here we have a quorum thank you very much if you could all please rise for the pledge of allegiance i pledge allegiance to the flag of the united states of america and to the republic for which stands one nation under god indivisible with liberty and justice for all thank you very much you may be seated uh we have on our agenda agenda approval there are any um uh additions subtractions
deletions etc on the agenda i wanted to um just quickly discuss sorry forgive me for one moment the reptiles item which is i hang on please six b thank you very much mr moore could we make that
7a 6b yes okay so you want to pull that big so we'll make that uh agenda item 7a yes thank you okay is there a consensus for that yes yes okay um any any other um items seeing none if i could have an approval of the agenda as amended second all in favor aye opposed okay adopted uh we now have presentation legislative uh updates by senator laurie burman thank you senator burman for joining us
this evening okay are we on yeah okay good evening everyone so happy to be here um i'm senator laurie burman i have represented delray for many many years um and we have term limits in the florida legislature i have been in the house of representatives for eight years and the senate for eight years and i have hit my term limits so this is my last year um representing the city and probably my last legislative report to all of you um and congratulations to uh commissioner maleka and joining the commission um and always a joy to work with all of you here on in the commission so um when i so a couple things first of all we have one responsibility in the legislature and that is to have a balanced budget and we failed um so we adjourned but we will be coming back to do the balance budget it has to be done by july 1st there were rumors we were going back next monday but that is seeming more and more unlikely we are going back april 20th a week from monday to do congressional redistricting only um so maybe they'll wrap it in maybe not um to answer your the big pressing question that everybody asks and that is what is going on with property tax it is in the same situation we did not do anything the house actually put forth a bill um pretty much uh eliminating property tax with the with exceptions for law enforcement in schools um we did not take that up in the senate i consider us the adults in the room um and were that i would think that would be a highly unlikely amendment in order to do anything for property taxes it has to be a constitutional amendment so everybody will get the opportunity to vote on it i do believe there will be something i don't know when it will come out if it will be in conjunction with all the other issues that are going on but i ask that everyone really examine and look at what we're doing see what the ramifications are you as city council members understand how devastating it can be to have changes to the property tax schedule that we have right now there might be some good things that we could do to help people um you know there's there's a lot of ideas floating around out there but i think a total elimination is uh really going to backfire on the state but let's see there could be something that comes out but all of you as citizens please educate yourself on the ballot amendment so that you when you vote you understand does it mean that your roads aren't going to be paved your trash isn't going to be picked up your parks are going to be closed and only open on saturdays you know so those are all different problems that could arise or does it mean that the fees will be switched um that commercial properties will pay more in in taxes will there be more fees to make up for the loss of income so it's it's going to be a real conundrum and i just ask all of you to pay attention um so what we did do we passed um a little over there's usually 2 000 bills roughly filed we passed a little bit over 200 which is actually a pretty extraordinarily small number which is sometimes is good because sometimes it's the 60 most dangerous days in the state when we're in session um but of those bills that we pass i would say there were an inordinate number of bills that preempted your ability to rule your uh your city here in delray beach um i am very much in favor of home rule i believe that the government closest to the people knows what know what the people want we have 67 counties and over 400 cities here in the state of florida and when you start preempting you're making the same rule for everybody and that's a problem because what happens is in delray beach is a lot different than what's going on in some of the rural areas and in some of the panhandle um so i always as my update to you all i like to give you a little bit of a review of what went on with preemption you will hear more from your from the league of cities from your attorneys but um just to give you a little highlight of um some of the things that we did pass so um we changed the sovereign immunity limits so right right now i think it was 250 and 350 we raised it to 350 per 350 000 per person and 500 000 per incident so when you do have a lawsuit most likely those numbers will be higher um and you will you might have to come up with more money in addition um if you have insurance that covers those numbers those that will probably also increase um that was a very hard-fought compromise there was um a lot of discussion of raising the limits up to a million dollars per incident and uh i will tell you i this past year i was the democratic minority chair and so i met with the league of cities every week and they did an amazing job they really worked hard because this was a session where cities and counties were attacked and they did everything they could to make bad bills a little more tolerable and that was an example of where they did it other things that we preempted you are not allowed to regulate the fuel source of gas leaf blowers so if somebody wants to use a leak gas leaf blowers they are they are allowed to you are not allowed to pass any regulations to achieve net zero greenhouse gas emissions we asked how that affects having a bus that would be an electric bus and the answer was pretty much you will have to justify that it's being done for economic reasons and not for um admit greenhouse not for carbon reduction reasons um so that was that was one of the more troubling bills that we saw um this session we also did a bill that so my goal as the minority leader was to put forth an agenda that was based on affordability i think those of us in the legislature have an obligation to help people be able to afford to live in this state to address the issues that affect our pocket books so we put forth an agenda of 11 insurance bills and not one of them got heard nothing was done to change your insurance at all here in the state this year there the feeling in tallahassee is rates are stabilizing and maybe going down a little bit but remember we're already twice the national average so i'm not happy that we're stabilizing at twice the national average i think we should have done something on the insurance front but what we did do is we did a lot of cultural war issues and one of them had to do with preemption on the city level and that was we eliminated any ability for a city or county to talk about and have programming that was based on diversity equity and inclusion um it is very very confusing the bill is so what happened was we would question the bill sponsor and say well is my city allowed to sponsor black history month and so the sponsor would go and make an exempt an exception and he would say okay well if it's a federally recognized holiday yes your city can can sponsor something but like what happens i know delray beach has a huge um st patrick's day parade i don't think that's a federal holiday um so i i'm not sure if you guys actually give any money to st patrick's day you are allowed to have police presence there we did clarify that but if you gave any money to the parade um that might be a violation of the dei you have to really look into that um but there yeah it's it's extraordinary like if you sponsor we ask questions about all different permutations um you know if you do something that's latin american somebody just came up and asked me a question about that um there is an exception for something that's free and open to the public so maybe maybe the parade would qualify for that i mean there it's just such a confusing bill and the and the end result of having a confusing bill like that is that it has a chilling effect because you're you're not going to want to you know get as involved with it you'll just go oh let's not do that we don't know what's going on if we're going to get in trouble for doing a bill like that um we also um did a couple bills about um let me just go through here and make sure i did hand you this out so you have all the preemption bills on here um oh yes we did a bill that you have to put certain information about your budget on your website and um you know there's very specific information and you also have to do an exercise where you um reduce your budget by 10 you don't have to implement the exercise but you will have to do the exercise yeah yeah so i mean there were there were um there were things done about um permitting um there was discussion about data centers um because there's a big data center supposedly coming into uh the area off of southern boulevard toward the western communities um with data centers in the end one of the interesting they actually left a lot of the data centers to cities and counties which was surprising and good so you will if there are any data centers that want to come into your city you will have the ability to negotiate with them one of the things i was disappointed about that was in that bill um originally they had a clause saying that you the city could not enter into a non-disclosure agreement with the um potential data center and now they they took that out so you can have a non-disclosure agreement and the non-disclosure agreement can provide that for up to one year you don't have to disclose the location so i i i found that pretty troubling i would hope that if there's going to be a data center where i live that i would at least know where it's going to be placed um but right now the way that bill was worded you have that ability um i don't know do you provide utilities
to any other surrounding communities the city of dairy beach to a light extent actually does we do
support gulf stream for example okay so there was a bill that limits um how much you can charge as a differential to um surrounding cities up to only 25 percent more of what you charge to your for your residence um so uh as you can see a lot of things were done on on preemption um i gave everyone we handed out this it has also some good bills that were done we did a bill about coastal resiliency i passed a couple pieces of legislation one about domestic violence one for physical education requirements for students with developmental disabilities who can now use their participation in the special olympics i was really proud of that bill and we worked with our school board to get that through we do uh occasionally do some bills that are a little more lighthearted last year and this year we tried but we're unsuccessful to get the flamingo as our state bird so we're still stuck with i think the mockingbird we need to get rid of that um but um so that's kind of in a nutshell um what's going on oh we did and i did want to talk about appropriations um we did we're successful so far because obviously the budget is not done but we do have an appropriation for delray beach for swinton avenue and atlantic avenue intersection improvements right now in the budget we have um 650 000 on the senate side nothing on the house but as long as we're in play in one chamber that's a good sign and hopefully when we go back we'll be able to do that and we also did get money for delray fire and rescue beach rescue drone program in the house for 338 000 so it's good that we're in play and hopefully when we go back to tellahassee we'll be successful so that's pretty much a little bit of a nutshell of what happened in our uh 60 most dangerous days and i'm happy to answer any questions that anybody has thank you very
much uh first of all i mean i i i watched very closely what you were doing with the on a lot of these bills and you fought very hard for local rule uh you did not mention that you fought also to get some money for the uh our local uh dfw c right oh right we talked about uh and i know that's that i don't know how it's going to do and it's not there's not getting a lot of traction but at least you fought very hard to get some some money towards the the rehab of that facility which i i personally thank you
very much for sure i feel pretty good about it because um joe casello who was the state representative who represented this area um before rob long who couldn't make it here tonight no he's on his way he'll be here at 5 20. we are keep i have to keep dragging you along just like when they the tv people said like a stretch out your thing he's gonna be on his way rob long took over and he was also instrumental in that and we are talking about um using naming the the center for um joe casello so so i i'm i was happy to write a letter in support of that i just think that you know whatever we can do to make that large you know okay good up and running it's great but you've done a great job
so let me let me any of the commission with any any comments from commissioner no thank you for being here and for updating us into uh a lot of the things that have been concerning me for a long time particularly the dei which could extend to the menorah lighting or a lot of other things well they excluded religion believe it or not oh they did they did exclude religion
doesn't saint patrick's day a religion i mean it's a saint in religion i mean i'm not saying that
because i'm irish but you know right for you for you it is for you and um i know that government can't advertise about like the property taxes or anything if something's on the ballot but can't we
make some proactive steps towards it prior to that um yeah you have to be careful okay absolutely we'll talk with the city manager he's shaking his head he understands i mean right now certainly you can do anything you want because there's nothing on the ballot right now right so um you can be telling people be careful what what you wish for um you know because we all want lower property taxes all right mr long has entered the auditorium mr mayor i'd like to chime in on a couple points if i may
can i do can i let i'm going to let the commission finish of course you can commissioner casal
thank you um i appreciate you coming here and i these the preemptions i mean we are a by constitutional right we are entitled to home rule and we're losing it every single day it's frightening um a lot of pro development what 180 and 803 927 every single day land use is one of our most valuable tools and we're losing control over it that concerns me but the biggest problem and i've been every time anybody comes and rob knows what i'll say exactly about live local it doesn't work for us they're making these these laws to cover the whole state but they don't work we're at build out we need to be so selective about what we're doing and we can't afford to lose industrial land use to residential apartments but the biggest problem i think when you're telling people to pay attention and this is what people may not really know is how we are being forced to cooperate because incorporated in every one of these laws is terminology that says if your municipal elected officials do not follow this they can be removed from office they can be um right the dei bill yes you can be fined daily you can even be charged yes criminally this is shocking to me it is yes it is i 100 agree with you
i don't see an end to it either it's a chilling effect 100 it's concerning so thank you for your time and i always
appreciate your hard work thank you commissioner burns yes i just wanted to say thank you as well senator berman for uh bringing this information to us and thank you for your briefing so that i can uh internalize this and share it with my community um but yeah and thank you so much for the work that you've done for um defending homeroom for us because you know as my colleagues say we're losing it day by day um so thank you you're welcome commissioner mark i don't have anything further other than to
say thank you very very much for the the tireless work that you do we we really appreciate it and rob things are going way better without you up here i just want to throw that out i mean
