30 years of service to the City of Delray Beach whereas Olivia Selvio began her career with the City of Delray Beach on August 26 1996 as a cashier in the utilities building division of the finance department her position later transitioned to a customer service representative where she currently serves with honor and distinction on August 26 2026 Olivia reached a milestone in her career having achieved 30 years of continuous full-time service with the city and whereas Olivia is known for her outstanding customer service skills she knows her customers by name and they ask for her if they don't see her in her usual spot in the left window of the utility billing office she has received numerous compliments for her customers from her customers for her kind and conscientious demeanor and whereas Olivia is a valuable member of the utility billing team she can be counted on to perform her work with accuracy and follow processes to the letter she is unfailingly punctual and ensures that her accounts balance before she leaves for the day and whereas Olivia is an outstanding team player she works well under pressure and never loses her cheerful positive outlook she is always willing to help co-workers with whatever needs to be done her diligence it's contributed to the success of the recent transition to the new utility software system and whereas even outside of her department Olivia has contributed to the success of the city during the COVID pandemic a letter a call center was set up to answer residents questions and Olivia volunteered to serve there and she volunteered we're going to miss you okay we're going Mr. Hajimiri are you commenting here all right good afternoon mayor commissioners Mr. Sadie Mahanichal madam city attorney madam city clerk i was told i get one minute for every year that olivia has served the city so so madam city clerk put a zero in the front of that three and i try to you know hopefully finish it before my 30 minutes is up i'm serious so at utilities department one of our models is to provide the best customer service it has been we believe that our customers are always right they can attest to death they deserve respect patient and best service that we can provide as utility building transitioned to utilities department about two and a half years ago we made it our goal to become even more customer focused and customer friendly olivia represent that commitment every single day for many customers olivia is their first interaction with the city when they come here she's right there she greets them with a smile same smile let me see the smile a friendly attitude and a genuine desire to help she truly makes a difference in their experience every single day olivia thank you for the 30 years of your loyal services to the city to utilities building i am proud to work with you and be part of the team that always put the customer first thank you thank you thank you olivia on behalf of the commission and the city as a whole we would first like to present you with this resolution that was read and this beautiful plaque i made it myself congratulations and i believe the commission would like to take a picture with you so you can stand here you can stand here to join us come on okay we have another recognition uh roots and wings and we are going to have commissioner consal um present this thank you yes and i would just um i want to recognize ms emelman who's here because this uh idea of recognizing the local organizations was really truly inspired by your do good delray events which i attended last year and i loved the recognition of the non-profits the pairing with the for-profits but this is very exciting for us to recognize some of the local organizations that are doing amazing things in our city for our residents and uh children so the first one is for roots and wings the city of delray beach proudly recognizes roots and wings for its outstanding commitment to childhood literacy founded in delray beach in 2016 by theodore ted hoskinson the organization works to improve literacy rates in palm beach county and to ensure that every child has the tools needed to succeed through project uplift roots and wings provides free small group after school tutoring to students in grades one through five who are reading below grade level the program helps students strengthen their reading skills build confidence and prepare for reading assessments in third grade through the above and beyond awards roots and wings honors outstanding teachers and school staff chosen by their peers who go above and beyond for their students their school and their community the city commission the residents of delray beach and the city extends its sincere appreciation to roots and wings for its dedication to our children and to our community and i'd like to present this to you on this sixth day of october 2026 sure yes absolutely thank you for allowing me to say a couple words first of all i want to thank you all so much for this recognition and for the opportunity to be here today on behalf of everyone at roots and wings i'm truly grateful i have a folder for each one of you and i hope you'll take the time to look through it later uh there are numbers and data in there that i'm very proud of but there are also letters from all of our delray beach principles that i feel speak volumes about what we have accomplished with roots and wings i encourage you to read those letters because they tell a larger story they tell a story about collaboration community and what can happen when we all work together on behalf of children i know literacy is important to each and every one of you i also it's know it's important to this city and it's essential to building a stronger delray beach in each of the past three years project uplift has served between 400 and 450 delray beach students who are struggling to read these students have received our free after school small group literacy instruction over the past three years we have invested almost 600 000 in delray beach this year roots and wings will again invest approximately 200 000 in the salaries of our teachers and literacy coordinators in delray beach schools that does not include any funds towards our administrative expenses and overhead i'm sharing those numbers because i think they're important and that's why while recognition like today means a lot to us funding is even more meaningful many of our donors and community partners designate their gifts to go to schools within their own communities we currently don't have any dedicated community funding supporting us in any delray beach school as unrestricted funding becomes more limited it will become more challenging for us to maintain our current level of service in delray beach so today along with saying thank you i'd like to thank and have you think about the city of delray beach and how it might become our financial partner in this work we provide support for children who need additional help learning to read i can't think of any investment that will pay greater dividends to the community than giving a child the ability to read i'd like to close with the words of shanta king the principal of pine grove and last year's principal of the year who wrote something that captures exactly what community partnership is roots and wings has supported our teachers they have motivated our students they have invested in literacy more importantly they have remained committed to pine grove through challenges changes growth and success that's what we want to continue doing together with you for the children of delray beach thank you thank you for your time there's a second presentation go ahead thank you so much next we would like to recognize bound for college the city of delray beach proudly recognizes bound for college founded in delray beach in 2012 by the late mark sauer as delray students first what began at village academy and later atlantic high has grown to serve more than 2 000 students in six grades through uh excuse me i apologize in grades 6 through 12 across six palm beach county public schools empowering motivated young people from low-income families to reach their full potential bound for college provides comprehensive college readiness resources entirely free of charge including act and sat tutoring and test prep college essay and application support and scholarship application assistance with particular attention to students who would be the first in their families to attend college summer programming with career exploration and group mentoring along with college tours throughout the state of florida rounds out a pathway designed to help students earn their degrees debt-free following mark sours passing his wife donna stepped forward to carry on his vision and commitment to local students ensuring that the organization he founded continue to grow and make a lasting difference in the lives of young people throughout our community the city commission and the the residents of the city of delray beach commend bound for college for opening the door to higher education for so many of our young people we honor the vision of its founder mark sour and the continued dedication of his wife donna in carrying that vision forward for future generations i'd like to present this to you today the sixth day of october miss did you want to say something okay thank you i would love to say something to all of you thank you so much for this honor um most of you knew my husband mark sour you couldn't miss him six foot four riding his bicycle all over delray beach when he retired here at 59 he wanted to help and the first thing he did was something similar to root some wings he went right to village academy and started reading to little third graders those little third graders have graduated college and are working out right now in our community and abroad and i have to tell you we have um successfully known of at least 400 students and the bulk of those are right here in delray that have graduated college have gone on for their masters and for their doctorate and they're out there in the careers and i have to tell you that this amazing city with these amazing children and our community let me tell you something we're worth it our kids are worth it you know ted takes them when they're little gets them ready to read then he hands them over to us and we get them past that finish line but we don't just to send them off to college so what we do is we follow through and we are very proud we as well pay our teachers we pay them 53 an hour to stay after school just to help their own kids and the average teacher is earning between eighty five hundred and ten thousand dollars more a year and i have 43 amazing teachers throughout our community here in palm beach so remember when it's time to think about what we do what ted does with bound for with the roots and wings what bound for college does we can't do it without your support financially as well we know you support us and love us and the schools love us but we really could use that additional support we've spent over a million dollars in the last four years in the city of delray for our students alone and that was from private foundations individual donors but gosh could we sure use a little help from the city of delray beach so i didn't bring my packets you'll be all getting one of those in the mail tomorrow with a little bit more about us and who we are but i am honored and mark would love this thank you guys so much thank you i had the opportunity to work with uh coach mark as a as a colleague and also as a coach and the program is excellent program and i had the privilege of working with many of those students who are now college graduates and working in our community so congratulate both of you on the work that you do with our students um in the school thank you okay we are on to the city manager's um response and inquiries yes ma'am i actually have a few updates if i may please okay thank you first of all i'd like to hearken us back to two weeks ago september 22nd during the proposed budget public hearing process there was a gentleman resident of delray beach mr jason botnick who offered his analysis and provided a written communication to each of you all in advance of that session with the assertion regarding 55 million dollars a year that we cannot account for based on some analysis he performed reviewing annual comprehensive financial reports between 2015 and 2024 and given the observations and concerns a couple of of you all have spoken to me individually about that in the aftermath of that particular dialogue which led me to have a discussion with representative from cbiz cpas who've been working with the city of dere beach for about a decade or so different name changes of the organization and of course i had an opportunity to speak to them about the observations having been shared publicly to that effect that resulted in a natural meeting between myself interim chief financial officer carmen aleman along with moses aliza and scott montgomery of cbiz cpas to discuss the analysis to the extent that we can in reference to the process of achieving a conference an annual comprehensive financial report that resulted in them providing for me over the weekend received yesterday a memorandum summarizing their thoughts and observations and what i like to do at this time is to offer orally a few excerpts from that submission and i will pass out for each of you all copies for your background and benefit as well so the subject general fund expenditure reporting considerations and of course there's a summary that outlines purpose budgetary considerations governmental fund financial reporting community redevelopment agency because i think it's important to underscore that the city of dere beach while not many cities have a community redevelopment agency a number does dere beach definitely is the case and has had that for quite some time so a few highlights i'd like to begin with the governmental fund financial reporting the general fund is reported using the modified modified accrual basis of accounting and the current financial resources measurement focus as required by generally accepted accounting principles for governmental funds via this reporting model expenditures generally represent the use of current financial resources as a result certain transactions that may be viewed differently under full accrual accounting are reported as expenditures within the general fund examples to this effect include capital asset acquisitions such as buildings equipment vehicles and infrastructure improvements which are reported as expenditures when purchased certain debt related payments including principal repayments which are reported as expenditures when current financial resources are used consequently a review of general fund expenditures alone may not provide a complete picture of the city's operating cost structure because expenditure totals can be affected by capital investment activities financing decisions and other transactions that are not necessarily recurring operating costs to interpret general fund expenditures solely as cash outflows and to fail to consider the portions related to long-term capital and infrastructure and reductions and liabilities will likewise lead to an incomplete analysis i'd like to offer a few words regarding the community redevelopment agency the dairy beach community redevelopment agency is reported as a blended component unit of the city for financial reporting purposes accordingly certain amounts reported within the general fund reflect payments associated with CRA activities including tax increment funding remitted in accordance with applicable florida statutes when analyzing transit general fund expenditures consideration should be given to the impact of CRA related amounts as these expenditures are not directly attributable to the city's general account governmental operations tax increment payments to the CRA increase from 7.7 million dollars in fiscal year 2015 for example to over 21 million dollars in fiscal year 2024 so within a range of period that we had an opportunity to summarize there's some commentary regarding personnel and public safety costs there's an explanation outline to that effect however i'd like to summarize the conclusion of this engagement with cbiz cpas in response to the concerns raised in conclusion and in summary expenditure trends within a general fund should be evaluated in the context of a a the city's approved annual budgets b the modified accrual basis of accounting used for governmental funds c capital asset acquisitions and debt related expenditures recorded within the general fund d CRA related expenditures reported by the city e personnel costs including salaries wages pension contributions and employee benefits which typically represent a significant portion of general fund expenditures and finally f relevant operational economic and policy considerations applicable to that period being analyzed so on an annual basis in this regard and my interest is to offer for the record as well as in response to one or two discussions i've had with you all individually about this why we are where we are likewise all is generally well and any concerns about millions of dollars not being accounted for are quite frankly alleviated i will pass for each of you all a copy for your benefit so if you would take that that's where we are and we go from there so thank you thank you mr moore i have another unrelated okay thank you i believe another for madam city clerk to have should i leave one for tom if we don't have enough copies i'll make one i have some oh we got an extra one yes okay may i just make a comment if you don't mind could we in the future this was this is dated october 2nd can we get these as they come in because i mean that um the information that we received did leave a lot of questions and i'm very glad they're