This is the Planning and Zoning Board slash Local Planning Agency. It's an advisory board which makes recommendations to the county commissioners who will make the final decision on these items. Items on today's agenda will be heard by the county commission on May 7, 2026 at 5 p.m. When a motion ends, any kind of a split vote, a roll call vote may be taken to ensure accuracy. You know, on that tie vote that we had for H3, I wondered if we could enter into the record the names of the board and how they voted. It's not on there. It's just as a tie vote. Does that matter? Can I do it? It's at the pleasure of the board. I mean, if you direct staff to include that in the message to the board of county commissioners, we'd be happy to do so. But it's not required. Request a zoning classification change from RU-210 and RU-111 to RU-215 under application 25Z-00062, located in District 1. Good afternoon, Chairman, members of the Planning and Zoning Board. My name is Kim Rzenka. I am not Bruce Moya. I'm the law firm of Lacey Rzenka. There has been an authorization put in for me for this application. This is a rezoning of 18.07 acres for multifamily apartments. The Dershkas are here. Eric and Carrie are representing the family. These are 12, 15 parcels that have been assembled over years, and now they're wishing to sell to retire and travel. But they are here if you have any questions. The contract purchaser is Millstone Ventures, LLC. They are here as well to tell you a little bit about themselves and what they plan for this project. And Bruce Moya with MBV as the engineer of record, who is here to answer any questions that may have come up from the staff report. There are a few nuances that are unusual, but they're environmental issues, but you may have questions. So I'm going to bring up Andy Weatherford with Millstone Ventures, LLC, to tell you about Millstone and the proposed project. Good afternoon, Mr. Chairman, members of the Planning and Zoning Board. I just want to start by thanking you for your time. Sir, if I could get your name and address for the record. Yeah, my name is Andy Weatherford. I'm the owner of Millstone Ventures. We're the contract buyer for this property. My address is 9820 West Point Drive. In Indianapolis, Indiana. So we wanted to just introduce myself, the project a little bit. We brought our team here today to address any questions you might have, but appreciate your consideration today. So my company, Millstone, we're a small development shop out of Indianapolis. My business partner and I started the company in 2017. We've got about 25 employees, and we're a vertically integrated development shop. So what that means is everything from planning and zoning through design, construction, and then property management, once the property's been developed, all stays with my team. So we consider ourselves what we like to call a cradle-to-grave development shop. So for every step of the process, through entitlements, design, construction, and property management, the advantage of working with my company, we think, for the communities in which we build, is there's one point of contact for every step of this project, and that is me and my team. You know, the type of product that we like to build, we consider ourselves a luxury resort-style community builder. So it's a multifamily product, but high-end market finishes and amenities. And, you know, being vertically integrated, the advantage that we believe we have is, you know, we control cost from the beginning with our design selections, through construction, with our construction company that we own, and that allows us to deliver this elevated product that we can deliver for our residents at market rate rental rates. So we don't have to charge above what's market for the product that we build, but we do build an elevated product for the communities that we try to serve. You know, we take a very targeted approach to our projects. We're down here for a reason, following, you know, population growth, job growth that is happening here in Brevard County. And, you know, we try to build where our product is needed and wanted. We know that our rezone request follows a future comp plan for the area. And, you know, what we're here to do is deliver some new housing stock in a community with a lot of job growth and population growth. And what we've been tracking is, you know, a minimal amount of new housing that's being delivered to the market that's sort of needed to support the continued job growth that's happening here in Brevard County. You know, what we're seeing is, you know, what we're seeing is, with that job growth, there's quite a few members of the workforce that are commuting from Orlando and other markets. And, you know, by delivering some nice housing stock, what we're hoping to do is give those people a reason to stay and keep those paychecks and live, work, and play here in Brevard County. And that's what we're hoping to provide for this community. So that's my opening bit as an introduction. And I just want to thank you all for your consideration today. All right. Thank you, sir. I'd like to talk a little bit about the area and the request. And I have a larger version of the map of the area because you all only get a very small packet, a small map in the packet. As I mentioned, this is a rezoning of 15 parcels that have been assembled by the Derskos since 1979. A majority of the parcels are zoned RU 210 with a density cap of five units to the acre. The smaller parcels to the north are part of the Sun Valley Platte from 1955. And those are zoned RU 111. This development is intended to