence that is your agenda everybody you're welcome to you're telling people look i'm obviously in your brain people are texting me what you're saying and every action that you've taken from day one is leading to this because you and i both know the state is the only one who can eliminate the district pay this contract you want to go into other hyperbole we just want to know the truth mayor i've told you you're not you're not i'm not telling what you want to hear you're not telling me what i just want to hear the truth i want come i want people i can handle the truth i want people to spend public dollars to have accountability no i don't think being i don't think spending money on non-tax non-public items is a good idea no i don't think they should be allowed to be i could probably go through a list not permitted no i don't think they should be allowed to take staff out for christmas parties when they when that's not permitted no i don't think they should pay ten thousand dollars to house a band for a private why not contact your partner and sit down with them and have that conversation the dda is your partner they voted for you mayor they voted for and you're treating them like what if you ask them they're independent and they are not why don't we put half of the money out they're not part of our city they're part of the team gentlemen why don't we do a suggestion can we get we're off topic they're going to be they're going other we have we are on topic no fine bring it up in comments the residents want to hear what fine going on bring it up in comments so let's bring it up now mayor but we have other we have other agenda who cares if we stay here till midnight i don't care if we get to the bottom of this would you recognize the attorney please can i make a suggestion thank you i can amend the i can amend the ila amendment to state no later than december 31st 2025 and april 30th 2026 the city shall pay the dda management fee of 350 000 so we'll split it that should give them enough sufficient time to to come up with their policies you know the fact of the matter is they're going to go through a state audit they should probably have policies in place sooner rather totally agree so i don't i don't see an issue and that was my point and they could very easily simply adopt the city's your sunset in the article should have said that instead of financial mismanagement i think that could be a good compromise for everybody up here and gives everybody assurances that you're not paying all the money so based on that could we have a motion to to to to do that so it'd be a motion to approve as as i stated in the amendment and then i will go with the go to the dda and provide them with the amendment so moved all in they made a commitment the dda made a commitment to implement the recommendations by march of 2026 at which point i can go and follow up so mayor the dates that i provided would be consistent approval of amendment three to progressive design build agreement uh dbia contract pursuant to rfq 2023-066 who is um is that mr hadjimiri mr hadjimiri yes sir good this is our engineering for phase two good evening again mayor commissioner hassan hadjimiri utilities department uh this evening with me here is ms suzanne mclair project director slash vice president of cdm smith um um tonight we're going to provide you a uh progress a brief progress update on the water treatment plan and hopefully um request to uh move to uh construction phase and uh receive your approval um for this one project um this slide um summarizes the key steps that we have taken from 2021 uh to today and i actually can spend over one hour to go through this no don't okay thank you very much but uh but just to let you know prior to 2021 there was always concern about the water but i hate to say that nothing was done yes um there was no why we're here thank you but well that's prior to you it all happened because correct so when i came here the first thing i did just to review what was done it it wasn't even in this uh next five years cip and um so we had to start from ground zero um to address the the water issue in the city of delray so the first thing that we did was um review the visibility study that was done previously uh i think back in 2018 or so which was already outdated and it had data that was from 2010 to 2015 that it wasn't really usable for the you know project that we were going to do so that was the first thing that we did and um part of that it um gave us some preliminary uh points that what we needed um uh to move forward uh at that time it was uh basically the size of the treatment plan was supposed to be only 14 million gallons per day um of nano filtration and it had an estimated cost of 120 million dollars that is after even we updated so um we knew that from day one the 120 million dollars it was nowhere in uh utilities budget utility runs on enterprise fund it's not part of the general fund so no money was there and the main reason for that was because city had not had any rate increase for previous 20 years unlike any other municipalities or utilities in the state of florida or even throughout the whole us so the funding wasn't there as a result we had to start the rate study um to for the 120 million so we did that rate study and um it went to effect um you see on the bar graph um in 2023 and then after that we acquired the services of uh progressive design build cdm smith to start the the design of this project right after the authorization was given to them uh epa changed the ruling on uh pfos and um it forced us to actually redesign the treatment plan and to go from the 14 million gallons per day of nano filtration to 22 million gallon so that itself pretty much doubled the cost of the project and we had to go with the second rate study which um that was also implemented just earlier this year um at this point uh the design of the treatment plan is uh nearly probably close to 98 percent completed and we are um ready to move to the next phase which is the construction of this project as far as the dollar value um we spend uh close to 28 million dollars for the early procurement of the long lead items uh because of the tight schedule that we have um we had to do that um and i came before you a few months ago and uh for gracious you know gave us the approval to go on and do that in order to stay scheduled so we have done that we also uh started the process for the deep injection well that's where we dispose the membrane concentrate from the nano filtration and that requires a very long permitting process so we have done that and actually deep injection well are currently under construction so that was another 30 million dollars and for the guaranteed maximum price for the project itself for the construction phase of it is about 228 million well i would say 229 million um so it brings the total um construction cost a total project cost of uh 287 million 437 dollars and some change um so that is uh basically what we are asking uh this evening for uh approval is amendment number three to the um to the contract with the cdm to proceed with the uh construction of the new water plant um we are hoping to hopefully after tonight is scheduled uh ntp with the uh cdm i start construction in january of uh 2026 um this project uh include the water treatment plan itself the office building for the utilities uh administration and six uh raw water production wells because we uh need more water supply uh to uh in order to be able uh to use the uh treatment planet its full capacity uh not at this point but uh when we reach the maximum capacity of the treatment plant which is 22 million gallons per day we um as part of the nano filtration we have to dispose about 20 percent of the water that we are treating uh and that's why we started the deep injection well for this project and we're hoping to be project to be completed hopefully by mid um 2028 um mr mayor and commissioners i've been involved with uh construct design and construction of the one very large wastewater treatment plant in the county and two water plants and when it comes to this type of project there is nothing more challenging to get the approval of the administration uh within the cities and also uh coordination with the other department and but what i have seen in city of delray beach is greatly unmatched with any other municipalities i don't want to bring an example what we have been able to accomplish here for the past three years is taking other municipalities close to six to seven years wow it this is facts even myself when i was a project manager dealing with this type of project it's just a large large uh when you're spending in the hundreds of millions of dollars and you're building a facility that is going to last for another 30 40 years you are not doing it just one building 50 or 60. well i'm kidding mr we don't for 50 years so um hopefully it would last by the way the water treatment plan that we have is 60 years old right and it's still kicking it's still kicking so um so we're hoping for the facility that would uh uh sustain for many many more years and for new generation so my sincere appreciation to previous commissioner and this commissioners and mayors that um you trusted in me and utilities and any item that i brought to you um it was always unanimously approved and that's the great asset to have in any municipalities conjunction