answered um but i would have i would have appreciated getting this up when you got it if you don't mind in the future if i may ladies and gentlemen it was dated october 2nd our discussion took place wednesday thursday time frame into friday it was provided to me yesterday so my interest was to make an oral presentation in that regard so my interest was to not modify the agenda because it is fairly fresh in the last day despite it being dated friday october 2nd it was received monday october 5th so again my interest was to offer an oral presentation in response to the concerns having been raised nevertheless i always do my best to try to get information to you all in advance and i will continue to do so thank you thank you i have one other item if i may actually to proceed thank you so during the last several days probably close to about the past week or so all of you elected officials and as well as myself have received a number of written communications from individuals concerned about what was known as the former agricultural reserve property located in unincorporated pine beach county west of the delray beach corporate limits i thought it would be appropriate that i'll take a moment to advise for the record that the property in question is not in fact located in the delray beach corporate limits and this of course pertains to the fact that palm beach county is contemplating an authorization of an islamic center school at that particular environment a number of individuals from boca raton unincorporated areas other parts of the general area have reached out to all of you as well as myself asking the city of delray beach to take their concerns into consideration as we grant approval the city of delray beach is not in that place whatsoever simply in long last because this is unincorporated palm beach county ladies and gentlemen it is therefore not a decision making process for which any city officials would be involved and therefore this is a matter to be addressed by the palm beach county board of commissioners so just to clarify for good measure ladies and gentlemen i thought that would be appropriate because quite frankly we were expected as city of delray beach officials to offer leadership and guidance accordingly not our jurisdiction not the corporate limits of dairy beach florida and therefore i'll offer the clarification at this time okay thank you finally bit of good news lindale boulevard and barrick road infrastructure improvements are substantially completed so we'll be closing those out fairly soon and therefore i thought we'd take a moment to highlight that for good measure because there's been a lot of attention and focus in that regard nevertheless madam vice mayor i yield at this time and thank you for the opportunity okay so that's the update that is coming to a conclusion yes ma'am all right thank you all right um we are now at the uh for comments and inquiries on agenda and non-agenda items from the public and i will read the rules the meeting is now open to public to the public any member of the public wishing to comment on any topic or agenda item other than quasi-judicial items or a public hearing item should come forward members of the public will have an opportunity to speak on quasi-judicial and public hearing items later in the meeting as those agenda items are called for public comment please sign in state your name and zip code for the record and you will have three minutes to address the commission this is not a question and answer opportunity and members of the commission will not be responding to inquiries from speakers speakers must address the commission as a whole not any individual insults personal attacks and disruptions will not be permitted and you will be asked to leave if you violate these rules please come to the podium and state your name and zip code for the record okay hello good evening my name is rita rana and my zip code is 33483 and as i always do thank to each of you for all that you do for our city it is great very much appreciated my comments tonight relate to the mayor's education round table at the delray chamber education fund breakfast in august the productive recommendations that came out of that ring round table are a great example of what can happen when the city our schools residents and our community organizations work together and it also gives an opportunity for me to thank mayor carney for inviting the rotary club of delray beach to the literacy coalition of palm beach county mayor's literacy initiative luncheon say that five times fast it was especially rewarding to see our mayor recognized for his commitment to literacy and education something very important to me and to the rotary club of delray beach and to the delray chamber education fund and others the luncheon reminded me of the beginnings of delray reads which we all love to volunteer for in 2011 and 2012 the city and its community partners came together around an action plan to improve third grade reading proficiency and mayor carney you were seating on that city commission and helped shape and support that effort i also remember when school board member and attorney edwin ferguson came here before the commission and presented very troubling data about literacy in our community the mayor immediately recognized the need for action and asked city manager terence moore and education liaison janai bowen to dig into the data and develop a plan janai we must recognize you as well your command of the data and your ability to turn it into a focus plan were remarkable i still remember your presentation to a packed commission chamber your work deserved the applause you received that evening experience inspired me to become more involved in education through the delray chamber education fund as a board member along with ted hoskinson and the rotary club of delray beach where i now have the honor of serving as president rotary through members like commissioner judy malica has supported scholarships the achievement centers for children and families the miracle league dictionaries for every third grader in our city and other educational activities and judy for more than 10 years you have championed children's education and all of these efforts also through rotary janai bowen vera woodson formerly dda member and i helped to create the fresh threads locker program providing clothing and necessities to nearly 100 children if you can imagine experiencing homelessness here in delray beach mary you have consistently i'll close supported these efforts and helped bring our community together thank you for your leadership your accessibility and most importantly for keeping our children and our education a priority and thank you for providing a valuable opportunity to be part of the solution thank you thank you thank you thank you rita what an act to follow wow i love rita i love rotary and i love delray beach and my name is steve english i'm at 33444 today i come to you to recognize the city for its to fight decisive action related to the recent personnel departure after the meeting two weeks ago it was clear that we have a systemic problem going on with this commission in my estimation everyone professes to want to follow the roberts rules of decorum but bastardize it at every turn what happened to the spirit of rotation it's not being exemplified when we watch these meetings i mean it's just galling at times watching the chain of command continually be undermined especially with respect to the city manager's authority it is something that's surprising that we haven't that we have lost a key employee through mr dakowitz's departure it seemed like that he was set up for failure and that it was he was used for political grandstanding this grandstanding is not serving the people of delray beach in any way shape or form i feel it was orchestrated and kind of like a gotcha moment was set up and if that's what our staff is seeing there's not it wouldn't be surprising that we lose more key staff we've got to get this together i mean delray is being competed against by very other strong municipalities if this is how we're going to conduct the city's business it's a shame on us and the when staff sees the confusion that their boss's authority is being undermined regularly how are they going to decide or derive any other interpretation that they can do the same that's why i'm so glad that the action was taken when someone's insubordinate and doesn't follow the chain of command there's no place for them to be employed by this city in any way shape or form or in any corporate structure in this country the lanes of this city's operational structure were defined close to almost 100 years ago and that those lanes are not being followed you know this if we turn around and everyone on this commission and with inside the operational structure of the city should stay in their lane and respect each other's lanes delray deserves better i hope we can follow that thank you how y'all doing my name is timothy boykins um i'm not here to argue that they'll fuss you know what i'm saying i just want to congratulate everybody and i also want to commend the water department your zip code sir your zip code your oh excuse me uh 33445 you know the water department like they gave the lady um props and everything she always been nice you know what i'm saying and she's been very helpful and i just want to say that as a customer coming in paying his bill late all the time you know i'm saying basically but she always had a smile on her face and she's a very beautiful person however i had the chance to meet mr hassan he helped me out on the situation and i ran across something that i thought was very concerning for the community it's the orders that were set aside by the commissioners and it's something to help people if they had a tragedy on their house far as a leak inside of their building or something of that nature but in the orders it just says on uh orders 46-23 but in section 50.4 it says that service must be rendered by a certified plumber and this is what i want to talk about because you know i'm saying everybody does not have the funds to call a certified plumber out to change something as small as this you don't say this is a flap and this is a toilet thing most men in the house know how to change these but if you call the plumber out they're going to charge you four to five hundred dollars and then you got to pay for your service but on the situation that aroused in my case that there was a 92 year old lady who daughter them take care she had a pipe that was broken but the pipe was broken underground and the water was shooting down rota root came out and said they wanted to charge the lady eight thousand dollars because they couldn't locate it so we did it at a price you know i'm saying way under that you know i'm saying and we got the problem we found out it was shooting underground on the sprinkler system but mr hassan helped with the build and i was very grateful for that but the thing about it is i want to go forward and see if we can change this to be able to help other people instead of saying certified plumber put handyman add to it handyman or qualified person but they must show pictures that the work was done that y'all can you know you know look and adjust the water bill you know it's like some people lie but i don't want to just say certified plumber you know what i'm saying so if y'all can revisit that add to it and say a qualified person or a handyman you don't say i think that will serve the delray beach community greater because you know i love my city and y'all are very helpful so just look at it and see if y'all can reword that and add in someone a handyman that we don't have these old people don't have to call a certified plumber for everything certified so you understand so thank you for your time god bless you i ain't fuss and i love everybody thank you thank you i don't know what's gonna happen next time thank you well so far so good tonight i have to say i'm stephanie emelman i'm the ceo of the delray beach chamber commerce and i was very excited to see you honoring two of our non-profits tonight because october is do good delray month that is a chamber program where we pair a for-profit business with a non-profit to raise awareness and funding for our local non-profits and over the past five years we've helped to raise nearly four hundred thousand dollars for our local non-profits and so what i'm here to do tonight is to encourage you to choose one out of the 20 events that we have going on in the month of october and the audience choose one one non-profit and attend their event and support them and i have to commend commissioner cassell because she attended nearly every do good delray event last year that was over 20 events yeah that was pretty good so if anyone needs any information just go to delraybeach.com backslash do good delray and we hope to see you at some of the events in october thank you thank you good evening daniel rose 3344 another month same old stories special events flea markets political rallies hey rumors there's a dancing lesson thing going on in subculture parking mess remains the same nothing's changed can't park handicap because the access aisle is always blocked by a car here's two examples of cars parked on the sidewalk today i wasn't even in the office for maybe two hours today here's a guy wrong way willie driving on the wrong side of the road because he doesn't know where to go all he did was pull a parking permit a lot to a permit to pull his uh pull a permit for his parking lot that's all he ever did he's not going to do it in my opinion i mean people park on the sidewalk um we had a day where an officer wrote several tickets the first day they're enforcing it for 250 dollars hasn't happened since just stopped why is this um had a car last thursday block my office so in other words i couldn't back out safely asked the lady not to park there she couldn't care less she walked right in she was there for an hour she got a ticket but i had to have help getting out of my own parking lot because she decided she's going to park and no parking when you're like please don't park here they have the same old story they'll tell you something that i can't unfortunately say because it involves four letter words mr richwagon will be here next week hopefully our next meeting to bring pictures of what happened on saturday with all the special events and flea markets about people parking in his his lot so now people driving the wrong side where are we going to take action for 22 months we've dealt with this nuisance and it's time to hold them accountable there was supposed to be an agenda item that was going to hold them accountable for what we understand the city manager pulled it and didn't have consent from anyone to do it just pulled it and then the guy's claiming victory in the media where's the life safety plan i don't think it's done yet did a public records request so anytime anyone from subculture emailed the city manager or the assistant city manager they get a response within 24 hours albert and i sent an email showing you about legal events parking issues everything else not one response from the manager assistant city manager none we get no responses whatsoever maybe they can confirm their email address we just get ignored i've even said in emails i had a question about contesting a parking traffic citation for someone no response so at this point up here that someone unfortunately this is sad someone's gonna have to die like this guy driving his big car on the wrong side of the road taking someone out perhaps before we take action but you understand the city's probably going to be liable too because for two years albert and i and other people have come up here and said this is a death trap waiting to happen even a commissioner brought up that this is really serious but again it's not just them you know now other places are holding illegal flea markets we tell you about them and again no response from the city manager otherwise so what messages are we sending to businesses in this town when we have a bad actor who does whatever he wants without any accountability and no one responds and everyone else gets punished everyone gets punished why because this will be no more evident than animal rescues that have been at the green market for over 20 years that now cannot bring animals for adoption because someone decided the rules don't apply to them and brought dogs without any care in the world of the cocoa market which is also mitigation so enough is enough we need accountability and i would like an explanation as why there's been a complete disregard for all of us with this nuisance because i haven't heard from anyone city manager otherwise about why this is happening so i'd like to put these in so you can look at them sorry thank you mr rose thank you i appreciate your time thank you thank you good afternoon everyone my name is yvonne roll 33444 i um i lived in dairy since 1970 i was a school boy employee for 40 plus years i received a traffic violation on september 2nd in the school zone that was no lights on and i'm aware of the school zones because i know all about it so the lights was on the flashing light was not on when i came through there and i got this ticket in the mail i have also heard that the news says these tickets was dismissed and i'm here to see what might get dismissed that's all i have to say thank you good evening mayor commissioner city manager city attorney i'm paul cannon my zip code is 33483 i want to briefly return to something this commission itself established earlier this year the budget financial review committee created by resolution 10326 i believe the timing of that decision has become particularly important when this committee excuse me when this commission approved resolution 10326 on june 2nd it did more than