mr mayor yeah i'm sorry mr moore thank you and thank you senator berman we interact pretty well working closely with ballot partners so thank you for the good work so my interest at this time is to chime in relative to the educational piece you just talked about commissioner malica of course you in orientation mode we're spending time together the best way to achieve that is via the annual proposed budget process or quarterly by annual updates regarding financial conditions of the city as it relates to property taxes revenue forecasting analysis impacts that may be achieved in that regard that's a great way to educate the community the commission residents stakeholders etc without compromising our inability to directly market or directly ask residents or stakeholders to take a particular position so there's approaches we have in mind and they've there's actually a couple templates we've developed myself working with chief financial officer henry dakowitz should any specific consideration come available we'll be able to showcase for the city of dairy beach what the financial impacts would be so from an educational community update standpoint there are some strategies we'll be able to execute without
compromising ourselves legally right number one that's a great point and i know the league has been doing that the league of cities has been doing that also exactly so we're all in alignment in that
regard and that's what we'll bring to the city of dairy beach if necessary in addition you talked a little bit about the diversity equity inclusion adjustments haven't been made by the forlora the legislature it's ought to become effective january 1 2027 my review of the background and material i highlight that because a couple of you all made faces here at the dais when you commented in your presentation as to what the impacts are in that regard so not sweating 2026 however we have to prepare ourselves accordingly and we are in fact beginning at this time so thank you wonderful thank you senator and
i just want to know a personal note uh you worked very hard and i was so happy it was passed the bill related to domestic violence yes i think that is such a serious issue in this country that people goes largely ignored because they're confined within families but it's it's yeah i the work that you did they'll let the bill that was passed is is by the way i i think it could have gone farther um but it was
right it was well they're doing a great first step right they're doing the study so just to explain to everybody about my bill um what what what the bill says is we need to do a study to create a phone number for someone who's in a domestic violence situation which would be a panic button kind of number that would go and meet to the police it will not be 9-1-1 when you call 9-1-1 and your perpetrator sees that you call 9-1-1 the the violence escalates and it's very very lethal and dangerous this way you would have a phone number you put it in your phone is your friend susie you know somebody's and there and no one picks up there's no no voice on the other side so if somebody grabs your phone oh susie didn't answer or whatever and um they the police come immediately to where you are so we're hoping that will happen um it was a first step and uh no i think that's a great bill and and and
and representative long you were a big supporter too so i i i think this is people don't realize these are the kind of the bread and butter things that make up a community and they go largely ignored
because they're not right fashionable but i want to thank you very much for the work you did on that last week um you all may have seen in the paper that um very disturbingly and very sadly a city commissioner from carl springs yeah was shot to death by her husband um and it only highlights how domestic violence is so prevalent and across every part of our cities and counties so whatever we can do i i said in my speech i'm very tired of reading in the newspaper about another one of these incidents and i would love for us to not have to read about these incidents anymore so well thank you very much for
all the work you did on that really thank you so very much and now we welcome back to the podium boy it's weird being down here um representative robert long
so rob long rob long it's three three four four five right we're just yeah yeah that's it so well anyway i did the same thing to senator berman at bpoa last week where i showed up right as she was finishing but then i delivered a completely redundant presentation i'm not going to do that here though well because i got the gavel yeah i know i know you're you're quick with the gavel but anyway uh thank you great to see you mayor and and this esteemed commission and of course the illustrious city manager i had to use a big word uh to introduce terence but um uh and congratulations to vice mayor burns and congratulations to commissioner malica um so i'll be quick because i just have a couple things to add um i'm sure senator berman um we have we have a road show now so i kind of know the whole routine um i just tack on a few quick things at the end because the senator the pro here i'm just a rookie really it is a really comprehensive job of covering everything that's been going on i'm sure she alluded to the fact that we didn't get much done this session we're going to be heading back up there in two weeks and so we'll probably have a follow-up update for you after the budget shakes out we talk about property taxes and we do this congressional redistricting for some reason before five years before the census go figure so um but i did want to we talk i heard you guys talk about home rule a little bit and some of the ridiculous preemptions that we're seeing um this this i know how well versed this commission is and well educated this commission is and the city is in terms of of home rule and preemptions and i i haven't seen so much preemptions that impact municipalities as ever as i've seen this session um and i know that uh house bill 803 was in particular is going to have a direct impact on this city's ability to uh build the new development services annex that i know you guys were looking at which is extremely disappointing um and the de that dei bill that the senator talked about we don't even under fully understand the impacts of that yet and how many events that could impact in our city uh so it's extremely disappointing um but i will thank the senator because luckily uh the senate blocked a lot of the worst bills have passed by the house so thank god we have the senate but a few bad ones obviously still made it through but but one highlight i'll leave you all with um that was one of the good things that happened um you know as as you all know i was serving for our late representative joe casello's what would have been his last year of his final term and we ended up passing a bill that we named the joe casello act and it was a really emotional bipartisan moment at the legislature and it's something that i know is important to this city is it deals with pfas and you guys have all been leaders on in terms of dealing with pfas which is the forever chemicals that they call them that because once they're in your body once they're in the groundwater they're extremely hard to get out linked up to cancer rates and all kinds of bad stuff um the the bill had to do with something i was actually able to work with um the late rep casello on years ago uh which was eliminating the a triple f foam from uh training that the firefighters use in their training and joe and i had worked on this back in 2022 he ran it then it didn't move unfortunately this year i was able to to bring it back up and it was kind of got carried across the finish line with by another group and it ended up being something that we all co-sponsored from the floor the entire house did and we named it the joe casello act passed unanimously through both houses it was a great way a really meaningful way to to do something to respect not only uh the late representative but but to all of our firefighters um so that that was one of the the positive things i'll leave you guys here on a positive note but it's always great to be here and i'll see y'all
in a few weeks i'm sure thank you stay there we got any questions for uh representative long no i want to thank you and i thank uh senator berman for your initiative to try to get some money for the vfwc here in delray beach i don't know whether it's going to ultimately pass but at least it's a start it's got it on the radar screen and i think it's a very important initiative that we that that that this that this gets done and i i appreciate it i know you it didn't get it through a bill but you somehow got it on the appropriations list and it suddenly suddenly got on the house bill so with
the senator's help we got it in the budget and we'll see if it stays in the budget and then if we can make it past the veto pen we're good to go but even if we don't we got a new governor next year and the fact that it made it into the budget this year is a good so we'll have another chance we made a great start so i i want to thank you very much because i know that was your initiative
and senator berman i already thanked you so thank you both very much no other comments thank you representative senator for the briefing thank you mr mayor yes i'd like to ask the commission
to indulge a request so the next item on the agenda is the current point in time homelessness census count estimates presentation however we have a presentation to priscilla patrick for an
exemplary employee performance award i recognize the number of employees from the city notably the department of parks and recreation are here to celebrate her recognition so i would like to ask if the commission would allow that presentation to take place first which would be brief but it does accommodate the schedule of the staff who are in attendance to raise your hands yeah i was going
to say the same thing because i think there's babies over there waiting for them yes ma'am you don't want to hear us keep talking up here okay i got you so with the consensus of the commission we're going
to we're going to reverse 4d and 4c so we're going to hear now 4d the presentate the presenting priscilla patrick with the exemplary employee performance award all right good afternoon the shaking human resources employee engagement administrator administrator here to recognize priscilla patrick as exemplary employee first we're going to call up amy hansen and prentice mobley to tell you what she
did to deserve this recognition assistant director of parks and recreation i was just reminded to keep it very brief by priscilla so we're gonna get half of what i originally planned i don't know if you were given the memo but we wrote a two-page memo instead of a one-page memo because of all the wonderful things priscilla has done for our department priscilla i'm sorry you're behind me but okay so priscilla is always on the phone and she is constantly solving problems for people walking through the door for boaters for those of you that aren't aware what priscilla does she now is our official marina person she was our so she handles all the concerns questions and new exciting things that are marina so a lot of the city uses well all of us use neogov for all of our wonderful things our employees do you have the option as a supervisor or anyone in the city to say good things about someone by putting a journal entry in some people get two to three a year in the 10 years that i've been working with priscilla she's had 51 wow 51 and those are right they are walk-ins they are emails they are phone calls but it's something that she gets recognized a lot for so that's one of the many things we wanted to bring to your attention this shows that she has exemplary customer service she doesn't say no she goes to the next level anytime someone has a question she's on the phone she's going to find out where where they are where they need to go she again she never says no that's just one small thing i know priscilla i'm taking a while i'm sorry she's dependable she's reliable consistently demonstrates a positive attitude and cooperative spirit she is the team player we utilize rec track pay track web track those are all the uh those are all the registration programs online and in person that we utilize priscilla is a super user so she is constantly helping teammates get through the registration process correct in issues that we've had in the past she's constantly on the phone for that i know i'm sorry kind of short she priscilla is our credit card guru and if you think about how large the city's parks and recreation department is especially if you've been to any of our events you'll know just how many purchases we do priscilla up until this point that she's now working specifically for the marina was in charge of all of our credit cards if you were to talk to sam who was responsible for signing every credit card receipt that was one of his least favorite days she would come in with a large bundle and quantity and everyone each one would have to be signed so priscilla was responsible for taking those in making sure they were correct correcting mistakes going back and finding out what the issues were so that in itself was a task uh this was not her original duty we've had uh people leave the department and she has continued to pick up all of their job responsibilities so that is just naming a few that she has done and i also don't want to take all of them away from prentice because prentice is also going to speak so i'm going to step down but we love priscilla she's fabulous and she is an integral part of our department she definitely deserves this award good evening
apprentice moby recreation superintendent um you know when you have uh when you put things together you have certain adhesives and you know you might have some bubble gum people like me uh you have hot glue uh you have duct tape you might have super glue um gorilla glue uh my favorite that i put on my hand you can peel it off elmo's glue right but in our department we have priscilla glue right she has the ability to bring our department together in many different ways by some of the things that amy mentioned that she does uh many different things very flexible wears many different hats and is a prime uh example of an exemplary employee if i had to give it to anybody and we appreciate her so much i appreciate her so much she was working under me uh for about four five six years as i've been uh superintendent uh and it's a very valuable part of our organization and how we operate daily so i appreciate you uh with the beet juice and uh introducing me to the different restaurants and so forth and uh she also has a thing when she goes to the same restaurant every day five five times a week uh but that's here or there like i said i'm gonna keep it short and sweet i try to throw a little entertainment in there as always but we do appreciate priscilla thank you uh for what you do for our parks and recreation department
and you appreciate it thank you priscilla on behalf of the entire city of delray beach and personally signed by the city manager we would like to present to you the exemplary employee
award thank you thank you very much thank you very much and thank you so much for your service uh we are now going to do the the the current point in our time the the homeless census that mr ezra krieg you you you are you are making the presentation with ariana yes the two of you there you go i knew that seeing you both sitting next to each other but you have a clicker of the
homeless and mayor vice mayor's organization many years ago uh thank you for this this opportunity for to present to you what is happening with the delray beach initiative to end homelessness uh why are we here we're here because about eight years ago uh through enlightened leadership of then chief uh jeff goldman and members of his staff most predominantly now chief daryl hunter um an effort a group of people were brought together to try to see what could be done positively and proactively about a issue that we had in the city which was a growing homeless population uh chief goldman understood that he that previous attempts throughout the united states to arrest your way out of homelessness which was generally what citizens requested they'd say you have homeless people arrest them doesn't work and didn't work and he he and chief hunter were looking for way better ways to deal with it and from that uh initial meeting is now an organization that we're very proud to have in our our city which is one of which is the only municipality in palm beach county that has an organization of its type and the the crux of the uh the organization is that if we wait for the federal government to solve our problems we're going to keep waiting if we wait for the state to solve our problems we're going to keep waiting and if we wait for the county to solve our problems we're going to keep waiting that it was important for delray people to take care of the issue in delray beach and thus uh over a hundred individuals and organizations have come together to try to address the problem in our community yeah you're this one oh i'm sorry and so these are some of the organizations that are involved not all of them are here but it gives you a sense of the types of organizations that are involved that work together and and the theory again was that each organization does something really good and if we could get those organizations to do the things they do really good and then work with other organizations that do other things really good we could stretch our resources and try to again address the problem in a positive and proactive way