with that um my daily uh interaction with mr moore mr moore is always available within a minute if i text him he returns my text or call within a minute and we meet probably five or ten minutes right after that so that's one things that i never had this kind of uh response from the city manager in my previous um employment i'm not talking about about previous employment they were great but things here are being done differently totally differently uh development services from the earliest stages of uh design phase they got involved with us they want to make sure that we built this treatment plan to meet all the cities and requirement that they had so i'm talking about almost a year or more than a year um i really appreciate uh miss um and tears um team uh we got to the point that um we got to the point that um basically today i guess uh we got the tool permit that um we needed to proceed with this and also out of their kindness they waived the uh permitting fee that it was a financial benefit to this project or estimated in the beginning was 500 000 for the permitting so i really really appreciate uh her and her team's effort sorry just for the record the regulations allow for that so we're not rules or anything it wasn't a favor it wasn't a favor that we can all right let's move it along just to be clear thank you for the legal clarification i appreciate that i didn't know that i didn't know so i had to text her and then she said yes you know we do not charge permitting fee for cities facilities so that was in the midst of our actually finalizing our gmp because originally up to probably close to two months ago our maximum price for the whole project was 30 302 million dollars which it really shocked me and uh we had a lot of going back and forth with um our design um engineer and owner wrap because i had promised here i had been here before you i said 284 million i really could did not have a face to come back and sit down here and say 300 million so we were able to bring the cost on but not jeopardizing the quality of the facility that we were receiving um parks and recreation uh as i mentioned there are six raw water production wells as part of this project that we had to build brand new if you remember originally we were planning to have them at the golf course but because of the location and a lot of other things you know we decided not to do that and hydraulically it wasn't feasible was not feasible either so um again we met with mr meetard and uh he was gracious enough to give us two other parts that we could uh put these wells one of them is a lake view golf course and another one is catherine uh yes thank you um park right next to the uh boys and girls and boys club so we put in six wells uh in that area and if we didn't have that we would be spending probably two more years try to locate a private site and go through the easement to building especially in del rey i mean wall to wall is concrete and pavement there is no place for us to find a wild site but uh thanks mr meetard and that that helped us a lot both financially and time-wise and uh city attorney's office uh they've been putting up with me for the past five and a half years and i will not do anything without consultation with them when it comes to the contract when it comes to spending the money and they have been great again the same service i get from them it's a matter of the minutes or you know a couple minutes maybe or sometimes um days but that's no because because it's more complex i mean we gave the uh document to them and we say hey this is up you tell us where to move forward so they take a lot of responsibilities on saying yes go ahead and many times they have told me no hassan you out of your mind and and i get it and i really appreciate that and also our purchasing and finance that they've been very very very um helpful during the rfq and rfp process and also help us to secure the funding through the revenue bond this year and we are going through the same thing next year or the second half um to do that i'm going to turn over to ms mcclure to give you a little bit more all right we're almost done suzanne meckler cdm smith good to see you all um really just wanted to highlight i have the quick video which i think you've seen before the rendering um but just want to highlight for the community um the differences so we're going from an open tank lime softening plant to a closed building membrane skid setup so you know the hope is that the look and feel of it will be very nice for that neighborhood as well as anybody passing by it'll be very contained and controlled it also helps equipment last longer if it's inside um the building um so there is going to be a large building that will house 22 mgd and membrane skids um and this building is going to be right on 7th so you can see it there this is the final uh rendering that we've worked on and incorporates a lot of the planning uh comments with colors and the walls and the security and things like that um so you'll see on 7th will be the main membrane building and we're going to having to be constructing this while the existing facility is operational so i'll play a little bit of a video but you'll see what's going to pop up is the new step we are going to have to demolish very small amount of existing infrastructure that the city can continue to operate but we will be a very contained site which is good because the rest of the operations can keep going um but as the city um starts seeing this come forward let's see there we go that's the empty site right now it's the stormwater pond we're relocating the stormwater um and as you can see there's a couple of little things that will be demolished but then we'll start building the membrane building the administration building is on the right side of the screen and that is seventh that we're following down and so really the facade is what the neighbors will see um very quiet inside very contained in noise um and the access will also be controlled as you go on over to fourth um you'll see that we have a wall now with land new landscaping again all been coordinated with development services in that group uh really hoping to improve that look and feel of that site which is a lot of lime softening sludge uh set up right now as you turn the corner you'll see the blue um piping with the pads is actually where the deep injection wells are going and that is currently being uh set up to be constructed i think drilling starts at the end of this month early next month um so as neighbors will start seeing the drill rig get out there but that means work is being done so the project has started and as you go in the the project is now going to be the plant is going to be officially separate and secure from the rest of the property so as you know you have public works over there and the the public utilities we're just going to separate the water treatment plan itself so that can be a a secure area and then the administration building that the utilities will have will be more connected with the public works and the environmental services current building so that's the the the project and we're looking forward to getting started so thanks so much for your support along the way thank you very much uh commission no i just thanks i want to put forward the motion and get it going very place sometimes in january we will celebrate this as i've told you when we when we looked at this in 2012 the number was 120 million so it's not getting better right no thank you thank you so much thank you for finally getting this on the road for us both of you thank you so much all right we have um the next portion we have the quesad judicial we have actually for items 7b 7c and 7d uh and i'm going to read the the the instructions first and then i'm going to ask any of you wishing to speak on these matters to stand and get sworn let me read the instructions first these hearings will be this letter in the mail i would like to thank the city for communicating this issue to me um i have served i don't like to be about me but i've served on a on your code board for six years so i've heard many cases and i've tried to be a good neighbor and a decent citizen and representative and trying to help mitigate some things to come along and when this came to my house i debated whether i should come here tonight or not um and then i thought about it and i thought it's probably the most responsible thing i could do so um uh as you have to weigh these out you may not have put these rules in place that are asked you may have been on the board when they made these i don't know but um i've been living uh next door to projects that have come in and they've taken advantage of every inch of whatever you're giving and so the experience my family and the people that i talk to when they walk dogs and my most of my nearby neighbors are that we're not enjoying the privilege of living in the city of delvary beach like we should now i've lived here for 30 years and that doesn't mean everything should be like it was 30 years ago of course not we enjoy the progress and the service that you guys are overseeing on the commission however i'm going to ask you just as as a neighbor and as a resident and i'm just going to ask you to consider if this house was next door to you if this variance was in your backyard if it was going to interrupt your enjoyment of your property