create another advisory committee it gave the committee responsibility to review the city's budget finance financial and budgetary systems and procedures revenues salaries and benefits operating expenses debt services capital expenditures grants and transfers it also specifically authorized the committee to review city departments and perform other duties directed by a majority of the commission that authority is particularly relevant now for three reasons first florida voters will decide amendment 3 on november 3rd if approved it would substantially change the property tax revenue environment few municipalities including the city of delray beach whatever one's position on the amendment it is its potential impact on the city's general fund is significant and deserves careful financial planning second the city has completed a difficult budget process and adopted a 6.3501 mil operating rate plus a 0.0289 mils for debt service we are beginning a new fiscal year with substantial ongoing operating commitments and greater uncertainty about the future of property tax revenues and third we've just experienced a change in leadership in the city's finance department with the departure of the chief financial officer those three circumstances an uncertain property tax environment a newly adopted budget with significant ongoing commitments and the change in financial leadership make independent financial review particularly timely i believe the committee was created to provide an additional level of independent review and to help the commission understand the city's financial position risks and opportunities particularly when the circumstances are changing resolution 10326 already gives the commission the authority to direct that work so my request tonight is straightforward please activate the and utilize the excuse me the budget financial review committee as contemplated by the resolution and give it an initial agreement to examine the city's financial exposure to amendment 3 identify potential revenue and expenditure impacts and review city departments for opportunities to improve efficiency controls and long-term financial resilience the committee was created in june the financial circumstances make that work make its work valuable here and now thank you very much thank you thank you good evening mayor carney vice mayor burns and commissioners my name is tia barnett 33426 and i have the privilege of serving as chairman of the board of the incredible hope foundation joining me tonight is our founder andrea bruton affectionately known to most of you as lucy andrea's vision heart and personal commitment to women affected by breast cancer and the deaths of some young women that were very close to us are the reason this organization exists today october is breast cancer awareness month and we wanted to take just a few minutes to tell you who we are share what we've been doing here in the community and most importantly to say thank you our mission is to provide and advocate equitable services for brown-skinned breast cancer patients survivors and families through financial support education for early detection encouragement and additional research and that word equitable is really important black women are are less likely than white women to be diagnosed with breast cancer but we are about 38 percent more likely to die from it that tells us there's still work to do around early detection access to care education and making sure women have support throughout their journey for us that support is very personal sometimes it looks like helping with transportation a utility bill a meal or connecting someone to a resource and sometimes it's simply just being there when someone says i'm scared and i don't know what to do next we want her to know she does not have to do this alone that is why we are so grateful to the city of delray beach and to the community partners who continue to support this work including healthy delray the set neighborhood alliance the coalition and peach umbrella network and we especially want to thank vice mayor angela burns for her continuous encouragement and visible substantial support this week we are excited uh to bring our tickled pink weekend to delray beach on friday october 9th we kick off things at pompey park with pink proud and step in with a purpose an evening of line dancing movement fellowship and fun on saturday october 10th y'all you know join us now we will host held in hope at the carolyn sims center in boynton this is creating a space for survivors and caregivers to breathe connect receive support and have some someone to pour back into them and on sunday october 11th we close the weekend with our tinkled pink tickled pink day party at the delray south civic center celebrating survivorship sisterhood community and hope mayor carney vice mayor burns and commissioners on behalf of andrea our board our volunteers and the women and families we serve thank you for believing in this work and for making room for organizations like ours to serve this community we may be a small organization but we believe that showing up for one woman and one family at a time can make a very big difference thank you and we hope to see you at some point this tickle pink weekend thank you good afternoon well done to you thank you so much good afternoon vice mayor um to the mayor wherever you are hello um and the commission andrea bruton three three four four five i wanted to express my concerns about the conduct and the handling of the commission meeting on september 22nd commissioners have an important responsibility to set policy ask tough questions and hold city management accountable that work is strongest when commissioners respect the city manager's role and avoid putting department heads in the middle of confrontations that could undermine the manager's ability to lead the chair's role must also be clear residents should know who's presiding speakers should follow chair the chair's direction and meeting procedures should be applied consistently we should expect all staff expect all staff to provide accurate information present options and offer candid recommendations even when the facts are difficult honest advice is essential and it should be delivered with professionalism and respect for elected officials management and employees public safety budgets deserve scrutiny of course but those discussions should also consider the services those dollars support community needs response time recruitment retention and the work of the police and fire employees who help keep the residents of delray safe above all disagreements should stay focused on the public's business residents deserve meaningful budget discussions and respectful debates personal confrontations distract from the issues and can weaken public confidence in the city's government i am asking that we hold every commission meeting to a clear standard of professionalism and respect and leadership our community deserve discussions that stay focused on the issues and serve the public good thank you thank you i wish i had paul cannon's english accent to present to you today i i'm just going to have to use my midwestern twang uh i sent about a month ago to all of you can you announce yourself in your zip code please yes sir jim chard 33483 sorry a month ago i wrote and distributed to to all of you and to the mayor the idea that uh the idea that uh we had a process starting 35 years ago to build a cultural center in the middle of our city in the heart of our city and five five and a half years ago that was largely shut down and we don't have a plan to replace it we did receive a consultant's report and i think we all sort of rolled our eyes and said we know that so what i'd like to suggest is we don't need any more consultants we don't need to spend any more money we have the know-how in this city and the committed uh citizens that could put a plan together to make this work i suggest we could do that in 30 days because we know how to do it we've done it before we did it for congress avenue task force which cbre was very glad to copy from what we did and present it to you all as a consultant first of all i think we need a task force of roughly 10 people two people from each of the commissioners uh those people should have certain guidelines in terms of their background and knowledge about not-for-profits and culture and so forth secondly we should have a tight timeline uh and putting together a plan as i suggested 30 days we've waited long enough we know how to do this we need to find either a 501c3 that we can use or create a new one and as all of you know you need that track record of three or four years before funding uh comes in so it would be very good if we could find a 501c3 that would be willing to work with us on that then i think that the task force would do a five to ten year timeline so that we as citizens know year one year five year ten exactly what we're getting on the campus in terms of art visual arts performance arts uh activities in the amphitheater that all obviously can't all be done at once so that uh madam chair may i have just one minute more um wrap it up i need you to wrap it up okay i have to give everybody one thank you um a detailed budget showing both revenues and expenses a list of possible funding sources they are out there an outline of a contract with the city that specifies the city's role in the not-for-profits role and does not pull the rug out from under the not-for-profit so they can't raise money from donors and then um the task force once it has that plan and your support would uh report on a quarterly basis i would uh respectfully suggest that this be discussed in the commission comments later tonight thank you thank you good evening pamela williams 33444 i want to start off by thanking commission on the cola increase uh retirees of dairy beach received we do appreciate you giving that great thought and ultimately approving that i want to say that the reminder or or statement of it being a one-time deal that's not going to happen we are going to ask for the cola again next year and i would like for you all to take that into consideration because we too would like to be able to survive in an ongoing lifestyle as opposed to it being set off in a a dollar amount as to the day that we retired not to go against our fellow retirees of the police department and fire department but we too would like to have the perk of being an essential employee the same way we have the burden of being one treat us all as if we are as important as our law enforcement and first responders and please consider again next year our cost of living increase because we are going to come together again and ask for that again thank you for that and duly appreciate it we'll see you all next year for our next annual increase let's get on to the accolades i would like to go on record to thank the great department of parks and recreation as well as public works there was an incident with the senior club where we were we were in a building that did not in my opinion come across as humane there was no air conditioning there was no notification those of us who were dropped off there not me i can walk had trouble being reassigned within three to four hours should have been less in my opinion but who am i it was all turned around thanks to clayton gilbert uh mike corralie missy barletto sam mita and the rest of those people thank you guys for getting us in comfort and let's continue open communication because with this rebuilding of pompey park things are going to happen and we do not want to be an afterthought as to how accommodations will be made so thank you for that and in closing let me just say i'm going to steal this from stephanie do good delray you all have to do good in order for you all to get good the way you all act up here at times is embarrassing so you have no right to say to me act right when i come here as your boss and i cut up you said an example if i see you all cutting up trust me so will i do better and we will treat you all better act the way you act and you get what you get please and for those who are looking to be re-elected we're looking at all of that those of you who are in office we look at all of that get it together and get it right thank you you're welcome george long certified rank and tour 3344 speaking of elections municipal elections just on the horizon i think and i'd like to offer some advice for anybody or more like a warning if you're thinking about running for office here campaigning is very bad for your complexion i have seen i don't give any names or not but i remember one uh lady who was black and complexion was turned green one year uh one guy was running for uh i think mayor something his eyes were red and one other person i think who was running for mayor they they were turned into a witch when they were reading the story to some children that one made their uh made it into these uh postcards but i will say something here i'll give delray credit when i've looked at what's going on at the state level they are just amateurs compared to what you guys can do when you start coloring up your opposition and everything people are just nothing so keep up the good work and i'll be collecting your um postcards thank you my name is queen my zip code is three three zero zero zero um i first want to say that i was actually looking at my emails just now and i couldn't understand why i received a bill from the city attorney's office for almost 500 for documents like what can be coming out of the city of dairy under harass other than harassment stalking retaliation for white officers holding me hostage and a couple of us are aware of that what could they be providing me at a charge of 500 so i did send an email so hopefully you all will be able to encounter to tell me send me something itemized because that was unitemized and that's not going to cut it for me especially when you all still have my graveyard out there and nobody have provided me with documents as to what is the fungus that's on the grounds and i would like that to come from a professional not parks and recreation um not their employees so i wanted to kind of put that on the chart and i'm not going to take my six minutes just yet but eventually i'm going to be getting my six minutes because i'm going to be speaking on behalf of the graveyard and also the senior citizens that can't make it in unless we want to roll them in give them their own seat and take our time and let them walk up here one by one or i'm going to take six minutes on behalf of all of us um i don't know how the meeting went when i was uh i guess i was just barred from that meeting thank you for illegally trespassing me whoever did it but we'll discuss that at one point or another but i do want the town to know that they should be thanking me because if it wasn't for me we would never have been to where we're at right now so what you guys are going to learn is you're not going to not invite me places you're going to make sure that i get there and i'm being very clear on that that graveyard would not be in the same entanglement that it's in right now we're not going to be sweeping anything under the rug and we're going to fix gates we're going to find out about bad soil we're going to get to the bottom of what actually happened to uh napoleon enoch powell and also mamie powell because i want to know what flood washed them away i mean commissioner burns said something about that as well so that should have been in the news so we're going to get to the bottom of a lot of stuff um we also going to get to the bottom of why am i trespassed from these public buildings even though i appreciate not being there because the building need to be towed down and rebuilt anyway and i think the machines don't work so the machine i want to know why would coco golf be coming there anyway um the next thing is i think i need to address the police of the park the chief of police too i see you guys gave out tennis shoes on behalf of coco golf foundation how could you give any of my children because one of those kids that y'all gave shoes to that's a family member of mine so you're not going to give my family member any tennis shoes when you're not stopping these white officers from walking in my face so we're going to address that too with the coco golf foundation and we also need to be clear too coco golf is going through something as well y'all got her picture splattered in the building like she's the only historical here i want to know why aren't we discussing what coco golf is going through which is the same thing the the abuse of black women and the abuse of black american women y'all don't know she's going through something or are y'all kicking that under the rug for a non-profit organization all right what y'all not understanding is my name is queen thank you you're welcome my name is queen i am the president of unia i don't know if you're aware of marcus garvey i'm the president of florida so we're going to be taking a lot of seats together okay and if you're a mayor whoever seat is up for grabs you're going to come through me because my black community i can guarantee you they're going to follow me thank you thank you you're welcome thank you so whoever's getting voted in i'm going to be your component and contestant too thank you do we have any other um persons for public comment okay seeing none public comment is closed okay moving on next on our agenda is the consent agenda and we did move one item but can i get it um an approval or approve the consent agenda i'm sorry motion to approve the consent agenda motion to okay we got a first and a second okay all in favor aye any opposed mayor did i hear you mayor hello mayor carney i have a note in front of me to remind myself to talk to you did we did we lose him he's definitely muted okay can we see if we can unmute the