of notable persons from our community who have recently passed I'm going to first go around the dais to see if we want to recognize anybody commissioner rogers go it's okay from the city of lauderdale lakes a dear friend I called him one of the three musketeers that got me to where I'm at today because I could always leave lauderdale lakes up to this man and I got the votes that I needed from that so he has recently passed he has served on the parks advisory board at the city but he was a community leader and I just want his family to know we miss him and there's nobody like the musketeers I thank you thank you let us all honor the brave men and women who have served and continue to serve in our armed forces both here and abroad and thank them for their service and like to pause a moment honorable tracy ramsa bar managed mannet okay i tried okay council general consul general consul general of the republic of trinidad and tobago cg please stand i'm going to give you an opportunity to speak and of course mrs angela j rose howell officer in charge consul general of jamaica in miami and of ladies i know we have one minute for you to do a welcome i introduce yourselves welcome welcome mrs tracy the board of county commissioners for inviting me to address you in my capacity as the newish acting consul general of trinidad and tobago having assumed back in july 2026 i am stationed in miami-dade county but only by tradition and obligation the vast majority of my community is right here in broward county and increasingly every day my heart belongs to broward county as well in trinidad and tobago and i believe it's widespread throughout the caribbean too there's this proverb when it comes to relationships usually romantic relationships and it says like who like you or sometimes love who loves you and that piece of advice is usually given out when a wise auntie or uncle observes a young lady or a young man investing all their energy and time into someone who does not reciprocate because sometimes we do dumb things like that i know i've been there but there's actually some wisdom in that little caribbean proverb that extends well beyond romance relationships flourish when there is reciprocity where people show up for each other where interest is genuine and where you don't have to force the connection i have been in south florida for just shy of four months four months and broward county has shown me again and again that trinidad and tobago does not have to force the connection here trinidad and tobago feels valued in broward county i've seen it in the way our national celebrations and traditions have been embraced i've seen it in the willingness of elected officials and community leaders show up participate and engage with our diaspora and i've seen it in the pride with which so many trinidad and tobago nationals have made broward county their home while continuing to contribute to the cultural and economic life of this county and i don't think i have to tell any of you that this year's carnival was broward carnival and i'm still not sure why anybody was calling it miami broward carnival but we might have to fix that next year so as i consider where the consular general should invest its energy in the years ahead i keep coming back to that very simple piece of caribbean wisdom like who like you broward county has demonstrated that it values trinidad and tobago my commitment is that during my tenure we will make sure that trinidad and tobago continues to show broward county that the feeling is mutual thank you very much thank you and council general thank you we hope to take the inbound and outbound trade mission out of broward county i know you felt our love okay although it was in miami you felt our love so we want there's any polls um i'm going to start on the right side here with commissioner davis mayor can i just clarify that the item that was moved to consent was item 49 was also moved to consent i'm sorry say that again item 49 was moved to consent the reading clerk misspoke so just wanted to make i know 49 was moved to consent yeah that's what it says okay okay um i'm it i'm a little confused it says on here it's moved to consent she misspoke when she read that she said 29 instead of oh i see i'm sorry okay i'm sorry commissioner davis any polls you're sure you're dean senator rich uh yes um item 7 and 10 for an abstention vice mayor no lamar steve item 24 and also show that i'm oh commissioner rogers okay item five okay give me one second which is the item uh on the data centers lamar which is your item on the data centers what number 40 uh i'd like i'm not pulling anything i'd like to be shown as a co-sponsor on item 40 as commissioner rogers is also shown as a co-sponsor on item 40. i'd like to as well and commissioner fur is a co-sponsor same here and senator rich is a co-sponsor and and and senator geller is a co-sponsor commissioner uddin is a co-sponsor okay and and and monica saparo is a co-sponsor i'd like to add chris nelson is a co-sponsor chris co-sponsor beautiful okay we have commissioner geller poll 24 commissioner rich seven and number 10 commissioner rogers number five and do we have any polls from the public mayor we have one poll from the public item 40. item 40 public poll okay you want to give us the motion please uh the consent agenda are items one through 40 adding 49 and 53 minus items 5 7 10 19 24 and 40. uh 19 it was a withdrawal next year was withdrawn okay yes i'd like to move approval of the consent agenda we have a motion or a second to move it i have a motion and second all in favor any opposed show that passing unanimously and let's go with uh we'll start with the commissioner rogers item five item five is a motion to approve sixth amendment to the agreement between brower county and wsp usa inc for transit system-wide study planning and preliminary design no members of the public decide to speak on the item commissioner rogers okay thank you um mr mayor and colleagues reason for me um pulling this item is to offer uh say thank you because they have achieved the goals that we set for the cbes goals under the agreement that we have and i think it's important that we recognize these commitments to include local businesses in their in the county from broward county in their work and that is important to us that's the reason for the cbes and if we're going to be deviating and not living up to the the letter of the law as it relates to the cbes then we're doing a disservice to the reason why we have that program so i just wanted to commend um wsp for living up to that agreement reason for pulling the item so thank you okay can i have a motion on number five i have a motion second number five all in favor aye any opposed shall item five patenting passing unanimously um commissioner rich number seven yes thank you um i serve on the boards of the brad behavioral health coalition uh which will be impacted financially uh if item seven is approved i also serve on the board of the area-wide council on aging which will be financially impacted if item 10 is approved i do not receive any compensation for serving on either of these boards and therefore i have no actual statutory voting conflict however to avoid the appearance of a conflict i am abstaining on seven and ten and ask that this be reflected in the minutes okay do a motion second i have a motion and a second to move item number seven all in favor aye any opposed show that passing eight zero with one abstention okay senator rich number ten i did both at the the same time oh you did both of them yeah okay motion and a second on i'll move item 10. it was that we already did okay so okay so i misspoke so i'll to let the record reflect that it was both seven and ten that we all voted on and approved is that okay council that's fine great thank you item number 24 commissioner geller thank you mr mayor members i just i this is a motion to set for public hearing so we can save the bulk of the debate for then but my this is an item that we have debated and i think it we're we'd be coming down on the wrong side this deals with the qualified vendor lists under the current law um if you are a cbe you get a broward based you get a certain percentage uh preference under if this passes as long as there are three um qualified vendors on the library or something like that they can charge 50 percent more or double what a large national contractor or somebody or a large vendor would charge i have think we have two separate uh responsibilities as county commissioners on the one hand we do have to encourage our local small businesses but we also have to be prudent stewards of the public tax dollar and i again we can have the full debate on this at the next meeting but i wanted to call everyone's attention that this is here on the agenda because i would uh at i'll vote for it today because it's just setting it for public hearing but i intend to vote against this at the next meeting and speak at greater length we should not be if it's a bid is 50 percent or a double we should not always be going with the um small cbe so we can discuss this later but i want to make sure everybody saw this okay since this is sponsored by commissioner davis i'm going to let you uh thank you um you know you brought it up and you know you said your piece so i'm going to say mine and i would also love for uh the uh honorable state senator to be corrected on his notion that somehow the cbes are charging 50 percent more or even 100 more than what is required to do a job and so for that particular portion i would like for uh administrator to um allow the procurement director to tell us when it is that ever on the qbls we've only had there's only actually one established for cbes for accounting services in the past there's one for marketing services which was never used this is a very small section uh where we are considering if you you have three cbes who are uh county certified businesses that they'll be able to compete amongst themselves but the notion that somehow a small business is going to charge exorbitant amounts over uh something that's already published that they have standards set for the particular procurement is preposterous so i would like for the procurement person that you have to explain has this occurred is this are there safeguards here mr gleason if you could if you might be able to um share um some information on the number of qbls and that are cbe reserves if you have any data handy and if not we can certainly get back with data i'd have to get back i don't have that data right now but we can certainly do the research that's necessary to corroborate it's just a general question when you had only one qbl and it was accounting and that was done a few years ago uh were the prices exorbitant over the asking price you don't know that in front of me i can't say but they were awarded correct i would say that all of the prices that are offered are compared and we do a price analysis and a cost analysis against prices paid before prices paid against similar services and commodities so there's a price reasonableness metric that we apply uh in in every case not just this but in all cases right whether there's cbe or non-cbes yes ma'am they are subject to this particular rule so i i don't know why this is this is an issue nobody's going to charge if something is 10 cents nobody's going to charge a dollar uh excuse me yeah well i got a cue uh did you want mr rogers no yes vice mayor the procurement gentlemen you come back for a second because i'm confused and maybe staff can clear this up morning vice mayor the statement in reference to a cbe a pool of offenders being able to charge this amount of money is that a true statement i'm sorry charge what is that true being able to charge 50 percent more or double the price of a large firm i can't say yes or no until i have all the prices that were paid uh how about past how about past practices i'm not aware of any past you're not aware of any past practices where a cbe which is our small business folks charging 50 percent or doubling their fees to compete in a pool that was already um categorized for them to compete in because they can't compete with the larger companies or vendors that we have here at the county i'm not aware you're not aware of it thank you so much sir mayor anybody else want to speak on this item thank you okay yeah i i definitely appreciate the the the push to try to make sure cbes get their fair share i think we all i think everybody up here wants to make sure that happens we're i think we're in general trying to help the little guy and little businesses to get started but i do think that having that checks and balances makes sense and i think knowing that that some larger company just because they know that they can might be able to get lower that's going to kind of hold it's it acts as a check and balance in general and i and i agree with you we do have two two things that are going on here we're trying to make sure the little guy gets the but we're also trying to be um wise and in the way that tax dollars are dealt with i think this provides that and you know i think it's still there's plenty of room here to make sure that the the small business gets the job so i'm i agree with i i don't think this is would be good policy i think it would be better to stay with the way that we had it it's it's i thought we we worked on this a long time um many quite a few years ago and kind of had this whole battle on this and found this kind of sweet spot that i think we're at so i you know i i i'm i think i have a tendency to want to keep it there what i like to do is as council just for public sake um right now before we pass this right now we're gonna just instead of using the word cbe we'll use big business small business right right now what is the ordinance that has to do with when small businesses apply and a big business applies for some type of procurement here can you explain how that works okay so um you know we're specifically dealing with the context of the of a qualified vendor vendors library so what happens is that the board uh approves a qualified vendors library which is a pre-approved group of vendors right that you can use you can use five vendors it's a pool and if we need a small contract um staff will request a bid from those you know so if say there's six vendors in a pool they ask for some bids however many of them who want to can apply and could they submit their pricing and so and what we do now if it's a mixed cbe non-cbe so big business small business um pool so you have two big businesses four small businesses then um they all submit sometimes you only get three cbe so we have the small businesses submitting and only one of the big guys so it just you know we never know who's going to submit then um currently our ordinance depends on the pricing so this will be a a small pricing these will be generally smaller contracts so if the if the small business if their pricing is a little bit higher than the big business but it's within five percent then we would apply we then the the the small business gets the gets the opportunity gets the con so let me just cut this short excuse me senator geller is is so what you're just saying let's just keep it simple that when the small businesses apply for a job and big businesses apply for a job if the small businesses bid is five percent more than the big businesses bid we can go with the small business to try to help this the little guy and i was just corrected it's ten percent right but five to ten but if the small business bid is 20 30 40 percent more we can go with the cheaper to go with the cheaper bit then we go that we go with the look with the big business so how does this change what does this change so here if uh under this circumstance where the bids come in if again you have a pool of six vendors so if three of the small businesses apply we only look at the pricing of the small business assuming the other thing that looks at that you look at is is as mr gleason may said we look and see what the pricing compares to the rest of the to general pricing in the industry then if that is deemed fair and reasonable according to our pricing um the pricing that purchasing has established then we go with the lowest ranked small business we do not look at the um big business even if they are substantially more than 10 percent lower or 50 percent lower whatever the pricing so uh so i i want to just say my two cents uh i agree with what commissioner first said i mean we've always been here to look out for the small business business but we are also stewards of the taxpayer dollars and so i think you've got to kind of watch what is being spent and how much is being spent um so what this being offered is it's kind of there's three small businesses bidding for a contract you're actually what commissioner davis is proposing is to not include the big business bid or multiple big business bid if three small ones i don't see how that's uh you know i just don't understand commissioner davis how that's good for the county and how that's good for our taxpayers okay so let me explain so the qvls there's only one set of circumstances where we do qvls right now this is a huge county billion dollars in contracts we're only talking about accounting services okay so just be clear this is not every single contract it's not every single billion this is strictly for the qvl which is accounting services okay so in this case and we have to talk let's get