thank you thank you all right hey i appreciate uh if everyone could uh grab a seat and we'll get the meeting started i'd like to good morning to everybody um welcome to the brower county commission meeting today is august 20th 2026 and we're going to start with the pledge of allegiance and since our county attorney drew myers's last day it's only apropos that you lead everybody here in the pledge of allegiance for which it stands one nation under god indivisible with liberty and justice for all please remain standing please remain standing it's customary that we observe a moment of silence in honor of notable persons from our community who have recently passed i'm going to go around the dais to ask any commissioners if they want to recognize anybody starting with commissioner rogers i remember how to use this thing i've been gone so long all right that's good and welcome back everyone and to those in the audience watching us online i first would like to acknowledge steve geller because he reminded me of my mom this morning i was trying to be strong thank you everyone for your kindness and just thanking you don't want to talk about it but a special tribute that was made by the geller family to plant a tree in israel in honor of mom is greatly appreciated thank you very much and let me go back to the people of my district officer rosanna mcwilliams city of sunrise okay we are deeply saddened by the passing of officer mcneil a beloved member of sunrise police department since 2019 and our heartfelt thoughts and prayers are with her our family and children and of course may her dedicated legacy bring comfort to all who knew her mr archie mckeaton city of lauderdale lakes of course we extend our deepest condolences to the family and friend of mr archie mckeaton an honorable veteran a dear friend long-time supporter participation very involved in the eastgate homeowner's association we profoundly and gratefully thank him for his service and will deeply miss by everyone in eastgate may his soul rest in peace and thank you for listening thank you mayor um i want to first recognize uh dotty mancini dotty mancini was a huge force in the health uh industry she actually worked her way up from being a nurse all the way to being imperial points a ceo and to the point that they actually named the dotty mancini park behind imperial point hospital so a true uh warrior and for our county uh fer mcbride passed away she was the secretary of the gulf mile association uh active member at the regency tower and she actually worked for a broward county schools system uh when she retired and she will be sorely missed and then mary mccauley uh was another fixture at the public chamber of commerce she worked there as a volunteer for 16 years and suddenly passed away and so our prayers are with her and her family and then um larry davis a prominent attorney uh here in fort lauderdale a lot of you knew a dear friend to sam goran and uh another kind of a surprise at the end of the day that larry passed so just want to keep your body in the prayers thank you we had a sorry we had a couple of giants pass away in southeast broward this last couple weeks you know one was steve worthman who many people know him uh he was a good man uh in so many ways to so many people for so many reasons and he found ways to just help people all over all over this county he was our direct or i think he was the uh department head i'm not sure what it was for hit for homeless in in the county well while he was here this is a number of years ago and everybody would go to steve for him for best practices on homeless he was he was the go-to person in this county and uh just did he was one of the kindest people you'll ever meet and our prayers go out to uh kathy worthman who is his wife and also to larry davis who was uh also a just a giant in this in this county in terms of helping just people all over but in terms of elections and trying to preserve democracy in this county nobody worked harder on that nobody he was a he was a he was a go-to person on election monitoring and making sure that our uh that our government our democracy was was safe and both will be incredibly missed yeah yeah um i also would like to uh recognize the loss of of larry davis um larry was just a giant in this community um he really cared about people vulnerable people um i had the privilege of working with him for many years on the bar behavioral health coalition uh he was a founding member of the bbhc and uh along with bob butterworth and they were dear dear friends and uh uh i just think you know there are people who with mental illness he was he was always concerned he just cared such a great just a great deal and um um my my thoughts and prayers i hope all of our thoughts and prayers go out to janet his wife and their family um and he will be sorely missed in this community but he leaves an incredible legacy which it would be great if everyone could follow uh i also want to uh extend my condolences to larry davis and the family i mean he told me i was his favorite county commissioner so i don't know about any of that but i i really like larry i enjoyed working with him i should probably said that to everyone but uh larry hat i'll i'll miss him just a great guy and i also um uh we lost dave ericks candace's father um i like to call him uncle dave because he used to give me a lot of good advice over the years and uh candace is great and uh dave was uh an interesting fun guy and uh he he's in my prayers and my thoughts for his family and i think there's a celebration of life on monday so uh he deserves it and i look forward to celebrating his life let us all honor let us also honor all the brave men and women who have served and continue to serve in our armed forces both here and abroad and thank them for their service and i ask that we pause a moment of silence thank you please have a seat mayor real quick i just wanted to recognize someone who's always been our security here in the rear of us officer davis is going to be your last day here when serving in this capacity so officer davis i want to thank you for all you've done for us god bless you okay i i also was wrong with saying our attorney's last this is your last commission meeting but you're still going to come to our 25th budget meeting so it's not your last day not off the hook yeah just made plans for tomorrow and next week mayor today's breakfast and music was provided by vice mayor mckenzie um must be the music by secret weapon and gotta give it up by marvin gay and thank you and i think vice mayor is he on the line now he is okay great yes i am good morning morning vice mayor um we have an 11 30 special set time for number 85 and today we're going to start with two proclamations the first proclamation before we get down down to it um many of us who've been here i've been here 12 years with beam and a lot of us we used to get annual um uh every year people would come here it's talking about our animal care how horrible the animals were being treated and poorly things were not good and we finally got a director of our animal care division who's doing just a super great job and we want to honor him doug brightwell if you want to come on down okay whereas broward county proudly recognizes william douglas doug brightwell an accomplished and dedicated leader who brings more than 20 years of comprehensive animal welfare experience for broward county animal care the second largest county operated animal welfare agency in florida and whereas under mr brightwell's leadership broward county animal care is celebrating a record-setting year of lifesaving impact achieving remarkable gains in fiscal year year of 2025 including 3894 pet adoptions over 160 more than the previous year 565 reunifications with families representing a 31% increase and 733 rescue transfers nearly 200 more than the year prior what a great job whereas mr brightwell's direction has led to faster pathways to safety for animals reducing the average stay for dogs by nearly 11 days and for cats by more than two days contributing to higher quality care and quicker matches with loving families and whereas the agency's live release rate rose to 82.79% demonstrating continued progress in saving lives and reflecting mr brightwell's commitment to ensuring that every pet receives compassionate care and the best possible outcome and whereas since assuming the role of director mr brightwell has strengthened community partnerships elevated public visibility decreased long-term long-stay dog populations by nine percent and increased short-stay dog outcomes by eight percent within the first seven months of leadership and lastly whereas borough county animal care has flourished under its leadership earning three national awards for excellence including the prestigious judges award for its shelter capacity crisis campaign expanding adoption programs for long-stay dogs increasing cat and kitten adoptions through retail partnerships and enhancing public outreach through expanded vaccination clinics to protect sterilization programs and humane code enforcement now therefore be proclaimed by the county board of county commissioners that the board hereby honors william douglas doug brightwell for his exceptional leadership steadfast dedication to animal welfare and inspiring service to the residents and animals. thank you mayor vice mayor commissioners administration i just want to say it's been a very huge privilege for me to be here in broward county the support of this commission and this administration has enabled us to do all of the great work we are doing our team from our kennel staff our animal control officers our administration our customer service folks they all work very hard and they care a great deal about the work that we do and i want to thank them because they are the reason we are successful in doing the things that we're doing so thank you all very much thank you mayor can i say one word real quick i think it's great that i really appreciate the fact that you're shining a light on those employees and that are doing and departments that are doing so much given the tax amendment that's coming up it's good for people to know all the different things that the county does animal control is one of the main things so it's good to know i think you want to face it toward the commissioners and let me describe that our next commission i'm sorry next proclamation that says for the developmental resources educational workforce can i have that and the reason there's nobody down here from here from the developmental resources educational workforce is because there's no such organization can you believe that i mean i think it's the first time we ever want to do a proclamation you know for an association that's not even existing well i think i misspelled it and let's just talk about how this is so if we just misspelled we take that a little sense of humor sorry drew i have that bad sense of humor doesn't true have to come down not yet so normally a proclamation talks about a person's schooling and their background and kind of boring so what i wanted to do is a proclamation is a proclamation where his clients actually are part of the proclamation that they could say how they feel about him so we are his clients we're the board of county commissioners you are our attorney and so this proclamation is going to have each one of us has something to say we're going to start with district one nan rich and nan why don't you go first and uh you can read it to drew very happy to whereas where is drew oh there he is okay whereas drew has had a long and distinguished career with broward county and has been a very special part of my experience as a broward county commissioner he is compassionate considerate caring and always ready to help drew is always making sure that he keeps us out of trouble while trying to find a way to help us achieve our the goals that we wish to accomplish district two will be me whereas when looking for the definition of the words honesty integrity class intelligence and ethical you do not need to go any further than look at andrew myers what an outstanding individual that will be greatly missed thank you for your friendship advice and always being there now third michael whereas you managed the nearly impossible for years keeping nine opinionated type a personalities in line legally you did it with great wisdom wit and humor enjoy your next well-deserved chapter whereas for the past eight years drew myers he's gonna look the other way now whereas for the past eight years drew myers has been an inspirational part of my life and a mentor to me both professionally and personally i've never met such an outstanding individual displaying class and dignity and always placing others before himself a true public servant his expertise and knowledge in government law is unparalleled to none and will be irreplaceable for many years to come susan i ask for god's blessings upon him and don as they now are able to enjoy their fruits of labor and their beautiful family mayor bogan told me had to shorten mine so this is what's left whereas i've dealt with many local government attorneys and andrew drew myers is undoubtedly one of the best a great lawyer a great leader a great friend and he will certainly be missed except no because we'll still be seeing each other whereas we're thankful for your oh so subtle way of watching our back by slowly standing up and and giving us the dad look when we're saying when we're sidebarring way too close for comfort thank you as drew has served the broward county's attorney's office well and as a fellow sagittarius i can relate to his no-nonsense style tenacity as well as his sincerity i wish you an adventurous and fun-filled retirement vice mayor mckenzie i will read yours unless you want to read yours whereas we spit together will be forever etched in the long walls so bye bye and heart drew i see the respect from your team and your love and honor for the position entrusted to you best wishes for the future enjoy now therefore be proclaimed by the broward county board of county commissioners that the board hereby designates thursday august 20th 2026 is andrew drew myers day in broward county florida come down and say something or do you want to say it from there oh i'll come down for a picture though yeah you guys did it well mostly i did he's staying you want to come up here and all right yes i thank you did you have your speech somewhere else yeah i do i'm going to grab it from over there and i promise you it's short thank you everybody uh got emotional for for a second there but i rallied so thank you thank you to melissa for uh bringing me a tissue just in case and oh don uh don don's here yes always makes me emotional um i was expecting to look at you guys when i was doing this but uh i'll do it this way so but uh thank you for your very uh kind comments and i'd like to briefly recognize some people first the board and vice mayor you're up there or up there somewhere i was hoping to get out of mayor bogan one more eight billion dollar organization in our communication system but everything was flawless today thank you for trusting me to be county attorney and for your consistent support for the office i think most of you know or at least five of you know i had planned to be county attorney for five years and i wound up doing it for almost nine and that's a direct result of the respect and appreciation i have for the board five members of the board that appointed me are still on the dais and i want to recognize them in order uh senator rich among your many great qualities is your tireless passion and speaking for those most in need the times i have seen you most upset and i haven't seen you really upset a lot but the times i've seen you most upset were when things were not moving quickly enough and it was negatively impacting those in dire need of county services and i can't imagine there is anyone in the state who is focused more on the issue of housing affordability uh mayor bogan on top of your many strengths and success as a public official lawyer and business person you have consistently championed matters that protect people your heart project is a great example but only one example you are also perhaps i think we all know uh the most generous person i know uh commissioner ud dean i greatly admire your practicality directness and your business acumen you call them as you see them you have a great crystal ball uh you really do you should be in vegas more uh and you're willing to take stands on things even if you know doing so will mean swimming against the current uh senator geller i've learned a lot watching you combine your tremendous political skills and your tremendous experience as a lawyer and great legal skills for example you've worked on a lot of mediations with me here and i watch you maneuver there and i see how quickly people come to trust you and that's a rare talent that serves the county well uh commissioner fur uh not too too far uh behind me uh i litigated the term limits case and i am happy the good part of it is we got to have all of you because the term limits and the bad part is that sometimes we lose one of you we've worked together on a number of matters and regardless of what the matter is your knowledge and collegiality combine to move the needle even in settings where and we all know what those settings are where the county is sometimes seen as an outsider uh four of our commissioners took office after after i was appointed commissioner fisher i was very close to commissioner lamarca and i was upset when he left uh so imagine how blessed i felt when somebody with such tremendous experience high character skill and dedication took that seat uh truly a blessing uh and then commissioners homeless and sharif left but again what great luck on my part uh to get vice mayor mckenzie and commissioner rogers vice mayor you're uh you're shrewd and direct uh a little more indirect today and you'll be a you'll be