mayor hello mayor carney exclamation point oh he's saying he's muted on his end not on ours the gentleman is saying okay i just i sent him a text i'm sorry i had i'm here i had to change screens to watch you to watch on you on youtube and i didn't have that microphone up but yes i'm here thank you and you vote uh to uh approve the consent agenda thank you okay thank you okay so we are on to our regular agenda and 7a is the discussion i'm sorry vice mayor is that 7aa so we do a first yes okay all right let's go to 7a the acceptance of the right-of-way dedication for 33 33 333 333 northwest swinton avenue commissioner um moliker yeah i actually pulled this item because i was kind of concerned that all of these things that were basically taking land from all these people and i understand that it's it's part of the comp plan that the roads have to be a certain distance and the alleys have to be a certain distance but it feels like whenever all these people have applied for a a permit of some sort and before we give them a permit for construction we first have to get that land that makes that alley whether we're going to make an alleyway or not to be a certain width and gets that road whether we're going to make a roadway or not to be a certain width am i understanding that accurately so typically when when there is development that is a time when the city looks at the comp plan looks at the property i'm looking at missy to make sure i'm not misstating anything and if there is a policy in place that says that at some point the city is going to widen this road that is the time when we make the ask the reason being is because and i think you and i spoke about this privately um when we take a dedication those imaginary lines start moving and so you know once something is already built we can't take a dedication because then it's going to go into the setbacks it's going to affect the you know the location of whatever is on that property so that's why we do things so i understand so all this is new development typically is right now a lot of this is um it might be a renovation on a property that's more than 50 percent it might be tearing down an existing structure and starting a new one there's a lot of things that happen in the right-of-way that are not roadway right so the right-of-way it's important to have the appropriate amount of right-of-way because that's where all our water and sewer lines are that's where our storm water management happens that's where sidewalks are and street lights so going through the the comprehensive plan effort we identified what the appropriate rights-of-way for each each roadway in the city is and because most of the places here were developed um i mean i always like to tease everybody and say that in the when we did osceola park neighborhood we had to do a lot of right-of-way dedications to get roadways right and everything because that plat was done when people rode horses to work so it's just a very it's a very old plat system and we're working very hard to get the appropriate amount of space to be able to provide the public infrastructure that's required so i understand that um we need a certain width of road and a certain width of alley but like when somebody bought that property that was their property and then we decided later that we needed more is that right i mean could it be an easement or does it have to be where we make them dedicated to us there there are opportunities for homeowners or people developing a piece of property to ask for waivers to the right-of-way dedications there are some places where we do that on a regular enough basis that we've actually made that a rule so that you don't have to rule on that every single time for the most part we do not have a lot of pushback from from people who were asking for this two feet of property um to be it's generally between between one and three feet of property it's not a lot yeah it looks like two feet for the alleyway it still looks like their front yard or their backyard if it's an alleyway and uh and and we don't generally get a lot where we fall into issues with with it are in those neighborhoods that are a lot older like um i'll go back to osceola park neighborhood again because i know that that plat was was developed in 1926. so lots were smaller then and now we have residential lot sizes that require a certain amount of width in order to build otherwise you have to do affordable housing and those kind of things so there are procedures in place for people who who need to have that extra land in their ownership to have um have variances and waivers for setbacks and that sort of thing so all these people are just happy to give it well no they're not okay um so we have to follow what our policies dictate right so you're the policy makers and i think we kind of discussed this at the last meeting when staff sees a repeat of the same waiver that's when we bring it to you and say you know we keep seeing this maybe there needs to be an adjustment in the code so this is a policy direction and you know our comp plan talks about the ultimate right away and you know um how much of a dedication is required to give if if that's the if the direction of the city commission is you know that that's not something that should be prioritized or should be changed we take that from you but you know from staff's position whatever's been memorialized in the code is what we have to tell people they have to do and then if they want to seek a waiver or a variance that's their prerogative sometimes we can do these internal adjustments through dsmg which is your department heads that meet together to address these issues but we can't say to someone you should really get a waiver you know like we can't do that because the policy of the commission has been we need a dedication of this amount and if somebody doesn't want to give it then you know they always have process they always have the ability to seek some other alternative relief and if it's appropriate and legally sound then you would grant it so the guy that's improving his house by 50 percent maybe his neighbor isn't giving up that roadway but he is right so we asked for it now and then under the you know assumption that at some point the development is going to trickle down the street and then you know it's piecemeal right and you know missy will tell you that it's you know sometimes we do have to go to people who aren't developing their property and say this is what we need because this is the improvement that's going to come to your neighborhood there's a benefit to the bargain right so there is a benefit to the community by doing this because that allows us to make improvements to bring things you know up to a different level but sometimes we do ask people to give us um these dedications because we are starting an improvement project in that particular neighborhood and they don't have development that would come before the city that would allow us to to to make that ask at the time of application but these people were not well we're asking we're we're asking for the dedication okay okay are there any other questions regarding this item okay can i get a motion sure uh motion to approve item 7aa formally 6c um do you need more than that no no you can just make the motion right away dedications thank you second i'll second thank you um all in favor aye aye any opposed mayor did i hear your aye yes okay thank you just checking all right now that i figured out how they work the buttons i'm in great shape okay thank you keep your finger on the button we're coming up with uh regular agenda uh 7a uh discussion regarding the education task force um um do if does miss bourne have a presentation is there a presentation with this no no okay thank you all right it was actually commission driven however ms poens and the rest of us are in position to address any specific questions this is your opportunity for guidance and direction and you know i know that you know education has been a priority for this entire commission and i know for myself after 34 years i certainly um have advocated for recognizing quality education and that's present in our school and advocating for excellent schools and education opportunities for every kid however um uh the mayor uh had the task force uh working and i think the to my understanding the the goal was to um to revise the comp plan so i would like to start with the mayor before i forget i have a note in here that mayor's on call so i don't forget him so mayor would you like to start discussion on this i i i'd be i'd be delighted thank you thank you uh vice mayor um first of all i want to thank judy malika for commissioner malika for actually getting this on the agenda we had spoken about it and she was she had actively participated as i think all the commissioners did uh coming to that breakfast and we we ended up with some very good results um uh and you know i've been i've been working with uh janai for the last couple of uh you know we've talked over you know a few weeks here about what we really well what we would really like to to come out of these uh out of this meeting and there were two essentially two two task forces that were discussed at this at this breakfast one was an education tax force uh and the other was a workforce development task force and they both by the way work hand in hand we've all talked about the importance of having education in order to you know stimulate uh business development but also we we need to have education so that the kids can have a place to you know can land jobs somewhere so that they're equally important they have to work hand in hand um and so i've kind of spoke with janai about how we want to set this thing up it's obviously going to be uh the commission to decide um but we want to know you know how long we want the task force to be in existence uh we talked at that breakfast about two years they said two years would be a good number you know how many members there should be of each one of these task forces um and that's going to be up to the commission the commission will be making the appointments to these and in relation to that uh you know what the qualifications are what we are looking for uh uh for these task force members because we are we we are going to be setting the goals and objectives for this uh for these task forces and it's going to be very important for us to make sure that whatever board that we choose uh the task force members that we choose that they're going to be active that they're going to be they're going to have to have regular meetings we can decide that you know at when we when we get to actually putting pen to paper about how many uh how many meetings we want to have um is how often will they meet but one of the key things that we talked about and we talked about it at the meeting and i believe we talked about it a couple weeks ago was we we we need to have some kind of measurement to to to to to to look at the performance of these task forces to make sure they're doing what we want them to do you know you have you know i i i think of like for example ronda uh ronda smith who's the principal of plumosa who's done such a fabulous job at really turning that place around and you know she developed her own system to do it it was a great it worked out really well for them i think it's a model for stuff for a lot of the schools here so what i'm looking for and i mean i'm for everyone else to jump in but what i'm looking for is that we could possibly have uh uh i know we've we bounced this around a number of times but to actually have now that we you know what the whole purpose of having this breakfast was to kick start this this initiative and to maybe have a workshop that we could have maybe in the first week in november i believe mr moore said when i called earlier today that there's some availability on the third of november if we wanted to do the workshop dedicated to this uh where we can all decide these questions about how many members we want uh what's the goals going to be uh etc etc so that we can get these two task forces up and running because i think this the city deserves the students deserve it and it's it's it's i think going to be a cornerstone to to improving education in this city because we have a lot of people that really want to help and i think we ought to take advantage of that so i guess i'm looking to that before when we end this thing to some kind of a consensus that we're going to have a workshop where we can thrash out all of these little elements that we want to have and um and you know then set have the city attorney put pen to paper to figure out whatever the legalese we need to establish the task force which we've got task forces we can then vote on them and then we can you know start the process of appointing people and getting them to work and i did you know i janiah by the way's got i asked her to be prepared in case anybody wanted to talk to her about some of the ideas that were bounced around so i know she's hopefully she's there um uh i can't i can only see the four of you she's here so and you can't see her okay that's good so anyway that that's really what what we're talking about we're really trying to kick start the the initiative that we that the the for the education breakfast and as i said i'm so thrilled that all the commissioners were you know participated in it uh everybody you know got to sit at a table and come up with different ideas and i just think it's it's it's it's it's it's time yeah so that's i'm done all right thank you so that actually i think that's the third task force that i've attended so we've been task forcing for a long time um and i also support um moving forward it seems like we workshop education to death so i am really uh supporting moving forward with developing these task force and um get getting things going uh i just wanted to say one quick thing if that's yes sure so commissioner malika and i actually had a robust conversation about this and what you know because i think from what i understand from the education breakfast and you'll correct me if i'm wrong i think what the groups wanted was some somewhat of a fluid environment not like another board or a committee right but almost like a fluid environment where you they can meet doesn't necessarily have to be subject to sunshine so you're not going to delegate any decision making or anything like that but it's more just like fact finding and florida law says that if the group is more fact finding basically you know they're getting information for you they're reporting to you then they're not subject to sunshine and you know i i think the more formal we start making this right the more um restrictions we're going to have with the sunshine law so from what i envisioned based on our conversation was just you know a group that can meet almost casually but you're they're going to be appointed and you know if they want to invite somebody else that's also a subject matter expert just to hear from them then they're going to make a report for you and bring the information back to you on what the needs of the community are what they're hearing from members of the community and just keeping it just pretty fluid so that you're not stuck in a situation where they're going to have notice requirements meeting requirements meeting minute requirements and all those other things that come along with our form or more formal boards so i don't know if that's what you were thinking but that's what she no no that that that that is that is what we were talking about because we don't want to get bogged down with the with like the two members of a task force not being able to talk to each other because you know one of them gets an idea and they want a bouncy idea off the other person we want to we want to be able to have the maximum flexibility to really kind of move this along so okay sounds good to me that's kind of that's what that i think that was i mean i mean i guess you know the commissioners were at the meeting there that was kind of what we talked about at the end about moving it forward so um that was my understanding anyway thank you mayor i'm going to move on uh commissioner thank you yeah when um when we were at the mayor's round table and the task force was brought up it was for the very reasons that the attorney mentioned is for the fluidity of it and they proposed the people that were talking at the table that i was part of is that one of their first missions of course we have to set the time frame which i think two years is reasonable i don't think we need a workshop for that um their proposals that they would come up with um comprehend a revision of the comprehensive plan with regard to education and changes or improvement of that plan that they would then bring to the commission and then they would come up with ideas to implement that which they would then bring to the commission so i think at this point i'm not i don't know that we need a workshop for it but i think at this point since it's a volunteer-led thing it's volunteer-led and driven you know we can do the appointments of it but maybe make an application available and then um and then have the commissioners appoint at least for for this for the um the task force the education task force i've not worked on the workforce task task force my table was for the education we're trying to bring back the education board but nobody wanted the restrictions that the board brought and so at what point will we outline for this task force what we want them to do i mean we just said here that we want it to be fluid that we want it to be a fact finding information gathering and then report back but i mean not that you know like i said we've been workshopped to death however there has to be some sort of direction for the group to for it to be successful as they they set out for themselves was