in any way shape or form where you live what would you think about that and when you start having a little bit of experience not not a lot it's six years of hearing it what will happen is is folks will find a way to not get a permit i didn't say they didn't get one but they're going to find a way to push the envelope as far as they can and these are professionals professional architects and they know the rules and i'd like you to take into consideration myself and all the people that live around this property as you consider granting variances and i want to thank you again for your service thank mr moore and thank you for having me thank you sir are there any other members of the public wishing to speak on this file seeing none is there any cross-examine of the the one person who spoke i think he just left by the applicant or the city no okay then it's to the commission did you have any comments you wanted to make so i you're sitting there trying to grab the mic so i'm figuring no i just you know we've gone over this issue at the last meeting this one um it meets lot coverage it meets setbacks it meets most of the regulations it is nonetheless um not meeting far um and so we're in a position where is the cure worse than the problem um the developer this is i think their first house in delray beach and so you know it was a failing on the architect or the pe okay yeah i mean it's the same as last time we acknowledged that the city had a part in this and so i i feel would feel like i think it's a foregone conclusion would you like me to make a motion well i want to hear from everybody else i feel the same way same you i mean yeah i mean we have this this is a deja vu i know and i appreciate the gentleman's service and i totally sympathize with him and understand what he's saying but when we have to say that we had some uh hand in the problem then i think and hopefully with the new matrix is we're going to be doing on everything this will be a a not a common occurrence okay so motion to motion to approve resolution number 266-25 second all uh and roll call setback requirement from five feet to two feet six inches for the project located at 601 and 777 east atlantic avenue also known as atlantic crossing as more particularly described herein providing for an effective date and further purposes if you please enter the file into the record um i'm going to give you two files one is for the waiver and one is for the accompanying site plan it's pz have a brief presentation i'd like to make regarding this waiver request because i believe it explains the why behind it and i'm going to give an overview of the project at large to begin this is the atlantic crossing project as i'm sure you're very aware it's bounded on the south by atlantic on the north by first to the west by federal to the east by veterans parkway it's bisected from south to north by seventh and as you look at the site plan here the buildings on the west side of seventh is considered phase one those are buildings one three six south and six north the east side of seventh is phase two those are buildings two four south five and four north this is the conceptual site plan that we presented at the beginning of the project well over a decade ago and here's an aerial photograph from a few weeks ago where the project stands today you can see that phase one the left side of seventh is complete those buildings are occupied with residents and restaurants and other commercial uses phase two is underway the entirety of the phase two site has been cleared what you're looking at on the southern portion of the site is the top of the subterranean parking garage atop of which will sit building two is another commercial building fronting atlantic behind that building excuse me behind that building four south which is a condominium building which we're discussing this evening how do i use the pointer can i point to it uh oh gosh i did something wrong i'm sorry which would you what would you like me to point to is this second portion up above the construction it's this it's right here yep and it's right there where the construction is ongoing at this moment thank you now i'll advance the slide can we do that okay you know this is a very large project obviously two city blocks and when it was initially conceived the idea was not that the entirety of the project would be the same architectural style but there would be a variety of architectural styles and those would be cohesive and complementary to one another so this is a rendering of building one the first commercial building along atlantic which i think is some is a coastal you know commercial style of building that's the rendering here's an image of what that building looks like as constructed this is building three this is the building immediately north of that building one which was designed in that alleys beach style you know the very white stucco and other elements it's got the living wall and the rendering and here it is today it's where hampton social is among others this is the main entry to building six north which is the northernmost building in phase one this is more of a coastal resort feel for the apartment building rendering again of the entry and then the as-built condition as it exists today well as i said this is regarding building four south and here you can see more clearly in the diagram the building in question which we pointed to earlier and as we began to contemplate work on phase two after all the years it has taken to get to this point we contemplated the design of building four south and whether or not it was still appropriate this image represents the original architectural style for that building for south which is something of a i'll use that one okay thanks very much uh something of a mediterranean revival style you see the tile roofs you see the arched entryway at the port co-share there and as we contemplated moving forward well go back a slide if i could there we go uh this has its place of course this design but years later we felt that it was no longer the best most suitable design style and so we approached the site plan review and appearance board and proposed a new style in 2022 and this was the proposal that we made this was the concept that we proposed which is obviously much more of a contemporary miami beach style building you know you can see the very clean lines the deep overhangs a very different architectural style and when we made our conceptual presentation to the board it was met with great enthusiasm and the board thought it was a very nice change of style and we're in favor of that and so we began working with my miss rodriguez and the rest of the staff to get through technical advisory review of that design and because of our own design and others it took us quite a while to get through that process over a year and a half and the final step of the approval for this level three modification that we were requesting to change the style of this building was a presentation to the site plan review and appearance board again which i made in this room and at that time their tastes had changed and this style was not approved by the board after about 18 months of work by the team and so we listened i listened to the board that evening and among several uh issues that they raised they they stated that they actually prefer the original style more than the new one and so the team contemplated that and we wanted to take into consideration the feedback that we had heard from the board and it was serious and we took it seriously so we literally went back to the drawing board and proposed a third style for this building which is this and this is what i would consider a contemporary interpretation of the meisner-esque style and you can see that it's in a way it's combining both elements from both the other two styles you'll note the curved archway over the port cocher with the blue tile inset it still has got some clean lines different from the tile roof that was the original proposal i'll show you a second image this is the one we've seen all three versions this is the north-facing main entry for the residence portion of this building and again you can see the carry through with the arched entryway and the blue tile insets and some of the design elements that are common to the port cocher are carried throughout the architectural style here when we responded to the comments from the site plan review and appearance board given where we were in the process we determined that we would certainly address the concerns and make the changes to the architectural style as you see them but working with the footprint of the building has had prior been designed so we didn't want to change the shape or the location of the building we wanted to keep that static and work with how we treated the exterior to meet the the feedback that we received and as a result of that i'm here with before you today to request this waiver here are the whys there are three interrelated elements to this request if we go back to that port cocher which i showed you in all three images the proportion of the arch that's creating the entry into the valet drop-off zone is specific and one of the things we're keen on as relates to this project is the public experience it's obviously a very important project here in delray beach it's very prominent and we want to ensure that when any member of the