the data before we start throwing things out there that a cbe or non-cbe has charged 50 less than what a cbe would charge we need the raw data because we're throwing things out and they're not substantiated so i'm perfectly willing to wait for the data to come back and you will see that the prices are competitive okay and so all we're doing with this one list of accountants is allowing them to compete amongst themselves when you have three and it is this is actually a cbe reserve it's called that cbe reserve qbl it's not non-cbe reserve it's cbe reserve so let's allow the cbe reserves to compete among themselves if you have three or more and if you look at the data in the past the last time this was created for the accountant the qvls the only people who were competing among themselves were the cbes because no non-cbes were deemed to be responsive and so this has been done before it's not new and we're not in any dire straits because of it so council just i'll be finished in a second senator so what she's saying is what she's proposing only applies to a limited amount of services which is accounting services well it only applies to cbe reserve so qbl is where there's a cbe reserve so a lot of you know where we have a lot of circumstances where there's no reserve it's just open to everybody it's not specifically designated um by oesbd as a cbe reserve so we only have a few contracts and staff can speak more to that than i can uh that this would apply in factually to so my question to you is does this she said this applies to accounting services yes is that what it's limited to yes or no so no it it is not facially limited to just that there might be a factual which um staff can apply can let you know if factually we only have one current um it may be that factually we only have one current cbe reserve we could ask um ospd can you mind i don't mind okay just i'm trying to get clarity make sure we have clarity on this speak on the qbls please miss feliciano can you address the qbl thank you good morning um we look at the some of the data of the previous qbls we had 21 qbls that have been said if you can use the term big small business instead of qbls the public has no idea what you're talking about sure so the qualified vendor list um we looked at data from purchasing there was 21 qualified vendors list set up since december of 2020 when the board decided to to implement the monetary and points differential two of the 21 were cbe reserves one for marketing services one for cpas the one for marketing services was not used was not utilized only the one for accounting services the cpa was utilized question could there be others that you will add in the future so so again as part of the procurement process the county purchasing division has the opportunity to set up qbls so if you did one in the future yeah yeah please we did one in the future it would come back to us am i correct or does it automatically kick in the way that it's being portrayed today that's a purchasing question i don't do all qbls come mr gleason um just don't don't go because just on on your point we're talking about not just qbls we're talking about cbe reserve qbls not just regular qbls so mr mayor there is qbls and then there's cbe qbls reserve and of that there's only been two and there's only one so the regular there's 21 regular but we're talking about the cbe reserve of which there's only one there has been one cbe reserve q within qbls that have been set up for accounting cpa services um that has been active and utilized okay so conclusion it doesn't apply to all the contracts this doesn't apply to you know it's a very it's very limited okay thank you that's all senator geller thank you just to close on this hopefully mr mayor the um i never said i just don't want to be misquoted i never said that there were um instances where the small businesses had charged 50 percent more right now they know if they want to be competitive they have to be within 10 percent i said it was possible if we eliminate this that they could be bidding 50 percent more since they know that there's not going to be a large business that can come in and challenge them so i did not say that it had occurred i said that it could occur if we do away with this um this is i as you asked mr mayor this is not limited to accounting there have been two instances thus far accounting and marketing although in marketing uh there were no valid small businesses that bid i believe but you you know this could easily happen with other cbe reserves which really should have the title cbe preference because it's not really a reserve it is a preference on the 10 percent so you know and right now when they say it's not going to cost more there is a 10 percent preference i think that is a reasonable number commissioner for members we went round and round and round on this in 2020 and determined that a 10 percent preference was the reasonable balance between trying to help small businesses in broward which i support but also being good stewards of the taxpayer dollar and so at the appropriate time i will be opposing this okay we're just we're just voting to put this on for public hearing that's it right i have to say something yeah and i'm gonna when the comment was made about what they could or however you crown the phrase senator to me it cast a doubt on the already small businesses who are trying to compete in this pool in which you have done a great job putting in safeguards uh to allow them an opportunity but when um you cast that out there it to me it taints it taints or paints a picture that they could do this our procurement department as much as i would like to see um a retooling have checks and balances so that policy makers don't have to dig this deep i mean this is a small business that we're digging this deep this is one occurrence for what i can understand and we're digging this deep we've been dealing with this for a few months and why is there such a propensity to do this here if we're gonna use this magnifying glass or or or or do this deep dive theme for i mean you probably did it in there are 12 years um i trust your stewardship and anyone else is up here but let's look at procurement as a whole let's go and just retool the whole thing before we just take this one thing and cast the doubt that this could happen from one of our vendors who we have already vetted through our processes that they can compete they're eligible why do we want to cast such doubt mayor this is why i'm speaking now it's not my item but i think just the idea that someone would cast that maybe we got to go to a workshop on this i don't know but i don't think we need to move forward to say that this is it uh this is this is gravely concerning to me exactly because the sorry that's just a piggyback then the non-cbe's have you questioned them have you questions these large contracts that go out are there checks and balances on them do we have percentage caps for them no we don't we have a procurement process and they do the checks and balances so why are we so focused in on the cbe's is my question because if that's the case we should be looking at what the non-cbe's are charging and who's checking on that the large cbe hold on hold on let's let's let's can we move this to we move this just for public hearing we're not voting on it we're just moving for public hearing i'm moving for public hearing so do pardon me your mic my only opportunity is to speak on this item before the public hearing sure since everyone else got that opportunity i just want to be on record that i support my colleagues commissioner davis position i support the question asked and if the process has worked i like the fact that there's a price cost analysis that give me that level of comfort that the county is supporting broward county businesses who are currently taxpayers they're currently living here there's so many things that we have to consider here guys so i'd like to have this i move for the public hearing um item to be moved i have a motion to public hearing agenda thank you i have a motion to move do i second i have a motion second all in favor aye any opposed sure i have eight to one uh moving it forward let's move on to number 40 a public poll number 40 who's who's the public poll item 40 is a motion to direct county attorney's office to draft an ordinance establishing a temporary one-year moratorium on the development of large-scale data centers within unincorporated broward county one member of the public has signed to speak on this item and that is chris nelson welcome mr nelson haven't seen you in a long time i know it's been a while you got always some juicy stuff on the menu though so uh i know this item was uh was it was on consent and by the fact that pretty much i think every one of you decided to co-sponsor it who didn't i did i did not sir well what's what's going on with you commissioner mckinsey what the heck i represent the bmsd and i think there's something else that has to be said today in public and you will hear it from me okay so uh with the data centers all right um thank you very much for putting in this one-year moratorium it really should be a permanent moratorium because uh we do not want these things in broward county and i just want to uh use this opportunity to address some things some rumors that have specifically been spread by congressman byron donalds who's running for governor who says that we need data centers he goes hey um commissioner geller do you like to use your phone do you or or whoever uh commissioner fisher do you like to use your phone have you ever heard of amazon and and google gemini do you like to use these things well in order to keep using them you need to have a giant noisy data center built right by the everglades or right in your backyard and it's like please don't talk to us like we're stupid okay we have amazon just fine and google gemini just fine without one of these um there's an expression that i've been using you know don't whiz on my head and tell me it's raining you know what i mean like telling me that oh uh we need these things in order to and you know what he says this is what he says he goes he goes okay these data centers are great and uh but we're gonna leave it up to local governments okay to do this well what about local governments that say screw you to the people well we want these data centers anyway um so i hope that when this one year moratorium is up that uh that you continue to fight back against these things because uh people like byron donalds have taken six million dollars from big tech and uh their goal is to turn florida into data center hell so this will be a fight that will be ongoing for a while and oh yeah you think oh there's nowhere in broward county for a data center oh they'll they'll find a place they'll stick them anywhere so anyway thank you thank you for uh for putting this up and for hopefully passing it uh commissioner fisher i'm sorry to hear that your vehicle was stolen um i hope that maybe you find the uh the investigating agency because this happened to be the same day you're bringing up something to remove the 911 operator from the sheriff's office maybe use another investigative agency other than the sheriff's office to look into that thank you mr nelson um i'm going to recognize uh hold on commissioner fisher but after one year more time we'll be glad to put it in your backyard no problem commissioner fisher you brought the item yeah please but two things mr nelson talked about a personal matter uh this morning that happened to me and i just want to thank the broad sheriff's office because my car has been recovered yeah and so i want to thank them for all their efforts and getting it forward so um the item 40 obviously is just a motion to direct uh the county attorney to draft an ordinance so i want to thank everybody who co-sponsored i appreciate y'all your support but again it'll come back in front of us as an ordinance but this is not passing item mr nelson is bringing it to the point where we can look at an ordinance to do that but appreciate everybody's support thank you and i'll move the item i have a motion and second item 40 all in favor aye any opposed i don't oppose it and thank you for clarifying it's a motion to direct because to me it came out of the air and i have a large portion of the bmsd and that's the only authority that we have here as a commission so when items like this come before me i have to take it a step further so that the public knows uh what we're doing here and as we move forward with this i want to dialogue a lot more with with administration because we we obviously can't talk and i know you have a reason why you're doing this uh uh commissioner fisher but there has been some talks about um data centers coming to the bmsd not so much in the form of what we see in these political commercials now and when we delve into this there's all types of data centers it could be just computers it could be some of the things that mr nelson just mentioned um what are we going to be handcuffing doing this moratorium are we going to sift through it to make sure that you know we don't stop smaller computer companies from being activated oftentimes when something is offered or proposed to the bmsd there's not very much there this could be that opportunity that that saves that community or or sinks it further and the data centers need to be looked at categorized in terms of what we're memorializing i'm stuck right now here's why here's why i struggle with this our own code precludes the cities that were incorporated from tractor trailer parking on lots with grass or some of the typical violations in most cities that would not be tolerated because of a outdated land use that when they were incorporated was um allowed to exist pretty much in perpetuity and i have a big issue with this in my in my district and i can't do anything about it because we impose something from the county that the cities can't undo so when we go down this road and i have a concern about data centers i do what are we precluding because the word preclusion really is a serious word by definition it means a lot and if we think this is going to be as detrimental as you think it is then we need to do look at you know how long uh this will happen so that we do protect these vulnerable areas so i'm making a comment because the bmsd is already vulnerable and when we move forward maybe we workshop at first and and then come back or however you want to handle it to make sure we we don't handcuff them in in what you're trying to divert right now and thank you very much mayor can i ask a question sure thank you thank you mr mayor um i was under and this i think my mistake i was under the impression we were doing countywide ban here we are only doing this in the bmsd i'm going to redirect that question to our county attorney yes well so again this is just a motion to direct a proposal for us to draft an ordinance and it would only be applicable to the bmsd there is some preemption here in this area and so we are only able to enacting bar term and based on our review of zoning regulations and our zoning um rights really only exist in the bmsd i didn't realize that and commissioner fisher one final question is have you adopted in this the state definition because commit uh commissioner mckenzie was right that you need to clearly define what you're talking about you don't want a loose definition that would apply to two computers tied together in an office you've adopted the state definition of large scale that is correct and that's what uh anika is going to do for us thank you mr mayor that answers all my questions i think the other part of this is it's not just the bmsd it's the three-fourths of the county that's out in the everglades that's the part that is probably the most vulnerable and that's why i want to further clarify we were saying one thing so you sent a message out right say another but so lamar really cleared it up early with yeah and direct we have an opportunity to put these things in play like we're all talking about yeah all right item 40 you want to move it i have a motion second item 40 all in favor any opposed show that passing unanimously we're going to take out of order number 43 i think we have some people here on item 43 how many uh public speakers do we have on item 43 nine nine three 43 and and um center before we call any public speakers senator rich do you want to uh do you want to uh introduce what's going on and and yeah just just to let you know um i'm going to be coming with a motion to defer this but i thought it was really only proper that we allow the people uh who had signed up to speak uh so that you can get a sense of what the people out in our community feel about this issue and then i'll be happy to come back and say a few words and make the motion okay you want to call the first public speaker please okay the public hearing on item 43 is now open item 43 is a motion to enact ordinance pertaining to certain county advisory boards repealing article 7 and article 9 of chapter 1 of the county code of ordinances nine members of the public have signed up to speak on the item the first member of the public is michael rayner followed by khalib thompson nine nine nine speakers i'm sorry well let's go through these speakers first go ahead yeah mayor as i'm speaking to the chair of the human rights board actually um by the rules the chair gets a three the full three minutes and doesn't get reduced