that they would make revisions to the comprehensive plan with regard to the education so they kind of set out the people in my who was they set that out they the um mitch cat the people at my table okay but i can name them that ultimately has to still come from us with direction so that so um i don't think a workshop would be a bad thing we just don't have to make it an hour we can just make it five minutes everybody comes in knowing where we're going to go so that so that the task force will have clear direction as to what what we're expecting from it so all right uh commissioner yeah thanks i would like to speak about the workforce development task force we're already meeting and we are already moving miss emelman is the leader and she's doing a tremendous job mr orris sat in on the first day i selected this table and i i couldn't be happier because there's so much potential so basically a task force already no no we sat i sat at the workforce development table we'd like to call it a task force but i don't think we need a workshop or even appointments we just want to have that title as we're working with the community but we already have we have a two-pronged approach which is bringing awareness to the students and the families of what programs are available and then bringing awareness to the um to the workforce employers of what students are available i'm sitting on this and we have had meetings tara lexer jackie ramirez is on it um michael corbett from career source matthew lenihan from palm beach state college joseph cortez from carver high school shannon greece the principal at carver middle and sam camp our economic development director and we have done a lot of work so i would like the opportunity for us to just take this title but not be assigned by the commission you wouldn't want to break up this group that's already moving forward and the great thing that miss emelman has done is as she finds somebody that might contribute she brings new people in so each meeting there's added individuals but we've gotten a lot of work done and i would like for us to continue um and so my so let me just ask a question well i think the city attorney said it could be a casual group but hold on wait a minute so the you're suggesting that we continue with the process the round table discussion continue for the workforce development i think if people are but there were five but there were five but there were because i was also in a group but what i'm asking is for your suggestion and is to that we continue the committees or the categories that we sat with at the uh at the round table discussion and continue working from that exactly so each of us commissioner stays with our group that we selected that day and works through it now the the situation with miss mollica is slightly different because they want to make recommendations for the comp plan so that may be something the whole commission wants input on but um with respect to this i think then what we should be doing is coming back to the commission with regular updates on what we're doing who's coming who's going from the groups what we've accomplished and what we're looking to accomplish and what we may need in order to continue that on but i would like to stay sitting with that group and i would like us to be called our workforce development task force and um i think it's it's probably the most productive way to continue this moving forward so signed so janai is the principal of of these task force is that correct well it sounds like one group went rogue not yet we're asking well i don't we we didn't go rogue we haven't been we're asking permission to continue working on i mean i think we're doing a great job if i say so myself i was trying to follow rules here i didn't realize we didn't have any well when i spoke to the city attorney you can have it you can we can do what we want we're the commission well well let me just say this i i know that there has been some move forward movement from these task force like i said this is the third year that i've attended and so out of it came uh we were on the kindergarten readiness years ago there were two kindergarten readiness drives that came out of it um for people who worked on that and they they registered over 300 families this past uh year for the 2026 year and then there was also a showcase of schools that came out of that roundtable discussion so committees are working um but i but at this point is separate from what we're talking about uh formulating a education task force and formulating a workforce task force because as it is janai and stephanie and that they're already working you know on this thing so yeah add your two cents yes i'm sorry so if i may just add some context to the origins of the task force so we started these roundtables particularly the city in collaboration with the chamber um stephanie wonderful stephanie uh we started these task force uh or i'm sorry these roundtables in 2024 so it was a way for us to convene partners in in um the school district our business partners as well as our non-profit partners to discuss the future of education in the city of delray beach so we know that as government we are great facilitators but we need people who are actually the doers so that's why we convene and we collaborate so in 2024 we formed these roundtables um the stakeholders were the the driving factor um so they were the ones that provided the goals and out of those goals and out of those discussions uh was a focus on reframing our relationship with the school district of palm beach county and improving the parents in the relationship with schools um also to develop a focus on kindergarten readiness as well as a focus on our industries here so out of that we developed for to repair relationships that was what they termed it um with school district of palm beach county particularly our public schools we developed the education the setters initiative and that was with in collaboration with chief hunter so we go out go out to the schools and we officially award and recognize teachers principals and students that are doing exceedingly well for the kindergarten readiness group we did host two roundtables um for that and out of that we held two registration drives and that was in collaboration with the achievement center for children and families and over those two drives we were able to successfully register 300 families for the 2025-2026 school year for kindergarten and then out of the other roundtable um we were able to host um industry tours with atlantic high school and village academy and hospitality and tourism industries the automotive industry as well as the medical industry so the goal for this iteration of the roundtable was to essentially codify that work right because a lot of people didn't know what came out of it so the intention was to develop task force and have whatever iteration you guys decide to do whether it's whether it's through a formal resolution um whether it's through you know you all you know designing the the makeup or the composition or the term limits and my goal as staff is to support that direction and i will come to the table with anything in terms of data from the city standpoint to move the goals and initiatives forward so that's where we are i believe that out of the groups that met the five groups that met the only um working groups that requested a task force was the workforce development group and the education board group okay so uh commissioner uh margaret did you have anything to say just a general comment uh we do have a lot of task force that are brewing right now and i think generally they're pretty good but one of the things i think we have to get from the task force is a clear direction of what they're trying to accomplish right i think sometimes we do not get that we also need to get agreed timelines uh because a lot of these task force are spiraling out of control and taking way longer than we would like um and we should have as a commission we should have a clear expectation of what our outcomes are for that task force and i think we could do a better job with that i agree with what janai said about finding people that are doers you know we we aren't paying these people we're asking them to step up and it's it's these people are amazing that are stepping up but i think we could do a better job managing these task force and and and that'll help us get to the finish line on projects sooner okay so i i'm just trying to understand the operation so i know that i've received emails from janai and stephanie at saying that this group which the five groups when they're meeting so it seems to me maybe i'm wrong that these task force are already formed and so we have a commissioner on on the workforce development we have the mayor on education and you're on education as well i mean no we when when we formed at the round table we discussed coming to the commission to formally to create okay nobody decided you know let's just go ahead and start doing this okay well well the education encompasses all of the the five groups so i i don't see a problem with you know designating a education task force and those persons that you named i mean we can we can go with it and if commissioner cassell is already working with her group she can be the reporter right the reporter back to commission that's just where i stand with it so thank you so for the education one we we need to uh mayor were you um an agreement with the the people that that um commissioner molliker named uh for the education so it looks like we don't have to select one that it's already formed there were just people at my table there were people at the table at the round table participating that doesn't encompass anybody that may have an interest in it okay because we haven't advertised it at all just the people that happen yeah i mean i think that i think that you we may have i mean i i think that other members of the commission might be interested in just seeing what's going on with the education component or the workforce development component so i i you know i like the fluidity of of we as a board because commissioner market is correct that's why one of the points i said is that you know the goals what we have to the goals and objectives need to be established and then the timeline or what i call it you know the metric the performance measurement needs to be in place so that we can determine you know we can have we can see what the results are based on what we we decided we want the goals and objectives to be that so i i'm i just want to get it started because that's well that's why i had the breakfast because we've been uh you know we've languished and we've gone back and forth on as you you're correct uh vice mayor that you know we've had a number of quote workshops on this i don't care whether we have a workshop or not i just want to get it started and if we can get it started without the need for another workshop to formally adopt a plan that's fine i just want to get it started okay i just uh add something to it we have miss emelman has led this group and it's accomplished a lot we understand our greatest workforce challenges we have them all listed out we know what credentials and certifications are most needed by employers so we're working with that we know how to measure our success and we have laid out one two three four five different ways that we can measure our success and we have our next steps lined up which was trying to formalize our group to give it you know a little prestige calling it a city task force um to bring other non-profit partners into our work group to add employers in targeted industries of our work group which is health care automotive hospitality culinary hvac and trades to develop an event to bring awareness to students and families to develop an event to bring awareness to employers in the workforce to look at our long-term marketing program how are we highlighting what's going on and what services are all available and to create an agenda for uh future meetings so we really and i say we but i give miss emelman all credit so how would you like us to formalize it so just give it a name that's all you have to do and we can allow miss emelman to be the leader of that group so can we proceed with the mayor's suggestion of having a workshop in whatever date he said that you have room mr moore and then at that meeting we formulate the process and pick the people or however and then see how we marry what's already going on with the whole thing so yes madam vice mayor i would propose a brief discussion at a workshop this does not need to involve a lengthy discussion so i would arrange a half hour in advance to the regular meeting for november 2nd okay so good the city commission meeting calendar for reminder purposes for the month of november our monday november 2nd we changed it from november 3rd to november 2nd because of course november 3rd is an election day and the second meeting in the month of november will take place tuesday november 17th sounds good so likewise we'll make arrangements for sometime during the four o'clock hour november 2nd in advance of the regular meeting the 4 30 hour okay all right thank you um i just wanted to ask one question uh on the on your the workforce development task force yes is that our new director of workforce is he on that correct absolutely okay thank you yeah that must be okay so i think so any can i just say something yes city staff is going to participate then it has to be formally created by the city because we have to justify why a staff member is and even though it is related to his job duties we're going to need to formalize that and we can do it through resolution we can do it however you want we can appoint the people that are already on there okay but i think for mr moore's purposes i think it needs to be formalized as a task it does and that will be a hallmark feature of the workshop meeting coming up number second second so that direction can be formalized from there thank you thank you and it will meet mr and only miss emelman's you know thing would want it to be like a formalized uh group so from the city so i i think that's you know a good plan okay i think miss she can hear you you got it she got it okay so any other action on this item are we thank you junei we are clear you're welcome um are we moving on are we we don't need to vote on anything it's already been decided okay so we're um on moving on on our agenda for public we have two public hearings i think here yes okay so ordinance number 39-26 an ordinance of the city commission of the city of delray beach florida amending the land development regulations of the city of delivery beach code of ordinances chapter 2 administrative provisions article 2.4 development application requirements section 2.4.2 application submittal requirements to add requirements for lobbyist disclosure and certification providing a complex clause and the severability clause authority to codify providing an effective date and further purposes this was the ordinance that was requested his commission directed i think commissioner cassell initiated it it essentially adds an additional requirement on a development application that's coming before the city commission to um provide a written certification um of any person that's identified as being retained or authorized at the time of application or during the application process to communicate with the city commission so palm beach county has a lobbyist registration ordinance it's done through the county this is just to memorialize it as part of the application so that anybody who would request that application would see that somebody's is listed as a registered lobbyist okay thank you so we have a present no presentation so this is planning planning board heard it on august 17th and voted six to zero to recommend approval okay uh this is a second reading and a public hearing are there any members of the public wishing to speak on this item okay seeing none can i get the motion sure motion to approve ordinance number three nine dash two six second second second do we call the roll on this one call the roll please deputy vice mayor margaret yes commissioner mullica yes commissioner cassell yes vice mayor burns yes mayor carney yes thank you ordinance 8b ordinance number 40-26 an ordinance of the city commission of the city of delray beach florida amending the community redevelopment plan for the city of delray beach finding that the modifications conform to the community redevelopment act of 1969 as amended to finding that the modifications are consistent with the city of delray beach's comprehensive plan and making further findings pursuant to the applicable requirements of florida statute 163.360 providing a complex cause of severability cause and authority to codify providing an effective date and for other purposes this is second reading okay thank you this board also sits as the cra so you have seen this before as the city commission you are determining that the plan before you is consistent with the act but also with our comprehensive plan the backup provides sort of the correlating policies that it meets and how it forwards affordable housing i believe this area is here and they're prepared to give a full presentation if you would like um ultimately this did go to planning and zoning board um on august 17th and it received a recommendation of approval with a vote of six to zero thank you so welcome CRA long time no see um this is a this is a second reading and a public hearing are there any members of the public uh wishing to speak on this item okay commissioner comments no i would just move it forward commissioner comments i think i'm good okay motion to approve ordinance number 40-26 second okay call the roll please commissioner malica yes commissioner cassell yes vice mayor burns yes mayor carney