public comes to the project they feel that it's a good representation of the city that it's safe that it's enjoyable and that is important for the proportion of this building and so when we made these changes and we held the footprint of the building where it was and we created this new arched form over the port cocher the as you're looking at the image the left end of that arch what would be the north side of that arch where it meets the ground is where we have our encroachment the encroachment is two and a half feet into a required five foot setback and the reason we're requesting it is because we feel that to maintain the correct proportion of this form which is so important it's the main entry to this project for many folks who will be either walking onto the site or dropping a car off at the valet that that was critical for the design and the style of this building so that's part one that the proportion of that arch and where it meets the ground secondly and i've shown several enlargements of the very specific encroachment that we're requesting as i mentioned this is the valet drop-off zone and you can see how the valet comes in off of seventh and it splits into two lanes for passengers to safely drop off their vehicles with the valet and you can see in the image on the bottom right the amount of that encroachment as i described it earlier that is where the arch is meeting the ground and you can see that it's projecting two and a half feet into that required setback for a distance of approximately eight feet but you may also notice that that form where it's meeting the ground is at the very back edge of the curb of that drive lane you may also notice that on the east side of that drive lane there's a sidewalk of about seven and a half feet wide in those numbers the width of the drive lane the width of the sidewalk to the east are just right to have a safe experience for dropping off cars any narrowing of those dimensions would result in an inoptimal solution so again because of the grounding of that form where it is relative to this curb and as relates to the safe and functional valley drop-off zone has resulted in this portion of the project that is projecting into the encroach into the uh setback excuse me and then finally i want to point out that that particular form of the building is supporting a mast which as i believe you're aware will ultimately be in support of a tensile fabric art piece which will span over seventh it's connected to building four as you see here in this image it's connected to buildings three and one and building two as well and so for those three reasons the proportion of the form of the building which we redesigned in response to the site plan review and appearance board to maintain safe and effective widths for valet drop-off and in support of this public art piece in the future we are requesting a waiver to grant this encroachment thank you thank you very much to the city okay so i will just be quick i want to put a couple of things on the record the first um and this is before i think our part was here um the this project travels under a different set of land development regulations um it was approved prior to the 2015 rewrite of the form based code that we have now including those design styles so um as part of the settlement agreement they they they and that was in the backup so i hope that everybody understands that um there's you know the background most of you again so the settlement agreement again makes them travel under the 200 the 2013 version of the code um and over time there's been you know changes and adoptions what's before you now is um in concert with what is otherwise an administrative approval level one for this project is an administrative approval with um slight adjustments um related to you know extending the porker share we can't take action on that until we make a decision related to the waiver so i think that the graphics that the applicant provided are probably better than mine um but i'm gonna you know basically there's a slight encroachment into the landscape area it's again it's it's um supposed to have a five foot setback it's too it's a two feet and change encroachment and the encroachment because that deck is sort of over the landscape area it goes the whole route of the purple um it does not reduce the sidewalk area it does not reduce the landscape area except where the column is landing and um it's it's basically fairly minimal based on staff's analysis in terms of impact um you know again there's i think the graphics were probably better that um that you saw before and ultimately while you're weighing the request it's the standard waiver that's the same way we're findings as we always use whether it's going to have an adverse effect on the neighborhood it's going to diminish um any public facilities and you know even if the road is private i think the sidewalk being maintained is probably the main issue there um as well as not creating anything that is unsafe and then ultimately is it a special privilege and i'm not sure um there is an art piece that is being supported as well i think with these changes and you know we have to land the gravity to the ground for a required art installation as that is required as part of their approval as well so um minor changes but it is encroaching into what at the time was a five setback we require 10 now um but again this is a unique project and it kind of travels under its own um sort of approval at that point um susie rodriguez is our senior planner who has become our atlantic crossing expert so i asked her to be here in case you had any detailed questions about the project as well and she's done a really great job so i really appreciate her input thanks thank you very much uh this is now we're opening it up for public comment if there are any members of the public wishing to uh address the commission on this uh application please come to the lecture and give your name and address you will each have three minutes seeing none public comment is closed is there any rebuttal to either of you on anything that you've said no um i just add that the planning and zoning board did review and recommended unanimous approval okay no rebuttal for me lovely you were told by scrap to go back and create the third but does did the second version comply and did not need any waivers i'm just curious because that's you know this seems i'm going to approve this because i appreciate the fact that you went back to the drawing board and for the record susie rodriguez senior planner the site plan reuni appearance board they reviewed they did not have to review the architectural style since this was prior to that amendment but when they did review the overall level three application it was brought into question the style and it was brought back to um staff so we could back to our review and consider so then we brought it back to staff the applicant decided that they were going to um take into account what the scrab said and they reverted back to the old style i think the question the question was the second style would it have required no they i mean i think ultimately what we see from edwards company is a real effort to try to make sure they know how disruptive this project has been and it has a long history behind it right and they are very responsive to the input they get unfortunately they were responsive to getting i think a mixed message here or a message that changed over time which you know doesn't make the project go faster correct and it's unfortunate um but i'm i'll be supporting this or the second version if you decide to go back to that no it's the third iteration of the um yeah that was my question as to whether or not he would have needed it before because i happen to like that design but once you do these curved designs you need them wider right for the because just by definition of the design as opposed to having a square so right because we're we i know we have no inclement weather here so we never have to worry about having enough places for people to be undercover um so i i understand this i i'm gonna well i'll support it as well but i i need a motion to okay uh is this is resolution area of six thousand six thousand square feet to twenty five hundred and seventy eight square feet for the project known as fifth third bank located at 1820 south federal highway as more particularly described herein providing for an effective date and further purposes thank you if you could please read the project into the record uh yes anthea geniotis development services director and i'm going to enter uh two files uh zero zero zero one four twenty twenty five and zero zero zero zero fifteen twenty twenty five and the applicant is here with an overview thank you are there any ex parte conversations on this not for me not for me either and i'll ask mr marker when he gets in but to the applicant okay name and address you've been sworn in i saw you said i'm so you were sworn yes uh name uh tim loken 550 south caldwell street charlotte north carolina 28202 okay so the project uh that's on the screen here today is a fifth third bank project um it's on south federal highway and you oh i'm doing the slides i was going to say next slide um so the uh the agenda that we shared previously uh was multifaceted we've got the purpose of why we're here here some site plan uh data some background to the property