like to call to order take three uh call to order of the planning commission meeting november 19th 2025 call the meeting to order please and is there a motion for approval of the agenda or comments conversation move the approval agenda second all in favor all opposed okay is there any public comment for any item not on this agenda the attorney office polling for ex-party communication has any member of the commission received any communication regarding the item on the agenda tonight no no no okay quasi-judicial items we've got party status determination mr chair we do not have any requests for party status but just for the uh benefit of anybody out there uh a party would be an individual who is more substantially or more directly impacted by the decision of the planning commission tonight uh somebody would have an opportunity to present testimony ask questions of witnesses and have additional time uh to present their their evidence as i mentioned we don't have any requests and there's no one here to make a request tonight but we have nothing to recommend okay um do we and then we're do we need to do anything with staff we're all good we need to do the swearing in yes so for anybody who's planning to speak at tonight's meeting please stand and raise your right hand do you swear or affirm that the testimony you provide today is the truth to the best of your knowledge or belief yes thank you okay yes sir good evening commissioners this is matey bengatar elogical county growth management i'm filling in for jerry brewington and this item tonight is c25 00024 a rezoning request to rezone from the r1b single family residential district to the r1a also single family residential this site is about a 5.8 uh acre site it's to the south of southeast hawthorne road and as you can see here uh to the east of southeast 27th street and to the west of southeast 35th street uh this aerial shows that the site is undeveloped it is actually owned by uh habitat for humanity and it's one of their phases um that uh you can see also to the northwest that's one of the developed phases for habitat for humanity this one is their next phase they're looking to develop the land use map shows that this parcel and all the surrounding parcels have low density residential uh designation which is one to four units an acre the zoning map shows that this parcel and those other parcels that were part of the habitat for humanity uh site have r1b which is actually inconsistent with uh the low density residential designation r1b has a density of four to eight units an acre and low density as i mentioned is one to four uh though therefore that is the purpose of this uh rezoning application to bring it into compliance at the time um r1b uh when the there was an existing uh previous uh application in the early 2000s and at that time it was consistent now comp plan changes code changes it's no longer consistent so that is why they're uh requesting this change um if this is uh rezoned and approved this will have the r1a and they will be able to develop this site again um it's adjacent to the initial celebration oaks habitat for humanity subdivision and the maximum density would yield 23 single-family residential units if r1a is approved this rezoning will not cause any level of service standards to fall below adopted levels and staff has found this rezoning request consistent with policy 7.1.2 of the future land use element which is uh what staff looks at for all rezonings similarly with the unified land development analysis section 402.77 looks at standards for rezoning criteria for approval such as ingress and egress suitability nature of the surrounding development and staff has found that this proposed request would fulfill the criteria for approval as found in the land development code and with that staff recommends the planning commission to find that this proposed rezoning request is consistent with the comprehensive plan and land development code and to recommend to the county commission that they approve the resolution approving this request that's our staff presentation and i can take any other questions you might have do we have questions yes um thank you why was um instead of changing the zoning why wasn't just the uh changing the future land use category uh so they are uh looking here if i go back um they are not intending to have any more units than what would be necessary for the low density residential so if they went up that would could cause up to eight units an acre and it's it was just the intent to have the rezoning instead to stay consistent with that and try uh not to increase the potential number of units thank you other comments questions all good if you'd like mr chair i have a question for the applicant is that no mr chair there's not sure uh do you know how many people attended the neighborhood meeting it wasn't in the i am not aware of how many people attended do you know if anyone attended i would not be surprised if no one attended but um we did not have any public comment for this is there a second we have a motion a second yes sir um i just have concerns with uh down zoning um inside of our urban reserve um we have a limited amount of land inside the urban reserve and i think it'd be better to uh change the future land use and do it down zoning so i won't support uh the motion on the floor thank you other comments discussion okay ready to vote all okay all in favor all opposed i was an aye i didn't say anything but i'm an aye the and i can explain why but i don't think it's necessary at this point unless you want to know so part motion passed okay let's go on about down the agenda affordable housing advisory committee planning commission representative um i remember um our current member of the commission um may not be here for next year you're here i'm sorry sorry and are you going to be here next year all year hope so okay good so then is there a motion can related to this one and if i can get my foot out of my mouth okay so if we can do um yes um i'm enjoying it i think is a great um advisory board and i'm retired and i can't attend them on the meetings at one o'clock that's good okay i move that we reappoint miss vinson good conversations so i'm rather new on the board so can do we have any details on this is just kind of protocol is it basically when it comes down to the planning commission you have chris or any other representatives are there presenting and everything else all with the information any updates or whatever you might need i will bring it to the board so we just have a member from this board serve as a liaison on the affordable housing okay but if somebody wanted to attend the meetings yes it's open to the public um yes it's not a secret i've been to a couple and anything like i said with the planning commission board you have staff there that does their presentation it's not a secret society mr chair that i think just to sort of clarify the that the affordable housing advisory committee its makeup requires that there be one sitting member of the planning commission um as part of that there's also a member of the board of county commissioners that sits on ahac as