hi everyone so some of the services that we do provide for the residents of our city we do meals showers we have a laundry truck and a shower truck twice a week on tuesdays and thursdays i mean tuesdays and fridays in the morning um they do haircuts we provide clean clothing backpacks toiletries transportation um if they need to get the doctor's appointments and job interviews only we can get a bus pass access to all the medical services substance use and behavioral health i believe in wraparound services we don't have a lot of wraparound services in palm beach county so when we really get together and we have one fixed site and we can bring all the resources in one place to provide people access to resources that's what we do there we actually provide mail for people that have been in delray for over six months that do not have an address we can help get them their birth certificates their food stamps and they can get their mail at this one local address we provide housing assistance homeless prevention and much much more with the homeless prevention we partner with the interfaith committee for social services which is our local non-profit they have received many grants over the last year and provided over fifty thousand dollars to our homeless residents i mean to our homeless prevention residents and when we talk about homeless prevention from our outreach team we have an advocate who will sit in the in the communities at least twice a month that will talk to the residents about like how their light bills are getting paid make sure that they're budgeted the property managers managers will sometimes call us and say hey listen this resident seems to be alone their bills are late this has never happened can you go in there and talk to them and we do whatever we can to prevent them being the next homeless out on the street in the city um diversion diversion is basically designed to not have people enter into the system so if somebody shows up in the city and they've never been homeless before and they just got kicked out or they left a sober home we don't want to put them into the shelters we don't want to get them all caught up into the services because sometimes when they get in it's very difficult to get out so our first line of action is really try to divert them find families find friends find case managers from other agencies where they have been connected to so it's a model that we do here it's a model that's done all over Palm Beach County it's a model that's done all over the state and the country um and it really works we do travelers aid if somebody has a family member in another state like recently we had someone who came down here three years ago for treatment they left treatment and they were kind of wandering around and he's like i just miss my family i want to go back so i called the brother and are you willing to take him i think he was in missouri he said absolutely our officer drove him to the train station we got the greyhound thank god for the interfaith committee's funds we were able to get him on that train and he made it in three days our bus back to missouri and he reunited and we don't send people to other cities that don't have a place to go because it's irresponsible to send homeless people to other cities to be homeless because we don't want them to do it to us so that's the purpose of
diversion and why do we do this okay let me just before i i address that the homeless prevention again our goal is to reduce the homeless population in delray beach um and one of the lessons we've learned is one of the best ways to reduce homelessness in delray beach is to prevent people from becoming homeless in the first place and so through incredible effort of the interfaith committee for social services we've raised nearly a hundred thousand dollars uh of which we've spent about fifty thousand dollars to prevent fifty four families in our in our southern palm beach county from becoming homeless those are fifty four families that do not become homeless on the streets and we've got a a great committee that works on this on a virtually daily basis making sure that we're keeping our our residents in their homes but why do we do this we do this because delray beach is a great place to live it's a great place to work and it's a great place to play and it should be a great place for all of its citizens the people who have the most and the people who have the least but we a lot of the people who are involved are uh do-gooders i happen not to be one of the do-gooders i'm a pragmatist i think that if we one of the issues that we were told by the city when we got started was that you know we have homeless people all over and it's causing all sorts of problems and one of the solutions that we came up with is to help make these people invisible so we provide showers and we provide clean clothes and we provide laundry and we provide food and we provide a lot of what we do so that you don't complain about them anymore because if you can't tell that they're homeless then it ain't homeless people that you're complaining about and so that was that is part of the motivation of what we do but in the room we have a number of people and i hope you'll take a moment and stand shona i mean i know your group there are a number of people and thank you folks there are a number of people in this room who are involved in this effort and it it's not uh it's a group this is why delray beach is so special because we are able to bring people together to accomplish a goal next slide am i really getting cut off at 1 30 no okay i have a
no 123 at this point okay i have a little bit more time i got to go on here so i want to i always like to present a story of how we collaborated on someone's real story and i have been given permission by the person to share their personal information because it gets a little in depth and i just want to share this very quickly delray beach police department first encountered our friend freddie when a patrol officer was performing his daily patrol through a local area in the city he stopped to check on freddie who was sitting in a parking lot alone after gaining freddie's trust he opened up to him about his recent experiences which landed him without income transportation or housing he lived in the city of delray since 2008 and he was evicted in september of 2025. knowing the work of the community outreach team that officer made a referral to us and officer jaworski and advocate samantha white went out there responded spoke with him asked him about what's going on and they quickly transported him over to the to to the caring kitchen lunch where we all met we introduced him to the homeless outreach team of palm beach county in turn knowing his medical diagnoses they referred him to the ryan white program i did the same thing as well this is a county program it's for people who were diagnosed with hiv we both made the same referral because we knew what they would pick up the phone for one of us so while he's waiting for housing we were able to get him a bicycle in the meantime his d his driver's license had been suspended he needed to pay the fines we were trying to figure out how to get the fines paid um we got him food stamps and just a few months after the initial contact the ryan white program came through they showed up at the police department they did his interview and by january they placed him in a motel for two weeks and then they put him in permanent supportive housing and now he's living in his own apartment he has a full-time job in one of our local businesses he's supporting himself and he's doing wonderfully and it's all because you guys allow us to do what we do and really help our residents so i want to introduce you to freddie i know talk about these stories but we never really get to see the real person behind it so freddie is a real person and we're so the next slide our numbers so these are our point in time numbers from 2023 all the way to 2026 as you see they have gone up they've gone down um this year we had 94 since the county counted there canceled theirs we did our own we had two off we had three officers three advocates we went out for 16 hours we counted every single person we could possibly find um we did 79 actual interviews 15 people were observations of those 15 people 14 of them we had never seen again um 16 of 16 people of the 94 we had never met before um four they've um 79 um 15 observations um you want to explain the
additional why where our numbers are up yeah yeah you know you you may look at that chart and say you went from 106 to 70 to 94 you know why did that happen uh there are a couple of factors involved number one uh in 2025 was when house bill 1065 came through uh which was uh an enforcement issue on homelessness essentially making homelessness illegal in the state of florida uh there was a lot of fear uh among the population so that they wouldn't allow us to count them because they didn't know especially with uniform officers whether that was going to lead to an arrest uh we additionally there were fear uh immigration fears that that happened the other reason why the numbers have gone up is because our economy is getting more and more expensive and people are falling over the edge and so we know that that is also adding to the numbers that we have uh we think that our count of 94 is pretty accurate uh we know that of the 94 as ariana has just told you some of those people we counted that day we've never seen again and one of the secret sauces of what we do is we know all of our homeless population in this city we know them by name we know their backgrounds we know where they're from etc etc so the fact that we saw people random people on that particular day and we haven't seen them again means that they're transient and probably never to come back again and we always have to remind everyone we
have many agencies in our city that people will come in and out of the city for we have the drug abuse foundation where it's accessible from every city in the entire county we have south county mental health delray medical center and fair oaks we have the health care district the courthouse the library so we have all these different agencies where people are coming in and palm tran so i know for a fact that i interviewed two people who were sitting on the bench at palm tran they were homeless but not necessarily homeless in our city but you have to do an honest count and it's where their feet are planted at that moment so we make sure that we give the most accurate number so yeah and as far as the numbers of placements in shelter all the other cities are catching on like a lot of other teams are up and running right now and really pushing people into the shelter and i think with all the funding too people are keeping people in the shelter a little longer so it's been a little harder to get people into shelter um and as far as housing we only got two in housing so far we know what housing is like right now there's no inventory so we're having a hard time just like everybody else looking for affordable housing and any questions any questions from any of
the commissioners well i don't have yes thank you i don't have any questions but i just wanted to say that you know i've had the opportunity to attend your meetings over the last three years i've also um you know been involved with some donations and but i wanted to just point out that um i i called ariana the work they do is just it's amazing um i had a homeless young man call me who had been living in his car for a year and a half his mother died he was living with his grandmother his grandmother died a year and a half and he has medical issues within 48 hours he called me in just tears he was born and raised in delray however he found housing or you found him housing in bell glade but he was happy to have a home and he's doing well and i thank you i thank you i thank you it's just just amazing the work that you do and the dedication that you know all of the agencies that come and sit around that table um i was being highly recruited by boca to come to their housing their homelessness i was like look you need to come to delray because it's the we we have it going on here like we already have a very powerful homeless uh organization and so i think they are attending uh i think i picked in one day and i saw the person who was recruiting me sitting at the table so they took my advice but thank you so much for for what you do thank you all chief ezra thank you thank you anyone else who wish you recognized yes i do thanks yes you may be so um you guys are heroes thank you so much i'm so proud of all the work that you do while you just depressed me with some of those numbers you also gave me hope and that's what you give the population is hope so thank you for all you do i i'd also like to say thank you i know
ariana you and i worked on a family of six uh a year or so ago it was a really tough situation that that i uncovered and you helped me find a situation that worked for that that young very young family and i can never thank you enough for that and it just showed me you you all three of you are doing god's work
and thank you you know i can't toot the horn enough for delray beach and you you talked about us being the only really one in palm beach county that's doing this and we are i i this chamber and others have talked about what we do with this 16 square miles four by four miles you know is incredible with all the not-for-profits we're doing ezra i would knowing you for as long as i have i would actually put you in the good guy category i i mean i i i will and i i may not and of course you were right about because you're a quanian i would certainly understand that that you would meet that that's that's an inside joke for for the rest of you but you know the interfaith committee the work you do with the interface committee rabbi moss has left but i know the work he does in it and the rest of you i just think it's tremendous and i just applaud you for for all the work that you do because it's it's it's and it's actually never enough thank you one more slide could i do you wish we recognize just i just i just also want to make sure that we also thank the caring kitchen because they're the ones who are feeding our home oh yes oh yes every day and i feel like in an indoor space with air conditioning it's less likely they're going to go out and steal things for to get pork food so i'm just always so i neglected i had that on my thing i neglected to say it so thank you that do feed because it it diverts things from some other things happening commissioner casal you should recognize no i was just also thank you you know i'm so fond of you and your organization
and everyone i've sat at your table and i've seen the collaboration and it's so successful and i've called you many times with a homeless family and within moments everybody's coming together to try and figure out how to um affect change and i just i guess i'll we need to remind ourselves that the only thing stopping us is more housing because people sometimes mistakenly believe that if if you're homeless it's because you're not capable of living in a house but many of these people are very capable they've just struggle and things build and then they're so far behind they can't figure out how to catch up and uh i wish it would be nice if we could do more you know thank you well that's a great great
introduction to the last slide because there are ways that people here people are watching and you as commissioners can do we hope that you'll you know consider making a donation to one of the service providers caring kitchen uh all the various groups that are out there that are working we hope that if there is an issue of someone who is unhoused in our community that you'll contact the homeless outreach team of the delray beach police department because that's our entree point to be able to do things we hope that if you see a legal activity or problems in the community that you'll report them because we want we want our community to be safe for everyone and we hope that you'll take a moment and learn more about homeless related issues and to and to the commissioners directly continue to support the incredible work of chief hunter and his department because this this could not be done without an incredible delray beach police department and i invite all of you to help honor that police department tomorrow morning 7 30 in the morning at the drug abuse foundation where we have our annual police appreciation breakfast thank you very much for the time sponsored by the kiwanis of delray beach