a fine mayor commissioner rogers even beyond your skills and well-earned reputation your kindness and graciousness are very much appreciated the most recent leave of the nine who appointed me was commissioner ryan i learned a lot from him over the years watching him and i miss working with him and as we know commissioner ryan spot was taken by commissioner davis uh we probably have too much in common for our own good uh but uh but that's okay uh i uh i wish you every success moving forward and best of luck uh to our county auditor bob i appreciate everything you kathy ann and your entire team do i want to recognize the county's amazing staff led by monica monica you've put together an incredible team i won't mention a bunch of names because uh i don't want to take too long and i will risk leaving some folks out but i want to recognize kevin who's looking down and working right now uh i've worked i've worked with kevin pretty much my entire career and is evident by the fact that he's multitasking even right now uh he adds value to everything he touches and he touches a lot of things uh the last group i want to mention is the legal team uh i could send a lot of them here now i could say great things about every last one of them and i could brag about some of them for hours and you guys know sometimes sometimes i do uh we have a deep bench broad expertise and total dedication we know we need to be responsive creative efficient and right it has been a joy to watch so many grow into incredible lawyers and i'm proud to call them my colleagues our deputy county attorneys have been a critical part of the success we've achieved maite and mike kerr are the only lawyers who have been with the office longer than i have they each have a total command of their practice areas which enabled me to become conversant in those areas rather than fluent which has been a tremendous help we recently celebrated maite's 35th year with the office and mike is leaving later this year after 38 years with the office those are big shoes to fill then we have by comparison the new guard danielle adam and nathaniel they're excellent lawyers and leaders who will continue to elevate the office you'll notice that that's not renee renee is out in northern california balancing work and hiking and trying to squeeze a few more weeks at a summer renee leads by example is a quick learner a willing doer and an expert in so many things since the day i became county attorney she has been an essential part of building the office i'm leaving somebody out oh the last lawyer i will mention is my successor anika is brilliant accomplished dedicated and independent she's ready to leave the office i'm confident anika will consistently provide the timely and wise counsel i have always tried my best to provide i want to thank melissa jillian and eric our senior staff for keeping the caos administrative side running smoothly and finally and i'm not going to look at her my wife dawn is here today uh she knows how i feel about her so i won't get into that uh i i do want to thank her for all the sacrifices that she's made and uh all the things she's done to enable me to do the best job that i could it's been an honor to be county attorney thank you for all of you so i'll hold the bear's hand before i get to my other uh items first of all uh where's dennis walker dennis where are you bud is he leave already dennis so vice mayor mckenzie's got a one of his staff people's name dennis come on here so we've had a heart program by the way where people can get scanned we've scanned over 7 000 people 4 000 who needed help he went in for a scan found he had 98% blockage and and got a stent again this showing how that scan saves lives it's great to have you back also we also had something real quickly on our agenda about spirit and uh commissioner uddin was just so spot on the the the all the buildings i think sold for 92 million we were looking right multi-family which would bring it down even less and you were just uh you know spot on and thanks for uh giving the good old college try um okay uh what i want to do right now because uh we got some people in the audience waiting um i'm gonna skip all the way to agenda item number uh 62 um and before i i get to that um you know when when um when uh an athlete does a great uh you know when an athlete has a profession and they do great in their sport um generally speaking they're honored when they leave by being put into the hall of fame right that's how they honor athletes but judges and lawyers doesn't have they don't have a hall of fame and um in my opinion the best way to honor somebody in the legal profession is by naming a courtroom and so on number 62 i'm asking uh if someone would move 62a uh which waives the requirements so moved second i have i have a motion and a second all in favor aye any opposed show that passing 8-0 and then now the question is in 62b uh it says motion to dub naming um courtroom 5165 which is at our courtroom and um and really it's so well deserved um for this person in the legal profession who's just outstanding and that's andrew myers so so so so i i i'd like i'd like to know if i can get someone to move uh 62b yep all let's take a vote all in favor aye any opposed drew when you come back in january we'll do a cutting ribbon cutting for room 5165 and it'll be the andrew drew myers courtroom congratulations now you can tell renee harrod what we're going to be doing um we're going to go also jump right now into item number 77 lamar fisher you want to take that away real quickly i do mayor thank you so much um true you know our uh chief judge uh carolisa phillips i'm sorry open just open the item open the public and open the item number 77 please is that a public hearing yes i'm sorry i'm going to open up public hearing and we're going to go to item number 77 public hearing is open item 77 commissioner fisher take it away you want to read it to the record i guess first the public hearing on item 77 is now open item 77 is a motion to adopt resolution renaming courtroom 1174 at the brower county judicial complex the judge susan f green hot courtroom one member of the public has signed up to speak on the item and that's chief judge carolisa phillips chief judge is not here today so the chief judge is in trial she couldn't make it so uh um so aldemar you want to take it thank you mayor for so much um chief judge carolisa phillips brought to our attention um the incredible accomplishments of judge greenhall and what she meant to the family division over the past 20 plus years at our court system and after retirement she never stepped away from service time and again she returned to help when needed generously sharing her wealth and experience and leading steady hand in the division she cared for so deeply about so many judges and attorneys said she was a trusted mentor a colleague and a friend she mentored every judge who had presided in the family division for the past 20 plus years beginning with the former chief judge jack tudor and of course our current chief judge herself continuing to keep up until two weeks ago before the newest judge pascal killey took over her strong fearless and pragmatic to her approach she's refreshingly candid with colleagues litigants and of course attorneys and it was just fitting that uh when the chief judge asked this mayor to to name a courtroom 11174 i felt that it was necessary to bring it to here and to make it happen i know it's gone through the process miss sapiro as far as the notifications all that so we don't need to waive anything so without further ado i'd like to move the item second i have a motion and second on item number 77 just make one comment just okay i just want to say that i think that this courtroom naming shows that the new process actually is working the way it's designed for naming courtrooms that where the chief judge makes recommendations that you know we seek input and this is a perfect example of the process our new process actually working okay i have a motion second all in favor aye any opposed show that passing 8-0 um i'm going to go to staying in the public hearing and the item number 88 thank you do you need to open it do we have to open oh it's open okay public hearing item number 88 is now open item 88 is a motion to approve or approve of modifications the county planning council's land use plan formal interpretation related to 1301 south ocean drive in the city of hollywood one member of the public has signed up to speak on the item okay i am going to be making a motion to defer this um indefinitely one this we didn't notice this but from what the county attorney is saying to me that it really wasn't noticed properly is it's on supplemental as opposed to our regular agenda a lot of people don't see the supplemental so we need to do that um in addition there's a lot of litigation going on on this and it needs to be kind of a few things need to be um kind of taken care of before we go into that the only thing i do want to say is there was an environmental i had asked at the last meeting for an environmental um review to look at to be i want people to know that that was just a cursory review that was not the kind of full review that would be required um if this was if they were going through this entire process some people wondered why it was so short and was only looking at a few things so with that i'd like to make a motion to um defer this and i'm not doing it i'm not doing a planned date on this do i have a second i have a motion and a second to relationship with an entity receiving funds for the performance of services under this agenda item one member of the public excuse me no members of the public have signed up to speak on this item okay um back to the dais any comments i need to do an advice okay i serve on the board of kids in distress which would be financially impacted if item six is approved i do not receive any compensation for serving on this board and i therefore have no actual statutory voting conflict however to avoid the appearance of a conflict i'm abstaining on item six and ask that this be reflected in the minutes i 24. item 24 is a motion to approve agreements between broward county and al jackson and company pa car rigs and ingram llc forvis mazars llp hct certified public accountants and consultants llc and s davidson associates pa for qualified vendors list for certified public accountant services one member of the public has signed up to speak on the item that's roderick harvey okay if you don't mind commission rogers will take the public speaker and then we'll come to you mr harvey is it please come on up harvey i have been a cpa for over 30 years i own and operate my own cpa firm based in hollywood i'm here today on agenda item 251557 to ask you to protect local small business equity by approving the cpa pool exclusively for certified cbe firms over ten years ago the commission created the cbe qvl qualified vendor list concept to give local firms a fair shot at county worth it is designed to be a share to market sheltered market so local cpa firms are not crowded out by larger non-certified entities the item before you today allows two non-cbe firms to into this specific accounting pool it is an about face of the true historical intent of the program it directly threatens our local market share and revenue to local cpa firms who have invested decades of service and tax dollars back into this community the numbers show our local community our local professional community is ready and fully capable out of the firms that submitted interest three local cbe firms were found fully qualified responsive and able to perform work our county ordinance is clear we only need two qualified cbe firms to keep a pool exclusive we have three there is absolutely no operational deficiency or legal reason to dilute this pool with three with two non-cbe firms i ask the commissioners to stand by local accounting firms that the end that we have done everything right to qualify for this program i urge you to approve item 251559 without the two cbe firms and allow the three cbe firms to create the pool if you agree i ask that the 2.5 million dollars that would be allocated to the two non-cbe firms be reallocated to the three cbe firms thank you so much thank you sir commissioner rogers thank you mr mayor and i need some clarification and i'm gonna say help me understand if the cbe reserve why are we adding non-cbe to the pool and i think maybe your purchasing or purchasing director can explain through monica through you mr mayor monica um and mr mayor mr kelleher is more knowledgeable on this particular item so in in this situation uh according to the code the uh ordinance there's you're allowed to have whenever you do the cbe reserves it's non-cbes are allowed to uh also respond to that and in this case that's what we did when since this is a qvl when you go out for the work order for the services then if the lowest bid of that services is is within 10 percent uh the cbes if within 10 percent they'd be getting the work i do want to add thank you kevin um something else i i understand on the ordinance is that if as so long as those non-cbe firms commit and have letters of intent for use of at least 25 percent um with the cbe firm then that would be allowable correct correct my name to you mr mayor pardon me face look like my brain right now yeah i don't understand what you're saying i mean does this gentleman have a shot at getting business we're here to help our businesses we're here to help local uh what's what's uh what's stopping that or what's uh i don't understand what how this gentleman can compete this gentleman would still he would be on the qbl with the other uh cbes and the two non-cbes and when when work is needed and counting work is needed they would they would put out for a work authorization and then each one of the five could bid for that as long as you know whoever has the the lowest price or if it's a cbe if they're ten percent within the lowest price they would be awarded to work yes mr gillard if i i think it's important that we check ask the county attorney if we can do what the gentleman asked because i believe we can't so can i ask the county attorney to come county attorney can you please comment as to what is legal and yes and and commissioner rogers if you have i did ask for a city attorney because what he explained to me and what i'm hearing from south okay why do we need a reserve if we're going to just throw anyone in at any given time i thought that cbe was set up to attract and encourage local businesses all the time go ahead yes and you know everything that's been said is is accurate let me see if i can try to uh weave it together in a way that makes sense and then i may fail in doing so but senator to answer your question directly uh we could always waive the procurement code and direct award essentially to anyone we want so there's always flexibility to to do things i mean it's consistent with state law so it could be done but it would require a waiver of the code of finding that that's in the best interest of the county and that that could could be discussed and it's not something that we normally recommend uh doing now uh what kevin said is is correct we modified our code a while ago to say that non-cbes can bid in cbe reserve opportunities uh what's the strange part here is that the cbe reserve normally applies when you're letting a single contract for one project here you're doing what we call a qvl a qualified vendor list which is basically a library of vendors so what you're doing is you're saying okay cbes and non-cbes if you're you're responsive or responsible and i think they put everybody on the list that was responsive or responsible then you can be on this this library of vendors so then the question becomes how is work allocated once specific projects come up uh under the scope of work and what kevin said makes sense the code doesn't directly say it but there's flexibility under the code to apply it basically if cbes and this is normally in the context of just an award of a single contract if cbes are within 10 percent price wise of non-cbes then they would automatically get the contract here what kevin's saying is staff's going to interpret that to say for each particular work authorization each scope of work that comes up over multiple years under this contract as long as the cbe is within 10 percent they're going to get that work i think that's a legitimate interpretation although the code doesn't expressly say that and i think staff has the flexibility to do that given the express language of the solicitation so follow-up question mr myers so my understanding then based upon what you said and what kevin had said is that although it says it's a cbe reserve it's not actually a reserve it's a preference so that if they see because we don't want a cbe to be bidding 200 000 a non-cbe bidding 50 000 and are paying three or four times the price so what the cbe reserve is doing is saying if you're a cbe and you're with no more than 10 percent higher they'll pick you even though you're not the lowest bid so it's a preference not a reserve is that a fair statement yes and the only it's not a distinction but just to make clear that section of the code normally applies when you're rewarding a single contract with a single scope of work here it's being interpreted to say it will apply it each time a work authorization every 50 000 or 100 000 project they give out over the years of this contract i think that's a fair interpretation i think it's legitimate for you to approve item 24 and i think staff has the flexibility given the language of the solicitation to apply it as kevin mentioned if i can just add a couple things the 10 percent is on contracts that are valued at three million or below three million or above it's five percent is to is the threshold and we're talking about the the business opportunity ordinance so it's not as much the procurement code that it's waived it is an