to the two you got it uh is that okay so yes at the discretion of the board but that's yeah go ahead don't worry about it michael rayner uh chair of the broward county human rights board we had a discussion of this item um yesterday at our board meeting along with the other implications of senate bill 1134 which is the anti-dei local bill that was passed by the legislature um you know for a county like broward county um we celebrate our diversity it was celebrated this morning as you had the jamaican consulate here um you know we celebrate who we are and what makes us great as a county and so um i'm grateful that senator rich is deferring the item to or requesting that the item would be deferred hopefully till december 8th after the election but we really feel that the county attorney's office might want to have a little bit more investigation in what other jurisdictions are doing um you know we don't feel that the racial equity task force or the commission status women have to be sunsetted uh to comply with the statute other jurisdictions are not sun setting different advisory boards um you know tallahassee actually has an lgbt advisory board as does i believe miami beach um duval is not sun setting their commission on status of women and i would just hope that we can try to find more of the rationales to where some of these or other jurisdictions are coming from um you know to protect that you know we did a lot of work um the commission status of women i know fought for a long time to get the uh cdaw passed a convention of eliminations of all forms of discrimination against women to have passed by this county commission um it's that dormant until the human rights board took up the recommendation and brought it to senator rich and we've already been receiving several years of data of how uh women are in the workplace and other aspects of life and it's provided critical data in making some of the decisions and some of the work that these boards have done also i don't think it's i think some of these boards too um if they are to sunset you know we really need to celebrate some of their accomplishments um and i think that maybe the commission might want to have a workshop with these different advisory boards to figure out where the work is that they're leaving off at um in the event that the statute should change in the future um i you know while i was in tallahassee on the aids drug assistance program issue you know i did have some conversations with some republican senators that hoped to repeal layers of this back actually and so um if some of this does get repealed and pulled back i would also like for the commission to have a commitment to reinstate these advisory boards if they should be sunset to make sure that we're continuing our commitment to the diversity of of broward um you know it's so disheartening to see after the the investment the county put into a dismantling racism effort that the human rights board participated in in learning so much more um you know florida is where diversity is is dying um and it's only because of you know a government and so i i'd ask you to consider uh postponing this until december 8th thank you next the next person signed up to speak is khalib thompson followed by bacardi jackson good morning good morning mayor and commissioners i'm khalib thompson co-founder and executive director of island space caribbean museum i'm speaking on how beyond this issue sb 1134 affects cultural institutions for more than six years broward county has encouraged and funded our work at island space thank you for helping us establish and welcome thousands of visitors to the world's only pan caribbean heritage museum our work has not changed but suddenly the work our the way our work is being regarded has two weeks ago we learned our application for continued county funding would not move forward other cultural nonprofits faced similar barriers as an immigrant i learned that the term disadvantaged existed in america because black people women immigrants etc have historically faced barriers to opportunity and support and wealth and opportunity have long been concentrated among those already advantaged efforts to level that pain playing field existed for a reason when organizations historically given less lose support those resources remain available to people who already had access and i have to ask how does that make our community stronger island space represents caribbean people across races languages and nationalities we cannot faithfully tell those stories while pretending those identities and experiences are irrelevant and i cannot accept that our commitment to preserving that history should make us less deserving of public support i understand the position that state laws have placed this commission in please continue standing with us tell us how we can effect change and challenge unjust outcomes island space will continue grateful for your support including funding through this year you believed in us before please keep believing in us and working with us thank you thank you thank you next please the next person up to speak is picardi jackson followed by mary eakins durand hi good morning might i combine my time for items 43 and 44 you tell me council 43 in front of you you can do that pardon me just have 43 in front of you now but it's a similar comment so i don't have to bifurcate can i just use both my time for both it's still two minutes um so i'll just have to come back up for 44 that's correct okay um so you didn't ding me for what i just asked right okay great hi um good morning i'm bacardi jackson and i'm a proud broward county resident of 20 years um and i have ceaselessly served this community on a number of boards including the community foundation of broward the broward college foundation board women in distress and the as an advisory board member of the broward county community action agency and i am also currently the executive director of the aclu of florida and it is in that capacity and in my personal capacity that i am here to address you today the mission of the aclu of florida is to protect defend strengthen and promote the constitutional rights and liberties of all people of florida and we are deeply distressed to learn that this commission is considering repealing its racial equity task force and the commission on the status of women several of you said in a prior commission meeting that you did not want these changes but felt your hands were tied by sb 1134 our message to you today is simple your hands are not tied first and foremost there is no law that is currently in effect it does not take effect until january 1st 2027 so you are not required to take any actions whatsoever until after january 1st 2027 any actions before that date are not required by the law are and are entirely within your control second sb 1134 expressly exempts advisory bodies volunteer advisory bodies such as the racial equity task force and the commission on the status of women not only does the law not require you to repeal these any efforts to repeal these advisory boards are contrary to the express protections in sb 1134 and could potentially expose broward county to constitutional and civil rights violations the legislature wrote a specific carve out and i'll continue i guess continue sure thank you continue okay the legislature wrote a specific carve out protecting exactly the kind of bodies items 43 seeks to abolish section 125.5958 provides that the statutes prohibitions do not apply to the actions of a body composed of non-elected volunteers or basic administrative support provided to such a body unless the staff members sole function is that support the racial equity task force is a 37 member appointed advisory body that does not have a staff members whose sole function is to support the board moreover it makes recommendations which this commission is free to accept or reject similarly the commission on the status of women is an 18 member appointed advisory board repealing these bodies ignores the protections the legislature chose to explicitly grant to non-elected advisory boards like the racial equity task force and the commission on the status of women and third and finally the over compliance creates civil rights and civil liberties risk sb 11 40 34 must be read alongside the u.s constitution and the statute itself says it does not bar any action required to comply with state or federal law and that's in section one two five five nine five seven a moreover over compliance carries its own legal exposure exposure in african people's education and defense fund versus pinellas county the 11th circuit reversed the dismissal of a non-profit suit against the county that revoked and denied the non-profits grant funding and permitted claims of first amendment retaliation and 14th amendment racial discrimination to proceed non-profit organizations have legal standing to challenge discrimination in the denial of funding grants and contracts so we urge you to vote no when this comes before this body thank you for the additional time thank you thank you thank you for the applause next the next speaker is mary eakins durand followed by toby foyer good morning mayor and commissioners i'm mary eakins durand deputy director for organizing for equality florida and a lifelong broward county resident equality florida appreciates the commission's historic steadfast support for broward's diverse communities including the lgbtq community today we ask you to show up for these communities to the fullest extent of the law this includes preserving the commission on the status of women and the racial equity task force equality florida has worked with local governments across the state to address the law's broad net of vague and sweeping prohibitions importantly that broad net has dozens of holes in it these holes are the exemptions that allow local governments to continue their support in various ways for example the law includes an exemption for advisory boards stating that it quote does not apply to the actions of a body composed of non-elected volunteers the law also has a broader exemption allowing counties to recognize and honor the groups honored by memorials in florida statutes chapter 265 which includes the women's hall of fame broward county should explore these and other arguments for preserving advisory boards including the commission and the task force moreover broward county should not repeal the ordinances while the law speaks to voiding certain ordinances it does not require repeal repealing these ordinances sends the wrong message about our county's values also importantly multiple legal organizations are analyzing challenges to the law that could pause enforcement or completely strike it down repeal would be hasty and unnecessary at this point we know that the law's vagueness is designed to encourage over compliance and self-censorship but broward county should take advantage of the exceptions that allow it to continue to support its diverse communities and should act before january 1 to show up for the communities and related organizations to the fullest extent possible thank you thank you who's next please the next speaker is toby foyer followed by burbeth foster good morning uh may about uh bogan and commissioners i am here on behalf of the status the broward county status of commission of the status of women uh my name is toby foyer i'm a former city of western commissioner and i have been on the broward uh commission on the status of women for the past 17 years it was with deep regret and dismay to hear of the proposed disbanding of the broward advisory board of commission of the commission of the status of women which has been in existence since 1976. that's 50 years of working with the broward county commissioners in assisting and recommending to the commissioners the needs of our women population this brings to mind the women suffrage movement and where women help women to get the right to vote and it took them 72 years before the 19th amendment passed and was in the constitution the women have a right to vote susan b anthony would turn over in her grave if she knew that women's rights were again being denied in 1946 the united nations established the commission on the status of women to promote women's rights that's right the united nations and 33 years later in december of 1979 the united nations general assembly convened a conference called cedar c-e-d-a-w the convention of the elimination of all forms of discrimination against women and here we are 47 years later that the state government had decided women don't have rights and has denied home rule to determine the fate of the broward commission of the status of women what a travesty the women's suffrage has shown us the way they made a difference they found their voices and got the vote the broward commission of the status of women makes a difference in women's lives and rights take a lesson from the women's suffrage movement thank you they got us the vote we have an election and as a woman i am going to look carefully at the candidates thank you for all that you do and for the commission of status of women one second please you would like for me to extend your time oh no problem please thank you i appreciate it okay i'll make a comment and i appreciate i think you said the state is where we're directing this energy am i correct yes they're the ones that's doing this yes and i think we're doing everything that we can uh to make make it right but it's a law and i just hope and pray that uh you all put the same type of energy uh on november 3rd and directing it at tallahassee i think we've done a good job here in trying to make things right so keep up the good work thank you so much i appreciate that very much thank you the next speaker is for beth foster followed by sydney calloway good morning commission my name is bro beth foster and i'm a resident of broward county i'm also an attorney with community justice project but i'm actually here in my capacity today as a community member and a member of florida rising i won't belabor um some of the legal points that have already been raised by um miss jackson as the executive director of the aclu i am here to just kind of chime in and concur with the analysis that i do appreciate commissioner rich's proposal to defer today's vote i think that there are legal agencies such as the aclu legal services support coalition and other organizations that actively work in the space have read this statute have read the new law see the plain language of the exemptions that are provided and understand that dismantling the racial equity board and the women's board is unnecessary under the new law there's simply no legal basis when you look at the statutory language so we're asking the commission to to just hold on take a beat consult with um other counties i'm sure the florida association of counties is also looking at this there are resources for you that are provided to you so that you can make the right decision with a county that boasts a demographic makeup of almost a third of black residents white residents latino residents it's very important that in this historical moment this commission acts courageously does not succumb to the fear that um the governor and the state administration and the state legislature would like you all to succumb to and today's um vote would be simply preemptively complying with something that is not necessary that the commission complies to so we'd ask you to look at the legal language of the statute yourselves the exemption sections that are provided and act narrowly to support your community thank you the next speaker is sydney calloway followed by nastasia tazzy janvier good morning for the record my name is sydney calloway i'm the office managing partner of the law firm of shuts and bone here in fort lauderdale i'm also a broward county resident since 1993 um part of my duties as the uh as a lawyer here in this community and you know i've been here since 1993 and we've had some challenges throughout um i'm here again on this item and i also want to concur with the uh comments that you've heard from uh miss bacardi jackson uh and but i'm also here again to uh ask uh that you uh again go with the uh wisdom of commissioner rich who would like to defer on this matter uh this is a time where the county actually needs to provide the leadership the county commission needs to provide the leadership i'm absolutely positive that you've got one of the finest county attorney offices in this state probably in the country and on that basis i'm saying as a member of the and and then former chair of the broward county uh urban league of broward county i sit did sit on your surtax transportation appointing authority and we just recently understood that the county was going to be revising the ordinance that would remove the urban league from a being a representative on that and other advisory boards i do encourage you to take another look at this the urban league is a organization that has as its mission to help the community african americans and others in this community that essentially means again that you should be making decisions and this law that we're speaking to does not i'd ask for just another minute of of your time please yeah as it applies to advisory boards again it does not apply to the actions of advisory board it does apply to the county's action to your actions however when your actions are pointed at organizations who have a