thank you very much thank you all all right next is the comments inquiries on agenda and non-agenda minus for the public uh city manager first with the response um to increase and highlights yes so i
have three and the first couple are fairly succinct and i made a commitment a few weeks ago to facilitate an update regarding the byload market and some of the issues and challenges that have been experienced in the surrounding vicinity as well likewise i've asked director of neighborhood and community services jerry prior as well as members of her team to be here we have henry thompson phil cartwright and others who are in position to offer a brief yet substantive update in terms of progress to date as well as some clarity in terms of what capabilities are and are not ms prior if you would please yes thank
you um thank you commissioner mayor ms malika it's so good to see you up there um i also want to introduce the code enforcement leadership team without this team um code enforcement would be in a worse place and it's not because this team were in a better place so henry thompson clean and safe supervisor interim code enforcement supervisor sorry i i downgraded you and then i'm going to upgrade you again um i'm sorry code enforcement interim administrator phil cartwright and then interim code enforcement supervisor joe oliva and absent tonight is the new nighttime code enforcement supervisor latoya thompson all right so um as the city manager said uh we received uh from a resident um questions and inquiries about two specific properties in in the neighborhood that they wanted code enforcement to look at a couple things before i start on the presentation we are regulated code enforcement's regulated by chapter 162 of the florida statute within that florida statute it says that we must allow property owners to voluntarily comply whatever code ordinance that is in violation so that is the first caveat we always try to do voluntary compliance with the property owners second property owners have a right to due process okay and meaning that they have a right to be heard in a special special magistrate process these two code cases that we will talk to you about tonight they're active code violations so my request is is that you hear the presentation but please don't offer any kind of suggestions or any kind of things moving forward because i want to protect the integrity of our code enforcement process as outlined in our chapter 162. so next slide who's the slide person you you know how to do it sir so the bylo market so this was um brought up as a concern and some a little bit of background on bylo market it was established as a merchant retail in 2019 it's a mixed use meaning that there is residential units on top on the second floor the zoning district of central business it had they have a valid business tax expires on september 30th 2026 there is currently a new tenant that has opened a business tax license as of march 30th and as of today they are starting to move merchandise and things into the store and they are allowed to do so so next slide so currently there's uh three sections of the code that is in violation of in the property the first one we issued the notice of violation on march 18th um and through our clean and safe division because this is part of the clean and safe footprint section uh removal of signs required maintenance of the building and then restrictions on outside usage ie storage on the outside of the of the property voluntary compliance is set as april 26th the case is scheduled for special magistrate provided that voluntary compliance was not achieved and that's that due process that we were talking about here's some photos of what um code officer uh connor lee took for the code case and then the next property was 240 northwest 8th ave it's a residential property the zoning district is single family it was quick claim deed in february 25th 2025 to a corporation out of new jersey and then active code violations is landscape maintenance maintenance of the building um voluntary compliance was set for april 11th and if it is not achieved in their schedule to attend and be heard on april 16th at the special magistrate hearing and then some photos of this um i can advise you as of today both properties were re-inspected both property owners are working towards voluntary compliance and that's all i have and these are all of our contacts um henry thompson phil cartwright and myself
great mr city manager so that's where we are ladies and gentlemen so as miss prior emphasized in our presentation and comments cases are pending i think all that's been done legally is being executed quite well and gentlemen thank you all for the good work in terms of getting us to this place and i hope this feedback and update is valued and appreciated because there is in fact a path forward and all involved will remain vigilant to continue to do what's appropriate in terms of this area as well as other vicinities of the community that requires attention thank you for the presentation to the very important to the community in that neighborhood so mr mayor thank you yes go ahead okay thank you the next item is actually pretty brief so going back to approximately mid-february the mid to latter part of february 2026 a number of you all had received email communications from residents and stakeholders concerned regarding quality of life impacts relative to the atlantic crossing project notably loud noise activity and other issues and challenges i've spoken to a couple of you all individually about that so we were able to take time to work with leadership of edwards company they are the columbus ohio-based developer involved in this particular project and frankly they've been fairly responsive in terms of following up with the office of the city manager as well as leadership of both public works and development services to address any specific concerns that have been arrived had been experienced notably is the noise related to the installation of sheet piling haven't been experienced back in february into march so we're pleased to report that that phase of construction activity has concluded likewise greatly subsiding issues and challenges that have been experienced up until that point my office actually hosted a meeting to include leadership of development services and public works to address a number of other safety concerns outside of the atlantic crossing projects to likewise anticipate additional relief and responsiveness to the area so i just wish to offer that update to the city commission however resident stakeholders expressing concerns to many of you all if not all in addition to other members of the community have been appreciative of our efforts today and they were thankful as a result and finally a brief update from director of public works missy barletto concerning pompey park renovation project the fact that progressive momentum currently remains the case and we are here to briefly update the commission so that you all can feel comfortable advising any concerned members of the community or elsewhere that we are in fact moving forward with the project implementation and a lot of the good work that has been done on a preliminary basis to get there so miss barletto if you would be so kind to
briefly update the commission excuse me could i just ask a couple questions on atlantic crossing before we jump to the next subject please thank you mayor um the sheet piling though that's a four phase project they're in working on i think the third phase in the front are they going to do more sheep piling in the fourth phase so that's completely done because i will say having been over there and i think election day judy you were standing over there with a friend of mine and she said it was just unbelievable the amount of noise going on consistently all day long and while i appreciate that um that doesn't qualify under our ordinance as noise construction noise is permitted during certain hours regardless of the decibel level if i live there i would be very unhappy too so i don't know thinking about whatever developments we approve in the future i think we need to consider these factors even how it's phased right maybe residential goes and it always goes in first because it's the money maker but maybe at the end of the day there needs to be some more considerations with that and then um the other question is should there be some i know these are permitted things but the decibel readings we were getting were in the 110 120 numbers but i know by people's phones which we can't rely on because they don't do the a and the c or the a and the b i'm not saying i'm saying that it was a lot of noise and it was for a very long period of time i'm glad it's over and i'm sure the residents are thrilled
yes ma'am thank you miss barletta if you would please um okay so about pompey park i i have been made aware that there are some rumors out there in the community that this project is not moving forward i would like to allay those those rumors for commission right now the project is moving forward one of the things that is different when we do a construction manager at risk contract is that the first few months of a of the contract we sit down with the design engineers and architects and the construction company and we work out all of the potential conflicts ahead of time so that when we start to do construction those things have been majorly resolved in advance and then we also arrive at at a guaranteed maximum price we will be bringing that next phase the contracts are done in two phases one phase to develop the guaranteed maximum price and the second phase to start construction we'll be bringing that guaranteed maximum price piece to commission in the middle of next month we'll do that in a joint city commission cra board meeting and um just to add to to the guarantee that this project is going forward we have already started spending money on the construction so there's there are things that are happening on the site we have contracted with florida power and light and have paid in advance for the permanent power to the new building we have on your agenda tonight there's a temporary an easement to florida power and light to in order to provide the temporary power to keep the existing building air conditioned and comfortable while the construction of the new building is going on so there's there's no reason to believe that the project is not going to happen thank you great um mr moore anything else i yield at
this time actually otherwise thank you miss perloto and again speaking to a couple of you all individually we thought it was very important that we highlight and underscore the progress actually been made because it's pretty significant and we look forward to sometime next month making the next leap forward and you are therefore now empowered to feel free to offer clarification any of you all deem appropriate in your individual

and nourishment thank you thank you very much good evening pamela williams 33444 i want to thank the city publicly for displaying the eyesore that the neighbors of the paradise heights hoa located in the set have had to look at what appears to be years now i am referencing the bilo and the private residents on northwest 8th let me share with my mayor and the commission how unhappy i am with this band-aid of solution or lack thereof a solution that was done tonight with a presentation the proverbial passing of the book is what i saw happening tonight to state that the owner new or old has the right to do process that's a backhanded slap in the face of my community's patients just not tonight's presentation was a joke it was a joke we know what it looks like we know that they've had ample amount of time to get it repaired and that dog and pony show was just you starting the calendar all over again respectfully i will be contacting the news we need bigger eyes on this coming here to be somewhat civil is not getting me anywhere i don't want to say me as if i'm the only person having a problem with i'm just the biggest mouth this is ridiculous so now we're going to start all over again we're giving new owners time to put a coat of paint on that building bring the landscaping up to par if you're not going to pave that driveway can you at least mark the designated parking spaces so when there are 10 cars there and there will be we now know who's parking legally and illegally this was a joke of a presentation i am so upset this is crazy what please do better and if not i will have to get someone from the outside no one wants to bring a blemish to delray beach but if it's happening to me someone's got to help me and if not where i pay my taxes perhaps the news can help thank you thank you very much

hiding in the back away from anyway marjorie waldo arts garage i hope you guys are doing well today i have two special things to tell you about madam may i ask you please to pass one one for you too we are celebrating at arts garage 15 years of being in office in office no um y'all have been in office a long time i've never been in office and i have no desire to be in office don't know how you do it sorry we have been open for business for 15 years in april um and it's very exciting on the 28th you have a cra meeting but it's at four and you'll go really fast so maybe after you'll swing by arts garage and um enjoy a glass of prosecco and listen to gianni bianchini a local amazing jazz performer uh play some piano for us and uh celebrate with the ribbon cutting that the chamber of commerce is doing for us if you don't know mayor carney was the founding board chair in 2011 served as board chair for two years before you bailed on us i did i apologize it's okay on may 29th we're also having a summer fundraiser that's part of our 15 year celebration called 70s jukebox and it's an interactive fundraiser where you get to pick the songs from the 70s and it will benefit scholarships for places summer camp which is almost always 60 to 95 percent um scholarship which means we don't say no to any mom or dad who or grandma or grandpa who wants their kid to attend uh for money there are four weeks in the camp and we're hoping to raise enough money that we can say yes to everybody so i hope you'll can that one costs money that one's 30 bucks plus fees but i'd love it if you'd come to either or both so thank you so much for all you do
as the founding chairman of the uh of the archipers i do intend to be there good even if i have to leave the cra meeting early good you can help me cut the ribbon well the new chair over here she's gonna have

so uh laura simon downtown development authority three three four eight three um i just wanted to just uh first congratulate um i didn't realize it was 15 years with arts garage it's amazing um and great work under marjorie waldo's leadership so uh kudos to you and all that you're bringing to our downtown um i did also want to um just recognize tonight the good work that are and that we saw the presentation from our um homeless task force which i think we probably need to like fix the name because they are doing so much uh progress that it's not task work it is like it is like you said hero i heard the word hero and it we really need to like applaud the work amazing work that these people are doing and i applaud daryl hunter we served together when he was on the clean and safe team really looking at our downtown as like we needed we needed help and we looked at other town towns and we really came together and he spearheaded that and i just really thank you for that and thank the team and thank the commission the leaders of before you that really invested in this um this work because it is it is tremendous downtowns across the world deal with us and we are blessed to have what we have here are we as a downtown development authority um fund the safety ambassador program that works alongside the city and uh really is a support to that and and touching these individuals in the morning and helping guide them to the services that they need and it is tough work and they're paying you know 15 an hour 16 an hour it's rough and they're discovering things that they don't want to discover but they we have had team members that have been there for eight you know eight years ten years ten years this program's been going us in 2016. so it's tremendous and you all should be really proud of it and really support the heck out of it and i just um i also want to support the uh run run with the chief um on atlantic avenue he said i could walk he said i could walk and i have to say that i've been here for i'm going in my 16th year and when i started here i'm bored and raised here but i wanted to do um i'm still have this and prentice knows if he's watching the longest line dance but i also wanted to do the run so i'm really excited to i'm a runner and i'm really excited to have that going through our downtown um wherever it is i would like i'd like a 5k but it's okay we'll do a mile first um but hopefully we'll get the longest line dance too so thank you thank you very much simon any other members of the public wishing to