ordinance for the cbe reserve and i apologize the board always has the authority to waive anything related to cbe at any time okay i yield to commissioner davis thank you so i wanted to clarify that the board could waive this particular um request here to have the non-cbe's mixed with the cbe's you don't you don't even have to you don't have to waive it i don't believe here and i i don't know if the the procurement director the purchasing director is here and i know sandy uh steed is here in the hobby i think that without waiving it uh that non-cbe's can compete with cbe's it's just that if a non-cbe is a when sandy steed is shaking her head in the affirmative if a non-cbe uh it gets the contract then they have to have a 25 percent cbe goal for their scope of work there's no way but my concern is that that was mentioned there are three cbe's that they can choose from and you know i i do believe there there's some flexibility there nobody's gonna you know uh bid above like the range like 200 000 for a job that's 50 000 and i mean so that's not normal so my thought process if this was carved out for cbe's and you got three not just one you got three different firms between the three you should be able to find one to do the work at a reasonable price so um i would like that the non-cbe's not be included yeah i uh in light of uh kevin's clarification i'm concerned with doing that because the solicitation i think sandy was written directly to allow that competition it might be seen as a material modification to the solicitation so what i would recommend and and commissioner davis it's a fair point that you're making uh what we what can happen here uh is uh you know the reason our code was changed years ago to put in these five percent and ten percent bumpers that kevin mentioned is to avoid exactly what you mentioned the fifty thousand uh versus uh versus two hundred thousand dollar amount what i would suggest here and it's up to the board this could be uh tabled and and we could work it out later or the board could award these contracts consistent with item 24 if staff applies it as they're saying with that uh ten percent preference or the five percent preference then it's it's consistent with how the cbe ordinance is structured to allow non-cbe's to participate also and if they don't do that then these contracts can be terminated for convenience as well if there's any problem with it mr mayor yes i don't believe i would support for us to move on with this i don't know of anything that we have done or said on this dais would give staff the authority to change something this important with us only seeing it for the first time that is where i'm having my challenges who authorizes who wanted this to happen why change now cbe we needed only two now we have three to choose from why do we need that extra two that's in here that are not cbe well doesn't it provide more competition yeah always there is always competition in the process but certain we have done it before when we are allowed for to give we are encouraging our businesses to do business with broad county creating an opportunity for businesses to do we've done this so why change it now is my concern mr mayor i want to remind the members of what we previously did and why we've ended up this way there was a lengthy debate on this and the question was we here on the dais have two some possibly conflicting issues and goals number one is we want to be uh making sure that we're promoting local broward county small businesses and the second goal was we also wanted to protect the taxpayers of broward county by giving them the most efficient um and least expensive source so after lengthy debate on this dais we reached a compromise and said on the contracts under three million we will give the local uh companies a ten percent bonus basically with that if they're with even if uh acme a national company is bidding a million and they build a million eighty thousand we're still going to go with the local company even though that would be eight percent higher but if the national company is bidding five hundred thousand and these three are a million one that's you know over fifty percent high over double that it would go to the national company that's what we decided as a balance to our two goals of one protecting local businesses but also protecting the taxpayer money because they're the ones paying by saying it's only the ten percent i think that we should stay with that compromise that we spend so much time debating can i recognize our council please yes and just to build on to that and just to give commissioner rogers some comfort we're not we wouldn't be changing the terms of the solicitation the solicitation contains language that says that uh the qvl procedures can be modified basically if and as required during the term so for your staff to apply it with that five or ten percent differential that senator geller just described is not changing the rules at all that's the rule in the solicitation and allowing non-cbes to participate in a cbe reserve is also the current rule under our procurement code for the reason senator geller mentioned mr mayor one final question of mr harvey mr harvey you want to come up for a sec we were just recently um told we i wasn't here but i understand the process and being a former mayor of a small city we know what it is thank you for that uh commissioner mayor rogers i am unsatisfied because there's also language that says that if a cbe is not available if a cbe is not deemed to be performing correctly that the non-cbes the larger firms can do the work the goal of 25 percent is admirable but at the time it appears to me that there is a potential for erosion of work and revenue from us the the cbe firms in this case you have three firms actually three very known firms around the county that do work currently and so i would like to see it would make me happy as a long time three generation resident of broward county to have those non-cba cbe firms to find a way legally to waive whatever needs to be done so that we can compete in a pool that is more competitive and spot on for us and so i would ask that you all to reconsider to be flexible to allow us who live here who have our children here who go to broward county schools here to compete among us for an amount up to 1.25 million which is not to me it's not 20 million and so i ask i hope i pray i besiege that you will find a way to let us three cbes perform this work in this circle thank you our cbe program is an important tool for creating economic opportunities for local businesses and ensuring that our procurement dollars reach a diverse range of qualified firms and that's how i close mr mayor thank you all colleagues can i can i just finish as well sure um so you have the larger firms the larger firms clearly they can lower their prices so much more than the small business firms but at the same time i'm sure there's a flexibility in the procurement code where clearly we're not gonna as you say give a five fifty thousand dollar job and charge have somebody charge two hundred thousand there's that flexibility also and you already have three cbes that you can choose from so i can understand if it was one cbe and or even two and then you need a non-cbe just in case but you have three so if we're really trying to ensure that small businesses can move up and and and uh you know get into the realm of a non-cbe this is a way to help them so i'm i'm not sure why there's flexibility in one way and not flexibility when it comes to pricing and who you would choose from the three cbes so if we are truly looking out for our cbe program in this instance this is one of the few instances i'd say that you got three opportunities to do so three people who qualify not just one not even just two that you can say well just in case let's make sure we have a non-cbe so i believe that this is one of the cases and not every case but we should look at it a case by case this is one of those where we could certainly focus on just the three cbes commissioner just a question so this is a library that we set up with five responsive participants when the different agencies go to choose which participant they want to use for this contract that's then not another bid that comes out that's a negotiated thing right with those specific players yes they you ask you put something out and you see who responds with the best terms correct it's an internal it's an internal process like a quote system that they'll put out the uh the what's the scope of work that's needed for that particular work authorization and ask for people to give their qualification and quotes for it and then so if if staff just agreed that if a if a someone came in at a lower price that if a non if a cbe was given the opportunity to come within ten percent of that price doesn't that solve the issue and that was the intent of how we were going to handle this uh that's the current code yeah but we would be applying the current code applying the current code in the library the qvl setting which i think is a reasonable interpretation someone want to make a motion move it i have a motion i'm moving do i have a second i have a motion second all in favor any to implement changes to the visit lauderdale's logo and branding to include a specific reference to brower county while retaining retaining the visit lauderdale brand and to take all actions necessary to implement this motion as mentioned there's 17 members of the public that signed up to speak on the item first one being aina from travel host so before we have any public speakers i want to just see if commissioner davis yes you want to open it up yes thank you so i i brought this item uh because uh the reference of broward county is nowhere on the visit lauderdale logo the visit lauderdale logo is just fine what i am asking for is that below the the logo it references that broward county is where visit lauderdale resides pretty much so of all the other agencies we have in the county to include uh the airport which is fll that's the logo below that logo it says broward county we go over to port everglades somebody say what's that where is that below the actual logo it designates broward county and every other agency even the planning council has broward county i don't think it's much to ask just to ensure that broward county is seen on the current visit lauderdale logo and let me continue this is not about replacing uh fort lauderdale or lauderdale with broward county it's about making sure the public understands that the destination being targeted is larger than fort lauderdale visit lauderdale itself has previously acknowledged the issue when the brand launched visit lauderdale said fort lauderdale is only one of 31 municipalities in broward county and while lauderdale was selected it was the most recognizable name to visitors and therefore helped to put the entire broward county area on the map now we can use the recognition of lauderdale to bring people in and use broward county to tell them where they are and how much more there is to the experience this to me is the next evolution of the same strategy the brand is funded by county tourism resources and its mandate is countywide there is a legitimate policy question about whether the county's name should have a more visible presence in the brand architecture it markets 31 municipalities including destinations and experiences outside the city of fort lauderdale the current visit lauderdale materials themselves describe the destination as encompassing 31 municipalities and including everything from the waterways to everglades to cultural fort lauderdale remains the strongest consumer facing name of the brand which we all agree i'm simply asking that the brand also build equity in broward county the larger destination and governmental entity behind it if visitors come because they recognize fort lauderdale that's good but if they leave knowing broward county as a destination the county has great created a water brand asset that can benefit every municipality and business not just those physically located in fort lauderdale broward county should not be treated as a competitor to fort lauderdale you got broward county greater fort lauderdale and other municipalities the county name gives geographic breadth fort lauderdale gives you consumer recognition and visit lauderdale gives you a call to action the question is how do we build a stronger and more inclusive destination brand that provides the enormous equity in the lauderdale name while increasing recognition of broward county i'm not asking us to abandon visit lauderdale i'm asking us to leverage the equity we have already built in visit lauderdale to build equity in the name broward county because visit lauderdale represents 31 municipalities and not just one that's my statement okay before we go to the public speakers um is uh beams where's beam i want you to hear this steve um and nan is not here look uh commissioner uh davis um and and i say this with all due respect um i believe that anytime you want to do something you should have behind you data focus groups marketing research that will justify whether we call it visit lauderdale visit broward visit broward lauderdale whatever you want to do um there should be data supporting it and i have not seen anything in the backup of data as our county administrator have you as a county administration done any research whatsoever to determine whether this would be an advantage um to to our county uh to you know to making it a better destination more recognizable more people remember it whatever that might be no sir there's not been any analysis done to support that okay second i got an email from stacy ritter is she here yes sir okay and i believe the email we talked about the cost in changing we're talking potentially millions of dollars in cost based on our inventory cost and um i host a breakfast with our business community and what are we change so i think you need to when you want to change something who's it to benefit is it to benefit excuse my you know mr smith miss jones down the street or is it to benefit people coming here for our business community i believe that what action we take regarding this marketing this should be the benefit for our business community not for somebody who lives on 23rd street somewhere because it doesn't matter and our business community that i met with that are here in numbers are totally opposed to this and um and so uh i i um therefore i'm going to go with the can i can i respond to you and so you know the business community again we got 31 municipalities so you know i don't that's thousands and thousands of businesses um maybe the idea is you know and and maybe we could how about talking to the thousands and thousands of business owners not just the select few who are mainly based here in fort lauderdale now in terms of the brand itself it's the same brand we're not changing the brand except adding broward county so i don't see how that could cost millions and millions of dollars and again that's why i would like to see that that be looked at what what is the cost to just add broward county and how could that hurt business because we are broward county you're telling me adding broward county it's going to have a significant impact on business i just mentioned to you i don't see how that could happen it would broaden it visit lauderdale broward county because now you're actually more inclusive but if you want to do a study welcome it but to me common sense dictates you already have visit lauderdale and adding broward county which is a broader area could not harm but help uh in response hold on one second uh we'll go around but you say we should talk to thousands of business owners this is not my item i would expect you or the county administration to come back and saying we've talked to thousands of business owners and this is why we should be doing it i i don't think i should be saying you know i think it's incumbent upon the the person that wants to change it to show why it's an advantage and um i have a lot of reasons why broward like we did the pasadena float i think it was a waste so people in california saw broward county float i mean no one remembers broward no one knows about broward no one knows where broward is and we have data on that data on that um you know so broward county go outside broward and you want to track tourists we want to track businesses come to broward they're gonna go where where's broward but when you say visit lauderdale at least they have an idea of where that is in south florida and and but the most important thing i think is data and and what does the data show that why we should do this i think it's a great question of millions of dollars why does it cost millions of dollars i think that needs to be explained uh stacy hopefully you can uh or somebody there can explain the the cost in changing it but uh mr mayor if i might before miss ritter comes up um i did want to note that when visit lauderdale did um begin with the branding of visit lauderdale there was a significant amount of market research done and it's not just local businesses but it was outside of our destination to see what resonated with travelers and so that's how we really came to visit lauderdale brand to begin with so there was an extensive amount of analysis and market research done to get there to begin with and stacy can certainly elaborate um on that more so and can i can i just respond because hold on i just want to do do you guys want to talk now or do you want to wait for the public speakers no no i got somebody else before you i'm asking and and commissioner rogers also do you guys want to talk let the public speakers go and then we'll uh i'm going to i'm going to leave it up to the public let the public speakers come up and then we'll talk yeah i have my office been inundated with emails from the business community i'm pretty sure i've got a good idea where this commission is going to vote