particular missions that serve this community that is the underlying rationale that supports why you can make the decisions to keep organizations like the urban league on your advisory board you're not choosing the urban league as a representative for one of your advisory boards because of race you're doing it because of its mission that is the singular most important uh chapter 125.595 relies on actions taken on the basis of race among other things pointing advisory board members who are representative not just on race not on race but on the work that they do in this community is how you restructure so that this can be applied in a way that is consistent with the county's organizational objectives as well thank you very much the next speaker is natacia tazzy janvier followed by natasha felisor good morning my name is natasha tazzy janvier i am a bard attorney here in florida and a legal fellow at the aclu of florida and i speak in my individual capacity because you have already heard from our fearless leader bacardi jackson before i share my legal assessment i want to share a short story because these types of ordinances impact real people a story about someone who found courage in organizations that serve on the racial equity task force like the naacp which built a foundation for courage to exist mr mayor you mentioned um briefly how the state imposed the law but you all get to decide how it's enacted in real time the defense of these boards critically matter about how you choose to navigate these next couple of months and into 2027 i bring you these defenses first the non-elected board carve-outs applies to the community boards the carve-out state any action of a body composed by non-elected volunteers are exempt from the law the racial equity task force the commission on the status of women fit in that exemption exactly applying the law has its opportunity here and do not deny it second there are other harms happening by sb 1134 black-led organizations and leaders are being denied funding as we speak now i want to point you to other exemptions in the law expressly those that honor state and federal holidays and observances like juneteenth the birthday of martha luther king and also those honored by the florida state statutes i want to name two which i've already shared with we've already shared with the county attorney including the florida slavery memorial and the florida african-american preservation network these should help protect community programs organizations and entities again use the carve-outs as your defense mechanisms here lastly there is real weight on the table choose a meaningful life that's my timer so you guys don't be me okay let me wrap up by saying the the stories and the narratives that you all have in front of you is one that you get to decide how to push back against and don't just deny the ordinance today but deny the ordinance going into 2027 the next speaker is natasha felisor good morning my name is natash felisor and i'm the field voting rights organizer with the aclu of florida however i'm speaking on my personal behalf this morning i stand before you today as a living example of what broward county's commitment to diversity equity and inclusion can make possible these opportunities that were made accessible to me such as the broward county public schools debate initiative allowed me and dozens of other black women the opportunity to learn lead and contribute to our communities in perpetuity broward county should not dismantle community representation because the changes you all are about to make are not merely administrative nor nugatory this is about the futures of the black children of broward county this is about the criticality of representation for young black adults in our already insular state items 43 and 44 threatened to eliminate critical community advisory boards including the racial equity task force but if it wasn't for the racial equity task force in broward county targeted research initiatives like the 2022 race and prosecution report would simply not exist the task force successfully established a massive structured coalition that brought historically siloed groups to the same table it formalized representative groups including but not limited to the naacp urban league florida rising the public defender's office and the school board of broward county amongst many others if broward county refuses to comply with sb 1134 they aren't just dismantling programs that serve black and brown communities but they're dissolving bodies through which those communities are granted a voice in local government we are urging the county commissioners to apply the laws exemptions and fight to keep these boards alive after all it is the people who elected this commission because they were confident in the power that you hold to create a path towards justice and equity especially for the people of color in these communities who are most disadvantaged and it is the people who will decide whether you have a seat in future election cycles do the right thing and follow the law vote against items 43 and 44 thank you thank you there are no more speakers okay we're going to bring it back to the dais um oh come on up okay you sign up for questions only eliahu rochester sir no problem sir no problem come on up just state your name and hi what's your name great my name is eli yahoo rochester um so good morning mayor and uh uh commissioners i am a jamaican-american broward resident and founder of ri legal code blue it's an ai powered civil rights tech startup speaking on behalf of the aclu and so i urge you to vote no on item 43. nine speakers or 10 now right 10 speakers from different walks of life came today to say no our presence must count please do not mistake the absence of others for indifference you have said the state passes law we understand but you are responsible for today's decision and for examining every lawful avenue to preserve these boards section 125.595 subsection 8 exempts the actions of bodies composed of non-elected volunteers and permits basic administrative support subject to a staffing limitation before dissolving these boards explain why that exemption cannot protect them your loyalty to the people must be visible in how you exercise your lawful authority the racial equity task force brings overlooked experiences into public decisions the commission on the status of women gives women's lives sustained attention we celebrate diversity in broward's food music business and ideas will we value those same people when they ask for a voice in government women are mothers and daughters nurturing warriors workers and leaders their dignity extends beyond any family role their voices deserve to endure in god we trust calls me to honor every neighbor's dignity across every faith or no faith as a tech startup founder i build toward the future progress requires institutions willing to listen and learn two more sentences i promise vote no on item 43 or defer it for a written analysis of lawful preservation show the people who came today that representation means something when broward speaks its government must listen thank you thank you sir bringing it back to the dais um nan do you want to move move uh your um you're gonna defer it i do i just want to say a couple of things i want to thank all the people who came today um um we heard from a lot of very elegant eloquent speakers and uh i appreciate them coming here and sharing their thoughts and you can see that they were all of one mind uh representing different aspects of the community and both of these uh commissions um i i um i'm not going to go into everything that i was going to say because so much has been said but i i just do want to say that i i really think it's so important for us uh to defer this uh before we and go nowhere with it until we have exhausted every opportunity whether it's legal uh uh uh or or other to uh protect the work that these critical boards do the thing for me in 2019 when we passed cdaw unanimously on this commission and think about it the united states of america is the only western democratic nation that has not signed uh on on to cdaw and but right now there are many many uh municipalities and counties and states around the country that have done it um and as a result of it we established those those uh with fiu metropolitan center every other year to do the study on status of women and i have to say i i i can't even you know think about where we would be without that because of the information that we have received um on on all different areas whether it's education um safety um uh um uh several other health and and it instructs how we spend our money many times and i look at women in distress they were here this morning for the for the proclamation and their their funding has increased dramatically from a hundred and some odd to 540 i believe uh people individuals right now and that was informed by work that came out of that study and i i just think there are so many other things but i i i just feel that um i would ask you all to at a minimum you know i i am asking to defer it because hopefully that was as was mentioned we have an election uh we're going to have a new governor we're going to have new cabinet members we're going to have a new legislature and we also have not explored all the legal aspects here because i just found out that not only leon county has not eliminated theirs but jackson but um jacksonville also has not so there is uh impetus around this state not to do this so i i'm going to go ahead and turn it over to anika she has the wording for the um motion you have mr mayor i'd like to take the motion for first do you want to take the motion or allow the others we'll do a motion do a second and then we'll anybody else wants to say anything go ahead um the motion proposed by senator rich is a motion to continue item 43 to the scheduled county commission meeting at 10 a.m on december 8th 2026 at 115 south andrews avenue room 422 fort lauradale florida um that motion is stated as required by florida law so we have a motion and a second and i'll bring it back to the desk commissioner davis yes so um i'd like to thank all the speakers who came forward it's important that we get different perspectives um in my meeting with our county attorney i i i had some reservations myself but what i i get to understand which i'm hearing today and you can correct this anika is that if we have any staff persons on these boards my understanding was that because we are paying that staff person then we would be in violation but it seems to me i'm hearing now is that if that person is not solely if that's not their sole function then it isn't the violation so i just need to be clear because certainly i don't want to rush in disbanding in boards when there are avenues that we can work with and we should be working around we should be trying to preserve these boards at whatever cost necessary within the law so the rush to judgment i don't i don't want to do i do want to be given every avenue where we can preserve these boards rather than rushing it bringing it today when these avenues haven't been looked at so i'm in agreement with making sure we check other counties what other municipalities are doing what angles they are using talk with these folks they've said they've met with you an aclu we need that information if they've given you information please be sure when we have our one-on-ones that we're given that so when we come we're not blindsided as i feel i have been today with all sorts of new information so i am in agreement with this being extended but at the appropriate time we need to meet so we can really uh dive really critically into these things so that we're not just you know trying to be ultra conservative and making decisions without really looking at the pros and the cons and every area we can preserve some of these boards to the best extent that we can within the law thank you okay can we take a vote oh senator geller and then commissioner david rogers thank you mr mayor i'll be brief the uh whether we like it or not there is a supremacy clause in the state of florida the legislature actually has the ability to create and dissolve entire counties and cities and we are required to follow the law i have no objection to today's motion by senator rich who is a fine commissioner and was a fine senator to postpone this through um to postpone this to december as long as we comply by the end of the year but we've heard some arguments i've been practicing law for 44 years we all know that a good lawyer can a lawyer can a good lawyer can argue either side of the case and we had some very good lawyers speaking uh and arguing one side but at the end of the day i'm going to follow the advice of our county attorney because our county attorney has the best interest of the county commission in mind we know that broward county is the only bright blue large county in the state of florida is the target of the state of florida and you know candidly even if the is if there is a new governor that's on our side or attorney general this is a law of the legislature i don't think they can do anything but i have no objection to waiting until december but in december i'm going to follow the advice of our county attorney commissioner rogers thank you mr mayor and i will agree with what senator geller just stated but i came in here today to let um commissioner nanrich know i was going to support the motion that you advance today because if i did not do that then i'm feeling that i'm not representing the people that i represent and i know their position and i'll recognize khalib from the caribbean island space i'll also recognize aclu the attorneys who are here today and of course women i'm a woman and when you try to tell me that i can't do we have gone come too far if you speak to the population of the state or even the united states it's 50 percent plus are females okay so why would i want to vote against all the things that we have achieved as women in this space and have fought for so nan thanks for the guidance on this thanks for your leadership always when you have a passion for something young lady you don't give up and because of that we are not saying i would not listen to my attorney because i speak to the attorney and i know we should be following letter of the law and as long as we can debate and we can collaborate and we can make the right decision in the best interest of the people who represent who we represent and of course in doing so we're representing we're doing the right thing for this county because they are the people who we represent so that's where i stand so again thanks nan and to everyone that adds something to this discussion you see engagement what can result from you being engaged so i thank you all for being here today bean thanks i'll be quick uh first of all i want to thank all the speakers for um coming today because i actually heard things i had not heard before which i appreciate um and i know and i i always appreciate our county attorney and and staff for being for trying to protect us on stuff but i do think sometimes there are laws that need to be tested i think this is one of and and there are you know what we're what we've seen come down from the legislature is is a full-scale assault on on local government and and you know the because this isn't is not a sharing of the values in broward county i really don't think it is uh we've put we put these boards together um because we thought it was the right thing to do and we've and we've uh benefited from that because we've gotten great advice from from all of them we you know it so it's been worthwhile we've watched as the state has been trying to whitewash history all over the place we've watched you know they took they've turned science into they've made science political when it never was and and education um so if there's ever time to to be willing to test a case i think it's this is one of them um so i i will be joining my um colleague here in voting to defer this but i do hope at some point we are we find a way to test this case thank you you want to go around again yeah let's do another okay i've got a motion a second to defer is that the appropriate continue till december meeting sure i just want to ask the county attorney yeah by just deferring it to december 8th clearly there's there's zero risk to the board up here because it has to be complied with by january 1st yes and the ordinance itself even as we had proposed was had an effective date at the end of december so it wasn't going to go into effect immediately okay so there's no risk to us on the dais up here by just deferring no so we're just going to consider it at a later time okay we got a motion a second to continue to the december meeting on item number 43 all in favor aye any opposed show that passing unanimously while we're in the public hearing we have three other items real quickly can we read item 41 the public hearing item 41 is now open item 41 is a motion to adopt resolution regarding vacation petition number 2026-v-04 vacating and annulling a 10-foot wide limited access easement lying within parcels a and b of the worship center platte in the city of plantation no members of the public have signed up to speak on the item i have no members of the public great bring it back to the board i have a motion do i have a second second i have a motion second item 41 all in favor say aye aye any opposed yes show that passing unanimously 