the actual waiver requests and then some architectural characteristics um as well as the site landscape plan um so what we're asking is to construct a one-story standalone branch bank which includes a drive-through um with the associated waiver to reduce the minimum floor area from 6 000 square feet to 25 78 square feet as mentioned one second mr marker i'm just confirming did you have any ex parte communications on this no sir okay continue please so as mentioned the property is located on south federal highway we'll be be seeing some other views here too that kind of zooms in on it the development area is 0.87 acres its land use designation is general commercial the zoning district is planned commercial and there is an existing drive-through restaurant on the site and we're proposing a financial institution with the drive-through and the green oval here highlighted is the site and you can see um it's adjacent to some other uh out parcel type retail spaces which we'll be seeing in a future slide here this next slide is just depicting the existing uh abandoned burger king restaurant again being on the south federal highway it does have a high high visibility along a major road and um i believe we're in alignment with delray beach's long-term vision of revitalizing and read redeveloping the corridor some architectural imagery for some background so this is a you know 3d computer generated graphics of the proposed branch bank and so again we'd be demolishing the existing uh restaurant structure and proposed to build a new one-story uh 2500 square foot free free standing bank for fifth third so the parking of on this project would be 15 total spaces and that includes one accessible and the drive-through stacking for the atm drive-through meets the minimum 100 feet from from the point of transaction and the stormwater on site incorporates two stormwater retention areas designed to retain on-site runoff and comply with the drainage and stormwater quality standards um here you see a color site plan depicted with the landscaping uh north federal high south federal highway is on your plan uh east and so the front door to the bank is also facing uh south federal highway with a uh connecting sidewalk one is there's your sidewalk and connector and then the drive-through is here to the rear one of the uh notes that i'll make about what used to be and what we are planning is the entrance into the site went one from two points of access to one and we're kind of slowing down in a way the vehicle vehicular access uh to where there's the the rear point um of egress or exit is is here uh it's been noted previously that there was an opportunity for vehicles to sort of zoom through here uh with a straight shot and so we believe we've kind of further um softened uh this site situation um this is just kind of a depiction of some of the typical landscapes that you'd see that we're proposing on the site and then into the actual waiver request itself um here uh again where the waiver is from uh the ldr section 4.4.12 f2 to reduce the minimum required flow area for free standing structure in the pc zoning district from 6 000 square feet to 25 78 square feet there's also a height exception uh pursuant to ldr table 4.3.4 j3 to exceed the maximum allowed parapet height by four feet maximum allowed of four feet by one foot and 11 inches to a maximum parapet height of five foot 11 inches and i'll share a bit about that here in just a second are we good um the so the proposed uh bank aligns with the objectives and policies by promoting a land use arrangement that is compatible with the adjacent properties it provides access to goods and services and strengthens the commercial character of the corridor the proposal also supports the objectives by contributing to the ongoing improvements in reinvestment of established commercial areas through the coordinated design improvement access and site enhancements these are just a couple um some data points uh when we were working with staff of some of the um some of the ways the development complies with the development standards and i know the text is small but this gets into um you know our what we're proposing to build uh reduces the impervious um impervious area and so we have additional you know pervious area um the height is well below the maximum allowed square footage or the maximum allowed height of 40 feet we're below that um our lighting uh will meet you know the the standard for the area and um also have bicycle parking and things like that again uh here's the the site depicted and we're going to show just a little bit about the the immediate adjacent neighbors so we have a chick-fil-a a pancake house the verizon all very similar uh size everybody does right they're very efficient um anyway on these parcels very similar sized footprints and so we're asking to for an update you know to be in in line with with kind of what's what's already happening out there uh okay here's uh building elevations and this speaks a little bit to the parapet height requests so here we see uh the color on the top is the building exterior elevation and then the lower image is a section through the building and we're only asking for a little bit of an increase to the parapet height so that we're fully uh screening the mechanical units and it also as you can see from the building elevation itself it works a little bit with the building proportions um for for a balanced holistic uh look and this is what we spoke to earlier um with the staff is is the harmony um and proportions of the building as it relates not only to itself but also to the greater area we also shared a bit about the materials of the building and so this will be comprised of what's called acm metal panel that's a composite metal panel with a high quality paint finish the drive it is an ephus with the stucco type finish and then brick at the base what you see here is a slate gray and again we're getting towards the end of this presentation reiterating the site plan with generous landscape especially along south federal highway and that concludes it great thank you very much to the city welcome so i think you have a good overview from the applicant i did um i just wanted to uh state that i think part of the issue when we see these the waiver reductions from the minimum square floor area of 6 000 to smaller is because pc anticipated a larger site that was i think five acres or higher so we have these small pieces that don't fit the zoning designation and so when they go to redevelop them the building then isn't you know quite as large to be able to park it there's a little bit of excess parking but not a lot the burger king site also had a drainage problem like right in the middle of the site that pooled constantly and the design that has come out is going to completely you know fix that issue on the site and then the only thing as well is that while the square footage related to the building is truly a waiver for you to consider with the waiver findings the height exception is really that the board that is acting on the site plan has to sort of be okay with the height you have the ability to say yes or no to a parapet that exceeds four feet this is a final approval this is a level four this won't be an appealable this is final action on this project so if you have any questions um both miss rodriguez and i are here i also think it had i believe that there was a decrease in trips by this changing from a restaurant to a bank so the impact the overall impact of that you know technical measure is less that's it for me great this is a public uh hearing if any member of the public wishes to speak trip count and by the way their chocolate milkshake machine never worked and i'm hoping yours does there because that's a key part to this decision uh no i think it's great what you're doing there and um great use of the site it's a challenging site because you know it's narrowing and off things i think you're doing the right work and yes you have left the access road to go back to chick-fil-a playgrounds as well as additional concrete slab at mike mashick boy scout pavilion so revenue adjustment of 247 281.86 and the expense to increase by the same so simply offset in that regard and then there's a number of water and sewer transfer adjustments to be made netting a outcome of zero so the expense to expense transfer amount equals five hundred thirty four thousand forty eight dollars and acoustics corporation so mayor since the last time we met at the workshop we did have an internal staff meeting concerning the landscape maintenance equipment you don't have to make a decision today because it's late but i was going to ask the commission to reconsider just the monday through friday portion of that we had changed it to the noise would not be able to commence for landscape maintenance equipment only until 8 a.m because we do have city staff that actually starts at 6 a.m and they're out working at 7 a.m staff is asking that we amend that to 7 a.m and 5 p.m on weekdays on saturday and sunday between 8 a.m and 4 p.m so we'll still have give a little bit of um relief on the weekends but because of the the staff and their hours and because they are unit employees it would create a huge hardship for the city and i do believe that whatever ordinances are in place for our residents our staff should have to follow as well and so um that's why