yes deputy vice mayor margaret yes motion passes thank you um there are no first readings and we have uh comments and inquiries on non-agenda items the city manager yes one very brief item one of the individuals who spoke via the public announced the zip code resident zip code of three three zero zero zero zero for the record there's no such zip code in the united states of america of three three zero zero zero so please be advised thank you thank you that that is it okay and so we that is all thank you are you at this time thank you city attorney no comments okay thank you and i think we have a presentation we have we're on to um city commission and i'm going to go ahead and recognize our deputy vice mayor happy to do it um commissioner cassell a couple of meetings ago asked about e-bikes and you know what's going on in the rest of florida perhaps in the rest of the nation and it's most of you won't know this but as a part of my commissioner duties up here i sit on the metropolitan planning organization it's a group that meets typically once a month uh and it's comprised of commissioners and mayors uh and deputy mayors from local municipalities and from the county so we have county representation too and we we typically use our sessions to share information we tackle issues but we bring a really good sense of cooperation and e-bikes has been on our agenda and after commissioner cassell brought up the question uh what i wanted to do was present just information on on e-bikes i'm not going to take positions today and i don't think any of us are but i just want to show you what the state laws are that we have to comply with i want to show you what local flexibility the state has given each of us and i also want to show you some of our neighboring cities and what they're doing with e-bikes this should take about five minutes and it's it's pretty informational uh once we finish this um this presentation mr moore is going to take the ball from here and the city's going to come back to the commission with a proposal on on e-bikes uh but again this will take just five minutes but you'll get you'll get a world of information from this if we could go to the next slide please yeah uh this is a little bit of an aha slide for most people uh standard homeowners and renters insurance almost always excludes e-bikes almost always excludes e-bikes and it's due to the motor vehicle exclusions which leaves riders and or their families personally exposed if they cause an accident and most people don't know that i will tell you yesterday i received this at my house this is a mailing that came from progressive insurance and right on the whole bottom half here it says get customizable e-bike coverage today so the insurance companies are very aware of e-bikes they know what's going on there have been a lot of lawsuits that have been filed around them most people don't carry this coverage and my my one caution to the citizens of delray is if you have an e-bike if one of your kids has an e-bike definitely talk to your carriers about it because you you're leaving yourselves a little bit liable if you don't get that coverage next slide please a little bit a little bit of data here there are three florida uh e-bike classifications for legal bikes and unmodified e-bikes class number one is is capped at 20 miles an hour and this is typically what you hear people when they say pedal assist so you do pedal to make the bike go but there is a motor to it that assists you in your pedaling class 2 is also limited to 20 miles per hour however class 2 vehicles have throttle that can provide power to the bike without any pedaling and maximum assisted speed of 20 miles per hour class 3 also has pedal assist but it'll allow you to go 28 miles an hour there are some state restrictions specifically the riders have to be 16 or older and they are very restricted from certain paths which we'll get into in just another minute in terms of designated bike lanes that we have all classes of e-bikes are allowed in designated bike lanes but the speed is capped by the state at 28 miles an hour over to the next and i i will throw in uh on on that previous slide we don't need to go back uh modified bikes oftentimes travel in excess of 45 miles an hour so they can travel very fast it's above what they're allowed to but if they've been modified they can go very fast so here's here's what we have to balance the state is telling us uh four things e-bikes have exactly the same rights and duties as a bicycle there are three classes which we just talked to motors have to be less than 750 watts and anything class three is limited to 28 miles an hour on the roads there currently is no license no registration no title and no insurance required by the state and as it stands right now uh e-bikes are allowed anywhere where bicycles are allowed including sidewalks now the the state the state has given cities some flexibility here um we have we have the right to determine uh what the minimum age is to operate e-bikes in delray beach uh government issued photo id requirement this is a hardship and considered in a lot of communities for people that would have to go get a government issued id um and a lot of communities are accepting school issued ids as well so that's something that we could look at uh cities may add a safety training requirement uh we can set up our own rules for streets highways sidewalks and sidewalk areas uh restrictions and prohibitions on e-bikes can happen on bike paths multi-use paths trails beaches and dunes so this is something that our parks and recreation team would need to look at um you know where e-bikes would would be allowed within the city of delray beach um and there was it's it's worth noting in 2026 state bill uh third 382 had proposed a 10 mile an hour near pedestrian rule so you weren't allowed to zoom past a pedestrian but that was voted down in in june of 2026 over on the next page uh the common require common rider require requirements that we're seeing in florida uh in our cities and in our counties uh the common uh age is 15 years old uh and that's a that's a common minimum age for class one and class two bikes on a public right-of-way and state law already requires that you must be 16 years of age or more uh if you have a class three bike um government id is required but again there is an option for uh a school id to be used instead uh on multi-youths youth multi-use paths 15 miles an hour is what the current cap is and there is uh there is a common rider requirement in florida that uh helmets are required if you're under the age of 16 and that's consistent with the state law as well so i know a lot to swallow a couple more charts um here's how some neighboring municipalities uh are regulating e-bikes um and you'll see as you as you go down the sidewalk column which is the second one on your left uh there are many many sidewalk provisions that that uh towns and municipalities uh are including there um and most are saying 15 to 16 to ride most are saying ids for state or either state or school uh most of the speed within the other cities and the counties are suggesting that we follow the state guidelines um uh and then over on the far right are some of the provisions that we're seeing uh in the town of palm beach the police chief can post signage uh and the town can require is requiring safety training in wellington um you know more of a suburban area than we are are um they are not allowing e-bikes to be on pipe on park in parks or on bridle paths they have a lot of uh horses up there and they they do not want the e-bikes near the horses um so they're excluding those and also you'll see they're also excluding gated communities in wellington so gated communities are kind of on their own on this um uh you know you'll see some parking rules that boynton beach is proposing i'll talk about parking in a minute and boca has largely been the most flexible if you look at what they're doing they're pretty much just following the state guidance they haven't really come in with anything that's particularly uh customizable so over on the next page you know these are again these are just considerations for delray and obviously mr morris team is going to take it from here again four pillars to the state baseline no license needed for class one and two no stage stage at state age minimums for one and two for class three 16 or older uh allowed on public streets and designated bike lanes and sidewalks shared paths and parks are left to local decision so what could delray you know what what will mr morris team be considering um should we allow e-bikes on sidewalks we have the ability to ban them citywide probably don't want to do that but we have the ability to do that um we could uh we could prohibit sidewalk riding and we potentially could add additional restrictions downtown uh e-bikes and parks i i did talk to sam meet on our heads of parks and recreation uh we will have to look at any and all of our parks to determine uh what we think the the right the right policy would be um and then you know there if if allowed a safe passing rule to consider a lot of our sister communities are looking at it if a rider uh is coming by you on an e-bike uh it would be good if they would slow to 10 miles an hour and it would be good if they could give some kind of an audible perhaps a signal bell just to let pedestrians know that an e-bike is approaching and you should be aware okay next slide uh where riding is commonly allowed and restricted around florida uh commonly allowed designated bike lanes on roads streets with speed limits of 30 miles an hour or less that's a big one you've got to remember that because we have a lot of streets in delray where the speed limits are higher and it's not commonly allowed for e-bikes to be in those high speed areas and designated multi-use use paths where it's commonly restricted in florida sidewalks which we've talked about some of the parks and rec facilities like basketball courts tennis courts football fields things like that and then the last thing here is a common complaint that that we get throughout florida which is stunt riding and stunt riding is basically when people are doing wheelies and and doing you know having fun as a kid would on a bike but creating a dangerous situation for other pedestrians and automobiles so stunt riding does carry fines uh scope and enforcement where would these ordinances apply uh local e-bike ordinances typically apply to public property and city regulated roads they do not apply to any private property hoas or gated communities so that they those communities would be left potentially on their own for how they want to handle it in their community um violations are typically non-criminal civil traffic infractions the penalties are generally monetary fines uh and it is expected that all riders understand all the traffic laws follow them including things that that we commonly see bikes not do which is stopping at red lights and stop signs um they are they are required by law to do that and of course uh no alcohol and no drugs uh we're just about the end here this is actually this is actually my last page um there is another concern that was expressed at the at the metropolitan planning organization which is about battery fires uh which brings into question parking considerations for e-bikes um i will tell you down at the bottom in the blue there e-bikes are statistically quite rare uh you get one fire for every 15 to 30 000 uh bikes that are out there what usually causes the fires it really the fire department will tell you it comes down to really four areas um parts that have been replaced that are cheap or uncertified uh broken management systems on unregulated voltage things like that uh physical damage from an accident uh and extreme temperatures which obviously florida um you know has has quite a bit of and the only reason i threw this one in is a lot of our sister cities are also trying to figure out where where we can park these safely and where we want them to be parked so this would be a consideration as part of what mr mr moore is going to be undertaking so that's that's where this the state is at that's where the city's at that's where some of our city our sister cities and the county are at and more to come from mr moore in the coming weeks agreed could i add to that agreed and sure thanks is that all that you have yeah and i just want to thank commissioner casal for bringing it up this this is very timely in the county right now and every you know it's a new to new thing and we're all trying to come to come to grips with it so okay that's it so we're we're at commissioner comments do you have additional comments that you wanted to make on something else i do not that's it thank you okay great thanks when um i brought it up and we agreed as a group that it would be good to go forward the city attorney sent us a a ordinance from wellington we're waiting to see if palm beach was going to create their own ordinance but they didn't but i think what i did is went through the ordinance the city attorney made some recommended changes and i think we instead of having the city make these determinations there's things that we have to figure out in this where are the pedestrian priority areas right correct riders should always yield to a pedestrian that's a bike rule that's not that's not going to change what is the speed on the sidewalk and it's different areas i don't think anybody should be downtown on atlantic avenue on these bikes at all period nor on the beach a1a area if you have one get off of it and walk it until you get out of the high pedestrian area because it's dangerous i think we should look at atlantic the beach area and pineapple grove no parks whatsoever um we also have to talk about um what the speed would be on the sidewalks in other areas for example if you're driving down lake ida road people use these all the time on the sidewalks they're going at quite a pace but there's really nobody on on there but these bikes and scooters so the speed limit is going to be different in different areas of the city we need to figure out what that's going to be passengers if the bike does not have is modified and it shouldn't have passengers passengers should not be on it and that's something we should regulate because people can get hurt um no bikes in playgrounds or sensitive areas at all um we already talked about high pedestrian areas are they going to be allowed and if so what speed but i think high pedestrian areas hop off and walk um and and a modified device these this um ordinance i don't know if you reviewed it but it's got all the the class one class two class three and a lot in it but again it applies to wellington so we need to make this applicable to our city but i think those are the things that the city attorney and mr moore should be deciding and i'd like to move it along because the consensus was months ago and there i'll just throw in one thing to add on to that you know a lot of cities have what we have like if you go down swinton avenue and you've got houses that are relatively close to swinton and they have a driveway and as they back out of their driveway there's bushes on both sides right and it is a total blind spot on the sidewalks and if a bike is if an e-bike is coming down at 25 miles an hour and a car is backing out there there isn't enough neither of them are going to see it in time and we're going to have accidents i i've heard a lot of heard a lot of that from more of our urban type streets where we have that situation you know less more freedom i think when you're more in the suburbs but the city the city has some some situations but the same is the case for a walker and a biker and i mean there's only so much regulating we can actually do but at the end of the day the point of this is it's becoming a nuisance downtown in the evening and it's also you know you fear that someone's going to get hurt so as quickly as we can move it along i'd be thrilled thank you so thank you for that educational thank you um thank you for your comments um so chief hunter and i actually met about this um with his team and just just to be clear florida statute does we are preempted except for certain things and those certain things are we can establish a minimum age requirement we can establish um the requirement of of a government-issued id and then we can require um training so i think could you say the third again training got it thank you and so i think what we need direction on is one what what is the age do you want to keep 15 do you want to do 16 where they would actually have a driver's license do you want to make it 18 um do you want to require a school id or is a government issued id sufficient and then do you want to require helmets um we can regulate helmets as well so we can say if they're under 16 they need to be wearing a helmet or any age really so you know chief hunter i'm sure if you call them up he has some thoughts we were pretty much in line as to what we were going to recommend to the commission you can give us the freedom we'll bring forth an ordinance if you're not happy with what we drafted you can recommend suggested changes but you know we're ready to go okay we're preempted by what from what rather um basically from everything else so we're preempted to say we cannot have them on sidewalks downtown so the florida statute yes because technically the way florida statute looks at these electronic bicycles is they they carry the same privileges that a regular bicycle carries so you know if a bicycle can be on the sidewalk then these could now as commissioner markert said there was a bill that was presented that talked about you know miles per hour i thought i think i thought it was 10 but whatever it was and then you'd have to have a bell and signal to people candidly that's not going to work in downtown