9-0 item 42 please the public hearing on item 42 is now open item 42 is a motion to adopt resolution regarding vacation petition number 2026-v-01 vacating and annulling a portion of a 30-foot wide drainage and flowage easement lying within parcel 3 of oriole golf and tennis club section 2 in the city of margate no members of the public have signed up to speak on the item i have a motion do i have a second second i have a motion second item number 42 all in favor any opposed show item 2 passing unanimously item 44 please our final public hearing item is item 44 item 44 is a motion to adopt resolution pertaining to the tourist development council the climate change climate change task force and the broward county homeless continuum of care board amending sections 12.3 12.24 and 12.153 of the county administrative code seven members of the public have signed up to speak on the item how many members seven okay the first speaker is michael rayner followed by kalib thompson are you moving to defer this item also to the december meeting okay we'll be we'll be uh when you're done speaking moving this item for deferral for a december meeting do you want to make uh go ahead yeah it's all yours point of order just a second just so speakers know i believe if they speak now they wouldn't have a chance to speak again and when this continues is that correct and they may want to hold off speaking till it is actually heard that may not be the case just because of the timing of this uh when the next um meeting happens because it'll it'll be more than 30 days after the um after this hearing so they um so they would have a chance to speak i just didn't i just wanted them to know if that was the case okay mr rayner please go ahead yeah uh michael rayner chair of the broward county human rights board again um on this one um the gentleman from who was with the urban league already had spoken on the issue of that uh seat being removed um i'm not sure particularly why that seat's being removed but on page five item 26 um the erasure of the lgbt community being represented on the coc board is rather staggering um lgbtq people um while a smaller number in the population actually have a higher incidence and prevalence of homelessness um among its youth and it's really concerning i mean the one thing i am reassured by is knowing you know the director patrice pauldino and her values of running that shop as well as the county's commitment um in addressing homeless programs to make sure that they are reaching out to individuals of all all folk in this county um i just find the erasure of that one position to be really staggering um it is replacing it with victims of hate crimes and or bias motivated crimes i just want to note that while there are protections at the federal level for uh on hate crimes for sexual orientation and gender identity at the state level florida has only protected sexual orientation as a protected class and hate crimes and not gender identity but um so that is you know some concerning area where um those individuals which are usually trans are more targeted for things as well um it is a concern and so i on this one i'm not asking the commission to postpone this one um you know there's other things in here which there may be other reasons for the other changes like the tourism board and how the chair is appointed um but i just want to state the objection to the erasure of the lgbt community on this and if i may i just want to thank uh before i finish being a commissioner for i want to thank you for your service um i probably will not speak uh with you before the end of your term and i just want to thank you for your commitment to um a lot of the things that um you know we're talking about today and making sure of why broward is great so i just want to say thank you thank you next the next speaker is cleave thompson followed by julio duno good morning again mayor and commissioners i'm not going to reread my statement but i just want to reiterate that uh the same point applies to this uh this item thank you thank you appreciate it next please the next speaker is julio duno followed by robert keston good morning or good afternoon um may and commissioners my name is julio duno i am a field organizer with the aclu of florida speaking in my own individual capacity a lifelong south floridian and a member of the lgbtq plus community i'm here to ask you to vote no on items 43 and 44. i have felt safe in south florida because local governments made room for people like me at the tables where decisions about our lives are made the lgbtq plus seat on the homeless continuum of care board is one of those tables it was created because lgbtq plus young people face 120 higher risk of homelessness than their peers they need someone on the board who understands what it takes to keep them safe we still honor the lives lost at polls may we never get comfortable thinking that could not happen in our own backyard for people experiencing homelessness the risk to their safety is not abstract lgbtq plus representation on our community boards is not symbolic it creates a real forum to build proactive safety measures into our community the proposed language will replace that see essentially erasing years of work serving the unique needs of lgbtq plus youth in this county not only is this unjust it is unnecessary sb 1134 does not take effect until january 1st 2027 it exempts volunteer boards like these and allows the county to provide them basic administrative support pre-compliance is how a bad law becomes more powerful than its own words these boards are how black lgbtq plus and women residents have a voice in this building and our whole county benefits when every voice is heard apply the exemptions keep these words please vote no on items 43 and 44 thank you thank you next mayor robert keston is no longer present so the next speaker is bacardi jackson followed by nastasia tazzy janvier thank you again for your careful consideration of these um proposals and i won't read i won't re-read everything that i said but the same analysis applies and i do want to offer that we are here to work with you with the county attorney we would be more than happy to provide you with additional analysis i have sent letters over to all of you and we will send additional ones but we do want to make sure that you are carefully considering the exemptions because that is following the law the law it is not contrary to the law to follow its own exemptions and they were specifically fought for we were there in the legislative session to fight for those exemptions and they were fought for and they were won and so those exemptions have meaning and we just urge you to look at those meanings thank you thank you can i just ask miss jackson can you send us your would you mind sending us your previous comments i will absolutely next please next speaker is nastasia tazzy janvier followed by berbeth foster i'm back to reiterate my comments that i shared before for item 43 as applied here again compositions of the board can also comply with sb 1134 the carve out language for non-elected volunteers and i hope that you all think about that offline in conversations with the county attorney and also utilize us as a resource in navigating um next steps thank you is that it the next speaker is berbeth foster okay and ilyahu rochester signed up for questions only wave in support just wave in support just okay um so i'm just gonna skip so these designated representatives um they they know their communities concerns through the relationships services and lived experiences they hear what people may never bring into these chambers the urban league understands barriers facing the communities it serves african-american representatives uh bring knowledge of businesses and neighborhoods lgbtq plus representatives understand how family rejection trauma and fear can lead to homelessness a young person may be forced from home by their parents or leave because they feel unsafe a seat focused on hate crime services cannot fully substitute for that knowledge government has a moral responsibility to care for everyone it it governs people contributing to our country and people who need help finding safety and stability human dignity cannot depend on someone's present ability to contribute removing representation does not make those needs to disappear it risks making them less visible the county attorneys advises you um you know you hold the vote uh please explain why the volunteer exemption cannot preserve these seats before concluding their removal is necessary law deserves scrutiny our history includes unjust laws later overturned because people challenged the exclusion they enforced and our moral traditions demand accountability in the story of uh canaan abel the question am i my brother's brother's keeper confronts our responsibility to one another my answer is yes i am my brother's keeper i am my sister's keeper in public office you must be too vote no on item 44 or defer it for a written later analysis keep these communities represented one more sentence their lives their knowledge and their dignity belong in your decisions thank you thank you sir there are no more speakers thank you bringing you back to item 44 nan uh senator rich do you want to make a motion yes i make the same motion i made uh i know it's a motion to continue to the december meeting okay um can i just state it please and with rich so just with the careful analysis of all these things that were brought up today by other organizations uh and you know for us to you know to really you know gain a greater depth of of knowledge about what what what it is and the legal impacts and so forth but you know i i just i just feel we we absolutely should not be making a decision today so i move to defer it second i have a motion second may i read the motion pardon me i'll hold back may i read the motion please um florida law requires that i read the following motion statement the motion being made by senator rich is a motion to continue item 44 to the schedule county commission meeting at 10 a.m on december 8th 2026 at 115 south andrews avenue room 422 fort lauradale florida now a second okay i got a motion and second to continue the meeting all in favor can i can i just ask the county attorney something sure are you going to bring us back a written memo that so i don't want to have to do all the research on every point that's being made by the different organizations bring us back please one written memo with the recommendations that you have on these things because i agree with what the public said to a certain extent but the problem is it's an unfair fight because we can't challenge these laws if we're faced with the force of being removed right after we make the challenge it's different than running into a courthouse as a plaintiff in something that you don't so i want to make sure that we're coming from the best available spot so please if you're going to do brief us incorporate this and send us something in full before the next before the december 8th yeah so we'll present our our recommendations to you um and then in terms of our um analysis we'll brief and be available to each of your offices with the analysis on each of the points one last thing if you don't i i just want to make sure that we're including these the people that spoke today that do have expertise with legal background and have some different opinions so that we can get you know an understanding of all of it okay yes and and um the team from the aclu was kind enough to meet with us um prior to this meeting so um we have our our analysis on on the points and to provide the board we got a motion and second all in favor any opposed show that passing eight zero um now we'll go to regular items item number 45 item 45 is a motion to approve threshold increase for open and contract baggage handling systems maintenance repair and operation services between brower county and oshkosh aerotech llc no members of the public have signed up to speak on this item i got a motion do i have a second i have a motion second item number 45 all in favor any opposed show that passing eight zero let's go to item number 46 item 46 has three motions motion a is a motion to approve final ranking of qualified firms for group one terminals one through four and airport operation control center request for proposals janitorial service services for terminals one through four motion b is a motion to award janitorial services to sunshine cleaning systems llc doing business as pritchard industries the top-ranked proposer based on the evaluation committee's june 3rd 2026 ranking motion c is a motion to authorize county administrator to execute the agreement with sunshine cleaning systems llc doing business as pritchard industries eight members of the public have signed up to speak on this item before before we have eight members come to speak on item 46 i just want to ask our administration uh or council um what your recommendation is on this matter um mr mayor our recommendation is to continue the item as or to approve the item as it is presented to you okay uh who's first to speak first member of the public signed up to speak is kevin barton followed by senator chris smith okay come on down good afternoon thank you uh my name is kevin barton i'm president of aviation for sunshine cleaning systems um first i'd like to thank the commission county attorney and uh the department of aviation um you know as we move forward with this new contract i'm excited about the opportunities ahead we look forward to implementing new cleaning technologies we spent a great deal of time during the rfp process as well as meeting with your team after the fact to ensure that we're providing the best services possible and implementing those technologies we have 400 team members who are dedicated to ensuring that the airport is clean and safe for passengers they provide services 24 7 365. additionally i'm also joined today by two of our cbe participants for this contract both mcj as well as daml and we are meeting all of the cbe requirements for the contract but again i would also like to point out this is more than just participation on this contract this is about mentorship and it's about setting them up for success in the future whether that's mentoring best practices within the industry but also best practices in business uh when one day they should be able to bid as a prime with our mentorship and leadership we've also recently negotiated a new cba with the seiu for the next three years and we have a great partnership with them meet with them regularly and feel confident that we'll be successful over the next five years providing services to the county thank you thank you next the next speaker is senator chris smith followed by george p cone good afternoon mr chair commission um i'm here on behalf of triangle who's asking today that this commission do not move forward on this item um brief background of why we're here triangle my client was ranked number one coming out of procurement part of that ranking of number one was because of the local preference we received local preference from your from from the um staff and sunshine challenged the local preference points that we had the 25 points that we had that made us number one that challenge went to the administrative law judge in tallahassee that administrative law judge used the wrong review to look at where our points were were given and that the administrative law judge did a de novo review and since we have lawyers on the camp on the commission um that review was correct was incorrect and that administrative law judge has also used a de novo review and have been found it's incorrect in the past and using that review ignore your procurement department your procurement department when sunshine first objected spent five months five months your entire procurement department researching and making sure that we were a local company and determined it and said that we were to receive those 25 points this administrator administrative law judge in tallahassee in his de novo review ignored all of that and and incorrectly sent it back down and told your staff to take away those points that's why we're here today because an administrative law judge using it used the wrong review and directed your staff to take away points from the number one ranked uh uh participant in this in this rfp we're asking that the council and what you can do go ahead we're asking that the council do not award this award today because we are in circuit court now because of the wrong application of the law we're asking that you not award this contract today and send it back to your staff to have your staff do what they did before and you have that ability to say staff take a look at this issue again look at everything that was brought up all the evidence brought up and and direct them to then uh award us our points back and we will be the number one ranked coming out of the rfp can i ask you a question yes sir so it's in litigation so let's say we do what you're suggesting then then they'll be back in litigation one way or another isn't it fair to say that a court's going to decide this one way or another well it makes it tougher if you decide today if you award the contract today that makes it a little tougher if we go back and we we have a court a circuit court look at exactly what we're doing and exactly what's going on and that an administrative law judge is asking you to go