i'd love to hear all 17 of my friends here but if there could be a test vote or something i'm pretty sure i know you're talking about saving time yes sir i'm pretty sure i know what this is not violating sunshine what where are you standing on this yes or no i'm voting no on it lamar yeah i was i'm not going to support it but i i was going to try to shorten time and have all the people stand up against it so they want we would we want to hear from the keith koenig and all those folks too as well but at the end of the day if these folks are against it and this is our business community i would love to hear from you but i think this shows the the support of not rogers okay there i'll speak there there's 31 municipalities i've been around for 30 years and i can tell you when there was a broad alliance we felt like we were a part of broward county okay so you're yes so when it came alliance alone i did not feel like we were reflected in the numbers and this is what the commissioner i'm just looking for a yes or no so we could save time where are you discussion i'm looking for further discussion we don't have to make a decision this is just a motion to direct i don't believe we should be directing staff right now until we have some more information like you requested thank you commissioner i think the logos need to stay very simple let's keep it as and when they get comfortable so you're no i'm a no what do you you know mr ud um since there were some comments made i'm going to be a no on this um but i i just wanted they did the marketing study i remember when it was hello sunny for years and years and years visit lauderdale is crisp and clean and i i think that the goal of visit lauderdale and they're satisfying their goal we're up six percent year over year in tourism dollars that are coming to broward county even if we put broward in the name that doesn't do anything for coral springs which gets a ton of money through visit lauderdale for the events that they're there the city of hollywood sent a letter that they're in support of visit lauderdale these things have to be in my opinion have to be crisp and clean and i think the visit lauderdale logo is the proper logo for the county i think businesses are shortening their logos to get people to do this and i would never vote for this anyway because it's a motion to direct county administration to do this i don't think county administration has the expertise in marketing and logo this is much different in my mind i can give you 10 examples of brands that have changed their logo that that have significantly backfired i don't think all any nine of us or county admin have anywhere near the expertise to discuss this and to vote on this and and to try and do what we're doing so i'm supportive of keeping a visit visit lauderdale i don't even want to study it anymore because i know it's been studied a million times by the alliance by the port everglades studied it i think lauderdale should be the county name but that's we'll take that as a no yeah come on please please all right um you so you i've been the opposition i've been informed by council that look at um we could we you you have the right to speak um i you know i can't you have the right to speak if you want to speak but i think you see the sentiment of the count of of how we're going to vote and i can call for a vote um if someone wants to make uh if someone uh well it's commissioner davis is uh if somebody wants to to move it second it and then we'll call for a vote and and mayor if anyone wants to speak if they could just raise their hand if they don't raise their tourism coalition and the chair of the broward workshop yeah so so i just reference that because i represent a lot of voices in the room here and also across the county uh this is not a county issue we market outside of the county people who don't know who we are or where we are there has been a lot of work and research that has gone into the visit lauderdale brand and launch and the success is undeniable you can look at the data since this change it has been a it has been a rocket ship uh the cdb has done extensive research on this surveys marketing studies workshops uh focus groups and all the data says that broward putting broward county name confuses the public and reduces engagement uh i again i'm chair of all those organizations they represent tourism across the county both west activities out west everything and all of those uh committees are unanimously opposed to this not one committee member said this is a good idea we should we should support this um again we have a brand new billion dollar convention center with your leadership finally came to light that that uh convention center is guaranteed by tdc dollars those dollars are driven by visit lauderdale we need to be focused on driving business and stabilizing that convention center that's a game changer for everywhere in the county and why would we start to change the brand now there is a reason that pepsi is not on the gatorade logo there's no confusion on what gatorade is i think we should take the same approach keep our logo clean and keep going in the direction we're going i strongly urge you not to make this change thank you does anybody else want to speak spoke too fast i'd like to hear from hanberry because i know he speaks a little folks i think you know can you please state your name and who finally multiple boards and also vice chair of the marketing advisory committee one thing tim didn't say that i think is critically important this is a destination marketing organization folks i think you all know what that means there is no dmo across the country that we are aware of and certainly no major markets that include the name of the county it's visit orlando it's not orange county talked into the bottom i can say the same thing over and over and over again because that's the respected practice of bringing people into a destination and that's why we're here everything else tim said i echo and by the way who's in this room are not just people from fort lauderdale we've got the general manager of the diplomat the general manager of margaritaville we have major attractions out west we have sawgrass mills the people that are on the marketing advisory committee and on these different boards are the experts in this room are literally hundreds and hundreds and hundreds of years worth of expertise in tourism and not one of them wants his name changed so thank you very much for the consideration for everything that you've discussed but there and i was there at the beginning i've been on the mac for 29 years i was the first woman they put on they figured women know something about travel and during that time frame we had a major ad agency i believe it was starmark do major research focus groups internationally locally domestically lauderdale came number one broward county was at the very bottom of that list that was part of that research folks so it wasn't us speaking it's people that make the decision of where they're going to bring their tour operators their guests and the people they're recommending to travel and this is a as you know a billion dollar industry please don't mess with it thank you very much for your consideration everybody's got to get their say okay come on in no thank you mr mayor members of the county commission i just take your name the opportunity my name is george hanbury and although i've been a resident of fort lauderdale in broward county for most than 40 years i do not speak as a resident perspective i'm speaking as the former president and ceo of the state's largest private not-for-profit doctoral research university and broward county's largest private employer of over 7 000 people that live throughout this county 23 000 students and over 200 000 alums come from nova southeastern university all over the globe when the founding fathers created nova university they started right there as a storefront on los olos boulevard in 1964. those founding fathers were not just from fort lauderdale they were from all over broward county and hollywood matter of fact the major contributors in philanthropies came from western broward county from hamilton foreman dr charles foreman and from hollywood whether it's bill horvitz or a.l mailman matter of fact at nova's campus over in the town of davie it's a mailman hollywood building but those founding fathers knew one thing they started out wanting to be the mit of the staff and they wanted only to attract students from all over the world to be graduate students and to this day nova southeastern university is 80 percent graduate and professional students and contrary to miami only 20 percent undergrads so we would have never attracted the founding fathers said students to come to the town of davie or to broward county the same thing you hear from aina lee and tim about destination brand and it being clean and crisp people who are searching for where they want to go they lean toward a place brand a place brand and hamilton foreman and a.l mailman and bill horvitz all from hollywood or the town of davie knew they had to have the place brown of fort lauderdale we would have never attracted all the top researchers or faculty members or students but just town of davie so i encourage you don't compromise the brand or dilute it thank you thank you sir can i uh can i ask uh county administrator can i ask stacy ritter um why it would cost about the cost let's pretend everybody loved the idea let's pretend it was the greatest idea uh stacy are you you do you have that or mr ritter yeah i'd like to come address commission thank you i know how much you wanted to speak today stacy thank you question is about cost why would it cost more money well there that is a complicated question and i'm going to try to make it as simple as possible and as quick as possible there are different tiers to rebranding there are simple tiers as simple as putting um a word on a business card which would cost a few thousand dollars to doing a full brand launch which includes videos media buys uh production companies talent wardrobe which can cost a couple million dollars when we rebranded in 2021 it cost us two million dollars and then when we refresh the brand this earlier this year it cost us another two million dollars so it depends on how much you want to do and you won't know what your tier is until you do the research to determine what moves the needle because i think we could probably all with certainty suggest that sticking a couple of words on a business card doesn't do anything so how much more do you have to do in order to move the needle and you won't really know that until you do the research what you do know is that if you don't do a full brand launch on a rebrand nobody will see it how much will it cost for people around the world to see your rebrand it it costs us two million dollars each time we do it oops thank you thank you mr all right so can i just my item yes ma'am good um so uh when and i'm just gonna say two things and then clearly because it seems you know folks have changed their mind about this was brought to us before not as an agenda item however once i make these two then i'll just withdraw the item since i don't have consensus here firstly that um was mentioned about other you know markets mammy dade they have their own uh mammy and the beaches they are not part of mammy dade county government they're a separate entity they have their own board and many of the other agencies do the same thing around uh florida they are not tied to a governmental entity and so the name of that entity is not on there however in addition to that when i'm sure um when this was looked at visit lauderdale broward county was not one of the options was that studied or was it just broward county visit lauderdale fort lauderdale was the combination study probably not and so um again because uh i'm seeing uh my colleagues saying no to the idea even though the cost to me that was mentioned would not be prohibitive um but just adding that um i will at this time withdraw the item because it's not getting any traction but stick by what my points were and that maybe at some later time when i do have consensus and real consensus i'll bring it up again thank you um council what if she's withdrawing the item do we need a motion here no i think it's fine yeah we're done okay thank you for uh for coming in and speaking um it it's 11 56 um i want to address one thing before uh we maybe grab food food is in the kitchen for all of us so we can do a working lunch um we do have some speakers from 67 seiu if you don't mind okay no i don't mind um i i want to just touch on commissioner davis one thing you just said you said this was brought up before when was this brought up a non-agenda non-agenda okay hey lamar yeah i i think we need a policy hold on i want to get a policy that any non-agenda is for announcements my mind we're half asleep we're not you know we're not it's been a long day and i don't believe that non-agenda should be used at all for i want to bring up something and if you don't object you don't object hey i'm talking about something they must they must agree to it and so i just want to make sure council you tell me whether we need a vote on this or a new policy anything brought up in non-agenda where we're not voting has no consequence of any policy or any direction for um any direction unless we all agree our majority agrees yeah the the only exception would be for moving basically to direct for an ordinance or an administrative code resolution because there's no final action that's being taken so you can raise that under your current rules non-agenda and if there aren't six objectors it moves forward but for anything else you're not taking any binding action through what you do non-agenda so i'll explain that again so if i bring up something that has to do with changing the administrative code or an ordinance i could do that without putting anything on the agenda and non-agenda i don't have to have it written anywhere and i could talk about you know what i could talk about how i want to change an ordinance and direct monica to come forward in another meeting or direct your office to come forward to another meeting with something even though my other commissioners haven't voted on it just proposed so yeah i mean technically if if it were a very long day and you only had six people on the dais and you said all right i direct the county attorney's office i'd like to see the county attorney's office do an ordinance on this remanded ordinance on this there won't be six objectors because you were in favor and there are only six total people we would draft it but again that comes back before the board twice a set for public hearing and then and then public hearing so no matter what happens a non-agenda it has to come before the board before admin or your or anybody takes action i mean we can prepare something we can't implement something mayor we can't and monica can't implement something for example if this item 85 instead of it being done this way which was proper if it were just brought up non-agenda and nobody said uh anything opposed to it monica would not have direction or authority to do that she couldn't implement it now could she draft a policy to bring it back to you for your later consideration yes okay miss do we need a motion if so i'll second it but i don't know there's no motion you're telling me that's our policy or that's the law it's it's both it's it's both uh you you act by voting right we take direction by voting except when we're preparing something for non-final action by us that you will subsequently the only thing at non-agenda is directing you to come back to the board or monica can come back to the board for us to vote on yeah or you know sometimes one of you will raise non-agenda that uh we need to send a letter of support to somebody and you can things of that nature will generally let it go but for staff to implement something no i can't so let's say i forget the motion to direct you i forget to put something on i could bring it up in non-agenda and say hey i'd really like you to put together something for the next meeting and even though there's no thing on the agenda that's legal under your current rules yes okay great okay there's no need to vote uh do you want to take uh we're gonna take oh we got number 67 let's do number 67 so we had some people waiting and then we're gonna go grab some uh bring food back to the desk to continue this meeting item 67 is a motion to adopt resolution urging the united states congress to take immediate legislative action to provide protection and a pathway to lawful permanent resident status and if otherwise eligible united states citizenship for haitian nationals affected by the termination of temporary protected status urging the executive branch of the united states pending congressional action to redesignate haiti for tps or provide other lawful temporary protection from removal recognizing the humanitarian economic workforce and family impacts of the termination on brower county three members of the public have signed up to speak on the item first is michael rainier followed by michelle pierre can i just make a statement please thank you um haitian immigration resolution the resolution responds to the termination of haiti's temporary protected status and resulting risk of removal loss of employment authorization family separation and workforce disruption the resolution requests congressional legislation providing eligible haitian nationals with protection from removal and an opportunity to apply for lawful permanent resident status an opportunity to pursue united states citizenship only after satisfaction of the applicable statutory naturalization requirements and temporary executive protection pending congressional action this is the basis of the resolution which um you can read uh yourselves but one of the things i wanted to ensure is that at a minimum the resolution is formally