address the commission seeing none public comment is closed we have already approved the consent agenda we now go on to the regular agenda items i'm sorry did you wish to speak ma'am that's coming later in the agenda that's what which agenda item are you talking about yes that's coming later and that's coming later in the agenda yes you'll have the opportunity to speak at that point yes okay we're now going to former uh the the consent agenda item 6b which is now uh agenda item 7a which is the raftelis the addition of uh additional spending request as it relates to the raftelis contract it was your issue right i was just we did the visioning we know where we have to go
what's the the plan for the goal setting because i think that i'm not saying we don't need rough telus but i really think what we need is first of all to agree that we're submitting money into these uh five visioning items but then i think what we really need is a day of goal setting with our staff to tell us how do we get what what can we do what should we do um in the visioning the staff wasn't as prominently involved as you know and we don't even know where to go next so i would like to focus not on the goal setting but on implementing our vision and talking about that and i don't know that raftelis um should or shouldn't be involved but i just want to make sure that we're not going to go do the same exercise and talk about goal setting like it's a a fresh thing because judy
we're involved in the visioning yes i agree with you in that um in the visioning process it was all ideas and where are we going to go but we had some solutions that we were bringing up and they're like yeah yeah no it's not it's not solution time right so i believe that the workshop should be solution
time and division you're talking about the the um goal setting goal setting workshop yes yes yes could you clarify thank you well i i i have been agreed that goal setting is kind of different from the visioning and certainly when we have a new commissioner um because we as commissioners sat back and we really listened which is what we're supposed to do and hear from the community which is what we're supposed to do and we're supposed to extrapolate all that stuff and hopefully develop from ourselves goal settings but we would like the city to go but we also may have some ideas that were not generated by the uh by the group which also may be worthy of mention and discussion so i i i think it's a totally different process um i understand your issue as it relates to you know duplicating stuff but i don't i don't really think that goal setting is duplicating um so much but that's that's just my view are there any other commissioner burns have any content i mean so i i mean may i would like to just approve this and go forward because i think it's going to be a valuable exercise especially as i say we have a
new commissioner and mr mayor yes if i may add to that so what we're planning for with this authorization is to essentially accomplish all the points having been raised at this session so a great reason for raftel is coming back to be the facilitator number one they worked with us quite well leading up to this place the last traditional goal setting session took place back in may of 2024 did a nice job it was a productive experience one number two with vision 2035 the direction will be to work collaboratively with them including key members of the executive leadership team to play a prominent and active role so that we can begin the process of connecting the dots with respect to what was outlined in vision 2035 so that's a continuous process in that regard so with tonight's authorization i plan to host a meeting with representatives with with ref tellus in the next couple weeks or so to prepare along those lines number one number two they've already been advised to that effect so with this authorization it takes under consideration every point having been raised and that will be the experience friday may 2026 thank you so if i can get a motion to approve

read the resolution to the record thank you resolution number 60-26 a resolution of the city commission of the city of delray beach florida amending its budget for the fiscal year beginning october 1st 2025 by providing for supplemental appropriations and the amounts identified in exhibit a repealing all resolutions inconsistent herewith providing an effective date and for other purposes thank you very
much sir thank you mr mayor the commissioners city manager city attorney um here are the amendments and explanations economic development um as we heard during the um the workshop 130 000 revenue increased to prior year surplus and expense increase to other contractual services for consulting services fire 382 062 62 cents revenue increase to concurrency mitigation and expense increase to capital equipment and protective bunker gear to buy and replace mission essential equipment fire is looking at eighteen thousand five five two twenty three expense transfer from operating supplies to regular salaries wages and benefits to reclassify two positions to support operational financial needs of the organization communications creative arts school forty five thousand dollars expense transfer from other contractual services line to the part-time wages and fica taxes to fund one additional program administrator related to sustained program and enrollment growth and community demand order and sewer fund zero change water distribution six hundred thousand dollar expense transfer from the non-operating contingency account
to other contractual services to fund deep injection well water line break and replacement of six four thousand dollars aged valves delray beach municipal golf course fund um a decrease of 24 24 24 million five hundred thousand dollars um is a revenue decrease of the debt proceeds note and bond proceeds and expense decrease of capital outlay recreational and other improvements transferring both to the golf course renovation bond fund so that renovations can be tracked separately um and the next one is the increase in the renovation bond fund we set up a separate fund for the bonds that we borrowed for the golf course renovation um and we expect the expenses to go through there but when we budgeted it was in the municipal golf course fund so we're just transferring from one fund to the other um here's the total impact there's five hundred twelve thousand sixty three dollars change because that's additional revenue that's coming into the general fund so the revised budget with the proposal for all funds is now six hundred forty nine million four hundred fifty two thousand three hundred fifteen
questions no are there any questions for me commissioner salt you wish we recognize mr more really quickly that water
waterline break was that the result of somebody else doing work or was that just a failure age infrastructure
we'll talk a little bit more about that in the next couple weeks but it's the result of go ahead my understanding is the result of other activities and so there will be a claims consideration
when did that actually happen this would have been in 2025 so 2025 there was a waterline break and we haven't
discussed a claim yet and we're in 2026 well information gathering took us all the way up into
the last few weeks this is why i asked you for the presentation on how we're handling claims because and that will take place april 21st period of time i look forward to that presentation that's also april

good evening mayor and commissioners missy barletta director of public works accompanied by cassitra thompson who apparently gets paid by the letter she has the longest title of anybody at this city um assistant chief procurement officer and uh and my partner this evening so what we're here tonight to do is to kick off the construction manager at risk um contract for the northwest neighborhood project this is a yeah this is exciting it's exciting for all of us we're so happy to finally be getting this this underway um this complete neighborhood project is going to take care of everything in the neighborhood from the deepest pipes underground to the top of the street lights um including roadways where we're putting impervious alleys that will help with um with the city being able to move forward with providing opportunities for ancillary dwelling units sidewalks stormwater improvements we're improving driveways potable water mains reclaim water mains sanitary sewer systems we're putting in traffic calming measures um we did a great deal of public outreach in the neighborhood in advance of the design of this project and some of the normal things that we propose for traffic calming like chicanes or landscape bulb outs those kinds of things are not happy items for the residents of the northwest neighborhood they like the traditional things they like stop signs and speed humps and that is what we're putting into their neighborhood you're welcome um so we're also going to be putting in decorative street lighting where we've um there will be a lot more street lighting in the neighborhood than what is there now there will be lights in the alleys as well as on the the roadways to enhance safety and there will be landscaping and irrigation so one of the things that the the reason that the city manager asked to have this as a presentation tonight where it would normally have just been approved on the consent agenda is so that we could talk about how a construction manager at risk project is phased because because of the intense negotiations that happen at the front end of this contract in the first phase it looks to the community like a project like a project is stalled and there's nothing going on because there's a lot of internal discussion there we're going over the plans we're straightening out any conflicts in advance we're fixing any questions that the contractor might have about the plan set that they've received and we're resolving those up front then we're arriving at a guaranteed maximum price which is the most that we're going to be charged for that project by the contractor and and then um moving forward with construction after the commission approves that guaranteed maximum price which is the second phase of the of the contract so what we're here to tonight is to ask you to approve the contract the phase one of the contract with um kiewik corporation for the construction manager at risk for northwest neighborhood i would like to ask joe pescatori who's in the back row he's our project manager with kiewik corporation and he's here tonight to to say hello to everybody they're as excited to get started as we are so we're very happy almost as much as we are no i i they're equal i think they're equal so um this company has a lot of experience at this type of type of um big community improvements um and the phase one of the contract will be in the amount of seven hundred and sixty three thousand eight hundred and sixteen dollars to the penny thank you very
much um i mean i i'm i've been hoping this gets started for a while i think the this these these improvements will add so much value to the property values there it pays for itself so i mean i'm really looking forward to it getting started sooner rather than later are there any comments from anybody from the

to anyone commissioner i met with uh mr bernardo and um the emails emails emails yeah emails i i also met
with um mr bernardo and i read all the emails and we did receive a package today which is off to our rights with all the emails that the city received so i include those all in my ex parte communication

and gentlemen of the commission i appreciate the time christopher bernardo on behalf of the petitioner this is a lot waiver a lot with waiver request it's associated with a single lot plat application that is being administratively processed through the city so before you is a waiver request this is okay got it thank you so to give you a point of reference uh of the lot at question that's lake idah road to your south i-95 to your to your west the subject lot is a red line there 504 northwest 8th avenue it is located within the lake idah shores subdivision very relevant to our discussion tonight is that it is on the boundary of the lake delray lake subdivision which is to its immediate immediate left so i i believe a little history of why we're here why this lot sits vacant as you can see from the visual one of the largest lots on that block so let's take you back to 1995 before delray lakes plat was established before the development was built the subject lot is there in the middle as you can see lake out of shores was put together piecemeal over many years there were many different subdivisions within that this is at the edge of the last subdivision and it's it's anticipated that the roadway there was possibly for the expansion of lake ida shores into what is now delray lakes so as you can see from this 1995 picture you have what is a unused partial unimproved right of way which is on the south side of the what is now northwest 8th avenue let's fast forward to 2002 after delray lakes was developed uh the subject plot sat vacant and as you can see from the from the turnaround um it's estimated that in the development of delray lakes uh this was likely just not incorporated into the into the um the subdivision so you had the turnaround there that that faced south and you have this there's just lost land so if you really deduce why we're here today it's likely for at the in the interim of this 1995 and the 2002 lot somewhere along there this probably should not have happened needless to say this was a lost piece of land was not part of the delray lake subdivision and was not part of the the delray the lake out of shores subdivision so it was vacant land uh so there were two sections of this land there's in the green there's a partially bank owned property now that's estimated to be left over from possibly the delray lake subdivision i i i was involved for this family um back in the time period relevant here we did plenty of title research it was an overlap piece of land very relevant to our discussion tonight the rest of the land sat as the unimproved right of way with no intent no potential or intended future use of any roadway clearly so what happened the lost land became a nuisance and a safety concern uh constant mischief and use of that land unmonitored free access no fencing uh what became a direct safety concern of the delray lakes delray lakes owner to the south who is the petitioner tonight you may have known in 2006 uh there was a high profile event uh that overshadowed many of the smaller mischief events uh over many years uh that fence uh there's a white fence which is the boundary line between delray lakes and lake out of shores on the north side of the homeowner to the south uh where there was consistent mischief and uh some pair of drug paraphernalia things constantly found kids just find a spot to to uh to hide in 2006 there was a high profile armed robbery that occurred up in port st lucie uh there was a uh police chase that uh the uh armed robbery suspect exited delray uh exited atlantic avenue uh came into the delray lakes and lake out of shores community through the vacant lot the the car was uh abandoned in that lot the assailant jumped the fence and was found in the lake of delray lakes uh after a probably a four to six hour lockdown that the community had at that time the lot itself became more of a feature for the community of delray lakes so what did the landowner do at that time in 2005 a demand was made to the region's bank this southern portion was the source of a good amount of the mischief and in some title research it was found that the bank owned the the property the bank was written a demand was made by myself at the time on behalf of this landowner uh the solution by region's bank uh property uh real estate owned council was to give the land away they didn't want it the land was given in 2005 to avoid the liability of the mischief on the lot in 2006 uh the landowner then approached the city with the conundrum uh the unimproved right of way was abandoned at the request of the landowner in 2010 the owner uh made a demand to the uh the same petitioner tonight made a demand to the owner to the north uh the north owner wanted nothing to do with the maintenance the lot deeded that portion so from 2010 to the present that landowner to the south paid the taxes on the land maintained the land insured the land and secured the land for 15 years 16 years now so what's the current status uh the owner is an entity is placed in an entity again for liability purposes to protect that family to the south it's a 16 911 square foot lot it's vacant no lot of record it is not platted it's a low density residential future land use designation it's zoned