be closer to State Road 405. There are some wetlands to the back that will be avoided. All the wetlands will be avoided as this is residential property in Brevard County. All 18 acres have the rez 15 future land use that has been there as long as we know. So at some point, the county's policy was this was to be multifamily. The map that I have provided to you, the red line that goes down the middle, that's Breezy Hill Lane. That is the address of the Derskos homestead. To the north of there is the fire station and Florida TIF land. And then to north of that is a BCSO office. What is not clear from in your packet is there are two apartment complexes to the north on the west side of State Road 405. That's why I put those there. They're older apartments. Summerhill apartment is a more northern one. It was built in 2005. And then it says WW apartments on the Brevard County website. And that was built in 1985. The new one at State Road 405 and State Road 407 is Millwright. And that was just open this year, phase one of that. So apartments are coming to this area. This is almost transitioning to a multifamily area. And when you look at your future land use, all of this area on the east side of State Road 405 is Residential 15. And also you can see the block of the 18 acres. The staff report states the primary uses on State Road 405 are commercial office and government facilities. And that the only new development is residential homes and apartments. However, it appears that this is more going towards multifamily on State Road 405. The staff report also states this is undeveloped commercially zoned land when, in essence, this is undeveloped multifamily zoned land. The preliminary concurrency says traffic will not cause a deficiency in the level of service by this development of approximately 270 units maximum on 18 acres. There's no school concurrency issues. There's no material violations of any relevant comprehensive plan policies. There are environmental issues that were raised, including a FEMA flood zone, a well, an aquifer recharge. Those are all site plan and engineering issues that will be discussed with staff and with Titusville if this is approved for rezoning. With that, Mr. Moy is here. If you have any questions regarding the environmental issues or any development issues, and the Durskas are here, too, if you'd have to ask them any questions. We're here to respond to anything you may want to know. Before she leaves, does anybody have any questions for Ms. Rezenka? Hold on one second, Ms. Kim. Is there anyone in the audience who wants to speak for or against this item? Kim, we're doing good. If that, we would request the rezoning to RE-215 as requested. Okay. Thank you. Mr. Moy, could you? Yes, sir, Mr. Chairman. How can I help you? Do we have any questions for the engineer? Yes, I have. One after Ron's already shot. I never expected John to have a couple of weeks. Look, I don't want you coming up here and not being asked anything. I appreciate it. Thank you. You don't have a site plan, but could you give me an idea of what kind of buildings you're going to be put on or how big they're going to be, how many there are? Are we talking about duplexes? Are we talking duplexes? Basically, we're looking at three-story walk-ups is what we're looking at. Probably typical of what you see in most other types of developments, multiple units with maybe 20, 15, 20 units in the building or more, three stories high. Is there going to be some amenities like a pool and trail and stuff like that? Yes, there will be a pretty hefty amenity package, including clubhouse, pool, and activities for the residents. Okay. All right. Thank you. Okay, Mr. John. Is there sewer in the area? There is. It will be stored by the City of Titusville water and sewer. Very nice. I noticed on the wetlands map that the entire north segment is wetlands. I wouldn't say the entire north segment, but there is that northern northeast corner and there's a couple that are internal to the property. Yeah, the couple I'm not worried about. It's the one that takes up most of that northern part of their site. Yeah, and being that it is residential, we don't have the ability to impact very many wetlands, even if we did. We're proposing to avoid all wetland impacts. So I just want to know, you're not going to build on that area? No, that's part of a very large wetland system, so I don't think that we would be allowed to build in there, even if we wanted to. Not to mention, that's part of a Titusville well field, so we would not propose to impact that wetland at all. And we're not proposing to impact any of the existing on-site wetlands. Oh, okay. And definitely not the one to the east, because that's a very large wetland system. It's a very valuable wetland system. Did you say on the east? Yeah, that extends way beyond our site boundaries. Yeah, that's not really only the one little corner there. Now, I was just concerned about the one just north of Breezy Hill Lane. It seemed that it was a very large swath, and I was just wondering, you were only going to develop that southern portion? Well, I think the two other wetlands on the property are isolated. No, no, no, this is one big one. But that runs along the east, the northeast. Can I interrupt? I think the NWI map first is what it's showing. So the GIS mapping doesn't always match what the actual wetland lines are. So I think that's maybe the confusion. Yeah. No, there's no confusion. This is one. I also looked it up on the website. See this kind of tan color? That's all wetlands. Blue is the wetland. Blue is a lake. No, blue is the wetland. It