communicating the board's policy position to congress the president dhs us cis ice and other appropriate federal officials thank you okay mr rayner i assume you're here opposing this uh vehemently and uh so why don't you take it away uh mayor commissioners good morning michael rayner chair of the broward county human rights board um we're very pleased to see this resolution on here um and you know haitians in south florida here on tps are not statistics they are our neighbors our co-workers our caregivers our small business owners our parents our friends their safety and dignity matter to our entire community we just had this room full of our tourism industry here in florida and i can only imagine how many haitians that are in tps just got fired within the last two weeks when they lost that protective status i know that nadezh sterling who's a friend of mine who owns le pak i didn't say it right i know a bakery in miramar i called her to see how things were going and she started to cry on the phone because she was writing her last paycheck to several of her employees as she's beginning to also expand another location of her haitian bakery and she was torn as to what to do and there's nothing we we can do other than speak up and advocate you know i believe also one of the things proper um in addition to this item's passage would probably be an additional motion to direct to have um this added to also the um like federal legislative packet which is typically standard of the actions of resolutions of this sort you know the human rights board we did some uh discussed this and submitted it um the memorandum which is attached and it references the august 10 um sun sentinel article which unfortunately was not attached but that's the um sun sentinel article you can see you know we're entering a such a horrible time in this nation i'm first generation on my father's side my father came from poland in the 40s but there's something much different when you're white and an immigrant and i have to say that as somebody that has the blessing to be here and to be born as a citizen and it tears me up when i see on facebook videos that are being posted that churches in south florida that are being raided right now of for haitians you see haitians being taken off of their bicycles in front of people's steps when you look on social media and how people are just trying to make sure the belongings that are left behind by ice on the sidewalk can get back to those families the inhumane time we're in where broward animal care is far more humane and how it picks up animals off the street to make sure that they're cared for we're in a time when our government when our government lacks any christian principles in a nation that's supposedly christian i don't know this country anymore and many of us struggle and i just want to say thank you for i know you're going to support this and i ask that there probably be another motion to add it to the legislative packet and if i may mayor if i could just thank drew for his years of um answering the phone when i call you at seven in the morning about an issue to help me through something and to help me in my advocacy and also as chair of the county's human rights board to ensure that we always maintain our moral compass and help us through the legal issues and i just want to thank you for that time that you've been here thank you he wanted to tell you how upset he was for calling at seven in the morning i just want to make sure you know that no he just got himself while o'brien hi everybody um michelle had to go to work so um my name is helene o'brien i lead 32bj sciu the union of airport workers janitors and security officers um i want to thank commissioner alexander davis for introducing today's resolution for years haitian immigrants with tps have been a part of the fabric of broward county in florida they help our airports run clean our offices care for seniors and do other essential jobs at the fort lauderdale airport around 60 of our members had tps and lost their jobs after more than a decade in the work there were terminal cleaners who kept the airport spotless wheelchair agents who helped seniors get their flights get to their flights safely and cabin cleaners who sanitized planes for passengers there were also security officers guarding and protecting uh county buildings janitors and landscapers at nova southeastern university and that was just 32bj members there were thousands of other tps holders in health care and other industries one of our members was a janitor who cleaned the airport terminal for almost 20 years he had never been late rarely missed work and he took pride in keeping those floors spotless and he is terrified to return to haiti his son was a police officer there and watched his own partner be killed gangs have taken over his home in haiti and he has nowhere to go back to he also has no income anymore another is a mother whose 15 year old son is a u.s citizen she lost her job and she can't afford to feed her child and she now has to choose whether she lives here in the shadows with her child or goes back to haiti without him these are people who have worked paid taxes raised families and contributed to brower county for years and they should not be treated as disposable i know we all agree and there's nothing we can do other than lift our voices and account on this county doing that thank you so much appreciate your help okay now speakers are done let's uh you want to move it commissioner yes senator okay thank you mr mayor i'll vote for this because i feel strongly on the topic but i just in general i keep saying that we should not really be taking positions on state and federal whenever we send a resolution in support of something to the state it just means that they are more opposed to with them they work because they don't like broward we really shouldn't be taking positions on federal and state issues but i i will vote for this because i feel strongly on the topic but i i just want to caution us on that thank thank you mr mayor what goes around comes around we all know what that means and we i'm here to support this resolution because even being in tallahassee when we knew that the legislatures could not do anything about federal issues we sent resolution in support so we're just one of 67 counties we need to do it broward county so i'm in support number 67 someone want to move it commissioner davis moved so moved i have a second i have a motion uh 67 this is recording um lamar what number is yours 83 okay we're going to skip real quickly to number 83 uh with commissioner fisher taking it away item 83 is a motion to discuss memorandum outlining the process necessary to bring the broward county department of fire rescue under the operational control of broward county no members of the public concern speak on the item thank you reading clerk and thank you mayor um as everyone knows that uh back in 2003 broward county did grant to the broward sheriff's office control of the fire rescue through an interlocal agreement with automatic renewals every five years and since our board's action we took in april the administration has been diligently working on this particular matter itself um i do want to thank mr ruiz for his dedication michael i want to thank you for all you're doing and you've been working so feverishly on this particular issue and dealing with all the stakeholders i know that you have been in charge and talking to the uh the iaff 4321 of the league of cities uh the broward county city managers association and the fire chiefs association so i want to thank you for getting the ball rolling and i think you've met with even all seven cities that we that broward sheriff's uh contract with with the fire but this particular item here today uh concerns the ill agreement between broward county and the broward sheriff's office for delivery of fire rescue services and under that agreement articles 11 and 12 the current five-year term expires on september 30th 2028 and the next five-year term would alamaki renew beginning october 1 of 2028 so but unless either party provides at least one year's written notice for the intent not to renew so the agreement does offer other cancellation opportunities but i feel this particular time that is now the right time to make a decision to discuss ending the agreement effective september 30th 2028 the timeline for this would ensure a smooth transition for this critical service and we all know that public safety is our number one focus as elected officials so the purpose of today's discussion is not to make a final decision as i do plan to bring an item back before us at our september 22nd board meeting so there's ample time for all parties and the public to study the issue the process can be relatively smooth transition it's moving all 907 plus or minus employees under broward county we already own the fire facilities and equipment we will assume of course the municipal contracts that michael's been diligently working with all the municipalities on that the 911 communications will be smooth and streamless etc administration obviously will position uh themselves and human resources department obviously will need inventory of the stations and training locations will pursue and purchase minimal equipment and take over all the air rescue helicopters and hangar at the pompano beach air park here's what the important part of it is in my opinion broward county now has the opportunity to control its own fire department and its costs commissioners who sit on this dais commissioner davis and commissioner rogers and others commissioner ferr commissioner dean i think that's it and uh when i say that because these individuals have served at the local level at the city level including myself and you understand the importance of having your own fire department and its advantages including their commitment to all of our communities so mayor i welcome the discussion here today and comments from my colleagues and of course um at the conclusion of the discussion i'm going to ask that you recognize me for a specific motion or directions for a 20-second meeting so appreciate you thank you okay welcome discussion uh let's start with manager for the city of lauderdale lakes thank you for the opportunity and good afternoon madam mr mayor and city commissioners i just want to briefly express our administration's support for moving this discussion forward and exploring the process necessary to bring broward county fire rescue under the operational control of broward county for lauderdale lakes this is particularly important because the cost of our current fire rescue contract has increased significantly and continues to place increasing pressures on our financial resources as we look ahead to the potential impacts of amendment 3 and the broader fiscal challenges municipalities may face we believe it is important to explore opportunities that can help ensure the long-term sustainability of essential public safety services from the city administration's perspective having broward county assume operational control is an option that deserves serious consideration if this can provide greater efficiencies more predictable costs and long-term financial sustainability while continuing to provide quality fire rescue services to our residents we are certainly supportive of exploring the opportunity we appreciate the county commission's initiating this discussion and considering the impact these increasing costs are having on the municipalities such as lauderdale lakes thank you thank you mr mayor i'll continue by saying i will be reaching out to all the cities that i represent to hear from the cities that i represent to hear from them and i am here to participate in this discussion and i'm glad it's a discussion and we want to make sure everybody understand it's a discussion that we're having this afternoon thank you very much going down the line anybody on this side i'm certainly undecided certainly think it's an idea well worth exploring and i look forward to commissioner fisher's motion same thing just looking looking forward to the discussion and see what benefits could be derived from that and uh vice mayor can you mute your phone please vice mayor can you mute your phone i'll get ready to speak i'll i'll call on you in one second you can call on him now commissioner fur is done and we're calling on you vice mayor locally and i do believe firmly in what uh commissioner fisher stated about having your own local um relationship with the department so i support it moving forward and look forward to the adam coming back uh to move forward senator riche anything no just um interested to hear the discussion and um i hear from many of the municipalities that this is the direction that they would like to go so we certainly should investigate it i look forward to the conversation as well and discussion i think right now we're seeing affordability is the number one issue right now to all our constituents and if there's a way that we can provide the same or better level of public service at a more affordable rate i think we should look be looking at that with every one of our departments and and this is just one of them so i thank commissioner fisher for bringing this up and i would support looking at it commissioner davis thank you um i would certainly like some more data i'm sure as we get into discussion we'll get data um historically why it was given over to be so in the first place since we had it previously and um other county agencies across the state and maybe across the country um what their fire departments are they under their sheriff's office or not um and then also if there are any areas of concern not just financial which of course we can't guarantee we're going to be less i don't want you know municipalities to think you know if we take it over they're going to get a cost savings they may not but what other issues are arising with them having control of the fire department i know we've talked a lot about uh the police departments and the issues of communication and so on so i'd like to see were there any other areas of improvement that were needed that were never addressed cannot be addressed and then certainly look forward to seeing um what that would um entail for us to take back the fire department as opposed to leaving it with beer so thank you for bringing the item okay commissioner fisher you want to close it thank you mayor just i'd like to move to direct the county administrator to place an item on the september 22nd 2026 board agenda for the board to consider whether broward county should not renew the next five-year term for the analytical agreement of the fire rescue services and if so direct the county administrator in consultation with the county's attorney's office to provide legal sufficient written notice of that decision to bso so we'll be discussing on this 20 seconds this motion passes 7101 southwest 205 avenue in an unincorporated broward county and to publish notice of receipt of the unsolicited proposal and accept other proposals for the same project motion b is much to direct county administrator to evaluate the feasibility of county owned operated yard waste composting facility on county owned property located at 7101 southwest 25th avenue and unincorporated broward county two members of the public have signed up to speak on the item the first member is dustin dubois followed by nick matthews good afternoon can you just state your name please good afternoon dustin dubois with filthy organics thanks for seeing me today i thought i was going to be saying good morning but that's out the door um listen believe it or not i've been working on composting partnership with the county actually since 2020 i first met with commissioner fisher to talk about some land opportunities at the time there was no appetite for it um which is fine but we've kept at it you know for the last six years and at the hopes of getting to this point that we're at today with your encouragement i've been working with the commission and staff to develop the project for more than a year now and i truly appreciate your help so far and i'm encouraged to see the county and its municipalities eagerness to utilize composting for recycling such a valuable resource i hope this can move forward today in the most expeditious means possible but i do have to say i'm a little confused by the request to issue excuse me the request issued to have staff explore doing this on their own about a year and a half ago scs engineering issued their studies in the swa master plan that that did review all this already um so you know that that's why i'm here today i'm seeking a partnership with the county please vote to move forward with filthy organics so that we can provide a sustainable waste solution together thank you mr senator i just want to verify that what the type of composting you're doing will be yard waste only and not food waste is that accurate that's correct thank you that's all i needed to know yeah before you do no i i've added an additional motion on this and i think it says a number 45 county administrator to proceed with further evaluation it should be perceived with further um filthy evaluation and make sure you put in the right words proceed with a filthy evaluation of this unsolicited okay mr mayor i was not sure what this meant honestly i mean i don't do jokes it's not very clear because you have heard me over the years talk about poop so i would i wasn't sure this isn't this isn't i'm just telling you guys gentlemen no i didn't say smelly i said filthy okay okay or whatever it is i just needed to know where i wanted to know how close to a city this county's site is located i keep hearing unincorporated broward county but who are the people that will be living close to your neighborhood filthy perfectly right whatever it is just because i don't know and i know it's district one so i wanted to hear from how close are you to human beings mr mayor our glass