r1 triple a i want to bring attention to uh the corner a lot if you look at the visual uh it's quite obvious that the landowner to the north at 508 northwest 8th avenue has no access actual real access to the road so we presented the enclave by the c plat and i'm going to back up for a second because prior to the presentation of that plat the landowner the petitioner here embarked on what has been a year long um discussion with the owners of the north lot at 508 northwest eighth avenue uh mr brennan's letter of approval is in your file he submitted it and came down to the city today made sure it was here today um but the bottom line is that we're remedying his access problem we're giving him an easement to the road through our lot he supports this plat so this is the enclave by the c plat it's pretty basic it's a single lot uh the feature of relevance here is in the in the far north uh east corner is the easement to allow the uh mr brennan and his family access to the road so what are we doing here today uh the plat admitted the plat application again is administrative so there's no relief requested with regard to the plat as it meets all ldr requirements except a lot width so what are we asking we're asking to waive the minimum lot with requirement of 100 feet to allow what is an 80 foot lot depth so in light of what i presented to you let's look at the issue at hand which is the lot of waiver request so the lot first of all there's some interesting features a lot it's 210 feet deep it's the deepest lot on the block by far uh by as much as uh 42 feet in fact it's the largest lot by about 25 percent at 16 911 square feet a lot of those lots are approximately 13 500 square feet it exceeds the the frontage interestingly enough although we're here on a lot with waiver the frontage is not a problem the frontage is actually 105 104 point and change so again exceeds the frontage the lot width does not meet the r1 triple a minimum requirement but let's look at the block neither does 70 percent of the house is on the block all down the street you can see there's two lots in the middle but other than that in fact the lot that we're talking about technically has zero frontage and zero lot width if you may under the calculation the lot immediately to the north of that which i note this person did file one of the only opposition letters but her lot is 34 feet uh when you figure out lot width as you can see it's very oddly shaped by the minimum lot width in the rear of the lot and again most if not uh 70 percent of those lots are 80 feet the lot in question again is the red box at the bottom of the of the and it's quite visually obvious the size of that lot so why is that the case well are these are r1 triple a it's a street and it's kind of an l-shaped uh zoning district the r1 double a district is to is to the east uh but this this street all in all is likely inappropriately zoned but that's not why we're here we're here because we're comparing the lots that are already there at 80 feet so what do you look at what do we look at to do with when we have these vacant lots this isn't the only vacant lot that's unplatted in the city and in fact this is throughout south florida you have these vacant lots well we look to our comprehensive plan and your comprehensive plan addresses what we do here comprehensive plan makes very clear that the any housing development the policy 115 is to to take existing and future housing needs through maintenance and infill development opportunities and redevelopment of underutilized parcels parcels objective housing of unique neighborhoods is to protect existing residential areas by fostering development and redevelopment that is consistent with the unique character of the neighborhood so again we are asking for the how do we get a waiver the waiver is that it shall not adversely affect the neighboring area shall not significantly diminish the provision of public utilities and it shall not create an unsafe situation does not grant a special privilege is the most important one here again we've already went through shall not adversely affect the neighboring area well in fact we're improving uh the neighboring area we're providing and solving a the access problem of the neighboring lot i will note that your file contains over 30 support letters and in doing so the the petitioner through our office and through our staff and through the petitions themselves took a lot of time to pull the neighborhood your file contains many support letters shall not to significantly diminish the use of public facilities there's no effect on public facilities there is street water that would be used for the housing element here shall not create an unsafe condition your package contains a significant portion of those letters from delray lakes community the delray lakes community this access problem has been here for now 16 plus years again i brought that uh subject of 2006 but it's more of the mischief and the constant in fact your your package also contains a letter from the neighbor immediately to the west who attests to the constant use of adolescents slipping through the fence car car mischief and criminal activity in the neighborhood coming through his backyard so we have the support of the homeowners in delray lakes does not grant a special privilege well it's pretty clear we're asking in fact to deny this homeowner would be granting a special privilege elsewhere we have 70 percent of the block is 80 uh 80 feet frontage i should note uh just very recently uh the lot at 614 northwest 8th avenue um is in for construction again that was a lot of record but i i believe it's very relevant here today that that is a homeowner that bought the the property the house was demolished and there is a new home going on that lot that lot has got an 80 foot frontage uh it's a 13 500 square foot lot it's 80 of the size of the lot that's at issue and it's got the same non-conforming frontage so what are we asking for we're asking for a waiver of the 100 foot minimum lot width requirement of the r1 triple a and allowed development of the residence as is permitted through the lake out of shores community and in conformity with the character of the of the surrounding neighborhood and i will make special note that this applicant took a lot of time to gather the support uh or denial and you'll see the overwhelming support in your file of both the delray lakes community and lake out of shores community thank you very much thank you mr bernardo uh to the city okay i think
you've gotten a pretty good overview by mr bernardo so i'm not gonna take a ton of time but i do want to touch on a couple of things if it's ever gonna come up there we go okay so um again the re this is a parcel of land but because it wasn't legally plotted that's that's the subject of what we're doing today in order to legally plot it uh it's because it's not technically meeting the minimum lot width it requires um both the conventional waiver standards but that you are also making a declaration that is necessary and appropriate in this case to allow this lot once the waiver is decided if it is approved then the plot will be done administratively and you will not see it again um last session we moved all plots to administrative so um so again uh the zoning requires um the r1 triple a zoning requires a hundred foot feet of width and frontage it has the frontage because of the weird abandonment the little corner um that is within this parcel um it meets the other standards it's currently vacant um this is the um original plat um and you can see that it was intended to be a right-of-way um it was um you know it should have you know had we followed the planning intent back in the day this should have been what connected to the neighbors to the west it's not the way that the development ended up happening so um over time these pieces were assembled um the biggest issue quite honestly is that the the parcel on lot 13 which through the result of this abandonment by not keeping their half they're sort of not connecting to the only street they have access from the proposal in front of you helps with that the driveway is still going across lot 12 that's between them this happened i honestly don't know how this happened but it was 20 years ago so we're all um making lemonade with what's there now um again the parcel that results if you approve the waiver is um consistent with the lots that are along uh the west side of northwest 8th avenue it's actually larger it's not able to have a dock even though it does touch the canal there's no way for a dock to meet the minimum setbacks of 10 feet from the surrounding properties so they'll have a nice um view of the water but
there's not really going to be any kind of boat access there um and then uh so the lot the other thing with this abandoned roadway and then this other sliver that have been assessed or amassed over time they share the same zoning as um the rest of the street however the rest of the street is subject to the lake ida overlay design standards which also limit far i'm not trying to spring this on you but when you start talking about neighborhood character i started paying attention to that um and so that is the only um i think issue that the lot is quite large um and if it's going to be developed to be consistent with the neighbors around it um perhaps it would be a good idea to condition the waiver upon following the lake ida design standards that all of these houses have to this one doesn't because it's part of the pud here but the rest of the street and surrounding neighborhoods are subject to extra design standards maybe that would help it does limit through far i'm just putting that on the record but it's a very large lot and you get the highest far when you um are adjoining the water so um but aside from that i think you've gotten a really good history um from the applicant and he's given you a good overview of the character um i did give you 32 letters of support and three of objections and there were i think four more that came in after the meeting started one one against and three in support that have been also forwarded to you but you may not have seen them yet i'm here if

address for the record you will each have three minutes hi i'm francine isaac zip code 33444 and i live on northwest 8th avenue address please excuse me address please 526 northwest 8th avenue thank you very much um we just got this letter um a week ago and a lot of us had family in for the holidays etc but we still managed to have a neighborhood meeting on it um we feel the request is flawed and it's we feel it should be denied based on both fact and precedent i'm not an attorney i'm not tech savvy so i can only talk to you on it um the arguments appear to be constructed to bypass the intent of our zoning code rather than comply with it if there are so many concerns regarding security for delray lakes i live in that neighborhood three houses away i've never seen drug use kids hanging out in the lot at all so if they have so much concern i would recommend that it be approved that that land go to delray lakes the applicant has access through his property to build and make it a part of delray lakes we're troubled by drainage issues i'd like to pass these around to the commission and building up is only going to create more flooding um we've been trying to address this with the city for about 15 years the driveway that he's talking about has been here and belonged to this house for 30 years okay so i think that is adverse possession under florida state statutes if the owner wanted to pursue that we just feel lake idaho association made this in 1990 and we want to keep it we don't want to see variances we don't want to see developers coming in dividing up property claiming falsehoods which we feel is being claimed in this petition we feel it's just arbitrary and i know i'm a little nervous so i'm not used to no need to be nervous with us i'm a little nervous so we feel the variance is not a minor deviation and also the frontage by the way they're claiming that the frontage has 104.97 feet we don't feel that we feel the current owner of the north house has about 25.22 feet of land that has been used as i said for 30 years so that would really leave them with less than 80 feet if you calculate it thank you

but the truth yes i'm trying to do everything okay my name is arthur parsons uh 33444 yeah i need your address or this is equation 714 sunshine drive thank you sir uh i've lived there since 1974. i can tell you the whole story the builder went bankrupt and we bought a lot of the homes and finished them okay so i know the whole area enfield was vacant at the time like he had talked about things happening on the lot i don't know about that but they stole one of my cars out of the backyard or my dad's car out of his garage and parked it in my backyard anyway that way of coming from late to the lake there that was going to be open there and northwest 8th was going to be open to go out to lake ida but the homeowners we all fought it because we didn't want lake ida road open coming through there some of you may remember that i'm 86 years old so i do remember things so um i'm not in favor of uh of it i mean it should be delray lake should be the ones that should do it because right there they got white fences up and they got gates coming through there's two gates coming through i don't know if the guy owns one of the places or what but i'm just saying i know the whole area and i have a vacant lot in fact i saw it up in the map up there you know i own an enfield it's all fenced in and grassed and everything like that but i'm just saying i i think it should go back to delray lakes and they should incorporate it that's my personal opinion i'm not in favor of it okay thank you sir that's all i can tell you okay thank you i've done it a long time

i just want to address a few of the comments that's fine mr bernardo and you know the the latest comment i we appreciate the concerns and i think you pointed out very appropriately the last gentleman that spoke that that was not in the interest of the community to be a road that's the whole problem that's why we're here and we do appreciate the fact that that might be part of delray lakes in fact that was originally the intent of the landowner that's a different uh planned unit development uh it's a different zone uh there was no support for that in the community uh this has been 15 years so that would be an option that it just isn't there for the community assuming too many legal obstacles uh and we don't have the power for that so uh we respect that but i i believe that those comments support here why this is sitting vacant um i i know there were some pictures of uh of a flooding i i don't i don't know how that's directly relevant here and and that would be just as much of a concern to my client he's on the flooding's in front of his own property so um uh i don't think that's relevant on the the point of the waiver that we're here um but i do want to address the community because i think it's important we had a few people speak uh they said they had a community meeting um well we had a community meeting and the the uh landowner had a community meeting uh the landowner um came with 30 plus supports from that community meeting that's from the effort to reach out to the community um sir no comment yeah and i want to add one more important point because it's a legal one uh the lot to the immediate north um mr brennan is a very nice man he's at 508 we've worked with him extensively on this um this is the only option that he has uh he is not the person that deeded that lot that was a prior owner um and um he is in full support this is a solution for his land it the the some of the letters that were submitted suggests that um he had some other options that's not the case he ran down to the city today made sure that letter he's the one that submitted this letter he wanted to make sure his support was clear and that's in your package and i think that's
that's the only point to make i'd like to ask you a question just because i used to do this kind of work how in the world did this guy able to get a deed to a property we had no direct access from i mean one of the basic requirements of conveying land in florida i mean this is like 101 is that you have access to the public road it does what was there some circumstance that well it would be going
beyond but i will say that we do we we spent a lot of time and there was an attorney that represented the prior landowner that i believe i don't want to put names on a record but i believe that attorney did this gentleman wrong the attorney inappropriately told the landowner that he was his counsel the attorney represented um a flipper that took that property the flipper took that property sold it to the brennans who are living there now and failed to disclose the condition i can say this because my office was the party that communicated i have a train of letters because i guess because i mean the comment made that the driveway's been there is kind of irrelevant yeah you're right on the property right you're right it was very clear that this this has been a problem that's been out in the open for very clear the fact that the driveway they've never made any claim for the uh for this right i'm just this is the solution that we're we've worked very very hard on for this line well thank