says estuarine and marine wetland. I can read these. Okay. We've had an environmental study done, and it's just not that big. They're two isolated wetlands. That map is not accurate. Well, that may be the case. Yes. Because I've found that in the past, too. Yes. So you've done the survey. We have done an environmental assessment of the property. Okay. So somebody actually walked the site? Yes, sir. Okay. All right. Very good. Thank you. And just so you know, too, we did have a meeting with District 1 Commission on this, and we didn't really hear any specific issues of concern. Just that, you know, we may be making an effort to use some LID technology in the development of the property was one of the biggest comments, but there was no specific objection to this type of use in that area. Okay. Mr. Neal, here's some evidence. Whenever you're ready. Mr. Chairman, I make a motion to approve. I have questions. Sorry. Looks like there's more questions. Yes. We're going to hold that motion. Ruth, go ahead. So, Mr. Hopping Gardner was talking about the wetlands. But above the wetlands is, is that aquifer recharge? Yes. Which is why the wetlands filters down, goes out to the wetlands for the Titusville wells. And my concern is, is when you develop out the top of the recharge and you put apartments and parking lots and whatnot there, it hinders the amount of recharge that's happening. And while you're getting water from the city of Titusville, the city of Titusville can't even supply itself with more than two-thirds of its own water because it gets it from unincorporated Brevard out by the county line. So, developing out another recharge area near their wellfield is likely, or could, burden North Brevard and unincorporated with more water needs for the city of Titusville. How does that work? So, for one, as far as it being a aquifer recharge, that would, we'd have to get testing to show that it, that it is, just because the maps show that they have aquifer recharge soils does not necessarily mean it does. Wetlands usually aren't aquifer recharge soils, but some of the upland soils could be. But we would comply with the, because it is in the area of critical concern for Titusville. So, we will, because we're getting utilities from the city, we will be complying with all their regulations regarding recharge for that project. So, that's going to be one of the challenges, is meeting their requirements, but we will have to meet their requirements for recharge. I understand that. I have concerns. They already haven't managed it very well. And unincorporated North Brevard pays that price with their residents and their wells as they suck up that water. And the more burden that that puts on unincorporated Brevard, the less folks out in unincorporated Brevard can use their well systems or have to continually drop wells because of saltwater intrusion and other things. And facilitating to make that problem worse is a real concern. That's all. Thank you. Any other questions? Ma'am, I'm sorry. I've already opened it for public comment. No one said anything. My name is John Platt, P like Paul, L-A-T-T. Office address is 330 Williams Point Boulevard, Cocoa, Florida. And a little bit about what you're wanting to do. Final plans is we want to go to BU2 because we want to put up a hardware store along US-1 with all the growth and the houses going in the back of that industrial site that we have now. But immediate use is we would like to turn it into a parking lot for a boat and RV storage facility to generate some extra income while we work on putting the new hardware store on across US-1. We'd also, right now, Atlantic Wire and Rigging works out of 330 Williams Point Boulevard as well as JPR Motorsports. And we like to move our, both the companies from being on a Williams Point Boulevard to having US-1 front access. All right. Any idea how long you expect time-wise between turning it into a storage facility and then turning it into a hardware store? That all depends on once we get everything up and running, what the final cost of the hardware store is going to be. I have got one quote on doing that, but it also depends on some work we're doing at Atlantic Wire on contracts coming in versus contracts going out. I am hoping within three years, but I don't know that to be 100% accurate. I'd like to get the RV storage up and running now to help generate and get some things going. But my goal is to have the RV storage parking lot in the back two parcels and having the hardware store and Atlantic Wire with JPR in the front parcel within three years. So the long-term plan is to keep some storage on the back section? It'll say some. It also depends on how large Atlantic Wire and JPR gets within the next three years of being on U.S. one front property versus being on a side street that no one knows that we're back there. We are a defense contractor for Lockheed Martin and the aerospace industries of things that we do. So it all really depends on what they decide they need from us is going to decide how big of a facility that we put together. We've been back where we are now for a little over almost 30 years, 92, almost 30 years. And we've now outgrown that facility and I've rented some bays onto the east side of us. And I like to put everything underneath one warehouse system. And the reason for going through BU2 is that light industrial would be fine, but I've been told if I want to put anything outside of the four walls of what we put up, it has to go to BU2 instead of light industrial. If I'm going to do that, I might as well in the back parcels put RV and boat storage with all the