well as a number of other representatives of the community um occasionally there are items from ahac that might come to the planning commission those usually be presented by staff although sometimes they're just updates generally from our representative the affordable housing advisory committee is a state mandated board and they develop recommendations looking for ways for the county to provide more affordable housing in the community okay and i'm going to come back to this in the kind of like the the at the very end for a conversation um which does not have anything to do with anybody here it does it's not related to what we just did um we we're looking for yeah we could vote that's a good thing to do i was already gone okay all in favor all opposed i'll go back to my original comment before we started on the um we have approval of the minutes and we have done that one okay i'm just going down attendance report we have to vote we have to vote well that's what i thought we were doing and then i thought you were doing yes so all any discussion on the minutes all in favor all opposed we can roll this one okay attendance report please that's good okay public comment from anybody staff anybody we appreciate you being here mr chair i will just since uh it's you asked staff i will just go ahead and make an announcement that there will not be a december planning commission meeting um with your action tonight we have no items that are waiting so um enjoy your your winter holidays public uh it's a public comment we don't really seem to have much public um and planning commissioner comments this is where i'm going to speak up for a moment does anybody else want to go first all right so from a developer's viewpoint um and i understand the the possibilities of different things you have a couple of different motions going in here you you have a development that is probably have done the impression that they're going to continue and complete the the housing so it looks like very much the same so there's some homogeneous there are some examples that are really different um my son lives in san francisco and um and a and housing is expensive there and in the middle of this development which is about 20 years old they did a multi-family attached in a single family that looks really very good okay and and i don't know the numbers on it um but there are some examples but when you do the beginning of a development as you know sometimes you feel the obligation to be consistent through the end and then sometimes there's other things to do to um um to accelerate affordability to do be more affordable and to do other things and that's something that i think there are other people in the county who are looking at that but this is one that i see when i go to visit we have a new grandchild and so which we're not getting to see enough of but this is the um this it's a balance in this and our job i think in part is to to make a community that we're proud of and serves as many members as we can and within that that was just my thought and mr chair may i speak yes ma'am um i think the board is doing everything possible one of our board members is with the county commission anna perez she makes sure that a lot of things and examples of other counties and cities and also bobby with coalition they um they make sure that what we need for our community is there and and is affordable to our citizens i suggest strongly that maybe you come to the meeting sometimes because a lot of thought process is given um to all the committee members to make sure that we have affordable homes and it's reasonable and uh and also staff is like i said is present and give information as well so if you can you know definitely drop in and anything you like to talk and share i know they're a little glad to hear it may i add one thing on the the home builders as well are trying to figure out how to make how to be more affordable and one of the problems that we have are codes and some codes justified than others um and some there are some political things that go into codes and we there are efforts to try and get back to the numbers so that we can develop better housing at a lower cost for people that that's a goal right now the cost of houses is actually going down a little the price of a house is going down a little bit that won't be for very long um but i think that if i come across something within the home builders realm um then we can decide whether or not you want to talk about it but at the moment i don't have anything that's productive on it we are on the hope program of trying to find out how to do houses and and and land use is going to play a very distinct part of it somewhere down the line and so you just it's just a think about it and as you think about it then maybe it's a you know we can come up with some ideas that might be helpful um but i would not like to dwell too much on it but i don't want to cast uh not not in our you know not with us because sometimes as you talk to people about it then you start to get ideas and then when we have something that's new and different you have some information and some thoughts on how and then you can look at it however you are i'm not trying to i'm not trying to get anything done i'm not trying to make any specifics but i'm trying to open it up a little bit to where we can have discussions that might be good to have it as background and maybe we'll come up with something and it's not that i'm trying to be the planning department i'm just but they're doing it all the time and not everybody here at the table is doing it all the time and so it's it's a good thing and the good part of it is if you're not looking at all the time you have fresh eyes and fresh eyes are good and so i'm i'm done with that speech yes ma'am we're about to go to the through the planning or the comp plan review phase so that would be a time to have discussion on housing okay yes sir i do want to chime in uh the discussion about other members attending the affordable housing advisory committee just keeping in mind that there's still sunshine requirements that would not be a noticed planning commission meeting if you do intend ongoing uh let us know we can notice it as a as a potential planning commission meeting so that there's no concerns regarding speaking and we have more than one person we need to notice if you have more than one person who is going to be having a back and forth or they're going to be commenting on something that is reasonably foreseeable to come back before this board if there's a specific development uh proposal for instance that might need a you know a land use change that's something that would likely come before this probably safer to notice than not to notice it's safer to just let us know and we'll make sure everything's taken care of okay but feel free to attend they are open meetings they're public they're they're sunshine meetings so just let us know please okay let's see what else do we have um public comments we read through that one planning commissioners comments anything else anything for anybody else are we ready to adjourn motion for adjournment okay we're adjourned