speakers matthews please state your name uh good afternoon nick matthews with the southern group on behalf of filthy organics uh thank you for the opportunity mayor and members of the commission uh real quick just kind of wanted to remind the commission to get everyone back up to speed it's been literally over a year since we first met with your staff and filthy organics to start exploring a partnership between filthy organics in the county and exploring different county land opportunities we've been before you previously and there was consensus that that previous site may not at the time didn't present a great option it was your vision your direction that kind of sent us back to staff to do our homework and we've come to a site that i think is is a really great a great option for this the memo uh issued by your staff essentially recommends moving forward in the process and raises some general issues that that that we feel are largely contractual in nature everything raised in that memo or things we can sit down and kind of hammer out in a negotiation session with your staff so um absolute confidence we can handle that uh the one thing and this is where i'm hoping attorney drew myers has a little more magic in it before he's gone um the motion of the way it's stated right now suggests or or recommends that staff move um with the competitive solicitation part of the unsolicited proposal process florida law now allows for unsolicited proposal processes to move forward as long as you bring an item to a publicly noticed agenda twice you have a hearing on the item two times you don't have to go out to the market and and look for a bunch of people from out of the area from across the country to throw in proposals i would suggest we've been here two or three times now this has been over a year in the making the only person knocking at your door kicking down your door to partner with you is dustin with filthy organics um he is broward based he's committed he's a cve here he's committed to broward been working with the county over a year in good faith what what we would you know what i would respectfully request is to amend your motion to take advantage of this new process under florida law where you can expedite things we can move things a little bit quicker and kind of um just bring an item to two publicly noticed agenda items and we'll move ahead we'll get to the negotiation table your staff we're confident monica and her team and kevin uh who've been great and very very accessible throughout this process i'm confident we're going to get to the table bring back something you guys can be proud of and dustin will start turning this uh yard waste into a a quality product so we're looking forward to getting started thank you thank you um first of all let me start off with in case my fellow commissioners didn't know that the solid waste authority is now a done deal it passed on yeah passed last friday and um all all the cities but two stayed with it uh deerfield beach and miramar decided not to so there's 26 cities and the county what that is essentially does is it directs it now the count that solid waste authority now has the ability to have flow control and they can direct where waste goes obviously this is one of the best opportunities to be able to send it to to send yard waste to our own landfill um and commissioner geller your question was a good one because i i all the surrounding cities have said as long as it's not um food waste bring it on the um and let me just first say i i really appreciate um filthy organics model of what they're doing everything dustin you've been been at every meeting with solid waste authority from since it started almost so you're a very good person to be working with here's what i here's what um when i looked at your proposal here's what what did concern me with it you're starting with 25 000 tons up to a hundred thousand ton capacity my concern is this is when i we the estimate of yard waste in broward county is going to be around 300 000 tons of yard waste the solid waste authority needs to hammer this out a little bit they need to figure out is it all going to go there is it going to are we going to divide the county into quadrants because and we also have to see where all this yard waste is currently going we kind of have an idea already um and we have to talk with haulers cities are you know cities are going to have to kind of be willing to sit to source separate and this is not what they're doing right now and you all you you get yard waste picked it you picked up at your house a lot of times it's it's both yard waste and um all kind of junk on certain days we get we're going to need it if it's going to go to the bank it has to be source separated or it needs to be so there's a lot of questions that are here i what i've put here is an additional motion and that what this is to evaluate the feasibility and i honestly do not know which one would be better of the county owning and operating a yard waste there at the bic they one of the one of the reasons that i saw in the proposal from both filthy organics organics and from admin is that this would be risk-free by having filthy organics do this i don't see a big risk because you know you've got flow control you you know we've got the acreage we've got all that stuff that's i don't know yeah hold on um 30 years ago the county commission decided not to to own the waste energy plants and the reason was they said because we don't know what the risk is we don't know it was new technology we don't know if these things are going to blow up we don't know what's going to happen so they didn't own it they delegated that authority to waste management and consequently while palm beach is building a brand new one we had ours torn down at a cost of you know we let we let waste waste management do that i think miami-dade got a got an estimate the other day for a new waste energy it was almost three billion dollars that that kind of asset we can't let those kind of assets go again one of the one of the things that the solid waste authority has has been looking at is what and where can we can control our own destiny i do think dustin would be a fantastic um uh somebody to work with but i but i think the solid waste authority does need to decide whether or not we need to own the facility or not that is an open question and i and i want to bring that to the solid waste authority with this motion i want to pass both these motions and let them both be evaluated the first one allow is is looking at the proposal by filthy organics and and i'm putting this forward to you um to your company you may be wanting to think of how can you have a larger capacity and i know i've spoken with kevin on this of trying to do you know maybe do we want to do a a small you know start off small i i don't think we need to do that i don't think we need to start off small we know we have the flow control we know there's 300 000 tons of yard waste in this county that has to go somewhere and so you know a year from now we have to come back to all the cities with all the prices of what all the yard waste is going to be what what the disposal is we're recycling all these costs and at that time they have uh have the option of saying we want to go we want to go further or not i think we need to come back with a real price a true price and a full full-blown idea of how to deal with yard waste in this county by that time and so we we need to know what that we can handle all that capacity or where that capacity can be split up so i am i am asking that both of these motions be looked at first a motion to to for further evaluation for the unsolicited public private partnership with filthy organics but also an additional motion that directs county administrator to evaluate the feasibility of a county owned and operated yard waste composting facility on county-owned property and i guess i need to ask um our county attorney do i do one of these at a time can i do them both at the same time i i think you can do both of them at the same time but i just want to make sure we understand your motion a okay to make sure that are you moving the motion a and motion b as they were stated on the additional material yes mr matthews had asked for something different so i just wanted to make sure no and i'm only asking for this right perfect thank you and and in the meantime i want the i want the part of the further evaluation on on part a is for county admin to be looking at how to for this for their proposal how would they and how could they make this bigger we know that um every household has about 0.85 amount of yard waste per year of tonnage that's that's what we need to be taking into consideration um all of these logistics are now going to be being looked at over the next we have to have our we'll have rfps out by probably december all these things so there's a lot of logistics that now that this swa is finally established the swa needs to be looking at these things so that's so i'm asking for both of these proposals to be accepted i make a motion to that effect um yes let me go back to our land use code right just thinking out loud okay because i recall residential communities were residential communities this is lived experience we have nursing homes assisted living group homes we have a bunch of different homes and i know the hospital i know where they are sending all that other smelly stuff i don't know when my garbage man picks up if he knows whether or not he's he's doing yard stuff or yard stuff mixed with other stuff good you mean you understand where i do i do and no one speaks to that tomorrow it might be a three-story building at that location so we can't say it's going to be a house's x amount because things are ever changing with our land use we have no control over it but you can control you want to be able to control the flow of the waste you have to know what the waste is how do we know if it's poop from dogs or poop from regular poop from me that you're picking up two questions one we have done a waste generation study so we know exactly not exactly but the percentage of waste in this county second what you're talking about is a holler agreements not disposal county deals with disposal not holler in those holler agreements they every city and and on a commercial side has a holler agreement they that picks up both garbage and some of them may pick up yard waste as well and they it is distinguished within the holler agreement those agreements have to be looked at totally different right now because right now every city has has has agreed that their stuff is going here here or here now they're going to be saying we want it to go there there and there for and the reason is the reason that for the county you're not going to stand up an entire mulching situation uh facility if you don't know 300 000 tons is coming you're not going to be buying equipment for that unless you know it's going now you know it's going there now you know how much is going there where it's going and this is to benefit each one of those cities that are involved okay does that does that help okay oh yeah what he needs to know someone needs to know i need to understand where the dog poop is going and where the regular ones that you're not controlling you control the hospitals and larger facilities but these single family homes that are doing all the other stuff and i know i need to get out of here by three o'clock so i'm going to be quiet after this okay so so there so all of that it needs to be earmarked and it needs to be source separated where can't work in recycling is already that way your garbage can is already your your disposal the the yard waste is separate from those two things so this is only dealing with the yard waste and that's it not poop not nothing else just yard waste okay leaves trees not we need to get this moving right okay thank you mayor um first of all we have seen this item before and when we saw the item before that mr dubois brought forward the location itself he has spent a lot of time and effort and money securing looking at one location that we had and then we said to them go back and work with the county to find another location and again they spent time money and effort working with the county administration to do so and they have so they came back with this motion at this particular 7101 southwest 205th avenue and i do appreciate my colleagues comments but again this is a small business we asked them to start off small and grow we asked them to come back and they spent filing fees and monies and costs to do the proposal now so i would i would not want to convolute it because the item b is at the same location 7105 southwest 25th avenue for you to look at i personally want to support item a like it is but also looking at the letter that was filthy organics they sent to us it was an additional material they talked about another process that we could utilize through florida law i want to look at mr myers and his team is that possible have you have you looked at that and i talked to ms ashton a minute ago about that it talked about proceeding with the unsolicited proposal process for the qualifying project without triggering the public meeting process but it also provides two public hearings of that process so the public has an opportunity to speak on it twice is that my understanding yes so it is possible to use the non-competitive process so that's what mr matthews was talking about i believe earlier so i know that commissioner fergus made a motion i would like to do a substitute motion or amend amendment to that motion to approve a with the change that ms ashton or somebody's going to tell me what that states okay am i too confusing or not no it's very easy you you would want to move uh a uh in fact the process that mr matthews is referring to and that you were referring to is being utilized in item 44 that already passed on consent so we have the language that we can use if that's the board's preference and you don't want to move b that's yours that would be my preference that would be my motion is that mr matthews that achieve the goal again these folks have been working diligently for the last year year and a half with us wanting to do the right thing and have done so so that's my motion i don't know if i'm going to second or not but that's my motion i have a motion i have a second on the substitute motion okay hold on i i got a second on substitution for only doing a right a what's a certain language that we're going to change the process there senator geller i am the alternate on the solid waste authority commissioner fur has been our member i'm going to give great deference to commissioner fur because of all of the work he knows more about the solid waste stream than the other eight of us i think that's rude very rude so what i would like i don't disagree with him what i would like to ask commissioner fur before we vote on this is if you have an opinion on his motion versus yours and if so could you elaborate a little because i like i agree with everything he said about filthy organics they've done a lot of work and i'd like to work with them but if you're saying that there are concerns with this because of the county needing the ability to control it ourselves i'd like to hear your comments before we vote on commissioner yeah i just want to point out so when commissioner fur responds uh if he thinks about which option under a that he wants the one that's printed with the competitive process or the one with the non-competitive process when we can give you that language commissioner fisher motion b uh is helpful because it tells staff what you'd like for them to do but even if motion b did not pass my unsolicited proposal uh experts uh in my office uh tell me that staff can still go through all of that analysis because staff doesn't have to ultimately accept a proposal and can use the property as it determines most beneficial so so b is helpful for direction not necessary in terms of actually doing that i just point that out uh for whatever it's worth i and i appreciate that that's a good distinction because if we were to to decide this this was a company we wanted to go with i would agree with you on doing a non-competitive they've been good partners they've done everything here but one i think the swa needs to be part of this conversation we're asking all we they've just gone through this crazy process for for 10 years now and this is one of the best opportunities of saving money for all of the residents in the in this county um filthy organics may want to take another look at their proposal recognizing what the capacity is now because they didn't know when they did this they didn't know how many cities there were going to be they didn't know how much was how much yard waste there was going to be and so they you know the proposal only deals with a fraction of what is needed my my feeling is that you know you're to your point if we're going to pick a company they're definitely the right company if we're but we need we need to analyze whether or not this is something where the county can stand this up themselves or should they i don't know i honestly don't know and it's one of those things that needs to be evaluated before we go forward with the unsolicited proposal that's that's kind of where i where i feel um and and i and if and if we weren't doing that proposal with filthy organics find something where we can but it might be able to work but it is one of those things where and i just you know i hadn't seen the the unsolicited unsolicited proposal until just a few days ago and i had i on my own thought was that this was going to be a proposal that would would be able to handle all of the yard waste that was going to be sent there all 300 000 tons it doesn't say that hold on nick and and and and it doesn't mean that you can't come back and and you know maybe there's a maybe part of the recognition of the evaluation of the proposal says you know what this