houses going around us. They're putting up, I'm thinking between six and 800 houses right on the outside of our industrial park that we got now. And with the way things are, they're going to need to have some storage areas for themselves as well. Any other questions for the applicant board? I need a motion. I'll make a motion to approve. What's the name of the name? Marsick. Marsick Family Trust, being represented by Kim Rizinka, requests a zoning classification change from AU and GU to EU under application 26Z-00003 located in District 2. Good afternoon, Chairman, members of the Planning and Zoning Board. My name is Kim Rizinka with Lacey Rizinka in Melbourne, Florida. I'm here on behalf of the Marsick Family Trust. This is a rezoning of a split parcel of 1.87 acres. Again, I gave you a map just to put it into perspective. This is the map that's in your package, but with a little more information. The yellow highlighted area is the parcel that has split zoning. Both lots are nonconforming in size for the zoning, and we're looking to fix that. The Marsick Trust also owns the homestead to the east of the .97 acres that crosses over Indian River Drive, the AU parcel is 1.44 acres, the DU parcel is 0.53, and just for perspective to the north is the Bonsai Motel. I also placed on here to the south of this property, there's many single-family homes, not exactly adjacent on US-1, but close to it. So this is somewhat of a mixed-use area. The future lane use of all of this, the future lane use to the west of US-1 is NC, and the future lane use is somewhat split for the parcel on the east side, and that is RES-4 and NC. No, I'm getting confused again. The zoning of EU for all of this, yes, it's NC and RES-4. And the rezoning for AU from AU to EU will make this consistent with the future lane use and allow it to be a conforming lot. The history of this is that William and Michelle Marsick purchased the house, the homestead, in 1995, and then they purchased the other property to be rezoned in 2001. Now William wishes to build a workshop, and the land that they have isn't sufficient. So we have to rezone the EU so we can add just a little bit of land to the homestead so we can build a workshop, and that's really the impetus for it. They didn't really want to rezone it. They wanted to keep it AU. They don't intend to build. They didn't go BU-1 or anything like that. They're just trying to make it all consistent and conforming so they can add a little bit of property to configure it so they have the ability to put a workshop. The parcel to be rezoned is nonconforming in size for both of the zoning. This will create land that can be used for residential purposes and for William's workshop. It's a simpler rezoning than most with a very altruistic purpose. They're only trying to make land conforming so they can add a small little workshop for William. With that, I'd ask that you approve the rezoning as requested. Kim, while you're right there, please, is there anyone in the audience want to speak for or against this item? Sir, if you could state your name and spell your last name and your address, please, for the record. Good afternoon. My name is John Holmquist, H-O-L-M-Q-U-I-S-T. My address is 105 Stone Street in Cocoa, Florida, 32922. The address of the property we're discussing now is 5405 FL 520 or West King Street. My brother and I acquired the property a couple years ago and we were trying to figure out the highest and best use. I don't see a way to click slides, but I have slides. I do have some hard copies if someone wanted a hard copy. Well, you need to clear that with staff over there. You can take that to them. Okay. So the property currently has a binding site plan of 40 single-family homes, which crowds around this 12-acre pond. We feel that that is not the highest and best use of the property. People that are looking for this environment already have Vieira to go to and many other places where you can be in a neighborhood that's put together like this. What we would like to do is change the northeast and west sides of the pond to RVP, as shown by the civil engineer plans here. And then return the southern portion of the property to agriculture. So the southern portion of the property would be equestrian area and large pet friendly for the RV park. The RV park, because we are seeking SBA funding, has a 30-day maximum stay. But once we clear that, after speaking with Commissioner Delaney, she suggested that we move it to a seasonal type of changeover as soon as possible because she's had issues before with a snowbird mentality coming down and wanting to stay put for more than one month period of time. We have done all of the due diligence. There is no wetlands. It's all high and dry. Our environmental study came back clean. And so that's why we're requesting the zoning is put forth by our final survey here. All right, sir, while you're there, is there anyone in the audience want to speak for or against this item? Yeah. Sir, again, if you could state your name and spell your last name and your address for the record. My name is Bradley Sinclair, S-I-N-C-L-A-I-R, 4563 Coquina Ridge Drive, Melbourne, 32935. Sorry, I'm not used to public speaking in front of y'all. I've never met Mr. Holmquist. My wife and I own 25 acres to the west. We've owned it since 2000, I guess. And I know a lot of history about this lake that Mr. Holmquist may not even know. And I, first of all, want to say I don't have any objection to him developing it. It's his property. He can do whatever he wants with it. But when they dug that lake, they dug it so deep that they hit the