right we have sidewalk cafes we have very constricted sidewalks to begin with so you know that we can if the commission is inclined to want to find a way to pray with that we'll look at it right um but i'm i feel safest regulating the three things that i mentioned the stunt writing is already regulated by florida statute it's called careless driving um the reason why you might want to require the age limit to be 16 is because if someone is underage then it just makes it makes it more challenging to cite them right because they're they're not of age they don't have the proper licensure at least if they're 16 you know they've gone through driving school they've taken a driving test and it doesn't mean they can drive a ride a bicycle but at least there's more assurances in that in that manner so i think that's just what we need the direction on um i think we spoke with sam sam's of the position i think you should not be allowed in parks right um and so i guess the most important thing is you know what age do you recommend if there's no recommendation from the commission 16 would be my recommendation i would agree i mean i think six i think 16 to 16 is the right age because they they're required to get a license i mean there's a lot we can do at 16 years old by the way i think wellington's a pretty good uh ordinance it's a good guide for us right thank you uh chief can i just get did you it was your recommend recommend at age 16 as well you don't have just yeah 16 chief wanted 30 just okay thank you well i'm inclined to go with the city attorney's uh recommendation and it seems like all the commissioners are inclined with the 16 a 16 i'm i'm okay with that i'd like the helmet also miss burns and i think the school id is fine i don't think they have to have a valid driver's license at 16 either one what's that in the three items that you describe and the helmet okay state law it's 16 it's an option right 15 it's a must what do you mean what do you mean for a helmet i i think yeah i think you don't need the helmet right you don't need it for a motorcycle correct helmets are under so so if it's preempted we can't no she said you could choose the age the school id or not or the helmet and i would say we do the helmet to operate an electric bicycle let me double check the helmet because we might be preempting okay what are we doing all right so do you we're establishing the age and we're establishing if they must possess the government issued id or if you're okay with the school id and then and then we can look at the other ordinances and okay so you're going to bring something back to us and then we say we approve okay that's how how does translate into scooters or it doesn't that's a whole different deal the electric scooters we have a definition for electric bicycles that's already in our um code under e-mobility devices so we kind of almost essentially lump them together i should for lack of a better word are they lumped together or they are not in our in our code of ordinances they are lumped together micromobility devices are defined as motorized scooters bicycles and electronic bicycles okay so we are we already have a framework for this right it's just a matter of adding these additional requirements so like my 11 year old granddaughter has an electric scooter kids that's what who rides these things are most of them do my grandchildren have them as well right 15 year olds i bought it huh i purchased it okay all right good grandma yeah yeah but so yeah putting i mean i would recommend going with the state's age requirements on these things my grandchildren 17 by by the way anyway okay oh my 11 year old lives in denmark so we don't have to worry about her hitting you guys all right okay okay so we have our direction yeah thank you largely no id i'm not into the government issued id myself particularly because i see people getting to and from work on their scooters who may or may not have any kind of government issued ids well the reason they need an id chief hunter can talk about this is if one of the one of our law professionals stops them we have to we have to be able to get an id from them and i've talked to some of chief hunter sergeants who've stopped people who are very young 13 14 years old and what winds up happening when they do something bad is the the officer has to hold them until their parents can come down and talk about the situation and that can tie up our officers for three hours you can imagine somebody's at work and they got to come down and you know so so having the idea the idea is it's important but i think on the mpo most of the cities were saying it's too much work to get a 15 year old to go down to motor vehicle or wherever to get the license and the majority of the cities in your examples did not have it yeah did not have it correct okay you have direction correct okay thank you did you have any other comments no just that if the helmet is permitted i would say helmet is a must for sure okay thank you i'm referring to your end of meeting oh i did have comments okay um thank you i apologize i was not i thought you were referring to no no okay i'm just going to say it subculture it the the pictures reflect a problem and here's the problem that concerns me the two gentlemen over there mr richwagon i believe had called a tow truck at one point to tow somebody because the guy was parked in his parking lot the gentleman um came running out almost ran mr richwagon over and then mr richwagon has to pay the tow company and i just i feel like we have got to find some kind of a solution here because it it's tiresome having the complaints coming in regularly and it's also concerning to because what is being told to the public is this one individual in this one place bless you mayor is not following the rules and doesn't have to that is not the message we really want to send to everybody so mr moore you have to come up with a solution if this gentleman is not in violation and he is having these events then the city needs to follow its process and procedure and address that but there's definitely something going on here that is problematic and i'm really frankly tired of hearing about it honestly so if i may vice mayor thank you i will be offering a an update during next commission meeting on a subject so i look forward to that and that will involve appropriate members of the team to get us to the place in which we should be thank you thank you um and then my other items are oh sugar i had a slip um holy moly i have a piece of paper danielle got an award oh gosh is it cfee certification and i wanted to congratulate her where are we at with the financial development committee this budgeting committee is it up online for people to sign up it is ready to go and when are we going to be selecting from that because i i have some people that i think are would be great candidates madam vice mayor yes to be recognized yes so the selection process is currently underway so the opportunity for individuals to express interest in that regard being facilitated by the office of the city clerk via online as well as contacting the office of the city clerk so the opportunity for commission to consider appointments will be forthcoming in the coming weeks okay there's still an opportunity for people to submit at this point in time i believe so yes okay we should make sure because i don't i didn't see that publicized anywhere i didn't see anything on it i even searched one day i think i want to say a week and a half ago and couldn't even find it i just had a discussion with leadership of the office of the city clerk to make sure that we proceed in a timely manner to get that up and running okay now that that budget has been adopted we should proceed beginning in october which is where we are now so those opportunities will be forthcoming would you just shoot us an email and let us know when it closes so that we can um encourage people who we think are qualified to apply yes ma'am and then um okay danielle pearson at cfee certification congratulations danielle pearsley not pearson was it pearsley i thought it was pearson pearson i'm sorry yeah yeah it is pearson sorry thank you no that's fine thank you um okay and then uh this 500 bill from public records i just read that and i understand that because that request was a lot um but i suppose as we start to with respect to the graveyard and that as we develop information regarding the possibility of where those individuals maybe we should share that maybe free of charge um the rest of the i know that the records request i read it lynn it's extensive it's it's really wait i mean i i understand i think that if you're making a records request you have to do a small request in order to get what you want especially free of charge but with that statement being made publicly i think it's fair to let the residents know why that charge was so high and it's because it's it's a completely extensive request it seeks documents from pd they want she seeks body worn camera footage which we just can't release and it takes hours to redact so i mean it's not as if she wants to clarify her request and and minimize it yeah we always entertain that but i'm not disputing it i just like public no i appreciate that that there's a reason why that and if that amount was put out there and it's because the request was very lengthy okay and my last thing is i just want to address what happened at our last meeting you know during our discussion about the millage rate i made the point that when this commission votes to approve a contract and raises and other expenditures we ultimately pay for those decisions in the budget and we have to responsibly specifically i referred to the wage increase for the police collective bargaining agreements which you know are expected to increase the cost of the current fiscal year by according to the agenda cover sheet 7.7 million in the fiscal year and i'm not disputing that that's not worthy i voted for that wage increase i don't have a problem with it but the point is our votes up here every meeting collectively become our budget and at time to vote for our budget we have to do that responsibly and the one thing that became frustrating is i brought that up and the mayor said that he did not vote for those wage increases he said i wasn't telling the truth to the taxpayers and i responded by calling my liar and i will say the exchange was not a shining moment for either of us and i wish the discussion had remained more respectful but the record should be very clear because i went back and checked the record that um miss our mayor voted for the wage increase both at impasse and and i like that in the public record and at the um next phase both he voted on august 21st page six of the minutes shows the vote and subsequently voted to ratify the contract on september 15th and the reason why i'm bringing this up is because it's important that residents be able to trust what we're saying here on the dais and when we're talking about budgets contracts wages millions of dollars or anything else the facts do matter and i don't want to ask residents to take my word for it i'm just asking them to look at the official record because it's clear that i what i was saying was accurate and my point has never been that one vote is better or bad the point is when we vote to approve spending we get to the budget time we just have to pay those bills and i'll always own my votes i'll always explain my votes and i'll provide residents accurate information from the dais and i expect them to hold me accountable to that and i believe every member of this dais should be held accountable to that same standard thank you thank you enter that into the record for me with the attachments um um i am going to you already okay can i take the mayor get the mayor sure yes mayor kearney you have uh comments for your closing comments um i i have a couple of comments i'm not going to get back into this whether whether the vote to ratify the contract which we were required to do by law uh meets the same test that uh commissioner fasal is saying because it was clear when the city attorney brought it up last time that we were required to do it the fact that you want to vote no and maybe put the city in a position of having a lawsuit that's just a way some people do business that's just not the way i do business i certainly made it clear that i didn't support uh the the uh the contract but that i had to vote for it because we were told by the center the city attorney said it was required so i do think that i'm to that we're required to do but let me just get to a couple of couple of other points um uh with respect to the the workforce development um task force i think that i would like to be able to have i mean i i'm hearing that they've been having a new number of meetings already uh we have not been informed as a commission about anything that they are deciding and i know that um commissioner sal always likes to to say that you know we should be informed about what's been going on so i do think that we should be getting as you have the meetings there um reports back as to what is being discussed so that we as a commission who are actually setting the goals uh for all of the all of these task forces have some general idea as to what is being discussed and i would also say that if members of the commission and because i know for example commissioner burns has expressed a great interest in that in that subject what would like to attend those task force meetings that the commissioner should be allowed to to attend those meetings maybe it means you have to notice that there's going to be one or more two or more commissioners there but i do think that um because it is such an important point uh commissioners ought to be able to to go to those meetings um the i want to revisit something uh i mean i the what commissioner malica brought up with on the on the agenda item she pulled with respect to dedications on the one the ones we were doing right there you know i i i had some questions on it but there was a lot of them there so i didn't really focus on the it as a thing as a as that particular policy but i do think that the policy of the city with respect to um requiring dedications needs to be looked at because this is not i mean i i experienced it when i was practicing in front of the commission here um and when all of a sudden they said well we want you to do a corner cut we want you to do this we want you to do that i do think that we need to sit down um and have a discussion about these dedications because it is taking land away and sometimes it does affect what someone can do to it and i and i and i and i i i i'm going to ask the the city manager to to to set up something where we can all be explained what these various things are so that we can question them and see whether or not any of these need to be modified based on what we think uh these dedication should be because staff has generated them i'm not saying they're not necessary but i just think that we have to have a better understanding of when a a property owner's property who they're trying to develop it is going to be somehow some to some dedication which could affect the property lines and this that and the other stuff so i i i i i would like to see that happen um and i think commissioner malica probably agrees with me because she she raised the issue as it related to that one item uh which were easements but it's still the same theory it's still dedications um and lastly um i i think that i i i i mentioned it briefly i do think that there are several ordinance out there wellington is certainly a very good ordinance as it relates to um these bikes because we really do need to get um these bikes under control um right now by the way i don't have to wear a helmet when i'm riding a motorcycle which i think is a crazy rule um so i don't know how the helmets are going to fit in but i certainly think if we can get helmets we ought to be able to uh i'd like to be able to assist on it particularly you know 16 year olds anyway that's all okay thank you commissioner malica thank you so much um first i didn't get a comment thank you very much for your e-bike presentation and all the work and research you put into it so i appreciate that i credit the metropolitan planning organization great organization and this is the kind of work that they do and this gets out to all the commissioners in the cities and it's sort of an unheralded organization that brings great value i herald it right now i'll let them know and thank you again proclamation i know and also i wanted to um have a shout out for the public safety open house that was this past sunday from 10 to 2 at the fire station it was very well attended very good what was it saturday it was saturday you're right sunday was church saturday was open house thank you for that got it and then also i wanted to compliment um chief hunter and his police force because i had lunch on atlantic avenue and noticed some of the big trucks getting pulled over but i think that when citizens see a police presence in downtown it makes them feel good it makes them feel safe and i thank you for that department's diligence and i brought up in the september meeting um the possibility of having our auditor um take a peek and she's like oh take a peek at um the difficulty that we're having in the cemetery and i went to the presentation the public presentation that kuhn i don't know if i'm pronouncing it right keeney huh keeney who knew with that spelling it doesn't spell that way with keeney and he first of all i have to say he did a very very good job with a lot of public with a lot of different input but he indicated that it would be a really good idea for an auditor to get involved because that is not within the scope of his work he's going to be bringing back a lot of suggestions to the city