proposal needs to enlarge itself a little bit and there's and and that's possible i'm sorry do you want to add something if i may thank you mayor uh first commissioner for we we all respect your knowledge in this more than anyone in the room like you like i think senator geller said certainly so don't build this ego okay well one of the i think you know the beauty of the unsolicited proposal process is it is a dynamic process it gets us it's a faster way to kind of get to the negotiating table almost one of the things dustin just told me is that if if the condition is right and then there's there's an appetite at the county and there's more space available we we can build up the capacity that is needed i think the one thing we wouldn't want to do is kind of pivot back to the solid waste authority and kind of work through that process there the the need for composting is identified in your master plan at the solid waste authority it is well documented it's needed we've got someone who is here answering the bell ready to address that now like we will work with your staff to bring a solution that is scalable to accommodate some or all of the need based on what what your staff thinks is most appropriate on that site um i i think the need is there we can we can do it we're excited to do it thank you thank you thank you i need to move down here we i just it's going to you know i have other commissioners that want to speak so let's recognize senator rich and then commissioner yuddin okay so you know the need is now if we go back and do this and go through this process with the with the solid waste authority i mean it's gonna take us another four years to get something done i mean the need is now i'm i i've been looking at this and reading i agree and i i have i have a question about the yard waste though because so much of the yard waste comes from not what's picked up at the curve side it's it's picked it's picked up by gardeners by people that are you know that are taking it there so do we have any idea what the tonnage is that come that is available from uh you know commercial all the commercial uh entities that hire uh people to clean up yard waste and the homes and everything i mean i know for instance in weston we don't they don't pick up yard waste we have two cans you know the recyclable and the regular garbage we don't have yard waste now you know maybe we're just one city that doesn't but i'm just saying i i think right now we we know we have enough to get started here and i it's just kind of frustrating to me to sit and listen and think that we may go back to square one almost after these people have been working on this a year and i'm looking at the at the because this is in my district out there where the where the facility is and that you you can see there's current yard uh waste piles and then there's a proposed eight acre site i mean i i can see that if there were a need for greater it could be enhanced and expanded and the other thing is that it's there's no um there's no change of property here it's our property we're not we're not selling our property to to to them um it's entire it'll be under a ground lease and um you know within the existing area of the broward county landfill so i i i just think we need to be we need to move ahead in in my opinion and and not go backwards by having to go through a whole other process again now thank you mr evie i want to see us try and prove the concept and i think subsection a with the changes that commissioner fisher made would let us do that i think we can start the pro i'd like to see us as a start of the process to prove prove concept and if it needs to be expanded on and the solid waste authority wants to come in and do more i think we would there's no reason not to but i don't think i think if we don't start we'll we'll be behind the eight ball even further than we are as a community not as a county but as a community we have not done the best job with our waste and we're seeing that over and over when we look at landfill sizes and whatnot and i want to at least start something and do it so i i would support what commissioner fisher uh made in his substitute motion although i do agree with commissioner fur you have to go to the solid waste authority at some point to get buy-in from them because we have a solid waste authority with everybody but i want to prove concept so i'm going to support commissioner fisher so i have a motion and a second and we haven't voted on it yes i need i need to say one more thing the the and just this would not be a long process all of the rfps of the sw you have to go out by november or december yeah but then how long is it going to take till they come back they we are expected to have all of the prices by april of next year man did you hear that yeah that's a long time i saw it a long time that's a quick that's a quick turnaround that's a quick turn right right right it'll be april of 2028 right all of the all and all all of those have to be decided on by next year every single one of those rfps and here's the part i'm here's the only part i'm worried about is that if the yard waste number is not considerably lower than what it is right now then it gives the cities the cities have the option of bailing on this so it has to be at a better price a much better price than where it is now of what the county is offering it is the one place where the prices that the cities had better prices than on everything else our global agreement we're better yard waste is the one place where if we don't have a better price they're going to say for a lot of us get for a lot of us going to say i'm out hollywood's going to say i'm out and all of them say and i think you guys know that that's up front if it's not if it's not and the reason why if if the count i know i'm sorry but you know what it's taken 10 years to get here so give me a minute let's go you know but if the uh the one thing that if the county was running it that then you run it like a utility and you run it like whatever the user services is whatever the cost is is what the cost is to the consumer and that's a different price if you can get it down to where it's like that that's where we need to be but i know you need to make a profit so there needs to be some we need to figure something out okay i appreciate the board's help in approving this ordinance amendment which is an important step in preserving access to critical medicaid funding for hospitals and the patients we serve this amendment helps align the county's lppf ordinance with the evolving federal waiver framework it gives the county and state the flexibility needed to continue participating in medicaid supplemental payment programs while complying with federal requirements for us this is more than a technical ordinance update it directly supports our ability to care for medicaid patients uninsured patients and vulnerable residents in our community these funds help sustain emergency services specialty care workforce needs and other essential hospital operations that benefit residents across the couch of the county the lppf structure allows hospitals to generate the non-federal share needed to draw down federal medicaid funds importantly this is accomplished without creating any new burden on county taxpayers or households timing is important because hospitals the county and the state need the ordinance framework in place before the rate resolution on behalf of our hospitals and the patients and families we serve thank you for helping approve this amendment and your continued support of the lppf program your actions help protect access to care and strengthen the health care safety net in this Motion D is a motion to direct public works and environmental service department. public works and environmental services department. And I pulled it for the simple reason because I just wanted staff to through Miss Shapiro wanted to just explain this Because when you talk about withdrawing from segment to be tree nourishment people get nervous, right? I got nervous because most of my district is on the coastal line But there's a specific reason for it and then more importantly my understanding is through Miss Shapiro my understanding that mr. Valpano or somebody wants to speak on this because There could be some some changes to it. So we might not have to do with withdrawal but it's wanted really just five minutes for him or her to Explain it real quickly and where we're at because withdrawing scared the dickens out of me So I want the public to understand it. We are not withdrawing from be tree nourishment In fact, this is just about a project that we completed a couple of years ago And there was a warranty repair that the core was going to do and as part of that warranty repair It's normally all covered by them when we did the project a few years ago All of the easements we had were sufficient for the project and there was no issues with it However, when they came back to do this renourishment, you know sort of the warranty repair the court had adopted some new policies which made it so that some of our easements at first it was six and then maybe it was 30 and then it might have been 90 something and so It just completely changed the whole picture of the project and would have had Significant financial implications for other beach projects and it's come to our knowledge that other Jurisdictions have gotten sort of exceptions and workarounds and so we were looking at trying to See if there was a policy or a legislative change that could be made so that we would be able to preserve You know, our real beach re-nourishment projects the future ones from having to be You know, so onerous in the way that they'd be implemented and actually there's been some fruitful conversations with the assistant secretary of the army's office as of yesterday That may be able to get us some sort of policy exception So we would work on that in the meantime. This would give us the flexibility to Continue to be able to address it with them and then hopefully get some sort of meaningful Reinterpretation before we actually do a real beach renourishment project. Thank you. That's what exactly just wanted for the record and let You know that we're still we have wiggle room here, but this gives the option to do so. And how much is it going to cost and is it worth it? Those are the questions that had to be asked and were answered in this resilience plan I will tell you having had a chance to go To many climate change conferences in place that places throughout the world look at this model, right? They're looking at our model and how good it is and they're saying this is the way to do it and you know, we should be proud of this of this plan it goes it gives us a blue blueprint Through 2070 it is not going to be easy to do It is a it is a big challenge I want to thank Commissioner bogan for putting forth the resilience Plan for money earlier this year that got it got as a good kick start And it's a it's brought in a lot of buy-in From a lot of cities. I also want to thank Nathaniel with the county attorney's office and I forgot the list of There's a bunch of people that had helped in rewriting this so that it's palatable on on many levels But thank you nathaniel and your whole group and i'm sorry. I'm joking I hope it is Actually 75 and 76 are far worse than the previous two These are changes that the state legislature and governor have imposed upon us to remove the sections of our procurement code that ensure employee retention Recognition of domestic partnerships and our entire living wage ordinance our That whenever we as a county find a vendor that can provide the same service at less expense to the taxpayers It does not result in the employees using losing their jobs Additionally domestic partner benefits have allowed couples in households who are registered as domestic partners But not married for whatever reason to extend their basic insurance Benefits to the partner most importantly our living wage ordinance in broward county Currently currently is currently eighteen dollars and fifty three cents per hour For security Service officers with qualifying health benefits and sixteen dollars and seven and nineteen cents per hour for all other Covered employees receiving health benefits. This will now fall to the florida minimum wage of fourteen dollars per hour For standard employees and ten dollars and ninety eight cents per hour for tipped employees to the firms who receive every employee Is losing anywhere from two dollars and nineteen cents per hour to four dollars and fifty three cents And I have to say this is just appalling Considering that everybody is talking about affordability and the fact that people can't afford health care They can't afford food. They can't afford gas and now what this is doing is reducing and lowering their wages So this is it's it's it's really very difficult But again, I understand that it is part of state law and I am only hoping that after the next election maybe we'll have people who will understand that we need to take better care of Everyone in the state of florida and make sure that everyone can make a living wage Senator rich you want to point out who's responsible is this we're talking about the governor and their state legislature I said that For me our republican state legislature and our governor is responsible for this. Um about a year ago senator polski She stood before this board in the browar county residents And she encouraged each one of us to kind of share with you guys on our ideas and what we have And so this is why i'm here today So in december of 2025 browar county launched the safe program safe parking program Which provides people experiencing homeless homeless homelessness Who are living in their cars with a secure place to park overnight? I believe we have an opportunity to build on that success Briar county currently has five county owned Campgrounds that are controlled by the county and their existing infrastructure is designed to support overnight stays My request before this board is to explore whether we can designate three to five camping sites um per campground for those people that are homeless um I recognize and I understand that broar county's current um campground rules prohibit sleeping in passenger vehicles Um, but i'm not proposing that we disregard those rules at all and I am proposing that I am not proposing that we replace the safe parking program that's already in place I'm asking us to create more space for that program to work um The part of that request is looking at the data How often are the campsites actually occupied throughout the year? How many sites are available during the um different times of the year? Um, this could be a coordinated effort between haas and Park participants are Referred and screened through the appropriate system and the current campground becomes a temporary structure place of stability While they are working towards permanent housing Um, so browar would not be the first county to actually explore campground facilities As a response to homelessness and 2012 dane county in wisconsin They formally designated three campsites at lake farm park Campground for unhoused people for the remainder of the camping season What I find interesting is that dane county revisited this issue in 2021 Recognizing that his campgrounds were one of the few lawful alternatives available to people without permanent housing And as of now in 2026, dane county's budget includes two million dollars towards creating a lawful Sleeping accommodations for home unhoused people including a campground or similar Arrangement to me. This says something important that this idea deserves to be evaluated rather than dismissed We already have the land. We already have the infrastructure. We already have the park systems Um, so before we invest in creating something entirely new I'm asking us to look at what we already have look at the data look at the challenges and look at the safeguards This is not about creating a place for people to remain homeless It's about creating a safe temporary place where someone can park tonight While browar county helps them work towards a permanent place to live. Can you do the next one look at that? They're even out besides the stanchions their way down the hallway in front of another airline Because a legion doesn't want to give customer service. It's just a joke and you know We have such good airlines that want to expand jet blue American United, you know Delta and Southwest and you know, I think we need to send mark. They have been working on a management plan Eight years because there because there was like a turf kind of war between the for Fish and wildlife commission and the department department of environmental protection Obviously, you've got for it goes all the way from martin county all the way down to biscayne bay But they finally put together an entire management plan. It's it's there. It is solid it's signed It's had public input But again, it's one of those things that this commission was the tip of the spear on that and It's something to be proud of when you're when we're now looking at doing Applying for grants fiu has already applied for a grant based on that They just got a million dollars So it is one of those things we can start to look at how do we use that for future future policy Anyway, congratulations to every the our department has been a huge has been Constantly giving input to it and they've done a huge job Thank you to the the entire resilience department and then lastly, I have two Requests from the school board for something. I think could be kind of interesting One is they are wondering if it's possible To use our broward county transit system For high school students the good the interesting part on that is you are actually kind of creating future users of that system They are they are minus 100 bus drivers right now, and they they don't have drivers They're asking is there a way to have to use our system and