aquifer. And for years, they've been trying to sell it, and I was trying to buy it, you know, over the years. And the east side was all wetlands because the lake was overflowing all the time and going that direction. So at some point in the past, I'm not good with time, five, ten years ago, one of the owners of the property dug a ditch. I don't know if you can see it, if it's on the survey there, it should be the west, southwest corner, dug a ditch there to drain the lake, to lower the water level so that it wasn't overflowing, so that eventually the wetlands would dry up. And because he had it surveyed, and that was wetlands. And so then eventually, I guess maybe he had it resurveyed. And again, I've never met this gentleman, and I'm not trying to put the kibosh on his development. But I'm concerned about water because that's low land out there. It's close to Lake Poinsettia. I don't know where this ditch goes to where this water drains to. I don't know how much water is going there. But I noticed on the survey, they had that considered for water storm retention. I don't think – I don't know. I'm not an engineer. I'm not any of that stuff. But I don't think you can be putting more water in that lake and then having to drain it out, and then it goes out down the road. And I guess eventually Lake Poinsettia. I don't know where it goes. If you look at it from an aerial, you can tell because the water is blue. It's a beautiful lake. It's not like green like most of them are. So there's all constantly water flowing. So that's one concern I have. The second one is sewer. If there – I know there's – excuse me, sewer available along 520, and I'm assuming that they would be required to hook up the sewer. And if that's the case, that's great. I was concerned – and I'm sorry I'm not more prepared, but I just kind of glanced at this before I came in this morning, and I saw that it's actually – you could put 240 RV lots in there. And I know he's only asking for 36, I think it is. But, you know, I know how this stuff happens. You know, you get 36, and then, well, you start getting – you want to add some more and add some more and add some more. And I don't know where you're going to put 240. I don't know if they're including the lake acreage to put 240 in there or not, but that's – that would be a problem. And our property actually has an easement. Our only driveway to get into our property runs across their property, and it's the easement coming in from 520. And our water comes in there, and, I mean, I'm kind of looking forward to – if he does develop it, I'm sure he's going to put a nice driveway in there, so I'll have a nice driveway. But our water line runs under the driveway, and that's been broken in the past over a couple times, not by him, but other people, and it lost a lot of water and cost a lot of money. My name is Jason Mattis, M-A-T-A-S. I live at 5200 Lake Poinsett Road. My property butts right up to this back corner here of this gentleman's plans to this property here. So – Could you get a little closer to the microphone? Yeah. What did you hear? Okay. I'm definitely – this would be a bad idea, 100%. Not – like, you got – what do you got? I don't know. You're going to do septic things for every one of those people. I mean, you're going to have sewage going into the ground right there. You've got to cut down all that – all those trees, all that wildlife. That's going to be gone. You know, I've spoke – I've spoke with every single person that touches that property, that backs up to it. Everybody – nobody wants that there. You're going to have – you're going to have RV parks. You're going to have multiple people from who knows where coming into Brevard County. Who knows who these people are. And there has been a lot of things as development has gone on west of 95 out by us that has affected us. 520 getting widened and 520 getting the median. We have flooded much more ever since that on the north side of 520 out there between Friday Road and 524. They put on our property during the year of the three storms when we got flooded in for almost a week, they actually put a drain going into the culvert that they had covered in that area. Now, I don't know if his stuff is going to affect any water coming over to our side because it's going to cross the highway. But some of the businesses that are already out there west of 95 don't even have turn lanes. People are pulling already the RV park or the RV sales place down the road is already blocking up traffic as people travel westbound towards us, towards Orlando. There's no turn lane for that. Is there going to be a turn lane for this? I can tell you as somebody that's been in that neighborhood since the 70s, and there's people that have been there longer than me and my family, people that don't have gates are probably going to put up gates. Y'all are going to get a lot of petitions, a lot more requests for, the word is escaping me right now, but permission for adding on security features out there. This is a mom-and-pop neighborhood. This is a bedroom neighborhood out there. The places that are wild really need to be preserved, especially if it's surrounded by everyone. The people in the community who you're serving are against it. With South Wellington and some other large equestrian areas, this is sort of a spot that people could stop along the way. Also, there's a lot of trails that have horse access in Brevard County. This is a place that people could come to with their horses, unload their horses in our pasture and at our stables, and then use the facilities that Brevard County has for that type of