you thank you so if i could respond to a couple of the things too um that were brought up um i think it's important um to note that um i agree with um mr bernardo this is this zoning of this parcel land and i completely agree with your comments you know assistant director alvarez and i you know we're trying to understand what four of us rebecca tossery and lexus rosenberg we're all trying to figure out how this happened because the issue isn't that this lot is particularly irregular in size or configuration the parcel that is being asked to be plotted today i think is relatively it's a size relatively consistent with the surrounding neighborhood the issue is more how did this guy end up without access and so the easement it was we we were very gratified to see the easement was being provided um it's typically when you abandon something you are ensuring the lots that are using that access point have access so this is 20 years ago and here we are um the parcel is zoned the same as lake ida as you can see by the aerial the lots in the neighboring property are smaller with more lot coverage um so if this is going to be developed the you know the um r1 triple a zoning which has the larger lots makes more sense and that's what it's zoned feeding this property to another subdivision doesn't change anything based on the ownership the zoning or what you can do with it it's either going to be a lot for an infill house or it is going to be a vacant parcel that i guess somebody could turn into a park or an hoa could use it so it's either a leftover parcel a vacant parcel a park or a house and they're asking to make this a plat so that it can be a house that's really what you're considering a new house will have to meet all of the current drainage requirements which require that any water sheeting that you know that results on the property has to be held on the property that the drainage calculations would be they have been increased over the years in the state and locally our stormwater reviewers would require that the the water not be sheeting off onto the neighbors or into the street they have to hold it for a certain period of time and it would also be meeting you know the current florida building code in terms of elevation and construction so those are those issues i think and in terms of whether the dimension is accurate or not they have submitted a plot they have submitted a legally certified survey to to give you the the dimensions so that's all i wanted to put on the record i will say that if
i had seen your map earlier with the 80 feet you could have saved me 20 minutes because i was in the property appraisers office going through each one of my own measuring so it would have been helpful but we did that yes thank you anyway to the commission commissioner mollica yes i just um with regard to
access you said that's to the triangle house with no access that would be done by easement we're we're
providing on this plat we're providing an easement which would be a platted easement so yes it would be part of the newly part of the land would be an easement on that land for access and then um anthea what did
you say that um you uh an agreement to this could be subject to following the lake ida standards or overlay or what so again all of this sort of abandonment back in the day before us was done just kind of messy
so part of the messy is that this these lots and all the lots that surround them are subject to the lake ida overlay design districts because this was a street it's it's that the the edge of that design requirement stops here and it goes around like this so if this lot is not part of this development then it should follow all of the standards of this neighborhood that's all and and there to be fair to you there are limits on the size of the houses there's certain articulations that are required things like that they're not particularly onerous but um if we're if you're in for a penny you're in for a pound let's put it that way so you know i think that would be something that would ensure that a lot of this size was developed consistently with the other lots that are this size in this particular neighborhood if they're asking for the waiver for the lot with then we could continue that they follow the lake ida overlay standards perhaps and then then it would be consistent with that neighborhood can i just that's agreeable
i don't think that's a problem and actually that would that was assumed to be honest with you so yeah no no just just asking for the commissioner marker commissioner burns no i was going to ask
that question as well and anthia did you say that if and when a house is built it will have to address the
that water issue that's that would be okay well to be clear it's not going to fix the drainage for the whole neighborhood right okay this is this is a battle the city is fighting you know as the world
changes so but every individual lot including the one that you know was further north um when they build a new infill house there's drainage calculations the codes get more and more stringent and so new development um has to hold their runoff on their site for a certain period of time i'm doing a good job busy this is stormwater is actually in engineering so um but um so that in terms of what would sheet off of this if it was a house it's not going to worsen the situation in the street it's not going to okay thank you it's not going to fix it all but it's not going to make it worse all right thank you

could you repeat just start right over don't do it okay to the city okay so this uh as you might have gleaned this ordinance adjusts a number of sections and um it is uh the culmination of i think years of work back and uh always del re um we began uh by adopting um goals objectives and policies related to trying to find uh creative ways of diversifying the housing uh in the city um and so we laid the foundation for a couple of things um one is that we do have a policy that um if we uh that we would start looking into things like tiny houses except and accessory dwelling units co-housing arrangements cottage housing things like that and the important thing was that uh we have a policy that said that when when we decide accessory dwelling units are allowed they are not included in the density calculations or the limitations um but that we would be careful where we put them in because we have other policies that talk about um doing uh these types of changes um sort of neighborhood by neighborhood and not just broadly adopting this we need to look at you know do you have alleys which make it a lot easier to incorporate an accessory dwelling unit uh if you don't how are you going to accommodate parking for an extra unit things like that now i'm going to give you a cautionary warning uh this is two sessions in a row with a florida state legislature um considered or there were bills floating around to just broadly say any any lot anywhere and you city cannot require another parking space so again this is the second year that sort of broad it's always dangerous when it's like an always situation right so uh that didn't that didn't get traction um so we're going to charge ahead with our program um to find these and this when i tell you it's been a long time coming we have always already which laid the foundation and then in collaboration with the cra uh taking our sort of neighborhood by neighborhood approach we did uh we had a an adu and infill housing study commissioned it was a joint effort um the crh funded for half of it um and we had them look at a lot of ways of like how do we start incorporating this type of use it was an extremely thorough um i think analysis it looked at the northwest southwest neighborhoods it analyzed the lot sizes that we have on the ground today where we have alleys if you don't have alleys what is going to fit what's not going to fit so that we have really good guidance going forward in terms of um how to affect this in this part of the city so this has sort of been this has been the foundation of the regulations um we brought this to a workshop this was a while ago um where i know commissioner long was still here um where we talked about how to incorporate um these within the rules that we have um i think the state might have even changed this but we haven't gotten there yet um so the point is that these are these are small accessory units that would be a separate living area not a guest cottage that you're not supposed to be renting on your airbnb site for the record um it is supposed to be you know this is supposed to be a rentable um unit this is a separate distinct unit that you can rent for the purpose of providing affordable housing um out of the workshop there was one rule that um the commission at the time felt strongly about which is um that it could only be two stories if the ground level provided parking otherwise it's a one story um you know unit are we allowed parking underneath the yes you can park
underneath that okay so the general rules 80s are not included in the calculation of density that came from the
cart comp plan already um a detached meaning it's not within or attached to the main building could be in front or behind to the side of the principal structure as long as we've got it it's subject to the setbacks um if it is in front it has to have a porch facing the street so that it looks nice all adus regardless of where they're located have to have an independent entrance um and then this um this rule we got a lot of feedback this is something i specifically asked the neighborhood um the
property owner or a family member of the property owner have to live on site if you're going to lease
the adu and then we started talking about well what if we get older and our kids move away and now i don't need the big house can i live in the adu and rent the front house we decided yeah that would be okay too um however they can only the somewhat we're on the property um you have to be using it for workforce housing when you build workforce housing there's a deed restriction we're already working with the city attorney's office to work on what we would need to do for these um it the property has to be homesteaded to build one and it has to be homesteaded to lease it separately um if you have family members that need to live in the back you've been an aging parent you have your kids have gotten too big and outgrown your house that's different that's your family you're not going to be subject to any of that um the um the ordinance requires at least one parking space um and uh that vehicular access and parking are allowed from improved alleys that you could parallel park along the alley if you needed
to within because of the 10-foot setback so that works with the lots that we have um and then uh the
ldr has been sort of restructured a little bit for residential accessory units and worked out so just if you're curious the last time we pulled the income requirements um again any of those cities workforce housing is required to either be rented to a very low low or moderate rate range these are the rents that those ranges are getting now um so 3156 unit dollars a month is a pretty steep fee but these are based on what we're pulling from um the florida housing finance corporation um planning and zoning board did review this and voted um 6-0 to recommend approval um this has taken a lot of work by rebecca dossery by barbara pinkston who's here and joined us from the county and bringing her knowledge and um assistant director alvarez and the city attorney to bring this forward so if you have any questions i'm happy to

steward i know i want to i just i really i i started working my interest in the city developed because of concerns of development i met you anthea under mr stillings and this was part of the plan back in like so long ago 1917 17 18 19 and then i was so excited to get in office in 2020 and be part of this movement and now it takes a long time to get things done but it's quite amazing only thing that's a little sad is i'd like to know what our plan is to start looking at doing this in other neighborhoods too because why i appreciate what you're saying about we need to test it out and see how it works and yeah i i know the governor is probably going to say it's it can be everywhere but i but i would like us to start looking for relief in other neighborhoods as well as quickly as possible
well i do i do want to also say that renee jett is saying from the cra and i sometimes talk about how we had this study queued up and then coveted and then that put us back we just didn't enter and we stripped all our budgets out or at least i had to and we didn't have the money and then we kind of took a little while to get fired back up again so it has taken longer than it should have um but i'm excited about it i think um you know this wasn't this was easy because we knew the neighborhood really wanted it and i had renee as a partner so um we were able to move that forward and she actually has a cra project with the townhouses it's going to come forward and actually build them so that's pretty exciting um i think it's i mean i hate to say it's a squeaky wheel syndrome so we need to know who wants them because there's probably some neighborhoods who would think i mean my neighborhood
would benefit tremendously from this as would so many it's not like it's not like it's not automatic
it's only within the designated areas right last question though how enforcement i mean we we probably need to start considering how that's going to work because i don't know how you you know how are we going to know if someone sells a home that the homeowner and but yeah they are going to have the same
covenant that affordable housing housing has i mean it's going to be a little bit different it'll be
customized to this we will work that out okay um i think it is tricky because we don't we're no longer allowed to look at some of the landlord things that we used to be able to oversee because we got preempted from that out of the state but um the main thing is is that you know there are people that are out there doing this illegally this neighborhood is poised to build them and use them legally and i think
right exactly good thank you it's very exciting thank you to you your team the cra and everybody
involved you've raised your hand you want to be recognized yes thank you i just had a couple
questions did you just say that there could be parallel parking along the alleyway because my
understanding is that had to be a driveway so this this regulation for the adu because the adu is in the back they might the design we've seen so far is that um if you're building new it's easy right you can always figure it out but this was really this analysis was done to figure out how to insert them behind the existing houses so that we weren't necessarily engendering you know pushing in or people selling out and then somebody new coming in and building them this allows the adu to have a parallel space off the alley so you've got a 10-foot rear setback you could actually use that legally for a parking space if you're fortunate enough to have an alley and miss barletto and the cra are
getting ready to build a bunch of them so i know um also uh the covenant would last the same time our current covenants last yes it would follow the same 40 years yes okay thank you thank you