incorporate that maybe combining Some synergy there. It's costing them money extra money that they don't have Unfortunately the the school board is getting starved It's actually getting starved because so many students are are being given scholarships to all these other private schools And they're they they're minus 10 000 students all that money and it is You're you're you're having it. It is really hard on that school system. That's our school system It's horrible And I think it's one of those things where we may need to think how do we where do we help out? How do we help if we can help out maybe we should so those two things um, monica, I'll talk to you and admin later, but this is something for both the uh transit division to to consider As well as uh as your department, so thank you, you know, if the schools are short on money You know, maybe they want to consider a little out of the box Like I cut the libraries out of all this. Oh, I knew you're going there. What do you think of that? You know, you know, you know what's not for I know but you know what's unfortunate because They've been starved for money a hundred schools don't have librarians a hundred schools don't have librarians in this in this county So all the the money you think Out of 250 schools. Yeah to schedule that meeting for you and me for this conversation sure to See whether or not we can have a conversation with the school board about their vacant properties and what we can do with those absolutely As we move forward If you're going to meet well, you're going to have to do it in public Well, what might what we've never done is have a joint a joint school board county commission meeting an accent for it And I know that you're talking I'll get it arranged. I'll get it arranged. All right. I need to read this script to you guys Sorry, we need to identify our canvassing board representative for the November general election cycle The county attorney informs me that the mayor is the county commission's representative on the canvassing board Unless the mayor is unable to serve I am unable to serve under our administrative code the role passes automatically to the vice mayor if he is able to serve vice mayor Can you serve? Oh, I heard he can serve okay. He has confirmed that he can serve Yes, so vice mayor mckenzie conserve the county attorney also informs me that I should appoint at least one alter alternate member Commissioner fisher and commissioner you are serving as alternates during the august election Are you willing to serve as alternates for november? Okay, great wait for response. Did I wait long enough? Thank you. Thank you commissioners fisher and you Dean are appointed it actually knew that they were going to say yes. Is that amazing? And that's my the only last thing is You know true, but I'm not done. I would give me one more second. I was just going to say drew We will see you in five days, but you will sorely be missed here I mean really sorely be missed here and and I don't know who's going to keep us out of trouble. I don't know if anika can keep us out of trouble But uh, hopefully she'll be able to yes, she'll keep us out of trouble Yeah, yeah, yeah Um, okay, so I want to follow up on what uh what commissioner first said I had a long conversation with school board member hickson and I'm connecting her with um If you don't mind we're going to connect them with she called me to with corey to talk about You know this thing with the with the transportation issues. It's it's actually a very good idea um if it you know if we if we can work at all All you know all out Um, and as far as the panther I saw you I saw your face So I I've I've pushed her in different I've given her a few names of other people and people that she could Go to it is it is sad because they pay over a million dollars a year to You know to pay for graduations at places and it's it's ridiculous So using nova because they're very inexpensive, but it's difficult because they're not quite I mean obviously they would love to use the amaranth uh, you know Facility so we'll we'll see what happens there I also just want to say I want to thank um the haas staff and patrice Paldino and her staff It's important for everybody to know how difficult this has been this year Dealing with the nofo which is the notification of funding for homeless Because it's through hud and hud keeps changing the dates the the everything about the the the the applications and each time the judge thank goodness the judge says no You can't do that go back fix it they come back But it's just been delayed and delayed and delayed and it's it's just you know a very difficult situation um, and I do want to thank her also because we did quickly get together and our a proposal for um a youth homelessness program That um actually had some funding available from from hud and we in just in about a less than a 10 day period We had to get it all together and have a rating committee and and then send it up and and then you know meet and and they worked with with them to send the rfps up but we have uh, we we accomplished that and i'm hoping that we'll get some funding for the youth homelessness grant from from from hud It's just it's you know, it's impossible and right now we're we are kind of on hold for for for 2026 And we're almost finished with 2026. So, you know, um, so it's a problem But I I just want to give them so such credit I mean the work that they've had to do on such short notice to turn things around and to get our applications in properly so that we don't lose any funding You know from from it's really important So just want to mention that and thank them Lastly one thing I I I've been going out and I know everybody else is and um Talking about educating I talk about educating not advocating About issues regarding to amendment property tax amendment And it's amazing to me really how many people do not know where their property tax goes So we have a really a big job in front of us and a lot of other people are out there I chair the coordinating council of broward It's all the human service organization. They're all doing it. I mean everybody's out there But it's just amazing giving them given the amount of money That we you know bring in in property tax that people don't know the incredible services so this morning when when you mentioned uh Commissioner for to uh to our animal care director, you know That that is just an example And people and people just don't you know, just don't know I have been kind of highlighting seniors and and other issues and public safety because it's not included now And i've been twice out to century village, which is in my district And you know they get it They they they get it now And uh paratransit all kinds of things so you you know tailor it But I just think it's so important for us to be out there and I want to mention monica I think there's one thing that was suggested and I agree Our new brochure is excellent. It's the updated from the you know, it's excellent for a certain group of people But other people need like like just a You know a circle which just shows where it goes so you can give it to them And it's not quite as complicated as as the other one I think we need to put something out there that we can have take to hand out when we go out to these places To give you know to give them the information But um I'm very hopeful. I have to tell you um Because I had a woman at century village after I got finished talking all about senior issues and public safety and she raised her hand And she said well, what what's going to happen to the homeless? I thought okay you get it So it's not just about you or your you know your specific population Was able to ask about what's going to happen to the homeless so um We you know, we just have to keep out there and I You know, I'm feeling that we can do this. Thank you um, I I also want to congratulate uh city commissioner carol shoeham who will be joining us up here And I want to congratulate all the people that put their hats out in the ring to run for office. It's not easy Uh, it's a difficult thing to do you put your friends yourself and your family through uh a lot of uh ups and downs and uh, but we appreciate people that run for office and that are willing to serve um I i'm seeing the same thing as far as what amendment three when that comes out um, I think that people You know, we talk about all the different pie charts and all the stuff that we send them But people think that they're paying you know too much for the services or too much in property taxes not understanding what the services are that that's provided there um Regardless of how the vote turns out in november for this I think there's going to need to be a concerted effort between the legislature and local governments to do something so that people have more affordability I mean, there's got to be some changes With some of this because people are getting priced out of living In this area, so be it with property taxes with insurance With whatever it may be affordability is going to be the key issue going forward. I think over the next few cycles um You know when when when spirit Left the airport I people would call me and I know they would call mark and and and and the business community and everyone say well What's going to go on? What's going to happen? You've lost such a big carrier and my thoughts have always been and they still are to this day that Our area is really a very demand driven area people want to be here airlines want to be here so I think that other airlines I think our passenger seats will quickly climb back to where they were other airlines want to be here They want to make the investment in this area. I think our airports doing a good job as far as being Very the very um Very intentional intentional about how they increase Airline slots to the different airlines and the different uh uh carriers that will come there I know that we want to make sure that we do this in a way that the front of the house Doesn't have too much burden until we can connect the back of the house So that people have a better experience in the airport. I've flown quite a bit this summer I was on a legion. I had a fabulous flight on a legion a few me There were no lines. I walked right through it was really amazing on a legion Um, but whatever anyway, i'll see you at the workshop, but thank you for everything you're doing at the airport Have you ever been called a bastard in a public meeting? I love it. Yes, commissioner your throw up bag And just quickly I wanted to um, also Congratulate all of the folks who Won their prospective elections including carol shuham and others. I mean it was A hard-fought battle some of the districts like congressional district 20 and 24 Um, but um, we trust that those who are Who have been voted in Will do the work at bringing the communities together in both of those congressional districts The other thing I'd like to say is also I don't know what it will take for folks to come out and vote. I know um supervisor scott was doing his best to Encourage people But when I noticed that there was really very few folks who actually Requested their vote by mail ballot And so that's something that certainly we'd have to push so that more more folks can participate In the election process as um Commissioner rich had mentioned about some of these laws that were passed by Tallahassee You know elections have consequences and when you don't vote and these things happen DEI and all the other things That we're faced with it's because we don't Exercise our right to vote so out of this I would hope that As november rolls around each of us will do our part because we know What voting does to educate Our constituents about being part of the process And making sure that they request their vote by mail for each and every election cycle So that's about it. I want to just talk a little bit about that and make sure that our residents know To check their voter status and be prepared to vote hopefully in november You said you said great example, but people won't people won't take your example I don't get it either, but i'm going to be brief But I really wanted to share with us so you're going to get your revenge now. Thank you. I'm rescinding Sorry, all right. I'm going to be brief state roads and or if not What they did on election day don't know if you're aware and i'm trying to find out so i'm going public On it they came out and they were picking up signs on election day because they were Within three feet of the roadway now if you're gonna do this I think for some you should be notifying Every candidate that Filled out an application to run for office Should be notified because how would they know they registered to vote and they bought the yard signs or whatever signage And on election day you're being told you have to move the sign They came down a state road in my district and we're removing signs on Election day there need to be something that is within law or whatever don't know if there is But I just know it seems unfair that our government is spending money To remove signs instead of spending money to notify us that we cannot do this because this is illegal So that's one thing I wanted to There's a way around that Huh? There's a way around it. I know you would have a solution with what it is You give them the sign they drive away and you put up a second sign That's it. You just you just solve the problem We solve the problem, but I think they need to not waste our tax dollars and then tell me there's not enough dollars for housing For schools and all education or for children All right, so that's where i'm at and of course i'm glad We're gonna direction is given to monica and her team that we need to schedule a meeting with our school board members That can attend just like we do with the legislators to talk about things that are common to both of us So I will leave the rest until the next meeting mr I I didn't speak the first time because I thought We were all waving yeah briefly though. I'm only got this follow-up to what senator rich was Saying the I have asked Over the past 20 years at least 15,000 people where they think local Community tax goes and I divide budget into five categories roads and bridges parks and recreation Administration and overhead first responders and everything else so they have to equal a hundred percent Average voter thinks that we're spending between a third and 40 percent on overhead and administration local governments and the real number is eight percent and they think we're spending between a quarter and a third on first responders And the real averages are between 50 55 and 65 percent so as We heard I think from both commissioner union and certainly from senator rich our voters simply don't know Where their tax dollars are going number one number two? I want to remind all of you and my emails that I sent it that I know all of you had that when blaze and gloria was saying Oh browards spending too much money He made up his facts Because he didn't use The number that everybody uses for population growth which is university of florida bureau of economic business research He didn't use the For inflation bureau of labor statistics Bureau of labor division of economic statistics for the metro statistical area of Dave broward palm beach and he compared our budget book number To our acfr number five years later and acfr is always five percent higher than budget book If you compare the accurate numbers we met his criteria and the last thing I wanted To say about that and this is a commissioner union the public knows we're overtaxed and they're wrong If you look at any of the national rankings florida comes out somewhere Between 45 and 49 as the lowest tax state in combined state and local taxes in the nation Under any objective standard we're not overtaxed But we also by all rankings are number one in insurance rates And we're typically around tip around 50 percent higher than number two regardless of which rankings you're looking at And that's what our problem is and They could fix that at the state level They could fix it at the congressional level or insurance rates But doing that would take on the insurance industry which gives Incredible amounts of campaign contributions So they don't do that and if you look at where the state dollars are going one of the reasons Local governments are increasingly strapped Among the executive and legislative committees of florida association of counties We are creating right now examples over the last five and ten years of how much the state used to pay for But they've been pushing down and unfunded mandates to local governments not just mandating We do things but taking state responsibilities away and giving them to local governments Making us pay for them. We're not an overtaxed state. We're an over insurance State cost and they won't do anything about it. I will be very brief first and foremost congratulations drew It's been an absolute pleasure working with you, and we've all appreciated your guidance and your friendship and and we will have more time to Privately share some some words, but I just wanted to say thank you for all your guidance to our office and to the entire county and And and congratulations on your retirement Um as for the graduation discussion just for the benefit of everyone. I have been speaking with the superintendent On the graduation issue, and I have directed Them to speak with the folks at amirant About it the issue there is the costs associated with opening the building the utilities security and everything else And my initial feedback on that from both amirant panthers folks And speaking with the superintendent they under he understands that it actually cost them more if they went to the amirant than their current structure With the cost per graduation, but they are going to be speaking I just wanted to at least address that so everybody had the benefit of hearing that And then lastly i'll see you in a few minutes in room 430.