i'm asking for that that one minor change i did add the 10 minutes of noise for the for the animals um i will say that i think seven o'clock i mean i i i understand the staff's issue um but i mean the whole point of not having these things going on at seven o'clock in the morning was actually for the benefit of the residents um so i'm i'm happy to go ahead today but understand when we discuss more fully i'm going to need some kind of an explanation or that maybe we adjust if it's going to be before eight o'clock then maybe they have even a tighter standard or maybe just on public property but again there's some residential that abounds that so that's why we were just very it was supposed to be for the residents i understand to accommodate you've heard me say this before and in the meeting the mayor mayor when i asked that question about staff mr moore you said that wouldn't would be easy to accommodate well and part of that was as the city attorney discussed we had an internal dialogue relative to what can be addressed in that regard and initially i thought that was the case but taken under consideration how private property above public property it did evolve okay so we're going to be meetings in the month of january were january 13th and january 20th now of course there will be a joint workshop meeting involving the downtown development authority concerning atlantic avenue beautification thursday january 22nd the recommendation based on initial review and feedback everyone's schedule is instead of a january 13th meeting we would have the meeting one week prior tuesday january 6th so the new schedule would be tuesday january 6th tuesday january 20th in terms of regular meetings january 20th a workshop meeting will be contemplated as well in addition to your joint workshop meeting with the downtown development authority thursday january 22nd so my interest is to secure you all support and consensus to proceed with that updated schedule as we've made appropriate staff arrangements to facilitate that and again this is all is there another option because i think i might be away the sixth having is there we have to have two meetings in the month yes ma'am yes ma'am what's is there a way to do it the following the last week so to do the two at the end well i don't have a calendar in front of me so i don't even know what we're looking at so the tuesdays in the month of january would be the 6th the 13th the 13th itself for the reasons relative to palm beach county days the 20th and a 27th why don't we do the 20 and 27th then there's a cra meeting during what croquet is and everything i've asked frank monnier up here he's from france but he's also an expert in croquet he's involved with the international croquet center to come up and kind of talk about croquet and what it means and what people do we even have a a little presentation so you can help educate us about croquet you didn't have to say that i was from france it's like now they're going to hold me against me my wife is french so you know i i have to always acknowledge the french good all right so i'm the executive director for the croquet foundation of america we are based out of west pine beach and we are a non-profit organization we're definitely like about promoting the sport of croquet when it comes for social or competitive sport and that's where like i know you've had a lot of conversation about this and i wanted to tell you a little bit more you are actually like in an area where we have a national croquet center in west pine beach you are in the heart of croquet where we have not only the national croquet center we have the largest croquet private croquet club the national croquet club and we also host the u.s croquet association but overseas of the croquet um clubs in the country you have probably in this area if you look at broward and pine beach county the largest amount of croquet clubs in the country no yes so croquet is definitely like a sport that you do outdoor that you can play especially when you're in south florida that you can play 365 days a year that being like a low impact sport that a lot of people have been initiated when they were playing backyard croquet with their family during the holidays especially here in florida it is a friendly sport bring people together social all ages all backgrounds together you can play and at any time just think of golf billiard and chess all together as a kind of sport so it's definitely something that you're going to think about about four and a half million people have played croquet in the u.s at some point you have about 400 club nationwide that has like i said all the ages all genders you probably think of all the croquet of people in their whites all people playing in a private club it is definitely something that is totally changing today um going back to that older population definitely something that we do promote because it is going to give you a lot of exercise you're outside you're standing you're walking and you're going to concentrate we do a lot of things with the croquet foundation with kids with disability awards so people with uh parkinson or Alzheimer because you can actually concentrate when you play croquet but you see it growing in all the clubs in all the urban areas and also with a lot of activities with the kids actually for the first time last year we we not we national cookie center but we as a nation nationwide association hosted the international under 21 championships um also like a sport that is definitely growing we hosted last month the world championships of croquet association in westbound beach a lot of the cities are definitely going to bring it or are bringing it in the cities through private clubs or in private uh public courses just because of the low impact and how it brings people together like i said uh you're going to see a lot of school programs but you also see a lot of things that are going to be in promoting the health and weight uh wellness um activities for the sport where again whether you are going to be in the aging population where walking and being stable is important that's what can help but also for young professional where that sport is going to require you to slow down and breathe especially in a world where we go so fast definitely a good impact what you're going to do there's a lot of programs being developed with universities all over the country you have schools that are developing programs as well in the athletic program i'm going to go as fast as possible because i know it's late thanks so much um in terms of economics this is kind of a very easy program to put together when you put a course together this is smaller than a tennis court you're going to be able to scale it down if you need to in terms of space the only main requirement in terms of maintenance is to keep the grass at quite an inch or lower but in terms of investment this is just having a flat land having grass and the equipment that you're going to have in the regular maintenance if you look also at every cities or country clubs or private clubs you're going to see also a lot of their pickable courts being changed into croquet clubs or croquet courts what you can do with uh public croquet uh course like some of the cities have done in saint augustine or like in uh venice you're going to have the opportunity to have a lot of things with the family having lessons um with the schools or again with a different association uh but you have around the city the senior centers for example all um activities for ski schools and after school programs and like i said you have a lot of program clubs around so you also have the opportunity to have a lot of partnership to help in terms of pros but also helping you with maintenance uh or equipment with the different clubs that are here you have two clubs in there right two private clubs uh you have three in boca and you have probably seven between west pine beach and pine beach so that's another one i want to say about croquet i'm making it as fast as i can no no that's why i i i i asked you to come and i appreciate it we've not met before so it's a pleasure um and this really piqued my interest when i heard that the boca raton resort was then converting stuff to bring croquet in because of the number of people that wanted to play we already know that the little club has the little club has one that's one um but one of the things that and i don't know if you know the statistics or not how many i was told that there's a lot of players who actually live in delray beach that play at your facility in in in west palm well i am a direct resident oh are you okay and i've been a member over there for five years so it's like there's definitely like i don't know the exact number but we have people from boca and delray but do not want to be in the very exclusive country club and are coming to us we are not like in a country club so at the croquet center our dues are very very low but any opportunity that people can find to have more public places where they can play in practice obviously you're not going to build a course where you're going to have competition in tournaments but definitely people want to play and bring their friends um because what i'm trying to achieve and i appreciate you uh mr manu your presentation um because i'm i'm seeing that more and more people are playing it and i mean again i don't play so i'm