activity. In addition, we are in between RV World and Cocoa Kennel, so people that are traveling with large animals in an RV could stop, keep their animals in our area, maybe bring their animals to Cocoa Kennel, and then enjoy the amenities in Orlando without their large animal as they travel. And if I can, I have a retort for all the people that have spoke here today. I am very happy to hear their concerns. I'm a Brevard County school teacher. I have property in Canalville Groves off of Satellite Boulevard. For lack of better words, these are my people, and I love hearing their concerns. I'm not, you know, for lack of better words, a developer from Indiana coming in here to make some money and run off. I've been here since 1989, and my brother and I think this is the best use of this property in lieu of building another 40 houses slammed in around this thing. And then, like I said, if I may, I could quickly address those concerns. No, you can. Go ahead. Okay, so number one, we already discussed we're not going to be doing septic and sewer. Next, an easement was put forth with Brevard County that was shown already several years ago for the drainage to come off of this pond. The engineer is looking at ways to use the pond for the water retention, but that would be only for the property that we're using, our own property. And the roads going in will be using millings to make sure that they're horse-friendly, so we're not putting in major roadways, per se, for this development for the RV park. Also, because this was a borrow pit, as he stated before, back in the 90s, and they did have it filled with water, and we do have fresh water flowing, the area was completely taken out back in the 90s. All the vegetation that is there now is invasive Brazilian pepper trees that will be taken out, and I'll be bringing palm trees and other scrub oaks from my property off of Satellite Boulevard in Canalville Groves to make this a wooded area, again, with Florida natural vegetation. Also, the majority of residential agricultural properties that touch this property, we're changing that portion of our property back to agriculture. All right? So the RVs themselves are going to be kept against the sides of the pond that are further away from the majority of the residents that have residential agriculture. It'll be against the properties that are commercial, except for Sinclair, which is known as Sinclair Equestrian. I have not spoken with Mr. Sinclair here. I've spoken with his daughter and his son-in-law that live on the premises. Very good rapport with them and with the stuff that they're doing there. And I want to make sure that his easement, his access, stays. So what we're really trying to do is minimize the impact. The future land use on this is also R15. So if someone from, again, Indiana came in here, they could be pushing to put in 15 units per acre, and we're trying to prevent that. That's a good point. Mr. Chairman, do you have a question? But we feel the equestrian component and the agricultural component would sort of deem younger people as well and a little bit older equipment. But yeah, it has to be functional. Have you looked into any of that at all? Yes, we definitely want to maintain, at the very least, a landscape barrier because we also want to maintain the noise reduction for our side. We are hearing 520 and 95 at this location. Currently, there is... It's an invasive species, but I love the pine trees that are there, so the pine trees stay. You could see on the imaging here that there's a pine tree line that basically circles or blocks in the property. That stays, but all the Brazilian peppers on there will be coming off, and we'll be putting in hopefully more palms. I believe that they came to that conclusion because they have heard feedback that it was difficult to buy a certain number of chickens and that six would be the ideal number that you could purchase. In the future, if somebody wants ten, they're going to come back here? This one would allow them six on any single-family size lot. If they want more than that, then they need to have a particular size lot and go in a different direction. This is just an additional option to our code. It doesn't delete anything that's already existing. So, if somebody has ten acres? If someone has ten acres, depending on what their zoning is, if they have AU or one of the rural zoning classifications, they could do a CUP for chickens. Um, number five, I signed affidavit to consent from all adjacent property owners for up to six chickens to be kept, raised, and slaughtered for personal and non-commercial uses on the subject property. I did my due diligence the best I could, and I'm going to freely admit I did not search out every single county or city or municipality within the state of Florida. But I did do my due diligence a good 30 minutes to an hour of searching, trying to find any other municipality or city that requires this, and I came up with Winter Park and Coral Gables out of the entire state. Volusia County, um, they require that you notify your neighbors, but it's not consent from your neighbors. Again, we don't require consent to own a dog or squawking parrots or, and I like parrots, nothing against parrots, just making a point. Um, why do we have, it's not, it's not the standard is what I'm saying. So for our administrative waivers, when you're, um, asking for, uh, administrative waivers to setbacks, we do ask that you, um, get a signed affidavit from all of your neighbors. So again, it is something that we have in our processes right now, but also we're here for you to give us recommendations to