against your county code because there are many references in the county code that gives us the ability for you to send it back to your procurement department for your procurement department to look at all the evidence presented to it in that five month review and to give us back those 25 points so your position is if we defer it yes sir not award anything yes it would make it more uh clear for a court to decide yes sir i don't i get it because uh i don't understand as a lawyer why i would make a difference whether we did because what you're saying is if we do something that's improper by our procurement codes somebody could take sue us sue anyway and go into court either way but i'd love to hear that if that's so your your recommendation is then not to award anything but just to defer it yes until a court decides yes mr mayor may i ask a follow-up question on that one second yeah okay um i agree with what you're saying my question to the county attorney here uh senator smith is an able lawyer like him the um concern that i have here is you know there is an alj ruling i thought based on my briefing that this matter as mayor bogan said is in litigation and that if the circuit court the correct uh appeal from the alj is to the circuit court and if the circuit court reverses then it would go to the award would then shift to senator smith's client is that correct so or have i i may have misunderstood the briefing it could potentially go to to senator smith's client so the posture that we're in and as you as you mentioned right there is uh active litigation and so um you know our recommendation is that we follow the the procedure and as um the county administrator stated that we approve the item as presented to the board that's based on our collective approach but in order to make that litigation right the this board needs to make the award uh needs to approve the item as presented senator geller let me finish my please please so what what you're saying uh county attorney you're contradicting what he's saying and i want to clear this up counsel in front of us is saying that if we just defer it and do nothing uh it would allow a court to uh make a more unbiased determination where we're being told by you by our you know your office that know the best thing to do for their even litigation is to award it to um to the other side and then the court can make that determination um counsel do you hear they're they're saying the opposite of what you're saying okay do you have a response for that yes please elizabeth peterson representing triangle services with pansamower and maynard i'm sorry who are you elizabeth peterson i'm with pansamower and maynard i represent trial and ghost services and i've been handling the bid pro uh protest procurement action to doha at this opportunity what what occurred was after it came back down from the administrative law judge that's a recommended order at which point the process gave the county administrator an opportunity to review that and present it in doing so she stated that she strongly disagreed with the recommendation but nevertheless moved forward with it and it's our position that in doing so that she did not follow the code in making that recommendation and provide the explanation that was required that's what he said at this point in time what we're asking is that what it could what the commission could vote to do is to send it back to the county administrator and direct her to make that recommendation what recommendation the recommendation to review to review the uh request or the order that came from the judge and um apply the county code uh you know your procurement officers expressed that during the commission they're only witness that testified that this is not how they applied the code that that the uh that the um i'm sorry i'm sorry i thought sorry uh that that the local business preference was not applied in the way that the county has interpreted it and uh this is all based on information this our client has this is the the facts that the court relied on were basically out of date website references and linked let me stop you sure you're not addressing my question you know council said that if we defer deferring means we take no action that it would be more unbiased more easier for court to make a determination i'm asking um i didn't understand that and if any lawyer here wants to but you know our county attorney is saying the exact opposite that if we move forward with the ranking as it is today that you'll have your just day in court to reverse that if it's you know if something was wrong that was done you're saying no it'd be more advantageous in keeping it more um unbiased if we just defer it and do nothing not vote on it is that accurate or not accurate no i don't think we're suggesting that you don't vote on it entirely and then the county attorney's position is correct if you uh move forward with what is stated in the agenda items today yes it would be then be permitted to move forward within the circuit court we're saying there's an alternative for the commission in order to have this review take place now before we're bogged down you want us to be the court you want us to be the court you want us to basically vote and say hey something that was done wrong by the judge the administrative judge you want us to do that and make that decision right versus having a court make that decision no we're asking you to send it back to the county administrator who had the ability to accept modify or reject the county i'm sorry the alj's ruling at the time she issued right you want us to do that instead of the court i gotcha does anybody have any questions senator geller do you uh mayor do you want to take the rest of the speakers um before bringing it back to the county commission i just i yeah we'll hear all the speakers i anybody else have questions for these individuals yeah just to in one sentence they're not asking us now to defer this right deferring it means we do nothing right they're asking us to instruct the county administrator to do something different as opposed to accepting what's before us correct when they first came and said defer it that's now not what they're asking right they want us to change the ranking and vote for them i got that uh any other questions before here are other speakers yes sir we're not asking for you to change the ranking we're asking for you to send it back to staff for them to look at in the war of the points so we're not asking for for you to decide in the war of the points but staff has already determined that i should have received the points gotcha thank you any any other so look thank you hang up hang tight hang tight our next speaker next speaker wait wait wait wait do you have a question okay maybe it's monica i need to ask this question you're you think the points need to be awarded is that is that what's going on here so i'm confused because we're talking about the great lawyers we have up there i understand that but we have great people up here and we find ourselves here because of a process again that's being questioned by both sides we got the court because one side didn't agree with the outcome and the other side saying deferred we thought initially but now they're saying give it back to staff that staff award the points that staff was going to award is that a accurate statement please tell me what happened how we got here when a process that we had gives 25 points to the local preference and now the 25 points have disappeared and a court is making a ruling and now you're asking me it's a policy maker to um opine on a procurement process you know how i feel about this stuff i'd rather it come out of procurement than come out of out of me but where is where are these 25 points now and and what do you plan to do with the if it comes back to you okay so let if i may i'm going to ask my staff to jump in if i get any of the sequence off but i think to clarify i'm going to attempt to clarify from the beginning of where where we started with this uh procurement and where we are today so originally um the originally uh top rank firm was deemed try as triangle they were ranked number one and they had received the points okay then um sunshine objected and protested that was denied uh by our procurement department our procurement director then sunshine then appealed and that went to the division of administrative hearings that uh the alj the administrative law judge um cited with sunshine uh on that i then sent a letter as i'm required to to review that and and i do want i need to make two clarifications to the statements that um your attorney uh senator smith made um and that you said that i strongly disagreed my letter said that i respectfully disagreed i just needed to clarify that for the record and that's okay and secondly you also stated i believe i heard and if i misheard you i apologize but i thought you said that i did not comply with the code but i did comply with the our procurement code and because i believe now the procurement code has recently changed where i didn't i no longer had to absolutely go with the ruling of an administrative law judge i had an opportunity to review and and make that determination so i just wanted to state for the record that i did comply with the code um and that other um clarification for the record so so now where we are in the in this sequence is that i had sent the letter um that i did carefully review the administrative law judge's um order um and i did respectfully disagree uh with the conclusion um but i also conferred with our county attorney's office and i did not see that there was any basis in law or fact for me to overturn that so that is why i went with the administrative law judge's recommendation order um so so now we went forward with the process and so where we are today is this item before you is is to recommend uh to be consistent with the administrative law judge's order to go back to um the ranking where now it has sunshine as number one because the points were um going uh consistent with what the administrative law judge's order said so now um then in the meantime uh triangle's uh representation filed a lawsuit in court um and it is my understanding and this is where i'm going to ask my county attorney uh for clarification if i misstate this as my understanding that at this point the circuit court is no longer able to proceed until the county has taken a final action on this item which is why earlier when the mayor asked me my recommendation my recommendation is to approve the item as it is is before you today because that then would be a final action of the board and then it would allow the um the rest of the um process to proceed in the courts if if back to your question vice mayor when you asked me if you if i did what you know if you all voted what i asked you let me tell you what i asked you if we send this back to you correct that's where i was just now what happens to the 25 points now you spent 10 minutes and you never talked about let me just articulate what i want to articulate because i need clarification to make a decision maybe the rest of you don't need that what happens to the 25 points if i send it back to you well it depends on what if you send it back to me to reconsider my reconsideration would be the same so i would i would do exactly what the letter is that i originally stated um and and that letter was um to the board so i would go back because my determination i still don't have any basis in law or fact to overturn what the administrative law judge um determined and what are all your options that you have at this point too is that the only option you have you could do what they have asked you uh to do and it would be to send it back to me but i'm telling you um there's nothing in my understanding that has changed in law so that's the only option you have do we have any other options on the table well you're saying to me and i don't have a dog in this fight other than the procurement process you know we find ourselves on these slippery slopes all the time trying to untangle something that happened in procurement and there's probably a good reason but what are all my options is what i'm asking you're saying you only have one option well that that is if you asked i was answering the question you asked me if you did if you referred it back to me i would look at it again what are my other options right now well legally and i would ask the county attorney to explain all the options that that was i think you have three options one option is is to vote in favor of the number one which is bernie's client number two is to overturn vote for a christmas client and number three is to defer it not do anything right now and let the court decide is those are three options no no there's actually four options so to the to the vice mayor's point so why is that no we're conducting this this this is here before the board pursuant to the procurement code adopted by the board right so we're when when we say what our options are we're presenting our options as provided in the procurement code so at this point the options under the code are to approve the item as presented right to reject all and essentially start over right but you're starting over you're not just direct and or um and then you can wave the procurement code so you'd have to do a waiver of the code and then do a potential uh direct award but you're still right so you know all of these are subject to the continued challenge um so we have four options on the table i'm just trying to get a question answer and it seems like it gets clouded or cloudier every time you try to get to to the um to the answers you're looking for so we have four options on the table you're choosing one of those options what you're saying mayor this is a policy decision i i want to be clear of that but earlier this morning when the the mayor asked me what my recommendation was was to test with the right yeah and and so i had just recommended to to um to approve the item as presented because that would then allow the court to you all would have a final action and that would put the situation in the proper context with the court and then the court would be the final um um determinant on on on the case i think the biggest question do you agree with your procurement department awarding 25 points for them or not either you agree with your procurement department or you don't agree forget the administrative law judge i'm just talking about whether your procurement director agrees with what they did or he doesn't agree with what they did the procurement code was followed and i concur with what actions my procurement code my procurement department took she concurs with what her procurement department there you go in terms of let's go yeah there you go okay so by awarding 25 points that's what they did okay mr dean and thank you monica and i'm sorry you still have a phone i just wanted to get a clarification so to me as incredibly torturous as this sounds and to the public i'm sure this sounds incredibly torturous but this is exactly what was followed under our procurement code and a few years ago the entire lobbyist community i'm both sides of all these issues said from now on we want you to have a doha process where if there's a problem we want to be able to go up to doha and this stuff takes time this was a this is over a two year procurement so no matter what happens here there's a lot of timing issues but doha made a ruling doha ruled one way or another whatever doha did what they were going to do came back to county administration county administration followed what doha's ruling was so in my mind the quickest way to resolve this thing the easiest and fairest way is because this is already in circuit court give them a final order and give them a final order today right now by approving this that puts them in the best footing the whole thing that senator smith said in the beginning deferring this is not an option that does nothing for anybody here it just leaves us in limbo the other thing we could do is we could put this back out on the street for another procurement in which case the same result is going to happen over two some odd years and sunshine is going to still be cleaning the airport which is what they're doing now so i want to hear from the rest of the public speakers but to me the quickest easiest fairest way is to approve this and let the circuit court judge decide if doha acted outside the scope mr mayor i've been asked no question yep the county attorney yes or no if they prevail if triangle prevails in the circuit court do they automatically then get the award it would go back and i um it comes back to the board right with that direction so in the same with the direction that we would rejigger the um the the point and then so there's several more steps after the circuit court rules but but if triangle wins in circuit court they will ultimately get the contract yes we're going to do our speakers who's next mr mayor please have a seat thank you yeah oh yes say one thing so i know you brought up an important point about the procurement code and and the administrator mentioned that she stands by the code so if you stand by the code isn't this going to occur again is there anything that you need to do or we need to do because if you're saying you stand by what's in the code then we could be here again so to answer your question commissioner at that point the code also allows for this legal process to