just reading how more and more people are playing it um and my goal is to and i've sent you the information on what we have there at the behind veterans park and what my goal here is hopefully tonight is to get the commission to agree to just study because we don't even know what we can put there and how we can put it there and what it's going to cost to put it there but if i'm trying to create options to keep it as an open space a recreational space that's all i'm trying to do and i wanted some introduction to croquet because we have a lawn bowling thing at the moment and i we saw that some of it can coexist we had all kinds of different stuff like that but i just want to kind of know what it would entail should we decide to number one do that and number two in what way would we then be able to participate with some of the other you mentioned all these clubs uh and i said i know the two but i know that there's others um what kind of i mean other like regular tournament how how could we make sure that if we did this we would be somehow included in i'm going to use the term circuit for lack of a better term in terms of getting this club utilized by others to come to delray to play it so if you want to have it used by players like i said it doesn't really matter on the size you can have a proper size what's a proper size and you has our staff looked into this because i feel tremendously i did not i saw this on here i had no idea but we at the last meeting we were talking about our staff looking into this we haven't i have not spoken to our staff our staff hasn't done a presentation and then this lovely gentleman comes all the way here and sits here for hours to do a presentation we don't even know there's a lot of maintenance required with croquet keeping the grass at that level and what have you why aren't we talking about doing something like this over at the golf course having a small section at the golf course and having maintenance there it's a very different experience as was described to me you know have you played croquet you can bring people to the golf course uh but then that's where they stay whereas if you brought them downtown the whole idea would be they would play we don't i would like staff i i think what we should do on this evening i don't want i'm not going to say yes to a study and go out and spend money we need to talk to our staff about this and see what what the thoughts are well that's that's i understand your opinion my view is that we have this site that's not being used for anything at the moment cart before the horse though you're talking about let's do a study on it let's talk to our staff first see if it's even doable before we do a study i got your point the my my goal here is to see what we whether this is a bona fide type of option to put into a i think our staff could figure that out i have all the faith in our staff talking and i'm trying to get i mean i'm trying to be polite um the so what i'm asking for and staff will clearly be involved because i've spoken to sam about this um but sam will be the first to tell you he doesn't design croquet courses so this is a specialty that we're trying to get someone to come in and tell us look if we're going to do this and we don't know if we're going to do that we i mean we don't know but i do know that we have a a a place back there which is not being used that there's tremendous amount of pressure because it's not being used and to create a recreational activity there which is a groaning activity is other communities are doing it so we really should be thinking in terms of how do we maximize the use of this recreation space which is why croquet kind of fit nicely with the layout and it's on grass and all i'm trying to do is to see if i can move this forward to have somebody help us with this we're not talking about spending a hundred thousand dollars what are we talking about spending i don't know what the cost that's the question though we keep on trying to do these things without even knowing the cost i'm not making any determinations unless someone can come in here and say what's the cost what's this let's let sam just look into it a little and come back to us we're not going to get to the point of understanding cost we have our staff can probably investigate what the cost to install croquet would be they don't have to be croquet experts to figure it out if i may ladies and gentlemen talk for suggestion a little clarity so there had been consensus that we come back and offer a brief presentation to this effect i actually agree with the sentiment that staff should have the opportunity to review the consideration to get to this place however i don't think we were in position to do that until such a discussion such a discussion such as this takes place this evening so i would support that direction because that does make sense my point is staff's going to have to coordinate with someone like you that's what i'm getting yes you know who does these designs someone's going to have to coordinate with a croquet person so when i like saying i want to go to the golf course but i'm not going to call a golf course designer so what i'd like to do with pretty that's a pretty big field 28 yards in in the so now given that clarity giving your feedback i'd like to offer the recommendation that we be given the coming weeks to assess what this might look like and we will offer a follow-up presentation in terms of any feasibility you're saying modest capital costs are a hundred thousand dollars if you're going to do like the full professional croquet court with all the irrigation and everything that is going on we're building right now for extra courts we already have 13 we're building four more next year plus another additional four in 2027 so i'm more than happy to welcome anybody that wanted to come and have a discussion about what it means to build obviously i'm going to tell you what it is to have a world cookie from a world croquet federation approved court to have international level competition but i can also put you in contact with people who have done i don't want to say less aversion but like more accessible less costly courses one other question if you have mine so assume you go with that course hundred thousand uh for the capital costs what's the annual cost of maintenance i know my cost i don't know what it is no i would add to that what's the staffing cost well that's maintenance yeah i mean there's going to be i mean i played croquet as a kid and you brought your own wickets and all that good stuff yes i don't think we're talking about that here i think we're talking about this being set up so it's going to have to be manned there's got to be some i don't know sam could look at it but there's got to be some kind of staffing model all right so the city is going to look into this meaning ability cost etc and if the city could also i guess look at uh the golf course just to see if there's a space i don't know we can't do it's good you're going to have a management company we can do whatever we want no we can't really well we can yeah we can blow the bond indenture too ladies and gentlemen i think i have the consensus and direction i need we'll start piece by piece we'll take it from there so we'll create an environment to come back before the city commission with respect to what this might look like in this environment the golf course we'll touch in the aftermath of that should there be merit to do so that's something that we need to follow up and examine as well and i'm happy to do it thank you know but we haven't heard i know we're waiting it's i was giving him one more meeting about reconstituting whether we call it the financial review board which is but but they work with the auditor and assignments that the auditor gives them to look at certain components of the city in certain you know way the city works i think it's a great idea we had a very very capable board that did this years ago it was disbanded for reasons i don't understand but i think now it's time to now that we have an in-house auditor to actually have a you know to what commissioner casal brought up a few meetings ago to to see how we can move that forward and i would appreciate it if if you could come back with some kind of a proposal how it would be constituted i could you could go back and look at the old exactly yeah we have it's not like we don't we don't have the documentation on how we did it before it's more about qualifications too i think there should be specific absolutely this is not this has got to be real qualifications so we'll make it as a discussion item mayor yes we'll make it as a discussion item to bring it back to you um however you want to do it yeah so um something that was mentioned that i saw at the planning and zoning meeting and i just wanted to know where it's falling there was a discussion about having uh shooting shooting ranges adjacent to residential properties and i haven't heard anything since that now are we i mean we had we used to look at these and do a zoning in progress so you can't be i don't know whether we're what we're allowed to do or not because i do think there needs to be some kind of a regulation of whether or not you want a gun range it was in mrock did we talk about potentially adding that as a conditional use so it at least have to come in front of us my my concern is sp 180 okay you know