take to the board. So if that's one of your recommendations, that, that shouldn't be required. I, I'm not a huge fan of that, especially six, because most people have, um, four neighbors. Um, so now you're going, I don't know. I just think it's inviting trouble. And what I, what something that is very much liked is, um, cause you can buy smaller coops and a lot of people do this. They buy the smaller coops from like tractor supply. You get a hurricane coming, they take those coops and they put them right in their garages with their chickens and they protect them in that manner. Um, and like, I think it's the city of Titusville among others. They, they allow you to have these coops and then you have to have a private, like a privacy fence in order to free range your chickens. Because they're not generally going to fly over a six foot privacy fence. And in, in that case, your neighbors are unlikely to even know that you have chickens. Okay. Um, county staff did research all 67 counties, um, for their codes on this. And I can't tell you how many municipalities codes, including Titusville and Coco and Palm Bay. Um, Orlando was one of them that we looked at as well. Um, so some of the, what we have in here is kind of modeled off of other codes that are in existence. I gotcha. Um, I just, my main sticking point is number five, um, having to get consent from your neighbors. I think that's a little heavy. Yeah. One second. I'll get you. And there are a lot of lots that we have recently approved that are neighborhood of 50 feet wide, 60 feet wide. Those lots are way too small. The chickens are, they're just too close. I know that there are coops that you can buy, but the problem is that chicken is a magnet for predators. You know, whether that's going to be snakes, coyotes, bobcats, coons, they all, and all of those will prey on pets that people have and running around their property. I just don't think this is a good idea at all for all the residential lots. I think we should have left it the way it is, and simply the only change made was increase the number of chickens from four to six. Another question I had was, we're allowing slaughtering of these chickens. To me, that is something in yards that are so small. You're going to put a pot of boiling water out in the backyard and cut the head off the chicken and let it run around for a little while and then dump it in. That itself is a terrible smell of burning feathers is what you really get. Oh, I like that smell. I love it. I can't smell it. It is gross. And because of the way the zoning sat, or maybe I was wrong on the lot size, but this person, these people were only allowed to have one chicken. Based on the way that it was, if I remember correctly. If you have less than a half an acre, you can have one chicken. Correct. Half an acre or more, you can have four. Okay, so it was less than that, and you can have one chicken. Chicken or flock animals. Flock animals mean that they flock together. So, having one chicken isolated by itself is seen as cruel. That is why places like Tractor Supply, you have at least my Tractor Supply, where I go, requires you to buy a minimum of four chickens. So, unless you find somewhere else to buy the chicken, and if you're going to supply your family with eggs, because that's what most people do with them, how are you going to supply your family with eggs with one chicken that lays one egg sometimes? Because they don't lay every single day of the year. During molting, which is several months long, I'll give a little overview. They don't lay at all, hardly. So, you will get no eggs. So, they're allowed to have one chicken that may supply them with 200 eggs a year, maybe, for a whole family. That's what people are wanting to be able to feed their families and raise them. Second of all, while back in the day, yes, and I will try and be gentle here, they used to do it in a much crueler fashion of how you butchered chickens. I would recommend, maybe they want to put some language in there about using a cone for slaughtering. Nothing runs around, your meat is better. But when you slaughter an older hen, it's not for meat. And furthermore, chickens run, chickens have a whole lifespan. They do not lay eggs their entire lifespan. So, you give somebody four chickens or six chickens, and it quits laying, and now they have that chicken for another two to three years or however long before the chicken passes away, and it's no longer producing eggs. Generally, what happens with those chickens is they end up dumped out in my area. I'll tell you that what was just described about them going into stockpots, what happens when they get dumped out in my area as well. Because nobody can have all of these chickens that people, so allowing them to slaughter them, it allows people, and I know many people who do this, it's an older chicken. You make bone broth. It is extremely nutritionally dense, and it is a good, solid product for your family. Therefore, you're not just knocking it off and throwing it into the garbage can to make it somebody else's problem. It has been fully utilized from beginning to end for your family's needs. And I'm free to answer questions because, yes, I live on agricultural land, and I do that. Ruth, do you have I heart chickens? I would wear it. I love my chickens. I call them my followers because when you walk through the yard, they all flock behind you. I know. They kind of become pets. My sister's got a bunch, and they all have names. They do do pets, but some people can't afford, they need to be able to have the eggs, and so the option to be able to provide more food