occur so because they have the right to appeal in court at this point the final as my understanding the final step would be for a court a circuit court to determine the factual um determination of this case and then that would be the final action so yeah but why is it that you don't change the code why would somebody have to go to court every time because the code you're saying you stand by the code so so what the issue at hand is is that one side disagreed with the points being awarded to the other firm and so that was the disagreement it wasn't a disagreement on the code they just disagreed that the firm was deserving of the points so then an administrative law judge reviewed the the facts in the case and while i believe as i stated that um that my procurement department appropriately assigned the points the administrative law judge reviewed all the facts and that administrative law judge made a different determination i was just saying that i was respecting the order but i disagreed with how that determination was made and so i asked my lee i asked my county attorney for their professional opinion and and i asked them do i have a basis in law or fact to over to to concur or to side differently than the administrative law judge the answer i received was no so then i felt i needed to follow the administrative law judge's order this is just an issue of whether they have 25 preference points or not that's it let's go to next speaker next speaker is george picom followed by bernie friedman good morning good good morning good afternoon sorry afternoon yes uh thank you for giving me you know what we're going to need uh to do a motion to extend the meeting i have a motion i have a motion a second all in favor any opposed showing that failing no passing nine nothing please start sir my name is george picom and i am the ceo of triangle services one of our owners perry fine wanted to be here today but unfortunately was out of the country for a prior commitment uh just a little bit about triangle we have proudly served broward county community for over 30 years and as a locally based business for over three years um and that is what's coming into question right here right now um so our principal place of business is in fort lauderdale uh we value our partnership that we've had with broward county for many years uh and appreciate the opportunity to continue to participate in broward's broward county's participant procurement processes sorry our partnership with the county has always been very important to us and we look forward to continuing that relationship we understand the county's responsibility to conduct procurements fairly consistently and according to its established rules and code we recognize the competition as part of the process and we respect the county's role in making procurement decisions however we are here today because we believe an important issue arose in how the local business preference requirements were applied in this procurement um and i'll go back to a question and point that we were just talking about but um our principal place of business here is here in fort lauderdale we attested to that under penalty of perjury our owner signed a document which was an extent i don't believe has been taken previously um and we have refocused our efforts on serving businesses in broward county uh so we participated in this procurement in good faith good faith yet the decision to remove triangles local preference points materially changed our ranking and the outcome of the competition um so i'll go to the point um that was mentioned that the county administrator um needed uh law or fact now my understanding is it is part of the code that she has the the ability to accept reject or modify may i have just a few more seconds a few more seconds um and at the beginning of the initial doha hearing to the point that commissioner ud made um he stated that he was using a de novo standard to review the case per broward county code that is not the standard in which he is supposed to be reviewing that hearing so right there it is fact and reason that he reviewed under the wrong standard and that same administrative law judge was overturned for the same thing very similar case in 2023 so i just want that to be understood yes thank you sir thank you very much thank you who's next next speaker is bernie friedman followed by harris harrigan okay thank you anyway bernie friedman with becker lawyers first of all i want to thank the purchasing department county administration and the county attorney this has been a two-year journey uh unfortunately and i also want to thank mary moss the purchasing agent who has lived with this for the last two years some very quick points factually the issues have been fully vetted yes we asked two years ago to go to hearing officers because basically the local hearing officers always ruled for the county and everyone wanted to get an impartial like by a non-biased hearing officer so we all said that we wanted to go to tallahassee this issue was completely and fully vetted we don't want to get into the weeds again and relitigate all the issues here today second of all not one but two different hearing officers heard this case there were two protests in this case that were heard by the hearing officers the first case had hours and hours of hearings evidence and by the way they did use the right standard and mark sempler can talk about that our lawyer who litigated that case i want to read into the record what the hearing officer said the hearing officer said on page 22 which was a long order that the county had a great deal of information at its disposal affirming triangles out of state headquarters or principal place of business their decision to reject sunshine's protests and uphold the decision to award local preference points to triangle was arbitrary and not not supported by substantial competent evidence the denial of the protest does not conform to the rfp's requirements or to the broward county code that was the first hearing officer the second hearing officer basically did a summary judgment and said this is ridiculous what are we back here again today another hearing officer just heard this case and i'm not going to rehear this case again and that was dismissed so here we are today according to the county code and it's section 21.88 that code requires that you approve the contract and then they have their opportunity to have a day in court on september 3rd they jumped the gun and they filed lawsuit against broward county it wasn't right the county filed a motion to dismiss we joined that motion to dismiss after today they can have their day in court and we'll litigate this in court and hopefully uh sunshine will be back i guess we won't have to come back because the county administrator has been delegated with the authority to award it thank you very much thank you mr freeman next who's next the next speaker is harris harrigan followed by mark stempler good afternoon sir good afternoon mayor and commissioners uh thank you uh my name is harris harrigan i'm the political director for 32bj seiu we're the union that that that represents airport workers janitors and security officers uh i'm here to express support for item 46. 32bj represents uh janitors at the fort lateral airport as well in all county properties uh at the airport we have a collective bargaining agreement with sunshine and its subcontractors the cba protects the workers wages uh their benefits and the working conditions at the airport sunshine has behaved as a responsible contractor and employer especially now that local living wages uh have been uh preempted well the local living wages laws have been preempted uh the county must be diligent about contracting with responsible contractors thank you thank you sir next our final speaker is mark stempler good afternoon mark stempler from the becker law firm on behalf of sunshine cleaning i i'm not here to re-litigate the whole case and i'm not going to go over every point but i am here to answer any questions about the process and procedure that has taken place so far um this has been a long process but we're still in the middle of it the next step in this process is for the county to award the contract to sunshine and then triangle can have its day in court but right now there's a motion to dismiss pending in court where triangle has sued the county filed by the county saying you have to dismiss this case until the county takes final agency action that's really what we're here discussing today so like i said i can answer any questions the the commission may have but you have to award in order for the next step to occur in the county's own process under its code uh and just to clarify one point that has been i think uh distorted a little bit the administrative law judge independent in tallahassee did apply the right standard and coming to his recommended award in favor of sunshine uh there's this de novo standard that's mentioned at the beginning of the hearing that's borne out by the transcript but that's not what was applied he looked at mounds of evidence and hours of testimony and then came to that conclusion so it was a fair process we're here today to to uh you know defend that but this is what has to happen in order for this process to play out thank you coming back to the dais so i'm happy to go i'll move 46 a b and see second so i have a motion moving 46 a b and c and i have a second is there any uh discussion seeing no discussion all in favor all right any opposed show that passes unanimously and we're moving on number uh 47 item 47 has two motions motion a is a motion to approve single source designation of vidtronics ticket and label llc for baggage tags and boarding passes for the aviation department motion b is a motion to award opening contract to single source vidtronics ticket and label llc for vidtronics baggage tags and boarding passes no members of the public decide to speak on the item i have a motion 47 second second by vice mayor all in favor of 47 a and b any opposed show that passing eight zero um the next would be four um next would be what 51 i'm sorry what am i doing 54 i'm sorry what's next 50 54. item 54 has two motions motion a is a motion to renew consideration of item 14 for the county commission's october 16th october 6 2026 meeting motion b is a motion to adopt resolution making certain findings regarding a county owned parcel of real property authorizing the real property and real estate development division to commence and manage the sale process for the property in accordance with the settlement agreement no members of the public have signed up to speak on the item um this is commissioner ver is this your item i think it came up from the county but i'm happy to address it this is this has to do with piece of property that is owned uh with 24 cities and the county um that it is gone from it was in 2015 we decided not to sell it it was one of the assets that was divided after the rv split uh it has gone through three extensions the initial contract allowed for three extensions the alpha 250 the alpha 250 at the last solid waste authority meeting there were there are cities that are interested in trying to keep this as a possibility for use for the solid waste authority um but we uh to to the county attorney's um um point we need to pass this but um senator geller has a an amendment to this to which the solid waste authority many of the members of the board are in approval of that they they they uh because it gives them a chance to see if they can gather all the cities together to say yes let's keep this justice to explain the amendment before that yes sir just for clarification and i know the answer can you just tell the public where this is i know you indicated sure how long we've been working on it but just where it is and this is this is uh in pompano yep it's in pompano near yeah yep so that's where it is okay where is it where is it uh in you know it probably better than i just uh so if you go um copeland's road in blunt road if you just go north uh uh uh to copeland's in that area that's where it's the alpha 250 is a 22 acre site yeah i know where it is i wanted just the public to be clear what we're doing i know how hard you've been working on it so yeah thank you but i didn't know all the streets right mr mayor i'd like to explain the amendment thank you and um i brought this up at the solid waste authority which was an agreement the uh there is a concern uh we are we cannot go into default uh but the only way that we can avoid default is if we get 25 cities to agree to extend so what this amendment would do is move forward so that we're not in default but say that if the 25 cities agree that it automatically comes back to the commission without any further vote um to the county administrator and we would then be able to to delay it if they get the 25 cities so that we're not in default and uh commissioner ferr did you have any additional the part with i know there had been some discussion there about the county putting forth the resolution saying we would be in favor of trying to keep this within the you know together so that we all have it together is that part of my amendment if not i have no problem with it uh it may have is that part of my amendment currently not i would have no objection i would consider that a friendly amendment yeah i think that was the way that it originally be planned for the county to say we're in favor of trying to keep this collectively owned together um so so that and if the solid waste authority at some point uh needed to use this we would we also it was brought up that pompano was interested in doing it perhaps for solid waste use we don't know we're not sure about that so yeah right so just a move moving of this item so we can because since you're in agreement can we move yeah it's a little i mean i'm not sure i'm i would consider that a friendly okay all right so just just because um the item authorizes so in perhaps a show um of that supporting that approach authorizes the county administrator to execute any agreement if the if if the other municipalities came back with that so you're essentially pre-approving a potential amendment to allow um additional time but if you're going to do an independent resolution we'd have to bring something back to the board so we're kind of leading the way on we're approving a potential amendment to allow the property to be yeah i'll move it only if they get the 25 cities to agree only if the inherent policy can be stipulated in the conjunctification of the overall process exactly see you did understand it i'll second that no more lawyers on here so that's um senator geller's amendment is has been moved so so that was just a motion to amend the item with senator geller's um yes and you and you got a second i want to amend his motion to amend amendment to my amendment the amended motion so it's amended correctly and it complies with the rule against perpetuities i'm sorry could he just excuse me we're moving this all right so so do you want to say council um no which one of us which county attorney please i think we need a 30 minute break no we're done i think county attorney so just so we have a motion we have a motion regarding the amended number 54 correct so i would vote on on senator geller's amendment item 54 so we have we have a motion and a second motion is second all in disfavor say aye all in favor aye aye aye any opposed show it not passing okay show it passing unanimously i said all in disfavor and you said aye so i guess that you're against it i'm in favor of the amendment does anybody oppose it okay all in favor you got it aye okay and show it passing unanimously and then take item 54 in total on your toes i like that we should not all in disfavor that's the way we got to start all right and then item 54 you can take the entire item as amended i think we moved it as amended second you vote on the amendment now we're moving as men we have a motion to second all in favor aye any opposed show it passing except for renee show it passing unanimously that's uh the entire item 54 with a b and c as amended by senator geller okay okay we have um now our our long drawn out speeches by our commissioners this is anybody uh i'll start with commissioner rogers senator geller you've already added your time allotment already so i i just wanted mr rogers no no no you're you're first you're first you're yielding okay i just wanted to thank monica i wanted to thank i had another one of my steve geller town meetings yesterday richard tournees and rasa mawad show up after hours at every one of my town meetings they are you know wonderful employees giving their time like that and i just wanted to make sure that you knew that mr fisher it's recovered thank god recently attended the grand opening of the parkland residence in oakland park want to thank the deitschmans for all they did there working with the city was amazing also sweetwaters restaurant i think everybody was there for that thank you for that and for heisinger park what a great addition to to our community there lastly uh paula prendergast uh executive director of the american red cross of broward county she resigned from her position of nearly 12 years of service want to thank her for all she's done for broward county thank you mayor thank you mr fur thank you very much um i had my last final meeting at the uh solid waste authority um i know done i'm done it it it it was a emotional