i'm willing to take on sp 180 on this issue because i don't think you're going to have the who's going to who's going to fight you the gun rangers yeah you know i maybe i just think the application that was before the planning and zoning board it's my understanding that it was um withdrawn yeah but i think the time to do it is before someone does it again we're happy to look into it and it doesn't make sense to put it you know put it near schools or residential we've been very cautious about it um however if we do get a challenge there is a certain finite amount of time that we have to let the commission know and take some action with the ordinance so it's not just this is automatic you can go to court and they have to give us an opportunity which i mean i'm not positive i think it's a very sense i don't know that this is one i mean i can tell you owners and things like that are going to do it whether you do this that or the other with their property but trying to prevent a gun thing going in a residential neighborhood i'm not sure you get a lot of people fighting that i really i really don't so do you want us to look into that i just think i think it's we need to i don't want to be relying on i mean we have this zoning district that you're allowed to put these things in and it seems to be i mean you can let her look into it and get back to us okay um first night i've received i can't tell you how many calls i got about first night and i know you and i have spoken about this because there is a real genuine desire for the people to have some something to do on something on first night and the way i had you and i had discussed it was i know we couldn't do the full-blown thing but you said that you have the ability to do put something together we probably end around 10 o'clock but we could have some minimal fireworks display not like we've done on our big ones on the beach but kind of like that whatever that one was that we had two years mayor could i on this because i talked to staff on this there's no our staff has been given that time off already yeah i understand but they were giving that comment this is my comments i appreciate your comment so while i understand the issue that was raised this is not really a um i am told that we can be done you need a consensus i think gosh i really wish you would but i mean you need a consensus so i'm going to get there if you don't want to vote for the citizens to have it then you don't have to it's not about the citizens you already know i know you ask them to take it off you work for staff mr mayor may i clarify for staff obviously you brought this up with me last week literally not terribly long ago and working with everybody involved we are not in position to offer a full if i may please a full-blown event concerts activities etc once upon a time this was actually facilitated by the former organization the the marketing organization that existed once upon a time stephanie was involved etc the city was a bit of a partner so at this juncture if any opportunity can be made available at all would be a brief fireworks display and that is it and that does require some logistics to get squared away in that regard so i did speak with staff obviously when the interest came about in that regard and my commitment or direction was that hey this is something that the commission would have to offer consensus on before we can remotely pursue the consideration but it's nowhere we're nowhere in position to offer a full-blown event at this juncture during the budgeting process we talked about what special event priorities would be to focus this was not one of them this current fiscal year nor the previous fiscal year and that's why we are where we are so that's where it lies and just to clarify for everybody's benefit that's how this came about nothing further i i guess i'm looking for consensus for you to put together that smaller thing smaller event so that because families will go down it will give them something to do on first night it'll be over by 10 o'clock it was the way we just just discussed it could be over by 10 o'clock but we will have done something because i i think the city residents and people would they everybody talks about bringing people downtown so you know this is something that we should be doing for our residents because it gives them something to do on first night and it's been a tradition in delray for a lot of years i would i didn't i'll be honest i didn't focus on it during the budget period that it wasn't on the list i'm honest um because if i had i would have raised it then so i'm looking for consensus if i may you why are you encouraging this smaller event when you know we don't have the staff for it our staff is working all of december in christmas village day and night i know this because i volunteered there our staff from all departments is there day and night and the staff that would organize this was specifically given that time off after we told them cut some of these events this is the most costly because the fireworks are done in close proximity to the to the i'm speaking i know no no you're not because you made the book but you your city manager should not be encouraging this you just said we can do this when your staff is telling you they can't that's not what i'm saying no because staff has the time off and there's nobody to do it so we'd be calling staff out of their time off if we could if we could work it out if there's some way that we can work it out mr moore if it if there's not then it's not if you if you figure out there's a way that we can work it out but to have the smaller event i'm i'm in agreement how are you going to staff it when staff is off it's a reasonable question if staff has been given time off and they've made vacation plans are you going to tell them come back in that's the city manager's job he's already said i know you don't want staff has a vacation until you get your way ask mr moore is staff on vacation in that department any staff members are in fact on vacation staff members that would do this so what would this would require let's tell the staff what this requires though it requires calling your staff that's on a holiday vacation and i'm not interested in doing that then why are you encouraging him i'm not encouraging anything as i've stated three times i'm not encouraging anything i will sit with this inquiry a few days ago my direction was talk about consensus and who gave you that direction pardon me why are you taking i'm not taking direction from anybody no i'm not told you they're not available julie commissioner gosal please that's not what i did five times right but you someone should listen so you're not happy with the first answer you ask it i mean please it's how do you tell people that have time off if they're going on vacations do it i mean i i we don't know what's available yet we don't know but i want to get get consensus to see if we can do it because i think the city residents deserve something they didn't care that it wasn't happening last year do you have to interrupt the entire time i just think it's disgusting to be asking our staff to come in on their vacation time right after they worked the whole christmas you have no idea what people do please i'm not in agreement with asking anyone to return off their vacation however if there's a way that you can do this then ask that question this will require staff to return off their vacation that means he's going to come back with an answer that we can't do it and and do we have the budget for it no you know we did money you know we passed the hat already twice tonight so yeah you know this was this is going to require real money we need to know what the what the cost is going to be like we'll have to put this in the budget and i could describe what that is quite frankly we don't have consensus correct fine okay that's end of it uh my last thing is is missy still here no she she's not she got out of dodge you know i i i i'm sure we all have gotten a bunch of emails on this barwick road thing i don't know the answer but i would like if our staff can come up and explain to us what we're doing here because i don't know whether they're making good points or bad points i don't know if we're we're we're following standard wits or not i don't know any of that i do know that i'm getting a lot of emails and i do understand that people aren't residents but we are building the road and we are maybe or maybe not impacting them i just would like somebody who is an expert to kind of so ladies and gentlemen what i plan to do for the january 6 meeting now that we've clarified january 6 we'll have a brief presentation to clarify the facts accordingly if that's okay with the city commission i think that would be appropriate because you've all been experiencing inquiries we've been experiencing inquiries and quite frankly in my mind it's a bit challenging because much of it is unincorporated residents they're not residents of the dairy beach corporate limits nevertheless we do what we can to be mindful and cognizant of impacts to anybody at all so let's give an opportunity we'll create an opportunity for that clarity so january 6 early part of the meeting we'll offer that update and we'll go from there so we'll do so with that if that's okay with everybody we'll make arrangements otherwise nothing further fine is there anything else