for your family and replenish your stock at the same time. Is there a cost associated with having chickens? Is that part of this? Because I didn't, sorry? Like any kind of fee. The fee hasn't been established yet. That would be established when it goes before the commission. And I would, I don't, I'm not opposed to Ruth's idea about notifying the neighbors as opposed to getting their permission as a concession. And I would also just support there not being a fee for having chickens in your yard. That would be my input on this whenever there's a motion made. I'm going to wait on Ruth to make that motion. What is the disposal process that people would use that have these chickens if it's for eggs and they age out? How are they going to dispose of them? Take them to the dump? Throw them in the trash? That's one question. The other one is, has anybody contacted Humane Society about this? What are their regulations or what do they feel should be restrictions on families that own chickens and how they are to provide housing for them and feeding them and taking care of them on their land? And the third thing is, you know, we had this big egg shortage last year, and it was because of bird flu, and so they slaughtered all the chickens in the country, and that's why all the prices went up. And will bird flu get into the District 1 and wipe everything out? And, you know, it could be a problem. We would take that chance in District 1. I second that. I can say from my entire, a lot of us have chickens out where I live, including all of my neighbors, and while the rest of the country slaughtered their chickens for bird flu and other things, I haven't seen that anywhere in District 1 in my area. And if I may, John, Mr. Haben-Gottner, we also have it in here that we would like people to participate in the IFIS class, Backyard Chickens, so that that will teach them how to maintain and care for their chickens and their property. But is that a requirement, or is it just a suggestion? It would be a requirement if it passes the way that it is now. If there's no modification to that, that would be a requirement of that AA. And then also, as far as waiving the fees for this, there is fees associated. There's a cost associated with reviewing the administrative approval. You know, there's staff costs. So if you're waiving the fees and you're saying, you know, this is a free thing, then, you know, that staff cost has to come from somewhere. So just to keep that in mind. But taking the zoning part out of it is a little problematic. If people are running businesses in their homes and they have trucks or they have equipment that becomes an eyesore in the neighborhood and code enforcement doesn't do their job, that there should be some sort of a linkage allowing the zoning to be kept, not taken out. I think we should let it remain. There was an HVAC guy that I knew that used to have all of his HVAC units in front of his house. And, you know, and the neighbors, you know, they tried to fight it and they couldn't. And I've seen that with plumbers. They do all kinds of things in their domiciles. I realize that the reason for this change is to comply with state law. Yes, ma'am. Is there a way to implement a tracking of this? Well, it goes through, but to be able to track it. And I agree with Mr. Huff and Gardner. It becomes, I understand, we have to comply with state law. But if we're tracking it, we're tracking problems. And I say that because I'll use, so sorry, I'll use the land, illegal land issues that have been going on in North Brevard as an example. There is a disconnect between the constitutional offices and planning and zoning that allows for illegal land, land illegally rezoned and slide through the cracks in District 1. And so because there's not a mechanism, that currently has fixed that. So when we remove these things, again, I understand it's matching state law, but is there a way to put in tracking to be able to know when there's going to be problems? Because really, it's quite backwards. You're not going to know what's going on until the complaints are coming in. And to be blunt about it, code enforcement is quite limited on, I mean, the person has to be wanting to comply with code enforcement for code enforcement to be effective. So coming in on the back end of things, again, I realize it's state law, but is there some type of tracking mechanism that we can implement to help this process and understand how it is going to affect and maybe get ahead of some things? So the tax collector's office has a tracking system where we can get updates about what BTRs are being approved. However, as you stated, code enforcement is reactive, not proactive. That would take quite a bit of staff time to be able to go through each one. And also, we do get those reports quarterly from the tax collector's office. Does state law still allow for limits on noise, parking, and safety, or does it done away with all of it? No, we're not preempted in that way. But we are preempted that we can't prohibit certain home-based businesses. So, but they still have to meet the performance standards, you know, for noise and pollution, smoke, all of those things, parking. Because, I don't know, I just, I find it troublesome. I know that there's a lot of businesses going on in private neighborhoods. I know there's full-on garages with testing vehicles around the neighborhood, among a million other things. And it's really difficult because you put in a code enforcement claim case, and then you get retaliated against. So, this seems, I don't know what the answer is, but this seems like a free-for-all.