but auditing some of like where those um where people are where they're not or what's been purchased and what has not is beyond his scope and i think it's very well within the scope of our brilliant city auditor so i would like to again ask for commission um consensus that we could guide our auditor in that direction to help us solve a problem that we have in our city and that is um the cemetery what do you think city commission i support it i think that the auditor's got great skill set and i'd like someone with that caliber to kind of go through all the books and records because maybe they could sort things out and then i i think it's certainly deserving of of of our full attention i agree thank you let me ask a question do you mind judy if i just ask mr moore isn't the organization that we hired going to work through that they're not not an audit not the specific details to that effect they'll come back with aggregate recommendations and so forth i'll have a status report report available by the end of next week however the intricacies of what's being described in that regard that would not be their role and function so i think we do have a consensus i didn't um mr marker i don't know if you had no look listen i i think the the cemetery issue is one that everybody up here feels bad about there's nobody that can feel good about this situation and there's a lot of work that has to go on i do want the community to know we are taking this seriously and if this is a step that could help us uh move it along faster and make it make the process um more efficient i would i would be for that thank you yes okay and that's all i have okay thank you i already lost the bet by the way no i you lost the bet i had a bet on how long the meeting would go and i lost it oh good okay so i estimating my time uh so i i have a couple of things one of them um i wanted to just uh i you i don't usually give a the um a summary of the league of city meetings i attend most of them i don't attend ones that are way way way north that take me over an hour to attend but i do go to the ones within an hour and this last meeting that we had on september 23rd was very interesting of course the topic was um the florida amendment three and it's um a potential impact on local government and property tax revenues there was a panel with the tax appraiser with the tax collector uh representatives from the city of um west palm beach and the as i said the the focus was on the the potential impact on local government and the in property taxes and so a significant amount of it expressed uh by the panel was that the amendment does not specifically uh protect funding from services such as police fire rescue and we've heard that uh here um from our own mr moore and and staff uh but they stress the distinction between education and advocacy um they stated that local governments and elected officials were advised that they may educate residents about how the amendment could affect municipal budgets and services but should consult with the senior attorney or county attorney on uh legal limitations on what they can say publicly uh concerning this and one of the the panelists agreed or they all agreed that uh one of the greatest challenges is public misunderstanding that some residents believe that the amendment would eliminate their property tax bill entirely which is not the case and um the i know that the tax collector uh uh distributed a um white paper that uh talked about the the amendment uh very informative meeting and um that was what happened at the last um league of cities meeting the other item that i wanted to talk about was um mr chart brought up the fact of that uh needs assessment uh and market study that we heard on september 22nd and um i think that we all can agree that the presentation did not meet the expectations of the board and and for me it was rather disappointing um i remember i think that we were all under the impression that we would be presented with a report outlining the best use for the campus um and mr moore indicated that those recommendations would come um at a cost of an additional fifty thousand dollars now i think i know that after a conversation with mr moore that that has not that second amount has not taken place and so i wanted to propose that we um and mr chart wasn't the only one i've gotten a few phone calls and people interested in um a task force a task force commissioner market another time another task force consisting of resident stakeholders city partners and organizations um to come up and provide uh this this information information for the commission so i would just like to get consensus from my colleagues and i'm sorry to not keep turning my head here um to to move forward with not following through with phase two which would cost the additional money and then direct staff to bring forward um a task force discussion at a future meeting how do you feel i would i would agree with that i think it was citizen-led in the beginning and i think it can be citizen-led now even while it's still there's still some contentious opinions out there i think for the most part everybody wants to come together and move forward so i think that's a great idea yeah to do that you know like a time frame right like the workshops you know we we workshop this to death so yeah we can't work i mean to move forward so if how do you feel about it well i would just throw out the the one thing that i would be concerned about is i think old school square has a lot of history a lot um and there's a lot of a people a lot of people in town that have very distinct opinions of course and and that that's perfectly fine but what i think we need to get to is to have a full analysis of all the options and then reach the option that's right for delray beach and you could already tell from some of the comments people have already made up their mind what the structure is going to look like and we haven't made up our mind what the structure is going to look like sure could be a 501 c3 could be run by the city could be run by the dda there's a million options and people are already jumping to the end without going through the process and i we can't do that it's too important to our downtown it's too important to our our citizens and we have we have to come at this really intelligently and and really from a neutral standpoint so that we can get a really factual decision not a decision that's based on somebody's personal agenda or needs that's the only the only thing so if i'd be okay with a task force if we could find a way that all the all the factions are neutralized this is the kind of thing in the corporate world where we would go hire mckinsey uh because they they would bring that neutrality to to the problem so i think i think we have we have to weigh that can can we i'd rather not spend the money but at the same time i think we we got to get to a good intelligent decision at old school square and it cannot be based on someone's personal preferences well i i agree with that enough personal um mayor do you have to you want to weigh in on that i mean look i i mean my my overall view generally speaking with old school square and things like that it's a government whether it's the dda or the city of delray beach should not be programming entertainment venues so at some point we are going to need some kind of umbrella organization whether it's a 501c3 or whatever doing it so i mean i do think we need to look at all of the options for example i mean i think that we have you know the amphitheater could we have a separate group running you know programming the amphitheater i think there are there are some separate things that we could do to look at to try to maximize the value of the place because it's it's running fine and they got people they're doing it dda's working hard but the entire campus needs we need to really take a good strong hard look at what we want that entire campus to look like so i'm i mean we we're we talk about workshopping everything to death we need to get off the dime and do something there and and i and i just don't think government should be running so are you in agreement to move forward or so did i get your consensus or no on a what's it called the work uh task force to move forward with so are you in favor of moving forward with the task force or not in favor are you asking me yes i am i'm in favor of moving forward with the task force thank you commissioner cassell i i i don't object to a task force but i think it's premature in that we don't how how do i know who i'm assigning when i don't even know what the heck they're going to be doing i mean we we need experts there's no disputing the history of old school square and its value to the community we all wholeheartedly agree the question is what is its potential going forward and none of us really know that do you do we want to go back to what it was before do we want it to be bigger do we even know what it could be the whole idea of the study mr moore and the reason why i was extremely disappointed during the presentation is i thought we were going to be getting the second half that information and that's what we need i can't assign anybody there until i have an idea what they're there what we think they're going to be doing i mean we we and we can't keep asking people to engage with us and then be running in circles and not know where we're going so at some point i don't know if this was the right company choice or not i think that um when we met with the dda and we did that joint workshop there were there are companies out there that probably specialize in this and some of that history we already had all that information from the dda so i feel we wasted money and i don't necessarily want to waste more money but i don't feel like we've gotten to the point where we need to be i i don't know how to move forward with that facility okay so if i could just if i could just jump in for one second i mean i don't think that i i don't think they told us anything we didn't already know of course they didn't right they didn't that was the issue of that we spent 50 down i mean and we all knew that so i i nice mayor okay let me let me just restate the dilemma that i'm hearing but mayor were you finished i'm sorry i don't like to cut people off were you finished yes yes yes okay thank you so what i'm hearing i have three cons i have the vote to get the consensus for the for the task force however i'm hearing that we need something in addition to the task force which is the expert opinions on moving forward so is there some hybrid solution that you have miss madam vice mayor ladies and gentlemen i would like to make a recommendation given the feedback of course we are not continuing a relationship with web management i mean i think that's clear i think everybody's in alignment in that regard and working with a task force environment this will become a november 2nd city commission regular meeting item i don't think there's a need for a workshop we appoint the task force so the city commission appoints a task force to help us define what the next steps will be and what the vision and considerations would be available that would be a continuous rolling process i don't think anybody's in position to define an individual framework above and beyond the commentary what we already know so to speak nevertheless i'd like to begin with the november 2nd regular city commission meeting to begin the process of defining a framework in terms of what that looks like okay could i ask a question yes thank you i need to understand something though because this company came highly recommended and i'm not i'm not assuming that they don't know what they're doing but i'm questioning did the contract not really did they not understand their task at hand and i don't want to maybe i have to call missy up to answer that question because hold on okay the city attorney is holding her hand up so maybe she can answer your question the contract was clear you know they they gave you a proposal and he actually delivered everything that was in that proposal except for the report so the report is pending the feedback that he received from this commission and that's the last thing that's so i don't think it's fair to say that you know did we get our money's worth because that's actually what we asked them to do now there was no phase two mentioned in that proposal and that could have been a verbal conversation with staff but maybe we wait to get that report and we direct mr moore to get us that final report so we can close out this contract and then maybe based on what's in that report because he's supposed to make recommendations um maybe from there that's what you can base your task force on okay and that's where they can get their direction sounds good so on that note madam vice mayor if i may be recognized yes november 2nd november 17th let's get that squared away so the item relative to a task force consideration will be accompanied by the report that miss jillen just summarized in her comments i like it thank you thank you miss barletto i think she wants to speak would could miss barletto did you want to speak you don't have to if you don't want to because the decision has been made i know the decision has been made but i did want to clarify okay that web management did provide us with a a two-part um a two-part proposal right and the pieces that that we all read we all heard in their presentation that we all already knew uh-huh they had to go through that part to be able to give you the extra pieces that that tell you what the options are for that for the rest of the campus so that was the way that they they viewed that and um it wasn't that they they wasted money they interviewed 50 people they put a lot of work into um looking at the entire environment for entertainment in the in the community and we of course live here we we experience it on a daily basis so yeah so a lot of what they said is when he said there's more to come is there still more to come from the report the report that miss uh that is the phase one piece that was the research part of it and that's and now the the other piece of it which you know i'm assuming that you do not want to go forward with is the analysis of that research and recommendations but contractually only phase one is in that agreement that is correct right so and that ends with the report yes ma'am thank you so madam vice mayor if i made the direction finalize the phase one report that would be the catalyst to proceed with the task force to begin an initial framework to get us to where we should be thank you so that is anticipated in the next few weeks or so so we'll tentatively plan for sometime in november either the second or the 17th miss parleto and i will be in touch to get the tail squared away and i think i'm comfortable okay thank you just for mr moore's edification it's he's supposed to deliver a report with recommendations for the optimal facility concepts for old school square yeah so we can work with that and that's our logical framework correct thank you thank you thank you thank you madam attorney i wanted to um also include in my comments uh a thank you to all of the um residents that came forward tonight um i heard the disappointment and the concern expressed about the tone and conduct of our last meeting and i and i take those concerns very seriously um so you know residents should be able to expect their city commissioners to conduct public business with professionalism fairness and respect um we can ask difficult questions challenging uh challenge recommendations and disagree strongly while still treating uh one another and our employees and the public with dignity so i just want to say to my colleagues tonight thank you for your cooperation um i hope we were we get an a today maybe a minus uh for ma'am you're on a tight ship we were scared to misbehave uh it's just firm it's not don't be scared don't be scared um and the and lastly i wanted to uh commend mr wise yet again i i um commended him and mr andrew um haynes at the last meeting for helping out a resident who were missing her loved one uh at the cemetery and so we had the meeting on september 22nd um wednesday last wednesday september 30th september 30th last wednesday right see i'm not good with numbers like you are um but anyway um i was very satisfied with the consultant and how he conducted the meeting and received all of the comments from everybody that were there and look forward to him uh concluding his um investigation and i already said that i agree with the audit um that that is needed however at that meeting i mentioned to mr wise uh not expecting anything i just said well you know while you know while you're out there you know my father's been missing for a long time my father passed in april of uh 1974 and my family and i for years asked the city to help us locate him and we were told too that you know there was a flood that came and gravestones were moved around and things were not not where they were originally i'll say it like that but i knew the general area and i looked for years my family looked for years and we could not locate it um and then recently maybe five years ago i've tried again no no luck well i mentioned it to mr wise on that night and lo and behold i got a call from our administrative assistant the next morning and this man found my father's burial site amazing to me there is no headstone there of course but he used some um uh old old documents to find the location and you know a lot of the markers are missing broken or whatever but he was able to locate my father after all these years so i will be also placing a headstone on my father's grave site and so thank you mr wise again yes that's it good job any other comments no i'm good he did he's good he did that presentation all right meetings adjourned and thank you thank you everyone