the map huh i said i'm exhausted just looking at the map no so basically let me just give you a brief overview on this whole thing the genesis of why do we have run with the chief and why this is so important not only to me and our department but for our community had an opportunity when i was in the interim role to attend several different meetings that we had throughout the city burning conversations was one several others uh with our team and what we what i call touching all four corners of delray beach mary you talked about it earlier 15 16 square miles of our city and some of the things what i heard our residents asked for was more accessibility to the police department transparency they wanted to know what we were doing so we're coming up with the the run with the chief this event was designed to strengthen the communication with their police department the community in a positive way non-enforcement setting it provides the residents with direct access with the police department and our leadership and the officers that we've hired on throughout the police department obviously we know we went through some some things last year where our community was still asking questions about the police department this event gives you an opportunity and some of you guys have been out to this event to be able to see for yourself the men and women that we've hired that's in the police academy that we have us one recruiting class away from being fully staffed at the delray beach police department so that's a tremendous effort from our recruiting department and all the men and women that's a part of the delray beach police department and this event gives us that opportunity so while sitting and thinking about what can we do next and how can we interact even more with our police department we came up with a couple different uh diagrams on what we wanted to do but the one that we stuck out uh with the department was the one to basically start the event at libby wesley park they have an amphitheater there where we can actually gather there we can have opportunities for all of our new recruits which we invite each month each month we do this we invite them to come back and tell the community where they're from you know why delray beach and just give you guys a just glimpse of some of the men and women that'll be trolling patrolling the delray beach police department and working within your neighborhoods so what we actually did was was pick libby wesley park to be able to start there and we're going to run up to northeast second and the whole genesis of this whole thing is to basically highlight the city of delray beach it's not it's not about the police department it's not about me you can run you can walk mayor you said you're going to walk so we're going to walk so basically just to show off our city i was going to say can i get a golf can i get one of your golf
cards do what you need to do what are those little things you're driving your cups a little segway hey we can do that too whatever you guys want thank you very much commissioner mark
but the whole genesis is just of this whole thing is to highlight our city so we have a a live and vibrant city and i want people to be able to see that but i also want them to be able to see the unity that we have in the city of delray beach across all delray beach and i feel like starting at libby wesley going up to northeast second pineapple grove you get the avenue we go down to pineapple grove a lot of people forget about pineapple grove uh laura simon and i uh came over uh detective uh dc steven you know have a at second while they talked about number here we take your contingent upon right so we have uh june 27th was the date that we're actually looking for and uh our special ops uh lieutenant uh honest showfully he has been working with dot uh with regards to the event actually uh he informed me today that there is no no issues as far as us being able to actually have the event on june 27th because of the road closures and different things that we have to you know plan for just to make sure the event typically when we highlight it at different parts of the city normally starts at nine o'clock but this event since it's on you know part of our state road it'll be held at eight o'clock and typically it lasts a little over an hour you know so uh but it hadn't been any issues as of you know today's and he was telling me so we're good for us that hard date of june 27th based from dot thank you very much that's great look forward would you like to
yes i would because um i'm very excited about this but in the initial getting the consent for this what i had asked for was the whole ab and you and i discussed the issues with it so i would suggest that once we're done with this area we begin planning the next leg of the ab that's safe and then the following because i will tell you all of these businesses want to come out and participate there's a lot of excitement about this event and i think at some point you should find yourself all the way down at the beach however you do it if you do it in fragments or whatever but it should be ongoing uh in terms of atlantic and you know i love moving into neighborhoods not just parks i i love this event so much and just really have a great deal of respect for you we all saw the recruitment video it's amazing you guys have been like this all night i'm complimenting
him i'm just saying you're pushing us more than a mile it's because it's because this is a very exciting moment for our city very this gentleman has really done a great deal i'm at every one of
these events to make this department what it is and i saying how much i thank you appreciate you thank
you well we got a lot of great men and women doing a lot of great work and uh making these things happen for us so i'm truly blessed just to be here and um to be here to serve this this city and uh in this opportunity that's been given to us so we're really appreciative to that so and thank you guys for your
support that gives me about three months to get in shape exactly huh let's do this deborah

mollica nothing from me commissioner marker i have one one quick one in it this um it's about some of the great work that the chief is doing i've had some really positive feedback in the community about the police cars running with their lights on in the evening so there's visibility um i'm hearing really good things people are happy about that so that's good also uh you've very very nicely parked cars at the unity school and that has slowed traffic down i can tell you that you also have one parked at cornell park occasionally and the residents um in that area have come over to me and said they were having problems with people coming too fast and stop signs and they've been very thankful because it has slowed down traffic to the um to the community center so thank you for doing that that was that was huge um and then the last thing i i was at deck 84 for a lunch two days ago and a gentleman by the name of chad smeely came up who was a new recruit who's just had nothing but good things to say about the police department the process the people that he met and he he just wanted me to publicly thank you for that because he he had such a good experience so thank you appreciate it thank you commissioner burns
yes i have a couple things um one of them i wanted to get consensus from my colleagues um to um have a presentation uh for us at the next or a following meeting and this is regarding a caddy program um pass this down um i was contacted by the people who are doing this and they are already taught to um atlantic high school principal but this will provide jobs and training and scholarships for um students and so they would like to give us a presentation so that the city can get some buy-in on this so you know i asked that i would get consensus do you want to have them great idea okay great so that's number one so if i may mr mayor yes did you need did you get a file you want to file i'm sorry yeah i'll take one
if you have one available because i like to make arrangements for the may 5th meeting you asked about the next meeting or the meeting following may 5th would work best so we'll make arrangements okay thank you
that that works um and then secondly well there was something that i wanted to mention during the um economic development workshop and i forgot to do it but i have been thinking about to a support for small businesses um the the incident with uh subculture um a business that my son has something that's happening with um with uh grooves and i just think that i would like for us to consider a small business success uh impact panel of some sort and this would be something for early guidance um you know rather than enforcement not waiting for you know things to happen and then we have people to come in front of us before hearing but a a panel that would uh help people in uh when they're opening up a small business i can put my ideas down now if i send that to everybody is that violating sunshine laws no okay so i can put it in writing and send each of you a copy of it and then we can consider it for another we just can't we just can't respond to you that's all right okay okay thank you i'll do that i'll send that out um i meant to mention that during the economic i think it works well with the economic development piece and last but not least i mentioned uh at our last meeting that the city of delray was recognized at the league of city meeting for coming in the honorable mention for 2026 for the delray reeds day we came in second place to the village of wellington again yes so um i don't know who gets this the library who i know the organ oh okay clerk what's that village of wellington they put a lot of money into there they did they did a video they did a a video they had lots of readers so did we but they i think what topped them off they did a video they did a a video that they
market the whole thing so so we're going to get genus people to make sure yeah we'll do it next year and that will be it thank you thank you commissioner kasal thanks um thanks sam for
bringing the autism uh acceptance information to us and also it's earth month but in light of what miss berman was saying mr moore could you update us on the climate action plan at some point soon can we still move forward with that in light of what's going on in the state i don't even know where we are if we are done with it or if we're it's on hold i just was curious as it's earth month so
some tweaks will be made in light of what's happening at the state level so we'll come back to you all with what's that looks like in the coming weeks great and again i would just acknowledge
that uh the turnout for your police recruiting was phenomenal thank you very much to you and everybody in your department i would like um a recognition i guess we don't do them as proclamations we do them as recognitions for saint paul's um they're just constantly they feed residents they um gave uh covet vaccines they're out in the community doing a great deal and they're they do it quietly and um you know it would be i think it would be nice we recognize a lot of people which the missionary baptist yeah pastors doc doc and bar i would like to get a consensus to do that and i can write up some of the recognitions and you know i think we should be recognizing everybody that's doing things to make our city better it doesn't take any effort on our part and that's what i would
just you know say what what will we be recognizing them for but you say you make a list because a lot of churches and i think we should get all get them all in here and recognize them i think i would like to do that and you know we each know different organizations but they are feeding they um they're they do they provide a lot of medical services in fact they have an upcoming event um saint matthews does a lot in the church saint john does a lot in the community so there are a plethora right
mount olive does i mean they all know and i have to tell you something i think the city we are a small city and we should be recognizing bringing these people in and recognizing them for what they're doing in our city i i would recognize all of them well well you know i mean right but i'm asking for
this one so is that can i get a consensus i'm okay with that i'm okay i just feel that we need to if we're going to do it for one we need to do it for all i'm 100 on board with you so bring let's bring
them one at a time i'm happy to recognize st paul's i mean reverend absolutely reverend bar is the one
who swore me in as you may remember right and i wanted also note on sunday april 26 from 11 to 4 they're doing a health fair um they give they're giving out groceries they're giving out um health screenings reading eye exams reading glasses doctor consultations uh for eligible patients i think people just have to bring their id and if people are interested they can text 754-262-5412 or email me and i'll get you that information there's a flyer i'm going to put it in in the main portion of city hall and i'll put it in the library and all over and so hopefully they can get good turnout for that so we have a consensus on that yeah i mean but i agree with commissioner burns i mean i think we should we should find out what all the different churches are doing so we can start working on because you know you hear me say this all the time we are 16 square miles the amount of what this city does with all the not-for-profits including the the religious organization and bring them in and i think it's meaningful it's the it's it's something small but it's but it has big big meaning um mr moore we when we're talking about these contracts and we changed your authority is there a way you could just kind of get us a list of like the stuff that's getting approved that we don't know about because now you know the the the monetary amount is up to a hundred thousand and i just maybe an email like once a month saying we've done this we've done that just so we have an idea of what's going on sure okay thank you i appreciate that thank you i know that was enthusiastic uh appreciate that gina i want to say thank you cost recovery at 54 at the creative arts school quite amazing what you're doing there and lastly when when did we decide we're talking about the beautification task force april 21st okay
and when are we talking about the audit um committee that was supposed to happen the staff was ready and then it got changed financial review committee that would be april 21st as well okay perfect thank you very
much and i believe uh oh neighborhood community services i really liked your magazine thank you
very much that's it thank you thank you um i did want to mention i did get an email about some i don't know whether the proclamation is the right word or whatever the thing is for the 100th anniversary of the colony hotel yes thank you the colony hotel is that something we want to just recognize i mean they're kind of like on all all the postcards from way back when i mean we ought to recognize them for being here for 100 years i can bring the owner you you you agree every good okay we all agree okay that's fine um uh the youth caddy program by the way i had actually spoken to to mr moore about and mr me taught about a couple weeks back um about having that to be an integral part of when we get the golf course up and running i think it's a great program and there's a number of others i mean western golf does it uh you know tiger woods's organization does it there's several of the foundations that do this it's a great program for kids it's a great you know great visual for the city and i think it's something we should definitely you know really try to participate in um my last comment has to do with lawn blowers uh i understand what there's a new state statute that prohibits us from you know controlling all the lawn blowers but i've been thinking about this and i actually had a conversation with the city attorney and she's not sure whether i can do this or not do this the city could do this or not do this but if we try to create within our ordinances and i'm going to ask if we could really kind of pursue this something whereby yes you can use a lawn blower but you still have to comply with
the noise ordinance of the city because the average lawn blower and by the way other lawn equipment operates at like 95 to 115 decibels we you know we can go to 60 60 or 65 and what i didn't know and this was brought out to me by someone that actually is involved with controlling some of these things is they can buy mufflers for these gas blowers for under 100 that pushes them to the 60 to 65 decibel level so i'm not i mean i'm just i just i still want to i mean i understand i can't stop the gas blowers but if i can find a way to at least create an ordinance where and i don't know if i can i'm just throwing this out there for consideration that yes you can use them but you still have to comply with our noise ordinance which we do with motorcycle mufflers we do this with you know this is we do this that's that's my other comment so i i don't know whether we can do it or not but i think it's worth trying to explore whether there is some way have you read the bill yeah i read the bill the bill i have not yeah well the bill would bill would bill is very broad and it says there no ordinance can be done to prevent the use of lawn blowers again i don't want to prevent the use of lawn blowers i'm saying you can use the lawn blowers but you still have to comply with our noise ordinance i don't know if i can do it or not i just think it's worth to take a look and see if i think it's worth to take a look as well you know if we gotta know we gotta know but i i just these things are really bothersome so you'll have that for us tomorrow morning at about nine right exactly yeah a little bit i wake up early well actually yeah commissioner mark right before the 10 o'clock team reading anyway i have no i have no other i have no other i have no other uh comments so thank you all for coming but excuse me unless mr long has something to say you missed commissioner comments but you know i'll open it up again for your for your you know i hate it when that happens we're adjourned good night everyone