meeting at which commissioner furr teared up i did tell him i did tell him don't everybody screw it up because it's been taking too long um you know that was that was that was about all i could eke out um but you know the good thing is uh carol shuham who's taking my place has been on that executive committee for from the beginning she knows her stuff she she would be it could be seamless but it and and and i say that because it is at a critical juncture right now the next year and a half through all the rfps and all those things that are going out um it needs somebody it needs some continuity that's kind of what i'm trying to say monica what if you retain him once he's off the day is yeah no i'm going on road trip road trip no golf clubs no a lot of golf clubs yes um second i want to uh at the congratulate the broward county cultural division for an exciting event they're having on october 29th at the broward center they're launching 50 years of public art and design a new book that will be definitive history of visual art here in broward county it should be a great event um and lastly the uh dania passed or they deferred the vote on the mangroves they did and uh first they had denied they had not taken a vote no one seconded it their attorney said no you have to go take a vote they're deferring it until the environmental impact is given to them from our department i you know i i have a feeling based on what i'm seeing that that in that environmental report is going to be saying don't mess this up because you've got all kind of wildlife there that mangroves is essential for providing preventing flooding all those kind of things um at some point and i'm going to say it again i know monica's heard me say this a million times i do think this land is is in the interest of the county having because it is a swath it goes that drains part of the stuff coming from the airport part of the stuff coming from port everglades from there down into the dania beach canal right now it's most of those drainages are going to be just on the south side of this if it was on the north side it'd be it'd be a guarantee we would need to do it but if you take into consideration sea level rise lay many years from now then it's going then that comes into play so i'm not going to be here to to try to get this passed but after dania takes a vote and does that environmental impact for you you all may want to be thinking in terms of buying that land or finding some way to to have control then okay and that's all i've got thank you do you have anything that you'd like to ask no thank you yes i do um we spoke of something in the past when we were talking about the ems transporters and there was a young lady here a small vendor who had nothing to do with what we were talking about in the procurement process she's only we're talking about providing a service shipping providing at knox at um land knocks land knocks village where is that can you bring it back later on not now but i want to know where it is because we sit here and we say that we don't want to hurt the small business we sit here and say all these things about um economic development but we all agreed that we wouldn't hold her as a part of that process and i think that process is still moving forward has been held up somewhere and i think she's still out there has all the insurances and she just wants to go pick up those people in a non-emergent uh situation so can you bring that back to us later not now so we can discuss it so as i just just so we can we all say we wanted to get her out of but she's i understand she's she's more entangled now than she was when she came here so as i understand it just for the understanding of of the body as well is that i believe the last action you all made was to refer it back to the ems council to discuss as part of that and i think that's where we but we excluded her we said we're going to get her out of here but that's over a year ago so i'm just saying where is she down is she still tangled up so i will have to we may not ever get i will check with um michael ruiz who has has been working that's all i want to happen to her because we all agreed to help her but is she being helped or is she being i will get the status and get back and yesterday the um the visit lauderdale interviews uh i thought it was it went well but where do we go from here so we collectively can have input on the interview that took place yesterday for visit lauderdale replacement and that whole process when are we going to have an opportunity to to opine you can bring that back to us later that's just what i want to put in the public because i can't speak to my colleagues about anything right now and i don't want to prolong this meeting but i think we don't need we don't need we should move the process forward until we all have an opportunity to speak about what we witnessed or experienced yesterday and the process as it moves forward the job no i said no more commissioners no not especially not you maybe maybe you dean but not you okay okay i just i have just two quick things i just wanted to let everyone know that there's going to be an exceptional um workshop at the broward center um on october 22nd which is thursday and it is the state of housing affordability in broward and we are sponsors uh along with um the coordinating council of broward and the broward housing council of course and wells fargo um i just want to say that um ned murray will be there and he will be giving presenting the latest findings from his last from this most recent study uh highlighting you know current market conditions demographic trends affordability challenges all those kinds of things and then there'll be a couple of wonderful panels uh that have um several of our people on on them uh the the one about how affordable housing comes to life in broward we'll have um sandra bessie einhorn will be moderating it and uh um uh mitchell rosenstein who many of you know is green mills group he did seven on seventh uh for bphi and he's going to be doing the new the new one uh also ralph stone is on that one and barbara blake boy and walter duke who's been very involved and there it's a it's it's a it convenes at eight for registration but the program basically starts around uh 8 30 quarter to nine and it goes till noon and then the other thing i just wanted to mention is there was one of the one of the young women today mentioned that she kind of got her start at the broward county debate program in our schools and um just wanted to mention because it's something that's dear to my heart because my daughter is the one that helped start that and it's still going strong all these years every year they have a big event so this year is not going to be a luncheon it's going to be um the annual debate event will be at broward community college because now they've become very involved thankfully also among others um and that's november 2nd from 4 to 6 pm can we amend that rich yes um spencer who works for me in my office full-time college he was a national debate champion yeah we are we are so fortunate i mean with this that's i can just say about the schools it's an incredible program it's the largest of any public school district in the in this in the in the united states and so many of these kids go on they get scholarships uh and there's a there's a clothing bank for kids you know who might not have the ability to get the clothes that they need to go on these debate trips and they get paid for so it is so it's a fabulous thing for young people and uh so it's still going strong but that's the next one november 2nd commissioner dean thank you i have two points that i'd like to make make it quick thank you sure i'll be very quick first um i just wanted to mention i know we read in the paper about bob swindell leaving the alliance and retiring and he did an amazing job and he'll move on and someone else will come in and i i think that i one of the things that i did two weeks ago and i didn't have a chance to speak it at the last meeting but i just wanted to bring the commissioners up to date i went by the opening of the carnegie mellon university that they're going to have down in winwood i wanted to go to make sure i kind of found out about it last minute and went down there i wanted to make sure that broward had some representation there because you got vanderbilt that's coming to palm beach i didn't invite bogan because he's yeah no one wants to invite him uh no i'm just teasing but uh so carnegie melling it carnegie mellon is doing a full-blown satellite campus in winwood there'll be a lot of broward county students that will try and and and use that it's another amazing uh addition to the education uh opportunities in our area most of the times when we're seeing some of these larger companies come down one of the things they're looking at is education opportunities through the whole spectrum so i thought that was a home run and i intend over the next couple years to keep on top of that to see where broward could play you know participate in some of that as we bring in some of these different financial services firms and hedge funds the other thing i wanted to do is i i got my uh budget book in brief from county administration i wanted to uh thank them and for the public and i want my comments on this one when they do the transcription i want verbatim on these comments please broward county continues to maintain the highest possible credit rating and general obligation bond rating at triple a from all three major rating agencies the adopted budget preserves the county's strong financial position by ensuring all financial obligations are fully addressed the fy27 adopted budget reduces the county all over county's overall millage rate to 5.6628 mills it also reduced the bmsd unincorporated operating millage to 2.3341 and reduced all six water control district millage rates to the rollback rate since since fy26 the county has had zero general obligation bond debt it's all paid off reflecting the county's continued commitment to prudent financial management most importantly public safety remains one of the county's highest priorities to demonstrate the county's strong commitment to public safety the adopted budget includes the county's largest investment in public safety in broward county's history the third and final year of the eight million dollar salary adjustment adjustment for bso detention deputies as originally promised by the sheriff two years ago and reiterated as his priority this year when he came in for the budget this represents a 24 million dollar total increase for salary adjustments there we also did a 15 million dollar increase for a 5.8 salary increase inclusive of benefits of fika and frs for bso departments including general law enforcement courts fire rescue and emergency services in addition to an increase to bso's special risk for the frs along with a 19.1 million dollar bso health insurance increase we fully funded bso's operating expense and capital outlay budget for fiscal year 27 to close bso budget has increased fiscal 26 by by 6.4 percent when you account the moving of the utilities and maintenance which was previously included in their budget that 6.4 percent compares to the county general fund that only went up 3.4 percent to their thing so i just want to compliment county administration and our finance department i'm bringing in a budget with lower millage rate the highest pop ever in public safety and completely balanced books in our budget thank you thank you for that unheard of speech commissioner davis i'll be quick um i want to concur with uh vice mayor mckenzie on the the bls um the young lady came before us over a year ago and we had promised she was the only one uh that would have been on that list for bls um basic life support services and we have yet to bring her back before this board and do anything with that so um i would also like to see that come back before the board uh the other thing is um in terms of the i have asked the attorneys to look in to look in to our charter and the point brought up about the three people that were brought before us for the job as far as visit lauderdale um and i know in our charter it talks about the commission being able to um when when directors are chosen being able to have a say so as far as who gets the job but over the years it seems like things have been splintered between department directors offices and it seems like our involvement has been watered down so i really want to get to the point where the charter made sure that these positions came before us as to when it dwindled down to where we have now more offices than we have departments and so the office positions don't come before us and my understanding is that the visit lauderdale is now an office it's not even a department and so therefore you know it's not going to really come before us at all so i hope that i can get that clarification as to when things when where you have now more offices than department directors they all report to our administrator but then we have less input now than we did back when the charter was created so i look forward to that information well well you don't understand if we brought back and you'll understand further the the organizational chart has i know maybe four or five departments but nine offices and really the only ones that we have any input on is department directors and you'd be surprised to see the ones that we don't have input on which is visit lauderdale uh the cultural department new division because it's not even a department anymore and also uh the office of economic development and small business they're totally out of we have no say so at all but i can i and i want stuff to research that when the charter was created was it all departments and when did we siphon off the responsibilities of this commission where now we have more offices and agencies than we have departments and in so doing we do not have a say so i just want i just want that to be brought back what what siphoned off i don't understand we all have an input no no the charter is clear about departments what we have an input on we don't have an input on anything else what department do we not have an input on well that's going to be there are several departments we have input on but what i'm saying to you there are offices and agencies that you do not have an input on like i just mentioned visit lauderdale i mean you don't have the final say so at all well our our county administrator would oversee but she doesn't have the final say so on departments did you know that she doesn't have the final say so on departments department heads yeah according to the charter if we revisit the charter let me finish what i'm saying if you revisit the charter i think it clearly states in in in those in the directorships where the approval is needed i think what you're trying to communicate is that maybe we need to include other departments and maybe that's a discussion we have in the future or workshop right like we do everything else all right that's what i'm saying that you know we don't have a say so in a lot of them but we do according to the charter have say so in departments and and because the mayor you know the the incoming mayor is gonna be so busy usually the the former mayor can be over those departments we could we could make some some new rules and anyway and commissioner i wasn't doubting you when you came back to me i would just say i don't understand you came back and i didn't i didn't understand what you're talking about so thank you for the explanation but i wasn't in a greater thank you i appreciate you at all it was just you were coming back kind of but so i didn't know because i i saw the faces that you didn't understand so i wanted to be clear of what what i was saying so i had to emphasize that but that's what i did but i made it clear to monica knows when we move forward with the mayorship that i do want to have a discussion about um the charter and how we operate oftentimes new people come on and uh you'll hear comments like you know i did that or we did that in the past but uh which is fine but i think if we understand what our do's and don'ts are you often say to me uh uh commissioner for that you know the charter says this and i i respect that because i think the charter is how we is our only constitution to be governed by so i do want to do a workshop or a full discussion on that moving forward without the emeritus mayor come november 17th county minister any uh reports yes uh quickly and and thank you uh vice mayor and and commissioner davis um i know we've had these conversations and um i think uh we have communicated to the board um the charter review commission is is going coming up so that's a perfect opportunity as well in addition to your workshop um that you'd like to discuss this um one of the reasons why um it was very important for the cvb um position um that uh one of the many many reasons why we had the reception last night as well so i wanted to make sure that i got the opportunity to put the finalists in front of the county commission as well as some of the community members to get feedback and i've heard from many of you that were there last night already um and i still intend obviously to connect with each of the commissioners to get individual feedback um and you're correct uh commissioner davis that not all of the agencies within county government um come to the board for confirmation um just the major
